The defendant filed a counterclaim (reconvención) against the aforementioned plaintiffs and RONALD ALBERTO WONG QUESADA, of legal age, single, businessperson, identification card six- three hundred twenty- zero eighty-eight. Attorney Ricardo González Mora, identification card one - six hundred eight - seven hundred ninety-six, bar membership number three thousand four hundred forty-nine, acts as special judicial attorney-in-fact (apoderado especial judicial) for the plaintiff; and attorney Alonso Gallardo Solís, bar membership number eighteen thousand seventy-seven, acts as counsel of record (abogado director) for the defendant.

The proceeding was conducted before the Juzgado Agrario del Segundo Circuito Judicial de Alajuela, San Carlos. Attorney Ronald Wong Li serves as counsel of record for counterclaim defendant Wong Quesada. This Tribunal reviews the ruling issued at eleven hours and one minute on the fifth of August, two thousand twenty-one.

Drafted by Judge Díaz Bolaños; and,

WHEREAS:

I.The ruling issued at 11 hours 01 minute on 05 August 2021, available in PDF format on the virtual desktop of the Juzgado Agrario de San Carlos, is appealed. In that decision, counterclaimant-defendant Carlos Emilio Fonseca Gutiérrez was ordered to amend the complaint to include Greivin, Grace, and Mauren, all surnamed Rodríguez Agüero, subject to the warning that the proceeding would be terminated with respect to the counterclaim. The hearing for final arguments (audiencia del alegato de buena prueba) was vacated. The appeal is signed by Alonzo Gallardo Solís in his capacity as counsel of record for Carlos Fonseca Gutiérrez. He argues that joinder of the parties (integración de la litis) should have occurred at an earlier stage and that the proceeding should not have been allowed to advance until it was ready for a first-instance judgment. This situation requires the annulment of all subsequent procedural acts performed after the issues in the counterclaim were joined.

He argues that the matter is precluded (precluido) and that the ruling lacks legal grounds and reasoning, as it fails to state the reasons for adopting such a “drastic” decision, thereby creating legal uncertainty and preventing them from contesting the ruling because it lacks a basis. He insists that the decision is null and void. He also lists acts and rulings contained in the case file. In the decision of 12 June 2019, the Rodríguez Agüero individuals—whom the court has ordered joined as parties—were recognized as interested third parties (terceros interesados), and service of process (notificación) was ordered. Service could not be completed, and an address was ordered to be provided for that purpose. On 05 July, the complaint was answered and a counterclaim was filed, consideration of which was deferred until the third parties had been served. An address for notifying them of the proceeding was ordered to be provided; at the same time, the complaint was deemed answered and the defenses (excepciones) raised, while the counterclaim was deferred until after the judicial inspection (reconocimiento judicial), all by ruling of 20 April 2020.

Furthermore, on 15 June 2020, his client was ordered to amend the counterclaim to include Ronald Wong because he was a member of the de facto partnership (sociedad de hecho), and Wong answered the action. In the ruling of 19 June, the counterclaim was served on the counterclaim defendants and the aforementioned Ronald Wong. An answer was filed on 06 July 2020. In the decision of 09 July, the counterclaim was deemed answered, and the defenses of lack of a legal right (falta de derecho), lack of standing as defendant (legitimación pasiva), and failure to join a necessary party (litis consorcio necesario incompleto) were deemed raised. In the final interlocutory order (autosentencia firme) of 24 September 2020, the last preliminary defense (excepción previa) was rejected because it was found unnecessary to join any other person and because Ronald Wong had already been joined in the litigation.

In the ruling of 03 November 2020, service on the aforementioned third parties was dispensed with because they were no longer creditors. Based on this summary, he asserts that the interlocutory order deciding the defense of failure to join a necessary party is pivotal because it states that joinder was already complete; it became final and, under the principles of legal certainty, res judicata (cosa juzgada), and legality, it cannot be modified. In his view, that decision takes precedence over the appealed order. He considers this situation grounds for nullity. He adds that the ruling of 03 November established that the Rodríguez Agüero third parties were no longer listed as creditors of the property. Accordingly, when the counterclaim was filed, they were listed as creditors. They now have no interest in the proceeding because the debt was paid, and they are in no way affected by its outcome.

He states that an analysis of the claims for relief and allegations in the counterclaim shows that the third parties did not participate in any of the contracts connected with the relief sought, namely, the de facto partnership agreement and the environmental impact study (estudio de impacto ambiental). The counterclaimant-defendant has had no relationship with them; only the counterclaim defendants have, as shown by the allegations and evidence demonstrating that they paid the debt and executed an assignment of the debt (cesión del crédito). His client neither participated in nor influenced those acts because they are unrelated to the relationship between the counterclaim defendants and his client. Lastly, he argues that, regarding the claims related to the mortgage entry (asiento hipotecario) on the property at issue, the current creditors are the counterclaim defendants, and the claim is therefore directed against them. He requests that the ruling be annulled and that the proceeding be ordered to continue (boxes 435 to 438).

II.The asserted nullity must be rejected. As to the alleged lack of legal grounds in the ruling, it does state, albeit briefly, the reasons why the lower court (órgano a quo) ordered joinder of the parties. In that regard, it stated: “As can be inferred from claims 6, 7 and 8 of the counterclaim filed on 05-07-19 20:32:45, and pursuant to article 22.1 of the Código Procesal Civil, which applies supplementally in this matter, counterclaimant-defendant Carlos Emilio Fonseca Gutiérrez is hereby ordered, within FIVE DAYS and in compliance with the legal formalities, to amend his complaint to include GREIVIN, GRACE, and MAUREEN RODRÍGUEZ AGÜERO, subject to the warning that the proceeding will be terminated with respect to the counterclaim…” (image 431). The passage explains that joinder was ordered based on claims 6 through 8 of the counterclaim; it also provides the legal basis. The right of defense may therefore be exercised because the decision contains the minimum elements required for that purpose.

The other ground is the appellant’s contention that the issue is precluded and subject to res judicata. Regarding the first point, the debate cannot be deemed concluded because, for preclusion to apply, the matter must be free of defects or flaws. In other words, although the interlocutory ruling issued at 10 hours 06 minutes on 24 September 2020 rejected the defense of failure to join a necessary defendant (litis consorcio necesario pasivo), it focused solely on Ronald Wong’s participation, which was expressly analyzed as follows: “THIRD: The first point to be made is that the plaintiff offered no evidence pursuant to article 45 of the Ley de Jurisdicción Agraria to support the defense raised, which would warrant its rejection; however, an analysis of the counterclaim shows that the counterclaim defendants are advised that the person they claim is absent from the proceeding, Mr. RONALD ALBERTO WONG QUESADA, has already been brought into the proceeding as a defendant; note that he has already answered the complaint against him, and therefore the defense raised is rejected” (emphasis in the original, image 364).

The ruling is unequivocal that only Ronald Wong’s participation was analyzed. This Chamber considers that the entire joinder of the parties should ideally have been reviewed without postponing it until judgment was rendered, since the proceeding had reached the final-arguments hearing stage (box 422), in the interest of procedural economy (economía procesal) and prompt justice. The ruling under review cannot foreclose debate regarding joinder of the parties because section 23 of the Ley de Jurisdicción Agraria imposes the duty to review procedural prerequisites (presupuestos procesales) sua sponte (de oficio). Therefore, although what occurred is not desirable, there is no procedural reason preventing the adjudicator from reviewing joinder of the parties, even at the current procedural stage of the matter.

III.Regarding the challenge on the merits, the appellant argues that the aforementioned creditors have no connection whatsoever with the relief sought. In this matter, broadly speaking, the existence of a de facto partnership agreement (contrato de sociedad de hecho) and another agreement to investigate possible environmental damage (daño ambiental) was described. The appellant alleged that the counterclaim defendants (actores reconvenidos), who retained possession, had breached the agreements. Furthermore, a mortgage (hipoteca) was created over the property where the agreement would be performed, and the counterclaimant defendant (demandado reconventor) appears as the debtor. The counterclaim pleading explains that the agreement provided that the balance owed to one of the creditors would be paid “solely and exclusively by this de facto partnership from the proceeds generated through the recovery of valuable waste from the property...” (frame 153).

Specifically, the sixth allegation of the counterclaim stated: “that the mortgage cited in the preceding paragraph was assigned to the counterclaim defendants herein by deed executed at 16:30 (sic) on 12 de abril de 2019 before notary GERALDINE MARIN VILLEGAS” (emphasis in the text of image 154). Furthermore, a subsection entitled “ON THE NULLITY OF SUBROGATION” states as follows: “The counterclaim defendants allege that they, as we have already seen and analyzed, unilaterally and contrary to the terms of the agreement, claim to have been subrogated to the right to collect the first-priority mortgage and, for that reason, executed or entered into the aforementioned credit-assignment agreement; however, the payment receipts issued by the original creditors show that the payments were made on 07 de abril de 2019, while the deed assigning the mortgage is dated 12 de abril de 2019, meaning that there is a difference of 5 days between the two acts...

Accordingly, the purported subrogation (subrogación) is null and void pursuant to that provision; the subrogation and payment were not performed simultaneously, nor is this reflected in the payment acknowledgment, and it must therefore be so declared” (frame 162). As a corollary to the foregoing, the claims concerning this alleged breach relating to the mortgage state: “...6) I further request that the assignment of the first-priority mortgage be declared (sic) null and void for the reasons stated, and 7) that the subrogation of that credit be declared inadmissible; 8) I further request that lawful possession of the property be restored to me, as I am the registered and actual owner of the property at issue in these proceedings; 9)...” (image 164). Based on the foregoing account, this Chamber agrees that the persons identified in the agreement shown in image 94 must be joined in the proceedings.

Grace, Maureen, and Greivin, all surnamed Rodríguez Agüero, and the counterclaim defendants appear therein. Under that document, the mortgage was paid, and it stated: “...expresses the unequivocal intent to subrogate the rights and causes of action relating to said mortgage loan in favor of...” (image 96); accordingly, the parties to that agreement must be joined in the litigation. Compulsory joinder (litis consorcio necesaria) is required when there are multiple parties and “...there is only one substantive legal relationship and only one cause of action; however, because the substantive legal relationship is a single one involving several persons, such that any modifications thereto, to be effective, must operate jointly with respect to all of them, the law requires that all persons subject to that relationship necessarily be summoned to the proceedings in which that single relationship is to be adjudicated, so that the decision will be binding upon all of them” (Calamandrei, Piero.

Derecho Procesal Civil, Volume II, p. 210). If this procedural requirement is not met, the judgment could not produce the effects attributed to it by law, because it would directly affect persons who were not parties to the proceedings. On this issue, the Sala Primera de la Corte Suprema de Justicia has held as follows: “Compulsory joinder, whether passive or active, entails the mandatory participation in the proceedings of all persons who might be affected by the requested ruling. It is evident that, in determining who those persons should be, a careful analysis of the prayers for relief must first be undertaken in order to ascertain from their terms whether the case can be decided with the persons already participating in the proceedings or whether others must be included” (voto 149 de 6 de noviembre de 1992. See also, to the same effect, 72 de 3 de setiembre de 1982). Specifically in its passive form, it applies when the claim is not brought against all persons against whom it may properly be asserted or whom the plaintiff’s claim may directly affect.

To protect their right of defense and give effect to the judgment entered in the proceedings, their proper joinder is ordered. Accordingly, pursuant to section 22.1 of the Código Procesal Civil, which applies supplementally to this subject matter, the appealed decision shall be affirmed.

IV.Pursuant to the authority granted by Article 589 of the Código de Trabajo, as applicable to this subject matter, the following observation must be made regarding the participation of attorney Alonzo Gallardo Solís, given that no special power of attorney (poder especial) in his favor appears in the record. Section 20.2 of the Código Procesal Civil provides, with respect to lead or substitute counsel, insofar as relevant, that the signature of the attorney authenticating the filing shall imply, unless expressly stated otherwise, representation in the proceedings with authority to act on behalf of the party in all matters beneficial to that party, provided that no special judicial power of attorney (poder especial judicial) or personal participation by the party is required. The scope of this provision was recently analyzed by the Tribunal, which stated, insofar as relevant: “III.- The appellant is correct in asserting this ground of appeal.

On other occasions, this Tribunal has addressed the procedural reform introduced by Article 20.2 of the Código Procesal Civil in relation to the informality principle (principio de informalidad) governing proceedings under the Ley de Jurisdicción Agraria, so as to facilitate access to justice and the right of defense, in the following terms: ‘In this regard, in light of the ruling concerning that situation issued on 1 de diciembre del 2020, it is clarified that the rule contained in the civil procedural reform, effective since octubre del 2018, which authorizes attorneys to act on behalf of their clients in all matters not requiring the clients’ personal participation or a power of attorney, even if the attorneys lack a special judicial power of attorney (section 20.2 Código Procesal Civil, applied supplementally), applies to agrarian proceedings because it is consistent with their principles of informality and expeditiousness.

Tribunal Agrario No. 238-F-21, de las 11:14 horas del 17 de marzo del 2021.’ In the present case, counsel for the plaintiffs specifically appeals the denial of admissibility because he considers that the denial of the appeal filed against ruling 2021-114 was unlawful, as he was representing the plaintiffs’ interests. Accordingly, this Tribunal considers the provisions of Article 10.2 (sic) of the Código Procesal Civil applicable with respect to standing to appeal: ‘The signature of the attorney authenticating the filing shall imply, unless expressly stated otherwise, representation in the proceedings with authority to act on behalf of the party in all matters beneficial to that party, provided that no special judicial power of attorney or personal participation by the party is required. The authenticating attorney shall be responsible for the content of the filings.’ Three key aspects that must be considered clearly follow from this provision: a) The signature of the authenticating attorney implies representation in the proceedings; b) Counsel of record has authority to act on behalf of the party in matters beneficial to that party; and c) That same counsel is responsible for the content of the filings.

This Tribunal is surprised by such a formalistic interpretation by the court below, when this possibility—rooted in constitutional case law—had already been recognized for the agrarian public defense service, which, upon assuming representation in a proceeding, may file motions and take action in the interests of the party it represents, as has also been reiterated in the case law of this Tribunal Agrario (sic). ... Thus, the ruling is not only contrary to the provision authorizing counsel to appeal in the interests and defense of the represented party, but also contrary to the principles of informality governing agrarian proceedings. Contrary to the trial judge’s statement, the Código Procesal Civil, in this area of representation, is consistent with modern procedural trends, including those in civil proceedings, aimed at facilitating access to justice and the proper exercise of the right of defense without imposing strict procedural formalities when they are unnecessary and costly for the parties to the litigation.” From the foregoing analysis, this Chamber understands that counsel may act without a power of attorney; nevertheless, the special provision of the Ley de Jurisdicción Agraria requiring persons represented by private counsel to do so through a special judicial power of attorney or any other form of authority suitable for participation in proceedings cannot be disregarded.

Furthermore, it is considered that the cited provision of the Código Procesal Civil does not provide an unrestricted exemption from filing a special judicial power of attorney. On this point, applying the principles of proportionality and reasonableness, substantive filings or filings materially affecting the merits must be established as limits on the failure to submit such authority. In this matter, the appeal is entertained because, in this filing, counsel appears as a “special judicial attorney-in-fact” even though he is not one, since, as stated, no authority appears in the record; rather, unlike in other pleadings, he does not state that his authority is “solely for this act,” as he did in the answer to the complaint, the counterclaim, and other filings (images 152, 167, and 309). Accordingly, this situation must be taken into consideration in future filings.

POR TANTO:

As to the matters appealed, the ruling issued at eleven hours and one minute on cinco de agosto de dos mil veintiuno is affirmed.

PROCESO ORDINARIO incoado por DOBLE A NOVENTA Y CINCO SOCIEDAD ANÓNIMA, cédula jurídica tres - ciento uno - ciento setenta y tres mil setecientos veinticuatro, representada por su apoderado generalísimo sin límite de suma y a título personal el señor ÁLVARO ARAYA CARVAJAL, mayor, viudo, comerciante, vecino de Purral, cédula de identidad número uno - quinientos veintitrés - ochocientos setenta y ocho; DIEGO ALFARO SÁNCHEZ, mayor, soltero, coligallero, cédula de identidad número dos - seiscientos setenta y tres - setecientos cincuenta y seis; y RODOLFO SEGNINI SABAT, mayor, abogado, vecino de San José, cédula de identidad número uno - mil ciento veintiséis - novecientos diecinueve; contra CARLOS EMILIO FONSECA GUTIÉRREZ, mayor, casado, empresario, cédula de identidad número uno - quinientos cuarenta y nueve - doscientos cuarenta. Intervienen como partes interesadas Greivin Rodríguez Agüero, cédula de identidad número dos – quinientos veinticuatro - novecientos noventa y cuatro; Maureen Rodríguez Agüero, cédula de identidad número dos - quinientos cuarenta - setecientos sesenta y seis; y Grace Rodríguez Agüero, cédula de identidad número dos - seiscientos trece - novecientos setenta; en su condición de acreedores.

El demandado reconvino a los citados actores y a RONALD ALBERTO WONG QUESADA, mayor, soltero, empresario, cédula seis- trescientos veinte- cero ochenta y ocho. Actúa como apoderado especial judicial de la parte actora, el licenciado Ricardo González Mora, cédula de identidad uno - seiscientos ocho - setecientos noventa y seis, colegiado tres mil cuatrocientos cuarenta y nueve; y como abogado director de la parte demandada, el letrado Alonso Gallardo Solís, colegiado dieciocho mil setenta y siete. Tramitado ante el Juzgado Agrario del Segundo Circuito Judicial de Alajuela, San Carlos. De reconvenido Wong Quesada, como abogado director el letrado Ronald Wong Li. Conoce este Tribunal de la resolución de las once horas uno minutos del cinco de agosto de dos mil veintiuno.

Redacta la jueza Díaz Bolaños; y,

CONSIDERANDO:

I.Se apela la resolución de las 11 horas 01 minuto del 05 de agosto de 2021 visible en el escritorio virtual del Juzgado Agrario de San Carlos, en modo PDF. En tal decisión se previno al demandado reconventor Carlos Emilio Fonseca Gutiérrez, ampliar la demanda contra Greivin, Grace y Mauren todos Rodríguez Agüero, bajo el apercibimiento de dar por terminado el proceso en cuanto a la contrademanda. Dejó sin efecto la audiencia del alegato de buena prueba. La apelación es rubricada por Alonzo Gallardo Solís en calidad de abogado director de Carlos Fonseca Gutiérrez. Aduce la integración de la litis debió de realizarse en una etapa anterior y no permitir avanzar el proceso hasta quedar listo para fallo de primera instancia. Esta situación genera se anulen todos los demás actos procesales posteriores a tenerse por trabada la litis de la reconvención. Aduce es un asunto precluido, y la resolución carece de fundamentación y motivación, sin exponer las razones por las cuales asume esa “drástica” decisión, lo cual genera inseguridad jurídica y no les permite contrarrestar esa resolución al carecer de fundamento.

Insiste la decisión es nula. Por otra parte, enlista actos y resoluciones que constan en el expediente. En decisión del 12 de junio de 2019 se tuvo a los señores Rodríguez Agüero -personas que se ordenan integrar a la litis- como terceros interesados y se ordenó la notificación. La cual no fue posible ejecutar y se previno aportar dirección para tal comunicación. El 05 de julio se contestó la demanda y se presentó reconvención, la cual fue reservada una vez se notificara a los terceros. Se previno una dirección para comunicarles el proceso, en conjunto tuvo por contestada la demanda e interpuesta las excepciones; reservó la reconvención luego del reconocimiento judicial, todo lo anterior en resolución del 20 de abril de 2020. Por otra parte, el 15 de junio de 2020, se le previno a su cliente ampliar la reconvención contra Ronald Wong por ser parte de la sociedad de hecho, persona que contestó la acción.

En resolución del 19 de junio se dio traslado a la reconvención contra los actores reconvenidos y el citado Ronald Wong. Se brindó contestación el 06 de julio de 2020. En decisión del 09 de julio se tuvo por contestada la reconvención; interpuestas las excepciones de falta de derecho, legitimación pasiva y la de litis consorcio necesario incompleto. En autosentencia firme del 24 de setiembre de 2020 se rechazó la última excepción previa porque se estimó no existía necesidad de integrar a ninguna otra persona, y que Ronald Wong ya estaba incorporado al litigio. En resolución del 03 de noviembre de 2020 se omitió la notificación de los citados terceros porque ya no eran acreedores. De tal resumen afirma, es medular el autosentencia que resolvió la excepción de litis consorcio necesario incompleto, porque en tal se indica que ya estaba completa; adquirió firmeza y por principio de seguridad jurídica, cosa juzgada y legalidad no puede ser variado.

Esa decisión a su entender tiene rango superior al auto apelado. Estima esa situación es una causal de nulidad. Suma a su argumento, en resolución del 03 de noviembre se tiene por acreditado los terceros Rodríguez Agüero no figuran como acreedores de la finca. Por tal razón, en el momento histórico que se presentó la reconvención ellos figuraban como acreedores. Ahora no tienen interés en el proceso pues el crédito fue pagado y no se ven afectados de forma alguno de las resultas del proceso. Indica, si se analizan las pretensiones y hechos de la contrademanda se desprende los terceros no participaron en ninguno de los contratos vinculados a la petitoria, sea el de la sociedad de hecho y el estudio de impacto ambiental. El demandado reconventor no ha tenido relación con ellos, únicamente los actores reconvenidos y esto se desprende de los hechos, pruebas donde demuestran que les pagaron el crédito y firmaron una cesión del crédito.

En tales actos no tuvo participación el cliente o injerencia pues son ajenos a la relación que medio entre los actores reconvenidos y su defendido. Por último aduce, las pretensiones relacionadas con el asiento hipotecario sobre la heredad en litis, los actuales acreedores son los actores reconvenidos, por eso la pretensión va dirigida a ellos. Pide se anule la resolución y se ordene continuar con los procedimientos (cuadros 435 a 438).

II.En cuanto a la nulidad invocada la misma ha de ser rechazada. Tocante a la falta de fundamentación de la resolución, la misma contiene de manera tímida los motivos por los cuales el órgano a quo ordenó la integración de la litis. Al respecto indicó: “Desprendiéndose de las pretensiones 6, 7 y 8 de la contrademanda ingresada el 05-07-19 20:32:45, y de conformidad con lo que dispone el artículo 22.1 del Código Procesal Civil de aplicación supletoria en esta materia, se previene al demandado reconventor Carlos Emilio Fonseca Gutiérrez, para que dentro del plazo de CINCO DÍAS y con las formalidades de ley, proceda a ampliar su demanda contra los señores GREIVIN, GRACE, y MAUREEN RODRÍGUEZ AGÜERO, bajo apercibimiento de dar por terminado el proceso en cuanto a la reconvención…” (imagen 431). De la lectura se explica la razón por la cual se ordenó la integración de la litis sustentado en las petitorias 6 a 8 de la reconvención; también se incluye el fundamento de derecho.

De tal forma es dable ejercer el derecho defensa pues la decisión cuenta con los elementos mínimos para tal situación. El otro motivo radica en que a criterio de quien recurre el tema está precluído y existe cosa juzgada. Relacionado con el primer punto, no es dable tener por concluído el debate, pues para estar en presencia de tal situación, el tema no debe contar con defectos o vicios. En otros términos, si de manera interlocutoria se resolvió rechazar la excepción de litis consorcio necesario pasivo según decisión de las 10 horas 06 minutos del 24 de setiembre de 2020 en esta únicamente se centró en la participación del Ronald Wong, lo cual fue analizado de manera expresa así: "TERCERO: Lo primero que se debe indicar es que la parte actora no ofrece prueba de conformidad con el artículo 45 de la Ley de Jurisdicción Agraria para fundamentar la excepción interpuesta, por lo que cabría un rechazo de la misma, pero si analizamos la contrademanda se le hace ver a los actores reconvenidos que la persona que aducen que falta en el proceso, el señor RONALD ALBERTO WONG QUESADA, ya fue traído al proceso como demandado, véase que el mismo ya procedió a dar contestación a la demanda en su contra, con lo cual se procede al rechazo de la excepción presentada" (lo destacado es del original en imagen 364).

Es diáfana la resolución en cuanto lo analizado fue únicamente la intervención de Ronald Wong. Considera esta Cámara, lo deseable era revisar la totalidad de la integración de la litis, y no diferirlo para el momento del dictado de la sentencia, pues el proceso había alcanzado la etapa de audiencia de alegato de buena prueba (cuadro 422), por un asunto de economía procesal y justicia pronta. La resolución en análisis no tiene la posibilidad de clausurar el debate de la integración de la litis, pues el numeral 23 de la Ley de Jurisdicción Agraria impone la obligación de revisar los presupuestos procesales de oficio. De tal forma, aun cuando no es deseable lo acontecido, no existe razón alguna de forma, para impedir a la persona juzgadora a revisar, incluso en la etapa procesal en que se encuentra el asunto, la integración de la litis.

III.Sobre el reproche de fondo, aduce la parte apelante los anteriores acreedores no tienen relación alguno con lo pretendido. En este asunto, grosso modo, se relató la existencia de un contrato de sociedad de hecho y otro para investigación de posible daño ambiental. Acusó el incumplimiento de los actores reconvenidos de las convenciones quienes mantenían la posesión. Por otra parte, se constituyó hipoteca sobre la finca donde se ejecutaría el acuerdo y el demandado reconventor figura como deudor. Explica en el pliego de reconvención, se estableció en el contrato el saldo a favor de uno de los acreedores será cancelado "única y exclusivamente por ésta sociedad de hecho con los recursos que se generen por la recuperación de desecho valorizable de la propiedad..." (cuadro 153). Específicamente en el hecho sexto de la contrademanda se relató: "que la hipoteca citada en el punto anterior, fue cedida a los aquí actores reconvenidos por escritura de las 16:30 (sic) del 12 de abril de 2019 autorizada ante la notaria GERALDINE MARIN VILLEGAS" (lo destacado corresponde al texto de imagen 154).

Por otra parte, se elenca un acápite titulado "DE LA NULIDAD DE LA SUBROGACION" donde se explicó lo siguiente: "Alegan los actores reconvenidos que ellos, como ya vimos y analizamos, de forma unilateral, contrario a lo pactado en el contrato, indican haberse subrogado el derecho de cobrar la hipoteca de primer grado y por ello efectuaron o suscribieron el contrato de cesión del crédito ya antes indicado, sin embargo de los recibos de pago de los acreedores originales, se observa que los mismo se realizaron el 07 de abril de 2019 y la escritura de cesión de la hipoteca es de fecha 12 de abril de 2019, sea que existe una diferencia de 5 días entre ambos actos… Por lo anterior, la supuesta subrogación es nula de conformidad con dicha norma, la subrogación y pago no se efectuaron en forma simultánea ni consta en la carta de pago, por tanto así se debe declarar” (cuadro 162). Corolario de lo anterior en las pretensiones tocante a este alegado incumplimiento relativo a la hipoteca se expresa: “…6) además solicito se declare (sic) anular la cesión de la hipoteca de primer grado por los motivos expuestos y 7) se declare improcedente la subrogación de dicho crédito, 8) además solicito se me restituya la posesión legítima de la finca como propietario registral y real que soy de la finca objeto del presente proceso, 9)…” (imagen 164).

Del recuento anterior, coincide esta Cámara en que deben ser traídos al procesos las personas señaladas en el contrato de imagen 94. En tal comparecen Grace, Maureen y Greivin todos Rodríguez Agüero y los actores reconvenidos. En ese documento se pagó la hipoteca y se indicó: “… manifiesta su voluntad expresa de subrogar los derechos y acciones en relación con dicho crédito hipotecario a favor de …” (imagen 96) de tal forma es necesario que los intervinientes en ese contrato sean integrados a la litis. La litis consorcio necesaria es exigida cuando existe una pluralidad de partes y “...la relación sustancial es sólo una, y una sola la acción, pero, como la relación sustancial es única para varios sujetos, en forma que las modificaciones de ella, para ser eficaces, tienen que operar conjuntamente en relación a todos ellos, la ley exige que al proceso en que hay que decidir de esa única relación, sean llamados necesariamente todos los sujetos de ella, a fin de que la decisión forme estado en orden a todos ellos” (Calamandrei, Piero.

Derecho Procesal Civil, Tomo II, p. 210). De no cumplirse con este requisito procesal, la sentencia no podría surtir los efectos que la ley le atribuye, por cuanto afectaría directamente a personas que no fueron parte en el proceso. Sobre el tema la Sala Primera de la Corte Suprema de Justicia ha determinado lo siguiente: “La litis consorcio necesario, pasivo o activo, implica la obligada participación en el proceso de todos aquellos sujetos que la resolución pretendida pudiera afectar, es obvio que en orden a determinar quiénes deban ser tales sujetos, lo que primero se impone es un análisis cuidadoso de las petitorias para, de sus términos, saber si puede la causa resolverse con las personas que ya actúan en el proceso o si es necesario involucrar a otras”(voto 149 de 6 de noviembre de 1992. Consúltese en el mismo sentido el 72 de 3 de setiembre de 1982). En su forma pasiva propiamente, procede cuando no se demanda a todos los sujetos contra los cuáles cabe o a quienes puede afectar directamente la pretensión de la parte actora.

Para proteger su derecho de defensa y hacer efectivo lo ordenado en la sentencia emitida en el proceso, se ordena integrarlos debidamente. De tal forma procederá de conformidad con el numeral 22.1 del Código Procesal Civil de aplicación supletoria a la materia, confirmar la decisión apelada.

IV.De conformidad con las potestades del artículo 589 del Código de Trabajo de aplicación a la materia debe hacerse la siguiente observación respecto a la intervención del letrado Alonzo Gallardo Solís, dado que no consta poder especial a su favor. El numeral 20.2 del Código Procesal Civil establece respecto a la persona abogada directora o suplente, en lo de interés, la firma de quien autentica implicará, salvo manifestación expresa en contrario, dirección del proceso con las facultades de actuar en nombre de la parte para todo lo que le beneficie, siempre y cuando no requiera poder especial judicial o la participación personal de la parte. El alcance de esta norma ha sido analizada recientemente por el Tribunal y en lo pertinente se indicó: "III.- Lleva razón el recurrente en su agravio. Este Tribunal se ha referido en otras oportunidades, a la reforma procesal introducida por el artículo 20.2 del Código Procesal Civil, en relación a la informalidad que rige según la Ley de Jurisdicción Agraria, para facilitar el acceso a la justicia y el derecho a la defensa, en los siguientes términos: " Se aclara al respecto, dado lo resuelto sobre esa situación en resolución del 1 de diciembre del 2020, que es aplicable en los procesos agrarios, por guardar afinidad con sus principios de informalidad y celeridad, la regla contenida en la reforma procesal civil, vigente desde octubre del 2018, que faculta a las personas abogadas para actuar a nombre de sus clientes, en todo lo que no se requiera su actuación personal o mandato, aun cuando no tengan poder especial judicial (numeral 20.2 Código Procesal Civil, aplicado supletoriamente) .

Tribunal Agrario No. 238-F-21, de las 11:14 horas del 17 de marzo del 2021. En el presente caso, precisamente el abogado director de la parte actora, recurre por inadmisión, por cuanto considera que la denegación del recurso de apelación interpuesto (contra la resolución 2021-114), fue rechazado de manera ilegal, al estar representando el interés de los actores. Por ende, este Tribunal considera que es de aplicación lo dispuesto en el artículo 10.2 (sic) del Código Procesal Civil, en lo que respecta al interés para apelar: "La firma del abogado autenticante implicará, salvo manifestación expresa en contrario, dirección del proceso con las facultades de actuar en nombre de la parte para todo lo que le beneficie, siempre y cuando no se requiera poder especial judicial o la participación personal de la parte. El autenticante será responsable por el contenido de sus gestiones." De dicha disposición se desprenden claramente tres aspectos claves que deben considerarse a) La firma del abogado autenticante implica la dirección del proceso; b) El abogado director, tiene facultades de actuar en nombre de la parte, en lo que le beneficie; y, c) El mismo abogado director es responsable del contenido de sus gestiones.

Le sorprende a este Tribunal una interpretación tan formalista del a-quo, cuando ya se había abierto esta posibilidad -arraigada en la jurisprudencia constitucional- para la defensa pública agraria, que cuando asume la dirección de un proceso, puede gestionar en interés de la parte que está representando, lo cual ha sido reiterado también en jurisprudencia de este Tribunal agrario (sic). …. De manera que lo resuelto no solamente es contrario a la norma que habilita al abogado director para apelar, en interés y en defensa de su representado, sino, también contrario a los principios de informalidad del proceso agrario. Contrario a lo indicado por el juzgador de instancia, el Código Procesal Civil, en esta materia de representación, se pone en sintonía con las nuevas tendencias procesales, incluso del proceso civil, para facilitar el acceso a la justicia y el adecuado derecho de defensa, sin exigir rigurosos formalismos procesales cuando éstos sean innecesarios y costos para las partes del litigio".

Del análisis anterior comprende esta Cámara la persona abogada directora puede actuar sin poder, empero no se puede obviar la norma especial de la Ley de Jurisdicción Agraria en cuanto a la necesidad, que quienes son representados por defensa privada lo hagan mediante un poder especial judicial o cualquiera de los otros mandatos idóneos para actuar en proceso. Se considera por otra parte, la norma en cita del Código Procesal Civil no exonera de manera irrestricta la presentación del poder especial judicial. En este punto, aplicando principios de proporcionalidad y racionalidad se debe establecer como límites a la falta de presentación del mandato aquellas gestiones sustanciales o de trascendencia para el fondo. En este asunto se atiende la apelación porque en esta gestión se apersona como “apoderado especial judicial” aunque no lo sea, pues como se indicó no consta mandato; sino porque a diferencia de otros memoriales, no indica que es “solamente para este acto” como lo hizo en la contestación de la demanda, la reconvención entre otros (imágenes 152, 167 y 309). De tal forma se debe tomar en consideración esta situación para las gestiones futuras.

POR TANTO:

En lo apelado se confirma la resolución de las once horas un minutos del cinco de agosto de dos mil veintiuno.
