Decision: 2021-1814 Case file: 14-000187-0485-PE(18) CRIMINAL JUDGMENT APPEALS COURT (TRIBUNAL DE APELACIÓN DE SENTENCIA PENAL). Segundo Circuito Judicial de San José. Goicoechea, at ten twenty-five hours on veinticuatro de noviembre de dos mil veintiuno.- APPEAL (RECURSO DE APELACIÓN) filed in the present proceedings brought against [Nombre1], an adult Costa Rican national, identity card number CED1, born in Limón on 22 de diciembre 1980, son of [Nombre2] and [Nombre3], resident of Limón Pococí, Barra del Colorado; for the offense of VIOLATION OF THE FORESTRY LAWS, to the detriment of NATURAL RESOURCES. Judges Gustavo Adolfo Gillen Bermúdez, Alberto García Chaves, and Francini Quesada Salas participated in the decision. Attorney Margot Avellan Ruiz, Criminal State Counsel (Procuradora Penal), and attorney Juan Diego Salon Piedra, public defender for the accused, appeared before this Court.
WHEREAS:
I.By judgment number 124-2021, issued at fourteen hours and five minutes on cuatro de marzo del dos mil veintiuno, the Tribunal Penal del Segundo Circuito Judicial de la Zona Atlántica, Pococí, ruled: “POR TANTO: Pursuant to Articles 39 and 41 of the Constitución Política; 8.2 of the Convención Americana sobre Derechos Humanos; 11 of the Declaración Universal de Derechos Humanos; 1, 2, 3, 11, 30, 31,45, 50, 59 al 63, 71 of the Código Penal; Articles 1, 2, 3, 9, 37, 40, 111 a 124, 180 a 184, 265, 267, 328, 330 a 336, 341, 352, 360 a 366 of the Código Procesal Penal; and Article 58 of the Ley Forestal, IN APPLICATION OF THE UNIVERSAL PRINCIPLE OF IN DUBIO PRO REO, MR. [Nombre1] IS ACQUITTED OF ALL PUNISHMENT AND LIABILITY for the offense of UNLAWFUL HARVESTING OF FOREST RESOURCES, committed to the detriment of THE ENVIRONMENT. The civil claim for damages (Acción Civil Resarcitoria) brought by the civil claimant, PROCURADURÍA GENERAL DE LA REPÚBLICA, against the DEFENDANT [Nombre1] is denied. This judgment is issued without a special award of costs, because the Court considers that the party acted in good faith and in the belief that it had a right. The MC660 chainsaw and the seized timber are ordered forfeited (comiso) to the State; since the timber was released without a court order by SINAC, SINAC shall verify whether or not that timber still exists. Let notice be given.” (sic).
III.After conducting the respective deliberation in accordance with Article 465 of the Código Procesal Penal, the Court considered the issues raised in the appeal.
Criminal Judgment Appeals Judge Gillen Bermúdez drafts the opinion; and,
CONSIDERING:
I.Admissibility. Attorney Margot Avellán Ruíz, representative of the Procuraduría General de la República, filed an appeal against judgment number 124-2021, issued at fourteen hours and five minutes on cuatro de marzo de dos mil veintiuno by the Tribunal Penal del II Circuito Judicial de la Zona Atlántica, Pococí seat. Review of the appeal shows that it was filed within fifteen business days after notice of the judgment, as provided by Article 459 of the Código Procesal Penal, and that it satisfies the admissibility requirements established by Articles 458 and 460 of that body of law, thereby allowing it to be heard under Article 8.2h of the Convención Americana de Derechos Humanos; accordingly, it is admitted for consideration and a decision on the merits.
II.i.- In the sole ground of appeal (motivo de apelación), she expressed disagreement with the reasoning of the judgment. She divided the objection into two clearly distinct aspects: the first concerning the commission of the offense, and the second concerning the dismissal of the civil action for damages (acción civil resarcitoria). Regarding her disagreement with the ruling in the criminal matter, she stated that both the private criminal complaint (querella) and the civil action alleged that the defendant [Nombre1], together with [Nombre4], had felled and utilized a tree of the species known as chancho blanco on land within the Refugio Nacional de Vida Silvestre Barra del Colorado; these events occurred on 10 de enero de 2014. She noted that, at trial, testimony was received from Manuel José [Nombre5], an official of the Sistema de Áreas de Conservación (SINAC), who explained how both defendants were caught in flagrante delicto (flagrancia) while utilizing the aforementioned forest product, stating that the defendant [Nombre1], after being advised of his right to remain silent (derecho de abstención), admitted not only that he owned the chainsaw—which he also stated during his preliminary examination (declaración indagatoria)—but also that he was directly responsible for the forest utilization (aprovechamiento forestal).
She maintained that, although official letter ACTO-GASP-RNVSBC-PO-002-2014 does not clearly describe the defendant’s conduct, the testimony given at trial by witness [Nombre5] prevails, as he clearly stated that the defendant had identified himself as the person interested in having the tree felled. She pointed to the existence of uncontroverted circumstantial evidence (indicios) confirming that the accused [Nombre1] was present at the site to oversee the felling and forest utilization, summarizing that evidence as follows: i.- the defendant’s presence at the utilization site; ii.- the fact that the chainsaw used to carry out the unlawful act belonged to the defendant; iii.- the fact that he provisionally took custody of the forest product resulting from the felling, 28 boards of the chancho blanco species; this was supported by seizure record (acta de decomiso) number 523 and the custody or administrative depositary record (acta de entrega en custodia o depositario administrativo) number 555, both prepared by SINAC officials and signed by the defendant [Nombre1].
She maintained that, although the private criminal complaint and the indictment (acusación) did not specify the actions performed by the defendant, it is a fact that the unlawful conduct under investigation was carried out under his orders and supervision, constituting direct perpetration (autoría inmediata) by the co-defendant [Nombre4] on behalf of the indirect perpetrator (autor mediato), the accused [Nombre1]. In support of her claim, she partially transcribed ruling 909-F-97 of the Tribunal de Casación Penal. She considered it unequivocal that the defendant [Nombre1], through the other defendant [Nombre4], did in fact carry out acts involving the utilization of a chancho blanco tree within Refugio Nacional de Vida Silvestre Barra del Colorado, because he indisputably had control over the act (dominio del hecho), was fully aware of the felling that occurred, and promoted and sought its execution.
She argued that the trial court maintained that a detailed and precise description of the tasks he was performing was required in order to charge and convict the defendant, whereas, in the appellant’s view, it was sufficient for the charging document to allege the operative verb contained in the statutory provision and then, at trial, to establish through witness testimony the actions committed by each defendant at the time of the events. She maintained that, although the witness did not describe in detail the conduct of the defendant [Nombre1], he did place him at the site, inside the national park and beside the person who carried out the felling, and also identified him as participating in the utilization through the orders he gave and the control he exercised over the cutting of the tree. She challenged the judgment’s contradictory reasoning because the judge acknowledged that a conviction was appropriate but nevertheless did not convict, finding that the indictment and the private criminal complaint lacked sufficient content to support it, which, in the appellant’s view, was incorrect.
Regarding the dismissal of the civil action for damages, she argued that the trial court dismissed the civil claim because no causal link (nexo causal) had been established between the unlawful act and the defendant. She considered that assertion inadmissible because witness [Nombre5] established that the felling and forest utilization had been conceived by the defendant [Nombre1] and carried out by the defendant [Nombre4] under the former’s orders. She added that testimony was also received from witness [Nombre6], who described the causation of environmental damage (daño ambiental) resulting in estimated harm of novecientos setenta y tres mil ochocientos treinta y cuatro colones con doce céntimos. She requested that the challenged judgment be declared ineffective and that the case be remanded (reenvío) for new proceedings.
II-ii.- Position of the Defense. After being duly given notice of the appeal filed by the representative of the Procuraduría General de la República (folio 188), attorney Juan Diego Salon Piedra, public defender for the defendant [Nombre1], stated that, contrary to the arguments advanced by the Procuraduría General de la República, the judgment objectively analyzed the indictment and the legal classification (calificación jurídica) that gave rise to the challenged decision. He stated that he fully agreed with the trial court’s finding that the defendant had engaged in no criminal conduct, noting that it had been established that there was no evidence and that witness [Nombre5] was contradictory and even unclear in certain respects, while in other respects providing new information that had never appeared in the reports. He stated that, in response to defense counsel’s questions about whether the defendant had been advised of his right to remain silent, witness [Nombre5] indicated that the warning had been given on the official’s own initiative, but that he did not remember whether it had been recorded in the report.
The defense considered this irregular because the authorities duly document such matters and even ask the detained person to sign a record confirming that the procedure was performed, which did not occur in the present case and was first mentioned seven years after the events. He asserted that the appellant was mistaken in stating that the defendant had identified himself during his preliminary examination as the owner of the tool, because that proceeding merely involved gathering identifying information and took place without defense counsel being present. He considered that the trial court was correct in stating that, even if the alleged hierarchy and allocation of functions could be independently established, a conviction would entail altering the scope of the criminal charge (marco de imputación criminal), thereby violating the right of defense. He requested that the acquittal be affirmed pursuant to the in dubio pro reo principle and that the civil action for damages be dismissed.
II.iii.- The ground is upheld. To properly resolve the objection raised, it must be recalled that the Ministerio Público and the Procuraduría General de la República filed an indictment and a private criminal complaint, respectively, against the defendant [Nombre1] based on the following facts: “1.- On diez de enero de dos mil veinte, the accused [Nombre4] (with certified copies of the record (testimonio de piezas) issued because he was absent) and [Nombre1], knowing that their acts were unlawful and aware that they lacked permits from the Municipalidad de Pococí and the Administración Forestal del Estado, entered Refugio Nacional de Vida Silvestre Barra del Colorado, specifically at GPS reference points CRTM CED2;CED3, for the purpose of felling and utilizing the trees by sawing them into logs. 2.- Thus, the accused, aware that their actions were unlawful and lacking the legally required permits, utilized forest resources on land belonging to the State’s natural heritage (patrimonio natural del Estado) by felling a tree of the Laurel species, for which purpose they used a model MC660 chainsaw to saw the tree and convert it into veintiocho wooden boards. 3.- On the same day and at the same location, SINAC-MINAE and Fuerza Pública officials were patrolling the area of Refugio nacional de Vida Silvestre Barra [Dirección1] Colorado when they observed the accused carrying out the utilization activities and proceeded to seize the sawn lumber and the model MC660 chainsaw used by the defendants to commit the alleged offense. 4.- As a result of the aforementioned actions, environmental damage was caused in the amount of novecientos setenta y tres mil ochocientos treinta y cuatro colones con doce céntimos” (sic, folios 44 y 75 a 76 respectively).
With respect to these facts, the trial court acquitted the defendant [Nombre1], finding that the charge had been improperly framed because, at trial, the Ministerio Público and the Procuraduría General de la República sought to prove that the defendant committed the offense as an indirect perpetrator by ordering the co-defendant [Nombre4] to fell the tree of the species known as chancho blanco; an aspect not described in either the indictment or the private criminal complaint. In this regard, the court below (a quo) stated: “...[...]...You would not be carrying out the prohibited conduct (acción típica) as such; that is, you are not the person doing the sawing. Instead, what might potentially exist, under the applicable legal concepts, is your joint perpetration (coautoría) with this other person...[...]...but the court cannot insert joint perpetration into an indictment or a private criminal complaint in order to clearly establish how the events occurred.
That would involve the court intruding into investigative and accusatory acts that are the responsibility of the private complainant and the prosecuting party. If the court were to modify the facts in the manner in which they might properly have been alleged, there would be no congruence between the indictment and the judgment (correlación entre acusación y sentencia), and the court would also be violating the principle of the right of defense, which includes the opportunity to defend against facts contained in the case file, rather than new facts that arise during the course of the trial without the corresponding amendment. Why? Because the facts remained unchanged throughout the trial; the indictment was never amended or altered.
It was consistently maintained, not that Mr. [Nombre1] had ordered, or had given the order to [Nombre4], who is absent, to carry out this statutorily defined, unlawful act (acción típica, antijurídica), but rather that what existed, what the private prosecutor (parte querellante) and the prosecution sought to prove, was not that you were cutting down the tree, but that you were the person who had ordered this individual to carry out the logging, as a form of active participation, or indirect perpetration (autoría mediata), if one also wishes to view it that way, or some form of co-perpetration (coautoría) in these proceedings; however, the act, the core of this charge, of this trial, as can be seen in fact number two, is that the Ministerio Público—because the indictment (acusación), the private criminal complaint (querella), and the civil action (acción civil) are completely the same, identical, using the same words and alleging the same facts—states that the defendants, referring to [Nombre4], who is absent, and the accused (imputado) [Nombre1], knowing that their acts were unlawful and without having the legally required permits—which has been established but is entirely irrelevant—exploited State forest resources, forest resources on lands belonging to the State’s natural heritage (patrimonio natural del Estado), by cutting down a tree of the species known as chancho blanco, which they sawed with a model 660 chainsaw; that is, the Ministerio Público has come to establish acts involving the unlawful exploitation (aprovechamiento ilegal) of forest resources, as has the Procuraduría General de la República through the private criminal complaint, alleging that you cut down that tree with that person; that is, it never charged you with having ordered the other individual to do this...[...]...” (video 140001870485PE-04032021020956-2_Multi, counter 26:34 to 30:08), and subsequently added: “...[...]...Furthermore, this entire lack of investigation does not allow the court, as the Ministerio Público and the Procuraduría General de la República sought to portray it, to amend the indictment, because the court would unlawfully violate the principle of congruence between the indictment and the judgment (principio de correlación de acusación y sentencia), since you came here to defend yourself against what you had been charged with—cutting down a tree together with another person, using a model MC660 chainsaw—whereas what the Ministerio Público and the private prosecutor came here to prove was instead that what you did was give another person the order to carry out that activity: entirely separate facts, facts of which you had no knowledge, and facts for which you may not have prepared to present a defense today; a situation that is not permeable (sic) to you or to the court, but is instead the sole responsibility of the prosecuting parties...[...]...” (video 140001870485PE-04032021020956-2_Multi, counter 35:07 to 36:03), a position that, in the view of this Tribunal de Apelación de Sentencia Penal, is incorrect because it requires objective elements constituting the offense that the criminal provision at issue does not require.
Regarding the characteristics of a proper charge (imputación), the Sala Tercera de la Corte Suprema de Justicia, in decision 1249-2021, with which this Court agrees, stated: “...[...]...In this regard, the case law has outlined the scope required of a proper charge: ‘The structuring of the charging instrument (pieza acusatoria) acquires particular relevance in procedural systems of a markedly adversarial nature, insofar as it serves a dual function: on the one hand, it defines the subject matter of the dispute (objeto de la litis), while at the same time establishing the limits within which the accused party’s right of defense—both personal and technical—is confined. Precisely in recognition of this, procedural laws generally codify mandatory rules intended to require the public or private prosecuting party to draft the charge in accordance with certain parameters. […] The indictment shall contain: (…) b) A precise and circumstantial account of the punishable act attributed to the accused.’ In elucidating the meaning of the adjectives ‘precise’ and ‘circumstantial,’ this Chamber has previously stated: ‘From this perspective, precision refers to the need for proper individualization, not only of the perpetrator, co-perpetrator, and participants, but also of the victim, while circumstantial detail refers to the need to indicate the manner, time, and place in which the act or omission occurred.
Furthermore, case law has established that the facts set forth in the indictment must be clear; that is, they must not contain obscure, ambiguous, or contradictory terms.’ (Sala Tercera de la Corte Suprema de Justicia, judgment N° 2017-0306, at 10 hours, 11 minutes, on 28 de abril de 2017. Composed of Chinchilla, [Nombre8], [Nombre5], [Nombre9], Gómez)” (Sala de Casación Penal, decision 2019-00549, 16:25 hours, 30 de abril de 2019; composed of [Nombre8], [Nombre11], [Nombre12], [Nombre13], and [Nombre14])...[...]...” (emphasis added). Thus, bearing in mind that the criminal provision established in article 58, subsection b, of Ley 7575, Ley Forestal, states: “A prison sentence of three months to three years shall be imposed on anyone who:...b) Exploits forest resources on lands belonging to the State’s natural heritage and in protected areas (áreas de protección) for purposes other than those established in this law...,” after a detailed reading of the indictment, this appellate panel finds that, contrary to the reasoning stated by the trial court (tribunal de mérito), both the prosecution’s indictment and the private criminal complaint do contain a clear and detailed description of the acts attributed to the accused, [Nombre1].
Both the indictment and the private criminal complaint establish that the events occurred on 10 de enero de 2013, on lands forming part of the Refugio Nacional de VIda Silvestre Barra del Colorado, thereby properly alleging the circumstances of time and place; as to the manner of commission, they state that both accused persons jointly carried out the exploitation by cutting down a tree of the species known as chancho blanco, thereby also clearly describing the manner in which the act was committed, and the charging document is therefore duly supported by circumstantial detail. With respect to the subjective element of the offense (aspecto subjetivo del tipo), because this is an intentional offense (delito doloso), it must be shown that the accused knew what he was doing and intended to carry out the logging; however, the description of the facts need not specify, as the court below (a quo) required, the form of participation in the act, whether indirect or direct, because this is not an objective requirement of the criminal provision under investigation.
What was alleged was the accused’s participation as a perpetrator in the unlawful cutting down of a tree located on State lands, and that conduct was duly charged. Whether he performed this act himself or through third parties is indeed a matter that must be addressed at trial in order to establish the subjective element of the offense—namely, the existence of criminal intent (dolo) in the conduct—but it need not necessarily be stated in the account of the alleged facts. Regarding the civil claim (pretensión civil) filed by the appellant, the trial court rejected the aforementioned civil action for damages (acción civil resarcitoria), reasoning that because its alleged facts were exactly the same as those in the indictment and the private criminal complaint, they had to be deemed unproven; as explained above, that reasoning was incorrect, and therefore, for the same reasons, the rejection of the civil claim must be declared unsupported.
In light of the foregoing, the appeal filed by the Procuraduría General de la República is granted, and the challenged judgment is consequently declared ineffective; the case is remanded to the court of origin so that, with a differently constituted panel, it may issue the decision required by law.

Resolución: 2021-1814 TRIBUNAL DE APELACIÓN DE SENTENCIA PENAL. Segundo Circuito Judicial de San José. Goicoechea, al ser las diez horas veinticinco minutos del veinticuatro de noviembre de dos mil veintiuno.- RECURSO DE APELACIÓN interpuesto en la presente causa seguida contra [Nombre1] , mayor, costarricense, cédula de identidad número CED1, nacido en Limón, el 22 de diciembre 1980, hijo de [Nombre2] y [Nombre3] , vecino de Limón Pococí, Barra del Colorado; por el delito de INFRACCIÓN A LA LEY FORESTALES, en perjuicio del LOS RECURSOS NATURALES. Intervienen en la decisión los jueces Gustavo Adolfo Gillen Bermúdez, Alberto García Chaves y la jueza Francini Quesada Salas. Se apersonaron en esta sede la licenciada Margot Avellan Ruiz, Procuradora Penal y el licenciado Juan Diego Salon Piedra, defensor público del encartado.
RESULTANDO:
I.Que mediante sentencia número 124-2021, de las catorce horas cinco minutos del cuatro de marzo del dos mil veintiuno, el Tribunal Penal del Segundo Circuito Judicial de la Zona Atlántica, Pococí, resolvió: "POR TANTO: De conformidad con los articulos 39 y 41 de la Constitución Política; 8.2 de la Convención Americana sobre Derechos Humanos; 11 de la Declaración Universal de Derechos Humanos; 1, 2, 3, 11, 30, 31,45, 50, 59 al 63, 71 del Código Penal, articulos 1, 2, 3, 9, 37, 40, 111 a 124, 180 a 184, 265, 267, 328, 330 a 336, 341, 352, 360 a 366 del Código Procesal Penal, articulo 58 de la Ley Forestal, EN APLICACIÓN DEL PRINCIPIO UNIVERSAL INDUBIO PRO REO SE ABSUELVE DE TODA PENA Y RESPONSABILIDAD AL SEÑOR [Nombre1] , por el delito de APROVECHAMIENTO ILEGAL DE RECURSOS FORESTALES cometido en perjuicio de MEDIO AMBIENTE. Se declara sin lugar la Acción Civil Resarcitoria incoada por parte del demandante civil PROCURADURÍA GENERAL DE LA REPÚBLICA en contra del DEMANDADO [Nombre1] .
Se dicta esta sentencia sin especial condenatoria en costas por estimar el Tribunal que la parte actúo en atención a la buena fe y estimando que tenia un derecho. Se ordena el comiso a favor del estado de la motosierra MC660 y la madera decomisada, siendo que la madera fue entregada sin orden judicial por parte del SINAC, deberán ellos verificar la existencia o no de dicha madera. Hágase saber. " (sic).
II.Que contra el anterior pronunciamiento, la licenciada Margot Avellan Ruiz, Procuradora Penal, interpusieron recurso de apelación.
III.Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 465 del Código Procesal Penal, el Tribunal se planteó las cuestiones formuladas en el recurso de apelación.
Redacta el juez de Apelación de Sentencia Penal Gillen Bermúdez; y,
CONSIDERANDO:
I.Admisibilidad. Contra la sentencia número 124-2021, dictada a las catorce horas cinco minutos de cuatro de marzo de dos mil veintiuno, por el Tribunal Penal del II Circuito Judicial de la Zona Atlántica, sede Pococí interpuso recurso de apelación, la licenciada Margot Avellán Ruíz, representante de la Procuraduría General de la República. De la revisión del recurso se evidencia que fue interpuesto dentro de los quince días hábiles después de la notificación de la sentencia, según lo dispone el artículo 459 del Código Procesal Penal, y cumple con los presupuestos de admisibilidad establecidos por los artículos 458 y 460 de dicho cuerpo normativo, lo cual permite su conocimiento en los términos del artículo 8.2h de la Convención Americana de Derechos Humanos, por lo que se admite para su estudio y resolución de fondo.
II.i.- En el único motivo de apelación, señaló inconformidad con la fundamentación de la sentencia. Dividió la queja en dos aspectos claramente diferenciados, el primero relativo a la comisión del delito, y el segundo referido al rechazo de la acción civil resarcitoria. En cuanto a la inconformidad con lo resuelto en materia penal, refirió que tanto en la querella, como en la acción civil planteadas, se atribuyó al encartado [Nombre1] , en conjunto con [Nombre4] , la tala y aprovechamiento de un árbol de la especie chancho blanco, en terrenos del Refugio Nacional de Vida Silvestre Barra del Colorado; hechos ocurridos en fecha 10 de enero de 2014. Señaló que en debate se recibió la declaración del funcionario del Sistema de Áreas de Conservación (SINAC), Manuel José [Nombre5] , quien refirió cómo se detectó a ambos imputados en flagrancia, mientras realizaban el aprovechamiento del citado producto forestal, indicando que el encartado [Nombre1] , luego de ser advertido de su derecho de abstención, admitió no solo ser el propietario de la motosierra, lo que también refirió en su declaración indagatoria, sino también ser el responsable directo del aprovechamiento forestal.
Sostuvo, que si bien el oficio ACTO-GASP-RNVSBC-PO-002-2014, no describe con claridad la acción desplegada por el imputado, prevalece lo declarado en debate por el testigo [Nombre5] , quien fue claro en indicar que el imputado se había presentado a sí mismo, como el interesado en que se realizase la tala. Señaló la existencia de indicios no controvertidos, que confirman que la presencia del acusado [Nombre1] en el lugar, se debía a velar por la tala y aprovechamiento forestal, indicios de los cuales realizó el siguiente recuento: i.- la presencia del imputado en el sitio del aprovechamiento; ii.- que la motosierra con la que se efectuó el acto ilícito, era propiedad del encartado; iii.- que haya recibido en depósito provisional el producto forestal derivado de la tala, 28 reglas de la especie chancho blanco; lo cual fue respaldado mediante el acta de decomiso número 523, y el acta de entrega en custodia o depositario administrativo número 555, ambas levantadas por los funcionarios del SINAC, y rubricadas por el encartado [Nombre1] .
Sostuvo, que aunque no se establezcan en la querella y la acusación las acciones que realizaba el imputado, es un hecho que la conducta ilícita investigada, se realizaba bajo sus órdenes y vigilancia, lo que constituye una autoría inmediata cometida por el coimputado [Nombre4] , a nombre del autor mediato, el acusado [Nombre1] . En apoyo de su reclamo, transcribió parcialmente, el voto 909-F-97 del Tribunal de Casación Penal. Consideró inequívoco, que el imputado [Nombre1] , a través del otro imputado [Nombre4] , efectivamente realizó actos de aprovechamiento de un árbol de la especie chancho blanco, dentro de Refugio Nacional de Vida Silvestre Barra del Colorado, ya que indiscutiblemente tenía dominio del hecho, teniendo plena conciencia de la tala acaecida, la cual promovió y buscó su ejecución. Reclamó, que el tribunal de juicio, argumentó que para la imputación y condena del encartado, se requiere una descripción detallada y exacta de las tareas que estaba realizando, ya que en criterio de la apelante, es suficiente con que se imputara el verbo contenido en la norma, y luego en el debate se desgranara a través de la declaración de los testigos, las acciones cometidas al momento de los hechos por cada uno de los imputados.
Sostuvo, que si bien el testigo no describió con detalle lo actuado por el imputado [Nombre1] , sí lo coloca en el sitio, dentro del parque nacional y al lado del ejecutor de la tala, además de ubicarlo como parte de la acción de aprovechamiento a través de la orden y control que ejercía sobre la corta del árbol. Reprochó la fundamentación contradictoria de la sentencia, pues el juez admitió que lo que correspondía era condenar, sin embargo, no lo hizo, considerando que la acusación y la querella no tenían contenido para ello, lo cual en criterio de la recurrente, es incorrecto. En cuanto al rechazo de la acción civil resarcitoria, reclamó que el tribunal de juicio, rechazó la pretensión civil por no haberse determinado el nexo causal entre el ilícito cometido y el imputado. Consideró que dicha aseveración es inadmisible, pues el testigo [Nombre5] , evidenció que la tala y aprovechamiento forestal fue ideado por el imputado [Nombre1] , y ejecutado por el encartado [Nombre4] , bajo las órdenes del primero.
Agregó que también se contó con la declaración del testigo [Nombre6] , quien refirió la causación de un daño ambiental que ocasionó un perjuicio estimado en la suma de novecientos setenta y tres mil ochocientos treinta y cuatro colones con doce céntimos. Solicitó, se declare ineficaz la sentencia impugnada, y se ordene el reenvío de la causa para una nueva sustanciación. II-ii.- Posición de la Defensa. Debidamente emplazado sobre el recurso de apelación planteado por la representante del la Procuraduría General de la República (folio 188), el licenciado Juan Diego Salon Piedra, defensor público del imputado [Nombre1] , señaló que contrario a los argumentado por la Procuraduría General de la República, en sentencia se hizo un análisis objetivo de la acusación y la calificación jurídica que dio origen a la resolución impugnada. Indicó que comparte de forma íntegra el argumento del tribunal de juicio, respecto de la nula acción delictiva del imputado, señalando que quedó acreditado que no existe prueba, y en el caso del testigo [Nombre5] , resultó contradictorio y hasta oscuro en algunos aspectos, y novedoso en otros respecto de información que nunca constó en los informes.
Refirió que ante preguntas de la defensa, sobre si al imputado se le había realizado la advertencia respecto de su derecho de abstención, el testigo [Nombre5] indicó que se hizo de oficio, pero no recordaba si se consignó en el informe, situación que la defensa consideró irregular, debido a que las autoridades realizan la constancia debida, e incluso solicitan a la persona detenida firmar para hacer constar dicha diligencia, lo cual no ocurrió en el presente caso y es referida siete años después de los hechos. Informó que se equivoca la apelante al indicar que el imputado en su indagatoria se autodeterminó como dueño de la herramienta, dado que dicha diligencia fue una toma de datos sin presencia del defensor. Consideró, que lleva razón el tribunal de juicio, al señalar que aún y cuando se lograra acreditar de forma independiente esa supuesta jerarquía y distribución de funciones, representaría en caso de condena, la modificación del marco de imputación criminal, lo que vulneraría el derecho de defensa.
Solicitó ratificar la sentencia absolutoria en aplicación del principio in dubio pro reo, y la declaratoria sin lugar de la acción civil resarcitoria. II.iii.- El motivo se declara con lugar. Con el fin de resolver adecuadamente la queja planteada, se debe recordar que el Ministerio Público y la Procuraduría General de la República, presentaron acusación y querella respectivamente, contra el imputado [Nombre1] , por los siguientes hechos: "1.- El día diez de enero de dos mil veinte, los acusados [Nombre4] (con testimonio de piezas por estar ausente) y [Nombre1] , conociendo la ilicitud de sus actos y a sabiendas que no contaba con los permisos de la Municipalidad de Pococí ni de la administración Forestal del Estado, invadieron el Refugio Nacional de Vida Silvestre Barra del Colorado, propiamente en los puntos de GPS de referencia CRTM CED2;CED3, con el fin de talar y aprovechar los árboles para el aserrío de trozas. 2.- Así, los acusados a sabiendas de la ilicitud de sus actos, y sin contar con los permisos de ley, aprovecharon los recursos forestales en terrenos del patrimonio natural del Estado al talar un árbol de la especie Laurel, para lo cual aserraron con una motosierra modelo MC660 dicho árbol, y lo convirtieron en veintiocho reglas de madera. 3.- El mismo día y lugar, , los funcionarios del SINAC-MINAE y de la Fuerza Pública realizaban recorrido en la zona del Refugio nacional de Vida Silvestre Barra [Dirección1] Colorado, siendo que observaron a los acusados ejecutando los actos de aprovechamiento, procediendo al decomiso de la madera aserrada y la motosierra modelo MC660 usada por los imputados para cometer el hecho acusado. 4.- Producto de las acciones antes indicadas, se ocasionó un daño ambiental que asciende los novecientos setenta y tres mil ochocientos treinta y cuatro colones con doce céntimos" (sic, folios 44 y 75 a 76 respectivamente).
Con relación a estos hechos, el tribunal de juicio, resolvió absolver al imputado [Nombre1] , argumentando una incorrecta imputación, en razón de que en debate el Ministerio Público y la Procuraduría General de la República, se abocaron a demostrar que el imputado cometió el delito por autoría mediata, ordenando al coimputado [Nombre4] la tala del árbol de la especie conocida como chancho blanco; aspecto que no se encuentra descrito ni en la acusación ni en la querella. En tal sentido, el a quo señaló: "...[...]...La acción típica como tal, no la estaría realizando usted, es decir, usted no es la persona que está aserrando, sino lo que eventualmente podría existir, dentro de los términos jurídicos que existen, es una coautoría suya con este otro...[...]...pero la coautoría no la puede venir el tribunal a insertar dentro de una acusación, dentro de una querella, para poder establecer claramente cómo fue que ocurrieron los hechos.
Esto generaría que el tribunal se esté inmiscuyendo en actos propiamente de la investigación, actos acusatorios que le corresponden a la parte querellante y a la parte acusatoria. Que si el tribunal viene a modificar los hechos como podría ser, de manera correcta se tuvieron que haber hecho, no existiría una correlación entre acusación y sentencia, y estaría vulnerando también el tribunal el principio de la defensa, también que tiene la oportunidad de defenderse de hechos que existan en el expediente, y no de nuevos hechos que uno vea surgir en el transcurso del debate sin la modificación correspondiente, ¿por qué?, porque los hechos durante el debate se mantuvieron de manera incólume, nunca existió alguna modificación o variación en la acusación. Siempre se mantuvo, no que el señor [Nombre1] , hubiese ordenado, o hubiese dado la orden a [Nombre4] , quien está ausente, de realizar esta acción típica, antijurídica, sino lo que hay, lo que se intentó demostrar por parte de la parte querellante y de la fiscalía, no fue que usted estaba talando, sino que usted era la persona que le había dado la orden a este sujeto de realizar la tala, como parte de participación activa, o de una autoría mediata, si se quiere ver también de esa manera, o algún tipo de coautoría en el presente proceso, pero el hecho, el núcleo de esta acusación, de este juicio como se puede observar en el hecho número dos, es que el Ministerio Público, porque la acusación, la querella y la acción civil, son completamente iguales, son idénticas, las mismas palabras, los mismos hechos, dicen: que así los acusados, refiriéndose a [Nombre4] , quien está ausente, y al imputado [Nombre1] , a sabiendas de la ilicitud de sus actos, sin contar con los permisos de ley, eso está acreditado pero no tiene ninguna relevancia, aprovecharon recursos forestales del Estado, forestales en terrenos de patrimonio natural del Estado, al talar un árbol de la especie chancho blanco, para lo cual lo aserraron, con una motosierra modelo 660, es decir, el Ministerio Público viene a acreditar hechos de aprovechamiento ilegal de recursos forestales, así como la Procuraduría General de la República a través de la querella, aduciendo que usted taló ese árbol con esa persona, es decir, nunca le acusó que usted hubiese ordenado al otro sujeto realizar esto...[...]..." (video 140001870485PE-04032021020956-2_Multi, contador 26:34 a 30:08), y posteriormente agregó: "...[...]...También toda esta falta de investigación, no le permite al tribunal, como lo quisieron hacer ver el Ministerio Público y la Procuraduría General de la República, modificar la acusación, porque quebrantaría de manera ilegal el tribunal, el principio de correlación de acusación y sentencia, puesto que usted venía acá a defenderse de lo que a usted le venían acusando, de talar un árbol junto con otra persona, con una motosierra modelo MC660, y lo que vinieron a demostrar aquí el Ministerio Público y la parte querellante, es que usted mas bien lo que hizo fue darle la orden a otra persona para que realizara esa actividad, hechos completamente aparte, hechos de los cuales usted no tenía conocimiento y hechos para los cuales usted eventualmente no se preparó para ejercer una defensa el día de hoy; situación que no le es permeable (sic) a usted, ni tampoco al tribunal, sino que es responsabilidad propia de las partes acusadoras...[...]..." (video 140001870485PE-04032021020956-2_Multi, contador 35:07 a 36:03), posición que en criterio de este Tribunal de Apelación de Sentencia Penal, resulta incorrecta, pues exige elementos objetivos de configuración del ilícito que el tipo penal en cuestión no requiere.
Sobre las características de una correcta imputación, la Sala Tercera de la Corte Suprema de Justicia, en el voto 1249-2021, el cual se comparte señaló:"...[...]...Sobre el particular, la jurisprudencia ha delineado los alcances que debe contener una adecuada imputación: “La estructuración de la pieza acusatoria adquiere relevancia en sistemas procesales de acentuado corte adversarial, en el tanto satisface una doble función: por un lado delimita el objeto de la litis, y, al mismo tiempo, fija los límites dentro de los cuales se circunscribe el derecho de defensa (tanto material como técnica) de la parte imputada. Justamente, ante esta constatación, las legislaciones procesales suelen positivizar reglas de carácter imperativo tendientes a conminar al actor penal (público o privado) a redactar la imputación observando determinados parámetros. […] La acusación deberá contener: (…) b) La relación precisa y circunstanciada del hecho punible que se atribuya.” Desentrañando el significado de los adjetivos “precisa” y “circunstanciada”, esta Sala ha indicado con anterioridad: “Desde esta óptica, precisión se refiere a la necesidad de realizar una adecuada individualización, no sólo del autor, coautor y partícipes, sino también de la víctima, mientras que la circunstanciación, es la necesidad de indicar el modo, tiempo y lugar en que se desarrolló la acción u omisión.
Además, vía jurisprudencia, se ha determinado que los hechos de la acusación, deben ser claros, es decir, que no tenga términos oscuros, ambiguos o contradictorios.” (Sala Tercera de la Corte Suprema de Justicia, sentencia N° 2017-0306, de las 10 horas, 11 minutos, del 28 de abril de 2017. Integrada por Chinchilla, [Nombre8], [Nombre5], [Nombre9], Gómez)" (Sala de Casación Penal, resolución 2019-00549, 16:25 horas, 30 de abril de 2019; con integración de [Nombre8] , [Nombre11] , [Nombre12] , [Nombre13] y [Nombre14] )...[...]..." (el resaltado es suplido). Así, teniendo presente que el tipo penal regulado en el artículo 58 inciso b de la ley número 7575, Ley Forestal, señala: "Se impondrá prisión de tres meses a tres años a quien:...b) Aproveche los recursos forestales en terrenos del patrimonio natural del Estado y en las áreas de protección para fines diferentes de los establecidos en esta ley...", a partir de la detallada lectura de la acusación, esta cámara de alzada, encuentra que contrario a lo esbozado por el tribunal de mérito, tanto la acusación fiscal, como la querella, sí contienen una clara y detallada descripción de los hechos imputados al acusado [Nombre1] .
Tanto en la acusación, como en la querella, se establece que los hechos ocurrieron el 10 de enero de 2013, en terrenos que conforman el Refugio Nacional de VIda Silvestre Barra del Colorado, con lo que se imputan de forma correcta las condiciones de tiempo y lugar de los hechos, y en cuanto al modo de comisión, se indica que ambos imputados de manera conjunta realizaron el aprovechamiento mediante tala de un árbol de la especie conocida como chancho blanco, con lo que el modo de comisión del hecho también se encuentra claramente descrito, y con ello el libelo acusatorio se observa debidamente circunstanciado. En cuanto al aspecto subjetivo del tipo, al tratarse de un delito doloso, debe demostrarse el conocimiento del imputado de su actuar y la voluntad de llevar a cabo dicha tala, sin que sea necesario establecer en la descripción de los hechos, la exigencia requerida por el a quo, la forma de participación en el hecho, ya sea mediata o inmediata, pues no es un requerimiento objetivo del tipo penal investigado.
Lo imputado, es la participación del encartado en función de autor, en la tala ilegal de un árbol ubicado en terrenos del Estado, lo que se encuentra debidamente acusado. Si esta acción la realizó por sí, o mediante terceros, es un punto que efectivamente debe discutirse en debate para constatar el elemento subjetivo del tipo, sea la existencia de dolo en la conducta, pero que no necesariamente debe señalarse en la relación de hechos acusados. En cuanto a la pretensión civil planteada por la apelante, el tribunal de instancia rechazó la citada acción civil resarcitoria, argumentando que al ser exactamente los mismos hechos de la acusación y la querella, se debían tener por no demostrados; razonamiento que como se indicó en líneas anteriores resultó incorrecto, por lo que por las mismas razones el rechazo de la pretensión civil debe declararse infundamentado. En razón de lo anterior, se declara con lugar el recurso de apelación planteado por la Procuraduría General de la República, y en consecuencia se declara la ineficacia de la sentencia impugnada, ordenándose el reenvío de la causa al despacho de origen, para que con una diferente integración, proceda a resolver conforme en derecho corresponda.
