Appeal in the special expropriation proceeding brought by the JUNTA ADMINISTRATIVA DEL SERVICIO ELÉCTRICO DE CARTAGO (JASEC) against CASCADAS DEL TORO S.A.

BACKGROUND FIRST: By judgment number 1264 - 2020, issued at fifteen hours and sixteen minutes on the twenty-fourth day of June of the year two thousand twenty, the Juzgado de lo Contencioso Administrativo y Civil de Hacienda ruled, insofar as relevant: “The total compensation (indemnización) that the Junta Administrativa del Servicio Eléctrico de Cartago must pay to CASCADAS DEL TORO S.A. for the expropriation of a 40.000 m2 parcel from the property registered in the Province of Alajuela Land Registry, Real Folio Registration No. Placa33525, located at Dirección19432, Province of Alajuela, which is essential for the construction of two tunnel headings for the Toro III Hydroelectric Project, is hereby set at SIXTY-EIGHT MILLION SIX HUNDRED FORTY THOUSAND EIGHT HUNDRED TWENTY-THREE COLONES (@68.640.823.00). Its nature is pastureland and primary forests with trails—3 lahuinas (Sic)—and a reforestation area, green areas, and gardens with 4 houses and 2 cabins, with internal gravel and cement roads; boundaries: north:

Cascadas del Toro S.A. Nombre9574 expropriated Nombre9574; south: Cascadas del Toro S.A., Florcita stream; east: Cascadas del Toro S.A., Río Toro Amarri//o (Sic), Nombre9574 expropriated ICE; west: Flor stream, public road, Cascadas del Toro S.A., Nombre9574 expropriated from ICE; area: as of the issuance of this judgment, 823.831.54 m2; cadastral plan (plano catastro) A -1105428-2006 applies to it, according to information from the Registro Nacional. The stated amount is itemized as follows: FIFTY MILLION SIX HUNDRED THOUSAND COLONES (@50.600.000.00) for the value of the expropriated land and EIGHTEEN MILLION FORTY THOUSAND EIGHT HUNDRED TWENTY-THREE COLONES (418.040.823,00) for damage to the remainder (daño al remanente). The parcel to be segregated (lote a segregar) is described as follows: Nature: pastureland, located in District 5 Venecia, Canton:10 San Carlos, Province of Alajuela; its boundaries are: North: reserved remainder of Cascadas del Toro SA; South: reserved remainder of Cascadas del Toro S.A; East: reserved remainder of Cascadas del Toro SA; and West: public road.

Its area is FORTY THOUSAND SQUARE METERS; cadastral plan A-1198283-2007 applies to it; it is located in the western section of the parent property (finca madre), represents 4,82% of the total area of said property, and has 84,69 meters of frontage on a public road. The parcel is irregularly shaped, has rolling topography, and is entirely covered by natural pasture; a stream known as la Hor crosses its center in a southwest-northeast direction. The remainder is described as follows: Nature: pastureland and primary forests with trails, three /ahuinas (Sic), and a reforestation area, green areas, and gardens with four houses and two cabins, with internal gravel and cement roads; located in District 5 Venecia, Canton: 10 San Carlos, Province of A/ajue/a; its boundaries are: North: Cascadas del Toro SA and the expropriated parcel; South: Cascadas del Toro S.A, Quebrada Florcita and the expropriated parcel; East: Cascadas del Toro S.A., Río Toro Amarillo and the expropriated parcel; and West: Quebrada Hor, public road, and the expropriated parcel.

Its area is 783.831.54 m2. The expropriated land shall be devoted to the stated public purpose. Once this judgment becomes final, the expropriating public enterprise is authorized to notarize the relevant portions of the record (protocolización de piezas), and consequently the Registro Público de la Propiedad Inmueble shall register the property in the name of the Junta Administrativa del Servicio Eléctrico de Cartago, free of encumbrances, restrictions, and notices, without prejudice to the notices and encumbrances that shall continue to burden the parent property. The Registro Nacional is required to cancel all notices, charges, and encumbrances, if any, prior to registration and on the basis of the deed notarizing the relevant portions of the record, without the need for any other procedure. The Junta Administrativa del Servicio Eléctrico de Cartago is ordered to pay interest on the difference between the administrative appraisal (avalúo administrativo) and the fair compensation (justiprecio), in accordance with section 11 of the Ley de Expropiaciones, from the date possession was granted until the aforementioned difference is actually deposited.

The Junta Administrativa del Servicio Eléctrico de Cartago is ordered to pay the attorney’s fees and procedural costs of these proceedings. Once this judgment becomes final, notice shall be provided to the Dirección Genera/ de Tributación and the Municipalidad de San Carlos for the calculation of national and municipal taxes in accordance with the law.” (see digital case file).

SECOND: By a filing submitted in due time and proper form, the representative of the expropriated party filed an appeal (see electronic case file).

THIRD: By virtue of this Court’s ruling issued at sixteen hours on the nineteenth day of August, two thousand twenty, the appeal was admitted (see electronic case file).

FOURTH: The hearing for the presentation of grounds for appeal was held at fourteen hours on the eighth day of February, two thousand twenty-one, at which time issuance of the judgment was deferred so that it could be rendered in writing (see electronic case file).

This judgment is rendered following deliberation and by unanimous decision.

GROUNDS

  1. 1REGARDING THE UNPROVEN FACTS: The account of proven and unproven facts in the appealed ruling is affirmed.

II. GROUNDS FOR APPEAL

The appellant set forth three central grounds for the appeal, namely:

  • 1)Unit value per M 2. In setting the fair compensation, the judge adopted the appraisal of the third tie-breaking expert (perito tercero en discordia), Nombre164194. , who determined a unit value of Cl.265 M 2; however, that expert opinion uses an incorrect unit value as its fourth reference, such that, if the incorrect value were replaced by the proper one, the amount payable per square meter would be 0.112.50 M 2, as shown in the “Appraisal Review Report” submitted by Lic. Gerardo Hidalgo and offered as evidence to assist in adjudication (prueba para mejor resolver).
  • 2)Damage to the remainder: In compensating for damage to the remainder, the judge rejected the three appraisals entered into the record by the valuation experts and chose to devise her own formula to establish an amount far lower than the amount established under this same category thirteen years earlier by Nombre9574 Administrative Appraisal 412-2007. The legal maxim that appraisals, rather than expert reports, establish the limits within which a judge must rule applies not only to the appraisals’ overall totals but also to the various categories comprising them and determining their results, particularly when dealing with a matter as specific and complex as estimating damage to the remainder in a partial expropriation. If the adjudicator does not interpret it in this manner, the judgment becomes arbitrary and lacks technical and factual support, as occurred in this case.
  • 3)Forestry and environmental damage (daño forestal y ambiental). The trial judge refused to award any sum for the forestry and environmental damage sustained by Reserva Natural Cascadas del Toro as a result of the expropriation ordered against it by JASEC; in doing so, she relied on a “study” conducted by Nombre9574 technicians in June 2017, seven years after possession of the expropriated land had been granted to Alianza ICE-JASEC and four years after the intake facility for P.H Toro 3, the project that prompted the expropriation, had been fully constructed and was operational. In other words, in this respect the judge disregarded the judicial inspection record (acta de reconocimiento judicial) of June 2010, a topographic survey conducted by Nombre9574 technicians in March 2010 to determine specifically the environmental impacts of PH Toro 3 on the Cascadas del Toro S.A property, and a forest inventory prepared by MINAE in 2011 during the processing of a tree-felling permit—all documentary evidence consistently recognizing the abundance of trees in the area at the time of the expropriation. Instead, she adopted an official report from the expropriating authority that was unlawfully characterized as an “addendum to the administrative appraisal” in August 2017, long after the trees to be inventoried and compensated had been cut down (a direct violation of the constitutional guarantee of prior compensation and Article 24 of the Ley de Expropiaciones). This occurred after Alianza ICE-JASEC had, for six years beginning in February 2011, disobeyed the Juzgado Contencioso’s numerous and repeated requests that it provide the required information regarding the forestry and environmental damage caused to Cascadas del Toro. Likewise, the appealed judgment disregards the fact that Nombre14912 acquiesced in the valuation that expert Nombre161016 conducted on this issue in October 2017 by order of the trial court, determining forestry and environmental damage in the amount of C 39.935.537,30 million. The appellant states that the expropriating authority acquiesced in this appraisal because, at an initial hearing, it confined itself to challenging the fees claimed by the expert without objecting to a single line of his report and, at a second hearing prompted by a supplemental expert opinion, refrained entirely from responding.
  1. 111REGARDING THE GROUNDS OF THE APPEALED JUDGMENT. Judgment number 1264 - 2020, issued at fifteen hours and sixteen minutes on the twenty-fourth day of June of the year two thousand twenty by the Juzgado de lo Contencioso Administrativo y Civil de Hacienda, sets forth the following grounds:

“VI.- EXPERT APPRAISALS (PERITAJES) SUBMITTED: To determine the just price of the expropriation that is the subject of these proceedings, we have the Administrative Appraisal (Avalúo Administrativo), two reports by court-appointed experts (peritos judiciales), evidence obtained to assist the court in reaching a decision, and the parties’ statements and positions. We proceed to analyze each of the expert appraisals. ADMINISTRATIVE APPRAISAL 412-2007: This was prepared on 10 de agosto de 2007, establishing the value of the land at @12.200.000.00 and the damage to the remainder (daño al remanente) at @11.922.292.00, for a total of @24.122.292.00. It explains the purpose of the appraisal, a general description of the project, a description of the area, and a description of the property, located at Dirección19663, in the Province of Alajuela, 2,2 km south and 0,3 km northeast of the community of Paraíso de Marsella.

The property has 618,97 m of frontage on the public road. The property has an area of 828.982.54 m2, according to cadastral plan A-1105428-2006. Two streams cross the land, their waters flowing in a southwest–northeast direction, and at its eastern end it borders the Río Toro, whose bank is steep. The property has mixed use; toward the west and center, there are several structures intended for recreational use, a pond area, livestock areas, and different types of pasture, while the property’s steepest areas are covered by forest. To the southwest, the property borders another property belonging to the same owners; at its western end, the frontage on the public road is abandoned and can be traveled only on foot or by pack animal. It states that native trees from the area are scattered throughout the land and that there is primary forest on the slope along the bank of the Río Toro and in the northern sector, near Quebrada La Flor.

The topography is rolling, with steeper slopes along the banks of the streams and the river; the site to be expropriated is in the west-central area. The average slope is estimated at 40%. The lot to be segregated (lote a segregar) represents 4,82% of the property’s total area, has 84,69% meters of frontage on the public road, is irregularly shaped, and has rolling topography. A stream crosses its center in a southwest–northeast direction. It is entirely covered by natural pasture, has an exact area of 4 ha according to plan A - 1198283-2007, and has scattered trees, primarily along the banks of the stream. A rounded value per hectare of 43.050.000,00 was determined, at 4305 m2. Regarding damage to the remainder, it states that the segregation of the lot is not expected to abruptly alter the property’s customary operations; it will affect the western section of the property, specifically the left side of the internal road.

This section has an area of 182.615.20 072, and damage to the remainder is estimated with respect to this section because it is the area affected by the segregation. Due to its topography and shape, the parent property (finca madre) has extensive areas that will not undergo any abrupt change. Access will be provided by the public road, which will be improved, thereby minimizing the impact on the parent property. It was determined that the affected sector of the property has a value of 43.000.000.00 per hectare, 300 m2; the remainder has an area of 142.615,20 m2, will lose its hydrological condition and one of the sites with the least rugged topography, and will continue to have the services available to the parent property. It was determined that the land has a value of @2.150.000.00 per hectare, 21500 m2, for a total of 430.662.268.00, such that the difference between the before and after values is @11.922.292.00 (i. 283 a 323).

On 27 de junio de 2014, an addendum to the Administrative Appraisal was submitted, stating that the value of the trees is implicitly included in the compensation value because the reference properties have a use similar to that of the section of land to be expropriated (i. 1251). Subsequently, on 7 de julio de 2017, an estimate of compensation for the forest resource (recurso forestal) was submitted, determining that the trees located in the protected area are not compensable because they are not marketable. Outside that area, there are 6 trees that, as of the date possession was granted, did not have a diameter greater than 30 cm, and therefore were not marketable; nor is there evidence that they were planted by the owner, and the owner does not receive Pago de Servicios Ambientales. Accordingly, no compensation is warranted (i. 1555 a 1585). REPORT BY Nombre161016: This was submitted on 21 de Octubre de 2010 and stated that its purpose was to review the Administrative Appraisal.

It explains why it departs from the Administrative Appraisal, stating that its values are entirely outdated; that it failed to consider that the public road would be left without an outlet and that 84.69 meters of the property’s street frontage would be severed; that the reduction in the flow of Quebrada la Flor affects the remainder of the property; that it estimated damage to the remainder over a section of 182.61520 m2 without the signature of the person responsible for the calculations establishing that area; and that it excluded the rest of the property from the calculation of the remainder. The comparison adjustment (homologación) was performed using agricultural properties, but the property is devoted to an agritourism operation; moreover, the appraisal analyzes properties with substantially different areas and uses that information to determine the value per square meter, for which reason the expert departs from it.

It states that the property has mixed topography, including flat areas, steeply sloped land near the Río Toro and Quebrada la Flor, and areas of natural forest. Several streams and springs (nacientes) flow through it, and the property as a whole is devoted to sustainable agritourism development; it has cemented internal roads, cabins and camping areas, mountain trails, and recreational fishing. The area to be segregated itself is land covered with natural pasture, with rolling topography and scattered trees located along the edge of the stream crossing it; the lot is irregularly shaped. The expert conducted a survey of the commercial value of the surrounding area and other comparable properties, summarizing the values in a table (i. 935). The expert states that a 100% degree of impairment should be applied. To determine the price, the expert compiled an inventory of market values and adjusted the land values for comparison, taking into account that the area to be expropriated is 4 hectares and that an ecotourism project covering 155 hectares and 177,33 m2 is being developed over the property’s total area, which consists of a consolidation of properties and a section of unregistered property.

Two remainders are created: the area closest to the area to be expropriated and the rest of the property. The expert sets the property’s value before the project at @2.856.976.819.00 and after the project at 4702,060.846.00. The report attaches plans, certification of ownership, and a certificate concerning the tourism operation conducted by Armotours SA. at the Cascadas del Toro property (i. 916 a 955). The expert clarified that the trees were not addressed because the Administrative Appraisal does not mention them and an inventory of the trees would be required to address that issue. The expert confirms that consideration was given to the property’s loss of access by way of its dirt road and that the loss of privacy and security was analyzed in assigning the value and degree of impairment to the remainder (i.982 a 983). Regarding valuation of the forest resource, the expert departs from the Administration’s criterion and states that this resource must be valued from the standpoint of its economic and environmental impact.

For this purpose, the income-replacement method (método de sustitución de rentas) is applied because the forest resource was destroyed and has no commercial value in itself. The expert estimates annual compensatory payment of 43.993.553.73, initially multiplied by 7 years, the period elapsed since the expert’s visit, for total compensation of @27.954.876.14. The expert subsequently extends the period to 10 years, stating that financial doctrine provides that economic projections must cover a minimum period of 3 years and a maximum of 10 years (i. 1610 a 1618, 1627 a 1630). REPORT BY Nombre164194: Submitted on 26 de marzo de 2015, it states that its purpose is to review the Administrative Appraisal, describes the property and the lot to be segregated, and states that the property is currently used for raising beef cattle and includes an area covered by naturally growing forest. It differs from the Administrative Appraisal because of the time elapsed and the changes in the property’s value and condition.

The expert proceeded to determine the current value and to infer the required value by applying a discount rate (tasa de descuento). The current value of the land was determined through research into listings in the area, consultation with neighbors and persons knowledgeable about the subject, and the expert’s personal judgment; using the comparable properties and the comparison-adjustment method, the expert determined an updated value of @1.265.00 m2. By applying the mathematical equation, the expert determines the value at the time the Administrative Appraisal was performed; as of agosto de 2017, the price is adjusted to “99.92 072. The expert determines damage to the remainder at @27.225.665.94 and the value of the area to be segregated at @27.996.800.00, for total compensation of @55.222.465.94 (i. 1275 a 1280). VII.- POSITION OF THE PARTIES: In a written submission dated 17 diciembre de 2008, the expropriated party filed a motion for reconsideration (recurso de revocatoria) alleging absolute nullity (nulidad absoluta) against the order commencing these proceedings, stating that Nombre14912 never notified them of the declaration of public interest (declaratoria de interés público), and that the court was proceeding on the basis of Ley No. 6313 even though Nombre9574 was not a party to these proceedings.

It asserted that the claimant’s standing (legitimación) to institute the action had not been considered, nor had the legality of the underlying administrative acts been assessed. It alleged that Article 5 of Ley No. 7495 and Article 7 of the Ley de participación de las Cooperativas de Electrificación Rural y de las Empresas de Servicios Públicos Municipales en el Desarrollo Nacional (Ley No 8345) were unconstitutional because they violated Articles 45, 169 and 170 of the Constitución Política. It stated that the administrative act declaring the property to be of public interest was absolutely null because Nombre14912 lacked territorial jurisdiction to act in San Carlos and also lacked subject-matter jurisdiction to order expropriations. As evidence, it attached Dictamen C-188-2005 de la PGR, judgment No. 2008- 014089 de la Sala Constitucional, and publication of the notice in boletín judicial No. 230 in expediente 07-001652-0163-CA.

All these arguments raised against the initial order were resolved by an order issued at thirteen hours and forty-two minutes on dos de febrero de dos mil nueve (i. 652 a 655), in addition to the matters stated in Considerando II. That order was in turn challenged by the expropriated party on 9 de febrero de 2009 (i. 661 a 682). The challenge was resolved by an order issued at fifteen hours and fifteen minutes on 19 de febrero de 2009, which scheduled a judicial inspection (reconocimiento judicial) and transfer of possession (puesta en posesión) (i. 685 a 690). This order was also challenged by the expropriated party on 2 de marzo de 2009 (i. 696 a 704). The challenge was summarily dismissed by the Tribunal de Apelaciones de lo Contencioso Administrativo y Civil de Hacienda (i. 757 a 759). In a motion for reconsideration dated 12 de mayo de 2010, filed against the order setting the date for the inspection and transfer of possession, the expropriated party reiterated its objections that JASFC is not authorized by the legal system to operate the public electricity-generation service outside the Provincia de Cartago.

In that same submission, the expropriated party acknowledged, as the Sala Constitucional had stated, that the Jurisdicción de lo Contencioso Administrativo was responsible for determining in ordinary proceedings whether Nombre14912 has expropriation authority (potestad expropiatoria), whether it may operate in San Carlos, and, consequently, the validity of the agreement.” It reiterates the absolute nullity (nulidad absoluta) of the Agreement and states that “the expropriation proceeding (juicio expropiatorio) is not stayed when the legality of the expropriation is challenged, because it cannot be commenced, nor may the eviction (desalojo) be validly ordered under the same circumstances.” It again alleges the absolute nullity of all actions taken by Nombre14912 and attaches the decision of Sala IV in which the action filed was dismissed, on the terms mentioned above. (i. 833 a 868). This was decided by an order issued at catorce horas y cincuenta y un minutos del treinta y uno de mayo del año dos mil diez (i 870).

On 2 de noviembre de 2012, it filed an incidental motion based on new facts (incidente de hechos nuevos) and absolute nullity, stating that Nombre14912 failed to submit Addendum No. I, which amended the alliance agreement with ICE; the addendum states that the appraisals (avalúos) required updating, and it considers that they had ceased to be effective as a result of that amendment. It attached minutes No. 7 of the Comité de Coordinación de la Alianza ICE-JASEC, addendum No. I to the Plan de Implementación, and copies of official letters 0690-136-2008 and 258-1626-2008 concerning the approval of Addendum No. 1 to the Plan (i. 1164 a 1183). By resolution No. 1851 - 2014 del veintiséis de setiembre de dos mil catorce, the incidental motion based on new facts and the absolute nullity of the proceedings was decided (i. 1263 a 1265). On 22 de agosto de 2016, it filed a motion for reconsideration (recurso de revocatoria) together with a claim of nullity, stating that Nombre164195.

Nombre164194 refused to clarify his expert opinion (pericia), failed to appraise the forest resources (recurso forestal), and was not a forestry engineer, as had been requested. It asked the court to decide the petition filed on 2 de octubre de 2015, seeking to have the expert opinion annulled and a new expert specializing in forestry engineering appointed (i. 1377 a 1383). The foregoing was addressed and decided by an order issued at trece horas cuarenta minutos del veintidós de agosto de dos mil dieciséis (i. 1384 a 1386). That decision was also appealed by the expropriated party before the Tribunal de Apelaciones (i. 1390 a 1393). The appeal and nullity claim were decided by judgment No, 376 - 2016 de las catorce horas treinta minutos del doce de setiembre de dos mil dieciséis del Tribunal de Apelaciones de lo Contencioso Administrativo y Civil de Hacienda (i. 1396 a 1397). On 5 de setiembre de 2017, the party requested the appointment of an expert in forestry and environmental matters to appraise the forest resources on the basis of the MINAE inventory, arguing that it was fraudulent to establish the value of those resources on the basis of an inventory from abril de 2017 (i. 1601 a 1604).

This request was addressed and denied by an order issued at catorce horas y veintidós minutos del doce de setiembre de dos mil diecisiete (i. 1605 a 1606). It follows from the foregoing that the arguments, objections, appeals, incidental motions, nullity claims, and their respective evidence have been duly addressed and decided in a timely manner in the course of these proceedings and by the appropriate judicial bodies. The record even shows that the constitutional challenges (acciones de inconstitucionalidad) alleged by the party were rejected by Sala IV; accordingly, there is no reason to examine repeated arguments further, since the appropriate bodies have already ruled on them. If the expropriated party does not share or fully agree with the decisions issued during the proceedings, that does not entitle it to persist in arguments that have already received a ruling, even if that ruling was not to its liking.

In a filing dated 23 junio de 2010, the expropriated party addressed the hearing granted in connection with the judicial inspection record (acta de reconocimiento judicial), stating that the lot to be expropriated includes the road providing access from the property to the public road and that, given the topographical conditions of that portion of the property, which is crossed by a high-flow stream, it would not be easy to build a new road connecting the property’s two sections. It stated that the road can be traveled on foot or horseback because it is used to drive cattle, but that it provides access to the public road. Once the highway was paved, it ceased to be used as the principal access route, and entry is now through a right-of-way easement (servidumbre de paso). It noted that, downstream from the lot to be subdivided (lote a segregar), the expropriated party has an area of virgin forest containing trails for tourist visits to two waterfalls formed along the stream (i. 886 a 887).

With respect to the first court-ordered appraisal (peritaje judicial), it stated that the expert failed to appraise hundreds of commercially valuable timber species, some 50 or more years old and others 5, 10 and 12 years old, planted by the expropriated party under reforestation programs. It asserted that the oldest and largest-diameter trees are located in the protection zone (zona de protección) of Quebrada Hor and must be compensated, since their exploitation by the expropriating party would constitute unjust enrichment (enriquecimiento sin causa); their scenic and conservation value is greater than their commercial value. Hundreds of younger trees planted for commercial purposes also exist outside the protected areas. It added that a road connecting the property’s two sections would be cut off and rendered unusable by the expropriation, which would also sever a second road running parallel to the stream and affected by the subdivision, forcing the expropriated party to construct a detour to reconnect it to the internal road network.

It stated that the expropriating party’s project would reduce the stream’s flow, thereby diminishing the property’s hydrological capacity and eliminating one of its principal tourist attractions, as well as destroying the privacy and exclusivity that attract tourists to the site. It attached a photograph of a “Fruta Dorada” tree, two photographs of “cebo,” photographs of the internal road, five-year-old cebo trees, another cebo tree, a panoramic view, and a plantation of cebo trees (i. 962 a 977). It contends that implicit valuation (valoración implícita) is prohibited by law and that its property is far superior to any other property in the area (i. 1270 a 1272). With respect to the third tie-breaking expert (tercer perito en discordia), it states that he appraised the land to be expropriated without having entered it. It also states that he used a comparable property that cannot be located in the field and assigned it a price below the price that actually applies (i, 1301 a 1316).

Nor does it agree with the compensation proposed by expert Nombre164196 for the forest resources, since it considers that, because the environmental damage is permanent and irreversible and has a serious impact on the remainder of the property (remanente), it is unjustified and unlawful to limit compensation to the last seven years without projecting it into the future (i. 1623 a 1624). Regarding the first court-ordered appraisal, the plaintiff stated that the expert mistakenly believes that the fair compensation (justiprecio) must exceed market value because this is an expropriation. It considers this incorrect because it would result in lawful enrichment. It stated that the comparable properties used as the basis for the market study must be similar in area to the lot to be subdivided, rather than similar to the property as a whole, an error made by the first court-appointed expert, who used properties ranging from 700 m2 to 115/ha.

It explained that, by weighting the values of commercial comparables similar to the expropriated lot, the expert should have arrived at a value of 44.495,41/m2. It stated that the subdivided lot represents barely 5% of the registered area and 3% when the unregistered area is considered, and is located at the rear of the property, whose only access is a dirt road passable only on foot or by pack animal. For those reasons, the remainder could not be impaired by 70%, as the expert proposes, which resulted in the damage to the remainder exceeding even the value of the property. It also considers it erroneous to conclude that subdividing a very small area located at the rear of the property, where only a portion of it is affected, impairs the entire property, including an unregistered area (i. 1025 a 1030). On 1 de agosto de 2011, Nombre14912 submitted a study of the administrative appraisal (avalúo administrativo) and the first court-appointed expert’s appraisal, addressing the methodology and data used.

It concluded that the administrative appraisal contained errors in the market study and in the standardization process (proceso de homologación), and was outdated. The expert report contains serious errors of form and substance in the standardization process and mistakenly concludes that subdividing a small area located at the rear of the property, where only a portion of it is affected, impairs the entire property, including an unregistered area. It states that the subdivision merely deprives the property as a whole of some frontage along a secondary road in very poor condition, and that the loss of an insignificant hydrological feature does not affect the property as a whole, much less the unregistered area. After updating the values and correcting the errors in the Administrative Appraisal, it estimates total compensation at 452.733.165.85 (lot @23.627.600.00; damage to the remainder 429.105.565,85) (i. 1032 a 1043). On 13 de abril de 2012, Nombre14912 submitted a technical report for a permit to cut trees in protected areas (i. 1065 a 1136). Finally, it agreed with the report of Engineer Nombre164194.

VIII. EVIDENCE TO ASSIST THE COURT’S DECISION (PRUEBA PARA MEJOR RESOLVER)

On 22 de febrero de 2017, the expropriated party submitted decisions of the Tribunal de Apelaciones stating that the administrative appraisal had expired and could not be considered in determining fair compensation, that the compensation price must be determined as close as possible to the date of the judgment, that crops or plantations must be valued independently, and that, if necessary, fair compensation may be determined on the basis of “judicial precedents” (antecedentes judiciales). For that purpose, it submitted Sentencia No. 218 - 2015; a resolution issued at siete horas diecinueve minutos del 27 de noviembre de 2009, in which the Tribunal de Apelaciones set countersecurity (contracautela); a copy of the technical appraisal by Engineer Nombre164197; an opinion of the Procuraduría General de la República stating that damage to the remainder must be estimated in partial expropriations; and a reservation of constitutional challenge (reserva de inconstitucionalidad) concerning the rulings of the Tribunal de Apelaciones recognizing Nombre14912’s standing to order expropriations (i. 1412 a 1508).

As a procedural act, a final judgment (sentencia firme) establishes a legal and factual reality that may be used to prove a fact in subsequent proceedings, for example when res judicata (cosa juzgada) is asserted, when a preliminary issue (prejudicial) is raised, when the judgment is invoked as an enforceable instrument (título ejecutivo), or when its content links it to the mechanism for producing judicial precedents. All these circumstances make sense within the reality described by Nombre164198 when stating that “means of evidence (medios de prueba) are a multifaceted phenomenon whose nature and definition vary according to different historical, cultural, and legal factors. Evidentiary systems have undergone profound changes since Roman times; likewise, different cultural assumptions concerning knowledge, truth, and the function of judicial decisions have strongly influenced conceptions of evidence.

In this context, an additional factor of complexity and differentiation is that many things may be used as sources of evidence. Under the prevailing interpretation of the principle of relevance (principio de relevancia), anything having significance or some usefulness in seeking the truth about the disputed facts may be used—at least in principle—as evidence.” Accordingly, the evidence offered by the party to assist the court’s decision is admitted because it concerns issues similar to those under discussion in these proceedings and could potentially serve as a reference and input for deciding them.

IX- DETERMINATION OF FAIR COMPENSATION (FIJACIÓN DEL JUSTIPRECIO): The expropriation may not generate an undue benefit for either the expropriating Junta or the expropriated party; a balance must be maintained between them.

Pursuant to Article 45 of the Constitución Política and Article 30 of the Ley de Expropiaciones, these judicial proceedings serve to determine the fair price of the property that the expropriating entity must pay to the expropriated party. The purpose is therefore to place the parties in conditions equivalent to those existing before the event occurred, so that, with the price awarded, the dispossessed party may at least obtain compensation for what has been taken from it, thereby preventing the unjust enrichment of either party involved. For that reason, we proceed to determine that price after analyzing the three reports submitted and the remaining arguments and evidence in the record. From the proven facts and the parties’ statements, it follows that it is impossible to adopt the amount established in the administrative appraisal (avalúo administrativo), because that valuation is outdated.

The Administrative Appraisal was prepared on 10 de agosto de 2007, while the filing initiating these proceedings is dated agosto de 2008; it is therefore evident that, with the passage of time, the values established therein have become outdated. This point is also confirmed by both court-appointed experts and by Nombre14912 through the study it conducted of the administrative appraisal and the first court-appointed expert appraisal (i. 1032 a 1043). This circumstance was also analyzed and resolved by the Tribunal de Apelaciones de lo Contencioso Administrativo in Resolution No. 291-2013, in connection with a case very similar to this one, concerning practically the same time periods and the same project. Accordingly, determination of the fair price must necessarily be based on the other expert appraisals received into the record, in order to determine whether the correct price can be derived from them.

Nevertheless, for reference and informational purposes, as well as to identify the criteria used by the Administration when conducting its valuations, the Administrative Appraisal is regarded as an expert appraisal reflecting the circumstances and conditions existing at the time of valuation, and its contents are therefore retained for informational and reference purposes. It is important to specify that the area to be expropriated is 40.000 m2, located at the rear of the property; all reports agree on this point. The property from which the land is to be expropriated has a registered area of 828.982.54 m2 and an unregistered area of 721.124.79 m2, for a total area of 1.550.107.33 072. In other words, the area to be expropriated represents 3% of the total area and 5% of the registered area. Accordingly, this Judge must conduct an exhaustive analysis of the expert appraisals submitted and the evidence entered into the record, with the objective of determining whether they satisfy the basic requirements established in the Ley de Expropiaciones and verifying whether the amount ultimately awarded is fair.

In view of that situation, the analysis will be divided into three subsections: a) Land value; b) Damage to the remainder; and c) Forest resources, as explained below: a) Land value: The first item to be valued in this judgment is the land to be expropriated by JASEC. The Administrative Appraisal of 10 de agosto de 2007 established the unit value of the land at "05.00 m2 (for reference only); the expert Nombre164199, on 21 de Octubre de 2010, determined the unit value to be 41.843.00 m2; and the third, tie-breaking expert (perito en discordia), Nombre164194., on 26 de marzo de 2015, determined the unit value to be 4699.92 m2. The very large difference between the valuations performed by Nombre164199. and Nombre164194., amounting to @1.143.03 colones per m2, is striking. This is primarily because the first court-appointed expert obtained the unit value by standardizing (homologación) two reference properties, one measuring 155 ha and the other 83 ha, according to the standardization table shown in image 943.

Ideally, in such cases, areas closer in size to the land to be expropriated should be used so that the comparison is valid; the areas used by the expert are more than twice the size of the lot to be expropriated. This report lacks an adequate comparison of surrounding prices, and the undersigned does not consider that it produced a uniform value typical of the area. This court-appointed expert stated that, using other appraisals of the same property conducted in the past, he obtained the unit value per square meter of the expropriated property (see image 657). This is not correct, because the applicable legal and technical rules require market values to determine the corresponding value. Using those references, he prepared a standardization table that, on its face, contains technical deficiencies rendering the valuation erroneous. Note that all adjustment or correction factors equal 1, which is equivalent to stating that the properties compared are exactly the same as the property being valued with respect to every characteristic compared (area, topography, shape, excess depth, access, location, Ley Forestal, street level, and marketability).

This is incorrect because, even though the properties form part of the same property, the object of the valuation for expropriation purposes is a 40.000 m2 lot, which in itself distinguishes it from them. Furthermore, the specific characteristics of the lot to be expropriated must be considered because this is a partial rather than a total expropriation, and this lot may have characteristics different from those of the rest of the property. In this regard, based solely on the area factor, reference No. 01, which has an area of 155/ha and is therefore almost four times larger than the severed lot (lote segregado) (see image 663), should have been adjusted. The undersigned considers that the price established by this court-appointed expert cannot be accepted. For his part, in determining the unit value, Nombre164194. physically inspected the area and determined its location, surrounding conditions, land uses (usos del suelo), type of cover, shape, topography, existing services, market offerings in the area for similar properties, information obtained from neighbors and knowledgeable persons, and his own professional judgment.

Using the references obtained, the property’s particular conditions, the size of the area to be expropriated, and the standardization method, he determined the updated value to be @1.265.00 and then adjusted that value to the date of the administrative appraisal by applying a discount rate, setting it at 4699.92 072 as of the date of the Administrative Appraisal. The expropriated party challenges the fact that this expert did not visit the land to be expropriated and was accompanied by an unknown person, and claims that he incorporated false information. Nevertheless, it identifies as false only the identity of the person who showed him the property, rather than the data included in his report. It also challenges one of the references used, but this doubt alone does not support finding it false or permit such a conclusion to be drawn. The undersigned considers the report submitted to be serious and the information included therein to be correct and credible; it will therefore be considered in determining the price.

Another item of information entered into the record is the study conducted by Nombre164195., at JASEC’s request, which determined a value of 4590.69 m2 by taking the value stated in the administrative appraisal and updating it on the assumption of a 30% increase due to the passage of time (i. 1043). We also have, as a reference, the amount established in Judgment No. 39-2017-1 of veintisiete de enero de dos mi/ diecisiete issued by the Tribunal de Apelaciones de lo Contencioso Administrativo, Sección Primera, which set a unit price of 42.000.00 m2 for the expropriation of 66.777.23 m2 from a property located in Marsella and required for construction of the Proyecto Hidroeléctrico Toro III. Determination of the value of the expropriated land in this case must necessarily be based on very specific circumstances. First, as already explained, it is impossible to adopt the amount established in the administrative appraisal; the value determined in the administrative proceedings cannot be confirmed.

Consequently, determination of the land’s value must necessarily be based on the other expert appraisals received into the record, which will provide the minimum and maximum possible parameters between which the fair price must be set, also taking into account the principle that replacement value must be determined as close as possible to the date of the judgment. In this regard, the first court-appointed expert set the amount at 41.843.00 m2, and no amount above that figure should be established; the third, tie-breaking expert set the amount at 4699,92 m2, which should therefore constitute the lower limit for determining the value. This is the range within which the compensation amount must be established. The undersigned does not agree with the value of "99.92 m2 determined by the third, tie-breaking expert because, as already stated, the value as of the date of the administrative appraisal would be completely outdated.

It would therefore make no sense to adjust a current value back to that date, as doing so would perpetuate the very defect for which use of the value from that time was rejected. For its part, as stated above, the value obtained by the first court-appointed expert is unacceptable because of both the formal and substantive errors in that appraisal when determining the value. Nevertheless, the work performed by expert Nombre164194 in his report produced an updated value per square meter of 41.265.00 m2 before applying the equation to adjust that value back to the date of the administrative appraisal. Based on the manner in which that value was obtained and the methodology used, the undersigned considers it to be a real, current, and fair value for use as the unit value in determining compensation in this case. In addition, it satisfies the requirement that the value be as close as possible to the date this judgment is issued.

For all the foregoing reasons, the unit value is established at @1.265.00 m2, which, multiplied by the 40.000.00 m2 area to be expropriated, results in FIFTY MILLION SIX HUNDRED THOUSAND COLONES ($50.600.000.00), the amount Nombre14912 must pay the expropriated party for the value of the 40.000.00 m2 of land. Because a value has been established in the record for this particular case and is considered by the undersigned to be fair and correct, it is unnecessary to resort to prices established in decisions concerning similar cases. b) Damage to the remainder (daño al remanente): The fundamental principle of the liability system is that a person is not required to bear damage. It follows from this premise that any injury suffered by a person with respect to his or her rights, which that person is not required to bear, must be fully remedied pursuant to Article 41 of the Constitution. According to the most authoritative scholarship and case law, compensable damage must be current, actual, and individualized, and must have a causal nexus—that is, the correlation that must exist between the cause and the harmful effect.

With respect to damage to the remainder resulting from a partial expropriation, as in this case, such damage arises from a detrimental effect on the property’s original attributes as they existed before the expropriation. Accordingly, the damage must be a direct consequence of the severance (segregación) or encumbrance imposed; that is, the causal nexus of the damage must lie in the expropriation or encumbrance itself. It follows that any impairment of rights (damage) arising from a cause other than the expropriation does not constitute damage to the remainder but rather damage in the broad sense, which must be claimed and determined in a different proceeding. The administrative appraisal justified this damage on the ground that the severance would affect the western section of the property, causing the partial loss of Quebrada La Flor, as well as a portion of the frontage on a public street (see image 21).

And it found that the expropriation (expropiación) affected only one section of the property; this section has an area of 182.615.20 m2, and the damage to the remainder (daño al remanente) is assessed with respect to this section, since it is the section that suffers the impact of the segregation (segregación) due to its topography and shape; the parent property (finca madre) has extensive areas that will not undergo any abrupt change. Access will be provided by the public road, which will be improved, thereby minimizing the impact on the parent property; under this assumption, the remainder has an area of 142.615.20 m2, will lose its hydrological condition and one of the sites with the least rugged topography, and will continue to have the services available to the parent property. The expert witness (perito) Nombre164199 determined the damage to the remainder to be 42.154.915.973,00; this expert states that the rest of the property is affected in two portions: remainder A, measuring 788.982.54 m2, by 70% of its value, and remainder B, measuring 721.194.33 rn2, by 80% of its value.

This drives the calculation of the damage to the remainder to a clearly exorbitant amount; he justifies using the rest of the property, even considering the unregistered area, based on the decrease in the flow of Quebrada la Flor for JASEC. This consideration is erroneous because the property has other hydrological sources, several streams, and Río Toro, and therefore this condition does not affect the entire property. This expert does not explain in detail how he determined those percentages of impairment; at first glance, it appears unreasonable that an alleged decrease in the stream’s flow would affect 70% or 80% of the property, considering that the segregated area represents 4.82% of the property’s total area (administrative appraisal (avalúo administrativo), image 14), which is another reason why that percentage is disproportionate. No errors or deficiencies are apparent in the report of the third tie-breaking expert (tercer perito en discordia); he uses four comparables with areas ranging from 4.000 m2 to 90.000 m2, but applies the comparability-adjustment method (método de homologación) and determines a unit value of 41.265.

He brings that value to the date of the administrative appraisal and states that it corresponds to 4699.92 m2; for the damage to the remainder, he established an impairment of 10% and calculated the affected area based on the registered land. Moreover, the defendant’s statements concerning the damage to the remainder lack reasonableness. Regarding the difficulty of constructing other internal roads on the property, given the land’s topographic conditions, to connect two sections of the property separated by the stream, both because of those topographic conditions and the restrictions imposed by the Ley Forestal, it is clear that this difficulty is caused by the topography of the land as well as by statutory restrictions, and that the property is divided by the stream; those circumstances are not a consequence of the expropriation, contrary to the defendant’s assertion. Likewise, the fact that the property has internal roads for driving cattle or tourist visits, which according to the judicial inspection (reconocimiento judicial) are in very poor condition, is of no consequence, because it cannot reasonably be inferred from the expropriation that those roads may no longer continue to be used for those purposes.

Upon review of the information in the record and the matters described during the judicial inspection, it cannot be inferred that segregation of the lot will abruptly alter the property’s customary activities; it removes some of the property’s frontage along a secondary road in poor condition, and the area being segregated from the property amounts proportionally to 4.82% of the total registered area. To determine the damage to the remainder more accurately, the area of 182.615.20 m2 identified as affected in the Administrative Appraisal is accepted as correct. This is because it is reasonable that a property of the stated size, relative to the area to be expropriated, cannot be affected in its entirety by the segregation at issue. Considering also that this is a section toward the rear of the property, it will specifically affect the western section of the property, particularly the left side of the internal road.

This section has an area of 182.615.20 m2, and the damage to the remainder is assessed with respect to this section, since it is the section that suffers the impact of the segregation due to its topography and shape. The parent property has extensive areas that will undergo no change; this segregation represents 4,82% of the property’s total area. Given the characteristics of the land, its current use, and the existing conditions, it is considered reasonable, for purposes of this component of compensation, to use the actually affected area determined in the Administrative Appraisal. Consistent with the third tie-breaking expert regarding the percentage of impairment, this adjudicator estimates it at 10%, considering the changes to the water resource, the effect on the nearby area, and the effect on the frontage, which is reduced by 84.69 meters from the property’s total frontage of 618.97 meters.

This percentage is adopted on the understanding that neither the current land use (uso de suelo) nor the activities conducted on the property are restricted. The expropriated party has no basis for asserting that the expropriated property loses privacy and exclusivity, first because the remainder will continue to be private property, as it will remain under the private ownership of the expropriated party, and second because the loss of any exclusive value of the property has not been demonstrated. Given the purpose of the expropriation, namely the segregation of a parcel of land, the “before-and-after” method (método del “antes y después”) used by both court-appointed experts is considered appropriate, but using the values established in this ruling, specifically the unit value established in the preceding paragraph. Accordingly, using the unit value defined in the preceding paragraph at @1.265.00, the damage to the remainder is calculated as follows.

Area 182.615.20 m2 x @1.265.00 = total value @231.008.228.00. Value of the area to be expropriated: Area 40.000.00 m2 x 41.265.00 = @50.600.000.00. Value of the remaining area: Area 142.615.20 1772 x 41.138.50 = 4162.367.405.00. The amount that Nombre14912 must pay to the expropriated party for damage to the remainder is established at EIGHTEEN MILLION FORTY THOUSAND EIGHT HUNDRED TWENTY-THREE COLONES @18.040.823.00). c) Forest resources (recurso forestal): This is not an item that was initially considered in the Administrative Appraisal; nevertheless, the expropriated party raises it as one of its objections. During the judicial inspection, it was stated that “trees scattered throughout the pasture can be observed, which, according to the participants, are timber trees planted as part of the property’s reforestation, including species such as Cávano and cedar”; it was also stated that there are trees along the stream bank.

In this regard, and in response to requirements during the proceedings, Nombre14912 submitted a technical report on the felling of trees (corta de árboles) in protected areas (áreas de protección) for the La Flor intake (i. 1067 a 1071). On 7 de julio de 2017, in response to a court order, it submitted an estimate of compensation for the forest resources, determining that the trees located in the protected area are not compensable because they are not marketable. Outside that area, there are 6 trees which, as of the date possession was granted, did not have a diameter greater than 30 cm and therefore were not marketable; nor is there evidence that they were planted by the owner, and the owner does not receive Pago de Servicios Ambientales. Consequently, no compensation is warranted. The expropriated party, for its part, maintains that what it seeks to have compensated, more than the commercial value, is the adverse effect because the property is used for ecotourism and the landscape and conservation value of those trees.

In this regard, it is important to consider that the State Natural Heritage (Patrimonio Natural del Estado) also comprises wild fauna and flora. Article 40 of the Ley de Conservación de Vida Silvestre (LCVS) establishes the public-domain status (demanialidad) of wild flora and fauna, which constitute a renewable natural resource and form part of the national heritage. Because they belong to the State and owing to their ecological importance and physical qualities, the legislature collectively designated its forests and forest lands as public domain, inalienable and not subject to acquisitive prescription, with a view to their conservation, protection, proper administration, and promotion. In this regard, our Sala Constitucional stated in judgment N04587-97 that “Forest property is conceived fundamentally for conservation, not for production or as an object of commerce among persons.” Under the forest regime (régimen forestal), forests are part of the State Natural Heritage, are devoted to the public purpose of conservation, and are subject to a public-domain legal regime (régimen jurídico de naturaleza demanial).

Title Three of the Ley Forestal governs forest management (manejo de bosques) on private property and provides as follows: ARTICLE 19. Authorized activities. On forest-covered land, no land-use change (cambio de uso del suelo) or establishment of forest plantations shall be permitted. However, the State Forestry Administration (Administración Forestal del Estado) may grant permits in such areas for the following purposes: a) To construct dwellings, offices, stables, corrals, nurseries, roads, bridges, and facilities intended for recreation, ecotourism, and other similar improvements on privately owned land and properties where forests are located. b) To carry out public or private infrastructure projects of national interest. c) To cut trees for reasons of human safety or scientific interest. d) To prevent forest fires, natural disasters, or other similar causes or their consequences. In such cases, forest cutting shall be limited, proportionate, and reasonable for the purposes set forth above.

A preliminary screening questionnaire must first be completed before the State Forestry Administration to determine whether an environmental impact assessment (evaluación de impacto ambiental) may be required, as provided by the regulations under this law.” This provision establishes that forest land use cannot be changed and that its commercialization is prohibited; trees may be cut only upon satisfaction of the conditions set forth in subsection c) of that article, and no such factual circumstance has been demonstrated in this specific case. In this regard, the expropriated party never had the right to commercialize timber from the forest, and it therefore is not a compensable asset. It is true that the Administration did not consider it as a separate item when preparing the estimate and, consequently, neither did the appointed experts, since they confined themselves to reviewing what had been valued in the administrative appraisal and did not find it to be an item warranting separate compensation.

The expropriated party requested the appointment of a forestry expert (perito forestal) to value this resource, but stated that it was not actually interested in the resource’s commercial value, but rather in the damage caused to the landscape and to the activity conducted on the property as a result of the trees cut for construction of the project. During the proceedings, the appointed experts and the Administration were required to review this issue and, if it was substantiated, to supplement the expert reports in this respect. The Administration reiterates its position that this is not an item capable of valuation or compensation. The expert Nombre164199 departs from the Administration’s position and states that this resource must be valued from the standpoint of its environmental economic impact, for which purpose he applies the income-substitution method (método de sustitución de rentas) because the forest resource was destroyed and has no commercial value in itself.

It estimates an annual compensatory payment of ",99355373, which it initially multiplies by 7 years, the time that has elapsed since the date of the inspection, for total compensation of @27.954.876.14. It subsequently extends the period to IO years, stating that financial doctrine indicates that economic projections must have a minimum term of 3 years and a maximum of 10 years, without explaining the basis for either the estimate or the term. The expropriated party also disagreed with the compensation suggested by expert Nombre164196 for the forest resource (recurso forestal), because it considers that, since the environmental damage is permanent and irreversible and has a serious impact on the remainder of the property, it is unjustified and unlawful to limit compensation to the past seven years without projecting it into the future. Such a claim by the expropriated party cannot be granted: first, no such damage has been proven, nor has it been identified or quantified; that is, throughout the time taken to process these proceedings, the expropriated party has not reliably established the damage suffered by its commercial activity as a result of the expropriation.

There is no evidence genuinely establishing that this occurred or has occurred. As a matter of law, the requested compensation projected into the future cannot be awarded; the damage must be actual and permanent, and throughout all the time that has elapsed, had the alleged impacts and damage actually occurred, it could have proven them, which it did not do. The undersigned therefore concludes that this item should neither be recognized nor compensated. Furthermore, because a stream runs through the expropriated property, we must analyze the legal regime governing protection zones (zonas de protección), which constitute a management category of protected wilderness areas (áreas silvestres protegidas), regulated by Ley Forestal Placa33524 and defined therein as follows: “Article 33.- Protection areas (áreas de protección). The following are declared protection areas: (...) b) A strip fifteen meters wide in rural areas and ten meters wide in urban areas, measured horizontally on both sides along the banks of rivers, streams, or brooks, if the land is flat, and fifty horizontal meters if the land is rugged.” From the standpoint of real rights (derechos reales), this may be characterized as a restriction on property ownership (limitación a la propiedad), based on the social function it serves in light of the doctrine of Article 45 of the Constitución Política.

The primary purpose of protection areas is to preserve and protect water resources (recurso hídrico); accordingly, trees are the essential means of achieving that purpose because of their crucial importance in protecting water. Without trees, the springs from whose waters rivers arise dry up. Article 34 of Ley Forestal establishes a prohibition on cutting trees in protected areas, except for projects declared by the Poder Ejecutivo to be in the national interest (conveniencia nacional), as occurred in the case before us; this means that, because their resources are not available for private commerce, they are likewise not compensable. In view of the foregoing, the compensation sought by the expropriated party for the trees located within the protection zone of the quebrada La Flor must be denied. Furthermore, outside the protection zone, which is essentially pastureland, only two trees belonging to commercially valuable timber species were identified (see forest inventory (inventario forestal), folio 825), which states: “According to Table 6, two of the trees are marketable (28.6%) and fall within the two diameter categories; they belong to the cebo species, while guarumos account for 71,4% of the trees.

In terms of volume (Table 7), m3, 50.8% would be marketable (0,7338).” In principle, these trees should be compensated because there is no legal restriction on their exploitation; however, the expropriated party has stated that it is not their commercial value that matters to it, but rather the damage caused by their felling to the landscape and the resulting impact on its commercial activity, damage that was neither demonstrated nor established in the record. It must also be considered that the existence of pastureland with two commercially valuable timber trees in an area of 4/ha is not a relevant or distinguishing factor affecting market value, since it is a common characteristic of properties in the area. Viewed mathematically, in a comparable-property adjustment table (cuadro de homologación), when the comparables have the same characteristic or constant, the adjustment factor is always equal to 1, meaning that no adjustment is made on that basis and it is therefore not a factor affecting the price.

Consequently, the compensation sought for the forest resource must be denied, and because there is no evidence demonstrating the loss of Pago de Servicios Ambientales, this is not actual damage that must be compensated. The total compensation that Nombre14912 must pay CASCADAS DEL TORO S.A. for the expropriation of 40.000 m2 of property registered under Placa6827 is set at SIXTY-EIGHT MILLION SIX HUNDRED FORTY THOUSAND EIGHT HUNDRED TWENTY-THREE COLONES ("8.640.823,00). xr- COSTS AND INTEREST: With respect to procedural costs and attorneys’ fees (costas procesales y personales), as well as interest, Nombre14912 is ordered to pay interest on the difference between the administrative appraisal (avalúo administrativo) and the fair compensation (justiprecio), pursuant to section 11 of Ley de Expropiaciones, from the date possession was granted, which occurred on 15 de junio de 2010, until the aforementioned difference is actually deposited.

Regarding costs, pursuant to section 193 of Código Procesal Contencioso Administrativo, the undersigned finds no exception that would justify exempting the expropriating party from costs, since it compelled the expropriated party to defend itself before the courts through legal counsel; it is therefore ordered to pay both categories of costs in these proceedings.” (see digital case file (expediente digital)).

IV. ON THE MERITS OF THE MATTER

One aspect that the Court cannot fail to note is that, in the case of expropriations (expropiaciones) of large or rural properties, as here, the price must be determined per hectare and not per square meter. In that regard, the administrative appraisal (avalúo administrativo) complies with that requirement (although it refers to the value per square meter by dividing the price per hectare by ten thousand), unlike the judicial expert reports (peritajes judiciales), which conduct their analysis per square meter, a technically improper approach. Nevertheless, despite that deficiency, it is the view of the undersigned that those studies must be considered as inputs; otherwise, the expropriated party would be left without any basis for challenging the amount offered in the administrative appraisal, which is precisely the foundation of the proceeding. Moreover, it must be mentioned that, like the trial judge, we are deeply concerned that the different values offered by the experts contain vastly different figures that are entirely unjustifiable at first glance.

It is impossible to explain why nearby or related properties have such different values, as the trial judge reasoned. The court below concludes that the substantially divergent values lack credibility, which, from a logical standpoint, is not an unreasonable conclusion. This court can find only one valid justification for this situation, derived deductively from the expert reports themselves: it is evident that, because of the agricultural conditions, the beauty of the landscape, and similar circumstances in the region, different types of land can be found within the area. Thus, three very different types of properties coexist: first, agricultural and livestock properties; second, a series of recreational properties resembling country estates, with areas close to one hectare; and finally, residential lots, with areas of approximately a few hundred square meters. It is beyond dispute that the area has substantial agricultural production, an attractive climate, and a marketable landscape, allowing those activities to thrive, with access, services, and especially the availability of water being decisive factors.

This explains why the first judicial expert describes the area as tourist-oriented (which, incidentally, he neither justifies nor substantiates, while the administrative appraisal describes it as an agricultural area), and, as the judge states, no evidence was submitted to support that conclusion (such as income-tax returns, reports to the Municipality, ICT reports, or any other material from which it could be inferred that this was the property’s economic activity). In our view, this means that criteria for recreational areas are being used when the applicable criteria should have been those for agricultural and livestock areas. This adjudicative body draws that conclusion from the map of homogeneous zones and the differing values shown for lots in the same area. Thus, the values fall at diametrically opposite ends because some cases involve agricultural properties and others recreational properties; we exclude residential construction lots because they have smaller areas and are located within the more densely populated areas.

In this regard, there is no evidence that either the parent property (finca madre) underlying the expropriation or the area being expropriated is a recreational property; moreover, its area and available services preclude such a finding. Not even the expropriated party’s theory of the case advances such a contention. In conclusion, the values corresponding to recreational properties do not apply to this case. Still less can the values corresponding to urban areas intended for residential construction be applied. The judge is likewise correct that the first expert report was poorly prepared, insofar as it attempts to create the impression that the expert performed work closely adhering to technical standards by seeking market values from certain reference properties and subsequently applying the multifactor method (método multifactorial). Unfortunately, when applying this method, the expert assigns a value of 1 to all the adjustment and valuation factors (factores de castigo y valoración) established by the formula, even though logic dictates that this value applies only to comparable properties (comparables) identical to the “standard” lot used as the basis for that methodology.

Accordingly, the mere fact that the comparable properties differed in size from the standard lot meant that a value other than one had to be assigned (higher or lower, as applicable), since a value of one means that the comparable lot and the standard lot are identical, which is impossible. This was not done here, and because the assignment required an assessment by the expert, this panel has no data or input from which to identify the correct variable for each case. The parties should have raised this issue when the expert opinion was submitted, requesting clarifications and additions to the report until the instrument was corrected so that it would be useful. Because that course was not followed, the expert report became unreliable for purposes of establishing a price. It bears noting that, on previous occasions, it has been stated that although the multifactor method is not the only instrument for setting the price of property subject to expropriation, it has the virtue of presenting numerous factors and seeking to make two properties with significant differences comparable.

To accomplish this purpose, however, the method and its criteria—the most questionable element—must be applied correctly and supported by technical grounds. Finally, the judge is correct in noting that both the expert reports and the appraisal use several reference properties from areas that are not nearby, as the descriptions of those references demonstrate. Indeed, as can be seen from the grounds for appeal (agravios), the appellant says nothing to challenge the judge’s finding on that point, which is the reason she rejected all the expert reports and also declined to accept the appraisal, considering them incapable of supporting any finding. This led the judge to rely on certain aspects of the third expert report, which, as a matter of prudence, appear to provide the most reasonable basis for determining fair compensation (justiprecio), as well as having been prepared recently. We reiterate that all these matters identified by the trial court remain unchanged to date and make it more difficult to resolve the dispute; worse still, none of them forms the basis of any ground for appeal by the expropriated appellant.

Accordingly, the trial judge’s conclusion that all those factors must be excluded because of their deficiencies remains valid to date. Therefore, not a single one of the studies can be accepted for purposes of determining the total amount of compensation (indemnización) when rendering this judgment. Now, following the order of the grounds for appeal presented orally by the appellant (not those presented in writing, which are broader), pursuant to section one hundred thirty-three of the Código Procesal Contencioso Administrativo, which provides that grounds for appeal must be presented orally before the Court, the following is found: 1) Unit value per M 2 . To determine fair compensation, the judge adopted the appraisal of the third tie-breaking expert, Nombre164194. , who determined a unit value of Cl.265 M 2, although that expert opinion uses as its fourth reference a unit value of C7.112.50 M 2, as shown in the “Appraisal Review Report” (“Informe de Revisión de Avalúos”) prepared by Lic. Gerardo Hidalgo and submitted as evidence to assist the court in reaching its decision (prueba para mejor resolver).

A comparison of the data in the expert report shows that, to resolve the dispute, the judgment relies on the third tie-breaking expert report, which takes as one of its references the location point Dirección19664, corresponding to Parque Nacional Juan Castro Blanco, with a value per square meter of 250 colones, whereas the correct reference is Dirección19665, whose value per square meter contains two amounts: Q1.500 colones for a standard lot of 7500 square meters and fifteen thousand colones (C15.000) for standard lots of 200 square meters, bearing in mind that the latter lot is urban. Here, the property is rural, which means that the value per square meter that must be used is one thousand five hundred colones Q1.500) per square meter. It should be noted that, according to the aforementioned expert, Nombre164194 , the amount is adjusted downward by ten percent based on the value per square meter because of the difference between the expropriated land and the standard lot.

It should be noted that the land to be expropriated comprises four hectares, while the standard lot for the homogeneous zones is seven thousand five hundred square meters; these are recreational country estates. The land affected by the public interest is three times larger than the standard lot. Consequently, the ten-percent downward adjustment stated by the expert is justified and therefore must be maintained. This would result in a value of one thousand three hundred fifty colones per square meter (Q1.350,00m2). The appellant seeks to replace this value with the fourth reference value from the third tie-breaking expert report and thereby derive the per-square-meter value to be applied in this specific case, a position this Court does not share. It can be seen that the first reference in that expert report is four thousand square meters, the second is two hectares, two thousand square meters, and nine hectares, making it evident that the areas differ greatly from one another.

Even the standardized comparison values (valores de homologación) are diametrically different without any logical justification. The Court can find no explanation for the different adjustment factors; the parties did not request clarification in that regard, and the Chamber has no basis for justifying those matters. Accepting the other criteria in that expert report (except for the homogeneous-zone value with its corresponding adjustment) would result in a decision unsupported by any technical factor. Furthermore, if the aggregate amount were compared with the homogeneous-zone value, it would produce an amount similar to that of urban land, higher than land in a city, and it cannot be forgotten that the property here is rural. Logic compels the conclusion that the appellant seeks to obtain the highest possible price, without any support for those percentages. In addition to the foregoing, the factors identified by the judge as diminishing the credibility of the expert report as a whole are applicable.

Accordingly, the only usable value is the homogeneous-zone value already indicated. The Chamber understands that this value was designed for tax purposes and not for determining compensation, but it is the only figure identified by the experts that cannot be invalidated and that has corresponding support. Moreover, the expropriated party is correct in stating that this expropriation has taken an excessive amount of time to resolve and that it is entitled to have the dispute definitively resolved (in the expropriation proceeding) based on the materials contained in the case file. The other expert report is not useful for the reasons stated by the trial judge, which were not challenged, and the same is true of the administrative appraisal. Consequently, this Court elects to reject the expert report invoked by the appellant, using only the homogeneous-zone value with the considerations already stated, since that value is invoked by the expropriated party itself.

Applying that value of one thousand three hundred fifty colones to the number of square meters expropriated (four hectares) produces a total of FIFTY-FOUR MILLION COLONES (C54.OOO.OOO), and the value of the expropriated land is set at that amount.

That item is reasonable and proportionate to the harm sustained by the expropriated company, without resulting in unjust and disproportionate enrichment. 2) Damage to the remainder (daño al remanente): Regarding compensation for damage to the remainder, the appellant argues that the judge disregarded the appraisal (avalúo) and the two expert reports (peritajes) entered into the case file, and instead devised her own formula to establish an amount that is far lower than the amount established under this item thirteen years earlier by Administrative Appraisal Nombre9574 412-2007 itself. In this regard, it should be clarified that the administrative appraisal assessed the damage to the remainder at the sum, whereas the judgment awards the sum of eighteen million forty thousand eight hundred twenty-three colones @18.040.823.00), such that the amount awarded in the judgment is greater than that offered in the administrative appraisal.

With respect to the before-and-after method used in the expert reports as a means of determining the damage to the remainder, although that method is suitable for this purpose (noting that there is no single method for determining compensation, but rather multiple methods, and that the method ideal for one case may not work for another), it is clear that the expert reports calculate the land values on the basis of recreational properties rather than agricultural or livestock properties, as is true of the case before us, for the reasons explained in the preceding point. Accordingly, like the first-instance judge, the Court concludes that the expert reports in this case are not useful for determining the damage to the remainder. It should be noted that the values used in the “before and after” analysis are, in both instances, based on inflated values that would be justifiable only if the affected properties were located elsewhere, possibly in urban areas, and that is not the situation before us.

Furthermore, the method used in the judgment to calculate the damage to the remainder is far from being a formula invented by the first-instance judge, as alleged in the ground of appeal (agravio). Essentially, because the before-and-after method in the expert reports could not be used due to their reliance on comparables of questionable credibility, she chose to use the bases of the formula set out in the administrative expert report. Thus, this is not an unjustifiably created formula, but rather the application of a method identified in the appraisal, with the values replaced for the benefit of the expropriated party. The method used is therefore neither improper, unlawful, nor contrary to law. Having made that clarification, the administrative appraisal assesses the damage to the remainder over an area of 182.615.20 m2, rather than over the entire property, and none of the court-appointed experts (expertos judiciales) refutes that area; even though they do not agree with it, they view the property as an indivisible whole and consequently conclude that compensation must be paid for the entire property as having been affected by the expropriation.

On other occasions, this Chamber has stated that such reasoning is fallacious because, depending on the location of the expropriated land, it is entirely possible for the effect on the remainder to extend not to the whole property but only to portions of it. A finding that the entire property sustained damage to the remainder must be justified, whereas in this case it is merely presumed on the premise that this was an ecological-environmental project, a position that we have consistently rejected. There is no sufficient basis for finding that this was an ecological-environmental project, as the expropriated party has consistently maintained; as noted, there are no tax or municipal records, records before the Ministerio del Ambiente y Energía, or any other evidence submitted that would support a categorical finding that a project of that nature existed before the expropriation, and under those circumstances no compensation whatsoever may be awarded.

This necessarily leads us to conclude that this is agricultural and livestock land, as stated in the administrative appraisal. For the damage to the remainder to exceed the expropriation itself, it must be technically substantiated. Under these circumstances, this Court accepts that area as the area actually affected by the expropriation, in accordance with the administrative appraisal (which, as already stated, has not been refuted), rather than the entire property. As already explained, this Court considers that the value per square meter for this expropriation is, and the administrative appraisal stated that the damage to the remainder extends over an area of 182.615.20 m2. Although some experts disagree with that area, the fact remains that they do not establish a technical criterion capable of disproving that number of square meters, as explained. Simply multiplying the square meters by the value per square meter yields, as the total, the amount for the item that would apply if that land were being expropriated, which is not the case here; what is sought is compensation for damage to the remainder (daño al remanente), not the expropriation (expropiación) of that portion of land.

Although the expert reports use as a reference that the damage to the remainder should be compensated at one hundred percent (100%), the fact remains that the property is not losing its entire value, and there is no dispossession; the expropriated party would continue to exercise the rights inherent in ownership over that area of land, just as over the rest of the property not affected by the expropriation, with the sole qualification that this portion of the property has suffered a reduction in its market value that must be compensated (the damage to the remainder), which is why this argument must be rejected. The administrative criterion indicates an impairment of approximately ten percent, a position that appears logical given such an extensive area of damage, resulting in a total amount of damage to the remainder of twenty-four million six hundred fifty-three thousand fifty-two colones (424.653.052,00), the amount at which the damage to the remainder is fixed.

Again, this is a value that is reasonable, proportionate, and consistent with the general conditions of the damage suffered, without producing unjust enrichment for the expropriated party. 3) Forestry and environmental damage. The appellant states that the trial judge refused to recognize any amount for the forestry and environmental damage suffered by Reserva Natural Cascadas del Toro as a result of the expropriation ordered against it by JASEC; in doing so, she relied on a “study” conducted by Nombre9574 technicians in June 2017, seven years after possession of the expropriated land had been granted to Alianza ICE-JASEC and four years after the intake for P.H Toro 3, the project that prompted the expropriation, had been fully constructed and was operational. In other words, in this respect, the judge disregarded the judicial inspection record (acta de reconocimiento judicial) from June 2010, a topographic survey (levantamiento topográfico) conducted by Nombre9574 technicians in March 2010 to specifically determine the environmental impacts of PH Toro 3 on the property of Cascadas del Toro S.A; and a forest inventory (inventario forestal) prepared by MINAE in 2011 as part of the processing of a tree-felling permit; all documentary evidence that consistently acknowledges the abundance of trees existing in the area at the time of the expropriation.

Instead, she accepted an official report from the expropriating authority, which was unlawfully characterized as an “addendum to the administrative appraisal (avalúo administrativo)” in August 2017, that is, long after the trees to be inventoried and compensated had been cut down (a direct violation of the constitutional guarantee of prior compensation and Article 24 of the Expropriations Law, according to the expropriated party). And this occurred after Alianza ICE-JASEC had, for six years beginning in February 2011, disobeyed the multiple and repeated requests from the Contentious-Administrative Court that it provide the required information concerning the forestry and environmental damage caused to Cascadas del Toro. Likewise, the challenged judgment disregards the fact that Nombre14912 acquiesced to the valuation of this item performed, by order of the trial court, by expert Nombre161016 in October 2017, which determined forestry and environmental damage of C 39.935.537,30 million.

We say, the appellant indicates, that the expropriating entity acquiesced to this appraisal because, at a first hearing, it merely challenged the fees claimed by the expert without objecting to a single line of his report, and at a second hearing, following an expansion of the expert assessment, it entirely refrained from responding, as the appellant states. In rejecting this item, the judge considered the following: a) This item was not considered in the initial appraisal. b) The judicial inspection indicated that “scattered trees can be seen in the pasture (potrero), which, according to the statements of those appearing, are timber trees planted as part of the reforestation of the property, including species such as Cóbano and cedro”; it was also indicated that trees existed along the bank of the stream. c) In response to requests made during the proceedings, Nombre14912 submitted a technical report on the felling of trees in protection areas (áreas de protección) for the La Flor intake. d) On 7 de julio de 2017, in response to a request from the Court, it submitted an estimate of compensation for the forest resource (recurso forestal), determining that trees located in the protected area were not compensable because they were not marketable; outside that area there were six trees which, as of the date possession was granted, did not have a diameter exceeding 30 cm, and therefore were neither marketable nor shown to have been planted by the owner, nor did the owner receive Pago de Servicios Ambientales, so no compensation was warranted.

It subsequently concludes verbatim: “Such a claim by the expropriated party is impossible to satisfy. First, such damage has not been proven, nor has it been specifically identified or quantified; that is, throughout the time elapsed during these proceedings, the expropriated party has not reliably established the damage suffered by its commercial activity as a result of the expropriation. There is no evidence actually demonstrating that this occurred or has occurred. The compensation it seeks, projected into the future, is legally impossible to award; the damage must be actual and permanent, and throughout all the time that has elapsed, if the impairments and damage alleged had truly occurred, it could have proven them, which it did not do. Therefore, the undersigned concludes that this aspect is not an item that should be recognized or compensated. Furthermore, because a stream crosses the expropriated property, we must analyze the legal regime applicable to protection areas, which constitute a management category for protected wilderness areas (áreas silvestres protegidas), regulated by Ley Forestal Placa33524 and defined therein as follows: ‘Article 33.- Protection areas.

The following are declared protection areas: (...) b) A strip measuring fifteen meters in rural areas and ten meters in urban areas, measured horizontally on both sides along the banks of rivers, streams, or creeks, if the land is flat, and fifty meters horizontally if the terrain is rugged.’ From the standpoint of rights in rem (derechos reales), it may be noted that this constitutes a restriction on ownership due to the social function (función social) it performs in light of the doctrine of Article 45 of the Political Constitution. The primary purpose of protection areas is to preserve and protect water resources, and trees constitute the essential means of accomplishing that purpose because of their critical importance in protecting water. Without trees, the springs from whose waters rivers originate dry up. Article 34 of Ley Forestal establishes a prohibition on cutting down trees in protected areas, except for projects declared by the Executive Branch to be of national interest (conveniencia nacional), as occurred in the case before us; this means that, because their resources are not available for private commerce, they are likewise not compensable.

In view of the foregoing, the compensation sought by the expropriated party for the trees forming part of the protection area of the La Flor stream must be rejected. Furthermore, outside the protection area, which is essentially pastureland, only two trees belonging to commercially valuable timber species were identified (see forest inventory I, 825), which states: ‘According to Table 6, two of the trees are commercially marketable (28,6%) and cover both diameter categories, and they belong to the cebo species, while the guarumos represent 71.4% of the trees; in terms of volume (Table 7), 50.8% of the m3 would be marketable (0.7338).’ In principle, these trees should be compensated because there is no legal restriction on their exploitation; however, the expropriated party has stated that it is not their market value that concerns it, but rather the damage caused by cutting them down, in terms of the landscape and the effect on its commercial activity, damage that was neither demonstrated nor established in the record.

Furthermore, the existence of pastureland with two commercially valuable timber trees in an area of 4/ha does not constitute a relevant or distinguishing factor affecting market value, because it is a common characteristic of properties in the area. Viewing the foregoing mathematically, in a comparison-adjustment table, when the comparable properties share the same characteristic or constant, the adjustment factor is always equal to 1, which means that no adjustment is made for that concept and therefore it is not a factor affecting the price. Consequently, the compensation sought for the forest resource must be rejected, and because there is no evidence demonstrating the loss of Pago de Servicios Ambientales, this is not actual damage that must be compensated.” In this regard, irrespective of whether that reasoning is shared, the fact remains that it has not been challenged. The appellant company never disputed a single one of the arguments set out by the judge, which it was required to do if it sought recognition of that item.

Thus, irrespective of whether any representative of Nombre14912, without the approval of the public entity’s Board of Directors as required by law for it to have any legal effect, acquiesced to the existence of a forest refuge (refugio forestal), this Court, like the trial court, has no basis for finding that a Reserva Cascadas del Toro existed at the time of the expropriation. Another matter that must be clarified is that the expropriation did not occur in two thousand ten, eleven, seventeen, or any of the other dates cited by the appellant; rather, this case file dates from two thousand eight. Therefore, if it seeks to derive any benefit from the alleged existence of a reserve on the expropriated property, it is obligated to establish incontrovertibly that such activity existed before that year. We reiterate that documents from Ministerio del Ambiente y Energía, Ministerio de Hacienda, Municipalidad, or any public agency would be suitable for that purpose, as would environmental oversight records (regencias ambientales), advertising, or, generally, something providing a clear picture of the project’s scope—but dating from before the expropriation, not afterward.

Documents dated after the case file was opened have been submitted from which environmental oversight may be inferred, but not as of the date on which the expropriating authority conducted the study. As already indicated, the respondent never submitted tax, municipal, or technical documents from which that status could be inferred before the expropriation proceedings began. Moreover, even if the existence of the aforementioned reserve could be accepted, the expert report recognizing it essentially starts from the premise that it was completely destroyed, which would be logical if the entire property had been expropriated, but that was not the case; in any event, that study does not credibly explain the extent of the damage, assuming such damage existed. Indeed, the documents prepared by Nombre9574 mentioning the existence of some environmental interest date from 2017, almost ten years after the expropriation proceedings began and also some time after the intake for the hydroelectric project.

Regarding the abundance of trees, the only point of agreement is that they exist along the banks of the watercourses that run through the expropriated property and that, as such, they are public-domain property (bienes demaniales). In that regard, the extensive documentary evidence concerning the existence of the trees does not support the conclusion drawn by the appellant, for the reasons stated above; nor does the judicial inspection (reconocimiento judicial). It should be clarified that among the undisputed facts is that the affected trees are located within a protection zone (zona de protección), title to which does not belong to the expropriated party but rather forms part of the property’s public domain, such that fewer than ten trees may be compensated; moreover, these trees have a small diameter, evidencing poor growth. That circumstance, established through the experts’ assessments, was never refuted except by the experts who consider the entire project to be an ecological forestry project, a view which, as we have repeatedly emphasized, is unsupported and amounts merely to a subjective assessment.

With respect to environmental services (servicios ambientales), it is evident that a person who dedicates all or part of a property to reforestation (reforestación), whether for another, larger project—as the expropriated party argues—or merely for the benefits of that activity, is not required to have an environmental-services contract. The fact remains, however, that the information predating the expropriation does not establish that circumstance, while the agreements entered into under a contract with the State postdate the expropriation act (acto expropiatorio), after several years had already elapsed since the commencement of the expropriation proceedings (proceso expropiatorio). This precludes a finding that the property had previously been intended for such an activity. Naturally, the subsequent activity would not be compensable, since otherwise the expert appraisal (labor pericial) would cease to constitute a determination of the property’s condition at the time of expropriation—hence the references by certain judges and the law to review of the administrative appraisal (avalúo administrativo)—which is precisely the basis of expropriation proceedings.

We must reiterate that, contrary to the position maintained by some of the experts and by the expropriated party, the use of the commercial value of the forest resource (recurso forestal) must be based not on the income it might eventually generate, but on whether that activity was generating economic value, for which no probative evidence has been presented either. It is the absence of evidence concerning the ecological forestry project whose existence the expropriated company continues to assert that precludes its economic recognition. Consequently, the claim of error (agravio) concerning compensation for forestry or environmental damage (daño forestal o ambiental) must be dismissed, as the trial judge did. As there are no further claims of error to resolve, it is appropriate as a matter of law to issue the corresponding ruling.

POR TANTO

The appeal is partially granted, and the amount awarded for the expropriated land is modified to FIFTY-FOUR MILLION COLONES (Q54.000.000), together with the sum of TWENTY-FOUR MILLION SIX HUNDRED FIFTY-THREE THOUSAND FIFTY-TWO COLONES (04.653.052,00) as compensation for damage to the remainder, for a total of SEVENTY- EIGHT MILLION SIX HUNDRED FIFTY-THREE THOUSAND FIFTY-TWO COLONES

SECCIÓN SEGUNDA. ANEXO A DEL 11 CIRCUITO JUDICIAL DE SAN JOSÉ. Goicoechea a las siete horas y treinta minutos del once de marzo de dos mil veintiuno.

Recurso de Apelación en proceso especial de expropiación establecido por la JUNTA ADMINISTRATIVA DEL SERVICIO ELÉCTRICO DE CARTAGO (JASEC) contra CASCADAS DEL TORO S.A.

RESULTANDO

PRIMERO: Mediante sentencia número 1264 - 2020 de las quince horas con dieciséis minutos del veinticuatro de junio del año dos mil veinte, el Juzgado de lo Contencioso Administrativo y Civil de Hacienda resolvió en lo que interesa: "Se establece en /a suma de SESENTA Y OCHO MILLONES SEISCIENTOS CUARENTA MIL OCHOCIENTOS VEINTITRÉS COLONES (@68.640.823.00) la indemnización tota/ que deberá de cancelar la Junta Administrativa de/ Servicio Eléctrico de Cartago a CASCADAS DEL TORO S.A. por la expropiación de un terreno de 40.000 m2 de la finca la finca de/ Partido de Alajuela, Matrícula de Folio Rea/ No. Placa33525, situada en e/ Dirección19432 , de /a Provincia de Alajuela, la cua/ resulta indispensable para la construcción de dos frentes de túnel de/ Proyecto Hidroeléctrico Toro III. Su naturaleza es terreno de potrero y bosques primarios con senderos - 3 lahuinas (Sic) y zona de reforestación áreas verdes y jardines con 4 casas y 2 cabinas con caminos internos de lastre y cemento, linderos: norte Cascadas de/ Toro S.A. Nombre9574 expropiado Nombre9574; sur: Cascadas de/ Toro S.A. quebrada Florcita; este Cascadas de/ Toro S.A. Río Toro Amarri//o (Sic) Nombre9574 expropiado ICE; oeste: quebrada Flor, camino publico, Cascadas de/ Toro S.A. Nombre9574 expropiado de/ ICE, mide: a/ momento de/ dictado de esta sentencia 823.831.54 m2, le corresponde e/ plano catastro A -1105428-2006, según información de/ Registro Nacional.

E/ monto indicado se desglosa de /a siguiente manera: CINCUENTA MILLONES SEISCIENTOS MIL COLONES (@50.600.000.00) por concepto de/ valor de/ terreno expropiado y DIECIOCHO MILLONES CUARENTA MIL OCHOCIENTOS VEINTITRÉS COLONES (418.040.823,00) por e/ daño a/ remanente. E/ lote a segregar se describe así: Naturaleza: terreno de potrero, situada: en e/ Distrito 5 Venecia, Cantón:10 San Carlos, de la provincia de Alajuela, sus linderos son: Norte: Con resto reservado de Cascadas de/ Toro SA, Sur: resto reservado de Cascadas de/ Toro S.A, Este: resto reservado de Cascadas de/ Toro SA, y Oeste: con ca//e pública. Su medida es de CUARENTA MIL METROS CUADRADOS, le corresponde e/ plano catastro A-1198283-2007, se /oca/iza en /a sección oeste de /a finca madre, representa un 4,82% de/ área tota/ de dicha finca, tiene un frente a ca//e pública de 84,69 metros, e/ lote tiene forma irregular, topografía ondulada, cubierto de pastos naturales en su totalidad; por su centro cruza una quebrada denominada la Hor que va en dirección suroeste - noreste.

E/ remanente se describe así: Naturaleza: terreno de potrero y bosques primarios con senderos, tres /ahuinas (Sic) y zona de reforestación, áreas verdes yjardines con cuatro casas y dos cabinas con caminos internos de lastre y cemento, situada: en e/ Distrito 5 Venecia, Cantón: 10 San Carlos, de la provincia de A/ajue/a, sus linderos son: Norte: Cascadas de/ Toro SA y Lote expropiado, Sur: Cascadas de/ Toro S.A, Quebrada Florcita y lote expropiado, Este: Cascadas de/ Toro S.A. Río Toro Amarillo y lote expropiado, y Oeste: Quebrada Hor, calle pública y lote expropiado. Su medida es de 783.831.54 m2. Destínese e/ terreno expropiado a/ fin público indicado. Firme este fa//o se autoriza a la empresa pública expropiante para que realice /a protocolización de piezas correspondiente, y por ende, e/ Registro Público de la Propiedad Inmueble realice la inscripción correspondiente, a nombre de /a Junta Administrativa de/ Servicio Eléctrico de Cartago, libre de gravámenes, limitaciones y anotaciones, sin perjuicio de las anotaciones y gravámenes que seguirá soportando /a finca madre.

E/ Registro Nacional está obligado a cancelar todas las anotaciones, las exacciones y los gravámenes en e/ caso de que hubiesen, previo a la inscripción y con fundamento en la escritura de protocolización de piezas, sin necesidad de ningún otro trámite. Se condena a la Junta Administrativa de/ Servicio Eléctrico de Cartago a/ pago de los intereses sobre la diferencia entre e/ avalúo administrativo y e/ justiprecio, de conformidad con e/ numera/ 11 de la Ley de Expropiaciones; a partir de la puesta en posesión y hasta e/ efectivo depósito de la diferencia recién citada. Se condena a la Junta Administrativa de/ Servicio Eléctrico de Cartago a pagar las costas personales y procesales de estas diligencias. Firme esta sentencia, comuníquese a la Dirección Genera/ de Tributación y a la Municipalidad de San Carlos para e/ cálculo de los impuestos nacionales y municipales conforme a la ley." (ver expediente digital).

SEGUNDO: Por escrito presentado en tiempo y forma, el representante de la expropiada interpuso recurso de apelación (ver expediente electrónico).

TERCERO: En virtud de resolución de las dieciséis horas del diecinueve de agosto de dos mil veinte de este despacho, se admitió el recurso de apelación interpuesto (ver expediente electrónico).

CUARTO: La comparecencia de exposición de agravios se realizó a las catorce horas del ocho de febrero de dos mil veintiuno, en la cual se difirió el dictado de la sentencia que corresponde a realizarlo de forma escrita (ver expediente electrónico).

Se dicta la presente sentencia previa deliberación y por unanimidad.

CONSIDERANDO

  1. 1SOBRE LOS HECHOS NO PROBADOS: se avala la relación de hechos probados y no probados de la resolución recurrida.

II. BASES DEL RECURSO

Expuso el recurrente como bases de su recurso, tres ejes medulares, a saber:

  • 1)Valor unitario por M 2. Para fijar el justiprecio, la jueza acogió el avalúo del perito tercero en discordia, Nombre164194. , que determinó un valor unitario de Cl.265 M 2, siendo que dicha experticia utiliza como cuarta referencia un valor unitario incorrecto, de suerte que de reemplazar el valor incorrecto por el adecuado el importe a cancelar por metro cuadrado sería de 0.112.50 M 2, como lo muestra el "Informe de Revisión de Avalúos" rendido por el Lic. Gerardo Hidalgo, aportado como prueba para mejor resolver.
  • 2)Daño al remanente: Para indemnizar el daño al remanente, la jueza descartó los tres avalúos allegados al expediente por los peritos valuadores, y optó por inventarse una fórmula propia, para establecer un monto que es mucho menor a lo que, en este rubro, trece años atrás estableció el propio Avalúo Administrativo del Nombre9574 412-2007. La máxima jurídica de que los avalúos, no los informes periciales, fijan los límites dentro de los cuales el juez debe resolver aplica no solo con relación a la globalidad de los montos totales de dichos avalúos, sino también con respecto a los diferentes rubros que los componen y determinan sus resultados; sobre todo, tratándose de tema tan específico y complejo como la estimación del daño al remanente en una expropiación parcial. Si esto no se entiende así por el juzgador, la sentencia deviene en arbitraria y carente de sustento técnico y fáctico, como en este caso ocurre.
  • 3)Daño forestal y ambiental. La jueza de instancia rechaza reconocer suma alguna por el daño forestal y ambiental sufrido por la Reserva Natural Cascadas del Toro a causa de la expropiación decretada en su contra por JASEC; para ello se basa en un "estudio" realizado por técnicos del Nombre9574 en junio de 2017, siete años después de que el terreno expropiado había sido dado en posesión a la Alianza ICE-JASEC y cuatro años después de que la captación para el P.H Toro 3, obra que motivó la expropiación, había quedado completamente construida y estaba en operación. Es decir, en este ámbito, la jueza ignoró el acta de reconocimiento judicial de junio de 2010, un levantamiento topográfico realizado por técnicos del Nombre9574 en marzo de 2010 para determinar de modo específico los impactos ambientales del PH Toro 3 en la finca Cascadas del Toro S.A; y un inventario forestal elaborado por el MINAE en el 2011, dentro de la tramitación de un permiso para talar árboles; todas pruebas documentales que coinciden en reconocer la abundancia de árboles existentes en el área al momento de la expropiación. En su lugar, acogió un informe oficial de la administración expropiante, al que de manera ilegal se le dio carácter de "adenda de/ avalúo administrativo" en agosto de 2017, sea mucho tiempo después de que los árboles a inventariar e indemnizar habían sido cortados (violación directa a la garantía constitucional de indemnización previa y al artículo 24 de la Ley de Expropiaciones). Y eso después de que la Alianza ICE-JASEC durante seis años, desde febrero de 2011, desobedeció los múltiples y reiterados pedidos del Juzgado Contencioso para que aportara la información requerida sobre el daño forestal y ambiental causado a Cascadas del Toro. De igual modo, la sentencia recurrida ignora que Nombre14912 se allanó a la valoraciÓn que, sobre este extremo y por orden del juzgado de instancia, realizó el perito Nombre161016 , en octubre de 2017, en el que determinó un daño forestal y ambiental por C 39.935.537,30 millones. Indica que el ente expropiante se allanó a este avalúo porque en una primera audiencia se limitó a cuestionar los honorarios liquidados por el perito, sin objetar una sola línea de su informe, y en una segunda audiencia, a raíz de una ampliación de la pericia, se abstuvo por completo de contestar.
  1. 111SOBRE LOS FUNDAMENTOS DE LA SENTENCIA RECURRIDA. La sentencia número 1264 - 2020 de las quince horas con dieciséis minutos del veinticuatro de junio del año dos mil veinte, del Juzgado de lo Contencioso Administrativo y Civil de Hacienda, establece como fundamento Io siguiente:

"VL- DE LOS PERITAJES RENDIDOS: Para poder determinar e/ justo precio de la expropiación objeto de estas diligencias, contamos con e/ Avalúo Administrativo y dos informes de peritos judiciales, prueba para mejor resolver y lo dicho la posición de las partes. Procedemos a analizar cada una de las pericias, A VALÚO ADMINISTRA TIVO 412-2007: Este se confeccionó e/ 10 de agosto de 2007, estableciendo e/ valor de/ terreno en @12.200.000.00, e/ daño a/ remanente en @11.922.292.00, para un tota/ de @24.122.292.00. Explica la finalidad de/ avalúo, descripción genera/ de la obra, descripción de la zona, descripción de/ inmueble, localizado en e/ Dirección19663 , , de la Provincia de A/ajue/a, se ubica 2,2 km a/ sur y 0,3 km noreste de /a comunidad de ParatSo de Marsella. E/ inmueble cuenta con un frente de 618,97 m a la vía pública. La propiedad tiene un área de 828.982.54 m2, según plano catastro A-1105428-2006, es un terreno por e/ que cruzan dos quebradas cuyas aguas fluyen en dirección suroeste - noreste, en su extremo este colinda con e/ Río Toro, cuya margen es abrupta.

La finca tiene un uso mixto, hacia e/ oeste y centro se pueden observar una serie de construcciones destinadas a/ uso recreativo, un sector de estanques, sectores de ganadería, diferentes tipos de pastos, los sectores más escarpados de la propiedad están cubiertos de bosque. La finca colinda a/ suroeste con otra finca que pertenece a los mismos propietarios, e/ frente a ca//e pública en su extremo oeste se encuentra en estado de abandono y so/o es apto transitarlo a pie o bestia. Indica que dentro de/ terreno existen árboles nativos de la zona en forma dispersa, bosque primario en la ladera margen de/ Río Toro posee bosque primario y sector norte, cercanías de la Quebrada La Flor. La topografía es ondulada, los márgenes de las quebradas y e/ río tienen mayor inclinación, en e/ centro oeste se encuentra e/ sitio a expropiar, Se estima la pendiente promedio en 40%. E/ lote a segregar representa un 4,82% de/ área tota/ de/ inmueble, con un frente de 84,69% metros a ca//e pública, forma irregular, topografía ondulada, por su centro cruza una quebrada en dirección suroeste - noreste, cubierto de pastos naturales en su totalidad, tiene una medida de 4 ha exactas según plano A - 1198283-2007, con árboles dispersos, principalmente en los bordes de la quebrada.

Se determinó un valor por hectárea redondeado a 43.050.000,00, por 4305 m2. Para e/ daño a/ remanente indica que no se deduce que la segregación de/ lote altere de manera brusca e/ quehacer habitual de la finca, afectará la sección oeste de/ inmueble, específicamente la margen izquierda de/ camino interno, esta sección tiene un área de 182.615.20 072 y sobre esta sección es que se estima e/ daño a/ remanente, ya que es la que sufre e/ impacto de la segregación, por su topografía y forma, la finca madre posee amplios sectores que no sufrirán ningún cambio brusco. E/ acceso se realizará por e/ camino público que será mejorado, /o que minimiza e/ impacto a la finca madre. Se determina que e/ sector de la finca impactado tiene un valor de 43.000.000.00 por hectárea, 300 m2, e/ remanente posee un área de 142.615,20 m2, perderá condición hidrológica y uno de los sitios con la topografía menos quebrada, seguirá contando con los servicios que posee /a finca madre.

Se determina que e/ terreno tiene un valor de @2.150.000.00 por hectárea, 21500 m2, para un tota/ de 430.662.268.00, por lo que la diferencia entre e/ antes y e/ después es de @11.922.292.00 (i. 283 a 323). F/ 27 de junio de 2014 se presenta addendum a/ Avalúo Administrativo, en e/ mismo se indica que e/ valor de los árboles implícitamente se encuentra incluido en e/ valor de indemnización, esto porque las fincas de referencia con uso similar a la sección de/ terreno a expropiar (i. 1251). Posteriormente, con fecha 7 de julio de 2017, se presenta estimación de /a indemnización de/ recurso foresta/ en e/ cua/ se determina que los árboles ubicados en /a zona protegida no son indemnizab/es por no ser comercializables, fuera de esta área existen 6 árboles, los cuales para la fecha de la puesta en posesión no poseían un diámetro superior a los 30 cm, razón por la cual no eran comercializables ni presentan evidencia de haber sido plantados por e/ propietario ni este posee pago de servicios ambientales, por /o que no procede indemnización alguna (i. 1555 a 1585).

INFORME DE Nombre161016 : este se presentó e/ 21 de Octubre de 2010, estableció como propósito revisar e/ avalúo administrativo yjustifica por qué se aparta de/ Avalúo Administrativo, indicando que sus valores están totalmente obsoletos, no consideró que esta dejando sin salida al camino público y que a/ inmueble se le cercena un frente de 84.69 metros a /a calle, /a disminución de/ cauda/ de la Quebrada la Hor incide en e/ resto de la finca, estima e/ daño a/ remanente sobre una sección de 182.61520 m2 sin firma de/ responsable de esos cá/cu/os que demuestren esa cabida, dejar por fuera en e/ cálculo de/ remanente e/ resto de/ inmueble. La homologación se hizo con fincas agropecuarias, pero e/ inmueble está dedicado a una explotación agro turística, además analiza áreas de fincas muy diferentes y usa ese dato para determinar e/ valor por metro cuadrado, por lo que se aparta de/ mismo. Indica que /a finca tiene una topografía mixta, áreas planas, terrenos de pendiente fuerte en las cercanías de/ Río Toro y la Quebrada /a Flor, áreas de bosque natural.

Huyen varias quebradas y nacientes, y e/ inmueble como ta/ esta dedicado a/ desarrollo sostenible agro turístico, cuenta con caminos internos cementados, cabinas y áreas para acampar, senderos en la montaña, pesca recreativa. Propiamente e/ área a segregar es un terreno cubierto de pastos naturales, con una topografía ondulada, árboles dispersos localizados en e/ borde de /a quebrada que la atraviesa, e/ lote es de forma irregular. Realizó un sondeo de/ valor comercia/ de /a zona aledaña y otras referencias, resumiendo los valores en una tabla (i. 935). Indica que debe tomarse a un 100% de afectación. Para determinar e/ precio realizó un inventario de/ valor de mercado, homologó los valores de los terrenos, tomando en cuenta que e/ área a expropiar es de 4 hectáreas, que en e/ área tota/ de /a finca se desarrolla e/ proyecto eco turístico de 155 hectáreas con 177,33 m2, la cual se compone de una reunión de fincas y de un sector de/ inmueble sin inscribir.

Se forman dos remanentes, e/ área más cercana a /a zona a expropiar y e/ resto de la finca. Define e/ valor de la finca antes de/ proyecto en @2.856.976.819.00 y después de/ proyecto en 4702,060.846.00. Anexa planos, certificación de la propiedad y una constancia de operación turística que realiza Armotours SA. en la finca Cascadas de/ Toro (i. 916 a 955). Aclaró que no se refirió a los árboles, porque e/ Avalúo Administrativo no los menciona y para referirse a/ punto necesitaría un inventario de los árboles, confirma que si consideró que la finca pierde acceso por e/ camino de tierra que tiene y sí analizó /a pérdida de privacidad y seguridad para asignar e/ valor y afectación a/ remanente (i.982 a 983). Con respecto a la cuantificación de/ recurso forestal, e/ perito se aparta de/ criterio de la administración e indica que la valoración de ese recurso tiene que darse desde e/ punto de vista de/ impacto económico ambiental, para lo cual aplica método de sustitución de rentas porque e/ recurso foresta/ fue destruido, y en si no tiene un valor comercial.

Estima un pago compensatorio anua/ de 43.993.553.73 que inicialmente multiplica por 7 años que es e/ tiempo que ha transcurrido desde e/ momento de su visita, para una indemnización tota/ de @27.954.876.14. Posteriormente amplia a 10 años, indicando que la doctrina financiera indica que las proyecciones económicas deben tener un tiempo mínimo de 3 años y un máximo de 10 años (i. 1610 a 1618, 1627 a 1630), INFORME DE Nombre164194 : Presentado e/ 26 de marzo de 2015, indica como objeto la revisión de/ Avalúo Administrativo, describe e/ inmueble y e/ lote a segregar, indica que en la actualidad la finca se dedica a /a cría de ganado para carne y un área cubierta de bosque con crecimiento natura/. Varia de criterio con respecto a/ Avalúo Administrativo por e/ tiempo transcurrido, la variación de/ valor y de las condiciones de/ inmueble. Procedió a determinar e/ valor actual y mediante una tasa de descuento inferir e/ valor requerido.

E/ valor actual de/ terreno mediante investigación de la oferta en la zona, consulta de vecinos, a entendidos en la materia y e/ criterio personal, con la referencias y método de homologación determinó un valor actualizado de @1.265.00 m2. Con la aplicación de la ecuación matemática determina e/ valor a/ momento en que se realizó e/ Avalúo Administrativo, a agosto de 2017 se ajusta e/ precio a "99.92 072. Determina e/ daño a/ remanente en @27.225.665.94 y e/ valor de/ área a segregar en @27.996.800.00, para una indemnización tota/ de @55.222.465.94 (i. 1275 a 1280). VII.- POSICIÓN DE LAS PARTES: La parte expropiada manifestó mediante escrito de/ 17 diciembre de 2008, planteando recurso de revocatoria con nulidad absoluta contra e/ auto que dio traslado a estas diligencias, indicando que Nombre14912 nunca les notificó la declaratoria de interés público, que e/juzgado da curso a las diligencias con base en la Ley No. 6313 sin ser e/ Nombre9574 parte de este proceso.

Que no se ha tomado en cuenta la legitimación de/ accionante para promover la causa, ni valoró la legalidad de los actos administrativos que le sirven de base. Acusa /a inconstitucionalidad de/ artículo 5 de la Ley No. 7495 y e/ 7 de la Ley de participación de las Cooperativas de Electrificación Rura/ y de las Empresas de Servicios Públicos Municipales en e/ Desarro//o Nacional (Ley No 8345), por violar los artículos 45, 169 y 170 de la Constitución Política. Indican que e/ acto administrativo que declara e/ interés público de la propiedad esta viciado de nulidad absoluta por cuanto Nombre14912 no tiene competencia territorial para actuar en San Carlos y tampoco tiene competencia materia/ para dictar expropiaciones. Adjunta como prueba Dictamen C-188-2005 de /a PGR, sentencia No. 2008- 014089 de la Sala Constitucional, publicación de/ edicto en boletín judicial No. 230 de/ expediente 07-001652-0163-CA.

Todos estos alegatos planteados en contra de/ auto inicia/ se resolvieron mediante auto de las trece horas y cuarenta y dos minutos de/ dos de febrero de dos mi/ nueve (i. 652 a 655) además de lo dicho en e/ considerando II. Auto que a su vez fue recurrido por la expropiada en fecha 9 de febrero de 2009 (i. 661 a 682). Recurso que se resolvió mediante auto de las quince horas y quince minutos de/ 19 de febrero de 2009, en el cua/ se señala reconocimiento judicial y puesta en posesión (i. 685 a 690). Esta también es recurrida por la expropiada en fecha 2 de marzo de 2009 (i. 696 a 704). E/ mismo fue rechazado de plano por e/ Tribuna/ de Apelaciones de lo Contencioso Administrativo y Civil de Hacienda (i. 757 a 759). En recurso de revocatoria de fecha 12 de mayo de 2010, planteado contra auto que señala fecha para reconocimiento y puesta en posesión, la expropiada reitera sus cuestionamientos con respecto a que JASFC no esta autorizada por e/ ordenamiento jurídico para explotar e/ servicio público de generación de electricidad fuera de la Provincia de Cartago, en este mismo escrito /a parte expropiada reconoce, ta/ y como lo indicó la Sala Constitucional, que /e corresponde a la Jurisdicción de lo Contencioso Administrativo resolver en vía ordinaria si Nombre14912 tiene potestad expropiatoria y si puede operar en San Carlos y por consiguiente la validez de/ convenio.

Insiste en /a nulidad absoluta de/ Convenio e indica que "e/ juicio expropiatorio no se suspende, cuando está impugnada la legalidad de la expropiación, porque no puede iniciarse, como tampoco puede ordenarse válidamente e/ desalojo si media la misma circunstancia". Y vuelve a acusar la nulidad absoluta de todo lo actuado por Nombre14912 y adjunta e/ voto de la Sala IV en e/ cual se declara sin lugar la acción interpuesta, en los términos antes mencionados. (i. 833 a 868). Esto se resolvió mediante auto de las catorce horas y cincuenta y un minutos de/ treinta y uno de mayo de/ año dos mi/ diez (i 870). E/ 2 de noviembre de 2012 presenta incidente de hechos nuevos y nulidad absoluta, indicando que Nombre14912 omitió presentar Addendum No. I que modificó e/ convenio de alianza con e/ ICE, en e/ mismo indican que los avalúos requieren actualización, y considera que habían perdido sus efectos por dicha modificación y adjunta acta No. 7 de/ Comité de Coordinación de /a Alianza ICE-JASEC, addendum No. I a/ Plan de Implementación, copia de/ oficio 0690-136-2008 y 258-1626-2008 referidos a la aprobación de/ Addendum No. 1 de/ Plan (i. 1164 a 1183).

Mediante resolución No. 1851 - 2014 de/ veintiséis de setiembre de dos mi/ catorce, se resuelve incidente de hechos nuevos y nulidad absoluta de actuaciones (i. 1263 a 1265). En fecha 22 de agosto de 2016 plantea recurso de revocatoria con nulidad concomitante en e/ cua/ indica que e/ Nombre164195. Nombre164194 rehusó hacer las aclaraciones a su pericia, omitió valorar e/ recurso forestal, no es Ingeniero foresta/ como se había solicitado, solicita se resuelva la petición realizada e/ 2 de octubre de 2015 en e/ sentido que se anule la pericia rendida y se designe nuevo perito con especialidad en ingeniería forestal, (i. 1377 a 1383). Lo anterior fue atendido y resuelto mediante auto de las trece horas cuarenta minutos de/ veintidós de agosto de dos mi/ dieciséis (i. 1384 a 1386). Resolución que también fue recurrida por /a expropiada ante e/ Tribuna/ de Apelaciones (i. 1390 a 1393). Recurso y nulidad que se resolvió mediante sentencia No, 376 - 2016 de las catorce horas treinta minutos de/ doce de setiembre de dos mi/ dieciséis de/ Tribuna/ de Apelaciones de lo Contencioso Administrativo y Civil de Hacienda (i. 1396 a 1397).

E/ 5 de setiembre de 2017 la parte solicita designar un perito en materia/ foresta/ y ambienta/ para que valore e/ recurso foresta/ con base en e/ inventario de/ MINAE, le resulta fraudulento que se fije e/ valor de/ recurso con base en un inventario de abril de 2017 (i. 1601 a 1604), esto le fue atendido y rechazado mediante auto de las catorce horas y veintidós minutos de/ doce de setiembre de dos mi/ diecisiete (i. 1605 a 1606). De lo anterior se desprende que los alegatos, oposiciones, recursos, incidentes, nulidades y sus respectivas pruebas, han sido debidamente atendidos y resueltos oportunamente en e/ trámite de las presentes diligencias y por las instancias correspondientes, consta incluso que las acciones de inconstitucionalidad alegadas le fueron rechazadas por la Sa/a IV, razón por la cual no corresponde ahondar en reiteraciones, siendo que ya se han pronunciado las instancias oportunamente.

Si la parte expropiada no comparte o no esta de/ todo de acuerdo con lo que se le ha resuelto durante la tramitación de/ proceso, no da pie a que insista en razonamientos de los cuales ya ha obtenido pronunciamiento, aunque que se le haya dicho no sea de su agrado. En escrito con fecha 23 junio de 2010, /a parte expropiada se refiere a la audiencia otorgada a propósito de/ acta de reconocimiento judicial indicando que e/ lote a expropiar abarca e/ camino que da acceso a/ inmueble por la vía pública y que dadas las condiciones topográficas de esa área de la finca, atravesada por una quebrada caudalosa, no será fáci/ construir un nuevo camino para unir las dos secciones de/ inmueble, Indica que e/ camino es transitable a pie o caba//o porque se utiliza para e/ arreo de/ ganado, pero es e/ acceso a/ camino público, con e/ asfaltado de la carretera dejo de utilizarse como vía principa/ de acceso, e/ ingreso se hace por servidumbre de paso.

Anota que aguas abajo de/ lote a segregar, la expropiada tiene un área de montaña virgen con senderos visitación turística de dos cataratas que se forman sobre la quebrada (i. 886 a 887). Con respecto a/ primer peritaje judicial indica que omitió /a valoración de centenares de especies maderables de alto valor comercial, algunos de 50 0 mas años de edad y otros de 5, 10 y 12 años plantados por la expropiada en e/ marco de programas de reforestación, que los de mayor edad y diámetro se ubican en la zona de protección de la Quebrada Hor y deben serle indemnizados, ya que e/ aprovechamiento de/ expropiante significaría un enriquecimiento sin causa, su valor paisajístico y conservacionista es mayor que e/ valor comercial, también fuera de las áreas de protección existen cientos de árboles más jóvenes que han sido plantados con fines comerciales. Agrega que un camino que comunica las dos secciones de la finca se corta e inhabilita con la expropiación y también corta un segundo camino que corre paralelo a la quebrada y se vería afectado por la segregación lo cua/ obligaría a/ expropiado a construir un desvío para reconectar/o a la red interna de caminos.

Manifestó que el proyecto de/ expropiante disminuiría e/ cauda/ de la quebrada disminuyendo /a capacidad hidrológica de la propiedad acabando con uno de sus principales atractivos turísticos además de acabar con la privacidad y exclusividad de/ lugar que atrae a los turistas. Adjunta foto de un árbol 'Fruta Dorada", dos de "cebo", fotos de/ camino interno, árboles de cebo de cinco años, otro árbol de cebo, vista panorámica, plantación de árboles de cebo, (i. 962 a 977). Considera que la valoración implícita esta prohibida por ley, que su propiedad es muy superior a cualquier otro fundo de la zona (i. 1270 a 1272). Con respecto a/ tercer perito en discordia indica que este valoró e/ terreno a expropiar sin haber ingresado a/ mismo. Que utilizó un referente que no se puede localizar en e/ campo y con un precio menor a/ que en realidad le corresponde (i, 1301 a 1316). Tampoco esta de acuerdo con la compensación que sugiere e/ perito Nombre164196 para e/ recurso forestal, ya que considera que tratándose de daños ambientales de carácter permanente e irreversible, con grave impacto en e/ resto de/ inmueble, considera injustificado e ilegítimo que la compensación se limite a los últimos siete años y no se proyecte a futuro (i. 1623 a 1624).

La pane actora manifestó con relación e/ primer peritaje judicial que e/ perito cree erróneamente que e/justiprecio debe ser superior a/ valor de/ mercado por tratarse de una expropiación, lo cua/ considera errado ya que se provocaría un enriquecimiento lícito. Indicó que los comparables que deben servir de base a/ estudio de mercado deben ser similares en área a/ lote a segregar y no similares con la totalidad de la finca, error cometido por e/ primer perito judicia/ que utilizó fincas desde 700 m2 hasta 115/ha. Explicó que ponderando valores de comparables comerciales similares a/ lote expropiado, e/ perito debió //egar a un valor de 44.495,41/m2. Indicó que e/ lote segregado representa apenas un 5% de/ área registrada y de un 3% considerando e/ área no inscrita y se encuentra en e/ fondo de /a finca cuyo único acceso es una ca//e de tierra no transitable más que a pie o en bestia, razones por las que no se podría afectar e/ remanente en un 70% ta/ y como lo propone e/ perito, cuya consecuencia significó que e/ daño a/ remanente es superior induso a/ valor de la finca.

También considera equivocadamente que la segregación de un área muy pequeña y localizada en e/ fondo de /a finca, en donde solo se afecta una porción de e//a, afecte toda /a finca incluyendo un área no inscrita (i. 1025 a 1030). Con fecha 1 de agosto de 2011, Nombre14912 presenta un estudio de/ avalúo administrativo y primer perito judicial, en la metodología y datos utilizados, en e/ cual se concluye que e/ avalúo administrativo presenta errores en e/ estudio de mercado, en e/ proceso de homologación y se encuentra desactualizado. E/ informe pericia/ presenta graves errores de forma y de fondo, en e/ proceso de homologación, considera equivocadamente que /a segregación de un área pequeña y localizada a/ fondo de /a finca, en donde so/o afecta una porción de e//a, afecte toda la finca incluyendo un área sin inscribir. Indica que la segregación solo le quita a toda la finca algún frente a ca//e secundaria en muy ma/ estado, se pierde una ínfima condición hídrica que no afecta e/ tota/ de la finca y mucho menos e/ área no inscrita.

Actualizando valores y corrigiendo errores de/ Avalúo Administrativo, estima /a idemnización tota/ en 452.733.165.85 (lote @23.627.600.00 daño a/ remanente 429.105.565,85) (i. 1032 a 1043). En fecha 13 de abril de 2012 Nombre14912 presenta un informe técnico para permiso de corta de árboles en áreas de protección (i. 1065 a 1136). Finalmente se muestra conforme con e/ informe de/ Ing. Nombre164194 . VIII. PRUEBA PARA MEJOR RESOLVER: En fecha 22 de febrero de 2017 la parte expropiada presenta resoluciones de/ Tribuna/ de Apelaciones en las cuales se menciona que e/ avalúo administrativo perdió vigencia y no pueden ser considerado para fijar e/ justiprecio, además que e/ precio de indemnización debe ser e/ más cercano a/ dictado de la sentencia, que la valoración de los cultivos o plantaciones debe hacerse en forma independiente, que en caso necesario e/justiprecio puede ser fijado con base en "antecedentes judiciales", para lo cua/ aporta /a Sentencia No. 218 - 2015, resolución de las siete horas diecinueve minutos de/ 27 de noviembre de 2009 en la que e/ Tribuna/ de Apelaciones fija contracaute/a, copia de/ peritaje técnico de/ Ing. Nombre164197 , criterio de la Procuraduría Genera/ de /a República que indica obligatoriedad de estimar daño a/ remanente en expropiaciones parciales, reserva de inconstitucionalidad de los fa//os de/ Tribuna/ de Apelaciones que reconocen legitimación activa de Nombre14912 para dictar expropiaciones (i. 1412 a 1508).

Como acto procesal, la sentencia firme conforma una realidad jurídica y materia/ que puede servir para acreditar un hecho en un proceso posterior, por ejen7p/o cuando se alega la cosa juzgada, cuando se hace valer /a prejudicial, cuando se invoca como título ejecutivo, cuando por su contenido queda vinculada a/ mecanismo de producción de precedentes judiciales. Todos estos supuestos, tienen sentido dentro de la realidad que describe Nombre164198, a/ señalar que "los medios de prueba son un fenómeno multifacético cuya naturaleza y definición varían de acuerdo con distintos factores históricos, culturales y jurídicos. Los sistemas probatorios han sufrido cambios profundos desde la época de los romanos; asimismo, las diferentes asunciones culturales acerca de/ conocimiento, la verdad y /a función de las decisiones judiciales han tenido una fuerte influencia en las concepciones de la prueba.

Y en este contexto, un factor adiciona/ de complejidad y diferenciación es que son muchas las cosas que se pueden usar como fuentes de prueba. Según la interpretación dominante de/ principio de relevancia, cualquier cosa que tenga significado o cierta utilidad en la búsqueda de la verdad sobre los hechos litigiosos puede ser usada - a/ menos en principio - como medio de prueba". En este sentido se acepta la prueba ofrecida por la parte para mejor resolver por tratar temas semejantes a los que se discuten en las presentes diligencias, y eventualmente podrían ser un referente e insumo para la resolución de las mismas. IX- FIJACIÓN DEL JUSTIPRECIO: La expropiación no puede generar un beneficio indebido ni para /a Junta que expropia ni para la parte que es expropiada; debe darse un equilibrio entre ambos. De conformidad con e/ artículo 45 de /a Constitución Política y e/ 30 de la Ley de Expropiaciones, estas diligencias judiciales, sirven para definir e/ precio justo de/ bien que e/ ente expropiante debe resarcir a/ expropiado, por lo que se busca dejar a las partes en igualdad de condiciones a las que tenían antes de que se produjera e/ hecho, de modo tal, que e/ desposeído, con e/ precio que se le asigne, pueda a/ menos compensar /o que le ha sido quitado, evitando de ese modo, un enriquecimiento injusto para cualquiera de las partes involucradas; por ese motivo es que procedemos a definir ese precio, una vez analizados los tres informes rendidos y e/ resto de argumentos y pruebas que constan en autos.

De los hechos probados y e/ dicho de las partes, se tiene que hay una imposibilidad de adoptar e/ monto establecido en e/ avalúo administrativo, debido a que esa valoración se encuentra desactualizada, e/ Avalúo Administrativo se confeccionó e/ 10 de agosto de 2007, e/ escrito de interposición de este proceso es de fecha de agosto de 2008, con lo cual es evidente que por e/ transcurso de/ tiempo los valores en e/ establecidos se han desactualizado, punto que además es confirmado por ambos peritos judiciales y por Nombre14912 con e/ estudio que realizó de/ avalúo administrativo y de/ primer peritaje judicial (i. 1032 a 1043), también esta circunstancia fue analizada y resuelta por e/ Tribuna/ de Apelaciones de lo Contencioso Administrativo, resolución No. 291-2013, a razón de un expediente muy similar a este que se refiere prácticamente a los mismos tiempos y e/ mismo proyecto, por lo que la fijación de/ justo precio deberá necesariamente sustentarse en los otros peritajes recibidos en autos para determinar si de e//os se puede derivar e/ precio correcto.

No obstante, para efectos de referencia e información, así como los criterios utilizados por la administración a /a hora de hacer sus valoraciones, se considera e/ Avalúo Administrativo como una pericia que refleja las circunstancias y condiciones existentes a/ momento de la valoración, por lo que /o contemplado en ella se mantiene a efectos de información y referencia. Es importante precisar que e/ área a expropiar es de 40.000 m2, ubicados a/ fondo de la propiedad, todos los informes coinciden en este punto, /a finca a expropiar tiene un área inscrita de 828.982.54 m2 y un área no inscrita de 721.124.79 m2, con esta área e/ tota/ sería de 1.550.107.33 072, es decir que e/ área a expropiar representa un 3% de/ área tota/ y un 5% de/ área inscrita. Siendo así las cosas, le corresponde a esta Juzgadora realizar un análisis exhaustivo de las experticias rendidas y la prueba aportada a los autos, con e/ objetivo de determinar si estas cumplen con los requisitos básicos establecidos en la Ley de Expropiaciones y verificar si e/ monto finalmente otorgado, es e/ justo; ante esa situación, se procederá a dividir e/ análisis en tres incisos: a) Valor de/ terreno; b) Daño a/ remanente y c) Recurso forestal, de /a forma que se explica a continuación: a) Valor del terreno: E/ primero de los rubros a valorar en esta sentencia, es e/ terreno a expropiar por parte de JASEC.

E/ Avalúo Administrativo de/ 10 de agosto de 2007, estableció e/ valor unitario de/ terreno en "05.00 m2 (solo como referencia); e/ perito Nombre164199 , en fecha 21 de Octubre de 2010 determinó e/ valor unitario en 41.843.00 m2 y e/ tercer perito en discordia, Nombre164194. , en fecha 26 de marzo de 2015, determinó e/ valor unitario en 4699.92 m2. Llama poderosamente /a atención la diferencia tan grande entre la valoración que realiza e/ Nombre164199. y e/ Nombre164194. , de @1.143.03 colones por m2. Esto se debe principalmente, a que e/ primer perito judicial obtiene e/ valor unitario con la homologación de dos referencias una de 155 ha y otra de 83 ha, según cuadro de homologación visible a imagen 943, lo idea/ en estos casos es que se utilicen áreas en rangos más próximos a/ de/ terreno a expropiar, para que la comparación sea válida, las áreas, utilizadas por e/ perito superan en más de/ doble de/ área de/ lote a expropiar.

Carece este informe de una debida comparación de los precios de/ entorno, no considera la suscrita que haya obtenido un valor homogéneo y usual conforme a la zona. Este perito judicial indicó que con e/ aporte de otros avalúos de la misma finca hechos en tiempo pasado, obtuvo e/ valor unitario por metro cuadrado de la finca expropiada (ver imagen 657). Lo anterior no resulta acertado pues /a normativa lega/ y técnica exige valores de mercado para deducir e/ valor correspondiente. Con dichas referencias confeccionó un cuadro de homologación e/ cual contiene a simple vista deficiencias técnicas que tornan errónea la valoración, pues nótese que todos los factores de ajuste o corrección son iguales a 1, que equivale a afirmar que las fincas comparadas son exactamente iguales a la valorada en todas las características comparadas (área, topografía, forma, exceso de fondo, acceso, ubicación, ley forestal, nivel de ca//e, comercialización) lo cual no es correcto, ya que aunque se trate de la misma propiedad, e/ objeto de valoración para efectos de la expropiación es un lote de 40.000 m2, lo que ya de por si las diferencia, además de se deben considerar las características propias de/ lote a expropiar, ya que es una expropiación parcia/ y no total, este lote puede tener características diferentes a las de/ resto de la propiedad.

En este sentido, solo por e/ factor de área debió ajustarse la referencia n 01 que tiene 155/ha de área, sea casi cuatro veces más grande que e/ lote segregado (ver imagen 663), considera la suscrita que no puede considerarse e/ precio establecido por este perito judicial. Por su parte, e/ Nombre164194. para determinar e/ valor unitario realizó una inspección física de/ área, determinando /a localización, condiciones de/ entorno, usos de/ suelo, tipo de cobertura, forma, topografía, servicios existentes, investigación de la oferta en la zona para áreas similares, consulta a vecinos, consulta a entendidos y su criterio. Con las referencias obtenidas, las condiciones particulares de/ inmueble, la cabida de/ área a expropiar y e/ método de homologación determinó e/ valor actualizado en @1.265.00 y este valor lo lleva a/ momento de/ avalúo administrativo mediante la utilización de una tasa de descuento, fijándolo en 4699.92 072 a/ momento de/ Avalúo Administrativo.

La parte expropiada cuestiona que este perito no visitó e/ terreno a expropiar y que se hizo acompañar de un desconocido, indica que incorpora información falsa, no obstante solo refiere como falso la identidad de la persona que le mostró la propiedad, no así los datos incorporados en su informe, cuestiona una de las referencias utilizadas, pero solo por esta duda no es posible considerar que sea falsa ni se puede inducir ta/ situación. Considera la suscrita que e/ informe presentado es serio y la información incorporada es correcta y creh/e, razón por la cua/ si será una pericia a considerar en /a determinación de/ precio, Otro dato aportado a los autos, es de/ estudio que realizó e/ Nombre164195. , a solicitud de JASEC, en este se determina un valor 4590.69 m2, tomando e/ valor dado en e/ avalúo administrativo y lo actualiza suponiendo un aumento de 30% por e/ tiempo transcurrido (i. 1043).

También tenemos como referencia e/ monto establecido en la Sentencia No. 39-2017-1 de/ veintisiete de enero de dos mi/ diecisiete de/ Tribuna/ de Apelaciones de lo Contencioso Administrativo, Sección Primera, en /a cual se definió un precio unitario de 42.000.00 m2 para una expropiación de 66.777.23 m2, de una finca ubicada en Marsella, necesaria para la construcción de/ Proyecto Hidroeléctrico Toro III. La fijación de/ valor de/ terreno expropiado en este caso, debe hacerse necesariamente a partir de circunstancias muy concretas. En primer lugar tenemos /a imposibilidad de adoptar e/ monto establecido en e/ avalúo administrativo, por /o ya expuesto, no es posible confirmar e/ valor dado en sede administrativa. Esto nos //eva a que /a fijación de/ valor de/ terreno deba necesariamente sustentarse en los otros peritajes recibidos en autos, los cuales nos darán los parámetros mínimos y máximos posibles, entre los cuales se deberá fijar e/ precio justo, Considerando además e/ principio de que e/ valor de reposición debe ser e/ más cercano a la fecha de /a sentencia.

En este sentido tenemos que e/ primer perito judicial fijo e/ monto 41.843.00 m2, no debería de fijarse un monto superior a este y e/ tercer perito en discordia fijo e/ monto en 4699,92 m2, por /o que este debería de ser e/ límite inferior en la fijación de/ valor, este sería e/ marco dentro de/ cual se debe de establecer e/ monto a indemnizar. No comparte la suscrita e/ valor determinado por e/ tercer perito en discordia establecido en "99.92 m2 en razón de como ya se dijo, e/ valor a/ momento de/ avalúo administrativo estaría totalmente desactualizado, por lo que no tendría sentido llevar un valor actua/ a esa fecha, estaríamos arrastrando e/ mismo defecto por e/ cual se descartado utilizar e/ valor de ese entonces. Por su parte, como ya se expreso supra, e/ valor obtenido por e/ primer perito judicia/ resulta inaceptable debido a los errores tanto de forma como de fondo de ese peritaje a/ momento de determinar e/ valor, No obstante, de/ trabajo realizado por e/ perito Nombre164194 en su informe, se obtuvo un valor actualizado de/ metro cuadrado en 41.265.00 m2, antes de aplicarle la ecuación para //evar ese valor a/ momento de/ avalúo administrativo, por la forma de obtener este valor y la metodología utilizada, considera la suscrita que es un valor real, actualizado y justo para ser utilizado como valor unitario a efectos de determinar /a indemnización en e/ presente caso.

Además de /o anterior, cumple con e/ requisito de ser e/ valor más cercano a/ dictado de la presente sentencia. En razón de todo lo anterior se establece como valor unitario @1.265.00 m2, por los 40.000.00 m2 de/ área a expropiar, nos da un monto de CINCUENTA MILLONES SEISCIENTOS MIL COLONES ($50.600.000.00) la suma que deberá cancelar Nombre14912 a la expropiada por concepto de/ valor de/ terreno de 40.000.00 m2. A/ tener un valor establecido en autos para e/ caso concreto, considerado por la suscrita como justo y correcto, no se considera necesario recurrir a precios fijados en resoluciones de casos similares. b) Daño al remanente: E/ principio básico de/ sistema de responsablidad se concentra en la no obligatoriedad de soportar e/ daño. De ta/ premisa se deriva que todo aquel daño que sufra una persona en sus derechos y que no esté en la obligación de soportar debe ser reparado de forma plena conforme a/ numera/ 41 constitucional.

Las características de/ daño para ser indemnizado, según la doctrina y jurisprudencia más calificada, estriban en su actualidad, efectividad e individualidad y su nexo de causalidad, esto es, la correlación que debe existir entre la causa y e/ efecto dañino. Con relación a/ daño a/ remanente resultante de una expropiación parcial, ta/ es este caso, e/ mismo se configura por /a afectación negativa a los atributos originales de la finca previos a la expropiación, de ta/ forma que los daños deben ser consecuencia directa de /a segregación o afectación operada, o sea, e/ nexo de causalidad de/ daño se encuentra en la misma expropiación o afectación per se. De lo anterior se deriva que toda afectación de derechos (daños) cuyo origen difiera de dicha causa (expropiatoria), no configura daño a/ remanente, sino, daños en sentido lato, que corresponden reclamar y determinar en otra VIS. E/ avalúo administrativo justificó este daño dado que la segregación afectará /a sección oeste de/ inmueble provocando una pérdida parcia/ de la Quebrada La Flor, así como un tramo de/ frente a ca//e pública (ver imagen 21).

Y consideró que la expropiación únicamente afectaba una sección de /a finca, esta sección tiene un área de 182.615.20 m2 y sobre esta sección es que se estima e/ daño a/ remanente, ya que es /a que sufre e/ impacto de la segregación, por su topografía y forma, la finca madre posee amplios sectores que no sufrirán ningún cambio brusco. E/ acceso se realizará por e/ camino público que será mejorado, lo que minimiza e/ impacto a la finca madre, e/ remanente en este supuesto, posee un área de 142.615.20 m2, perderá condición hidrológica y uno de los sitios con la topografía menos quebrada, seguirá contando con los servicios que posee la finca madre. E/ perito Nombre164199 , determinó e/ daño a/ remanente en 42.154.915.973,00; este perito indica que e/ resto de la finca se afecta en dos porciones, remanente A de 788.982.54 m2 en un 70% de su valor y e/ remanente B de 721.194.33 rn2 con un 80% de su valor, esto dispara e/ cálculo de/ daño a/ remanente a una suma a todas luces exorbitante, justifica la utilización de/ resto de la finca, considerando incluso e/ área no inscrita en razón de /a disminución de/ cauda/ de /a Quebrada /a Flor, para JASEC, esta consideración es errónea considerando que la finca tiene otras fuentes hidrológicas, varias quebradas y Río Toro, por lo que esta condición no afecta toda la finca.

Este perito no explica detalladamente la forma en qué determinó esos porcentajes de afectación, a simple vista resulta irrazonable que una supuesta disminución de/ cauda/ de la quebrada impacte e/ 70% u 80% de/ inmueble, considerando que e/ porcentaje que representa e/ área segregada es de un 4.82% de/ tota/ de la finca (avalúo administrativo imagen 14), motivo por e/ que además resulta desproporcionado dicho porcentaje. De/ informe de/ tercer perito en discordia no se observan errores o deficiencias, utiliza cuatro referencias con áreas que van desde los 4.000 m2 a 90.000 m2, no obstante utiliza e/ método de homologación y determina un valor unitario de 41.265, ese valor /o //eva a/ momento de/ avalúo administrativo e indica que e/ mismo corresponde a 4699.92 m2, para e/ daño a/ remanente estableció una afectación de/ 10% y consideró e/ área de afectación sobre e/ terreno inscrito. Por otra parte en cuanto a las manifestaciones de /a parte demandada con respecto a/ daño a/ remanente, las mismas carecen de razonabi/idad, pues en cuanto a /a dificultad de construir otros caminos internos en la propiedad dada las condiciones topográficas de/ terreno para unir dos secciones de la finca separadas por la quebrada, tanto por las condiciones topográficas como por las limitaciones de la ley forestal, queda c/aro que ta/ dificultad es causada por /a topografía de/ terreno además de las limitaciones de ley y que /a división de /a finca es por causa de la quebrada, dichas circunstancias no son consecuencia de la expropiación ta/ y como lo afirma la demandada.

De igual forma, a nada conduce e/ hecho de que la finca tenga caminos internos para e/ arreo de ganado o la visitación turística, en muy ma/ estado según e/ reconocimiento judicial, pues por causa de la expropiación no se deriva razonablemente que tales caminos no puedan continuar siendo utilizados para esos fines. Revisada la información que consta en autos, lo descrito en e/ reconocimiento judicial, no se deduce que la segregación de/ lote altere de manera brusca e/ quehacer habitual de la finca, le quita a /a finca algo de frente a ca//e secundaria en ma/ estado, proporcionalmente lo que se le esta segregando a la finca es un 4.82% con respecto a/ área tota/ inscrita. Para determinar e/ daño a/ remanente con mayor exactitud, se toma como correcta e/ área indicada como afectada en e/ Avalúo Administrativo de 182.615.20 m2, esto por cuanto es razonable que una finca de las proporciones indicadas con respecto a/ área a expropiar, no puede verse afectada en su totalidad por la segregación que nos ocupa, considerando además que es un sector de la finca hacia e/ fondo, afectará concretamente la sección oeste de/ inmueble, específicamente la margen izquierda de/ camino interno, esta sección tiene un área de 182.615.20 m2 y sobre esta sección es que se estima e/ daño a/ remanente, ya que es /a que sufre e/ impacto de /a segregación, por su topografía y forma, /a finca madre posee amplios sectores que no sufrirán ningún cambio, esta segregación representa un 4,82% de/ área tota/ de la finca, por las características de/ terreno, e/ uso actua/ y las condiciones dadas, se considera razonable utilizar para efectos de este extremo de indemnización e/ área realmente afectada determinada en e/ Avalúo Administrativo.

Coincidiendo con e/ tercer perito en discordia en cuanto a/ porcentaje de afectación, e/ cual estima esta juzgadora en un 10% considerando los cambios en e/ recurso hídrico, afectación a/ área cercana y a/ frente e/ cua/ disminuye en 84.69 metros de los 618.97 metros que tiene la propiedad en total. Se considera este porcentaje en e/ entendido de que no se limita e/ uso de suelo actual ni las actividades que en e/ inmueble se realizan. No //eva razón /a expropiada a/ afirmar que la finca expropiada pierde privacidad y exclusividad, en primer término por cuanto e/ remanente continuará siendo propiedad privada, ya que continuará bajo dominio privado de/ expropiado y en segundo término por cuanto no se ha demostrado la pérdida de algún valor exclusivo de/ inmueble. Atendiendo a/ objeto de la expropiación, e/ cual es /a segregación de un terreno, se considera apropiado e/ método de/ "antes y después", utilizado por ambos peritosjudiciales, pero con los valores que se han definido en la presente resolución, propiamente e/ valor unitario establecido en e/ punto anterior, Siendo así las cosas, y con e/ valor unitario definido en e/ punto anterior en @1.265.00, se procede a calcular e/ daño a/ remanente.

Área 182.615.20 m2 x @1.265.00 = valor tota/ @231.008.228.00. valor de/ área a expropiar: Área 40.000.00 m2 x 41.265.00 = @50.600.000.00. Valor de/ área remanente: Área 142.615.20 1772 x 41.138.50 = 4162.367.405.00. se estable en DIECIOCHO MILLONES CUARENTA MIL OCHOCIENTOS VEINTITRÉS COLONES @18.040.823.00) e/ monto que deberá cancelar Nombre14912 a la expropiada en razón de/ daño a/ remanente. c) Recurso forestal: Este no es un rubro que se haya considerado inicialmente en e/ Avalúo Administrativo, no obstante la expropiada lo expresa como una de sus inconformidades. En e/ recorrido de/ Reconocimiento judicial se indicó que se obsen'an "árboles dispersos en e/ potrero, que según indicaciones de los comparecientes son árboles maderables plantados como parte de reforestación de la propiedad, entre los cuales se encuentran especies como Cávano y cedro", también se indicó que existen árboles a/ margen de la quebrada.

A/ respecto y ante e/ requerimientos en la tramitación de/ proceso, Nombre14912 presenta un informe técnico de cona de árboles en áreas de protección para la toma la Flor (i. 1067 a 1071). Con fecha 7 de julio de 2017, ante requerimiento de/ Juzgado, presenta estimación de la indemnización de/ recurso foresta/ en e/ cual se determina que los árboles ubicados en la zona protegida no son indemnizab/es por no ser comercializables, fuera de esta área existen 6 árboles, los cuales para /a fecha de la puesta en posesión no poseían un diámetro superior a los 30 cm, razón por la cua/ no eran comercializables ni presentan evidencia de haber sido plantados por e/ propietario ni este posee pago de servicios ambientales, por lo que no procede indemnización alguna. Por su parte la expropiada considera que más que e/ valor comercia/ es la afectación dado que la finca se dedica a/ ecoturismo e/ valor paisajístico y conversacionista de esos árboles es /o que pretende le sea resarcido.

A/ respecto es importante considerar que e/ Patrimonio Natura/ de/ Estado también está compuesto por la fauna y la flora silvestre, e/ artículo 40 de la Ley de Conservación de Vida Silvestre (LCVS) establece la demania/idad de la flora y fauna silvestre, la cual constituye un recurso natura/ renovable y forma parte de/ patrimonio nacional. Sobre la base de pertenencia a/ Estado, por la importancia ecológica y cualidades físicas, e/ legislador afecta en bloque sus bosques y terrenos forestales, imprimiéndoles en forma genérica /a condición de dominio público, inalienabilidad e imprescriptibilidad con miras a su conservación, protección, administración adecuada y fomento. A/ efecto nuestra Sa/a Constitucional en sentencia N04587-97 indicó que 'La propiedad foresta/ se concibe fundamentalmente para conservar, no para producir, ni ser parte de/ comercio de los hombres". De conformidad con e/ régimen forestal, los bosques son Patrimonio Natura/ de/ Estado y están dispuestos a un fin público de conservación y sometido a un régimen jurídico de naturaleza demanial.

E/ Titulo Tercero de la Ley Foresta/ regula e/ manejo de bosques en propiedad privada, estableciendo Io siguiente: ARTICULO 19.Actividades autorizadas. En terrenos cubiertos de bosque, no se permitirá cambiar e/ uso de/ suelo, ni establecer plantaciones forestales. Sin embargo, la Administración Foresta/ de/ Estado podrá otorgar permiso en esas áreas para los siguientes fines: a) Construir casas de habitación, oficinas, establos, corrales, viveros, caminos, puentes e instalaciones destinadas a la recreación, e/ ecoturismo y otras mejoras análogas en terrenos y fincas de dominio privado donde se localicen los bosques. b) Llevar a cabo proyectos de infraestructura, estatales o privados, de conveniencia nacional, c) Cortar los árboles por razones de seguridad humana o de interés científico. d) Prevenir incendios forestales, desastres naturales u otras causas análogas o sus consecuencias. En estos casos, la corta de/ bosque será limitada, proporciona/ y razonable para los fines antes expuestos, Previamente, deberá llenarse un cuestionario de preselección ante la Administración Foresta/ de/ Estado para determinar la posibilidad de exigir una evaluación de/ impacto ambiental, según lo establezca e/ reglamento de esta ley".

De dicha norma se extrae la imposibilidad de cambiar e/ uso de suelo de/ bosque, su comercialización se encuentra prohibida y la única forma de cortar árboles es mediante e/ cumplimiento de los presupuestos de/ inciso c) de dicho artículo, lo cua/ no es un presupuesto de hecho demostrado en e/ caso concreto, en este sentido la expropiada nunca tuvo derecho a comercializar la madera de bosque por tanto no resulta un activo indemnizab/e, Es cierto que /a administración no /o consideró a la hora de hacer la estimación como un rubro individual, y consecuentemente los peritos nombrados tampoco, dado que se limitaron a revisar lo valorado en e/ avalúo administrativo y no observaron que fuera un rubro a indemnizar de forma independiente. La expropiada requirió e/ nombramiento de un perito foresta/ para /a valoración de este recurso, no obstante indicó que en realidad no es e/ valor comercia/ de/ recurso lo que /e interesa, sino e/ daño ocasionado a/ paisaje y actividad que realiza en la finca a propósito de los árboles cortados para la construcción de/ proyecto.

En e/ proceso se les requirió a los peritos nombrados y a la administración revisar este punto y de ser rea/ se ampliaran los peritajes en este aspecto. La Administración reitera su consideración de que no es un rubro va/orab/e e indemnizab/e, E/ perito Nombre164199 , se aparta de/ criterio de la administración e indica que la valoración de ese recurso tiene que darse desde e/ punto de vista de/ impacto económico ambiental, para /o cual aplica método de sustitución de rentas porque e/ recurso foresta/ fue destruido, y en si no tiene un valor comercial. Estima un pago compensatorio anua/ de ",99355373 que inicialmente multiplica por 7 años que es e/ tiempo que ha transcurrido desde e/ momento de su visita, para una indemnización tota/ de @27.954.876.14, Posteriormente amplia a IO años, indicando que /a doctrina financiera indica que las proyecciones económicas deben tener un tiempo mínimo de 3 años y un máximo de 10 años, sin justificar la razón de su estimación y de/ plazo.

La expropiada tampoco estuvo de acuerdo con la compensación que sugiere e/ perito Nombre164196 para e/ recurso forestal, ya que considera que tratándose de daños ambientales de carácter permanente e irreversible, con grave impacto en e/ resto de/ inmueble, considera injustificado e ilegítimo que la compensación se limite a los últimos siete años y no se proyecte a futuro. Ta/ pretensión de la expropiada es imposible de satisfacer, primero no se ha demostrado ta/ daño, tampoco se ha individualizado ni cuantificado, es decir, durante todo e/ tiempo transcurrido en la tramitación de este proceso, /a expropiada no ha acreditado fehacientemente cuál es e/ daño que ha sufrido en su actividad comercia/ a propósito de la expropiación, no hay ningún indicio que realmente acredite que esto se dio o ha sucedido, la compensación que pretende proyectada a futuro, por imperativo lega/ es imposible de otorgar, e/ daño debe ser rea/ y permanente, y durante todo este tiempo que ha transcurrido, de haber ocurrido realmente las afectaciones y daños que alega, pudo haberlos acreditado, /o cual no sucedió.

Por lo que la suscrita concluye que este aspecto no es un rubro que se deba de reconocer ni indemnizar. Por otra parte, en razón de que por la finca expropiada pasa una quebrada, debemos analizar e/ régimen jurídico de las zonas de protección, las cuales constituyen una categoría de manejo de áreas silvestres protegidqs, reguladas en la Ley Foresta/ Placa33524 y en la cual se definen como: "Artículo 33.- Areas de protección. Se declaran áreas de protección las siguientes: (...) b) Una franja de quince metros en zona rural y de diez metros en zona urbana, medidas horizontalmente a ambos lados, en las riberas de los ríos, quebradas o arroyos, si e/ terreno es plano, y de cincuenta metros horizontales, si e/ terreno es quebrado. Desde e/ punto de vista de los derechos reales, se puede señalar que se trata de una limitación a la propiedad, en razón de la función socia/ que desempeña a la luz de la doctrina de/ artículo 45 de la Constitución Política.

E/ fin primordial de las áreas de protección, es preservar y proteger e/ recurso hídrico, ante e//o, los árboles se constituyen e/ medio esencia/ para dicho cometido en razón de su importancia capita/ en /a protección de/ agua. Sin árboles, los manantiales de cuyas aguas nacen los ríos se secan. E/ artículo 34 de la Ley Foresta/ establece /a prohibición de cortar árboles en las áreas protegidas, con excepción de los proyectos declarados por e/ Poder Ejecutivo como de conveniencia nacional, lo cual se dio en e/ caso que nos ocupa e implica que a/ no estar dispuestos sus recursos a/ comercio de los hombres, tampoco resultan indemnizab/es. Dado lo anterior se debe rechazar la indemnización pretendida por e/ expropiado de los árboles que forman parte de /a zona de protección de la quebrada La Flor, Por otra parte, fuera de la zona de protección que es en esencia un potrero, se identificaron únicamente dos árboles de especies maderables comerciales (ver inventario foresta/ I. 825) e/ cual indica que: " De acuerdo con e/ Cuadro 6, dos de los árboles son de carácter comercializable (28.6%) y abarcan las dos categorías diamétricas, y corresponden a la especie cebo, mientras que los guarumos representan e/ 71,4% de los árboles, en cuanto a/ volumen (cuadro 7) m3 e/ 50.8% sería comercializable (0,7338).

Estos árboles en principio deberían indemnizarse pues no existe ninguna limitación lega/ para su explotación, sin embargo, la parte expropiada ha indicado que no es e/ valor comercia/ lo que le interesa, sino e/ daño ocasionado con la tala de los mismo a/ paisaje y efecto en su actividad comercial, daño que no fue demostrado ni acreditado en autos. Considerando además que la existencia de un potrero con dos árboles de especies maderables comerciales en un área de 4/ha, no constituye un factor relevante o diferenciador que afecte e/ valor de mercado, puesto que es una característica común de los inmuebles de la zona. Viendo lo anterior desde e/ punto de vista matemático, en un cuadro de homologación cuando las comparables cuentan con la misma característica o constante, e/ factor de corrección es siempre igual a 1 lo cua/ significa que no hay ajuste por dicho concepto y por tanto no es un factor que influye en e/ precio.

En consecuencia corresponde rechazar la indemnización pretendida de/ recurso foresta/ y a/ no existir prueba que demuestre /a pérdida de/ pago por servicios ambientales, este no es un daño rea/ que deba ser indemnizado. Se fija en SESENTA Y OCHO MILLONES SEISCIENTOS CUARENTA MIL OCHOCIENTOS VEINTITRÉS COLONES ("8.640.823,00) la indemnización tota/ que deberá de cancelar Nombre14912 a CASCADAS DEL TORO S.A. por la expropiación de un terreno de 40.000 m2 de la finca matrícula Placa6827. xr- COSTAS E INTERESES: Respecto a las costas procesales y personales, asícomo de los intereses, se condena a la Nombre14912 a/ pago de los intereses sobre la diferencia entre e/ avalúo administrativo y e/ justiprecio de conformidad con e/ numera/ 11 de la Ley de Expropiaciones; a partir de la puesta en posesión, acaecida e/ 15 de junio de 2010, y hasta e/ efectivo depósito de la diferencia recién indicada.

En relación con las costas, a/ tenor de/ numera/ 193 de/ Código Procesa/ Contencioso Administrativo, no encuentra la suscrita ninguna excepción para eximir en costas a la expropiante quien obliga a/ expropiado a ejercer su defensa en estrados judiciales mediante patrocinio letrado, por lo que se le condena a/ pago de ambas costas de este proceso." (ver expediente digital).

IV. SOBRE EL FONDO DEL ASUNTO

Un aspecto que no puede dejar de notar el Tribunal es que tratándose de expropiaciones de fundos grandes o rurales, como es el caso, la fijación del precio se debe realizar por hectárea y no por metro cuadrado, en ese sentido, el avalúo administrativo cumple con ese requisito (aún cuando hace una referencia al valor por metro cuadrado, dividendo el precio por hectárea por diez mil), no así los peritajes judiciales que hacen su análisis por metro cuadrado, lo que técnicamente no es procedente. Ahora bien, pese a esa deficiencia, es criterio de los suscritos que deben tomarse en cuenta dichos estudios como insumos, en tanto que de lo contrario dejaría a la parte expropiada sin elemento para contradecir el importe ofrecido en el avalúo administrativo, que es exactamente la base del proceso. Por otro lado, no puede dejar de mencionarse, que al igual que la juzgadora de primera instancia, nos preocupa de sobremanera que entre los diferentes valores ofrecidos por los expertos se denotan rubros abismalmente diferentes, totalmente injustificables a simple vista.

No es posible explicar como las fincas cercanas o relacionadas tienen valores tan diferentes, como razonó la señora juzgadora de primera instancia. La a quo llega a la conclusión que impera una falta de credibilidad de los valores sustancialmente alejados, Io que desde el plano lógico no es es una conclusión irrazonable. Este órgano solo puede encontrar una justificación valida para esta situación, que se extrae de los mismos peritajes como inferencia deductiva, es evidente que dentro de la zona por las condiciones agrícolas, la belleza del paisaje y situaciones parecidas de la región se logran ubicar diferentes tipos de terrenos; así conviven tres tipos muy diferentes de fundos, por un lado el agrícola ganadero, por el otro, una serie de fincas de recreo, al mejor estilo de quintas, con áreas cercanas a una hectárea y por último, los terrenos correspondientes a viviendas, con cabidas de alrededor de un par de cientos de metros cuadrados.

Es incuestionable que la zona es de una importante producción agrícola, un clima atractivo y un paisaje comercializable, lo que permite que esas actividades subsistan, siendo determinante los accesos, los servicios y en especial, la tenencia del agua. Esto explica el motivo por el cual el primer experto judicial describe la zona como turística (lo que por cierto no justifica o motiva, mientras el avalúo administrativo habla de una zona agrícola), y como dice la juzgadora no se aportan elementos para arribar a esa conclusión (como declaraciones de renta, informes a la Municipalidad, informes del ICT o cualquier otro aspecto que permita deducir que esa era la actividad económica de esa finca). Eso lleva a nuestro entender que se está utilizando criterios para zonas de recreo cuando debieron utilizarse los referentes a zona agrícola ganaderos. Esa conclusión la extrae este órgano jurisdiccional del mapa de zonas homogéneos y valores diferenciados que presentan los lotes en la misma zona.

Así es, como los valores oscilan diametralmente opuestos pues en algunos casos se esta tratando de fincas agrícolas y en otras fincas de recreo; dejamos de lado los fundos para construcción de vivienda, en tanto que tienen cabidas más pequeñas y se ubican dentro de las áreas más pobladas. Al respecto no hay prueba de que la finca madre, base de la expropiación, como el área que está expropiando, sean fincas de recreo; además la cabida y los servicios impiden considerar tal cosa; ni siquiera en la teoría del caso de la parte expropiada se sostiene una tesis semejante. En conclusión de lo expuesto, los valores correspondientes a fincas de recreo no son aplicables al presente caso. Mucho menos es posible aplicarle los valores correspondientes a zonas urbanas para la construcción de viviendas. Igualmente, tiene razón la juzgadora que el primer peritaje se encuentra mal confeccionado, en la medida en la cual pretende dar la sensación de haber realizado un trabajo muy ajustado a la técnica buscando valores de mercado de algunos referentes, y posteriormente utiliza el método multifactorial.

Lamentablemente, a la hora de utilizar este método le otorga un valor de 1 a todos los factores de castigo y valoración que establece la formula, cuando la lógica es que ese valor únicamente corresponde a aquellos comparables que sean idénticos al lote "tipo" utilizado como base de esa metodología. De esa manera, el solo hecho de que los comparables tengan una dimensión diferente del lote tipo, implicaba que tenía que asignarse un valor diferente de uno (hacia arriba o hacia abajo según fuera el caso) pues eso equivale a que el lote comparado y el tipo son idénticos lo que no es posible; lo que en este caso no se hizo, y por corresponder la asignación a una valoración que al perito asignar, este Colegio no tiene un dato o un insumo para identificar cual es la variable correcta para cada caso. Ese aspecto debió ser señalado por las partes al momento de presentarse la experticia, pidiendo aclaraciones y adiciones al informe, hasta lograr enderezar el instrumento de forma que resultara útil, pero al no tomarse ese camino, el resultado es que el peritaje se torna poco fiable para los fines de establecer un precio.

No está demás decir, que ya en ocasiones anteriores se ha señalado que el método multifactorial, si bien no es el único instrumento para fijar un precio de un bien a expropiar, tiene la virtud de exponer muchos elementos, y procurar hacer que dos bienes con diferencias importantes puedan compararse; pero para poder cumplir este fin, el método y los criterios (el elemento más cuestionable) deben ser empleados correctamente, con su sustento técnico. Por último, tiene razón la juzgadora, en señalar que tanto los peritajes como el avalúo, utiliza varios referentes de zonas no cercanas, en tanto que la descripción de los referentes arrojan esa conclusión; incluso, como puede verse en los agravios nada dice la parte recurrente para combatir lo indicado por la juzgadora sobre ese particular y que es el motivo por el cual desecha todos los informes periciales y tampoco acepta el avalúo, al considerarlos incapaces de generar alguna convicción.

Eso llevo a la juzgadora a tener que tomar algunos aspectos del tercer peritaje, que en prudencia parecen corresponder a lo más razonable para fijar el justiprecio, así como de haberse confeccionado en data reciente. Reiteramos, que todos estos aspectos apuntados por el juzgado de primera instancia se mantienen, a la fecha, y generan un mayor nivel de dificultad para resolver la litis y peor aún no son motivo de agravio alguno por parte de la expropiada apelante. En ese sentido, la conclusión de la juzgadora de primera instancia sobre la necesidad de excluir todos esos factores por sus deficiencias se mantienen a la fecha, de allí que no se posible aceptar uno solo de los estudios para poder establecer el importe total de la indemnización a la hora de dictar la presente sentencia. Ahora bien, siguiendo el orden de los agravios expuestos por el recurrente a viva voz (no lo expuestos de forma escrita que son más amplios) en aplicación del canon ciento treinta y tres del Código Procesal Contencioso Administrativo que determina que los agravios se exponen a de manera oral frente al Tribunal, se obtiene lo siguiente:

  • 1)Valor unitario por M 2 . Para fijar el justiprecio, la jueza acogió el avalúo del perito tercero en discordia, Nombre164194. , que determinó un valor unitario de Cl.265 M 2, siendo que dicha experticia utiliza como cuarta referencia un valor unitario sería de C7.112.50 M 2, como lo muestra el "Informe de Revisión de Avalúos" rendido por el Lic. Gerardo Hidalgo, aportado como prueba para mejor resolver. Del cotejo de los datos del informe pericial, se evidencia que la sentencia utiliza para resolver el conflicto, el tercer peritaje en discordia, el cual toma como una de sus referencias el punto de ubicación Dirección19664 que corresponde al Parque Nacional Juan Castro Blanco con un valor por metro cuadrado de 250 colones, siendo lo correcto, el Dirección19665 cuyo valor por metro cuadrado presenta dos montos Q1.500 colones para el lote tipo de 7500 metros cuadrados y quince mil colones (C15.000) para lotes tipo de 200 metros cuadrados, teniéndose en cuenta que éste último lote es urbano. En este caso estamos frente a un fundo rural, lo que obliga que el metro cuadrado que debe utilizarse es de mil quinientos colones Q1.500) por metro cuadrado. Es de precisar que según el mencionado experto, Nombre164194 , en atención al valor por metro cuadrado, se castiga el importe en un diez por ciento, en razón de la diferencia del terreno objeto expropiado con relación al lote tipo, véase que el terreno a expropiar es de cuatro hectáreas y el lote tipo de las zonas homogéneos, es de siete mil quinientos metros cuadrados, se trata de quintas de recreo. El terreno afecto al interés público es tres veces más grande que el lote tipo. Consecuencia de lo dicho, el castigo del diez por ciento expuesto por el perito se presenta justificado, lo que obligaría a mantenerlo. Eso llevaría que el metro cuadrado sería de mil trescientos cincuenta colones por metro cuadrado (Q1.350,00m2). La parte recurrente espera sustituir este valor por el cuarto valor de referencia del tercer peritaje en discordia y con ello derivar el valor por metro cuadrado que debe ser aplicado para el caso concreto, tesis que no es compartida por este Tribunal. Puede verse que la primera referencia de ese peritaje es de cuatro mil metros cuadrados, el segundo de dos hectáreas, dos mil metros cuadrados y nueve hectáreas, siendo evidente que se trata de áreas muy discrepantes entre sí, incluso los valores de homologación se tornan diametralmente diferentes sin una justificación lógica. El Tribunal no logra ubicar una explicación de los diferentes factores de castigo, las partes no pidieron aclaración al respecto y la Cámara no tiene elementos para justificar esos aspectos. Aceptar los demás criterios de ese peritaje (a excepción del valor de zonas homogéneas con su correspondiente castigo) daría pie a sustentar una resolución sin tener un factor técnico de respaldo. Por otro lado, si comparamos la sumatoria con el valor de zonas homogéneas, daría un rubro semejante a un terreno urbano, superior al de una ciudad y no puede olvidarse que estamos en una finca rural. La lógica obliga a concluir que lo pretendido por el recurrente tiene por pretensión recibir el precio más alto posible, no tiene un sustento sobre la base de esos porcentajes. Amén de lo dicho, los factores indicados por la juzgadora para restarle credibilidad al experto, como un todo, resultan aplicables, motivo por el cual, el único valor rescatable es el correspondiente a zonas homogéneas ya indicado. La Cámara comprende que dicho valor esta diseñado para fines tributarios y no para establecer indemnizaciones, pero es el único rubro de los indicados por los expertos que no puede ser invalidado y que presenta su correspondiente sustento. Por otro lado, la parte expropiada tiene razón en señalar que esta expropiación ha tomado un tiempo exagerado en ser resuelta y tiene el derecho que el conflicto se resuelva definitivamente (en vía expropiatoria) a partir de los insumos que constan en el expediente. El otro peritaje no es de utilidad sobre las bases indicadas por la juzgadora de primera instancia, que no fueron combatidas, al igual que el avalúo administrativo. Consecuencia de lo dicho, este Tribunal opta por rechazar el peritaje que invoca el recurrente, utilizando únicamente el valor de zonas homogéneas con los aspectos ya indicados, en tanto que es invocado por la misma parte expropiada. Dicho valor de mil trescientos cincuenta colones aplicado por la cantidad de metros expropiados (cuatro hectáreas) genera un total de CINCUENTA Y CUATRO MILLONES DE COLONES (C54.OOO.OOO), fijándose el valor del terreno expropiado en ese importe. Dicho rubro resulta razonable y proporcional al daño recibido por la sociedad expropiada, sin generar un enriquecimiento injusto y desproporcional.
  • 2)Daño al remanente: Para indemnizar el daño al remanente, sostiene el recurrente que la jueza descartó el avalúo y los dos peritajes allegados al expediente, y optó por inventarse una fórmula propia, para establecer un monto que es mucho menor a lo que, en este rubro, trece años atrás estableció el propio Avalúo Administrativo del Nombre9574 412-2007. Sobre este aspecto, es de precisar que el avalúo administrativo fijo el daño al remanente en la suma mientras que la sentencia se otorga la suma de dieciocho millones cuarenta mil ochocientos veintitrés colones @18.040.823.00), de manera que lo otorgado en sentencia es mayor que lo ofrecido en el avalúo administrativo. Con respecto al método del antes y el después utilizado por los peritajes como medio para fijar el daño al remanente, si bien dicho método es idóneo (advirtiendo que para fijación de una indemnización no existe un método, sino múltiples métodos, donde aquel ideal para un caso puede no funcionar para otro) para este fin, es manifiesto que los peritajes están utilizando los valores del terreno sobre la base de fincas de recreo y no agrícolas o ganaderas como es el caso que nos ocupa, sobre las bases explicadas en el punto anterior. En ese sentido, al igual que que la juzgadora de primera instancia, el Tribunal arriba a la conclusión que los peritajes en este caso no son de utilidad para fijar el daño al remanente. Véase como los valores utilizados del "antes y el después", parten en ambos casos, de valores exagerados, solo justificables si la afectación correspondiera a fincas en ubicaciones diferentes, posiblemente en áreas urbanas y no esa no es la realidad a la que nos enfrentamos. Por otro lado, la forma de obtener el rubro del daño al remanente que señala la sentencia está muy lejos de ser una formula inventada por la juzgadora de primera instancia, como lo indica el agravio. Básicamente, al no poder utilizar el método del antes y el después de los peritajes por utilizar comparables de dudosa credibilidad, tomó el camino de utilizar las bases de la formula expuestos en el peritaje administrativo. De manera que no estamos frente a una formula de creación injustificada, sino de aplicación de un método señalado por el avalúo, reemplazando los valores en beneficio del expropiado. Así el método utilizado no es impropio, ilegal o contrario a la legalidad. Realizada esa aclaración, tenemos que el avalúo administrativo fija el daño al remanente sobre un área de 182.615.20 m2 y no sobre el total de la finca, cabida que no es desvirtuada por ninguno de los expertos judiciales; aún cuando no es compartida por ellos, en tanto ubican la finca como una integridad y consecuentemente arriban a la conclusión que debe indemnizarse la totalidad de la finca como afectada por la expropiación. Ya en otra ocasiones, esta Cámara ha señalado que ese razonamiento es falaz, en tanto, bien puede ser que por la ubicación del terreno expropiado es totalmente posible que la afectación al remanente no sea sobre el total sino solo sobre espacios de este. El establecer que toda la finca es la que presenta daño al remanente debe justificarse, lo que en el caso se presume, bajo la óptica de que se trata de un proyecto ecológico ambiental, postura que ya hemos desacreditado consistentemente. No existen las bases suficientes para poder sostener que estamos frente a un proyecto ecológico ambiental, como de forma consistente lo ha sostenido el expropiado, como se ha señalado, no existen datos tributarios, municipales, ante el Ministerio del Ambiente y Energía, ni otro dato aportado, que permite sostener de manera categórica que antes de la expropiación existía un proyecto de tal naturaleza antes de la expropiación y en esas condiciones no es posible indemnización alguna. Eso nos lleva necesariamente a que estamos frente a un terreno agrícola ganadero, como lo señaló el avalúo administrativo. Para entender que el daño al remanente sea mayor a la misma expropiación debe estar técnicamente justificado. En esa condición este Tribunal toma esa área como la efectivamente afectada por la expropiación conforme con lo indicado por el avalúo administrativo (que como ya indicamos no ha sido desvirtuada) y no la totalidad de la finca. Como ya se expuso, este Tribunal considera que el valor por metro cuadrado es de para esta expropiación y el avalúo administrativo señaló que el daño al remanente se extiende por un área de 182.615.20 m2. Si bien algunos peritos discrepan de esa área, lo cierto es que no establecen un criterio técnico que permita desvirtuar dicha espacio de metros cuadrados, según lo expuesto. La simple multiplicación de los metros cuadrados por el valor por metro cuadrado genera como total el importe de Rubro que correspondería si fuera que ese terreno a expropiar, lo que en la especie no se da, lo que se pretende es indemnizar el daño al remanente y no expropiar esa porción de tierra. Si bien los peritajes utilizan como referencia que debe indemnizarse el daño al remanente en un cien por ciento (100%) pero lo cierto es que la finca no esta perdiendo el total de su valor, y no existe desapoderamiento, el expropiado seguiría ejerciendo los atributos de la propiedad sobre esa área de terreno al igual que sobre la demás finca que no esta afectada por la expropiación, con la única salvedad que esa porción del inmueble presenta un menoscabo de su valor comercial que debe ser indemnizado (el daño al remanente) motivo por el cual este planteamiento debe rechazarse. El criterio administrativo se orienta a señalar una afectación de alrededor del diez por ciento, posición que parece lógico dentro de un área de daño tan amplia, lo que genera un monto total de daño al remanente en razón de veinticuatro millones seiscientos cincuenta y tres mil colones cincuenta y dos colones (424.653.052,00) importe en el cual se fija el daño al remanente. Nuevamente, estamos frente a un valor que resulta razonable, proporcional y ajustado a las condiciones generales del daño sufrido; sin que produzca un enriquecimiento injusto para la parte expropiada,
  • 3)Daño forestal y ambiental. Expone el recurrente que la jueza de instancia rechaza reconocer suma alguna por el daño forestal y ambiental sufrido por la Reserva Natural Cascadas del Toro, a causa de la expropiación decretada en su contra por JASEC; para ello se basa en un "estudio"realizado por técnicos del Nombre9574 en junio de 2017, siete años después de que el terreno expropiado había sido dado en posesión a la Alianza ICE-JASEC y cuatro años después de que la captación para el P.H Toro 3, obra que motivó la expropiación, había quedado completamente construida y estaba en operación. Es decir, en este ámbito, la jueza ignoró el acta de reconocimiento judicial de junio de 2010, un levantamiento topográfico realizado por técnicos del Nombre9574 en marzo de 2010 para determinar de modo específico los impactos ambientales del PH Toro 3 en la finca Cascadas del Toro S.A; y un inventario forestal elaborado por el MINAE en el 2011, dentro de la tramitación de un permiso para talar árboles; todas pruebas documentales que coinciden en reconocer la abundancia de árboles existentes en el área al momento de la expropiación. En su lugar, acogió un informe oficial de la administración expropiante, al que de manera ilegal se le dio carácter de "adenda de/ avalúo administrativo" en agosto de 2017, sea mucho tiempo después de que los árboles a inventariar e indemnizar habían sido cortados (violación directa a la garantía constitucional de indemnización previa y al artículo 24 de la Ley de Expropiaciones expone el expropiante). Y eso después de que la Alianza ICE-JASEC durante seis años, desde febrero de 2011, desobedeció los múltiples y reiterados pedidos del Juzgado Contencioso para que aportara la información requerida sobre el daño forestal y ambiental causado a Cascadas del Toro. De igual modo, la sentencia recurrida ignora que Nombre14912 se allanó a la valoración que, sobre este extremo y por orden del juzgado de instancia, realizó el perito Nombre161016 , en octubre de 2017, en el que determinó un daño forestal y ambiental por C 39.935.537,30 millones. Decimos, indica el recurrente, que el ente expropiante se allanó a este avalúo porque en una primera audiencia se limitó a cuestionar los honorarios liquidados por el perito, sin objetar una sola línea de su informe, y en una segunda audiencia, a raíz de una ampliación de la pericia, se abstuvo por completo de contestar, según señala el recurrente. Para el rechazo de ese extremo la juzgadora consideró lo siguiente: a) Ese un rubro no fue considerado en el avaluo inicial. b) El Reconocimiento judicial se indicó que se observan "árboles dispersos en el potrero, que según indicaciones de los comparecientes son árboles maderables plantados como parte de reforestación de la propiedad, entre los cuales se encuentran especies como Cóbano y cedro", también se indicó que existen árboles al margen de la quebrada. c) Ante el requerimientos en la tramitación del proceso, Nombre14912 presenta un informe técnico de corta de árboles en áreas de protección para la toma la Flor. d) Con fecha 7 de julio de 2017, ante requerimiento del Juzgado, acredita estimación de la indemnización del recurso forestal en el cual se determina que los árboles ubicados en la zona protegida no son indemnizables por no ser comercializables, fuera de esta área existen seis árboles, los cuales para la fecha de la puesta en posesión no poseían un diámetro superior a los 30 cm, razón por la cual no eran comercializables ni presentan evidencia de haber sido plantados por el propietario ni este posee pago de servicios ambientales, por Io que no procede indemnización alguna. Posteriormente, concluye literalmente: "Ta/ pretensión de la expropiada es imposible de satisfacer, primero no se ha demostrado ta/ daño, tampoco se ha individualizado ni cuantificado, es decir, durante todo e/ tiempo transcurrido en la tramitación de este proceso, la expropiada no ha acreditado fehacientemente cuál es e/ daño que ha sufrido en su actividad comercia/ a propósito de la expropiación, no hay ningún indicio que realmente acredite que esto se dio o ha sucedido, la compensación que pretende proyectada a futuro, por imperativo lega/ es imposible de otorgar, e/ daño debe ser rea/ y permanente, y durante todo este tiempo que ha transcurrido, de haber ocurrido realmente las afectaciones y daños que alega, pudo haberlos acreditado, lo cual no sucedió, Por /o que la suscrita concluye que este aspecto no es un rubro que se deba de reconocer ni indemnizar. Por otra parte, en razón de que por la finca expropiada pasa una quebrada, debemos analizar e/ régimen jurídico de las zonas de protección, las cuales constituyen una categoría de manejo de áreas silvestres protegidas, reguladas en la Ley Foresta/ Placa33524 y en la cua/ se definen como: "Artículo 33.- Áreas de protección. Se declaran áreas de protección las siguientes: (...) b) Una franja de quince metros en zona rural y de diez metros en zona urbana, medidas horizontalmente a ambos lados, en las riberas de los ríos, quebradas o arroyos, si e/ terreno es plano, y de cincuenta metros horizontales, si e/ terreno es quebrado. Desde e/ punto de vista de los derechos reales, se puede señalar que se trata de una limitación a la propiedad, en razón de la función socia/ que desempeña a la luz de la doctrina de/ artículo 45 de la Constitución Política. E/ fin primordial de las áreas de protección, es preservar y proteger e/ recurso hídrico, ante e//o, los árboles se constituyen e/ medio esencia/ para dicho cometido en razón de su importancia capita/ en la protección de/ agua. Sin árboles, los manantiales de cuyas aguas nacen los ríos se secan. E/ artículo 34 de /a Ley Foresta/ establece la prohibición de cortar árboles en las áreas protegidas, con excepción de los proyectos declarados por e/ Poder Ejecutivo como de conveniencia nacional, lo cual se dio en e/ caso que nos ocupa e implica que a/ no estar dispuestos sus recursos a/ comercio de los hombres, tampoco resultan indemnizab/es. Dado /o anterior se debe rechazar /a indemnización pretendida por e/ expropiado de los árboles que forman parte de /a zona de protección de la quebrada La Flor. Por otra parte, fuera de la zona de protección que es en esencia un potrero, se identificaron únicamente dos árboles de especies maderables comerciales (ver inventario foresta/ I, 825) e/ cual indica que: " De acuerdo con e/ Cuadro 6, dos de los árboles son de carácter comercializable (28,6%) y abarcan las dos categorías diamétricas, y corresponden a la especie cebo, mientras que los guarumos representan e/ 71.4% de los árboles, en cuanto a/ volumen (cuadro 7) m3 e/ 50.8% sería comercializable (0.7338).". Estos árboles en principio deberían indemnizarse pues no existe ninguna limitación lega/ para su explotación, sin embargo, /a parte expropiada ha indicado que no es e/ valor comercia/ lo que le interesa, sino e/ daño ocasionado con la tala de los mismo a/ paisaje y efecto en su actividad comercial, daño que no fue demostrado ni acreditado en autos. Considerando además que la existencia de un potrero con dos árboles de especies maderables comerciales en un área de 4/ha, no constituye un factor relevante o diferenciador que afecte e/ valor de n7ercado, puesto que es una característica común de los inmuebles de la zona. Viendo lo anterior desde e/ punto de vista matemático, en un cuadro de homologación cuando las comparables cuentan con la misma característica o constante, e/ factor de corrección es siempre igua/ a 1 /o cual significa que no hay ajuste por dicho concepto y por tanto no es un factor que influye en e/ precio. En consecuencia corresponde rechazar la indemnización pretendida de/ recurso foresta/ y a/ no existir prueba que demuestre la pérdida de/ pago por servicios ambientales, este no es un daño rea/ que deba ser indemnizado" Al respecto véase que como al margen de compartir el criterio, lo cierto es que los razonamientos no se combaten. La sociedad recurrente nunca contradijo uno solo de los argumentos expuestos por la jueza, que era lo que tenía que hacer si pretendía que se le reconociera ese rubro. Así al margen de si alguno de los representantes de Nombre14912 (sin acuerdo de la Junta Directa del ente público como lo exige la ley para surtir algún efecto jurídico) se allanó o no a la existencia de un refugio forestal este Tribunal al igual que el Juzgado de primera instancia no tiene bases para poder hablar de la existencia de una Reserva Cascadas del Toro al momento de la expropiación. Otro aspecto que debe aclararse es que la expropiación no se dió en el dos mil diez, onde, diecisiete o demás datas referenciadas por el recurrente, sino que este expediente data del dos mil ocho; de manera que si presente derivar algún beneficio a partir de la supuesta existencia de una reserva en el fundo expropiado, es su obligación acreditar de forma incontrovertible que dicha actividad existía antes de ese año, reiteramos, sea documentos del Ministerio del Ambiente y Energía, del Ministerio de Hacienda, de la Municipalidad o de cualquier dependencia pública resultarían idóneos en ese sentido, regencias ambientales, publicidad o en general, algo que de clara visión del alcance del proyecto, pero no de fechas posteriores a la expropiación sino anteriores. Se han aportado documentos de fecha posterior al inicio del expediente donde se puede extraer una regencia ambiental, pero no para la fecha en la cual la expropiante hizo el estudio. La parte accionada no aportó en ningún momento, como ya se ha indicado, documentos tributarios, municipales, o técnicos que permitan derivar esa condición antes del inicio del proceso expropiatorio. Incluso, aún cuando se pudiera creer en la existencia de la mencionada reserva, el peritaje que la reconoce prácticamente parte de la premisa que esta fue destruida en su totalidad, lo que resultaría lógico si se hubiera expropiado la totalidad del inmueble, lo que no fue así; en todo caso dicho estudio no explica de forma creíble el alcance del daño, si es que este existiera. Incluso, véase como los documentos realizados por el Nombre9574 donde se menciona la existencia de algún interés ambiental son del año 2017, casi diez años después de iniciado el proceso expropiatorio y también tiempo después de la captación por el proyecto hidroeléctrico. En lo referente a la abundancia de arboles, el consenso solo se ubica de la existencia de estos en los márgenes de los caudales de agua que son enrumbados por la expropiada y que como tal son bienes demaniales. En ese sentido las abundantes pruebas documentales sobre la existencia de los árboles no permiten generar la conclusión que extrae el recurrente, por lo antes dicho, al igual que el reconocimiento judicial. Es de precisar que entre los aspectos que no se desmienten, está el hecho que los árboles afectados se encuentran dentro de un área que es zona de protección, cuyo dominio no es del expropiado sino que conforman la parte demanial del inmueble, de manera que solo sean menos de una decena los que si pueden ser indemnizados; siendo estos últimos de un diámetro pequeño lo que evidencia un crecimiento pobre. Esa situación fruto de las valoraciones de los expertos nunca es desmentida, salvo por los peritos que consideran que todo el proyecto es ecoforestal, que como ya hemos insistido consistentemente no presentan un sustento, sino que corresponde a una mera valoración subjetiva. En lo que refiere a los servicios ambientales es evidente que una persona que dedica una finca, en todo o en parte, a la reforestación sea para otro proyecto mayor (como lo argumenta el expropiado) o por los meros beneficios de esta actividad no está obligada a tener un contrato de servicios ambientales, lo cierto es que los datos que constan de antes de la expropiación no evidencian esa situación, y los realizados al amparo de un contrato con el Estado, estos acuerdos son de datas posteriores al acto expropiatorio, cuando ya habían transcurrido varios años desde el inicio del proceso expropiatorio, lo que impide considerar que la finca tuviera un interés en ese sentido como actividad previa. Naturalmente, la actividad posterior, no sería indemnizable en tanto la labor pericial dejaría de ser una verificación de como estaba el bien al momento de ser expropiado (de allí que algunos juzgadores y la ley refieran a la revisión del avalúo administrativo), que es exactamente la base de un proceso expropiatorio. Debemos reiterar, que contrario a lo sostenido por alguno de los peritos y por el señor expropiado, la utilización del valor comercial del recurso forestal debe partir no de los ingresos que puede llegar a producir, sino de si esa actividad estaba produciendo un valor económico, lo que tampoco presenta valor probatorio. Es la ausencia de prueba sobre el proyecto ecológico forestal que la sociedad expropiada insiste en su existencia, lo que impide su reconocimiento económico. Consecuencia de lo dicho, el agravio expuesto en cuanto a la indemnización al daño forestal o ambiental, debe desestimarse; como lo realizó la jueza de primera instancia. No existiendo más agravios que resolver, es en derecho que se proceda a dictar el respectivo dispositivo.

POR TANTO

Se acoge parcialmente el recurso de apelación, se modifica el importe del terreno expropiado en la suma de CINCUENTA Y CUATRO MILLONES DE COLONES (Q54.000.000) y el rubro de VEINTICUATRO MILLONES SEISCIENTOS CINCUENTA Y TRES MIL CINCUENTA Y DOS COLONES (04.653.052,00) por concepto de daño al remanente, para un total de SETENTA Y OCHO MILLONES SEISCIENTOS CINCUENTA Y TRES MIL CINCUENTA Y DOS COLONES
