(See brief received on 30/04/2021).- II) By means of the ruling issued at sixteen hours and forty-five minutes on the thirtieth day of April of the year two thousand twenty-one, this Court, among other things, denied the present application as an extremely urgent interim measure (medida cautelar provisionalísima) and joined Mr. Gerardo Pizarro Espinoza as a party to the proceeding (see ruling dated 30/04/2021).- III) By means of the brief filed by the plaintiff on the fourth day of May of the current year, the plaintiff states, among other things, that he is expanding his application to include Messrs. Gerardo Pizarro Espinoza and Ervin Adolfo Álvarez Fuentes (see brief filed on 04/05/2021).- IV) By means of the ruling issued at fifteen hours and thirty minutes on the tenth day of May of the year two thousand twenty-one, this Court deemed the present application for interim relief expanded to include Mr.
ERVIN ADOLFO ÁLVAREZ FUENTES and therefore ordered that he be served at that time (see ruling dated 10/05/2021).- V) By means of the brief dated the nineteenth day of May of the current year, counsel for the State opposed the present application for interim relief (see brief dated 19/05/2021).- VI) By means of the brief filed on the second day of July of the current year, Mr. Gerardo Víctor Pizarro Espinoza addressed the interim measure, asserting that the administrative eviction (desalojo administrativo) he pursued was lawful and in accordance with the law (see brief filed on 02/07/2021).- VII) By means of the brief dated the twelfth day of August of the current year, counsel for the Instituto de Desarrollo Rural (INDER) opposed the present application for interim relief, requesting, among other things, that the present application be denied and that the plaintiff be ordered to pay costs, together with the corresponding statutory interest accruing until payment in full (see brief dated 12/08/2021).- VIII) By means of Ruling Number 555-2021, issued at fourteen hours and twenty minutes on the ninth day of September of the year two thousand twenty-one, this Court ordered that the SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN (SINAC) be joined as a party to the litigation (litis); by means of its brief filed on the twenty-fourth day of September of the current year, SINAC opposed the present application for interim relief and requested that it be denied (see Ruling N°555-2021 and brief filed on 24/09/2021).- IX) The statutory requirements have been observed in the proceedings, and no defects or omissions are apparent that could deprive the parties of their right to a defense or result in future nullities.- CONSIDERATIONS (CONSIDERANDO):
ABRAHAM JIMÉNEZ MATARRITA: Insofar as relevant to deciding this interim relief (medida cautelar), he states that the present filing is directed against the action taken by officers of the Siquirres Public Force, specifically the Station Chief, Deputy Superintendent Alexis Selles Selles, in placing another person in possession of the property that he occupied, and against the damage caused to his home, which he claims was burned, as well as the damage to the agricultural crops, as a result of the eviction (desalojo) carried out against him by the Siquirres Police Delegation, whereby Mr. Gerardo Pizarro Espinoza was placed in possession of property belonging to the Instituto de Desarrollo Rural, plot number 30, under registered survey plan (plano catastrado) number L-716764-1987, corresponding to real-property folio (folio real) number 50527-00. According to administrative proceeding (expediente administrativo) number 2020-168, the eviction of occupants from several properties registered to Mr.
Gerardo Pizarro Espinoza under real-property folio numbers 31746-004, 48916-A-001, and 38605-00 was ordered. He asserts that the property he possessed was not included in the list of properties to be vacated under the eviction order, but Deputy Superintendent Alex Selles Sellos, Station Chief, proceeded to carry out the eviction from the property he possessed, dispossessing him of the property where he claims to live with his family. He states that the Instituto de Desarrollo Rural itself authorized him to remain on that land. He comments that administrative eviction proceedings seek to place the lawful titleholders of properties in possession, whether as owners or possessors, thereby completing an administrative procedure. He states that, in administrative proceeding number 2020-168-, several properties registered under real-property folio numbers 38605-000, 31746-004, and 48916-A-001, all in the province of Limón and registered to Mr.
GERARDO PIZARRO ESPINOZA, were ordered vacated; accordingly, the eviction order was issued by the Ministerio de Seguridad Publica, Office of the Deputy Minister, and addressed to the Siquirres Police Delegation, which was required to comply with the order as to the properties identified therein. However, Public Force officials, specifically Deputy Superintendent Alex Selles Selles, Station Chief, proceeded to carry out the eviction from the property he possessed, and he therefore considers that the official breached his duty of care by evicting him and placing another person in possession of a property for which no eviction order had been issued. He states that on 22 de abril del año dos mil veintiuno, Public Force officers and several other persons arrived at the property at issue (propiedad en litis), stating that they were going to carry out the eviction and that they had orders to evict the persons present there.
He states that he told them the property belonged to INDER, but they disregarded him and, that same day, proceeded to remove all his belongings from his home, including the tools he uses for farming—among them sprayers, shovels, and machetes—and threw them into the pasture; he claims that he has not recovered those belongings and does not know their whereabouts. He states that while he was away from the property, several persons arrived and set fire to his house, which was completely destroyed. He comments that, as of the date on which he filed his application, he had nowhere to live and no work, and was therefore in a precarious situation. He does not know what happened to the crops, but has heard from neighbors that they have seen people at the site who apparently are destroying them. With respect to the likelihood of success on the merits (Apariencia de Buen Derecho), he considers that the administrative litigation claim (demanda contencioso administrativa) to be filed is reasonable and legally well-founded because he regards as unlawful the eviction from property that he possessed, used for his subsistence, and inhabited with his family, and because, through an act that he describes as arbitrary, he and his family were dispossessed of the property.
He considers that the evidence submitted demonstrates that the Public Force dispossessed him of the property, which was not among the properties identified in the eviction order sent to the Siquirres Public Force. He asserts that the adversarial proceedings (contradictorio) will establish that his right was violated and that he was dispossessed of the property by those vested with authority, who evicted him from it without any consideration whatsoever; although he is not its registered owner, he is authorized by the registered owner itself to remain on that property. With respect to risk arising from delay (Peligro en la Demora), he comments that this requirement has been relaxed under administrative litigation procedural law. Previously, interim relief was granted only where harm that was difficult or impossible to remedy existed and had to be proven. Now, what must be demonstrated is seriousness—that is, an intermediate degree—because the harm may be serious, present, or potential.
He states that interim relief is granted on grounds of risk arising from delay where the harm is serious or greater, which is not the case with minor loss and damage. This requires establishing a probability that the present or potential loss and damage is being caused by the implementation of the effects of the challenged acts. He argues that the present application for interim relief seeks to restore him to possession of the property he has possessed, a right that he claims was granted to him by the Instituto de Desarrollo Rural, because he is a simple farmer who works in the fields, asserting that his only education is his hands, since he has devoted himself to the land and to growing agricultural products, which he claims are his family’s means of subsistence, and because this is where he lives with his family. He asserts that the Siquirres Public Force acted arbitrarily pursuant to the eviction order sent by the Ministerio de Seguridad Publica, Office of the Deputy Minister, which ordered the eviction from the properties in the Limón registration district under real-property folios 38605-000, 31746-004, and 48916- A-001; however, in fact, the property from which the eviction occurred was the property under registered survey plan L-716764-1987, corresponding to real-property folio number 50527-000, registered to IDER, which is the property that he possesses.
He emphasizes that the actions of the Siquirres Public Force violated his rights as possessor, which had been recognized by INDER, because he uses the property for his own and his family’s subsistence and built his home there. He states that he is now wandering about without a place to live and remains uncertain about the crops, since to date he does not know what has happened to them; therefore, the requested relief is intended to allow him and his family to return to their home and thereby enforce his rights as possessor. With respect to the balancing of the interests at stake (Ponderación de los Intereses en Juego), he comments that, in granting the requested relief, consideration must be given to the requirement that the interim relief not adversely affect the public interest or potentially affected third parties. He therefore wishes to state why the interim relief will neither affect third parties nor harm the public interest: he is authorized to remain on the property he possesses because the registered owner itself (INDER) authorized him to use it for his own and his family’s subsistence and to live there; the purpose of the registered owner is to grant land to farmers so they may work it; and now, through the actions of the Siquirres Public Force, he was dispossessed of the property and that right of possession was granted to another person who has no right to be on the property, thereby causing him serious harm consisting of the loss of the land and the destruction of the dwelling and two crops, without causing any harm to the Administration or third parties, since he considers it established that the property belongs to INDER and that the actions of the Siquirres Public Force dispossessed him of the only thing he has.
Among his evidentiary materials, he submits the following, transcribed verbatim: “(...) 1.- Certified copy of the record of placement in possession (acta de puesta en posesión) executed on 22 de abril de dos mi veintiuno, demonstrating that the eviction was carried out on the property under plan L-716764-1 987. 2.- Certified copy of the eviction order issued by the Ministerio de Seguridad Publica, Office of the Deputy Minister, indicating which properties were to be vacated and establishing that it does not include the eviction from registered survey plan L- 716764-1987, corresponding to the property under real-property folio 50527-000. 3.- Full registry certification (certificación literal) for property 50527-000, indicating that it is registered to INDER. 4.- Certification of registered survey plan L-716764-1987. 5.- INDER-GG-DRT-RDHC-OTSQ-0415-2021 document dated 26 abril del 2021, indicating that I am (sic) in possession of that plot and further indicating that INDER has not requested (sic) any type of eviction from that property. 6.- Certifications for the properties from which the Ministerio de Seguridad Publica ordered the eviction, under real-property folio numbers 38605-000, 31746-004. 48916- A-001; the full registry records show that plan number L- 716764-1987, which appears in the Record of Placement in Possession, does not correspond to any of the properties subject to eviction.
I request (sic), as of now and so that it may be considered when the Final Interim Relief (Medida Cautelar Definitiva) is decided, that this Court order a copy of the entire administrative eviction file related to expediente 2020-517- DV, as well as the record of placement in possession bearing number 2020-1257- DV.”.- III) ARGUMENTS OF THE STATE’S REPRESENTATION: As relevant to the resolution of this matter, the State’s representation has expressed its opposition to the present interim measure (medida cautelar). It points out that, as stated in Resolutions N° 2020-517-DV of 15 horas y 30 minutos del 17 de abril del 2020 and 2020-1257-DV of 09 horas del 14 de diciembre del 2020, the eviction of properties bearing registration numbers 7-38605-000, 7-31746-004 and 7-48916-A-001 was ordered, and the applicant was directed to provide the services of a land surveyor to guide the Police during that eviction.
In this regard, it asserts that the surveyor who signed the eviction record was Engineer Ervin Adolfo Álvarez Fuentes, thereby demonstrating that the Fuerza Pública carried out the eviction in accordance with the instructions of the Departamento de Desalojos Administrativos del Ministerio de Seguridad Pública. With respect to danger in delay (Peligro en la Demora), it states that section 21 of the CPCA establishes, as an essential requirement for granting an interim measure, that the execution or continuation of the conduct at issue in the proceedings cause serious actual or potential harm or loss (periculum in mora). Therefore, merely mentioning the possibility that the execution of the challenged administrative act or action could cause serious harm or loss is insufficient for an interim measure to be granted. That possibility must possess at least two principal characteristics: it must be reasonable and objectively well-founded.
This possibility cannot be deemed to exist solely on the basis of the interested party’s assertion; rather, that party must demonstrate that the injury is imminent. It points out that, as shown in the record, the party neither identifies, much less proves, the alleged harm or loss—still less that it is serious—that would result from dispossession (desposesión) of the property that was allegedly vacated, namely N°7-50527-000, registered survey plan (plano catastrado) N° L-716764-1987, thereby failing to satisfy the burden-of-proof principle (principio de carga de la prueba) contained in section 41 of the Código Procesal Civil, which applies supplementally pursuant to section 220 of the Código Procesal Contencioso Administrativo. It considers that, in view of the complete absence of evidence capable of proving the harm and loss alleged by the plaintiffs, the interim measure at issue must be denied.
With respect to likelihood of success on the merits (Apariencia de Buen Derecho), it states that article 7 subsection f) of the Ley de Arrendamientos Urbanos y Suburbanos authorizes the Ministerio de Seguridad Pública to conduct administrative eviction proceedings (procesos de desahucio administrativo) in cases involving a loan for use (comodato), mere precarious occupancy (simple ocupación precaria), or occupancy of real property solely by tolerance.
It adds that this proceeding does not require extensive formalities and is essentially limited to verification by the aforementioned Ministry of the applicant’s right to the property sought to be vacated. It further states that, as shown in the record, the administrative eviction application at issue was granted after it was verified, through the corresponding registry certificate (certificación registral), that Mr. Gerardo Pizarro Espinoza is the owner of the properties registered in the Partido de Limón under Matrícula N°7-38605-000, 7-31746-004 and 7-48916-A-001, and the plaintiff failed to establish a superior right or any legal title justifying his continued presence on the property. It reports that, in this case, the Ministerio de Seguridad Pública ordered the participation of a land surveyor, Engineer Ervin Adolfo Álvarez Fuentes, for the purpose of delineating the area subject to eviction, guiding the Fuerza Pública de Siquirres, and preventing the eviction of persons from properties not included in the order.
Through official letter N°MSP-DM-DVURFP-DGFP-DRNHA-DPCSIQUIRRES-0908-2020 dated 24 de abril del 2021, issued by the Fuerza Pública de Siquirres and entitled “Inventory of Personal Property and Judicial Deposit of Assets,” it can be established, at folio 15 of that administrative file (expediente administrativo), that Mr. Abraham Jiménez Matarrita and his family were occupying the property Matrícula N° 7-38605-000, registered survey plan N° L-0716765-1987, and were evicted from that property in accordance with the order of the Departamento de Desalojos Administrativos del Ministerio de Seguridad Pública. In the opinion of the State’s representation, the Ministerio de Seguridad Pública’s decision granting the administrative eviction and the eviction itself satisfied the two basic requirements established by our legal system: a) It verified in the registry that the property belonged to the party who initiated the application. b) It verified that the requirement of mere tolerance (mera tolerancia) was met, since there was no lease agreement, precarious title, or legal title supporting the plaintiff’s and his family’s presence on the property.
In addition, the eviction was carried out under the supervision of a land surveyor, who delineated the area subject to eviction and guided the Fuerza Pública in carrying out those proceedings, determining that the plaintiff was encroaching upon property N° 7-38605-000. In the opinion of the State’s representation, the actions of the Ministerio de Seguridad Pública fall within its lawful authority and are duly grounded—among other provisions—in sections 45 of the Constitución Política, 7 subsection f) of the Ley de Arrendamientos Urbanos y Suburbanos, 305 of the Código Civil, and 8 of the Ley General de Policía. Accordingly, in its opinion, there is little likelihood that the principal claim will be granted or that it has a likelihood of success on the merits. With respect to the balancing of the interests at stake (Ponderación de los Intereses en Juego), it states that, in this case, the other interests at stake must be weighed against the plaintiff’s claim.
The public interest present in this case is clear, because the Ministerio de Seguridad Pública merely verified that the circumstances contemplated by the legal system were in fact present—protection of the right to private property enshrined in article 45 of the Constitución Política—in compliance with the principle of legality (principio de legalidad) and the protection of public order. It adds that, upon balancing the interests at stake, it is evident that a public interest must be protected; therefore, the appropriate course is to deny the requested interim measure, and the public interest must prevail over the private interest.
Official letter INDER-GG-DTR-RDHC-OTSQ-0839-2021 dated 10 de agosto de 2021 from the oficina territorial de Siquirres del INDER states that parcel 30 of Asentamiento Neguev contains wetland areas and that, under these circumstances, the land forms part of the Patrimonio Natural del Estado. At any time, any occupant may be evicted from public-domain areas (aéreas de dominio público), including those belonging to the Patrimonio Natural del Estado, as provided in articles 13, 14 and 15 of the Ley Forestal, under which the lands possess the inherent characteristics of inalienability (inalienabilidad), immunity from adverse possession (imprescriptibilidad), and immunity from attachment (inembargabilidad), and no private possession shall give rise to any right, for the purpose of protecting the natural resource, which prevails over the private interest. On the foregoing grounds, it requests that the interim application be denied in its entirety as to the Instituto de Desarrollo Rural and that the plaintiff be ordered to pay both categories of costs (ambas costas).
With respect to danger in delay, it considers that the plaintiff does not clearly demonstrate what difficulties arise. With respect to the balancing of the interests at stake, it emphasizes that the plaintiff cannot seek any type of interim relief concerning parcel 30 of Asentamiento Neguev, located in distrito el Cairo, cantón de Siquirres, provincia de Limón, which belongs to the Instituto de Desarrollo Rural. It reports that this property is covered by registered survey plan number L-716764-1987 and forms part of the property registered in the Registro Nacional under real-property folio number 7-50527-000 in the name of the Instituto de Desarrollo Rural. Consequently, the plaintiff is not the owner of the property, the property has not been awarded to him by the INDER, and he holds no administrative permit over the land. Moreover, any possession of any land belonging to the Instituto de Desarrollo Rural is precarious; therefore, neither the length of his possession nor the possessory acts (actos posesorios) he has performed are relevant.
Nor is it necessary to afford the possessors any hearing, because the precarious nature of the situation means that they may be evicted by the Ministerio de Seguridad Pública at any time. It states that occupation is not the means of acquiring the status of an allottee or lessee (asignataria o arrendataria) of INDER lands; rather, the legal system itself renders absolutely null and void (nulidad absoluta) any act that contravenes article 46 of Ley 9036 Ley de Transformación del Instituto de Desarrollo Agrario (IDA) en el Instituto de Desarrollo Rural (INDER). Likewise, this violates not only the Institution’s right to possess and retain property it owns, but also the right of potential beneficiaries to compete freely to participate in a particular public-interest project or program, which could result in unjustified unequal treatment in violation of article 33 of the Constitución, thereby infringing every potential beneficiary’s right to access on equal terms.
It adds that, at any time, any occupant may be evicted from public-domain areas, including those belonging to the Patrimonio Natural del Estado, as provided in articles 13, 14 and 15 of the Ley Forestal, under which the lands possess the inherent characteristics of inalienability, immunity from adverse possession, and immunity from attachment, and no private possession shall give rise to any right, for the purpose of protecting the natural resource, which prevails over the private interest.
In its view, the party neither identifies nor demonstrates the alleged harm or loss that would be caused by dispossession from the property from which that party was allegedly evicted, property 7-50527-000, plan L-716764-1987, thereby failing to comply with the burden-of-proof principle (principio de carga de la prueba) contained in Article 41 of the Code of Civil Procedure (Código Procesal Civil), which applies to this matter pursuant to Article 220 of the Code of Civil Procedure. With respect to the likelihood of success on the merits (Apariencia de Buen Derecho), it states that the administrative eviction proceeding (gestión de desahucio administrativo) at issue was granted after the corresponding registry certification established that Mr. Gerardo Pizarro Espinoza is the owner of the properties recorded in the Limón registry district under Property Registration Nos. 7-38605-000, 7-31746-604 Y 7-48916-a-00A, and the plaintiff failed to demonstrate a superior right or any legal title that would justify remaining on the property, as evidenced by the Ministerio de Seguridad Pública’s decision granting the administrative eviction (desalojo administrativo).
It considers that the eviction itself complied with the two basic requirements established by our legal system: 1- It verified in the Property Registry that the property belonged to the applicant; 2- It verified compliance with the requirement of mere tolerance (mera tolerancia), since there was no lease agreement, precarious title, or legal title supporting the plaintiff’s and his family’s presence on the property. It therefore considers that the actions of the Ministerio de Seguridad Pública fall within its lawful powers and are based on Art. 45 of the Constitución Política, Art. 7 subsection f) of the Ley de Arrendamientos urbanos y suburbanos, and Article 305 of the Código Civil, and accordingly considers that the principal request should not be granted.
Las medidas cautelares contra la Administración Pública. 2 ed. Buenos Aires, Argentina: Ábaco, 2006). With the foregoing clearly established, the adjudicator, in compliance with Article 21 of the aforementioned procedural statute, must determine whether a request for an interim measure should be granted by verifying that the claim in the merits proceedings (pretensión del proceso de conocimiento) is neither frivolous nor manifestly lacking in seriousness. This constitutes a preliminary assessment of the merits to determine whether the case presents what legal scholarship and case law have called a likelihood of success on the merits, or fumus boni iuris. The provision under review also establishes that an interim measure may be granted when the implementation or continuation of the conduct subject to the proceedings causes serious actual or potential harm or loss, a situation defined in legal scholarship as periculum in mora, or risk arising from delay (peligro en la demora); that is, when the pathological delay of judicial proceedings creates a present, real, and objective risk that the applicant will suffer serious harm (Jinesta Lobo, Ernesto.
Manual del Proceso Contencioso-Administrativo. 1 ed. San José, Costa Rica, Editorial Jurídica Continental, 2008). Following the same line of reasoning, Article 22 of the Código Procesal Contencioso Administrativo establishes the adjudicator’s obligation, in light of the principle of proportionality (principio de proporcionalidad), to balance the interests at stake—that is, the individual’s circumstances, on the one hand, against the public interest and the interests of third parties that may be affected by the adoption of the interim measure, on the other. Additionally, the aforementioned Article 22 requires the interim measure to be ancillary (instrumental) and provisional. Based on the foregoing legal framework for analysis and the elements required for granting an interim measure, the specific case will now be examined.- VIII) REGARDING THE SPECIFIC CASE. The principal objective of the applicant’s request for interim relief (pretensión cautelar) is for this Court to order the Ministry of Public Security to place him in possession of the property registered under number 50527- 000, cadastral plan number L-716764-1984, from which he claims that he and his family were evicted on the twenty-second of April of the current year.
He also requests that the Public Force officers be ordered to refrain from entering the property without an order from a competent authority. In addition, he requests that Mr. Gerardo Pizarro Espinoza, who was the person placed in possession of the property, be ordered to vacate it and not disturb either the claimant or any member of his family. Upon analyzing the foregoing, we see that the claimant’s request is aimed at setting aside an administrative eviction (desalojo administrativo) and placement in possession carried out almost six months ago in favor of Mr. Gerardo Víctor Pizarro Espinoza. It should now be emphasized that Mr. Pizarro Espinoza, in his response to this request for interim relief, reported that he had requested the administrative eviction, which he considers lawful pursuant to his rights over the properties registered in his name. Note that in this matter, although two government agencies are involved in relation to the land in dispute (IDA and SINAC), it is important to be clear that, in proceedings of this type, it is not appropriate to determine preliminarily who does or does not hold the superior right (mejor derecho) being asserted, since that issue, if applicable, must be analyzed on the merits in the principal proceeding or before the appropriate court.
However, the basis of the request for interim relief now being decided on the merits is different, because it challenges the conduct of the public administration, represented here by the Ministry of Public Security. Such conduct, if applicable, could indeed be subject to review in this jurisdiction. Note that the claimant’s argument is based on the contention that the administrative action was unlawful. He asserts that damage was caused to his dwelling, as well as to the agricultural crops he had on that property. As has been stated and is known to everyone, one matter is ownership or possession of the property and the determination of the superior right that the claimants may assert over it, and quite another is the challenge to the administrative proceeding (procedimiento administrativo) itself. For this Court, there is an administrative act (acto administrativo) that the claimant has challenged from its inception and in its final decision.
For purposes of the case under consideration, we cannot overlook that we are analyzing the requirements for interim relief (presupuestos cautelares), and not what the claimant may or may not ultimately obtain on the merits. The claimant must bear in mind what was analyzed and determined above: notwithstanding the foregoing, it is considered that he has the likelihood of success on the merits (apariencia de buen derecho) necessary to challenge before this Court the record or administrative act ordering eviction from the property in which he claims an interest, should he decide to file such a challenge. It will be in the merits proceeding (causa de conocimiento) that it will be determined whether Mr. Abraham Jiménez Matarrita’s right was in fact violated as he claims. In this summary review, that substantive issue is found to involve allegations properly belonging to the principal proceeding, such as a possible declaration of nullity of the administrative proceeding, an issue related to what was analyzed in that forum and challenged by the applicant in this matter, which, as already indicated, is indeed subject to review by this Court.
(In support of the foregoing, see decision 000649-C-S1-2021 of the First Chamber of the Supreme Court of Justice, issued at 14:15h on 18/03/2021). Under the terms stated, the likelihood-of-success requirement shall be deemed satisfied. Regarding the risk arising from delay (peligro en la demora): It should be noted that the only evidence submitted by the claimant in the proceeding relates directly to the administrative events he challenges and to his request that the administrative case file (expediente administrativo) be forwarded for the final resolution of this request for interim relief. That evidence would not substantiate the harm, much less its magnitude, that he might suffer—or, rather, might already be suffering—as a result of an administrative eviction carried out against him on the twenty-second of April of the current year (see fact “SECOND” in this request for interim relief).
As has been shown, the evidence submitted relates to the processing of the administrative proceeding and will be highly useful in the principal case should he decide to bring it before this Court; however, it does not demonstrate the harm, much less its magnitude. It must be recalled that, to be protected through proceedings of this type, the harm must not only exist but must also reach a serious level warranting such protection; and that seriousness obviously could be established only if the party bringing such a request supported it with evidence that is relevant, compelling, and necessary for that purpose, which is precisely what is absent from the record. He has submitted no evidence demonstrating the material or financial impossibility of moving elsewhere, staying with a relative, or renting another place while awaiting the outcome of the proceeding that may be filed. This Court might conclude that execution of the eviction causes harm merely because he must leave the dwelling he occupies, but this Court cannot determine the magnitude of that harm in the absence of evidence to that effect.
Note that the applicant is aware that harm must be demonstrated in proceedings of this type. Let us consider what he stated in the section entitled “2.-Periculum In mora.”: (...) This requirement has been relaxed under the new administrative litigation procedural legislation (legislación procesal contenciosa administrativa). Previously, interim relief (medida cautelar) was granted only if there was harm that would be difficult or impossible to remedy, and such harm had to be proven. Now what must be demonstrated is seriousness, that is, an intermediate level, since harm may be serious, present, or potential. Interim relief is granted for risk arising from delay in cases of serious harm and above, but not in cases of minor loss and damage. For this purpose, it is necessary to establish a probability assessment of the present or potential loss and damage being caused by the implementation of the effects of the acts, (...)”.
(Boldface and underlining are ours). Despite that knowledge, this case reveals a complete failure to demonstrate the harm and, consequently, its magnitude. Although it may be understandable that the eviction could cause harm, its magnitude can be demonstrated only by the person seeking to have his request granted, and it could never be assumed that, in cases of this type, the judicial authority must grant the request solely on the party’s assertion, since this would not only contravene the rules governing the matter (Article 41 of the Code of Civil Procedure, applicable to this subject matter by referral from 220 of the Code of Administrative Litigation Procedure), but would also create a procedural imbalance in favor of the applicant, who bears the burden of proving his assertions. In this case, the claimant stated that he is single and lives in a common-law union (unión libre). He has also asserted that he occupied the property where the challenged eviction was carried out together with his family and that the property provides his family with sustenance and food.
Further on, specifically among his claims for relief, we see that in the request identified as number “3.” he stated the following: “(...) That Mr. GERARDO PIZARRO ESPINOZA, who was the person placed in possession of the property, be ordered to vacate the property and not to disturb either the undersigned (sic) or any (sic) member of my (sic) family.(...)”. (Boldface and underlining are ours). Note that throughout his request for interim relief, the claimant refers to his family (members of his family), to his concern that he may be unable to provide for his family, to his assertion that he lived there with his family, and to the property’s role in providing sustenance for his family. This Court fully understands the concern that having to vacate one’s dwelling, or the property where one lived with one’s family, may cause any person, particularly if that person cultivated on the property the food needed to support the household; that is entirely clear.
However, what is unclear is which family the applicant means. This Court has only two pieces of information concerning the claimant: that he is single and that he lives in a common-law union. It is entirely unknown whether the family members he states are dependent on him include sons or daughters; if so, he should have established that fact with the evidence required for that purpose—a birth certificate would have sufficed—because such evidence would have made it possible not only to verify that relationship but also their ages, in order to establish at least the financial and maintenance dependency that the claimant asserts arose from the property he occupied. If, when referring to his family, he meant only the person with whom he lives in a common-law union, he should have established that she is also financially dependent on him, in order to rule out the possibility that she is a significant source of household income that would prevent his family’s support from being jeopardized while awaiting the outcome of the principal proceeding.
Under these circumstances, as stated, harm arises merely from having to vacate the dwelling and property he occupied, but Mr. Jiménez Matarrita must understand that this Court does not know him and that he is therefore required to demonstrate the harm and its magnitude. This can be accomplished only through supporting evidence, which he was required to provide under section 41.1.1 of the Code of Civil Procedure, applicable to this subject matter by referral from 220 of the Code of Administrative Litigation Procedure. If, as he asserts, this is truly the only property available to him and his family, he should have submitted the necessary supporting evidence, because the record shows that he stated—but did not prove—that he has nowhere to live. Time has passed, however, and this Court does not know his current situation or that of his family. Regarding the carrying out of the administrative eviction, which, as has been duly established in the record, occurred on the twenty-second of April of the current year, there would not only be an evident lack of a present interest (interés actual) in staying the execution of an administrative action that has already been carried out, but, more importantly, no evidence of the adverse consequences that the loss of that property has caused the claimant and his family.
It is unknown whether he was able to continue performing his work. It is unknown whether he has been able to continue meeting his own needs and those of his family. No evidence of this has been submitted in the record that would now require this Court, in deciding the merits, to grant the request or, rather, reverse the provisional summary denial (rechazo provisionalísimo) issued on the very day this request for interim relief was filed, pursuant to section 29 subsection 2) of the Code of Administrative Litigation Procedure. This shows that the harm in this case was not and has not been serious enough to warrant granting this request for interim relief solely on the claimant’s assertion, in clear conflict with section 41 of the Code of Civil Procedure.
Accordingly, the element analyzed cannot be deemed satisfied, and for that reason the interim measure (medida cautelar) must be denied, since all the conditions or requirements must be present for it to be granted, and the absence of any one of them results in its denial, as is hereby ordered. With regard to the balancing of the interests at stake (Ponderación de Intereses en Juego) and the possible harm to the public interest (Interés Público) and interested third parties (Terceros Interesados), this Judge considers that, because the existence of serious harm has not been demonstrated, the only possible conclusion is that the private interest must yield to the public interest represented by the need for the actions of public entities and private parties to conform to the standards of legal certainty and legality established by the legal system; the foregoing is without prejudice to whatever may ultimately be decided on the merits in the corresponding proceeding.
This Court cannot disregard the powers conferred upon the various administrative authorities, represented in this case by the Ministerio de Seguridad Pública; however, it likewise cannot disregard that, through an application for interim relief (gestión cautelar), it would be inappropriate, inadmissible, and premature to rule on whether the relief sought is proper or on how the administrative authority must act in this type of administrative proceeding. It is therefore determined that, until otherwise decided in the proceeding on the merits (proceso de conocimiento), prudence weighs against deeming the condition analyzed to have been satisfied, because in the particular case under review there is a complete lack of the evidence necessary to assess the harm that the plaintiff herein could suffer or may be suffering as a result of the administrative determination adverse to his interests. Under those circumstances, that harm or adverse effect cannot be assessed so as to weigh which harm or situation should receive protection, and it is therefore beyond doubt that the public interest must prevail over the private interest.
Moreover, the element or requirement under review was structured or divided so as to analyze not only the balancing of the interests at stake and the impact on the public interest, but also the possible impact on interested third parties; and it is at this point that the undersigned must pause and exercise caution in analyzing the situation. In this matter, the plaintiff herein has disputed and challenged the manner in which the administrative eviction proceeding (procedimiento administrativo de desalojo) was conducted and the manner in which another person—who, according to him, has no right to be on the property of the Instituto de Desarrollo Rural—was placed in possession (posesión); we are referring to Mr. Gerardo Pizarro Espinoza. It should be recalled that Mr. Pizarro Espinoza was the person who initiated the administrative eviction proceeding, which was decided in his favor, and he now enjoys possession granted through administrative channels.
Although that possession is being challenged through this application for interim relief and the possible principal action (demanda principal), he is the person whom the administrative authority placed in possession and who, as the plaintiff himself has stated, currently resides at the property. In this case, it has been established since the very day on which this application for interim relief was filed that, by the time it was submitted, the eviction had already been carried out. It is evident that the relief requested by the applicant includes an order placing him in possession of the property from which he was evicted on veintidós de Abril del año en curso; however, he did not seek relief through this avenue until treinta de abril, that is, eight days after the administrative authority evicted him and placed Mr. Pizarro Espinoza in possession. Although the administrative proceeding through which Mr.
Pizarro Espinoza assumed possession is being challenged, this is a situation that must be protected by this Court, which is why he was joined in the proceeding so that he could receive judicial due process (debido proceso jurisdiccional) and participate therein. The plaintiff’s challenge to the administrative proceeding is fully reviewable in this Jurisdiction, as stated when analyzing the requirement of a likelihood of success on the merits (apariencia de buen derecho), but it is a matter that must be litigated in the proceeding on the merits, and it would be contrary to law to deprive Mr. Pizarro Espinoza of that property through this interim measure. If the purpose is to protect third parties or minimize any possible harm to them, as required by the condition or element analyzed, the undersigned considers it appropriate and advisable not to deem this condition satisfied; consequently, the interim measure must be denied.
On this occasion, the balance weighs in favor of protecting the rights of the public administrative authority represented herein, as well as those of Mr. Gerardo Pizarro Espinoza, who, as indicated, is the person to whom the administrative authority granted possession of the real property on veintidós de Abril del año en curso; and if the plaintiff decides to initiate the proceeding on the merits, that will be the forum in which it will be determined which position is correct. Accordingly, the interim measure sought by Mr. Abraham Jiménez Matarrita is denied.- IX) COSTS (COSTAS): In this matter, the representative of the Instituto de Desarrollo Rural (IDA), as part of its claim, sought an award of costs against Mr. Abraham Jiménez Matarrita; however, in the opinion of the undersigned, the manner in which the events occurred in the administrative proceedings (sede administrativa) afforded the claimant the opportunity to come before this court in order to defend his rights and interests.
It should be noted that, through an application for interim relief (gestión cautelar), it is not appropriate to examine the merits of the matter and, consequently, whether or not the applicant is correct can be determined only in the principal proceedings (causa principal), should he decide to institute them. Nevertheless, despite this, it cannot be overlooked that this application for interim relief was denied for a different reason; however, the review and analysis of the requirements for interim relief (presupuestos cautelares) established that he has the requisite prima facie basis to come before this court to protect his interests and rights, and therefore the requirement of likelihood of success on the merits (Apariencia de Buen Derecho) was deemed satisfied, which establishes that he had sufficient grounds to appear before this court. Furthermore, regarding costs in applications of this type, there are several rulings by the Tribunal de Apelaciones de lo Contencioso Administrativo holding that, until a different position is adopted, this Court considers that the foregoing ruling should be issued without an award of costs, precisely because of the nature of these proceedings.
(see, among others, RESOLUCIÓN 009-TA-11, 010-TA-11. SENTENCIA Nº 90 -2011 bis TRIBUNAL DE APELACIONES DE LO CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA. Anexo A del Segundo Circuito Judicial de San José, Calle Blancos, at thirteen hours and thirty minutes on March sixteen, two thousand eleven). Accordingly, this matter is resolved without any specific award of costs.- X) REGARDING THE DEFENSES RAISED IN THIS TYPE OF MATTER: Solely for the purpose of ruling on the defenses (excepciones) raised in applications of this type, this Court reiterates what the Tribunal de Apelaciones has stated regarding the assertion of defenses in such applications; the parties are therefore referred to the holding of the Tribunal de Apelaciones, specifically the Sección Segunda del Tribunal de Apelaciones de lo Contencioso Administrativo, which has developed this issue and held, insofar as relevant to this ruling, as follows: “(...) From a technical standpoint, it is not possible to raise defenses, as may properly be done in proceedings on the merits (procesos de conocimiento), except, of course, those relating to jurisdiction (which must be heard as a preliminary matter and ruled upon separately, since it suspends jurisdiction to continue hearing the case file, except as to that application itself), those relating to legal capacity and formal requirements (the latter of which would be considered when ruling on the merits of the application), or those relating to joinder of the parties (integración de la litis).
Accordingly, any defense or plea that is submitted serves no purpose; however, if raised, it must be reserved for consideration together with the merits of the interim measure (medida cautelar), rather than decided by an interlocutory ruling. An interlocutory ruling is inappropriate in proceedings of this type because it would permit a summary application (gestión sumaria) to be transformed into ordinary proceedings, thereby distorting its essential nature.(...)”. (boldface and underlining added). (see resolution N° 314-2020-II TRIBUNAL DE APELACIONES DE LO CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA DEL SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ, SECCIÓN SEGUNDA, at seven hours and thirty minutes on June eleven, two thousand twenty.). This Judge agrees with the Tribunal de Apelaciones regarding the assertion of defenses in this type of proceeding, in which the parties actually require a prompt ruling resolving the matter submitted for consideration.
Although, in this case, those persons or institutions whose rights and interests might be affected had to be joined to the proceedings, this was required precisely because the relief sought through this application directly entailed the participation of the parties joined to these proceedings, and their participation was therefore ordered. As for the other defenses, such as res judicata (cosa juzgada) or lack of standing (falta de legitimación), these matters must be reserved for analysis in the principal proceedings; the claimant must take this into consideration at the appropriate time if he decides to litigate the principal proceedings before this jurisdiction.- XI) DISPOSITION OF THE CASE: Therefore, because not all the necessary legal requirements have been met, the requested interim measure must be denied as presented. It must be taken into consideration that both the requirement of likelihood of success on the merits and the balancing of the interests at stake (ponderación de intereses en Juego) are matters for the Judge to analyze, verify, and examine in order to determine whether they have been satisfied and whether the action may be heard in proceedings on the merits before this Jurisdiction (likelihood of success on the merits), and whether the determination made affects the public interest or the interests of third parties (balancing of the interests at stake).
However, one of the requirements for granting interim relief is within the control of the person who initiates this type of proceeding (RISK ARISING FROM DELAY [PELIGRO EN LA DEMORA]), because proof of the harm is incumbent upon the person who suffers it, who must substantiate the allegation with relevant and probative evidence for that purpose (article 41 of the Código Procesal Civil). This is precisely the requirement that was not supported and substantiated as was the claimant’s duty and obligation, and this Court has no reason to remedy the omissions identified in the corresponding section. As a logical consequence of this ruling, the interim measure sought by Mr. ABRAHAM JIMÉNEZ MATARRITA against the STATE (Ministerio de Seguridad Pública), INSTITUTO DE DESARROLLO RURAL (INDER), SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN (SINAC), GERARDO PIZARRO ESPINOZA, and ERVIN ADOLFO ÁLVAREZ FUENTES is denied. This matter is resolved without an award of costs. The case file shall be closed and archived in due course.-

Correo Electrónico [email protected] Segundo Circuito Judicial de San José, Anexo A (Antiguo edificio Motorola) ------------------------------------------------------------------------------------------------- PROCESO: MEDIDA CAUTELAR PROVISIONALISIMA PROMUEVE: ABRAHAM JIMÉNEZ MATARRITA DEMANDADOS: EL ESTADO (Ministerio de Seguridad Pública ), INSTITUTO DE DESARROLLO RURAL (INDER), SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN (SINAC), GERARDO PIZARRO ESPINOZA y ERVIN ADOLFO ÁLVAREZ FUENTES ------------------------------------------------------------------------------------------------- N°640-2021 TRIBUNAL PROCESAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA DEL SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ - ANEXO A - Goicoechea, al ser las quince horas cuarenta y cinco minutos del día seis de Octubre del año dos mil veintiuno.- Se conoce MEDIDA CAUTELAR ANTE CAUSAM, interpuesta por el señor ABRAHAM JIMÉNEZ MATARRITA en contra del ESTADO (Ministerio de Seguridad Pública ), INSTITUTO DE DESARROLLO RURAL (INDER), SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN (SINAC), GERARDO PIZARRO ESPINOZA y ERVIN ADOLFO ÁLVAREZ FUENTES.-
RESULTANDO:
CONSIDERANDO:
Cita que el propio Instituto de Desarrollo Rural le autorizó para la permanencia en dicha tierra. Comenta que los procesos de desalojos administrativos, lo que se buscan es poner en posesión a los legítimos titulares de las propiedades, sean por ser propietario o poseedores, cumpliendo así con un trámite administrativo. Cita que dentro del expediente administrativo bajo el número 2020-168-, se procedió a realizar el desalojo de varias propiedades inscritas bajo los folios reales con los números 38605-000, 31746-004, 48916-A-001, todas de la provincia de Limón, a nombre del señor GERARDO PIZARRO ESPINOZA, así se emitió la orden de desalojo, por parte del Ministerio de Seguridad Publica. Despacho del Viceministro, dirigida a la Delegación de Policía de Siquirres, orden que debían de acatar sobre las propiedades que se indican en la orden de desalojo, pero los funcionarios de fuerza pública, propiamente el Sub-Intendente, Alex Selles Selles, jefe de puesto, procedió a realizar el desalojo en la propiedad que estaba poseyendo, con lo cual considera que faltó al deber de cuidado al realizar un desalojo y puesta en posesión de una propiedad que no se había girado orden de desalojo.
Informa que el día 22 de abril del año dos mil veintiuno, se presentaron a la propiedad en Litis, oficiales de la fuera pública junto con varias personas, indicando que iba a realizar el desalojo de la propiedad, quienes indicaron que tenían órdenes de desalojar a las personas que se encontraban en dicho lugar. Cita que les manifestó que esa propiedad le pertenece al INDER, pero hicieron caso omiso, siendo que ese mismo día procedieron a sacar todas sus pertenencias de su casa de habitación, como las herramientas que utiliza para el cultivo; entre ellas bombas de fumigar, palas, machetes y la tiraron al potrero, pertenencias que asegura no las ha recuperado y desconociendo su paradero. Informa que al no estar en la propiedad, llegaron unas personas y procedieron a incendiar su casa la cual quedó destruida en su totalidad. Comenta que a la fecha en que presentó su gestión no tiene donde vivir y no tiene trabajo, por lo que se encuentra en una situación precaria.
Que desconoce que sucedió con los cultivos, pero ha escuchado de vecinos que han visto personas en dicho lugar y en apariencia los están destruyendo. Respecto a la Apariencia de Buen Derecho considera que la demanda contencioso administrativa que se presentará, es razonable y fundamentada en derecho, esto en razón al desalojo que considera ilegal de una propiedad que estaba poseyendo, la cual la utilizaba para su subsistencia y es donde habitaba junto con su familia y que mediante un acto que afirma es arbitrario, fue despojado junto con su familia de la propiedad, considerando que con la prueba aportada, queda demostrado el despojo de la propiedad, por parte de la fuerza pública, misma que no corresponde a desalojo de fincas que se habían establecido en la orden de desalojo enviada a la Fuerza Pública de Siquirres. Asegura que en el contradictorio quedara demostrado que su derecho fue violentado y despojado de la propiedad, por quienes tienen tener la autoridad y sin ningún tipo de reparo, lo desalojaron de la propiedad, que si bien no es su dueño registral, está facultado para estar en dicho propiedad por el propio dueño Registral.
Respecto al Peligro en la Demora; comenta que este presupuesto ha sido flexibilizado en la legislación procesal contenciosa administrativa. Antes, la medida cautelar solo se otorgaba si había daños de difícil o imposible reparación y había que probarlos. Ahora lo que se debe demostrar es una gravedad, es decir un nivel intermedio, pues los daños pueden ser graves, actuales o potenciales. Cita que de daños graves en adelante se dan medidas cautelares por el peligro en la demora, lo que no ocurre con el caso de daños y perjuicios leves. Para ello es necesario acreditar un juicio de probabilidad de los daños y perjuicios actuales o potenciales que la ejecución de los efectos de los actos está causando. Argumenta que la presente solicitud cautelar de puesta en posesión de la propiedad que ha estado poseyendo, derecho que afirma le otorgó el Instituto de Desarrollo Rural, esto en razón que es un simple campesino, el cual se dedica al trabajo de campo, asegurado que su único estudio son sus manos, ya que se ha dedicado a la tierra, a cultivar productos agrícolas, lo cual asegura que es el medio de subsistencia de su familia, y es el lugar en donde vive junto a su familia, que con la actuación de la fuerza pública de Siquirres que asegura es arbitraria, con la orden de desalojo enviada por el Ministerio de Seguridad Publica, despacho del Viceministro, en la cual se ondeó el desalojo de las propiedades partido de Limón, bajo los folios reales 38605-000, 31746-004, 48916- A-001, pero de acuerdo a la realidad, la propiedad que fue desalojada fue la propiedad bajo el plano catastrado L-716764-1987, misma que pertenece al folio real número 50527-000, a nombre del IDER, que es la propiedad que posee.
Enfatiza que con el actuar de la fuerza pública de Siquirres violentaron su derecho de poseedor, derecho que se lo acreditó el INDER, ya que dicha propiedad la utiliza para su subsistencia, y la de su familia, y en donde construyó su casa, afirmando que anda ambulando sin tener un lugar donde vivir, y con la incertidumbre de los cultivos, que a la fecha desconoce que ha pasado con dichos cultivos, por lo que dicha mediada es para poder ingresar de nuevo a su hogar junto a su familia, y así poder valer su derecho como poseedor. Respecto a la Ponderación de los Intereses en Juego; comenta que para otorgar la cautela solicitada debe tenerse en cuenta que la medida cautelar no debe afectar el interés público o de posibles terceros afectados. Por ello se permito indicar los motivos por los cuáles la medida cautelar no va a afectar a terceros ni va a afectar el interés público ya que la propiedad que esta poseyendo, se encuentra facultado para estar en dicha propiedad, ya que el propio dueño registral (INDER), le ha facultado para que utilice dicha propiedad para su subsistencia y la de su familia, y poder habitar en dicha propiedad, que el fin del dueño Registral, es otorgar tierras a los campesinos para que trabajen la tierra, y hoy por el actuar de la Fuerza Pública de Siquirres, el cual lo despojo de la propiedad, y le acredito ese derecho de posesión a otra persona que no tiene derecho de estar en la propiedad, causándole con ello un gran perjuicio que la pérdida de la tierra, la destrucción de la vivienda, como de dos cultivos y ningún perjuicio a la Administración o terceros, ya que considera quedó demostrado que dicha propiedad pertenece el INDER, y que con el actuar de la fuerza pública de Siquirres, lo despojaron de lo único que tiene.
Dentro de su material probatorio aporta el que de seguido se transcribe de forma literal: "(...) 1.- Copia Certificada del acta de puesta en posesión realizada el día 22 de abril de dos mi veintiuno, en la cual demuestra que dentro de desalojo se llevó a cabo en la propiedad con el plano L-716764-1 987. 2.- Copia Certificada de la orden de desalojo por parte Ministerio de Seguridad Publica. Despacho de Viceministro, en la cual se indica, cuáles eran las propiedades que debían de ser desalojadas y la cual consta que no se incluye el desalojo del pleno catastrado L- 716764-1987, misma que corresponde a la propiedad con el folio real 50527-000. 3.-Certificación literal de la propiedad 50527-000, en la que se indica que se encuentra a nombre de INDER. 4.- Certificacion del plano catastrado L-716764-1987. 5.- Documento INDER-GG-DRT-RDHC-OTSQ-0415-2021 con fecha 26 abril del 2021, en la que se indica que estoy (sic) en posesión de dicha parcela, y además se indica que INDER, no solicitado (sic) ningún tipo de desalojo en dicha propiedad. 6.- Certificaciones de las propiedades que se ordeno el desalojo por parte del Ministerio de Seguridad Publica, con los folios reales números 38605-000, 31746-004. 48916- A-001 y con los estudios literales, se muestra que el plano con el numero L- 716764-1987, mismo que aparece en el acta de Puesta de Posesión, no corresponde a ninguna de la propiedades objeto de desalojo.
Solicito (sic) desde ahora y para que sea apreciado cuando corresponda resolver la Medida Cautelar Definitiva, que este Tribunal ordene copia de todo el expediente del desalojo administrativo relacionado con el expediente 2020-517- DV, como del acta de puesta en posesión que indica el número 2020-1257- DV.".- III) ARGUMENTOS DE LA REPRESENTACIÓN ESTATAL: De interés para resolver este asunto, la representación del Estado ha manifestado su oposición a la presente medida cautelar. Hace ver que según consta en las resoluciones N° 2020-517-DV de las 15 horas y 30 minutos del 17 de abril del 2020 y 2020-1257-DV de las 09 horas del 14 de diciembre del 2020, se dispuso desalojar los inmuebles matrícula números 7-38605-000, 7-31746-004 y 7-48916-A-001, y se ordenó a la parte gestionante aportar los servicios de un ingeniero topógrafo a fin de guiar a la Policía en el desalojo referido. En ese sentido, asegura que se puede constatar que el topógrafo firmante en el acta de desalojo es el Ingeniero Ervin Adolfo Álvarez Fuentes, quedando demostrado que la Fuerza Pública realizó el desalojo de acuerdo a lo indicado por el Departamento de Desalojos Administrativos del Ministerio de Seguridad Pública.
Respecto al Peligro en la Demora expone que el numeral 21 del CPCA establece como requisito indispensable para la procedencia de una medida cautelar el que la ejecución o permanencia de la conducta sometida a proceso, produzca graves daños o perjuicios, actuales o potenciales (periculum in mora). Por ello, para la procedencia de una medida cautelar no basta únicamente con mencionar la posibilidad de que la ejecución del acto o actuación administrativa que se cuestiona pueda provocar un daño o perjuicio grave. Esa posibilidad debe cumplir al menos con dos características principales: que sea razonable y objetivamente fundada. No puede tomarse como existente esta posibilidad con el simple dicho del interesado, sino que éste deberá demostrar la inminencia de la lesión. Hace ver que según consta en autos la parte no indica y mucho menos demuestra cuáles son los supuestos daños o perjuicios (mucho menos que sean graves) que le produciría la desposesión del inmueble que supuestamente fue desalojado, es decir, el N°7-50527-000, plano catastrado N° L-716764-1987, incumpliendo el principio de carga de la prueba contenido en los numerales 41 del Código Procesal Civil, de aplicación supletoria por disposición del numeral 220 del Código Procesal Contencioso Administrativo.
Considera que en vista de la ausencia total de prueba capaz de acreditar los daños y perjuicios alegados por los demandantes, asegura que debe rechazarse la medida cautelar que nos ocupa. Respecto a la Apariencia de Buen Derecho expone que el artículo 7 inciso f) de la Ley de Arrendamientos Urbanos y Suburbanos, faculta al Ministerio de Seguridad Pública para llevar a cabo los procesos de desahucio administrativo en casos de comodato o la simple ocupación precaria o por pura tolerancia de un bien inmueble. Agrega que este proceso no requiere de mayor trámite, y se circunscribe básicamente a una constatación por parte del citado Ministerio en cuanto al derecho que le asiste al solicitante sobre el inmueble que se pretende desocupar. Agrega que según consta en autos, la gestión de desahucio administrativo que nos ocupa fue acogida al comprobarse, mediante la respectiva certificación registral, que el señor Gerardo Pizarro Espinoza, es el propietario de los inmuebles inscritos en el Partido de Limón, Matrícula N°7-38605-000, 7-31746-004 y 7-48916-A-001, sin que la parte actora demostrara poseer mejor derecho o algún título legal que justificara su permanencia en el inmueble.
Informa que el Ministerio de Seguridad Pública en este caso ordenó la intervención de un Ingeniero Topógrafo, Ingeniero Ervin Adolfo Álvarez Fuentes, con la finalidad de delimitar el desalojo, guiar a la Fuerza Pública de Siquirres y evitar se desalojaran propiedades no contempladas dentro del mismo. Que por medio del oficio N°MSP-DM-DVURFP-DGFP-DRNHA-DPCSIQUIRRES-0908-2020 de fecha 24 de abril del 2021, emitido por la Fuerza Pública de Siquirres, titulado “Inventario de muebles y depósito judicial de los bienes”, se logra constatar, a folio 15 de dicho expediente administrativo, que el señor Abraham Jiménez Matarrita y su familia se encontraban ocupando el inmueble Matrícula N° 7-38605-000 plano catastrado N° L-0716765-1987, siendo desalojados de esta propiedad de acuerdo a lo ordenado por el Departamento de Desalojos Administrativos del Ministerio de Seguridad Pública. A criterio de la representación Estatal, la declaratoria con lugar del desalojo administrativo por parte del Ministerio de Seguridad Pública y el desalojo mismo cumplió con las dos exigencias básicas que establece nuestro ordenamiento jurídico: a) Constató que registralmente la propiedad pertenecía al promotor de la gestión. b) Constató que se cumplía el requisito de la mera tolerancia, puesto que no existía ningún contrato de arrendamiento o título precario o legal que respaldara la estancia del actor y su familia en el inmueble.
Aunado a lo anterior, el desalojo se realizó con la supervisión de un Ingeniero Topógrafo, el cual delimitó el área a desalojar y guío a la Fuerza Pública en la realización de dichas diligencias, determinando que el actor invadía el inmueble N° 7-38605-000. A criterio de la representación del Estado, la actuación del Ministerio de Seguridad Pública está dentro de sus competencias legítimas, y debidamente fundamentada –entre otros- en los numerales 45 de la Constitución Política, 7 inciso f) de la Ley de Arrendamientos Urbanos y Suburbanos, 305 del Código Civil y 8 de la Ley General de Policía, por lo que a su criterio existe poca posibilidad de que la pretensión principal sea acogida o que ésta tenga apariencia de “buen derecho”. Respecto a la Ponderación de los Intereses en Juego, expone que en este caso, frente a la pretensión de la parte actora, debe ponderarse los demás intereses en juego.
Es patente el interés público presente en este caso, en virtud de que el Ministerio de Seguridad Pública se limitó a comprobar la efectiva concurrencia de los supuestos comprendidos en el ordenamiento jurídico (tutela del derecho a la propiedad privada consagrado en el artículo 45 de la Constitución Política) en acatamiento del principio de legalidad y el resguardo al orden público. Agrega que efectuando una ponderación de los intereses en juego, le resulta evidente que hay un interés público que debe ser resguardado, de suerte tal que lo correspondiente sea el rechazo de la medida cautelar planteada, y debe de prevalecer el interés público sobre el interés particular.
Que, el oficio INDER-GG-DTR-RDHC-OTSQ-0839-2021 del 10 de agosto de 2021 de la oficina territorial de Siquirres del INDER, indica que la parcela 30 del Asentamiento Neguev tiene presencia de zonas de humedal y ante esta circunstancia, se está en presencia de un terreno que forma parte del Patrimonio Natural del Estado, y en cualquier momento, cualquier ocupante puede ser desalojado de las aéreas de dominio público que le pertenecen incluso al Patrimonio Natural del Estado, según lo dispone los artículos 13, 14 y 15 de la Ley Forestal, en donde los terrenos tienen las características inherentes de inalienabilidad, imprescriptibilidad e inembargabilidad en donde cualquier posesión por los particulares no causará derecho alguno, con la finalidad de proteger el recurso natural que prevalece ante el interés particular. Por lo expuesto solicita que la cautelar sea declarada sin lugar en todos sus extremos en cuanto al Instituto de Desarrollo Rural, condenando en ambas costas al actor.
Respecto al Peligro en la Demora; considera que la parte actora no demuestra con claridad cuales son los inconvenientes que se suscitan. Respecto a la Ponderación de los Intereses en Juego; enfatiza que el actor no puede pretender ningún tipo de cautelar sobre la parcela 30 del Asentamiento Neguev, ubicada en el distrito el Cairo, cantón de Siquirres, provincia de Limón, que le pertenece al Instituto de Desarrollo Rural. Informa que esta finca cuenta con el plano catastrado número L-716764-1987 y le pertenece a la finca inscrita en el Registro Nacional bajo el número de folio real número 7-50527-000 a nombre del Instituto de Desarrollo Rural. En consecuencia, el actor no es propietario del inmueble, la propiedad no le ha sido adjudicada por el INDER y no goza de permiso administrativo alguno sobre el terreno. Incluso, cualquier posesión en cualquier terreno del Instituto de Desarrollo Rural resulta precaria y por ello, no tiene ninguna relevancia cuanto tiempo ha poseído, ni cuáles actos posesorios ha realizado; tampoco es necesario dar audiencia alguna a los poseedores, pues la precariedad de la situación hace que en cualquier momento pueda ser desalojado por el Ministerio de Seguridad Pública.
Comenta que la ocupación no es la forma de adquirir la condición de asignataria o arrendataria de las tierras del INDER, sino que el mismo ordenamiento sanciona con la nulidad absoluta de cualquier acto que entre en contravención con el artículo 46 de la Ley 9036 Ley de Transformación del Instituto de Desarrollo Agrario (IDA) en el Instituto de Desarrollo Rural (INDER). Asimismo, no solo se viola el derecho de la Institución de tener y mantener una cosa de su propiedad, sino el derecho a la libre concurrencia de los posibles beneficiarios, en la participación en un determinado proyecto o programa de interés público, que podría provocar un trato desigual injustificado infractor del artículo 33 de la Constitución, infringiendo el derecho de todo posible beneficiario de acceder en igualdad de condiciones. Agrega que en cualquier momento, cualquier ocupante puede ser desalojado de las aéreas de dominio público que le pertenecen incluso al Patrimonio Natural del Estado, según lo dispone los artículos 13, 14 y 15 de la Ley Forestal, en donde los terrenos tienen las características inherentes de inalienabilidad, imprescriptibilidad e inembargabilidad en donde cualquier posesión por los particulares no causará derecho alguno, con la finalidad de proteger el recurso natural que prevalece ante el interés particular.
A su criterio, la parte no indica ni demuestra cuales son los supuestos daños o perjuicios, que le produciría la desposesión del inmueble que supuestamente fue desalojado, inmueble 7-50527-000 plano L-716764-1987, incumpliendo el principio de carga de la prueba contenido en los numerales 41 del Código Procesal Civil, de aplicación a la material por disposición del numeral 220 del Código Procesal Civil. Respecto a la Apariencia de Buen Derecho; comenta que la gestión de desahucio administrativo que nos ocupa, fue acogida al comprobarse mediante la respectiva certificación registral que el señor Gerardo Pizarro Espinoza, es el propietario de los inmuebles inscritos en el partido de Limón, Matrícula 7-38605-000, 7-31746-604 Y 7-48916-a-00A, sin que la parte actora demostrara poseer mejor derecho o algún título legal que justificara su permanencia en el inmueble, lo que se denota en la declaratoria con lugar del desalojo administrativo por parte del Ministerio de Seguridad Pública, considerando que el desalojo mismo cumplió con las dos exigencias básicas que establece nuestro ordenamiento jurídico 1- Constató que registralmente la propiedad perteneciera al promotor de la gestión, 2- Comprobó que se cumplía con el requisito de la mera tolerancia, puesto que no existía ningún contrato de arrendamiento o título precario o legal que respaldara la estancia del actor y su familia en el inmueble.
Considerando con ello que la actuación del Ministerio de Seguridad Pública esta dentro de sus competencias legítimas y fundamentada art. 45 de la Constitución Política, art. 7 inciso f) de la Ley de Arrendamientos urbanos y suburbanos, 305 del Código Civil, con lo cual considera que no resulta procedente la petición principal.
Las medidas cautelares contra la Administración Pública. 2 ed. Buenos Aires, Argentina: Ábaco, 2006). Teniendo claro lo anterior, el juzgador con observancia de lo dispuesto en el artículo 21 de la norma procesal indicado, debe determinar la procedencia de una solicitud de medida cautelar, verificando al efecto que la pretensión del proceso de conocimiento no sea temeraria o, en forma palmaria, carente de seriedad, lo que constituye una valoración preliminar del fondo para determinar si existe en el caso en cuestión lo que la doctrina y la jurisprudencia han llamado apariencia de buen derecho o fumus boni iuris. La norma de análisis también establece la procedencia de la medida cautelar cuando la ejecución o permanencia de la conducta sometida a proceso produzca graves daños o perjuicios, actuales o potenciales, situación que ha sido definida en la doctrina como el periculum en mora o peligro en la demora, es decir, que en virtud de la demora patológica del proceso judicial, concurra un peligro actual, real y objetivo de que se genere a la parte promovente un daño grave (Jinesta Lobo, Ernesto.
Manual del Proceso Contencioso-Administrativo. 1 ed. San José, Costa Rica, Editorial Jurídica Continental, 2008). Bajo la misma línea de pensamiento, el artículo 22 del Código Procesal Contencioso Administrativo, establece la obligación del juzgador de realizar, a la luz del principio de proporcionalidad, una ponderación de los intereses en juego, es decir, entre la circunstancia del particular, por un lado y el interés público y los intereses de terceros que puedan verse afectados con la adopción de la medida cautelar, por el otro. Adicionalmente y del mismo numeral 22 citado, se exige que la medida cautelar resulte instrumental y provisional. Partiendo del anterior marco normativo de análisis y los elementos requeridos para la estimación de una medida cautelar, se procede a realizar el estudio del caso concreto.- VIII) SOBRE EL CASO CONCRETO. La pretensión cautelar de la parte promovente, tiene como principal objetivo el que este Tribunal le ordene al Ministerio de Seguridad Pública ponerlo en posesión de la propiedad inscrita bajo el numero 50527- 000 plano catastrado número L-716764-1984, de la cual afirma fue desalojado junto con su familia desde el pasado veintidós de Abril del año en curso.
Asimismo se gestiona que se le ordene a los oficiales de la Fuerza Pública que se abstengan de ingresar a la propiedad, sin una orden por parte de autoridad competente. Aunado a ello se solicita que se le prevenga al señor Gerardo Pizarro Espinoza, que fue a la persona que pusieron en posición de la propiedad, de desocuparla y no perturbar tanto al actor como a algún miembro de su familia. Una vez analizado lo anterior, vemos que la pretensión de la parte actora radica en dejar sin efecto un desalojo administrativo y puesta en posesión materializado hace casi seis meses, a favor del señor Gerardo Víctor Pizarro Espinoza. Ahora bien se debe de destacar que el señor Pizarro Espinoza, dentro de su escrito de contestación a la presente gestión cautelar informó que él solicitó el desalojo administrativo, el cual lo considera legítimo conforme a su derecho sobres las finca de su propiedad registral.
Nótese que en este asunto, si bien existen dos administraciones involucradas respecto al terreno en discusión (IDA y SINAC), es importante el tener claridad, que en este tipo de procesos no es procedente analizar de forma previa quien cuenta o no con el mejor derecho que se reclama, ya que esto de ser el caso deberá ser analizado en el fondo del proceso principal ó ante la vía jurisdiccional correspondiente. Sin embargo la razón de la gestión cautelar que hoy se conoce por el fondo es distinta, ya que se cuestiona el proceder de la administración pública aquí representada en el Ministerio de Seguridad Pública. Lo cual de ser el caso, sí podría ser objeto de revisión en esta jurisdicción. Nótese que el reclamo de la parte actora radica en considerar la actuación administrativa como ilegal. Donde afirma que se han dado daños en su casa de habitación; así como daños en los cultivos agrícolas que tenía en esa propiedad.
Como se ha indicado y es de conocimiento de todas y todos, una cosa es la titularidad del inmueble o posesión del mismo y la configuración del mejor derecho que sobre este puedan reclamar las partes accionantes, y otra muy distinta el cuestionamiento al procedimiento administrativo en sí. Para este Tribunal, existe un acto administrativo cuestionado desde sus inicios por la parte actora y cuestionado en su resolución final, que para el caso en estudio no podemos dejar pasar por alto que nos encontramos analizando los presupuestos cautelares, y no lo que por el fondo pueda o no lograr la parte actora; quien deberá tener presente de lo ya analizado y determinado líneas atrás que pese a ello, se considera que la parte actora cuenta con la apariencia de buen derecho necesaria para combatir en esta sede el acta o acto administrativo por medio de la cual se ordena el desalojo de la propiedad de su interés, en el caso de que decida su interposición, y será en la causa de conocimiento donde se analicen si en realidad, el derecho del señor Abraham Jiménez Matarrita fue violentado como lo afirma, situación de fondo que en esta sumaria revisión se constatan que son alegaciones que son propias del proceso principal; como lo sería una posible declaratoria de nulidad del proceso administrativo, situación que tiene relación con lo que se analizó en aquella sede y ha sido objeto de cuestionamientos por parte del gestionante en este asunto, lo cual como ya se adelantó, sí resulta objeto de revisión ante este Tribunal.
(En respaldo de lo anterior, ver resolución 000649-C-S1-2021 de la Sala Primera de la Corte Suprema de Justicia, dictada a las 14:15h del 18/03/2021). En los términos citados téngase por superado el elemento de Apariencia de Buen Derecho. Con relación al Peligro en la Demora: Es de destacar que la parte actora la única prueba que hizo llegar al proceso tiene relación directa con los acontecimientos administrativos que cuestiona; así como en gestionar la remisión del expediente administrativo para la resolución final de esta gestión cautelar; prueba que no vendría a respaldar el daño y menos aún la magnitud del mismo que podría experimentar, o más bien estar experimentando con un desalojo administrativo materializado en su contra desde el pasado veintidós de Abril del año en curso (ver hecho "SEGUNDO" de esta gestión cautelar). Como se ha evidenciado, la prueba aportada tiene relación con el tramite del procedimiento administrativo, la cual será de mucha utilidad en la causa principal en el caso de que decida su interposición en esta sede; sin embargo, la misma no tiene la particularidad de demostrar el daño, y menos aún la magnitud del mismo; que recordando para ser tutelado por medio de este tipo de procesos, el daño no solamente deberá estar presente; sino que este deberá alcanzar una magnitud de gravedad para ser tutelado por medio de este tipo de gestiones; y esa gravedad obviamente solo se podría establecer, si la parte que acude a este tipo de gestiones la respalda en la prueba pertinente, contundente y necesaria para tal fin y es precisamente la que no consta en autos.
No ha aportado ninguna prueba que demuestre la imposibilidad material o económica de trasladarse a otro lugar, con un familiar, alquilar otro lugar, a la espera de las resultas del proceso que corresponda interponer. Este Tribunal podría pensar que el daño con la ejecución de desalojo se da, por el simple hecho de tener que abandonar la vivienda que habita, pero evidenciar la magnitud del daño, es algo que no podría determinar este Tribunal a falta de prueba en ese sentido. Nótese que el gestionante es conciente que el daño en este tipo de procesos debe de ser demostrado. Veamos que indicó en el apartado denominado como "2.-Periculum In mora.",: (...) Este presupuesto ha sido flexibilizado en la nueva legislación procesal contenciosa administrativa. Antes, la medida cautelar solo se otorgaba si había daños de difícil o imposible reparación y había que probarlos. Ahora lo que se debe demostrar es una gravedad, es decir un nivel intermedio, pues los daños pueden ser graves, actuales o potenciales.
De daños graves en adelante se dan medidas cautelares por el peligro en la demora, lo que no ocurre con el caso de daños y perjuicios leves. Para ello es necesario acreditar un juicio de probabilidad de los daños y perjuicios actuales o potenciales que la ejecución de los efectos de los actos está causando, (...)". (La negrita y subrayado es nuestro). Pese a ese conocimiento, en este caso se ha evidenciado una total falta de demostración del daño y con ello obviamente su magnitud; que si bien puede resultar entendible que el desalojo puede provocar un daño, pero la magnitud del mismo solo la puede demostrar quien pretende que se acoja su gestión y jamás se podría pensar que la autoridad jurisdiccional en este tipo de casos debe de admitir la gestión únicamente con el dicho de la parte, ya que esto no solo contraviene la normativa que regula el tema (artículo 41 del Código Procesal Civil de aplicación a la materia por emisión del 220 del Código Procesal Contencioso Administrativo), sino que crea un desequilibrio procesal a favor de la parte gestionante que se encuentra en la obligación de probar su dicho.
En este caso el actor informó que es una persona soltera y que vive en unión libre. También ha asegurado que la propiedad en la que se practicó el desalojo que cuestiona, la habitaba junto con su familia y la misma le sirve para su sustento y alimento familiar. Más adelante y propiamente dentro de sus pretensiones, vemos que en la pretensión identificada como número "3." señaló lo siguiente: "(...) Que se le prevenga al señor GERARDO PIZARRO ESPINOZA, que fue la persona que pusieron en posesión de la propiedad de desocupar la propiedad, y no perturbar tanto al suscrito (sic) como alguno (sic) miembro de mi (sic) familia.(...)". (la negrita y subrayado es nuestro). Nótese que el actor a lo largo de todo su escrito cautelar, hace mención a su familia (miembros de su familia), a la preocupación de no poder velar por su familia, al asegurar que en ese lugar vivía con su familia, y que la misma le sirve para el sustento de su familia.
Ahora bien, totalmente tiene entendido este Tribunal de la preocupación que pueda generar en cualquier persona el tener que desalojar su casa de habitación, o la propiedad donde habitaba con su familia; más aun, si de la propiedad cultivaba los alimentos que le serían para el sustento de su hogar, de eso se tiene total claridad. Sin mbargo, de lo que no se tiene claridad es, a cual familia se refiere el gestionante. Y es que este Tribunal solo tiene dos informaciones referente al actor, que es soltero y que vive en unión libre, pero se desconoce por completo si como parte de la familia que cita que dependen de él, tiene hijos o hijas, y de ser el caso, debió acreditarlo con la prueba necesaria para tal efecto -una certificación de nacimiento habría bastado para tal comprobación- ya que con ella no solo se podría verificar ese parentesco, sino también sus edades, con el fin de establecer al menos esa dependencia económica y de manutención que asegura el actor se da fruto de la propiedad que habitaba.
Ahora, si cuando hablaba o cita a su familia únicamente se refería a la persona con la que habita en unión libre, debió acreditar que ella también depende económicamente de usted; con el fin de descartar que ella no sea una fuente importante de ingresos en su hogar, con la cual no permitiría poner en peligro la manutención de su familia, a la espera de las resultas del proceso principal. En esas condiciones como se ha indicado, el daño se da por el simple hecho de tener que desalojar la vivienda y propiedad que habitaba, pero deberá comprender el señor Jiménez Matarrita, que este Tribunal no lo conoce y por tal motivo se encuentra en la obligación de demostrar el daño y la magnitud del mismo, y eso solo se logra con la prueba que lo respalde, y era su obligación conforme lo dispone el numeral 41.1.1 del Código Procesal Civil, aplicado a la materia por remisión del 220 del Código Procesal Contencioso Administrativo.
Si en realidad es la única propiedad con la que cuenta su persona y su familia como lo afirma, debió aportar la prueba necesaria en respaldo de ello, porque de los autos se evidencia que indicó -más no probó- que no tiene donde vivir, pero el tiempo ha pasado y desconoce este Tribunal cual es su situación actual y la de su familia. A propósito de la materialización de la ejecución del desalojo administrativo, que como bien se ha acreditado en autos, se dio desde el pasado veintidós de Abril del año en curso, con lo cual no solo se estaría ante una evidente falta de interés actual en suspender la ejecución de una actuación administrativa materializada, pero mas que ello, que consecuencias adversas ha generado en el actor y en su familia el no contar con esa propiedad. Pudo o no seguir realizando su trabajo. Ha podido seguir satisfaciendo las necesidades propias y las de su familia. De eso no existe prueba aportada en autos, como para que ahora por el fondo este Tribunal se vea en la obligación de admitir o más bien revertir el rechazo provisionalísimo que se realizó desde el mismo día en que ingresó esta gestión cautelar, conforme lo establece el numeral 29 inciso 2) del Código Procesal Contencioso Administrativo, lo que evidencia que el daño en este caso no fue ni ha sido de tal gravedad como para pretender que se acceda a esta gestión cautelar solo con el dicho de la parte actora, en clara controversia con el numeral 41 del Código Procesal Civil.
Siendo así no se puede tener por superado el elemento analizado, y por tal motivo la medida cautelar debe de ser rechazada, ya que para la procedencia de la misma deberán estar todos los presupuestos o requisitos presentes, ya que a falta de uno de ellos la consecuencia es su rechazo, como en efecto se dispone. Con relación a la Ponderación de Intereses en Juego y a la posible afectación al Interés Público y de Terceros Interesados; considera este Juzgador que al no verse demostrado la existencia de un daño grave, no puede más que concluirse que el interés particular debe de ceder ante el interés público que representa la necesidad de que las actuaciones de las entidades públicas y de los particulares se adecuen a los parámetros de seguridad jurídica y de legalidad que dispone el ordenamiento; lo anterior independientemente de lo que por el fondo en el proceso respectivo se disponga. Este Tribunal no puede desconocer las competencias conferidas a las distintas administraciones; en este caso representada por el Ministerio de Seguridad Pública; sin embargo tampoco puede desconocer que por medio de una gestión cautelar resultaría inoportuno, improcedente y prematuro referirse a la procedencia o no de lo que se gestiona y la forma en que debe de actuar la administración en este tipo de diligencias administrativas, determinándose con ello que hasta tanto no se disponga otra cosa en el proceso de conocimiento, la prudencia se inclina por no tener por superado el presupuesto analizado, ya que en el caso particular bajo estudio, existe una total falta de prueba necesaria que permita dimensionar el daño que podría experimentar o estar experimentando el aquí actor con la determinación administrativa que le es adversa a sus intereses, y en esas circunstancias no se puede dimensionar ese daño o afectación como para poder ponderar cual daño o situación debe de ser tutelada, resultando en esas condiciones indudable que ha de prevalecer el interés público sobre el particular.
Aunado a ello, resulta ser que el elemento o requisito en estudio fue estructurado o dividido, donde no solo se analiza la ponderación de intereses en juego y la afectación al interés público; sino y además de ello, la posible afectación a terceros interesados, y es en este punto que el suscrito se debe de detener y ser cauto en el análisis de la situación. En este asunto se ha discutido y cuestionado por parte del aquí actor, la forma en que fue realizado el procedimiento administrativo de desalojo y la forma en que se pone en posesión a otra persona que según él afirma no tiene derecho de estar en la propiedad del Instituto de Desarrollo Rural; hablamos del señor Gerardo Pizarro Espinoza. Recordando el señor Pizarro Espinoza fue la persona que interpuso el procedimiento administrativo de desalojo el cual fue declarado a su favor, y hoy día goza de una posesión concedida en sede administrativa, que si bien la misma está siendo discutida a través de esta gestión cautelar y la posible demanda principal, fue a él a quien la administración lo puso en posesión y hoy día, como lo ha indicado el propio actor es la persona que habita el lugar.
En este caso se ha establecido desde el mismo día en que ingresó la presente gestión cautelar, que para la hora de interponerla ya se había materializado el desalojo, resultando evidente que dentro de las pretensiones formuladas por el gestionantes, se encuentra el ordenar la puesta en posesión de aquella propiedad de la que fue desalojado desde el día veintidós de Abril del año en curso, pero acude a esta vía hasta el día treinta de abril, sea esto ocho días después en que la administración lo desalojó y puso en posesión al señor Pizarro Espinoza, que pese a que se está cuestionando el procedimiento administrativo por medio del cual él asume la posesión, estamos ante una situación que debe de ser tutelada por este Tribunal, y de ahí que se haya integrado al proceso para que pudiera tener ese debido proceso jurisdiccional y una participación dentro del mismo. El cuestionamiento al procedimiento administrativo que hace el aquí actor, es un asunto totalmente revisable en esta Jurisdicción como se indicó a la hora de analizar el presupuesto de apariencia de buen derecho, pero es un asunto que se deberá discutir en el proceso de conocimiento, y resultaría contrario a derecho que por medio de esta medida cautelar, se deje sin esa propiedad al señor Pizarro Espinoza.
Si se quiere tutelar o minimizar una posible afectación a terceras personas como lo establece el presupuesto o elemento analizado, estima el suscrito procedente y conveniente no tener por superado este presupuesto y en consecuencia la medida cautelar debe de ser rechazada. La balanza en esta ocasión se inclina por tutelar los derechos de la administración pública aquí representada, como también del señor Gerardo Pizarro Espinoza que como se indicó, es la persona que desde el veintidós de Abril del año en curso la administración le dio la posesión del inmueble, y si la parte actora decide interponer el proceso de conocimiento, es ahí donde se discutirá cual de las posturas es la correcta. Siendo así, se rechaza la medida cautelar gestionada por el señor Abraham Jiménez Matarrita.- IX) COSTAS: En este asunto la representación del Instituto de Desarrollo Rural (IDA), dentro de su pretensión gestionó la condenatoria en costas a cargo del señor Abraham Jiménez Matarrita; sin embargo a consideración del suscrito que en la forma que acontecieron los hechos en sede administrativa, le dio la oportunidad a la parte actora de acudir a esta sede jurisdiccional, con el fin de defender sus derechos e intereses.
Nótese que por medio de una gestión cautelar, no es procedente analizar el fondo del asunto y por consiguiente si la parte que gestiona lleva no no lleva razón, es algo que solo se podrá determinar en la causa principal en el caso de que decida su interposición. Sin embargo y pese a ello, no se pude perder de vista que la razón de rechazo de esta gestión cautelar ha obedecido a una situación distinta; pero dentro de la revisión y análisis de los presupuestos cautelares se determino, que cuenta con la apariencia necesaria de acudir a este vía en resguardo de sus intereses y derechos y de ahí que se tuviera por superado el presupuesto de Apariencia de Buen Derecho, lo que determina que tuvo motivos suficientes para apersonarse a este vía. Aunado a ello, en tema de costas en este tipo de gestiones, existen varios pronunciamientos del Tribunal de Apelaciones de lo Contencioso Administrativo, que hasta tanto no se tenga una dirección en un sentido distinto, este Tribunal considera que se debe de emitir el anterior pronunciamiento sin condenatoria en costas, precisamente por el tipo de procesos.
(ver entre otras la RESOLUCIÓN 009-TA-11, 010-TA-11. SENTENCIA Nº 90 -2011 bis TRIBUNAL DE APELACIONES DE LO CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA. Anexo A del Segundo Circuito Judicial de San José, Calle Blancos, a las trece horas treinta minutos del dieciséis de marzo de dos mil once). Siendo así, se resuelve este asunto sin especial condenatoria en costas.- X) RESPECTO A LAS EXCEPCIONES PLANTEADAS EN ESTE TIPO DE ASUNTOS: Solo a manera de emitir pronunciamiento en cuanto las excepciones planteada en este tipo de gestiones, este Tribunal se permite en indicar lo ya reiterado por parte del Tribunal de Apelaciones en cuanto a la interposición de excepciones en este tipo de gestiones; por lo que se remite a las partes a lo dictaminado por el Tribunal de Apelaciones propiamente la Sección Segunda del Tribunal de Apelaciones de lo Contencioso Administrativo que ha avanzo en este tema, considerando a lo que resulta de interés para esta disposición lo siguiente: "(...) Desde un punto de vista técnico no le es posible oponer excepciones, como resulta viable en los procesos de conocimiento, salvo claro está, lo correspondiente a la competencia (que debe ser conocida de previo y especial pronunciamiento en tanto suspende la competencia para seguir conociendo el expediente, salvo ésa gestión propiamente dicha), lo correspondiente a la capacidad y los requisitos formales (estos últimos se conocería al momento de resolver por el fondo la solicitud) o lo correspondiente a integración de la litis.
En esos términos, cualquier excepción o defensa que se presente no tiene razón de ser, pero en caso de ser interpuesta, deberá ser reservada para ser conocida con el fondo de la medida cautelar y no de manera interlocutoria. La resolución interlocutoria dentro de este tipo de procesos no resulta procedente, pues permitiría convertir una gestión sumaria en un proceso ordinario, desnaturalizando su esencia.(...)". (la negrita y subrayado es nuestro). (ver resolución N° 314-2020-II TRIBUNAL DE APELACIONES DE LO CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA DEL SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ, SECCIÓN SEGUNDA, de las siete horas y treinta minutos del once de junio de dos mil veinte.). Coincide este Juzgador con lo dispuesto por el Tribunal de Apelaciones en cuanto a la interposición de las excepciones en este tipo de procesos, donde en realidad las partes requieren de una resolución pronta que venga a resolver el tema puesto a conocimiento; que pese a que en este caso se debió integrar al proceso a aquellas personas o Instituciones que podrían verse afectados en su derecho e intereses, esto se debió precisamente a la pretensión formulada por medio de esta gestión, que involucraba de lleno la intervención de las partes integradas a este proceso y de ahí que se determinó su participación.
Ahora respecto a las demás excepciones como por ejemplo cosa juzgada o la falta de legitimación, es un tema que deberá quedar reservado para el análisis de la causa principal; siendo esto algo que en su oportunidad deberá tomar en consideración la parte actora si decide ventilar la causa principal ante esta jurisdicción.- XI) RESOLUCIÓN DEL CASO: Por ende, al no concurrir en su totalidad los presupuestos legales necesarios, se debe de declarar sin lugar la medida cautelar solicitada en los términos que fue planteada. Se deberá tomar en consideración que tanto el presupuesto de apariencia de buen derecho como la ponderación de intereses en Juego son de análisis, comprobación y estudio por parte del Juez para verificar su cumplimiento y determinar si la demanda puede o no ser conocida en un proceso de conocimiento ante esta Jurisdicción (apariencia de buen derecho), y si la determinación que se toma afecta o no el interés público o de terceros interesados (ponderación de intereses en Juego); pero uno de los presupuestos o requisitos para la procedencia de la medida cautelar se encuentra en manos de quien acude a este tipo de procesos (PELIGRO EN LA DEMORA), ya que la demostración del daño, es inherente a la persona que lo sufre y será quien deberá probar su dicho con prueba pertinente y conducente a tal fin (artículo 41 del Código Procesal Civil), y es precisamente el presupuesto que no fue amparado y respaldado como era el deber y obligación de la parte actora, no teniendo este Tribunal el porque suplir las omisiones apuntadas en el apartado correspondiente.
En consecuencia lógica de esta disposición se rechaza la medida cautelar, gestionada por el señor ABRAHAM JIMÉNEZ MATARRITA en contra del ESTADO (Ministerio de Seguridad Pública ), INSTITUTO DE DESARROLLO RURAL (INDER), SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN (SINAC), GERARDO PIZARRO ESPINOZA y ERVIN ADOLFO ÁLVAREZ FUENTES. Se resuelve este asunto sin condenatoria en costas. En su oportunidad archívese el expediente.-
POR TANTO
Se declara SIN LUGAR la medida cautelar anticipada solicitada por el señor ABRAHAM JIMÉNEZ MATARRITA en contra del ESTADO (Ministerio de Seguridad Pública ), INSTITUTO DE DESARROLLO RURAL (INDER), SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN (SINAC), GERARDO PIZARRO ESPINOZA y ERVIN ADOLFO ÁLVAREZ FUENTES. Se resuelve este asunto sin condenatoria en costas. En su oportunidad archívese el expediente. NOTIFÍQUESE. Lic. Rodrigo Huertas Durán.
