Intraprocedural precautionary measure, processed before the Administrative and Tax Civil Court (Tribunal Contencioso Administrativo y Civil de Hacienda), by Desarrollos Hoteleros Guanacaste S.A., represented by its special litigation counsel (apoderado especial judicial), Claudio Donato Monge, against the State, represented by State Attorney Yannia Salas Víquez; Sistema Nacional de Áreas de Conservación (SINAC), represented by its special litigation counsel, Deifilia Dávila Ruíz; Municipalidad de Santa Cruz, represented by its special litigation counsel, Nombre18225; Instituto Costarricense de Turismo, represented by its special litigation counsel, Nombre71324; Following deliberation and by unanimous vote, the Court rules:

Drafted by Judge González Vílchez; and

CONSIDERING

I- On October 3, 2017, the plaintiff company filed its complaint together with a request for a precautionary measure (medida cautelar), seeking the following: “(...) Order the Municipalidad de Santa Cruz to take such administrative actions as may be necessary to prevent motor vehicles from traveling and parking within the maritime-terrestrial zone (zona marítimo terrestre) of Playa Conchal (...)” (see images 12 and 13 of the digital precautionary-measure file). Subsequently, on February 8, 2019, the petitioner filed a motion renewing its request for a precautionary measure, in which it sought the following interim relief against the Municipalidad de Santa Cruz: “(...) i) Order the installation of concrete culverts and signage referring to the legislation prohibiting vehicles from traveling through the public zone (zona pública), at the two vehicular access points to Playa Conchal: Puerto Viejo and Brasilito, and on the access road ascending from Playa Brasilito to Playa Conchal.

In Brasilito, three cement-filled concrete culverts shall be installed at the Playa Brasilito entrance before the Manglar, as well as concrete culverts at all other access points to Playa Brasilito. In the Puerto Viejo sector, three cement-filled concrete culverts shall be installed in the entrance area to the public zone, across from Restaurante El Encanto. On the access road ascending between Playa Brasilito and Playa Conchal, three cement-filled concrete culverts shall be installed at the beginning of the ascent toward Playa Conchal (where they were initially placed but subsequently destroyed). ii) Preserve and maintain the concrete culverts at the indicated vehicular access points so that the Municipalidad prevents vehicles from accessing the public zone and environmentally protected areas at all times. iii) Protect the concrete culverts against damage by third parties. iv) Maintain a Policía Municipal presence at the site to ensure that the measure preventing vehicles from entering the public zone is not circumvented and to prevent damage to the culverts or signage. v) Submit monthly reports on compliance with the precautionary measures.(...)” With respect to the State and SINAC, it was requested that they: “(...) continue submitting reports, given that, since the issuance of the currently effective extremely urgent provisional precautionary measure (medida cautelar provisionalísima), they have performed important compliance-monitoring work.(...)” (see images 696 through 700 of the digital precautionary-measure file).

II- After completion of the requisite proceedings, the case-management judge (juez tramitador) of the Trial Court, by order N°1226-2019, issued at eight a.m. on July fifteenth, two thousand nineteen, ruled, insofar as relevant, as follows: “(...) The precautionary measure sought by Desarrollos Hoteleros Guanacaste SA against the STATE, SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN (SINAC), INSTITUTO COSTARRICENSE DE TURISMO (ICT), AND MUNICIPALIDAD DE SANTA CRUZ is hereby PARTIALLY GRANTED. The request for interim relief contained in the initial application for the precautionary measure, as well as the claims identified by the petitioner as a.i, a.ii, and a.iii in its February 8, 2019 filing, are DENIED because they fail to satisfy the requirements established in the Código Procesal Contencioso Administrativo and the principles of instrumentality (instrumentalidad) and reasonableness (razonabilidad).

Furthermore, claims a.iv and a.v of the requested precautionary measure are MODIFIED so as to order instead the provisional closure to vehicular traffic of the areas deemed State Natural Heritage (Patrimonio Natural del Estado) and wildlife refuge (Refugio de vida silvestre), in accordance with SINAC technical opinion SCT-OR-DR-0933-18. This imposes upon the State and SINAC the obligation to conduct regular inspections and maintain the closure; SINAC must coordinate the inspection work with the Municipalidad de Santa Cruz and submit quarterly reports to this Court. With respect to the areas not affected by the stated closure, the Municipalidad is ordered to exercise effective oversight of profit-making activities, ensuring compliance with the proper use of the public-zone tract, in coordination with the traffic authorities and any other relevant authorities, by preventing the parking of vehicles, the cutting of trees, the accumulation of solid waste, alterations to the topography of the land, or any action that alters the ecological balance of the area without proper authorization; it shall also regulate temporary or mobile facilities such as tents, trailers, or similar structures outside the areas designated for such purposes (if any), and, above all, regularize any unlawful construction.

Likewise, to organize human use of this strip of land, the municipality shall coordinate actions with ICT to guarantee access to the zone at all times, the free movement of all persons within it, and the practice of sports and activities promoting wholesome physical and cultural recreation. The defendants shall submit quarterly reports to this Court concerning compliance with these orders. The extremely urgent provisional precautionary measure shall remain in effect until this ruling becomes final.(...)” Dissatisfied with the ruling, both the plaintiff company, Desarrollos Hoteleros Guanacaste S.A., and the co-defendants, the State and Sistema Nacional de Áreas de Conservación (SINAC), timely and properly filed appeals, which were admitted and on which this Court now rules.

III- GROUNDS FOR APPEAL OF PLAINTIFF DESARROLLOS HOTELEROS GUANACASTE S.A: The special judicial representative of the plaintiff company states, insofar as pertinent and relevant, that although the judge found that the likelihood of success on the merits (apariencia de buen derecho) of the application for a precautionary measure (medida cautelar) had been established, both with respect to violations of environmental and legal provisions governing the maritime-terrestrial zone (zona marítimo terrestre), when analyzing danger in delay (peligro en la demora), he reasoned, with respect to the portion of the public zone (beach) located outside the State Natural Heritage (Patrimonio Natural del Estado), that no danger in delay had been established because, in his view, the 1973 map sheet refers to the existence of the road segment, which was subsequently inventoried by MOPT between 2001 and 2003.

He contends that, on that basis, the trial judge considered that the segment had held road status for at least 46 years and had appeared in the MOPT inventory register for 16 years, and from this concluded that the polluting activity was not evident. He considers the position adopted by the presiding judge on this point to be erroneous and to entail an improper assessment of the evidence, because it is limited to merely formal or documentary criteria concerning the road’s registration on a map sheet and with MOPT, but does not analyze the actual, current, and severe pollution that vehicular traffic occurring in the public zone of Playa Conchal may cause in material terms. He asserts that it is an indisputable fact—and that the judge himself and the evidence in the case file confirm—that traffic along the purported road segment (which crosses not only the public zone of the maritime-terrestrial zone but also the State Natural Heritage) has resulted in a significant environmental impact, and that allowing motor vehicles to travel along the beach poses a danger to the entire ecosystem.

He alleges that it has been established in the judicial case file that “if the precautionary measure is not granted, the harm identified in the documentary technical evidence will not only continue but will become more severe for the local fauna, vegetation, and morphology,” and that the presiding judge disregarded this evidence in the appealed decision. He adds that, as stated in the Environmental Impact Assessment (Evaluación de Impacto Ambiental) of February and March 2016, it was determined, for example: “On the beach itself: Faunal depletion was found, as no hermit crabs, crabs, or olives, which are common species on Costa Rica’s Pacific beaches, were observed...In the dunes: The removal of original vegetation cover: herbaceous plants, shrubs, and trees; compaction, subsidence, and erosion caused by vehicle traffic and parking; and harm to the landscape.” He maintains that SINAC itself also identified impacts in areas outside the State Natural Heritage in official letter ACT-OR-DR-066617, mentioning hydrocarbon spills and harm to the beach’s flora and fauna, a sparse presence of vegetation, crustaceans, and mollusks, erosion and loss of vegetation in the dunes, accumulations of solid waste, and cut vegetation.

He therefore considers that the formal documentation of the road’s registration, as well as the time taken by the competent public bodies to fulfill their obligations to prevent this from occurring and continuing to occur, cannot be sufficient to assess the potential harm or danger in delay, because it omits any analysis of the impact generated by traffic along that segment, which has even increased in recent years and is established in the judicial case file. In his view, the potential for future environmental harm cannot be derived from a mere analysis of documentary records, particularly because the case file contains evidence from the various reports and images that clearly show the environmental impacts on the ecosystems caused by the large number of vehicles that traveled along the beach and that will continue to do so if the appealed decision remains in effect. He alleges that the impact is real, current, and severe, and that it extends beyond the State Natural Heritage area to the entire beach and dunes located outside it.

He recalls that the Constitutional Chamber has held that the precautionary principle (principio precautorio) concerns the adoption of measures not when the facts creating a risk are unknown, but when there is a lack of certainty as to whether those facts will actually have harmful effects on the environment. He states that, in this case, there are no elements that could provide the judge with certainty that vehicular traffic on the beach has no environmental impact, and that this cannot be inferred from a mere analysis of dates in documentary records but must instead be demonstrated technically and scientifically; no evidence to that effect appears in the judicial case file. Nevertheless, he asserts that even under basic principles of logic, it is evident that vehicle traffic exposes the beach to noise, vibrations, loads, and hydrocarbons that affect the flora and fauna, as well as the people present there.

In other words, he adds, there is no evidence in the case file demonstrating that vehicles traveling along the beach do not cause environmental harm; moreover, the defendant bears the burden of presenting such evidence pursuant to the principle of reversal of the burden of proof in environmental matters (principio de inversión de la carga de la prueba en materia ambiental). He cites case law of the First Chamber to that effect. He argues that the improper assessment of the procedural burden is also apparent in the analysis of the request to install concrete culverts, because the moving party is required to technically demonstrate the appropriateness of that measure, when determining which measure can effectively prevent vehicles from traveling along the beach is, in fact, a matter within the administration’s exclusive authority and responsibility. He adds that, in prior decisions of this Court, the procedural requirement of danger in delay was assessed in a manner more consistent with the precautionary principle.

He indicates that it is very important to clarify that the requested precautionary measure in no way affects people’s access to the beach and public zone, which they may continue to access freely through the various access points serving this area. To the contrary, he considers that the precautionary measure preventing unrestricted traffic through the beach area (the public zone of the maritime-terrestrial zone) protects people’s right to access the public zone and freely enjoy the full extent of the beach and sea without the safety hazards posed by vehicular traffic and commercial activities—including some that contravene other provisions of our legal system—particularly to children and older adults who lack the ability to avoid vehicles. He requests that this appeal be granted and that the precautionary measure be expanded so that, instead, the provisional closure of vehicular traffic to Playa Conchal and to the areas considered State Natural Heritage and wildlife refuge is ordered or, alternatively, that the specific relief sought in the application for a precautionary measure be granted as follows: i) Order the installation of concrete culverts and signs referring to the legislation prohibiting vehicle traffic through the public zone at the beach’s two vehicle access points, Puerto Viejo and Brasilito, and on the access incline from Playa Brasilito to Playa Conchal.

In Brasilito, three cement-filled concrete culverts must be installed at the Playa Brasilito entrance before the Manglar. In the Puerto Viejo sector, three cement-filled concrete culverts must be installed in the entrance area to the public zone, opposite Restaurante El Encanto. On the access incline between Playa Brasilito and Playa Conchal, three cement-filled concrete culverts must be installed at the beginning of the incline toward Playa Conchal (where they were initially installed but destroyed). ii) Preserve and maintain the concrete culverts at the specified vehicle access points so that the Municipality prevents vehicles from accessing the public zone and environmentally protected areas at all times.

IV- GROUNDS FOR APPEAL OF THE STATE: The State’s representative states, insofar as relevant, that the appealed decision is improperly reasoned because the presiding judge found that no “danger in delay” existed “inasmuch as the reported events have been occurring for decades.” In reaching that conclusion, he considered the following 3 events in time:

  • 1)That the road status of the segment covered by the application for a precautionary measure dates back at least forty-six years, and that it has appeared in the official road register with an assigned MOPT road code for at least sixteen years, which makes it evident that the polluting activity addressed by the claims on the merits in the principal case file does not satisfy the danger-in-delay requirement, thereby plainly causing the environmental studies submitted by the moving party, as well as the studies conducted by MINAE, to demonstrate the existence of an environmental impact consolidated over time.
  • 2)That, when the Refugio Nacional de Vida Silvestre Conchal was established, road code 503010, which is the subject of the application for a precautionary measure, already existed, notwithstanding that an inalienable-zone strip was included when the regulation establishing that Área Silvestre Protegida (State Natural Heritage) was issued, resulting in an evident overlap from the outset.
  • 3)That it was not until 16 de julio de 2018 that the Sistema Nacional de Áreas de Conservación intervened in that area, both in the mangrove area and in the Refugio, and therefore the urgency and immediacy required for the measure are absent. (See recital (considerando) VII. ANALYSIS OF THE FACTUAL FRAMEWORK FOR THE DISPOSITION OF THIS MEASURE PRECAUTIONARY MEASURE (SPATIOTEMPORAL CONTEXT OF THE PRECAUTIONARY ANALYSIS AND DANGER IN DELAY [peligro en la demora]). She considers that the foregoing reasoning, in addition to being incorrect, violates the regulations and principles governing environmental matters (Article 11 of the Ley de Biodiversidad; the fundamental right to a healthy and ecologically balanced environment [Article 50 of the Constitution]; the precautionary principle in environmental matters; the principle of State Protection of Environmental Law; and the principles of environmental quality and solidarity, the latter established as Principle 7 of the 1992 United Nations Conference on Environment and Development). She argues that, in environmental matters, damage does not become consolidated merely through the passage of time, as the processing judge erroneously understands. She adds that the challenged ruling reflects a lack of knowledge of environmental matters, as evidenced by the imprecise use of technical language. Proof of this is the challenged ruling-judgment’s (auto-sentencia) use of the concept of environmental impact (impacto ambiental)—a regulated activity intended to mitigate environmental impacts so as not to cause an imbalance—as a synonym for environmental damage (daño ambiental)—an imminent and significant threat to a constituent element of the environment resulting in the loss of the natural balance—which was established by SINAC through report ACT-OR-DR-0666-17 of May 23, 2017. She alleges a lack of reasoning in the balancing of the interests at stake (ponderación de intereses en juego), because in recital “IX. REGARDING THE SATISFACTION OF THE REQUIREMENTS FOR ISSUANCE OF THE REQUESTED PRECAUTIONARY MEASURE” of the challenged ruling-judgment, the processing judge merely stated: “upon conducting an analysis balancing the interests at stake, the public interest in providing road access to the area, as permitted and required by Ley 6043 (Article 23), and considering that the environmental damage referenced in the cited reports concerns a consolidated situation, do not permit a finding of danger in delay that would jeopardize the free use and enjoyment of the area (…)”. She considers that the foregoing reveals the absence of any analysis of the requirement concerning the balancing of the interests at stake. In her view, a genuine analysis should at least include reasoning that weighs the interests at stake, which in this case would be two public interests that the judge did not weigh at all: first, the environmental interest whose purpose is to protect the inalienable zone (zona inalienable) and the State Natural Heritage (Patrimonio Natural del Estado) from the environmental damage demonstrated through SINAC technical report ACT-OR-DR-0666-17; and second, the prohibition established by Article 127 of Ley 7331 against the operation of motor vehicles on the country’s beaches, as opposed to the interest of the Municipality and certain residents in driving motor vehicles through the inalienable zone (BEACH) of the Maritime-Terrestrial Zone (Zona Marítimo Terrestre). Consequently, a defect in the ruling-judgment has been demonstrated. She emphasizes that the right of access to and enjoyment of the beach does not mean that Article 127 of Ley de Tránsito por Vías Públicas Terrestres number 7331 of April 22, 1993, which establishes restrictions on the operation of motor vehicles on beaches, may be violated: “ARTICLE 127.- The operation of motor vehicles on the country’s beaches is prohibited (…)”. She believes that, although Ley 6043 and its Reglamento Decreto 7841 refer in several articles to access limited to the public zone (zona pública), their purpose is to ensure the public’s use and enjoyment of the beach (public zone). This does not mean that people must travel across the beach in a motor vehicle, because they may enter on foot, as occurs in the case at hand, since the precautionary measure (medida cautelar) does not prohibit pedestrians from accessing and enjoying the beach and the sea. The State’s representative further considers that the processing judge incorrectly interpreted the request for a precautionary measure, because the precautionary application (acción cautelar) seeks to restrict motor-vehicle traffic across the beach (the inalienable zone of the Maritime-Terrestrial Zone). In this regard, she emphasizes that the measure is not intended to prevent people from accessing and enjoying the beach—since they may enter on foot, as is occurring under the emergency interim measure (medida provisionalísima) that remains in effect—but rather to prevent access by motor vehicles (cars, all-terrain vehicles, motorcycles, among others). Nevertheless, she asserts that, despite being aware of the technical reports establishing environmental damage, the processing judge erroneously found that application of the pro natura and precautionary principles “conflicts with the provisions governing free access to, use, and enjoyment of the maritime-terrestrial zone set forth in Sections 23 of Ley 6043 and 9 of the regulations to that law (decreto 7841-P), as well as the specific provisions of the Ley de CAMINOS Públicos, particularly Sections 19 and 23” (See recital VIII LIMITATION ON REVIEW UNDER SUMMA COGNITIO. ANCILLARY AND INSTRUMENTAL NATURE OF THE PRECAUTIONARY MEASURE IN RELATION TO THE PROCEEDINGS ON THE MERITS (BALANCING OF INTERESTS). She maintains that the foregoing reasoning lacks legal basis and reveals a lack of knowledge of the principles governing environmental matters. She argues that, contrary to the processing judge’s statement, access to the beach (the inalienable public zone) is possible in this case by means of two access routes: route 180 and route 933; in other words, there are two roads that ensure the public’s access to, use, and enjoyment of the beach. Therefore, she considers it untrue that the requested precautionary measure would prevent people from walking along the beach, as the processing judge appears to have erroneously understood. She emphasizes that, under the emergency interim measure currently in effect, people may access the beach (the inalienable zone), because the measure is specifically intended to prevent the motor-vehicle traffic causing the established environmental damage, not to eliminate pedestrian access to the beach, as the challenged ruling-judgment erroneously suggests. She asserts that the request for a precautionary measure does not conflict with the principle of instrumentality (principio de instrumentalidad), because it does not seek closure of the road—which would concern the merits—but rather the provisional suspension of motor-vehicle access to the beach pursuant to 127 of Ley General de Caminos, due to the environmental damage existing in the ecosystem according to report ACT-OR-DR-0666-17 of May 23, 2017, issued by SINAC. The State’s representative considers that the challenged ruling-judgment failed to assess the evidence, because, with respect to the environmental damage supporting the requirements of danger in delay and the balancing of the interests at stake, it did not evaluate official communication ACT-OR-DR-0733-18 of July 15, 2018, issued by Área de Conservación Tempisque. Regarding the environmental damage established through report ACT-OR-DR-0666-17, that communication stated that it must be understood that any measure adopted would be of little or no effectiveness as long as vehicle access to the public zone remained open. She emphasizes that the beach was left unprotected by the partial measure adopted. She asserts that the ruling-judgment is contradictory because, in recital VIII, the processing judge states that matters concerning the permanence, existence, extinguishment, registration, and modification of the road must be decided in the judgment on the merits; nevertheless, in recital VII he analyzed those matters and concluded that the protected area (Refugio de Vida Silvestre Conchal) overlaps with the road area on the beach. She reiterates that the precautionary application seeks to restrict motor-vehicle traffic across the beach (the inalienable zone of the Maritime-Terrestrial Zone). In this regard, she emphasizes that the measure is not intended to prevent people from accessing and enjoying the beach—since they may enter on foot, as follows from the emergency interim measure that remains in effect—but rather to prevent access by motor vehicles (cars, all-terrain vehicles, motorcycles, among others). She further considers that the existence of the Refugio de Vida Silvestre encompassing the inalienable zone does not constitute a legal basis for finding that there is no danger in delay. She adds that the case record (expediente) establishes environmental damage according to report ACT-OR-DR-0666-17 of May 23, 2017, issued by SINAC, and it is precisely the existence of this environmental damage that the judge disregarded when analyzing whether that requirement was satisfied. She notes that the processing judge stated in the challenged ruling-judgment that the requested measure did not satisfy all the requirements for its issuance, yet partially granted the measure, with the aggravating circumstance that he failed to take into account the section of the beach (the inalienable zone) owned by the State and administered by the Municipalidad de San Cruz. She therefore considers that the precautionary measure, as partially granted, lacks practical effectiveness because, as stated in the SINAC reports, access to the State Natural Heritage area from both sides is through beach lands administered by the Municipalidad de Santa Cruz. It states that, at present, the most urgent provisional measure (medida provisionalísima) made it possible to restrict access by motor vehicles because culverts were placed at both ends of the stretch of beach at issue in the litigation; consequently, authorizing the removal of those obstacles on the grounds that the only area where a provisional closure to vehicular traffic should be ordered is the State Natural Heritage (Patrimonio Natural del Estado, PNE) and the Wildlife Refuge (Refugio de Vida Silvestre) (it is clarified that the refuge is part of the PNE), administered by SINAC, is contradictory: first, because it is based on the legally and technically unfounded premise that no environmental damage occurs in the beach area (which is inalienable), despite the reports establishing otherwise; and second, because the judge failed to consider that vehicles will continue to cross the portion of the PNE (thereby affecting the ecosystem), since the road at issue in the litigation enters the public zone through areas administered by the municipality on both sides of the beach; consequently, the environmental damage will continue. It asserts that if the interim relief (medida cautelar) is maintained solely over the sector of the State Natural Heritage administered by SINAC, as held in the challenged decision, it will be impossible to prevent vehicle access and environmental damage to the ecosystem will continue, because access via both routes is administered by the Municipalidad and includes the beach—that is, the area intended for everyone’s use and enjoyment, where vehicles are prohibited under Article 127 of Ley de Tránsito por Vías Públicas Terrestres number 7331. In that regard, it considers that the precautionary principle (principio precautorio) in environmental matters must prevail and notes that it was not analyzed in the challenged order with respect to balancing the interests at stake, among which the public interest in protecting the environment prevails. Accordingly, it requests that the appeal filed against the challenged interim-relief ruling (auto-sentencia de medida cautelar) be granted and that the interim prohibition on motor-vehicle access be extended to the beach area, which was included in the most urgent provisional measure from the outset and where barriers preventing the entry of motor vehicles are already in place. In other words, it requests that the interim relief be maintained along the stretch encompassing both the beach area (the inalienable 50-meter zone of the maritime-terrestrial zone (zona marítimo terrestre)) and the closure points currently located within the State Natural Heritage at playa Conchal, between boundary markers (mojones) M391–M392 and up to coordinates CRTM05 300834.7, 1150582.0, and between boundary markers M245–M246, as has been maintained since the most urgent provisional measure was issued.

V- GROUNDS OF APPEAL OF SINAC: The special judicial representative (apoderada especial judicial) of SINAC states, insofar as pertinent and relevant, that interim measures have been ordered in this matter to prevent motor vehicles from circulating in the maritime-terrestrial zone of Playa Conchal, and that the interim relief ordered against the Municipalidad de Santa Cruz was to remain in effect (Closure of the road to prevent motor vehicles from circulating in the maritime-terrestrial zone of Playa Conchal, including closure of vehicular access to the beach). She contends that this is due to the environmental fragility of the site, which contains estuary, forest, mangrove, and dune ecosystems, since the road lies within the public zone (zona pública) of the maritime-terrestrial zone and within the State Natural Heritage. She clarifies that the existing road is a single continuous stretch and that maintaining a partial closure is not feasible because the road continues through the area, which would result in unlawful entry at any point along the beach.

She contends that, although it has been stated that the road affects the State Natural Heritage, it also affects the public zone and causes erosion and loss of vegetation; vehicle traffic through the dune affects the flora and fauna of the beach, causing sediment to accumulate in the mangroves. She explains that although the dune lacks vegetation, it is connected to the estuary and the sea; vehicle traffic would interfere with the movement of passing fauna (invertebrates such as crabs), and other species would be run over. Furthermore, vehicle traffic would contribute to the compaction of beach sand and to hydrocarbon spills from vehicles that become stuck because of tidal changes, given the road’s location in the public zone. Accordingly, she appeals the decision at issue and requests that the interim relief be maintained, with the road completely closed to vehicle entry.

VI- ARGUMENTS OF THE MUNICIPALIDAD DE SANTA CRUZ: The special judicial representative of the respondent municipal entity states that, after studying and analyzing the arguments contained in the appeal briefs and comparing them with the challenged decision, he considers that the decision should be upheld in all respects because it is consistent with the merits of the record and the evidence submitted in the proceedings.

VII- ARGUMENTS OF ICT: The Instituto Costarricense de Turismo was given an opportunity to respond to the appeals filed by the plaintiff, the State, and SINAC by an order issued at thirteen hours twenty-five minutes on the twenty-ninth of April of two thousand twenty, but there is no record that the institution submitted any response in that regard.

VIII- REGARDING THE EVIDENCE SUBMITTED BY THE PARTIES IN THEIR APPEALS AND STATEMENTS OF GROUNDS: In its notice of appeal, the plaintiff company submits a series of documents, and the State, in its statement of grounds for appeal, also submits official communication SINAC-SE-IRT-179-2019 of 19 de julio de 2019, issued by the Departamento de Información y Regularización Territorial concerning the two access routes to Playa Conchal. Although the evidence submitted by the claimant is not new because it is already contained in the main proceedings, while the official communication submitted by the State is new, it must be stated that, given the manner in which this matter is decided, no ruling is issued regarding this evidence.

IX- MERITS OF THE APPEAL: This adjudicative body vacates the challenged decision sua sponte for the following reasons: 1- It must be clarified that the grounds set forth by the plaintiff, as well as by the State and SINAC, show that many of the appellants’ objections to the appealed decision concern matters constituting nullity due to defects in the statement of reasons, inconsistency, and other defects that will be addressed below. Therefore, this Appellate Court cannot rule on the merits of the interim relief requested in this matter, because doing so would resolve it in a single instance and, as will be seen, would practically reconstruct the challenged decision, which contains gross defects warranting its nullity; 2- In this regard, reference must be made to Article 28.1 of the Código Procesal Civil, which applies subsidiarily to this matter as permitted by Article 220 of the Código Procesal Contencioso Administrativo and which states, insofar as relevant: “(...) Decisions must state their reasons and must be clear, precise, specific, and consistent with what was requested or provided by law.

(...)”. As will be analyzed below, the appealed order satisfies none of the requirements applicable to every judicial decision; 3- Specifically, the challenged decision is inconsistent in the following respects: a) Considerando VIII of the appealed order states verbatim: “(...) Accordingly, it must be declared that the permanence, existence, extinguishment, registration and/or modification of public road C-5-03-010 are matters pertaining to the merits and are therefore excluded from the effects of this interim-relief proceeding. (...)”. Here, the trial judge states that the existence and registration of the road passing through Playa Conchal, among other related matters—the road to which the plaintiff seeks to bar motor-vehicle access—is a merits issue rather than an interim-relief issue. Contradictorily, however, in Considerando VII of the challenged decision, the court below relies on all the information concerning that road, stretch, or route in analyzing serious harm (daño grave).

This is inconsistent because, on the one hand, the judge excludes the issue of the road’s establishment and even its route, but on the other hand uses that information to analyze serious harm; b) Regarding the requirement of serious harm, the judge states that it has not been met, as shown in Considerando VII of the challenged decision, and therefore denies the principal request for interim relief, namely: “(...) Order the Municipalidad de Santa Cruz to take the administrative actions necessary to prevent motor vehicles from traveling through and parking in the maritime-terrestrial zone of Playa Conchal (...)”. Nevertheless, in Considerando X, in finding that the interim measures ordered “sua sponte” are warranted, the judge accepts that serious harm exists under the precautionary and pro natura principles (principios precautorio y pro natura); 4- The appealed order also lacks an adequate statement of reasons in the following respects: a) In Considerando VIII, although the judge titles that section as an analysis of the balancing of interests (ponderación de intereses), a reading of that portion of the challenged decision reveals no explanation of which interests are being balanced.

Indeed, it does not identify the private interests, much less the public interests; instead, it merely provides a confusing analysis without substantiating the reasons why that requirement for interim relief has not been met; b) The trial judge appears to indicate—although the decision is unclear—that serious harm is established where the State Natural Heritage and Refugio de Vida Silvestre Conchal are located (without even referring to the latter by name), through application of the precautionary and pro natura principles, but does not explain why those principles apply in those areas. Yet, on the other hand, the judge appears—it bears repeating, the judge is unclear—to find that serious harm is not established in the Public Zone of the Maritime-Terrestrial Zone (the beach itself), but that explanation is not clearly substantiated in the challenged decision; 5- In general, the appealed order is neither clear, precise, nor specific.

Specifically, the judge partially grants the interim relief, prohibiting—as may be understood—vehicle access along the road passing through Playa Conchal in the areas comprising the State Natural Heritage and Refugio de Vida Silvestre Conchal. Yet the judge does permit vehicles to enter the Public Zone of the Maritime-Terrestrial Zone. However, the road, route, or stretch is the same, and it is therefore contradictory to grant interim relief by prohibiting passage in some areas while authorizing it in others. This lack of clarity even creates confusion for the parties as to how the trial judge’s ruling is to be implemented. For the foregoing reasons, the appealed order is vacated.

POR TANTO

Given the manner in which this matter is decided, no ruling is issued regarding the evidence submitted by the plaintiff and the State. Challenged decision Nº1226-2019, issued by the Tribunal Contencioso Administrativo y Civil de Hacienda at eight hours on the fifteenth of July of two thousand nineteen, is vacated sua sponte. The trial judge shall take note of the matters stated in the reasoning portion of this decision. The case record is ordered returned to the Tribunal Contencioso Administrativo for further proceedings within its purview. Medida cautelar intraprocesal Actora: Desarrollos Hoteleros Guanacaste S.A.

Medida cautelar intraprocesal, tramitada ante el Tribunal Contencioso Administrativo y Civil de Hacienda, por Desarrollos Hoteleros Guanacaste S.A, representada por su apoderado especial judicial, Claudio Donato Monge, contra el Estado, representado por la Procuradora, Yannia Salas Víquez; Sistema Nacional de Áreas de Conservación (SINAC), representado por su apoderada especial judicial, Deifilia Dávila Ruíz; Municipalidad de Santa Cruz, representada por su apoderado especial judicial, Nombre18225 ; Instituto Costarricense de Turismo, representado por su apoderado especial judicial, Nombre71324 ; Previa deliberación y por unanimidad, el Tribunal resuelve:

Redacta el Juez González Vílchez, y;

CONSIDERANDO

I- El 3 de octubre del 2017, la sociedad actora presentó escrito de demanda con medida cautelar, pretendiendo lo siguiente: "(...) Ordene a la Municipalidad de Santa Cruz a disponer las actuaciones administrativas que resulten necesarias para impedir el tránsito y estacionamiento de vehículos automotores por la zona marítimo terrestre Playa Conchal (...)" (ver imágenes 12 y 13 del legajo digital de medida cautelar). Posteriormente, el 8 de febrero del 2019, la accionante presentó gestión de reiteración de medida cautelar, en la cual solicitó como pretensiones cautelares en contra de la Municipalidad de Santa Cruz: "(...) i) Ordenar la colocación de alcantarillas de concreto, y rotulación que haga referencia a la legislación que prohíbe la circulación de vehículos por la zona pública, en los dos accesos vehiculares de la Playa Conchal: Puerto Viejo y Brasilito y en la subida de ingreso de Playa Brasilito a Playa Conchal.

En el caso de Brasilito se deberán instalar tres alcantarillas de concreto rellenas de cemento por la entrada de Playa Brasilito antes del Manglar, así como alcantarillas de concreto en todos los demás accesos a Playa Brasilito. En el sector de Puerto Viejo se deberán instalar tres alcantarillas de concreto rellenas de cemento en el área de ingreso a la zona pública, frente al Restaurante El Encanto. En la subida de ingreso entre Playa Brasilito y Playa Conchal, se deberán instalar tres alcantarillas de concreto rellenas de cemento al inicio de la subida hacia Playa Conchal (donde fueron colocadas inicialmente, pero destruidas). ii) Conservar y dar mantenimiento a las alcantarillas de concreto en los puntos de acceso vehicular indicados, de manera que la Municipalidad impida en todo momento el acceso de vehículos a la zona pública y a las áreas ambientalmente protegidas. iii) Proteger las alcantarillas de concreto frente a daños de terceros. iv) Mantener presencia de la Policía Municipal en el lugar, con el objeto de que no se burle la medida de impedir el ingreso de vehículos a la zona publica y evitar daños a las alcantarillas o rotulación. v) Rendir informes mensuales sobre el cumplimiento de las medidas cautelares.(...)".

Con respecto al Estado y al SINAC, se solicitó: (...) continúen presentando informes dado que han ejercido a partir del dictado de la medida cautelar provisionalísima vigente una labor importante de supervisión de cumplimiento.(...)" (ver imágenes de la 696 a la 700 del legajo digital de medida cautelar).

II- Luego del trámite de rigor, el juez tramitador del Tribunal de Instancia, mediante auto N°1226-2019, de las ocho horas del quince de julio de dos mil diecinueve, resolvió en lo que interesa, lo siguiente: "(...) Se declara CON LUGAR PARCIALMENTE la medida cautelar interpuesta gestionada por Desarrollos Hoteleros Guanacaste SA contra el ESTADO, SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN (SINAC), INSTITUTO COSTARRICENSE DE TURISMO (ICT) Y LA MUNICIPALIDAD DE SANTA CRUZ, Se RECHAZAN la pretensión cautelar contenida en el escrito de interposición de la medida cautelar, así como las pretensiones identificadas por la promovente en su escrito del 8 de febrero de 2019 como a.i, a.ii y a.iii de la solicitud de medida cautelar, lo anterior por no cumplir con los requisitos establecidos en el Código Procesal Contencioso Administrativo así como con los principios de instrumentalidad y razonabilidad.

Asimismo, se ADECÚAN las pretensiones a.iv y a.v de la medida cautelar solicitada para que en su lugar se ordene el cierre provisional de tránsito vehicular en las zonas consideradas como Patrimonio Natural del Estado y Refugio de vida silvestre conforme el criterio técnico SCT-OR-DR-0933-18 del SINAC, imponiéndose con ello la obligación de inspección regular y mantenimiento de cierre a cargo del Estado y del SINAC, la cual debe coordinar las tareas de inspección con la Municipalidad de Santa Cruz, remitiendo informes trimestrales a este Tribunal. Sobre las áreas no afectadas por el cierre indicado, se ordena el efectivo control de actividades lucrativas a la Municipalidad velando por el respeto al correcto uso del tracto de zona pública, en coordinación con las autoridades de tránsito y demás pertinentes, impidiendo el parqueo de los vehículos, corta de árboles, concentración de residuos sólidos, alteración de la topografía del terreno, o que se lleve a cabo cualquier acción que altere el equilibrio ecológico del lugar sin la debida autorización; así como controlar las instalaciones temporales o móviles como tiendas de campaña, trailers o similares fuera de las zonas destinadas para tales fines (si existiesen) y sobre todo regularizar cualquier tipo de construcciones irregulares.

De igual forma, a efectos de organizar el aprovechamiento humano de dicha franja de terreno, deberá el municipio coordinar acciones con el ICT a efectos de garantizar en todo momento el acceso a la zona y el libre tránsito en ella de cualquier persona, la práctica de deportes y de actividades para el sano esparcimiento físico y cultural, remitiendo los demandados informes trimestrales a este Tribunal del cumplimiento de lo ordenado. Se mantiene la medida cautelar provisionalísima hasta la firmeza de la presente resolución.(...)". Inconformes la sociedad actora, Desarrollos Hoteleros Guanacaste S.A, así como los codemandados, el Estado y el Sistema Nacional de Áreas de Conservación (SINAC), apelaron, en tiempo y forma, recursos admitidos y en virtud de los cuales resuelve este Tribunal.

III- AGRAVIOS ACTORA DESARROLLOS HOTELEROS GUANACASTE S.A: El apoderado especial judicial de la sociedad actora, en lo pertinente y relevante, señala, que pese a que el juez tuvo por acreditado la apariencia de buen derecho de la solicitud de medida cautelar, tanto en lo que se refiere a las violaciones a las disposiciones ambientales y legales de la zona marítimo terrestre, a la hora de analizar el peligro en la demora procede a razonar, en lo que respecta a la parte de la zona pública (playa) que esta fuera del Patrimonio Natural del Estado, que no se acredita un peligro en la demora dado que, en su criterio, en la hoja cartográfica de 1973 se hace referencia a la existencia del tramo vial, y luego fue inventariado entre el año 2001 y 2003 por el MOPT. Sostiene, que con base en ello considera el juez de instancia, que la condición vial del tramo tiene al menos 46 años de existencia y 16 de constar en el registro de inventario del MOPT, y con eso concluye que no sea evidente la actuación contaminante.

Considera, que el criterio que sostiene el juez tramitador es errado en este extremo y conlleva una indebida valoración de la prueba, por cuanto, se limita a acudir a criterios meramente formales o documentales sobre el registro del camino a nivel de hoja cartográfica y del MOPT, pero no analiza la situación real, actual y severa contaminación en el plano material que puede ocasionar el tránsito vehicular que ha venido sucediendo en la zona pública de Playa Conchal. Afirma, que es un hecho indiscutible, y el propio juez, así como la evidencia del expediente lo confirma, que la circulación por el supuesto tramo vial (que, además de la zona pública de la zona marítimo terrestre también atraviesa el Patrimonio Natural del Estado), ha resultado en un impacto ambiental significativo y permitir la circulación de automotores por la playa representa un peligro para todo el ecosistema. Aduce, que se ha tenido por demostrado en el expediente judicial que "de no otorgarse la medida cautelar, el daño que se indica en la prueba técnica documental no sólo continuará, sino que se agravará, de forma severa para la fauna, vegetación y morfología del lugar", y esta prueba es obviada por el juez tramitador en la resolución que se recurre.

Agrega, que como consta en la Evaluación de Impacto Ambiental de febrero y marzo de 2016, se determinó, por ejemplo: "En la playa propiamente: Se encontró defaunación, pues no se observaron ermitaños, cangrejos, ni olivas que son especies comunes en las playas del pacífico de Costa Rica...En las dunas: La eliminación de cobertura vegetal original: herbáceas, arbustos y árboles: la compactación, hundimientos y erosión por tránsito y estacionamiento de vehículos; y la afectación del paisaje". Sostiene, que el impacto también en zonas externas al Patrimonio Natural del Estado fue determinado por el propio SINAC en el oficio ACT-OR-DR-066617 al mencionar derrames de hidrocarburos y afectación a la flora y fauna de la playa, con escasa presencia de vegetación, crustáceos y moluscos, erosión y pérdida de vegetación en las dunas, presencia de acumulación de desechos sólidos y vegetación cortada.

Por ello, estima que la documentación formal del registro del camino, así como el tiempo que han demorado los órganos públicos competentes de cumplir con sus obligaciones para evitar que esto se produzca y que se siga produciendo, no puede ser suficiente para valorar el potencial daño o el peligro en la demora, puesto que omite cualquier análisis sobre el impacto que venía generando el tránsito sobre dicho tramo que incluso se ha venido incrementando en los últimos años y que en el expediente judicial se encuentra demostrado. En su criterio, el potencial de daño ambiental futuro no se puede derivar de un simple análisis de registros documentales, máxime que consta evidencia en el expediente de las distintas pruebas e imágenes que reflejan con meridiana claridad los impactos ambientales en los ecosistemas por la gran cantidad de vehículos que circulaban por la playa y que circularán de mantenerse la resolución recurrida.

Aduce, que el impacto es real, actual, severo y trasciende la zona del Patrimonio Natural del Estado y se extiende por toda la playa y dunas que se encuentra fuera del mismo. Recuerda, que la Sala Constitucional ha señalado que el principio precautorio, refiere a la adopción de medidas, no ante el desconocimiento de hechos generadores de riesgo, sino ante la carencia de certeza respecto de que tales hechos efectivamente producirán efectos nocivos en el ambiente. Manifiesta, que en este caso, no hay elementos que puedan dar certeza al juez que el tránsito vehicular en la playa no tiene impacto ambiental y ese dato no puede desprenderse de un simple análisis de fechas del registro documental, sino que debe demostrarse técnica y científicamente, prueba que en dicho sentido no se encuentra en el expediente judicial. No obstante, asevera, incluso bajo principios elementales de lógica es evidente que la circulación de vehículos expone a la playa a ruidos, vibraciones, cargas, e hidrocarburos que afectan la flora y fauna, además de las personas que en ella se encuentran.

En otras palabras, agrega, no existe prueba en el expediente que demuestre que la circulación de vehículos por la playa no genere daños ambientales, prueba que además corresponde presentar a la parte demandada, en virtud del principio de inversión de la carga de la prueba en materia ambiental. Cita jurisprudencia de la la Sala Primera en ese sentido. Argumenta, que la indebida valoración de la carga procesal también se manifiesta cuando se analizan las pretensiones de que se coloquen alcantarillas de concreto y se exige a la parte promovente que debe ser quien demuestre técnicamente la procedencia de dicha medida, cuando en realidad se trata una actividad que es de resorte y responsabilidad exclusiva de la administración determinar la medida que, en forma efectiva pueda impedir la circulación de vehículos por la playa. Agrega, que en resoluciones previas de este Tribunal el presupuesto procesal de peligro de la demora fue valorado en forma más compatible con el principio precautorio.

Indica, que es muy importante aclarar que la medida cautelar solicitada en nada afecta el acceso de las personas a la playa y la zona pública, quienes lo pueden seguir haciendo libremente a través de los distintos accesos que existen para esta zona. Por el contrario, considera que la medida cautelar que impide el libre tránsito por la zona de playa (zona pública de la zona marítimo terrestre), protege el derecho de las personas de acceder a la zona pública y de disfrutar libremente de toda su extensión de la playa y del mar sin los peligros de seguridad que el tránsito vehicular y las actividades comerciales, incluyendo algunas que contravienen otras normas de nuestro ordenamiento jurídico, le ocasionan a estas personas, y especialmente a los niños y a los adultos mayores que no tienen la habilidad de esquivar los vehículos. Solicita, que se proceda a acoger el presente recurso y se amplié la medida cautelar para que en su lugar se ordene el cierre provisional del tránsito vehicular a la Playa Conchal y a las zonas consideradas como Patrimonio Natural del Estado y Refugio de vida silvestre, o subsidiariamente se acoja en forma concreta las pretensiones incluidas en la gestión de medida cautelar de: i) Ordenar la colocación de alcantarillas de concreto, y rotulación que haga referencia a la legislación que prohíbe la circulación de vehículos por la zona pública, en los dos accesos vehiculares de la playa: Puerto Viejo y Brasilito y en la subida de ingreso de Playa Brasilito a Playa Conchal.

En el caso de Brasilito se deberán instalar tres alcantarillas de concreto rellenas de cemento por la entrada de Playa Brasilito antes del Manglar. En el sector de Puerto Viejo se deberán instalar tres alcantarillas de concreto rellenas de cemento en el área de ingreso a la zona pública, frente al Restaurante El Encanto. En la subida de ingreso entre Playa Brasilito y Playa Conchal, se deberán instalar tres alcantarillas de concreto rellenas de cemento al inicio de la subida hacia Playa Conchal (donde fueron colocadas inicialmente, pero destruidas). ii) Conservar y dar mantenimiento a las alcantarillas de concreto en los puntos de acceso vehicular indicados, de manera que la Municipalidad impida en todo momento el acceso de vehículos a la zona pública y a las áreas ambientalmente protegidas.

IV- AGRAVIOS DEL ESTADO: La representante estatal, en lo relevante, indica que la resolución recurrida, incurre en una indebida fundamentación, debido a que el juez tramitador consideró que no existe “peligro en la demora” “en tanto los hechos denunciados ocurren desde hace décadas”, para llegar a esa conclusión consideró los siguientes 3 eventos temporales:

  • 1)Que la condición vial del tramo objeto la solicitud de medida cautelar data de al menos cuarenta y seis años de existencia y de al menos dieciséis años de constar registro oficial vial y código vial asignado en el MOPT, lo cual hace evidente que la actuación contaminante objeto de estudio de las pretensiones de fondo del legajo principal no cumplan con el requisito de peligro en la demora, haciendo con ello de forma palmaria que los estudios ambientales ofrecidos por la parte promovente, así como los estudios realizados por el MINAE manifiesten en consecuencia la existencia de un impacto ambiental consolidado en el tiempo.
  • 2)Que, al momento del nacimiento del Refugio Nacional de Vida Silvestre Conchal, el camino código 503010 objeto de la solicitud medida cautelar ya existía, ello pese a que al momento de emitir la norma de creación de dicha Área Silvestre Protegida (Patrimonio Natural del Estado), se incluyó una franja de zona inalienable, existiendo un evidente traslape desde un inicio.
  • 3)Que, es hasta el 16 de julio de 2018 que el Sistema Nacional de Áreas de Conservación realizó una intervención en dicha zona, tanto en la zona de manglar como del Refugio, en consecuencia, no se tiene el elemento de urgencia y actualidad que requiere la medida. (Ver considerando VII. ANÁLISIS DEL CUADRO FÁCTICO PARA LA RESOLUCIÓN DE ESTA MEDIDA CAUTELAR (UBICACIÓN ESPACIO- TEMPORAL DE ANÁLISIS CAUTELAR Y PELIGRO EN LA DEMORA). Considera, que el anterior razonamiento además de incorrecto, es violatorio de las regulaciones y principios que rigen la materia ambiental (artículo 11 de la Ley de Biodiversidad, el derecho fundamental a un ambiente sano y ecológicamente equilibrado (art 50 Constitucional), al principio precautorio en materia ambiental, al de Tutela del Derecho Ambiental a cargo del Estado, al principio de calidad ambiental y de solidaridad como Principio 7 de la Conferencia de las Naciones Unidas sobre Medio Ambiente y Desarrollo 1992). Argumenta, que en materia ambiental no existe consolidación de un daño por el transcurso del tiempo como lo entiende erróneamente el juez tramitador. Agrega, que de la sentencia recurrida se desprende el desconocimiento de la materia ambiental que se refleja en la falta de precisión del lenguaje técnico, prueba de ello es la utilización que se realiza en el auto-sentencia recurrido del concepto de impacto ambiental (es una actividad regulada que busca mitigar los impactos en el medio ambiente para no provocar un desequilibrio), como sinónimo del daño ambiental (peligro eminente y significativo de algún elemento constitutivo del ambiente por el cual se pierde el equilibrio natural), acreditado por el SINAC mediante informe ACT-OR-DR-0666-17 del 23 de mayo de 2017. Acusa, una falta de fundamentación en la ponderación de intereses en juego, debido a que en el considerando “IX. SOBRE LA CONCURRENCIA DE LOS PRESUPUESTOS PARA EL DICTADO DE LA MEDIDA CAUTELAR PROMOVIDA” del auto-sentencia recurrido, el juez tramitador se limitó a indicar: “realizando un análisis de la ponderación de los intereses en juego, el interés público de dar acceso vial a la zona conforme lo permite y ordena la propia Ley 6043 (artículo 23) y considerando que el daño ambiental que los informes citados refieren a una situación consolidada, no permiten realizar una valoración de peligro en la demora que ponga en riesgo el libre uso, goce y disfrute de la zona (…)”. Considera que de los transcrito se colige, la ausencia de análisis respecto del presupuesto de ponderación de intereses en juego. En su criterio, un verdadero análisis debería al menos incluir un razonamiento en donde se incluya la ponderación de los intereses en juego que en este caso serían: dos intereses públicos respecto de los cuales el juez no realizó ninguna ponderación: el primero de índole ambiental cuya finalidad es la protección de la zona inalienable y del Patrimonio Natural del Estado por el daño ambiental demostrado mediante informe técnico del SINAC ACT-OR-DR-0666-17 y el segundo la prohibición de circulación de los vehículos automotores en las playas del país que establece el artículo 127 de la Ley 7331 versus el interés Municipal y de algunos munícipes de transitar con vehículos automotores por la zona inalienable (PLAYA) de la Zona Marítimo Terrestre, en consecuencia, se tiene por demostrado un vicio en el auto-sentencia. Destaca, que el derecho al acceso y disfrute a la playa no implica que deba violentarse lo dispuesto por el artículo 127 de la Ley de Tránsito por Vías Públicas Terrestres número 7331 del 22 de abril de 1993 que establece limitaciones en materia de circulación de vehículos automotores por las playas: “ARTÍCULO 127.- Se prohíbe la circulación de los vehículos automotores en las playas del país (…)”. Estima, que, si bien es cierto que Ley 6043 y su Reglamento Decreto 7841 aluden al acceso en varios artículos circunscritos a la zona pública, el espíritu que les anima es el de asegurar a la colectividad el uso y disfrute de la playa (zona pública), lo cual no implica que las personas deban transitar la playa en algún vehículo automotor ya que pueden accesar caminando como ocurre en el caso que nos ocupa, ya que la medida cautelar no prohíbe a los transeúntes el ingreso y disfrute de la playa y el mar. Por otra parte, estima la representante estatal, que existe una incorrecta interpretación del juez tramitador sobre la solicitud de la medida cautelar, debido a que la acción cautelar va dirigida a restringir el paso de los vehículos automotores por la playa (zona inalienable de la Zona Marítimo Terrestre), en ese sentido, se enfatiza que la medida no pretende impedir el paso y disfrute de las personas a la playa (quienes pueden ingresar caminando tal y como sucede con la medida provisionalísima que se mantiene), sino de los vehículos automotores (carros, cuadriciclos, motos, entre otros). Sin embargo, afirma, que el juez tramitador consideró erróneamente a pesar de conocer los informes técnicos que acreditan un daño ambiental que, la aplicación de los principios pro natura y precautorio “se enfrentan a las disposiciones de libre acceso, goce y disfrute de la zona marítimo terrestre que dispone los numerales 23 de la Ley 6043 y 9 del reglamento a dicha ley (decreto 7841-P), así como las regulaciones propias de la Ley de CAMINOS Públicos concretamente los numerales 19 y 23” (Ver considerando VIII LIMITANTE DE CONOCIMIENTO SUMMA COGNITIO. ACCESORIEDAD E INSTRUMENTALIDAD DE LA MEDIDA CAUTELAR RESPECTO DEL PROCESO DE FONDO (PONDERACIÓN DE LOS INTERESES). Sostiene, que el anterior razonamiento carece de legalidad y evidencia una falta de conocimiento de los principios que rigen la materia ambiental. Alega, que contrario a lo expuesto por el juez tramitador, el acceso a la playa (zona pública inalienable), en el presente caso es posible por dos accesos, uno es la ruta 180 y el otro es mediante la ruta 933, es decir, existen dos caminos que aseguran a la colectividad el acceso, uso y disfrute de la playa. Por ello, considera, no es cierto que las personas con la medida cautelar solicitada no puedan transitar por la playa como parece erróneamente entenderlo el juez tramitador. Enfatiza, que actualmente con la medida provisionalísima las personas pueden accesar a la playa (zona inalienable), porque precisamente, lo que busca la medida es evitar el tránsito automotor que causa el daño ambiental acreditado y, no eliminar el paso de los transeúntes a la playa como erróneamente se refleja en la auto-sentencia recurrida. Asevera, que la solicitud de medida cautelar no riñe con el principio de instrumentalidad ya que no se pide el cierre del camino (que correspondería a la discusión del fondo), lo que se pidió es la suspensión provisional del acceso de los vehículos automotores a la playa de conformidad con el 127 de la Ley General de Caminos debido al daño ambiental existe en el ecosistema según el informe ACT-OR-DR-0666-17 del 23 de mayo de 2017 emitido por el SINAC. Estima la representante del Estado, que existe una falta de valoración de la prueba, en el autosentencia recurrido, debido a que no se valoró en relación con el daño ambiental que permite acreditar el presupuesto del peligro en la demora y la ponderación de los intereses en juego, el oficio ACT-OR-DR-0733-18 del 15 de julio de 2018 emitido por el Área de Conservación Tempisque, que indicó en relación con el daño ambiental acreditado mediante informe ACT-OR-DR-0666-17, que se debía tener claro que cualquier medida que se adopte será poco o nada efectiva, mientras el acceso de vehículos a la zona pública continúe abierto. Destaca que la playa quedó desprotegida por la medida parcial adoptada. Afirma, que existe contradicción del auto-sentencia, ya que en el considerando VIII el juez tramitador indica que los temas de permanencia, existencia, extinción, registro, y modificación de la vía, son temas de sentencia de fondo, no obstante, en el considerando VII realizó el análisis de esos temas de fondo y concluye que existe un traslape entre la zona del área protegida (Refugio de Vida Silvestre Conchal) y la zona del camino sobre la playa. Reitera, que la acción cautelar va dirigida a restringir el paso de los vehículos automotores por la playa (zona inalienable de la Zona Marítimo Terrestre), en ese sentido, se enfatiza que la medida no pretende impedir el paso y disfrute de las personas a la playa (quienes pueden ingresar caminando tal y como se deriva de la medida provisionalísima que se mantiene), sino de los vehículos automotores (carros, cuadriciclos, motos, entre otros). Por otra parte, considera que el hecho de que exista el Refugio de Vida Silvestre que abarca la zona inalienable no es una razón jurídica para fundamentar la inexistencia de peligro en la demora. Añade, que en el expediente se encuentra acreditado un daño ambiental según informe ACT-OR-DR-0666-17 del 23 de mayo de 2017 emitido por el SINAC, es precisamente la existencia de ese daño ambiental lo que el juez obvió al momento de analizar la procedencia de dicho presupuesto. Señala, que el juez tramitador indicó en el auto-sentencia recurrido que la medida solicitada no cumple con todos los presupuestos para otorgarse, no obstante, acoge parcialmente la medida, con el agravante de que no se tomó en cuenta el sector de la playa (zona inalienable) propiedad del Estado cuya administración corresponde a la Municipalidad de San Cruz. Por ello, considera, que la medida cautelar adoptada parcialmente carece de practicidad en los términos en que fue otorgada ya que como se indicó en los informes del SINAC, el acceso al área de Patrimonio Natural del Estado por ambos lados, se realiza por terrenos de playa que administra la Municipalidad de Santa Cruz. Manifiesta, que actualmente, la medida provisionalísima permitió restringir el acceso a vehículos automotores porque se colocaron alcantarillas en ambos extremos del trayecto de la playa objeto de litis, en consecuencia, autorizar que se quiten dichos obstáculos por considerarse que la única área sobre la que debe ordenarse el cierre provisional de tránsito vehicular es el Patrimonio Natural del Estado (PNE) y el Refugio de Vida Silvestre (se aclara que el refugio integra el PNE), administrados por el SINAC, es un contrasentido, primero porque parte de la premisa sin fundamento jurídico ni técnico de que en la zona de playa (inalienable) no se producen daños ambientales a pesar de los informes que así lo acreditan y, en segundo lugar, el juez no consideró que los vehículos continuarán atravesando por la parte de PNE (afectado el ecosistema), porque el camino objeto de litis ingresa a la zona pública por áreas de administración municipal, en ambos lados de la playa, en consecuencia, el daño ambiental continuará produciéndose. Afirma, que si se mantiene la medida cautelar únicamente sobre el sector del Patrimonio Natural del Estado en administración del SINAC como es la tesis de la resolución recurrida, será imposible impedir el acceso de los vehículos y continuarán produciéndose el daño ambiental en el ecosistema ya que el ingreso por ambas rutas es administrado por la Municipalidad y comprende la playa, sea la zona destinada para el uso y disfrute de todos y en la cual no se permite transitar vehículos según lo dispuesto por el artículo 127 de la Ley de Tránsito por Vías Públicas Terrestres número 7331. En ese sentido, estima, debe prevalecer el principio precautorio en materia ambiental y que no fue analizado en el auto recurrido para referirse a la ponderación de los intereses en juego en donde prevalece el interés público de proteger el medio ambiente. Por lo anterior, solicita acoger el recurso de apelación planteado contra el auto-sentencia de medida cautelar recurrido, y se ordene extender la medida cautelar de prohibición del acceso a los vehículos automotores a la zona de la playa, área que fue incluida desde un inicio dentro de la medida provisionalísima y sobre la cual ya existen los obstáculos para evitar el ingreso de vehículos automotores. Es decir, requiere que se mantenga la medida cautelar en el trayecto comprendido tanto por la zona de playa (zona inalienable de 50 metros de la zona marítimo terrestre), así como los puntos de cierre que existen actualmente dentro del Patrimonio Natural del Estado en playa Conchal ubicados entre los mojones M391–M392 y hasta las coordenadas CRTM05 300834.7, 1150582.0, entre los mojones M245–M246 como se ha conservado desde el dictado de la medida provisionalísima.

V- AGRAVIOS DEL SINAC: La apoderada especial judicial del SINAC, en lo pertinente y relevante, indica que dentro del presente asunto se ha ordenado las medidas cautelares para evitar la circulación de vehículos automotores en la zona marítimo terrestre de Playa Conchal, se consignó que se mantenga la medida cautelar ordenada a la Municipalidad de Santa Cruz (Adopción del cierre del camino para evitar la circulación de vehículos automotores en la zona marítimo terrestre de Playa Conchal, incluyendo el cierre del paso vehicular hacia la playa). Sostiene, que lo anterior obedece a la fragilidad ambiental del sitio que contiene ecosistemas de estero, bosque, manglar y duna, al ubicarse el camino dentro de la zona pública de la zona marítimo terrestre y dentro de Patrimonio Natural del Estado. Aclara, que el camino existente es un solo tramo y mantener el cierre parcial no es posible por la continuación del mismo, lo cual provocaría ingresos de carácter ilegal en cualquier sector de la playa.

Sostiene, que si bien es cierto, se ha indicado que afecta el Patrimonio Natural del Estado, dicho camino también afecta la zona pública, y provoca la erosión y pérdida de la vegetación, el paso de los vehículos dentro de la duna afecta la flora y fauna de la playa, generando la acumulación de sedimentos en los manglares. Explica, que la duna aunque se encuentra desprovista de vegetación tiene una conexión con el estero y el mar, el paso de vehículos afectaría el paso de la fauna que transita (invertebrados como cangrejos), y otras especies serían atropelladas, además el tránsito de vehículos contribuirían con la compactación de la arena de la playa, así como el derrame de hidrocarburos provocado por los vehículos que quedan atascados por los cambios en las mareas, dado la ubicación del camino en la zona pública. Por lo anterior, apela la resolución de marras y solicita mantener la medida cautelar, con el cierre total del camino para el ingreso de vehículos.

VI- ARGUMENTOS DE LA MUNICIPALIDAD DE SANTA CRUZ: El apoderado especial judicial del ente municipal demandado, señala que una vez estudiados y analizados los argumentos que contienen los escritos de los recursos de apelación, confrontados con la resolución recurrida, estima que la misma debe mantenerse en todos sus extremos, debido a que se encuentra ajustada al mérito de los autos y las probanzas que fueron aportadas al proceso.

VII- ARGUMENTOS DEL ICT: Al Instituto Costarricense de Turismo, se le dio la audiencia para referirse a los recursos de apelación interpuestos por la actora, el Estado y el SINAC, mediante auto dictado a las trece horas veinticinco minutos del veintinueve de abril del dos mil veinte, sin que conste pronunciamiento de dicha institución al respecto.

VIII- SOBRE LAS PRUEBAS APORTADAS POR LAS PARTES EN SUS RECURSOS DE APELACIÓN Y EXPRESIÓN DE AGRAVIOS: En su escrito de interposición del recurso de apelación, la sociedad actora aporta una serie de documentos, así como el Estado en su escrito de expresión de agravios, también presenta el oficio SINAC-SE-IRT-179-2019 del 19 de julio de 2019, emitido por el Departamento de Información y Regularización Territorial sobre las dos rutas de acceso a Playa Conchal. Ahora bien, aunque no son pruebas nuevas la aportadas por la accionante, ya que se encuentran ubicadas dentro del proceso principal, y el oficio presentado por el Estado si lo es, se debe indicar, que por la forma en que se resuelve este asunto, se omite pronunciamiento en cuanto a estas probanzas.

IX- SOBRE EL FONDO DEL RECURSO DE APELACIÓN: Este órgano jurisdiccional, anula de oficio la resolución recurrida, por los siguientes motivos: 1- Debe aclararse que de los agravios expuestos, tanto por la parte actora, así como del Estado y el SINAC, se aprecia que muchas de las inconformidades de los recurrentes contra la resolución apelada, radican en aspectos que son propios de una nulidad por vicios de fundamentación, incongruencia, entre otros, que se expondrán más adelante. Es por ello, que este Tribunal de Alzada, no les posible resolver por el fondo la medida cautelar solicitada en este asunto, ya que lo haría en una única instancia, y como se verá, reconstruyendo, prácticamente, la resolución recurrida, la cual tiene vicios groseros que ameritan su nulidad; 2- En ese sentido, se debe traer a colación, lo que establece el artículo 28.1 del Código Procesal Civil, de aplicación supletoria a esta materia por permitirlo el numeral 220 del Código Procesal Contencioso Administrativo, que en lo relevante, indica: "(...) Las resoluciones deberán ser fundamentadas, claras, precisas, concretas y congruentes con lo solicitado o previsto por la ley.

(...)". Precisamente, como se analizará a continuación, ninguno de los requisitos señalados que debe tener toda resolución judicial, los cumple el auto apelado; 3- Precisamente, la resolución recurrida incurre en el vicio de incongruencia, en los siguientes puntos: a) En el Considerando VIII del auto apelado, se expone textualmente: "(...) Así, debe declararse que el tema de la permanencia, existencia, extinción, registro y/o modificación de la vía pública C-5-03-010, son temas propios de fondo, y excluidos, por tanto, de los efectos de la presente acción cautelar.(...)". Aquí el juez de instancia afirma que el tema de la existencia, registro, entre otros aspectos relacionados con el camino que pasa por Playa Conchal, y es el que la parte actora pretende se cierre el acceso de automotores, es un tema de fondo y no de la cautelar. Sin embargo, de manera contradictoria, en el Considerando VII de la resolución recurrida, el juez a quo, toma todos los datos de ese camino, tramo o vía, para hacer el análisis de daño grave.

Esto resulta una incongruencia, ya que por una parte excluye el tema de la constitución, incluso el trayecto de esa vía, pero utiliza esa información para analizar el daño grave; b) Respecto al presupuesto del daño grave, el juzgador indica que no se cumple como se aprecia en el Considerando VII de la resolución recurrida, y por ello, niega la principal solicitud de medida cautelar que es; "(...) Ordene a la Municipalidad de Santa Cruz a disponer las actuaciones administrativas que resulten necesarias para impedir el tránsito y estacionamiento de vehículos automotores por la zona marítimo terrestre Playa Conchal (...)". No obstante, en el Considerando X, para dictar la procedencia de las medidas cautelares de "oficio", acepta que existe un daño grave bajo los principios precautorio y pro natura; 4- Asimismo, el auto apelado, tiene vicios de falta de fundamentación, en los siguientes aspectos: a) En el Considerando VIII el juzgador, pese a que titula ese apartado como el análisis de ponderación de intereses, de la lectura de esa parte de la resolución recurrida, no existe un fundamento de cuales intereses está ponderando.

De hecho, no se menciona en qué consisten los intereses particulares, ni mucho menos los públicos, solo se hace un análisis confuso, sin llegar a sustentar las razones por las cuales ese presupuesto de la medida cautelar no se cumple; b) El juez de instancia, parece indicar, ya que no es claro, que se cumple el daño grave, en donde se ubica el Patrimonio Natural del Estado, así como en el Refugio de Vida Silvestre Conchal (que ni siquiera menciona este último por su nombre), por aplicación de los principios precautorio y pro natura, sin explicar las razones por las cuales se aplican estos principios en estas zonas. Pero por otro lado, parece, se insiste el juez no es claro, que en la Zona Pública de la Zona Marítimo Terrestre (Playa propiamente), el daño grave no se cumple, pero esa explicación no se sustenta claramente en la resolución recurrida; 5- En general, el auto apelado, no es claro, preciso y concreto.

Justamente, el juzgador otorga parcialmente la medida cautelar, no permitiendo, por lo que se puede entender, el acceso de vehículos por el camino que pasa por Playa Conchal, en las zonas que son Patrimonio Natural del Estado, así como en el Refugio de Vida Silvestre Conchal. Pero si permite el paso de vehículos a la Zona Pública de la Zona Marítimo Terrestre. Ahora bien, el camino, vía o tramo es el mismo, por lo que es un contrasentido otorgar la medida cautelar impidiendo el paso en una zonas y en otras autorizándolas. Esto produce una falta de claridad, incluso confusión para las partes, de cómo llevar a la práctica lo resuelto por el juez en la resolución recurrida. Por las razones dadas, se anula el auto apelado.

POR TANTO

Por la forma como se resuelve, se omite pronunciamiento en cuanto a las pruebas aportadas por la actora y el Estado. Se anula de oficio la resolución recurrida Nº1226-2019, dictada por el Tribunal Contencioso Administrativo y Civil de Hacienda, a las ocho horas del quince de julio de dos mil diecinueve. Tome nota el juez de instancia de lo señalado en la parte considerativa de esta resolución. Se ordena devolver los autos al Tribunal Contencioso Administrativo para lo de su cargo.
