San Ramón, at eleven twenty a.m. on veinte de octubre de dos mil veintiuno.* * Having reviewed the foregoing appeal of judgment (recurso de apelación de sentencia), the Court rules as follows;* * Appellate Judge Peraza Segura authors the decision;* WHEREAS:* In a submission timely and properly filed, Margoth Avellan Ruiz, of the Procuraduría General de la República, acting as civil claimant (actora civil) and private prosecutor (querellante) on behalf of the State of Costa Rica, appeals judgment N° 274-2019 issued by the Tribunal de Juicio de Heredia on 8 de febrero de 2021.- * Following the statutory hearing (audiencia de Ley), Lic. Segismundo Araya Zúñiga, counsel for the accused (imputado) and civil defendant (demandado civil), requests that the appeal filed be denied, essentially because it was untimely and because the facts deemed proven in judgment 274-2019, issued at 8:15 on 30 de abril de 2019, are as follows: “The accused [Nombre1] has no prior convictions”; therefore, under the substantive law (norma sustantiva), neither the demolition of the structure nor compensation for the civil claimant can be ordered. * In the sole ground of appeal raised by the Procuraduría General de la República, it is alleged, in summary, that the rejection of restitution of matters to the condition existing before the commission of the offense was insufficiently reasoned and failed to observe the rules of sound judicial reasoning (sana crítica).
It is argued that articles 140 of the Código Procesal Penal and 103 of the Código Penal, sections 22 and 123 of the rules on civil liability currently in force from the Código Penal de 1941, article 50 of the Constitución Política, and 99 of the Ley Orgánica del Ambiente were disregarded or not applied. The judgment under appeal dismissed the civil action for damages (acción civil resarcitoria) brought by the Procuraduría General de la República and denied the request to restore the site to its original condition before the commission of the offense, on the ground that no damage had been caused. From its perspective, this is erroneous because what governs is the statutory restriction, which prohibits any human activity within the protection zone (zona de protección) of a body of water, in this case a permanent spring (naciente). It cites articles 33 and 58 of Ley Forestal 7575, which provide that no activity, crop, structure, building, or work may remain within the protection zone of a body of water, since doing so constitutes a violation of the aforementioned prohibition and also the commission of an environmental offense (ilícito ambiental), regardless of whether harm has been caused to the water source.
The trial judge accepted the defense’s argument derived from the contents of the file concerning a water concession processed under number 8052 and maintained in the records of the Dirección de Aguas del MINAE regarding the use of the spring, which states that the area in which the body of water at issue is located is not a reserve area; this was interpreted as eliminating the spring’s protection zone. This is an erroneous interpretation of a document that addresses the area’s aquifer reserves, rather than the spring’s protection zones. That protection zone is protected by law, and another law is required to eliminate it. When the spring comes into existence, the 100-meter protection zone established by the forestry provision arises automatically, without any administrative decision being necessary to enable or disable it. Protection of the spring does not depend on whether it is contaminated or whether it is considered an aquifer reserve.
The case law of the Tribunales de Casación Penal and, currently, the Tribunales de Apelación Penal has been categorical in holding that, pursuant to the pro natura principle and the principle of forest irreducibility (irreductibilidad del bosque), any encroaching conduct must be eliminated in order to remove the risk of harm to the natural resource and prevent anyone from benefiting from the unlawful act, which must be done by the court on its own motion, even in acquittals and even when no civil action has been filed. It cites decisions 2014-1528 and 2007-0964 of 10:00 on 30 de agosto de 2007 of the Tribunal de Apelación de Cartago, and 507 of 10:15 on 21 de septiembre de 2007 of the Tribunal de Casación Penal de San Ramón. It also refers to decisions 2015-921 of 8:30 on 26 de junio de 2015, 2015-1265 of 10:56 on 10 de setiembre de 2015, and 2017-1423 of 08:30 on 27 de noviembre de 2017 of the Tribunal de Apelación de Sentencia Penal del Segundo Circuito Judicial de San José.
This case law did not require evident or existing damage or harm, as stated in the challenged judgment, because the purpose is to protect a higher-order interest—the environment—by halting the continuing unlawful act. The trial judge’s position permits impairment of protection zones by allowing the offense to continue over time. In this case, there is a permanent spring that was encroached upon by the accused through the construction of a dwelling used by third parties and by the accused. The trial judge stated that there was uncertainty regarding the dwelling’s distance from the spring because the SINAC report indicates that it is 78 meters, whereas the forensic analysis report DCF 2015 521 ING at folio 6 determined that it is 65 meters. The measurement taken by SINAC officials is preliminary and was made with a measuring tape, while the forensic surveying expert was precise in his measurement.
The SINAC report includes photographs of the construction, thereby permitting its identification. The forensic analysis even contains a sketch of the structures to be removed. It requests that the challenged judgment be reversed and the case remanded for new proceedings. The claim is unsuccessful. This Chamber shall address the arguments by which the civil defendant requests that the appeal be dismissed, as follows: The appeal was not filed out of time, as asserted by defense counsel in the opposition thereto. The challenged judgment retains the same number as the judgment it supplements, and the appellant clearly states that it is appealing the judgment issued on 8 de febrero de 2021, for which the appeal period expired on 1 de marzo de 2021; the appeal at issue was filed on that same date, within the period provided by law for filing an appeal. Nor is it true, as stated in the civil defendant’s response to the appeal, that the remand ordered for adjudication of the civil action depends on the sole proven fact contained in the first of the trial-court judgments.
Decision number 2020-00332, at nine hours ten minutes on veintinueve de abril de dos mil veinte, of this Tribunal de Segunda Instancia vacated all rulings concerning the civil action for damages in judgment 274-2019 of 8:15 on 30 de abril de 2019; consequently, the civil complaint once again became the basis upon which the new trial was to be conducted. In addition, when a civil action is processed within criminal proceedings, procedural law does not require the civil action for damages to be read aloud, as asserted by civil defense counsel, because the civil defendant becomes apprised of the complaint when served with notice; therefore, the alleged omission of commencing the remand trial by reading the civil action does not constitute any defect. Turning to the substance of the challenged judgment, it dismissed the civil action for damages after introducing the provisions of the Costa Rican legal system that establish the obligation to compensate for damage, citing article 1045 of the Código Civil, concerning fault-based civil liability (responsabilidad civil subjetiva), and article 1048 of the same code, which governs strict civil liability (responsabilidad civil objetiva).
Regarding the first provision, it stated that the requirements for fault-based civil liability are the existence of damage, a causal relationship between the civil defendant’s negligent or intentional act, and the parties’ standing to sue and be sued (legitimación activa y pasiva), and it reached two conclusions; the first was that it had not been proven that the civil defendant knew of the spring’s existence because: i) It is not visible from the construction site. ii) There is a road between the civil defendant’s property and the source. ii) The failure to obtain municipal permits is not a clear indication that he knew of the water source. On those grounds, negligence-based civil liability was ruled out; although the issue was addressed only very briefly, the reasoning suggests that a lack of due care was excluded. Within that framework, to find that the civil defendant had no obligation to compensate the civil plaintiff, the judgment emphasized that the plaintiff had not demonstrated that the spring allegedly affected had suffered any impairment and that the sole instance of vegetation removal described in the visual inspection conducted during the investigative stage could have resulted from natural causes.
It noted that articles 31 and 58 of the Ley Forestal protect 100 meters from the banks of springs as reserve areas, but that the site where the building was erected is not a reserve and therefore is not a protection zone either. It based its finding that there was no evidence from which material damage could be established on the fact that the witnesses [Nombre2], an official of the Sistema Nacional de Áreas de Conservación (SINAC), and Edwin Chavarría González did not report any contamination or alteration of the water source’s channel; moreover, the expert assessment ordered to establish and quantify the damage, issued by [Nombre4], merely provides the value of the building erected. This Chamber finds that the starting point for deciding the appeal under review is to rule out civil liability arising from an intentional act, because the civil defendant was acquitted in the criminal proceedings; consequently, the provisions upon which the appellant contends that the demolition of the building and civil judgment were erroneously denied (140 of the Código Procesal Penal, 103 of the Código Penal, the rules on civil liability currently in force from the Código Penal de 1941, and article 99 of the Ley Orgánica del Ambiente) are inapplicable in this case.
Article 140 of the Código Procesal Penal establishes a provisional measure within criminal proceedings, which in the case under review (sub examine) have already concluded, while section 103 of the Código Penal governs the compensation obligation of the perpetrator of the punishable act, and it was determined by final judgment that the civil defendant was not that perpetrator. As guidance for deciding the appeal at issue, we return to the quotation from decision 902-2012 of the Sala Tercera, issued at 14:05 on 10 de mayo de 2012, included in decision number 2020-00332 of this Chamber sitting with a different panel, issued at nine hours ten minutes on veintinueve de abril de dos mil veinte and appearing beginning at folio 598: “The principle that the civil action is ancillary (principio de accesoriedad) to the criminal action entails formal, rather than substantive, dependence; that is, the existence of the latter is required for the issue of restitution or civil compensation to be adjudicated.
Once the oral and public trial has been held, the principle of ancillary jurisdiction ceases to apply because the parties have had the opportunity to discuss the facts alleged in the complaint, present evidence, and submit the legal arguments supporting their claims. It must also be taken into account that the resolution of the criminal matter does not always coincide with that of the civil matter. This is because, while the criminal action concerns whether or not there is conduct that is statutorily defined, unlawful, and culpable, in the civil matter the important question is to determine, on the court’s own motion, whether the substantive prerequisites are present, namely: a) The right: which entails proving the existence of non-pecuniary or pecuniary damage; a causal relationship between the event and the damage; and, finally, a basis for civil attribution: subjective (intent or negligence: art. 1045 of the Código Civil), or strict liability (created risk: art. 1048.5 of the Código Civil; consumer protection concerning products or services: art 35 of Ley 7472; liability of the Administration: arts 190 et seq. of the Ley General de la Administración Pública, among others), or even that, at the end of the trial, it is shown that what occurred was a breach of contract, which must also be decided by the trial judges in the judgment; b) Standing to sue and be sued; and c) A present interest.
Accordingly, in our legal system it is not valid to maintain that an acquittal in the criminal proceeding necessarily results in the same outcome for the civil complaint, an issue that has been extensively addressed in the case law of the Sala Tercera de la Corte Suprema de Justicia and the Tribunales de Casación (now Tribunales de Apelación de Sentencia Penal).
The criteria for resolving criminal and civil disputes are different, and there is only some overlap when the civil action (acción civil) concerns the application of liability based on subjective attribution (imputación subjetiva): intent (dolo) and fault (culpa). […[ The Trial Court is required to assess whether the aforementioned substantive civil prerequisites are present and decide accordingly; it is not sufficient to assert that the civil action depends on the criminal action. Even if it were determined that there was a breach of contract (incumplimiento contractual), the Court would still have a duty to rule as appropriate on the requested reparation.” (Emphasis added). Following this line of reasoning, it remains to be examined whether the appeal presents arguments establishing whether the civil defendant bears fault-based civil liability (responsabilidad civil por culpa) that could support an order requiring him to demolish the constructed building or compensate the State as the owner of the water and natural resource alleged to have been affected.
In this regard, under the provisions of Article 1045, conduct is negligent when a person acts without due diligence, through negligence or recklessness, thereby causing compensable damage; the civil plaintiff bears the burden of proof (carga de la prueba) to establish this. Two obstacles arise. The first is that the allegation contained in the civil complaint attributes intentional conduct and does not describe negligent or reckless conduct. Let us examine it: “FIRST. Civil defendant [Nombre1] is the possessor of a property located in Desamparados de Alajuela, near Colegio Saint John [Dirección1] , . SECOND. Without specifying the exact date, but between August 2014 and 23 de setiembre de 2014 inclusive, on the aforementioned property, defendant [Nombre1], knowing that his acts were unlawful, proceeded to encroach upon the protection area (área de protección) of a permanent spring (naciente permanente) by carrying out earthworks (movimiento de tierra) and constructing, making habitable, and occupying a residential structure consisting of two stories and having an approximate area of 45 metros cuadrados; all of the foregoing at a horizontal distance of 65 metros from the aforementioned body of water and without the corresponding permit from the municipality or the State Forestry Administration (administración forestal del Estado).
THIRD: As a consequence of the unlawful conduct of the private complainant defendant (querellado), [Nombre1], environmental damage (daños al ambiente) occurred, consisting of site-restoration costs and the costs that will be incurred in reforesting the affected area, which were assessed by the Ministerio de Ambiente y Energía at one million one hundred seventy-seven thousand eight hundred eighty-four colones (1,177.884,00).” Under the principle of consistency with the pleadings (principio de congruencia externa), which applies in civil matters and requires every judgment to conform to the complaint and the answer submitted by the parties, this circumstance would preclude a civil judgment against the defendant because the question of whether intentional conduct existed has already been resolved. Nevertheless, even hypothetically applying a broad line of reasoning under which negligent harmful conduct might be inferred from the factual framework of the civil complaint despite the failure to describe the alleged careless or reckless act, the civil plaintiff did not appeal that specific issue by offering reasoning or evidence contradicting the trial judge’s findings.
Therefore, under the party-disposition principle (principio dispositivo), which governs civil matters and pursuant to which a party is deemed to accept those determinations regarding which it did not exercise its right to appeal, the exclusion of subjective civil liability (responsabilidad civil subjetiva) in the judgment on the merits (sentencia de mérito) cannot be challenged by the court sua sponte. The other legal basis advanced by the appellant is Article 99 of Ley Orgánica del Ambiente, number 7554, which reads verbatim: “In the event of a violation of environmental-protection regulations or conduct clearly established in this law as harmful to the environment, the Public Administration shall apply the following protective measures and penalties: a) Warning through notice that a complaint exists. b) Reprimand commensurate with the seriousness of the violations, once they have been established. - 20 - c) Enforcement of the performance bond furnished as part of the environmental impact assessment (evaluación de impacto ambiental). d) Partial or total restrictions, or an order immediately halting the acts giving rise to the complaint. e) Total or partial, temporary or permanent closure of the acts or circumstances giving rise to the complaint. f) Partial, total, permanent, or temporary revocation of the permits, business licenses, premises, or businesses giving rise to the complaint or to the polluting or destructive act or circumstance. g) Imposition of obligations to compensate for or stabilize the environment or biological diversity. h) Modification or demolition of structures or works that harm the environment. i) Alternatives for satisfying the penalty, such as attending official educational courses on environmental matters and performing community work in the environmental field.
These penalties may be imposed on private individuals or public officials for acts or omissions that violate the provisions of this law, other environmental-protection provisions, or provisions protecting biological diversity.” As may readily be observed, this provision applies within an administrative proceeding (procedimiento de carácter administrativo) conducted before the Tribunal Ambiental Administrativo, in accordance with Articles 103 et seq. and related provisions of the cited Law 7554. Following this same line of reasoning, the Tribunal de Apelación de Sentencia de Cartago ruled in decision Nº 627 – 2020 dated 23 de octubre de 2020, issued in expediente 16-000237-0567-PE: * [...] The principle of irreducibility of forest ecosystems (principio de irreductibilidad de los ecosistemas boscosos) constitutes an obligation imposed by the legislature upon the State as a course of action in response to conduct that causes environmental harm, such that the State cannot relinquish or abandon its efforts to restore lands that formerly constituted forest ecosystems to that condition.
This does not mean, however, that in a judgment of acquittal (sentencia absolutoria), in which no form of subjective or strict civil liability (responsabilidad civil subjetiva u objetiva) could be established against any person, the judicial authority must order acts or omissions that necessarily require a technical determination as to the best course of action in such cases of environmental damage. In other words, when a judgment acquitting particular persons accused of causing such environmental damage is entered, the State is required to exercise its administrative statutory powers to comply with Article 45 of Ley de Biodiversidad, which provides:* “The State is required to prevent any risk or danger threatening the continued existence of ecosystems. It must also prevent, mitigate, or restore environmental damage that threatens life or impairs its quality,” because the criminal judge’s jurisdiction is limited to the civil reparation (reparación civil) established by Article 103 of Código Penal.
None of the provisions cited by the appellant grants criminal courts jurisdiction to order the demolition of buildings, the removal of structures or roads, or other measures customarily ordered by courts of justice; rather, they establish general principles concerning the State’s obligation to restore damage. Conversely, Article 99 of Ley Orgánica del Ambiente establishes a series of administrative penalties that the Public Administration may impose, including those set forth in subsections d), e), g), and h) of that provision, which authorize restrictions or orders immediately halting the acts giving rise to the complaint; the total or partial, temporary or permanent closure of such acts; the imposition of obligations to compensate for or stabilize the environment or biological diversity; and the modification or demolition of structures or works that harm the environment, among others. Accordingly, it is evident that, in a case such as this one, in which the alleged criminal act (hecho punible) could not be proven, responsibility and authority for protecting and ensuring the restoration of forest ecosystems affected by that environmental damage rest solely and exclusively with the State Forestry Administration. [...]" (Emphasis added).
It cannot be overlooked that, as the appellant indicates, the reasoning offered in the appealed judgment to rule out damage to the spring is erroneous: namely, that it was not shown that the water source had been contaminated or had suffered any other form of impairment and that, moreover, because it was not located within a reserve area, it did not constitute a protection area. It must be recalled that reserve areas, referenced in Article 1 of Ley Forestal and classified therein as biological reserves or forest reserves, are a legal concept distinct from the protection areas surrounding water sources, which need not be located within a reserve to receive the protection granted under Articles 33 and 58 of Ley Forestal. Thus, Article 33 of Ley Forestal provides that the following are protection areas, as a regime restricting privately owned land: “a) Areas bordering permanent springs, defined as a radius of one hundred meters measured horizontally.” Their creation responds to the need to safeguard water resources, which are of vital importance to survival, by seeking to keep them free from contamination, while also protecting the biodiversity of the ecosystems in which they are located and serving as a containment mechanism against natural impacts caused by runoff during rainy seasons, a source of flooding given the climatic conditions specific to our country; all of the foregoing in light of population growth and increasing urbanization with little or no planning.
Returning to the grounds for appeal, even though the reasons for excluding environmental damage are erroneous, the fact remains that the appellant civil plaintiff did not challenge the absence, as found in the judgment on the merits, of negligent conduct by civil defendant [Nombre1] that would impose upon him an obligation to compensate the State, which appeared as civil plaintiff through the Procuraduría General de la República. Nor were any arguments offered to establish strict liability arising under Article 1048, which plainly contains no factor under which the conduct alleged against [Nombre1] could be classified. Accordingly, the appellant’s arguments lack support, and the appeal therefore fails.* Por tanto* The appeal filed by Margoth Avellán Ruiz, of the Procuraduría General de la República, acting as a civil plaintiff on behalf of the State of Costa Rica, is hereby denied. San Ramón, a las once horas veinte minutos del veinte de octubre de dos mil veintiuno.* * Visto el anterior recurso de apelación de sentencia que se formula, se resuelve;* * Redacta la Jueza de Apelación de Sentencia Peraza Segura y;* CONSIDERANDO:* En escrito presentado en tiempo y forma, Margoth Avellan Ruiz, de la Procuraduría General de la República, constituida como actora civil y querellante representando al Estado de Costa Rica, plantea recurso de apelación en contra de la sentencia N° 274-2019 emitida por el Tribunal de Juicio de Heredia el 8 de febrero de 2021.- * Conferida la audiencia de Ley, el Lic. Segismundo Araya Zúñiga, defensor del imputado y demandado civil, solicita que se declare sin lugar el recurso de apelación interpuesto, en resumen porque es extemporáneo y de los hechos que se tienen por probados en la sentencia 274-2019 de las 8:15 del 30 de abril de 2019 que son los siguientes: “El imputado [Nombre1] no acusa juzgamientos anteriores”; no se puede, con aplicación de la norma sustantiva, fundamentar el derribo de la construcción o el resarcimiento a la actora civil. * En el único motivo del recurso de la Procuraduría General de la República, en resumen, se alega insuficiente fundamentación e inobservancia de las reglas de la sana crítica, en el rechazo de la restitución de las cosas al estado anterior a la comisión del delito.
Se argumenta que hubo inobservancia o falta de aplicación de los artículos 140, del Código Procesal Penal y los numerales 103 del Código Penal, 22 y 123 de las reglas vigentes sobre responsabilidad civil del Código Penal de 1941, artículo 50 de la Constitución Política y 99 de la Ley Orgánica del Ambiente. En la sentencia que se recurre, se declaró sin lugar la acción civil resarcitoria incoada por la Procuraduría General de la República y se rechazó la solicitud de restauración del sitio al estado original antes de la comisión del delito, con fundamento en que no se generó ningún daño. Lo que desde su perspectiva es equívoco, porque lo que priva es la reserva que hace la ley, que prohíbe llevar a cabo cualquier actividad humana dentro de la zona de protección de un cuerpo de agua, en este caso de una naciente de carácter permanente. Cita los artículos 33 y 58 de la Ley Forestal 7575 que ordena que ninguna actividad, cultivo, estructura, construcción u obra puede permanecer en la zona de protección de un cuerpo de agua, pues esto significa violación a la prohibición acotada y asimismo, la comisión de un ilícito ambiental, ello independientemente si se ha causado un perjuicio a la fuente de agua.
La juzgadora acogió el argumento de la defensa que se deriva del contenido del legajo referente a una concesión de agua tramitada bajo el número 8052 que lleva en sus archivos la Dirección de Aguas del MINAE sobre el aprovechamiento de la naciente, que indica que el área donde se encuentra el cuerpo de agua que nos ocupa, no es zona de reserva, lo que fue interpretado como una anulación de la zona de protección de la naciente. Esto es una errónea interpretación de un documento en el que se discute las reservas acuíferas de la zona y no las zonas de protección de la naciente. Esa zona de protección se encuentra protegida por ley y para su eliminación se requiere otra ley. Con la generación de la naciente surge automáticamente la zona de protección de los 100 metros que dispone la norma forestal, sin que sea necesario un dictado administrativo que lo habilite o deshabilite. El respeto a la naciente es independiente de que esté o no contaminada, o de que se le considere reserva acuífera o no. La jurisprudencia de los Tribunales de Casación Penal y actualmente de Apelación Penal ha sido categórica al señalar, que en aras de los principios pro natura y de irreductibilidad del bosque, toda conducta invasora debe ser suprimida, a fin de eliminar el riesgo de perjuicio al recurso natural e impedir que se saque provecho del ilícito, ello de oficio, aún en absolutorias y hasta sin acción civil de por medio.
Cita los votos 2014-1528, 2007-0964 de las 10:00 del 30 de agosto de 2007 del Tribunal de Apelación de Cartago; 507 de las 10:15 del 21 de septiembre de 2007 del Tribunal de Casación Penal de San Ramón. Refiere además los votos 2015-921 de las 8:30 del 26 de junio de 2015, 2015-1265 de las 10:56 del 10 de setiembre de 2015 y 2017-1423 de las 08:30 del 27 de noviembre de 2017 del Tribunal de Apelación de Sentencia Penal del Segundo Circuito Judicial de San José. No se requirió en esta jurisprudencia un daño o perjuicio evidente o actual, como se expone en la sentencia que se impugna, porque se trata de dar protección a un bien superior que es la protección del ambiente deteniendo la continuación del ilícito. La tesis de la juzgadora permite un menoscabo a las zonas de protección, con la perpetuación en el tiempo del delito. En este caso hay una naciente de carácter permanente que fue invadida por el encartado con la construcción de una casa de habitación que es aprovechada por terceros y el encartado.
La juzgadora dijo que había duda de la distancia a la que se encuentra la vivienda de la naciente, porque el informe del SINAC indica que son 78 metros en tanto que el dictamen de análisis criminalístico DCF 2015 521 ING de folio 6 determinó que son 65 metros. La medida realizada por los funcionarios del SINAC es preliminar y se realiza con cinta métrica y el perito topógrafo forense es preciso en su medición. El informe del SINAC incluye fotografías de la construcción lo que permite individualizarla. Y el análisis criminalístico inclusive contiene un croquis de las estructuras a eliminar. Solicita que se revoque la sentencia impugnada y se ordene el reenvío para nueva sustanciación. El reclamo no prospera. Procede este Cámara a dar resolución a los alegatos por los que el demandado civil solicita que se declare sin lugar el recurso en los siguientes términos: El recurso no fue presentado de forma extemporánea como lo asevera la defensa técnica en la oposición al mismo.
La sentencia que se impugna conserva el mismo número de la que integra y es clara la recurrente en indicar que se apela la que se emitió el 8 de febrero de 2021, sobre la cual se vencía el término de impugnación el 1 de marzo de 2021, siendo que la apelación que nos ocupa fue presentada esa misma fecha, dentro del término concedido por la ley para recurrir. Tampoco es cierto, como se indica en el libelo de contestación del recurso del demandado civil, que el reenvío ordenado para que se conozca la acción civil depende del único hecho probado que contiene la primera de las sentencias de primera instancia. El voto número 2020-00332, de las nueve horas diez minutos del veintinueve de abril de dos mil veinte, de este Tribunal de Segunda Instancia anuló todo lo resuelto en relación con la acción civil resarcitoria en la sentencia 274-2019 de las 8:15 del 30 de abril de 2019; como consecuencia de ello, la demanda civil volvió a ser la base sobre la cual, el nuevo juicio debía realizarse.
Adicionalmente, en la tramitación de la acción civil, dentro de un proceso penal, la ley procesal no requiere dar lectura a la acción civil resarcitoria, como lo apuntó la defensa civil, porque el demandado civil entra en el conocimiento de la demanda cuando es notificado, razón por la cual la señalada omisión para iniciar el juicio de reenvío con la lectura de la acción civil no constituye vicio alguno. Ahora bien, en cuanto al contenido de la sentencia impugnada, esta declaró sin lugar la acción civil resarcitoria y para eso hizo una introducción de las normas que, en el ordenamiento jurídico costarricense contienen la obligación de resarcir un daño, citando el artículo 1045 del Código Civil, referido a la responsabilidad civil subjetiva, el 1048 del mismo cuerpo normativo que regula la responsabilidad civil objetiva. Sobre la primera norma señaló que los requisitos para que se dé la responsabilidad civil subjetiva son la existencia del daño, la relación causal entre la acción culposa o dolosa del demando civil y la legitimación activa y pasiva de los sujetos intervinientes, arribando a dos conclusiones; la primera que no se demostró que el demandado civil conociera la existencia de la naciente porque: i) Esta no es visible desde el sitio de la construcción. ii) Entre el inmueble del demandado civil y la fuente existe una calle. ii) La omisión de gestionar permisos municipales no es indicio claro de que se conocía de la fuente acuífera.
Con estos argumentos se descartó la responsabilidad civil por culpa, si bien el punto se desarrolla muy someramente, deja entrever que se excluyó una falta de diligencia. Dentro de ese marco para señalar la ausencia de una obligación de resarcir del actor civil recalcó que en la especie no demostró la actora, que la naciente que se indica afectada, sufriere algún menoscabo y que la única desprovisión de vegetación reseñada en la inspección ocular, llevada a cabo en la etapa de investigación, pudo deberse a la acción de la naturaleza. Apuntó que los artículos 31 y 58 de la Ley Forestal protegen 100 metros de la margen de las nacientes como áreas de reserva, pero que el lugar donde fue levantada la edificación no es una reserva y por ello, tampoco una zona de protección. La ausencia de medios probatorios sobre los que establecer un daño material la fundó en que los testigos [Nombre2] funcionario del Sistema Nacional de Áreas de Conservación (SINAC) y Edwin Chavarría González no refirieron alguna contaminación o variación en el cauce de la fuente de agua y además el peritaje ordenado para establecer el daño y cuantificarlo, emitido por [Nombre4] , lo que ofrece es el valor de la construcción levantada.
Estima esta Cámara, que el punto de partida para la resolución del recurso bajo examen es descartar la responsabilidad civil derivada de un hecho doloso, por haber sido absuelto el demandado civil en sede penal, lo que tiene como consecuencia que la normativa sobre la que la recurrente estima erróneamente denegado el derribo de la construcción y la condena civil (140 del Código Procesal Penal, 103 del Código Penal, reglas sobre responsabilidad civil vigentes del Código Penal de 1941 y artículo 99 de la Ley Orgánica del Ambiente) es una normativa inaplicable en el presente caso. El artículo 140 del Código Procesal Penal contiene una medida provisional en el marco de un proceso penal, que en el sub examine ya ha fenecido y de su parte el numeral 103 del Código Penal regula la obligación indemnizatoria que le asiste al autor del hecho punible, de quien, por sentencia firme, se descartó que fuera el demandado civil.
Como una guía para la resolución de recurso que nos ocupa, se retoma la cita de la resolución de la Sala Tercera 902-2012 de las 14:05 horas del 10 de mayo de 2012, introducida en el voto de esta Cámara con diferente integración, número 2020-00332 de las nueve horas diez minutos del veintinueve de abril de dos mil veinte visible a partir del folio 598: “El principio de accesoriedad de la acción civil en relación con la acción penal implica una dependencia de carácter formal y no sustantiva, es decir, se requiere de la existencia de la segunda para que deba resolverse el problema de restitución o reparación civil. Una vez que se ha celebrado el juicio oral y público el principio de accesoriedad desaparece, pues las partes han tenido oportunidad de discutir sobre los hechos de la demandada, presentar las pruebas y formular los argumentos jurídicos que sustenta sus pretensiones. Además, debe tomarse en cuenta que no siempre la solución del problema penal coincide con el civil.
Esto es así porque mientras en la acción penal se discute si estamos o no ante de una acción, típica, antijurídica y culpable, en lo civil lo importante es determinar, de oficio, la presencia de los presupuestos materiales, a saber: a) El derecho: lo que implica demostrar la existencia de un daño moral o patrimonial; una relación de causalidad entre el evento y el daño y finalmente, un criterio de imputación civil: subjetivo (dolo o culpa: art. 1045 del Código Civil), o de responsabilidad objetiva (riesgo creado: art. 1048.5 del Código Civil: de protección al consumidor de productos o servicios: art 35 de la Ley 7472; de responsabilidad de la Administración: arts 190 y ss de la Ley General de la Administración Pública, entre otros, o incluso que al final de juicio se demuestre que lo que se ha producido es un incumplimiento contractual, lo que también debe ser resuelto por los jueces de juicio en sentencia b) La legitimación activa y pasiva y c) El interés actual.
De tal forma que en nuestro medio no es válido sostener que por haberse absuelto en lo penal, la misma suerte corre la demanda civil, tema que ha sido ampliamente tratado por la jurisprudencia de la Sala Tercera de la Corte Suprema de Justicia y por los Tribunales de Casación (hoy de Apelación de Sentencia Penal). Los criterios para resolver el conflicto penal y el civil son diversos y solo hay alguna coincidencia cuando en la acción civil se discute la aplicación de una responsabilidad fundada en imputación subjetiva: dolo y culpa. […[ Es obligación del Tribunal de Juicio entrar a valorar si están o no presentes los citados presupuestos civiles materiales, para decidir lo que corresponda, sin que sea suficiente afirmar que existe una dependencia de la acción civil de la penal. Incluso, en el caso que se llegara a estimar que hay un incumplimiento contractual, también es un deber del Tribunal resolver lo que corresponda sobre la reparación que se pide.” (la negrita es propia).
En esta línea de pensamiento, resta examinar si en el recurso se ofrecen argumentos para establecer si al demandado civil le cabe una responsabilidad civil por culpa en la que, pueda sustentarse la orden para que derribe la edificación construida o efectúe una indemnización al Estado como titular del recurso hídrico y natural que se señala afectado. En ese sentido, al tenor de lo dispuesto en el artículo 1045 hay una actuación culposa cuando se actúa sin la diligencia debida, por negligencia e imprudencia y con ello se ocasiona un daño susceptible de ser resarcido y es la parte actora civil la que tiene la carga de la prueba para demostrarlo. Son dos los óbices que surgen, el primero es que la imputación que contiene la demanda civil es a título doloso, no describe una actuación negligente o imprudente, veamos: “PRIMERO. Que el demandado civil [Nombre1] es poseedor de una propiedad que se ubica en Desamparados de Alajuela, del Colegio Saint John [Dirección1] , .
SEGUNDO. Que sin precisar fecha exacta, pero sí entre el mes de agosto de 2014 y hasta el 23 de setiembre de 2014 inclusive, en la finca antes mencionada, el imputado [Nombre1] con conocimiento de la ilicitud de sus actos, procedió a invadir el área de protección de una naciente permanente, esto al realizar movimiento de tierra y construir, habilitar y detentar una estructura destinada a vivienda, la cual consta de dos plantas y ostenta un área aproximada de 45 metros cuadrados; todo lo anterior a una distancia de 65 metros horizontales del cuerpo de agua mencionado y si contar con el permiso municipal respectivo o de la administración forestal del Estado. TERCERO: Que como consecuencia del actuar ilícito del querellado [Nombre1] , se produjo daños al ambiente que consisten en los costos de recuperación del sitio y los costos en que se incurrirá para la reforestación de la zona afectada, los cuales fueron ponderados por el Ministerio de Ambiente y Energía en la suma de un millón ciento setenta y siete mil ochocientos ochenta y cuatro colones (1,177.884,00)” Situación que de acuerdo con el principio de congruencia externa que aplica en materia civil y que consiste en que toda sentencia debe dictarse en concordancia con la demanda y con la contestación formuladas por las partes, impediría una condena civil porque, la existencia de una actuación dolosa es una discusión superada.
Sin embargo, haciendo el ejercicio hipotético de aplicación de una línea de pensamiento amplio, en la que se partiere de que, a pesar de no describirse la acción descuidada o imprudente achacada, del marco fáctico de la demanda civil podría inferirse una actuación dañina culposa, no recurrió la actora civil ese punto en específico ofreciendo razonamientos o probanzas que se contrapongan a los que dio la juzgadora, por lo que, en virtud del principio dispositivo, que rige en materia civil, y según el cual, la parte se muestra conforme con aquellos extremos con respecto a los cuales no ejerció su derecho de impugnación, la exclusión de la responsabilidad civil subjetiva, hecha en la sentencia de mérito no puede combatirse oficiosamente. El otro fundamento jurídico que ofrece la recurrente es el numeral 99 de la de la Ley Orgánica del Ambiente, número 7554, que a la letra dice: “Ante la violación de las normativas de protección ambiental o ante conductas dañinas al ambiente claramente establecidas en esta ley, la Administración Pública aplicará las siguientes medidas protectoras y sanciones: a) Advertencia mediante la notificación de que existe un reclamo. b) Amonestación acorde con la gravedad de los hechos violatorios y una vez comprobados. - 20 - c) Ejecución de la garantía de cumplimiento, otorgada en la evaluación de impacto ambiental. d) Restricciones, parciales o totales, u orden de paralización inmediata de los actos que originan la denuncia. e) Clausura total o parcial, temporal o definitiva, de los actos o hechos que provocan la denuncia. f) Cancelación parcial, total, permanente o temporal, de los permisos, las patentes, los locales o las empresas que provocan la denuncia, el acto o el hecho contaminante o destructivo. g) Imposición de obligaciones compensatorias o estabilizadoras del ambiente o la diversidad biológica. h) Modificación o demolición de construcciones u obras que dañen el ambiente. i) Alternativas de compensación de la sanción, como recibir cursos educativos oficiales en materia ambiental; además, trabajar en obras comunales en el área del ambiente.
Estas sanciones podrán imponerse a particulares o funcionarios públicos, por acciones u omisiones violatorias de las normas de esta ley, de otras disposiciones de protección ambiental o de la diversidad biológica.” Norma que como puede observarse fácilmente, está dispuesta dentro de un procedimiento de carácter administrativo que se lleva ante el Tribunal Ambiental Administrativo, acorde con lo que disponen los artículos 103 siguientes y concordantes de la Ley de 7554 citada. En esta misma línea de pensamiento resolvió el Tribunal de Apelación de Sentencia de Cartago en el voto Nº 627 – 2020 de fecha 23 de octubre de 2020, emitido dentro del expediente 16-000237-0567-PE: * [...] El principio de irreductibilidad de los ecosistemas boscosos corresponde a una obligación que el legislador le ha impuesto al Estado como forma de actuación frente a los comportamientos que impliquen un daño al medio ambiente, de forma tal que aquél no podría renunciar o claudicar en su accionar para que los terrenos que constituían ecosistemas boscosos vuelvan a serlo, pero no significa que en una sentencia absolutoria, en la que no fue posible establecer ningún tipo de responsabilidad civil subjetiva u objetiva de alguna persona, deba la autoridad jurisdiccional ordenar acciones u omisiones que necesariamente conllevan un criterio técnico, respecto de cuál es la mejor manera de proceder en tales casos de daño ambiental.
En otras palabras, cuando exista una sentencia absolutoria contra determinadas personas acusadas de ese daño ambiental, el Estado tendrá la obligación de poner en marcha las potestades legales administrativas para cumplir con lo dispuesto por el artículo 45 de la Ley de Biodiversidad que establece que:* “El estado tiene la obligación de evitar cualquier riesgo o peligro que amenace la permanencia de los ecosistemas. También deberá prevenir, mitigar o restaurar los daños ambientales que amenacen la vida o deterioren su calidad”, pues el juez penal tiene limitadas sus competencias a la reparación civil establecida por el artículo 103 del Código Penal. Ninguna de las normas señaladas por el recurrente permiten establecer una competencia de los tribunales penales para ordenar derribos de edificaciones, remoción de estructuras, caminos u otras disposiciones que habitualmente ordenan los tribunales de justicia, sino que establecen postulados generales de obligación del Estado de restaurar los daños.
Por el contrario, el artículo 99 de la Ley Orgánica del Ambiente establece una serie de sanciones administrativas que puede realizar la Administración Pública, entre las que se encuentran los incisos d), e) g) y h) de dicha norma en donde se estatuye la posibilidad de restringir u ordenar la paralización inmediata de los actos que originaron la denuncia; la clausura total o parcial, temporal o definitiva de dichos actos; la imposición de obligaciones compensatorias o estabilizadoras del ambiente o la diversidad biológica; y la modificación o demolición de construcciones u obras que dañen el ambiente, entre otras. De acuerdo con lo anterior, resulta evidente que en un caso como el presente, en el que no fue posible demostrar el hecho punible atribuido, la responsabilidad y competencia para proteger y tutelar la restauración de los ecosistemas boscosos por ese daño ambiental es única y exclusivamente de la Administración Forestal del Estado. [...]" (La negrita es propia).
No se puede pasar por alto que, como lo indica la recurrente, son erróneos los argumentos ofrecidos en la sentencia apelada para descartar el daño a la naciente porque no se demostró que la fuente acuífera se contaminara o sufriera algún otro tipo de menoscabo y porque además, al no estar dentro de una zona de reserva no constituye área de protección. Debe recordarse que las zonas de reserva, a las que se hace alusión en al artículo 1 de la Ley Forestal, clasificándolas en reservas biológicas o reservas forestales, son un concepto jurídico distinto de las áreas de protección de las fuentes acuíferas que no necesariamente deben estar ubicadas dentro de una reserva para recibir la tutela concedida en los artículo 33 y 58 de la Ley Forestal. De esta manera, el ordinal 33 de la Ley Forestal establece que son áreas de protección, como régimen de limitación a las áreas de propiedad privada “a) Las áreas que bordeen nacientes permanentes, definidas en un radio de cien metros medidos de modo horizontal.” Su creación obedece a la necesidad de salvaguardar el recurso hídrico, de cardinal trascendencia para la sobrevivencia, en la procura de mantenerlo libre de contaminación, pero también para la resguardo de la biodiversidad del ecosistema en el que se encuentran y como mecanismo de contención contra los embates naturales por la escorrentía en épocas lluviosas, fuente de inundaciones, dadas las características climáticas propias de nuestro país; todo lo anterior de cara al crecimiento demográfico y la creciente urbanización con escasa o nula planificación.
Retomando los motivos de la impugnación aún y cuando las razones para excluir un daño ambiental sean erróneas, es lo cierto que la recurrente actora civil no impugnó la ausencia, que en la sentencia de mérito se estableció, de una conducta culposa del actor civil [Nombre1] , que le imponga una obligación de resarcir al Estado constituido como actor civil a través de la Procuraduría General de la República. Tampoco se ofrecieron argumentos tendientes a establecer una responsabilidad objetiva derivaba del numeral 1048 que, a todas luces, no contiene ningún factor en el cual encuadrar la actuación demandada en contra de [Nombre1] . Así entonces, no encuentran sustento los alegatos de la recurrente y por ende el recurso no prospera.* POR TANTO* Se declara sin lugar el recurso de apelación interpuesto por Margoth Avellán Ruiz, de la Procuraduría General de la República, constituida como actora civil representando al Estado de Costa Rica.
