THE STATE Nº53-2021-I TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA, SEGUNDO CIRCUITO JUDICIAL, SAN JOSÉ, GOICOECHEA, at eleven thirty on quince de junio de dos mil veintiuno.- Ordinary proceeding (proceso de conocimiento) brought by Victor Urzola Herrera, of legal age, divorced, a surgeon, resident of Guácima de Alajuela, holder of identity card 1-0966-0360, against the State, represented by State Attorney Mariamalia Murillo Kopper, and the Sistema Nacional de Áreas de Conservación (SINAC), represented by Lic. José Guillermo Corrales Montero. Lic. Javier Slein Sandí, Bar Association membership number 23105, appears as special judicial attorney-in-fact (apoderado especial judicial) for the plaintiff.
BACKGROUND:
The statutory requirements and time limits have been observed throughout the proceedings, and no errors, defects, or omissions capable of rendering the proceedings void or depriving the parties of their right to a defense are apparent. This ruling is issued unanimously following deliberation. This matter was assigned to the reporting judge on 31 de mayo 2021.

CONSIDERATIONS:
With respect to the evidence for a better determination appearing at images 135 through 140, consisting of the certification from the Juzgado Penal de Alajuela and the request for dismissal (desestimación) filed by the Fiscalía of that judicial circuit in criminal case 19-002191-0305-PE, after hearing the parties and recalling that, pursuant to Article 50 of the Código Procesal Contencioso – Administrativo, evidence for a better determination is within the Court’s authority and its admissibility is decided at this procedural stage, this Chamber finds that the evidence offered is relevant to the resolution of this case and therefore admits it in accordance with Article 93 of the Código Contencioso Administrativo.
The following are deemed proven, as they are supported by the corresponding evidence: 1. That property recorded in the Province of Alajuela under registration number 424769-000 contains, at CRTM05 coordinates E-468780 – N-1099424, Abra-3345-I and Río Grande map sheet, scale 1:50.000, and under the North Lambert system at initial latitude coordinate 214.285 and initial longitude coordinate 505.040, an unnamed spring (naciente), registered under reference OA-162-2017 (Oficina Alajuela), D301 (Regional SINAC), code 13092, as a tributary of Quebrada Salitral, part of the Río Grande de Tárcoles watershed (cuenca) (84-24), and classified as of 1 de julio de 2016 as a permanent public-domain watercourse (cauce de dominio público permanente) by the Dirección de Aguas del Ministerio de Ambiente y Energía, a fact recorded in official letter DA-UHTPCOSJ-2039-2017 issued by that authority. (Images 18 and 25 of administrative case file OA-338.pdf submitted as evidence). 2.
That on 27 de febrero de 2019, an anonymous complaint was received and identified as Complaint 33, reporting the “proyecto el arroyo” and activities involving earthworks (movimientos de tierra), tree cutting, and construction of a stable within the protection area (área de protección) of a spring at CRTM05 coordinates E-468780 – N-1099424. (Image 8 of administrative case file OA-338.pdf submitted as evidence). 3. That on 6 de marzo de 2019, at 13 hours, Orlando Vindas Mesén, an inspector from the SINAC Área de Conservación de la Cordillera Volcánica Central, oficina Alajuela, conducted an on-site inspection in response to complaint N° 33 at the location identified in the preceding recitals (considerandos), finding that “earthworks are being carried out to form a terrace,” “construction work begins on infrastructure for a horse stable” (sic), and “Uneven terrain and the existence of a spring,” and determining that “The persons responsible for the work, Gabriel Andrés Fernández Quesada and architect Lewdy López, are instructed not to continue the work because a spring classified as permanent by the Dirección de Agua is located less than 100 metros away.
Architect Lewdy López states that he will inform the property owner, Mr. Victor Urzola Herrera,” with Fabián Guerrero Fonseca present as a witness. (Image 5 of administrative case file OA-338.pdf submitted as evidence). 4. That on 8 de marzo de 2019, official letter OA-258 was forwarded to Mr. Minor González G, Head of the SINAC Oficina de Alajuela, together with the field-visit report concerning complaint N° 33. (Image 6 of administrative case file OA-338.pdf submitted as evidence); 5. That through decision OA-283-2019 issued at 14 hours on 8 de marzo de 2019, a preventive measure (medida preventiva) was imposed ordering the immediate suspension of all activity at the site georeferenced through the GPS CRTM-05 system at E-468780 – N-1099424, within the residential development el Arroyo, owned by Mr. Víctor Urzola Herrera, further stating that “…he is prohibited from carrying out infrastructure works, constructing channels, depositing soil, performing earthworks, opening or widening roads, removing understory vegetation, cutting trees, or undertaking related work at the described site, in order to safeguard the protection of the soil, forest cover (cobertura boscosa), and water resources (recurso hídrico), as established by the environmental legislation currently in force,” which decision was served on the plaintiff on 2 de mayo de 2019.

On 6 de abril de 2019, survey engineer David Silvestre Valverde Cordero issued a written report regarding a visit conducted on 4 de abril de 2019 for the purpose of “documenting that the body of water described in official letter DA-UHTPCOSJ-1942-2017, issued by the Dirección de Aguas del Ministerio de Ambiente y Energía, had no surface runoff (escorrentía superficial) whatsoever on the date of the field visit. This spring is located within the property described by cadastral survey map (plano catastrado) A-1038752-2005, corresponding to property 424769 in the Province of Alajuela. Geographic location: district 05 Guácima, Canton 01 Alajuela, Province 02 Alajuela,” finding that “The field inspection confirms that the spring under study has no surface runoff, with the continuity of the emergence of water at the surface having ceased entirely.
The area was inspected within a radius of 20 m to verify that the emergence point (punto de afloramiento) had not shifted. The coordinates of the site were then recorded using a GPS navigator, and the conditions were documented through photographs. The report issued by the MINAE Dirección de Aguas locates the spring using North Lambert coordinates Latitude: 214285, Longitude: 505040; when those coordinates are converted to the CRTM05 projection, the projection currently designated as official, the result is E: 468703 and N: 1099678. The coordinates recorded in the field using the GPS navigator are E: 468719 and N:1099695 in the CRTM05 system, which, although they differ somewhat from those indicated by MINAE, confirm by their proximity that this is the same spring under study.” (Images 14 through 19 of the digital judicial case file). 7. On 2 de mayo de 2019, Mr. Orlando Vindas Mesén, an inspector from the SINAC Área de Conservación de la Cordillera Volcánica Central, oficina Alajuela, again conducted an on-site inspection and stated: “Affected soil: 140 mts2 on average; uneven terrain; a permanent spring exists, according to the determination of the Dirección de Agua…
The terrain’s topography was modified to level it and construct infrastructure possibly intended for use as a stable. The protection area is reduced. The risk of contamination of the water resource increases.” (Image 19 of administrative case file OA-338.pdf submitted as evidence). 8. On 3 de mayo de 2019, through official letter OA- [565] 564 (sic), a criminal complaint was forwarded to the Ministerio Público de Alajuela against the plaintiff for violation of Article 33 (artículo 33) of the Ley Forestal. (Images 21 through 24 of administrative case file OA-338.pdf submitted as evidence). 9. On 3 de mayo de 2019, notary public Javier Armando Slein Sandí prepared a notarial record (acta notarial) at the plaintiff’s request, stating: “At the request of Mr. VICTOR JAVIER URZOLA HERRERA, I first appeared at a property owned by him, located in District five, La Guácima, Canton one, Alajuela, Province of Alajuela, at eleven hours and twenty minutes on uno de mayo del dos mil diecinueve, to attest to what was observed both on that property and on adjoining land, specifically in relation to the existence of an alleged permanent spring, which is located within the property adjacent to his registered property.
The alleged spring is approximately ninety metros from where block-and-concrete buildings are being erected. The undersigned notary asked about the purpose of that construction and was informed that the buildings would be used as horse stalls and other support facilities. I proceeded to the alleged groundwater spring accompanied by Mr. URZOLA HERRERA, Mr. JUAN GREGORIO PAVON RAMOS, residence identification number uno cinco cinco ocho uno siete cuatro nueve cero cuatro dos ocho, and Mr. GABRIEL ANDRES FERNANDEZ (sic) QUESADA, identification number dos - cero quinientos noventa y seis - cero novecientos veinticuatro, whom I asked whether they were familiar with the area and the surrounding land; they answered the undersigned notary affirmatively. When the undersigned notary public arrived with the three aforementioned persons, I found an opening consisting of a hole in the ground, located at the base of a rock approximately un metro in diameter, and an area of vegetation typical of the region, without any noteworthy features.
That hole and its surroundings were completely dry. In my presence, Mr. URZOLA HERRERA asked those accompanying him whether what those present, including the undersigned, were observing was a normal condition. Messrs. Pavón and Fernandez (sic) responded that the site had never been a spring; that only during the rainy season did water overflow from the hole as a water outlet, ceasing to flow as soon as the rain stopped; and that during the dry season it remained completely dry, which is why it was called a water outcrop (afloramiento de agua) and was not regarded as a spring. In my presence, those beside me commented among themselves that what was being observed was a natural condition of the region. I verify that the site is not located on land owned by Mr. URZOLA HERRERA, because to reach the site I had been asked to observe, I had to leave the visible boundaries of the property where I originally appeared.
I then asked the aforementioned persons about the continuity of the outcrop during the rainy season and was told that, in years of heavy rainfall, the outcrop flowed continuously only for a few weeks, at most tres o cuatro meses, and that after emitting water for a few days or weeks of the year, it quickly dried up and remained dry for several months, as the undersigned notary was observing at that time. I heard the aforementioned persons state that outcrops in the area are common in years of heavy precipitation, but that they generally are not sources of groundwater flow and do not create a watercourse, except for water-flow ditches during the heavy downpours common in the area in the rainy season, and that when outcrops do occur, they are not substantial and there is no pressurized flow of water that would suggest that the outcrop is a connecting branch to an underground tributary. The undersigned notary observes that reforestation is underway on Mr.
Urzola Herrera’s property, and I hear him tell the other persons accompanying him that cuarenta trees of species native to the area have already been planted throughout certain portions of the property because he intends to reforest an area that in the past (sic) was so severely affected by deforestation. The information regarding outcrops is hereby placed on record, the undersigned having been physically present in the aforementioned area for a period of dos horas from the moment (sic) of the undersigned notary’s arrival. A recess was taken for lunch, and at catorce horas quince minutos a light drizzle began in the area. It was stated in my presence that this was normal for the transitional season, and after a period of una hora, I returned alone along the path to the alleged spring and verified that, despite the drizzle, there was no trace of any type of water outcrop. This being a statement of what was observed and what was discussed in my presence, I leave the area and close this record at quince horas y cuarenta minutos on the same date indicated above…” (Images 10-11 of the digital judicial case file). 10.
On 3 de junio de 2019, the Unidad Hidrológica Tárcoles – Pacífico Central issued official letter DA-UHTPCOSJ-1032-2019 in favor of Pablo Cerdas Murillo, stating: “Last martes 21 de mayo, you and I visited the place where the referenced water source is located, in la Guácima de Alajuela, at latitude coordinates 214.285 and longitude 505.040, where it was determined that the source was completely dry even though some heavy rains had already occurred. After reviewing the Sistema Nacional Integrado de la Gestión de los Recurso Hídricos (SINIGIRH), it was determined that the source had been the subject of other determinations issued in prior years and at different times of the year, in which the technical personnel determined that the spring is permanent.
Therefore, given this ambiguity and taking into account the provisions established by this Water Directorate in the Technical Opinion Guide on Bodies of Water, monitoring of this source is hereby ordered for the current hydrological year, which would run from June to May, in order to demonstrate whether the spring (naciente) is indeed intermittent. You are likewise informed that if you have graphic documentation concerning this source, such as photographs or videos taken during the past few months, you should submit it to enable a better determination.” (Image 20 of the digital court file). 11. On 26 de julio de 2019, notary Allan Makhlouf Maklouf prepared a notarial record (acta notarial) stating that “at twelve thirty hours on veintiocho de Junio of the current year, specifically at the northern boundary of the property in the Province of Alajuela, registered under the real-property folio system, registration number CUATROCIENTOS CUATRO MIL QUINIENTOS VEINTICUATRO- CERO CERO CERO, [I proceeded] to prepare a notarial record concerning the existence of bodies of water along the aforesaid boundary of the described property.
The aforementioned property, owned by Hacienda Inmobiliaria Real De Pereira SA, is bounded to the north by the property in the Province of Alajuela registered under the real-property folio system, registration number CUATROCIENTOS VEINTICUATRO MIL SETECIENTOS SESENTA Y NUEVE - CERO CERO CERO. It is precisely on this property that I was asked to verify the existence of bodies of water. Upon appearing at the site, at the time of the visit I was unable to identify the existence of any type of stream (quebrada) or spring, or any permanent emanations from the subsoil. Furrows were identified through which rainwater from the neighboring properties drains during the rainy season. This proceeding was conducted in the company of Mr. Juan Gregorio Pavón Ramos, … who is deemed a witness to the facts described above. All of the foregoing was ratified and approved in my presence, and this proceeding was concluded thirty minutes after it began.
The undersigned certifies that photographs of the area taken at the time the record was prepared are attached hereto, that they are appended to the certified copy for the requesting party, and that a copy is retained in my reference protocol as supporting documentation…”. On 12 de junio de 2020, the Deputy Prosecutor’s Office for the First Judicial Circuit of Alajuela filed a motion to dismiss (solicitud de desestimación) in criminal proceeding 19-002191-00305-PE for the offense of exploitation of protection areas (aprovechamiento de áreas de protección) against the plaintiff herein and others. (Images 137 to 139 of the digital court file). 13. On 13 de abril de 2021, the Alajuela Criminal Court certified that criminal proceeding 19-002191-00305-PE for the offense of exploitation of protection areas against the plaintiff herein and others had been closed and dismissed. (Image 135 of the digital court file).
The following facts were not proven in these proceedings: 1. The change in the technical assessment by the MINAE Water Directorate regarding the spring (naciente) at issue in these proceedings, from permanent to seasonal. (The case record (autos)). 2. The intermittent status of spring registry N° 13092. (The case record).
The claimant states that, through administrative compliance order (prevención administrativa) OA-283-2019, the SINAC Alajuela office ordered the construction of a stable on his property to cease because it was within a radius of 100 meters from a permanent spring. He alleges that it is not permanent but rather an intermittent water source, which emerges only during the rainy season and dries up completely during the summer. He states that he was not notified of that action and that, moreover, his actions did not violate sections 33 and 58 of the Ley Forestal, section 90 of the Ley de Conservación de la Vida Silvestre, section 11 of the Ley de Biodiversidad, sections 50, 98, 99 and 101 of the Ley Orgánica del Ambiente, or section 31 of the Ley de Aguas. He therefore considers that the administrative conduct in question lacks any basis and must accordingly be annulled, and that compensation must be awarded for the damages and losses this has caused, given that it “caused a situation of stress and psychological distress because I had to immediately resolve a series of circumstances, such as finding a place for the horses I was housing in the stables, determining what to do with the workers and construction materials being used, so that the workers would not leave to work elsewhere and the materials would not deteriorate.
In addition, I had to contact and pay the fees of several experts who could verify and attest that the alleged water spring was not permanent but intermittent. Furthermore, I am a surgeon and had to alter my schedule of surgical procedures and patient appointments in order to address the foregoing matters with the urgency I mentioned. In addition, I have had to devote additional time and money to hiring an attorney to resolve, through administrative proceedings, the situation caused by the SINAC official’s actions; on the other hand, I have also had to devote additional time and money to defending myself against a pending criminal complaint filed against me by that official, despite his knowledge that his assertions were false. To accomplish all of the foregoing, I have had to stop seeing patients and performing surgeries, all of which has affected me emotionally and financially.” In his closing arguments, he asserts that the intermittent status was proven through four items of evidence: the two notarial instruments submitted, the surveyor’s technical assessment, and Water Directorate official letter DA-UHTPCOSJ-1032-2019, dated 3 de junio del 2019, which establish that status, thereby depriving administrative compliance order OA-283-2019 of its factual basis.
He further states that this situation was assessed by the Prosecutor’s Office in criminal proceeding 19-002191-0305-PE, whose assessment is consistent with his arguments, and invokes the non bis in idem principle pursuant to section 42 of the Constitution, Article 14.7 of the International Covenant on Civil and Political Rights, and Article 8.4 of the American Convention on Human Rights.
As grounds for dismissal of the claim, the Office of the Attorney General argues that section 158 of the Ley General de Administración Pública does not apply to the act challenged by the claimant because all formal and substantive elements of the administrative act (acto administrativo) are present: it was issued by the competent body within an administrative proceeding and in compliance with the procedural formalities required for its validity. It adds that the act giving rise to the alleged harm—namely, opinion DA-UHTPCOSJ-2039-2017—is not being challenged in these proceedings, rendering the claimant’s demand unsupported. It further argues that the claimant’s counsel does not even specify the alleged damages and losses, thereby failing to comply with the obligation under section 58(e) of the CPCA. In its closing arguments, it asserts that the claimant failed to establish the alleged nullity and that his theory of the case must therefore be rejected.
It adds that the claimant could apply to the Municipality for a new construction permit if he demonstrates a change in the circumstances of the spring, but this would not affect the validity of the administrative act issued in 2019. Regarding the evidence submitted to assist the court in reaching a decision (prueba para mejor resolver), it notes that those are assessments made by the Prosecutor’s Office and that no assessment by the Criminal Court was submitted; therefore, their content has no evidentiary relevance to the case record, aside from the fact that criminal and administrative-litigation assessments are independent of one another. It concludes by reiterating the defenses raised and its request for an award of costs.
For its part, codefendant SINAC likewise opposes the claim in its answer and closing arguments, asserting that the challenged actions were based on the preexisting technical assessment DA-UHTPCOSJ-2039-2017 of the MINAE Water Directorate, which classifies the spring at issue in these proceedings as permanent, and that this Directorate even stated in official letter DA-UHTPCOSJ-1032-2019 that there are “other” technical assessments to that effect. The actions of its officials therefore constituted a direct application of section 16 of the LGAP through reliance on those technical assessments, and the challenged actions were consequently neither arbitrary nor capricious. With respect to the objection concerning the filing of the criminal complaint, it invokes compliance with a legal duty, specifically Article 21 of Decreto 28409-MINAE Reglamento Autónomo de Servicios del Ministerio del Ambiente y Energía, which establishes that obligation for officials. It therefore maintains that the actions complied with the environmental regulations contained in Ley Forestal 7575 Articles 33, 34 and 54; Ley Orgánica del Ambiente 7554 Articles 34, 51, 61 and 99 d); Ley de Biodiversidad 7788 Articles 22 and 28; Ley General de la Administración Pública Articles 16 and 150.
As part of her theory of the case, the claimant invokes the non bis in idem principle on the basis of section 42 of the Constitution, Article 14.7 of the International Covenant on Civil and Political Rights, and Article 8.4 of the American Convention on Human Rights. In this regard, before addressing the merits of the present matter, it is important to define the scope and limitations of that principle in light of the decision in the criminal jurisdiction (sede penal), as distinguished from these administrative-litigation proceedings (sede de lo contencioso administrativo). We must therefore recall that our legal system establishes different regimes for attributing liability, which are of differing natures and entail different legal consequences, the classic categories being civil, administrative, and criminal liability, without prejudice to the existence of other types of liability depending on the conduct under review.
Accordingly, the principle invoked does not mean that a ruling under one of these analyses has the derivative effect of precluding consideration of the other forms of liability, which is precisely what the claimant seeks to establish through her argument. The decision in the criminal jurisdiction serves exclusively to establish that the facts alleged and invoked in that jurisdiction may not be adjudicated again for the purpose of imposing criminal liability under the offense initially investigated; it does not, however, extend to preclude analysis of the same facts with respect to other legal consequences that are of a different nature, as is the case here in the administrative-litigation jurisdiction. It should be noted that there is not even a connection between the relief sought in these proceedings—which is based on the alleged nullity of the administrative actions identified as administrative compliance order OA-283-2019, as well as the alleged harmful consequences arising therefrom—and the matters investigated in the criminal proceeding, where the facts investigated and the alleged offense under investigation (exploitation of protection areas (aprovechamiento de áreas de protección)) have no binding effect on the action challenged here.
Accordingly, there is no violation of the principle invoked because the matters belong to different spheres, and the decision in one has no bearing on the administrative conduct at issue in these proceedings.
FAILURE TO CHALLENGE PRIOR ACTIONS AND CERTAIN RELEVANT ASPECTS OF THE ASSESSMENT OF EVIDENCE IN THIS SPECIFIC CASE. ABSENCE OF TECHNICAL CRITERIA: Although not expressly stated as such in its arguments, the claimant’s central theory is to challenge administrative action (actuación administrativa) OA-283-2019 on the ground that it lacks its statement-of-reasons component (componente motivo), which, if proven, would entail a defect in the administrative conduct (conducta administrativa) and its consequent nullity, thereby demonstrating the arbitrariness alleged in the complaint. This is so because the claimant asserts that there is no factual basis supporting the legal consequence of the land-use restriction (limitación urbanística) encumbering its property in the form of a prohibition on construction, specifically concerning whether a water spring (naciente de agua) is permanent or intermittent and the protection regime applicable to it.
For this purpose, the party offers four items of evidence: two notarial records, a topographic report, and official letter DA-UHTPCOSJ-1032-2019, dated 3 de junio del 2019, from the Dirección de Aguas, which, in its view, conclusively demonstrate that the spring is intermittent rather than permanent. Court’s determination: The first matter we must consider, as the State’s representative points out, is the limitation that the claimant itself placed on its claims, since it confined its challenge to administrative notice (prevención administrativa) OA-283-2019, which is based on a registration with an administrative body other than SINAC, namely, the Dirección de Aguas del MINAE, corresponding to registration N° 13092 and identified as an unnamed spring, a tributary of Quebrada Salitral, part of the Río Grande de Tárcoles basin (84-24), and classified as of 1 de julio de 2016 as a permanent public-domain watercourse (cauce de dominio público permanente).
Accordingly, it is clear that the theory of the claimant’s case is not directed at challenging the SINAC act, but rather the act of the Dirección de Aguas, which was issued on a different date and whose nullity cannot be adjudicated without violating the prohibition against ruling ultra petita (prohibición de ultrapetita procesal) established in section 122 of the Código Procesal Contencioso Administrativo. It must therefore be borne in mind that both the legal argument and the evidence submitted constitute, in substance, an indirect challenge to the administrative conduct of a third administrative body, which is not the subject matter of this proceeding. Confined to the relief sought, this Panel of Judges cannot order SINAC to remove or disregard an encumbrance (gravamen) that falls within the administrative authority of the Dirección de Aguas, because doing so would entail a case-specific refusal to apply it or, at best, render the encumbrance imposed by the Dirección de Aguas relatively ineffective, which would violate the principle of legality (principio de legalidad) under section 11 of the Constitution and section 11 of the Ley General de Administración Pública.
The effect of this limitation, self-imposed through the wording of the claimant’s requested relief, would become evident if the claims were granted, because even then the legal classification made by the Dirección de Aguas would not be eliminated, and the land-use restriction would remain in place until that encumbrance was reviewed administratively or judicially. This matter is governed by section 38.1 of the CPCA, which provides that a claim for nullity (pretensión de nulidad) is inadmissible in relation to acts that, despite being defective, merely reproduce prior acts that are final and conclusive. In a different vein, even if the possibility afforded by section 41.2.a in relation to section 122.a of the CPCA were invoked and the action of the Dirección de Aguas were assessed as a “related act” (acto conexo), the claim would likewise be untenable under section 16 in relation to sections 136.2, 158.4, and 302 of the Ley General de Administración Pública, given the evidentiary weight that the claimant seeks to attribute to the four aforementioned items of evidence concerning the alleged intermittence of the spring registered under N° 13092, as explained immediately below.
As part of the reasoning (motivación) for every administrative act (acto administrativo), the Ley General de Administración Pública provides, pursuant to sections 16, 160, and 216, for the applicability of scientific and technical rules, which must be applied when they lead to a single unequivocal conclusion; where they do not, the applicable parameters must be those of logic, rationality, and reasonableness. This brings us into the realm of what is known as technical discretion (discrecionalidad técnica), insofar as more than one technically valid option is available to the Administration in creating, modifying, extinguishing, executing, suspending, or revoking a particular administrative conduct. The same body of law, pursuant to section 15 and the aforementioned section 16, grants administrative-law judges (49 Constitutional, 1, 2, 36, 42, and 122 of the CPCA) authority to review such discretion in order to verify that it remains within the legally permissible parameters for declaring the administrative conduct lawful.
Accordingly, this Panel of Judges considers that an objective mechanism must be established so that the judge may perform that task, particularly in view of the wording of the second paragraph of the aforementioned section 16, which states: “The Judge may review the conformity of the discretionary elements of the act with these nonlegal rules, as though exercising judicial review of legality,” in conjunction with the maxim iudex peritus peritorum (the judge is the expert of experts) and the adage iura novic curia (the judge knows the law). Thus, a type of benchmark (baremo) containing basic components may be devised to enable the judge to conduct administrative review, even in scenarios involving technical discretion. In doing so, certain minimum and maximum standards applicable to specific cases may be considered in order to give concrete substance to the so-called Principle Prohibiting Arbitrariness (Principio de Interdicción de la Arbitrariedad).
On the one hand, there is a minimum requirement of technical verification (the prerequisite for applying the legal framework), that is, the actual existence of a technical mechanism applied by the Administration rather than a mere conjecture. These mechanisms are defined by the relevant branch of science, and their existence is verified by identifying the method (objective element, 16 LGAP) and the technical expert (técnico) (subjective element, 302 LGAP) involved in the administrative conduct, in order to avoid a potential appeal-to-authority fallacy. On the other hand, it is possible to review whether, in the particular case, that method was properly used in the administrative conduct—or whether it was used at all—and whether it was applied by a person possessing the requisite expertise. Even after these analyses have been satisfied, however, more than one technical solution may exist, either because several methods are available or because several technical experts may be capable of performing the task; it is precisely in this area that the Administration’s discretionary component comes into play.
Clearly, when methods are at issue, the various branches of science offer methods ranging from the most general to the most specific and detailed; the same is true of technical experts and professionals, ranging from compatible professions and trades to specialized academic and professional qualifications. Therefore, where it is verified that the Administration, within the parameters of rationality and reasonableness, as well as logic, used a method and an official suited to the intended purpose, the principle of preservation of the administrative act (principio de conservación del acto administrativo) applies, notwithstanding the existence of other alternatives and other types of technical experts, and the judge may not substitute their judgment for that of the Administration. Logic, reasonableness, and rationality are applied in practical terms when it is verified that the administrative action is not manifestly incompatible with the required task or purpose forming the basis of the administrative action.
It may validly be concluded that such an analysis is possible, particularly through verification by expert evidence (prueba pericial), since this evidentiary mechanism can identify shortcomings, defects, irregularities, and any other factor enabling the judge to reach an objective conviction that arbitrary conduct exists or, conversely, to find that the Administration acted within the permissible parameters of technical discretion. We must therefore compare the contents of the administrative record (expediente administrativo) in the terms set out above. It appears that act OA-283-2019 was accompanied by supporting materials and served on the claimant (images 14 to 18), and this was not disproven in this proceeding; compliance with section 136.2 of the Ley General de Administración Pública is therefore presumed. The claimant alleges a purported defect in service (notificación), but acknowledges receiving notice in fact 3 of the complaint, and thus any defect in communicating the act must be deemed cured.
This is also because the proof of service appearing as image 14 of the administrative record, completed at 11 hours on 2 de mayo de 2019 at the residence of the party bringing the action, was not challenged. Accordingly, the technical opinion (criterio técnico) identified by the Dirección de Aguas and entitled DA-UHTPCOSJ-2039-2017 accompanies and provides the reasoning for the act at issue in this proceeding. Against this background, we shall compare it with the evidence in the record, beginning with official letter DA-UHTPCOSJ-1032-2019 of 3 de junio de 2019, issued by Álvaro Leonel Porras Vega of the Unidad de Hidrológica de Tárcoles – Pacífico Central de la Dirección de Aguas del MINAE. In this regard, the claimant maintains that this official letter establishes that the spring is intermittent, a conclusion with which this Court does not agree based on its reading of the document. Apart from the fact that the identity of Pablo Cerdas Murillo, the addressee of the official letter, is unknown, it is abundantly clear that the letter is an interlocutory act (acto interlocutorio), rather than a dispositive act, informing the aforementioned Cerdas Murillo, who is not a party to this proceeding, that a field inspection was conducted on 21 de mayo de 2019 at coordinates latitude 214.285 and longitude 505.040.
It is therefore understood to concern the same location as the spring at issue in this proceeding, and it states that the site was dry at the time of the inspection. Nevertheless, it further clarifies that the Sistema Nacional Integrado de la Gestión de los Recursos Hídricos contains “other” assessments (dictámenes) of this water source indicating that it is permanent, describing this situation as an “ambiguity.” Likewise, it immediately cautioned that, in circumstances of this kind, the “Dictamen Técnico sobre Cuerpos de Agua” guide had to be followed, requiring a study of at least one year between the months of junio and mayo “to demonstrate whether the spring is in fact intermittent or not” (emphasis added, image 20 of the digital court record). Thus, far from proving the fact alleged by the claimant or constituting a change in the Dirección de Aguas’s position, official letter DA-UHTPCOSJ-1032-2019 neither contradicts DA-UHTPCOSJ-2039-2017 nor constitutes the final act declaring or defining the technical status of the spring at issue in this proceeding.
Moreover, the notarial instruments (actas notariales) submitted—one executed by the plaintiff’s own special judicial attorney-in-fact and the other by notary Allan Makhlouf Maklouf—do not constitute technical evidence capable of superseding the technical opinion of the Dirección de Aguas. They merely describe an observation, as would also occur with a judicial visual inspection (inspección ocular judicial), documenting certain factual circumstances at a particular time and place, independently of any technical assessment—in this case, a hydrological assessment—under sections 16 and 302 of the Ley General de Administración Pública or sections 94 and 105 of the Código Procesal Contencioso Administrativo (Expert Evidence (Prueba Pericial)). Lastly, the report of surveying engineer David Silvestre Valverde Cordero does not demonstrate, in terms of the subjective assessment of technical qualifications, that he is competent to issue an opinion in place of a person with expertise in hydrology, since the field of surveying does not extend that far.
Accordingly, the submitted report is not relevant evidence (prueba conducente), contrary to the plaintiff’s contention. Lastly, reference may be made here to the evidence admitted for purposes of rendering a better-informed decision (prueba para mejor resolver), consisting of the Fiscalía Adjunta de Alajuela’s request for dismissal, which likewise is not suitable for discrediting the foregoing for several reasons: first, it is the opinion or interpretation of a prosecutor in criminal proceedings and cannot supersede the administrative action, nor does it constitute a judicial ruling; second, that procedural action is confined to the effects it had within criminal proceeding 19-002191-0305-PE, and therefore its evidentiary value cannot be extended beyond those bounds; and third, and most importantly, it is indirect or referential evidence (prueba indirecta o remisiva), because the prosecutor refers to an apparent official communication DA-UHTPCOSJ-1061 in which the Dirección de Aguas supposedly “reclassified the spring (naciente) as intermittent”; however, that communication was not submitted in these proceedings, and its content and scope are therefore unknown.
Thus, because the plaintiff did not submit suitable technical evidence contradicting the evidence in the record, and because there are no claims to that effect, including any seeking a declaration regarding the factual circumstances of spring registration N° 13092, this ground for challenge (agravio) must be rejected.
In accordance with the preceding recital (considerando), no other arguments challenging the validity of the administrative act (acto administrativo) at issue in these proceedings can be identified; therefore, the challenged conduct must be found consistent with the legal framework, both in itself and because it is based on the technical opinion of the Dirección de Aguas. Nevertheless, it is relevant to this case that the plaintiff clearly understand the non-compensable urban-planning encumbrance regime (régimen de afectación urbanística no indemnizable) arising from the second paragraph of Article 45 of the Constitution, since this provision gave rise to the restriction that affected the plaintiff’s ability to build on the property and that the plaintiff ultimately alleges caused damages recoverable from the defendants. On the one hand, it must be understood that the event giving rise to the encumbrance (gravamen) was not a discretionary act of the defendant Public Administration, but rather, as indicated supra, originated in record N° 13092 of the Dirección de Aguas, which entered the water source at issue in these proceedings, identified as an unnamed spring (naciente), a tributary of Quebrada Salitral, part of the Río Grande de Tárcoles watershed (cuenca) (84-24), and classified it as of July 1, 2016, as a permanent public-domain watercourse (cauce de dominio público permanente).
From that date onward, the properties surrounding that spring became subject to the restrictions of the Ley de Aguas, including the non-compensable prohibition on construction within the spring protection zone (rango de protección de nacientes) regulated by Article 31 thereof. However, natural circumstances may change, whether because the exact point at which the flow emerges is relocated, obstructed, combines underground with other sources, dries up, or because of any other factor that alters, modifies, or extinguishes the point at which the water surfaces. To demonstrate such variability in circumstances, under the principle of parallelism of forms (principio de paralelismo de las formas), the same procedure must be followed; that is, just as the encumbrance was imposed, the same process must be followed for its release (desafectación). The Dirección de Aguas was therefore correct in stating in official letter DA-UHTPCOSJ-1032-2019 that the change must be established through a technical study lasting at least one year, meaning that the requested modification is possible if those parameters are followed.
In any event, it must be clarified that the Pro Natura Principle (Principio Pro Natura), which arises not only from the second paragraph of Article 45 of the Constitution but also from Article 50 of the Constitution itself, which enshrines the priority of a healthy and ecologically balanced environment, means that any such variation, if established, would constitute a prospective, never retroactive, modification of the urban-planning encumbrance regime, which is, at bottom, what the plaintiff indirectly seeks to have this Court declare. In summary, even if there were a subsequent action modifying the protection regime applicable to the spring recorded under N° 13092, it would have prospective and not retroactive effect. This means that, even under this scenario, the ex nunc variation (prospectively) would not invalidate the SINAC administrative action at issue in these proceedings. Consequently, it must be understood that the entity possessing its own legal personality merely fulfilled a legal duty in light of the encumbrance in effect at the time of the events, thereby negating the alleged arbitrariness complained of by the plaintiff and substantiating the proper exercise of the powers assigned to the defendant public entity.
It should also be borne in mind that part of this lawful exercise of authority and fulfillment of legal duties consists of notifying the competent authorities, including the criminal authorities, of facts that must be investigated within their respective spheres, regardless of whether, upon completion of those proceedings, it is ultimately determined that liability should or should not be imposed under the terms of recital VII of this judgment. Accordingly, this claim of error is likewise rejected.
As a corollary to all the foregoing, the first claim must be rejected because no grounds invalidating administrative act OA-283-2019, issued at 14 hours on March 8, 2019, have been established. That act imposes a preventive measure (medida preventiva) and orders the immediate suspension of all activity at the site georeferenced using the GPS CRTM-05 system at E-468780 – N-1099424. Consequently, because there is no unlawful basis supporting the claim for compensation in the second claim, it must likewise be rejected by reason of its connection to and derivation from the first, given the failure to satisfy the requirements of Articles 191, 192, 195, and 275 of the Ley General de Administración Pública.
In their answers to the complaint, both defendants raised the defense of lack of legal entitlement (excepción de falta de derecho), which is sustained in its entirety. With respect to the defense asserted by the State’s representative concerning uncured defects in the complaint that preclude a ruling on the merits, it is noted that this matter was decided by interlocutory ruling at the preliminary hearing and that, in view of the disposition of the present case, review of that ruling is moot.
With respect to costs, pursuant to Article one hundred ninety-three of the Código Procesal Contencioso Administrativo, procedural costs and attorney’s fees (costas procesales y personales) constitute a burden imposed upon the losing party by reason of having lost. Waiver of such an award is permissible only when, in the Court’s judgment, there was sufficient reason to litigate or when the judgment is rendered on the basis of evidence whose existence was unknown to the opposing party. In this case, the Court finds no reason to exempt the plaintiff from costs; accordingly, they shall be imposed upon the plaintiff.
POR TANTO
Based on the findings of fact and conclusions of law set forth above, the defense of lack of legal entitlement raised by the defendants is sustained. Consequently, the complaint filed by Victor Urzola Herrera against SINAC and the STATE is declared WITHOUT MERIT. Both categories of costs shall be borne by the plaintiff and shall be assessed during the judgment-enforcement stage. Notice shall be given.

RESULTANDO:
En los procedimientos se han observado las prescripciones y términos de ley, y no se perciben vicios, defectos u omisiones susceptibles de producir nulidad de lo actuado o indefensión a las partes. Se dicta la presente resolución por unanimidad y previa deliberación. Este asunto fue turnado al juez ponente en fecha 31 de mayo 2021.

CONSIDERANDO:
De la prueba para mejor resolver visible a imágenes 135 a 140 y que corresponden a la constancia del Juzgado Penal de Alajuela y a la solicitud de desestimación de la Fiscalía de dicho circuito dentro de la causa penal 19-002191-0305-PE, después de oídas a las partes, y haciendo recordatorio de que, conforme el artículo 50 del Código Procesal Contencioso – Administrativo, la prueba para mejor proveer es resorte del Tribunal y su admisibilidad se resuelve en este momento procesal, al respecto, estima esta Cámara que la prueba ofrecida resulta pertinente para la resolución del presente caso, y en ese sentido, se acepta la misma de acuerdo a lo establecido en el artículo 93 del Código Contencioso Administrativo.
Se tienen como tales, por tener el correspondiente sustento, los siguientes: 1. Que la finca Partido de Alajuela matrícula 424769-000 posee en las coordenadas CRTM05 E-468780 – N-1099424, hoja cartográfica Abra-3345-I y Río Grande, escala 1:50.000, y bajo el sistema Lambert Norteen coordenadas de latitud inicial 214.285 y longitud inicial 505.040 una naciente de agua, sin nombre, registrada en la referencia OA-162-2017 (Oficina Alajuela), D301 (Regional SINAC), código 13092 como un afluente de Quebrada Salitral, parte de la cuenca (84-24) Río Grande de Tárcoles y calificada a partir del 1 de julio de 2016 como un cauce de dominio público permanente por la Dirección de Aguas del Ministerio de Ambiente y Energía, hecho que se hace constatar en el oficio DA-UHTPCOSJ-2039-2017 de dicha autoridad. Que en fecha 27 de febrero de 2019, se recibe queja anónima la cual se identificó como Queja 33 en la cual se pone en conocimiento el “proyecto el arroyo” con acciones de movimientos de tierra, corta de árboles y construcción de una caballeriza en área de protección de una naciente en las coordenadas en las coordenadas CRTM05 E-468780 – N-1099424.

Que en fecha 6 de marzo de 2019, a las 13 horas el inspector del SINAC del Área de Conservación de la Cordillera Volcánica Central, oficina Alajuela, Orlando Vindas Mesén realiza inspección ocular en atención a la queja N° 33 en el sitio indicado en los considerandos anteriores encontrando “se realiza movimiento de suelo, para conformar una terraza”, “inician obras de construcción de infraestructura para establo caballos” (sic), “Terreno quebrado y existencia de una naciente de agua”, determinando que “Se le indica a los encargados de las obras Gabriel Andrés Fernández Quesada y Lewdy López Arquitecto, no continuar con las obras por ubicarse a menos de 100 metros una naciente de Agua dictaminado como permanente por la Dirección de Agua. El Arquitecto Lewdy López manifiesta que le informará al propietario del inmueble señor Victor Urzola Herrera”, lo anterior acompañado del testigo Fabián Guerrero Fonseca.

Que en fecha 8 de marzo de 2019, se remite el oficio OA-258 al señor Minor González G, Jefe de la Oficina de Alajuela del SINAC, el informe de la gira respecto de la queja N° 33. (Imagen 6 del expediente administrativo OA-338.pdf aportado como prueba); 5. Que por medio de la resolución OA-283-2019 de las 14 horas del 8 de marzo de 2019, se dicta medida preventiva y se ordena la suspensión inmediata de todo tipo de actividad en el sitio georreferenciado por medio del sistema GPS CRTM-05 E-468780 – N-1099424, dentro del residencial el Arroyo, propiedad del señor Víctor Urzola Herrera señalando además que “…se le prohíbe realizar obras de infraestructura, canales, depósitos de tierra, movimientos de suelos, apertura o ampliación de caminos, eliminación de flora menor, corta de árboles y obras afines en el sitio descrito en resguardo de la protección del suelo, cobertura boscosa y del recurso hídrico tal como establece la legislación ambiental vigente”, acto notificado al actor en fecha 2 de mayo de 2019.
(Imágenes 9 a 14 del expediente administrativo OA-338.pdf aportado como prueba). 6. En fecha 6 de abril de 2019, el ingeniero topógrafo David Silvestre Valverde Cordero, emite informe escrito sobre visita realizada el día 4 de abril de 2019, con el objeto de “documentar el cuerpo de agua descrito en el oficio DA-UHTPCOSJ-1942-2017 emitido por la Dirección de Aguas del Ministerio de Ambiente y Energía para el día de la visita a campo se encuentra sin escorrentía superficial alguna. Dicha naciente se encuentra dentro de la inmueble descrito por el plano catastrado A-1038752-2005 el cual describe a la finca 424769 del partido de Alajuela. Situación geográfica: distrito 05 Guácima, Cantón 01 Alajuela, Provincia 02 Alajuela”, encontrando que “En la inspección de campo, se confirma que la naciente en estudio se encuentra con ausencia de escorrentía superficial, rompiendo en su totalidad la continuidad de brote de agua hacia la superficie.
Se realiza un recorrido en la zona en un radio de 20 m para verificar que no se haya desplazado el punto de afloramiento. Se procede a tomar las coordenadas del sitio con la utilización de un navegador GPS y documentar la situación por medio de fotografías. En referencia al informe emitido por la dirección de aguas del MINAE, ubica la naciente mediante coordenadas Lambert Norte Latitud: 214285, Longitud: 505040 y que al trasladar dichas coordenadas la proyección CRTM05, proyección oficializada al día de hoy, obtenemos E: 468703 y N: 1099678. Las coordenadas levantadas en campo por medio del Navegador GPS corresponden a E: 468719 y N:1099695 en el sistema CRTM05, que, aunque presentan cierta diferencia con las indicadas por el MINAE, comprueba por su radio de cercanía que se trata de la misma naciente en estudio”. (Imágenes 14 a 19 del expediente judicial digital). 7. En fecha 2 de mayo de 2019, nuevamente el señor Orlando Vindas Mesén, inspector del SINAC del Área de Conservación de la Cordillera Volcánica Central, oficina Alajuela, realiza inspección ocular en el sitio e indica: “Suelo afectado 140 mts2 promedio, terreno quebrado, existe naciente de agua permanente, según dictamen de la Dirección de Agua…
Se modificó la topografía del terreno para nivelarlo y construir obras de infraestructura con fines posiblemente de usarlo como caballeriza. Se reduce el área de protección. Aumenta el riesgo de contaminación el recurso hídrico”. (Imagen 19 del expediente administrativo OA-338.pdf aportado como prueba). 8. En fecha 3 de mayo de 2019, por medio de oficio OA- [565] 564 (sic), se remite al Ministerio Público de Alajuela denuncia penal en contra del actor por infracción al artículo 33 de la Ley Forestal. (Imágenes 21 a 24 del expediente administrativo OA-338.pdf aportado como prueba). 9. En fecha 3 de mayo de 2019, el notario Javier Armando Slein Sandí realiza acta notarial a solicitud del actor, la cual señala: “A solicitud del señor VICTOR JAVIER URZOLA HERRERA, me presente, primeramente en finca de su propiedad, ubicada en el Distrito cinco, La Guácima, Cantón uno, Alajuela, de la Provincia de Alajuela, al ser las once horas veinte minutos del día uno de mayo del dos mil diecinueve para dar fe de lo observado tanto en dicha propiedad como en terreno colindante, específicamente en relación a la existencia de una presunta naciente de agua permanente, la cual se encuentra dentro del terreno contiguo a su propiedad registral, presunta naciente que se encuentra aproximadamente a noventa metros de distancia de donde se están levantando edificaciones de block y concreto las cuales el suscrito notario pregunta sobre la finalidad de dicha construcción y según se me informa serán destinadas a cuadras para equinos y demás instalaciones de apoyo.
Me dirijo a dicha presunta naciente acuífera en compañía del señor URZOLA HERRERA y de los señores JUAN GREGORIO PAVON RAMOS, cedula (sic) de residencia uno cinco cinco ocho uno siete cuatro nueve cero cuatro dos ocho y del señor GABRIEL ANDRES FERNANDEZ (sic) QUESADA, cedula (sic) dos - cero quinientos noventa y seis - cero novecientos veinticuatro, personas a quienes pregunté si tienen familiaridad con la zona y con los terrenos aledaños, respondiendo positivamente al suscrito notario. Al llegar el suscrito notario público junto con las tres personas ya indicadas, encontré un acceso de agujero en tierra, el cual se encuentra al pie de una roca de aproximadamente un metro de diámetro y un área de vegetación propia de la zona sin detalles sobresalientes. Dicho agujero y entorno se encuentran totalmente secos, pregunta, en mi presencia, el señor URZOLA HERRERA a quienes lo acompañan, si lo que los presentes, incluyendo al suscrito estamos observando es una condición normal, recibiendo por respuesta de los señores Pavón y Fernandez (sic), que dicho sitio nunca ha sido una naciente de agua, que solamente cuando es temporada de lluvia, rebalsa agua por dicho agujero a manera de desfogue de aguas, cesando de salir al momento de detenerse la lluvia y que en temporada seca permanece totalmente seco, por lo que se llama afloramiento de agua, no se le conoce como naciente.
En mi presencia, comentan entre quienes se encuentran a mi lado, que lo que está observando es una condición natural de la región. Constato que dicho sitio, no se encuentra en terrenos propiedad del señor URZOLA HERRERA, pues para llegar al sitio que se me solicitó observar, debí salir de los linderos visibles de la propiedad donde me presenté originalmente. Procedía a preguntar a las personas supra citadas sobre la continuidad de afloramiento en época lluviosa, recibiendo la respuesta de que en año de mucha lluvia el afloramiento es ininterrumpido solo por algunas semanas, a lo sumo tres o cuatro meses y que luego de permanecer emanando agua algunos días o semanas del año, se seca rápidamente y permanece así por varios meses tal como el suscrito notario lo está observando en este momento. Escucho conversar a los interlocutores ya indicados, que los registros de afloramientos en la zona son comunes en años de grandes precipitaciones, pero generalmente no son sitios de generación de flujo acuífero ni generan cauce, salvo las zanjas de corrida de agua cuando hay fuertes aguaceros comunes de la zona en época de lluvia y que en las ocasiones cuando se producen afloramientos, estos no son voluminosos y que no existe una salida de agua con presión que haga presumir que dicho afloramiento sea un ramal de comunicación con un afluente subterráneo.
El suscrito notario observa que se está en proceso de reforestación en la propiedad del señor Urzola Herrera, y escucho que le indica a los demás acompañantes que ya se han plantado cuarenta árboles de especies nativas de la zona, distribuidos a lo largo de ciertas áreas de la totalidad de la finca pues tiene la intención de reforestar una zona que en pasado (sic) fue tan golpeada por la deforestación. Se tiene por consignada la información sobre afloramientos habiendo estado el suscrito de cuerpo presente en la zona ya indicada, siendo dicha presencia un lapso de dos horas a partir de momento (sic) de llegada del suscrito notario. Se procede a hacer un receso de almuerzo y al ser las catorce horas quince minutos, se presenta una llovizna sobre la zona, se comenta en mi presencia que es normal de la época de transición y transcurrido un período de una hora, por lo que, de forma individual, volví a recorrer el sendero hasta la presunta naciente y constaté que a pesar de la llovizna, no existe rastro de algún tipo de afloramiento de agua.
Siendo esta la manifestación de lo observado y lo que se conversó en mi presencia, me retiro de la zona y procedo a cerrar la presente acta al ser las quince horas y cuarenta minutos de la misma fecha supra indicada…” (Imágenes 10-11 del expediente judicial digital). 10. En fecha 3 de junio de 2019, se emite el oficio DA-UHTPCOSJ-1032-2019 por parte de la Unidad Hidrológica Tárcoles – Pacífico Central a favor de Pablo Cerdas Murillo, indicando que: “El pasado martes 21 de mayo junto a su persona realizamos una visita al lugar donde se ubica la fuente en referencia, esto en la Guácima de Alajuela, en la coordenadas latitud 214.285 y longitud 505.040, allí se determinó que la fuente a pesar de que ya habían caído algunos aguaceros estaba completamente seca. Una vez revisado el Sistema Nacional Integrado de la Gestión de los Recurso Hídricos (SINIGIRH), se determina que la fuente tiene otros dictámenes realizados en años anteriores y en diferentes épocas del año, donde los técnicos determinaron que la naciente es de carácter permanente.
Por lo tanto, dada esta ambigüedad y tomando en cuenta lo estipulado por esta Dirección de Agua en la guía de Dictamen Técnico sobre Cuerpos de Agua es que se establece realizar un seguimiento sobre esta fuente para el presente año hidrológico que iría de junio a mayo, para demostrar que efectivamente la naciente es de carácter intermitente o no. Igualmente, se les informa que si ustedes tienen documentación gráfica sobre esta fuente tales como fotografías o videos, tomadas durante los últimos meses las aporten para un mejor resolver”. (Imagen 20 del expediente judicial digital). 11. En fecha 26 de julio de 2019, el notario Allan Makhlouf Maklouf realiza acta notarial en la que señala que “al ser las doce horas con treinta minutos del veintiocho de Junio del año en curso, concretamente en el lindero norte de la finca del Partido de Alajuela, inscrita bajo el sistema de folio real, matrícula número CUATROCIENTOS CUATRO MIL QUINIENTOS VEINTICUATRO- CERO CERO CERO, a realizar un levantamiento de acta notarial sobre la existencia de cuerpos de agua en el lindero antes dicho de la finca descrita.
La finca antes mencionada propiedad de la empresa Hacienda Inmobiliaria Real De Pereira SA, colinda par el norte con la finca del partido de Alajuela, inscrita bajo el sistema de folio real, matrícula número CUATROCIENTOS VEINTICUATRO MIL SETECIENTOS SESENTA Y NUEVE - CERO CERO CERO. Es precisamente sobre esta finca que se me solicita verificar la existencia de cuerpos de agua. Al apersonarme a la zona al momento de la visita no pude identificar que existiera algún tipo de quebrada o naciente de agua, ni emanaciones del subsuelo de forma permanente. Se identifican surcos por donde en la temporada lluviosa desfogan las aguas pluviales, de las fincas vecinas. Dicha diligencia se realizó en compañía del señor Juan Gregorio Pavón Ramos, … a quien se le tiene como testigo de los hechos anteriormente descritos. Se ratifica y aprueba todo lo anterior en -mi presencia y se concluye la presente treinta minutos después de iniciada.
El suscrito hace constar que se adjuntan a la presente acta fotografías del área tomadas al momento del levantamiento del acta que se adjuntan al testimonio para el solicitante y se guarda copia en mi protocolo de referencias como respaldo…”. (Imagen 12 del expediente judicial digital). 12. En fecha 12 de junio de 2020, la Fiscalía Adjunta del Primer Circuito Judicial de Alajuela presenta solicitud de desestimación dentro del proceso penal 19-002191-00305-PE por el delito de aprovechamiento de áreas de protección en contra del aquí actor y otros. (imágenes 137 a 139 del expediente judicial digital). 13. En fecha 13 de abril de 2021, el juzgado penal de Alajuela certifica que el proceso penal 19-002191-00305-PE por el delito de aprovechamiento de áreas de protección en contra del aquí actor y otros se encuentra archivado con desestimación. (Imagen 135 del expediente judicial digital).
Resultan hechos que no lograron probarse en este proceso: 1. La variación de criterio técnico por parte de la Dirección de Aguas del MINAE respecto a la naciente objeto de este proceso de permanente a temporal. (Los autos). 2. La condición de intermitente de la naciente registro N° 13092. (Los autos).
Señala el accionante que, mediante la prevención administrativa OA-283-2019, el SINAC, oficina Alajuela ordenó detener la construcción de una caballeriza dentro de su inmueble por estar dentro de un radio de 100 metros de una naciente permanente. Alega que dicha condición no es tal, sino que se trata de un registro de agua intermitente, que aflora solo durante la época lluviosa, quedando seca totalmente durante el verano. Señala que dicha actuación no le fue notificada y que, además, no ha realizado con sus actuaciones infracción a los numerales 33 y 58 de la Ley Forestal, 90 de la Ley de Conservación de la Vida Silvestre, 11 de la Ley de Biodiversidad, 50, 98, 99 y 101 de la Ley Orgánica del Ambiente y 31 de la Ley de Aguas. Considera en consecuencia que la conducta administrativa indicada, carece de fundamento para su existencia y por ello debe anularse y declararse la reparación de los daños y perjuicios que esto ha acarreado, dado que “ocasionó una situación de estrés y afectación sicológica, porque debí solucionar de manera inmediata una serie circunstancias, como el buscarle un sitio a los caballos que estaba albergando en las caballerizas, ver que hacía con los operarios y los materiales de construcción que estaban siendo empleados, para que los operarios no se fueran a trabajar a otro lado y los materiales no se deterioraran.
Además, debí contactar y pagar los honorarios de varios peritos que pudieran comprobar y dar fe de que la alegada naciente de agua no era permanente, sino intermitente. Yo, además soy médico cirujano, y debí alterar mi agenda de operaciones quirúrgicas y atención de pacientes que tenía programadas, para poder solventar los aspectos anteriores con la premura a la que hice referencia. Aunado a lo anterior, he tenido que sacar tiempo y dinero adicional para contratar un profesional en Derecho que me solucionara en vía administrativa la situación ocasionada con lo actuado por el funcionario del SINAC y, por otro lado, también he tenido que dedicar tiempo y dinero adicional para defenderme de una denuncia penal que está en trámite en mi contra, interpuesta por dicho funcionario, a sabiendas de la falsedad de sus afirmaciones. Para poder realizar todo lo anterior, he tenido que dejar de atender pacientes y de realizar cirugías, todo lo cual me ha afectado emocional y económicamente”.
En conclusiones, afirma que la condición de intermitente se probó a través de cuatro pruebas: las dos actas notariales aportadas, el criterio topógrafo y el oficio DA-UHTPCOSJ-1032-2019, de fecha 3 de junio del 2019 de la Dirección de aguas que señalan tal condición, con lo que se le resta fundamento fáctico a la prevención administrativa OA-283-2019. Complementa indicando que esta situación fue valorada dentro del proceso penal 19-002191-0305-PE por parte de la fiscalía, que concuerda con lo expuesto e invoca el principio non bis in idem conforme el 42 Constitucional y 14.7 del Pacto Internacional de Derechos Civiles y Políticos y 8.4 de la Convención Americana de Derechos Humanos.
Expone la representación de la Procuraduría como fundamento para el rechazo de la demanda que el acto cuestionado por la parte actora no le es aplicable el numeral 158 de la Ley General de Administración Pública, en tanto los elementos tanto formales como sustanciales del acto administrativo están presentes a cabalidad, fue dictado por el órgano competente, dentro de un procedimiento administrativo y con las formalidades procesales requeridas para su validez. Agrega que, el acto que genera la afectación, a saber, el dictamen DA-UHTPCOSJ-2039-2017, no está siendo impugnado en el presente proceso, con lo que carece de sustento la reclamación accionante. Por otra parte, reclama que la representación actora ni tan siquiera determina cuáles son los supuestos daños y perjuicios con lo que se incumple la obligación del 58 inciso e) del CPCA. En conclusiones afirma que la parte actora no logró acreditar la supuesta nulidad alegada, por lo que su teoría del caso, debe desestimarse.
Añade que la parte actora podría solicitar un nuevo permiso de construcción ante el Municipio si comprueba el cambio de circunstancias de la naciente, pero ello no afectaría la validez del acto administrativo dictado en el año 2019. En cuanto a la prueba para mejor resolver, hace la indicación de que ello son valoraciones de la fiscalía, ya que no se aportó la valoración del Juzgado Penal, por lo que su contenido no tiene relevancia probatoria para los autos, sin mencionar la independencia de la valoración penal frente a la contencioso administrativa, finaliza reiterando las excepciones planteadas y la condenatoria en costas.
Por su parte, el codemandado SINAC rechaza igualmente la demanda en la contestación y conclusiones invocando que el sustento de las actuaciones alegadas giran en torno de la pre existencia del criterio técnico DA-UHTPCOSJ-2039-2017 de la Dirección de Aguas del MINAE que califica la naciente objeto de este proceso como permanente, y que incluso dicha instancia afirmó en el oficio DA-UHTPCOSJ-1032-2019 que existen “otros” criterios técnicos en ese sentido, con lo que la actuación de sus funcionarios resultan de una aplicación directa del numeral 16 de la LGAP al aplicar dichos criterios técnicos, no siendo por ende arbitrarias ni antojadizas las actuaciones cuestionadas. Por otra parte, respecto del reproche de que se haya presentado la denuncia a nivel penal, invoca el cumplimiento de un deber legal, concretamente, el artículo 21 del Decreto 28409-MINAE Reglamento Autónomo de Servicios del Ministerio del Ambiente y Energía el cual consagra dicha obligación de los funcionarios, por lo que las actuaciones se apegaron a lo dispuesto por la normativa ambiental contenida en la Ley Forestal 7575 artículos 33, 34 y 54; Ley Orgánica del Ambiente 7554 artículos 34, 51, 61 y 99 d); Ley de Biodiversidad 7788 Artículos 22 y 28; Ley General de la Administración Pública Artículos 16 y 150.
Invoca como parte de la teoría del caso la accionante la aplicación del Principio non bis in ídem con fundamento en los numerales 42 Constitucional y 14.7 del Pacto Internacional de Derechos Civiles y Políticos y 8.4 de la Convención Americana de Derechos Humanos. Al respecto, es de importancia previo al conocimiento del fondo del presente asunto, delimitar los alcances y limitaciones de tal principio dado lo resuelto en se penal, frente a esta sede de lo contencioso administrativo. Por ello, debemos recordar que nuestro ordenamiento jurídico establece distintos regímenes de imputación de responsabilidad, de diversa naturaleza y que otorgan diferentes consecuencias jurídicas, siendo la clásica invocación de responsabilidad civil, administrativa y penal, ello sin demérito de la existencia de otros tipos de responsabilidad, acorde a la conducta que se somete a análisis. Con ello, el principio invocado no alcanza a que lo pronunciado en uno de estos razonamientos tenga el efecto reflejo de inhibir la facultad de conocimiento de las demás responsabilidades, que es, justamente, lo que la parte actora pretende hacer valer con su argumento.
Lo resuelto en sede penal, alcanza – exclusivamente – para delimitar que los hechos alegados e invocados en tal sede, puedan ser juzgados nuevamente, para imputar responsabilidad delictual, en los términos del delito inicialmente investigado, pero no alcanza a exacerbar, el análisis de los mismos hechos respecto a otras consecuencias jurídicas, que distan de ser de igual naturaleza, como lo es en este caso, la sede contenciosa administrativa. Nótese que incluso no existe relación entre las pretensiones de este proceso que poseen como base la alegación de la nulidad de las actuaciones administrativas identificadas como prevención administrativa OA-283-2019, así como las presuntas consecuencias dañosas originadas en ésta y lo investigado en el proceso penal, donde los hechos investigados y la imputación delictual investigada (aprovechamiento de áreas de protección) no tienen un efecto vinculante sobre la actuación acá cuestionada.
Así las cosas, no existe violación al principio invocado en tanto se tratan de cuestiones de orbe disímil y lo resuelto en uno, no posee afectación sobre la conducta administrativa objeto de este proceso.
NO IMPUGNACIÓN DE ACTUACIONES PREVIAS Y ALGUNOS ASPECTOS RELEVANTES DE VALORACIÓN DE LA PRUEBA EN EL CASO CONCRETO. AUSENCIA DE CRITERIO TÉCNICO: La teoría central de la parte actora, aunque así no lo enumera en sus alegaciones, es atacar la actuación administrativa OA-283-2019 por ausencia de su componente motivo, el cual, de acreditarse, acarrearía un vicio de la conducta administrativa y consecuente nulidad, demostrándose así la arbitrariedad que es manifestada en la demanda. Esto es así, por cuanto señala la inexistencia del presupuesto fáctico que sustenta la consecuencia jurídica de la limitación urbanística que pesa sobre su inmueble como una inhibitoria constructiva, concretamente, la situación de permanencia o intermitencia de una naciente de agua y su régimen de protección. Para ello, la parte ofrece cuatro elementos probatorios, a saber: dos actas notariales, un informe topográfico y el oficio DA-UHTPCOSJ-1032-2019, de fecha 3 de junio del 2019 de la Dirección de Aguas, los cuales, a su criterio, demuestran fehacientemente que estamos en presencia de una naciente intermitente, no una permanente.
Criterio del Tribunal: Lo primero que debemos considerar, tal y como lo hace ver la representación Estatal, es la limitación que la propia parte accionante realiza en sus pretensiones, dado que se limita a impugnar la prevención administrativa OA-283-2019, la cual tiene por presupuesto, el registro en otra instancia administrativa diferente al SINAC, sea la Dirección de Aguas del MINAE, y que corresponde al registro N° 13092 y que es identificada como naciente sin nombre, afluente de Quebrada Salitral, parte de la cuenca (84-24) Río Grande de Tárcoles y calificada así a partir del 1 de julio de 2016 como un cauce de dominio público permanente. Con ello, es claro que la teoría del caso de la demanda, no se enmarca a cuestionar el acto del SINAC, sino aquél de la Dirección de Aguas y que posee otra fecha de emisión y cuyo pronunciamiento de nulidad no puede entrarse a conocer sin violentar el principio de prohibición de ultrapetita procesal contemplado en el numeral 122 del Código Procesal Contencioso Administrativo.
Téngase presente entonces, que la alegación tanto de derecho como las pruebas aportadas, constituyen en el fondo, un ataque indirecto a la conducta administrativa de una tercera instancia administrativa, y que no es objeto del proceso. Limitándonos a la pretensión, esta Cámara de Jueces no puede ordenarle al SINAC que elimine o desatienda un gravamen que es administrado, competencialmente, por la Dirección de Aguas, ya que ello implicaría realizar una desaplicación singular o en el mejor de los casos, una ineficacia relativa del gravamen realizado por la Dirección de Aguas, lo cual atenta contra el principio de legalidad, en los términos del numeral 11 de la Constitución y 11 de la Ley General de Administración Pública. Efecto de esta limitación, autoimpuesta por la propia redacción de pretensiones del actor, la encontraríamos en el supuesto de que, aún declarando con lugar las pretensiones, ello no eliminaría la calificación jurídica de la Dirección de Aguas, y la limitación urbanística se mantendría, hasta que no se revise, administrativa o judicialmente, esta afectación.
Este fenómeno lo regula el numeral 38.1 del CPCA al señalar que no es admisible la pretensión de nulidad en relación con los actos que, estando viciados, sean reproducción de otros anteriores, firmes y definitivos. En otro orden de ideas, aún haciendo uso de la posibilidad que da el numeral 41.2.a en relación con el 122.a del CPCA, y valorar la actuación de la Dirección de Aguas como un “acto conexo”, la pretensión resultaría igualmente inatendible, en aplicación del numeral 16 en relación a los artículos 136.2, 158.4 y 302 de la Ley General de Administración Pública, ello frente al valor probatorio que le pretende reconocer la parte accionante a las cuatro pruebas ya referidas de la supuesta intermitencia de la naciente con registro N° 13092, tal y como de inmediato se explica. Como parte de la motivación de todo acto administrativo, la Ley General de Administración Pública indica, conforme el numeral 16, 160 y 216 la aplicabilidad de reglas de la ciencia y de la técnica, ellas de aplicación obligatoria cuando son en sentido unívoco, entendiendo que, cuando no sea de tal forma, los parámetros a aplicar deben ser los de la lógica, racionalidad y razonabilidad, encontrándonos así en el campo de lo que se conoce como discrecionalidad técnica, ello en tanto existan, técnicamente, más de una opción a utilizar por parte de la Administración en la creación, modificación, extinción, ejecución, suspensión o revocación de determinada conducta administrativa.
Ahora bien, el mismo cuerpo normativo, conforme el artículo 15 y el ya citado numeral 16, le otorgan prerrogativas al juez de lo contencioso administrativo (49 Constitucional, 1, 2, 36, 42 y 122 del CPCA) para que controle tal discrecionalidad, con la finalidad de verificar que estamos dentro de los parámetros legalmente permitidos para declarar la conducta administrativa como ajustada a derecho. Con ello, a consideración de esta Cámara de Juzgadores es que se debe plantear un mecanismo objetivo para que el juez cumpla con tal tarea, sobre todo si se pone especial cuidado en la redacción que se desprende del párrafo segundo del ya citado 16 que afirma: “El Juez podrá controlar la conformidad con estas reglas no jurídicas de los elementos discrecionales del acto, como si ejerciera contralor de legalidad”, lo cual se une a la máxima iudex peritus peritorum (el juez es perito de peritos), junto con el adagio iura novic curia (el juez conoce el derecho).
Así, podemos crear un tipo de baremo con componentes básicos que permita al juzgador realizar la aplicación de la fiscalización administrativa, aún en escenarios de discrecionalidad técnica, a lo cual podemos pensar en ciertos mínimos y máximos aplicables a casos concretos para darle un contenido concreto al llamado Principio de Interdicción de la Arbitrariedad. Por una parte, encontramos un mínimo de verificación técnica (presupuesto para la aplicación del escenario jurídico), es decir, la existencia de, efectivamente, un mecanismo técnico de aplicación por parte de la Administración y no una simple ocurrencia, los cuales van a ser definidos por la rama de la ciencia de que se trate, y ello se verifica ante la identificación del método (elemento objetivo, 16 LGAP) y del técnico (elemento subjetivo, 302 LGAP) que participan de la conducta administrativa, ello con la finalidad de evitar una eventual falacia de autoridad.
Por otra parte, es posible fiscalizar si, en el caso concreto, dicho método fue utilizado correctamente en la conducta administrativa (o si no se utilizó del todo) y si éste fue realizado por quien posee la pericia para ello. Ahora bien, aun superando estos análisis, es posible entonces que encontremos más de una solución técnica, ya sea por la existencia de varios métodos, o por la posibilidad de que varios técnicos sean los que puedan hacer la tarea, y es justamente en este ámbito, en la que entra el componente discrecional de la Administración. Es claro que, si se habla de métodos, las diferentes ramas de la ciencia nos brindan desde los más generales, hasta los más específicos y detallados, ocurriendo lo mismo con los técnicos y profesionales, encontrando desde profesiones y oficios compatibles, hasta grados académicos y profesionales de especialización. Por ello, de verificar que la Administración, en parámetros de racionalidad y razonabilidad, así como de lógica, utilizó un método y un funcionario apto para el fin que se buscaba, aún pese a la existencia de otras alternativas y otro tipo de técnicos, entra en aplicación el principio de conservación del acto administrativo, no pudiendo el juez sustituir a la Administración.
Hablamos de lógica, razonabilidad y racionalidad aplicada de manera práctica, cuando se verifica que la acción administrativa no es, abiertamente incompatible para la tarea o fin que se requiere y que sirve de fundamento al actuar administrativo, concluyendo válidamente que dicho análisis es posible, particularmente, echando mano a prueba pericial de verificación, en tanto a través de este mecanismo probatorio se puede identificar las carencias, defectos, irregularidades y cualquier otro elemento que le permita al juzgador, de manera objetiva, llegar al convencimiento de la existencia de una conducta arbitraria o por el contrario, afirmar que se actuó bajo los parámetros de discrecionalidad técnica permitida. Ahora bien, tenemos entonces que cotejar lo que consta en el expediente administrativo en los términos supra – indicados, encontrando que al acto OA-283-2019 aparentemente se le acompañó y notificó a la parte accionante (imágenes 14 a 18), no siendo ello desacreditado en este proceso, con lo que se presume el cumplimiento de lo ordenado por el numeral 136.2 de la Ley General de Administración Pública.
Ahora bien, el actor alega un supuesto vicio en la notificación, mas la da por entendida en el hecho 3 de la demanda, con lo que cualquier vicio en la comunicación del acto se tendría por subsanado, y ello en el entendido que, de igual manera, no se atacó el acta de notificación visible a imagen 14 del expediente administrativo realizado a las 11 horas del 2 de mayo de 2019, en la casa de habitación del promotor de la demanda. Así, encontramos que el criterio técnico, que señala la Dirección de Aguas y que lleva por título DA-UHTPCOSJ-2039-2017, es acompañante y sirve de motivación al acto objeto de este proceso. Frente a esto, cotejemos con la prueba obrante en autos, comenzando con el oficio DA-UHTPCOSJ-1032-2019 del 3 de junio de 2019, la cual es emitida por Álvaro Leonel Porras Vega, de la Unidad de Hidrológica de Tárcoles – Pacífico Central de la Dirección de Aguas del MINAE. Al respecto, la parte considera que este oficio acredita que la naciente es intermitente, aspecto que, de su lectura, no concuerda este Tribunal.
Más allá del hecho de que se desconoce quién es Pablo Cerdas Murillo, destinatario del oficio, queda con meridiana claridad constatado que el oficio es un acto interlocutorio, no resolutivo en el cual informa al citado señor Cerdas Murillo, que no es parte de este proceso, que se realizó el 21 de mayo de 2019 una visita de campo en las coordenadas latitud 214.285 y longitud 505.040, por lo que se entiende que se trata de la misma locación que la naciente objeto de este proceso, e indica que, al momento de la visita, el sitio estaba seco. Empero, además aclara que, en el Sistema Nacional Integrado de la Gestión de los Recursos Hídricos, a dicha fuente de agua se le realizaron “otros” dictámenes que señalan la condición de fuente permanente, calificando este evento de “ambigüedad”. De igual forma, advirtió de inmediato que ante supuestos de este tipo había que apegarse a lo que dispone la guía de “Dictamen Técnico sobre Cuerpos de Agua” que obliga a que se deba realizar un estudio de al menos un año entre los meses de junio a mayo “para demostrar que efectivamente la naciente es de carácter intermitente o no” (resaltado es nuestro, imagen 20 del expediente judicial digital).
Así, lejos de acreditar el hecho señalado por el demandante, y de constituirse como un cambio de criterio de la Dirección de Aguas, el oficio DA-UHTPCOSJ-1032-2019 no contradice el DA-UHTPCOSJ-2039-2017, no constituye el acto final de declaratoria o definición de la condición técnica de la naciente objeto de este proceso. Por otra parte, las actas notariales aportadas, una realizada por la propia el propio apoderado especial judicial del actor y el otro por el notario Allan Makhlouf Maklouf, no constituyen prueba técnica con la capacidad de sustituir el criterio técnico de la Dirección de Aguas, y se limitan a describir una observación, al igual que ocurriría con una inspección ocular judicial, a la constatación en tiempo y lugar de determinadas circunstancias fácticas, las cuales son independientes de una valoración técnica, en este caso de hidrología, en los términos del numeral 16 y 302 de la Ley General de Administración Pública o 94 y 105 del Código Procesal Contencioso Administrativo (Prueba Pericial).
Por último, el informe del ingeniero topógrafo David Silvestre Valverde Cordero, no resulta a nivel de calificación de idoneidad técnica subjetiva como competente para emitir un criterio en sustitución de quien conoce de la materia de hidrología, ya que la rama de la topografía no alcanza en tales términos, por lo que el informe aportado no resulta como prueba conducente como lo pretende la parte actora. Por último, podríamos acá traer a colación la prueba admitida para mejor resolver, correspondiente a la solicitud de desestimación de la Fiscalía Adjunta de Alajuela, la cual tampoco resulta ideal para demeritar lo supra citado por varios motivos: el primero, se trata de la opinión o interpretación que realiza una fiscal dentro de un proceso penal, el cual no puede sustituir la actuación administrativa y no constituye un pronunciamiento de tipo jurisdiccional; segundo, dicha actuación procesal está circunscrita a los efectos que tuvo dentro del proceso penal 19-002191-0305-PE, por lo que no puede extralimitarse su valor probatorio; y tercero y de mayor importancia, se trata de una prueba indirecta o remisiva, ya que la Fiscal hace referencia a un aparente oficio DA-UHTPCOSJ-1061 en el que, supuestamente, la Dirección de Aguas “recalificó la naciente como de carácter intermitente”, mas dicho oficio no fue presentado en este proceso por lo que se desconoce su contenido y alcances.
Así, como la parte actora no aportó prueba idónea de naturaleza técnica que contradijese la prueba obrante en autos, ni tampoco existen pretensiones en ese sentido, ya sea declarativas de la circunstancia fáctica de la naciente registro N° 13092, este agravio debe ser rechazado.
Siguiendo lo señalado en el considerando anterior, no se logra identificar otros alegatos que ataquen la validez del acto administrativo objeto de este proceso, por lo que ha de confirmarse el ajuste al marco de legalidad de la conducta impugnada, tanto en sí misma, como por su fundamentación en el criterio técnico de la Dirección de Aguas. Sin embargo, resulta relevante para el presente caso que la parte actora tenga claro el régimen de afectación urbanística no indemnizable que se desprende del párrafo segundo del numeral 45 Constitucional, en tanto de él se desprende la limitación que afectó su capacidad edilicia dentro del terreno y que, a la postre, alega como originador de daños y perjuicios reclamables a los demandados. Por un lado, ha de entenderse que el hecho constitutivo del gravamen no es un acto discrecional de la Administración Pública demandada, sino que, como se indicó supra, esta posee su génesis en el registro N° 13092 de la Dirección de Aguas que ingresa la fuente de agua objeto de este proceso identificada como naciente sin nombre, afluente de Quebrada Salitral, parte de la cuenca (84-24) Río Grande de Tárcoles y calificada así a partir del 1 de julio de 2016 como un cauce de dominio público permanente.
Es a partir de tal fecha que las propiedades circundantes a tal naciente quedaron afectas a las limitaciones de la Ley de Aguas, siendo ésta, de carácter no indemnizable, la imposibilidad de edificación en el rango de protección de nacientes regulada en dicha normativa en su artículo 31. Empero, las circunstancias de la naturaleza pueden llegar a cambiar, ya sea por el hecho de que el punto exacto del alumbramiento del caudal se reubique, sea obstruido, se combine subterráneamente con otras fuentes, se seque, o cualquier otro factor que altere, modifique o extinga el punto de afloración de agua. Para demostrar esta variabilidad de las circunstancias, por el principio de paralelismo de las formas, debe realizarse el mismo trámite, es decir, tal cual se generó la afectación, así debe seguirse para su desafectación, llevando razón la indicación que hace la Dirección de Aguas en el oficio DA-UHTPCOSJ-1032-2019 al señalar que la determinación del cambio debe realizarse a través de un estudio técnico de – al menos – un año, resultando que la pretensión de modificación es posible, si se siguen tales parámetros.
Pero en todo caso, ha de aclararse que el Principio Pro Natura que deviene no solamente del párrafo segundo del numeral 45 Constitucional, sino del propio numeral 50 de la Carta Magna que consagra la prelación del ambiente sano y ecológicamente equilibrado, implica que tal variación, en caso de así acreditarse, se configuraría como una modificación del régimen de afectación urbanístico a futuro, nunca retroactivo, que es, en el fondo, lo que pretende de manera indirecta el actor que este Tribunal declare. En síntesis, aun considerando que existiese una actuación posterior que modificase el régimen de protección de la naciente de registro N° 13092, ello lo sería con efectos futuros y no con efectos retroactivos, lo que implicaría que, aún en este supuesto, la variación ex nunc (hacia futuro) no tiene efecto invalidante sobre la actuación administrativa objeto de este proceso del SINAC. Ha de entenderse, consecuentemente, que lo único que realizó el órgano con personalidad jurídica propia, es realizar un cumplimiento de un deber legal, frente a la afectación vigente al momento de los hechos, eliminando la alegada arbitrariedad que aqueja el demandante, sustentando con ello, el ejercicio correcto de las competencias asignadas al órgano público demandado.
Téngase por otra parte presente, que parte de dicho ejercicio legítimo y cumplimiento de deberes legales, está la de poner en conocimiento de las autoridades competentes, como lo sería la penal, de hechos que han de investigarse en el ámbito de cada uno, ello independientemente de que al final de tales gestiones, se determine la procedencia o improcedencia de una imputación de responsabilidad en los términos del considerando VII de esta sentencia. Por ello, tampoco este agravio es de recibo.
Corolario de todo lo anterior, encontramos que la pretensión primera no es de recibo ante la falta de acreditación de elementos invalidantes del acto administrativo OA-283-2019 de las 14 horas del 8 de marzo de 2019, que dicta medida preventiva y ordena la suspensión inmediata de todo tipo de actividad en el sitio georreferenciado por medio del sistema GPS CRTM-05 E-468780 – N-1099424. De manera consecuente, ante la carencia de una base antijurídica que sustente la reclamación de indemnización de la pretensión segunda, por conexidad y derivación, ha de rechazarse igualmente, ello ante la falta de requisitos conforme los numerales 191, 192, 195 y 275 de la Ley General de Administración Pública.
En la contestación de la demanda, ambas partes demandadas opusieron la excepción de falta de derecho, la cual se acoge en su totalidad. Y se señala que, respecto de la defensa de defectos no subsanados en la demanda que impiden pronunciamiento de fondo alegada por la representación estatal, se hace ver que ésta fue resuelta interlocutoriamente en la audiencia preliminar, y por la forma en cómo se resuelve el presente asunto, carece de interés la revisión de lo resuelto.
Respecto a las costas, de conformidad con el numeral ciento noventa y tres del Código Procesal Contencioso Administrativo, las costas procesales y personales constituyen una carga que se impone a la parte vencida por el hecho de serlo. La dispensa de esta condena sólo es viable cuando hubiere, a juicio del Tribunal, motivo suficiente para litigar o bien, cuando la sentencia se dicte en virtud de pruebas cuya existencia desconociera la parte contraria. En la especie, el Tribunal no ubica algún motivo para exonerar en costas, por lo que procede imponerlas a cargo de la parte actora.
POR TANTO
Con base en los fundamentos de hecho y derecho expuestos se acoge la defensa de falta de derecho opuesta por las demandadas. Consecuentemente, se declara SIN LUGAR la demanda interpuesta por Victor Urzola Herrera en contra del SINAC y el ESTADO. Son ambas costas a cargo de la actora, mismas que se deberán de liquidar en la etapa de ejecución de sentencia. Notifíquese.
