Case No. N°20-002875-1027-CA Decision N°108-2021-II ADMINISTRATIVE AND TAX CIVIL COURT, SECOND SECTION. SECOND JUDICIAL CIRCUIT OF SAN JOSÉ. Goicoechea, at thirteen hours thirty minutes on the twenty-sixth of November, two thousand twenty-one.- Proceedings on the merits (proceso de conocimiento), declared to involve purely questions of law (de puro derecho), brought by [Nombre62 001], identity card number [CED62 ], against the Junta Administrativa del Registro Nacional and the State. Attorneys Solón Armando Murillo Cruz, acting as special judicial attorney-in-fact (apoderado especial judicial) for the plaintiff; Nombre81957, acting as special judicial attorney-in-fact for the Junta; and Gloria Solano Martínez, in her capacity as State Attorney (Procuradora), participate in these proceedings. Following the requisite deliberation, judgment is hereby rendered unanimously.

WHEREAS

II.POSITION OF THE PLAINTIFF.- Counsel for the plaintiff alleges the following: "FIRST: My client acquired by purchase, in 2004, the property recorded in the Heredia Registry District under real property folio (folio real) number [Valor 002], which is described in the attached certification (Documentary Evidence No. 1). Following a series of transactions involving possessory title proceedings (información posesoria), transfers, consolidations, and subdivisions (segregaciones) prior to that acquisition, the property in the Heredia Registry District under real property folio number [Valor 017] was created; it belonged to [Nombre62 004], who sold and transferred it to [Nombre62 005], and the latter subdivided and sold to my client [Nombre62 Placa1088] a parcel measuring one hundred twenty-one thousand ninety meters and eighty-one square decimeters (121.090,81 m2), as shown on registered survey plan (plano catastrado) Number [Valor 003].
That subdivided property was recorded in the Property Registry, Heredia Registry District, under real property folio registration number [Valor Placa704], and is located in [...], canton 1° Heredia, province of Heredia; it consists of pastureland and forest and is bounded by [...]. My client’s property is located at the place known as "[...]". SECOND: The property described above originated from properties recorded in the National Registry since 1896, and the transactions chronologically recorded since then are detailed below: Property Number [Valor 006] was recorded on 23 de marzo de 1896 by order of the Civil Judge of Heredia in response to an application for a possessory title (título posesorio) filed by [Nombre 006] (sic), who, having proven possession through the testimony of two witnesses, together with the opinion of the First Public Prosecutor, stated that he had possessed it in his own Nombre62 for more than TEN YEARS, thereby demonstrating that he had possessed the property since at least two years before Law No. 65 of 30 de julio de 1888 entered into force.
The legal status shown in that document therefore demonstrates that Mr. [Nombre62 006] (sic) acquired that property in 1886, that is, two years before the enactment of the aforementioned law (Documentary Evidence No. 2 from the Administrative File). It should be noted, as a highly significant detail, that the statement of the applicant for the possessory title was duly proven, not only through testimony but also by the opinion of the First Public Prosecutor of Heredia. Accordingly, private possession dates from at least 1886, evidently prior to the entry into force of Law 65. Property [Valor 009] of Volume [Valor 032], Folios [Valor 042], [Valor 043], [Valor 044], and Volume [Valor 045], Folio [Valor 046]. a. Entry [Valor 047]. Property created through the consolidation of Nos. [Valor 007] and [Valor 006] (Documentary Evidence No. 3), owned by [Nombre62 007], and awarded and recorded in the Nombre62 of [Nombre 008] on 14 de junio de 1916 (Documentary Evidence No. 7 from the MINAE Administrative File). b. Entry [Valor 048]. [Nombre62 008] sells said property to [Nombre62 009], and it is recorded on 9 de mayo de 1919. c. Entry [Valor 049]. [Nombre 009] sells the property described to [Nombre 010], and it is entered in the Registry accordingly on 5 de abril de 1920. d. Entry [Valor 050].
Pursuant to a court settlement (arreglo judicial), Mr. [Nombre62 010] sells this property to [Nombre 012] (sic). e. Entry [Valor 012]. While this property was owned by [Nombre 012], according to Entry [Valor 051], the Third Civil Court of Heredia sold it at judicial auction to [Nombre62 013]. f. Entry [Valor 052]. The area of the property is corrected to 6 hectares, 9.190 meters, and 70 decimeters, on 25 de noviembre de 1973. g. Entry [Valor 053]. While this property was owned by [Nombre62 013], it was sold to [Nombre 014], S.A., and the transfer was recorded on 15 de marzo de 1961. h. Marginal Note: On folio [Valor 044] of Volume [Valor 032], there is a marginal note stating: "This property was consolidated into number [Valor 016], folio [Valor 031], volume [Valor 030], by virtue of its sale to [Nombre62 015] and [Nombre62 016]...". Property [Valor 016], Volume [Valor 030], folios [Valor 031], [Valor 042], and [Valor 013].
It should be noted from these documents that none of the Entries contains any indication, whether through a marginal annotation or observation, that any objection was raised against this registration (Documentary Evidence No. 4). Registration 1. It is stated that this is cultivated land with cleared mountain land, its boundaries demarcated and enclosed by four-strand barbed-wire fences built more than forty years earlier. This is the property known as [...], located in [...] de Heredia. Its area is 13 hectares, 729 meters, and 10 square decimeters. It states that the property belongs to the company [Nombre 014], S.A., and that because properties [Valor 009] and [Valor 010] are contiguous, it consolidates them into a single property, thereby creating the property described here, and sells it, together with another property described in an immediately subsequent division, to [Nombre62 015] and [Nombre62 016].
This declaration of intent was recorded in the Registry on 16 de junio de 1962. Registration 2. This is a mortgage registration, which is irrelevant to these proceedings. Registration 3. Folio [Valor 031]. The stated owners assign their rights to the company [Nombre 020], S.A., which may be abbreviated in Spanish as [Nombre 021] S.A. This registry transaction was officially recorded on 20 de junio de 1975. Entry [Valor 050]. Folio [Valor 042]. This is a mortgage cancellation, which is irrelevant to these proceedings. Registration 5. This entry records the sale of said property to the company [Nombre 035], S.A. The same entry states that, once the aforementioned company became the owner of said property, it sold it to [Nombre 022]. S.A. This was recorded in the Registry on 22 de enero de 1981. Registration [Valor 012]. Folio [Valor 013]. This concerns an annotation correcting the text and is irrelevant to this case.
Property [Valor 014]. Owned by [Nombre 023]. It originated from the consolidation of properties [Valor 015] and [Valor 016], as stated in the copy of the public deed (escritura pública) submitted herewith. It measures 66ha 4974m2 with 8dm2. A lot is subdivided and sold to [Nombre62 004]. This subdivided lot, consisting of 13 hectares, is assigned real property folio number [Valor 017]. The remainder of property [Valor 014] measures 53 hectares, 4.974,80 m2. In the deed consolidating the aforementioned properties, at the end of the first folio and its reverse side, the notary adds a reference that the Registry did not record, stating as follows: "...it is hereby placed on record: That this consolidation of properties is subject to a forestry contract (contrato forestal) for the cultivation of alder entered into by [Nombre 024], on behalf of the company [Nombre 025] Anónima, the former owner of the property, and Nombre82147, on behalf of the State, in his capacity as Minister of Agriculture, Livestock, and Finance, whose commencement date was veintidós de octubre de mil novecientos setenta y nueve and whose expiration date is veintidós de octubre de mil novecientos ochenta y nueve.
The undersigned notary advises the appearing party that documents concerning the properties to be consolidated are pending registration." The foregoing observation shows a senior official representing the Costa Rican State entering into a forestry contract with a private person, affecting real property when, pursuant to Law 65, that land had already been in the public domain (dominio público) for more than thirteen decades. It may be inferred, with an extremely high degree of probable certainty and logic, that the minister was unaware of the public-domain nature (naturaleza demanial) of the land in question, but such ignorance resulted from the National Registry’s lack of thoroughness and diligence. (Documentary Evidence No. 5). Property [Valor 017]. The land acquired from [Nombre62 004] was consolidated with other adjacent parcels, which were recorded under this same folio number. Following the consolidation, its area was 130.000,00 m2, according to registered survey plan No. [Valor 019], a certified copy of which is submitted as evidence.
As stated, this property is owned by [Nombre 005]. According to a search by property number in the National Registry, this property has No. [Valor 014] as its predecessor property (Documentary Evidence Nos. 6 and 7). Mr. [Nombre62 005], as owner of property real property folio No. [Valor 017] in the Heredia Registry District, measuring 130.000,00 m2 according to registered survey plan No. [Valor 019], subdivided a lot measuring 121.090,81 m2 according to registered survey plan No. [Valor 003] and sold it to [Nombre62 001]. Property [Valor 002]. A Registry Certification identifies Property [Valor 017] as the predecessor of No. [Valor 002], which measures 121 thousand meters and 81 square decimeters (Documentary Evidence No. 1). THIRD: As previously stated, my client acquired property [Valor 002] through an assignment for consideration (cesión onerosa) in 2003. Before acquiring that property, its registry status was duly verified, as required, and it was determined that the aforementioned property was not subject to any registry annotation or court judgment that would have provided notice of any impediment.
Relying on that verification as trustworthy information, my client acquired the aforementioned property under the protection of the principle of Registry Security (Seguridad Registral), because, as will be seen, each transaction was duly reviewed, authorized, and entered in the National Registry at the relevant time by competent officials, and there were never any grounds—none being recorded in any of the Daily Journal filings (asuntos de Diario)—for the slightest doubt as to the proper registration of the aforementioned property. Accordingly, in 2004, the deed of sale was submitted to the National Public Registry for registration in his name. FOURTH: It was not until 2008, when the property had already been owned for five years, that my client learned of the continued force of an antiquated law and that a judgment had been issued in an amparo proceeding (recurso de amparo), case Number 07-007996-0007-CO, against several State institutions, including the Municipalidad de San Rafael de Heredia and MINAE.
That proceeding alleged violations of several articles of the Political Constitution because, according to the amparo petition, the Empresa de Servicios Públicos de Heredia was promoting the pollution and destruction of protection zones (zonas de protección) by installing electrical grids for the private construction of chalets, cabins, and mountain hotels in groundwater recharge areas and groundwater reservoirs. The foregoing was prohibited under Law 65 of 30 de julio de 1888, which declared inalienable a strip of land two kilometers wide on either side of the summit of the mountain known by the Nombre62 of Montaña del Volcán de Barba, from the hill called Zurquí to the one known by the Nombre62 of Concordia. That amparo proceeding was granted pursuant to Decision No. 2008-12109, issued at 15:16 on 5 de agosto del 2008. With respect to the Municipalidad de San Rafael, the Chamber ordered the person holding office as Mayor and the person holding office as President of the Council of the Municipalidad de San Rafael de Heredia "to proceed immediately to take the actions required by law against the abandoned-dog shelter located in Refugio de Vida Silvestre Jaguandurí (sic), and to investigate the complaint filed by Grupo Comité Salud de los Ángeles de San Rafael concerning the alleged pollution at that location." The judgment likewise ordered the person holding office as Minister of the Environment and Energy "within seven months from service of that judgment, to take such steps as fall within the scope of his or her authority to physically demarcate the zone established by Law Number 65 of 1888 and, thereafter, to initiate proceedings to recover the land located in that sector that is being occupied by private parties."
It was at this point that my client became interested in compiling detailed information on the documents, not only from the Registro Público but also from the Archivo Nacional, and found that prior transactions had been recorded—including possessory-information proceedings (informaciones posesorias), segregations (segregaciones), consolidations (reuniones), transfers by sale (traspasos por venta) of the land, and mortgages (hipotecas)—dating back to 1896, all duly recorded in the Real Property Registry (Registro inmobiliario). Following the cited ruling, my client was no longer able to continue attending to, maintaining, or monitoring his property; moreover, the municipality ceased maintaining the access road, with the result that it was no longer possible to enter the site even in a four-wheel-drive vehicle. Furthermore, because of the lack of monitoring, the belongings and materials in the dwelling he had there were looted by criminals who later arrived.
Nor did the municipality grant any further permits for construction work in the area, although it had previously done so (See item ññ of the Proven Facts included in Voto 2008-12109). FIFTH: According to the determination issued by the Sistema Nacional de Áreas de Conservación Cordillera Volcánica Central, SINAC, through Official Letter (Oficio) ACCVC-PNE-001-2015, signed by Lic. Nombre82148, Coordinator, registered property (finca matrícula) [Placa703 ] in the province of Heredia, owned by [Nombre62 001], is located entirely within the geographical area covered by Decreto Ley LXV of 1888 (Documentary Evidence No. 8). SIXTH: Voto 2008-12109, repeatedly cited herein, of the Sala Constitucional, ordered the Municipalidad de San Rafael, among other things, verbatim: “a) That they immediately refrain from granting any type of permit within the area established by Law number 65 of 1888, insofar as their jurisdictions are concerned.” For that reason, following those provisions, my client could no longer continue maintaining the property, nor was he able to obtain suitable road access for motor vehicles, and thus the property inexorably fell into disrepair as a result both of the action of Nature and of unknown persons who began stealing all the property located on the premises.
This circumstance, so disastrous for the property interests of Mr. [Nombre62 001], has not prevented the inaction of the various State authorities from continuing to this day, since no study has been initiated regarding the situation of each possessor or registered owner in the aforementioned area, as may be seen from the facts set forth herein. SEVENTH: Despite the time elapsed from the enactment of Law 65, July 30, 1888, to the date of this complaint—that is, 131 years and 7 months—the Costa Rican State, through the Registro Público, continued to process private applications for the recording of entries (anotación de los asientos) in the ordinary course, starkly contrary to the observations of the case law, which has held: “V. There are different sources of rights in rem (derechos reales). They consist of the legally sufficient events authorized by the legal system to give rise to their creation or establishment.” (Resolution 000431-F-00 at 15:55 hours on June 7, 2000, of the Sala Primera de la Corte Suprema de Justicia), thereby causing, through its omission, my client, like many other persons, to purchase his property in reliance on the legal certainty (seguridad jurídica) expected from the Registro Nacional and at all times acting in good faith (buena fe), since he could never even have imagined that, almost 132 years ago, a law placing property within the public domain (afectación al demanio) might have been enacted without being implemented and might be affecting land that appeared in the Registry to be free of any restriction on its transfer.
More seriously still, notwithstanding the Sala Constitucional’s issuance of Voto 2008-12109, the State’s inaction has continued, encouraging substantial private investment in that land which, when abruptly suspended following the cited ruling, thereby caused the enormous property losses suffered by the affected parties, since improvements cannot be made to land that is now known to have the legal status of “res extra commercium.” EIGHTH: My client does not seek to retain possession of the real property, since he is aware of the State’s sovereign authority (potestad de imperio) to subject such property as it deems to be of interest to the protection of the public good; nevertheless, because his family assets, acquired through his arduous work, have been harmed, my client, who is now 72 years old, continues to see his property interest placed in jeopardy, and the Registry’s permissiveness has created a serious risk that he will not live to see his lifetime of effort secured and will instead see it irretrievably lost because the Registro Nacional failed to apply the full scope of law 65, particularly under the pandemic conditions afflicting the world today.
My client’s right is based on Legal Principles (Principios Jurídicos) that are fundamental and, as such, enshrined in our Constitución Política. We know, however, that principles are not legal per se and will be so only if they form part of the body of legality (bloque de legalidad). The Principle of Good Faith (Principio de Buena Fe) has indeed been extensively developed and guaranteed by Constitutional Law (Derecho de la Constitución), case law, and statute (Art. 21 del C.C.). Legal scholarship also provides extensive guidance concerning this principle [citation omitted], which refers to the duty of cooperation between contracting parties. And what greater cooperation could there be than ensuring the proper registration of the property in the Real Property Registry, by both buyer and seller? Likewise, there is the principle of Registry Reliability (Seguridad Registral), established by the Código Civil in Articles 460, 462, and 463.
Based on the provisions invoked, my client’s right to compensation (resarcimiento) for the property losses he is suffering is manifest, as he acquired real property that belongs to the public domain but that, through an omission by the Registro de la Propiedad, was not identified as such in its entries—not merely once but, as the evidence submitted in this regard demonstrates, on multiple consecutive occasions beginning in 1896. NINTH: As held in Voto 12109-2008 and reiterated in Legal Opinion (Opinión Jurídica) OJ-020-2009 of February 20, 2009, issued by the Procuraduría General de la República (PGR), the agency responsible both for implementing the full scope of Law 65 of 1888 and for initiating proceedings to recover the land located in that sector and occupied by private parties is the Ministerio del Ambiente y Energía, MINAE, through its subordinate bodies. Nevertheless, its inaction ultimately reinforced my client’s conviction that purchasing the land in question would be advantageous to his interests.
Likewise, actions were taken by the Municipalidad de San Rafael de Heredia that led my client to decide to purchase the property. Indeed, the actions of these bodies and entities comprising the State are detailed in Voto 12109-2008, from which the following declarations in its Proven Facts section are particularly relevant: d. “By resolution number 943-2004-SETENA at 11:20 hours on June 22, 2004, the Secretaría Técnica Nacional Ambiental granted environmental approval (viabilidad ambiental) for the application to construct a small house at Dirección8865 in Heredia, submitted by Mr. [Nombre62 027]. (Pages 212 to 214 of the case file).” Note how an entity subordinate to MINAE pursuant to Decreto No 36815-MINAET of September 12, 2011, granted environmental approval for a dwelling in the area encompassed by the boundaries of law 65. k. “By notice number 1087 of May 5, 2005, the Municipalidad de San Rafael formally required (previno) the Sociedad Humana de los Estados Unidos de América to comply with a series of requirements for authorization to operate a veterinary hospital in the Reserva Jaguarundi.
(Page 769 of the case file).” According to this proven fact, the Municipalidad de San Rafael imposed a series of requirements upon a private entity for authorization to operate a veterinary hospital in the same area. Therefore, if it imposed a series of requirements, it was because that local government left open the possibility of granting the construction permit for the facility. m. “By notice number 1120 of June 20, 2005, the Municipalidad de San Rafael de Heredia formally required the Sociedad Humana de los Estados Unidos de América to comply with a series of requirements for authorization to operate the dog shelter it maintained in the Reserva Jaguarundi. (Page 54 of the case file).” Similarly, the local government of San Rafael formally advised a private party of a series of requirements it was required to meet for the construction of a dog shelter in the area. z. “In a Technical Report (Informe Técnico) dated February 15, 2006, Msc. Ruth Tiffer Sotomayor and Lic. Marlon Salazar Chacón, of the Centro Científico Tropical, concluded that a shelter for stray dogs could be constructed in the Refugio de de Silvestre Jaguarundi without posing a risk to the environment.
(Pages 134 to 147 of the case file).” I do not know the legal nature of the Centro Científico Tropical cited here, but the fact remains that this is a proven fact identified in the cited ruling, in which approval—legitimate or illegitimate, but nevertheless existing—was given for construction in the area under discussion. aa. “On an unspecified date, Mr. Nombre82151, Biologist in Charge of the Wildlife Component of the Área de Conservación Volcánica Central, issued Technical Report number IT-VS-001-06, stating that a shelter for stray dogs could be developed in the Refugio de Vida Silvestre Jaguarundi, provided that a series of recommendations were followed. (Pages 132 to 133 of the case file).” In this other proven fact, this body subordinate to MINAE issued a “Technical Report” endorsing the development of a dog shelter in the area. cc. “By administrative warning (apercibimiento administrativo) number 1 of April 25, 2006, the Municipal Mayor of San Rafael de Heredia requested that the representative of the Sociedad Humana de los Estados Unidos proceed to clean the land owned by it.
(Page 762 of the case file).” In this proven fact, we are faced with an action by the municipal mayor of San Rafael ordering the cleaning of land owned by the “Sociedad Humana de los Estados Unidos.” It should be noted that, in addition to ordering it to clean the land—which is very different from ordering an eviction (desalojo)—he recognized that organization as the owner, even though the land is subject to law 65 of 1888. ee. “In a filing dated June 12, 2006, the Ministerio Público requested that the Juzgado Penal de Heredia dismiss the complaint filed against the Refugio de Vida Silvestre Jaguarundi. (Pages 391 to 398 of the case file).” Here we are faced with an action by a body of the Costa Rican State—this time, the Poder Judicial—requesting dismissal of a complaint against an occupant of land in that public-domain area. ii. “By resolution number R-O69-SINAC-2007 at 09:40 hours on June 05, 2007, the Acting Director General of the Sistema Nacional de Áreas de Conservación granted the appeal (recurso de apelación) filed by the Refugio de Vida Silvestre Jaguarundi against resolution SRC-024-05 and authorized the operation of a shelter for abandoned dogs at that location, provided that it complied with a series of provisions. (Pages 168 to 175 of the case file).” This proven fact reflects the authorization granted by the Acting Director General of SINAC for the operation of a dog shelter.
ññ “As of the date on which they submitted their report in the present amparo proceeding (recurso de amparo), the authorities of the Municipalidad del Cantón Central de Heredia had granted only two construction permits within the area established by law number 65, which were issued after all requirements established by the legislation in force had been met. (Report at folio 280 of the case file).” This proven fact describes the authorization of two municipal construction permits within the area covered by law 65, but states that the permits were issued after verifying compliance with all requirements established by the legislation in force, which is untrue because, as has been shown, these are public-domain assets (bienes demaniales), and therefore permits could not be granted to build there. The facts detailed above, taken from the previously discussed voto 2008-12109, do not contribute to the subject matter of the present action, but they demonstrate that irregular and unlawful acts, whether intentional or not, were committed within the delimited area created by law 65, of 1888, by officials of institutions forming part of the State, and that these acts created or reinforced the confidence that led to the completion of the purchase of the property located at that site and dedicated to the public domain (afectado al demanio).
TENTH: All the registration-related violations (infracciones de carácter registral) appearing in the record allowed my client, first, to acquire the property with complete confidence and in good faith and, subsequently, to make improvements, perform maintenance, and invest in the aforementioned property, all of which progressively increased the value of that land, in addition to the maintenance work that the Municipalidad de San Rafael originally performed on the access road, which previously could be traveled by off-road vehicles. The omissions by the Registro Nacional led to the filing of the amparo proceeding, which concluded with the suspension of all maintenance and care of the properties located on that land, resulting in a drastic reduction in the commercial value that those properties could have attained. Accordingly, a subsequent appraisal (peritaje) must take into account the value of the real property as of the date on which the work to care for the property was suspended, a date that could be placed on the same date as voto 12109-2008, so that the appraisal may be indexed for enforcement of the judgment (ejecución de sentencia).
ELEVENTH: Each of the omissions committed by the Registry left a mark on the real property, an indication of proper registration status (corrección registral), upon which possession of the property could be based. Under such circumstances, case law and the law may deem it established that public-domain status (demanialidad) prevents the acquisition, through the passage of time, of any right over assets dedicated to the State domain. Likewise, inalienability (inalienabilidad) may preclude the partial or total transfer of assets under private law. It may be argued that prolonged possession by private parties produces no acquisitive effects and that the Administration’s tolerance of, or delay in opposing, their actions confers no rights. Alternatively, case law may hold that the principles of inalienability and immunity from acquisitive prescription (imprescriptibilidad) that characterize public-domain assets (bienes dominicales), together with the legal public notice of their public-domain status (publicidad legal del demanio), prevent reliance against them on the doctrine of the registered third party (tercero registral).
All the foregoing is incontrovertible. Nevertheless, the acts and omissions by the various administrative bodies of the State that violate the legal system cannot evade with impunity the provisions of numeral 1045 of the Código Civil: “Anyone who, through willful misconduct, fault, negligence, or imprudence, causes harm to another is required to repair it together with the resulting losses”; nor may artículo 190 and the following and related provisions of the Ley General de la Administración Pública, concerning the liability of the Administration, or numeral 1° of the Código Procesal Contencioso Administrativo, be disregarded. All these rules forming part of the body of legality (bloque de legalidad), protected under Artículo 41 of our Constitución Política, proclaim their binding mandate in favor of my client. The State, through its deconcentrated body (órgano desconcentrado) known as Ministerio de Ambiente y Energía, engaged in an omission that is unlawful because it violated artículos 11 and 129 of the Constitución Política by failing to timely implement the provisions of Ley 65.
Furthermore, pursuant to numerales 190 and 191 of the Ley General de la Administración Pública, the Junta Administrativa del Registro Nacional is civilly liable to my client for continuously authorizing the registrations and Entries (Asientos) in the Registro Público relating to the various transactions involving the purchase and sale, transfer, consolidation, and subdivision (segregación) of properties at the site known as [...] , where the referenced real property is located, only subsequently to deny him any possibility of enjoying a property that, in principle, it should never have permitted any third party to register because it was not susceptible to private commerce (no estar en el comercio de los hombres). In that regard, the State may retain the real property at issue. It possesses sovereign authority (Potestad de imperio), but the substantial losses caused by omissions contrary to the legal system, which have placed my client on the verge of losing the assets resulting from his lifetime of work, must be compensated promptly, fairly, and fully.
TWELFTH: By judgment N° 13-2018 of 15:30 hours on 20 de febrero de 2018, the Tribunal Contencioso Administrativo, Sección Octava, dismissed a claim brought by my client in proceeding N° 14-008023-1027-CA, whose subject matter and parties differ from those in the present proceeding, although it also concerned the same property. For the purposes relevant to the present proceeding, Considerando X of that Decision, quoting the repeatedly mentioned Voto of the Sala Constitucional, states as follows: “The petitioner must take into consideration that the mere delimitation does not directly affect his private property, because it is not yet known whether it lies wholly or partially within the inalienable area already established by law....” As of the present date, as I stated in the Fifth Fact, MINAE has already determined that my client’s property is located entirely within the area affected by law 65.
Consequently, there are now negative effects on his property interests and, taking into account that said ministry has not given even the slightest indication that it will begin work to recover the affected assets, given my client’s age, 72 years, there is a very clear risk that he will not obtain redress for the damage suffered by his estate, because he cannot, and will not be able to, exercise all the prerogatives enjoyed by the property’s lawful owner. In this same regard, Dictamen C-480-2014, of 19 de diciembre de 2014, issued by PGR, declared: “Once the preliminary study has been conducted by the Departamento Legal del Área de Conservación, those registry entries (asientos registrales) that are not supported by the exercise of ten-year possession prior to dedication to the public domain (afectación del dominio público) must be brought to the attention of the Dirección del Registro Inmobiliario so that it may assess the corresponding cautionary annotations (anotaciones de advertencia), as well as to the Asesoría Jurídica del Ministerio de Justicia for the study and assessment of those cases that would require a prior declaration of adverse effect on the public interest (declaratoria de Lesividad) before bringing judicial proceedings to cancel the registry and cadastral entries that improperly encompass the Zona Inalienable de la Ley 65 de 1888.” (Final paragraph). As may be seen, none of the State bodies has fulfilled its clearly defined powers, to the resulting detriment of my client.”
“Pursuant to Article 66, subsections f), j), and k), of the Administrative Litigation Procedure Code (Código Procesal Contencioso Administrativo, CPCA), the following preliminary defenses (defensas previas) are raised: Failure to Join Necessary Parties (Falta de Integración de la Litis). [Rejected by the Case-Management Judge]. Substantive res judicata (cosa juzgada material). Based on a review of court expediente 14-008023-1027, processed before the Administrative Litigation Procedure Court, and of the ruling issued in Resolution No. 13-2018, at 15:30 hours on veinte de febrero de 2018, the plaintiff states in the complaint that ‘(...) a claim by my client was dismissed, (...) the subject matter and parties of which differ from those herein, although it also concerned the same property.’ Contrary to the foregoing allegation, it is abundantly clear that the person filing the present complaint is Mr. [Nombre62 001], who seeks an order requiring the parties—here, the State and the Administrative Board—to pay compensation arising from the designation as a reserve affecting the property registered in the Heredia Registry District under Folio N° [Valor 002].
In analyzing the doctrine of res judicata, the First Chamber, in its Resolution No. 00041 - 2018, del 25 de enero del 2018, reiterated the following: [Partial transcription of the judgment]. In this case, it is abundantly clear that what the plaintiff seeks both in the prior proceeding and in this one is compensation for being unable to dispose of the property, as well as for the non-pecuniary and pecuniary harm caused by the designation as a reserve affecting the property registered in the Heredia Registry District under Folio N° [Valor 002], belonging to Mr. [Nombre62 001], because it is subject to the provisions of Ley 65. Thus, in 2014, the person filing the present complaint initiated administrative litigation proceedings against the State, in which SINAC (Sistema Nacional de Áreas de Conservación) appeared as an interested third party, and the claim was declared inadmissible by Resolution N°13-2018, at 15:30 hours on veinte de febrero de 2018.
That resolution found that the inalienability of the lands located in the area, including those of Mr. [Nombre62 001], had been established by the legislature before the original title was granted through possessory information proceedings (Diligencias de Información Posesoria), thereby affecting subsequent registry transactions through the plaintiff’s acquisition, because, pursuant to Article 129 of the Political Constitution, ignorance of the law cannot be pleaded and, because Ley 65 remains in force, it cannot be disapplied. The claim for subjective non-pecuniary harm (daño moral subjetivo) resulting from the inability to dispose of the property was likewise declared inadmissible, ‘(...) because no subjective right arising from the legal system exists, since, under the constitutional mandate that no one may plead ignorance of the law, (...) the purpose of this provision regarding the protection of the area’s aquifers cannot be disregarded; therefore, it is not “(...) possible to protect a legal situation predating the legislation that subjected that territorial area to restrictions in the public interest and that, from that time onward, formed part of the State public domain (demanio público estatal).
(...)”’ As can be seen, the crux of the actions undertaken by the plaintiff, both administratively and judicially, is identical, and they seek the same objective: compensation for the inability to dispose of the property. To that end, the plaintiff has made similar factual arguments seeking to have my client held liable by framing those arguments from a registry-law perspective. Indeed, this matter has involved acts and omissions by other entities that have been challenged and sanctioned, but those matters fall outside the National Registry’s sphere of authority; my client is merely one link in the situation, and there is no evidence whatsoever that it engaged in conduct contrary to the legal system governing us. Expiry of the action (caducidad de la acción). To establish this defense regarding the actions taken by my client that the plaintiff alleges were omissions and errors and, consequently, potential sources of administrative liability, it is first necessary to identify the specific event from which the statutory period applicable to this defense must be calculated.
According to the complaint, the principal event underlying both the main and ancillary claims is the alleged inability to dispose of the property registered in the Heredia Registry District under Folio N° [Valor 002]. These matters do not fall within the registry sphere, because Ley 65 establishes the inalienability of the plaintiff’s lands, which originated through a series of registry transactions initially conducted by means of possessory information proceedings, with respect to which the National Registry merely complied with the judicial order from which the publicly recorded registry information (publicidad registral) derives. This is because, according to the plaintiff, those actions—characterized as omissions—impaired the right of possession over the acquired property. As follows from these considerations, the dates from which the relevant period must be calculated are: -23 de septiembre de 2004.
Date on which property [Valor 002] was registered. -Agosto de 2008. Date on which the plaintiff learned of the Constitutional Chamber’s ruling issued at 15:16 hours on 5 de agosto de 2008, when, according to fact 4 of the complaint, the plaintiff states that he learned of Ley 65 de 1888. -2015, Oficio ACCVC-PNE-2015, undated, consisting of a certification by the Coordinator of the State Natural Heritage, concluding that the property registered in the Heredia Registry District under Matricula Placa891° [Valor 002] lies within the geographical area covered by Decreto de Ley 65 del año 1888. Accordingly, with respect to the National Registry’s actions from which, according to the complaint, the alleged losses and damages arose, given their registry-related nature and pursuant to the rules established in Articles 267 and 455 of the Civil Code and Article 32 of Ley 3883 Ley de Inscripción de documento en el Registro Público, the period for determining whether the invoked defense of expiry has accrued must begin when the registrations entered the public registry records and could therefore have become known to any interested party; for these purposes, that rule must be read in conjunction with Article 175 of the General Public Administration Law.
On this point, the Administrative Litigation Court’s position has been consistent with that interpretation, and its Fifth Section, Anexo A, reasoned as follows in the ruling issued at fifteen hours on veintidós de junio de dos mil doce: [Partial transcription of the judgment]. In view of the foregoing considerations and pursuant to Article 175 of the General Public Administration Law, in the version in force before the amendment introduced by the Administrative Litigation Procedure Code and applicable when the plaintiff acquired and registered the property, the period for bringing the present action concerning subsequent transactions relating to the property has expired. If the triggering event were deemed to be the plaintiff’s knowledge of the Constitutional Chamber’s ruling issued at 15:16 hours on 5 de agosto de 2008, or Oficio ACCVC-PNE-2015, the date of which is unknown, the requested defense would likewise have to be sustained.
In light of the foregoing considerations, the applicable period for those acts has expired to the plaintiff’s detriment because, as the record shows, the complaint against my client was not filed until 10 de junio de 2020. It is therefore evident that the statutory period for bringing the present action had long since elapsed, and I consequently request that this defense of expiry be sustained. Limitation of the claimed right (prescripción del derecho reclamado). It should be noted that the claim for compensation asserted as the main and ancillary claims regarding pecuniary harm and losses does not satisfy the requirements established in Article 196 of the General Public Administration Law, since they had not materialized as of the filing date of the present complaint. Nevertheless, because the efficient cause alleged to have generated them is time-barred by expiry, as established in the preceding section, this claim lacks the necessary factual basis for an award.
Furthermore, as specifically follows from the claimant’s own statements, he has known since 2008 that a superior property right existed over the portion of land occupied by his property, if only because it constitutes public-domain property (bien demanial). It is therefore evident that the alleged harm would have begun to arise at that time and that the relevant limitation period would likewise have begun to run. As for the claimed non-pecuniary harm (daño moral), the plaintiff’s statement in fact four shows that it occurred when he learned of the existence of Ley 65 in 2008 and of Oficio ACCVCPNE-2015, signed by the Coordinator of the State Natural Heritage in agosto de 2015. The right to claim payment of the requested compensation is therefore barred by the statute of limitations. This is because, pursuant to Article 198 of the General Public Administration Law, read in conjunction with Article 41 of the Administrative Litigation Procedure Code, the right to request compensation from the Public Administration must be exercised within four years of the event giving rise to liability.
In this case, according to the claimant’s theory, that event occurred when he learned in 2008 of ley 65, which establishes the inalienability of the property he possesses. The year 2015 must also be considered, because that was when the Coordinator of the State Natural Heritage confirmed in the aforementioned official letter that the property registered in the Heredia Registry District under Matricula Placa891° [Valor 002] lies entirely within the area; thus, the period for asserting any administrative liability would have expired in 2019. It should be noted that Mr. [Nombre62 001] pursued several administrative and judicial actions to obtain compensation for the lands in his possession, which were declared inalienable, not subject to acquisitive prescription (imprescriptibles), and non-transferable because of their status as State natural heritage under the aforementioned law, ignorance of which cannot be pleaded.
The Constitutional Chamber clearly stated in its ruling 12109-20098 that administration of these lands falls to MINAE-SINAC; it is important to note that public-domain property (bienes de dominio público) may not be privately possessed, and its prolonged holding by private parties neither produces acquisitive effects nor confers any right as a result of the Administration’s tolerance or delay in opposing their actions. Consequently, anyone who transfers such property also transfers the defect in the basis of acquisition, since no one may, either unilaterally or through the passage of time, change the basis of possession. In the case before us, considering the historical registry transactions affecting this property, its original registration associated with possessory title proceedings (información posesoria) dates from 23 de marzo de 1896, while the plaintiff received confirmatory notice from the Coordinator of the State’s Natural Heritage in agosto de 2015; accordingly, under the principle of legal certainty (seguridad jurídica), any claim in this regard would no longer be admissible today.
Therefore, the plaintiff has no right to seek the alleged damages (daños y perjuicios) claimed as ancillary relief, because the 4-year limitation period for enforcing such a claim expired long ago. Failure to uphold the asserted statute of limitations (prescripción) would violate the principles of legal certainty and would allow any person subject to the Administration, even long after the period granted by law had elapsed, to seek compensation for damages allegedly arising from administrative conduct occurring between 124 and 5 years ago, demonstrating that the period for claiming compensation for administrative conduct has indeed expired. As to the request for reimbursement of the real property tax paid to the Municipalidad de San Rafael de Heredia, included within the claimed pecuniary damage (daño material), that request is inadmissible because its imposition falls within the jurisdiction of the local government under the regulations governing it, and not within that of the Registro Nacional.
Considerations regarding the facts and claims. According to the claims set forth by the plaintiff in its complaint, the purpose of these proceedings is: a. That the Junta Administrativa del Registro Nacional be ordered, with the amount to be determined subsequently, to compensate for the damage caused by the unavailability of the property registered in the Heredia Registry District under Property Registration Plate891° [Valor 002], the value of which shall be determined during enforcement of the judgment. b. That the amount to be determined be indexed in accordance with section 124 of the CPCA. c. As ancillary relief, that it be ordered to pay the damages caused by its failure to act, with the amount to be determined during enforcement of the judgment. The damages consist of: -Pecuniary damage: the substantial depreciation of the facilities and land caused by the lack of maintenance and security, as well as the deterioration of the access road, following Resolution 2008-12109 of the Constitutional Chamber, which ordered the suspension of all private activity because the lands are inalienable. -The full amount of the real property tax that my client has paid to the Municipalidad de San Rafael de Heredia since 2004 and that, by definition, it was not required to pay because of the State’s tax immunity, the amount of which shall be determined in due course. • Non-pecuniary damage (daño moral): caused by the anguish, discouragement, and helplessness of seeing a lifetime’s work disappear in view of the imminent possibility of losing ownership of the property. d. That the State be ordered to pay interest on the amount determined during enforcement of the judgment. e. That the State be ordered to pay both categories of costs in these proceedings, together with interest until payment in full. -The central subject matter of the proceedings: Based on the plaintiff’s claims and arguments, the purpose of these proceedings is to obtain compensation for the damage caused by the unavailability of the property registered in the Heredia Registry District under Property Registration No. [Valor 002], in reliance on the public record (publicidad registral) and because of the alleged failures of the Registro Nacional to apply Ley 65 de 1888.
In light of the foregoing, this representative submits that the theory is incorrect and unsupported by the legal system; accordingly, the matter is analyzed below. REGARDING THE PROPERTY REGISTERED IN THE HEREDIA REGISTRY DISTRICT UNDER PROPERTY REGISTRATION [Valor 002]. -Possessory title proceedings. Regarding the origins of the property registered in the Heredia Registry District under Property Registration [Valor 002], the Registro Inmobiliario conducted a historical review of the registry entry (asiento registral) for this property, which was forwarded to us by official letter DRI-01-398-2020, dated 31 de julio de 2020, and is attached together with the corresponding certifications; insofar as relevant, it states as follows: “(...) 1. Property [Valor 002] derives from the subdivision (segregación) (and sale) made by [Nombre62 005] in favor of [Nombre62 001] from property [Valor 017], executed through the document recorded in volume [Valor 024], entry [Valor 025], with registration completed on 23 de setiembre de 2004. 2.
Property [Valor 017] derives from the subdivision (and sale) made by [Nombre62 023] in favor of [Nombre62 004] from property [Valor 014], carried out through the document recorded in volume [Valor 026], entry [Valor 027]. Registration completed on 24 de marzo de 1992. 3. Property [Valor 014] derives from the consolidation (reunión) by [Nombre62 023] of properties [Valor 015] and [Valor 016], through the document recorded in volume [Valor 028], entry [Valor 029]. Registration completed on 31 de junio de 1991. 3.1 Property [Valor 015] arose from the possessory title formation proceedings (formación Posesoria) instituted by [Nombre62 033] before the Juzgado Civil de Heredia, according to volume 838, folio 160, on 08 de setiembre de 1914. 3.2 Property [Valor 016] originated from the consolidation and sale of properties [Valor 009] and [Valor 010] carried out by [Nombre 014] S.A. in favor of [Nombre62 015] and [Nombre 016], as recorded in volume [Valor 030], folio [Valor 031], on 16 de junio de 1972. 3.2.1 Property [Valor 009] originated from the consolidation by [Nombre 007] of properties [Valor 007] and [Valor 006], in volume [Valor 032], folio [Valor 031], dated 14 de junio de 1916. 3.2.2 Property [Valor 010] originated from the consolidation by [Nombre62 013] of properties [Valor 033] and [Valor 034], in volume [Valor 055], folio [Valor 056], dated 25 de noviembre de 1933. ...381 Property [Valor 007], identified in paragraph 3.2.1., originated through possessory title proceedings in favor of [Nombre62 028], widower of the marital partnership (sociedad conyugal) with [Nombre62 029], as recorded in volume [Valor 035], folio [Valor 036], dated 16 de junio de 1897. ...382 Property [Valor 006], identified in paragraph 3.2.1., originated through possessory title proceedings in favor of [Nombre62 006] (having only one surname), as recorded in volume [Valor 037], folio [Valor 038], dated 23 de marzo de 1896. ...383 Property [Valor 033], identified in paragraph 3.2.2., originated through possessory title proceedings instituted by [Nombre62 034], according to volume [Valor 039], folio [Valor 040], dated 23 de febrero de 1933. 3.2.2.2.
Property [Valor 034], identified in paragraph 3.2.2., originated through possessory title proceedings instituted by [Nombre 031], as described in folio [Valor 039], folio [Valor 041], dated 23 de febrero de 1933. Returning to the foregoing, the land that today constitutes the property registered in the HEREDIA Registry District under Property Registration [Valor 002] originated from the historical transactions involving property [Valor 017] in the same Registry District and its chain of title (antecedentes de dominio), namely: [Valor 014], [Valor 015], [Valor 016] , [Valor 015], [Valor 016], [Valor 009], [Valor 010], [Valor 007], [Valor 006], [Valor 033] and [Valor 034]. According to the historical review of the registration entries for properties [Valor 015], [Valor 007], [Valor 006], [Valor 033] and [Valor 034], they arose through possessory title proceedings after the enactment of Ley LXV dated 30 de Julio de 1888, in every case pursuant to a final and binding judgment issued by the Judge of the Juzgado Civil of the province of Heredia, who had jurisdiction to do so.
Such final judgments are not open to question by this Registry because they have substantive res judicata effect (cosa juzgada material), and this Registry has no authority to review or revoke them, as it is prohibited from assessing the evaluations and determinations of certainty made by the Judges of the Republic. Notwithstanding the preceding paragraph, the registry entries do not disclose any background information establishing possession for the ten-year period preceding registration of the cited property—namely, property 4-[Valor 002]. (...)”. It follows from the foregoing that the actions taken by the Registro Nacional since the origins of the land currently owned by Mr. [Nombre62 001] do not constitute any type of omission, because they were carried out under the applicable regulatory framework, as provided by Article 9 of the Constitución Política and Articles 450, 453 subsection 2), and 484 of the Código Civil, which governs us with respect to the registration of judicial writs (mandamientos judiciales).
Of importance to the case before us is that the registry entries establish that the possessory title proceedings from which this property originated occurred after the enactment of Ley 65 de 1888, without indicating whether the requirement of ten years’ possession prior to issuance and registration was satisfied. Such information can be investigated only in the court case files for each of these transactions, an investigation that, as determined by the Constitutional Chamber, must be conducted by MINAE. This circumstance does not alter the central issue in this lawsuit, since the Registro Nacional fully complied with the judicial authority’s request at the time of registration. REGARDING MANDATORY COMPLIANCE WITH JUDICIAL ORDERS. It is clear to the Registro Nacional that judicial writs issued by the country’s respective Authorities constitute enforceable orders that must be obeyed by the Public Administration, as national case law has consistently established.
In this regard, Resolution No. 2000-10991 of the Constitutional Chamber, issued at fifteen hours and twenty-two minutes on doce de diciembre del dos mil, stated the following concerning this issue: [Partially reproduces the judgment]. Likewise, the scope of the registration review (calificación registral) has long been defined, and repeatedly reaffirmed, in national case law. Among such decisions, the Sala Primera de la Corte Suprema de Justicia stated the following regarding the scope of registration review in Judgment No. 100, issued at 16:45 hours on 17 de diciembre de 1980: [Partially reproduces the judgment]. The case law cited above clearly establishes that orders issued by the various Judicial Authorities constitute mandates that must be obeyed by the Registro Nacional, because it acts as “an auxiliary to the justice system.” Acting contrary to an order or departing from such a mandate could effectively nullify the Judge’s ruling, thereby creating uncertainty and jeopardizing the ability of each person subject to the Administration to enforce their rights.
In the present case, it is important to emphasize that the registration transactions carried out with respect to the real property at issue in these proceedings were conducted pursuant to the regulations governing registry matters for such purposes, both from their inception and through their final acquisition and registration on 23 de setiembre de 2004, when Mr. [Nombre62 001] acquired ownership of the property. That said, and in accordance with the description in section IV subsection A, it is evident that the various transactions carried out, which gave rise to property of the Heredia Registry District, Registration No. [Valor 002], stem from a judicial writ (mandamiento judicial) that cannot be challenged by my client; consequently, the source of the legal situation before us cannot be attributed to my client. REGARDING THE DUTY TO PROVIDE COMPENSATION AND THE ALLEGED DAMAGES. A. Impropriety of damages: This representation considers it relevant to note that the plaintiff seeks a general award ordering the Administrative Board to compensate it for the damages caused by the unavailability of property of the Heredia Registry District, Registration No. [Valor 002], in addition to seeking payment of interest on that amount.
The plaintiff has based its administrative and judicial claims on its inability to possess the property at issue in these proceedings as a result of administrative action, specifically the application of Ley 65, having previously brought actions in 2014 seeking a determination of liability and of the obligation of the State and SINAC-ACC to provide compensation in ordinary proceedings (proceso de conocimiento) before the Contentious-Administrative Court, expediente 14-008023-1027-CA, and recently against the National Registry, acknowledging in all these proceedings that, since the creation of property of the Heredia Registry District, Registration No. [Valor 002], it has been located in an inalienable zone (zona inalienable) by operation of law. In this regard, it should be noted that we are NOT dealing with a registry omission (omisión registral), as opposing counsel seeks to portray it, because the notarial instruments were registered exactly as the legal and surveying professionals prepared them, given that the origins of property of the Heredia Registry District, Registration No. [Valor 002], lie in historical transactions involving several properties in that same registry district, with chains of title (antecedentes de dominio) originating through possessory information proceedings (Diligencias de Información Posesoria) conducted after the enactment of Ley 65 del 30 de julio de 1888; in every case, title was established by a final and binding judgment issued by the Civil Judge of the province of Heredia having jurisdiction over the matter, and the National Registry could not question the registration of what was ordered in that judgment.
Furthermore, the very concept of registry public notice (Publicidad Registral) is defined by our legal system and requires the purchaser to review the registry information, including a diligent review of the record books. In this regard, Article 66 of the Public Registry Regulations, Decreto Ejecutivo No. 26771 del 8 de febrero del 1998, states verbatim: “(...) Basis of registry public notice. Registry public notice consists of the information contained in the record books, electronic data-processing systems, digitized records, and microfilm. A close relationship must exist between those systems, with each serving as a reciprocal and complementary aid to the other, in order to guarantee the unity, security, and consistency of the registry information (...)”. At this point, it should be noted that the purchase of real property requires not only verification of the existence of encumbrances (gravámenes) or notices (anotaciones), but also, as part of the duties of the appointed notary, a review of the property’s chain of title; it is therefore improper for the plaintiff now to seek to impute liability for damages to my client, since the National Registry acted in accordance with the law, the framework for registry examination (calificación registral), and the principle of application by an interested party (principio de rogación).
Accordingly, the registry actions complied with the rules and principles governing the registration of registry entries (asientos registrales), and there was no registry omission of any kind that would justify a judgment against us. First, the statement of facts upon which the plaintiff seeks to establish the possible existence of damages fails to demonstrate any connection with the administrative conduct of my client—including the circumstances of manner, time, and place—because the property’s unavailability results from the existence of Ley 65 de 1888, which provides that the property lies within a zone intended to protect the aquifers of Heredia and Alajuela. With respect to the registration of the registry entries that gave rise to property of the Heredia Registry District, Registration No. [Valor 002], the applicable legal framework for registry examination was duly followed at the time, in compliance with the judicial order arising from the possessory information proceedings that had been conducted, without any negligent, permissive, or omissive conduct by the Real Property Registry either in the actions taken in 1896 or those taken in 2004.
It should be clarified that responsibility for delimiting the area affected by this Law lies with MINAE, as confirmed by Constitutional Chamber decision 12109-2008 de las quince horas y dieciséis minutos del 5 de agosto de 2008, which granted it a period within which to locate and recover these lands. Consequently, there is no conduct attributable to the National Registry that is contrary to the legal system and that would establish the underlying unlawfulness (antijuricidad) required to find financial liability (responsabilidad patrimonial); that claim must therefore be denied. Finally, the damages claimed also fail to satisfy the requirements established by the applicable legal system and have not been duly proven as required, matters for which the plaintiff bears exclusive responsibility (Article 58 subsection f) of the Code of Contentious-Administrative Procedure and section 41.1 of the New Code of Civil Procedure).
In this regard, it is appropriate to mention that section 196 of the General Law of Public Administration provides that any alleged harm must be actual, economically quantifiable, and attributable to a particular person or group. Before characterizing it, harm must be understood as any injury, impairment, loss, or detriment to a person’s patrimonial or non-patrimonial legal sphere; therefore, because those requirements have not been met in the present case, the claim must be denied (see, to that effect, decisions numbers 846 de las 11:22 horas del 18 de diciembre de 2008 and 202-F-2001 de las 15:45 horas del 07 de mano de 2001 of the First Chamber of the Supreme Court of Justice). As to the ancillary claim (pretensión accesoria) seeking the payment of damages and alleging pecuniary harm (daño material), the First Chamber’s holding that, where appropriate, an allegation of non-pecuniary harm (daño moral) must be proven is significant; the Court of Cassation emphasized this in the following terms: [Partially transcribes the judgment].
Similarly, with respect to non-pecuniary harm, decision 014-F-93 of the First Chamber of the Supreme Court of Justice, de las dieciséis horas del dos de marzo de mil novecientos noventa y tres, states as follows: [Partially transcribes the judgment]”.
IV.POSITION OF THE STATE’S DEFENSE.- Counsel for the State answered as follows: “Res judicata (cosa juzgada) and lack of legal entitlement (falta de derecho). The claims asserted had already been rejected in another proceeding. For the second time, the plaintiff is bringing a claim for damages that has already been rejected with the force of substantive res judicata (cosa juzgada material). Indeed, in the plenary proceeding (proceso de conocimiento) conducted under expediente 14-8023-1027-CA, judgment N° 13-2018-VIII, issued at 15:30 hours on 20 de febrero de 2018, held that the damages claimed were not warranted. Specifically: [The judgment is partially transcribed]. Notwithstanding the unequivocal nature of that ruling, Mr. [Nombre62 001] has filed suit again and essentially requests the same relief as in proceeding 14-8023-1027-CA: recognition of the ‘right’ to receive financial compensation because he is unable to dispose of property 4-[Valor 002].
However, it is indisputable that this claim has already been denied with the force of substantive res judicata. Accordingly, in this new proceeding, neither the claim for damages nor the requested expropriation proceeding (trámite expropiatorio) is admissible. The parties, subject matter, and cause are identical, and the defense of substantive res judicata applies pursuant to sections 64 of the Código Procesal Civil and 66, subsection 1.j, of the Código Procesal Contencioso Administrativo (CPCA). This new complaint is not legally cognizable, as it seeks to reopen a pointless dispute already resolved by judgment N° 13-1028-VIII. Moreover, the lack of legal entitlement is evident because the land at issue is public-domain property (demanial) and forms part of the State Natural Heritage (Patrimonio Natural del Estado) (Ley 7575, articles 13, 14; Ley 7554, section 38; Sala Primera, judgments 59-99, 1070-10, 1088-11 and 1675-12; constitutional decisions 945-05, 17126-06, 2063-07, 16975-08, 17650-08, 17659-08, 21258-10 and 16938-11): [Transcribes and cites constitutional judgments 16975-08, 17650-08, 17659-08, 16938-11 and 12973-13.
Its declaration and statutory dedication are sufficient to establish that public ownership. Conversely, its removal from the public domain (desafectación) requires a statute (Código Civil, articles 261, 262 and 486; Ley ITCO, article 7; Ley 4465, article 18; Ley 7575, sections 13 and 14; constitutional decisions 846-95, 3145-96, 5026-97, 7294-98, 2988-99, 2408-07, 11155-07, 13367-12 and 10158-13; Sala Primera, judgments 230-90, 12-95, 1259-09 and 189-11; Tribunal Contencioso Administrativo, decisions 5579-82-1, 7747-85-1, 9172-87-1, 100-94-1, 190-2012-11, 84-2014-11, 868-2011-111, 79-2016-IV, 19-2009-VII and 46-2009-IX), as well as the necessary technical studies justifying the measure in accordance with section 38 of Ley 7554 and the constitutional case law construing it (decisions 5399-93, 7294-98, 5975-06, 2408-07, 11155-07, 1056-09, 14772-10, 18702-10, 13367-12, 10158-13 and 12745-19); regulations, judicial decisions, or administrative action are not appropriate means for that purpose.
Public-domain status (demanialidad) ‘...means that the passage of time does not give rise to any right over this type of property, whether ownership or even mere possession’ (constitutional judgments 12129-05 and 10097-06). Inalienability (inalienabilidad) precludes its transfer, whether partial or total, voluntary or compulsory, and its possession under private law. Constitutional decisions also reaffirm that public-domain property ‘cannot be the subject of private possession’ (480-90, 2306-91, 2557-91,98-92, 1055-92, 1207-93, 5399-93, 5976-93, 220-94, 914-94, 1763-94, 2767-94, 6785-94, 3793-94, Placa13306, 6079-94, Placa13307, 3227-96, 422-96, 4815-96, 5026-94, 623-98, 7294-98, 790-01, 6347-15, 9004-15, 9640-15, 12393-16, 13160-16, 13980-16, 14586-16, 14784-16, 15288-16, 16481-16, 16760-16, 11715-17, 19499-17, 11414-18). Indeed, ‘private parties do not exercise possession over such property because neither in fact nor in law do they hold it under their power and control’ (Tribunal Contencioso Administrativo, decisions 9282-87-1, 10019-88-1, 10166-88-1, 10418-88-1, 107-2008-II, 868-2011-111 and 19-2009-VII).
Because public-domain property is outside the stream of commerce, no claims may be made regarding real rights (derechos reales) of ownership or possession as owner (Sala de Casación, judgment issued at 9:30 hours on 6 de junio de 1936; Sala Primera, judgments 17-95, 104-96, 597-00, 237-07, 506-2007 and 535-C-S1-2014; constitutional judgments 2306-91, 6758-93 and 6192-95; Tribunal Contencioso Administrativo, decisions 1019-88-1, 433-10-11 and 84-2014-II). Its holding by private parties produces no acquisitive effects (constitutional judgments 6758-93 and 6192-95). Whoever conveys such property transmits the defect in the basis for its acquisition: the reason is obvious, ‘no one may change, on their own or through the passage of time, the basis of their possession... Nor may the attributes or defects of possession be changed by one’s own will or through the passage of time; as possession began, so it always continues’ (cites legal scholarship).
Accordingly, agreements between private parties encompassing public-domain property have no valid effect against the State because of the property’s legally inalienable nature and the absence of valid title (Sala de Casación, decision issued at 10 hours on 1° de agosto de 1946, 3-53, 79-55,78-76 and 121-79; Sala Primera, judgments 16-1982, 11-03, 607-04, 934-06, 45-07, 173-08, 317-08, 796-10, 1562-12; Tribunal Contencioso Administrativo, 109-2009-IX, 433-2010-11, 2642-2010-VII, 33-2012-IV, 51-2012-VIII, 71-2012-VIII, 190-2012-11, 346-2012-IV, 95-2013-V). The principle of freedom of contract (autonomía de la voluntad) does not operate against the public domain (constitutional judgments 2306-91, 6758-93 and 6192-95; Sala Primera, decisions 104-96, 597-00, 237-07 and 1562-2012; Tribunal Contencioso Administrativo, judgments 1019-88-1, 433-2010-11 and 84-2014-VII). Along those lines, Sala Primera held: [Transcribes judgments 506-2007 and 189-2011].
Similarly, see judgments 1842- 2009-VI and 38-2010-VI of the Tribunal Contencioso Administrativo; the latter held: [Transcribes the judgment]. In judgment N° 69-2018-11, issued at 8:00 hours on 30 de octubre de 2018, the Tribunal Contencioso Administrativo held: [Transcribes the judgment]. Lastly, neither expropriation proceedings nor claims for damages against the public domain are admissible. In judgment N° 104-1996, recital VII, Sala Primera stated that properties eligible for expropriation are those registered in accordance with the law, whereas properties registered contrary to the legal system may be recovered without undergoing that proceeding. In judgment N° 480-2019, Sala Primera further stated: [Transcribes the judgment]. This position is followed by the Tribunal Constitucional and the Tribunal Contencioso Administrativo: [Transcribes constitutional judgment 8098-2007 and judgments 35-07-IV; 2569-09-IV and 59-2014-VIII of the Tribunal Contencioso Administrativo].
Lack of legal entitlement and lack of the State’s standing as a defendant (falta de legitimación pasiva). Although this complaint is not legally cognizable, to safeguard the interests of the party I represent, I raise the defenses of lack of legal entitlement and lack of standing as a defendant with respect to the claim for damages, pursuant to article 22 of Ley N° 5695 (of 28 de mayo de 1975). Accordingly, in the hypothetical and unlikely event that, in light of the substantive claims asserted here, some form of redress is deemed appropriate in favor of the plaintiff, responsibility for it would fall upon the co-defendant, in its capacity as a deconcentrated agency (órgano desconcentrado) with its own assets and budget, and not upon the State. As to the party I represent, there is already a judgment, with the force of substantive res judicata, that denied a claim to that effect.”
V.PROVEN FACTS (HECHOS PROBADOS).- The following relevant facts are deemed proven and material to the resolution of this matter:
Nombre4631, or whoever holds the office of Alcalde Municipal del Cantón Central de Heredia; Nombre82152, or whoever holds the office of Alcalde, and Nombre82153, or whoever holds the office of Presidenta del Concejo Municipal, both of the Municipalidad de Santa Bárbara de Heredia; Nombre82154, or whoever holds the office of Alcaldesa, and Nombre82155, or whoever holds the office of Presidente del Concejo Municipal, both of the Municipalidad de Barva de Heredia; Nombre82156, or whoever holds the office of Alcalde, and Nombre82157, or whoever holds the office of Presidenta del Concejo Municipal, both of the Concejo Municipal de San Isidro de Heredia; Nombre82158, or whoever holds the office of Alcaldesa de San Pablo de Heredia; Nombre71399, or whoever holds the office of Alcalde, and Nombre82159, or whoever holds the office of Presidenta del Concejo Municipal, both of the Municipalidad de San Rafael de Heredia; Nombre82160, or whoever holds the office of Alcalde Municipal de Santo Domingo de Heredia; Nombre38661, or whoever holds the office of Alcalde Municipal de Moravia; and Nombre19428, or whoever holds the office of Alcalde Municipal de Vázquez de Coronado, are ordered as follows: a) They shall immediately refrain from granting any type of permit within the area established by law number 65 of 1888, insofar as their respective jurisdictions are concerned; b) They shall retain the professionals necessary to prepare the hydrogeological vulnerability maps (mapas de vulnerabilidad hidrogeológica) recommended by SENARA in its report entitled ‘Recarga Potencial del Acuífero Colima y Barva, Valle Central, Costa Rica,’ which maps shall be incorporated into the land-use regulations (normativa urbanística) of their respective jurisdictions, as recommended by the aforementioned authority.
Nombre82161, or whoever holds the office of Ministra de Salud; Nombre71399, or whoever holds the office of Alcalde; and Nombre82159, or whoever holds the office of Presidenta del Concejo Municipal, the latter two both of the Municipalidad de San Rafael de Heredia, are ordered immediately to take such legal action as may be appropriate against the abandoned-dog shelter operating in Refugio de Vida Silvestre Jaguandurí and to investigate the complaint filed by Grupo Comité Salud de los Ángeles de San Rafael regarding the alleged contamination at that location. The respondents are warned that, pursuant to article 71 of the Ley de la Jurisdicción Constitucional, any person who receives an order issued in a constitutional amparo proceeding (recurso de amparo) that the person is required to comply with or enforce, and who fails to comply with or enforce it, shall be punished by imprisonment for three months to two years or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty.
The State and the Municipalidades de Heredia, Santa Bárbara, Barva, San Pablo, San Isidro, San Rafael, Santo Domingo, Moravia y Vasquez de Coronado are ordered to pay the costs, damages, and losses underlying this ruling, which shall be quantified during enforcement of the judgment before the contentious-administrative jurisdiction (jurisdicción de lo contencioso administrativo). As to the other respondent authorities, the action is denied.” (Nexus.PJ consulted on 19 de noviembre de 2021).
Consequently, pursuant to artículo 129 Constitucional, he cannot plead ignorance of the law; and because Decreto Ley LXV remains in force, it cannot be disregarded, and the claim must therefore be denied.—As to the second claim, it states: ‘b) That the defendant be ordered to pay subjective non-pecuniary damages for the distress caused by being unable to dispose of the real property, of which my client has effectively been deprived over so many years. I estimate these damages at fifty million colones, an amount proportionate to the harm caused.’—For the same reasons already stated regarding the preceding claim, no individual right (derecho subjetivo) arising from the legal system exists in this case, since, under the constitutional mandate that no one may plead ignorance of the law, it would not be possible to disregard a statutory mandate intended to ensure the water supply for future generations in the provinces of Alajuela, Heredia y San José, as the Sala Constitucional noted in the judgment cited above.
Moreover, in this case, his ownership derives from a registration made after Decreto Ley LXV; consequently, it is not possible to protect a legal situation predating those rules, which subjected that territorial area to restrictions in the public interest and, from that time onward, made it part of the State’s public domain (demanio público estatal). Furthermore, as stated in the unproven facts, the plaintiff did not establish, in accordance with the burden of proof (carga de la prueba) set forth in artículo 317 del CPC, which applies supplementarily pursuant to artículo 220 del CPCA, that his right of possession had been interfered with or that it had yielded to the public interest protected by Decreto Ley LXV, it being clear that he did not acquire ownership until the year 2004.—(...)” Mr. [Nombre62 001] did not file an appeal on points of law (recurso de casación), and the judgment therefore became final. VII.SUBSTANTIVE RES JUDICATA (COSA JUZGADA MATERIAL) WITH RESPECT TO THE STATE.- Having reviewed the record, this Court finds that, with respect to the State, the doctrine of substantive res judicata applies. Article 64 of the Code of Civil Procedure provides: “Article 64.- Res judicata. For res judicata to arise, there must be identity of parties, subject matter, and cause of action, which may be declared sua sponte. Its effects are limited to the operative provisions. Final judgments issued in ordinary proceedings and rulings expressly designated by law produce substantive res judicata, rendering the existence or nonexistence of the adjudicated legal relationship indisputable in another proceeding. Judgments issued in all other proceedings shall have the effect of formal res judicata (cosa juzgada formal), and the filing of an ordinary proceeding shall not prevent their enforcement.” Pursuant to the cited provision, the requisite analysis follows.
As relevant to this matter, on 29 de setiembre de 2014, the plaintiff herein, [Nombre62 001], filed an action before this Administrative Litigation Court against the State (expediente 14-008023-1027-CA), based on the same cause of action and seeking the same relief for which he now brings a new proceeding against the State (see image 2). Both on that occasion and in this proceeding, the plaintiff alleges that he is the registered owner of property in the Heredia registry district, real-property folio registration [Placa703 ], and that this property lies within the area that had been declared inalienable by the Constitutional Congress through Decreto Legislativo N°65 del 30 de julio de 1888; consequently, the State has prevented him from exercising all incidents of ownership over his property, allowing him only to retain possession. The plaintiff does not claim the loss of his ownership right to property N° [Valor 002] in the province of Heredia, but rather the inability to exercise any of the incidents of ownership over it until the State duly recovers that land as ordered by the Constitutional Chamber and pays him compensation for his right.
That inability to exercise rights over his property is the cause for which the claimant sued the State in proceeding number 14-008023-1027-CA and sought payment of compensation. In this new plenary proceeding (proceso de conocimiento), the plaintiff has likewise sued the State and also seeks payment of compensation on that basis, as expressly stated in his principal claim for relief (number 1), which reads: “That judgment be entered without specifying the amount ... ordering payment to my client, [Nombre62 001], as compensation for the damage caused by the inability to exercise rights over his property N° [Valor 002] in the Heredia registry district, the value of which shall be determined during enforcement of the judgment.” It is clear to this Chamber that, irrespective of the arguments set forth in each complaint, proceeding 14-008023-1027-CA and the present proceeding, both ordinary proceedings, involve complete identity of parties (the State and [Nombre62 001]), subject matter (compensation), and cause of action (inability to exercise rights over property N° [Valor 002] in the Heredia registry district due to the encumbrance imposed by Ley N°65 de 1888).
In view of the foregoing, it is relevant to note that, in proceeding number 14-008023-1027-CA, the Eighth Section of this Court already issued judgment N°13-2018 de las 15:30 horas del 20 de febrero de 2018, dismissing the plaintiff’s action. The relevant portion of its operative provisions stated: “The defense of lack of legal entitlement (falta de derecho) asserted by the State is sustained. The action brought by [Nombre62 001] against the State is declared unfounded (...).” As relevant here, the grounds for the judgment stated: “Now, regarding the relief sought by the plaintiff, the first claim reads: ‘a) That the respondent parties be ordered to pay the compensation arising from the declaration of a reserve over his property, for which purpose I request that the Ministry of Finance conduct the corresponding appraisals, as provided in the Expropriations Law.’.- In accordance with the foregoing, and as expressly provided in Article 1 of Decreto Ley N° LXV, the respondents cannot be ordered to pay compensation for the declaration of a ‘reserve,’ as the party describes it, since the terminology used by the legislature was ‘inalienability’ (inalienabilidad); however, such compensation is likewise unavailable because that reserve or inalienability was established by the legislature before title was granted through judicial action and before the plaintiff herein acquired the property.
Therefore, as provided by Article 129 of the Constitution, he may not plead ignorance of the law; and because Decreto Ley LXV remains in force, it cannot be disregarded, and the claim must consequently be denied.- As to the second claim, it reads: ‘b) That the respondent be ordered to pay subjective emotional distress damages (daño moral subjetivo) for the disruption caused by being unable to dispose of the property, of which my client has effectively been dispossessed for so many years. I estimate these damages at fifty million colones, an amount proportional to the harm caused.’.- For the same reasons already stated regarding the preceding claim, no individual right (derecho subjetivo) arising from the legal system exists in this case, because, under the constitutional mandate that no person may plead ignorance of the law, it would not be possible to disregard a statutory mandate intended to meet the water-supply needs of future generations in the provinces of Alajuela, Heredia, and San José, as the Constitutional Chamber noted in the decision cited above.
In this case, his ownership derives from a registration made after Decreto Ley LXV; accordingly, it is not possible to protect a legal situation predating the legislation that subjected that territorial area to public-interest restrictions and caused it, from that time onward, to form part of the State public domain (demanio público estatal). Furthermore, as stated in the findings regarding facts not proven, the plaintiff failed to establish, in accordance with the burden of proof set forth in Article 317 of the CPC, which applies supplementally pursuant to Article 220 of the CPCA, that his right of possession had been disturbed and had yielded to the public interest protected by Decreto Ley LXV, it being clear that he did not acquire ownership until 2004.- (...)” That judgment is now final. In that judgment, the Court adjudicated the merits of the relief sought by the plaintiff and denied it for the stated reasons.
Although the plaintiff’s arguments in this new proceeding focus primarily on challenging the public notice afforded by the Property Registry (publicidad registral), which led to the creation and acquisition of property N° [Valor 002] in the province of Heredia, the cause of action remains the same: the inability to exercise rights over that property due to the encumbrance affecting it because it is located within the inalienable area established by Ley N°65 de 1888. Accordingly, because proceeding 14-008023-1027-CA and the present proceeding, both ordinary proceedings, involve identity of parties, subject matter, and cause of action, substantive res judicata consequently exists in favor of the State. Thus, in this matter, what was definitively adjudicated in judgment N°13-2018 de las 15:30 horas del 20 de febrero de 2018 is indisputable, and this circumstance constitutes a statutory bar preventing this adjudicatory body from ruling again on the claims for compensation asserted against the State, which were already denied in the aforementioned judgment. Accordingly, the substantive res judicata defense reiterated by the State’s counsel in its closing arguments must be sustained, and the action against the State must be declared inadmissible.
VIII.LIMITATION PERIOD (PRESCRIPCIÓN) WITH RESPECT TO THE JUNTA ADMINISTRATIVA DEL REGISTRO NACIONAL.- Having reviewed the record, this Court finds that, with respect to the Junta Administrativa del Registro Nacional, the limitation period has expired. Article 41 of the Código Procesal Contencioso Administrativo provides: “Article 41.- The maximum period for commencing proceedings shall be the same as that established by the legal system as the limitation period for the respective substantive right at issue in the following cases: 1) In civil matters involving the Treasury. 2) In tax matters, including proceedings for a declaration of injury to the public interest (proceso de lesividad).” Pursuant to the cited provision, the requisite analysis follows. The plaintiff alleges that, although Ley N°65 was enacted in 1888, the Registro Nacional allowed the notation and registration of all private-party transactions that, from their inception, gave rise to the registry entry for property N° [Valor 002] in the Heredia registry district, without it being known that the property had been allocated to the public domain (demanio) since that time, and that this caused him, in reliance on legal certainty (seguridad jurídica) and good faith (buena fe), to acquire that property.
As stated in the preceding recital (considerando), the claimant seeks an order in these proceedings requiring payment of compensation in his favor because he is unable effectively to exercise control over his real property. With regard to the Junta Administrativa del Registro Nacional, this Court finds that this principal claim, as well as the ancillary claims, is time-barred. It must be recalled that the system governing the Administration’s financial liability (responsabilidad patrimonial) in the exercise of its administrative function (public-law capacity) is regulated by the Ley General de la Administración Pública, not by the Código Civil, since the latter applies only when adjudicating situations in which the Administration has acted in the exercise of its private-law capacity. Consequently, in light of the foregoing, the period to be used in calculating the limitation period in cases where an administered party (administrado) seeks compensation from a public body or entity for conduct inherent in the exercise of an administrative function, as in this case, is that established in Article 198, first paragraph, of the Ley General de la Administración Pública, namely, 4 years.
That provision states: “Article 198.- The right to claim compensation from the Administration shall become time-barred after four years, counted from the event giving rise to liability. (...).” Applying that rule to the present case, the plaintiff registered his ownership right (derecho de propiedad) over property N° [Valor 002] in the province of Heredia on 23 de setiembre de 2004. Until that time, the title appeared to be regular, and no encumbrance affecting the aforementioned property was known. It was not until 5 de agosto de 2008 that the Sala Constitucional issued decision N°2008-12109 and formally ordered the Ministerio de Ambiente y Energía and the Municipalidades de Heredia, Santa Bárbara, Barva, San Pablo, San Isidro, San Rafael, Santo Domingo, Moravia y Vásquez de Coronado to delimit the area affected by Ley N°65 de 1888 and initiate proceedings to recover the land in that area that was being occupied by private parties.
Accordingly, from the issuance of that order by the Sala Constitucional, the State was required to exercise its protective powers over the public domain and, consequently, to restrict and compensate private parties holding title to land located within the inalienable zone established by Ley N°65 de 1888. In this specific case, there is no evidence of the exact date on which the Ministerio de Ambiente y Energía informed the plaintiff that he could no longer exercise control over property N° [Valor 002] in the province of Heredia, or of the date on which it began taking material actions intended to prevent him from enjoying the property, for purposes of calculating the 4-year limitation period, since that would be the point at which the event giving rise to financial liability for the inability effectively to exercise control over the aforementioned property would have occurred. Nevertheless, it is undisputed that on 29 de setiembre de 2014 the claimant appeared before the courts and sued the State precisely because he was unable to exercise the incidents of ownership (atributos del dominio) over his property due to the inalienability established by Ley N°65 de 1888, as explained in the preceding recital.
Therefore, it is evident and inherently logical that, if the plaintiff filed suit on that date on that basis, it was because by that time the State had effectively prevented him from exercising control over property N° [Valor 002] in the province of Heredia. Consequently, that certain date, 29 de setiembre de 2014, may unquestionably be established as the starting point for calculating the period within which compensation could be claimed from the Public Administrations connected to the basis of the claim (the unavailability of property N° [Valor 002] in the province of Heredia). This places the expiration of the 4-year limitation period on 30 de setiembre de 2018, the date until which the plaintiff could claim compensation from the Administration for being unable to exercise control over his property due to its being affected by Ley N°65 de 1888. Nevertheless, the claimant did not do so because, although he filed that lawsuit against the State in 2014 (giving rise to proceeding 14-008023-1027-CA), he failed on that occasion to sue the Registro Nacional.
That omission meant that, by the time he filed these new proceedings on 10 de junio de 2020, the action seeking compensation from the Registro was time-barred. Accordingly, the limitation defense raised by counsel for the Junta Administrativa del Registro Nacional must be upheld, and the action against the Junta must be declared inadmissible.
IX.The expiration defense (caducidad) raised by the Junta Administrativa del Registro Nacional is manifestly unfounded, given that these are liability proceedings in which the annulment of no administrative act (acto administrativo) is sought. Therefore, the one-year expiration period established in Article 39 of the Código Procesal Contencioso Administrativo does not apply; rather, as explained above, the applicable period is the limitation period governing the substantive right at issue in the proceedings.
XI.REGARDING THE AFFIRMATIVE DEFENSES (EXCEPCIONES DE FONDO).- In view of the manner in which this matter is decided, no ruling is issued on the defense of lack of legal right (falta de derecho) raised by the Junta or on the defenses of lack of legal right and lack of passive standing on the merits (falta de legitimación ad causam pasiva) raised by the State.
By express provision of Article 193 of the Código Procesal Contencioso Administrativo, the plaintiff must be ordered to pay both categories of costs in this action solely because he was the unsuccessful party in these proceedings, there being no grounds justifying exemption pursuant to subsections a) and b) of the aforementioned Article 193. The costs shall accrue interest once their amount has been determined and becomes payable.
THEREFORE
The expiration defense is rejected. The defenses of res judicata on the merits (cosa juzgada material) raised by the State and expiration of the limitation period raised by the Junta Administrativa del Registro Nacional are upheld. Consequently, the complaint filed is declared inadmissible. The plaintiff is ordered to pay both categories of costs in this action, as well as any interest that may accrue thereon once their amount has been determined and becomes payable. Voto N°108-2021-II TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA, SECCIÓN SEGUNDA. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ. Goicoechea, a las trece horas treinta minutos del veintiséis de noviembre de dos mil veintiuno.- Proceso de conocimiento, declarado de puro derecho, de [Nombre62 001] , cédula de identidad número [CED62 ], contra la Junta Administrativa del Registro Nacional y el Estado. Intervienen los abogados Solón Armando Murillo Cruz en su carácter de apoderado especial judicial del actor, Nombre81957 en su condición de apoderada especial judicial de la Junta y Gloria Solano Martínez en su calidad de Procuradora. A continuación, se emite la sentencia por unanimidad, previa deliberación de rigor.

CONSIDERANDO
(Imágenes 2 a 33).
II.POSICIÓN DE LA DEMANDA.- La representación de la parte actora aduce lo siguiente: "PRIMERO: Mi representado adquirió, por compra, en el año 2004, la finca inscrita en el partido de Heredia al folio real número [Valor 002], que se describe en la certificación que se adjunta (Prueba documental N° 1). Después de una serie de movimientos por información posesoria, traspasos, reuniones y segregaciones previas a esa adquisición, nació la finca del partido de Heredia, folio real número [Valor 017], que le perteneció a [Nombre62 004], quien la vendió y traspasó a [Nombre62 005] y, este último, segregó y le vendió a mi representado [Nombre62 Placa1088], un terreno con una medida de ciento veintiún mil noventa metros con ochenta y un decímetros cuadrados (121.090,81 m2), según consta de plano catastrado Número [Valor 003]. Dicho inmueble segregado, se inscribió en el Registro de la Propiedad, Partido de Heredia, al Folio Real matrícula [Valor Placa704] y está situado en el [...], del cantón 1° Heredia, provincia de Heredia, que es terreno de potrero y bosque, que linda al [...].
La finca de mi representado, se encuentra ubicada en el punto conocido como "[...]". SEGUNDO: El inmueble antes descrito, tiene como orígenes, fincas que constan inscritas en el Registro Nacional desde el año de 1896 y, a continuación, se hace un detalle de los movimientos cronológicamente registrados desde entonces: Finca Número [Valor 006], fue inscrita el 23 de marzo de 1896, por orden del Juez Civil de Heredia en atención de una solicitud de título posesorio, planteada por [Nombre 006] (sic), quien, habiendo probado la posesión mediante el dicho de dos testigos, más el dictamen del Primer Agente Fiscal, exponiendo que desde hacía más de DIEZ AÑOS la poseía a Nombre62 propio, deja demostrado que poseyó el inmueble desde al menos dos años antes de la vigencia de la ley N° 65 del 30 de julio de 1888. La situación jurídica manifiesta en el citado documento, demuestra, entonces, que el señor [Nombre62 006] (sic) adquirió dicha finca en el año 1886, es decir, dos años antes de la promulgación de la ley ya mencionada (Prueba documental N° 2 del Expediente Administrativo).
Nótese, como detalle de mucha importancia, que el dicho del solicitante del título posesorio, fue debidamente probado, no solo testimonialmente, sino también por el dictamen del Primer Agente Fiscal de Heredia. Así las cosas, la posesión privada llega a serlo desde el año 1886 como mínimo, evidentemente anterior a la vigencia de la ley 65. Finca [Valor 009] del Tomo [Valor 032], Folios [Valor 042], [Valor 043], [Valor 044] y Tomo [Valor 045], Folio [Valor 046]. a. Asiento [Valor 047]. Finca formada por la reunión de las N°s [Valor 007] y [Valor 006] (Prueba documental N° 3) Propiedad de [Nombre62 007] y fue adjudicada y registrada a Nombre62 de [Nombre 008], el 14 de junio de 1916 (Prueba documental N° 7 del Expediente Administrativo del MINAE. b. Asiento [Valor 048]. [Nombre62 008] vende la finca dicha, a [Nombre62 009] y se registra el 9 de mayo de 1919. c. Asiento [Valor 049]. [Nombre 009], vende la finca descrita a [Nombre 010] y así se asienta registralmente el 5 de abril de 1920. d. Asiento [Valor 050].
Por arreglo judicial, el señor [Nombre62 010], vende a [Nombre 012] (sic) esta finca. e. Asiento [Valor 012]. Siendo la presente finca propiedad de [Nombre 012], según Asiento [Valor 051], el Juzgado Tercero Civil de Heredia la remató en [Nombre62 013]. f. Asiento [Valor 052]. Se rectifica la cabida de la finca, quedando ésta en 6 hectáreas, 9.190 metros y 70 decímetros; el 25 de noviembre de 1973. g. Asiento [Valor 053]. Siendo la presente finca propiedad de [Nombre62 013], la vende a [Nombre 014], S.A. cuyo traspaso se inscribe el 15 de marzo de 1961. h. Nota al Margen: En el folio [Valor 044] del Tomo [Valor 032], se lee nota al margen que dice: "Refundida esta finca en la número [Valor 016] , folio [Valor 031] , tomo [Valor 030] en virtud de venta a [Nombre62 015] y [Nombre62 016]...". Finca [Valor 016] Tomo [Valor 030], folios [Valor 031], [Valor 042] y [Valor 013]. Nótese de estos documentos que, en ninguno de los Asientos se indica ni por anotación al margen u observación que, se haya hecho alguna objeción a esta inscripción (Prueba documental N° 4).
Inscripción 1. Se indica que este es terreno cultivado y con montaña limpia, deslindado y con cercas de cuatro hilos de alambre de púas, construidas desde hace más de cuarenta años. Se trata de finca conocida como [...], ubicada en [...] de Heredia. Su medida es de 13 hectáreas 729 metros 10 decímetros cuadrados. Indica que es propiedad de la sociedad [Nombre 014], S.A. y que por estar contiguas las [Valor 009] y [Valor 010], las reúne en una sola, formando la aquí indicada y la vende junto con otra que se describe en una separación posterior inmediata, a [Nombre62 015] y [Nombre62 016]. Esta voluntad queda inscrita en el Registro el 16 de junio de 1962. Inscripción 2. Se trata de una inscripción hipotecaria, sin interés en este proceso. Inscripción 3. Folio [Valor 031]. Los indicados propietarios ceden su derecho a la sociedad [Nombre 020], S.A., pudiendo abreviarse en español, [Nombre 021] S.A. este movimiento registral se oficializa el 20 de junio de 1975.
Asiento [Valor 050]. Folio [Valor 042]. Es cancelación hipotecaria, sin interés para nuestro proceso. Inscripción 5. Se consigna en este asiento, la venta de dicha finca a la sociedad [Nombre 035], S.A. Se indica, en el mismo asiento que, dueña ya la citada sociedad, de la finca dicha, la vende a [Nombre 022]. S.A. Se anota registralmente el 22 de enero de 1981. Inscripción [Valor 012]. Folio [Valor 013] . Se refiere a una anotación de corrección de texto, sin interés para nuestro caso. Finca [Valor 014]. Propiedad de [Nombre 023]. Su origen es la reunión de las fincas [Valor 015] y [Valor 016], según se indica en la copia de la escritura pública cuya copia se aporta. Mide 66ha 4974m2 con 8dm2. Segrega y vende lote a [Nombre62 004]. Este lote segregado, de 13 hectáreas, toma el número [Valor 017] del folio real. El resto del terreno de la finca [Valor 014], mide 53 hectáreas, 4.974,80 m2.
En la escritura de reunión de las fincas antes citada, al final del primer folio y vuelto, el notario agrega una referencia sin que tome nota el registro, que dice lo siguiente: "...se hace constar: Que sobre la presente reunión de fincas existe un contrato forestal de cultivo de jaúl celebrado por [Nombre 024] , en representación de la sociedad [Nombre 025] Anónima, anterior propietaria de la finca y Nombre82147 , en representación del Estado, como Ministro de Agricultura, Ganadería y Hacienda, cuya fecha de inicio lo fue el veintidós de octubre de mil novecientos setenta y nueve y cuyo vencimiento lo es el veintidós de octubre de mil novecientos ochenta y nueve. El suscrito notario advierte al compareciente que sobre las fincas a reunir existen documentos pendientes de inscripción". La observación apuntada, muestra a un alto funcionario representante del Estado costarricense, suscribiendo un contrato forestal con una persona privada, con efectos sobre un bien inmueble cuando, de acuerdo con lo que establece la Ley 65, dichos terrenos ya eran de dominio público, desde hacía más de trece décadas.
Es de deducir, con un grado mayúsculo de posibilidad de certeza y de lógica, que el señor ministro desconocía la naturaleza demanial de los terrenos en cuestión, pero tal ignorancia resulta a causa de la falta de acuciosidad y diligencia del Registro Nacional. (Prueba documental N° 5). Finca [Valor 017]. El terreno adquirido de [Nombre62 004], es reunido con otros terrenos adyacentes, que quedan registrados bajo este mismo número de folio. Luego de la reunión su cabida es de 130.000,00 m2, según plano catastrado N° [Valor 019] que se aporta certificado, como prueba. Como se dijo, esta finca es propiedad de [Nombre 005]. De acuerdo con Consulta por número de finca, en el Registro Nacional, esta finca tiene como antecedente la N° [Valor 014] (Pruebas documentales N°s 6 y 7). Siendo el señor [Nombre62 005], propietario de la finca folio real N° [Valor 017] del Partido de Heredia, que mide 130.000,00 m2, según plano catastrado N° [Valor 019], segrega un lote de 121.090,81 m2 según plano catastrado No [Valor 003] y lo vende a [Nombre62 001].
Finca [Valor 002]. Mediante Certificación Registral, se muestra la Finca [Valor 017], como antecedente de la N° [Valor 002], que mide 121 mil metros con 81 decímetros cuadrados (Prueba Documental N° 1). TERCERO: Como ya se indicó, mi representado adquirió, mediante cesión onerosa, la finca [Valor 002], en el año 2003. Para la adquisición de dicho inmueble, se procedió, como debe ser, a la comprobación previa del estado registral de dichos terrenos, y se determinó que la citada finca no tenía ninguna clase de anotación registral, ni de sentencia judicial que hiciera alertar de algún impedimento. Teniendo tal comprobación como datos fidedignos, mi representado adquirió la citada finca, respaldado en el principio de Seguridad Registral, pues como se apreciará, cada uno de los movimientos, en su momento fue debidamente revisado, autorizado y anotado en el Registro Nacional, por funcionarios competentes, y nunca mediaron, pues no consta en ninguno de los asuntos de Diario, razones para tener la menor desconfianza en la correcta inscripción de la citada finca.
De esta forma, en el año 2004 se procedió a la presentación ante el Registro Público Nacional, de la escritura de compraventa, para su inscripción a su nombre. CUARTO: No fue sino hasta el año 2008, cuando la finca tenía ya cinco años de adquirida, que mi representado se enteró de la vigencia de una vetusta ley, y que había sido dictada sentencia en un recurso de amparo cuyo proceso fue el Número 07-007996-0007-CO, en contra de varias instituciones del Estado, entre las cuales figuraron la Municipalidad de San Rafael de Heredia y el MINAE. Este recurso denunció violación a lo dispuesto en varios artículos de la Constitución Política, ya que, según se indicó en el amparo, la Empresa de Servicios Públicos de Heredia estaba fomentando la contaminación y destrucción de las zonas de protección, al instalar redes eléctricas para la construcción privada de chalets, cabañas y hoteles de montaña en las zonas de recarga y reservorios de aguas subterráneas.
Lo anterior, prohibido en razón de la Ley 65, del 30 de julio de 1888, que declaró inalienable una zona de terreno de dos kilómetros de ancho, a uno y otro lado de la cima de la montaña conocida con el Nombre62 de Montaña del Volcán de Barba, desde el cerro llamado Zurquí, hasta el que se conoce con el Nombre62 de Concordia. Este recurso de amparo tuvo un resultado estimatorio, de acuerdo con Resolución N° 2008-12109, de las 15:16 horas del 5 de agosto del 2008. En lo que se refiere a la municipalidad de San Rafael, la Sala ordenó a quien ocupe su cargo como Alcalde y a quien ocupe su cargo como Presidente del Concejo de la Municipalidad de San Rafael de Heredia, "que de inmediato procedan a realizar las acciones que conforme a derecho contra el refugio de perros abandonados que existe en el Refugio de Vida Silvestre Jaguandurí (sic), e investiguen la denuncia planteada por el Grupo Comité Salud de los Ángeles de San Rafael, con respecto a la supuesta contaminación que existe en dicho sitio".
Asimismo, la sentencia ordenó a quien ocupe su cargo como Ministro del Ambiente y Energía, "que dentro del plazo de siete meses contado a partir de la notificación de dicha sentencia, realice las gestiones que estén dentro del ámbito de sus competencias para que se delimite físicamente la zona establecida por la ley número 65 de 1888, y luego de ello, inicie los procesos de recuperación de los terrenos que se ubican en dicho sector y que estén siendo ocupados por particulares". Fue en este punto en que mi representado se interesó en levantar una información detallada sobre los documentos, no solo del Registro Público sino también del Archivo Nacional, y halló que, se asentaron movimientos previos, de informaciones posesorias, segregaciones, reuniones, traspasos por venta de los terrenos e hipotecas, desde el año 1896, todos, debidamente asentados en el Registro inmobiliario. A partir del citado voto, mi representado ya no pudo seguir dando atención, mantenimiento ni vigilancia a su propiedad; además, la municipalidad dejó de darle mantenimiento al camino de acceso, de manera tal que, no se pudo ya más, entrar ni siquiera en vehículo de doble tracción a dicho sitio.
Además, por la falta de vigilancia, las pertenencias y materiales de la casa de habitación que tenía allá, fueron saqueadas por delincuentes que llegaron posteriormente. La municipalidad tampoco concedió más permisos para obras constructivas en la zona, cosa que antes sí concedía (Véase el punto ññ de los Hechos Probados incluidos en el Voto 2008-12109). QUINTO: De acuerdo con lo dictaminado por el Sistema Nacional de Áreas de Conservación Cordillera Volcánica Central, SINAC, mediante Oficio ACCVC-PNE-001-2015, signado por el Lic. Nombre82148 , Coordinador, la finca matrícula [Placa703 ] de la provincia de Heredia, propiedad de [Nombre62 001], se ubica totalmente dentro del área geográfica abarcada por el Decreto Ley LXV del año 1888 (Prueba documental N° 8). SEXTO: El voto 2008-12109, de reiterada cita, de la Sala Constitucional, le ordenó, entre otras, a la Municipalidad de San Rafael, textualmente: "a) Que de inmediato se abstengan de otorgar cualquier tipo de permiso dentro de la zona establecida por la ley número 65 de 1888, en lo que respecta a sus jurisdicciones".
Por esa razón, a partir de tales disposiciones, ya mi representado no pudo continuar dando mantenimiento a la propiedad, ni tuvo posibilidad de contar con un acceso vial apropiado para vehículos motores, de manera que la finca fue perdiendo su buen estado, de manera inexorable, en razón, tanto de la acción de la Naturaleza, como de personas desconocidas que, comenzaron a hurtar todos los bienes existentes en el inmueble. Esta circunstancia, tan nefasta para los intereses patrimoniales de don [Nombre62 001], no obsta para que la inacción de las diferentes instancias estatales continúe hasta el día de hoy, pues no se ha iniciado el estudio de la situación de cada poseedor o propietario registral en la zona dicha y, como se aprecia de los hechos aquí expuestos. SÉPTIMO: A pesar del tiempo transcurrido desde el dictado de la Ley 65, 30 de julio de 1888, a la fecha de esta demanda, es decir, 131 años y 7 meses, el Estado costarricense, por medio del Registro Público, continuó dando curso normal a las gestiones particulares de anotación de los asientos, muy a contrapelo de lo acotado por la jurisprudencia, que ha sentenciado: "V.
Existen diferentes fuentes de los derechos reales. Están constituidas por los hechos idóneos autorizados por el ordenamiento jurídico para generar su nacimiento o constitución". (Resolución 000431-F-00 de las 15:55 horas del 7 de junio del 2000, de la Sala Primera de la Corte Suprema de Justicia), provocando con su omisión, que mi representado, al igual que muchas otras personas, haya incurrido en la adquisición de su finca, confiando en la seguridad jurídica que se espera del Registro Nacional y actuando en todo momento apegado a la buena fe, pues nunca pudo imaginar siquiera que, hace casi 132 años, pudiera haberse dictado una ley de afectación al demanio, sin ejecución y que estuviera afectando terrenos que, en el registro aparecían libres de cualquier impedimento para su comercio. Más grave aún, no obstante haber dictado la Sala Constitucional el voto 2008-12109, ha continuado la inacción del Estado, propiciando la inversión privada cuantiosa en dichos terrenos que, al suspenderse abruptamente a partir del citado voto, ocasionando con ello los ingentes daños patrimoniales que han sufrido los perjudicados, pues, no se pueden realizar mejoras en terrenos que, hoy se sabe, tienen una condición jurídica "res extra commercium".
OCTAVO: No es pretensión de mi representado, conservar en su posesión el inmueble, pues está informado de la potestad de imperio del Estado, para afectar los bienes que estime de interés para la protección del bien público, sin embargo, al haber sido perjudicado en su patrimonio familiar, obtenido de su arduo trabajo, mi representado, quien ya cuenta 72 años de edad, continúa viendo peligrar su interés patrimonial y, la permisividad registral le ha ocasionado un grave riesgo de no llegar a ver asegurado su esfuerzo de toda la vida y más bien, de verlo perderse irremediablemente, a causa de la inaplicación de los alcances de la ley 65, por parte del Registro Nacional, máxime en las condiciones de pandemia que asuelan el mundo hoy día. El derecho de mi representado se sustenta en Principios Jurídicos que resultan fundamentales y, como tales, consagrados en nuestra Constitución Política. Ahora bien, sabemos que, los principios no son jurídicos per se, y solo lo serán, si forman parte del bloque de legalidad.
Pues bien, el Principio de Buena Fe ha sido ampliamente desarrollado y garantizado por el Derecho de la Constitución, la jurisprudencia y la Ley (Art. 21 del C.C.). También la doctrina ilustra ampliamente sobre este principio [hace cita] que se refiere al deber de cooperación entre las partes contratantes. Y, ¿qué mayor cooperación que la de asegurar la correcta inscripción del bien en el Registro Inmobiliario, tanto por parte del comprador como del vendedor? Igualmente, el principio de Seguridad Registral, que establece el Código Civil en sus artículos 460, 462 y 463. A partir de los cánones invocados, resulta palmario el derecho de mi representado, al resarcimiento de los daños patrimoniales que está sufriendo, por la adquisición de un bien inmueble que, pertenece al demanio pero que, por omisión del Registro de la Propiedad, no se indicó así en sus asientos, no una vez, sino, como se aprecia de la prueba aportada al respecto, en múltiples ocasiones consecutivas, a partir del año 1896.
NOVENO: Tal y como lo sentenció el Voto 12109-2008, y lo reiteró la Opinión Jurídica OJ-020-2009 del 20 de febrero del 2009, de la Procuraduría General de la República (PGR), el organismo responsable de ejecutar, tanto los alcances de la Ley 65 de 1888, como el inicio de los procesos de recuperación de los terrenos que se ubican en dicho sector y que estén siendo ocupados por particulares, es el Ministerio del Ambiente y Energía, MINAE, por medio de sus órganos subordinados. No obstante, su inacción terminó de facilitar el convencimiento de mi representado, de que la compra del terreno en cuestión, era una compra favorable a sus intereses. Igualmente, se produjeron actuaciones por parte de la Municipalidad de San Rafael de Heredia, que vinieron a provocar en mi representado, la toma de la decisión de comprar el inmueble. En efecto, las acciones de estos órganos y entes componentes del Estado, se detallan en el Voto 12109-2008, del que interesa resaltar lo que declara en su apartado de Hechos probados: d. "Por resolución número 943-2004-SETENA de las 11:20 horas del 22 de junio de 2004, la Secretaría Técnica Nacional Ambiental, otorgó viabilidad ambiental, para la solicitud de construcción de una casa pequeña en el Dirección8865 en Heredia, presentada por el señor [Nombre62 027].
(Folios 212 a 214 del expediente)". Nótese cómo, una entidad dependiente del MINAE según Decreto No 36815-MINAET del 12 de setiembre del 2011, otorgó viabilidad ambiental para una casa de habitación en la zona incluida dentro de la delimitación de la ley 65. k. "Por notificación número 1087 del 5 de mayo de 2005, la Municipalidad de San Rafael previno a la Sociedad Humana de los Estados Unidos de América, que debía cumplir con una serie de requisitos para la habilitación de un hospital veterinario en la Reserva Jaguarundi. (Folio 769 del expediente)". Según este hecho probado, la Municipalidad de San Rafael le dictó a una entidad privada, una serie de requisitos para habilitar un hospital veterinario en la misma zona. Ergo, si le dictaron una serie de requisitos, es porque ese gobierno local dejó abierta la posibilidad de otorgar el permiso de construcción de la instalación. m. "Por notificación número 1120 del 20 de junio de 2005, la Municipalidad de San Rafael de Heredia, previno a la Sociedad Humana de los Estados Unidos de América, que debía de cumplir una serie de requisitos para la habilitación del albergue de perros que tenía en la Reserva Jaguarundi.
(Folio 54 del expediente)". De idéntica forma, el gobierno local de San Rafael, le previene a un particular, de una serie de requisitos que debía cumplir para la construcción de un albergue de perros en la zona. z. "Por Informe Técnico del 15 de febrero de 2006, la Msc. Ruth Tiffer Sotomayor, y el Lic. Marlon Salazar Chacón, del Centro Científico Tropical, estimaron en el Refugio de de Silvestre Jaguarundi, podía construirse un albergue para perros callejeros, sin que ello implicare un riesgo para el medio ambiente. (Folios 134 a 147 del expediente)". Desconozco la naturaleza jurídica del aquí citado Centro Científico Tropical, pero el caso es que, es un hecho probado señalado por el voto de cita, donde se entrega un aval, legítimo o ilegítimo, pero existente, para construcciones en la zona de discusión. aa. "En fecha no precisada, el señor Nombre82151 , Biólogo Encargado del Componente de Vida Silvestre del Área de Conservación Volcánica Central, emitió el Informe Técnico número IT-VS-001-06, en el que se señala que en el Refugio de Vida Silvestre Jaguarundi podía desarrollarse un albergue para perros callejeros, siempre y cuando se cumpliera con una serie de recomendaciones.
(Folios 132 a 133 del expediente)". En este otro hecho probado, este órgano dependiente del MINAE, emite un "Informe Técnico" que avala el desarrollo de un albergue para perros en la zona. cc. "Por apercibimiento administrativo número 1 del 25 de abril de 2006, el Alcalde Municipal de San Rafael de Heredia, solicitó a la representante de la Sociedad Humana de los Estados Unidos, que procediera a limpiar los terrenos de su propiedad. (Folio 762 del expediente)". En este hecho probado, nos hallamos ante una actuación del alcalde municipal de San Rafael, mediante la que ordena la limpieza de los terrenos propiedad de la "Sociedad Humana de los Estados Unidos". Nótese que, además de que le ordena limpiar los terrenos, lo cual es muy diferente a desalojar, reconoce como propietaria a dicha sociedad, pero se trata de terrenos afectados por la ley 65 de 1888. ee. "Por escrito del 12 de junio de 2006, el Ministerio Público solicitó al Juzgado Penal de Heredia, que se desestimara la denuncia presentada contra el Refugio de Vida Silvestre Jaguarundi.
(Folios 391 a 398 del expediente)". Aquí estamos ante una actuación de un órgano del Estado costarricense; esta vez, del Poder Judicial, que solicita desestimar una denuncia contra un ocupante de terrenos en dicha zona de dominio público. ii. "Por resolución número R-O69-SINAC-2007 de las 09:40 horas del 05 de junio de 2007, el Director General a.¡. del Sistema Nacional de Áreas de Conservación, acogió el recurso de apelación planteado por el Refugio de Vida Silvestre Jaguarundi contra la resolución SRC-024-05, y autorizó la actividad de refugio de perros abandonados en dicho lugar, siempre y cuando cumpliera con una serie de disposiciones. (Folios 168 a 175 del expediente)". En este hecho probado, se aprecia la actuación autorizadora del Director General interino del SINAC, para el funcionamiento de un refugio de perros. ññ "A la fecha en que rinden su informe dentro del presente recurso de amparo, las autoridades de la Municipalidad del Cantón Central de Heredia, únicamente había otorgado dos permisos de construcción dentro de la zona establecida por la ley número 65, los cuales fueron dados luego de que se cumplieran todos los requisitos establecidos por la legislación vigente.
(Informe a folio 280 del expediente)". En este hecho probado, se detalla la autorización de dos permisos municipales de construcción dentro de la zona contemplada por la ley 65, pero, dice que los permisos fueron dados luego de comprobar que se cumplieron todos los requisitos establecidos por la legislación vigente, lo cual no es cierto, pues, como se viene viendo, se trata de bienes demaniales, de manera que no se podía otorgar permisos para construir allí. Los hechos anteriormente detallados, tomados del voto 2008-12109 ya conocido, no aportan al objeto de la presente demanda, pero demuestran que, dentro de la zona delimitada que se creó mediante ley 65, de 1888, se produjeron actuaciones irregulares, ilegítimas, con dolo o sin él, cometidas por funcionarios de instituciones componentes del Estado y que estas actuaciones, suplieron o reforzaron la confianza para la consumación de la compra de la finca ubicada en ese sitio afectado al demanio.
DÉCIMO: Todas las infracciones de carácter registral que constan en autos, permitieron a mi representado, primero, adquirir el bien, con total confianza y buena fe y, después, realizar mejoras, mantenimiento e inversiones en la citada finca, todo lo cual fue produciendo un incremento en el valor de dichos terrenos, agregado a las obras de mantenimiento que la Municipalidad de San Rafael le daba originalmente al camino de acceso, por el cual, era posible transitar anteriormente en vehículos rurales. Las conductas omisas por parte del Registro Nacional, produjeron la interposición del recurso de amparo que concluyó con la suspensión de cualquier actividad de mantenimiento y atención de las propiedades ubicadas en esos terrenos, con lo que se produjo la drástica reducción del valor comercial que esas propiedades pudieron alcanzar, de manera que, un posterior peritaje, deberá contemplar el valor del inmueble, a la fecha de suspensión de las labores de atención de la finca, fecha que se podría ubicar en la misma data del voto 12109-2008, a fin de que se pueda indexar tal avalúo, para ejecución de sentencia.
DÉCIMO PRIMERO: Cada una de las omisiones cometidas por el Registro, le dejó al inmueble una marca, una señal de corrección registral, para contar en la posesión del inmueble. Y, en tales circunstancias, la jurisprudencia y la ley pueden tener por establecido que la demanialidad hace que, por el transcurso del tiempo, no se adquiera ningún derecho sobre los bienes afectados al dominio de Estado. Puede, asimismo, la inalienabilidad, imposibilitar el traspaso parcial o total de bienes en términos del derecho privado. Se puede alegar que, la detentación prolongada por parte de los particulares, no produce efectos adquisitivos, y que la tolerancia, o tardanza de la Administración para repeler sus actuaciones, no confieren ningún derecho. O bien, la jurisprudencia puede sentenciar que los principios de inalienabilidad e imprescriptibilidad que caracterizan a los bienes dominicales, y que la publicidad legal del demanio, se oponen a que en su contra pueda esgrimirse la figura del tercero registral.
Todo lo anterior es incontrastable. No obstante, las acciones y las omisiones transgresoras del ordenamiento jurídico, por parte de los diversos estamentos administrativos del Estado, no pueden evadir impunemente lo establecido por el numeral 1045 del Código Civil: "Todo aquél que por dolo, falta, negligencia o imprudencia, causa a otro un daño está obligado a repararla junto con los perjuicios"; tampoco podría obviarse el artículo 190 siguientes y concordantes de la Ley General de la Administración Pública, referentes a la responsabilidad de la Administración, así como el 1° del Código Procesal Contencioso Administrativo. Y todas estas normas del bloque de legalidad, tuteladas desde el Artículo 41 de nuestra Constitución Política, alzan su mensaje obligante en favor de mi representado. El Estado, por medio de su órgano desconcentrado denominado Ministerio de Ambiente y Energía, incurrió en una conducta omisa, la cual resulta ilícita por quebrantar los artículos 11 y 129 de la Constitución Política, al dejar sin ejecución oportuna lo establecido por la Ley 65.
Además, según los numerales 190 y 191 de la Ley General de la Administración Pública, la Junta Administrativa del Registro Nacional, es responsable civil frente a mi representado, por autorizar de forma continuada, las inscripciones y los Asientos en el Registro Público, de los diversos movimientos de compra venta, traspaso, reunión y segregación de fincas en el sitio denominado [...] , donde se ubica el inmueble de cita, para, posteriormente, negarle toda posibilidad de disponer el goce de una finca que, en principio no debió permitirle inscribir a ninguno de los terceros, por no estar en el comercio de los hombres. En tal sentido, el Estado puede quedarse con el inmueble de la especie. La Potestad de imperio le asiste, pero, los cuantiosos perjuicios que las conductas omisas en contra del ordenamiento jurídico, que a mi representado lo tienen al borde de perder el patrimonio producto del trabajo de toda su vida, debe ser indemnizado oportuna, justa e integralmente.
DÉCIMO SEGUNDO: Mediante sentencia N° 13-2018 de las 15:30 horas del día 20 de febrero de 2018, del Tribunal Contencioso Administrativo, Sección Octava, fue desestimada una pretensión de mi representado, en el proceso N° 14-008023-1027-CA, cuyo objeto y partes son diversos del presente, aunque siempre referidos a la misma finca. Para los fines que interesan al presente proceso, el Considerando X de dicha Resolución, citando el tantas veces mencionado Voto de la Sala Constitucional, dice lo siguiente: "Debe tomar en consideración el recurrente, que con la mera delimitación no se afecta de manera directa su propiedad privada, pues aún se desconoce si la misma se encuentra plena o parcialmente dentro de la zona inalienable ya dispuesta por ley...". A la fecha actual, como lo indiqué en el Hecho Quinto, ya el MINAE determinó que la finca de mi representado se ubica enteramente dentro de la zona afectada por la ley 65, de manera que, ahora sí existen efectos negativos para sus intereses patrimoniales y, teniendo en cuenta que dicho ministerio no ha dado ni siquiera indicios de que va a empezar a hacer las labores de recuperación de los bienes afectados, a la edad de mi representado, 72 años, existe una clarísima situación de riesgo de no encontrar reparación a los daños sufridos en su patrimonio, dado que no puede, ni podrá, acceder al goce de todas las prerrogativas de dueño legítimo de la propiedad.
En este mismo sentido, el Dictamen C-480-2014, del 19 de diciembre de 2014, de la PGR, declaró: "Realizado el estudio preliminar por parte del Departamento Legal del Área de Conservación, aquellos asientos registrales que no estén amparados al ejercicio de la posesión decenal previa a la afectación del dominio público han de ser puestos en conocimiento de la Dirección del Registro Inmobiliario a efecto de que valore las anotaciones de advertencia respectivas, así como de la Asesoría Jurídica del Ministerio de Justicia para el estudio y valoración de los casos que requerirían declaratoria de Lesividad previa al ejercicio de la acción judicial para la cancelación de los asientos de registro y catastro que comprendan indebidamente la Zona Inalienable de la Ley 65 de 1888". (Último párrafo). Como se aprecia, ninguno de los estamentos del Estado ha cumplido con sus competencias, que se encuentran claramente definidas, con el consiguiente perjuicio para mi representado".
III.POSICIÓN DE LA CONTESTACIÓN DE LA JUNTA ADMINISTRATIVA DEL REGISTRO NACIONAL.- La representación de la Junta contestó lo siguiente: "Con fundamento en el artículo 66 incisos f) j) k) del Código Procesal Contencioso Administrativo (CPCA), se plantean las siguientes defensas previas: Falta de Integración de la Litis. [Rechazada por la Jueza Tramitadora]. Cosa Juzgada material. De una revisión del expediente judicial 14-008023-1027 tramitado en el Tribunal Procesal Contencioso Administrativo y de lo dictado en la resolución No. 13-2018, de las 15:30 horas del veinte de febrero de 2018, la parte actora menciona en el escrito de demanda que "(...) fue desestimada una pretensión de mi representado, (...) cuyo objeto y partes son diversos del presente, aunque siempre referidos a la misma finca". Contrario a la alegación anterior, es más que notable que quien interpone la demanda que nos ocupa, es el señor [Nombre62 001], pretendiendo para sí que se condene a las partes, en este caso al Estado y a la Junta Administrativa, al pago indemnizatorio que por declaratoria de reserva que se da sobre la propiedad del Partido de Heredia Matrícula N° [Valor 002].
Analizado el instituto de cosa juzgada por parte de la Sala Primera en su resolución No. 00041 - 2018, del 25 de enero del 2018, se ha reiterado lo siguiente: [Transcribe parcialmente la sentencia]. En este caso, es más que claro que lo reclamado por la parte actora tanto en el proceso anterior como en este, es la indemnización por la no disponibilidad del bien, así como el daño moral y material, ocasionados ante la declaratoria de reserva que recayó sobre la propiedad del Partido de Heredia, Matrícula N° [Valor 002], perteneciente al señor [Nombre62 001] , al encontrarse ésta sometida a lo preceptuado en la Ley 65. Es así como en el 2014, quien interpone la actual demanda, acude a un proceso contencioso administrativo, acción que realizó contra el Estado, presentándose como tercero interesado el SINAC (Sistema Nacional de Áreas de Conservación) en el que se declara mediante resolución N°13-2018, de las 15:30 horas del veinte de febrero de 2018, improcedente, al establecerse que la inalienabilidad de las tierras que se encuentran en la zona, incluidas las del señor [Nombre62 001], fue dispuesta por el legislador con anterioridad a la titulación original que se diera mediante diligencias de Información Posesoria afectando los subsiguientes movimientos hasta la adquisición del demandante, por cuanto de conformidad con el artículo 129 de la Constitución Política, no se puede alegar ignorancia de la ley y al estar vigente la Ley 65, esta no se puede desaplicar.
En relación con las pretensiones de daño moral subjetivo por no poder disponer del inmueble igualmente, se le declara improcedente lo pretendido, "(...) al no existir ningún derecho subjetivo derivado del ordenamiento jurídico, toda vez que en aplicación del mandato constitucional de que nadie puede alegar ignorancia de la ley(...) no se puede desconocer lo que esta norma pretendía en cuanto a la protección de los mantos acuíferos de la zona, por lo que no es "(...) posible tutelar una situación jurídica anterior a tal normativa que sometió esa zona territorial a limitaciones de interés público y que conformaban desde ese momento parte del demanio público estatal.(...)". Como se puede apreciar, el punto medular de las acciones que ha realizado la parte actora, tanto a nivel administrativo, como a nivel judicial son idénticas y tienden al mismo objetivo, cual es la indemnización por la indisponibilidad del bien para ello ha utilizado argumentos similares dentro de los hechos, tendientes a que se declare la responsabilidad de mi representada al enfocar sus argumentos desde el punto de vista registral.
En efecto en este asunto han existido actuaciones y omisiones de otros entes que han sido cuestionados y sancionados, pero esto sale de la esfera de competencias del Registro Nacional, siendo mi representada un eslabón dentro de la situación, sin comprobación alguna de la existencia de conductas contrarias al ordenamiento jurídico que nos rige. Caducidad de la acción. A efectos de acreditar la existencia de la presente excepción con respecto de las actuaciones desplegadas por mí representada que se acusan como omisas y erróneas por la parte actora y en consecuencia como eventuales generadoras de responsabilidades administrativas, es necesario en primer término precisar cuál es el hecho puntual a partir del que se debe efectuar el cómputo del plazo de ley establecido para esta excepción. De acuerdo con lo expresado en su escrito de demanda, el hecho principal del que se derivan tanto su pretensión principal como la accesoria corresponde a la supuesta indisponibilidad del inmueble de Partido de Heredia Matrícula N° [Valor 002].
Actuaciones que no corresponden al ámbito registral, por cuanto es la Ley 65 la que determina la inalienabilidad de las tierras de la parte actora, originadas en una serie de movimientos registrales realizados en un inicio mediante Diligencias de Información Posesoria de las que el Registro Nacional solo procedió con el cumplimiento del mandato judicial del cual se desprende la publicidad registral que se publicita. Lo anterior por cuanto según señala la parte actora, con estas actuaciones consideradas omisiones se afectó el derecho de posesión del inmueble adquirido. Tal y como se desprende de estas consideraciones, las fechas a partir de las cuales debe efectuarse el cómputo relacionado son las siguientes: -23 de septiembre de 2004. Fecha en la que se practica la inscripción de la finca [Valor 002]. -Agosto de 2008. Fecha en que la parte actora conoce de la resolución de la Sala Constitucional de 15:16 horas del 5 de agosto de 2008, donde según hecho 4 de la demanda, indica que conoce de la Ley 65 de 1888. -2015, Oficio ACCVC-PNE-2015, sin fecha, que es Constancia del Coordinador de Patrimonio Natural del Estado, en el que se concluye que la finca del Partido de Heredia Matricula Placa891° [Valor 002] , se encuentra dentro del área geográfica abarcada por el Decreto de Ley 65 del año 1888.
Así las cosas tenemos que en lo concerniente a las actuaciones del Registro Nacional y de las que según la demanda derivan los presuntos daños y perjuicios alegados, dada su naturaleza registral al tenor de las reglas establecidas en los artículos 267 y 455 del Código Civil y 32 de la Ley 3883 Ley de Inscripción de documento en el Registro Público, el inicio del plazo para computar el acaecimiento de la excepción de caducidad que se invoca debe efectuarse desde el momento en que con la inscripción accedieron a la publicidad registral y podían por ende ser objeto de conocimiento de cualquier interesado, norma que debe relacionarse al efecto con lo establecido en el numeral 175 de la Ley General de la Administración Pública. En este punto la posición del Tribunal Contencioso Administrativo ha sido consistente con dicha tesis y en la resolución de las quince horas del veintidós de junio de dos mil doce dictada por la Sección Quinta Anexo A, de dicho Tribunal, se razonó lo siguiente: [Transcribe parcialmente la sentencia].
En virtud de las anteriores consideraciones y de conformidad con el artículo 175 de la Ley General de la Administración Pública en su versión previa a la reforma operada por el Código Procesal Contencioso Administrativo, aplicable al momento de adquisición e inscripción del bien por la parte actora, así como el plazo para la interposición de la presente acción respecto de los movimientos posteriores relacionados con la propiedad, se encuentra caduco. De considerarse como hecho generador el conocimiento de lo dispuesto por la Sala Constitucional mediante resolución de 15:16 horas del 5 de agosto de 2008, así como el oficio ACCVC-PNE-2015, del cual se desconoce fecha, procedería también acoger la excepción solicitada. En atención a las consideraciones expuestas y respecto de dichos actos el plazo ha operado el acaecimiento de éste en perjuicio del actor, ya que según se desprende de los autos que la demanda en contra de mi representada fue interpuesta hasta el día 10 de junio de 2020, resultando evidente que ha transcurrido sobradamente el plazo permitido por ley para interponer la acción que nos ocupa, razón por la que solicito se acoja la presente excepción de caducidad.
Prescripción del derecho reclamado. Cabe indicar que el reclamo indemnizatorio planteado como pretensión principal y accesoria en lo referente al daño material y perjuicios, no cumple con los requisitos establecidos en el artículo 196 de la Ley General de la Administración Pública, siendo que éstos no son efectivos a la fecha de interposición de la presente demanda. No obstante, lo anterior y dado que la causa eficiente que se reclama como generadora de éstos se encuentra caduca tal y como se acreditó en el apartado anterior, se queda esta pretensión sin el debido fundamento fáctico para su otorgamiento, sumado a lo cual y en concreto según se desprende del propio dicho del accionante, desde el año 2008 conoce de la existencia de un mejor derecho de propiedad en la porción de terreno que ocupa su finca, nada más que por constituir un bien demanial, de modo que es evidente que desde ese momento habría empezado a generarse los supuestos daños y a correr el plazo de prescripción que nos ocupa.
Ahora bien en lo concerniente al daño moral reclamado, tal y como se desprende de lo manifestado por la parte actora en el hecho cuarto, el mismo acaeció desde que tuvo conocimiento de la existencia de la Ley 65 en el año 2008, así como del Oficio ACCVCPNE-2015, suscrito por el Coordinador de Patrimonio Natural del Estado en agosto de 2015, por lo que ha operado la prescripción del derecho para reclamar el pago de la indemnización solicitada, lo anterior por cuanto conforme lo establece el artículo 198 de la Ley General de la Administración Pública, en relación con el numeral 41 del Código Procesal Contencioso Administrativo, el derecho para solicitar a la Administración Pública la indemnización debe ser dentro del plazo de cuatro años, contados a partir del hecho que motiva la responsabilidad, el cual es en este caso según la teoría de la accionante se da con el conocimiento en el año 2008 de la ley 65, con la que se determina la inalienabilidad del inmueble que posee, se toma en cuenta también como fecha el año 2015, cuando el Coordinador de Patrimonio Natural del Estado mediante oficio citado supra, confirma que la finca del Partido de Heredia Matricula Placa891° [Valor 002] se encuentra totalmente dentro de la zona, por lo cual el plazo para demandar cualquier responsabilidad administrativa habría fenecido en el año 2019.
Es de señalar que el señor [Nombre62 001], gestionó varias acciones tanto administrativas como judiciales con el fin de obtener una indemnización sobre las tierras de su posesión, las cuales fueron declaradas inalienables, imprescriptibles e intransferibles por su condición de patrimonio natural del estado según la ley de reiterada cita, sin que pueda alegarse desconocimiento alguno de ésta. La Sala Constitucional indicó con claridad en su voto 12109-20098 que la administración de estas tierras corresponde al MINAE-SINAC, siendo de trascendencia indicar que los bienes de dominio público, no pueden ser objeto de posesión privada y su detentación prolongada por los particulares no produce efectos adquisitivos ni la tolerancia o tardanza de la Administración para repeler sus actuaciones otorgan ningún derecho, por lo que quien los enajene transmite el vicio en la causa de adquisición, toda vez que nadie puede cambiar por sí mismo, ni por el transcurso del tiempo, la causa de posesión, que en el caso que nos ocupa y considerando los movimientos registrales históricos de esta finca en cuanto a su inscripción originaria relacionada a una información posesoria, datan del 23 de marzo de 1896, y el conocimiento confirmatorio que tuviera la parte actora en agosto de 2015 por parte del Coordinador de Patrimonio Natural del Estado, plazo que al día de hoy no sería procedente por un principio de seguridad jurídica efectuar cualquier reclamo al respecto.
Así las cosas, a la parte actora no le asiste ningún derecho para peticionar los presuntos daños y perjuicios reclamados como pretensión accesoria en virtud de que prescribió sobradamente el plazo de 4 años para su exigibilidad. El no declarar la prescripción alegada, atenta contra los principios de seguridad jurídica y permitiría que cualquier administrado, aun habiendo pasado de forma sobrada el plazo que la ley otorga, pueda pretender una indemnización por daños y perjuicios derivados supuestamente de conductas administrativas acaecidas entre 124 y 5 años atrás, con lo que se puede observar que efectivamente el plazo para reclamar la indemnización por una conducta administrativa ha fenecido. En cuanto a la solicitud de la devolución del impuesto sobre bienes inmuebles pagado a la Municipalidad de San Rafael de Heredia, incluido dentro del daño material pretendido, resulta improcedente tal solicitud siendo que la aplicación de este es competencia del Gobierno local según lo establece la normativa que les rige y no del Registro Nacional.
Consideraciones sobre los hechos y pretensiones. El objeto del presente proceso de acuerdo con las pretensiones establecidas por la parte actora en su escrito de interposición de demanda consiste en: a. Se condene en abstracto a la Junta Administrativa del Registro Nacional por concepto de indemnización por los daños ocasionados por la indisponibilidad de la finca del Partido de Heredia Matrícula Placa891° [Valor 002], cuyo valor se determinará en ejecución de sentencia. b. Que se disponga la indexación del monto a determinar, conforme con el numeral 124 del CPCA. c. Accesoriamente se condene al pago de daños y perjuicios ocasionados por su actuación omisa y en ejecución de sentencia se determine ese monto. Los daños y perjuicios se componen: -Daño material: por la cuantiosa devaluación de las instalaciones y terrenos, provocado por la falta de mantenimiento y vigilancia, así como por el deterioro del camino de acceso, a partir de la Resolución 2008-12109 de la Sala Constitucional, que ordenó la suspensión de toda actividad particular, por ser terrenos inalienables. -Por el total del impuesto sobre bienes inmuebles que mi representado ha pagado a la Municipalidad de San Rafael de Heredia desde el año 2004 y que, por definición, no le correspondía pagar, por la inmunidad fiscal del Estado, monto que se determinará oportunamente. • Daño moral: producido por la angustia, desánimo, impotencia de ver esfumarse el esfuerzo de toda una vida, ante la inminente posibilidad de perder la propiedad del inmueble. d. Se condene al Estado al pago de intereses sobre el monto determinado en la ejecución de sentencia. e. Que se condene al Estado al pago de ambas costas de este proceso con sus intereses hasta su efectivo pago. -El objeto medular del proceso: De lo expresado por la parte actora, tanto en sus pretensiones como argumentos, el objeto del presente proceso estriba en que se le indemnice por los daños ocasionados por la indisponibilidad de la propiedad del Partido de Heredia Matrícula N° [Valor 002], al amparo de la publicidad registral y ante las supuestas omisiones del Registro Nacional en la no aplicación de la Ley 65 de 1888.
De conformidad con lo anterior, es criterio de esta representación que la tesis no es correcta ni tiene sustento dentro del ordenamiento jurídico, por lo que, de seguido se procede al análisis del presente asunto. SOBRE LA PROPIEDAD DEL PARTIDO DE HEREDIA MATRICULA [Valor 002]. -Diligencias de información posesoria. En relación con los orígenes de la propiedad del Partido de Heredia Matrícula [Valor 002], el Registro Inmobiliario procedió a realizar un estudio histórico del asiento registral de esta finca, el cual nos fue remitido mediante oficio DRI-01-398-2020, de fecha 31 de julio de 2020 que junto con las certificaciones correspondientes se adjunta y en lo que interesa describe lo siguiente: "(...) 1. Que la finca [Valor 002] proviene de la segregación (y venta) que realiza [Nombre62 005] a favor de [Nombre62 001] de la finca [Valor 017], ejecutada mediante el documento que ocupo el tomo [Valor 024] asiento [Valor 025], inscripción practicada en fecha 23 de setiembre de 2004. 2.
Que la finca [Valor 017] proviene de la segregación (y venta) que realiza [Nombre62 023] a favor de [Nombre62 004] de la finca [Valor 014], llevada a cabo mediante el documento que ocupo el tomo [Valor 026] asiento [Valor 027]. Inscripción practicada endecha 24 de marzo de 1992. 3. Que la finca [Valor 014] proviene de la reunión que hace [Nombre62 023] de las fincas [Valor 015] y [Valor 016], mediante el documento que ocupo el tomo [Valor 028] asiento [Valor 029]. Inscripción practicada endecha 31 de junio de 1991. 3.1 Que la finca [Valor 015] nace por la formación Posesoria tramitada por [Nombre62 033] ante el Juzgado Civil de Heredia, según el tomo 838 folio 160, en fecha 08 de setiembre de 1914. 3.2 Que la finca [Valor 016] se origina por la reunión y venta de las fincas [Valor 009] y [Valor 010] que llevó a cabo [Nombre 014] S.A. a favor de [Nombre62 015] y [Nombre 016], con vista al tomo [Valor 030] folio [Valor 031], el día 16 de junio de 1972. 3.2.1 Que la finca [Valor 009] se origina de la reunión realizada por [Nombre 007] de las fincas [Valor 007] y [Valor 006], en tomo [Valor 032] folio [Valor 031] de fecha 14 de junio de 1916. 3.2.2 Que la finca [Valor 010] se origina de la reunión realizada por [Nombre62 013] de las fincas [Valor 033] y [Valor 034], en tomo [Valor 055] folio [Valor 056] de fecha 25 de noviembre de 1933. ...381 Que la finca [Valor 007] indicada en el punto 3.2.1. se originó mediante Diligencias de información Posesoria a favor de [Nombre62 028] , viudo de la sociedad conyugal de [Nombre62 029], con vista en el tomo [Valor 035] folio [Valor 036] con fecha 16 de junio de 1897. ...382 Que la finca [Valor 006] indicada en el punto 3.2.1. se originó mediante Diligencias de Información Posesoria a favor de [Nombre62 006] (de único apellido), con vista en el tomo [Valor 037] folio [Valor 038] con fecha 23 de marzo de 1896. ...383 Que la finca [Valor 033] indicada en el punto 3.2.2. se originó mediante diligencias de información Posesoria promovidas por [Nombre62 034] , según tomo [Valor 039] folio [Valor 040] de fecha 23 de febrero de 1933. 3.2.2.2.
Que la finca [Valor 034] indicada en el punto 3.2.2. se originó mediante Diligencias de Información Posesoria promovidas por [Nombre 031] como se describe en el folio [Valor 039] folio [Valor 041] con fecha 23 de febrero de 1933. Retomando lo expuesto, se tiene que el terreno que hoy conforma la finca del Partido de HEREDIA matrícula [Valor 002] tiene su origen en los movimientos históricos que relacionan la finca del mismo Partido matrícula [Valor 017] y los antecedentes de dominio de éstas, sean: [Valor 014], [Valor 015], [Valor 016] , [Valor 015], [Valor 016], [Valor 009], [Valor 010], [Valor 007], [Valor 006], [Valor 033] y [Valor 034]. De conformidad con el estudio histórico de los asientos de inscripción de las fincas [Valor 015], [Valor 007], [Valor 006], [Valor 033] y [Valor 034], nacen mediante Diligencias de información Posesoria con posterioridad a la promulgación de la Ley LXV de fecha 30 de Julio de 1888, en todos los casos con sentencia definitiva y firme dictada por el Juez Civil de la provincia de Heredia con competencia para ello siendo incuestionable para este Registro tal resolución firme por contar la misma con autoridad de cosa juzgada material sin que este Registro tenga la facultad para revisar o revocar las mismas, por estarle vedado entrar a calificar las valoraciones y juicios de certeza de los Jueces de la República.
No obstante, lo indicado en el párrafo anterior; de los asientos registrales no es posible determinar antecedentes que determinen la posesión decenal anterior a la inscripción del inmueble de cita -sea la finca 4-[Valor 002]. (...)". Se desprende de lo anterior, que las actuaciones realizadas por el Registro Nacional desde los orígenes de los terrenos que actualmente son propiedad del señor [Nombre62 001], no constituyen ningún tipo de omisión, al encontrarse amparadas al marco normativo según lo disponen los artículos 9 de la Constitución Política, 450, 453 inciso 2) y 484 del Código Civil y que nos rige en lo concerniente a la inscripción de mandamientos judiciales. De importancia para el caso que nos ocupa, es que a nivel de los asientos registrales se logra determinar que las informaciones posesorias que originan esta propiedad fueron posteriores a la promulgación de la Ley 65 de 1888, sin que se desprenda de estos si se cumplió con la posesión decenal de previo a la emisión a su inscripción, datos que solo pueden ser investigados dentro de los expedientes judiciales de cada uno de estos movimientos y que según lo definió la Sala Constitucional corresponde realizar al MINAE, situación que no altera el punto medular de esta demanda siendo que el Registro Nacional, cumplió a cabalidad con lo solicitado por la autoridad judicial al momento de su inscripción.
SOBRE EL CUMPLIMIENTO OBLIGATORIO DE LAS ÓRDENES JUDICIALES. Resulta claro para el Registro Nacional, que los mandamientos judiciales expedidos por las respectivas Autoridades del país constituyen ejecutorias que deben ser acatadas por la Administración Pública, así lo ha venido estableciendo la jurisprudencia nacional, en ese sentido la resolución de la Sala Constitucional número 2000-10991, de las quince horas y veintidós minutos del doce de diciembre del dos mil, que sobre el tema indicó al respecto: [Transcribe parcialmente la sentencia]. En este mismo sentido, la amplitud del marco de calificación ha sido delimitada desde vieja data y en forma reiterada en la jurisprudencia nacional, dentro de esta, la Sala Primera de la Corte Suprema de Justicia, en Sentencia N° 100 de las 16:45 horas del 17 de diciembre de 1980, ha indicado respecto al marco de calificación registral lo siguiente: [Transcribe parcialmente la sentencia].
De la jurisprudencia señalada anteriormente, se desprende claramente que las órdenes emanadas por las distintas Autoridades Judiciales, constituyen un mandato que debe ser acatado por el Registro Nacional, dado que éste actúa como "un auxiliar de la justicia", siendo que, el actuar de forma diferente a lo ordenado o bien, el apartarse de este mandato, podría significar dejar sin efecto lo decretado por el Juez, dejando en un estado de incertidumbre y de peligro la posibilidad que tiene cada uno de los administrados de hacer valer sus derechos. En el presente caso, es importante resaltar que los movimientos realizados en el inmueble objeto del presente proceso, se realizaron a la luz de la normativa que para tales efectos rige la materia registral tanto desde sus orígenes como hasta su final adquisición e inscripción el 23 de setiembre de 2004 que es el momento donde adquiere la propiedad el señor [Nombre62 001].
Dicho lo anterior, y conforme a lo descrito en el apartado IV inciso A, es evidente que los diferentes movimientos realizados y que dan origen a la finca del Partido de Heredia Matrícula N° [Valor 002] proceden de un mandamiento judicial no cuestionable por parte de mi representada, y consecuentemente, la raíz de la situación jurídica que nos ocupa no podría ser atribuida a mi representada. SOBRE EL DEBER DE INDEMNIZAR Y LOS PRESUNTOS DAÑOS Y PERJUICIOS. A. Improcedencia de daños y perjuicios: Resulta de interés para esta representación, hacer notar que la parte actora pretende que en abstracto se condene a la Junta Administrativa a indemnizar por los daños ocasionados por la indisponibilidad de la finca del Partido de Heredia Matrícula N° [Valor 002] aunado al hecho de pretender el pago de intereses sobre dicho monto. La parte actora, ha basado sus reclamos administrativos y judiciales sobre la imposibilidad de poseer la finca objeto del proceso, por el actuar administrativo, específicamente por la aplicación de la Ley 65 dirigiendo acciones previamente en el año 2014 con el fin que se determinara la responsabilidad y la obligación de indemnización contra el Estado y el SINAC-ACC en proceso de conocimiento ante el Tribunal Contencioso Administrativo, expediente 14-008023-1027-CA y recientemente contra el Registro Nacional, reconociendo en todos estas gestiones que desde los orígenes de la finca del Partido de Heredia Matrícula N° [Valor 002], ésta se encuentra en una zona inalienable por disposición de ley.
Sobre este particular, nótese que NO estamos ante una omisión registral, como así lo pretende exponer la contraparte, pues los instrumentos notariales fueron inscritos tal y como los profesionales en derecho y topografía realizaron sus labores, dado que los inicios de la propiedad Matrícula del Partido de Heredia [Valor 002], tienen su origen en los movimientos históricos que relacionan varias fincas de ese mismo partido, con antecedentes de dominio que nacen mediante Diligencias de Información Posesoria con posterioridad a la promulgación de la Ley 65 del 30 de julio de 1888 y en todos los casos se establecieron mediante una sentencia definitiva y firme dictada por el Juez Civil de la provincia de Heredia con competencia para ello, siendo incuestionable para el Registro Nacional la inscripción de lo resuelto en tal resolución. Adicionalmente, el concepto mismo de la Publicidad Registral se encuentra definido por nuestro ordenamiento jurídico, obligando al adquirente a una revisión de la información registral, incluyendo la revisión diligente de tomos.
Al respecto el artículo 66 del Reglamento del Registro Público, Decreto Ejecutivo No. 26771 del 8 de febrero del 1998 señala textualmente:"(...) Base de la publicidad registral. La publicidad registral está constituida por la información contenida en los tomos, sistemas de procesamiento electrónico de datos, digitalización y la microfilmación. Debe existir entre esos sistemas una estrecha relación siendo ambos auxiliares recíprocos y complementarios, a fin de garantizar la unidad, seguridad y congruencia de la información registral (...)". En este punto cabe advertir, que la compra de un inmueble no solo requiere la verificación de la existencia de gravámenes o anotaciones sino que dentro de los deberes del notario designado se encuentra el realizar los estudios históricos de la propiedad, por lo que no es procedente que ahora pretenda achacar responsabilidad generadora de daños y perjuicios a mi representada, pues la actuación del Registro Nacional ha estado apegada al derecho, al marco de calificación y al principio de rogación.
Así las cosas, las actuaciones registrales se ajustaron a las normas y principios en las inscripciones de asientos registrales, no existiendo ningún tipo de omisión registral que justifique la condenatoria en nuestra contra. En primera instancia de la relación de hechos a partir de la cual la parte actora pretende sustentar la eventual existencia de daños y perjuicios no se logra establecer ninguna relación con la conducta administrativa desplegada por mi representada (condiciones de modo, tiempo y lugar), por cuanto la indisponibilidad de la propiedad se da debido a la existencia de la Ley 65 de 1888, que determina que su propiedad se encuentra dentro de una zona que pretende proteger los mantos acuíferos de Heredia y Alajuela. En cuanto a la inscripción de los asientos registrales que dieron origen a la finca del Partido de Heredia Matrícula No. [Valor 002], se cumplió en su momento con el marco jurídico de calificación registral, en acatamiento al mandato judicial que se desprendió de las diligencias de Información Posesoria realizadas, sin que mediara tanto en las actuaciones del año 1896 como en las realizadas en el año 2004 conducta negligente, permisiva u omisiva por parte del Registro Inmobiliario.
Cabe aclarar que la responsabilidad de delimitación del área afectada por esta Ley, corresponde al MINAE, confirmado a partir del voto de la Sala Constitucional 12109-2008 de las quince horas y dieciséis minutos del 5 de agosto de 2008, en el que se le otorgó plazo para la localización y recuperación de estas tierras, consecuencia de ello no existen conductas atribuibles al Registro Nacional que sean contrarias al ordenamiento jurídico, que causen la antijuricidad de base para declarar la existencia de una responsabilidad patrimonial, por lo que debe rechazarse tal pretensión. Finalmente, tampoco cumplen los daños y perjuicios reclamados con los requisitos establecidos en el ordenamiento jurídico que rige la materia ni son debidamente acreditados como corresponde, siendo estos aspectos de resorte exclusivo de la parte actora (artículos 58 inciso f) del Código Procesal Contencioso Administrativo y numeral 41.1 del Nuevo Código Procesal Civil).
Conviene mencionar al respecto que el numeral 196 de la Ley General de la Administración Pública, establece que todo daño alegado habrá de ser efectivo, evaluable económicamente e individualizable en relación con una persona o grupo. Previo a su caracterización debemos entender por daño como toda lesión, menoscabo, pérdida o detrimento en la esfera jurídica patrimonial o extrapatrimonial de una persona, por lo que en el presente caso al incumplirse con tales presupuestos el reclamo debe ser rechazado (ver en ese sentido resoluciones números 846 de las 11:22 horas del 18 de diciembre de 2008 y 202-F-2001 de las 15:45 horas del 07 de mano de 2001 de la Sala Primera de la Corte Suprema de Justicia). En cuanto a la pretensión accesoria que solicita el pago de los daños y perjuicios, estableciendo un daño material es de importancia lo indicado por la Sala Primera de que cuando proceda, el alegato sobre el daño moral, este deba ser probado, lo destaca en los siguientes términos el Tribunal de Casación: [Transcribe parcialmente la sentencia].
En un sentido similar en relación con el daño moral en la resolución 014-F-93 de la Sala Primera de la Corte Suprema de Justicia, de las dieciséis horas del dos de marzo de mil novecientos noventa y tres, se considera lo siguiente: [Transcribe parcialmente la sentencia]".
IV.POSICIÓN DE LA CONTESTACIÓN DEL ESTADO.- La representación estatal contestó lo siguiente: "Cosa juzgada y falta de derecho. Las pretensiones planteadas ya fueran rechazadas en otro proceso. La parte actora interpone -por segunda ocasión- un reclamo indemnizatorio que ya le fue rechazado con autoridad de cosa juzgada material. En efecto, en el proceso de conocimiento tramitado en el expediente 14-8023-1027-CA, se dictó la sentencia N° 13-2018-VIII, de las 15:30 horas del 20 de febrero de 2018, que resolvió que no procede la indemnización reclamada. Veamos: [Transcribe parcialmente la sentencia]. A pesar de la contundencia de lo resuelto, el señor [Nombre62 001] acciona nuevamente, y pide, en esencia, lo mismo que en el proceso 14-8023-1027-CA: que se reconozca el "derecho" a percibir remuneraciones económicas al no poder disponer de la finca 4-[Valor 002]. Sin embargo, es incontrovertible que esa pretensión ya fue denegada con autoridad de cosa juzgada material.
Por ende, en este nuevo proceso, el reclamo indemnizatorio o trámite expropiatorio pretendido es improcedente. Hay identidad en las partes, objeto y causa, siendo aplicable la excepción de cosa juzgada material conforme con los numerales 64 del Código Procesal Civil y 66, inciso 1.j del Código Procesal Contencioso Administrativo (CPCA). Esta nueva demanda es improponible, pues busca reabrir un debate inocuo, ya definido por la sentencia N° 13-1028-VIII. Además, es evidente la falta de derecho, porque el terreno en cuestión es demanial y constituye Patrimonio Natural del Estado (Ley 7575, artículos 13, 14; Ley 7554, numeral 38, Sala Primera, sentencias 59-99, 1070-10, 1088-11 y 1675-12, votos constitucionales 945-05, 17126-06, 2063-07, 16975-08, 17650-08, 17659-08, 21258-10 y 16938-11): [Transcribe y cita las sentencias constitucionales 16975-08, 17650-08, 17659-08, 16938-11 y 12973-13. Para consolidar ese dominio público basta su declaratoria y afectación normativa.
En tanto, su desafectación requiere ley (Código Civil, artículos 261, 262 y 486, Ley ITCO, artículo 7; Ley 4465, artículo 18; Ley 7575, ordinales 13 y 14; resoluciones constitucionales 846-95, 3145-96, 5026-97, 7294-98, 2988-99, 2408-07, 11155-07, 13367-12 y 10158-13, Sala Primera, sentencias 230-90, 12-95, 1259-09 y 189-11, Tribunal Contencioso Administrativo, resoluciones 5579-82-1, 7747-85-1, 9172-87-1, 100-94-1, 190-2012-11, 84-2014-11, 868-2011-111, 79-2016-IV, 19-2009-VII y 46-2009-IX), y los necesarios estudios técnicos que justifiquen la medida conforme con el numeral 38 de la Ley 7554 y la jurisprudencia constitucional que lo informa (resoluciones 5399-93, 7294-98, 5975-06, 2408-07, 11155-07, 1056-09, 14772-10, 18702-10, 13367-12, 10158-13 y 12745-19), siendo improcedente al efecto la vía reglamentaria, la resolución judicial o la actuación administrativa. La demanialidad "...hace que por el transcurso del tiempo no se adquiera ningún derecho sobre este tipo de bienes ni de propiedad ni siquiera la mera posesión" (sentencias constitucionales 12129-05 y 10097-06).
La inalienabilidad imposibilita su traspaso, parcial o total, voluntario o forzoso, y la posesión en los términos del Derecho privado. Y, las resoluciones constitucionales reafirman que los bienes de dominio público "no pueden ser objeto de posesión privada" (480-90, 2306-91, 2557-91,98-92, 1055-92, 1207-93, 5399-93, 5976-93, 220-94, 914-94, 1763-94, 2767-94, 6785-94, 3793-94, Placa13306, 6079-94, Placa13307, 3227-96, 422-96, 4815-96, 5026-94, 623-98, 7294-98, 790-01, 6347-15, 9004-15, 9640-15, 12393-16, 13160-16, 13980-16, 14586-16, 14784-16, 15288-16, 16481-16, 16760-16, 11715-17, 19499-17, 11414-18). Efectivamente, "los particulares no ejercen posesión sobre esas cosas ya que ni de hecho, ni de derecho, las tienen bajo su poder y voluntad" (Tribunal Contencioso Administrativo, resoluciones 9282-87-1, 10019-88-1, 10166-88-1, 10418-88-1, 107-2008-II, 868-2011-111 y 19-2009-VII). Como los bienes demaniales están fuera del comercio, no caben alegatos sobre derechos reales de propiedad y posesión a título de dueño (Sala de Casación, sentencia 9:30 horas del 6 de junio de 1936, Sala Primera, sentencias 17-95, 104-96, 597-00, 237-07, 506-2007 y 535-C-S1-2014, sentencias constitucionales 2306-91, 6758-93 y 6192-95, Tribunal Contencioso Administrativo, resoluciones 1019-88-1, 433-10-11 y 84-2014-II).
Su detentación por particulares no produce efectos adquisitivos (sentencias constitucionales 6758-93 y 6192-95). Quien los enajene, transmite el vicio en la causa de adquisición: la razón es obvia, "nadie puede cambiar por sí mismo, ni por el transcurso del tiempo, la causa de su posesión... Tampoco se puede cambiar por la propia voluntad ni por el transcurso del tiempo las cualidades ni los vicios de la posesión, tal como ella comenzó tal continúa siempre" (hace cita de doctrina). Por ende, los convenios entre particulares que abarcan bienes demaniales, por la naturaleza jurídica inalienable de los bienes y la ausencia de titularidad hábil, carecen de efectos válidos frente al Estado (Sala de Casación, resolución de 10 horas del 1° de agosto de 1946, 3-53, 79-55,78-76 y 121-79, Sala Primera, sentencias 16-1982, 11-03, 607-04, 934-06, 45-07, 173-08, 317-08, 796-10, 1562-12,Tribunal Contencioso Administrativo, 109-2009-IX, 433-2010-11, 2642-2010-VII, 33-2012-IV, 51-2012-VIII, 71-2012-VIII, 190-2012-11, 346-2012-IV, 95-2013-V).
El principio de autonomía de la voluntad no opera frente al demonio público (sentencias constitucionales 2306-91, 6758-93 y 6192-95, Sala Primera, resoluciones 104-96, 597-00, 237-07 y 1562-2012, Tribunal Contencioso Administrativo, sentencias 1019-88-1, 433-2010-11 y 84-2014-VII). En esa línea, la Sala Primera resolvió: [transcribe la sentencias 506-2007 y 189-2011]. En análogo sentido, ver del Tribunal Contencioso Administrativo, las sentencias 1842- 2009-VI y 38-2010-VI, y la última, dispuso: [Transcribe la sentencia]. En la sentencia N° 69-2018-11 de las 8:00 horas del 30 de octubre de 2018, el Tribunal Contencioso Administrativo, dispuso: [Transcribe la sentencia]. Por último, no procede el trámite expropiatorio ni los reclamos indemnizatorios contra el dominio público. La Sala Primera, en la sentencia N° 104-1996, considerando VII, indicó que las propiedades que pueden expropiarse son las inscritas con sujeción a la ley, en tanto, las inscritas en contra del ordenamiento jurídico se pueden recuperar sin someterse a ese trámite.
En la sentencia N° 480-2019, la misma Sala Primera agregó: [Transcribe la sentencia]. El criterio es seguido por el Tribunal Constitucional y el Contencioso Administrativo: [Transcribe las sentencia constitucional 8098-2007 y las sentencias Tribunal Contencioso Administrativo, 35-07-IV; 2569-09-IV y 59-2014-VIII]. Falta de derecho y falta de legitimación pasiva del Estado. Si bien estamos ante una demanda improponible, en resguardo de los intereses de mi representado, opongo las excepciones de falta de derecho y de legitimación pasiva en relación con el reclamo indemnizatorio, con fundamento en lo que establece el artículo 22 de la Ley N° 5695 (del 28 de mayo de 1975). Siendo así, en el hipotético e improbable caso de que, atendiendo a las pretensiones materiales aquí planteadas, se estime procedente conceder a favor del actor algún tipo de reparo, le correspondería asumirlo a la parte co-demandada, en su condición de órgano desconcentrado con patrimonio y presupuesto propios, y no al Estado. Respecto a mi representado ya existe una sentencia, con autoridad de cosa juzgada material que declaró sin lugar una pretensión en ese sentido".
Se ordena a Nombre4631 , o a quien ocupe su cargo como Alcalde Municipal del Cantón Central de Heredia, a Nombre82152 , o a quien ocupe su cargo como Alcalde, y a Nombre82153 , o a quien ocupe su cargo como Presidenta del Concejo Municipal, ambos de la Municipalidad de Santa Bárbara de Heredia, a Nombre82154 , o a quien ocupe su cargo como Alcaldesa, y a Nombre82155 , o a quien ocupe su cargo como Presidente del Concejo Municipal, ambos de la Municipalidad de Barva de Heredia, a Nombre82156 , o a quien ocupe su cargo como Alcalde, y al Nombre82157 , o a quien ocupe su cargo como Presidenta del Concejo Municipal, ambos del Concejo Municipal de San Isidro de Heredia, a Nombre82158 , o a quien ocupe su cargo como Alcaldesa de San Pablo de Heredia, a Nombre71399 , o a quien ocupe su cargo como Alcalde y a Nombre82159 , o a quien ocupe su cargo como Presidenta del Concejo Municipal, ambos de la Municipalidad de San Rafael de Heredia, a Nombre82160 , o a quien ocupe su cargo como Alcalde Municipal de Santo Domingo de Heredia, a Nombre38661 , o a quien ocupe su cargo como Alcalde Municipal de Moravia, y a Nombre19428 , o a quien ocupe su cargo como Alcalde Municipal de Vázquez de Coronado, lo siguiente: a) Que de inmediato se abstengan de otorgar cualquier tipo de permiso dentro de la zona establecida por la ley número 65 de 1888, en lo que respecta a sus jurisdicciones; b) Que procedan a contratar a los profesionales necesarios para la elaboración de los mapas de vulnerabilidad hidrogeológica recomendados por SENARA en su informe denominado “Recarga Potencial del Acuífero Colima y Barva, Valle Central, Costa Rica.”, los cuales deberán ser incluidos en la normativa urbanística de sus jurisdicciones, tal y como lo recomienda la autoridad antes mencionada.
Se ordena a Nombre82161 , o a quien ocupe su cargo como Ministra de Salud, a Nombre71399 , o a quien ocupe su cargo como Alcalde y a Nombre82159 , o a quien ocupe su cargo como Presidenta del Concejo Municipal, ambos de la Municipalidad de San Rafael de Heredia, que de inmediato procedan a realizar las acciones que conforme a derecho procedan contra el refugio de perros abandonados que existe en el Refugio de Vida Silvestre Jaguandurí, e investiguen la denuncia planteada por el Grupo Comité Salud de los Ángeles de San Rafael, con respecto a la supuesta contaminación que existe en dicho sitio. Se advierte a los recurridos que de conformidad con lo dispuesto por el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.
Se condena al Estado y a las Municipalidades de Heredia, Santa Bárbara, Barva, San Pablo, San Isidro, San Rafael, Santo Domingo, Moravia y Vasquez de Coronado al pago de las costas daños y perjuicios que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. En cuanto a las demás autoridades recurridas, se declara sin lugar el recurso." (Nexus.PJ consultado el 19 de noviembre de 2021).
Este daño lo estimo en la suma de cincuenta millones de colones, la cual es proporcional en cuanto al daño causado.".- Con idéntica argumentación a la ya señalada en la pretensión anterior, en este caso no existe ningún derecho subjetivo derivado del ordenamiento jurídico, toda vez que en aplicación del mandato constitucional de que nadie puede alegar ignorancia de la ley, no sería posible desconocer un mandato legal que busca satisfacer las generaciones futuras en cuanto al suministro de agua para las provincias de Alajuela, Heredia y San José, tal y como lo reseñó la Sala Constitucional, en el voto supra citado, y en este caso, su propiedad deriva de una inscripción posterior al Decreto Ley LXV, razón por la cual, no es posible tutelar una situación jurídica anterior a tal normativa que sometió a esa zona territorial a limitaciones de interés público y que conformaban desde ese momento parte del demanio público estatal.
Además, conforme se indicó en los hechos no probados, no acreditó el demandante, conforme la carga de la prueba, establecida en el artículo 317 del CPC, aplicable supletoriamente conforme lo prevé el artículo 220 del CPCA, que se haya perturbado el derecho de posesión y que este cediera ante el interés público tutelado por el Decreto Ley LXV, siendo claro su adquisición del dominio hasta el año 2004.- (...)". El señor [Nombre62 001] no presentó recurso de casación, por lo que la sentencia alcanzó firmeza. VII.COSA JUZGADA MATERIAL RESPECTO DEL ESTADO.- Revisados los autos, estima este Tribunal que con respecto al Estado ha operado el instituto de la cosa juzgada material. El artículo 64 del Código Procesal Civil dispone: "Artículo 64.- Cosa juzgada. Para que se produzca cosa juzgada es necesaria la identidad de sujetos, objeto y causa, la cual puede ser declarada de oficio. Sus efectos se limitan a lo dispositivo. Producen cosa juzgada material las sentencias firmes dictadas en procesos ordinarios y las resoluciones expresamente indicadas por la ley, lo cual hace indiscutible, en otro proceso, la existencia o no de la relación jurídica juzgada. Las sentencias dictadas en los demás procesos tendrán efecto de cosa juzgada formal y la presentación de un proceso ordinario no impedirá su ejecución". De conformidad con la norma citada, a continuación se hace el análisis de rigor. Para lo que interesa en este asunto, se tiene que el 29 de setiembre de 2014, el aquí actor, [Nombre62 001] interpuso demanda en esta sede contencioso administrativa contra el Estado (expediente 14-008023-1027-CA), por la misma causa y con el mismo objeto por los que ahora interpone un nuevo proceso contra el Estado (ver imagen 2).
Tanto en aquella oportunidad como en este proceso el actor reclama que es dueño registral de la finca del partido de Heredia folio real matrícula [Placa703 ] y que ese inmueble se encuentra dentro de la zona que había sido declarada como inalienable por el Congreso Constitucional mediante Decreto Legislativo N°65 del 30 de julio de 1888, por lo que el Estado le ha impedido hacer uso de todos los atributos del dominio sobre su finca, pudiendo solo mantener la posesión. El actor no reclama la pérdida del derecho de propiedad sobre la finca N° [Valor 002] de la provincia de Heredia, sino la indisponibilidad de todos los atributos del dominio sobre la misma, hasta tanto el Estado procede con la debida recuperación de ese terreno conforme con lo ordenado por la Sala Constitucional y le cancela (indemniza) su derecho. Pues bien, esa situación de indisponibilidad sobre su inmueble es la causa por la cual el accionante demandó al Estado en el proceso número 14-008023-1027-CA y solicitó a su favor el pago de una indemnización.
También en este nuevo proceso de conocimiento el actor ha demandado al Estado y también solicita el pago de una indemnización por tal causa, según lo indica expresamente en su pretensión principal (número 1) que dice: "Que se condene en abstracto ... a pagar a mi representado [Nombre62 001], por concepto de indemnización, por los daños que ha ocasionado la indisponibilidad de su finca N° [Valor 002] del partido de Heredia, cuyo valor se determinará en ejecución de sentencia". Es claro para esta Cámara que, con independencia de los argumentos esbozados en cada una de las demandas, entre el proceso 14-008023-1027-CA y el presente proceso, ambos ordinarios, existe plena identidad de sujetos (Estado y [Nombre62 001]), objeto (indemnización) y causa (indisponibilidad de la finca N° [Valor 002] del partido de Heredia por la afectación de la Ley N°65 de 1888). Teniendo en cuenta lo indicado, es relevante acotar que en el proceso número 14-008023-1027-CA ya la Sección Octava de este Tribunal dictó sentencia N°13-2018 de las 15:30 horas del 20 de febrero de 2018, mediante la cual rechazó la demanda del actor.
En su parte dispositiva estableció en lo conducente así: "Se acoge la excepción de falta de derecho interpuesta por el Estado. Se declara improcedente la demanda de [Nombre62 001] contra el Estado (...)". En su fundamentación, en lo que interesa, el fallo indicó: "Ahora bien, en cuanto a lo pretendido por la parte actora, la primera pretensión dice: "a) Se condene a las partes accionadas al pago de la indemnización que por declaratoria de reserva se dio sobre su propiedad, para lo cual solicito se realicen los respectivos avalúos por parte del Ministerio de Hacienda, según lo establecido en la Ley de Expropiaciones.".- Conforme lo antes indicado, por lo dispuesto expresamente en el artículo 1° del Decreto Ley N° LXV, no es posible condenar a las accionadas al pago de una indemnización por la declaratoria de "reserva", según indica la parte, siendo la nomenclatura usada por el legislador de "inalienabilidad", sin embargo, ello es igualmente improcedente, toda vez que tal reserva o inalienabilidad, fue dispuesta por el legislador con anterioridad a la titulación realizada por actividad jurisdiccional y a la adquisición misma del aquí demandante, por lo que éste conforme lo dispone el artículo 129 Constitucional, no puede alegar ignorancia de la ley y al estar vigente el Decreto Ley LXV, no se puede desaplicar y por ende la pretensión debe rechazarse.- En cuanto a la segunda pretensión, esta dice: "b) Condenar a la parte demandada al daño moral subjetivo, por la perturbación de no disponer del inmueble, del cual prácticamente mi representado se ha visto despojado a lo largo de tantos años.
Este daño lo estimo en la suma de cincuenta millones de colones, la cual es proporcional en cuanto al daño causado.".- Con idéntica argumentación a la ya señalada en la pretensión anterior, en este caso no existe ningún derecho subjetivo derivado del ordenamiento jurídico, toda vez que en aplicación del mandato constitucional de que nadie puede alegar ignorancia de la ley, no sería posible desconocer un mandato legal que busca satisfacer las generaciones futuras en cuanto al suministro de agua para las provincias de Alajuela, Heredia y San José, tal y como lo reseñó la Sala Constitucional, en el voto supra citado, y en este caso, su propiedad deriva de una inscripción posterior al Decreto Ley LXV, razón por la cual, no es posible tutelar una situación jurídica anterior a tal normativa que sometió a esa zona territorial a limitaciones de interés público y que conformaban desde ese momento parte del demanio público estatal.
Además, conforme se indicó en los hechos no probados, no acreditó el demandante, conforme la carga de la prueba, establecida en el artículo 317 del CPC, aplicable supletoriamente conforme lo prevé el artículo 220 del CPCA, que se haya perturbado el derecho de posesión y que este cediera ante el interés público tutelado por el Decreto Ley LXV, siendo claro su adquisición del dominio hasta el año 2004.- (...)". Dicha sentencia actualmente se encuentra firme. En el referido fallo, el Tribunal conoció por el fondo lo pretendido por el actor y por las razones indicadas procedió a denegar lo pedido. Si bien los argumentos del actor en este nuevo proceso se enfocan mayormente en cuestionar la publicidad registral que dio lugar a la conformación y adquisición de la finca N° [Valor 002] de la provincia de Heredia, la causa de pedir continúa siendo la misma, esto es, la indisponibilidad de dicho inmueble por la afectación que sobre el mismo pesa por estar ubicado dentro de la zona inalienable decretada por la Ley N°65 de 1888.
Siendo así, se estima que al existir identidad de sujetos, objeto y causa entre el proceso 14-008023-1027-CA y el presente proceso, ambos ordinarios, consecuentemente, existe cosa juzgada material frente al Estado, por lo que en este asunto se hace indiscutible lo que ya fue declarado con carácter definitivo en la sentencia N°13-2018 de las 15:30 horas del 20 de febrero de 2018, constituyendo tal situación una prohibición legal para que este órgano jurisdiccional se pronuncie nuevamente sobre las pretensiones indemnizatorias deducidas contra el ente mayor, mismas que ya fueron denegadas en la sentencia mencionada. Así las cosas, lo que procede es acoger la cosa juzgada material reiterada por la representación estatal en sus conclusiones, y declarar inadmisible la acción respecto del Estado.
VIII.PRESCRIPCIÓN CON RESPECTO A LA JUNTA ADMINISTRATIVA DEL REGISTRO NACIONAL.- Revisados los autos, estima este Tribunal que con respecto a la Junta Administrativa del Registro Nacional ha operado la prescripción. El artículo 41 del Código Procesal Contencioso Administrativo dispone: "Artículo 41.- El plazo máximo para incoar el proceso será el mismo que disponga el ordenamiento jurídico como plazo de prescripción para el respectivo derecho de fondo que se discute en los siguientes supuestos: 1) En materia civil de Hacienda. 2) En materia tributaria, incluso el proceso de lesividad". De conformidad con la norma citada, a continuación se hace el análisis de rigor. El actor reprocha que a pesar de que la Ley N°65 fue emitida en 1888, el Registro Nacional permitió anotar e inscribir todos los actos de particulares que desde su origen dieron lugar al asiento registral de la finca N° [Valor 002] del partido de Heredia, sin que se tuviera conocimiento de que estaba afecto al demanio desde aquella época, y esto provocó que él, confiado en la seguridad jurídica y en la buena fe, incurriera en la adquisición de esa finca.
Tal y como se indicó en el considerando anterior, el accionante solicita en este proceso que se condene a pagar una indemnización a su favor por no poder disponer efectivamente de su inmueble. Pues bien, en lo que atañe a la Junta Administrativa del Registro Nacional, este Tribunal observa que esa pretensión principal, así como las accesorias, se encuentran prescritas. Es preciso recordar que el régimen de responsabilidad patrimonial de la Administración por el ejercicio de su función administrativa (capacidad de derecho público) está regulado en la Ley General de la Administración Pública, no en el Código Civil, dado que este último cuerpo legal resulta aplicable solamente cuando se juzgan situaciones en las cuales la Administración ha actuado en el ejercicio de su capacidad de derecho privado. Por consiguiente, en atención a lo señalado, el plazo que se debe utilizar para computar la prescripción en los supuestos en que un administrado pretende exigir a un órgano o a un ente público un resarcimiento por conductas que son propias del ejercicio de una función administrativa, como en este caso, es el previsto en el artículo 198 párrafo primero de la Ley General de la Administración Pública, esto es, 4 años.
Dicha norma dice: "Artículo 198.- El derecho de reclamar la indemnización a la Administración prescribirá en cuatro años, contados a partir del hecho que motiva la responsabilidad. (...)". Aplicando esa regla al presente caso, tenemos que el aquí actor inscribió su derecho de propiedad sobre la finca N° [Valor 002] de la provincia de Heredia, el 23 de setiembre de 2004. Hasta ese momento el título de propiedad parecía ser regular y no se tenía conocimiento de alguna limitación que pesara sobre el mencionado inmueble. No fue sino hasta el 5 de agosto de 2008, que la Sala Constitucional emitió la resolución N°2008-12109 y ordenó formalmente al Ministerio de Ambiente y Energía y a las Municipalidades de Heredia, Santa Bárbara, Barva, San Pablo, San Isidro, San Rafael, Santo Domingo, Moravia y Vásquez de Coronado, delimitar la zona afectada por la Ley N°65 de 1888 e iniciar los procesos de recuperación de los terrenos de dicha zona que estaban siendo ocupados por particulares.
Entonces, es a partir de esa orden dada por la Sala Constitucional que el Estado debía ejercer sus potestades de protección sobre el demanio, y en consecuencia, debía limitar e indemnizar a los particulares que tuvieren título sobre terrenos ubicados dentro de la zona inalienable de la Ley N°65 de 1888. En el caso concreto no se tiene prueba de la fecha exacta en que el Ministerio de Ambiente y Energía le comunicó al aquí actor que ya no podía disponer de la finca N° [Valor 002] de la provincia de Heredia, o de la fecha en que comenzó a ejercer actuaciones materiales tendientes a impedirle el disfrute del bien, a efecto de computar el plazo prescriptivo de 4 años, ya que ese sería el momento a partir del cual se habría configurado el hecho que motiva la responsabilidad patrimonial por la no disposición efectiva del mencionado inmueble. No obstante, es incontrovertido que el 29 de setiembre de 2014 el accionante acudió a estrados judiciales y demandó al Estado, cabalmente, por el hecho de no poder disponer de los atributos del dominio sobre su finca en razón de la inalienabilidad de la Ley N°65 de 1888, tal y como se explicó en el considerando anterior, por tanto, es notorio y de suyo lógico que si el actor demandó en esa fecha por esa causa, es porque ya en ese momento el Estado le había impedido efectivamente disponer de la finca N° [Valor 002] de la provincia de Heredia y, por consiguiente, es a partir de esa fecha cierta, 29 de setiembre de 2014, que se puede establecer sin lugar a dudas el punto de inicio del cómputo para reclamar indemnización a las Administraciones Públicas relacionadas con la causa de pedir (indisponibilidad de la finca N° [Valor 002] de la provincia de Heredia), lo que conlleva a situar la finalización del plazo de prescripción de 4 años el 30 de setiembre de 2018, fecha hasta la cual el actor podía reclamar resarcimiento a la Administración por no poder disponer de su finca debido a la afectación de la Ley N°65 de 1888.
No obstante, el accionante no lo hizo así, dado que si bien presentó aquella demanda en el año 2014 contra el Estado (dando lugar al proceso 14-008023-1027-CA), omitió demandar en esa oportunidad al Registro Nacional, y esa omisión ha generado que para el momento en que presenta este nuevo proceso el 10 de junio de 2020, se encuentre prescrita la acción para reclamar indemnización al Registro. Por tal motivo, lo que procede es acoger la defensa de prescripción opuesta por la representación de la Junta Administrativa del Registro Nacional, debiendo declararse inadmisible la acción respecto de la Junta.
IX.La defensa de caducidad opuesta por la Junta Administrativa del Registro Nacional resulta manifiestamente improcedente, habida cuenta que el presente es un proceso de responsabilidad, en el que no se pretende la nulidad de ningún acto administrativo, por lo tanto no opera el plazo anual de caducidad regulado en el artículo 39 del Código Procesal Contencioso Administrativo, sino, como se explicó anteriormente, lo que aplica es el plazo de prescripción del derecho de fondo que se discute en el proceso.
XI.SOBRE LAS EXCEPCIONES DE FONDO.- Por la forma en que se resuelve, se omite pronunciamiento sobre las excepciones de falta de derecho opuesta por la Junta y de falta de derecho y de falta de legitimación ad causam pasiva opuestas por el Estado.
Por expresa disposición del artículo 193 del Código Procesal Contencioso Administrativo, procede condenar al actor al pago de ambas costas de esta acción por el solo hecho de haber resultado vencido en este proceso, sin que medien razones que justifiquen su exoneración conforme los incisos a) y b) del numeral 193 citado. Las costas generarán intereses una vez que sea determinado y exigible su monto.
POR TANTO
Se rechaza la defensa de caducidad. Se acogen las defensas de cosa juzgada material opuesta por el Estado y de prescripción opuesta por la Junta Administrativa del Registro Nacional. En consecuencia, se declara inadmisible la demanda presentada. Se condena al actor a pagar ambas costas de esta acción, así como los eventuales intereses que pudieren generarse sobre las mismas una vez que sea determinado y exigible su monto.
