By virtue of the appeal (recurso de apelación) filed by the Procuraduría General de la República, this Court reviews the judgment rendered at veintidós horas cuarenta y seis minutos on diecinueve de abril de dos mil veintiuno.

CONSIDERATIONS
The petitioner instituted these possessory information proceedings to register in its name with the Registro Público de la Propiedad the property described as follows: Land containing a Church with Atrium, Passageway, and Rectory, located at [Dirección1], , in the Province of Cartago, which, according to the attached registered survey plan (plano catastrado), Number C-1943750-2016, has an area of tres mil trescientos veintisiete metros. The Procuraduría General de la República, as representative of the State, opposes the granting of title (titulación), arguing that the width of the public road along the eastern boundary is not respected, according to official communication DVOP-DI-DV-PV-2017-1574, and further that, when the church was built (entre los años 1954 y 1960), laws 1338 and 1851 were in effect, both providing that public roads must have a minimum width of veinte metros, which conflicts with the information shown on the plan.
In a judgment rendered at veintidós horas cuarenta y seis minutos on diecinueve de abril de dos mil veintiuno, the Juzgado Civil de Cartago ruled: “POR TANTO: / Pursuant to Articles 1, 2, 3, 4, 5, 6, 8, 15, 16, and 19, all of the Ley de Informaciones Posesorias, and Sections 853, 856, and 860, all of the Código Civil, these possessory information proceedings are approved, subject to the encumbrances (afectaciones) referred to in Articles 17 and 19 of the Ley de informaciones Posesorias and without prejudice to third parties having superior rights. The Registrar of the Registro de la Propiedad is ordered to register, for the first time, in the name of TEMPORALIDADES DE LA IGLESIA CATÓLICA DIÓCESIS DE CARTAGO, legal-entity identification number CED9, the property described in the plan registered with the Catastro Nacional under number C-1943750-2016, which is described as follows: Land containing a Church with Atrium, Passageway, and Rectory, located at [Dirección2], in the First Canton of Cartago, Province of Cartago, which, according to the attached registered survey plan N° C-1943750-2016, has an area of tres mil trescientos veintisiete metros cuadrados, and whose boundaries (linderos) are: to the north, Alquileres Villanueva Sociedad Anónima (property identifier CED10), Temporalidades de la Arquidiócesis de San José (property identifier CED11), and Nopal Sociedad Anónima (property identifier CED12); to the south, [Dirección3], with a frontage thereon of ochenta y dos metros con setenta centímetros lineales; to the east, [Dirección4], with a frontage thereon of cuarenta y ocho metros con setenta y siete centímetros lineales; and to the west, [Dirección5], with a frontage thereon of treinta y cinco metros con noventa y cuatro centímetros lineales.
The real property at issue in this proceeding is valued at cincuenta millones de colones. A certified copy of this judgment shall serve to register the referenced property for the first time with the Registro de la Propiedad; the petitioner and the State’s representative shall take notice that the only property to be registered is the lot described in the sketch on the referenced plan, and therefore, if possession of any kind is exercised over an area extending beyond the boundaries of the plan sketch, that area shall not form part of this registration.- [Nombre2]. Jairo Jiménez Sandoval, Judge.-” (sic). In essence, the decision rejects the State representative’s objection on the ground that the objection was procedurally defective, and also because the property was established at the beginning of the last century. It adds that, as early as un mil novecientos diez, a structure existed on the petitioner’s land, which, in un mil novecientos sesenta y cuatro, was completely demolished to make way for the current building.
The trial judge thus concludes that the land existed as a real property right (derecho real) of the petitioner before the enactment of the laws that the State representative considers to have been violated.
Disagreeing with that decision, the State representative timely filed an appeal and a concurrent motion for nullity (nulidad concomitante). The grounds asserted by the Procuraduría General de la República are the same as those set forth in its objection dated veintisiete de octubre de dos mil diez. It contends that the plan registered by the petitioner encompasses part of the right-of-way (derecho de vía) of [Dirección6], which is State-owned public-domain property (bien de dominio público estatal), pursuant to Sections 2 and 4 of the Ley de Caminos Públicos and Sections 2, 4, and 5 of the Ley de Construcciones. It challenges the witnesses’ testimony because none of them lived during the colonial period, before the cited laws, and maintains that the construction of the building on the property must be taken into account when applying the legal provision. It refers to opinions issued by the Procuraduría General de la República itself, legal scholarship, and court decisions in support of its assertions.
It requests that the appealed judgment be vacated because the underlying plan encompasses areas within the public road domain (dominio vial). In its appearance before this appellate court by brief dated diez de junio de dos mil veintiuno, the petitioner requests that the appealed judgment be affirmed because the grounds for the challenge are irrelevant, as no violation of law exists.
Because they were not challenged, the list of facts deemed proven and not proven is affirmed.
The State’s representative raises only one grievance, concerning the infringement of public-domain rights (derechos demaniales) over public property, which, in her opinion, has occurred in these proceedings. The grievance is without merit. The State’s representative has made a commendable argumentative effort, but it is insufficient to alter the ruling. Indeed, this Court agrees that the public domain (dominio público) comprises assets that, by the legislature’s express will, are specially designated to serve the community and the public interest. These are known as State-owned assets (bienes dominicales), public-domain assets (bienes demaniales), public property or things, which do not belong individually to private persons, are intended for public use, and are subject to a special legal regime, outside private commerce. These functions, as defined by the constitutional body, result from the necessary statutory designation for public use (afectación), a power reserved to the legislature, and satisfy the following: i. a special purpose-based condition to which the asset, whether public or private, is subject; ii. a dual legal nature, either as assets incorporated into the public domain or as assets subject to the private-property regime, with an imposed social-interest restriction; iii. designation as an instrument demonstrating such designation, which, in the case of public-domain property, marks the beginning of its public-domain status and, in relation to privately owned property, denotes the moment when the public-interest restriction is imposed on private property; and iv. the removal of the assets from private commerce, such that they may not be transformed, attached, sold, or transferred to third parties.
As stated, this designation is not arbitrary; it must necessarily be based on objective parameters, whether from disciplines such as biology, history, architecture, geology, environmental engineering, archaeology, technology, art, etc., in order to determine the asset’s environmental value or the public use to which it could be put. Indeed, Article 121 of the Constitución Política de la República, Articles 10, 261, and 262 of the Código Civil, and section 2 of the Ley de Tránsito por Vías Públicas Terrestres y Seguridad Vial, in the case of roads, establish that property intended for a service of general utility constitutes public property. However, as stated above, the restriction cannot be arbitrary and must be imposed by law, which leads us to analyze the temporal application of the rule. The non-retroactivity of the law (irretroactividad de la ley) has a constitutional basis, as Article 34 of the Constitución Política provides: “No law shall be given retroactive effect to the detriment of any person or of that person’s acquired property rights or vested legal situations.” Under this fundamental principle, legal rules may not be applied retroactively when doing so would prejudice a person’s “acquired property rights” or “vested legal situations.” The principle of non-retroactivity serves the purpose of legal certainty and security and respect for acquired rights and beneficial legal situations, with the consequence that rules of transitional law must be interpreted restrictively and, therefore, statutory terms must not be extended to situations contrary to those principles.
On this matter, the Sala Constitucional de la Corte Suprema de Justicia held: “...c) Acquired property rights and vested legal situations. Numerous rulings of the Sala Constitucional attest to the validity and importance of the guarantee of the non-retroactivity of the law (where ‘law’ must be understood in its generic sense, as referring to legal rules in general: judgment no. 473-94). For example, ruling no. 1879-94 at 17:30 hrs on 20 de abril de 1994 (reiterating what had previously been held in judgment no. 1147-90 at 16:00 hrs on 21 de setiembre de 1990) stated: / ‘... the principle of non-retroactivity, like the other principles relating to fundamental rights or freedoms, is not merely formal but also, and above all, substantive, such that it is violated not only when a new rule or the amendment of a prior rule unlawfully alters rights acquired or situations vested under that prior rule, but also when the effects, interpretation, or application of the latter cause unreasonable or disproportionate harm to the holder of the right or situation that the rule itself recognizes.’ / Likewise, judgment no. 1119-90 at 14:00 hrs on 18 de setiembre de 1990 held: / ‘A legal situation may become vested—as the Corte Plena has previously stated—through a judicial judgment declaring or recognizing a disputed right, and also under a statutory rule that establishes or guarantees particular consequences that a subsequent law cannot disregard without becoming unconstitutional for violation of Article 34 of the Constitución.’ / The concepts of ‘acquired right’ and ‘vested legal situation’ are closely related in constitutional doctrine.
It may be said that, in general terms, the former denotes a consummated circumstance in which something—tangible or intangible, whether an asset previously belonging to another or a right that previously did not exist—has entered into or affected a person’s patrimonial sphere, such that the person experiences a demonstrable advantage or benefit. A ‘vested legal situation,’ in turn, represents not so much an increase in assets as a state of affairs whose legal characteristics and effects are fully defined, even if those effects have not yet ended. What is relevant concerning a vested legal situation is not precisely whether those effects continue, but rather that—by virtue of a statutory mandate or a judgment so declaring—a clear and defined rule has already come into legal existence, connecting a factual predicate (conditioning event) with a particular consequence (conditioned effect). From this perspective, the person’s situation is expressed by a logical proposition of the form ‘if..., then...’; that is, if the conditioning event has occurred, then the ‘vested legal situation’ necessarily entails that the conditioned effect must also occur.
In both cases (an acquired right or a vested legal situation), the legal system protects—by rendering it inviolable—the situation of the person who obtained the right or enjoys the situation, for reasons of equity and legal certainty. In this case, the constitutional guarantee of the non-retroactivity of the law translates into the certainty that a change in the legal system cannot have the consequence of removing an already acquired asset or right from the person’s estate, or of causing the beneficial consequence expected by the interested party from the vested legal situation to fail to arise where the factual predicate occurred before the statutory amendment. Now, specifically with regard to the latter, it has also been understood that no one has a ‘right to the immutability of the legal system,’ that is, a right to have the rules never change. Accordingly, the constitutional provision does not mean that, once the rule connecting the event to the effect has come into legal existence, it cannot be amended or even repealed by a subsequent rule; rather, it means that—as explained—if the conditioning event has occurred, a statutory amendment changing or eliminating the rule cannot prevent the conditioned effect expected under the prior rule from arising.
This is so because, as stated, what matters is that the state of affairs enjoyed by the person was already defined in terms of its elements and effects, even if those effects are still occurring or have not yet begun to occur. Thus, the person is entitled to the consequence, not to the rule.’” (boldface does not appear in the original, Sala Constitucional de la Corte Suprema de Justicia, Voto Número 2765 at 15:05 hrs on 20-05-1997). In this specific case, the appellant alleges that no new survey plan (plano) excluding the right-of-way (derecho de vía) was submitted, and that the right-of-way cannot be less than twenty meters because it is [Dirección7] . She relies on Articles 2 and 4 of the Ley General de Caminos Públicos and Articles 2, 4, and 5 of the Ley de Construcciones. The appealed ruling found that the petitioner acquired possession (posesión) of the property on veinticuatro de mayo de dos mil cinco, when the representative of the Arquidiócesis de San José orally transferred to her the possession that the latter had exercised for more than ninety years, quietly, openly, peacefully, and in good faith.
The evidence supporting this conclusion derives from the statement made in the initial application to commence the proceeding, contained in a document electronically added to the record on nueve de noviembre de dos mil dieciséis, as well as the testimony of witnesses [Nombre3] , [Nombre4] and [Nombre5] . The appealed judgment’s reasoning in this respect is that possession of the property predates the effective date of the rule sought to be applied and that, because the possession was so longstanding, the witnesses could not have been present when it began; however, under the standards of logic, experience, and sound human understanding, it was reasonable to presume that an institution such as the Iglesia Católica—and, in this case, its churches—dated from many years before the enactment of the laws that the State’s representative seeks to apply. The appellant does not challenge this reasoning; she merely cites legal scholarship asserting that possessory-title proceedings (proceso de información posesoria) do not directly and indisputably establish ownership.
Notwithstanding the foregoing, as stated above when explaining the temporal application of the rule, in this matter the petitioner held an acquired ownership right in the parcel (fundo) whose registration she obtained in these proceedings. Ownership as a right was complete from its inception; what these proceedings accomplish is to declare it, and they do not have the effect of creating the right, as the appellant appears to understand, because registration in the Property Registry (inscripción registral) is a formal requirement and not a requirement that creates the ownership right. It is true that ownership may be disputed in subsequent proceedings by anyone claiming a superior right, but that is not the case here, because the appellant does not dispute ownership of the property but rather its dimensions in relation to the State’s interests, attributing public-domain status (demanialidad) to the right-of-way.
If the petitioner acquired ownership on veinticuatro de mayo de dos mil cinco, and ninety years earlier the prior owner had already exercised the ownership right over the real property, this means that the elements of ownership, as dominion or control over it, date back to the year un mil novecientos quince. Indeed, it is not possible to conclude with certainty that possession dates back to the colonial period, even though the witnesses so stated, but ownership could be traced to the beginning of the twentieth century, in the year indicated above. Witness [Nombre5] specifically states that she has known the property since her birth, setenta y cinco years ago, and then tells us that new buildings had been constructed more than setenta years ago. Witness [Nombre3], in turn, tells us that he knows the property, that it has belonged to the Iglesia since the colonial period, and that it has been owned by the petitioner since dos mil cinco. The witness tells us that she acquired the property from the diócesis de San José and that the Iglesia has always been its owner.
Finally, the witness [Nombre4] reiterates the foregoing and refers to historical documentation concerning how long the real property has been owned. Articles 2 and 4 of the Ley General de Caminos Públicos provide that all land occupied by existing roads or by roads constructed in the future is owned by the State and that, in the case of streets, their width shall be no less than twenty meters. Similarly, sections 2, 4, and 5 of the Ley de Construcciones provide that any publicly owned and commonly used land designated by an administrative authority for unrestricted travel in accordance with planning laws and regulations constitutes a public thoroughfare (vía pública), and that such land is inalienable and not subject to acquisitive prescription (inalienable e imprescriptible). Finally, Article 2 of the Ley de Tránsito por Vías Públicas Terrestres y Seguridad Vial defines a right-of-way (derecho de vía) as the right encumbering a strip of land within the public domain that is designated for the construction of roadway works for vehicular or pedestrian travel, or for other works related to safety, beautification, road naming, informational signs concerning services, activities, and tourist destinations, as well as for the installation of public transportation stops or bus shelters.
Given that the establishment of the restriction (constitución de la limitación) takes effect upon enactment of the law, and that ownership predates the effective date of the restrictions that the State’s representative seeks to apply, the relief requested cannot be granted because these portions of the land acquired public-domain status (demanialidad) only after the applicant’s right had been established.
VII.In addition to the foregoing, even if the appellant were deemed correct in asserting that the applicant’s property is subject to the aforementioned rules, the right-of-way (derecho de vía) constitutes a legal encumbrance (gravamen legal) pursuant to subsection a) of Article 19 of the Law on Possessory Information (Ley de Informaciones Posesorias). It provides that “...Properties registered under this law shall remain subject to the following reservations, without the need to state them in the ruling: / a) If the property is landlocked or fronts public roads less than twenty meters wide, it shall be subject to the reservations set forth in the General Law on Public Roads (Ley General de Caminos Públicos); / (By Resolution N° 16629 of 28 de noviembre de 2012, the Constitutional Chamber (Sala Constitucional) established that the preceding subsection is constitutional provided that it is interpreted to mean that the absence of compensation refers solely to the value of the strip or portion of land reserved by the State by virtue of its original public ownership.)….” When this is considered in conjunction with Article 301 of the Civil Code (Código Civil), the survey (mensura) of land, whether challenged or not, is not by itself sufficient to prove possession (posesión) of that land; accordingly, under these provisions, there was likewise no obstacle to approving the registration.
In view of the foregoing, no harm has been caused, nor has the normal course of the proceeding been violated. Without further consideration, the concurrently asserted invalidity (invalidez concomitante) is denied, and the challenged ruling is affirmed as to the matters under appeal.
POR TANTO
The concurrently alleged NULLITY (NULIDAD) is denied. As to the matters appealed, the judgment under appeal is AFFIRMED.

Participa EL ESTADO, representado por la PROCURADURIA GENERAL DE LA REPUBLICA, en su Procuradora General Adjunta, Magda Inés Rojas Chaves, mayor, casada, abogada, vecina de Heredia, cédula de identidad número CED8. Además se cuenta con los Licenciados José Enrique Brenes Montero y Daniela Vargas Delgado en su condición de apoderado especial judicial de la promovente el primero y abogada directora de la Procuraduría General de la República la segunda.
En virtud del recurso de apelación interpuesto por la Procuraduría General de la República, conoce este Tribunal, de la sentencia de las veintidós horas cuarenta y seis minutos del diecinueve de abril de dos mil veintiuno.
Redacta el Juez Echegaray Rodríguez; y,
CONSIDERANDO
La parte promovente interpuso las presentes diligencias de información posesoria para inscribir a su nombre en el Registro Público de la Propiedad la finca que describe así: Terreno de Templo con Atrio, Pasillo y Casa Cural, situado en el [Dirección1] , , de la Provincia de Cartago, que según el plano catastrado adjunto Número C-1943750-2016 posee una extensión de tres mil trescientos veintisiete metros. La Procuraduría General de la República como representante del Estado se opone a la titulación argumentando que en cuanto al rumbo este no se respeta el ancho del camino público, esto según oficio DVOP-DI-DV-PV-2017-1574, y además que cuando se construyó el templo (entre los años 1954 y 1960), se encontraba vigente las leyes 1338 y 1851 disponiendo ambas que el ancho de los caminos públicos es de mínimo veinte metros, lo que contraviene la información que arroja el plano.
Por sentencia de las veintidós horas cuarenta y seis minutos del diecinueve de abril de dos mil veintiuno, el Juzgado Civil de Cartago, dispuso: “POR TANTO: / De conformidad con los artículos 1, 2, 3, 4, 5, 6, 8, 15, 16 y 19 todos de la Ley de Informaciones Posesorias y numerales 853, 856 y 860 todos del Código Civil se aprueban las presentes diligencias de Información Posesoria, con las afectaciones a que se refiere el artículo 17 y 19 de la Ley de informaciones Posesorias y sin perjuicio de terceros de mejor derecho. Se ordena al Señor Registrador del Registro de la Propiedad inscribir, por primera vez, a nombre de TEMPORALIDADES DE LA IGLESIA CATÓLICA DIÓCESIS DE CARTAGO cédula de persona jurídica CED9, la finca descrita en el plano inscrito en el Catastro Nacional bajo el número C-1943750-2016, que se describe así: Terreno de Templo con Atrio, Pasillo y Casa Cural, situado en el [Dirección2] , del Cantón Primero Cartago de la Provincia de Cartago, que según el plano catastrado adjunto N° C-1943750-2016 posee una extensión de tres mil trescientos veintisiete metros cuadrados, y cuyos linderos son al norte con Alquileres Villanueva Sociedad Anónima (identificador predial CED10), con Temporalidades de la Arquidiócesis de San José (identificador predial CED11), y Nopal Sociedad Anónima (identificador predial CED12), al sur con [Dirección3] con frente a ella de ochenta y dos metros con setenta centímetros lineales, al este con [Dirección4] con un frente a ella de cuarenta y ocho metros con setenta y siete centímetros lineales, y al oeste con [Dirección5] con un frente a ella de treinta y cinco metros con noventa y cuatro centímetros lineales.
El inmueble objeto de este proceso se estima en la suma de cincuenta millones de colones. Sirva la certificación de esta sentencia para inscribir en el Registro de la Propiedad la finca relacionada por primera vez, debiendo tomar nota la promovente y la representación Estatal que lo único que se inscribirá es el lote descrito en el croquis del plano indicado, por lo que si se ejerce posesión de cualquier tipo sobre un área que extralimita el croquis del plano, eso no formará parte de esta inscripción.- [Nombre2]. Jairo Jiménez Sandoval Juez.-” (sic). En lo medular la resolución dispone rechazar la oposición del representante del Estado, al considerar informal la oposición, y además por cuanto la finca se constituyó a principios del siglo pasado, agrega que ya para el año un mil novecientos diez existía una construcción dentro del terreno de la promovente el cual para el año un mil novecientos sesenta y cuatro fue destruido completamente para dar lugar a la edificación actual.
Así concluye la persona juzgadora de primera instancia que el terreno existe como derecho real de la promovente con anterioridad a la promulgación de las leyes que considera infringidas la representante del Estado.
En desacuerdo con dicha resolución la representante del Estado interpone en tiempo recurso de apelación y nulidad concomitante. El fundamento de la Procuraduría General de la República es el mismo otorgado en su alegato de oposición de fecha veintisiete de octubre de dos mil diez. Estima que el plano inscrito por la promovente comprende parte del derecho de vía de la [Dirección6] , bien de dominio público estatal, conforme a los numerales 2 y 4 de la Ley de Caminos Públicos y 2, 4 y 5 de la Ley de Construcciones. Desacredita la declaración de los testigos por cuanto ninguno de ellos vivió en tiempo de la colonia, con anterioridad a las leyes citadas, y que debe tomarse en cuenta la construcción de la edificación dentro de la propiedad para la aplicación de la norma legal. Hace referencia a dictámenes emitidos por ella misma, doctrina y resoluciones de los tribunales para fundamentar su dicho. Solicita se anule la sentencia recurrida en virtud que el plano base comprende áreas de dominio vial. En su apersonamiento a esta instancia por memorial de fecha diez de junio de dos mil veintiuno, la promovente solicita que siendo los argumentos de impugnación irrelevantes por no existir quebranto de ley se confirme la sentencia recurrida.
Por no ser objeto de impugnación, se confirma el elenco de hechos tenidos por acreditados y no acreditados.
El único agravio de la representación estatal es respecto a la transgresión de los derecho demaniales, sobre bienes públicos que en su opinión ha ocurrido con las presentes diligencias. El agravio no es de recibo. Loable el esfuerzo argumentativo del representante del Estado, pero insuficiente para variar lo resuelto. En efecto concuerda este Tribunal que el dominio público se encuentra integrado por bienes que manifiestan, por voluntad expresa del legislador, un destino especial de servir a la comunidad, al interés público. Son los llamados bienes dominicales, bienes demaniales, bienes o cosas públicas o bienes públicos, que no pertenecen individualmente a los particulares y que están destinados a un uso público y sometidos a un régimen especial, fuera del comercio de los hombres. Estas funciones definidas por el órgano constitucional, son producto de la necesaria afectación vía ley, reservado así al legislador, cumpliendo lo siguiente: i. un especial condicionamiento finalista al que está sujeto dicho bien, ya sea público o privado; ii. una naturaleza jurídica dual, ya sea de bienes incorporados al demanio público, o de bienes adscritos al régimen de la propiedad privada, con limitación de interés social impuesta; iii. una afectación como instrumento para evidenciar la afectación, en el caso del bien demanial, demarca el inicio de esa demanialidad y, en relación con los bienes particulares, denota el momento en que se impone la limitación de interés público a la propiedad privada; y, iv. la extracción de los bienes del comercio de los hombres, no pudiendo ser transformados, embargados, vendidos ni traspasados a terceros.
Esta afectación no es arbitraria, como se indicó, necesariamente debe contar con con parámetros objetivos, ya sean disciplinas como la biología, historia, arquitectura, geología, ingeniería ambiental, arqueología, tecnología, arte, etc.; para determinar el valor ambiental del bien o el uso público que se le podría dar. En efecto la Constitución Política de la República en su artículo 121, así como el Código Civil en sus artículos 10, 261 y 262 del Código Civil, lo mismo que el numeral 2 de la Ley de Tránsito por Vías Públicas Terrestres y Seguridad Vial, para el caso de caminos, establecen que son cosas públicas los bienes destinados al servicio de utilidad general. Ahora bien, como se indicó líneas atrás la limitación no puede ser arbitraría y debe ser legalmente impuesta, lo que nos lleva al análisis del aplicación de la norma en el tiempo. La irretroactividad de la ley, tiene base constitucional, al establecer el artículo 34 de la Constitución Política que “A ninguna ley se le dará efecto retroactivo en perjuicio de una persona, o de sus derechos patrimoniales adquiridos o de situaciones jurídicas consolidadas.”.
Según este principio de carácter fundamental, no se permite la aplicación retroactiva de las normas jurídicas, cuando con ella, se perjudique los “derechos patrimoniales adquiridos” de una persona o “situaciones jurídicas consolidadas”. El principio de irretroactividad cumple el objetivo de certeza y seguridad jurídica y el respeto de los derechos adquiridos y a las situaciones jurídicas beneficiosas, con la consecuencia que la interpretación de las normas de derecho transitorio ha de realizarse en sentido restrictivo y, por tanto, sin extender los términos legales a situaciones contrarias a aquellos principios. Sobre el tema la Sala Constitucional de la Corte Suprema de Justicia dispuso: “...c) Derechos patrimoniales adquiridos y situaciones jurídicas consolidadas. Numerosos pronunciamientos de la Sala Constitucional atestiguan sobre la vigencia e importancia de la garantía de la irretroactividad de la ley (donde "ley" debe entenderse en su sentido genérico, como referido a las normas jurídicas en general: sentencia nº 473-94).
Por ejemplo, en resolución nº 1879-94 de las 17:30 hrs del 20 de abril de 1994 (reiterando lo que previamente se había dispuesto en sentencia nº 1147-90 de las 16:00 hrs del 21 de setiembre de 1990), se expresó: / "... el principio de irretroactividad, al igual que los demás relativos a los derechos o libertades fundamentales, no es tan solo formal, sino también y sobre todo material, de modo que resulta violado, no solo cuando una nueva norma o la reforma de una anterior altera ilegítimamente derechos adquiridos o situaciones consolidadas al amparo de la dicha norma anterior, sino también cuando los efectos, la interpretación o la aplicación de esta última produce un perjuicio irrazonable o desproporcionado al titular del derecho o situación que ella misma consagra." / Del mismo modo, la sentencia nº 1119-90 de las 14:00 hrs del 18 de setiembre de 1990 sostuvo: / "Una situación jurídica puede consolidarse –lo ha dicho antes la Corte Plena– con una sentencia judicial que declare o reconozca un derecho controvertido, y también al amparo de una norma de ley que establezca o garantice determinadas consecuencias que una ley posterior no puede desconocer sin incurrir en vicio de inconstitucionalidad por infracción del artículo 34 de la Constitución." / Los conceptos de "derecho adquirido" y "situación jurídica consolidada" aparecen estrechamente relacionados en la doctrina constitucionalista.
Es dable afirmar que, en términos generales, el primero denota a aquella circunstancia consumada en la que una cosa –material o inmaterial, trátese de un bien previamente ajeno o de un derecho antes inexistente– ha ingresado en (o incidido sobre) la esfera patrimonial de la persona, de manera que ésta experimenta una ventaja o beneficio constatable. Por su parte, la "situación jurídica consolidada" representa no tanto un plus patrimonial, sino un estado de cosas definido plenamente en cuanto a sus características jurídicas y a sus efectos, aun cuando éstos no se hayan extinguido aún. Lo relevante en cuanto a la situación jurídica consolidada, precisamente, no es que esos efectos todavía perduren o no, sino que –por virtud de mandato legal o de una sentencia que así lo haya declarado– haya surgido ya a la vida jurídica una regla, clara y definida, que conecta a un presupuesto fáctico (hecho condicionante) con una consecuencia dada (efecto condicionado).
Desde esta óptica, la situación de la persona viene dada por una proposición lógica del tipo «si..., entonces...»; vale decir: si se ha dado el hecho condicionante, entonces la "situación jurídica consolidada" implica que, necesariamente, deberá darse también el efecto condicionado. En ambos casos (derecho adquirido o situación jurídica consolidada), el ordenamiento protege –tornándola intangible– la situación de quien obtuvo el derecho o disfruta de la situación, por razones de equidad y de certeza jurídica. En este caso, la garantía constitucional de la irretroactividad de la ley se traduce en la certidumbre de que un cambio en el ordenamiento no puede tener la consecuencia de sustraer el bien o el derecho ya adquirido del patrimonio de la persona, o de provocar que si se había dado el presupuesto fáctico con anterioridad a la reforma legal, ya no surja la consecuencia (provechosa, se entiende) que el interesado esperaba de la situación jurídica consolidada.
Ahora bien, específicamente en punto a ésta última, se ha entendido también que nadie tiene un "derecho a la inmutabilidad del ordenamiento", es decir, a que las reglas nunca cambien. Por eso, el precepto constitucional no consiste en que, una vez nacida a la vida jurídica, la regla que conecta el hecho con el efecto no pueda ser modificada o incluso suprimida por una norma posterior; lo que significa es que –como se explicó– si se ha producido el supuesto condicionante, una reforma legal que cambie o elimine la regla no podrá tener la virtud de impedir que surja el efecto condicionado que se esperaba bajo el imperio de la norma anterior. Esto es así porque, se dijo, lo relevante es que el estado de cosas de que gozaba la persona ya estaba definido en cuanto a sus elementos y a sus efectos, aunque éstos todavía se estén produciendo o, incluso, no hayan comenzado a producirse. De este modo, a lo que la persona tiene derecho es a la consecuencia, no a la regla.” (las negritas no forman parte del original, Sala Constitucional de la Corte Suprema de Justicia, Voto Número 2765 de las 15:05 hrs del 20-05-1997).
En el caso concreto acusa la recurrente que no se aportó nuevo plano donde se excluya el derecho de vía, sin que pueda ser menor de veinte metros por ser [Dirección7] . Se apoya en el artículo 2 y 4 de la Ley General de Caminos Públicos y 2, 4 y 5 de la Ley de Construcciones. En la resolución recurrida se tuvo por acreditado que la promovente adquirió la posesión del bien desde el veinticuatro de mayo de dos mil cinco y cuando el representante de la Arquidiócesis de San José le cedió de manera oral la posesión que esta había ejercido por más de noventa años, de forma quieta, pública, pacífica y de buena, los elementos de convicción para arribar a esta conclusión provienen de la declaración hecha en la solicitud inicial de apertura de procedimiento, en documento agregado electrónicamente a los autos en fecha nueve de noviembre de dos mil dieciséis, así como las declaraciones de los testigos [Nombre3] , [Nombre4] y [Nombre5] .
La fundamentación de la sentencia recurrida a este respecto es que la posesión de la propiedad es anterior a la vigencia de la norma que se pretende aplicar, y que por la posesión tan antigua no pudieron estar presentes los testigos desde el inicio de la misma, pero que bajo criterio de lógica, experiencia y correcto entendimiento humano era lógico suponer que una institución como la Iglesia Católica y en este caso sus templos datan de mucho años antes de la promulgación de las leyes que pretende aplicar la representante del Estado. La apelante no ataca este razonamiento, se limita a hacer cita de doctrina sosteniendo que el proceso de información posesoria no comprueba de forma directa e indiscutible la propiedad. No obstante lo anterior, como se indicó líneas atrás, al explicar la aplicación de la norma en el tiempo, en el presente asunto la promovente mantenía un derecho adquirido de propiedad sobre el fundo cuya inscripción realizó en el presente asunto, la propiedad como derecho era perfecta desde su inició, lo que se realiza mediante el presente proceso es declararlo, no tiene efectos constitutivos del derecho, como parece entenderlo la apelante, pues la inscripción registral es un requisito formal y no de constitución del derecho de propiedad, es cierto es posible su discusión en un proceso posterior por quien alegue mejor derecho, pero este no es el caso, pues la apelante no objeta la propiedad del bien sino sus dimensiones respecto de los intereses del Estado, achacando demanialidad del derecho de vía.
Si la promovente adquirió la propiedad en fecha veinticuatro de mayo de dos mil cinco, y ya noventa años antes su anterior propietario había ejercido el derecho de propiedad sobre el inmueble, esto quiere decir que los elementos de la propiedad como dominio o señorío sobre la misma se remonta al año un mil novecientos quince, en efecto no es posible concluir a ciencia cierta que la posesión derive desde la colonia aunque los testigos así lo hayan indicado, pero la propiedad sí podría rastrearse hasta los inicios del siglo veinte en el año antes indicado. Incluso la declarante [Nombre5] , concreta que conoce el inmueble desde su nacimiento, hace setenta y cinco años, luego nos indica que hacía más de setenta años que se habían hecho nuevas edificaciones. Por su parte el testigo [Nombre3] nos indica que conoce el inmueble, que desde la colonia es de la Iglesia, y que desde dos mil cinco es propiedad de la promovente, el declarante nos indica que ésta adquirió el inmueble de la diócesis de San José y que la Iglesia siempre ha sido la propietaria.
Finalmente el testigo [Nombre4] , reitera lo anterior, hace alusión a documentación histórica respecto a la antigüedad de la propiedad del inmueble. De esta forma no podría aplicarse retroactivamente la Ley General de Caminos Públicos, Ley Número 5060 del veintidós de agosto de un mil novecientos setenta y dos (http://www.pgrweb.go.cr/scij/Busqueda/Normativa/Normas/nrm_texto_completo.aspx?param1=NRTC&nValor1=1&nValor2=38653&nValor3=40757&strTipM=TC, accesada a la fecha de esta resolución), tampoco la Ley de Construcciones, Ley Número 833 del dos de noviembre de un mil novecientos cuarenta y nueve (http://www.pgrweb.go.cr/scij/Busqueda/Normativa/Normas/nrm_texto_completo.aspx?param1=NRTC&nValor1=1&nValor2=36307&nValor3=38272&strTipM=TC, accesada a la fecha de esta resolución) o, la Ley de Tránsito por Vías Públicas Terrestres y Seguridad Vial, Ley Número 9078 de cuatro de octubre de dos mil doce (http://www.pgrweb.go.cr/scij/Busqueda/Normativa/Normas/nrm_texto_completo.aspx?param1=NRTC&nValor1=1&nValor2=73504&nValor3=90232&strTipM=TC, accesada a la fecha de esta resolución), pues la propiedad del bien es anterior a estas normas.
Los artículos 2 y 4 de la Ley General de Caminos Públicos dispone que son propiedad del Estado todos los terrenos ocupados por carreteras existentes o que se construyan en el futuro, y en el caso de las calles su ancho no será menos a veinte metros, en el mismo sentido los numerales 2, 4 y 5 de la Ley de Construcciones, que será vía pública todo terreno de dominio público y de uso común, que por disposición de la autoridad administrativa se destinare al libre tránsito de conformidad con las leyes y reglamentos de planificación, siendo estas inalienables e imprescriptibles, finalmente el artículo 2 de la Ley de Tránsito por Vías Públicas Terrestres y Seguridad Vial define el derecho de vía como el derecho que recae sobre una franja de terreno de naturaleza demanial y que se destina a la construcción de obras viales para la circulación de vehículos o el tránsito de personas o de otras obras relacionadas con la seguridad, el ornato, la nomenclatura vial, el anuncio informativo de servicios, las actividades y los destinos turísticos, así como para la instalación de paradas de vehículos de transporte público o parabuses.
Si tenemos que la constitución de la limitación rige a partir de la promulgación de la ley, siendo que la propiedad es anterior a la vigencia cuyas limitaciones pretende aplicar la representante del Estado no es posible acceder a lo peticionado, dado que el inicio de la demanialidad de estas porciones dentro de los terrenos es posterior a la constitución del derecho del petente.
VII.Aunado a lo anterior, incluso si se considerara que lleva razón la parte apelante que el bien de la promovente esta afectado a las normas antes indicadas, el derecho de vía constituye un gravamen legal al tenor del inciso a) del artículo 19 de la Ley de Informaciones Posesorias. Según este se dispone que “...Las fincas inscritas por medio de esta ley quedarán afectadas por las siguientes reservas, sin que haya necesidad de indicarlas en la resolución: / a) Si el fundo es enclavado o tiene frentes a caminos públicos, con ancho inferior a veinte metros, estará afecto a las reservas que indica la Ley General de Caminos Públicos; / (La Sala Constitucional mediante resolución N° 16629 del 28 de noviembre de 2012, estableció que el inciso anterior es constitucional siempre y cuando se interprete que la no indemnización se refiere, únicamente, al valor de la franja o porción del terreno que el Estado se reserva, en razón de su dominio público originario.)…”, si esto se relaciona con el artículo 301 del Código Civil, la mensura de un terreno, sea o no protestada, no basta por sí sola para probar la posesión del mismo terreno, así conforme a estos numerales no existía obstáculo tampoco para aprobar la inscripción.
Por lo expuesto, no se causa perjuicio ni se ha violado el curso norma del procedimiento. Sin más consideraciones, se desestima la invalidez concomitante y se confirma la resolución impugnada, en lo que es objeto de alzada.
POR TANTO
Se desestima la NULIDAD alegada de forma concomitante. En lo apelado se CONFIRMA la sentencia apelada.
