CONSIDERING:
I.The request for evidence to supplement the record is denied as unnecessary, pursuant to article 52 of the Ley de Jurisdicción Agraria.-
II.The list of facts found to have been proven is adopted because it is consistent with the evidentiary record (acervo probatorio).-
IV.Attorney Roberto Soto Vega, counsel for the plaintiff, files an appeal against said decision, stating as follows: SUBSTANTIVE GROUNDS FOR APPEAL: “GROUND I: INCORRECT DETERMINATION OF THE LIST OF UNPROVEN FACTS: The undersigned considers that unproven facts 3, 5, and 6 are facts that my client proved, on the following grounds: Regarding unproven fact 3), this fact was indeed proven. If we examine the judicial inspections (reconocimientos judiciales), my client states that the area where the gravel road runs along the riverbank and the corner or intersection area where the testimonial evidence was received belonged to her; this is established as follows. As I shall explain in this appeal, Articles 78, 79, and 84 establish the doctrine of accession by alluvion (accesión por aluvión). In the present matter, the two witnesses for the plaintiff presented by my client state that this corner area belonged to my client.
As will also be explained herein, it was evident that the area where the evidence was received belonged to my client’s property by operation of law; that is, regardless of whether or not it formed part of her registered property, it was established that it was part of my client’s property. Both witnesses—[Nombre4], who has known the property for as long as he can remember, and [Nombre5], who stated that he has known the area for more than 23 years—indicated that this area (referring to the intersection and the right branch of the river), as well as the area where the gravel road runs along the riverbank, formed part of my client’s property. This is the appropriate evidence to establish this fact, and topographic evidence showing that it formed part of my client’s registered property was unnecessary, because it could well have been outside that registered area and, over the years, no water flowed through that location (there was no evidence to the contrary); thus, my client’s ownership of the area was established.
Furthermore, it was unnecessary to establish that the defendant was the party that encroached upon and eliminated that area in order to incorporate it into the mining concession (concesión minera), because the defendant acknowledged at the site that it was they who did so, and the mounds and the gravel road made from materials from the area show that the defendant was the party that transformed it; this is a notorious and evident fact. Nevertheless, it was also established through testimonial evidence, since both witnesses stated that it was the defendant. The time at which the witnesses may have said they saw the machinery working in that area is therefore irrelevant because, as noted, this became a notorious, evident, and undisputed fact. For his part, Esteban Bonilla Elizondo, an official of the Dirección de Geología y Minas, stated that when he first became familiar with the site it was pastureland and that he had doubts as to whether it formed part of the riverbed.
In response to the inconclusive answer, he promptly stated that, for this project, they did not know whether private properties had been affected. It should also be noted that, parallel to the gravel road observed during the judicial inspection, which runs along part of the bank of the river’s right branch, there is a spring (naciente) within the boundaries of my client’s property, near the area where the defendant conducts mining operations. That official of the Dirección de Geología y Minas stated that these are not springs protected under Articles 33 and 34 of the Ley Forestal. However, there is not a single item of evidence in the case file consisting of an opinion issued by SENARA. And why is that opinion important? In decision [Telf1], the Sala Constitucional held: “In this regard, determining whether a spring is permanent or non-permanent falls within the purview of the Administration’s technical bodies, which, in accordance with their respective areas of authority, would be a matter for the Dirección de Aguas del Ministerio del Ambiente y Energía, in strict coordination with other related bodies, such as the Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento and the Instituto Costarricense de Acueducto y Alcantarillado itself…”.
The testimony of Mr. [Nombre6] does not show that the corresponding inter-agency consultations were conducted. In addition, the report by [Nombre7] [Nombre8] precisely identifies the spring located on my client’s property and recognizes its status and character as such; it likewise concludes that the protection zones (zonas de protección) have been affected. Based on this analysis of the evidence, given the lack of sufficient technical information to disprove the existence of that water outflow on the property as a spring, we find that the defendant’s activities are being conducted without respecting the buffer distances prescribed by Article 33 of the Ley Forestal, both for the spring area and for the upstream protection zones, where scouring is evident from the judicial inspections and the expert and testimonial evidence. Accordingly, unproven fact 3), as found by the court below (a quo), is supported by the evidence and should have been deemed proven.
Not only that: when the river’s and springs’ protection zones are affected, my client’s property is automatically encroached upon and she automatically loses cultivation areas. Why is this so? When the river’s protection zones are scoured away, my client must automatically shift the protection zone 15 meters inland in the scoured area of the river, thereby losing cultivation areas; land is lost through scouring. This was an evident fact clearly established by all the evidence, and the area lost by my client can be determined during a possible judgment-enforcement phase. The scouring and loss per se, however, were established by the evidence. To that extent, unproven facts 4) and 6) are also supported by the evidence. Unproven facts 5 and 6 are established by the evidence introduced into the proceedings, including the report by [Nombre7] Allan Astorga, who, after preparing a historical report based on aerial maps and in his capacity as a geologist with extensive experience in Costa Rica, concluded: “The historical photointerpretation analysis shows that the bifurcation of the Puerto Viejo River south of the Isla and adjacent properties has not been active at all times (referring to the right branch).
Nevertheless, the river channel in the eastern sector has continued to carry water originating from the springs…” Based on the fieldwork conducted by the author, it is clear that substantial deepening of the Puerto Viejo River channel occurred, very likely due to excessive extraction of sediment from the river; one element confirming this situation is the presence of hard rocks forming part of the river-channel substrate (…). The principal conclusion is that, based on the historical photointerpretation analysis of the Puerto Viejo River channel near the Isla and adjacent properties, which shows substantial stability of the channel, and considering the mining-extraction activities carried out in that same river sector since 2012, it is clear to the author of this document that those mining activities caused a substantial imbalance in the river channel and its banks, possibly due to excessive overexploitation of the river channel and/or improper management of the Puerto Viejo River, thereby inducing significant erosion processes along its banks and potential environmental damage.” (Emphasis added).
In his recommendations, expert [Nombre8] states: “That no further mining be permitted in the Puerto Viejo River channel or its bifurcation, because the river system near the Isla and adjacent properties and to the south was significantly destabilized…”. This follows from the analysis of the expert opinion (dictamen pericial) and the testimony of the plaintiff’s witnesses, including [Nombre5]. Witness [Nombre4] stated in his testimony that no water flowed through the area between the Isla and my client’s property (the area of the aforementioned bifurcation) and that he has known the area for as long as he can remember, while [Nombre5] stated that it was a small stream, meaning that practically no water flowed through the area. This lends credibility to both witnesses and supports facts 5 and 6, which the judgment deemed unproven, insofar as it was the defendant, through its mining activities, that destabilized the embankments (taludes) of my client’s property and entered areas that had belonged to my client.
This fact was established through the appropriate evidence offered by both the plaintiff and the defense, as will be explained further under Ground V herein. As stated above, it was proven that the defendant eliminated that corner area and the right side of the river branch, which proved to be an undisputed and evident fact. Accordingly, the judgment must be reversed and my client’s claims granted. GROUND II: DIRECT VIOLATION OF ARTICLES 33 AND 34 OF THE LEY FORESTAL: Failure to apply Articles 33 and 34 of the Ley Forestal and the case law of the Sala Constitucional concerning protection zones. The competent body for determining whether springs exist is SENASA.
The official of the Directorate of Geology and Mines, Geologist Esteban Bonilla, states that his duties include reviewing technical studies for the granting of concessions and, once they are granted, reviewing the project’s operations and work reports; he indicates that regular inspections are conducted and that they have a protocol containing a list of priorities, on the basis of which they conduct visits, and that a concession may be inspected six to seven times a year or twice a year; in 2011, he conducted an inspection visit, toured the entire area, and focused on examining what was of technical interest to them, and he recalls that there were indications of material extraction and that he attempted to investigate, indicating that it was being carried out by third parties; he believes that a complaint was filed and is under the impression that charges were brought before the Public Prosecutor’s Office, after which he lost track of the matter; he does not know the Chahuer property or its boundaries, and he served as coordinator for that area of Limón until 2017; he indicates that studies concerning springs (nacientes) are reviewed by SETENA; in the case of this concession, data were obtained from the property of [Nombre9], (a third party unrelated to the proceedings), and that, based on his technical knowledge, he determined that they were not springs and accordingly ruled them out, and that this third party then retained a private professional who ruled out three water outcrops as springs; these are the three cases of which he is aware; the concession has two objectives, one economic, namely to generate wealth, and another secondary objective, namely to establish or stabilize a hydraulic system in the river; he indicates that when he originally visited that area on the right bank—which, in his view, is considered a branch, and which the witness calls the right branch—there was very little water, with pools and evidence that the flow occasionally filled this area; there was scrubland in the area; during his visits he never inspected upstream because work had not been conducted in the upstream sector (where the washed-out area on the right bank is located), and his last visit was in late 2016 or early 2017, which was the last time he visited the area, and he did not go beyond this area because extraction was focused on the right bank; he continues by indicating that the width to be exploited under the concession is determined according to geomorphological criteria and aerial photographs; I do not know, in this case, what has occurred that might affect private properties; the concession is granted over the riverbed, and the riverbed is often located within private property; the width of the concession varies, depending on the width of the riverbed from side to side, and the concession extends to the point reached by the water during an ordinary flood; he indicates that he did not observe any water outcrop on the property of [Nombre1] and that they considered the water he saw to be part of the river (that is, this spring was never subjected to analysis), and he refers to the analysis of Islote by reference to a private report prepared by a third party, and this was clear because that is how he answered the question posed by the a quo; I understand that these outcrops have no protection; I am not aware of any opinion, and the Ley de Aguas applies to me.
This testimony is consistent with that of the supervising official for the extraction project, Geologist Adrián Bonilla, who stated that he was unaware of any study concerning that spring, and in this regard there is evidence from [Nombre7] [Nombre8] indicating that the existing water outcrops on my client’s property are springs and that extraction works, such as roads and earthworks (movimientos de material), were carried out nearby, at distances shorter than the setbacks and distances prescribed in Articles 33 and 34 of the Ley Forestal; in this regard, the Ley Forestal contains no such exception as they seek to establish, nor any distinction between springs and water outcrops, since springs themselves are precisely that—water outcrops. Accordingly, the a quo not only omits analysis of this important and decisive issue, which is the subject matter of the dispute (Litis), because, by failing to observe the protection zones (zonas de protección) of the spring that was confirmed to be within the boundaries of my client’s property and was mapped and located by [Nombre7] [Nombre8], the defendant encroached upon the protection zones, which should have been respected, and in turn upon my client’s property.
The encroached area within the spring’s protection zone, the area adjoining the river, and the washed-out area adjoining the river are facts established by all the evidence introduced in the proceedings, and in this regard there is an actual area of loss from my client’s property, also established by the expert witness (perito) [Nombre8] and classified as an erosion area. Although its exact size was not necessarily required to be proven by my client, since such erosion on the property is a certain and notorious fact, the area is precisely, at least in part, the area contemplated in Articles 33 and 34 of the Ley Forestal; alternatively, the area could be determined precisely during the judgment-enforcement stage (fase de ejecución de sentencia), since the degradation and encroachment occurred within the protection zones of the outcrop or spring that emerges in part of my client’s property, which was not disputed and, as I indicated, is public and notorious.
In this regard, the judgment directly results in the non-application of Articles 33 and 34 of the Ley Forestal and of the legal doctrine and case law informing those provisions; upon determining that the defendant failed to observe those setbacks, it automatically follows that it encroached upon my client’s property, since the testimonial evidence and the aerial photographs introduced in the expert report of *. [Nombre8] established that protective tree cover (cobertura arbórea de protección) existed. Furthermore, because the river’s protection zones, measured from the riverbed toward my client’s property, are wholly owned as part of my client’s property, when my client loses land to the river, it loses cultivated areas as the protection zones shift further into the property. The burden of the evidence—although my client was the party that reproduced it—was incumbent, under the provisions of article… .of the Ley de biodiversidad, upon the defendant or the State itself, which actively intervened in support of the defendant.
As a corollary to the foregoing, and although this matter might ultimately not be the defendant’s responsibility, the undersigned considers that, according to the testimony of Mr. Esteban Bonilla Elizondo, an official of the Dirección de Geología y Minas, who stated regarding the concessions (concesiones), reiterating that the determination of whether the existing outcrops (afloramientos) constituted a spring (naciente) was a matter for the Dirección de Geología y Minas and that no study whatsoever had been conducted concerning the outcrop on my client’s property, there is, to that extent, a direct violation of the case law of the Sala Constitucional, because SENARA is one of the principal technical authorities that must be consulted for any project involving springs or protection areas (áreas de protección). There is no evidence that any consultation took place before the concession was granted.
Let us consider what the Sala has stated about failing to refer to SENARA any matter or uncertainty concerning water resources (recursos hídricos); let us examine the Sala’s findings: “VII.—Regarding the environmental role of the Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento in matters relating to water resources. Consistent with the text of judgment No. 2009-000262 at 14:32 hours on 14 de enero de 2009, with respect to SENARA’s participation in environmental matters relating to water resources and their protection, it is pertinent to reproduce certain considerations previously expressed by this Court. This is because they are material to the case under review: ‘XVII.—Scientific certainty concerning the existence of water resources and the exploitation of the Acuífero Sardinal. A central issue in the violations alleged by the petitioners is the lack of conclusive hydrogeological studies (estudios hidrogeológicos) establishing the existence of sufficient water resources in the Acuífero Sardinal for it to be exploited under the terms contemplated and sought by ICAA.
In this regard, the Sala reiterates the obligation of public institutions to observe and rigorously apply the precautionary principle (principio precautorio) in environmental matters, from which arises the obligation to prevent the execution of works that lack the technical certainty necessary to conclude that their implementation is harmless to the environment and, in this specific case, to the aquifer (acuífero) in question (...) It is important to note that this account of the facts makes no mention of or reference to the Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento—SENARA—because, although ICAA had been developing the project concept since marzo de dos mil seis, and although SENARA is a vital entity with respect to the use of groundwater resources (recurso hídrico subterráneo)—such as the Acuífero Sardinal—it was not until the filing of the constitutional-protection petition (recurso de amparo) that SENARA began evaluating ICAA’s actions within the scope of its authority.
XVIII.—Regarding the Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento. As explained in Considerando III of this judgment, SENARA’s authority extends beyond matters concerning irrigation districts (distritos de riego); rather, it is national in scope by virtue of the institution’s own historical background. Furthermore, Article three of the Ley de Creación del SENARA, law number 6877, provides, insofar as relevant, as follows: “ARTICLE 3.—The functions of SENARA are: (…) ch) To investigate, protect, and promote the use of the country’s water resources, both surface water and groundwater. (…) h) To oversee compliance with the legal provisions governing matters within its purview. Decisions made by the Service for that purpose concerning the drilling of wells and the exploitation, maintenance, and protection of waters—whether undertaken by public institutions or private parties—shall be final and mandatory.
Nevertheless, such decisions may be appealed on grounds of illegality within ten days before the Tribunal Superior Contencioso Administrativo. The Court shall issue its ruling within a period not exceeding ninety days.” (emphasis added). Thus, by express provision of its enabling statute (ley de creación), SENARA has authority to protect the country’s water resources, and its decisions concerning their exploitation, maintenance, and protection are therefore final and mandatory. Article one hundred fifty-seven of the Ley de Aguas—still in force—provides in turn that: “Article 157.—Municipalities have a duty to consult the Departamento de Agricultura and obtain the corresponding permit from it before transferring, mortgaging, leasing, granting for sharecropping, or independently exploiting any land that they own or acquire whenever such land contains usable public-domain waters (aguas de dominio público).
The Departamento de Agricultura shall determine whether such lands are located between those mentioned, and whether the intended use thereof could affect the conservation of the waters used by the population. The same obligations shall apply to the Boards of Education, Social Protection Boards and, in general, every public body.” (emphasis not in the original) This statutory provision must be interpreted and applied in accordance with Article twenty-one of the Law on Soil Use, Management and Conservation—from which it is established that the Ministry of Agriculture and Livestock, or Department of Agriculture in the terminology used by the Water Law, retains secondary or residual jurisdiction over this matter—which clearly provides that: “ARTICLE 21.- In matters relating to water, the Ministry of Agriculture and Livestock shall coordinate with the National Irrigation and Drainage Service and any other competent institution the promotion of hydrological, hydrogeological, and agrological research in the country’s watersheds, as well as practices for the improvement, conservation, and protection of soils in watersheds, in accordance with the powers of the aforementioned Service…” Thus, a harmonized reading of the recently cited provisions shows that, for the use of public-domain waters, every public entity—without distinction—must obtain the corresponding permit from SENARA, to the extent that duly reasoned decisions adopted by SENARA in this regard shall be final and mandatorily binding.
This definition is far from being a rhetorical statement by the Chamber; on the contrary, it derives from the responsible harmonization of the broad statutory framework governing the matter, which, as stated, requires the progressive development and recognition inherent in the field of human rights, since the right to water and the right to a healthy and ecologically balanced environment are fundamental human rights. The Chamber notes that this clarification places SENARA in a particularly significant position regarding management of the nation’s water resources, which is important considering the eminently technical nature of this administrative agency, a position that must be reinforced and exercised through the necessary and proper inter-agency coordination among the various entities involved—ICAA, SETENA, MAG, Municipalities, among others. In this regard, seeking to carry out projects for the extraction and exploitation of water resources without due authorization from and involvement by SENARA violates the statutory provisions protecting the environment, because the necessary technical findings determining the availability of and potential use of public-domain waters would be lacking.” “It is precisely there that the failure of the authorities legally entrusted with safeguarding environmental protection to communicate and coordinate with one another becomes evident.
In addition, given the uncertainty and doubts regarding the bodies of water located on the property and the land where a third party, in this case a private company, would undertake a project of that magnitude, not even an assessment or approval from the National Groundwater, Irrigation and Drainage Service was requested; under oath, that entity stated unequivocally that construction should not be allowed to proceed until it had validated the site’s hydrogeological information. In other words, the original project was not submitted to SENARA for review, even when doubts arose concerning the nature and condition of the bodies of water in question; when such doubts arose, communications and the issuance of precautionary measures (medidas cautelares) occurred solely among the respondents, after the amparo proceeding (amparo) had already been filed” (Res. Nº 2019015629, CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE.
San José, at nine thirty in the morning on the twenty-third of August, two thousand nineteen). In the present case, SENARA opinions are lacking, while the geologists of the Directorate of Geology and Mines, Esteban Bonilla Elizondo, determine on their own what is and is not a spring (naciente) for purposes of granting the above-mentioned concession; accordingly, those bodies of water were not evaluated before the concession was granted, and [Nombre7] [Nombre8] and the inspections contained in the record conclude that the spring exists. That conclusion, the reasonable doubt resulting from the lack of studies and the definition of springs provided by geologist Allan Astorga, together with the credible testimony of Directorate of Geology and Mines official Esteban Bonilla Elizondo and the project’s own respondent geologist, support the belief that the area near the spring should have maintained its setback (retiro).
Therefore, when the concession was granted despite that doubt, the precautionary principle (criterio precautorio) should have prevailed; consequently, the spring protection zones were encroached upon, even though they had been protected by my client for years, and in the sector—which is now a channel—the witnesses stated that pastureland, forest, and trees had existed. Because the respondent’s work failed to observe the statutory setbacks and encroached upon areas owned by my client through accession (accesión) from the river itself, the sixth allegation of the complaint was proven, as were the seventh allegation and claims 1, 2, which must be granted; alternatively, at least the third claim should be granted, the complaint should be partially upheld, and I request that the judgment be reversed and the complaint granted. III. GROUND FOR APPEAL: ERROR OF FACT IN REQUIRING EXPERT EVIDENCE TO ESTABLISH THAT THE AREAS WHERE THE JUDICIAL INSPECTION AND TAKING OF EVIDENCE OCCURRED BELONGED TO MY CLIENT, IN DIRECT VIOLATION OF ARTICLES 78, 79 AND 84 OF THE WATER LAW (ACCESSION BY ALLUVION (ACCESION POR ALUVION)) This issue specifically concerns the area where witness testimony was taken and the area near the spring observed during the inspections of the river’s right branch.
The honorable court below does not analyze the evidence as a whole (testimonial, documentary, and judicial inspections). This assertion is based on the fact that the evidence for the plaintiff (testimonial evidence) introduced into the proceedings shows that the area where evidence was taken—namely, at the river intersection where, according to the plaintiff’s witnesses, my client’s property once bordered the island—did not require my client to prove, as the court below incorrectly held in its judgment, through a surveying expert, that the affected area belonged to its property, and the omission of such evidence does not deprive it of standing or the right to file the complaint. That is incorrect, and such evidence was unnecessary for the following reason: The testimonial evidence was taken at the corner of the intersection, at what is now the boundary between my client’s property and the concession or exploited area.
The plaintiff’s witnesses stated that this area formed part of my client’s property and that the property extended up to that point, and that vegetation existed there; this fact was not refuted by the opposing party. The witness [Nombre6], an official of the Directorate of Geology and Mines, stated that there was scrubland and a small channel along the right bank. All the defense evidence offered in response to the complaint established that the right bank of the river in the intersection area is an area for which the concession was granted. However, it was observed that no flow runs through that area—the intersection and right bank—particularly through what appeared at that time to be the river channel. Given its dimensions, as I stated above, it is not credible that, during a normal high-water event or ordinary flood of that channel—the right branch—the water would rise and cover the entire width of the observed concession area.
Moreover, the channel running through this area carried only a minimal flow when the evidence was taken; it was minimal according to Directorate of Geology and Mines official [Nombre6], it had been minimal before the concession was granted, and, according to the plaintiff’s witnesses and the expert report by [Nombre7] [Nombre8], that area had closed off at some point in the past and little water flows through it; in other words, this area does not flood during an ordinary flood. It would be illogical to think otherwise and contrary to common sense and sound human understanding. Therefore, it is automatically established that part of that right branch—the intersection where the evidence was gathered—formed part of my client’s property pursuant to Articles 78. 79 and 84 of the Water Law, which provides: “River channels abandoned as a result of a natural change in the course of the waters shall belong to the owners of the respective properties along their entire length.
If the abandoned channel separates estates belonging to different owners, the new boundary line shall run equidistant from each.” In other words, the intersection area (right branch) contained only a small channel (see aerial photographs), and, by operation of law, my client’s estate automatically encompassed part of that area through which no water flowed during an ordinary river flood. Therefore, the court below incorrectly assessed the evidence and the evidentiary elements my client was required to use to prove ownership of that area, because, by operation of law, those areas belonged to my client’s property before they were included in the concession. Consistent with the article cited above, Article 84 ibídem provides: “Except as stated in Article 81 ibídem, any gradual increase received through the accession or sedimentation of the waters shall belong to the owners of lands bordering streams, torrents, rivers, and lakes.” In other words, an area that does not form part of the river channel during a normal flood does not form part of the public-domain channel and is likewise not eligible for concession, according to the testimony of Directorate of Geology and Mines official Esteban Bonilla Elizondo.
Therefore, because no previous concessions had existed at the site—as established by the testimony of the Directorate of Geology and Mines official and the project’s own supervising geologist—this area formed part of my client’s property by operation of law. This constitutes an irrebuttable presumption (presunción iuris et de iure), and my client acquired the real right (derecho real) through accession under the legal doctrine known as alluvion (aluvión), thereby entitling my client to assert its claim. I reiterate that this was established by the plaintiff’s evidence and by an analysis of other evidence, such as the judicial inspections and the testimony of the plaintiff’s witnesses, who stated unequivocally that my client’s property encompassed the corner area where the evidence was taken and that trees existed in that area. This presumption is supported by the legal system and, therefore, pursuant to the rules for assessing evidence under Section 41.1.2 of the Code of Civil Procedure, it was not rebutted by the respondent, which, despite having all the technical capacity and studies, could not rebut the presumption in my client’s favor that the washed-out strip where the road is located, on the river’s right branch, and the intersection where the evidence was taken, had not formed part of the river channel before the concession.
This is further supported by the fact that the amount of water flowing there was negligible—merely a small stream—and by the testimony of the Directorate of Geology and Mines official, who, when identifying the area where exploitation could legally be authorized within the channel area, referred in his testimony to the definition of “channel” in Article 69 of the Water Law, limiting the right branch, at the time the concession was granted, to a narrow strip in the intersection area.
Therefore, there is an error of fact on the part of the court below (a quo) in finding that this (topographic) evidence was essential to establish that the washed-away and vanished area of my client’s (registered) property (the area where the taking of evidence was conducted and which is now part of the concession area and part of the right branch) could be established only through the preparation of a topographic expert report showing that it encompassed the property owned by my client. This error of fact in the assessment of the evidence constitutes a violation of Article 54 of the Ley de la Jurisdicción Agraria, because the assessment of the evidence (in its absence) is incorrect, and direct harm results from the failure to apply Articles 78, 79, and 84 of the current Ley de Aguas. It was also established that the area upstream from where the evidence was taken—the washed-away riverbank of my client’s property adjoining the river—is subject to drainage and washout.
As stated, the washed-away corner area and right branch, which were also part of my client’s property, are addressed in the study prepared by [Nombre7] [Nombre8], which states: “The 2018 image shows new areas of river channels and fluvial bars that did not exist in 2006. These are areas where intense ‘erosion’ processes occurred or, alternatively, where anthropogenic (human) activity occurred, such as the mining operations that have been conducted in that area since 2012. On the map in Figure 4.3, these correspond to the areas shown in red. Their total area is 64.439,9 square meters. It is important to note that many of these correspond to protected areas (áreas de protección) of the Puerto Viejo River…” These areas identified in red include an area at the corner of the right bank (intersection), coinciding with the area where the evidence was taken and the washed-away area upstream along the right side of my client’s property adjoining the river.
The photographs introduced into the proceedings show that, between 2006 and 2018, there was a change in the corner at the intersection on the right side of my client’s property, as [Nombre7] [Nombre8] noted in his report and as shown on map 4.3. Figure 3.13 (2006 aerial photograph) and Figure 3.15 (2018 aerial image) also show the change in the shape of that corner and how, in the latter image, it appears as part of the river channel, which is consistent with the expert’s conclusions and, as will be seen, with the testimony of the plaintiff’s witnesses. In the present case, the accretion (accesión) that had existed for years along the right bank of the river in favor of my client’s property was evident because it was an abandoned channel through which water did not flow even during an ordinary rise, as provided in Article 69 of the Ley de Aguas. On this subject, Spanish legal scholarship has stated: “Article 370 provides that ‘river channels that are abandoned because the body of water naturally changes course belong to the owners of the riparian lands along the respective length corresponding to each.
If the abandoned channel separated properties belonging to different owners, the new boundary line shall run equidistant from each.’ A publicly owned channel therefore disappears and becomes private, which occurs automatically, just as the incorporation of the new land into the riparian property is also automatic…” (Luis Diez-Picazo y Antonio Gullón, Sistema de Derecho Civil, Volúmen III, Derecho de las Cosas y Derecho Inmobiliario Registral, Sexta Edición, p.187). Accordingly, after all the evidence had been gathered, and considering that all the plaintiff’s witnesses stated that the area at the intersection where the evidence was taken was part of my client’s property and was not subject to flooding, the witness [Nombre5] testified that there had even been a Higueron tree there, that the area disappeared, and that he saw the defendant’s machinery working at the site. The evidence of [Nombre7] [Nombre8] and the testimony of Mr. [Nombre4] likewise establish this fact.
Meanwhile, the defendant presented no evidence in this regard and, despite having them in its possession, did not submit the studies that had served as the basis for the Dirección de Geología y Minas at the time (if such studies existed) to establish that this specific area of the intersection and right branch was part of the river channel and that it filled completely during ordinary rises. This representation could well have filed the action as an action for recovery of property (proceso reivindicatorio); however, the grounds for the claims explained the particular circumstances of the case, in which the areas had disappeared and had by then become part of the area exploited by the defendant, such that only compensation for damages and losses (indemnización de los daños y perjuicios) was applicable, as was in fact claimed. Because my client’s possession of that area before the concession was granted in 2012 was demonstrated through suitable and relevant evidence, the court below was empowered to grant the action, uphold the claims, and enter a non-liquidated judgment (condena en abstracto) against the defendant so that the precise area lost by my client and its potential value could be determined during the judgment-enforcement phase (fase de ejecución de sentencia).
IV. GROUND FOR APPEAL: ERROR OF FACT IN THE ASSESSMENT OF THE COURT-ORDERED SUPPLEMENTARY EVIDENCE (PRUEBA PARA MEJOR PROVEER), CONSISTING OF THE TECHNICAL REPORT BY PARTY-APPOINTED EXPERT (PERITO DE PARTE) [Nombre7] ALLAN ASTORGA. The court below commits a procedural error in admitting and not admitting the evidence (party-appointed expert report (peritaje de parte)), and then commits an error of fact in its analysis by diminishing the weight of its conclusions because the expert used the term “possibly” in reference to the actions that caused the washout along the boundaries of my client’s property and the loss of land. I explain these errors below: Procedural errors by the court below in admitting or not admitting the evidence (party-appointed expert report). First, the court below uses the evidence to discredit the plaintiff’s testimonial evidence, stating: “As with the testimony of Mr. [Nombre5], this testimony lacks technical support.
On the contrary, the photographs submitted in the report by geologist [Nombre8] Gättgens show that the right channel or right branch of the river has always existed, contrary to Mr. [Nombre4]’s statement that it did not previously exist. The geologist himself states that the river’s bifurcation at [Dirección2] and the adjacent properties has exhibited variable behavior, closing in some years and reopening through erosion in other years.” Here we see the use of the party-appointed expert evidence, yet elsewhere in its judgment the court below states the following regarding its admissibility: “The first is a technical report prepared by geologist [Nombre8] Gättgens, who was privately retained and not appointed as an expert in the proceedings, which diminishes its probative force because his statements and conclusions could not be subjected to adversarial scrutiny. Although the opposing party was given an opportunity to state whatever it considered relevant to its interests, it was not possible to question him, request clarifications where necessary, or even offer rebuttal evidence.” Note how the court below uses the technical evidence to analyze the testimony of the plaintiff’s witnesses but, elsewhere, finds that the same evidence (the expert report) is biased and diminishes its credibility because it was privately commissioned and was not subjected to adversarial proceedings (contradictorio).
Neither of those arguments is procedurally correct. The first is incorrect because party-appointed expert evidence is permitted under the new provisions contained in the currently effective Código Procesal and modern legal trends, and an expert report cannot be discredited merely because it was submitted by one party. Contemporary legal scholarship has moved beyond this argument and permits a fact to be proven through such technical evidence, provided that the court below analyzes it together with the other evidence introduced into the proceedings. What is procedurally incorrect is to admit it and use it only selectively; the correct course is to admit it and assess it in its full context. The second procedural error committed by the court below in the judgment is its statement that the evidence could not be subjected to adversarial scrutiny. I respectfully submit that this assertion by the court below is also incorrect because the opposing party was notified of the report and, accordingly, was afforded the opportunity to request any clarification or supplementation, which would have been proper and lawful; nevertheless, it did not do so.
Adversarial scrutiny in the current agrarian proceedings is very limited for the parties because expert reports are documentary evidence, and neither court-appointed nor party-appointed expert reports are in fact subjected to genuine adversarial scrutiny. This would be possible only if there were a supplementary stage requiring the experts to provide their technical testimony before the court below in genuinely adversarial proceedings. No such stage currently exists; therefore, the procedural mechanisms that ensure equality between the parties consist of the hearing at which the expert reports are disclosed (as occurred with the present expert report) and at which both parties may submit their comments, requests for supplementation, and objections (principle of adversarial testing of the evidence (contradicción de la prueba)); what is improper is to discredit it as evidence (medio probatorio) merely because it was submitted by one of the parties, or to consider its admission a violation of the defendant’s due process (debido proceso), while disregarding a substantive analysis thereof together with the other evidence; the manner in which the respected judge conducted the analysis is improper because it is unclear whether it was admitted, or whether it was used insofar as it was unfavorable but not insofar as it was favorable.
It is important to note that my client endeavored not to retain a compliant expert witness (perito), but rather the person most qualified for that purpose; one need only examine the credentials of [Nombre7] Allan Astorga, which he sets forth in his own expert report (pericia), including a Licentiate Degree in Geology from Universidad de Costa Rica, [Nombre7] in Natural Sciences from Universidad de Stuttgart Alemania, and Full Professor at Escuela Centroamericana de Geología of Universidad de Costa Rica in the fields of Sedimentary Petrology, Sedimentology, and Environmental Geology, specializing in environmental impact assessment (evaluación de impacto ambiental), strategic environmental assessment (evaluación ambiental estratégica), environmental land-use planning (ordenamiento ambiental territorial), and comprehensive environmental management (gestión ambiental integral). Likewise, he worked at RECOPE and SETENA, where he served as Secretary General, and as a consultant to Banco Mundial, Banco Interamericano de Ambiente y Desarrollo, Naciones Unidas, Unión Mundial para la Conservación de la Naturaleza, FAO, among others.
Nor should it be overlooked that [Nombre7] [Nombre8] prepared the expert report and attested to its contents UNDER OATH; that is, a person who is so publicly known and is a scientist specializing in the subject matter cannot be deemed compliant merely because my client retained him for a discrete professional service. This argument by the court below (a quo) is contrary to logic and sound human understanding, as well as to principles such as procedural fairness (lealtad procesal) and good faith (buena fe), because, without analyzing anything concerning the expert, it disqualifies him merely because he was retained by one party. Nevertheless, that does not make him compliant, and therefore the expert report should have been admitted and assessed in its entirety. The manner in which the court below treated it may be reversed by the Court so that it may be regarded as credible evidence, not characterized as compliant, and therefore assessed, together with its findings, without procedural prejudice, pursuant to the rules established in Article 54 of Ley de la Jurisdicción Agraria.
In connection with the foregoing ground of appeal (agravio), and apart from the procedural violation committed by the court below, there is an error of fact (error de hecho) in the analysis of the expert report prepared by Geologist [Nombre8], specifically in disqualifying it for its use of the term “possibly”: The error of fact occurred in the court below’s analysis of the report when it stated that the expert indicated: “The principal conclusion is that, based on the historical photointerpretation analysis (análisis de fotointerpretación histórica) conducted on the channel (cauce) of Río Puerto Viejo near the Isla and the adjacent properties, which shows significant stability in its channel, and with respect to the mining extraction activities carried out in that same section of the river since 2012, it is clear to the author of this document that such mining activity caused a significant imbalance in the river channel and its banks, possibly due to excessive overexploitation of the river channel and improper management of the Río Puerto Viejo channel, thereby inducing significant erosion processes along its banks and potential environmental damage.” The court below takes that conclusion out of context because the expert, [Nombre7] [Nombre8], was categorical in stating that the mining activity conducted there caused the imbalance in the river; what the expert identified as possible were the causes—overexploitation of the river channel and improper management of the Río Puerto Viejo channel.
In other words, the expert had no doubt, contrary to the erroneous interpretation of the court below, that the mining extraction conducted in 2012—which was conducted solely by the defendant—caused the erosion present in the study area and the washing away of the properties adjacent to the Isla, including my client’s property. Based on the expert’s repeated reference to the properties adjacent to the Isla, analyzed in conjunction with the judicial inspections (reconocimientos judiciales), it is clear that he was referring to my client’s property, a fact that is also apparent from the studies and was not disputed. The attempt to assert that the failure specifically to mention my client’s property is grounds for discrediting the expert report is unacceptable because the property is adjacent to the Isla and appears in all the aerial photographs. The court below was perfectly able to locate it in the expert report when using the study to discredit the witnesses for the plaintiff, yet it states that the study is not useful because it does not identify my client’s property.
This is contrary to the rules of logic and sound human understanding, since the following matters are readily verifiable: the expert report states that sedimentation occurs on properties adjacent to the Isla; my client’s property is adjacent to the Isla; the court below verified that my client’s property lies partly at the intersection of Río Sarapiquí and the Isla; the inspections confirmed that the edges of my client’s property had been degraded and washed away; and an area belonging to my client was granted under a concession (concesión), specifically the corner where the testimonial evidence was received. Nevertheless, that area was granted under a concession despite not forming part of the channel, as stated by the expert [Nombre6] and under Article 69 of Ley de Aguas itself, which defines the areas of a river channel that may be granted under a concession. It is neither logical nor evident that, during an ordinary flood (crecida ordinaria), the river would cover the entire intersection area, since the small volume of water flowing through the area is evident from the aerial photographs submitted and the testimony of the plaintiff’s witnesses.
Nor is it logical that the channel where the defendant’s witnesses stated the concession had been granted would encompass the entire current width of the right branch. The defendant introduced no evidence in the proceeding demonstrating that this area—the right branch—formed part of the channel during an ordinary flood. The notion that it formed part of the river during an ordinary flood is irrational because its extent is excessive in relation to the small watercourse, as was also recounted in the testimony of [Nombre6], an official of Dirección de Geología y Minas, who stated that it was a small channel before the concession was granted and that he even had to verify whether it was continuous. For the foregoing reasons, the court below committed an error of fact by incorrectly interpreting the party-appointed expert evidence (prueba pericial de parte). On the basis of the evidence introduced into the proceeding, it is at least possible to treat [Nombre7] [Nombre8]’s expert report as documentary evidence (prueba documental), analyze the aerial photographs to locate my client’s property, and conclude categorically, as the submitted expert report does, that extraction from the river caused the washing away of the edges of my client’s property.
As the expert stated, there were possibly two causes, both intrinsic to those human extraction activities, but neither was unrelated to that extractive activity, as the judge’s analysis incorrectly suggests by taking the matter out of context. According to the expert report, those two possibilities were excessive overexploitation of the river channel or improper management of the Río Puerto Viejo channel, thereby inducing significant erosion processes along its banks and potential environmental damage. The images in [Nombre8]’s report clearly identify the actual area that my client’s firm has lost because the judicial inspection, the cadastral plans (planos catastrados), and the evidence gathered by the court below established with absolute clarity that the defendant’s river-exploitation operations caused the loss of part of my client’s property. The inspections contained in the record, especially the one used in the first interim-relief proceeding (diligencia de medida cautelar), show the sotacaballos trees, which are planted along riverbanks—a matter of public knowledge—to prevent collapses, and show that those trees had been washed away as a result of the property’s erosion.
Accordingly, the court below incorrectly assessed the study by [Nombre7] Allan Astorga, a geologist whose prestigious experience, once evaluated, far exceeds that of the other experts presented. Far from seeking a compliant expert report, this representation retained the services of the professional most qualified to ascertain the material truth (verdad real) of the facts and specifically to provide credibility to the Judge. The fact that he was retained privately does not mean that he lacked objectivity or was compliant with the parties. What experience does show me is that, because of the structure of current agrarian proceedings (proceso agrario), court-ordered expert reports (peritajes judiciales) are very limited, do not go further, and do not constitute in-depth studies of the issues presented. LASTLY, WITH RESPECT TO THAT REPORT, I REQUEST THAT IT BE ACCEPTED AS EVIDENCE FOR FURTHER CONSIDERATION (PRUEBA PARA MEJOR PROVEER) ON APPEAL AND ADMITTED INTO EVIDENCE, OR, ALTERNATIVELY, I REQUEST THAT IT BE ADMITTED AS EVIDENCE TO ASSIST IN THE DECISION (PRUEBA PARA MEJOR RESOLVER), BUT AS DOCUMENTARY EVIDENCE, supporting, through the existing images, the theory of the case (teoría del caso), which is itself substantiated by evidence such as witness testimony, notorious facts, and disputed facts, demonstrating that part of my client’s property—the intersection and part of the right branch—was encroached upon and belonged to my client.
The images contained in that study establish the loss of a considerable area of my client’s property. It is undisputed that the place where the judicial inspection was conducted and the evidence received was an area where the defendant exploits the concession, and to that extent it is also a notorious fact. Thus, my client would establish at least part of its claims, insofar as the defendant encroached upon part of its property, caused it to disappear, and transformed it into a channel, and the defendant should therefore be found liable at least in part. Without that technical report, however, the defendant could not be held liable for the upstream washing away. I therefore request that this expert report be admitted at least as documentary evidence and that the complaint be partially granted. GROUND OF APPEAL V: IMBALANCE BETWEEN THE ANALYSIS OF THE PLAINTIFF’S AND DEFENDANT’S TESTIMONIAL EVIDENCE AND IN THE ALLOCATION OF THE BURDENS OF PROOF (CARGAS PROBATORIAS): The court below credits the defendant’s witnesses, who are employees and economically dependent on the activity they perform, and any irregular conduct brought to light in the management of the concession would expose them to liabilities of every kind.
For that reason, the testimony of the project’s supervising geologist (Geólogo regente), [Nombre10], who arrived in the area in 2013 and had no prior familiarity with it, and who also claims to be unaware of studies concerning the spring (naciente) located on my client’s property, among other matters, is that of a compliant witness because he has a direct interest in the outcome of the proceeding, as he benefits financially from the work.
The witness [Nombre4] was not an accommodating witness, as characterized by the court a quo, because, in his personal capacity, he has no conflict with the defendant, or I am unaware of whether he does, since he filed his complaint as the representative of an association. He even states that he came to testify because he had long been involved in proceedings concerning the dredging of the river; he says that he is a paramedic; he states that he filed the complaint because of the ecological damage to the river and that this is why he is testifying; he states that he has known the area for as long as he can remember; and he states that he knows the concession area (área de la concesión). He even produced a card belonging to Mr. [Nombre11], who is a witness for the defense, stating that they stopped to speak with him. He states that the condition of the channel (cauce) changed considerably after the concession was granted; he states that the diversion to the right bank did not exist and that he had never seen it in his life.
Although he could not provide the exact date and stated that it was approximately two years ago, he was consistent in describing when he visited the area, and he stated that when they began removing material from that area—the right bank—he visited the site and told them that they could not do it that way (in reference to the defendant); that the flow consisting of that jet of water was not there; and he identifies the properties belonging to [Nombre1], points out the property, and locates it precisely at the site. He also identifies the Island, which he states adjoined [Nombre1]’s property, and, when asked, “How far did the Chahuer property extend?” he states that it extended to the location where the evidence was being received. Referring to that area where the evidence was received, he states that it consisted of pastures, that there were trees, including a chilamate tree, and that they were pastures.
He testifies that he knows of a spring (naciente) and points out where it is located, which was confirmed during the judicial inspection (reconocimiento). He states that the road on which we were standing was approximately two or three meters from the spring and that the defendant company, which removed material from the river, built that road, because he saw its workers working at that site and within the Chahuer property. He further states that the road built by the defendant is within my client’s property and that the erosion washouts on my client’s property occurred when the defendant began working. He recalls that the channel did not pass through that location (in reference to the right-hand diversion), because the property facing my client’s property belonged to one of his uncles and adjoined my client’s property, referring to the Island, and that the water was located where the water issuing from the spring flows in the lower portion of the right bank.
This direct testimony establishes that my client’s property extended to the site where the judicial inspection and receipt of evidence took place; that the area containing the access road to the site where the evidence was received—which is now part of the concession—was a pasture belonging to my client; and that no such channel existed. This may be consistent with the expert report (peritaje) prepared by [Nombre7] [Nombre8], which states that, at some point, no channel existed. It should be noted that even Adrián Bonilla, the geologist from the Dirección de Geología y Minas, had doubts in two thousand eleven, before the concession was granted, because of the limited channel, and had to verify that it was continuous. Contrary to this, in making a factual error in his analysis of the testimonial evidence, the court a quo analyzes the testimony in isolation and finds that the witness’s statement that no water flowed through the area of the right branch contradicted [Nombre8]’s study and that, to that extent, the witness was accommodating, without considering or assessing that the expert himself determined that, at a certain point in history, no water flowed along that right bank.
To that extent, the court a quo conducted its analysis while omitting this technical consideration, even though it relied on the same report by [Nombre7] [Nombre8] to disregard the testimony. Moreover, the witness who works for the Dirección de Geología y Minas states that he had to verify whether the channel was continuous because its flow was so limited, and that he determined it was a channel based on several pools that he observed; he also states that there are cases in which projects are approved in privately owned areas. Regarding the testimony of Mr. [Nombre5], he states that he has known the site for 23 years; that he is a farm laborer who works on the Island; and that the channel area was different from what exists today. Pointing to the right bank of the river, he says that no river existed there and that there was a forest, dating back to when Mr. [Nombre12] purchased the property.
He says that a small stream (yurrito) ran along the right bank, on the side where the tractor (chapulín) is located (intersection of the right bank) that the properties bordered along the right bank, referring to the property of my client and La Isla; he states that the area where evidence was being taken and where the farm tractor (chapulín) was located was part of my client’s property, and that there had been a higuerón tree there that disappeared; he states that when the river rises, it fills up but did not carry away the trees. He states that he saw machinery belonging to the defendant company knocking down the trees and that he even has photographs; he stated that the forest on my client’s property extended as far as the stream (yurro), and that this was where it bordered La Isla. This witness establishes that the area where evidence was being taken formed part of my client’s property and was not part of any riverbed (cauce).
He uses the term yurro to refer to the watercourse; in popular parlance, yurro is a diminutive of river. According to the standard dictionary of the Poder Judicial, yurro is a term that, in Costa Rica, means “stream, brook.” A brook is “a small river with a low flow…”; a stream, in turn, is “a short, almost continuous flow of water…” (Diccionario de la Lengua Española, Real Academia Española, twenty-first edition). In other words, the testimony for the claimant is consistent and mutually corroborative, and it is true that at some point in history water flowed through the site and that it was also a low-flow location. There is no technical evidence from the defendant or from the Dirección de Geología y Minas—even though they were responsible for proving that fact—showing that, during an ordinary rise of the river, the water could have reached that area and covered its entire width. In light of common sense and sound human understanding, this would lead us to believe that such a possibility is implausible and, accordingly, that by operation of law this area formed part of my client’s property.
Once it has been established that this area was part of my client’s property, I reiterate that not a single item of technical evidence was submitted by the defendant showing that the area where evidence was taken, and where the road built by the defendant that led us to the site was located, constituted part of the riverbed. The defendant is the party that possesses, or should possess, this evidence, yet it neither introduced nor reproduced it in the proceedings. Quite to the contrary, before the concession (concesión) was granted, those lands formed part of my client’s property, as was demonstrated, and the defendant therefore proceeded to encroach upon that area, caused it to disappear, and converted it into part of the concessioned riverbed, even though the area belonged to my client by operation of Articles 78 and 84 of the Ley de Aguas. Having established that my client’s property encompassed those areas, the lower court (a quo) accorded greater evidentiary weight to the defendant’s witnesses on the ground that they are scientists in the relevant field, without considering that they have a genuine interest in the proceedings, both because of their employment and because of the liabilities that could arise from their actions.
In this regard, the lower court states that the defendant presented the testimony of [Nombre11], an Agricultural Engineer specializing in soils who has been responsible for the environmental oversight (regencia ambiental) of the concession since 2013; [Nombre10], who has served as the concessionaire’s supervising geologist (regente geológico) for 5 or 6 years and is responsible for supervising extraction activities; and [Nombre6], a Geologist and official of the Dirección de Geología y Minas who is responsible for reviewing technical studies for the granting of concessions. In this regard, the second witness concludes that the extraction of materials from the river was conducted in accordance with the applicable legal provisions, while the court disregards the testimony of nontechnical persons such as those presented by my client; however, those witnesses have a discernible interest and are not credible.
The expert examination (peritaje) conducted by [Nombre13] states that there has been a change in morphology, that the effects of erosion are present, and that land originally forming part of the property of the claimant herein has indeed been lost; it concludes that this resulted from the dynamics of the river and that there is no evidence that it resulted from the extraction of material from the river. This point warrants particular attention because the judge expects the expert to enter into a matter reserved for the judge—namely, assessing all the evidence to determine the causes of that degradation. The expert stated that it could not be associated with the extraction activity, but he did not rule it out either. Accordingly, it is the lower court, through an integrated assessment of the evidence, that must determine whether there was additional evidence sufficient to rule out the defendant’s liability for the proven damage.
The witness testimony offered by my client is consistent, since both witnesses saw the machinery operating in the area, knew the property before the concession was granted, and have personal knowledge that the area where part of the concession is now being exploited belongs to my client. In this regard, the lower court avoids a comprehensive analysis of the evidence and substitutes for its own decision the doubt expressed by an expert, discrediting my client’s witnesses by stating that they lack technical expertise. Nevertheless, they testify and tell the truth—a truth that neither the scientists nor the defendant could refute because they had not known the area for 23 years or more, as the witnesses had. Neither the defendant nor the State that joined in support demonstrated that the claimed area formed part of the riverbed during an ordinary rise. The defendant, which conducted the studies required to obtain the concession, should have had that evidence readily available; despite being required to substantiate and demonstrate the matter, it failed to do so, and its conduct is procedurally reprehensible.
A causal nexus (nexo causal) between the claimed damage and the defendant’s conduct may also be established through evidence other than technical evidence, such as witness testimony. The lower court may not use technical evidence to substitute for its own function, because the judge is the expert of experts and may corroborate the truth of the facts alleged in the complaint through any legally admissible evidence. Thus, by tipping the balance in its analysis between truthful witnesses with direct and historical knowledge and scientific witnesses who did not know the area before the concession, the lower court directly violated Article 54 of the Ley de la Jurisdicción Agraria. It neither conducted an analysis nor articulated the principles of equity applied in assessing the evidence. Instead, it imposed or sought to impose a requirement that only a scientific finding that the defendant encroached upon part of my client’s property, and only a scientific determination that the scouring (lavado) and damage to my client’s property were caused by extraction from the river, could establish the encroachment and the claimed damage, thereby precluding their proof through other evidence such as witness testimony.
In other words, the desired causal relationship supposedly cannot be established through witness testimony, the paramount form of evidence in all proceedings, even though we have witnesses who state that they knew the area and my client’s property and even though, pursuant to Articles 78 and 81 of the Ley de Aguas, those lands belonged to my client, and despite presenting eyewitnesses who state that they saw the defendant’s machinery operating there, their testimony is supposedly untrue unless supported by scientific evidence. This is precisely the imbalance created by the lower court in its analysis: it abandoned the maxims of experience and sound human understanding when assessing the expert evidence, allowing that evidence to supplant its own analysis and turning the expert into the judge, thereby replacing the role of the lower court. Accordingly, I submit that my client’s theory of the case is proven by all available means, including the report of Geologist [Nombre8], who, on the strength of an impressive résumé, states that there is indeed a connection between the damage—the scouring and loss of an area of my client’s property—and the extraction activities.
That loss of land and scouring are also supported by the impartial expert’s report and were observed during all the judicial inspections (reconocimientos judiciales), while the witness testimony establishes the causal relationship between the proven damage and the defendant’s direct liability. The defendant, meanwhile, failed to prove its defenses, because it did not establish that the area at the intersection and along the right branch of the river was subject to flooding during an ordinary rise, nor did it present testimony from anyone who had previously known the area. On the contrary, none of its witnesses had known the area beforehand, with the sole exception of the official from the Dirección de Geología y Minas, whose testimony was in fact unequivocal and established that only an almost nonexistent current flowed through that area, which was pastureland. Likewise, the State was a passive observer and neither produced nor submitted any material evidence to refute my client’s theory of the case.
Accordingly, the judge incorrectly interprets the provision governing burdens of proof (cargas probatorias) by requiring my client to establish through scientific means—although this was in fact done—the encroached-upon area of the property, even though my client is entitled to the presumption and rights established by Articles 78, 79 and 81 of the Ley de Aguas. The burden of proof rested with the defendant under Section 41.1.2 of the Código Procesal Civil, and it failed to satisfy that burden. Regarding its liability for the scouring of and encroachment upon the property in the area of the intersection and right bank, this is a notorious fact (hecho notorio) documented during the inspections, because the area is now under concession. In this regard, all witnesses—those called by the claimant, those called by the opposing party, and those giving confession (confesión)—consistently stated that the entire area had been covered by the concession, and material was present there according to the judicial inspections. Accordingly, the judgment must be reversed and all claims granted in full (images 9 to 24 of the electronic case file).-
IV.Attorney Roberto Garita Chinchilla, counsel for the defendant, also files an appeal (recurso de apelación), stating as follows: GROUNDS ON THE MERITS: “FIRST: The plaintiff, [Nombre1] . , recklessly and maliciously filed this ordinary action (demanda ordinaria) against my client, INDACO HORQUETAS S.A, valuing it at ciento veintiocho millones de colones and alleging that INDACO HORQUETAS S.A. unjustifiably encroached upon and caused the disappearance of an area forming part of the property owned by the plaintiff, [Nombre1] . , located in the Canton of Sarapiquí, Province of Heredia, Real Property Registry Folio number 86482-000, seeking alleged damages (daños y perjuicios), which were never proven by [Nombre1] S. A. SECOND: The judgment fails to indicate the date on which the plaintiff, [Nombre1] S. A, acquired the property, an issue of utmost importance because the plaintiff recklessly seeks recovery for alleged damage caused before it became the owner of the property located in the Canton of Sarapiquí, Province of Heredia, Real Property Registry Folio number 86482-000.
The significance of this evidence, which was raised by the defense during the evidentiary stage, is paramount, as it demonstrates the recklessness of the action brought by the plaintiff against the defendant, a circumstance that more than justifies an award of costs (condenatoria en costas) against [Nombre1] . , so as to compensate, to some extent, the expenditures incurred by the defendant, INDACO HORQUETAS S.A, in defending itself and proving the falsity of each assertion made by the plaintiff in its complaint. THIRD: The judgment challenged herein shows that the only fact the plaintiff, [Nombre1] . , was able to prove is that its property adjoins a property belonging to the defendant company, INDACO HORQUETAS. Those facts were NEVER disputed, whereas ALL disputed facts were deemed UNPROVEN FACTS. Thus, the plaintiff, [Nombre1] . , did NOT prove that the entire portion of its property adjoining Río Puerto Viejo is duly protected by trees; nor did the plaintiff demonstrate that INDACO HORQUETAS S.A encroached upon its property as a result of its extraction activities.
The plaintiff, [Nombre1] . , did not demonstrate that the defendant company, INDACO HORQUETAS S.A, performed work in Río Puerto Viejo without respecting the protection zones (zonas de protección), or that, as a result of its work and extraction of materials, the trees that protected those zones were felled and washed away. The plaintiff, [Nombre1] . , did not demonstrate that the defendant company, INDACO HORQUETAS S.A, diverted the waters of Río Puerto Viejo and thereby caused encroachments that endangered its property, the crops on its property, or its internal roads. Nor did the plaintiff, [Nombre1] S. A, demonstrate in any manner that any impact suffered or potentially suffered by its property due to water currents, flooding and overflows of Río Puerto Viejo, erosion of land in riparian areas, or any other impact caused by the flow of those waters resulted from the extraction activities conducted by the concession holder (concesionaria), INDACO HORQUETAS, SOCIEDAD ANÓNIMA.
The plaintiff, [Nombre1] S. A, did not establish in any manner that the defendant company was responsible for the disappearance of areas of land that it alleges occurred on its property, or that it was liable for damages relating to that land or on any other basis, because liability for the alleged damage or loss was not demonstrated. These evidentiary deficiencies, together with the valuation of the claim at 128.000.000 de colones, make it clear that this ill-conceived action cannot go unsanctioned as against the plaintiff, [Nombre1] S. A, because that valuation, together with the assertions contained in the complaint, demonstrates the unjustified financial burden imposed on the defendant, INDACO HORQUETAS SOCIEDAD ANÓNIMA, which obviously could not remain idle in the face of such a claim and had to pay legal fees and fees for expert assessments in the relevant field to refute a claim of such a substantial amount as that brought by the plaintiff, [Nombre1] S. A. FOURTH: GROUND OF APPEAL: The plaintiff, [Nombre1] S.A, recklessly sued my client, INDACO HORQUETAS SOCIEDAD ANÓNIMA, valuing the claim at the exorbitant sum of 128.000.000 de colones.
Every action produces a reaction; therefore, in order to defend itself, my client, INDACO HORQUETAS, S.A., was forced to incur, without justification, expenses exceeding 20.000.000 de colones. The plaintiff did not prove any of the disputed assertions in this action, and the claim was therefore dismissed. Nevertheless, the judgment under appeal, as rendered, prejudices the defendant company by failing to order the plaintiff to pay costs, based on an unfounded determination by the trial judge. This financially harms my client, INDACO HORQUETAS S.A, because the judgment under appeal does not award costs in favor of Indaco Horquetas and against the plaintiff, [Nombre1] S. A, which caused the harm yet walks away victorious and unscathed, without its malicious action producing any financial consequence whatsoever.” (images 38 to 41 of the electronic case file).-
The appellant is incorrect with respect to the arguments made in this first claim. Having reviewed the evidence in the record, this Court concludes that the factual basis of the appealed judgment (the list of proven and unproven facts) was correctly established, in accordance with the evidentiary principles and rules governing this field. In this regard, it should be recalled that agrarian matters are governed by the system of free evaluation of the evidence (libre valoración de la prueba), which, according to the First Chamber, means that the judge is not bound by criteria predetermined in the general rules and may weigh the body of evidence (acervo probatorio) with considerable latitude, subject only to the requirement of acting in accordance with principles of equity and law (see decisions N°9 de las quince horas del veintinueve de enero de mil novecientos noventa y siete; N°50-98 de las quince horas veinte minutos del veinte de mayo de mil novecientos noventa y ocho; N° 310-01 de las dieciséis horas del veinticinco de abril del dos mil uno; 445-01 de las catorce horas quince minutos del veinte de junio del año dos mil uno).
This Court concurs with the First Chamber of the Court, pursuant to Articles 9 of the Civil Code and 5 of the Organic Law of the Judiciary. Moreover, in matters of civil liability (responsabilidad civil), whether contractual or noncontractual, strict or fault-based, and regardless of whether the matter is agrarian, civil, or commercial, a claim may be allowed only if there is damage or loss attributable to or caused by the person sued. Damage is understood as “any impairment, loss, or detriment to a person’s patrimonial or non-patrimonial legal sphere (the injured party), which results in the deprivation of a legally protected interest whose preservation could objectively have been expected had the harmful event not occurred. Under this view, there is no civil liability without damage, just as there is no damage without an injured party. Moreover, only damage that is proven (its reality or existence) is compensable, this being a question of fact entrusted to the sound discretion of the adjudicator…” (First Chamber of the Supreme Court of Justice, decision Nº114 de las 16:00 horas del 2 de noviembre de 1979).
In addition to being real, certain, actual, and deserving of legal protection, the damage must have been caused by a third party and must still exist when the complaint is filed. There must also be a causal relationship (relación de causalidad) between the unlawful act and the damage sustained. In matters of noncontractual liability (responsabilidad extracontractual), the plaintiff bears the burden of proving the elements of the theory of damages (teoría del daño), namely: the existence and quantification of the alleged damage; the causal nexus (nexo de causalidad) between the event giving rise to the damage and the damage itself; the defendant’s status as the party that caused the damage; and the plaintiff’s status as the injured party. The challenged judgment essentially dismisses the complaint because the aforementioned causal nexus could not be proven; that is, more specifically, it was not proven that the extraction work conducted under the defendant’s concession caused the loss of one hectare of land from the plaintiff’s property, located at [Dirección3], which borders the Río Puerto Viejo in its entirety.
The plaintiff’s grounds of appeal are based on the argument that the loss of one hectare of land alongside the river channel was indeed proven. This Court finds that this fact was conclusively established by the topographic expert evidence (prueba pericial topográfica) produced in the proceedings; however, it was not proven that this loss was due solely to the defendant’s conduct rather than to changes in the channel of the Río Puerto Viejo over the years, nor that the erosion process began when the defendant commenced its operations, as would be necessary to establish its civil liability. The challenged judgment found it proven that the property of which the plaintiff is the registered owner, recorded in the Heredia Registry District under registration [Placa1] and depicted on registered cadastral plan number H-39623-77, has experienced a reduction in its area as of the present date. It should be noted that this plan (appearing at folio 1 of the physical case file) dates from 1977, and it is a matter of public and common knowledge that, between that year and 2014 (37 years), the flat terrain and heavy precipitation in the area caused river channels to widen, in some cases to shift, and to generate erosion processes.
It is therefore evident that the channel of the Río Puerto Viejo and its boundary with that property no longer have the same dimensions as in 1977. This is also shown by the expert evidence prepared by geologist Javier Oviedo González, who, using a methodology consisting of field studies, satellite images, and materials from the case file itself, determined that the plaintiff’s land had indeed undergone changes and had been subject to erosion, but that it could not be established through “feasible evidence” that this resulted from material extraction or river changes caused by the defendant’s conduct. The scope of that evidence was defined in the complaint at folio 22, specifically by requesting that the expert indicate whether the defendant had failed to respect the river protection zones or had failed to take mitigation measures to prevent erosion on the plaintiff’s property. The defendant also requested this technical evidence at folio 130 of its answer, to prove its opposing theory of the case, namely that the changes to the property were attributable to “natural conditions and the erosional and depositional patterns of the Río Puerto Viejo.” In this context, the geologist considered a series of significant omissions in the complaint, including the failure to identify the exact locations of the affected areas or the timing of the events resulting in the loss of land (folio 182).
He conducted an expert inspection (reconocimiento pericial) in the presence of both parties and, as part of his methodology, consulted the topographic maps of the Instituto Geográfico Nacional and the Padrón Minero Nacional to identify other extraction concessions on the aforementioned river, and compared them with the coordinates obtained by GPS during that judicial inspection (folio 184). During the inspection, he determined that there were only ornamental plants and that only certain sections of the property were affected by fluvial erosion from the river, rather than the entire boundary adjoining the river and the concession area (folio 186). This is consistent with the outcome of the judicial inspection conducted previously on 16 de setiembre del 2014 (record at folio 28), which is attached to the case file on a video DVD. It is noteworthy that images from 2003 and 2007 (before the concession began operating) show that, during those four years, the river’s fluvial dynamics changed over time, altering its banks, and that this occurred long before the defendant began its operations (folios 187 to 189).
Furthermore, the study of precipitation levels from 2005 to 2014 (folio 190) indicates that the highest average rainfall occurred from 2008 to 2010, that is, during the two years preceding the concession-based extraction. The expert determined that “no recent extraction has occurred in the affected sectors; rather, it has taken place downstream, and it is therefore implausible to attribute the loss of land to the extraction of material under the mining concession” (folio 191), “but instead it is the product of the natural dynamics of the Río Puerto Viejo” (folio 192); he thus concluded that there is no evidence that the change in morphology was caused by the defendant’s actions (folio 193). In addition, he stated that a circular dike had been constructed on the right bank of the river in the southernmost sector of the plaintiff’s property to reduce downstream erosion; accordingly, there is no evidence that the required mitigation measures were not implemented.
This Court finds that this expert evidence is reliable, objective, and methodologically appropriate for determining that the river’s natural erosion was indeed the cause of the reduction in the area of the plaintiff’s property. The same is not true of the private expert report offered as additional evidence to assist the Court in reaching its decision (prueba para mejor resolver) by engineer [Nombre8], which is not taken into consideration, as stated in the first recital (considerando), because, under the principle of free evaluation of evidence in agrarian matters, precedence must be given to geologist Oviedo’s expert report, which was requested by both parties and whose author was appointed by the Court, giving it greater objectivity and scientific rigor. Moreover, the testimonial evidence cited by the appellant is not suitable evidence for proving this technical and scientific matter because, unlike the expert report, which even analyzes the hydrographic history of the Río Puerto Viejo, witnesses [Nombre5] and [Nombre4] merely expressed opinions regarding its behavior without being experts in the field.
In addition, witness [Nombre4] is a paramedic and has an interest in the proceedings because he filed complaints concerning the activity in the river; therefore, his technical opinions are not credible. Accordingly, the grounds of appeal concerning violations of Articles 32 and 33 of the Ley Forestal and of the Water Law are without merit, because it was not even established which points along the riverbank were occupied by the defendant, nor was it established that there had been an encroachment upon or destruction of the hectare of land, as explained above. Contrary to the witnesses cited by the appellant, witness [Nombre11] stated that no material had been extracted outside the concession area, that the material was removed from the center of the channel, and that this was in fact beneficial to the plaintiff because the extraction minimized lateral erosion caused by rainfall and stabilized the flow of the water.
This is consistent with the testimony of [Nombre10], who explained that this method of sheet extraction (extracción laminar) creates passive-water conditions with less energy and, therefore, less erosion potential. Consequently, the fifth ground of appeal is also without merit because, as emphasized above, the burden of proof (carga de la prueba) rests with the plaintiff, not the defendant, and the testimony of witnesses [Nombre10] and [Nombre11] is more consistent with the expert evidence produced. The appellant is likewise incorrect in arguing for recovery of the property (reivindicación), because such relief was not requested in the claims set forth in the complaint. The fourth ground of appeal is without merit because, since the private expert report was not admitted, it cannot be included in the body of evidence; therefore, there can be no error of fact or law concerning evidence that does not even form part of the evidentiary record. Consequently, the plaintiff’s grounds of appeal are rejected.-
As to the appellant’s sole grievance (agravio), the appellant is incorrect. To resolve this grievance, it is necessary to analyze the rules governing awards of costs (régimen de condenatoria en costas) under Costa Rican procedural law, as established by this Court: “In its broadest sense, an order to pay procedural and attorney’s costs (costas procesales y personales) occurs when a judicial ruling requires a particular person to pay these litigation expenses, which that person would not otherwise be required to pay. Pursuant to the cited provision, exemption from the payment of costs applies: 1.- To the losing party (perdidoso) who litigated in good faith (buena fe): This ground for exemption from costs is perhaps the most controversial of all. As noted above, costs are the expenses of the proceedings. This ground vindicates a party who neither commits abuse of process (abuso procesal) nor litigates recklessly or maliciously; that is, it examines the parties’ conduct during the proceedings, since by referring to ‘litigating,’ the provision concerns the parties’ conduct throughout the iter procesalis.
This good faith in litigation must be evident, as the provision states, and therefore the exemption must be supported by reasons given by the Judge. In any event, Article 223 ibídem supplements this doctrine by expressly indicating the specific cases in which such good faith cannot be deemed to have existed: a. In the case of a defaulting party (rebelde) who did not enter an appearance at first instance. b. A losing party who did not accept manifestly well-founded claims (pretensiones evidentes) in the complaint or counterclaim (reconvención). c. A litigant who submitted false documents and/or offered false or bribed witnesses. d. A party who failed to present evidence in support of an action or defense (evidentiary negligence (negligencia probatoria)). 2.- When the complaint and counterclaim contain excessive claims (pretensiones exageradas). This ground for exemption is not a reward for the losing party, but rather an application of the principle of procedural equality (principio de igualdad procesal) when both parties abuse the proceedings through the exercise of their right of action by asserting excessive claims.
It constitutes reciprocal abuse of the proceedings; therefore, as a matter of equity, the provision rewards neither party but sanctions both by eliminating the possibility that either party’s opponent will be required to bear both parties’ costs. Thus, each party shall pay its own costs for having abused the proceedings. 3.- When the complaint or counterclaim is partially granted: The rule that the losing party pays is set aside where the prevailing party succeeds only partially in the litigation because the judgment grants only some of that party’s claims. This means that the prevailing party was not entirely correct and the losing party was not entirely mistaken. Like the general rule awarding costs against the losing party, this ground for exemption, unlike the preceding ground, neither punishes abuse of the proceedings nor rewards good-faith litigation. Partially prevailing in a proceeding is also equivalent to partially losing despite obtaining a favorable judgment.
Accordingly, this exemption seeks equity between the parties by exempting the party that partially lost because that party also partially prevailed through the rejection of some of its opponent’s claims. 4.- Partial exemption from costs, exempting the party from procedural costs generated by idle or unnecessary applications (gestiones ociosas o innecesarias) filed by the prevailing opposing party: This ground for exemption from costs also constitutes a sanction for abuse of process. It does not concern an inadmissible or reckless complaint, as in the exemption from costs for excessive claims, but rather cases in which the abuse consisted of idle or unnecessary applications (inadmissible, repetitive, or unfounded appeals or incidental motions (incidentes)). This exemption is partial. It applies when the prevailing party abused the proceedings but nevertheless prevailed because its complaint was supported by the legal system.
The exemption applies only to costs generated by those unnecessary or idle applications.” TRIBUNAL AGRARIO, Voto 662-F-07 de las trece horas veinte minutos del dieciséis de agosto del dos mil siete.- In accordance with the foregoing, in light of section 55 of the Ley de Jurisdicción Agraria and section 222 of the Código Procesal Civil, this Court finds the grievance to be without merit, since it is evident that the plaintiff litigated in good faith and had sufficient grounds to litigate, as the plaintiff initially possessed objective elements that led him to file suit, and because the outcome of the litigation depended on technical and scientific evidence; pursuant to section 55 of the Ley de Jurisdicción agraria, the appellant must be exempted from payment of both categories of costs. The grievance is rejected, and the challenged judgment is affirmed.-

VOTO N° 786-F-21 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las quince horas treinta y ocho minutos del veinticinco de agosto de dos mil veintiuno.- PROCESO ORDINARIO establecido por [Nombre1] SOCIEDAD ANÓNIMA, cédula jurídica CED1 - - , representada por su presidenta [Nombre2] , mayor, educadora, cédula de identidad CED2 - - ; contra, INDACO HORQUETAS, SOCIEDAD ANÓNIMA, representada por [Nombre3] , cédula de identidad CED3 - - , en calidad de apoderado generalísimo sin límite de suma. Interviene como parte interesada EL ESTADO, representado por el licenciado José Joaquín Barahona Vargas, mayor, procurador, abogado, cédula de identidad CED4 - - . Actúa como apoderado especial judicial de la parte actora el licenciado Roberto Soto Vega, colegiado ocho mil cuarenta y tres y como representante de la parte demandada la licenciada Ana Lucrecia Quirós [Nombre4], colegiada cinco mil doscientos cuarenta y tres y el licenciado Roberto Garita Chinchilla, colegiado ocho mil ciento treinta y uno. Tramitado ante el Juzgado Agrario del Segundo Circuito Judicial de la Zona Atlántica, Guápiles.-
RESULTANDO:
Redacta el juez Picado Vargas, y;
CONSIDERANDO
I.Se rechaza la solicitud de prueba para mejor resolver por innecesaria, conforme al artículo 52 de la Ley de Jurisdicción Agraria.-
IV.El licenciado Roberto Soto Vega abogado de la parte actora interpone recurso de apelación contra dicha resolución, manifestando lo siguiente: AGRAVIOS DE FONDO: "AGRAVIO I: INCORRECTA DETERMINACIÓN DEL ELENCO DE HECHOS NO PROBADOS: Considera el suscrito que los hechos no probados 3, 5 y 6 son hechos que mi representada probó, con fundamento en lo siguiente: Sobre el hecho no probado 3), este hecho si se probó, si observamos los reconocimientos judiciales mi representada indica que el área por donde se encuentra el camino de lastre a la orilla del río y el área esquinera o intersección donde se recibe la prueba testimonial eran de su propiedad, se acredita de la siguiente manera. Como lo expondré en el presente recurso los artículos 78, 79 y 84, establecen la figura de la accesión por aluvión, en el presente asunto, los dos testigos de cargo que aportó mi representada, señalan que esa área esquinera era propiedad de mi representada, acá también como se dirá, era notorio que esa área donde se recibió la prueba pertenecía a la finca de mi representada por imperio de ley, es decir indiferentemente que formara parte o no de su finca inscrita, se acreditó que era parte de la finca de mi representada.
Ambos testigos [Nombre4] quien conoce la finca desde que tiene uso de la razón, indican que el área era parte de la finca de mi representada, en igual sentido el testigo [Nombre5] quien indicó que hace más de 23 años conoce el área y que esa área (en alusión a la intersección y brazo derecho del río) y el área donde se encuentra el camino de lastre a la orilla del río era parte de la finca de mi representada. Este es el medio probatorio idóneo para acreditar este hecho y resultaba innecesaria una prueba topográfica que vinera hacer ver que era parte de la finca inscrita de mi representada, porque bien podía encontrarse fuera de esa área inscrita y por el transcurso de los años no corrió agua por ese sitio (no existió contra prueba al respecto) y se acredita la pertenencia del área a mi representada, por otra parte era innecesario acreditar que fue la demandada la que invadió y desapareció dicha área para transformarlo en parte de la concesión minera, por cuanto, la demanda en el sitio reconoce que fueron ellos los que lo realizaron y se evidencia con los montículos, el camino de lastre realizado con materiales que el área quien la transformó fue la demanda es un hecho notorio y evidente, pese a ello también se acredito mediante la prueba testimonial ya que ambos testigos señalaron que fue la demandada y acá pierde relevancia el tiempo en el que los testigos pudieron indicar que vieron la maquinaria trabajando en esa área, por cuanto como se mencionó paso a ser un hecho notorio, evidente y no controvertido.
Por su parte el funcionario de la Dirección de Geología y Minas Esteban Bonilla Elizondo, indicó que cuando conoció el sitio era potrero y que tuvo dudas de si era o no parte del cauce, ante la respuesta inconclusa indicó que rápidamente que para este proyecto desconocían si se afectaron fincas privadas. También es de notar que paralelo al camino observado en el reconocimiento de lastre que se encuentra a la orilla en parte del brazo derecho del río, existe una naciente dentro de los límites de la finca de mi representada que se encuentran en la cercanía del área donde la demanda realiza la explotación minera, indicando dicho funcionario de la Dirección de Geología y Minas que no son nacientes protegidas por los artículos 33 y 34 de la Ley Forestal, sin embargo, no existe una sola prueba dentro del expediente de algún dictamen emanado por el SENARA, y porque es importante dicho dictamen?
La Sala Constitucional en el voto [Telf1], señaló: ¨En este sentido, la verificación de si una naciente es de carácter permanente o no permanente, es una determinación que compete a las instancias técnicas de la administración, que de conformidad con sus respectivos ámbitos de competencia, sería un asunto propio de la Dirección de Aguas del Ministerio del Ambiente y Energía, es estricta coordinación con otras instancias relacionadas, como el Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento, y el propio Instituto Costarricense de Acueducto y Alcantarillado…¨. De la declaración del señor [Nombre6] no se desprende que se realizaran las consultas interinstitucionales correspondientes. Aunado a ello, el informe del [Nombre7] [Nombre8] , ubica perfectamente la naciente existente en la finca de mi representada y le da tal condición y carácter, igual concluye que existen afectaciones a las zonas de protección.
A partir de este análisis probatorio, donde se carece de la información técnica suficiente para desacreditar la existencia de ese brote de agua en la finca como naciente, nos encontramos, con el hecho de que la actividad desplegada por la demandada se desarrolla sin respetar los márgenes previstos en el artículo 33 de la Ley Forestal, tanto para el área de nacientes como para las zonas de protección aguas arriba que se evidencia el lavado tanto en los reconocimientos como en las pruebas periciales y testimoniales, y el hecho no probado 3) por parte del a quo, se encuentra respaldado y debió de tenerse como probado. No solo eso al afectarse las zonas de protección del río y nacientes, automáticamente se invade la finca de mi representada y automáticamente pierde áreas de cultivos, ¿Por qué de esta afirmación?, al lavarse las zonas de protección del río, mi representada automáticamente debe de correr la zona de protección (tierras adentro) 15 metros en el área de lavado del río y en ese tanto se pierden áreas de cultivo, por el lavado y se pierde tierra, esto fue un hecho evidente y manifestó acreditado por todos los medios probatorios y el área que perdió mi representada es determinable en una eventual fase de ejecución de sentencia, sin embargo, el lavado y la pérdida per se, quedó acreditado probatoriamente.
Este tanto también los hechos no probados números 4) y 6) encuentra respaldo probatorio. Hechos no probados 5 y 6 se acreditan mediante los elementos probatorios traídos al proceso como lo es el informe del [Nombre7] Allan Astorga, quien realizando un informe histórico de los mapas aéreos en y en su condición de Geólogo de gran experiencia en Costa Rica, concluye ¨ El análisis de fotointerpretación histórica muestra que no todo el tiempo la bifurcación del río Puerto Viejo al sur de la Isla y fincas adyacentes ha estado activo (en alusión al brazo derecho). No obstante, el canal fluvial del sector este si ha mantenido agua, derivada de los manantiales…¨Por el trabajo de campo realizado por el autor, queda claro que se dio una importante profundización del cauce del río Puerto Viejo, muy posiblemente por un exceso de explotación del sedimento del río un elemento que constata esta situación se observan rocas duras que forma parte del sustrato del cauce fluvial (…).
Como conclusión principal se deriva que a partir del análisis de fotointerpretación histórica realizada al cauce del Río Puerto Viejo a la altura de la isla y fincas adyacentes y que muestra una significativa estabilidad del cauce, y respecto a la acciones de extracción minera desarrolladas en ese mismo sector del río desde 2012, queda claro para el autor de este documento que dicha actividad minera generó un significativo desequilibrio en el cauce del río y sus márgenes, posiblemente por exceso de sobre explotación del cauce del río y o/ por inadecuado manejo del río Puerto Viejo, con lo que indujo a significativos procesos de erosión en sus márgenes más potenciales daños ambientales¨. (la negrita es nuestra). El perito [Nombre8] en sus recomendaciones indica: ¨Que no se permita más explotación minera en el cauce del río Puerto Viejo ni en su bifurcación, dado que el sistema fluvial a la altura de la Isla y fincas adyacentes y al sur, fueron desequilibrados de forma significativa…¨.
De este análisis del dictamen pericial y de los testimonios de los testigos de cargo [Nombre5] . El testigo [Nombre4] , indicó en su deposición que en el área existente entre la Isla y la finca de mi representada (área de la mencionada bifurcación) no corría agua y que conoce la zona desde que tiene uso de la razón, .mientras que [Nombre5] indicó que se trataba de un yurrillo en alusión a que prácticamente no corría agua en el área, lo que hace creíble ambos testimonios y respaldan los hechos 5 y 6 tenidos por no probados en la sentencia, en el sentido de que la demandada con sus actividades mineras, es quien desestabilizó los taludes de la finca de mi representada, y que se introdujo en áreas que pertenecieron a mi representada, hecho que se acredito con los medios probatorios idóneos prueba de cargo y descargo, como se ampliará e indicará en el agravio V del presente y como se expuso líneas atrás se probó que la demandada fue la que eliminó esa área esquinera y parte derecha del brazo del río, lo que resultó ser un hecho no controvertido y evidente, en ese tanto la sentencia debe de ser revocada para acoger las pretensiones de mi representada.
II AGRAVIO: INFRACCION DIRECTA DE L OS ARTICULOS 33 Y 34 DE LA LEY FORESTAL: Desaplicación de los artículos artículo 33, 34 de la Ley Forestal y de la jurisprudencia de la Sala Constitucional en relación con las Zonas de Protección. El órgano competente para determinar si existen nacientes o no es SENASA. El funcionario de La Dirección de Geología y Minas, Geólogo Esteban Bonilla, dice que dentro de sus tareas esta la revisión de estudios técnicos para el otorgamiento de concesiones y cuando se otorgan revisa la operatividad del proyecto, los informes de labores, indica que se hacen inspecciones regulares, y que tienen un protocolo con una lista de prioridades y con base en ella realizan las visitas, que se puede estar viendo una concesión de seis a siete veces al año o dos veces al años, en el año 2011, realizó una visita de inspección, recorrió todo el sector, y se enfocaron en ver lo que técnicamente les interesaba, y recuerda que habían indicios de extracción de material, y trató de indagar, indicando que eran terceros que la realizaban, cree que hubo una denuncia, y que tiene la idea que se acusó ante el Ministerio Público y perdió el seguimiento, no conoce la finca de Chahuer, ni los límites y ejerció la coordinación hasta el año 2017 de esa zona de Limón, indica que los estudios de nacientes quien los ve es la SETENA, en el caso de esta concesión se tomaron los datos de la finca de [Nombre9] , (un tercero ajeno al proceso) y que por su conocimiento técnico determinó que no eran nacientes y así lo descartó, y que procedió ese tercero a contratar un profesional privado quien descartó tres brotes como naciente, son los tres casos que conoce, la concesión tiene dos objetivos uno económico que es generar riqueza y otro secundario que es dejar o asentar un sistema hidráulico en el río, indica que cuando visitó originalmente esa zona al margen derecho y que para él, el lado derecho se considera un brazo y el testigo lo llama brazo derecho indica que había muy poco agua, con pozas y evidencia de que ocasionalmente el flujo llenaba esta área, que había charral en el área, que en sus visitas nunca inspeccionó aguas arriba porque no se había trabajado el sector aguas (donde está el lavado al margen derecho) y la última visita fue a finales del 2016 o inicios del 2017, y fue la última vez que visitó la zona y no paso de esta área porque la extracción se enfocaba en el margen derecho, continua indicando que el ancho a explotar en la concesión se ve por criterios geomorfológicos y fotografías aéreas, desconozco en este, que ha ocurrido que afecten, propiedades privadas, la concesión se otorga sobre cauce y muchas veces el cauce está dentro de una propiedad privada, sobre el ancho de la concesión es variado,, depende del ancho del cauce de lado a lado y la concesión va donde llega el agua en la crecida ordinaria, indica que no vio afloramiento de agua en la finca de [Nombre1] y consideraron que vio agua que era parte del río (es decir, esta naciente nunca fue sometida análisis) y señala el análisis del Islote por referencia a un informe privado que realizó un tercero, y quedó claro porque así lo respondió ante la pregunta del a quo, tengo entendido que esos afloramientos no tienen protección no tengo conocimiento sobre algún dictamen y me aplica la Ley de Aguas, este testimonio es conteste con el encargado regente del proyecto de extracción Geólogo Adrián Bonilla, quien indicó que no conoce ningún estudio sobre esa naciente y en este tanto existe la prueba del [Nombre7] [Nombre8] que indica que los brotes de agua existentes en la finca de mi representada son nacientes y las obras de extracción como caminos y movimientos de material se desarrollaron en la cercanía a menos de los retiros y distancias previstas en los artículos 33 y 34 de la Ley Forestal, en ese tanto no existe en la Ley Forestal una excepción que intentan dar o una diferenciación entre nacientes y afloramientos de agua, toda vez, que las propias nacientes son eso, afloramientos de agua, siendo así, el a quo, no solo obvia el análisis de este importante tema, trascendental y objeto de Litis, por cuanto al no respetar la demandada las zonas de protección de la naciente que se constató está dentro de los límites de la finca de mi representada y graficada y ubicada por el [Nombre7] [Nombre8] , estaríamos frente a una invasión de las zonas de protección, que debieron de respetarse y a su vez la finca de mi representada, él área invadida en la zona de protección de la naciente y en la zona colindante con el río y el área lavada colindante con el río, es un hecho acreditado mediante todos los elementos probatorios traídos al proceso, y en ese tanto existe un área real de pérdida de la finca de mi representada establecida también por el perito [Nombre8] y catalogada como área de erosión, que bien su determinación exacta en cuanto a medida no necesariamente debió de ser probada por mi representada por cuanto es un hecho cierto y notorio tal erosión en la finca, el área es precisamente en parte la prevista en los artículos 33 y 34 de la Ley Forestal o en su defecto se podría determinar con exactitud el área, en la fase de ejecución de sentencia, toda vez, que la degradación y el acercamiento se realizaron en las zonas de protección del afloramiento o naciente que brota en parte de la finca de mi representada, lo que no tuvo contravención y como lo indiqué es público y notorio.
En ese tanto, la sentencia lesiona directamente una inaplicación directa de los artículos 33, 34 de la Ley Forestal, doctrina y jurisprudencia informadora de los mismos y al determinarse que la demandada no respeto tales retiros, automáticamente invadió la finca de mi representada por cuanto se acreditó con la prueba testimonial y en las fotografías aéreas traídas en la pericial del *. [Nombre8] que existía cobertura arbórea de protección y aunado a que las zonas de protección del río considerándolas del cauce a la finca de mi representada son propiedad absoluta de la finca de mi representada, quien al perder área del río, pierde áreas de cultivo al desplazarse las zonas de protección hacia el interior de la finca. La carga de la
prueba –pese a que mi representada fue quien la reprodujo-correspondía por disposición del artículo… .de la Ley de biodiversidad a la demandada o al propio Estado quien fue un coadyuvante activo en defensa de la demandada. Como corolario de lo anterior y pese a que este aspecto eventualmente no sería responsabilidad de la demandada, considera el suscrito que del testimonio del señor Esteban Bonilla Elizondo, funcionario de la Dirección de Geología y Minas, al indicar que las concesiones al reiterar que el criterio de naciente o no de los afloramientos existentes era un criterio de la Dirección de Geología y Minas y que no existió estudio alguno para el afloramiento existente en la finca de mi representada, en ese tanto existe un quebranto directo a la jurisprudencia de la Sala Constitucional por cuanto uno de los principales criterios técnicos que se deben de considerar en cualquier proyecto referente a nacientes o áreas de protección lo es el SENARA, no existiendo respaldo de consulta alguna previo al otorgamiento de la concesión y observemos lo que ha indicado la Sala sobre omitir cualquier consulta concerniente a recursos hídricos o dudas sobre los mismos al SENARA observemos lo expuesto por la Sala: ¨ VII.- Tocante a la función del Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento, en materia ambiental relacionada con el recurso hídrico.
Acorde con el texto de la sentencia No. 2009-000262 de las 14:32 horas del 14 de enero de 2009, en lo tocante a la participación del SENARA en cuestiones de índole ambiental, relacionadas con el recurso hídrico y su protección, resulta de interés transcribir algunas consideraciones vertidas en su oportunidad por este Tribunal. Lo anterior, por ser de trascendencia para el caso en estudio: "XVII.- Sobre la certeza científica en cuanto a la existencia del recurso hídrico y la explotación del Acuífero Sardinal. Punto medular en las violaciones aducidas por los recurrentes, es la carencia de estudios hidrogeológicos contundentes que aseguren la existencia del recurso hídrico suficiente en el Acuífero Sardinal, para que el mismo sea explotado en los términos previstos y queridos por el ICAA. Sobre el particular, la Sala reitera la obligación de las instituciones públicas de respetar y aplicar de manera sólida el principio precautorio en materia ambiental, de donde surge la obligación de impedir la realización de obras que carezcan de la certeza técnica necesaria para concluir que su ejecución resulta inocua para el ambiente, y, en el caso concreto, para el acuífero en cuestión (...) Resulta importante apreciar que en esta relación de hechos es nula la mención o referencia al Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento – SENARA-, pues a pesar que desde marzo de dos mil seis el ICAA venía elaborando la idea del proyecto, y ser el SENARA una entidad vital en cuanto a la utilización del recurso hídrico subterráneo –como lo es el Acuífero Sardinal- no fue sino con la interposición del recurso de amparo que esta entidad inició a evaluar las actuaciones del ICAA en el ámbito de sus competencias.
XVIII.- Sobre el Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento. Según se ha explicado en el III considerando de esta sentencia, las competencias del SENARA trascienden lo concerniente a los distritos de riego, siendo así que las mismas resultan tener una vocación nacional derivada de sus mismos antecedentes institucionales. Asimismo, el artículo tres de la Ley de Creación del SENARA, ley número 6877, dispone, en lo conducente que: “ARTÍCULO 3º.- Son funciones del SENARA: (…) ch) Investigar, proteger y fomentar el uso de los recursos hídricos del país, tanto superficiales como subterráneos. (…) h) Vigilar el cumplimiento de las disposiciones legales en las materias de su incumbencia. Las decisiones que por ese motivo tome el Servicio, referentes a la perforación de pozos, y a la explotación, mantenimiento y protección de las aguas -que realicen las instituciones públicas y los particulares- serán definitivas y de acatamiento obligatorio.
No obstante, tales decisiones podrán apelarse dentro del décimo día por razones de ilegalidad, para ante el Tribunal Superior Contencioso Administrativo. El Tribunal resolverá en un plazo no mayor de noventa días.” (énfasis añadido). Es así, que, por disposición expresa de su ley de creación, el SENARA tiene la competencia de proteger los recursos hídricos del país, razón por la cual sus decisiones en torno a la explotación, mantenimiento y protección, serán definitivas y de acatamiento obligatorio. Por su parte, el artículo ciento cincuenta y siete de la Ley de Aguas -aún vigente- señala que: “Artículo 157.- Es deber de las Municipalidades consultar al Departamento de Agricultura, y obtener de él el correspondiente permiso, antes de enajenar, hipotecar, dar en arriendo o a esquilmo o explotar por su cuenta, cualquier terreno que posean o adquieran cuando en dichos terrenos existan aguas de dominio público utilizables.
El Departamento de Agricultura decidirá si tales terrenos están comprendidos entre los mencionados y si el destino que se deseare darles pudiera afectar la conservación de las aguas que utilizan las poblaciones. Iguales obligaciones tendrán las Juntas de Educación, Juntas de Protección Social y, en general, todo organismo de carácter público.” (el destacado no es del original) Esta disposición normativa debe interpretarse y aplicarse de conformidad con lo dispuesto en el artículo veintiuno de la Ley sobre el Uso, Manejo y Conservación de Suelos –a partir del cual se define que el Ministerio de Agricultura y Ganadería o Departamento de Agricultura en el lenguaje utilizado por la Ley de Aguas) mantiene una competencia secundaria o residual en esta materia- norma que claramente establece que: “ARTÍCULO 21.- En materia de aguas, el Ministerio de Agricultura y Ganadería deberá coordinar, con el Servicio Nacional de Riego y Avenamiento y cualquier otra institución competente, la promoción de las investigaciones hidrológicas, hidrogeológicas y agrológicas en las cuencas hidrográficas del país, así como en las prácticas de mejoramiento, conservación y protección de los suelos en las cuencas hidrográficas, según las competencias del Servicio mencionado…” De tal forma, la integración de las normas de reciente cita informa que, para el aprovechamiento de las aguas de dominio público, toda entidad pública –sin distingo- deberá obtener del SENARA el permiso correspondiente, al punto que las decisiones que de manera fundamentada adopte el SENARA en cuanto a ello, serán definitivas y de acatamiento obligatorio.
Esta definición dista de ser una manifestación retórica de la Sala; por el contrario, la misma deriva de la responsable integración del amplio marco normativo que regula la materia, que, como se dijo, requiere del progresivo avance y reconocimiento propio del ámbito de los derechos humanos, toda vez que el derecho al agua y el derecho a un ambiente sano y ecológicamente equilibrado son derechos humanos fundamentales. La Sala advierte que esta precisión sitúa al SENARA en una posición particularmente relevante en cuanto a la gestión del recurso hídrico nacional, lo cual resulta importante considerando la naturaleza eminentemente técnica de esta dependencia administrativa, posición que debe ser reforzada y ejercida mediante la necesaria y debida coordinación interinstitucional de las diferentes entidades involucradas –ICAA, SETENA, MAG, Municipalidades, entre otras-. En este sentido, pretender ejecutar proyectos de extracción y explotación del recurso hídrico sin la debida autorización y vinculación del SENARA, resulta ser violatorio de las previsiones normativas de protección al ambiente, pues se carecería de los insumos técnicos necesarios que dictaminen la disponibilidad y posibilidad de aprovechamiento de las aguas de dominio público". ¨Allí es, precisamente donde se evidencia la omisión de las autoridades legalmente encargadas de velar por la protección, al ambiente, de comunicarse y coordinar entre sí.
A lo dicho, se suma que ante la incertidumbre y dudas generadas sobre los cuerpos de agua existentes en la propiedad y los terrenos donde se desarrollaría un proyecto de esa envergadura por un tercero, en este caso una empresa privada, ni siquiera se requirió la valoración o aprobación del Servicio Nacional de Aguas Subterráneas Riego y Avenamiento, entidad que, bajo juramento, fue prístina en esgrimir que hasta tanto ellos no validaran la información hidrogeológica del sitio, no se debía permitir la prosecución de la construcción. Es decir, el proyecto original no fue sometido a conocimiento de SENARA, ni siquiera cuando surgieron las dudas sobre la naturaleza y condición de los cuerpos de agua en mención, siendo que cuando surgió duda al respecto, la comunicación y el dictado de las medidas cautelares, se produjo únicamente entre las accionadas, y estando ya interpuesto el amparo¨ (Res.
Nº 2019015629, SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del veintitrés de agosto de dos mil diecinueve). Nos encontramos que en el presente caso existen dictámenes ausentes del SENARA, mientras que los Geólogos de la Dirección de Geología y Minas Esteban Bonilla Elizondo, auto determinan que es naciente y que no, para el otorgamiento de la concesión supra indicada, en cuyo caso, nos encontramos que esos cuerpos de agua no sufrieron evaluación previa a la concesión y el [Nombre7] [Nombre8] y los reconocimientos existentes en autos dictaminan la existencia de la naciente y esa duda razonada en la falta de estudios y la definición de nacientes realizada por el Geólogo Allan Astorga, sumado el testimonio creíble del funcionario de Geología y Minas Esteban Bonilla Elizondo y el propio Geólogo encartado del proyecto, hacen creer que esa zona cercana a la naciente debió de guardar su retiro y en ese tanto al otorgarse la concesión, con esa duda, debió de prevalecer el criterio precautorio y como consecuencia existió una invasión a las zonas de protección de la naciente, las cuales fueron por años protegida por mi representado y en el sector (que hoy es cauce) existía para los testigos potrero, bosque y existían árboles, al no guardar los trabajos de la demandada con los retiros legales, e invadió áreas propiedad de mi representada por accesión del mismo río y en ese tanto el hecho sexto de la demanda se probaron así como también el hecho séptimo y las pretensiones 1 , 2 y deben de ser declaradas con lugar o en su defecto al menos la tercera pretensión declarando parcialmente con lugar la demanda y solicito se revoque la sentencia y se declare con lugar la demanda.
III. AGRAVIO: ERROR DE HECHO POR SOLICITAR PRUEBA PERICIAL PARA ACREDITAR QUE LAS AREAS DONDE SE REALIZÓ EL RECONOCIMIENTO JUDICIAL Y LA RECEPCIÓN DE PRUEBA PERTENECIAN A MI REPRESENTADA, CON UN QUEBRANTO DIRECTO A LOS ARTICULOS 78, 79 Y 84 DE LA LEY DE AGUAS (ACCESION POR ALUVION) Este aspecto se refiere específicamente al área donde se realizó la recepción de prueba testimonial y el área cercana a la naciente observada en los reconocimientos brazo derecho del río. El honorable a quo, no realiza un análisis de la prueba de manera integral (testimonial, documental, reconocimientos judiciales). Esta afirmación se fundamenta en el hecho de que las pruebas de cargo (testimoniales) traídas al proceso, nos indican que el área donde se desarrollaron las recepciones de prueba, sea en la intersección del río donde la finca de mi representada en algún momento según testigos de cargo colindó con la isla, no tenía mi representada que probar, como lo analiza incorrectamente el a quo en su sentencia que el área afectada pertenecía a su finca, por medio de un perito Topógrafo, y que el haber prescindido de el mismo le resta legitimación y derecho para la presentación de la demanda, esto no es cierto y esa prueba resultaba innecesaria, por lo siguiente: Si observamos la prueba testimonial se realizó en la esquina de la intersección en lo que hoy es el límite de la finca de mi representada con la concesión o el área explotada, los testigos de cargo señalan que esta área formaba parte de la finca de mi representada y hasta allí llegaba la misma, que existía vegetación y este hecho no fue descalificado por la contra parte, y el testigo funcionario de la Dirección de Geología y Minas [Nombre6] , señaló la existencia de un charral y un pequeño cauce al margen derecho y quedó demostrado mediante toda la prueba de descargo que ofreció la demanda que ese margen derecho del río en el área de la intersección, es un área donde se otorgó la concesión, sin embargo, se observó que por esa área (la intersección y margen derecho) no corre un caudal, sobre todo lo que a ese momento parece el cauce del río, y por las dimensiones como lo indique líneas atrás, no resulta creíble que en una llena o crecida ordinaria de ese cauce (brazo derecho) crezca y las aguas cubran toda el área observada a lo ancho y concesionada, es más el cauce que corre por esta área era mínimo al momento de la recepción de la prueba, era mínimo según el funcionario de la Dirección de Geología y Minas [Nombre6] , era mínimo antes de otorgar la concesión y según los testigos de cargo y el peritaje del [Nombre7] [Nombre8] indica que esa área se cerró en algún momento histórico y que sobre el mismo discurre poca agua, es decir, esta área no inundada en una crecida ordinaria. resultaría ilógico pensarlo y seria contra las reglas de sentido común y el correcto entendimiento humano pensarlo siendo así se prueba automáticamente que parte de ese brazo derecho, la intersección donde se recabo la prueba formaban parte de la finca de mi representada por disposición de los artículos 78. 79 y 84 de la Ley de Aguas, que indica ¨ Los cauces de los ríos que queden abandonados por variar naturalmente el curso de las aguas, pertenecen a los dueños de los predios respectivos en toda la longitud.
Si el cauce abandonado separa heredades de distintos dueños, la nueva línea divisoria correrá aquidistante de una y otras¨. Es decir, el área de la intersección(brazo derecho), únicamente poseía un cauce pequeño (ver fotografías aéreas) y la heredad de mi representada automáticamente por imperio de ley comprendía parte de esa área, por donde no corría agua en una crecida ordinaria del río, siendo así, el a quo, valora incorrectamente la prueba y los elementos probatorios que tenía que utilizar mi representada para probar que esa área era de su propiedad, toda vez, que por imperio de ley, esas áreas pertenecieron a la propiedad de mi representada antes de ser concesionadas, en igual sentido que el artículo anteriormente citado el artículo 84 ibídem dispone: ¨ Salvo lo dicho en el artículo 81 ibídem, pertenecen a los dueños de los terrenos confinantes con los arroyos, torrentes, ríos y lagos, el acrecimiento que reciban paulatinamente por la accesión o sedimentación de las aguas¨.
Es decir, el área que no forma parte del cauce del río en una crecida normal, no forma parte del cauce del dominio público y tampoco son áreas concesionables según el propio testimonio del funcionario de la Dirección de Geología y Minas Esteban Bonilla Elizondo y en ese tanto, al no haber existido otras concesiones en el sitio con anterioridad - como quedó acreditado en los testimonios del funcionario de la Dirección de Geología y Minas y del propio Geólogo regente del proyecto-, esta área por imperio legal formaban parte de la finca de mi representada, siendo esta una presunción iuris et de iure y habiendo adquirido mi representada el derecho real por accesión en la figura jurídica conocida como aluvión, asistiéndole el derecho a mi representada de su reclamo, esto insisto se acreditó con la prueba de cargo y analizando otras pruebas como los reconocimientos judiciales, testimonios de cargo que fueron contundentes al indicar que la finca de mi representada comprendía el área donde se recibió la prueba (esquinera) y que habían árboles en esta zona, esta presunción está amparada al ordenamiento jurídico y por lo tanto con base en las reglas de valoración probatoria del numeral 41.1.2 del Código Procesal Civil no fue desvirtuada por la demandada pese a poseer toda la capacidad técnica y los estudios no pudo desvirtuar la presunción de la propiedad a favor de mi representada de que esa franja lavada donde se encuentra el camino en el brazo derecho del río y la intersección donde se recibió la prueba, fuera un área parte del cauce del río antes de la concesión, aunado a que lo que corría en agua era insignificante o un yurrillo y el testimonio del funcionario de la Dirección de Geología y Minas, al señalar cuál área era la legalmente permitida otorgar la explotación en el área de cauce remitiéndose en su deposición a la definición de cauce del artículo 69 de la Ley de Aguas, reduciendo el brazo derecho al momento de otorgar la concesión como una pequeña franja en el área de la intersección.
Por lo tanto existe un error de hecho por parte del a quo, al considerar que esta prueba (topográfica) era esencial para acreditar que el área lavada y desaparecida de la finca (inscrita) de mi representada ( área donde se realizó la prueba y hoy parte del área concesionada y parte del brazo derecho), solo era acreditable con la elaboración de un peritaje topográfico que se acreditara que comprendía la finca propiedad de mi representada, error de hecho en la apreciación de la prueba que constituye una violación a los artículos 54 de la Ley de la Jurisdicción Agraria por cuanto la apreciación de la prueba (en su ausencia) es incorrecta, y se produce una lesión directa por no aplicación de los numerales 78, 79 y 84 de la Ley de Aguas vigente y también se acreditó que el área aguas arriba de donde se recibió la prueba el lavado de la orilla de la finca de mi representada colindante con el río sufre el drenaje y lavado.
Como se indicó el área lavada esquinera y brazo derecho que era parte de la finca de mi representada también según el estudio elaborado por el [Nombre7] [Nombre8] manifiesta ¨ se evidencian nuevas zonas de cauces y barras fluviales en la imagen del 2018 que no existían en el año 2006. Estas zonas son áreas donde se dieron procesos de ¨erosión¨ intensos o en su defecto, donde se dio actividad antropológica(humana)como la explotación minera que se ha desarrollado en esa zona desde el año 2012. En el mapa de la Figura 4.3 corresponde con las zonas de color rojo. Su área total es de 64.439,9 metros cuadrados. Es importante señalar que muchas de estas corresponden con áreas de protección del río Puerto Viejo…¨ Estas áreas identificadas en rojo comprende un área en la esquina del margen derecho (intersección) coincidiendo con el área donde se realizó la recepción de la prueba y el área aguas arriba lavada al margen derecho de la finca de mi representada que colinda con el río.
Se observa en las fotografías áreas traídas al proceso como entre el año 2006 y 2018 existe un cambio en la esquina de la intersección al margen derecho de la finca de mi representada como lo apuntó el [Nombre7] [Nombre8] en su informe y se observa en el mapa 4.3, también en la figura 3.13(foto aérea del año 2006) y la figura 3.15(imagen aérea del año 2018) el cambio en la forma de dicha esquina y como en esta última se observa que forma parte del cauce, resultando coincidente con las conclusiones del perito y como se verá con los testigos de cargo . En el presente caso la accesión que por años en el margen derecho del río había existido a favor de la finca de mi representada era evidente, por ser un cauce abandonado o por donde no corrían aguas ni siquiera en una corrida ordinaria como lo indica el artículo 69 de la Ley de Aguas, sobre el tema la doctrina española ha indicado ¨ Preceptúa el artículo 370 que ¨los cauces de los ríos, que quedan abandonadas por variar naturalmente el cuerpos de las aguas, pertenecen a los dueños de los terrenos ribereños en toda la longitud respectiva a cada uno.
Si el cauce abandonado separaba heredades de distintos dueños, loa nueva línea divisoria correrá equidistante de una y otra¨. Desaparece, pues, un cauce de dominio público, para transformarse en privado, lo que ocurre automáticamente, como también es automática la incorporación del nuevo terreno al predio ribereño…¨. ( Luis Diez-Picazo y Antonio Gullón, Sistema de Derecho Civil, Volúmen III, Derecho de las Cosas y Derecho Inmobiliario Registral, Sexta Edición, p.187). Así las cosas, habiéndose recabado toda la prueba y considerando que todos los testigos de cargo indicaron que por el área donde se recibió la prueba en la intersección, era una finca de mi representada y no se inundaba, el testigo [Nombre5] , declaró que hasta existía un árbol de Higueron y que esa área desapareció y observó la maquinaria de la demandada trabando en el sitio. En igual sentido la prueba del [Nombre7] [Nombre8] y el testimonio del señor [Nombre4] , lo acreditan, mientras tanto la demanda no hizo prueba al respecto y pese a tenerlos en su poder no aportó los estudios que en su momento sirvieron de base a la Dirección de Geología y Minas (si existieron) que acreditara que en esa área específica de la intersección y brazo derecho, era cauce del río y que en crecidas ordinarias se llenara en su totalidad.
Esta representación bien pudo plantear la demanda como un proceso reivindicatorio, no obstante, en la fundamentación de las pretensiones se indicó la particularidad del caso, donde las áreas habían desaparecido y hoy eran ya parte del área explotada por la demandada y en ese tanto resultaba aplicable únicamente la indemnización de los daños y perjuicios, como en efecto fueron reclamados. Demostrada la posesión de mi representada de esa área antes del otorgamiento de la concesión en el año 2012, mediante prueba idónea y pertinente, facultaba al a quo, a declarar con lugar la demanda acogiendo las pretensiones y condenando a la demandada en abstracto para que en la fase de ejecución de sentencia se determinara el área exacta que perdió mi representada y su eventual valor. IV. AGRAVIO: ERROR DE HECHO EN LA VALORACION DE LA PRUEBA PARA MEJOR PROVEER INFORME TECNICO DEL PERITO DE PARTE [Nombre7] ALLAN ASTORGA.
El a quo, comete un error procesal en la admisión y no admisión de la prueba (peritaje de parte), pero luego comete un error de hecho en su análisis restándole valor a sus conclusiones por el uso del perito del término ¨posiblemente¨ en cuanto a las acciones que conllevaron el lavado en los márgenes de la finca de mi representada y pérdidas de áreas, estos errores los expongo a continuación: Errores Procesales en la admisión o no de la prueba (peritaje de parte) por parte del a quo. Primero el a quo, utiliza la prueba para descalificar la prueba testimonial indicando de cargo: ¨ Al igual que con la declaración del señor [Nombre5] esta deposición no encuentra respaldo técnico, por el contrario, de las fotografías aportadas en su informe por parte del señor geólogo [Nombre8] Gättgens, se evidencia que siempre ha existido el cauce derecho o brazo derecho del río y no como indicó el señor [Nombre4] que antes eso no existía.
El mismo Geólogo señala que se observó que la bifurcación del río, en el [Dirección2] y fincas adyacentes, ha tenido un comportamiento variable, cerrándose en algunos años y abriéndose, por erosión, otros años¨. Acá vemos el uso de la pericia de parte, y en otro momento de su sentencia el a quo, señala sobre la admisibilidad de la misma, lo siguiente: ¨; la primera es un informe técnico elaborado por el señor geólogo [Nombre8] Gättgens, quien fue contratado de manera privada y no como perito del proceso lo cual le resta contundencia para efectos probatorios ya que sus afirmaciones y conclusiones no han podido ser sometidas al escrutinio del contradictorio pues si bien se confirió audiencia a la parte contraria a fin de que manifestara lo que considerara pertinente a sus intereses, no se ha podido cuestionar y pedir aclaraciones en caso de existirlas o incluso poder ofrecer pruebas de descargo¨.
Observemos como el a quo, utiliza la prueba técnica para analizar las deposiciones de los testigos de cargo, pero en otro momento, considera que el mismo(peritaje) es complaciente y le resta credibilidad por haber sido contratado de manera privada y por no haber sido sometido al contradictorio, ninguno de los anteriores argumentos es procesalmente correcto, el primero por cuanto la pericia de parte a la luz de las nuevas disposiciones contempladas en el Código Procesal actualmente vigente y las tendencias modernas, lo permiten y no puede ser descalificado el peritaje solo por ser aportado, por una parte, este argumento es superado por la doctrina contemporánea y se permite probar un hecho por estos medios técnicos probatorios, eso sí, el a quo, debe de analizarlo conjuntamente con los demás elementos probatorios traídos al proceso. Lo incorrecto procesalmente es tenerlo y darle un uso parcial, siendo lo correcto admitirlo y valorarlo en todo su contexto, por otra parte el segundo procesalmente incorrecto que el a quo, comete en la sentencia es señalar que la prueba no puede ser sometida a un contradictoria.
Esta afirmación del a quo, considero respetuosamente también es incorrecta, por cuanto la contra parte fue puesta en conocimiento y en ese tanto, si se le permitió pedir cualquier aclaración y adición siendo ello procedente y legal, no obstante, no lo hizo, el contradictorio en el marco del actual proceso agrario es muy limitado para las partes por cuanto el peritaje es documental y en efecto ni los peritajes oficiales ni los peritajes de parte son sometidos a un verdadero contradictorio, pero ello solo sería posible si existiera una etapa complementaria que obligara a los peritos realizar sus deposiciones técnicas ante el a quo, en un verdadero contradictorio, en la actualidad no existe y por lo tanto, los instrumentos procesales para garantizar el equilibrio a las partes existen en la audiencia que pone en conocimiento los peritajes (como se realizó en el presente peritaje) y que ambas partes puedan realizar sus observaciones, ampliaciones y objeciones (principio de contradicción de la prueba), lo que no resulta correcto es desacreditarlo como medio probatorio por solo el hecho de ser propuesto por una de las partes, ni considerar que su admisión es un quebranto al debido proceso de la demanda, obviando el análisis de fondo del mismo con los demás elementos probatorios, la forma en que realizó el respetable juez el análisis no es correcto por cuanto no se sabe si fue admitido o no, o utilizándolo en lo que perjudica pero no en lo que beneficia.
Es importante señalar que mi representada se esmeró no por contratar a un perito complaciente, sino más bien al más calificado para ese fin, basta con observar los antecedentes del [Nombre7] Allan Astorga, que los expone en su propia pericia, entre ellos es Licenciado en Geología de la Universidad de Costa Rica, [Nombre7] en Ciencias Naturales de la Universidad de Stuttgart Alemania, Profesor Catedrático de la Escuela Centroamericana de Geología de la Universidad de Costa Rica, en disciplinas de Petrología Sedimentaria, Sedimentología y Geología Ambiental Especialista en evaluación de impacto ambiental, evaluación ambiental estratégica, ordenamiento ambiental territorial y gestión ambiental integral. En igual sentido laboró en RECOPE, En SETENA, donde fungió como Secretario General, consultor del Banco Mundial, Banco Interamericano de Ambiente y Desarrollo, Naciones Unidas, Unión Mundial para la Conservación de la Naturaleza, FAO, entre otras, lo anterior sin obviar que el [Nombre7] [Nombre8] realiza el peritaje dando fe de su contenido BAJO LA FE DE JURAMENTO, es decir una persona, tan públicamente conocida, científico especialista en la materia, no puede considerarse complaciente porque mi representada la contrató para un servicio profesional aislado, este argumento del a quo, es contrario a la lógica y correcto entendimiento humano, principios como el de lealtad procesal y buena fe ya que sin analizar nada en relación con el perito lo descalifica por el mero hecho de haber sido contratado por una parte, no obstante, ello no lo hace complaciente y en ese tanto la pericia debió de ser admitida, valorándola en su integridad y la forma en la que lo hizo el a quo, puede ser revocada por el Tribunal, para tenerla como una prueba creíble y no darle el calificativo de complaciente y en ese tanto realizar una valoración sin prejuicios procesales de dicha prueba y de sus resultados, con base en las reglas dispuestas en el artículo 54 de la Ley de la Jurisdicción Agraria.
En relación con el anterior agravio y dejando de lado la lesión procesal del a quo, existe un error de hecho en el análisis de la pericia realizada por el Geólogo [Nombre8] propiamente descalificándolo por el uso de término ¨probablemente¨: El error de hecho se produce en el análisis del informe realizado por el a quo, al señalar que el perito indicó: ¨ Como conclusión principal se deriva que a partir del análisis de fotointerpretación histórica realizado al cauce del Río Puerto Viejo a la altura de la Isla y fincas adyacentes y que muestra una significativa estabilidad de su cauce, y respecto a las acciones de extracción minera desarrolladas en ese mismo sector del río desde el 2012, queda claro para el autor de este documento que dicha actividad minera generó un significativo desequilibrio en el cauce del río y sus márgenes, posiblemente por exceso de sobreexplotación del cauce del río y por inadecuado manejo del cauce del río Puerto Viejo, con lo que se indujo a significativos procesos de erosión en sus márgenes y potenciales daños ambientales¨ El a quo, descontextualiza dicha conclusión, ello por cuanto el perito [Nombre7] [Nombre8] , fue categórico al indicar que la actividad minera desarrollada fue la que generó el desequilibrio en el río, las causas posibles para el perito fueron la sobre explotación del cauce del río y un inadecuado manejo del cauce del río Puerto Viejo, es decir, para el perito experto no existe duda, como lo interpreta erróneamente el a quo, de que la extracción minera desarrollada en el año 2012 (siendo la única que lo realizó la demandada) fue la provocadora de la erosión existente en la zona de estudio y el lavado de las fincas adyacentes a la Isla, como la de mi representada.
Las fincas adyacentes a la Isla, término reiterado por el perito analizado con base en los reconocimientos judiciales, queda evidenciado que se trata de la finca de mi representada, hecho que además es notorio en los estudios y del que no existió contradicción, intentar decir que la no mención específica de la finca de mi representada es un motivo para desacreditar el peritaje no es de recibo por cuanto la finca es adyacente a la Isla, salta en todas las fotografías aéreas y el a quo, se ubicó a la perfección en la pericia para desacreditar los testigos de cargo utilizando el estudio, sin embargo, indica que el estudio al no indicar la finca de mi representada no es útil, siendo ello contrario a las reglas de la lógica, el correcto entendimiento humano, al ser aspectos fácilmente constatables que el peritaje indica que la sedimentación se produce en fincas adyacentes a la Isla, la finca de mi representada es adyacente a la Isla, la finca de mi representada el a quo, constató se encuentra en parte en la intersección del río Sarapiquí y la Isla, la finca de mi representada se constató en los reconocimientos sufrió degradación en sus bordes, se lavaron y un área que le pertenecía, fue dada en concesión, como lo era la esquina donde se realizó la recepción de la prueba testimonial, sin embargo, fue dada en concesión, pese a no formar parte del cauce según lo indicado por el perito [Nombre6] y en el propio artículo 69 de la Ley de Aguas que define las áreas de cauce del río que se pueden dar en concesión no resultando lógico ni evidente que en una crecida normal el río abarcara toda el área de la intersección por cuanto el poco caudal que atraviesa el área es evidente en las fotografías aéreas aportadas y en los testigos de cargo y el cauce donde señalaron los testigos de la demandada se otorgó la concesión no es lógico que comprenda toda el área que hoy ocupa a lo ancho del brazo derecho, y la demandada no trajo prueba al proceso que acreditara que esa área(brazo derecho) era parte del cauce en una crecida ordinaria, el pensar que era parte del río en una crecida ordinaria deviene en irracional por cuanto la extensión es excesiva en relación con el pequeño paso del agua y así lo relató el testimonio del Funcionario de la Dirección de Geología y Minas [Nombre6] , quien indicó que era un cauce pequeño antes de otorgarse la concesión y que tuvo que revisar incluso si era continuo.
Por lo expuesto, el a quo, comete un error de hecho al interpretar la prueba pericial de parte de forma incorrecta, siendo probable con las pruebas traídas al proceso al menos como prueba documental el peritaje del [Nombre7] [Nombre8] y analizarlas fotos aéreas para ubicar la propiedad de mi representada y concluir categóricamente que la extracción del río es lo que provocó el lavado en los bordes de la finca de mi representada como lo hace el peritaje propuesto. Las razones probablemente como lo indica el perito pudieron ser dos propias de esas labores humanas de extracción, pero nunca ajenas a esa actividad extractiva como lo descontextualiza el análisis del señor Juez. Esas dos posibilidades fueron según el peritaje el posible exceso de sobreexplotación del cauce del río o por inadecuado manejo del cauce del río Puerto Viejo, con lo que se indujo a significativos procesos de erosión en sus márgenes y potenciales daños ambientales.
El informe de [Nombre8] en sus imágenes señala con claridad el área efectiva que ha perdido la firma de mi representada por cuanto del reconocimiento judicial, los planos catastrados y la prueba recabada por el a quo, se acreditó con absoluta claridad que las maniobras de explotación del río por parte de la demandada son las razones de la pérdida de parte de la finca de mi representada, en los reconocimientos existentes en autos en especial el utilizado en la primera diligencia de medida cautelar se observan los árboles de sotacaballos que son utilizados en la siembra a las orillas de los ríos(hecho público) para sostener los derrumbes y que dichos árboles se encontraban lavados producto de las acciones de lavado de la propiedad y en ese tanto el a quo, valoró incorrectamente el estudio del [Nombre7] Allan Astorga, Geólogo que valorada su prestigiosa experiencia supera con creces la aportada por los demás expertos y esta representación lejos de buscar un peritaje complaciente contrató los servicios del profesional más calificado para buscar la verdad real de los hechos y para precisamente dar credibilidad al Juez, y no por el hecho de haberlo contratado privadamente significa falta de objetividad del mismo ni tampoco complacencia con las partes, lo que la experiencia si me indica que es que por la estructura del proceso agrario actual, los peritajes judiciales son muy limitados y no van más allá y no son estudios profundos de los temas que se plantean.
POR ULTIMO EN RELACION CON DICHO INFORME SOLICITO QUE SE TENGA COMO PRUEBA COMO MEJOR PROVEER EN EL RECURSO DE APELACION Y SE ADMITA COMO PRUEBA O EN SU DEFECTO SOLICITO SE ADMITA COMO PRUEBA PARA MEJOR RESOLVER PERO COMO DOCUMENTAL, de apoyo con las imágenes existentes de la teoría del caso, misma que se acredita por medio de los elementos probatorios como los testimoniales, hechos notorios y con controvertidos, acreditando que parte de la finca de mi representada (intersección y parte del brazo derecho) fue invadida y que era parte de la finca de mi representada, las imágenes existentes en dicho estudio, se acredita la pérdida de un área considerable de la finca de mi representada, no es controvertido, que donde se realizó el reconocimiento judicial y recibiera la prueba fuera un área donde la demandada aprovecha la concesión y en ese tanto también es un hecho notorio, siendo así mi representada si acreditaría al menos parte de las pretensiones en cuanto a que la demandada invadió parte de su finca y la desapareció y la transformó en cauce, debiendo de ser condenada al menos de manera parcial, siendo que para acreditar el lavado aguas arriba, no se le podría sin dicho informe técnico acreditar la responsabilidad a la demandada.
Solicito así se admita al menos de forma documental dicha pericia y se acoja la demanda parcialmente. AGRAVIO V: DESEQUILIBRIO EN EL ANALISIS DE LA PRUEBA TESTIMONIAL DE CARGO CON LA DE DESCARGO Y EN LA BALANZA DE LAS CARGAS PROBATORIAS: El a quo, da credibilidad a los testigos de la parte demandada, trabajadores y quienes si dependen económicamente de la actividad que realizan, y cualquier acción irregular que salte a la luz en el manejo de la concesión les traería aparejadas responsabilidades de toda naturaleza, es por eso que lo declarado por el Geólogo regente del proyecto [Nombre10] , quien llegó a la zona en el año 2013 y antes no conocía la zona, quien además asegura no conocer estudios de la naciente existente en la finca de mi representada entre otros aspectos, es un testigo complaciente, por cuanto tiene un interés director en el resultado del proceso por cuanto del mismo se beneficia económicamente con el trabajo.
El testigo [Nombre4] , no fue un testigo complaciente, como lo califica el a quo, por cuanto el a título personal no tiene o desconozco si así es, conflicto con la demandada ya que su denuncia lo fue como representante de una asociación, incluso indica que llego a declarar porque hace mucho tiempo llevaba un proceso sobre el dragado del río, dice ser paramédico, indica que puso la denuncia por los daños ecológicos en el río y por eso está declarando, indica conocer la zona desde que tiene uso de la razón, indica conocer el área de la concesión incluso sacó una tarjeta del señor [Nombre11] quien es testigo de descargo, indicando que pasaron hablar con el él, indica la situación del cauce ha cambiado después de la concesión un montón, indica que el desvío al margen derecho no existía y nunca la vio en la vida y pese a no poder indicar con exactitud de la fecha y señalar que fue hace como dos años, si es conteste al mencionar cuando él fue a visitar la zona y que cuando comenzaron a sacar material de esa zona(margen derecho) fue cuando el visitó el área y les indicó que no podían hacerlo así (en alusión a la demanda) el caudal con ese chorro de agua no estaba y señala que las fincas de [Nombre1] y señala la propiedad y la ubica en el sitio perfectamente y la Isla la cual señala pegaba con la finca de [Nombre1] y ante la pregunta de ¿dónde llegaba la finca de Chahuer? indica que llegaba donde se estaba recibiendo la prueba, indica en alusión a esa área donde se recibió la prueba que eran potreros que había árboles un chilamate y fueron potreros.
Declara conocer una naciente y señala el sitio donde se encuentra, y se constató en el reconocimiento indicando que el camino (donde nos encontrábamos) estaba como a dos o tres metros de la naciente y que ese camino lo hizo la compañía demanda que sacó material del río, porque los vio, trabajando en ese sitio, y dentro de la finca Chahuer, que el camino realizado por la demanda está dentro de la finca de mi representada y además contesta que los lavados existentes en la finca de mi representada por erosión se dieron cuando la demandada comenzó a trabajar que recuerda que ese cauce no pasaba por ahí (en alusión al desvío derecho) porque la propiedad del frente de la finca de mi representada era de uno de sus tíos y que eran colindantes con la de mi representada en alusión a la Isla y que donde había agua era donde corre el agua que brotan de la naciente en la parte baja del margen derecho.
Con este testimonio directo se acredita que el área de mi representada llegaba hasta el sitio donde se realizó el reconocimiento y recepción de prueba, que el área donde está el camino de acceso al sitio donde se realizó la prueba (que hoy es parte de la concesión) era un potrero y pertenecía a mi representada y que no existía tal cauce lo que podría guardar relación con el peritaje realizado por el [Nombre7] [Nombre8] que indica que en algún momento no existió cauce, nótese que hasta el Geólogo de la Dirección de Geología y Minas Adrián Bonilla, tuvo duda en el año dos mil once, antes de otorgar la concesión por el poco cauce, tuvo que corroborar que era continuo, contrario a ello en un error de hecho en el análisis de la prueba testimonial el a quo, realiza un análisis aislado del testimonio y considera que más bien cuando el testigo indicó que por el área del brazo derecho no corría agua, esta es una contradicción con el estudio de [Nombre8] , y que en ese tanto el testigo resultaba complaciente, sin considerar ni valorar que el propio perito determina que en un momento histórico no existió paso de agua por ese margen derecho.
En ese tanto el a quo, realizó un análisis omitiendo esta consideración técnica, pese a que se basa para el descarte del testimonio en el mismo informe del [Nombre7] [Nombre8] , incluso el testigo funcionario de la Dirección de Geología y Minas, indica que tuvo que corroborar si el cauce era continuo por escaso que era su cauce y que fue por unas pozas que observó que determinó que se trataba de un cauce, que existen casos donde se aprueban proyectos en áreas privadas. En relación con el testimonio del señor [Nombre5] , indica que tiene 23 años de conocer el sitio, es un peón agrícola que trabaja en la Isla y señala que el área del cauce era diferente a lo que existe hoy señalando el margen derecho del río y dice que no existía río que lo que había era un bosque, desde que don [Nombre12] compró la finca, dice que por margen derecho pasaba un yurrito, por el lado de donde está el chapulín (intersección del margen derecho) que las fincas colindaban por el margen derecho en alusión a la de mi representada y la Isla, indica que el área donde se estaba recibiendo la prueba y se ubicaba el chapulín era parte de la finca de mi representada y que había higuerón que se fue, indica que cuando el río crece se llena y no se llevaba los árboles.
Indica vio maquinaria de la empresa demandada derribando los árboles indica que hasta tiene fotos, indicó que el bosque de la finca de mi representada llegaba hasta el yurro y que en ese sitio era la colindancia con la Isla. Este testigo acredita que el área donde se desarrollaba la prueba formaba parte de la finca de mi representada, y que no era parte de ningún cauce de río alguno, utiliza el término yurro para referirse al paso, yurro que en el argot popular es un diminutivo de río, el concepto del yurro según el diccionario usual del Poder Judicial es un término que, en Costa Rica, significa ¨ arroyo, riachuelo¨. El concepto de riachuelo es un río pequeño y de poco caudal…¨ por su parte arroyo es ¨caudal corto de agua casi continuo…¨(diccionario de la Lengua Española, Real Academia Española, vigésima primera edición) es decir los testimonios de cargo son contestes y concuerdan y es verdad que por el sitio en algún momento histórico no corrió agua y que también era un sitio de poco caudal y no existe prueba técnica de la demandada o de la Dirección de Geología y Minas pese a ser a ellas a quienes les correspondía probar tal hecho que señalara que en área de una crecida normal del río pudiese haber llegado hasta esa área y abarcar todo ese ancho, lo que a la luz del sentido común y el correcto entendimiento humano, nos haría creer que no es posible y en ese tanto esa área formaba por disposición legal, parte de la finca de mi representada, acreditado que esa área era parte de la finca de mi representada insisto no existe una sola prueba técnica aportada por la demanda que nos señalara que el área donde se realizó la recepción de prueba y donde se encontraba el camino realizado por la demanda que nos llevó al sitio, fuese cauce del río, esta prueba quien la posee o debe de tener en su poder es la demandada y no la trajo al proceso ni la reprodujo y esas tierras todo lo contrario antes de la concesión eran parte de la finca de mi representada como se demostró y la demandada de esa forma procedió a invadir esa área, la desapareció y convirtió en parte del cauce concesionado pese a ser un área propiedad de mi representada por imperio de ley de los artículos 78 y 84 de la Ley de Aguas, ahora bien, demostrado que la finca de mi representada comprendía esas áreas, a quo, concedió mayor valor probatorio a los testigos de la demandada, valorando que son científicos en la materia, pero no valorando que tienen un verdadero interés en el proceso tanto laboral como responsabilidades que se pueden derivar de sus actuaciones y en este tanto el a quo indica que la demandada aporta el testimonio de los señores [Nombre11] , quien es un Ingeniero Agrónomo especialista en suelos quien ha tenido a su cargo la regencia ambiental de la concesión desde el año 2013, [Nombre10] , quien es el regente geológico de la concesionaria, desde hace 5 o 6 años y encargado de la supervisión de labores de extracción y [Nombre6] quien es Geólogo y funcionario de la Dirección de Geología y Minas y se encarga de la revisión de los estudios técnicos para el otorgamiento de concesiones, y en ese tanto el segundo concluye que la extracción de materiales del río se ha realizado acorde con las disposiciones legales pertinentes, obviando valor a los testimonios de personas no técnicas como los aportados por mi representada, sin embargo, los mismos tienen un interés plausible y no merecen credibilidad.
Ahora bien en el peritaje realizado por el señor [Nombre13] , señala que ha existido un cambio en la morfología, los efectos de la erosión están presente y efectivamente se ha perdido terreno que originalmente conformaba parte de la finca de la acá actora, y concluye que esta es producto de la dinámica del río y que no existe evidencia que fuese producto de la extracción de material del río, ojo acá porque el juez pretende que el perito entre en una materia propia del juez cual es valorar con todos los elementos probatorios las causas de dicha degradación, el perito indicó que no se podía asociar a la labor extractiva pero tampoco lo descartó y en ese tanto el a quo, en una labor integradora de los elementos probatorios es a quien le corresponde fallar si existieron elementos probatorios adicionales para descartar la responsabilidad de la demanda en los daños demostrados, la prueba testimonial ofrecida por mi representada es conteste ya que ambos testigos observaron la maquinaria trabajando en el área, conocía la finca antes de la concesión y les consta que el área donde hoy se explota parte de la concesión es de mi representada y en ese tanto el a quo, huye del análisis integral de la prueba para sustituir su fallo por la duda que presente un perito, descalificando los testimonios de mi representada indicando que los mismos carecen de criterio técnico, no obstante, declaran y dicen la verdad, verdad que no pudo ser contrastada por los científicos ni por la demanda porque no tenían 23 años o más de conocer la zona como los testigos, ni demostraron la demandada ni el mismo Estado que coadyuvó que el área que se reclama fuese parte del cauce en una crecida ordinaria, prueba que se debió de tener a mano por la demandada quien fue la que realizó los estudios para obtener la concesión, pese a tenerlos que acreditar y demostrarlo, no lo hace y su conducta es procesalmente reprochable y tenemos que por un elemento probatorio diferente a la prueba técnica, como lo es la testimonial se puede también atribuir el nexo causal entre los daños que se reclaman en las pretensiones de la demanda, y es que la prueba técnica no puede utilizarse por el a quo, para sustituir su función, por cuanto el juez es perito de peritos, y puede por cualquier medio probatorio legal, corroborar la verdad de los hechos expuestos en la demanda, en ese tanto al desequilibrar el a quo, la balanza en el análisis de los testigos reales verídicos e históricos, con testigos científicos quienes no conocían la zona antes de la concesión, es un quebranto directo a lo dispuesto en el artículo 54 de la Ley de la Jurisdicción Agraria, por cuanto no existió análisis ni expresó los principios de equidad en el análisis de la prueba y traslada o pretende que solo si científicamente se indica que la actora si invadió parte de la finca de mi representada, solo si científicamente se determina que el lavado y los daños de la finca de mi representada fueron provocados por la extracción del río, no es posible mediante otros elementos probatorios como la prueba testimonial acreditar la invasión y los daños reclamados, es decir, no puede por la vía de la prueba reina de todos los procesos como lo es la prueba testimonial acreditarse el nexo de causalidad deseado, pese a que tenemos testigos que dicen haber conocido el área y haber conocido la finca de mi representada y tener que según los artículo 78 y 81 de la Ley de Aguas, esos terrenos pertenecían a mi representada y pese a llevar testigos directos que dicen haber visto maquinaria de la demandada trabajando, los mismos si no tienen prueba científica que los respalde no son ciertos, esto precisamente es el desequilibrio provocado por el a quo, en su análisis, dejando las máximas de experiencia y el correcto entendimiento humano en el análisis de la prueba pericial para sustituirla y convertir al perito en juez, sustituyendo la labor del a quo, y en ese tanto considero que la teoría del caso de mi representada se prueba por todos los medios incluido el informe del Geólogo [Nombre8] quien con un curriculum impresionante indica que si existe conexión entre los daños(lavado, pérdida de un área de la finca de mi representada) con las labores de extracción, pérdida de área y lavado que también tiene respaldo en el informe del Perito imparcial y que se observó en todos los reconocimientos judiciales, conectando la prueba testimonial la relación causal entre los daños acreditados con la responsabilidad directa de la demandada, mientras que la demandada no hace la prueba de sus excepciones, ya que no probó que el área de la intersección y brazo derecho del río, fuera inundable en una crecida ordinaria, ni aportó un testimonio que conociera con anterioridad la zona, lejos de ello, ninguno de los testigos conocía la zona con anterioridad, solamente el funcionario de la Dirección de Geología y Minas, quien más bien fue contundente en su declaración y acreditó la casi inexistente corriente que pasaba por esa área que era potrero, en igual sentido el Estado fue un espectador pasivo que no realizó ni aportó ninguna prueba trascendental para contra argumentar la teoría del caso de mi representada, en ese tanto el juez interpreta incorrectamente la disposición sobre cargas probatorias obligando a mi representada acreditar por un medio científico –pese a que se hizo- el área invadida de la finca, cuando le asiste la presunción y derecho de los artículos 78, 79 y 81 de la Ley de Aguas, cuando la carga de la prueba correspondía a la demandada por disposición del numeral 41.1.2 del Código Procesal Civil y no lo hizo y en relación con su responsabilidad en el lavado e invasión de la finca en el área de la intersección y margen derecho, es un hecho notorio que quedó plasmado en los reconocimientos, por cuanto hoy es área concesionada y en ese tanto todos los testigos de parte, contraparte, confesión, fueron contestes en señalar que toda esa área había sido objeto de concesión y existía material según los reconocimiento judiciales. En ese tanto la sentencia debe de ser revocada para que se declare con lugar en todos los extremos (imágenes 9 a 24 del expediente electrónico).-
IV.El licenciado Roberto Garita Chinchilla abogado de la demandada también interpone recurso de apelación manifestando lo siguiente: AGRAVIOS DE FONDO: "PRIMERO: La parte actora, [Nombre1] . , de forma temeraria y mal intencionada, planteó esta demanda ordinaria en contra de mi representada INDACO HORQUETAS S.A, estimándola en la suma de ciento veintiocho millones de colones, argumentado que la empresa INDACO HORQUETAS S.A., invadió injustificadamente y desapareció área que formaba parte de la finca propiedad de la actora [Nombre1] . , finca ubicada en el Cantón de Sarapiquí, Provincia de Heredia, Matrícula de Folio Real número 86482-000, por supuestos daños y perjuicios, los cuales nunca fueron probados por la empresa [Nombre1] S. A. SEGUNDO: La sentencia es omisa en cuanto a indicar la fecha en la que la actora [Nombre1] S. A, adquiere el inmueble, tema que es de suma importancia, ya que la actora, de forma temeraria, demanda los supuestos daños ocasionados antes de ser propietaria de la finca ubicada en el Cantón de Sarapiquí, Provincia de Heredia, Matrícula de Folio Real número 86482-000.
La importancia de este elemento probatorio, que fue alegado por la defensa en etapa probatoria, es de suma relevancia, pues demuestra la temeridad de la acción desplegada por la actora en contra de la demandada, razón que justifica sobradamente una condenatoria en costas en contra de la empresa [Nombre1] . , para compensar de alguna forma, los desembolsos económicos que hizo la demandada INDACO HORQUETAS S.A, para poderse defender y probar la falsedad de cada una de las aseveraciones hechas por la actora en su demanda. TERCERO: En la sentencia aquí impugnada, se desprende que lo único que la actora [Nombre1] . pudo probar, es que su propiedad es colindante con un inmueble que pertenece a la empresa demandada INDACO HORQUETAS. Hechos que NUNCA fueron controvertidos, pero como HECHOS NO PROBADOS, temenos todos los hechos controvertidos. De manera que la actora [Nombre1] . , NO probó que en su finca, la totalidad de la zona colindante con el Río Puerto Viejo se encuentre debidamente protegida por árboles, tampoco demostró la parte actora, que la sociedad INDACO HORQUETAS S.A, haya invadido su finca debido a la explotación.
No se demuestra por parte de la actora, [Nombre1] . que la sociedad accionada INDACO HORQUETAS S.A, haya realizado labores en el Río Puerto Viejo sin respetar las zonas de protección y que por motivo de sus trabajos y aprovechamiento de materiales, los árboles que mitigaban las zonas de protección hayan sido derribados y lavados. No demuestra la parte actora [Nombre1] . , que la sociedad demandada INDACO HORQUETAS S.A, haya realizado desvíos de las aguas del Río Puerto Viejo y que con motivo de ello haya realizado invasiones que pongan en peligro su propiedad, los cultivos que existen en su finca y los caminos internos de su finca. Tampoco demuestra en forma alguna la parte actora, [Nombre1] S. A, que la afectación que haya sufrido o podido sufrir su propiedad por causa de las corrientes de aguas, crecidas y desbordamientos del Río Puerto Viejo, lavado de terreno en áreas ribereñas y cualquier otra afectación que el discurrir de dichas aguas haya provocado, sean por culpa de las labores extractivas realizadas por la concesionaria INDACO HORQUETAS, SOCIEDAD ANÓNIMA.
No acredita en forma alguna la actora, [Nombre1] S. A, que la empresa demandada sea responsable de la desaparición de áreas de terreno que aduce se produjeron en su propiedad, ni que sea responsable del pago de daños y perjuicios por esos terrenos o por cualquier otro concepto ya que no se demuestra la responsabilidad del eventual daño o perjuicio. Tales falencias probatorias, en conjunto con la estimación de la demanda, en la suma de 128.000.000 de colones, hacen evidente que la venturosa acción no puede quedarse sin sanción alguna en contra de la actora, [Nombre1] S. A, pues tal estimación de la demanda, en conjunto con las aseveraciones que la demanda contiene, evidencian un desgaste económico injustificado para la accionada, INDACO HORQUETAS SOCIEDAD ANÓNIMA, quien obviamente, no puede quedarse de brazos cruzados ante semejante demanda y debe pagar honorarios a profesionales en derecho y experticias de peritos en su campo, para desmentir semejante demanda de tan cuantiosa estimación, como la desplegada por la actora, [Nombre1] S. A. CUARTO: AGRAVIO: la actora [Nombre1] S.A, demanda de forma temeraria a mi representada INDACO HORQUETAS SOCIEDAD ANÓNIMA, estimando la demanda en la exorbitante suma de 128.000.000 de colones, como toda acción, esta genera una reacción, de manera que para defenderse, mi representada INDACO HORQUETAS, S.A. se ve en la necesidad de desembolsar una suma de dinero superior a los 20.000.000 de colones injustificadamente.
La actora no probó ninguna de las aseveraciones controvertidas en esta demanda, por lo que tal acción fue declarada sin lugar. No obstante, la sentencia aquí recurrida, en los términos en que se resuelve, causa agravio a la empresa demandada, al no condenarse en costas a parte la actora, por un criterio infundado del señor Juez de primera instancia, lo cual afecta económicamente a mi patrocinada INDACO HORQUETAS S.A, pues la sentencia aquí recurrida, no le concede condenatoria en costas a favor de la empresa Indaco Horquetas y en contra de la actora [Nombre1] S. A, quien hace el daño y sale airosa y campante, sin que su mal intencionada acción le genere consecuencia económica alguna." (imágenes 38 a 41 del expediente virtual).-
No lleva razón la apelante en cuanto a lo expuesto en este primer reclamo. Revisados los elementos probatorios que constan en autos, este Tribunal concluye el fundamento fáctico de la sentencia recurrida (elenco de hechos probados y no probados) fue correctamente establecido, de conformidad con los principios y reglas probatorias que inspiran esta materia. Al respecto, debe recordarse en materia agraria impera el sistema de libre valoración de la prueba, lo que significa según la Sala Primera, que el juez no está sujeto a criterios preestablecidos en la normativa común y que puede hacer la ponderación del acervo probatorio con gran amplitud, sin otro límite que actuar respetando principios de equidad y derecho (ver votos N°9 de las quince horas del veintinueve de enero de mil novecientos noventa y siete; N°50-98 de las quince horas veinte minutos del veinte de mayo de mil novecientos noventa y ocho; N° 310-01 de las dieciséis horas del veinticinco de abril del dos mil uno; 445-01 de las catorce horas quince minutos del veinte de junio del año dos mil uno).
El Tribunal comparte lo expuesto por la Sala Primera de la Corte, al tenor de lo dispuesto por los artículos 9 del Código Civil y 5 de la Ley Orgánica del Poder Judicial. Por otro lado, en materia de responsabilidad civil, contractual o extracontractual, objetiva u subjetiva, independientemente de tratarse de materia agraria, civil o comercial, para ser admitido el reclamo debe existir un daño o perjuicio, el cual debe ser imputable u originado por quien se demanda. Por daño se entiende “ todo menoscabo, pérdida o detrimento de la esfera jurídica patrimonial o extrapatrimonial de la persona (damnificado), el cual provoca la privación de un bien jurídico, respecto del cual era objetivamente esperable su conservación de no haber acaecido el hecho dañoso. Bajo esta tesitura, no hay responsabilidad civil si no media daño, así como no existe daño si no hay damnificado. Por otra parte, solo es daño indemnizable el que se llega a probar (realidad o existencia), siendo ello una cuestión de hecho reservada al prudente arbitrio del juzgador…”(Sala Primera de la Corte Suprema de Justicia, voto Nº114 de las 16:00 horas del 2 de noviembre de 1979).
Aparte de tener que ser real, cierto, efectivo y merecedor de amparo jurídico, se requiere el daño sea causado por un tercero y esté subsiste a la hora de plantearse la demanda. Debe mediar además una relación de causalidad entre el hecho ilícito y el daño acontecido. En materia de responsabilidad extracontractual, corresponde a la parte actora demostrar los elementos de la teoría del daño, a saber: la existencia y cuantificación del daño alegado, la relación del nexo de causalidad entre el hecho generador del daño y éste; la calidad de agente generador del daño del demandado y la condición de damnificado del actor. La sentencia impugnada declara sin lugar la demanda básicamente, por no haber podido ser demostrado el referido nexo de causalidad; es decir, y más concretamente, que las labores de extracción por medio de concesión de la demandada haya generado la pérdida de una hectárea de terreno de la finca de la actora, ubicada en la [Dirección3] ques en su totalidad con el Río Puerto Viejo.
Los agravios de la actora se dirigen bajo el argumento de que la pérdida de una hectárea de terreno junto al cause del río sí se demostró; aspecto que considera este Tribunal sí se logró acreditar fehacientemente con la prueba pericial topográfica practicada en el proceso, pero no se demostró que dicha pérdida se debiera únicamente al actuar de la demanda o a razones del cauce del Río Puerto Viejo a lo largo de los años y si dicho proceso de erosión haya empezado con el inicio de labores de la demandada, para así determinar una responsabilidad civil de ésta. La sentencia impugnada tuvo por demostrado que la finca de la cual la actora es la propietaria registral de la finca partido de Heredia, matrícula [Placa1] y graficada en el plano catastrado número H-39623-77, ha tenido pérdida de su cabida a la actualidad. Nótese que dicho plano (visible a folio 1 del expediente físico) es del año 1977, y resulta un hecho público y notorio que en el transcurrir de dicho año al año 2014 (37 años) la zona por su naturaleza plana y de mucha precipitación, ha provocado que el cauce de los ríos se amplíe, en algunso casos se cambie y genere procesos de erosión.
Lo cual genera que evidentemente el cauce del Río Puerto Viejo y la colindancia con dicha finca no se encuentre en las mismas proporciones que en el año 1977. Ello se muestra también demostrado con la prueba pericial realizada por el geólogo Javier Oviedo González, quien con una metodología consistente en estudios de campo, imágenes satelitares y del mismo expediente determina que efectivamente ha existido una modificación del terreno de la actora, la cual se ha encontrado en proceso de erosiónm pero no se puede determinar con "evidencia factible" que sea producto de la extracción de material o por cambios de río por la actuación de la demandada. El objeto de dicha prueba fue delimitada en la demanda a folio 22, específicamente en que dicho perito indicara si la accionada había o no irrespetado las zonas de protección del río o no hubiera tomado medidas de mitigación para evitar la erosión en la finca de la actora.
La parte demandada también solicitó dicha prueba técnica a folio 130 de su contestación, para demostrar su antítesis del caso, en el sentido de que las modificaciones en dicha finca obedecen a "condiciones naturales y patrones erosivos y depositacionales del Río Puerto Viejo". Bajo este contexto el perito geólogo tomó en consideración una serie de omisiones importantes en la demanda, como lo es que no se indicó la localización exacta de los lugares afectados ni la temporalidad de sucesos de la pérdida del terreno (folio 182). Realizó un reconocimiento pericial con la presencia de ambas partes y como parte de la metodología recurrió a las hojas topográficas del Instituto Geográfico Nacional y el Padrón Minero Nacional para determinar incluso otras concesiones de explotación sobre el citado Río y las cotejó con las coordenadas que arrojó el GPS en dicho reconocimiento judicial (folio 184).
En el reconocimiento determinó que solo habían plantas ornamentales y que solo son algunos tramos de la propiedad las que se encuentran afectadas por la erosión flivial del río y no toda la colindancia con el río y la concesión (folio 186); lo cual coincide con el resultado del reconocimiento judicial realizado con anterioridad el 16 de setiembre del 2014 (acta en folio 28) y que se encuentra adjunto al expediente en DVD de video. LLama la atención que de acuerdo con imágenes de los años 2003 y 2007 (anteriores al inicio de la concesión) muestran que en esos cuatro años la dinámica fluvial del río ha cambiado con el tiempo, modificando las riberas del mismo y que ello ocurrió mucho antes de que inciara la actividad de la demandada (folios 187 a 189). Además, del estudio de cantidad d precipitaciones de los años 2005 a 2014 (folio 190) se denota que las mayores precipitaciones se dieron en promedio en los años 2008 a 2010, es decir en los dos años antes de la explotación concesionada.
El perito determina que "los sectores afectados no se ha dado explotación reciente, siendo más bien aguas abajo, de ahí que resulete inverosímil atribuirle la pérdida del terreno a la extracción de material por la concesión minera" (folio 191), "sino que son producto de la dinámica natural del Río Puerto Viejo" (folio 192); concluyendo así que no existe prueba que el cambio en la morfología se deba al accionar de la accionada (folio 193). Aunado a ello, indica que hay un dique circular realizado en la margen derecha del río en el sector más al sur de la finca de la actora para disminuir la erosión aguas abajo, por lo que no hay prueba de que no se hayan realizado las medidas de mitigación ordenadas. Este Tribunal considera que dicha prueba pericial es fidedigna, objetiva y metodológicamente adecuada para determinar que efectivamente, la erosión natural del río es la causa del menocabo en la extensión de la finca del actor; no así el peritaje privado ofrecido como prueba para mejor resolver del ingeniero [Nombre8] , el cual no se toma en consideración, como se indicó en el primer considerando, pues prevalece, a la luz de la libre valoración de la prueba en materia agraria, la pericial del geólogo Oviedo, que fue solicitada por ambas partes y fue designado por el Despacho, lo cual hace que tenga más objetividad y rigidez científica.
Por otra parte, la prueba testimonial invocada por la recurrente no resulta prueba idónea para demostrar este hecho de naturaleza técnica-científica, pues a diferencia del peritaje, que incluso analiza la historia hidrográfica del Río Puerto Viejo, los testigos [Nombre5] y [Nombre4] indican opiniones de comportamiento sin ser técnicos en la materia. Aunado a ello, el testigo [Nombre4] es paramédico y tiene interés en el proceso, por haber interpuesto denuncias relativas a la actividad en el río, por lo que no merece credibilidad sus opiniones técnicas. Por ello, los agravios relativos a violación de los artículos 32 y 33 de la Ley Forestal y a la Ley de Aguas no son de recibo, pues ni siquiera se acreditó cuáles puntos del magen del río eran los que estaban ubicados la accionada ni tampoco se acreditó que huibiese invasión ni destrucción de la hectárea de terreno coko se ha explicado anteriormente.
Contrario a los testigos citados por el recurrente, el declarante [Nombre11] afirmó que no se había extraído material fuera del área de concesión y que el material se sacaba del centro del cauce y que ello más bien era positivo para la actora pues la extracción minimiza las erosiones laterales por la lluvia y estabilizaba el flujo de las aguas; lo cual concuerda con el testimonio de [Nombre10] que explicó que este método de extracción laminar genera condiciones de agua pasiva, con menos energía, y genera menos potencial de erosión. Por ello, tampoco es de recibo el quinto agravio, pues la carga de la prueba, se insiste, corresponde a la actora y no a la demandada y la prueba testimonial de los testigos [Nombre10] y [Nombre11] resultan más coincidentes con la prueba pericial realizada. Tampoco lleva razón en el argumento de la reivindicación de la finca, pues ello no fue pedido en las pretensiones de la demanda.
El cuarto agravio no es de recibo pues al no ser admitido el peritaje privado no puede ser tomado dentro del acervo probatorio por lo que no puede existir error de hecho ni de derecho en una prueba que ni siquiera forma parte del cúmulo de elementos de prueba. En consecuencia, se rechazan los agravios de la parte actora.-
En cuanto a su único agravio, no lleva razón el recurrente. Para dilucidar este agravio, resulta menester analizar lo concerniente al régimen de condenatoria en costas que sigue el ordenamiento procesal costarricense, según ha establecido este Tribunal: "En su sentido más genérico, la condenatoria a pagar las costas procesales y personales se produce cuando hay una resolución judicial que impone a determinada persona el pago de estos gastos procesales que, sin dicha imposición, no estaría obligada a pagar. De acuerdo con el numeral citado, la exención al pago de costas procede: 1.- Al perdidoso que haya litigado de buena fe: Esta causal de exención de costas es quizás la más polémica de todas. Como se reseñó anteriormente, las costas son los gastos del proceso. Esta causal reivindica a quien no comete abuso procesal ni litiga con temeridad o malicia; es decir, que examina la conducta procesal de las partes, dado que al hablar de “litigar” la norma se refiere a la conducta de las partes durante el iter procesalis.
Esta buena fe al litigar debe ser evidente, según reza la norma, por lo que la exención debe ser fundamentada por el Juzgador. De todas formas, el artículo 223 ibídem complementa este instituto indicando expresamente en qué casos concretos no se puede considerar que existió esta buena fe: a. En el caso del rebelde que no se haya apersonado en primera instancia. b. El vencido que no haya aceptado pretensiones evidentes de la demanda o reconvención. c. Al litigante que haya aportado documentos falsos y/u ofrecido testigos falsos o sobornados. d. El que no haya aducido prueba para fundar su acción o excepción (negligencia probatoria). 2.- Cuando la demanda y contrademanda comprendan pretensiones exageradas. Esta causal de exoneración no es un premio al vencido, sino una aplicación del principio de igualdad procesal cuando ambas partes abusan del proceso, con su derecho de acción, al cometer abuso procesal por pretensiones exageradas.
Se trata de un abuso con el proceso recíproco, por lo que en términos de equidad, la norma no premia a nadie, sino que sanciona a ambas partes eliminándoles la posibilidad a ambos de que su contraparte tenga que cargar con las costas de ambos. Así, cada quien pagará sus costas por haber abusado con el proceso. 3.- En caso de que la demanda o contrademanda sean declaradas parcialmente con lugar: La regla de quien pierde paga se rompe en una situación en que el vencedor gane el litigio parcialmente, al concedérsele en la sentencia solo una parte de sus pretensiones. Esto quiere decir que ni el victorioso tenía toda la razón y que el vencido no estaba del todo equivocado. Al igual que la condenatoria en costas al vencido como regla genérica, esta causal de exención, a diferencia de la causal anterior, no castiga al abuso con el proceso ni premia a la buena fe al litigar. Ganar parcialmente un proceso equivale a la vez a haber perdido parcialmente la sentencia favorable.
Por ello, esta exención busca la equidad entre las partes, exonerando al parcialmente vencido, por haber ganado a su vez parcialmente con el rechazo de algunas de las pretensiones de su contrincante. 4.-Exención parcial de costas, exonerando de las costas procesales generadas por gestiones ociosas o innecesarias que haya promovido la contraparte victoriosa: Esta causal de exención de costas también constituye sanción al abuso procesal. No se toma la demanda improponible o temeraria, como en la exención de costas por pretensiones exageradas; sino cuando el abuso radicó en gestiones ociosas o innecesarias (recursos o incidentes improcedentes, reiterativos o infundados). Esta exención es parcial. Es para casos en que la parte victoriosa haya abusado en el proceso y aún así haya ganado porque su demanda estaba amparada por el ordenamiento jurídico. La exoneración sólo es sobre las costas generadas por estas gestiones innecesarias u ociosas." TRIBUNAL AGRARIO, Voto 662-F-07 de las trece horas veinte minutos del dieciséis de agosto del dos mil siete.- De conformidad con lo expuesto a la luz del numeral 55 de la Ley de Jurisdicción Agraria y el numeral 222 del Código Procesal Civil, considera este Tribunal que el agravio no es de recibo; ya que es evidente que el actor litigó de buena fe y tenía suficientes motivos para litigar, ya que en un principio tenía elementos objetivos que lo llevaron a demandar, y por depender el resultado del litigio de prueba técnico científica; debe eximirse del pago de ambas costas al recurrente, de conformidad con el artículo 55 de la Ley de Jurisdicción agraria. Se rechaza el agravio y se confirma la sentencia impugnada.-

Se confirma la sentencia en lo que fue objeto de apelación.- ???????????????
