STATEMENT OF FACTS (RESULTANDO):
I.By a brief filed with the Tribunal Contencioso Administrativo y Civil de Hacienda on 25 de mayo de 2011, the plaintiffs instituted a civil proceeding involving the Public Treasury, and their claims (pretensiones) were specified at the preliminary hearing (audiencia preliminar), which was held in two sessions on 06 de febrero and 08 de junio del 2014, seeking a judgment declaring the following: “...A) (...) that the State forcibly dispossessed them and has prevented them from exercising the rights inherent in the land-possession regime (régimen de posesión de la tierra) quietly, peacefully, and as owners. B) Pursuant to article 42.h) of the Código Procesal Contencioso Administrativo, we request a declaration that the material conduct (actuación material), constituting a de facto action (vía de hecho), caused by the forcible dispossession (desposesión forzosa) of the property without a written and effective administrative act (acto administrativo), without prior payment of the value of the land, the improvements (mejoras), their accessions (accesiones), or the value of the standing timber, is inconsistent with the Constitución Política and the legal system, and that such values must be indexed through the date of actual payment.
The Public Administration and the defendant Trust should be ordered to pay the value of the property, the value of the improvements and their accessions, the value of the timber, attorneys’ fees and litigation costs (costas personales y procesales), and the damages caused to date, all indexed through the present date, together with statutory interest, until actual payment. The material conduct of forcibly dispossessing the plaintiff companies of their property, which constitutes a de facto action with continuing effects through the present date, should be declared inconsistent with the legal system; and the State and the defendant Trust should be ordered to pay all costs of these proceedings and the damages caused. G) The plaintiffs seek an order requiring the State to pay the price of the real property, updated in accordance with the inflation indices recorded by the Banco Central de Costa Rica and indexed through the date of actual payment, together with the value of its improvements and accessions and the price of the timber existing on the property, all likewise updated in accordance with the inflation indices of the Banco Central de Costa Rica.
II.By an order issued at 11:21 hours on 23 de agosto del 2011, the complaint was admitted for processing and served upon the State; and, as ordered in the decision issued at 09:49 hours on 26 de octubre de 2012, the Sistema Nacional de Áreas de Conservación (SINAC) and the Junta Directiva del Parque Recreativo Nacional Playas Manuel Antonio were joined as parties, that Board being the Trust identified by the plaintiffs in their claims. (See images 1276 and 1278 of the digital court file).
III.By a brief received on 26 de octubre de 2011, counsel for the State opposed the complaint and raised the affirmative defenses (excepciones) of lack of a current interest, failure to state a right, statute of limitations (prescripción), and lack of standing on the part of both the plaintiffs and the defendants (falta de legitimación activa y pasiva). Counsel for the Junta Directiva del Parque Recreativo Nacional Playas Manuel Antonio did the same by a brief filed on 13 de diciembre de 2012 and raised the defenses of lack of a current interest, failure to state a right, statute of limitations, and lack of standing on the part of both the plaintiffs and the defendants. Finally, counsel for SINAC also opposed the complaint by a brief filed on 20 de diciembre de 2012 and raised the defenses of failure to state a right, statute of limitations, and lack of standing on the part of the plaintiffs. (See images 1241 through 1260, 1292 through 1310, and 1311 through 1326 of the digital court file).
IV.The preliminary hearing was held in two sessions, the first on 06 de febrero and the second on 08 de junio, both in 2014. During the judicial proceeding, the claims were defined in the terms set forth in the first statement of facts. The statute-of-limitations defense was reserved for determination in the judgment. All facts were deemed disputed except fact number 1, insofar as the real property identified therein is located within the area comprising Parque Nacional Manuel Antonio; and the specified documentary evidence and the testimony of Nombre111205 and Nombre111206, offered by the plaintiff corporations, were admitted, with their statements being taken in advance (deposición anticipada). The testimony of Nombre111207 was also admitted on behalf of the Junta Directiva del Parque Recreativo Nacional Playas Manuel Antonio. The plaintiff corporations were also granted expert evidence (prueba pericial) so that a land-surveying engineer could compare plan No. P-451272-97 with plan No. P-986592-2005 and determine whether both plans described the same real property.
That expert appraisal (peritaje) was assigned to engineer Christian Stanley Chacón Barquero. Expert evidence was also admitted for the plaintiffs to establish the value of the land. That appraisal was assigned to engineer Nombre58528. The State, in turn, was granted expert evidence to determine whether the land corresponding to Plan Placa19634 is land belonging to the Municipalidad de Aguirre (now Municipalidad de Quepos) and leased to Nombre111208. That appraisal was assigned to engineer Nombre111209. Counsel for the plaintiff corporations also submitted evidence during that proceeding, namely, the record of the hearing held in criminal case No. 07-200009-0457-PE, in which the conditional suspension of proceedings (suspensión del proceso a prueba) against Nombre111210 for the offense of embezzlement of public funds (peculado) was approved, concerning checks that were allegedly intended to pay for the plaintiffs’ properties, for the purpose of demonstrating that the property from which they were dispossessed was never paid for.
They also submitted a plan of the alleged property dating from 1953, arguing that the document could be identified following the advance deposition of Nombre111211. Pursuant to artículo 50 of the CPCA, the case-management judge reserved the admission or rejection of that evidence for the Trial Court (Tribunal de Juicio). (See images 1482 through 1484 and 1573 through 1576 of the digital court file and the digital backup held in the custody of this Court).
V.Nombre58528 submitted the commissioned expert report (pericia) on 12 de agosto de 2015, and by an order issued at 15:23 hours on 29 de octubre de 2015, the parties were given an opportunity to respond. Christian Stanley Chacón Barquero subsequently submitted his report, followed by Nombre111209. The parties were likewise given an opportunity to respond to those expert reports. (See images 1614 through 1638, 1665, 1666, 3863 through 3871, and 3934 through 3941).
VI.By order issued at 11:06 hours on 21 de setiembre de 2020, the supplemental hearing was scheduled for 08:30 hours on 06 de agosto de 2021. That order was served on all parties and on the expert witnesses Christian Stanley Chacón Barquero, Nombre58528, and Nombre111209. (See images 4014 to 4024).
VII.The supplemental oral and public trial hearing was held beginning at 08:30 hours on 06 de agosto de 2021, with representatives of the claimant companies and the defendants in attendance. As relevant here, the parties delivered their opening statements, and testimony was received from the expert witnesses Christian Stanley Chacón Barquero and Nombre111209. Although expert witness Nombre58528 was served with the order convening the hearing through the designated means, he did not appear at the trial hearing; however, the parties excused him from orally presenting his expert report. The parties delivered their closing arguments exclusively orally, as instructed, and at 14:55 hours on that day the supplemental trial hearing was declared closed. Therefore, under the principle of procedural preclusion (principio de preclusividad), any documentation submitted to the proceedings after the close of the hearing is inadmissible. Finally, this Tribunal ordered that these proceedings be conducted in accordance with Article 111, subsection 1), of the Administrative Litigation Procedure Code (Código Procesal Contencioso Administrativo). VIII.This judgment is issued following deliberation and by unanimous decision of the members of the Tribunal, within the fifteen-day period established in Article 111.1 of the Administrative Litigation Procedure Code—this matter having been declared highly complex—with no grounds having been identified that could invalidate the proceedings.

CONSIDERING:
During the preliminary hearing held on 08 de junio de 2014, counsel for the claimant companies offered as new evidence a copy of the record of the hearing held in criminal proceeding No. 07-200009-0457-PE, in which the suspension of criminal proceedings subject to probation (suspensión del proceso penal a prueba) against Mr. Nombre111210 was approved in connection with the offense of embezzlement (peculado), arising from the removal and forgery of signatures on checks allegedly intended to pay for the claimants’ properties, for the purpose of proving that the property of which they were dispossessed was never paid for. Counsel also offered a survey plan (plano) of the purported property from the year 1953, arguing that this document could only have been conceptualized after the anticipated testimony (deposición anticipada) of Mr. Nombre111211. Opinion of this Collegiate Body. With regard to the well-established discretionary admission of evidence to assist in adjudication, the First Chamber of the Supreme Court of Justice has held that rejecting such evidence does not render the parties defenseless.
Among other judgments, the relevant portion of judgment number 547-F-2002, issued at sixteen hours on doce de julio de dos mil dos, is transcribed below: “(…) IV.- Numerous precedents of this Chamber, referring to evidence to assist in adjudication, have stated that such evidence belongs to the judge and not to the parties. Consequently, the decision to obtain it is discretionary for the judicial body, which may dispense with it without issuing any ruling whatsoever. Therefore, failure to rule on it is appropriate precisely because the evidentiary stage—during which the parties must prove the facts giving rise to their rights, as required by the rules governing the burden of proof—has already concluded; once that stage has been procedurally foreclosed, it is within the exclusive authority of the adjudicator to determine whether new evidence necessary for the proper resolution of the dispute should be added to the record.
Among many others, the following decisions may be consulted: 59, issued at 15:20 hours on 31 de mayo de 1996; 23, issued at 14:20 hours on 4 de marzo de 1992; 34, issued at 10:45 hours on 28 de mayo de 1993; and 83, issued at 14:40 hours on 22 de diciembre de 1993. (…)”. In further support of the foregoing, judgment number 29-1995, issued at fifteen hours and thirty minutes on veintidós de febrero de mil novecientos noventa y cinco, also handed down by the First Chamber, clarifies as follows: “(…) Among the judge’s powers to direct and organize proceedings is the authority to order evidence for better adjudication (prueba para mejor proveer) (Article 97, subsection 2, and Article 331 of the Code of Civil Procedure), when the evidence to be taken may have a decisive influence on the outcome of the proceedings (…). The essential feature of evidence for better adjudication is its optional or discretionary nature; the parties cannot demand it.
Ordering such evidence depends entirely on the initiative, prudence, and judgment of the judicial body, and consequently its denial does not render any party defenseless.” That said, this Chamber finds as follows: 1) Regarding the approval of the suspension of criminal proceedings subject to probation ordered in criminal case 07-200009-0457-PE against Mr. Nombre111210, to the detriment of the Board of Directors of Parque Nacional Manuel Antonio, it is admitted because it is evidence intended to complete the referenced criminal case file, which was offered as evidence at the appropriate procedural time. 2) Regarding the aforementioned survey plan, it dates from the year 1953. Accordingly, it is evidence that should have been submitted when the complaint was filed or with the reply to the answer to the complaint, pursuant to Article 70) of the CPCA; these are the two procedural opportunities for submitting evidence, since outside those two procedural opportunities only evidence concerning new facts arising after the filing of the action and the answer thereto is admissible. This is clearly not such a case, and the evidence is therefore rejected.
The following are deemed proven:
Ten-year possessory rights (derechos de posesión decenal) over real property, under conditions suitable for acquiring it by adverse possession (usucapirlos), form part of the holder’s estate and are subject to legal protection and transactions. According to the case law of the Constitutional Chamber (Sala Constitucional), the constitutional concept of property protects the lawful possessor (poseedor legítimo). For these purposes, there appears to be no objective reason justifying different treatment between unregistered and registered properties, and such treatment could raise constitutional concerns under the principles of reasonableness, private property, and equality. (To that end, the terms “privately owned lands” (“tierras de propiedad privada”) used in certain provisions must be understood broadly, as encompassing registered and unregistered property.) The issue therefore shifts to reliable means of proving those rights before the Administration.
It was noted supra that an information proceeding for perpetual remembrance (información ad perpetuam) does not satisfy the controls and safeguards of a possessory information proceeding (información posesoria), a special proceeding for proving possessory rights against third parties (Código Civil, arts. 267 y 479). 8) Regarding the appropriateness of compensation (indemnización) for the unregistered property that, according to survey plan (plano) P-451272-97, in the name of Los Curres S. A., is located within Parque Nacional Manuel Antonio, the following questions are raised for consideration, as general observations and reiterating the opinion issued by the Procuraduría in the Información para Perpetua Memoria before Notario Oscar L. Trejos Antillón for the direct purchase: 8.1) The inadequacy of the proceedings to substantiate the alleged possessory rights; 8.2) Nullity due to defects in the taking of testimonial evidence and the lack of specificity in the witnesses’ statements, which reveal such close ties to the parties who offered them as to cast doubt on their impartiality; 8.3) The Administración Forestal del Estado’s lack of knowledge of any effective acts of possession exercised by the applicants over the claimed property, at least during the last fourteen years, corresponding to the tenure of the Park’s current Administrator; 8.4) Contradictions regarding the registration and location of the property. 8.5) The fact that survey plan P-451272-97 states that the property is part of property 57241 of the Partido de San José, subdivided (segregada) from property 42112.
The former is depicted in survey plan P-123-66, which describes land “Owned by Compañía Bananera de Costa Rica” and places it outside Parque Nacional Manuel Antonio, at a considerable distance. In turn, survey plan P-451272-97 amended Placa19634, which describes a property “owned by Municipalidad de Aguirre (Hoy Municipalidad de Quepos), leased to Inversiones Lutz S.A.” 8.6) Moreover, a survey plan prepared unilaterally by one party and registered with the Catastro Nacional does not, by itself, prove possession, much less ownership, of real property. 8.7) The possible statute of limitations (prescripción) that would affect any potential right to compensation, pursuant to article 198 of the Ley General de la Administración Pública and the date of publication of the regulations that created and expanded the Park, depending on which regulation affected the property at issue. 8.8) The irregular and subjective delineation of the Public Zone (Zona Pública) boundary shown on survey plan P-451272-97...” (See images 729 through 763 of the digital judicial case file).
It could not be established:
In accordance with the claims set forth in the complaint and clarified at the preliminary hearing, logically ordered, the purpose of this action is to obtain a judgment:
Regarding this, it was stated: “(...) The legal protection and economic-legal value of possessory rights (derechos posesorios) over an unregistered parcel make their holder subject to the power of expropriation, on grounds of public interest and with prior compensation, in order to transfer them compulsorily to the State (...).” The “Ley de la Autoridad Reguladora de los Servicios Públicos,” in its article 79, and article 79 of the “Reglamento a la Ley General de Telecomunicaciones” (Decreto Ejecutivo número 34765-MINAET del 22 de setiembre de 2008) expressly stipulate that the right of possession (derecho de posesión) must be negotiated in the event of direct purchase, or expropriated in the event of compulsory acquisition. Likewise, “Ley indígena” No. 6172 recognizes the right of good-faith possessors within indigenous reserves to be relocated or expropriated in accordance with the Expropriations Law.
Article 317 of the Civil Code, for its part, states: “(...). A possessor, regardless of the nature of the possession, is also entitled to reclaim possession of which the possessor has been improperly deprived, and once restored to possession, the possessor shall be deemed, for purposes of acquisitive prescription (prescripción), never to have been dispossessed. Possession may not be taken violently, even by the person legally entitled to it; while the current possessor objects, it must be claimed through judicial proceedings.” Article 318 of the same body of law, in turn, provides: “...To be restored to the enjoyment of a right, it is sufficient for the possessor to prove the fact of possession and that the possessor was unlawfully deprived of it (...).” It is evident that the possession maintained by the plaintiffs over the disputed property cannot be improperly taken from them and that, in the event of a dispute, the matter must be resolved through judicial proceedings.
The possessory-information proceeding (proceso de información posesoria) filed by the plaintiffs before the Agrarian Court of Puntarenas was closed, and there was no opportunity to resolve the disagreement concerning possession of the property; nor, however, did the State acquire ownership through any of the procedures provided for in the legal system, namely expropriation or direct purchase. Consequently, the companies she represents were forcibly deprived by the State of their legitimate possession of the unregistered parcel described by the geometric figure contained in Cadastral Plan P-986592-2005, in the Province of Puntarenas, which locates it between geographic coordinates 371-373, north latitude, and 447-449 west longitude on the Quepas map sheet of the Instituto Geográfico Nacional. To date, the State has paid them neither the value of the land, nor the value of the improvements, nor the value of the timber.
The complaint should therefore be upheld, the State should be held liable for dispossessing them of the parcel and for failing to pay for possession of the parcel, the improvements, and the timber, and it should be ordered to pay costs, damages, and both categories of legal costs incurred in this action. At the supplemental trial hearing, Licenciado Fabián Volio Echeverría, representing the plaintiff companies, reiterated that the State incorporated the parcel described in plan P-986592-2005, which formed part of a larger property, into Parque Nacional Manuel Antonio without paying the compensation required by law. Don Nombre111213 bequeathed that parcel to don Nombre111214, and subsequent transfers were made until it reached the plaintiff companies. He stated that dispossession of those lands occurred in the 1990s. A case file was opened and an appraisal was communicated, but a problem arose with the cadastral plan because the surveyor stated that it concerned an unregistered parcel, even though their possession of the property and his clients’ right to compensation had already been recognized; nevertheless, an official of the Junta Administrativa cashed the checks earmarked for payment for the property.
From that point forward, the Procuraduría General de la República opposed payment for the property held in possession, even though case law recognizes the right to compensation for possessory rights. The possessory-information proceedings (diligencias de información posesoria) were initiated because the Procuraduría stated that an unregistered parcel could not be expropriated; however, once those proceedings had been brought, they were closed because the Procuraduría objected on the grounds that the parcel belonged to the State or the municipality, even though it had been used by the Lutz family for approximately 100 years or more. Regarding the notation on plan No. P.7434-72, the Municipalidad de Aguirre (Hoy Municipalidad de Quepos) was asked whether any file existed recording any type of lease agreement, and that Municipalidad replied that none existed, meaning that the property had never belonged to the municipality.
He concluded that the right to claim compensation was not time-barred because, over time, there had been actions that tolled the limitation periods, including express agreements recognizing the right to compensation, appraisals, and even the issuance of checks that were misappropriated to the detriment of his clients. The State cannot acquire title by adverse possession (usucapir), since it is obligated to compensate for any impairment of a property right such as the one at issue here, and plan P-986592-2005 was approved by the Municipalidad de Aguirre (Hoy Municipalidad de Quepos), thereby establishing that the parcel is not municipal property. Counsel for the State stated: A) REGARDING THE FACTS: The property described by the plaintiffs is land unregistered in the Public Registry and located within Parque Recreativo Nacional Playas Manuel Antonio, which was created in 1972. As the plaintiffs themselves acknowledge, possession of the property is held by the State.
The evidence submitted by the plaintiffs themselves shows that the alleged possession they exercised in the past was not exercised under a claim of ownership, but rather under a lease granted by the Municipalidad de Aguirre (Hoy Municipalidad de Quepos); accordingly, because it is public property, the deeds under which the listed persons and companies purportedly disposed of the parcel in question lack validity and legal effect. Expropriation would apply only to parcels that were privately owned. There is no evidence that the parties reached an agreement concerning the property and its price, and, moreover, an error does not create a right. The State purchased from the Lutz family two registered properties located within the Park, but the Agrarian Court, following the State’s objection, denied the possessory-information application through which the plaintiff companies sought to register the property at issue in this litigation; and the fact is that the plaintiff companies have not demonstrated possession of the property under a claim of ownership.
Pursuant to section 282 of the Civil Code, the fact of possession continues for as long as there is actual custody of the thing, enjoyment of the right, or the ability to continue possessing the thing; however, in the present case, the plaintiff companies did not demonstrate that they exercised possession over the property for which they now claim compensation. The fact is that, upon the creation of “Parque Recreativo Nacional Playas de Manuel Antonio” through Ley No. 5100 del 15 de noviembre de 1972, the property at issue in this litigation became part of that Park. It is therefore untrue that the plaintiffs could have exercised any possession over the property since setiembre de 1999, as they allege in the second fact of the complaint. Property of the Municipalidad de Aguirre (Hoy Municipalidad de Quepos): The plaintiff companies did not demonstrate that, at any time, they exercised possession of the referenced property as owners, as required by section 856 of the Civil Code.
On the contrary, the evidence submitted by the plaintiffs shows that possession was exercised by Inversiones Lutz—which later transferred it to Los Curres S.A., which in turn transferred it to the other plaintiff companies—as lessee of property belonging to the Municipalidad de Aguirre (Hoy Municipalidad de Quepos). This is expressly stated in cadastral plan No. Placa19634; and no one may unilaterally change the basis of possession, even through the passage of time. “(...) A person who actually holds a thing while recognizing another’s ownership is merely the custodian of the thing and the representative of the owner’s possession, even if occupation of the thing is based on a right. No one may unilaterally change the basis of possession, nor may it be changed through the passage of time. A person who began to possess in his own right and as owner of the thing continues to possess as such until it is proven that he began to possess on behalf of another.
A person who began to possess on behalf of another is presumed to continue possessing under the same title until the contrary is proven. Nor may the characteristics or defects of possession be changed by one’s own will or through the passage of time; possession always continues as it began (...), unless a new title of acquisition is created.” (Ramírez Granda. Diccionario Jurídico Edit Claridad. Buenos Aires. 6° edic., pg. 227). (Emphasis by underlining added.) If the possession allegedly exercised by the plaintiff companies—or by their transferors—was held as lessees, the possession alleged here could never have arisen. Public-domain property (bien de dominio público): Because the property belongs to a public entity, it would have the characteristics of all public-domain property (bien demanial), namely immunity from acquisitive prescription and non-transferability. Accordingly, the assignments or transfers of possession purportedly made to the plaintiff companies would be null and void by operation of law (article 1063 of the Civil Code), namely deed No. 26, executed at 10 horas del 4 de marzo de 1975—supplemented by No. 48, at 17 horas del 23 de junio de ese año—and No. 86, executed at 17 horas del 1o de setiembre de 1999.
Pursuant to the applicable legislation and case law, acts and agreements entered into by private parties concerning public-domain real property are absolutely void because of the nature of the property, the absence of valid title, and their conflict with prohibitory rules (Political Constitution, article 129, paragraph 4); General Public Administration Law, article 18.2; Civil Code, arts. 261, 262, 627, subsection 2), 629, 631, 835, 837, 844 1063; Court of Cassation, judgments Nos.
78-76 and 121-79; Procuraduría General de la República, opinions numbers C-197- 87, C-100-95 and C-157-95), as follows: “The conveyance of public-domain property (bien demanial) is absolutely null and void due to a total lack of subject matter: conveying public-domain property is legally as impossible as conveying something that does not exist and cannot exist (...).” (BlONDO BIONDI. Los bienes. Editorial Bosch-Urgel, Dirección6895 . . 1961, pp. 276-347). “(...) the rule of inalienability of public-domain property...is founded on the noncommercial nature of the public domain, which may not be disposed of while it remains dedicated to a public-purpose objective (...) when that rule is violated as such, that is, in cases of transfer to private parties pursuant to civil law, absolute nullity or nullity by operation of law is the appropriate sanction for contracts conveying public-domain property because of the lack of subject matter, given the noncommercial nature that characterizes such property.” (PARADA VAZQUEZ.
Bienes Públicos y Urbanismo. Editorial Marcial Pons, Madrid, 1988, pp. 88-89). Maritime-terrestrial zone (zona marítimo terrestre): The cadastral plan (plano catastrado) No. P-986592-2005, through which the plaintiff companies sought to prove possession of the property at issue in this litigation, improperly assigns the 200 meters of inalienable zone to Los Curres S.A., one of the plaintiff companies, disregarding the fact that, since the early nineteenth century, the maritime-mile strip has enjoyed public-domain protection under Law No. 162 of June 20, 1828, and that the General Code issued on July 30, 1841, provided that: “the ebb and flow of the sea, its shores, ports, coves, roadsteads, and generally all portions of the territory of the State that are not susceptible to private ownership shall be deemed to belong to the public domain.” and may not be acquired by prescription (articles 296 and 1535, first part, book II, title I, chapter III, and book III, title XXI, chapter IV).
For its part, Law No. 39 of August 31, 1868, article 1°, prohibited “claiming vacant lands located within a zone two thousand varas in width along the coasts of both seas.”, and similarly, Water Law No. 11 of May 26, 1884, article 20, provided: “The maritime-terrestrial zone, or the area along the coasts of the Republic washed by the sea during its ebb and flow, together with the immediately adjacent lands extending for a distance of one mile, is within the public domain.” This has been recognized by the Sala Constitucional and the Sala Primera de la Corte Suprema de Justicia: “(...) The public-domain status of the maritime-terrestrial zone (or seashore, as it was formerly called) has been recognized since time immemorial, and Roman law itself acknowledges that status as ‘res communes’ and ‘extra comercium.’ In our country, at least since the last century, the public character of that strip has been clearly recognized as an extension of State ownership over the marine zone adjacent to the national territory, over which it exercises sovereignty.
(...) Thus, anyone seeking through unauthorized means to exercise exclusive use of that zone will be barred from doing so, since it has also been accepted since time immemorial that such property cannot be acquired by private parties through prescription and is outside commerce. (...)” (Sala Constitucional, Voto No. 447-91 at fifteen hours thirty minutes on February 21, 1991). “(...) From this brief review of the legislation concerning the maritime-terrestrial zone, it is easy to conclude that the 200-meter strip measured from ordinary high tide along both coasts, defined as part of the maritime-terrestrial zone by article 9 of the current Law on the Maritime-Terrestrial Zone, has been within the public domain—and the lands contained therein have been public-domain property—since at least 1828. The changes introduced in this area by the legislation of the last century and the present one never generally removed these 200 meters from the public domain; rather, the legislation predating 1942 and 1943 established a wider strip—the so-called maritime mile—but never a narrower one.” (Sala Primera de la Corte Suprema de Justicia, Voto No. 7 at fifteen hours five minutes on January 20, 1993).
Easement (servidumbre) over public property: The cadastral plan No. P-986592-2005 describes access to the property as an easement over property No. 129484, registered in the name of El Estado, and these lands registered in the name of El Estado within Parque Nacional Manuel Antonio form part of the State Natural Heritage (Patrimonio Natural del Estado) (article 13, first paragraph, of the Ley Forestal) and, because of their public-domain status (inalienability, article 14 of the Ley Forestal), they cannot be encumbered in favor of private properties by that means: “The public domain consists of property that, by the express will of the legislature, has the special purpose of serving the community and the public interest. These are known as State-owned property, public-domain property, public things, or public property, which do not belong individually to private parties and are intended for public use and subject to a special regime outside human commerce.
In other words, they are dedicated to such use by their very nature and purpose. Consequently, such property belongs to the State in the broadest sense of the term, is dedicated to the service it provides, and that service is invariably essential by virtue of an express provision. Characteristic features of such property are that it is inalienable, not subject to acquisitive prescription, not subject to attachment, may not be mortgaged or otherwise encumbered under civil law, and administrative action replaces possessory injunctions (interdictos) for recovery of ownership. Because it is outside commerce, such property cannot be the subject of possession, although a right of use may be acquired, but not a property right. (...) In general, no fundamental right may be deemed violated when the purpose is to preserve the nature and use of public property; work, free trade, property, the objective assets of persons, and all other rights cannot be illegitimately imposed over and against the general interest by encumbering State property that forms part of the public domain.” (Sala Constitucional, Judgment No. 2306 at 14:45 hours on November 6, 1991).
Article 11 of the National Parks Service Law, No. 6084 of August 24, 1977, expressly prohibits the creation of easements in favor of private properties over lands subject to that management category, and section 7 of Law No. 5100, which created this national park, prohibits the creation of easements under which park lands constitute the servient estate (fundo sirviente). The cadastral plan No. P-451272-97, through which Los Curres S.A. initially sought to prove possession of the property in question, stated that it was part of the property registered in the San José Registry District, volume 1055, folio 147, number 57251, which raised serious doubts not only as to its location but also regarding the plaintiff companies’ alleged right of possession; consequently, the objections raised by the Procuraduría General de la República were valid, both in opposing the ad perpetuam memoriam proceedings (diligencias de información ad perpetuan memorian) and the possessory title proceedings (información posesoria) through which the plaintiff companies sought to prove possession of the property in question.
The statements made by the Procuraduría in Legal Opinion No. 046-2004 of April 16, 2004, reaffirmed through Opinion No. C-024-2006 of January 23, 2006, are well founded. Regarding the alleged dispossession of the property: As to the alleged forcible dispossession (desposesión forzoza) of the property by the State, the fact is that the plaintiff companies have not proven possession of the property in question. Contrary to what was alleged, all the case law cited in support of their claims clearly states that, for possession to be compensable, it must first be proven, a requirement that the plaintiff companies have not met in this case. Without prejudice to what was asserted as a preliminary defense, any rights that the plaintiff companies might have held over the property in question would be more than time-barred under article 198 of the General Law of Public Administration. Claimed damages (daños y perjuicios): Finally, as to the claim for damages, in the view of that State representation, it is likewise unfounded.
First, because the plaintiff companies have no right over the property in question. Second, because any possible rights are time-barred. And lastly, because the alleged damages do not meet the requirements of section 196 of the General Law of Public Administration. These arguments were reiterated at the supplemental trial hearing. The representation of the Junta Directiva del Parque Recreativo Manuel Antonio stated: A) REGARDING THE FACTS: The property described is land not registered in the Public Registry, located within the current boundaries of Parque Nacional Manuel Antonio, which was created in 1972. As the plaintiff companies acknowledged, possession of the property is held by the State, and the alleged possession exercised in the past was not held as owner but under a lease granted by the Municipalidad de Aguirre (Hoy Municipalidad de Quepos); because the property is public property, the instruments through which the persons and companies identified in the statement of facts purported to dispose of the property in question lack validity and legal effect.
Expropriation would apply only to properties under private ownership, which is not the case here because this is State-owned property. There is no record that, with respect to the property at issue in this litigation, the parties reached an agreement regarding the property and its price; in any event, an error does not create a right, much less over public-domain property. The State did indeed purchase from the Lutz family two properties located within Parque Nacional Manuel Antonio; with respect to the property at issue in these proceedings, the Agrarian Court, following opposition by the State, denied the possessory title proceedings through which the plaintiff companies sought to register the property at issue in this litigation, and the plaintiff companies have not demonstrated in any manner or by any reliable evidence that they possessed the property as owners. Every request for the purchase of land is processed through the ordinary formal procedure; after the technical review process, the purchase is either recommended or not recommended, and payment is then made.
The request submitted by the plaintiffs was processed, but because payment was improper, as the property belonged to the State and was not eligible for title registration, neither SINAC nor the Trust of the Junta Directiva del Parque Recreativo Nacional Playas de Manuel Antonio, whose settlor is MINAET, made any payment for it; this is confirmed by the judgment in the possessory title proceedings processed under expediente No 06-160028-642-AG before the Juzgado Agrario de Puntarenas. Regarding the criminal proceeding referenced by the plaintiff companies’ representation, that representation stated that a criminal proceeding was indeed being processed at the request of that Board; it clarified, however, that it was not true that the money involved had in any way been allocated by either SINAC or that Board to purchase the property under dispute here.
“Because they are outside commerce, these assets cannot be the object of possession, although a right of use may be acquired, but not a right of ownership (...)” (emphasis not in the original). From that perspective, because of their legal nature, public-domain property (bienes de dominio público) cannot be owned, possessed, or appropriated by private parties, whether gratuitously or for consideration; they cannot be lost through prescription; nor can they be acquired by adverse possession (usucapión); their designated purpose cannot legally be altered; nor may they be used for a purpose other than that established by the legal system, and the State is responsible for their protection and administration on behalf of the public interest. Accordingly, use by third parties shall not create any right in their favor, and the plaintiffs are legally barred from making private use of assets designated as public-domain property.
Consistent with the foregoing, constitutional case law has clearly established that the special protection provided by the legal system for public-domain property applies to the Natural Heritage of the Nation (Patrimonio Natural de la Nación), taking into account that such heritage helps to safeguard the inhabitants’ fundamental rights to a better quality of life, within the context of the fundamental right to a healthy and ecologically balanced environment, as provided under domestic law and the international instruments ratified by the country. In this regard, see Constitutional Chamber judgments No. 2003-03840 of 14:02 hours on 02 de mayo del 2003 and No. 05266-2009 of 12:24 hours on 27 de marzo del 2009, among others. With the enactment of Ley Forestal number 7575 of 13 de febrero de 1995 and other bodies of law, our legal system developed the provisions set forth in the Constitución Política and instruments of International Law for the protection and safeguarding of the State Natural Heritage (Patrimonio Natural del Estado), establishing the inviolability (intangibilidad) of protected wildlife areas (áreas silvestres protegidas).
Such is the case with the provisions of Articles 13 and 14 of the aforementioned Law: “ARTICLE 13.- Establishment and administration The State Natural Heritage shall consist of the forests and forest lands of national reserves, areas declared inalienable, properties registered in its name, and those belonging to municipalities, autonomous institutions, and other agencies of the Public Administration, except for real property securing credit transactions with the National Banking System and incorporated into its assets (...)”. “ARTICLE 14.- Non-attachable and inalienable status of the Natural Heritage The forest lands and forests constituting the State Natural Heritage, detailed in the preceding article, shall be non-attachable and inalienable: their possession by private parties shall create no right in their favor, and the State’s action to recover such lands is not subject to any statute of limitations.
Consequently, they may not be registered with the Public Registry through possessory information proceedings (información posesoria), and both their invasion and occupation shall be punished in accordance with this law.” 2. REGARDING THE STATE NATURAL HERITAGE: The Constitutional Chamber’s case-law development has established that the Natural Heritage consists of two components: 1) Protected Wildlife Areas (regardless of their management category) declared by Law or Executive Decree; understood to include forest reserves, protective zones, national parks, biological reserves, national wildlife refuges, wetlands, and natural monuments, pursuant to the regulations set forth in Articles 1, 2, and 3 subsection i) of Ley Forestal; 32 of Ley Orgánica del Ambiente; 22, 28, and 58 of Ley de Biodiversidad; 3 subsections d) and f) of Ley del Servicio de Parques Nacionales; and 3, 7, 17, and 82 subsections a) and b) of Ley de Conservación de la Vida Silvestre. 2) The Natural Heritage consists of the other forests and forest lands or lands suitable for forestry (aptitud forestal) belonging to the State and public institutions (Article 13 of Ley Forestal), which are subject to an immediate legal designation (afectación legal inmediata).
Regarding the components comprising the Natural Heritage, in judgment number 2003-03840 of 14:02 hours on 02 de mayo del 2003, the Constitutional Chamber stated: (...) According to the classification established by environmental regulations, the State’s forest or natural heritage consists of forest reserves, biological reserves, protective zones, wildlife refuges, wetlands, and natural monuments (Article 2 of Ley Orgánica del Ambiente, number 7554, of dieciocho de setiembre de mil novecientos noventa y cinco) (...) Thus, it is clear that the Costa Rican legal system affords special and heightened protection to property designated for public use or enjoyment, and imposes even greater safeguards when regulating public environmental property (...)”. (Emphasis not in the original). As can be seen, protected wildlife areas are incorporated into the Natural Heritage of the Nation regardless of their management category (whether national parks, biological reserves, forest reserves, national wildlife refuges, protective zones, natural monuments, or wetlands), a legal status that is also enshrined in Articles 35 and 38 of Ley Orgánica del Ambiente, in which the legislature generally regulated the objectives governing the establishment, administration, and oversight of Protected Wildlife Areas.
Likewise, when lands covered by any of the specified management categories are under the administration and/or protection of a public entity, they shall automatically become part of the State Natural Heritage, as provided in Articles 13 and 14 of Ley Forestal. Consequently, the assets comprising the State Natural Heritage likewise possess the characteristics inherent to public-domain property: exemption from prescription (imprescriptibilidad), inalienability (inalienabilidad), and immunity from attachment (inembargabilidad). Regarding the maritime-terrestrial zone (zona marítimo terrestre), it stated that Ley number 6043 of 02 de marzo de 1977 establishes that the Zona Marítimo Terrestre (ZMT) forms part of the national heritage, belongs to the State, and is inalienable and not subject to prescription. Accordingly, pursuant to the legal system, it is clear that forest lands, lands suitable for forestry (including those identified within the ZMT), and Protected Wildlife Areas are part of the State Natural Heritage—whose protection is the obligation of the State and its institutions—and that their administration falls to the Ministerio de Ambiente, Energía y Telecomunicaciones through the Sistema Nacional de Áreas de Conservación, pursuant to Article 22 of Ley de Biodiversidad; therefore, forest areas, lands suitable for forestry, wetlands, or lands forming part of any Protected Wildlife Area are part of the State Natural Heritage and consequently possess the characteristics of public-domain property. 3.
REGARDING THE SURVEY PLAN SUBMITTED: As stated in the response to the first factual allegation of the complaint, the surveying and registration of plans with the Catastro Nacional do not, by themselves, prove possession or ownership of land, nor that the asserted real rights (derechos reales) have been exercised over it, as held by the Sala Primera de la Corte Suprema de Justicia in judgments 06-F-90 of 15:40 hours on 10 de enero de 1990; 56-94 of 13:50 hours on 04 de agosto de 1994; and 66-94 of 14:45 hours on 17 de agosto de 1994. The same follows from the regulations set forth in Articles 301 of Código Civil and 57 of Reglamento a la Ley del Catastro Nacional. 4. INADMISSIBILITY OF THE CLAIM: i) POSSESSION NOT PROVEN: Although the legal system recognizes the right of possession independently of the right of ownership (Articles 277 et seq. of Código Civil), for the right of possession to be protected by the legal system, it must have been acquired in one’s own right, as owner, and lawfully, as required by Articles 280 and 856 of Código Civil.
Where a right of possession is asserted within a protected wildlife area, regardless of its class or category, Article 7 of “Ley de informaciones Posesorias” requires the applicant for title (titulante) to prove legal rights arising from ten-year possession (posesión decenal), exercised for at least ten years before the effective date of the law or decree creating that wildlife area; the plaintiffs have not established such ten-year possession prior to 15 de noviembre de 1972, the date on which the park was created. In view of the provisions of that article, it is clear that, upon the creation of Parque Recreativo Nacional Playas de Manuel Antonio by Ley No. 5100 of 15 de noviembre de 1972, the property at issue in this litigation became part of that Park; therefore, it is not true that the plaintiffs could have exercised any possession over that property since setiembre de 1999, as they assert in the second factual allegation of the complaint.
Because the property therefore belongs to a public entity, it possesses the characteristics of all public-domain assets (bienes demaniales), namely, exemption from prescription, inalienability, and immunity from attachment, particularly considering that, pursuant to Articles 13 and 14 of Ley Forestal, because it belongs to the Municipalidad, the property forms part of the State Natural Heritage. Accordingly, any assignments or transfers of the right of possession granted to the plaintiff companies would be null and void by operation of law (nulos de pleno derecho) (Article 1063 of Código Civil), namely, deeds No 26, executed at 10 hours on 4 de marzo de 1975—supplemented by No 48, at 17 hours on 23 de junio de ese año—and No. 86, executed at 17 hours on 01 de setiembre de 1999. Legislation and case law have repeatedly held that acts and agreements entered into by private parties concerning a tract of public-domain real property are absolutely void because of the nature of the asset, the absence of valid title, and their contravention of prohibitory rules.
(See Constitución Política, Article 129, paragraph 4); Ley General de la Administración Pública, Article 18.2; Código Civil, Arts. 261, 262, 627, subsection 2), 629, 631, 835, 837, 844 1063; Sala de Casación, judgments Nos. 78-76 and 121-79; Procuraduría General de la República, opinions numbers C-197-87, C-100-95 and C-157-95). Furthermore, the evidence submitted by the plaintiffs shows that the alleged possession was exercised by the company Inversiones Lutz—which subsequently transferred it to Los Curres S.A., and the latter to the plaintiff companies—but according to registered survey plan No. Placa19634, submitted by the State’s counsel, such possession was exercised by Inversiones Lutz as lessee of property belonging to the Municipalidad de Aguirre (Hoy Municipalidad de Quepos). If the possession allegedly exercised by the plaintiff companies—or by their transferors—was held as lessee, the right of possession could never have arisen and, therefore, the claim is inadmissible.
That registered cadastral survey (plano catastrado) number P-986592-2005, by means of which the plaintiff companies sought to establish possession (posesión) of the property at issue in this litigation, improperly and unlawfully assigns the 200 meters of the inalienable zone (zona inalienable) to the commercial organization Los Curres S.A., one of the plaintiff companies, disregarding the fact that, since the beginning of the nineteenth century, the maritime-mile strip has enjoyed public-domain protection (protección demanial), and that Article 11 of the Ley del Servicio de Parques Nacionales, number 6084 of 24 de agosto de 1977, expressly prohibits the establishment of easements (servidumbres) in favor of privately owned properties on lands subject to that management category (categoría de manejo). That, accordingly, the claim for damages (daños y perjuicios) is also without merit. These arguments were reiterated at the supplemental trial hearing (audiencia complementaria de juicio).
According to the theory of the case presented by counsel for the plaintiff companies in their complaint and on the basis of which the present dispute was joined, counsel for the plaintiffs asserted that within the boundaries of Parque Nacional Manuel Antonio there is a property not registered with the Registro Nacional, the area, location, and boundaries of which are described in cadastral plan (plano catastrado) No. 986592-2005. They asserted that this property was acquired by Mr. Nombre111213, who conducted an agricultural activity consisting of logging and banana cultivation. They stated that Mr. Nombre111213 subsequently transferred it to his son, Herman Lutz Salazar, who continued using it for cattle ranching and logging. They further stated that, in mid-1975, Mr. Lutz Salazar transferred it to the company "Inversiones Lutz S.A.," which contributed it as capital upon the incorporation of Los Curres, which ultimately distributed it in equal shares among the plaintiffs.
They maintained that, when the State created Parque Nacional Manuel Antonio, it included this property within the Park’s area, dispossessing their principals of the property through de facto action (vías de hecho), and that although it agreed to pay the affected parties, in their case they were never paid the corresponding amount. This omission continues to date. They alleged that the actions of the Costa Rican State contravene Article 45 of the Constitución Política, which guarantees prior compensation for private property in the event of deprivation. They asserted that they would prove that ownership of that property belongs to the plaintiff companies and that, consequently, for it validly to become part of the Park, compensation must be paid in accordance with the law. The plaintiff companies further asserted that they are lawful possessors of an unregistered property and that the right of possession over an unregistered property must be regarded as a property right in cases of compulsory acquisition by the State.
They also asserted that the Sala Constitucional has recognized in its judgments that, when the State must compulsorily acquire real property, both the right of ownership in the strict sense—that is, ownership of properties registered in the land registry—and the right of possession over unregistered properties are equally compensable. This was established in judgment 2006-18443 at 10:24 on December 22, 2006. Likewise, they cited judgment No. 17410-2009 of that same Chamber, issued at 11:13 on November 17, 2009, from which it follows that economic compensation would be warranted if possession had been held in good faith before the issuance of the Decree. They stated that, along the same lines, the Contentious-Administrative Courts have also held that, for the purpose of ordering protective measures and compensation for damages, the right of ownership or possession over the property must be established.
They further stated that the Procuraduría General de la República, in its Opinion C-097-1994 of June 13, 1994, confirmed that payment for forested portions was appropriate when the State purchased unregistered properties. In conclusion, according to counsel for the plaintiff companies, the compensation that the State must provide when it deprives the possessor of an unregistered property of the right of possession must be similar to the prior compensation required by Article 45 of the Constitución Política in cases involving the expropriation (expropiación) of a registered property. Thus, for compensation purposes, the right of ownership—in the strict sense, that is, over real property legally registered in the Registro Público—is equated with a right of possession duly established in accordance with the law over an unregistered property—when the taking is carried out by the State in the exercise of its sovereign powers, such as through expropriation or dispossession of the right of possession.
In view of the foregoing, it is appropriate to clarify what the concepts of the rights of ownership and possession entail under Costa Rican law and case law. With respect to the right of ownership, Article 45 of the Constitution provides: “Property is inviolable; no person may be deprived of his or her property unless a legally proven public interest exists and prior compensation is paid in accordance with the law. In the event of war or domestic unrest, prior compensation is not required. Nevertheless, the corresponding payment shall be made no later than two years after the state of emergency has ended. For reasons of public necessity, the Asamblea Legislativa may, by a vote of two-thirds of all its members, impose limitations on property in the social interest.” The cited article not only guarantees the private property of citizens but also enshrines its inviolability as a guarantee that the State will not arbitrarily deprive citizens of their property and that they may be deprived of it only in cases of proven public interest and upon prior compensation.
Accordingly, in Costa Rica, property, as the holder’s subjective, exclusive, and exclusionary right, receives constitutional protection safeguarding citizens’ individual rights. This is a constitutional rule that the State may not validly disregard, provided that the citizen satisfies the conditions under which the law grants that right. Nevertheless, it is well known that the right of ownership is not absolute and yields in certain circumstances, such as where the public interest is involved, subject to the safeguard that the holder of the right must be compensated in such cases. The Código Civil regulates the concept of ownership and establishes 2 types: public and private. The former belongs to the State in the broad sense and enjoys special protection because of its purposes; its most significant or representative characteristic is that such property cannot be acquired by private parties through acquisitive prescription (prescripción positiva), is not subject to attachment, and is generally inalienable—that is, it is outside private commerce.
Thus, Article 261 provides, insofar as relevant, that public property or things are those permanently allocated by law to a service of general utility and those made directly and immediately available for public use, while all other things are private and subject to private ownership. With respect to public property, Article 262 of the same body of law provides that public things are outside private commerce—that is, they are inalienable—until they are declassified by law from the use or service to which they are allocated. Moreover, regarding the incidents of ownership (dominio) in general, Article 264 of the C.C. states that ownership or absolute bare ownership (nuda propiedad absoluta) of a thing comprises the following rights: 1. Possession. 2. Usufruct. 3. Transformation and alienation. 4. Defense and exclusion. 5. Restitution and compensation; and Article 267 requires that, for ownership of real property to have full legal effect, the property must be registered in the Registro Público.
Along the same lines, Article 455 states that instruments subject to registration that have not been registered shall not be effective against third parties until the date on which they are submitted for registration. Regarding the right of possession as an incident of the right of ownership, this right is defined as a person’s authority to hold under his or her control and will the thing that is the object of the right (Article 277 of the C.C.). As to its origin, Article 279.2 of the C.C. provides that the right of possession is acquired independently of the right of ownership and that one basis for its acquisition is maintaining possession of the property for more than one year, provided that, in accordance with the requirement of Article 284, possession of the property is held in good faith. As for claims by a good-faith possessor, Article 328 of the C.C. identifies the items for which that person is entitled to compensation.
With respect to compensation, there can be no doubt that it is warranted in cases involving expropriation of absolute ownership or of any of its incidents considered individually, such as the right of possession over unregistered real property. Regarding this type of compensation, the Sala Primera has held: “...The institution of expropriation is justified because the right of ownership is not absolute. On the contrary, in addition to being a subjective right, it must satisfy collective needs and public interests. Expropriation does not alter the general property regime; it is inherent in it because, when a public interest imposes a sacrifice upon a private party, that sacrifice must be minimized by compensating the private party with an equivalent value...” (See Voto No. 116-92 of the Sala Primera). Regarding the scope of expropriation, that Chamber stated in Voto No 266 at 16:20 on December 18, 1992: “...V.
Etymologically, the term derives from ‘ex’ and ‘propio.’ It means deprivation of property; that is, it is an act of compulsory divestment (acto ablatorio) concerning a right held over an object. Therefore, in legal systems in which property is a constitutionally guaranteed fundamental right, as in Costa Rica, expropriation is permissible only in the cases provided for by law, and the power to expropriate is conferred exclusively upon public authorities. In a very general sense, expropriation is any compulsory or coercive acquisition of the right of private ownership or any of its incidents...” (emphasis added). Expropriation and the corresponding compensation are thus understood to apply not only to the right of ownership in the strict sense—that is, absolute ownership registered in the land registry, together with all of its incidents—but also potentially to dispossession by the State of one or more of the incidents encompassed by the concept of ownership, such as the right of possession, pursuant to the applicable legislation, provided that this right was established publicly, peacefully, and in good faith and was timely asserted, likewise in accordance with the applicable law.
It must be borne in mind that, pursuant to Ley N° 139 of July 14, 1941, Ley de Informaciones Posesorias, Article 1 provides: “A possessor of real property who lacks an instrument registered or eligible for registration in the Registro Público may request that one be granted in accordance with the provisions of this law” (emphasis not in the original), while Article 16 of the same body of law reads as follows: “Ownership acquired under this law becomes definitively vested against third parties after three years, calculated from the date on which the respective instrument is registered in the Registro Público, since the extinctive prescription (prescripción negativa) of an action by third parties who may be affected is limited to that period.
/ This period shall be reduced to one year solely for the purpose of applying for and obtaining loans from agencies of the Sistema Bancario Nacional or the Instituto Nacional de Vivienda y Urbanismo” (emphasis not in the original); thus, whereas previously there is only possession (posesión), subject to certain conditions that must be met, it is clear that ownership (dominio), with all its attributes, is acquired under this Law only upon proof that all the requirements established for that purpose have been satisfied. One requirement in particular, set forth in Article 6, is proof of possession, as follows: “Possession shall be established through the testimony of three witnesses who reside in the canton where the property is located. They shall be questioned as to how long they have known the property; whether they know that the applicant for title (titulante), or prior owners, has possessed it for a continuous period of no less than 10 years; whether such possession has been open, peaceful, and exercised as owner; and what acts such possession has consisted of.
Likewise, the Judge shall question the witnesses, ex officio (de oficio) or at the request of a party, regarding any other information deemed relevant to proving possession. All of the foregoing shall be conducted without the need for questions previously submitted by the interested party.” (Emphasis not in the original).
Counsel for the plaintiff companies requested a judgment declaring the right of possession (derecho de posesión) that they claimed to hold over the real property (inmueble) described in survey plan No. P-986592-2005, located in the district of Quepos, Canton of Aguirre, province of Puntarenas, between geographic coordinates 371-373 North latitude and 447-449 West longitude on the Instituto Geográfico Nacional map sheet, consisting of regenerating forest, secondary forest, scrubland, and dense brush; with an area of 155 hectares, 1995 meters and 53 square decimeters, and the following current boundaries: North: the State, Parque Nacional Manuel Antonio, and Río Naranjo, S.A.; South: Zona Marítimo Terrestre and the Pacific Ocean; East: the State and Parque Nacional Manuel Antonio; West: the State and Parque Nacional Manuel Antonio, Los Tepezcuintes S.A., Carlos Hidalgo Cárdenas, and Daniel Sanahan Sanahan.
The plaintiff companies asserted that this possession was originally exercised by Mr. Nombre111213, who subsequently transferred it to Mr. Herman Lutz Salazar, who in turn transferred it in mid-1975 to the family company “Nombre111208 .”; that company transferred it to the company known as “Los Currés, S.A.,” which in turn “subdivided” (segregó) it into five properties and transferred them in equal shares to the plaintiffs, who claimed to have exercised possession since September 1999 quietly, publicly, peacefully, and as owners. They stated that, when aggregated among all possessors, such possession exceeds 100 years. They requested that, once their right of possession over the property had been declared, the defendants be ordered to answer for having engaged in a physical act (actuación material), or unlawful administrative action (vía de hecho), by dispossessing them of the property without a valid and effective administrative act (acto administrativo) and without prior compensation, as guaranteed by Article 45 of the Constitution, and consequently that the defendants be ordered to pay them the pecuniary damages specified in their complaint.
The defendant institutions, for their part, opposed the complaint, stating, insofar as relevant, that Mr. Nombre111213 did not acquire a right of possession over the property described in plan Placa19634, because the property belonged to the Municipalidad de Aguirre (now Municipalidad de Quepos), and therefore no such right could arise over property owned by a State institution. They further contended that the plaintiffs had not proven that they exercised a right of possession over the property and that, in any event, following the enactment of Law No. 5100 of 30 October 1972, which created the park, no right of that kind could arise over property forming part of the “Patrimonio Natural del Estado.” Opinion of the Chamber: It must therefore be determined whether the plaintiffs held a right of possession over the property described in survey plan No. P-986592-2005 under the conditions they asserted; namely, that it originated with Mr.
Nombre111213, who transferred it to Mr. Herman Lutz Salazar, who in turn transferred it to the family company “Nombre111208 .” in mid-1975, and that company transferred it to the company known as “Los Currés, S.A.,” which in turn subdivided it into five properties and, on 01 September 1999, transferred them to the plaintiffs in 5 equal shares. Only if that status is confirmed will the merits of their claims, as pleaded, be examined. A contrario sensu, if the existence of the alleged right is not proven, the claims asserted would be examined as unnecessary. As to the property described in plans P-7434-1973 and P-986592-2005, it is established that the property is physically located within the boundaries of Parque Nacional Manuel Antonio. This circumstance was confirmed at trial by Engineers Christian Stanley Chacón Barquero and Nombre111209. There can therefore be no doubt that the property over which the plaintiffs claim a right of possession forms part of a National Park.
As to the creation of Parque Nacional Playas de Manuel Antonio, the Costa Rican Legislature provided as follows in Law No. 5100, entitled “Ley de Creación del Parque Recreativo Nacional Playas de Manuel Antonio,” dated 30 October 1972: “The area lying within the following boundaries, according to the 1:50.000-scale base maps of the Instituto Geográfico Nacional, is hereby declared Parque Nacional Manuel Antonio: beginning at a point located on the beach between coordinates 371.000 N NIE22, it continues on a N 45° E bearing for a distance of 250 meters to a point located at coordinates 371.15 N NIE74; it then continues along coordinate 447.200 E due North to Camaronera Creek, following it upstream until reaching coordinate 372.000 N. It then continues along a straight line on a S 50° E bearing until reaching coordinates 371.000 N NIE75. From this point, it continues along coordinate 371.000 N due East until reaching coordinates 371.000 N NIE76.
From this final point, it continues along coordinate 449.650 E due South until reaching the coast. The islands located off this demarcated area, including Isla Magote and those located off Playa Espadilla, as well as the territorial waters to their full extent, are considered part of this National Park.” Thus, as of 30 October 1972, the Costa Rican State, exercising its sovereign powers (potestades de imperio), determined that the lands located within the specified coordinates constituted public-domain property (bien de dominio público) and, as such, were subject to special protection or a special relationship of subjection (relación de sujeción especial). As to the nature of such property, as stated supra, Article 261 of the Civil Code provides: “Public property consists of things that, by law, are permanently allocated to any service of general public benefit, and those from which everyone may benefit because they have been made available for public use....” Thus, in the case before us, the lands comprising Parque Nacional Manuel Antonio, by the Legislature’s will, became public property subject to special protection, since Article 262 of the same body of law states: “Public property is outside the stream of commerce; it may not enter it unless so provided by law, by removing it from the public use for which it was intended.” Accordingly, when the ordinary Legislature designated the lands comprising Parque Nacional Manuel Antonio on 30 October 1972, this meant by operation of law that, from that date onward, those lands were withdrawn from commerce, such that no person could claim a validly acquired ownership or possession right after Law No. 5100 entered into force.
Another important point to consider is the purpose for which the properties covered by the legislative decree were withdrawn from commerce: the creation of a “National Park.” In addition to the protection granted to public-domain property by Article 262 of the Civil Code, National Parks, as part of the Patrimonio Natural del Estado, enjoy additional protection under environmental legislation. In safeguarding the environment, the Costa Rican State provided in Article 18 of “Ley Forestal ” No. 4465 of 25 November 1969 that: “The Patrimonio Forestal del Estado consists of National Reserves, Forest Reserves, National Parks, State Forest Nurseries, Protection Zones, and Biological Reserves.” Accordingly, the lands located within the boundaries established by Law No. 5100 as part of Parque Nacional Manuel Antonio became subject to enhanced protection because they formed part of the “Patrimonio Forestal del Estado.” Law No. 7174, “Ley Forestal,” of 28 June 1990, in turn stated in Article 32: “The State’s forest estate consists of all forests and forest lands within national reserves and areas declared inalienable, properties registered in its name, and properties belonging to municipalities, autonomous institutions, and other agencies of the Public Administration.” Article 33), in turn, provides: “The forest lands and forests constituting the State’s forest estate, as specified in the preceding article, shall be immune from attachment (inembargables) and inalienable (inalienables); their possession by private parties shall create no right in their favor, and the State’s action for recovery of these lands (acción reivindicatoria) shall not be subject to limitation (imprescriptible).
Consequently, they may not be registered in the Public Registry through possessory-title proceedings (información posesoria); their encroachment and occupation shall be punished in accordance with this law on land suitable for forestry and shall automatically be incorporated into the State’s forest estate.” Finally, “Ley Forestal” No. 7575 of 16 March 1996 provided in Article 13): “Establishment and administration. The State’s natural heritage shall consist of the forests and forest lands within national reserves and areas declared inalienable, properties registered in its name, and properties belonging to municipalities, autonomous institutions, and other agencies of the Public Administration, except for real property securing credit transactions with the Sistema Bancario Nacional that becomes part of its assets. The Ministerio del Ambiente y Energía shall administer the heritage. Where appropriate, through the Procuraduría General de la República, it shall register the lands in the Registro Público de la Propiedad as individually identified properties owned by the State.
Non-governmental organizations that acquire real property containing forest or suitable for forestry using funds from donations or the treasury obtained on behalf of the State must transfer such property into the State’s name.” And Article 14): “Status of the natural heritage as immune from attachment and inalienable. The forest lands and forests constituting the State’s natural heritage, as specified in the preceding article, shall be immune from attachment and inalienable; their possession by private parties shall create no right in their favor, and the State’s action for recovery of these lands shall not be subject to limitation. Consequently, they may not be registered in the Public Registry through possessory-title proceedings, and both their encroachment and occupation shall be punished in accordance with this law.” Thus, “Ley Forestal ” No. 4465 of 25 November 1969 and its amendments under Law No. 7174 and Law No. 7575 afforded special protection to the Patrimonio Forestal del Estado, and that protection extended to the lands included within Parque Nacional Manuel Antonio by express provision of Law No. 5100, such that after 30 October 1972 no private party may claim a right—such as possession or ownership—validly acquired over those properties.
Subsequently, to avoid adversely affecting good-faith possessors (poseedores de buena fe) in these areas, the Legislature enacted “Ley de Informaciones Posesorias” No. 5257 of 31 July 1973, Article 7 of which provides: “When the property concerned in the proceedings lies within a protected wildlife area (área silvestre protegida), regardless of its management category, the applicant for title (titulante) must demonstrate that he or she holds the legal rights arising from ten-year possession (posesión decenal), exercised for at least ten years before the effective date of the law or decree that created that protected wildlife area....” Thus, although no person may claim a right of ownership or possession arising after the State, by law or decree, designates the property by incorporating it into the Patrimonio Natural del Estado, that person may claim possession exercised beforehand under the terms prescribed by the cited article.
Accordingly, the interested party must prove that possession was exercised for at least 10 years before the date on which the protected wildlife area was created. Regarding this requirement, the First Chamber, in its decision No.
001485-F-S1-2017, issued at 09:25 hours on 30 de noviembre de 2017, stated: “...V.- First, this Chamber must clarify that cadastral plans (planos catastrados) A-241056-1995, A-591564-1999, A-656768-2000, A-656769-2000 (the subject of this proceeding for a declaration of injury to the public interest (proceso de lesividad)) are indeed located within Reserva Biológica Alberto Manuel Brenes (San Ramón), which, since 20 de junio de 1975, was declared a protected area (zona protegida) by Decreto Ejecutivo N° 4960-A. Consequently, they form part of the State’s natural heritage (patrimonio natural del Estado), pursuant to sections 13 of the Ley Forestal and 32 of the Ley Orgánica del Ambiente. In this regard, it should be recalled that, under section 13 of the Ley Forestal, ‘The State’s natural heritage shall consist of the forests and forest lands (terrenos forestales) of national reserves, areas declared inalienable, properties registered in its name, and properties belonging to municipalities, autonomous institutions, and other bodies of the Public Administration, except for real property securing lending transactions with the National Banking System that becomes part of their assets....’ Among the situations contemplated, the statutory mandate is clear in establishing that property covered by forest and forest lands within national reserves forms part of the State’s natural heritage.
Having clarified the foregoing, it is necessary to note the provisions of section 47 of Decreto Ejecutivo 13607, Reglamento a la Ley del Catastro Nacional, in force at the time of the events: ‘ARTICLE 47.- The National Cadastre shall not register plans of private properties located within any type of reserve or national park, except where authorization has been granted by the corresponding entity. In such cases, it shall be clearly noted that the property is located within a reserve or national park, and the restrictions to which it shall be subject by law shall also be indicated. This authorization must appear on the plan.’ This mandate is reproduced in section 80 of the current Reglamento a la Ley del Catastro Nacional no. 34331. That prohibition against registering in the National Cadastre plans of land located in protected wilderness areas (áreas silvestres protegidas) is a consequence of the inalienability of the State’s natural heritage, which constitutes public-domain property (bien de dominio público).
Likewise, for reasons of public interest, the State is responsible for acting as guardian of the public domain (policía demanial), ensuring the protection, conservation, and custody of natural areas and species. In performing this function, there is no doubt that national legislation, through its various environmental provisions, has granted the State the power to prohibit, restrict, or limit certain human activities or to make them subject to the prior issuance of a permit or authorization, as occurs under the aforementioned section 47. In this particular case, when each of the challenged endorsements (visados)—declared injurious to the public interest by MINAE—was granted, the State knew that Reserva Biológica Alberto Manuel Brenes had been established on the lands described in those plans. In other words, those plans were prepared for property that is immune from attachment, not subject to acquisitive prescription, inalienable, and outside the stream of commerce.
In view of those circumstances, regardless of the possession alleged by the occupants of those lands, authorization should not have been granted unless, for some reason, they alleged and demonstrated a superior right of possession predating the creation of the reserve, as provided in section 7 of the Ley de Informaciones Posesorias. That section provides as follows: ‘ARTICLE 7º.- When the real property to which the proceeding pertains lies within a protected wilderness area, regardless of its management category, the person seeking title must demonstrate that he or she holds legal rights arising from ten-year possession (posesión decenal), exercised for at least ten years before the effective date of the law or decree by which that wilderness area was created.... Without exception, cadastral plans submitted in possessory-title proceedings (diligencias de información posesoria) must be certified by the Ministerio del Ambiente y Energía through the responsible entity, which shall certify whether the property for which title is sought is located inside or outside those protected wilderness areas.’ This is the legal context within which this authorization operates, and it is therefore understood that, if such an endorsement is requested, it is because the interested party has ten-year possession exercised for at least 10 years before the effective date of the law or decree by which the wilderness area was created.
Allowing private parties to request the registration of plans for public-domain property, particularly forest property, without demonstrating that they possessed the property for 10 years before the protected wilderness area was created would undermine the inalienability of such lands and subject them to private discretion, with all that this entails, including the acquisition of benefits or title to property or, in the worst case, irreparable environmental damage. Hence, an administrative procedure prior to the registration of plans located within any type of reserve or national park was devised under the designation ‘authorization.’ It should be noted that the general rule is: ‘The National Cadastre shall not register plans of private properties located within any type of reserve or national park....’ This Adjudicating Body reiterates that the endorsement as authorization (section 57 of Decreto Ejecutivo 13607) must necessarily be analyzed in conjunction with section 7 of the Ley de Informaciones Posesorias, transcribed above.
This is because only if that environmentally qualified ten-year possession (posesión decenal ecológica) is satisfied should the endorsement be granted without difficulty, but solely for cadastral purposes. Hence the importance of the co-defendants demonstrating in this proceeding that they satisfied the ten-year possession requirement before 26 de junio de 1975, the date on which the protected area at issue was created by Decreto Ejecutivo no. Placa19641. None of them, however, demonstrated the foregoing, and it was therefore impossible to grant them the authorization mentioned in the provision under review. In other words, the requirement to demonstrate such possession in order to obtain authorization follows from a harmonious interpretation of the legal system, specifically sections 57 of Decreto Ejecutivo 13607 and 7 of the Ley de Informaciones Posesorias. Therefore, the authorization that must be issued by the competent ‘entity,’ namely MINAE, is not a mere formality, as the Court stated; it is a verification of requirements that, as such, involves a series of actions and procedures intended to fulfill the ultimate purpose of the provision, namely the safeguarding and protection of the State’s natural property.
For all these reasons, the State is also correct when it argues that, if possessory recovery (recuperación posesoria) has not yet been undertaken with respect to the areas of the State’s natural heritage at issue in the proceeding, the Administration would be remiss in allowing them to be cadastrally registered in the names of private parties. Indeed, such actions could have irreparable consequences for the State’s natural heritage. It is not the case that rights of possession or ownership are being granted through that endorsement; this Chamber clearly understands that the authority competent to grant them is the judge hearing the respective possessory-title proceeding (proceso de Información Posesoria). Nevertheless, through that endorsement, the Administration—as custodian and guardian of public-domain property—would be granting private parties authorization to register plans covering property forming part of a reserve, which, it bears repeating, would undermine the public-domain status (demanialidad) of such lands, particularly if compliance with the statutory possession requirements has not first been verified.
Accordingly, it is evident that, without undertaking any substantial review, the Administration granted private parties the right to pursue the registration of plans covering property that has formed part of a biological reserve since 1975. If those authorizations were not granted with the utmost care and thoroughness in protecting such property, the proper course was to seek a declaration that those acts or endorsements were injurious to the public interest, as well as the registration of each of the ensuing plans (plan no. A-241056-1995 registered in the name of Nombre59163; no. A-591564-1999 registered in the name of Nombre59163; no. A-656768-2000 registered in the names of Nombre59163 and Nombre59163; and no. A-656769-2000 registered in the names of Nombre59163 and Nombre59163). This is precisely because the administrative authorities that granted the specified authorizations did not conduct the corresponding studies and analyses to determine whether the interested parties had maintained ten-year possession of those lands, whether original or derivative, and the interested parties likewise failed to demonstrate it before the Reserve was created by Decreto Ejecutivo 4960-A of 26 de junio del año 1975.
This Chamber has interpreted the issue of the endorsement and the ten-year possession requirement in a similar manner (judgment 000808-F-S1-2012, issued at 8 hours 35 minutes on 5 de julio de 2012). This is not simply a matter of noting on the plan whether the land is located within a reserve, as the Court interpreted it. On the contrary, the property at issue here is located within protected wilderness areas; these are not ordinary agricultural or private properties. Accordingly, that authorization must be issued by MINAE, but only after screening through studies, reports, hearings, or any other action it considers appropriate in defense of the public domain (demanio). Moreover, the evidence submitted by the co-defendants, through which they sought to substantiate their ten-year possession, is insufficient to establish that such possession predated the declaration of the lands they claim as a biological reserve.
On this specific point, the parties are referred to the findings of the trial judge, all of which are adopted by this Chamber. Upon review of the case file, none of the evidence subjected to adversarial examination demonstrates possession since junio de 1965. Consequently, the State’s appeal must be granted.’ (Emphasis added). Thus, anyone seeking to assert a right of possession over property that has become part of the State’s Natural Heritage shall bear the burden of proof and establish that the right of possession originated 10 years before the reserve or national park was created by Decree or Law; otherwise, the request cannot be judicially granted. In the case under examination (sub exámine), as stated above (supra), the request is not that the judgment grant, through the corresponding title, ownership of unregistered real property by means of the procedure established in the Ley de Informaciones Posesorias, based on possession exercised over it in full compliance with the requirements established for that purpose in that body of law.
Rather, based on the right of possession—only one of the elements of ownership—which the plaintiffs asserted was originally created by Mr. Nombre111213, who transferred that right to Mr. Herman Lutz Salazar, who transferred it to the company ‘Inversiones Lutz S.A.,’ which in turn transferred it to the company ‘Los Currés, S.A.,’ which ultimately transferred it in equal shares to the plaintiffs herein by deed No. 86, executed at 17 hours on 01 de setiembre de 1999, they seek compensation for the losses and/or damages caused by a physical act that they identified as dispossession (desposesión), arguing that they were dispossessed of the property through self-help measures (vías de hecho) and without compensation, and they therefore seek an order requiring the defendants to pay the pecuniary amounts claimed.
For this Chamber, it is clear that, under the cited regulations and case law, after 30 de octubre de 1972 no private party could maintain or acquire in good faith (buena fe), and consequently seek compensation (indemnización) for, a right of possession (derecho de posesión) arising after the national park was legally created. This is because, as of that date, the property at issue was withdrawn from private commerce (comercio de los hombres), pursuant to Article 262 of the Civil Code and the Ley Forestal. On the other hand, solely for compensation purposes, such a right and the corresponding compensation could be recognized, provided it is established, in accordance with Article 7 of the Ley de Informaciones Posesorias, that the right of possession arose at least 10 years before the protected wilderness area (área silvestre protegida) was created by statute or decree, regardless of its class or category, and provided that the claim was filed in a timely and proper manner.
Accordingly, possession alleged to have arisen after 30 de octubre de 1972 cannot be considered under any circumstances, and legal instruments purporting to transfer it have no legal effect, nor does a registered cadastral survey (plano catastrado), as stated in the cited case law. Indeed, an essential requirement for a right of possession to arise under the law is that the possessor or possessors act in good faith and that the right pertain to a legally transferable thing or property, meaning that it must remain within private commerce. It follows from the foregoing that Deed No. 26, executed at 10:00 hours on 04 de marzo de 1975, Deed No. 48, executed at 17:00 hours on 23 de junio of that same year, and Deed No. 86, executed at 17:00 hours on 01 de setiembre de 1999, cannot constitute valid legal mechanisms for transferring any ownership or possession right over real property that, as of 30 de octubre de 1972, became part of the State’s public-domain assets (bienes demaniales).
As stated supra, Article 261 of the Civil Code, “Ley No. 30 del 19 de abril de 1885 con rige a partir del 01 de enero de 1888,” establishes that public property is outside private commerce, and the persons who appeared in those instruments knew of the legal status imposed upon those properties after 30 de octubre de 1972 as a result of the enactment and entry into force of Ley No. 5100, Ley de Creación del Parque Nacional Manuel Antonio. Under the principle that no one may plead ignorance of the law (Article 129 of the Political Constitution), they knew as of that date of the legal status those lands had acquired by legislative mandate upon becoming part of the State Natural Heritage (Patrimonio Natural del Estado), and consequently being governed not only by Article 262 of the Civil Code—insofar as they were excluded from private commerce—but also by forestry legislation; therefore, no private party may validly assert a right such as possession.
Thus, with respect to the right of possession, the only matter that could be examined is whether such a right arose over the property at least 10 years before the creation of Parque Nacional Manuel Antonio—that is, between 30 de octubre de 1962 and 30 de octubre de 1972—under the terms of Article 7 of the Ley de Informaciones Posesorias, and was therefore enforceable against the State and its institutions. In this regard, to establish possession, the plaintiff companies submitted as their only evidence the testimony of the witnesses Nombre111205 and Nombre111206. At the outset, this fails to comply with Article 6 of the Ley de Informaciones Posesorias, which, for these purposes, requires possession to be established through the testimony of three witnesses; this circumstance alone would suffice to prevent the necessary possession from being legally established. Notwithstanding the foregoing, for these purposes Mr.
Nombre111205 gave advance testimony on 06 de enero de 2014 before the Juzgado Contravencional de Menor Cuantía de Aguirre and Judge Celso Fernández Delgado, at which time he reportedly stated the following: “I was born in Santa Cruz; I moved from the area for work-related reasons. I worked for Lutz, who raised rice and cattle. The ranch was called Lutz and was located in Azul. This ranch borders Roncador above, the sea, and the banana plantation, Bananera; before it became a banana plantation, it was entirely forest. Before, there was neither a road nor a town; before, there was nothing. Alcevidiades used to live there and owned land. Nombre111215’s land is on the right when facing away from the boundary with the sea. Alcivididades divided the property among his children; I know of no other owner of that property. The side bordering Bananera was on the side of the sun; Nombre111215 was on the opposite side, and the sea was on the other side.
I know of no other boundary. I was a field supervisor on the farm and worked with cattle. The farm was very large; I do not know how to say how large it was. It was fenced with solid posts and living fence posts. I knew Buster Land; his farm adjoined Don Geman’s on the side of the sun, in the upper section. Counsel Adriana Bonilla Bonilla proceeds to ask questions: I have lived here since I was twenty years old, and I am now ninety-two. I worked for Nombre111214 from the time I arrived here and later for Glen Lutz París.” It should be noted that Mr. Nombre111205 stated that he worked for Lutz without specifying any given name, and although he claimed to have worked for that gentleman, neither the witness nor the plaintiff companies established through suitable evidence that this employment relationship actually existed, such as a record of employer-employee contribution payments maintained for such purposes by the CCSS, accounting records documenting the payment of wages, annual bonuses, vacation pay, disability leave, etc. He then stated that cattle were raised and rice was grown on the farm, without providing details as to whether the rice was produced for sale, consumption, or animal feed, etc., and, if it was sold, to whom it was sold, etc. Similarly, regarding the cattle, he did not specify what type of cattle they were or their intended use.
He did not state whether the cattle were sold and, if so, to whom, or whether they were taken to a slaughterhouse and, if so, which slaughterhouse, etc. He then stated that the ranch was called Lutz; however, it has been established that, in addition to the property they claimed was depicted in survey P-986592-2005, the Lutz family owned two other properties in the area that were registered in the Public Registry of Property: property No. 129484-001 through 005, with survey P-448729-97, measuring 16 has.113m2; and property No. Placa19631, with survey P-448733-97, measuring 119,59 ha, both of which were acquired and paid for by the Fideicomiso Parque Nacional Manuel Antonio. (See images 249 through 254, 271, 272, and 303 through 306 in the electronic court case file.) Furthermore, the witness did not specify which property he was referring to—whether one of the properties registered in the Public Registry or the property depicted in survey P-986592-2005.
The witness also failed to identify the boundaries of the alleged property with any degree of precision and referred to a man whom he called Nombre111215 and another whom he called Buster Land, neither of whom is connected with this case. For his part, Mr. Nombre111206 appeared on 09 de noviembre de 2017 and also gave advance testimony before the Juzgado Civil y de Trabajo de Quepos and Judge María Cristina Cruz Montero. Under oath, he stated that he had arrived in the area at the age of 10 and had lived there for 30 years. He stated that they moved next to Finca Tamarindo, which he said belonged to Mr. Nombre111214, and that as of that date—09 de noviembre de 2017—it still existed, and that he had retired 10 years earlier after working for that farm. He stated that the farm, Tamarindo, bordered the property of Alcidades Zúñiga and the sea to the south. He stated that Alcidades was on the left-hand side and Boca del Río Naranjo was on the right-hand side.
He stated that Alcidades later sold the property to a foreign gentleman named Nombre111216. He stated that, after Don Nombre111214, Finca Tamarindo had no other owners and that, when he died, the farm passed to his children, Douglas, Randolph, Lucía, and Nombre111217. He stated that a river, Río Naranjo, was nearby. He stated that the farm was used for cattle and that there were houses on the farm where the laborers lived. He stated that he was a laborer for Don Nombre111214 and, after Don Nombre111214 died, continued working on the farm, with Don Nombre111214’s children giving him instructions and paying his wages. He stated that, from the time he arrived, the farm consisted of pastureland with irregular topography, including a hill, rugged terrain, and flat land. He stated that the property beside Río Naranjo also belonged to Don Nombre111214, without recalling the size of the farm, and further stated that the farm no longer existed at that time because oil palm was being grown there and that he did not know who its current owner was.
In this Chamber’s view, the testimony of Mr. Nombre111206 likewise lacks sufficient precision to establish the acquisition of a right of possession over the lands depicted in survey P-986592-2005. Specifically, the witness did not precisely describe the property’s boundaries. He stated that cattle-raising operations were conducted there, but did not indicate whether the cattle were sold and, if so, to whom. Nor was any effort made to prove the witness’s employment relationship with the plaintiff companies or their predecessors. Finally, on the date he testified—09 de noviembre de 2017—in response to a question from State Counsel, he stated that he did not know who currently owned the property and asserted that oil palms were then growing on the farm he described, which is inconsistent with the forest conditions of the lands now forming part of Parque Nacional Manuel Antonio. Accordingly, the testimony of Mr.
Nombre111205 and Mr. Nombre111206 is insufficient to establish any right of possession exercised by Mr. Nombre111213 or Mr. Herman Lutz Salazar between 30 de enero de 1962 and 30 de enero de 1972, the date on which Ley 5100, Ley de Creación del Parque Nacional Manuel Antonio, was enacted, because their statements were vague and imprecise and lacked references to manner, time, or place, specific activities, exact locations, activities carried out within the property, etc. Moreover, the number of witnesses is insufficient to establish possession of real property, because Article 6 of the Ley de Informaciones Posesorias, as we reiterate, provides: “Possession shall be established through the testimony of three witnesses who reside in the canton where the property is located. They shall be questioned as to how long they have known the property; whether they have personal knowledge that the applicant for title (titulante), or previous owners, maintained possession of it for a continuous period of no less than 10 years; whether that possession was public, peaceful, and exercised under a claim of ownership; and what acts that possession consisted of.
The Judge shall also question the witnesses, ex officio or at a party’s request, regarding any other information considered relevant to proving possession. All of the foregoing shall be conducted without the need for a prior written examination submitted by the interested party.” Accordingly, this Court does not find it established that Mr. Nombre111213 or Mr. Herman Lutz Salazar exercised possession over the property depicted in survey No. P-986592-2005 for at least 10 years before 30 de enero de 1972. As has been repeatedly stated, the survey itself is not capable of establishing the existence of a right such as possession; moreover, that survey was prepared in 2005, approximately 33 years after Ley No. 5100 was enacted. Another point worth emphasizing is that counsel for the plaintiff companies asserted that the State dispossessed them through de facto measures (vías de hecho) and that, as of the filing of the complaint, it had failed to pay compensation even though appraisals had been performed and payment had been ordered.
With respect to that alleged administrative action, which the claimant parties themselves characterized as a physical action, they fail at every level to specify the circumstances of manner, time, and place, even though this is a central factual circumstance for their theory of the case, as part of the cause of action (causa de pedir). Moreover, even overlooking this deficiency, with respect to the dispossession (desposesión) of the property, their counsel did not establish by any means that it had occurred, nor did counsel establish which institution carried it out, how, or when—whether it was carried out by the police or by institutions responsible for safeguarding and protecting the environment. The fact that the claimant parties were not in a position to describe the circumstances under which they were allegedly physically dispossessed of the property in question could be explained by their inability to demonstrate the possession (posesión) they claim to have exercised.
As a logically necessary consequence, if they did not establish that they held a right of possession (derecho de posesión), neither could any infringement of that right be deemed established, whether through an alleged physical dispossession or through the legal creation of the National Park at issue. In the latter case, we would be discussing the potential liability of the State as legislator (responsabilidad del Estado Legislador), provided that the requirements therefor were met, although that is not the theory advanced by the claimants. Furthermore, although an appraisal (avalúo) existed, it noted the conditions of the land described in survey plan Placa19642. It should be noted that Agricultural Engineer Gerardo Ramírez Villalobos stated, with respect to possession, that it was incomplete and that the Registry review did not make it possible to verify possession of the property in the name of Curres S.A. Their counsel also failed to establish that an administrative act (acto administrativo) had been issued ordering payment for the property described in plan No. P-986592-2005.
Given its legal nature and scope, this administrative conduct (conducta administrativa) is not equivalent to a final and favorable administrative act (acto administrativo firme y favorable). To the contrary, it was established that, by official letter DAJ-1004 dated 30 de septiembre de 2002, the Departamento Legal del MINAET informed Mr. Agustín Atmetlla Herrera that, for purposes of payment for the property, he had to establish that it was registered; otherwise, he had to establish such ownership before the Courts. Subsequently, Mr. José Francisco Mattey Fonseca, President of the “Junta Directiva del Parque Recreativo Parque Nacional Playas de Manuel Antonio,” consulted the Procuraduría General de la República regarding the situation concerning payment for the property previously described in plan No. Placa19643 in the name of the company “Los Curres S.A.” In Opinion OJ-046-2004, dated 16 de abril de 2004, that Procuraduría stated that insufficient diligence had been exercised in establishing the alleged possessory rights (derechos posesorios).
That position was subsequently reiterated by the Procuraduría in Opinion C-024-2006 dated 23 de enero de 2006, in response to a new inquiry submitted by Mr. Mattey Fonseca in a letter dated 07 de diciembre de 2005. In addition, by letter dated 06 de marzo de 2006, the Junta Directiva del Parque Recreativo Nacional Playas de Manuel Antonio informed Attorney Rosibel Carmona Delgado, Coordinadora de Estudio de la División de Fiscalización Operativa y Evaluativa del Área de Servicios Agropecuarios y de Medio Ambiente Contraloría General de la República, that, with respect to the claim asserted by the claimants and pursuant to Opinions Nos. O.J.-046-2004 and O.J.-024-2006 of the Procuraduría General de la República, no right of possession over the property identified therein had been demonstrated, and any possible claim was time-barred (prescrita); accordingly, those lands were to be registered in the name of the State.
It was also established that, by official letter ACOPAC-605-06 dated 23 de junio de 2006, Mr. Mario Coto Hidalgo, in his capacity as Director of the Área de Conservación Pacífico Central (ACOPAC), informed Engineer Ronald Vargas, Director of the Sistema Nacional de Áreas de Conservación (SINAC), that, in accordance with Opinion OJ-046-2004 of the Procuraduría General de la República, the purchase of the Los Curres property was not legally permissible, and that this had been communicated to the Contraloría General de la República by official letter ACOPAC-D-225-06. (See images 193 through 197 of the digital court case file (expediente digital judicial)). With respect to the criminal complaint (denuncia penal) filed on 23 de febrero de 2007 before the Fiscalía de Dirección3332 against Mr. Nombre111210, for the alleged offenses of Forgery and Alteration of Documents, Ideological Falsehood, and Embezzlement in Connection with Fraud, it should be stated that at no time was it established that the misappropriated funds had been allocated by administrative act to pay for the lands described in plan No. P-986592-2005.
As to the burden of proof (carga de la prueba), it must be recalled that, under Article 41.1 of the new Código Procesal Civil, in conjunction with Article 220 of the Código Procesal Contencioso Administrativo, a party is required to prove its assertions, which the claimant parties failed to do in this case. The relationship between those two articles gives rise to what is known as onus probandi (or burden of proof), a Latin expression for the legal principle identifying who is required to prove a particular fact before the courts. The basis of onus probandi lies in an old legal maxim stating that “what is normal is presumed; what is abnormal must be proven.” Therefore, anyone alleging something that departs from the normal state of affairs must prove it (“affirmanti incumbit probatio”: the burden of proof rests upon the person who affirms). Essentially, this maxim means that the burden or task of proving a proposition must fall upon the person who departs from the normal state of affairs—that is, the person claiming to possess a new truth concerning a matter.
Accordingly, because the claimant companies failed to establish any legally constituted right of possession over the property they identified, and because that requirement was the basis upon which the viability of all the claims, considered as a whole, was constructed, under the referenced legal parameters the proper course is to dismiss the complaint in its entirety, as is hereby ordered.
In their defense, the defendants raised the affirmative defenses of statute of limitations (prescripción), lack of a current interest (falta de interés actual), lack of active and passive standing (falta de legitimación activa y pasiva), and lack of legal entitlement (falta de derecho). Given the manner in which this matter is resolved, it is unnecessary to address the statute-of-limitations defense, because, since the claimant companies failed to establish any enforceable right in their favor, it would be entirely futile to analyze whether they filed their claim in a timely manner. As to the defense of lack of a current interest, it must be rejected because the claimant companies instituted civil proceedings against the Public Treasury (proceso contencioso civil de hacienda), seeking monetary recognition of a possessory right (derecho de posesión) which, they alleged, had been taken from them by the State through de facto action (vías de hecho), a circumstance that continues to await—a current interest—a ruling on their claims.
This undoubtedly entitles them to request a judicial determination of their action; consequently, there has been no loss of current interest, and that defense must therefore be rejected. Regarding the defense of lack of standing (falta de legitimación), it must be noted that standing constitutes the capacity or fitness to be a party to a specific proceeding, as a defendant, depending on the conditions prescribed for that purpose by procedural law in relation to the claim asserted. Standing may arise either from the legal-administrative relationship established between the claimant and the Administration or from the law, in accordance with what the law has established in that regard. Indeed, there are two types of standing in a proceeding: procedural standing (legitimación ad procesum) and standing on the merits (legitimación ad causam). The first, procedural standing, concerns a procedural issue; in other words, whether the person appearing has legal capacity to act under the law or, if acting on behalf of another, holds the appropriate form of legal representation in accordance with our legal framework.
The second, standing on the merits, concerns determining whether the person filing the action legally possesses a right that may be claimed; that is, the party with standing is the person who, under substantive law (derecho de fondo), has a specific legal relationship with the subject matter of the proceeding, namely, the claim. In the case before us, there is no doubt that the claimants have procedural standing, but they lack standing on the merits, which entails a lack of legal entitlement, because they did not establish by any means that they held the possessory right over the property to which they referred. As to the lack of legal entitlement, it is necessary to refer to the proof of the facts as a fundamental component thereof, because what is determined in that section will establish whether there are legal grounds for the relief sought; and because no enforceable right in favor of the claimant companies was established, the proper course is to uphold the defenses of lack of active standing on the merits and lack of legal entitlement, and to dismiss the action.
Pursuant to section 193 of the Código Procesal Contencioso Administrativo, court costs and attorneys’ fees (costas procesales y personales) constitute a burden imposed on the unsuccessful party by virtue of having lost. The unsuccessful parties in this case are the claimant companies and, consequently, they are ordered to pay both categories of costs incurred as a result of these proceedings in favor of the State, SINAC, and the Junta Directiva del Parque Recreativo Nacional Playas Manuel Antonio. The amount of costs shall be determined by the competent judge during the judgment-enforcement stage (fase de ejecución de sentencia), upon application by the defendants.
POR TANTO:
Given the manner in which this matter is resolved, it is unnecessary to address the statute-of-limitations defense. The defenses of lack of a current interest, lack of passive standing, and lack of active procedural standing are rejected. The defenses of lack of active standing on the merits and lack of legal entitlement are upheld. Consequently, the action brought by LOS CURRES S.A. ACHI DE BOCA NARANJO QUEPOS LTDA. INVERSIONES KLAN S.A. ACILU S.A. Y CULTIVOS Y MOVILIZACIÓN TIERRAS S.A. against EL ESTADO, EL SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN Y LA JUNTA DIRECTIVA DEL PARQUE RECREATIVO NACIONAL PLAYAS MANUEL ANTONIO is dismissed in its entirety. Both categories of costs shall be borne by the claimant companies. The amount of costs shall be determined by the competent judge during the judgment-enforcement stage, upon application by the defendants’ counsel. Let notice be given. José Iván Salas Leitón. RESULTANDO:
I.Por escrito presentado ante el Tribunal Contencioso Administrativo y Civil de Hacienda el día 25 de mayo de 2011, la parte actora planteó proceso civil de hacienda cuyas pretensiones fueron precisadas en la audiencia preliminar realizada en dos tantos, durante los días 06 de febrero y 08 de junio del 2014, para que en sentencia, se declare lo siguiente: "...A) (...) que el Estado las desposeyó forzosamente y les ha impedido ejercer sus derechos inherentes al régimen de posesión de la tierra, de manera quieta, pacífica y a título de dueñas. B) Conforme al artículo 42.h) del Código Procesal Contencioso Administrativo, pedimos que se declare la disconformidad con la Constitución Política y el ordenamiento jurídico la actuación material, constitutiva de una vía de hecho, causada por la desposesión forzosa de la finca sin acto administrativo escrito ni eficaz, sin el pago previo del valor de la tierra ni de las mejoras, ni de sus accesiones, ni del valor de la madera existente, valores que deben ser indexados hasta el momento del pago efectivo.
De igual modo pretenden las accionantes la condenatoria al Estado y al Fideicomiso demandado a resarcirles los perjuicios causados, consistentes en la falta de disfrute del inmueble, la imposibilidad de explotar comercialmente el inmueble y de los intereses legales que hubieran percibido si se hubiera hecho el pago previo del precio del inmueble, originados en la posesión del inmueble y desde la fecha en que ocurrió la desposesión forzosa por parte del Estado y hasta su efectivo pago. B) De manera prudencial se estiman los daños en al menos mil millones de colones, y los perjuicios se estiman de manera prudencial en al menos doscientos millones de colones, pero que serán determinados por un perito y por las pruebas que consten en el expediente.” (Ver imágenes de la 104 a la 143 del expediente judicial digital).
II.Por resolución de las 11:21 horas del 23 de agosto del 2011, se dio curso a la demanda y se confirió traslado al Estado y según lo ordenado en la resolución de las 09:49 horas del 26 de octubre de 2012, se integró al Sistema Nacional de Áreas de Conservación (SINAC) y a la Junta Directiva del Parque Recreativo Nacional Playas Manuel Antonio; correspondiéndose esa Junta, con el Fideicomiso que indicaron las actoras en sus pretensiones. (Ver imágenes 1276 y 1278 del expediente judicial digital).
III.Por escrito recibido el día 26 de octubre de 2011; la representación del Estado contestó negativamente la demanda y en su defensa opuso las excepciones de falta de interés actual, falta de derecho, prescripción y falta de legitimación activa y pasiva. Lo mismo hizo la representación de la Junta Directiva del Parque Recreativo Nacional Playas Manuel Antonio, por escrito presentado el día 13 de diciembre de 2012 y opuso en su defensa las excepciones de de falta de interés actual, falta de derecho, prescripción y falta de legitimación activa y pasiva. Finalmente la representación del SINAC también contestó negativamente la demanda por escrito presentado el día 20 de diciembre de 2012 y opuso las excepciones de falta de derecho, prescripción y falta de legitimación activa. (Ver imágenes de la 1241 a la 1260; de la 1292 a la 1310 y de la 1311 a la 1326 del expediente judicial digital).
IV.La audiencia preliminar se llevó a cabo en dos tantos; la primera el día 06 de febrero y la segunda el día 08 de junio ambas del 2014. En la diligencia judicial se definieron las pretensiones en los términos del resultando primero. Se reservó la excepción de prescripción para ser conocida en sentencia. Se tuvieron como controvertidos todos los hechos a excepción del número 1, en cuanto a que el inmueble que ahí se indica, se encuentra dentro del área que conforma el Parque Nacional Manuel Antonio, y se admitió la prueba documental que se indicó y testimonial de los señores Nombre111205 y Nombre111206 de parte de las sociedades actoras, a quienes se le tomó anticipadamente sus declaraciones. Además se admitió a la Junta Directiva del Parque Recreativo Nacional Playas Manuel Antonio el testimonio del señor Nombre111207 . A las sociedades actoras también se les admitió prueba pericial para que un Ingeniero Topógrafo realizara una comparación entre el plano No. P-451272-97 y el No. P-986592-2005 y determinara si ambos planos describían el mismo inmueble.
Peritaje que recayó en el Ingeniero Christian Stanley Chacón Barquero. Además se les admitió prueba pericial para que estableciera el valor del terreno. Este peritaje recayó en el Ingeniero Nombre58528 . Por su parte al Estado se le admitió prueba pericial para que se determinara si el terreno correspondiente al Plano Placa19634 es un terreno perteneciente a la Municipalidad de Aguirre (Hoy Municipalidad de Quepos) dado en arriendo a la sociedad Nombre111208 . Peritaje que recayó en el Ingeniero Nombre111209 . Además de la prueba aportada en esa diligencia por parte de la representación de las sociedades actoras, a saber, el acta de la audiencia realizada dentro del proceso penal No. 07-200009-0457-PE, en la que se homologó la suspensión del proceso a prueba, en contra del señor Nombre111210 , por el delito de peculado, con respecto a cheques que supuestamente eran para pagar las fincas de las actoras, ello con el fin de demostrar que la finca desposeída nunca fue pagada.
Así como un plano de la supuesta finca del año 1953 bajo el alegato de que dicho documento se pudo conceptualizar posterior a la deposición anticipada del señor Nombre111211 . Prueba que conforme a lo dispuesto en el artículo 50 del CPCA el señor Juez de Trámite reservó para su admisión o rechazo al Tribunal de Juicio. (Ver imágenes de la 1482 a la 1484 y de la 1573 a la 1576 del expediente digital judicial y respaldo digital en custodia de este Tribunal).
V.Que el señor Nombre58528 presentó la pericia encomendada el día 12 de agosto de 2015, y por auto de las 15:23 horas del 29 de octubre de 2015 se dio audiencia a las partes. Luego lo hizo el señor Christian Stanley Chacón Barquero y finalmente el señor Nombre111209 . De dichas pericias también se dio audiencia a las partes. (Ver imágenes de la 1614 a la 1638, 1665, 1666, de las 3863 a la 3871 y de la 3934 a la 3941).
VI.Que mediante auto de las 11:06 horas del 21 de setiembre de 2020, se señaló la audiencia complementaria para las 08:30 horas del 06 de agosto de 2021. Auto que fue notificado a todas las partes y a los peritos Christian Stanley Chacón Barquero, Nombre58528 y Nombre111209 . (Ver imágenes 4014 al 4024).
VII.Que la audiencia complementaria de juicio oral y público, se realizó a partir de la 08:30 horas del día 06 de agosto de 2021, con la presencia de la representación de las sociedades actoras y de las accionadas. En lo que resulta relevante, las partes rindieron su alegato de apertura, se recibió a los peritos Christian Stanley Chacón Barquero y Nombre111209 . A pesar de que el perito Nombre58528 fue notificado del auto de convocatoria al medio señalado, no se presentó a la audiencia de juicio, sin embargo las partes lo eximieron de la presentación oral del peritaje. Las partes rindieron sus conclusiones exclusivamente de manera oral, tal y como se les indicó, y al ser las 14:55 horas de ese día se dio por cerrada la audiencia complementaria de juicio, por lo que por principio de preclusividad cualquier documentación hecha llegar al proceso posterior al cierre de la audiencia resulta improcedente. Finalmente este Tribunal dispuso darle al presente proceso, el trámite previsto en el artículo 111, inciso 1) del Código Procesal Contencioso Administrativo. VIII.Se dicta esta sentencia, previa deliberación y por unanimidad de los integrantes del Tribunal, dentro del plazo de quince días establecido en el artículo 111.1 del Código Procesal Contencioso Administrativo -al haberse declarado muy complejo el presente asunto-, sin que se observen causales capaces de invalidar lo actuado.
Redacta el Juez Salas Leitón,
CONSIDERANDO:
Durante la audiencia preliminar celebrada el día 08 de junio de 2014, la representación de las sociedades actoras ofreció como prueba nueva copia del acta de la audiencia realizada dentro del proceso penal No. 07-200009-0457-PE, en la que se homologó la suspensión del proceso penal a prueba, en contra del señor Nombre111210 , por el delito de peculado, por la sustracción y falsificación de firmas en cheques que supuestamente eran para pagar las fincas de las actoras, ello con el fin de demostrar que la finca desposeída nunca fue pagada. Así como un plano de la supuesta finca del año 1953 bajo el alegato de que dicho documento se pudo conceptualizar posterior a la deposición anticipada del señor Nombre111211 . Criterio de este Órgano Colegiado. En atención a la ya conocida admisión facultativa de la prueba para mejor resolver, la Sala Primera de la Corte Suprema de Justicia ha sostenido que el rechazo de la misma no produce la indefensión de las partes.
Entre otras sentencias, se transcribe en lo que interesa el texto de la número 547-F-2002 de las dieciséis horas del doce de julio de dos mil dos, que indica: “(…) IV.- Múltiples precedentes de esta Sala, refiriéndose a la prueba para mejor resolver, han señalado que esta es prueba del juez, y no de las partes. En consecuencia, la decisión de recabarla es facultativa del órgano jurisdiccional, y puede prescindirse de ella sin necesidad de resolución alguna. Ergo, la omisión de pronunciamiento a su respecto, precisamente porque ha sido rebasada la etapa probatoria, en la cual deben las partes demostrar los hechos constitutivos de su derecho, según lo imponen las normas sobre la carga de la prueba y precluída aquella etapa, será facultad exclusiva del juzgador, determinar si deben allegarse a los autos nuevas probanzas necesarias para la correcta decisión del litigio. Pueden consultarse, entre muchas otras las siguientes resoluciones; 59 de las 15:20 horas del 31 de mayo de 1996, 23 de las 14:20 horas del 4 de marzo de 1992, 34 de las 10:45 horas del 28 de mayo de 1993 y 83 de las 14:40 horas del 22 de diciembre de 1993.
(…)”. En abono a lo anterior, la sentencia número 29-1995 de las quince horas treinta minutos del veintidós de febrero de mil novecientos noventa y cinco, también dictada por la Sala Primera, aclara lo siguiente: “(…) Dentro de las facultades instructoras y ordenatorias del juez, está la de ordenar prueba para mejor proveer (artículo 97, inciso 2, y 331 del Código Procesal Civil), cuando las probanzas por practicar tengan una influencia decisiva en el resultado del proceso (…). El aspecto medular de la prueba para mejor proveer es su carácter facultativo o discrecional, no pudiendo ser exigida por las partes; su ordenación depende enteramente, de la iniciativa, prudente y criterio del órgano jurisdiccional, consecuentemente su denegatoria no causa indefensión alguna”. Dicho lo anterior, estima esta Cámara: 1) En cuando a la homologación de la suspensión del proceso penal a prueba dictada dentro de la causa penal 07-200009-0457-PE seguida contra el señor Nombre111210 en perjuicio de la Junta Directiva del Parque Nacional Manuel Antonio, se acepta por tratarse de prueba con el fin de completar en expediente penal indicado ofrecido como prueba en su momento procesal oportuno. 2) El cuanto al plano que se indicó, se tiene que el mismo data del año 1953.
De forma que se trata de prueba que debió aportarse al momento de interponer la demanda o con la réplica a la contestación de la demanda, conforme a lo establecido en el artículo 70) del CPCA; que son los dos momentos procesales para hacer llegar la prueba, pues fuera de esos dos momentos procesales sólo es admisible aquella que se refiera a hechos nuevos posteriores a la interposición de la acción y a su contestación, y evidentemente ese no es el caso y por ende se rechaza.
Como tales se tienen los siguientes:

Conforme a las pretensiones que fueron establecidas en el escrito de demanda y precisadas en la audiencia preliminar, en un orden lógico, el objeto de la presente demanda lo es para que en sentencia:
De acuerdo a la teoría del caso que ha sido expuesta por la representación de las sociedades actoras en su demanda y bajo la que se ha trabado la presente litis, tenemos que la representación judicial de las actoras afirmaron que dentro de límites del Parque Nacional Manuel Antonio se ubica un inmueble no inscrito en el Registro Nacional, cuya cabida, ubicación y linderos se encuentran descrito en el plano catastrado No. 986592-2005. Afirmaron que ese inmueble fue adquirido por el señor Nombre111213 , quien desarrolló una actividad agraria consistente en la explotación maderera y bananera. Que luego el señor Nombre111213 la trasladó a su hijo Herman Lutz Salazar, quien continuó con su explotación ganadera y maderera. Que luego, a mediados del año de 1975 el señor Lutz Salazar la traspasó a la sociedad "Inversiones Lutz S.A." y está la otorgó como aporte de capital al momento de constituir la sociedad Los Curres, la que finalmente la distribuyó por partes iguales entre los actores.
Sostuvo que el Estado cuando creó el Parque Nacional Manuel Antonio incluyó dentro de su área esa finca, desposeyendo por las vías de hecho a sus representadas del inmueble y a pesar de que acordó pagar a los afectados, en su caso nunca se les pagó el monto respectivo. Conducta omisiva que se mantiene a hasta la fecha. Acusaron que lo actuado por el estado costarricense contraviene lo dispuesto en el artículo 45 de la Constitución Política que garantiza la indemnización previa de la propiedad privada en caso de privación. Afirmaron que probarían que la propiedad de dicho inmueble pertenece a las sociedades actoras y que por ende para que forme parte del Parque de manera válida debe ser indemnizada conforme a la Ley. Luego, aseguraron las sociedades actoras que son poseedoras legítimas de una finca sin inscribir, y que el derecho de posesión sobre un inmueble no inscrito debe considerarse como un derecho de propiedad, en los casos de apropiación forzosa por parte del Estado.
Y que la Sala Constitucional ha reconocido en sus sentencias que cuando el Estado deba apropiarse forzosamente de un inmueble, tanto el derecho de propiedad en sentido estricto, esto es, de las propiedades registralmente inscritas como el derecho de posesión sobe las fincas no inscritas, son igualmente indemnizables. Así en la sentencia 2006-18443 de las 10:24 horas del 22 de diciembre de 2006. Que igualmente en la sentencia de esa misma Sala No. 17410-2009 de las 11:13 horas del 17 de noviembre de 2009, de la cual se concluye que de haberse poseído de buena fe de manera anterior a la emisión del Decreto procedería la compensación económica. Que en esa misma línea también los Tribunales Contenciosos, en los que ha señalado que para efectos de disponer medidas de protección y reparación de daños y perjuicios, se debe acreditar el derecho de propiedad o de posesión sobre el bien. Que la Procuraduría General de la República en su Dictamen C-097-1994 del 13 de junio de 1994 confirmó la procedencia del pago de las porciones de bosque en la compra del Estado de fincas sin inscribir.
En conclusión, conforme al criterio de la representación de las sociedades actoras; la indemnización que debe reconocer el Estado cuando despoja del derecho de posesión al poseedor de un inmueble sin inscribir, debe ser similar a la indemnización previa que exige el artículo 45 de la Constitución Política, en los casos de expropiación de una finca inscrita. De esta forma, se equipara para efectos indemnizatorios el derecho de propiedad, ---en sentido estricto, esto es sobre un inmueble legalmente inscrito en el Registro Público--, con el derecho de posesión debidamente constituido conforme a la ley, sobre una finca no inscrita, ---cuando se trata de un apoderamiento realizado por el Estado en el ejercicio de sus potestades de imperio como lo es la expropiación o la desposesión del derecho de posesión---. En razón de lo expuesto resulta oportuno precisar en qué consiste conforme a la normativa y jurisprudencia costarricense, el concepto del derecho de propiedad y de posesión.
En cuanto al derecho de propiedad tenemos que el artículo 45 constitucional establece: "La propiedad es inviolable; a nadie puede privarse de la suya si no es por interés público legalmente comprobado, previa indemnización conforme a la ley. En caso de guerra o conmoción interior, no es indispensable que la indemnización sea previa. Sin embargo, el pago correspondiente se hará a más tardar dos años después de concluido el estado de emergencia. Por motivos de necesidad pública podrá la Asamblea Legislativa, mediante el voto de los dos tercios de la totalidad de sus miembros, imponer a la propiedad limitaciones de interés social." El citado artículo no sólo garantiza la propiedad privada de los y las ciudadanas sino que consagra su inviolabilidad, como garantía del ciudadano del que el Estado no le privará de la suya de una manera arbitraria y sólo en casos de interés público comprobado y previa indemnización podrá privársele de la misma.
De esta forma en Costa Rica, la propiedad como derecho subjetivo, exclusivo y excluyente del titular, recibe una tutela constitucional, en resguardo de los derechos individuales de los ciudadanos. Norma de rango constitucional que el Estado no puede desconocer válidamente, siempre que el ciudadano cumpla con las condiciones que conforme a la ley, le otorga ese derecho. No obstante ello, bien es sabido que el derecho de propiedad no es absoluto y cede ante ciertas circunstancias como lo es el interés público, con el resguardo que en tales casos el titular del derecho deberá ser indemnizado. Luego, tenemos que el Código Civil regula el concepto de propiedad, estableciendo 2 tipos de ella, la pública y la privada. La primera es propia del Estado en sentido amplio, la cual goza de una tutela especial por sus fines y su característica mas significante o representativa es que son bienes sobre los que no prospera la prescripción positiva por parte de particulares, son inembargables y en general inalienables, es decir, están fuera del comercio de los hombres.
Así, el artículo 261 establece en lo que interesa que serán bienes o casas públicas, los que por ley están destinadas de modo permanente a un servicio de utilidad general, y aquellas entregadas al uso público de manera directa e inmediata y todas las demás serán cosas privadas y objeto de propiedad privada. En cuanto a los bienes públicos el artículo 262 del mismo cuerpo normativo, establece que las cosas públicas están fuera del comercio, esto es, son inalienables, mientras por ley no se desafecten del uso o servicio al que están destinados. Por otra parte, en términos generales sobre los atributos del dominio (propiedad) el artículo 264 del C.C. indica que el dominio o nuda propiedad absoluta sobre una cosa comprende los siguientes derechos: 1 De posesión. 2. De usufructo. 3. De transformación y enajenación. 4. De defensa y exclusión. 5. De restitución e indemnización y el artículo 267 exige que para que la propiedad sobre inmuebles surta todos los efectos legales, se requiere que el bien se halle inscrito en el Registro Público, y en esta misma línea el artículo 455 señala que los títulos sujetos a inscripción y que no lo estén, no perjudicarán a terceros, sino desde la fecha de su presentación.
Sobre el derecho de posesión como atributo del derecho de propiedad, tenemos que este derecho se conceptualiza como la facultad que corresponde a una persona de tener bajo su poder y voluntad la cosa objeto del derecho, (art. 277 del C.C.) y en cuanto a su origen, el artículo 279.2 del C.C. establece que el derecho de posesión se adquiere independientemente del derecho de propiedad, y una de sus causas, es por conservar la posesión del bien por mas de un año, siempre y cuando conforme con la exigencia del artículo 284 la posesión del bien se haga de buena fe. Y en cuanto a las reclamaciones del poseedor de buena fe, el numeral 328 del C.C., indica los extremos a los que tiene derecho a ser indemnizado. En cuanto a la indemnización se refiere, no cabe duda que esta procede en casos de expropiación de la propiedad absoluta o de alguno de sus atributos considerado individualmente, como por ejemplo lo es el derecho de posesión sobre un inmueble no inscrito.
En cuanto a este tipo de indemnización la Sala Primera ha señalado: "...El instituto expropiatorio se justifica por cuanto el derecho de propiedad no es absoluto. Por el contrario, además de ser un derecho subjetivo debe satisfacer necesidades colectivas e intereses públicos. La expropiación no altera el régimen general de la propiedad, es consustancial con él pues cuando un interés público se impone un sacrificio al privado, éste se debe minimizar mediante su compensación con un valor equivalente..." (Ver Voto No. 116-92 de la Sala Primera). En cuanto a los alcances de la expropiación esa Sala indicó en su voto No 266 de las 16:20 horas del 18 de diciembre de 1992: "...V. Etimológicamente el vocablo deriva de "ex" y "propio". Significa privación de la propiedad, es decir, se trata de un acto ablatorio referido a derecho que se tiene sobre un objeto. Por ello en los ordenamientos jurídicos donde la propiedad es un derecho fundamental constitucionalmente garantizado, como el costarricense, la expropiación únicamente procede en los casos previstos por ley, y el poder de expropiar es conferido sólo a la autoridad pública.
En un sentido muy general, expropiación es toda adquisición forzosa o coactiva del derecho de propiedad privada o alguna de sus atributos...". (resaltado es nuestro). De esta manera se concibe la expropiación y su respectiva indemnización no sólo del derecho de propiedad en sentido estricto, es decir la propiedad absoluta registralmente inscrita y con sus atributos incluidos, sino que también existe la posibilidad de indemniza por el despojo que el Estado realice de algunos o de algunos de los atributos que engloba el concepto de propiedad, como lo sería el derecho de posesión, conforme a la legislación aplicable, siempre y cuando ese derecho se haya conformado de manera pública, pacífica, de buena fe y se haya hecho valer en tiempo, igualmente conforme a la ley aplicable. No debe perderse de vista que conforme la Ley N° 139 del 14 de julio de 1941, Ley de Informaciones Posesorias, en su artículo 1: "El poseedor de bienes raíces que careciere de título inscrito o inscribible en el Registro Público podrá solicitar que se le otorgue, de acuerdo con las disposiciones de la presente ley" (el resaltado no es del original) mientras que el numeral 16 del mismo cuerpo normativo reza así: "La propiedad que se adquiera por la presente ley, queda definitivamente consolidada para terceros a los tres años, los cuales se contarán a partir del día de la inscripción del respectivo título en el Registro Público, ya que se limita a ese plazo la prescripción negativa de la acción de terceros a quienes pueda afectar. / Este plazo se reducirá a un año únicamente para el efecto de solicitar y obtener préstamos de los organismos del Sistema Bancario Nacional o del Instituto Nacional de Vivienda y Urbanismo" (el resaltado no es del original) luego, cuando antes sólo se tiene la posesión con algunos presupuestos que deben concurrir en ella, el dominio con la totalidad de sus atributos, es claro que se sólo adquiere en aplicación de esta Ley mediante la acreditación de la totalidad de los requisitos para ellos exigidos, entre los que destaca uno en particular según su artículo 6, a saber, la prueba de la posesión, así: "La justificación de la posesión se acreditará con la declaración de tres testigos, vecinos del cantón donde se halle situado el inmueble, a los cuales se interrogará desde cuándo conocen la finca, si les consta que ha estado sometida por el titulante o por anteriores dueños a posesión durante un período continuo no inferior a 10 años, si esa posesión ha sido en forma pública, pacífica y en concepto de dueño y en qué actos ha consistido.
Asimismo el Juez interrogará a los testigos de oficio o a solicitud de parte, sobre cualquier otro dato que se considere de interés para probar la posesión. Todo lo anterior se hará sin necesidad de previo interrogatorio formulado por el interesado". (El resaltado no es del original).
La representación de las sociedades actoras solicitaron que en sentencia se declare el derecho de posesión que dijeron ostentar sobre el inmueble descrito en el plano No. P-986592-2005, ubicado en el distrito de Quepos, Cantón de Aguirre, provincia de Puntarenas, entre las coordenadas geográficas 371-373, latitud Norte, y 447-449 longitud Oeste de la hoja del Instituto Geográfico Nacional, que es terreno de bosque en regeneración, de bosque secundario, charrales y tacotal; con una cabida de 155 hectáreas, 1995 metros con 53 decímetros cuadrados, con los siguientes linderos actuales Norte: el Estado con el Parque Nacional Manuel Antonio y Río Naranjo, S.A.; Sur: Zona Marítimo Terrestre y el Océano Pacífico; Este: El Estado con el Parque Nacional Manuel Antonio; Oeste: el Estado con el Parque Nacional Manuel Antonio, Los Tepezcuintes S.A., Carlos Hidalgo Cárdenas y Daniel Sanahan Sanahan. Posesión que las sociedades actoras afirmaron ejerció originalmente el señor Nombre111213 , quien luego la traspasó al señor Herman Lutz Salazar y este a mediados del año 1975 la traspasó a la sociedad familiar "Nombre111208 .", y esa sociedad a la sociedad denominada "Los Currés, S.A." que a su vez la "segregó" en cinco inmuebles, y traspasó por partes iguales a los actoras, quienes aseguraron haberla ejercido desde el mes de setiembre de 1999 de manera quieta, pública, pacífica y en calidad de dueñas.
Posesión que indicaron, sumada entre todos los poseedores supera los 100 años. Solicitaron que, una vez declarado su derecho de posesión sobre el inmueble; se condene a las accionadas por haber incurrido en una actuación material, o vía de hecho, al desposeerlas del inmueble sin mediar un acto administrativo válido y eficaz y sin indemnización previa en los términos que lo garantiza el artículo 45 de la Carta Magna y en consecuencia se les condene a pagarles los extremos patrimoniales que indicaron en su demanda. Por su parte, las instituciones accionadas se opusieron a la demanda señalando en lo que interesa que el señor Nombre111213 , no generó un derecho posesión sobre el inmueble descrito en el plano Placa19634, ya que el inmueble pertenecía a la Municipalidad de Aguirre (Hoy Municipalidad de Quepos) y por tanto no se podía generar dicho derecho sobre un bien propiedad de una institución del Estado.
Que las actoras no acreditaron haber ejercido un derecho de posesión sobre el inmueble y que en todo caso luego de la emisión de la Ley mediante la que se creó el parque, No. 5100 del 30 de octubre de 1972, no se podía generar un derecho de ese tipo sobre un bien que constituye parte del "Patrimonio Natural del Estado". Criterio de la Cámara: Corresponde entonces determinar si las actoras ostentaron un derecho de posesión sobre el inmueble descrito en el plano No. P-986592-2005, en las condiciones que lo indicaron, es decir, generado por el señor Nombre111213 , quien lo traspasó al señor Herman Lutz Salazar y este a la sociedad familiar "Nombre111208 ." a mediados del año 1975, y esa sociedad a la sociedad denominada "Los Currés, S.A." que a su vez la segregó en cinco inmuebles, y traspasó el día 01 de setiembre de 1999 a las actoras en 5 partes iguales, y sólo en caso de confirmarse tal condición, entrar a analizar las procedencia de sus pretensiones tal y como fueron planteadas.
A contrario sensu, de no acreditarse la existencia del derecho alegado, por innecesario se entraría a conocer las pretensiones planteadas. En cuanto al inmueble que se describe en los planos P-7434-1973 y P-986592-2005, se tiene que este se ubica materialmente dentro de los linderos del Parque Nacional Manuel Antonio. Situación que fue confirmada en juicio por los Ingenieros Christian Stanley Chacón Barquero y Nombre111209 . De manera que no cabe duda que el inmueble sobre el que se reclama por parte de las actoras un derecho de posesión forma parte de un Parque Nacional. Ahora bien, en cuanto a la creación del Parque Nacional Playas de Manuel Antonio, tenemos que el Legislador costarricense por Ley No. 5100, denominada "Ley de Creación del Parque Recreativo Nacional Playas de Manuel Antonio", del 30 de octubre de 1972, dispuso: "Declárase Parque Nacional Manuel Antonio la zona comprendida entre los siguientes linderos, según los mapas básicos escala 1:50.000 del Instituto Geográfico Nacional, partiendo de un punto situado sobre la playa entre las coordenadas 371.000 N NIE22 sigue en orientación N 45° E y por una distancia de 250 metros hasta un punto situado sobre las coordenadas 371.15 N NIE74 sigue luego sobre la coordenada 447.200 E con rumbo Norte hasta la quebrada Camaronera, por la que sigue aguas arriba hasta alcanzar la coordenada 372.000 N. Sigue entonces por una línea recta con orientación S 50° E hasta alcanzar las coordenadas 371.000 N NIE75 De este punto, sigue sobre la coordenada 371.000 N con rumbo Este, hasta alcanzar las coordenadas 371.000 N NIE76 De este último punto sigue por la coordenada 449.650 E con rumbo Sur, hasta alcanzar la costa.
Las islas ubicadas frente a esta delimitación incluyendo la isla Magote y las situadas frente a playa Espadilla, lo mismo que hasta donde abarquen las aguas territoriales, se considera parte de este Parque Nacional". De esta forma, a partir del 30 de octubre de 1972, el Estado costarricense en el uso de sus potestades de imperio, dispuso que los terrenos ubicados dentro de las coordenadas que se indicaron, calificaba como un bien de dominio público, y que como tal, afecto a una tutela o relación de sujeción especial. En cuanto a la naturaleza de los bienes, tal y como se indicó supra el artículo 261 del Código Civil establece: "Son cosas públicas las que, por ley, están destinadas de un modo permanente a cualquier servicio de utilidad general, y aquellas de que todos pueden aprovecharse por estar entregadas al uso público....". Así en el caso que nos ocupa, los terrenos que conformaron el Parque Nacional Manuel Antonio por voluntad del legislador, entraron a formar parte de las cosas públicas y a una tutela especial, pues el artículo 262 de este mismo cuerpo normativo señala: "Las cosas públicas están fuera del comercio; y no podrán entrar en él, mientras legalmente no se disponga así, separándolas del uso público a que estaban destinadas." De esta forma, al afectar el legislador ordinario los terrenos que conforman el Parque Nacional Manuel Antonio, el día 30 de octubre de 1972; ello implicó de pleno derecho que desde esa fecha, esos terrenos fueron excluidos del comercio, de manera que nadie podría alegar un derecho de propiedad o de posesión válidamente generado, luego de la entrada en vigencia de la Ley No. 5100.
Otro punto importante de tomar en cuenta es el fin por el que los inmuebles comprendidos en el decreto legislativo, fueron sustraídos del comercio; pues lo fue para la creación de un "Parque Nacional", y aunada a la protección de los bienes de dominio público que otorga el artículo 262 del Código Civil, los Parques Nacionales como parte del Patrimonio Natural del Estado, gozan de una protección adicional, conforme a la legislación ambiental. Y es que el Estado Costarricense en tutela del medio ambiente, dispuso en el artículo 18 de la "Ley Forestal " No. 4465 del 25 de noviembre de 1969, que: "El Patrimonio Forestal del Estado está constituido por las Reservas Nacionales, Reservas Forestales, Parques Nacionales, Viveros Forestales del Estado, las Zonas Protectoras y Reservas Biológicas." De manera que a las tierras contempladas en los límites que estableció la Ley No. 5100 como parte del Parque Nacional Manuel Antonio, les sobrevino una protección más intensa por formar parte del "Patrimonio Forestal del Estado".
Por su parte la Ley No. 7174 "Ley Forestal" del 28 de junio de 1990, señaló en su artículo 32: "El patrimonio forestal del Estado está constituido por todos los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, de las fincas inscritas a su nombre y de las pertenecientes a las municipalidades, a las instituciones autónomas y a los demás organismos de la Administración Pública.". Por su parte el articulo 33) "Los terrenos forestales y bosques que constituyen el patrimonio forestal del Estado, detallados en el artículo anterior, serán inembargables e inalienables; su posesión por los particulares no causará derecho alguno a su favor y la acción reivindicatoria del Estado por estos terrenos es imprescriptible. En consecuencia, no son susceptibles de inscripción en el Registro Público mediante información posesoria; su invasión y ocupación serán sancionadas conforme con lo dispuesto en esta ley de aptitud forestal, quedarán automáticamente incorporados al patrimonio forestal del Estado." Finalmente la "Ley Forestal" No. 7575 del 16 de marzo de 1996, dispuso en su artículo 13): "Constitución y administración.
El patrimonio natural del Estado estará constituido por los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, de las fincas inscritas a su nombre y de las pertenecientes a municipalidades, instituciones autónomas y demás organismos de la Administración Pública, excepto inmuebles que garanticen operaciones crediticias con el Sistema Bancario Nacional e ingresen a formar parte de su patrimonio. El Ministerio del Ambiente y Energía administrará el patrimonio. Cuando proceda, por medio de la Procuraduría General de la República, inscribirá los terrenos en el Registro Público de la Propiedad como fincas individualizadas de propiedad del Estado. Las organizaciones no gubernamentales que adquieran bienes inmuebles con bosque o de aptitud forestal, con fondos provenientes de donaciones o del erario, que se hayan obtenido a nombre del Estado, deberán traspasarlos a nombre de este.
Y el artículo 14): "Condición inembargable e inalienable del patrimonio natural. Los terrenos forestales y bosques que constituyen el patrimonio natural del Estado, detallados en el artículo anterior, serán inembargables e inalienables; su posesión por los particulares no causará derecho alguno a su favor y la acción reivindicatoria del Estado por estos terrenos es imprescriptible. En consecuencia, no pueden inscribirse en el Registro Público mediante información posesoria y tanto la invasión como la ocupación de ellos será sancionada conforme a lo dispuesto en esta ley." De esta forma, la Ley Forestal " No. 4465 del 25 de noviembre de 1969, y sus reformas mediante Ley No. 7174 y Ley No. 7575, dotaron una tutela especial sobre el Patrimonio Forestal del Estado y esta protección se extendió a los terrenos incluidos dentro del Parque Nacional Manuel Antonio por disposición expresa de la Ley No. 5100 de manera que posterior al día 30 de octubre de 1972, ningún particular puede alegar derecho ---como el de posesión o de propiedad--- generado válidamente sobre esos inmuebles.
Luego, con el fin de no afectar a poseedores de buena fe en esta áreas, el legislador emitió la "Ley de Informaciones Posesorias" No. 5257 del 31 de julio de 1973, la cual dispone en su artículo 7: "Cuando el inmueble al que se refiera la información esté comprendido dentro de un área silvestre protegida, cualquiera que sea su categoría de manejo, el titulante deberá demostrar ser el titular de los derechos legales sobre la posesión decenal, ejercida por lo menos con diez años de antelación a la fecha de vigencia de la ley o decreto en que se creó esa área silvestre..." De esta forma, si bien nadie puede alegar un derecho de propiedad, o de posesión, posterior a la afectación que haga el Estado por ley o por decreto al incorporarlo al Patrimonio Natural del Estado; si puede reclamar la posesión ejercida con anterioridad en los términos en que lo prescribe el citado artículo. De esta forma el interesado deberá acreditar que la posesión la ejerció al menos 10 años antes a la fecha de creación del área silvestre.
Sobre esta exigencia la Sala Primera en su voto No. 001485-F-S1-2017 de las 09:25 horas del 30 de noviembre de 2017, señaló: "...V.- En primer término, esta Sala debe aclarar que los planos catastrados A-241056-1995, A-591564-1999, A-656768-2000, A-656769-2000 (objeto de este proceso de lesividad) sí se encuentran ubicados dentro de la Reserva Biológica Alberto Manuel Brenes (San Ramón); la cual, desde el 20 de junio de 1975, por medio de Decreto Ejecutivo N° 4960-A, fue declarada zona protegida. Consecuentemente, forman parte del patrimonio natural del Estado de conformidad con los numerales 13 de la Ley Forestal y 32 de la Ley Orgánica del Ambiente. En este sentido, recuérdese, conforme al numeral 13 de la Ley Forestal “El patrimonio natural del Estado estará constituido por los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, de las fincas inscritas a su nombre y de las pertenecientes a municipalidades, instituciones autónomas y demás organismos de la Administración Pública, excepto inmuebles que garanticen operaciones crediticias con el Sistema Bancario Nacional e ingresen a formar parte de su patrimonio…”.
Dentro de las posibilidades que se brindan, el mandato legal es claro al determinar que una propiedad cubierta por bosque y terrenos forestales de las reservas nacionales, forma parte del patrimonio natural del Estado. Aclarado lo anterior, es necesario señalar lo dispuesto por la norma 47 del Decreto Ejecutivo 13607, Reglamento a la Ley del Catastro Nacional vigente al momento de los hechos: “ARTICULO 47.- El Catastro Nacional no inscribirá planos de propiedades particulares que se encuentren localizadas en cualquier tipo de reserva o parques nacionales, excepto cuando exista autorización de la entidad correspondiente. En estos casos se anotará claramente que la finca se encuentra localizada en una reserva o parque nacional e indicará además las limitaciones a las que quedará sujeta por ley- Esta autorización deberá constar en el plano.” Este mandato es replicado por el numeral 80 del actual Reglamento a la Ley del Catastro Nacional no. 34331.
Esa prohibición de inscribir en el Catastro Nacional planos de terrenos ubicados en áreas silvestres protegidas, es consecuencia de la inalienabilidad del patrimonio natural del Estado el cual constituye un bien de dominio público. De igual forma, por motivos de interés público, el Estado es el encargado de actuar como policía demanial, procurando la protección, conservación y custodia de las áreas y especies naturales. En este ejercicio, no existe duda que la legislación nacional, en sus diversas normas ambientales, le ha otorgado al Estado la potestad de prohibir, restringir o limitar ciertas actividades del hombre, o bien sujetarlas al otorgamiento previo de un permiso o autorización como sucede en el precepto 47 comentado. En el caso concreto, al momento de otorgarse cada uno de los visados cuestionados -declarados lesivos por el MINAE-, el Estado era conocedor que sobre los terrenos que aquellos planos describían, estaba constituida la Reserva Biológica Alberto Manuel Brenes.
En otros términos, esos planos fueron levantados sobre bienes inembargables, imprescriptibles, inalienables y que están fuera del comercio de los hombres. Ante tal panorama, más allá de la posesión que alegaren los ocupantes de esos terrenos, la autorización no debió ser concedida, salvo que por alguna razón alegaran y demostraren mejor derecho de posesión anterior a la creación de la reserva según lo dispuesto por el canon 7 de la Ley de Informaciones Posesorias. Ese numeral dice lo siguiente: “ARTÍCULO 7º.- Cuando el inmueble al que se refiera la información esté comprendido dentro de un área silvestre protegida, cualquiera que sea su categoría de manejo, el titulante deberá demostrar ser el titular de los derechos legales sobre la posesión decenal, ejercida por lo menos con diez años de antelación a la fecha de vigencia de la ley o decreto en que se creó esa área silvestre… Sin excepción alguna, los planos catastrados que se aporten en diligencias de información posesoria, deberán ser certificados por el Ministerio del Ambiente y Energía, por medio del ente encargado, el cual dará fe de si el inmueble que se pretende titular se encuentra dentro o fuera de esas áreas silvestres protegidas.”.
Ese es el contexto legal dentro de la cual se encuentra ubicada esta autorización, por lo que se entiende que si tal visado es solicitado, es porque el interesado dispone de la posesión decenal, ejercida por lo menos con 10 años anteriores a la fecha de vigencia de la ley o decreto en que se creó esa área silvestre. Si se permite que particulares soliciten la inscripción de planos de bienes demaniales, particularmente forestales, en el tanto no demuestren haber poseído el inmueble 10 años antes de la creación del área silvestre protegida, atentaría contra la inalienabilidad de tales terrenos y los sometería al escenario de la voluntad privada con todo lo que ello involucra, como la obtención de beneficios, títulos de propiedad o en el peor de los casos, a daños ambientales de imposible reparación. De ahí que se haya ideado un trámite administrativo previo a la inscripción de planos que se encuentren localizadas en cualquier tipo de reserva o parques nacionales, bajo la denominación “autorización”.
Nótese, la regla general es que: “El Catastro Nacional no inscribirá planos de propiedades particulares que se encuentren localizadas en cualquier tipo de reserva o parques nacionales…”. El visado como autorización (numeral 57 del Decreto Ejecutivo 13607), insiste este Órgano Decisor, necesariamente debe ser analizado en relación con el precepto 7 de la Ley de Informaciones Posesorias recién transcrito. Lo anterior, pues solo si se cumple con esa posesión decenal ecológica, el visado debería ser concedido sin problemas, pero para efectos meramente catastrales. De ahí la importancia que que los co-demandados demostraran en este proceso, que cumplieron con la posesión decenal anterior al 26 de junio de 1975, fecha de creación de la zona protegida en mención por medio del Decreto Ejecutivo no. Placa19641. Sin embargo, ninguno de ellos demostró lo anterior, por lo que era imposible otorgarles la autorización que menciona la norma en estudio.
En otros términos, demostrar esta posesión como requisito para obtener la autorización, procede de la interpretación armónica del ordenamiento jurídico, específicamente de las normas 57 del Decreto Ejecutivo 13607 y 7 de la Ley de Informaciones Posesorias. Ergo, esa autorización que debe dar el “ente” competente, sea el MINAE, no es una simple formalidad como expone el Tribunal, es una verificación de requisitos que como tal, involucra una serie de actuaciones y procedimientos tendientes a dar cumplimiento al fin último de la norma, sea la tutela y protección de los bienes naturales del Estado. Por todo ello, también lleva razón el Estado cuando alega que, si no se ha ejercido aún la recuperación posesoria de las áreas del patrimonio natural del Estado objeto del proceso, mal haría la Administración en permitir que sean catastradas a nombre de particulares. Lo anterior, pues efectivamente tales actuaciones podrían traer consecuencias irreparables al patrimonio natural del Estado.
No se trata de que a través de ese visado se esté otorgando derechos de posesión o de propiedad, eso lo tiene claro esta Cámara, pues el competente para ello, será la persona juzgadora del respectivo proceso de Información Posesoria. Empero, con ese visado, la Administración (custodio y guardián de los bienes demaniales) sí estaría brindando una autorización a particulares, para que se inscriban planos sobre bienes parte de una reserva, lo cual, se insiste, atentaría contra la demanialidad de tales terrenos, máxime si antes no se ha verificado la existencia de requisitos legales de posesión. Así las cosas, es evidente que sin mayores esfuerzos, la Administración otorgó el derecho a particulares, de poder gestionar la inscripción de planos sobre bienes que desde 1975 son parte de una reserva biológica. Si tales autorizaciones no fueron otorgadas con el más estricto cuidado y minuciosidad en protección de tales bienes, lo correcto era promover la lesividad de tales actos o visados, así como la inscripción de cada uno de los planos que le siguieron (planos no. A-241056-1995 inscrito a nombre de Nombre59163; el no. A-591564-1999 inscrito a nombre de Nombre59163; el no. A-656768-2000 inscrito a nombre de Nombre59163 y Nombre59163; y, el no. A-656769-2000 inscrito a nombre de Nombre59163 y Nombre59163).
Justamente porque las autoridades administrativas, quienes otorgaron las autorizaciones indicadas, no realizaron los estudios y análisis correspondientes, para verificar si los interesados mantenían o no la posesión decenal de esos terrenos (originaria o derivada), y tampoco los interesados la demostraron (hasta antes de la creación de la Reserva mediante Decreto Ejecutivo 4960-A del 26 de junio del año 1975). En similar sentido, ha interpretado esta Sala el tema del visado y el requisito de la posesión decenal (sentencia 000808-F-S1-2012 de las 8 horas 35 minutos del 5 de julio de 2012). No se trata simplemente de estampar en el plano si el terreno se ubica o no en una reserva como interpreta el Tribunal. Por el contrario, se habla aquí de bienes ubicados en áreas silvestres protegidas, no de simples fincas agrícolas o privadas. Por ende, esa autorización debe ser brindada por el MINAE pero con base en el filtro de estudios, informes, audiencias, o cualquier otra actuación que estime conveniente en defensa del demanio.
Por lo demás, los medios probatorios presentados por los co-demandados y mediante los cuales pretendieron sustentar su posesión decenal, no tienen la virtud de acreditar que esta sea anterior a la declaratoria de reserva biológica de los terrenos que reclaman. En este punto concreto, se remite a las partes a lo expuesto por la Jueza de primera instancia, todo lo cual es prohijado por esta Sala. Analizado el expediente, ningún elemento de prueba sometido al contradictorio evidencia la posesión desde junio de 1965. En consecuencia, el recurso del Estado debe ser acogido." (Resaltado es nuestro). De este modo, quien pretenda hacer valer un derecho de posesión sobre un bien que ha ingresado a formar parte del Patrimonio Natural del Estado deberá asumir la carga de la prueba y acreditar que su derecho de posesión se originó 10 años antes de la creación de la reserva o parque nacional, por Decreto o por Ley, caso contrario no podrá accederse jurisdiccionalmente a tal pedido.
En el caso sub exámine tal y como se indicó supra, no se peticiona que en sentencia se otorgue a través del respectivo título la propiedad sobre un bien inmueble sin inscribir mediante el procedimiento previsto en la Ley de Informaciones Posesorias, a partir de la posesión ejercida sobre éste en cumplimiento integral de los presupuestos previstos para ello en dicho cuero normativo, sino que, con base en el derecho de posesión (uno sólo de los elementos del dominio) que aseguraron las actoras generó el señor Nombre111213 originariamente, quien traspasó ese derecho al señor Herman Lutz Salazar y este a la sociedad "Inversiones Lutz S.A." y esta a su vez, a la sociedad "Los Currés, S.A." que finalmente la traspasó en partes iguales entre las aquí actoras, por escritura No. 86, otorgada a las 17 horas del 01 de setiembre de 1999, se les indemnice a título del pago por los daños y/o perjuicios ocasionados por un acto material que identificaron como una desposesión, siendo que argumentan que fueron desposeídas del inmueble por las vías de hecho y sin ser indemnizadas, y así, se condene a las accionadas al pago de los extremos patrimoniales que reclamaron.
Para esta Cámara es claro que conforme a la normativa y jurisprudencia citada, luego del 30 de octubre de 1972, ningún particular podría mantener o generar de buena fe, y por ende exigir la indemnización por un derecho de posesión generado posteriormente a la creación legal del parque nacional. Ello por cuanto a partir de esa fecha el bien de interés salió del comercio de los hombres, conforme lo que señala el articulo 262 del C.C. y la Ley Forestal. Por otro lado, para efectos puramente indemnizatorios sí se podría reconocer ese tipo de derecho y su respectiva indemnización, siempre que se acredite conforme a lo dispuesto en el artículo 7 de la Ley de Informaciones Posesorias, que el derecho de posesión se constituyó al menos 10 años antes de la creación por ley o por decreto del área silvestre protegida, cualquiera sea su clase o categoría y siempre que la reclamación se haya hecho en tiempo y forma.
De manera que la posesión alegada posterior al 30 de octubre de 1972, no puede ser considerada bajo ningún supuesto y los instrumentos jurídicos que hayan dispuesto su traspaso, no surtirá ningún efecto legal, ni un plano catastrado tal y como se indicó en la jurisprudencia citada. Y es que un elemento esencial para que se constituye al amparo de la ley el derecho de posesión, es que el o los poseedores actúen bajo un principio de buena fe y que el derecho recaiga sobre una cosa o bien hábil, es decir que se encuentre dentro del comercio. Consecuencia de lo hasta aquí dicho, es que las escrituras No. 26, de las 10 horas del 04 de marzo de 1975 , o la No. 48, de las 17 horas del 23 de junio de ese mismo año, o la No. 86, de las 17 horas del 01 de setiembre de 1999; no pueden constituir un mecanismo jurídico válido para traspasar ningún derecho de propiedad o posesión sobre un inmueble que desde el día 30 de octubre de 1972, pasó a formar parte de los bienes demaniales del Estado, pues como se indicó supra, el artículo 261 del Código Civil "Ley No. 30 del 19 de abril de 1885 con rige a partir del 01 de enero de 1888" establece que las cosas públicas están fuera del comercio y que quienes comparecieron en dicho instrumento sabían de la situación jurídica que sobre esos inmuebles sobrevino posterior al 30 de octubre de 1972, con ocasión de la aprobación y puesta en vigencia de la Ley No. 5100, Ley de Creación del Parque Nacional Manuel Antonio.
Y bajo el principio de que nadie puede alegar ignorancia de la Ley (artículo 129 de la C.P.) desde esa fecha supieron de la naturaleza jurídica que esos terrenos adquirieron por mandato legislativo, al formar parte del Patrimonio Natural del Estado y por ende regidos no sólo por lo dispuesto en el artículo 262 del C.C., ---en cuanto excluidos del comercio--, sino también por la Legislación Forestal, razón por lo que ningún particular puede reclamar un derecho como el de posesión de manera válida. Así, en cuanto al derecho de posesión, lo único que cabría analizar, es si al menos 10 años antes de la creación del Parque Nacional Manuel Antonio, a saber, entre el 30 de octubre de 1962 y el 30 de octubre de 1972, en los términos en que lo indica el artículo 7 de la "Ley de Informaciones Posesorias", se constituyó un derecho de posesión sobre el inmueble y por ende reclamable frente al Estado y sus instituciones.
Al respecto tenemos que para efectos de acreditar la posesión, las sociedades actoras presentaron como únicos elementos de prueba, la declaración de los testigos Nombre111205 y Nombre111206 . Así y de entrada, no se da cumplimiento a lo dispuesto en el artículo artículo 6 de la Ley de Informaciones Posesorias en lo que para estos efectos exige la justificación de la posesión mediante la declaración de tres testigos, de modo que bastaría con esta circunstancia para no poderse tener por acreditada legalmente la posesión necesaria. Con todo y lo anterior, para estos efectos declaró el señor Nombre111205 el día 06 de enero de 2014 de manera anticipada en el Juzgado Contravencional de Menor Cuantía de Aguirre ante el Juez Celso Fernández Delgado, momento en el que habría manifestado lo siguiente: "Nací en Santa Cruz, me vine de la zona por cuestiones de trabajo. Trabajé con Lutz, que tenía arroz y ganado.
La Hacienda se llamaba Lutz localizada en Azul. Esta hacienda colinda arriba con Roncador, con el mar, con la bananera esta Bananera, antes de ser bananera era pura montaña. Ante nos había carretera ni pueblo, antes no había nada. Antes vivía Alcevidiades que tenía terrenos. El terreno de Nombre111215 está a la derecha dando la espalda a la colindancia del mar. Alcivididades le repartió la propiedad a los hijos, no conozco otro dueño de esa propiedad. El lado de la colindancia de la Bananera (era por el lado del sol), al contrario Nombre111215 y al otro lado el mar. No conozco mas colindancia. Yo era Jefe de campo en la finca, trabajaba con ganado. La finca era muy grande no se como decir cuanto mide. Estaba cercada con poste macizo, con poste vivo. Yo conocí a Buster Land, la Finca de el pegaba con Don Geman en el lado del Sol, en la parte de arriba. Se procede a realizar preguntas por parte de la Licenciada Adriana Bonilla Bonilla: Vivo aquí desde que tenía veinte años y ya tengo noventa y dos.
Yo trabajé con Nombre111214 desde que llegué aquí y después con Glen Lutz París." Nótese que el señor Nombre111205 indicó que laboró con Lutz sin precisar nombre alguno, y si bien dice haber laborado para este señor, ni el declarante, ni las sociedades actoras acreditaron mediante prueba idónea que efectivamente esa relación laboral se hubiese dado, como lo podría ser, un historial del pago de cuotas obrero-patronales que para los efectos lleva la CCSS, registros contables de pago de salario, aguinaldo, vacaciones, incapacidades, etc. Luego, señaló que en la finca se explotaba con ganado y la siembra de arroz, sin precisar detalles, si el arroz se producía para vender o para consumo, o alimento para los animales, etc, y si se vendía, a quien se le vendía, etc. Igualmente en cuanto al ganado, no precisó que tipo de ganado, y cual era su destino. Si ese ganado se vendía y si se vendía a quien se le vendía, o si se llevaba a matadero, a cual matadero, etc. Luego indicó que la Hacienda se llamaba Lutz, sin embargo ha sido un hecho probado que en la zona los Lutz tuvieron aparte de la que afirmaron describe el plano P-986592-2005, otras dos fincas que sí se encontraban inscritas en el Registro Público de la Propiedad a saber, la finca No. 129484-001 al 005 con plano P-448729-97 de 16 has.113m2; y la finca No. Placa19631 , con plano P-448733-97 de 119,59 ha, las cuales fueron adquiridas y canceladas por el Fideicomiso Parque Nacional Manuel Antonio.

Además el testigo no precisó a cual finca se refería, si era a alguna de las inscritas registralmente o a las que describía el plano P-986592-2005. Además, el testigo no precisó con alguna especie de rigor colindancias de la supuesta finca y se refirió a un señor al que llamó Nombre111215 y a otro al que denominó Buster Land, quienes no tiene relación en la presente causa. Por su parte el señor Nombre111206 se presentó el día 09 de noviembre de 2017, y de manera anticipada también declaró en el Juzgado Civil y de Trabajo de Quepos, ante la Jueza María Cristina Cruz Montero; y bajo la fe de juramente señaló que llegó a la zona a la edad de 10 años y que vivía allí desde hacía 30 años. Que llegaron a vivir a la par de la Finca Tamarindo, la cual indicó era propiedad del señor Nombre111214 , e indicó que a esa fecha ---09 de noviembre de 2017---, todavía existía y que se pensionó laborando para dicha finca hacía 10 años.
Que esa finca (Tamarindo) colindaba con Alcidades Zúñiga, y con el mar por el rumbo sur. Que Alcidades se encontraba al lado izquierdo y al lado derecho quedaba la Boca del Río Naranjo. Que luego, Alcidades vendió a un señor Nombre111216 quien era extranjero. Que la finca Tamarindo, después de Don Nombre111214 no tuvo más dueños y luego que este fallece, la finca pasó a sus hijos, Douglas, Randolph, Lucía y Nombre111217. Que había un río cerca, que es el Río Naranjo. Que la finca se dedicaba al ganado y que en la finca habían casas donde vivían los peones. Que fue peón de Don Nombre111214 y cuando falleció siguió laborando en la finca y quien le daba órdenes y le cancelaba el salario eran los hijos de don Nombre111214. Que desde que llegó la finca era potreros con una topografía irregular, una parte cerro, terreno quebrado y parte plana. Que la propiedad que estaba al lado de Río Naranjo también era de don Nombre111214 , sin recordar cuanto medía la finca y señaló también que en ese momento la finca no existía porque lo que había cultivado era palma y desconocía quien era su dueño actual.
En criterio de esta Cámara, el testimonio del señor Nombre111206 también adolece de precisión como para acreditar la generación de un derecho de posesión conforme a los terrenos que describe el plano P-986592-2005. Y es que no se detalla con precisión linderos del inmueble que describe el testigo. Referencia que en el se llevaba a cabo la explotación de ganado, pero no indica si ese ganado se comercializaba, y si se comercializaba con quien se comercializaba. Luego, tampoco se hizo un esfuerzo por demostrar la relación laboral del testigo para con las sociedades actoras o sus predecesores. Finalmente, al día en que declaró, a saber el día 09 de noviembre de 2017, a pregunta del señor Procurador indicó que desconocía quien era el dueño actual del inmueble y afirmó que en la finca que describió, existía a ese momento palma, lo cual no coincide con la realidad forestal de los terrenos que hoy forman parte del Parque Nacional Manuel Antonio.
De esta forma, el testimonio de los señores Nombre111205 y Nombre111206 , resultan insuficientes como para tener por acreditada algún derecho de posesión ejercido por el señor Nombre111213 o el señor Herman Lutz Salazar entre el 30 de enero de 1962 y el 30 de enero de 1972, fecha de emisión de la Ley 5100, "Ley de Creación del Parque Nacional Manuel Antonio", pues se trataron de manifestaciones vagas, imprecisas, sin referencias de modo, tiempo o lugar, actividades precisas, lugares exactos, actividades desplegadas dentro del inmueble, etc. Aunado a que la cantidad de testigos es insuficiente para acreditar la posesión sobre un inmueble, pues el artículo 6 de la Ley de Informaciones Posesorias, que reiteramos, indica: "La justificación de la posesión se acreditará con la declaración de tres testigos, vecinos del cantón donde se halle situado el inmueble, a los cuales se interrogará desde cuándo conocen la finca, si les consta que ha estado sometida por el titulante o por anteriores dueños a posesión durante un período continuo no inferior a 10 años, si esa posesión ha sido en forma pública, pacífica y en concepto de dueño y en qué actos ha consistido.
Asimismo el Juez interrogará a los testigos de oficio o a solicitud de parte, sobre cualquier otro dato que se considere de interés para probar la posesión. Todo lo anterior se hará sin necesidad de previo interrogatorio formulado por el interesado." De esta forma, no tiene este Tribunal acreditada la posesión que se indicó generó sobre el inmueble descrito en el plano No. P-986592-2005, el señor Nombre111213 o el señor Herman Lutz Salazar, de al menos 10 años antes del 30 de enero de 1972. Y es que como se ha reiterado, el plano por sí mismo no tiene la virtud de acreditar la existencia de un derecho como el de posesión, luego ese plano fue confeccionado en el año 2005, es decir, aproximadamente 33 años después de la emisión de la Ley No. 5100. Otro punto a resaltar es que la representación de las sociedades actoras aseguró, que el Estado las desposeyó por las vías de hecho y que a la fecha de la presentación de la demanda omisa en cuanto al pago de la indemnización a pesar de que se había realizado avalúos y ordenado el pago.
En relación con esa supuesta actuación administrativa que las mismas partes accionantes identificaron como material, en ningún nivel precisan circunstancias de modo tiempo y lugar, pese ser esta una circunstancia fáctica medular para su teoría del caso, como parte de la causa de pedir. Luego, aún y pasando esto por alto, en cuanto a la desposición del inmueble, esa representación no acreditó por ningún medio que esta se hubiese dado, no acreditó que institución lo hizo, cómo o cuándo. Si se hizo por medio de la policía o por instituciones encargadas de la tutela y protección del medio ambiente. Podría explicarse el hecho de que las partes actoras no se haya encontrado en posición de describir las circunstancias en que habrían sido materialmente despojadas del inmueble en cuestión, con causa en que no se han encontrado en posición de demostrar la posesión que se dice, habrían sido ejercida.
Como consecuencia lógico necesaria, si no se acreditó ostentar un derecho de posesión, tampoco se podría tener por acreditada lesión alguna a este, ya por una supuesta desposesión material, ya por la creación legal del Parque Nacional de interés, caso en el cual estaríamos hablando de una eventual responsabilidad del Estado Legislador, de mediar los presupuestos para ello, aunque esta tesis no es la planteada por quienes accionan. Luego, si bien existió un avaluó, en este se advirtió de las condiciones que presentaba el terreno que describía el plano Placa19642. Véase que el Ingeniero Agrónomo Gerardo Ramírez Villalobos señaló en cuanto a la posesión, que esta era incompleta y que del estudio del Registro no se pudo verificar la posesión del inmueble a nombre de Curres S.A. Tampoco acreditó esa representación que se hubiese emitido un acto administrativo en el que se hubiese dispuesto el pago de la propiedad que describe el plano No. P-986592-2005.
Esta conducta administrativa por su naturaleza jurídica y alcances, no guarda identidad con un acto administrativo firme y favorable. Por el contrario, se tiene que por oficio DAJ-1004 del 30 de septiembre de 2002, el Departamento Legal del MINAET le indicó al señor Agustín Atmetlla Herrera, que para efectos de pago del inmueble debía acreditar que se encontraba inscrito porque de lo contrario, debía acreditar dicha titularidad ante los Tribunales. Posteriormente el señor José Francisco Mattey Fonseca, Presidente de la "Junta Directiva del Parque Recreativo Parque Nacional Playas de Manuel Antonio"; consultó a la Procuraduría General de la República la situación referida al pago del inmueble que describió en su momento el plano No. Placa19643 a nombre de la Sociedad "Los Curres S.A." y esa Procuraduría en el Dictamen OJ-046-2004, del 16 de abril de 2004, indicó que había una inadecuada diligencia para acreditar los pretendidos derechos posesorios.
Criterio reiterado posteriormente por esa Procuraduría en su dictamen C-024-2006 del 23 de enero de 2006, ante nueva consulta que hiciera el señor Mattey Fonseca por nota del 07 de diciembre de 2005. Además de que por nota de fecha 06 de marzo de 2006, la Junta Directiva del Parque Recreativo Nacional Playas de Manuel Antonio, le indicó a la Licenciada Rosibel Carmona Delgado, Coordinadora de Estudio de la División de Fiscalización Operativa y Evaluativa del Área de Servicios Agropecuarios y de Medio Ambiente Contraloría General de la República, que respecto a la reclamación de las actoras, según los Dictámenes de la Procuraduría General de la República Nos. O.J.-046-2004 y O.J.-024-2006; no se demostró derecho la posesión sobre el inmueble que allí se indicó y que toda posible reclamación estaba prescrita, por lo que se debían inscribir dichos terrenos a nombre del Estado. También se tuvo acreditado que por oficio ACOPAC-605-06 del 23 de junio de 2006, el señor Mario Coto Hidalgo, en su condición de Director del Área de Conservación Pacífico Central (ACOPAC), le indicó al Ingeniero Ronald Vargas, Director del Sistema Nacional de Áreas de Conservación (SINAC), que conforme a lo indicado por la Procuraduría General de la República en su Dictamen OJ-046-2004, no procedía la compra de la finca Los Curres, y que así fue comunicado a la Contraloría General de la República por oficio ACOPAC-D-225-06.

En cuanto a la denuncia penal que se planteó el día 23 de febrero de 2007, ante la Fiscalía de Dirección3332 contra el señor Nombre111210 , por el presunto delito de Falsificación y Alteración de Documentos, Falsedad Ideológica y Peculado, con Ocasión de Estafa; indicar que en ningún momento se acreditó que los dineros sustraídos fueran destinado mediante acto administrativo para el pago de los terrenos descritos en el plano No. P-986592-2005. Ahora bien, en cuanto a la carga de la prueba, es de recordar que a la sombra de lo normados por el artículo 41.1 del nuevo Código Procesal Civil con relación al 220 del Código Procesal Contencioso Administrativo, es obligación de la parte probar su dicho, lo que en la especie no lo hizo. De la relación de ambos artículos se deriva lo que se conoce como el onus probandi (o carga de la prueba) expresión latina del principio jurídico que señala quién está obligado a probar un determinado hecho ante los tribunales.
El fundamento del onus probandi radica en un viejo aforismo de derecho que expresa que "lo normal se presume, lo anormal se prueba". Por tanto, quien invoca algo que rompe el estado de normalidad, debe probarlo ("affirmanti incumbit probatio": a quien afirma, incumbe la prueba). Básicamente, lo que se quiere decir con este aforismo es que la carga o el trabajo de probar un enunciado debe recaer en aquel que rompe el estado de normalidad (el que afirma poseer una nueva verdad sobre un tema). De forma que al no haber acreditado las sociedades actoras ningún derecho de posesión constituido legalmente sobre el inmueble que indicaron siendo ese presupuesto, aquel sobre en el que en su totalidad fue erigida la procedencia de las pretensiones integralmente entendidas, bajo los parámetros legales referenciados, lo procedentes es declarar la demanda sin lugar en todos sus extremos, como en efecto se dispone.
Las accionadas opusieron en su defensa las excepciones de prescripción, falta de interés actual, falta de legitimación activa y pasiva y falta de derecho. Por la forma en que se resuelve, por innecesario nos referiremos a la excepción de prescripción, pues no habiéndose acreditado derecho amparable a favor de las actores, resultaría absolutamente estéril analizar si las actoras plantearon su reclamación en tiempo. Sobre la excepción de falta de interés actual, la misma debe rechazarse toda vez que las sociedades actoras presentaron proceso contencioso civil de hacienda solicitando el reconocimiento patrimonial sobre un derecho de posesión, que se dijo les fue cercenado por el Estado por las vías de hecho, circunstancia que continua expectante -interés actual- de una resolución a sus pedimentos. Lo anterior, sin duda alguna les da derecho a requerir se le resuelva judicialmente su gestión por lo que no ha operado una pérdida de interés actual y por ende debe rechazarse dicha excepción.
Sobre la excepción de falta de legitimación, debe advertirse que la legitimación constituye la capacidad, la aptitud para ser parte de un proceso concreto, como parte pasiva, dependiendo de las condiciones que para tal efecto, la ley procesal preceptúa con relación a la pretensión que se plantea. Ahora, la legitimación deviene ya sea de la relación jurídico-administrativa establecida entre el actor y la Administración, o bien de la ley, de acuerdo a la que ella haya establecido al respecto. Y es que en un proceso existen dos tipos de legitimación, para el proceso (ad procesum) o para la causa (ad causam). La primera (ad procesum) consiste en una cuestión procesal, en otras palabras, si quien se apersona tiene capacidad de actuar conforme a la ley o si actúa por otro con el tipo de representación legal adecuada ajustada a nuestra normativa. La segunda (ad causam) versa en verificar si la persona que interpone la demanda tiene jurídicamente hablando un derecho que reclamar, es decir; la parte legitimada es aquella persona que al tenor del derecho de fondo tiene una determinada relación-jurídica con el objeto del proceso, sea la pretensión.
En el caso que nos ocpa no cabe duda que quienes accionan gozan de la legitimación ad procesum, mas no una legitimación ad causan lo que conlleva una falta de derecho, pues no acreditó por ningún medio que ostentara el derecho de posesión sobre el inmueble que referenciaron. Ahora, en cuando a la falta de derecho, es menester remitirse a la demostración de los hechos, como parte fundamental de ello, porque de lo que en ese acápite se determina, se podrá desprender si existen o no las bases legales para lo pretendido y no habiéndose acreditado derecho amparable a favor de las actoras, lo procedente es acoger la excepción de falta de legitimación ad causan y falta de derecho y rechazar la demanda.
De conformidad con el numeral 193 del Código Procesal Contencioso Administrativo, las costas procesales y personales constituyen una carga que se impone a la parte vencida por el hecho de serlo. La parte vencida en la presente causa lo han sido las sociedades actoras y en consecuencia, se les condena al pago de ambas costas generadas como consecuencia de la tramitación de la presente causa en favor del Estado, del SINAC y de la Junta Directiva del Parque Recreativo Nacional Playas Manuel Antonio. La determinación de lo correspondiente a las costas en cuanto a su importe se habrá de definir por el juez competente en la fase de ejecución de sentencia a ruego de las accionadas.
POR TANTO:
Por la forma en que se resuelve por innecesario nos referimos a la excepción de prescripción. Se rechaza la excepción de falta de interés actual, la falta de legitimación pasiva y falta de legitimación activa ad procesum. Se acoge las excepciones de falta de legitimación ad causam activa y falta de derecho. En consecuencia, se declara improcedente en todos sus extremos la demanda incoada por las sociedades LOS CURRES S.A. ACHI DE BOCA NARANJO QUEPOS LTDA. INVERSIONES KLAN S.A. ACILU S.A. Y CULTIVOS Y MOVILIZACIÓN TIERRAS S.A. contra EL ESTADO, EL SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN Y LA JUNTA DIRECTIVA DEL PARQUE RECREATIVO NACIONAL PLAYAS MANUEL ANTONIO. Son ambas costas a cargo de las sociedades actoras. La determinación del importe en cuanto a las costas, se habrá de definir por el juez competente en fase de ejecución de sentencia a ruego de la representación de las accionadas. Notifíquese.
