Goicoechea, at nine fifty a.m. on December fourteenth, two thousand twenty-one.- Appeal seeking absolute nullity (nulidad absoluta), filed in proceedings for enforcement of a final and favorable act, conducted before the Tribunal de lo Contencioso Administrativo y Civil de Hacienda under case file N°20-5180-1027-CA, by: Nombre162657, identity card number CED22308; Nombre16866, identity card number CED22309; INVERSIONES E INMOBILIARIA FAMZELATA S.A., corporate identification number CED22310, represented by Mr. Nombre27411, identity card number CED22311; CORPORACION AGROCOMERCIAL COTO HIDALGO S.A., corporate identification number CED22312, represented by Nombre27412, identity card number CED22313; Nombre162658, identity card CED22314; and Nombre161189, identity card number CED22315, against: MUNICIPALIDAD DE PARAÍSO, which did not respond to the hearing granted. Nombre27413 and Nombre26520 appear as special judicial counsel (apoderados especiales judiciales) for the plaintiffs.
Following deliberation and by unanimous decision, the Court rules:
Opinion drafted by Judge Yazmín Aragón Cambronero, and,
WHEREAS:
I).- In these proceedings for enforcement of a final and favorable act, counsel for the petitioners requested: “1. We respectfully request that the Enforcement Judge order Municipalidad de Paraíso to comply immediately with the judicial enforcement of the final administrative act (acto administrativo firme) issued by Municipalidad de Paraíso through the administrative decision contained in official letter MUPA-ALC-01-2020, dated 2020-01-06, and in the Minutes of Ordinary Session number 295 held on 10/12/2019, Article 09, which are contained in Volume 45 and held in the Office of the Secretary of the Concejo Municipal. / 2. That it be ordered to pay the costs of this judicial enforcement of the final administrative act” (img. 2-7). After being duly notified of these proceedings, the defendant did not oppose the relief sought.
II).- Following the required procedure, José Martín Conejo Cantillo, Enforcement Judge of the court of first instance, ruled as follows in decision N°305-2021, issued at 11:05 a.m. on August 12, two thousand twenty-one:
“(...)The petition for enforcement of a final and favorable administrative act filed by Nombre162657, identity card number CED22308; Nombre16866, identity card number CED22309; INVERSIONES E INMOBILIARIA FAMZELATA S.A., corporate identification number CED22310; CORPORACION AGROCOMERCIAL COTO HIDALGO S.A., corporate identification number CED22312; Nombre162658, identity card CED22314; and Nombre161189, identity card number CED22315, against MUNICIPALIDAD DE PARAÍSO is DENIED in all respects. No special award of costs. (...)”.
Dissatisfied with the decision, counsel for the plaintiffs filed a timely appeal in proper form. Once the appeal had been admitted, a hearing was granted regarding the alleged errors, to which the defendant did not respond, after which this appellate panel now rules.
III).- ALLEGED ERRORS RAISED BY THE ENFORCEMENT PETITIONER: Counsel for the petitioners disagrees with the decision and, in a brief received by the court on August 23, 2021, raised the following alleged errors: 1.- Improper interpretation and failure to apply legal provisions: He contends that the first-instance judge violated sections 176 of the Código Procesal Contencioso Administrativo and 228 of the Ley General de la Administración Pública by failing properly to apply, much less interpret, those provisions and the case law (jurisprudencia) of Sala I de la Corte Suprema de Justicia and Sección I of this appellate court. After quoting recital VI (considerando VI) of the challenged decision, he concludes that the court below became improperly entangled in arguments that he considers unnecessary in this type of proceeding by stating that, if the Municipalidad did not answer the complaint, Article 65 of the code governing the matter does not apply—a position inconsistent with the legal system, since that provision must be read in conjunction with sections 39 and 3.4 of the Código Procesal Civil.
He argues that the judge committed another legal error by analyzing official letter MUPA-ALC-01-2020, dated June 06, 2020, which concerns a preparatory act (acto preparatorio) irrelevant to the enforcement of the final and favorable act contained in the minutes of Ordinary Session N°295 of December 10, 2019, in which it was ordered: “(…) Por tanto, it is resolved to adopt the study’s recommendations, with the most economically viable option for the Municipalidad being to acquire the land and designate it for reforestation and restoration, thereby creating a biological corridor in the area (…)”; this decision was confirmed in the minutes of Ordinary Session N°296 of December 17, 2019, ratified and made final. He asserts that the judge failed to comply with the cited provisions because he relied on subjective rather than legal assessments and considered, for example, that the administrative decision should have identified the persons from whom the properties would be purchased or whose properties would be expropriated.
He states that, by failing to conduct the proper analysis, the judge violated the pro libertate and pro homine principles, which lie at the heart of human-rights doctrine. He adds that, under the former, everything favoring property rights must be interpreted broadly and everything restricting them narrowly; under the latter, the law must always be interpreted and applied in the manner most favorable to the human person. He insists that the court below became sidetracked by making incoherent statements about what the final administrative act issued by the Concejo Municipal should be, thereby attempting to substitute itself for the Administration, which the legal system does not permit, because its task is to enforce the terms established in the administrative act. By failing properly to analyze its provisions, the judge erred in stating that the decision adopted by the Concejo was a general order.
He contends that the judge violated due process (debido proceso) and his right of defense (derecho de defensa)—Articles 39 and 41 of the Constitución Política and Articles 08 and 25 of the Convención Americana de Derechos Humanos—which procedural law sanctions by absolute nullity. He adds that the court below committed another error by stating that the final administrative act being enforced is not subject to judicial enforcement and is properly addressed in plenary proceedings (proceso de conocimiento), which contravenes the case law of Sala Constitucional. In support, he invokes Article 13 of the Ley de la Jurisdicción Constitucional and Voto N°2017-8852, issued at 09:15 a.m. on June 14, 2017—which he quotes in part. Based on the foregoing, he requests that the challenged decision be reversed or vacated and that the enforcement petition be granted in all respects. Alleged Error 2: Failure to state the grounds and legal basis for the judgment: He asserts that the challenged decision is cursory and lacks adequate reasoning, in violation of Article 57 of the Código Procesal Contencioso Administrativo.
He states that, contrary to the ruling, it was indeed established that the administrative act whose enforcement is sought conferred a favorable legal status (situación jurídica favorable) upon the plaintiffs. He emphasizes that the complaint enjoys a presumption of truthfulness (presunción de veracidad) and that nothing in the case file disproves the assertion that the plaintiffs’ properties are located in Nombre162659 de Ujarrás del cantón de Paraíso. Moreover, it is not a general order, as the judge incorrectly interpreted it to be, because the location of the properties can be inferred from the evidence submitted. He objects to the violation of Articles 82 of the CPCA and 41.1, .2. and .3 of the procedural code because, if the Municipalidad did not answer the complaint and the record contains evidence establishing the plaintiffs’ standing (legitimación), he cannot understand why the decision concludes that the plaintiffs do not hold a favorable legal status.
He argues that the appealed decision contains inconsistencies, incoherence, and contradictions. With respect to the assessment of the evidence (valoración de la prueba), he invokes Voto N°1739-92 of Sala Constitucional de la Corte Suprema de Justicia, emphasizing that all judgments must be clear, precise, consistent, and reasoned. In the present case, he concludes, the ruling is contradictory and confusing and also distorted the procedural framework governing the burden of proof (carga de la prueba), thereby violating effective judicial protection (tutela judicial efectiva) as a fundamental component of the right to justice and due process. He argues that the judge merely transcribed information without providing grounds or reasoning. He insists that, in light of Articles 176 of the CPCA and 228 of the Ley General de la Administración Pública, the judge’s reasoning is invalid and lacks adequate justification.
The judge merely stated that it was a general order issued by the Administración Municipal but did not explain how he reached that conclusion, particularly since the case file contains factual, legal, and evidentiary elements that refute the judge’s position. He states that the reasons must be fair and objective; otherwise, the decision is arbitrary and therefore void. He requests that the ruling be declared absolutely null and that the matter be remanded because the alleged defect is evident. Alleged Error 3: Violation of the rules of sound judicial evaluation (sana crítica) due to inadequate reasoning: He complains that the decision is confusing and contradictory, obstacles that make it impossible to determine the grounds underlying the denial of his claim, contrary to effective judicial protection. Its reasoning is superficial and, he asserts, fails to satisfy the requirements for a reasoned decision because it does not adequately explain the factual, legal, and evidentiary grounds for denying the relief sought.
The decision contains insufficient reasoning and legal support and improperly assesses the applicable legal provisions. Once the defect is established, the proper course is to reverse the decision and grant the complaint. He explains that the Enforcement Judge refuses to enforce the final and favorable administrative act, contrary to the provisions of the aforementioned section 176 of the CPCA, despite having a legal and constitutional obligation to enforce it, using as a pretext that it is a general declaration, which it is not. In the fact the judge deemed proven, he described and specified the substance of the final administrative act issued by the Concejo Municipal, yet his reasoning reaches a different conclusion. He argues that the proceeding established in Article 176 of the CPCA was created as a response to administrative inaction or negligence in enforcing acts favorable to the governed party (administrado), a remedy the judge appears to nullify by referring the parties to plenary proceedings.
He requests that the appeal and request for absolute nullity be granted and that the decision be reversed and the relief sought granted, including an award of costs against the defendant; alternatively, he requests that the decision be vacated for failure to state its grounds and legal basis.
Before ruling as a matter of law, and given its significance to the disposition of the appeal, it is necessary to quote the portions relevant here of the reasoning stated by the first-instance judge in the decision now challenged, as follows:
“(…) II. PROVEN FACTS (HECHOS PROBADOS). The following are deemed relevant to the issuance of the judgment: 1. Under Article 9 of Ordinary Session number 295-2019, dated December 10, 2019, the Concejo Municipal de Paraíso considered official letter MUPA-ALC-947-2019, dated December 10, 2019, signed by the Alcaldesa Municipal, concerning Report No. MUPA-UTGVM-615-2019, submitted by the Internal Commission appointed by the Despacho de la Alcaldesa Municipal to address the case known as La Luisiana. That document is transcribed in the minutes of the session, which ultimately recorded the following resolutions: “Por tanto, it is resolved: / To follow the recommendations of the study, with the most economically viable option for the municipality being to acquire the land and designate it for reforestation and restoration, thereby creating a biological corridor in the area. / To assess the possibility of carrying out the controlled extraction of material to enable sediment control as an environmental prevention measure, and its use in municipal works. [It is unclear whether these two matters are part of the transcribed act or whether they are also resolutions of the Council, because they are not recorded in the same manner as the other resolutions] / 1- IT IS UNANIMOUSLY RESOLVED TO WAIVE COMMITTEE REVIEW OF OFFICIAL LETTER MUPA-ALC-947- 2019.
RESOLUTION FINAL AND DEFINITIVELY APPROVED. / 2-IT IS RESOLVED TO APPROVE THE REPORT IN OFFICIAL LETTER MUPA-ALC-947-2019, SUBMITTED BY THE ALCALDESA MUNICIPAL REGARDING REPORT OFFICIAL LETTER N°MUPA-UTGVNI-61 5-2019 SUBMITTED BY THE INTERNAL COMMISSION APPOINTED BY THE DESPACHO DE LA ALCALDESA MUNICIPAL TO ADDRESS THE CASE KNOWN AS LA Nombre162659. NOTICE SHALL BE GIVEN. RESOLUTION FINAL AND DEFINITIVELY APPROVED. / 3-IT IS UNANIMOUSLY RESOLVED TO RECOMMEND THAT THE MUNICIPAL ADMINISTRATION ATTACH DETAILS OF THE COSTS OF EACH SQUARE METER ACCORDING TO THE STUDY CONDUCTED BY THE APPRAISER, NOTICE SHALL BE GIVEN. RESOLUTION FINAL AND DEFINITIVELY APPROVED. / 4-IT IS UNANIMOUSLY RESOLVED TO REQUEST THAT THE MUNICIPAL ADMINISTRATION PROVIDE A JOINT RESPONSE, BY THE MUNICIPAL COUNCIL AND THE ADMINISTRATION, TO THE SALA CONSTITUCIONAL, GIVEN THAT AS OF THIS DATE THIS MUNICIPAL COUNCIL DOES NOT HAVE A MALE OR FEMALE LEGAL ADVISOR. NOTICE SHALL BE GIVEN. RESOLUTION FINAL AND DEFINITIVELY APPROVED” (img. 37-41).
The following is relevant to this case: 1. The existence or content of official letter MUPA-ALC-01-2020, dated January 6, 2020.
ARGUMENTS OF THE PARTIES. In summary, the party seeks enforcement of the administrative decision contained in official letter MUPA-ALC-01-2020, dated 2020-01-06, and in the Minutes of Ordinary Session number 295 held on 10/12/2019, Article 09. In defense of its interests, the party stated that, because the Municipality had failed to respond, the facts should be deemed admitted. In addition, in its initial filing it cited articles of the Ley General de la Administración Pública (LGAP) and the CPCA and referred to Costa Rican legal scholarship regarding proceedings for the enforcement of a final and favorable administrative act. The Municipalidad de Paraíso did not respond to the hearing granted. (…).
Before analyzing the acts whose enforcement is sought, it is necessary to examine the consequences of the Municipality’s failure to answer the service of process (emplazamiento) granted. Although the party does not cite a specific article in support of its assertion, its argument is similar in substance to Article 65 CPCA, insofar as it provides that, in the absence of a response to service of process, the facts shall be deemed admitted. However, this Trial Judge finds that this provision cannot be applied because this is not an adjudicatory proceeding on the merits (proceso de conocimiento), but rather an enforcement proceeding (proceso de ejecución), in which the obligation to verify compliance with the requirements established in Article 176 CPCA is not negated by the Municipality’s failure to respond, pursuant to Article 155.2 CPCA. Accordingly, this Trial Judge remains responsible for verifying whether the acts whose enforcement the party seeks, and the manner in which it seeks their enforcement, comply with the cited article, and may not presume or unquestioningly accept the assertions made by the plaintiff in its filings.
To conduct the analysis in this matter, the Court will examine compliance with the requirements for each of the two acts that the plaintiff seeks to enforce. 1. Official letter MUPA-ALC-01-2020, dated 2020-01-06. As established in unproven fact 1, this Trial Judge was unable to locate the aforementioned official letter among the evidence submitted by the plaintiff; consequently, it cannot be determined whether it has the same content as the Municipal Council’s resolution, whether it is the official letter through which the Council’s resolution was communicated, or whether it has different content. Under these circumstances, the party’s application to enforce this official letter must be denied because its content does not appear in the case file, which precludes analysis of the requirements established in Article 176 CPCA. 2. Article 09 of the Minutes of Ordinary Session number 295 held on 10/12/2019.
As previously described, this act of the Municipal Council considers an official letter submitted by the Alcaldía Municipal, which in turn refers to a report and recommendations issued by a commission appointed to analyze what was referred to as the La Luisiana case. That report set forth a series of technical recommendations regarding the Reventazón–Orosí river channel and the possibility of flooding, recommending the acquisition of land and its dedication to reforestation and restoration purposes. Of particular importance to this Trial Judge is that neither that document nor, consequently, the resolution adopted by the Council specifically identifies the land recommended for expropriation or acquisition, the municipal residents who would be affected by the decision, or the technical findings and recommendations incorporated therein. Nor did the plaintiff make any evidentiary effort to establish how the plaintiffs’ land is connected to the legal situation described in the municipal resolution or how the decision to purchase land would affect them.
As stated previously, one of the essential requirements established in Article 176 CPC is that the act whose enforcement is sought must contain a specific declaration granting an identified person or group of persons a particular right, defined in time and space, rather than a general declaration requiring subsequent administrative analysis or development, since, ultimately, the final and favorable act must operate in a manner similar to an enforceable instrument (título ejecutivo), in the sense that its content must be sufficient for enforcement; otherwise, an analysis inherent to an adjudicatory proceeding on the merits would be required. In this case, as already stated, the act of the Municipal Council does not identify any properties that could be affected by the decision to acquire land, nor does it establish a specific order to the Administration in this regard. Thus, this Trial Judge cannot find that the decision sought to be enforced grants the plaintiffs a favorable legal position, because it merely gives a general order to the Municipal Administration to proceed in a particular manner, which is very different from what the article in question requires.
Accordingly, enforcement of this second act is also denied. VII. COSTS (COSTAS). As to the costs for the enforcement stage, this Trial Judge finds that this claim must be denied based on the case law issued by the Sala Primera de la Corte (see, in this regard, decision 1400-A-S1-2015, issued at 9:35 a.m. on December 10, among many others). In that decision, the Sala notes the existence of a line of case law establishing that decisions on the assessment of costs (liquidaciones de costas) are merely interlocutory orders (autos) and consequently are not subject to cassation appeal (recurso de casación). The Sala likewise extends that standard to interlocutory orders assessing interest and thereafter also to those assessing damages. The Sala states that, in such cases, the enforcement order did not decide whether damages existed, an issue decided in the judgment being enforced, but merely established the amount of compensation.
If a decision resolving an assessment of costs is an interlocutory order, then under the rules of Article 193 CPCA, costs may not be awarded for enforcement proceedings before this court, because an award of costs in this jurisdiction may be made only in judgments and in interlocutory orders equivalent to judgments (autos con carácter de sentencia). Consequently, the award of costs is denied (…)”.
V.In the grounds for appeal (agravios), counsel for the claimant alleges that the challenged decision is null and void (nulidad), in summary, for the following reasons: lack of reasoning, improper assessment of the factual and legal framework, and violation of the claimant’s Right to a Defense and Due Process, because, counsel argued, the decision did not adequately analyze the legal situation at issue in light of sections 176 of the Administrative Litigation Procedure Code (Código Procesal Contencioso Administrativo) and 228 of the General Public Administration Law (Ley General de la Administración Pública). This Chamber finds that the claims of nullity raised are without merit for the following reasons: A careful reading of the challenged decision supports the conclusion that it satisfies the duty to provide reasons established in section 57 of the Code governing this matter and is also clear and consistent in its content.
It should be noted that, after establishing the factual framework underlying his substantive findings, the judge stated that, even though the Municipalidad de Paraíso had failed to answer the complaint, it was necessary to analyze the act whose enforcement was sought, pursuant to the powers conferred upon him by article 155.2 of the Code governing this matter. He analyzed each of the acts. With respect to official letter MUPA-ALC-01-2020, dated 2020-01-06, he noted that it could not be located among the evidence submitted and that it was therefore not feasible to establish its content in order to compare it with the provisions of article 176 of the aforementioned body of law. As for the matter contained in article 09 of the Minutes of Ordinary Session number 295, held on 10 de diciembre de 2019, he analyzed its content and stated the reasons preventing the requested relief from being granted.
Specifically, he found: It does not include any indication of which properties might be affected by the decision to acquire land, nor does it contain a specific order to the Administration in that regard. He stated that, as judge, he was unable to establish that the decision conferred a favorable legal position upon the claimants, because its provisions amounted to a general order directing the Municipal Administration to proceed in a certain manner, which is very different from what the cited section 176 requires. He emphasized that the act whose enforcement is sought must contain a specific declaration in favor of a person or an identified group of persons concerning a specific right, defined in time and space, rather than a general declaration requiring subsequent administrative analysis or preparation. He likened it to an enforceable instrument (título ejecutivo), in the sense that its content must be sufficient for enforcement; otherwise, it would require the type of analysis conducted in full adjudicatory proceedings (proceso de conocimiento).
The various findings contained in the judgment are, it bears repeating, understandable and consistent with its operative part (parte dispositiva); indeed, the appellant himself was able to raise the substantive grounds for appeal that he presented at the appropriate time, which fully guaranteed his right to a defense. Although he clearly disagrees with the decision, that disagreement is not sufficient to invalidate it. Nor does the interpretation—characterized as incorrect by the aggrieved party—given by the lower court (a quo) to sections 176 of the Code governing this matter and 228 of the General Public Administration Law constitute grounds for invalidating the judgment issued; those matters must instead be analyzed as substantive grounds for the appeal filed. Consequently, all claims of nullity raised are rejected in their entirety.
The list of proven facts contained in the challenged decision is upheld because it faithfully reflects the events established in the record, as is the fact identified as unproven.
Having analyzed the grounds raised in the appeal, the arguments of the enforcing party, and the ruling of the enforcement judge, this Collegiate Body finds that the challenged decision must be affirmed for the following reasons: First, it is essential to note that the claimants expressly requested, as relief, that enforcement be ordered of two administrative acts (actos administrativos) that they consider final and favorable, specifically: official letter MUPA-ALC-01-2020, dated 2020-01-06, and the matter contained in article 09 of the Minutes of Ordinary Session number 295, held on 10/12/2019. As to the first of these, it was not attached to the case file processed at first instance, and in these proceedings it was characterized as a merely procedural act (acto de mero trámite) with no material consequences. No specific ground for appeal was raised concerning its non-enforcement or the inability to ascertain its content, as stated by the judge in his decision.
Accordingly, the enforcement analysis is limited to the second act, corresponding to Article 09 of the Minutes of Ordinary Session number 295, held on 10 de diciembre 2019. In this regard, this Chamber finds that the lower court’s decision accords with the law for the following reasons: To better understand the ultimate ruling, it is essential to clarify the background and content of the decision issued by the Concejo Municipal in the referenced act contained in article 09 of the Ordinary Session. The record shows that Municipal Mayor Laura Morales Brenes brought Official Letter MUPA-ALC-947-2019 to the attention of the Concejo Municipal. That letter presented report N° MUPA-UTGYVM-615-2019, submitted by the Internal Commission appointed by her Office and known as the Unidad Técnica de Gestión Vial Municipal to address the case known as la Luisiana. That body, in turn, relied on the opinion expressed by geologist Allan Astorga Gättgens in the report entitled “River Dynamics of the Río Reventazón Orosí” (“Dinámica Fluvial del Río Reventazón Orosí”).
In summary, the expert stated that this watershed (cuenca hidrográfica) covers more than 400 square kilometers, with more than 80% of its territory in mountainous areas experiencing high levels of annual precipitation. He described the river’s flow, its rocky nature, and the steep gradients that increase the erosive power of the river system. He then described the braided system (sistema trenzado) of the Río Reventazón-Orosi, which, he stated, extends for more than 10 kilometers from the Tapantí sector to its “mouth” at the Cachí reservoir. He concluded that sedimentation and erosion in the interwoven system are controlled by the changing dynamics of the channels and riverbeds, which in turn result from periodic flooding and the substantial sediment contribution originating in the upper reaches. He added that the results of the hydrological, sedimentological, and vulnerability analyses concerning different types of natural hazards, conducted in the area over the past 08 years, “(…) consistently conclude that the lateral migration of the left bank of the Río Reventazón in the Nombre162659 sector is the result of natural processes associated with river dynamics and not of human intervention, such as the construction of dikes on the right bank or mining extraction (…) The environmental zone in which the properties that are the subject of the claim are partially located, Zone I-B, officially designated by the Secretaria Técnica Nacional Ambiental through resolution 1308-2009 SETENA, is an environmental zone that is highly vulnerable to flooding and river erosion processes, with restrictions on human activities associated with the development of infrastructure works, and permits only forest areas or crops or livestock farming subject to conditions, or extractive mining activity, provided that its design contributes to reducing vulnerability (…)”.
(See images 70-71 of the principal electronic case file). In light of the situation studied, the expert recommended that the following measures be taken: “1. (…), that a sedimentological design and control program be implemented for mining extraction activities that may be carried out or are being carried out in the channel of the Río Reventazón-Orosí, in order to fulfill a dual-purpose extraction plan involving the production of high-quality aggregates and environmental prevention and preventive risk management. 2. It is highly important that the design and construction of protective works, such as dikes or dredging, take into account the results of these river-dynamics studies, (…). 3. (…), that the provisions of the Plan Regulador of the canton of Paraíso for the major riverbed zone of the Río Orosí (environmental zone 1-B) be strictly applied in order to prevent the development of new construction activities in the area and to establish (sic) a preventive risk-management and corrective plan for existing infrastructure works in that area. 4.
It is highly advisable to develop a Preventive Risk Management Plan for the upper reaches of the Río Reventazón-Orosí that considers the possibility of a major flooding event.” (See image 71 of the principal electronic case file). As a result of this report, the Unidad Técnica de Gestión Vial Municipal decided: “Por tanto, it is resolved: To comply with the study’s recommendations, the most economically viable option for the municipality being to acquire the land and devote it to reforestation and restoration, thereby creating a biological corridor in the sector. To assess the possibility of carrying out controlled extraction of material to permit sediment control as an environmental preventive measure, and using such material in municipal works.” (See image 71 of the principal electronic case file; emphasis added). After reviewing the report and its recommendations, the Concejo Municipal de Paraíso unanimously resolved: “(…)1- IT IS UNANIMOUSLY RESOLVED TO WAIVE COMMITTEE REVIEW OF OFFICIAL LETTER MUPA-ALC-947- 2019.
RESOLUTION FINAL AND DEFINITIVELY APPROVED. / 2-IT IS RESOLVED TO APPROVE THE REPORT IN OFFICIAL LETTER MUPA-ALC-947-2019, SUBMITTED BY THE MUNICIPAL MAYOR REGARDING OFFICIAL REPORT N°MUPA-UTGVNI-61 5-2019, FORWARDED BY THE INTERNAL COMMISSION APPOINTED BY THE OFFICE OF THE MUNICIPAL MAYOR TO ADDRESS THE CASE KNOWN AS Nombre162659. NOTICE SHALL BE GIVEN. RESOLUTION FINAL AND DEFINITIVELY APPROVED. / 3-IT IS UNANIMOUSLY RESOLVED TO RECOMMEND THAT THE MUNICIPAL ADMINISTRATION ATTACH DETAILS OF THE COSTS PER SQUARE METER ACCORDING TO THE STUDY CONDUCTED BY THE APPRAISER, NOTICE SHALL BE GIVEN. RESOLUTION FINAL AND DEFINITIVELY APPROVED. / 4- IT IS UNANIMOUSLY RESOLVED TO REQUEST THAT THE MUNICIPAL ADMINISTRATION PROVIDE A JOINT RESPONSE FROM THE CONCEJO MUNICIPAL AND THE ADMINISTRATION TO THE SALA CONSTITUCIONAL, GIVEN THAT TO DATE THIS CONCEJO MUNICIPAL DOES NOT HAVE A MALE OR FEMALE LEGAL ADVISER.
NOTICE SHALL BE GIVEN. RESOLUTION FINAL AND DEFINITIVELY APPROVED.” (Images 71-72 of the principal electronic case file; transcribed in uppercase because it was recorded that way in the resolution; emphasis added).
VIII.From what was reviewed in the preceding section, it is clear to this Collegiate Body (Órgano Colegiado) that, although it may be concluded that the act sought to be enforced in these proceedings is final, it is also true that it does not provide for the performance of specific administrative conduct favorable to the current claimants, who state that they are the owners of the land or properties that could eventually be subject to expropriation (expropiación) for reasons of public utility. It should be noted, as the a quo has indicated, that this is an act of a general nature insofar as its content describes the technical criterion regarding the “Dinámica Fluvial del Río Reventazón Orosí”; recommendations are made both by the geologist who prepared the report and by the Unidad Técnica de Gestión Vial Municipal, which deemed the most economically viable option for the municipality to be the acquisition of the land in the disputed area and its allocation to reforestation and restoration, thereby creating a biological corridor (corredor biológico) in the sector.
The Concejo Municipal even recommended attaching the unit value per square meter of the properties to be acquired. However, the act as a whole completely omits the identification of the owners and the designation of the parcels (fundos) eligible for total or partial acquisition by the municipal entity should the project to create a biological corridor in the Luisiana area be carried out. This prevents establishing a duty to enforce the act in question for the benefit of the current appellants; this does not entail, as the appellant construes it, assuming the position of the active administration (administración activa) by directing how it must issue its decisions, but rather examining the content of the act in order to compare it with sections 228 of the Ley General de Administración Pública and 176 of the Code governing this matter. An act enforced pursuant to Title VIII, Enforcement of Judgments (Ejecución de Sentencias), Chapter I, must necessarily establish, in favor of the private party (administrado), the Administration’s performance of specific conduct, such that the adjudicating judge does not require further information or additional evidence in order to compel compliance through the coercive mechanisms provided for in the relevant chapter, including, in the event of noncompliance, civil, disciplinary, and criminal liability, as well as an order to pay a fine of five base salaries—sections 158 and 159 of the Code governing this matter.
It bears repeating that, due to the inherently coercive nature of judgment-enforcement proceedings (vía de ejecución de sentencia), to which the legislature referred the mandatory enforcement of final and favorable administrative acts (actos administrativos), it is essential that the underlying enforceable instrument (título base)—the certification of the act—require the performance of specific and direct conduct in favor of the private party; any contrary interpretation would undermine the nature of the provisions cited. In this case, the specific location of the properties within the disputed area is unknown, assuming that they are located in Luisiana; it is also unknown whether their partial or total expropriation is necessary. Moreover, a budgetary appropriation (contenido presupuestario) would be required, and there is likewise no evidence that one exists, as well as, of course, a declaration of public interest (declaratoria de interés público) regarding the assets affected by the territorial entity’s decision, should the power of expropriation ultimately be exercised.
In any event, even after a declaration of public interest has been issued, that decision may be reversed or modified by the expropriating Administration in administrative or judicial proceedings, all pursuant to the Ley de Expropiaciones—N° 7495 del 03 de mayo de 1995 and its amendments. The information identified above is basic and essential for determining whether the act was in fact favorable to the current appellants; the general nature of the administrative agreement (acuerdo administrativo) prevents the enforcement requested in these proceedings from being ordered. For the reasons stated, the appeal must be denied and, consequently, the decision under review shall be affirmed.
POR TANTO:
The motion for nullity (gestión de nulidad) filed by the claimants’ representative is denied. As to the matters appealed, the challenged decision issued by Trial Court Enforcement Judge J. Martín Conejo Cantillo, resolución N°305-2021 de las 11:05 horas del 12 de agosto de dos mil veintiuno, is affirmed. Notice shall be given. Yazmín Aragón Cambronero. Hubert Fernández Argüello. TRIBUNAL N°448-2021-I TRIBUNAL DE APELACIONES DE LO CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA. SECCIÓN PRIMERA. II CIRCUITO JUDICIAL DE SAN JOSÉ. ANEXO A. Goicoechea, a las nueve horas y cincuenta minutos del catorce de diciembre dos mil veintiuno.- Recurso de apelación con nulidad absoluta, interpuesto dentro de proceso de ejecución de acto firme y favorable, tramitado ante el Tribunal de lo Contencioso Administrativo y Civil de Hacienda, bajo la carpeta N°20-5180-1027-CA, por: Nombre162657 , cédula de identidad número CED22308; Nombre16866 , cédula de identidad número CED22309; INVERSIONES E INMOBILIARIA FAMZELATA S.A., cédula jurídica número CED22310; representada por el señor Nombre27411 , cédula de identidad número CED22311; CORPORACION AGROCOMERCIAL COTO HIDALGO S.A., cédula jurídica número CED22312; representada por Nombre27412 , cédula de identidad número CED22313; Nombre162658 , cédula CED22314 y Nombre161189 , cédula de identidad número CED22315, contra: la MUNICIPALIDAD DE PARAÍSO, que no ha respondido a la audiencia conferida. Previa deliberación y por unanimidad, el Tribunal resuelve:
Redacta la Jueza Yazmín Aragón Cambronero, y,
CONSIDERANDO:
I).- En el presente proceso de ejecución de acto firme y favorable, el representante de los accionantes, requirió: “1. Solicitamos respetuosamente al Juez de Ejecución que se condene a la Municipalidad de Paraíso, ordenándose cumplir en forma inmediata la Ejecución Judicial del Acto Administrativo firme dictado por la Municipalidad de Paraíso mediante la resolución administrativa contenida en el oficio MUPA-ALC-01-2020, con fecha 2020-01-06 y en el Acta de la Sesión Ordinaria número 295 del día 10/12/2019, Artículo 09, que se encuentra en el Tomo 45, custodiada en el Departamento de la Secretaría del Concejo Municipal. / 2. Que se condene al pago de las costas de esta Ejecución judicial del acto administrativo firme” (img. 2-7). Debidamente notificada de la existencia de ello, la parte demandada no formuló oposición a lo pretendido.
II.Luego del trámite de rigor, el Juez Ejecutor del Tribunal de Instancia, José Martín Conejo Cantillo, mediante resolución N°305-2021 de las 11:05 horas del 12 de agosto de dos mil veintiuno, resolvió:
"(...)Se declara SIN LUGAR en todos sus extremos la ejecución de acto administrativo firme y favorable, presentada por Nombre162657 , cédula de identidad número CED22308; Nombre16866 , cédula de identidad número CED22309; INVERSIONES E INMOBILIARIA FAMZELATA S.A., cédula jurídica número CED22310; CORPORACION AGROCOMERCIAL COTO HIDALGO S.A., cédula jurídica número CED22312; Nombre162658 , cédula CED22314 y Nombre161189 , cédula de identidad número CED22315, en contra la MUNICIPALIDAD DE PARAÍSO. Sin especial condena en costas.. (...)".
Inconforme con lo decidido, el representante de la parte actora, apeló en tiempo y forma. Recurso admitido, se confirió audiencia sobre los agravios formulados, la cual no fue atendida por la accionada, luego de lo cual, resuelve este órgano colegiado en alzada.
III).- AGRAVIOS DEL EJECUTANTE: El señor representante de los accionantes, se muestra inconforme con lo resuelto, mediante escrito recibido en estrados judiciales el 23 de agosto del 2021, expuso los siguientes agravios: 1.- Indebida interpretación y falta de aplicación de normas: Advierte, el juez de instancia, violentó los numerales 176 del Código Procesal Contencioso Administrativo y 228 de la Ley General de la Administración Pública, al no aplicar y menos interpretar, adecuadamente esas normas y la Jurisprudencia de la Sala I de la Corte Suprema de Justicia y de la Sección I de este Tribunal de Alzada. Luego de transcribir el considerando VI de la resolución recurrida, concluye, el a quo se enredó en forma indebida con alegatos que estima innecesarios en este tipo de procesos, al señalar que si la Municipalidad no contestó la demanda, no se aplica el artículo 65 del Código que rige la materia, tesis disconforme con el Ordenamiento Jurídico -norma de referencia en concordancia con los cánones 39 y 3.4 del Código Procesal Civil-.
Aduce, el juzgador comete otro yerro jurídico, al analizar el oficio MUPA-ALC-01-2020, de fecha 06 de junio del 2020, correspondiente a un acto preparatorio sin relevancia para la ejecución del acto firme y favorable, contenido en el acta de la Sesión Ordinaria N°295 del 10 de diciembre del 2019, en la cual se dispuso: “(…) Por tanto, se acuerda, acatar las recomendaciones del estudio siendo la opción económica más viable para la Municipalidad, adquirir los terrenos y destinarlos a reforestación y recuperación, generando un corredor biológico en el sector (…)”, confirmada en acta de la Sesión Ordinaria N°296 del 17 de diciembre de 2019, ratificada y en firme. Asegura, el juez no cumplió con las normas referidas, al partir de apreciaciones subjetivas, no jurídicas, y considerar, por ejemplo, que era necesario que en la resolución administrativa, se hubiere indicado las personas a las que se le iban a adquirir o expropiar sus fincas; dice, al no realizar el examen adecuado, quebrantó los principios pro libertate y pro homine, meollo de la doctrina de los Derechos Humanos, agrega, según el primero, debe interpretarse extensivamente todo lo que favorezca y restrictivamente todo lo que limite la propiedad; según el segundo, el derecho debe interpretarse y aplicarse siempre de la manera que más favorezca al ser humano.
Insiste, el a quo se distrae en realizar afirmaciones incoherentes, de como debe ser el acto administrativo firme que dictó el Concejo Municipal, pretendiendo sustituir a la Administración, lo que no está permitido por el Ordenamiento Jurídico, pues su labor, es hacer cumplir los términos señalados en el acto administrativo, al no realizar un análisis adecuado de lo dispuesto en este, se confundió al afirmar, que lo acordado por el Concejo, fue una orden genérica. Advierte, el juzgador irrespetó el Debido Proceso y su derecho de Defensa -artículos 39 y 41 de la Constitución Política, 08 y 25 de la Convención Americana de Derechos Humanos-, lo que sanciona el Derecho Procesal bajo pena de nulidad absoluta. Agrega, otro yerro en el que incurrió el a quo, consistió en afirmar que no es una ejecución judicial el acto administrativo firme que se ejecuta y que es propio de un proceso de conocimiento, lo cual contraviene la jurisprudencia de la Sala Constitucional, invoca en su apoyo el artículo 13 de la Ley de la Jurisdicción Constitucional y el Voto N°2017-8852, de las 09:15 horas del 14 de junio del 2017 -el cual transcribe parcialmente-.
Solicita, con sustento en lo expuesto, se revoque o anule la resolución recurrida y se acoja en todos sus extremos la ejecución planteada. Agravio 2: Falta de motivación y fundamentación de la sentencia: Asegura, la resolución impugnada, es escueta y sin razonamiento adecuado, en violación al artículo 57 del Código Procesal Contencioso Administrativo. Dice, contrario a lo resuelto, sí se logró acreditar que el acto administrativo que se solicita ejecutar, otorgó una situación jurídica favorable a los actores, resalta, la demanda goza de una presunción de veracidad, no existe elemento alguno en el expediente judicial que la desacredite, en ubicar las propiedades de los actores en Nombre162659 de Ujarrás del cantón de Paraíso, y además, no se trata de una orden genérica, como fue mal interpretado por el juzgador, pues se infiere de la prueba aportada la ubicación de las fincas; reprocha la violación de los artículos 82 del CPCA y 41.1, .2. y .3 del Código de Rito, pues si la Municipalidad no contestó la demanda y existe prueba en el expediente que acredita la legitimación de los actores, no logra entender, porque se resuelve no existe una situación jurídica favorable a los actores, interpela, se incurre en incongruencias, incoherencias y contradicciones, en la resolución apelada.
En lo que se refiere a la valoración de la prueba, invoca en su apoyo, el voto N°1739-92 de la Sala Constitucional de la Corte Suprema de Justicia, resaltando que todas las sentencias deben ser claras, precisas, congruentes y fundamentadas; en el presente caso, concluye, lo resuelto es contradictorio y confuso, además, desnaturalizó el esquema procesal relativo a la carga de la prueba, lo cual violenta la tutela judicial efectiva como parte fundamental del derecho a la justicia y el debido proceso. Aduce, lo realizado por el juzgador fue una transcripción de información, pero no fundamentó o motivó. Insiste, a la luz de los artículos 176 del CPCA y 228 de la Ley General de la Administración Pública, lo considerado por el juzgador no es válido, carece de una argumentación adecuada, se limitó a indicar que es una orden genérica de la Administración Municipal, pero no expresó la razón por la que llegó a esa conclusión, máxime que en el expediente judicial, existen elementos fácticos, jurídicos y probatorios, que descalifican la tesis del juzgador, dice, las razones deben ser justas y objetivas, de otro modo, la resolución es arbitraria y por ello nula.
Solicita se declare la nulidad absoluta de lo resuelto y se ordene el reenvío, por ser evidente el vicio reprochado. Agravio 3: Violación a las reglas de la sana crítica, por falta de fundamentación: Agravia, la resolución es confusa y contradictoria, obstáculos que impiden determinar los motivos que sirvieron de base para el rechazo de su pretensión, lo que es contrario a la tutela judicial efectiva, su argumento es superficial, y asegura no cumple con los requisitos de fundamentación, pues no da en forma adecuada las explicaciones fácticas, jurídicas y probatorias para denegar la pretensión, existe una insuficiente motivación y fundamentación e indebida valoración de las normas jurídicas; al constatarse el vicio, lo procedente es revocar lo resuelto, para en su lugar acoger la demanda. Explica, el juez ejecutor se niega a ejecutar el acto administrativo firme y favorable, en contra de lo dispuesto en el referido numeral 176 del CPCA, teniendo la obligación legal y constitucional de ejecutarlo, poniendo por excusa que se trata de una declaración genérica, cosa que no lo es, pues en el hecho que tuvo por probado, detalló y especificó en que consiste el acto administrativo firme dictado por el Concejo Municipal, sin embargo, en la explicación resuelve diferente.
Aduce, el proceso previsto en el artículo 176 del CPCA, surge como una respuesta ante la inercia o negligencia administrativa de ejecutar sus propios actos favorables al administrado, lo cual, parece dejar sin efecto el juzgador remitiendo a las partes a un proceso de conocimiento. Solicita se declare con lugar el recurso de apelación y nulidad absoluta, pide se revoque lo resuelto se acoja la pretensión esgrimida, incluyendo la condenatoria en costas para la demandada; o en su lugar se anule, por falta de motivación y fundamentación.
De previo a resolver lo que en derecho corresponda y dada su trascendencia en la resolución del recurso, resulta necesario transcribir, en lo que resulta de interés, lo considerado por el Juzgador de instancia, en la resolución que hoy se impugna, así definió:
“(…) II. HECHOS PROBADOS. De importancia para el dictado de la sentencia, se tienen los siguientes: 1. En el artículo 9 de la sesión ordinaria número 295-2019, del 10 de diciembre de 2019, el Concejo Municipal de Paraíso conoció el oficio MUPA-ALC-947-2019, del 10 de diciembre 2019 suscrito por la Alcaldesa Municipal, referido al Informe No. MUPA-UTGVM-615-2019, remitido por la Comisión Interna nombrada por el Despacho de la Alcaldesa Municipal para atender el caso conocido como La Luisiana. Dicho documento es transcrito en el acta de la sesión que finalmente consignó como acuerdos: “Por tanto, se acuerda: / Acatar las recomendaciones del estudio siendo la opción económica más viable para la municipalidad, adquirir los terrenos y destinarlos a reforestación y recuperación, generando un corredor biológico en el sector. / Valorar la posibilidad de realizar la extracción controlada de material que permita el control de los sedimentos como medida de prevención ambiental, y la utilización de los mismos en obras municipales. [No queda claro si estos dos aspectos son propios del acto transcrito o si también son acuerdos del Concejo, porque no están consignados de la misma forma que los otros acuerdos] / 1- SE ACUERDA POR UNANIMIDAD DISPENSAR DE TRAMITE DE COMISIÓN EL OFICIO MUPA-ALC-947- 2019.
ACUERDO EN FIRME Y DEFINITIVAMENTE APROBADO. / 2-SE ACUERDA APROBAR EL INFORME OFICIO MUPA-ALC-947-2019, PRESENTADO POR LA ALCALDESA MUNICIPAL REFERENTE AL OFICIO INFORME N°MUPA-UTGVNI-61 5-2019 REMITIDO POR LA COMISIÓN INTERNA NOMBRADA POR EL DESPACHO DE LA ALCALDESA MUNICIPAL PARA ATENDER EL CASO CONOCIDO COMO LA Nombre162659. COMUNÍQUESE. ACUERDO EN FIRME Y DEFINITIVAMENTE APROBADO. / 3-SE ACUERDA POR UNANIMIDAD RECOMENDAR A LA ADMINISTRACIÓN MUNICIPAL ANEXAR DETALLES DE LOS COSTOS DE CADA METRO CUADRADO SEGÚN EL ESTUDIO LLEVADO A CABO POR EL PERITO VALUADOR, COMUNIQUESE. ACUERDO EN FIRME Y DEFINITIVAMENTE APROBADO. / 4-SE ACUERDA POR UNANIMIDAD SOLICITAR A LA ADMINISTRACIÓN MUNICIPAL DAR RESPUESTA EN FORMA CONJUNTA CONCEJO MUNICIPAL Y ADMINISTRACIÓN A LA SALA CONSTITUCIONAL DADO A QUE A LA FECHA ESTE CONCEJO MUNICIPAL NO CUENTA CON UN ASESOR o ASERORA LEGAL. COMUNÍQUESE. ACUERDO EN FIRME Y DEFINITIVAMENTE APROBADO” (img. 37-41).
De relevancia para este caso, se tiene: 1. La existencia o el contenido del oficio MUPA-ALC-01-2020, con fecha 6 de enero de 2020.
ARGUMENTOS DE LAS PARTES. En síntesis, la parte busca la ejecución de la resolución administrativa contenida en el oficio MUPA-ALC-01-2020, con fecha 2020-01-06 y en el Acta de la Sesión Ordinaria número 295 del día 10/12/2019, Artículo 09. En defensa de sus intereses, la parte indicó que ante la ausencia de respuesta por parte de la Municipalidad, debían tenerse por ciertos los hechos. Además, en su escrito inicial citó artículos de la Ley General de la Administración Pública (LGAP) y del CPCA e hizo referencia a doctrina nacional sobre el proceso de acto administrativo firme y favorable. La Municipalidad de Paraíso no hizo referencia a la audiencia concedida. (…).
De previo a analizar los actos que se pide ejecutar, es necesario analizar las consecuencias de que la Municipalidad no haya contestado el emplazamiento concedido. Aunque la parte no hace referencia a un artículo concreto para justificar su indicación, su alegato tiene un contenido similar a lo dispuesto en el artículo 65 CPCA, en el sentido de que ante la ausencia de responder al emplazamiento, se tendrán por ciertos los hechos. Ahora bien, considera este Juzgador que no es posible aplicar dicha norma pues no estamos frente a un proceso de conocimiento, sino a uno de ejecución, en el que la obligación de verificar el cumplimiento de los requisitos dispuestos en el artículo 176 CPCA no se ve enervada por la falta de respuesta municipal, de conformidad con el artículo 155.2 CPCA. En ese sentido, este Juzgador siempre tiene el encargo de verificar si los actos que la parte pide ejecutar y la forma o modo en que los pide es conforme al artículo indicado, sin poder presumir o aceptar sin cuestionamiento las afirmaciones hechas por la parte actora en sus escritos.
A fin de realizar el análisis en el presente asunto, se procederá a revisar el cumplimiento de los requisitos para cada uno de los dos actos que solicita ejecutar la parte actora. 1. El oficio MUPA-ALC-01-2020, con fecha 2020-01-06. Según se verifica en el hecho no probado 1, este Juzgador no pudo hallar en la prueba presentada por la parte actora el oficio mencionado, con lo que no se puede verificar si tiene el mismo contenido del acuerdo del Concejo Municipal, si es el oficio mediante el cual se comunica el acuerdo del Concejo o si tiene un contenido diverso. Ante tal circunstancia, se debe rechazar la gestión de la parte de ejecutar este oficio al no constar en el expediente su contenido, lo que impide el análisis de los requisitos dispuestos en el artículo 176 CPCA. 2. El artículo 09 del Acta de la Sesión Ordinaria número 295 del día 10/12/2019. Como se reseñó previamente, este acto del Consejo Municipal conoce un oficio remitido por la Alcaldía Municipal, que a su vez hace referencia a un informe y recomendaciones rendidos por una comisión nombrada para analizar lo que se denominó caso La Luisiana.
Dicho informe señaló una serie de recomendaciones técnicas en cuando al cauce del río Reventazón – Orosí y a la posibilidad de inundaciones, recomendando la adquisición de terrenos y dedicarlos a fines de reforestación y recuperación. Resulta de particular importancia para este Juzgador que en dicho documento, y por consiguiente, en el acuerdo tomado por el Consejo, no se hace una indicación concreta de cuáles son los terrenos que se recomienda expropiar o adquirir ni a cuáles munícipes afectaría la decisión que se toma, o los hallazgos y recomendaciones técnicas incorporadas. No hay tampoco ningún esfuerzo probatorio de la parte actora por acreditar cómo se vinculan los terrenos de los actores con la situación jurídica narrada en el acuerdo municipal o cómo les afectaría la decisión de compra de terrenos. Tal y como se dijo anteriormente, uno de los requisitos esenciales establecidos en el artículo 176 CPC, es que el acto cuya ejecución se solicita debe contener una declaración específica a favor de una persona o un conjunto de personas identificadas de un derecho en concreto, determinado en el tiempo y en el espacio, y no una declaración genérica que requiera posterior análisis o elaboración administrativa, pues a fin de cuentas, el acto firme y favorable debe comportarse similar a un título ejecutivo, en el sentido de que su contenido debe ser suficiente para la ejecución, pues de otra forma, se requeriría de un análisis propio de un proceso de conocimiento.
En este caso, no contiene el acto del Concejo Municipal, como ya se dijo, indicación alguna de cuáles propiedades podrían verse afectadas con la decisión de adquirir terrenos, ni establece una orden concreta a la Administración en este sentido. Así, no puede acreditar este Juzgador que la decisión que se busca ejecutar otorgue una situación jurídica favorable a los actores, porque lo que se da es una orden genérica a la Administración Municipal de proceder en determinado sentido, lo cual es muy distinto a lo que exige el artículo en cuestión. En este sentido, también se rechaza la ejecución de este segundo acto. VII. COSTAS. En cuanto a las costas por la fase de ejecución, para este Juzgador este extremo debe rechazarse a partir de la jurisprudencia emanada por la Sala Primera de la Corte (ver al respecto la resolución 1400-A-S1-2015, de las 9:35 horas del 10 de diciembre, entre muchas otras).
En esta resolución, la Sala señala la existencia de una línea jurisprudencial en la que estableció que las resoluciones que deciden sobre liquidaciones de costas son meros autos, y en consecuencia no tienen recurso de casación. Asimismo, la Sala extiende ese parámetro a los autos en los que se hacen liquidaciones de intereses, y después también a aquellos en los que se liquidan daños y perjuicios. Señala la Sala que en estos casos el auto de ejecución no decidió sobre la existencia de los daños, tema que se decidió en la sentencia que se ejecuta, sino que únicamente establece el monto de lo indemnizado. Si la resolución en la que se resuelve una liquidación de costas es un auto, de conformidad con las reglas del artículo 193 CPCA no es posible condenar al pago de costas en ejecución en esta sede, pues la condena al pago de costas en esta jurisdicción sólo puede darse en las sentencias y en los autos con carácter de sentencia. En consecuencia de lo anterior, se deniega el reconocimiento de costas (…)”.
V.El representante de la parte actora, en sus agravios, acusa la nulidad de la resolución recurrida, en resumen, por los siguientes motivos: falta de fundamentación o , indebida apreciación del cuadro fáctico y jurídico, violación a su Derecho de Defensa y Debido Proceso, ello por cuanto, adujo, se trata de una resolución que no analizó adecuadamente la situación jurídica debatida a la luz de los numerales 176 del Código Procesal Contencioso Administrativo y 228 de la Ley General de la Administración Pública. Estima esta Cámara, los reproches de nulidad formulados, no resultan de recibo, en razón, de lo siguiente: La lectura detenida de la resolución recurrida, permite concluir la misma cumple con el deber de fundamentación establecido en el numeral 57 del Código que rige la materia, además resulta clara y congruente en su contenido. Nótese, el juzgador luego de establecer el marco fáctico sobre el cual descansan sus consideraciones de fondo, señaló, que aún ante la falta de contestación de la demanda por parte de la Municipalidad de Paraíso, resultaba necesario realizar el análisis del acto cuya ejecución se pretende, esto conforme a las potestades que le confiere el artículo 155.2 del Código que rige la materia.
Analizó cada uno de los actos, en cuanto al oficio MUPA-ALC-01-2020, de fecha 2020-01-06, hizo ver que el mismo no fue posible localizarlo dentro de la prueba aportada, por lo que no resultaba viable establecer su contenido, a efecto de confrontarlo con lo dispuesto en el artículo 176 del citado cuerpo normativo. Por su parte, lo relativo al contenido en el artículo 09 del Acta de la Sesión Ordinaria número 295 del día 10 de diciembre de 2019, analizó su contenido, señaló las razones que impedían acceder a lo pretendido, en concreto estimó: Este no incluye, indicación alguna de cuáles propiedades podrían verse afectadas con la decisión de adquirir terrenos, ni tampoco una orden concreta a la Administración en este sentido. Adujo, su imposibilidad, como juzgador, para acreditar que la decisión otorgue una situación jurídica favorable a los actores, porque lo dispuesto corresponde a una orden genérica a la Administración Municipal, para proceder en determinado sentido, lo cual es muy distinto a lo que exige el numeral 176 de cita, resaltando, que el acto cuya ejecución se solicita debe contener una declaración específica a favor de una persona o un conjunto de personas identificadas de un derecho en concreto, determinado en el tiempo y en el espacio, y no una declaración genérica que requiera posterior análisis o elaboración administrativa, asimilándolo a un título ejecutivo, en el sentido de que su contenido debe ser suficiente para la ejecución, pues de otra forma, se requeriría de un análisis propio de un proceso de conocimiento.
Las diferentes consideraciones contenidas en el fallo, se insiste, resultan comprensibles y congruentes con su parte dispositiva; tanto así que al propio recurrente, le fue posible realizar los agravios de fondo que expuso en su oportunidad, lo que le ha garantizado su derecho de defensa en forma plena, aún y cuando, es claro no se encuentra conforme con lo decidido, ello no tiene la fuerza para anularlo; así como tampoco constituye una causa de invalidez de la sentencia dictada, la interpretación -calificada como incorrecta por el agraviado- efectuada por el a quo, a los numerales 176 del Código que rige la materia y el 228 de la Ley General de la Administración Pública, aspectos que corresponde analizar como motivos de fondo del recurso formulado. En consecuencia, se rechazan en su totalidad los agravios de nulidad formulados.
Se avala el elenco de hechos probados contenido en la resolución impugnada, por ser fiel reflejo de lo acontecido en autos, así como el consignado como no probado.
Analizados los agravios formulados en el recurso, los argumentos de la parte ejecutante, así como lo resuelto por el juez ejecutor, este Órgano Colegiado, estima la resolución impugnada deberá confirmarse en razón de lo siguiente: En primer término, resulta indispensable señalar, los accionantes expresamente solicitaron en su pretensión, se ordene la ejecución de dos actos administrativos, que estiman firmes y favorables, en concreto: al oficio MUPA-ALC-01-2020, de fecha 2020-01-06, y el contenido en el artículo 09 del Acta de la Sesión Ordinaria número 295 del día 10/12/2019. En cuanto al primero de ellos, no se adjuntó al expediente tramitado en primera instancia, y en esta vía se calificó como un acto de mero trámite sin consecuencias materiales, no se realizó un agravio concreto relacionado con su falta de ejecución o la imposibilidad de conocer su contenido, externada por el juzgador en su resolución, es por ello que se concreta el análisis de la ejecución al segundo de los actos, correspondiente al Artículo 09 del Acta de la Sesión Ordinaria número 295 del día 10 de diciembre 2019 y en este sentido, estima esta Cámara, lo resuelto por el a quo, se encuentra conforme a derecho, en razón de lo siguiente: Para una mejor comprensión de lo que en definitiva se resuelva, resulta indispensable aclarar los antecedentes y el contenido de la resolución emitida por el Concejo Municipal, en el acto de referencia contenido en el artículo 09 de la Sesión Ordinaria; así se tiene que según se desprende de los autos, la señora Alcaldesa Municipal Laura Morales Brenes, puso en conocimiento del Concejo Municipal, el Oficio MUPA-ALC-947-2019, en el que se presentó el informe N° MUPA-UTGYVM-615-2019, remitido por la Comisión Interna nombrada por su Despacho denominada Unidad Técnica de Gestión Vial Municipal, para atender el caso conocido como la Luisiana, Órgano que a su vez se basó en el criterio expuesto por el doctor en geología Allan Astorga Gättgens, en el informe denominado “Dinámica Fluvial del Río Reventazón Orosí”.
El experto, indicó en resumen, esta cuenca hidrográfica es de más de 400 kilómetros cuadrados, con más del 80% del territorio en zona montañosa, con altos niveles de precipitación anual, describió el caudal del río, su naturaleza rocosa y pendientes altas que aumentan el poder erosivo del sistema fluvial; luego describió el sistema trenzado del Río Reventazón-Orosi, el cual dijo, se extiende por más de 10 kilómetros desde el sector de Tapantí, hasta su “desembocadura” en el embalse de Cachí, concluye, que el control de sedimentación y erosión del sistema entrelazado, lo genera la dinámica cambiante de los canales y de los lechos, originados a su vez por las crecidas periódicas y el gran aporte de sedimento producido en las partes altas. Adicionó, los resultados de los análisis hidrológicos, sedimentológicos y de vulnerabilidad a diferentes tipos de amenazas naturales, realizados en los últimos 08 años en la zona, “(…) son coincidentes en concluir que el proceso de migración lateral del margen izquierdo del Río Reventazón en el sector de la Nombre162659 es producto de procesos naturales vinculados a la dinámica fluvial y no a procesos de intervención humana, como la construcción de diques en la margen derecha o la extracción minera (…) La zona ambiental en la que se localizan parcialmente las fincas objeto de la demanda, la Zona I-B, oficializada por la Secretaria Técnica Nacional Ambiental, mediante resolución 1308-2009 SETENA, es una zona ambiental altamente vulnerable a los procesos de inundación y erosión fluvial, con restricciones a las actividades humanas vinculadas al desarrollo de obras de infraestructura y que solamente permite el desarrollo de áreas de bosque o de cultivos o ganadería bajo condiciones, o bien, la actividad minera extractiva siempre que su diseño favorezca el proceso de disminución de la vulnerabilidad (…) ”.
(Así imágenes 70-71 del expediente electrónico principal). El experto recomendó ante la situación estudiada, tomar las siguientes medidas: “ 1. (…), se realice un diseño y control sedimentológico de las extracciones mineras que se puedan desarrollar o se desarrollen en el cause del Río Reventazón-Orosí, a fin de cumplir un plan de extracción de doble propósito en el ámbito de la producción de agregados de buena calidad y la prevención ambiental y la gestión preventiva del riesgo. 2. Es de gran relevancia que los diseños y construcción de obras de protección, como diques o dragados, tomen en cuenta los resultados de estos estudios de dinámica fluvial, (…). 3. (…), se aplique en forma estricta lo señalado por el Plan Regulador del cantón de Paraíso para la zona del lecho mayor del Río Orosí (zona ambiental 1-B) a fin de que se evite el desarrollo de nuevas actividades constructivas en la zona y se establezcan (sic) plan de gestión preventiva de riesgo y correctivos para las obras de infraestructura existentes en la misma. 4.
Es altamente recomendable que se desarrolle un Plan de Gestión Preventiva de Riesgo para la parte alta del Río Reventazón-Orosí, que considera posibilidad de un gran evento de inundación.” (Así imagen 71 del expediente electrónico principal). Es a raíz de este informe, que la Unidad Técnica de Gestión Vial Municipal, decidió: “Por tanto, se acuerda: Acatar las recomendaciones del estudio siendo la opción económica más viable para la municipalidad, adquirir los terrenos y destinarlos a reforestación y recuperación, generando un corredor biológico en el sector. Valorar la posibilidad de realizar la extracción controlada de material que permita el control de los sedimentos como medida de prevención ambiental, y la utilización de los mismos en obras municipales.” (Así imagen 71 del expediente electrónico principal, énfasis suplido). Al conocer el Concejo Municipal de Paraíso, el informe y sus recomendaciones, por unanimidad acordó: “(…)1- SE ACUERDA POR UNANIMIDAD DISPENSAR DE TRAMITE DE COMISIÓN EL OFICIO MUPA-ALC-947- 2019.
ACUERDO EN FIRME Y DEFINITIVAMENTE APROBADO. / 2-SE ACUERDA APROBAR EL INFORME OFICIO MUPA-ALC-947-2019, PRESENTADO POR LA ALCALDESA MUNICIPAL REFERENTE AL OFICIO INFORME N°MUPA-UTGVNI-61 5-2019 REMITIDO POR LA COMISIÓN INTERNA NOMBRADA POR EL DESPACHO DE LA ALCALDESA MUNICIPAL PARA ATENDER EL CASO CONOCIDO COMO LA Nombre162659. COMUNÍQUESE. ACUERDO EN FIRME Y DEFINITIVAMENTE APROBADO. / 3-SE ACUERDA POR UNANIMIDAD RECOMENDAR A LA ADMINISTRACIÓN MUNICIPAL ANEXAR DETALLES DE LOS COSTOS DE CADA METRO CUADRADO SEGÚN EL ESTUDIO LLEVADO A CABO POR EL PERITO VALUADOR, COMUNIQUESE. COMUNÍQUESE. ACUERDO EN FIRME Y DEFINITIVAMENTE APROBADO”. (Imágenes 71-72 del expediente electrónico principal, se transcribe en mayúscula porque así se consignó en el acuerdo, énfasis suplido).
VIII.De lo reseñado en el apartado anterior, queda claro para este Órgano Colegiado, si bien es posible concluir que el acto que se pretende ejecutar en esta vía, se encuentra firme, es lo cierto, el mismo no contempla el cumplimiento de una conducta administrativa favorable y concreta, para los hoy actores, quienes dicen ser los propietarios de los terrenos o fincas que eventualmente podrían ser objeto de expropiación por razones de utilidad pública. Nótese, tal y como lo ha indicado el a quo, se trata de un acto de naturaleza general, en cuanto a su contenido, describe el criterio técnico de la “Dinámica Fluvial del Río Reventazón Orosí”, se realizan recomendaciones tanto por el geólogo redactor del informe, así como por la Unidad Técnica de Gestión Vial Municipal, quien estimó como la opción económica más viable para la municipalidad, adquirir los terrenos en la zona en conflicto y destinarlos a reforestación y recuperación, generando un corredor biológico en el sector, e incluso se recomendó por parte del Concejo Municipal, anexar el valor unitario del metro cuadrado de las fincas por adquirir.
Sin embargo, del cuerpo total del acto, se encuentra ausente por completo, la identificación de los propietarios y la definición de los fundos susceptibles de ser adquiridos total o parcialmente, por el ente municipal, en caso de concretarse el proyecto de creación de un corredor biológico en la zona de la Luisiana. Lo anterior impide establecer un deber de ejecución del acto en cuestión, a favor de los hoy recurrentes; no se trata, como lo interpreta el recurrente, de tomar la posición de la administración activa indicando la forma en que debe dictar sus resoluciones, sino, de apreciar el contenido del acto a efecto de confrontarlo con los numerales 228 de la Ley General de Administración Pública y 176 del Código que rige la materia. El acto que se ejecuta de conformidad con el Título VIII Ejecución de Sentencias, Capítulo I, debe necesariamente establecer a favor del administrado, el cumplimiento de una conducta concreta por parte de la Administración, de forma tal, que la persona juzgadora, no requiera de mayor información o prueba adicional, a efecto de ordenar el cumplimiento por las vías coercitivas que contempla el capítulo relacionado, incluyendo en caso de incumplimiento, la responsabilidad civil, disciplinaria y penal, así como la condena al pago de una multa a cinco salarios base -numerales 158 y 159 del Código que rige la materia-.
Se insiste, por la naturaleza coactiva propia de la vía de ejecución de sentencia, a la cual el legislador remitió para el cumplimiento obligado de los actos administrativos firmes y favorables, resulta indispensable que el título base -certificación del acto- responda al cumplimiento de una conducta concreta y directa a favor del administrado, lo contrario desnaturaliza lo regulado en las normas de cita. En la especie, se desconoce, la ubicación particular de las fincas dentro de la zona en conflicto, en caso de que estas se ubiquen en la Luisiana, se ignora, si resulta necesaria su expropiación, en forma parcial o total; además, se requerirá de un contenido presupuestario, que tampoco se evidencia exista, y por su puesto la declaratoria de interés público de los bienes afectados por la decisión del ente territorial, si es que finalmente se llega a ejercer la potestad expropiatoria, la que en todo caso, aún con la declaratoria de interés público, puede ser revertida o modificada, por la Administración expropiante, en sede administrativa o jurisdiccional, todo ello de conformidad con la Ley de Expropiaciones -N° 7495 del 03 de mayo de 1995 y sus reformas-.
La información indicada, resulta básica y esencial, para determinar si efectivamente el acto resultaba favorable a los hoy recurrentes; la generalidad del acuerdo administrativo, impide ordenar la ejecución solicitada en esta vía. En razón, de lo expuesto, se debe rechazar el recurso de apelación formulado y en consecuencia se confirmará la resolución venida en alzada.
POR TANTO:
Se rechaza la gestión de nulidad formulada por el representante de los actores. En lo que ha sido objeto de recurso, se confirma la resolución recurrida dictada por el Juez Ejecutor del Tribunal de instancia J. Martín Conejo Cantillo, resolución N°305-2021 de las 11:05 horas del 12 de agosto de dos mil veintiuno. Notifíquese. Yazmín Aragón Cambronero. Hubert Fernández Argüello. Rosa M. Cortés Morales.
