Esas áreas, antes a mayor distancia de la pista, no tenían las limitaciones específicas apuntadas por la Dirección de Aviación Civil y que se traducen en general, en impedimentos para siembra de productos que por su altura, puedan poner en riesgo la seguridad de las aeronaves. Por eso, es posible afirmar, de manera cierta, que la expropiación no sólo conllevó una reducción de la cabida, sino también una menor capacidad de uso del terreno, en particular la siembra de palma aceitera -uso actual-. También se afectó la regularidad del inmueble y eso sin duda alguna incide en la deseabilidad del inmueble y afecta su precio, siendo éste justamente, el daño al remanente que el perito encontró, al realizar su experticia y que, como lo reclaman los recurrentes, debe ser indemnizado. Esta Cámara, a falta de prueba determinante sobre una afectación mayor, estima que la afectación es la mínima, es decir, del uno por ciento (1%), pues el peritaje judicial no arroja elementos de juicio suficientes, para conceder el monto total que fija en su experticia. Ese daño, además, debe calcularse a partir del monto por metro cuadrado establecido en el avalúo administrativo, que fue el que se fijó en sentencia y con el cual se conformaron las partes, de cuatro mil quinientos cincuenta y seis colones (¢4.556,00). Así las cosas, de acuerdo con la certificación registral que consta en autos, la finca total, antes de la expropiación, es de 388.709,58 metros cuadrados, por lo que, una vez restada el área expropiada, de 48.664 metros cuadrados, el área remanente es de 340.045,58 metros cuadrados. Así lo indica claramente el avalúo administrativo y lo confirma el perito judicial, de modo que no hay controversia al respecto. II CIRCUITO JUDICIAL DE SAN JOSÉ. ANNEX A. Goicoechea, at thirteen hours and twenty minutes on veintinueve de junio de dos mil veintiuno.- Judicial proceedings to determine fair compensation (justiprecio) in an expropriation, brought by the State, represented by Procurador Alejandro Arce Oses, against Nombre162427, identity card CED127072, and Nombre162428, identity card number CED127073.- Also participating are the Consejo Técnico de Aviación Civil (CETAC), the Junta de Desarrollo Regional de la Zona Sur (JUDESUR), and the company Palma Tica, Sociedad Anónima.- Upon appeal by the expropriated party, this Court reviews the first-instance judgment, N°1303-2020, issued at thirteen hours and eighteen minutes on treinta de junio de dos mil veinte.- The matter is decided unanimously after deliberation.- Judge Fernández Argüello writes the opinion, and

WHEREAS:

I).- CORRECTION OF CLERICAL ERROR: The heading of the appealed judgment states that this expropriation is being pursued against the company Embotelladora Candry de Costa Rica S.A., which is incorrect. These proceedings are directed exclusively against Nombre162427 and Nombre162428, in their capacity as co-owners of the land subject to dispossession (despojo), and this is hereby clarified.- II).- PROCEDURAL MATTERS: The State brings these proceedings to establish the price it must pay Nombre162428 and Nombre162427 for the expropriation of a 48.664-square-meter parcel of land that forms part of property registered under folio Placa33223 in the Partido de Puntarenas and is required for the expansion of the Aeródromo de Drake.- The expropriated parties objected to the administrative appraisal (avalúo administrativo), and the Consejo Técnico de Aviación Civil and the Junta de Desarrollo Regional de la Zona Sur were admitted as parties.- Following the required proceedings, Judge Billy Araya Olmos, in judgment N°1303-2020 issued at thirteen hours and eighteen minutes on treinta de junio de dos mil veinte, ruled:

"THEREFORE: THE COMPENSATION SET FORTH IN ADMINISTRATIVE APPRAISAL N° 2016-126 OF 26 DE NOVIEMBRE DE 2016 IS AFFIRMED, in the amount of TWO HUNDRED SEVEN MILLION SIX HUNDRED THIRTY THOUSAND EIGHT HUNDRED SEVENTY-SEVEN COLONES (¢207.630.877,00). This compensation comprises the following items: 1.- Expropriation of a 4,8664-hectare parcel of land, valued at ONE HUNDRED NINETY-EIGHT MILLION THREE HUNDRED FIVE THOUSAND EIGHT HUNDRED COLONES (¢198.305.800,00), at ¢45.560.000,00/ha, pursuant to cadastral plan (plano catastrado) 6-1912006-2016, which forms part of the parent property (finca madre) F.R. 6- 00094703-001-002. It has 1037,97 meters of frontage and a depth of 630 meters and is located in Bahía Drake, Osa, Puntarenas; its current use is agriculture and livestock farming. This parcel is irregularly shaped, with essentially flat topography, and because of the design for the expansion of the Aeródromo de Drake, a portion of the front section of the referenced parent property is being acquired.

It is bounded on the east and west by public roads, on the north by Nombre162429, and on the south by a public road. Due to the size of the property, it has access from the south, east, and west by gravel roads without drainage ditches. The property is currently enclosed by a fence made of wooden posts and barbed wire, as well as teak and poro trees. Additionally, the property contains oil-palm crops, the area of which is enclosed by an electrified fence. The area in which the aforementioned parcel is located has basic public services, e.g., potable water, electricity, and garbage collection. There are no major shopping centers, but the area does have public educational centers, small grocery stores that supply local residents, and cabins for tourist accommodations. In other words, the land to be expropriated is bounded to the North by Nombre162427 and Nombre162430; to the South by Nombre162427 and Nombre162430; to the East by Nombre162427 and Nombre162430; and to the West by a right-of-way easement (Servidumbre de Paso) and Cooperativa de Servicios Múltiples de Coto 63 RL.

This land appears among the North, South, and West boundaries because it is embedded within the land of the parent property; see the Cadastral Composite of Areas to Be Expropriated. 2.- Trees and plantations, valued at ONE MILLION ONE HUNDRED FIFTY-FOUR THOUSAND ONE HUNDRED FORTY-TWO COLONES (¢1.154.142,00), at ¢2.000,00/m². This compensation, in turn, comprises: 2.1.- Oil-palm plantation and poro, orange, and teak trees, valued at six million three hundred thousand colones (¢6.300.000,00). Specifically, within the property to be expropriated there is a cultivated area of 2,94 hectares, and an average of 143 plants per hectare is estimated, resulting in an estimated 420 oil-palm plants. A total of 25 teak trees, 1 orange tree, and 15 poro trees were counted. The teak trees have a diameter ranging from 0.25 m to 0.5 cm and a height ranging from 3 to 5 meters. The poró trees have a diameter of approximately 0.25 m and an average height of 3 m, pursuant to Anexo 3. 3.- RECONSTRUCTION OF ACCESS RAMP over a natural channel for transporting palm fruit, measuring 60 m long by 6 m wide, with an estimated gravel thickness of 7 cm and an area of 360 m², valued at SEVEN HUNDRED TWENTY THOUSAND COLONES (¢720.000,00), at ¢2.000,00/m².

This activity must be compensated in this report because the owner must perform the work again to maintain the movement of machinery during palm-fruit harvesting; accordingly, the corresponding quotation was obtained to determine the cost per m² of ramp. 3.- Compensation for restoration of the plan: 3.1.- Increase (10%) of ninety-seven thousand two hundred sixty-seven colones (¢97.267,00); 3.2.- Stamps in the amount of fifty thousand colones (¢50.000,00). II. The parent property to be expropriated is registered under the real-folio system (folio real), registration number Placa33223, and is owned by Nombre162431, identity card CED127074, and Nombre162427, identity card CED127075, who respectively own interests 0001 and 002. Its description is agricultural land Dirección19537, and it is bounded to the North by Dirección19538, to the South by Dirección4870, to the East by Dirección336, and to the West by Dirección336.

It measures: Three hundred eighty-eight thousand seven hundred nine meters and fifty-eight square decimeters, pursuant to cadastral plan P-0292276-1995. The following entries are recorded against this property: Expropriation order under filing reference 2017-181075-001. And encumbrances (gravámenes), namely: 1.- Statutory reservations under the water law and public-roads law, filing references: 430-03899-01-0131-001. 2.- First-ranking mortgage under filing reference: 546-15234-01-0001-001. 3.- Second-ranking mortgage under filing reference: 2011-132062-01-0005-001. 4.- Third-ranking mortgage under filing reference: 2011- 132062-01-0006-001. III. As a result of the Proyecto Ampliación del Aeródromo de Drake, the remaining area of property F.R. 94703-001/002 in the Partido de Puntarenas will be 340.045,58 m² and will be bounded to the North by Nombre162427 and Nombre162428 (Land to be expropriated), to the South by Nombre162427 and Nombre162428 (Land to be expropriated), to the East by Nombre162427 and Nombre162428, and to the West by Servidumbre de Paso and Cooperativa de Servicios Municipales de Coto 63 RL (Land to be expropriated).

IV. III. The expropriated property shall be allocated to construction of the project "Ampliación del Aeródromo de Drake"; the property was declared to be in the public interest pursuant to the Resolution of the Ministerio de Obras Públicas y Transportes, issued at eleven hours and fifty minutes on cinco de setiembre de dos mil dieciséis and published in the newspaper La Gaceta N° 196 on doce de octubre de dos mil dieciséis. IV. Once this ruling becomes final, the Notaría del Estado is authorized to proceed as soon as possible with the corresponding incorporation of the record into a notarized instrument (protocolización de piezas). The certifying officer of the Registro Público assigned in due course is required to cancel all entries, charges, and encumbrances affecting the expropriated property based on the instrument incorporating the record, without further proceedings and without prejudice to any civil, criminal, or administrative liability, including liability that may be imposed on any official charged with carrying out that duty who is reluctant to comply with the foregoing provision in a timely and proper manner, under section 190 of the Ley General de la Administración Pública and section 314 of the Código Penal.

In other words, once this judgment becomes final, the Administración Tributaria de Puntarenas and the Ayuntamiento de Osa shall be notified so that each Public Administration may determine the applicable national and local tax liabilities. No special award of interest or interest. THAT IS ALL. Notify promptly." Dissatisfied with that ruling, the expropriated persons filed a timely and procedurally proper appeal, which was admitted; accordingly, it is analyzed below. The oral hearing on the appeal was held at nine hours on veintiséis de febrero de dos mil veintiuno.- III).- PROVEN FACTS: The proven facts contained in the appealed ruling are affirmed because they are consistent with the evidence cited in support thereof. The following are added: 8) The expropriated property is located "approximately 125 meters Southeast of the Aeródromo de Drake" (administrative appraisal, folio 68, image N°2, of the administrative record); 9) According to the cadastral composite of areas to be expropriated prepared during the administrative proceedings, the location of the area subject to dispossession and the remainder of the property is shown as follows (folio 18 of the administrative record):

  • 9)As stated by the Dirección General de Aviación Civil during the expropriation proceedings: "1. The Aeródromo de Drake expansion project was planned as a code 1B aerodrome; therefore, the remainder of the parent property will be located within three obstacle-limitation surfaces, which are listed below: a. Approach surface. b) Transitional surface. c. Inner horizontal surface. The limitations shall be as follows: a. Approach surface. A clear distance of 80 m must be maintained from the Airport’s western boundary. From that point, construction may reach a maximum height of 4.00 m above the natural ground level and may increase by 0.5m for every 10m farther east from the airport. b. North Transitional Surface. A clear distance of 9.00m must be maintained from the Airport’s southern boundary. From that point, construction may reach a maximum height of 4.00m and may increase by 2.00m for every 10m farther north, up to a height of 45.00m above the natural ground level. c. South Transitional Surface.

(zone A) Because this is an area composed of two slopes, the precise location where a structure is intended to be built must be known; therefore, it is impossible to determine a maximum height in this zone, although, as a general indication, the farther from the airport, the greater the permitted building height, provided that it does not exceed 15.00m above the natural ground level. d. North Transitional Surface. (zone 8) In this zone, construction may reach a maximum height of 15.00m from the Airport’s southern boundary and may increase by 2.00m for every 10.00m farther south, up to a height of 45.00m above the natural ground level. e. Inner Horizontal Surface. On this surface, construction may reach a maximum height of 45.00m above the natural ground level (...)"; the foregoing is shown in the following sketch:

  • 10)The expansion of the Aeródromo de Drake entails a change in category from 1A to 1B, for the purpose of providing greater safety for aeronautical operations, since the length and width of the runway, as well as its safety strips, were expanded. The restrictions resulting from that change are exactly the same as those that existed before the expansion, since the number in the Aerodrome classification remains One (official letter DGAC-DA-IA-OF-0181-2021, dated 12 de abril de 2021, signed by engineers Francisco Madrigal Gutiérrez and Alexander Sánchez Mora, respectively Head of the Aeronautical Surveying Process and Head of Aeronautical Infrastructure, both of the Dirección General de Aviación Civil; evidence obtained for further adjudication (prueba para mejor resolver), images 18 to 24 of the appeal record);
  • 11)According to plan 6-1913448-2016 (the plan describing the land on which the Aerodrome was located before the expropriations), as well as plan 6-1912006-2016 (the plan describing the land to be expropriated), property number 94703-001 and 002 was separated from the Aerodrome grounds by an easement (servidumbre) 9.00m wide, and the distance of 125 meters from the expropriated land to the Aerodrome was measured in the administrative appraisal (avalúo administrativo) from the boundary of that land to the entrance to the airfield by way of the public road (same official letter DGAC-DA-IA-OF-0181-2021 and the plans attached thereto);
  • 12)The restrictions before and after the expansion of the aerodrome are exactly the same; the only change was the location of the obstacle limitation surfaces (superficies limitadoras de obstáculos), because they are determined by reference to the runway (same official letter cited above).- IV).- GROUNDS FOR APPEAL (AGRAVIOS): The attorneys-in-fact (apoderados) for the appellants state that the judgment contains defects of form and substance that must be corrected. They assert that the judgment identifies as an expropriated party a bottling company that has no connection with the matter, confuses the Administration’s expert witness (perito) with the expert evidence received in the judicial proceedings, and also orders the disbursement of part of the compensation to Palma Tica S.A. without suitable documentation establishing the outstanding balances, as well as the payment of other debts not included in the corresponding deed. They state that the Judge misunderstood the nature of the plants and fruits for purposes of determining the price. They therefore contend that the judgment is legally untenable and conflicts with the purpose of expropriation, which is to establish a fair price. Regarding the debts owed to Palma Tica S.A., they maintain that there are two mortgages: the first for $72.301,00 and the second for $50.983,00, for a total of $123.184,00. In an order issued at 08:41 hours on 28 de junio de 2017, the court below (a quo) ordered the payment of those debts and an additional amount of ¢759.000,00 for the purchase of fertilizers, in favor of Palma Tica S.A., even though that amount was neither secured by a mortgage nor relevant to the encumbrances on the property. Nor is there any legal provision allowing the adjudicator to take that money from the parties they represent. They add that the property was subject to restrictions both before and after the expropriation; they assert that the Ley de Aguas markedly affects the value of the property, to the detriment of its price; they state that they requested an environmental impact study (estudio de impacto ambiental) and that the court-appointed expert determined that a drainage ditch (acequia) existed, although they believe it to be a wetland (humedal). They allege that the restrictions imposed on the expropriated property by aviation laws were not considered. They state that Engineer Nombre162432 requested information on several occasions that was not contained in the administrative record, after which it was determined that restrictions on use had existed even before title was granted, since there are several areas that cannot be used by the expropriated parties. Those restrictions do not appear in the Public Registry and have not been compensated; the parcel is therefore presumed to be unencumbered and, in any event, they believe that the unusable areas constitute uneconomic remnants (fundos inadecuados) for which payment must be made.- As a result of the expropriation, they assert, the property is divided in two and only the interior surface may be used; in the northern transition area, 9 meters remain free from the southern boundary, and in the approach surface, 80 meters remain free from the boundary. Logic, sound judicial discretion (sana crítica), and common sense indicate that the parcel is unencumbered and that the restrictions, despite being absolute, were not compensated. They state that the State did not determine that there was damage to the remainder (daño al remanente); however, such damage could indeed be observed during the judicial inspection (reconocimiento judicial), notwithstanding which the judge disregarded that issue. If the judgment is upheld, they assert, payment of the fair price is denied and the right to compensation is rendered ineffective, because the expropriated parties must bear the obligations generated by those areas, which they cannot use. They believe that the judgment lacks adequate reasoning regarding damage to the remainder; they consider it false that the conditions were preexisting, because a small aerodrome is not the same as an airport, just as the landing of small aircraft is not the same as the landing of large airplanes. What they seek is for the assets of the expropriated parties to remain unchanged with respect to the remainder of the property. They state that they are aware of the public interest involved in the project; nevertheless, their property is affected by more than 80%, given the severe restrictions affecting its desirability and use precisely because it is located in the area adjacent to the airport. They reiterate that damage to the remainder is an essential issue and that the judgment disregarded the court-appointed expert appraisal, which did quantify it.- Based on those considerations, they request:
  • 1)That judgment 1303-2020 be supplemented by adding damage to the remainder, namely loss of value resulting from the taking and the restrictions imposed, in the amount of ¢215.318.430,98 established by the court-appointed expert;
  • 2)That this amount be indexed to bring it to present value from the date possession was taken until actual payment; and
  • 3)Payment of statutory interest. In the alternative, they request that the trial judge be granted a mandatory deadline within which to make a new and fair determination of the compensation.- V).- THE STATE’S ARGUMENTS: The State representative, for his part, states that the appeal does not challenge the compensation awarded for the value of the land or for the other damages, but instead is limited to damage to the remainder. He requests that the appeal be denied on the following grounds: First, he asserts, the appellants do not request that the ruling be declared null and void, and although he acknowledges that the ruling contains clerical errors, these do not invalidate it to such a degree that it must be set aside. He states that damage to the remainder was indeed analyzed in the judgment and that it was determined not to exist. He states that the payments to Palma Tica were not established in the appealed ruling and therefore cannot be reviewed through this appeal. All information requested by the court-appointed expert was provided to him in a timely manner.- Regarding damage to the remainder, he considers that its existence was not demonstrated and that the denial of this item is therefore correct. Pursuant to article 22 of the Ley de Expropiaciones, he maintains, only actual, certain, and effective damages that are directly caused by the expropriation may be recognized, not contingent or hypothetical damages. He argues that the administrative appraisal included a technical study which determined that the remainder of the property sustained no damage. The expropriated area of 48.664 square meters represents approximately 12% of the entire property, which measures 340.045, 58 square meters, and only part of that remainder adjoins the runway, with an easement between them. The portion remaining in the hands of the expropriated parties is not adversely affected because the reduction in area instead increases its value; the property’s frontage increases by more than three hundred meters, its current conditions are maintained, and it is left with 1024 meters of frontage. To value the remainder, the court-appointed expert used the before-and-after method (método del antes y el después); that is, he calculated the total value of the property, then removed the expropriated area and determined whether the remainder was adversely affected. He indicated that such damage did exist and set that item at two hundred fifteen million colones; however, the State representative asserts that this amount lacks supporting reasoning and a clear methodology regarding the damage and its extent. The principal reason given is the proximity to the runway; nevertheless, he states, it is a fact that since the property was awarded to the expropriated parties, it has been subject to the restrictions of article 90 of the Ley de Aviación Civil, the Ley de Construcciones, and the Convenio de Chicago concerning the height of structures, which, he asserts, were in force before the acquisition, dating from 1996. In other words, the restrictions invoked are not the result of the expropriation but arise from statutory and international restrictions that predate even the acquisition of the land.- Nor is the remainder rendered unusable, and therefore it cannot be characterized as uneconomic remnants. In short, he concludes, the additional payments sought are unwarranted, and he therefore requests that the appealed judgment be affirmed.- VI).- MERITS OF THE MATTER. SCOPE OF THE JUDGMENT. First and foremost, it is essential to establish the scope of the appeal filed and thereby define the matters on which this Court will rule.- This is because some aspects of the judgment were not challenged at all and, on the other hand, although the appellant presented a series of arguments on various issues during the oral hearing, these ultimately did not give rise to specific claims for relief.- Thus, it is asserted that the ruling contains formal defects, such as the names of the expropriated parties and confusion when referring to the experts; however, these are clerical errors, and when expressly consulted on the matter, the party stated that it was not seeking any declaration of nullity. The appellants likewise stated that errors had been made regarding the crops and trees located on the land subject to the taking; nevertheless, the expropriated parties accepted the amount awarded at first instance for ancillary works (obras complementarias) and plantings. Finally, a series of objections are raised concerning the manner in which the compensation was ordered to be distributed; however, the judgment does not address that matter, and the appellants themselves state that it was addressed in earlier rulings, which cannot be reviewed at this time because the Court’s jurisdiction is limited to reviewing the judgment issued. Accordingly, no ruling will be made on any of those matters. Nor will the Court address the unit price per square meter assigned to the expropriated property, since that is not the subject of the appeal, or the rulings concerning trees and plantings, the access ramp, or the restoration of the cadastral plan (plano catastrado), matters as to which no ground for appeal was raised. Under these circumstances, the only matter challenged, and the matter to which all the claims for relief relate, is damage to the remainder; the analysis on the merits will therefore be limited to that issue and follows below.- VII).- REGARDING DAMAGE TO THE REMAINDER (DAÑO AL REMANENTE). The appellants’ principal grievance consists in asserting that the Judge did not properly assess the damage caused to the remainder of the property by its partial expropriation (expropiación parcial).- They state that such impairment was established in the report of the expert appointed by the court and could have been confirmed during the judicial inspection (reconocimiento judicial); nevertheless, the Judge disregarded its existence and denied that claim, despite the evidence in the record and without adequate reasoning.- After reviewing the judgment, the Court determines, first, that the Judge did address the matter at length and concluded that there was no reliable evidence of possible damage to the remainder, which requires rejection of the alleged defect of insufficient reasoning. Because of its relevance, the reasoning stated by the court below in Recital V, “On Compensation,” concerning the matter is transcribed below:
“(...) DAMAGE TO THE REMAINDER. The Before-and-After formula was applied in the administrative appraisal (avalúo administrativo, AA) to determine whether the aforementioned item might exist. Accordingly, it was concluded that no damage to the remainder existed, and it was assumed that the owner suffered no economic loss as a result of the partial expropriation for the purpose of expanding Aeródromo de Drake (folio 60 exp. admvo). In this regard, Eng. Nombre162432 maintains that he cannot accept the results obtained in administrative appraisal No 2016-126 concerning the value of the remaining area and the damage to the remainder, and departs from them because they were estimated using uncertain data for which there is no adequate certainty in technical terms or legal certainty in legal terms. Along the same lines, he cites Directive VA- 01-2012, issued by the Dirección General de Tributación del Ministerio de Hacienda and entitled Guía de Valoraciones Administrativas, and further explains that, as a result of the severance of the parent property (finca madre), the property’s usefulness is diminished in terms of its area, frontage, regularity, and productive capacity, as shown below in the cadastral overlay (montaje catastral) submitted by the expropriating authority. He adds that the parent property is cut through its middle section, making the remainder more irregular, and that no mention is made of the restrictions on use that will affect the remainder because an airport runway will be embedded in its middle section. In that context, he reasons that, when applying the Before-and-After method, the unit value of the remaining land in the AA is calculated on the basis of frontage measuring 1.813,69 m, that is, greater than the frontage of 1.037,97 that the parent property had before the expropriation; and when the remainder is standardized against the proposed comparables on account of a reduction in area and an increase in frontage, a higher unit value is obtained for the property after the expropriation, the administrative expert explains. Thus, he infers that neither the appraisal itself nor the record in expediente No 17-000117-1028-CA-6 contains any document explaining where the aforementioned easement (servidumbre) will be constructed, which property will be the servient estate (fundo sirviente) and which will be the dominant estate (fundo dominante) when it is registered, its dimensions, or where it borders the remainder of the property; consequently, the reviewer finds no support for the administrative expert’s assertion concerning the frontage of the remainder. Therefore, he concludes that he cannot accept the results obtained in the AA concerning the value of the remaining area and the damage to the remainder, and departs from them because they were estimated using uncertain data for which there is no adequate certainty in technical terms or legal certainty in legal terms. In

that context, he reiterates, in accordance with the aforementioned Directive, that as a result of the expropriation the property’s usefulness is diminished in terms of its area, frontage, regularity, and productive capacity, as shown below in the cadastral overlay submitted by the expropriating authority. He further states that the remainder lies within the airport’s area of influence and is therefore subject to obstacle limitation surfaces (superficies limitadoras de obstáculos). Accordingly, in his view, the AA failed to consider the effects of the partial expropriation on the remainder, thereby violating Article 22, he emphasizes. Furthermore, he determines from the unregistered survey plan (plano sin catastrar) signed by Eng. Francisco Madrigal Gutierrez IT-4296 that the sum of the surface areas listed in the AREA TABLE included in the unregistered survey plan provided by the expropriating entity amounts to 344.151,00 m², a figure that exceeds by 4.105,42 m2 the area of the remainder, or portion of the property left after the severance to which it is subjected in the expropriation proceeding (proceso expropiatorio).

In his view, this inconsistency in the information provided by the expropriating authority is improper. Accordingly, he departs from the Administrative Appraisal. He therefore determines the compensation payable in the following terms: 1.- Damage to the remainder resulting from the expropriation, in the amount of TWO HUNDRED FIFTEEN MILLION THREE HUNDRED EIGHTEEN THOUSAND FOUR HUNDRED THIRTY COLONES AND 98/100 (¢215.318.430,98).- In this regard, this Court considers that, pursuant to Section 22 LE, substantial damages are compensable per se if and only if they are actual and permanent. In other words, under administrative-law doctrine, with respect to the damage to the remainder at issue in this particular case, the Court does not find any damage that is assessable, individualized, or actual (cf. Art. 196 of the Ley General de la Administración Pública). This is so because the remaining area of the parent property is separated by a right-of-way easement (servidumbre de paso) whose holder is precisely the expropriating public entity; that easement, as matters stand, separates the property from the runway of the Aeródromo de Bahía Drake.

Thus, the restrictions, as emphatically argued by the claimant, do in fact arise from the Ley General de Aviación Civil, Ley (N° 5150) del 14 de mayo de 1973, Article 96 of which reads as follows: ‘Structures and facilities on land adjoining or immediately adjacent to aerodromes and airports, within their protection and safety zones, shall be subject to the restrictions established by the relevant regulations and to those imposed for safety purposes by the Dirección General de Aviación Civil.’ Nevertheless, damage to the remainder is plainly nonexistent, since the conditions predating the partial expropriation at issue have remained and will remain materially unchanged by operation of law. In other words, damage of this kind does not arise merely because the property was already subject to restrictions due to its location facing the Aeródromo runway. To reiterate, both the restrictions and the limitations inherent in the governing Law remain unchanged with respect to the land, since aircraft will continue to land in the same area where they have done so for many years.

Additionally, the court-appointed expert assesses what, in his view, constitutes alleged DAMAGE TO THE OIL-PALM PLANTATION ON THE REMAINDER (VP on remainder), the value of which he sets at Nine million two hundred two thousand one hundred twenty-one colones and 25/100 (¢9.202.121,25); in addition, he determines the value of the DAMAGE TO THE PALM PLANTATION at Twenty-one million nine hundred fifty-six thousand ninety-one colones and 25/100 (¢20.956.091,25) (folio 53 of the court-ordered expert report). However, the professional must bear in mind that his assignment rests on a detailed and meticulous review of the AA in the record and, moreover, that if he departs from that instrument, he must provide a reasoned and technical factual basis supporting any other item he may assess. Accordingly, the adjudicator of these proceedings cannot endorse the amounts proposed by the professional, either for the alleged damage to the oil-palm plantation on the remainder or for the damage he assumes occurred to the palm plantation.

It is therefore important to emphasize that Article 35, p. 3° of Ley N° 7495 provides that the purpose of the court-ordered assignment shall be to ‘(...) review the administrative appraisal so that it conforms to the value of the property at the time it was appraised’ (Emphasis supplied). Consequently, if the expert ‘(...) were to depart from the administrative appraisal, he must explain in detail the reasons why he changes his opinion and considers that the property has a different value’ (Emphasis added). Accordingly, neither may the values set by the professional for the two items be endorsed, as he did not even attempt to explain them in detail.” As can be seen, the adjudicator did analyze this issue and concluded that no damage to the remainder existed, based on three grounds: a) he found no assessable, individualized, or actual damage to the remainder of the property; he stated that this remainder is separated by a right-of-way easement held by the expropriating authority, which separates the property from the runway of the Aeródromo de Bahía Drake; b) the restrictions affecting the land arise from Article 96 of the Ley General de Aviación Civil, Ley (N° 5150) del 14 de mayo de 1973, which renders the damage to the remainder nonexistent; he asserted that these conditions predated the partial expropriation and have remained and will remain materially unchanged by operation of law; and c) the property was already subject to restrictions due to its location facing the Aeródromo runway, and aircraft will continue to land in the same area where they have done so for many years.

This collegiate body disagrees with the ruling on this issue and considers that damage to the remainder of the property can indeed be deemed established. The court-ordered expert report, prepared by Engineer Nombre162432, appears at images 315 through 371 of the digital record of the first-instance proceedings, and the issue of damage to the remainder is addressed beginning at image 321 of that document. Engineer Nombre162432 states that the effects caused by the expropriation and their impact on the highest and best use (mayor y mejor uso) of the remainder are as follows:

  • a)The property, he states, undergoes a reduction of 12,51% in its surface area, leaving a remaining area of 340.045,58 square meters, “which, for the owner of a property whose highest and best use is oil-palm cultivation and cattle-raising activities, entails a reduction in the area planted with palm trees, in pasture area and the volume of available feed, and therefore in income” b) That three obstacle-limitation surfaces (superficies limitadoras de obstáculos) will be located on the remainder of the parent property (finca madre): an approach surface (superficie de aproximación), a transitional surface (superficie de transición), and an inner horizontal surface (superficie horizontal interna). Each of these surfaces is subject to limitations affecting the highest and best use of the remainder; he stated that oil palms are grown there and that, in some areas, they must be removed, resulting in the loss of productive use of the property.

The expert indicates that obstacle-free zones A and B together have an area of 12.229,00 m2 and are subject to a 100% limitation, since no obstacles may exist above the natural ground level. Both areas are planted with commercial oil palms, and this crop must therefore be removed, which, in addition to the actual damages (daño emergente) caused to the expropriated party, also affects lost income (ingresos dejados de percibir). The productive use of the property is thus reduced by 3,60%. On the approach surface referred to as the Northern Transitional Surface, Southern Transitional Surface (Zone A), and Southern Transitional Surface (Zone B), the sectors closest to the lot being expropriated are subject to limitations on the height of the palm plants, because the palm has a single upright trunk that can reach more than 40 meters in height in its natural state. In industrial crops grown for oil production, its height is limited to 10,-15 meters, with a diameter of 30-60 cm covered by scars from old leaves; c) regularity.

As a result of the taking (despojo) of land from the parent property, the remainder becomes more irregular in shape: Because this is a rural area and a property of considerable size, the negative effect exists but is limited; and d) noise pollution (contaminación sónica): the airport and its approach surface are embedded in the central portion of the western sector of the property, leaving the property exposed to high levels of noise pollution.

This collegiate body agrees with the expert appointed in the proceedings that the remainder has indeed suffered impairment, although it does not agree with either the percentage of impairment or the amount proposed in his expert report. It is true, as has been established in the record, that the condition of the property before and after the expropriation is not the same. Before the taking, the property bordered the aerodrome only along its western boundary; moreover, it was located 125 meters from the beginning of the runway.- Now, the runway has been “embedded” within the property; that is, part of the remainder now directly borders the aerodrome to the North, South, and East.- Although there is technical evidence indicating that the change in its category does not increase the nature of the legally based restrictions imposed by an aerodrome of this type, the fact remains that the property is now closer to the runway, particularly along its sides and in the areas designated as obstacle-free zones A and B. Those areas, which were previously farther from the runway, were not subject to the specific restrictions identified by the Dirección de Aviación Civil, which generally constitute impediments to planting crops whose height could jeopardize aircraft safety.

It may therefore be stated with certainty that the expropriation entailed not only a reduction in area but also a diminished land-use capacity (capacidad de uso del terreno), particularly for the cultivation of oil palms—the current use. The regularity of the property was also affected, and this undoubtedly diminishes the property’s desirability and affects its price. This is precisely the damage to the remainder (daño al remanente) that the expert found when preparing his report and that, as the appellants contend, must be compensated. Nevertheless, regarding the magnitude of that impairment, the Court finds that the court-ordered appraisal (peritaje judicial) does not sufficiently explain why the reduction in the value of the remainder is estimated at 0,74% of the price per square meter assigned to the land before the expropriation.- In this Court’s view, that expert report is not entirely clear regarding the specific areas in which productive use will be absolutely impossible or substantially reduced.

Nor is there conclusive evidence regarding the amount of income that may cease to be received, and without such evidence it is not possible to award the amount established therein, exceeding two hundred fifteen million colones, as the appellants seek. Furthermore, there is no evidence that a wetland (humedal) exists there. In fact, because the remaining area exceeds 34 hectares, the resulting impairment cannot be deemed as substantial as the expert indicated. Although the price has been negatively affected—an impact that the owners are not required to bear and for which they must be compensated because of the depreciating factors affecting the property as a result of the taking—the fact remains that, despite all the restrictions, the property may continue to be used for its current purposes (agriculture and livestock farming). Accordingly, the damage to the remainder must be set at a much lower percentage.

In its case law, when this collegiate body has recognized damage to the remainder in partial expropriations (expropiaciones parciales), it has applied the criterion expressed by numerous experts in proceedings of this type, who, from an appraisal standpoint, have indicated that the percentage of impairment ranges from one to ten percent. Thus, when the impairment is 10%, this means that the property has been completely affected because the essential content of the property right is impaired and the attributes of ownership are severely restricted. That is clearly not the situation in this case, where the property’s new circumstances do not generally prevent continuation of its current use, as stated above (see, to similar effect, judgment of this same Section, N°128-2021-I de las 11:40 horas del 08 del ocho de abril de 2021). In the absence of decisive evidence of a greater impairment, this Court finds that the impairment is the minimum, namely one percent (1%), because the court-ordered appraisal does not provide sufficient grounds to award the full amount set forth in the expert report.

Furthermore, that damage must be calculated using the amount per square meter established in the administrative appraisal (avalúo administrativo), which was the amount set in the judgment and accepted by the parties: four thousand five hundred fifty-six colones (¢4.556,00). Accordingly, based on the land-registry certification (certificación registral) in the record, the total property before expropriation measured 388.709,58 square meters; therefore, after subtracting the expropriated area of 48.664 square meters, the remaining area is 340.045,58 square meters. This is clearly stated in the administrative appraisal and confirmed by the court-appointed expert, and there is therefore no dispute in that regard. Multiplying this latter area by the land’s unit value yields a price of one billion five hundred forty-nine million two hundred forty-seven thousand six hundred sixty-two colones and forty-eight céntimos (¢1.549.247.662,48); multiplying that amount by one percent (0,01) equals fifteen million four hundred ninety-two thousand four hundred seventy-six colones and sixty-two céntimos (¢15.492.476,62), which is the amount hereby approved as damage to the remainder.- VIII).- COSTS AND INTEREST.

In view of the ruling concerning damage to the remainder, and because there is a difference between the administrative appraisal and the amount established in the judgment, Article 11 of the Ley de Expropiaciones must be applied. Under that provision, statutory interest (intereses al tipo legal) must be awarded on that difference, which in this case amounts to ¢15.492.476,62, from the date of dispossession (desposesión), which occurred on diez de noviembre de dos mil diecisiete, until that amount is actually paid.- Likewise, the ruling concerning legal costs (costas) must be reversed, and those costs must be borne by the State. Attorney’s fees (costas personales) must be calculated on that same difference, plus any interest that may be assessed and approved.- The request for indexation (indexación) is denied as unfounded, and in all other respects, because the decision was not appealed, it must remain undisturbed.-

POR TANTO:

As to the matters appealed, the judgment under appeal is reversed solely insofar as it denied payment for damage to the remainder and interest and ordered no special award of costs. In its place, damage to the remainder is awarded in the amount of fifteen million four hundred ninety-two thousand four hundred seventy-six colones and sixty-two céntimos (¢15.492.476,62), on which the expropriating authority must pay interest from diez de noviembre de dos mil diecisiete—the date possession was taken—until that amount is actually paid. The State is ordered to pay the costs of the proceeding; attorney’s fees must be calculated on that same difference, plus any interest that may be assessed and approved.- In all other respects, because the decision was not appealed, it remains undisturbed. Goicoechea, a las trece horas veinte minutos del veintinueve de junio de dos mil veintiuno.- Diligencias judiciales de fijación del justiprecio en expropiación, promovidas por el Estado, en la persona del Procurador Alejandro Arce Oses, contra Nombre162427 , cédula CED127072 y Nombre162428 , cédula número CED127073.- También intervienen, el Consejo Técnico de Aviación Civil (CETAC), la Junta de Desarrollo Regional de la Zona Sur (JUDESUR) y la empresa Palma Tica, Sociedad Anónima.- Por apelación de la parte expropiada, conoce este Tribunal de la sentencia de primera instancia, N°1303-2020 de las trece horas dieciocho minutos del treinta de junio de dos mil veinte.- Se resuelve, previa deliberación y por unanimidad.- Redacta el Juez Fernández Argüello, y

CONSIDERANDO:

I).- CORRECCIÓN DE ERROR MATERIAL: El encabezado de la sentencia apelada, indica que la presente expropiación se sigue contra la empresa Embotelladora Candry de Costa Rica S.A., lo cual es erróneo. Las presentes diligencias se dirigen exclusivamente contra los señores Nombre162427 y Nombre162428 , en su condición de copropietarios del terreno objeto de despojo y así se aclara.- II).- CUESTIONES DE TRÁMITE: El Estado, promueve estas diligencias, para que se establezca el precio que debe pagar a la señora Nombre162428 y al señor Nombre162427 , por la expropiación de un terreno de 48.664 metros cuadrados, que forma parte de la finca matrícula Placa33223 del Partido de Puntarenas, necesaria para la ampliación del aeródromo de Drake.- Los expropiados, se opusieron al avalúo administrativo y se tuvo como parte al Consejo Técnico de Aviación Civil y a la Junta de Desarrollo Regional de la Zona Sur.- Luego del trámite de rigor, el Juez, licenciado Billy Araya Olmos, en sentencia N°1303-2020 de las trece horas dieciocho minutos del treinta de junio de dos mil veinte, dispuso:

"POR TANTO: SE CONFIRMA LA INDEMNIZACIÓN CONTENIDA EN EL AVALÚO ADMINISTRATIVO N° 2016-126 DEL 26 DE NOVIEMBRE DE 2016, por el monto de DOSCIENTOS SIETE MILLONES SEISCIENTOS TREINTA MIL OCHOCIENTOS SETENTA Y SIETE COLONES (¢207.630.877,00). Indemnización que comprende los siguientes rubros: 1.- Expropiación de un lote de terreno de 4,8664 hectáreas, valorado en CIENTO NOVENTA Y OCHO MILLONES TRESCIENTOS CINCO MIL OCHOCIENTOS COLONES (¢198.305.800,00), a razón de ¢45.560.000,00/ha, conforme al plano catastrado 6-1912006-2016, el cual, forma parte de la finca madre F.R. 6- 00094703-001-002. Tiene frente de 1037,97 metros y fondo de 630 metros, y se ubica en Bahía Drake, Osa, Puntarenas, cuyo uso actual es agricultura y ganadería. Este lote tiene forma irregular con topografía esencialmente plana y debido al diseño de la ampliación del Aeródromo de Drake se adquiere una porción de la parte frontal de la finca madre en referencia.

Tiene como colindantes al este y al oeste calle pública, al norte con Nombre162429 y al sur camino público. Tiene acceso por el sur, este y oeste debido a la extensión de la finca mediante caminos de lastre, sin cunetas. Actualmente la propiedad se encuentra cerrada por cerca de postes de madera y alambres de púas, y árboles de teca y poro. Adicionalmente la propiedad cuenta con cultivos de palma aceitera cuya área se encuentra con cerca electrificada. La zona donde se encuentra el lote antes mencionada, dispone de los servicios públicos básicos, v. gr., agua potable, electricidad y recolección de basura. No se encuentran centro comerciales de importancia, pero si cuentan con centros de educación públicos, pulperías que abastecen a los vecinos de la zona y cabinas para alojamiento de turistas. En otras palabras, el terreno a expropiar linda al Norte: Nombre162427 y Nombre162430 , al Sur: Nombre162427 y Nombre162430 , al Este: Nombre162427 y Nombre162430 , y al Oeste: Servidumbre de Paso y Cooperativa de Servicios Múltiples de Coto 63 RL.

Este terreno aparece en los colindantes Norte, Sur y Oeste, porque el mismo se encuentra inmerso del terreno de la finca madre, ver en montaje Catastral de Áreas a Expropiar. 2.- Árboles y plantaciones, valorados en MILLÓN CIENTO CINCUENTA Y CUATRO MIL CIENTO CUARENTA Y DOS COLONES (¢1.154.142,00), a razón de ¢2.000,00/m². Indemnización que, a su vez, comprende: 2.1.- Plantación de palma de aceite y árboles de poro, naranjo y teca, valorados en seis millones trescientos mil colones (¢6.300.000,00). Siendo esto, dentro de la finca a expropiar se encuentra un área cultivada de 2,94 hectáreas y se estima un promedio de 143 plantas por hectárea, de manera que se estiman 420 plantas aceiteras. Se contabilizaron 25 árboles de teca, 1 árbol de naranjo y 15 árboles de poro. De los árboles de teca rondan un diámetro de 0.25 m a 0.5 cm y una altura que variaba de 3 a 5 metros. Los árboles de poró rondan un diámetro de 0.25 m y una altura promedio de 3 m, conforme al Anexo 3. 3.- RECONSTRUCCIÓN DE RAMPA DE ACCESO por canal natural para el trasiego de palma de 60 m de largo por 6 m de ancho y se estima un espesor de 7 cm de lastre, cuya área es de 360 m², valorada en SETECIENTOS VEINTE MIL COLONES (¢720.000,00), a razón de ¢2.000,00/m².

En el presente informe se debe reconocer esta actividad dado que el propietario debe volver a realizar el trabajo con el fin de mantener el trasiego de maquinaria durante la recolección del fruto de la palma de manera que para tipificar el costo por m² de rampa, se llevó a cabo la cotización respectiva. 3.- Indemnización por restitución de plano: 3.1.- Incremento (10%) en noventa y siete mil doscientos sesenta y siete colones (¢97.267,00); 3.2.- Timbres en cincuenta mil colones (¢50.000,00). II. La finca madre a expropiar se encuentra inscrita bajo el sistema folio real matrícula Placa33223, y es propiedad de Nombre162431 , Cédula identidad CED127074, y Nombre162427 , cédula de identidad CED127075, son propietarios por su orden de los derechos 0001 y 002, respectivamente. Su naturaleza es terreno para la agricultura Dirección19537 , y linda al Norte: Dirección19538 , Sur: Dirección4870 , Este: Dirección336 , y Oeste: Dirección336 .

Mide: Trescientos ochenta y ocho mil setecientos nueve metros con cincuenta y ocho decímetros cuadrados, conforme al plano catastrado P-0292276-1995. Sobre esta finca pesan las siguientes anotaciones: Mandamiento de expropiación a citas 2017-181075-001. Y, gravámenes, a saber: 1.- Reservas de ley de aguas y ley de caminos públicos citas: 430-03899-01-0131-001. 2.- Hipoteca de primer grado a citas: 546-15234-01-0001-001. 3.- Hipoteca se segundo grado a citas: 2011-132062-01-0005-001. 4.- Hipoteca de tercer grado a citas: 2011- 132062-01-0006-001. III. El resto de la cabida de la finca del Partido de Puntarenas F.R. 94703-001/002, a consecuencia del Proyecto Ampliación del Aeródromo de Drake; quedará con una área de 340.045,58 m², y linda al Norte: Nombre162427 y Nombre162428 (Terreno a expropiar), al Sur: Nombre162427 y Nombre162428 (Terreno a expropiar), al Este: Nombre162427 y Nombre162428 , a Oeste: Servidumbre de Paso y Cooperativa de Servicios Municipales de Coto 63 RL (Terreno a expropiar).

IV. III. Destínese lo expropiado a la construcción del proyecto "Ampliación del Aeródromo de Drake"; inmueble declarado de interés público conforme a la Resolución del Ministerio de Obras Públicas y Transportes, de las once horas cincuenta minutos del cinco de setiembre de dos mil dieciséis, publicada en el diario La Gaceta N° 196 del doce de octubre de dos mil dieciséis. IV. Firme este pronunciamiento, se autoriza a la Notaría del Estado a fin de que proceda con la respectiva protocolización de piezas a la brevedad. Por su parte, el oficial certificador del Registro Público que por turno corresponda, se encuentra compelido a cancelar todas las anotaciones, exacciones y gravámenes que pesen sobre el bien expropiado, con fundamento en la escritura de protocolización de piezas, sin ulterior trámite, y sin perjuicio de las eventuales responsabilidades civiles, penales, y administrativas, inclusive, que puedan recaer sobre la persona del funcionario llamado a cumplir con tal encargo quien se manifieste reticente a cumplimentar la antes dicha disposición en tiempo y en forma, en los términos del numeral 190 de la Ley General de la Administración Pública, y 314 del Código Penal.

En otros términos, previa firmeza de este fallo, se ordena notificar a la Administración Tributaria de Puntarenas y al Ayuntamiento de Osa, a los efectos de que sendas Administraciones Públicas procedan a determinar las cargas impositivas nacionales y locales, según correspondan. Sin especial condenatoria en intereses ni intereses. ES TODO. Notifíquese en breve".

Inconforme con dicha resolución, apelaron en tiempo y forma las personas expropiadas, recurso admitido y en virtud de lo cual, se entra a su análisis de seguido. La audiencia oral del recurso, se celebró a las nueve horas del veintiséis de febrero de dos mil veintiuno.- III).- HECHOS PROBADOS: Se avalan los hechos probados que contiene el pronunciamiento recurrido, por ser contestes con las pruebas que en su apoyo se citan. Se agregan los siguientes: 8) Que la finca expropiada, se ubica "aproximadamente a 125 metros al Sureste del Aeródromo de Drake" (avalúo administrativo, folio 68, imagen N°2, del expediente administrativo); 9) Que según montaje catastral de áreas a expropiar, elaborado en sede administrativa, la situación del área objeto de despojo y del resto de la finca, se muestra de la siguiente manera (folio 18 del expediente administrativo):

  • 9)Que según indicó la Dirección General de Aviación Civil, durante el trámite de la expropiación: "1. El proyecto de ampliación del Aeródromo de Drake se planificó para un aeródromo clave 1B, por lo tanto, el resto de la finca madre se ubicará en tres superficies limitadoras de obstáculos, las cuales se indican a continuación: a. Superficie de aproximación. b) Superficie de transición. c. Superficie horizontal interna. Las limitaciones serán las siguientes: a. Superficie de aproximación. Deberá dejar una distancia 80 m libre de la colindancia oeste del Aeropuerto. A partir de este punto podrá construir una altura máxima de 4.00 m sobre el nivel natural del terreno y podrá aumentar 0.5m por cada 10m que se aleje al este del aeropuerto. b. Superficie Transición Norte. Deberá dejar una distancia 9.00m libre de la colindancia sur del Aeropuerto. A partir de este punto podrá construir una altura máxima de 4.00m y podrá aumentar 2.00m por cada 10m que se aleje al norte hasta alcanzar una altura de 45.00m sobre el nivel natural del terreno. c. Superficie Transición Sur.

(zona A) Por ser esta un área compuesta por dos pendientes es necesario conocer con exactitud el punto donde se pretende hacer una edificación por lo tanto es imposible determinar en esta zona una altura máxima, pero para tener una idea se puede decir que entre más se aleje del aeropuerto más altura se podrá edificar sin que esta pase de 15.00m sobre el nivel natural del terreno. d. Superficie Transición Norte. (zona 8) En esta zona se podrá construir una altura máxima de 15.00m a partir del lindero sur del Aeropuerto y podrá aumentar 2.00m por cada 10.00m que se aleje al sur hasta alcanzar una altura de 45.00m sobre el nivel natural del terreno. e. Superficie Horizontal Interna En esta superficie se podrá construir una altura máxima de 45.00m sobre el nivel natural del terreno (...)"; lo anterior, según el siguiente croquis:

  • 10)Que la ampliación del Aeródromo de Drake, implica un cambio de categoría de 1A a 1B, ello, con la finalidad de dar mayor seguridad a las operaciones Aeronáuticas, ya que se amplió la longitud y el ancho de la pista, así como las franjas de seguridad de esta. Las limitaciones que implica dicho cambio son exactamente la mismas que se tenían anteriormente sin la ampliación, ya que el número en la clasificación del Aeródromo se mantiene en Uno (oficio DGAC-DA-IA-OF-0181-2021, de 12 de abril de 2021, suscrito por los ingenieros Francisco Madrigal Gutiérrez, y Alexander Sánchez Mora, por su orden Jefe del Proceso de Topografía Aeronáutica y de Infraestructura Aeronáutica, ambos de la Dirección General de Aviación Civil; prueba para mejor resolver, imágenes 18 a 24 del legajo de apelación);
  • 11)Que según plano 6-1913448-2016 (plano que describe los terrenos donde se emplazaba el Aeródromo antes de las expropiaciones), como el plano 6-1912006-2016 (plano que describe los terrenos a expropiar) la finca numero 94703-001 y 002 era separada de los terrenos del Aeródromo por una servidumbre de 9.00m de ancho y la distancia de los 125 metros del terreno expropiado al Aeródromo, es tomado en el avalúo administrativo desde el lindero de ese terreno a la entrada al campo de aterrizaje por la calle pública (mismo oficio DGAC-DA-IA-OF-0181-2021 y planos a éste acompañados);
  • 12)Que las limitaciones antes y después de la ampliación del aeródromo son exactamente las mismas, lo único que cambió fue la ubicación de las superficies limitadoras de obstáculos, debido al hecho que están en función de la pista (mismo oficio anterior).- IV).- AGRAVIOS: Manifiestan los apoderados de las recurrentes, que la sentencia contiene defectos de forma y de fondo, que deben enmendarse. El fallo, afirma, cita como expropiada, una empresa embotelladora que no tiene ninguna relación con el asunto, confunde al perito de la Administración con el recibido en sede judicial y además, ordena el giro de parte de la indemnización a Palma Tica S.A., sin contar con documentación idónea que acredite los saldos adeudados y pagar otras deudas que no aparecen contempladas en la escritura correspondiente. El Juez, dice, malentendió la naturaleza de las plantas y frutos, a efectos de determinar el precio. Por eso, señala, la sentencia es incompatible con la vida jurídica y choca con el fin de la expropiación, que es la fijación de un precio justo. En relación con las deudas con la empresa Palma Tica S.A., sostiene que hay dos hipotecas: la primera, por $72.301,00 y la segunda, por $50.983,00, para un total de $123.184,00. El a quo, en resolución de las 08:41 horas del 28 de junio de 2017, ordenó la cancelación de esas deudas y un monto adicional por ¢759.000,00 por compra de fertilizantes, a favor de Palma Tica S.A., lo cual no tenía respaldo hipotecario ni influencia en los gravámenes de la finca. Que no existe tampoco, norma alguna que permita al juzgador, quitar ese dinero a sus representados. La finca, agrega, soporta limitaciones antes y después de la expropiación; la Ley de Aguas, asevera, afecta ostensiblemente el valor de la propiedad, en demérito del precio; aduce, pidieron un estudio de impacto ambiental y el perito judicial determinó la existencia de una acequia, empero, estiman que se trata de un humedal. No se consideraron, alega, las limitaciones que las leyes aeronáuticas imponen a la finca expropiada. El Ingeniero Nombre162432, dice, solicitó en varias ocasiones información que no constaba en el expediente administrativo, luego de lo cual, se determinó que desde antes de la titulación ya había restricciones de uso, pues hay diversas áreas que no pueden ser utilizadas por los expropiados. Que esas limitaciones, no constan en el Registro Público, ni han sido indemnizadas, por lo que el predio se presume libre y en todo caso, las áreas inutilizables constituyen a su juicio fundos inadecuados que deben pagarse.- Con motivo de la expropiación, asegura, la finca queda dividida en dos y sólo se puede usar la superficie interna, en la transición Norte, quedan 9 metros libres de la colindancia Sur y la superficie de aproximación, 80 metros libres de colindancia. La lógica, la sana crítica y el sentido común, indican que el predio es libre y que las limitaciones, a pesar de ser absolutas, no se indemnizaron. El Estado, manifiesta, no determinó la existencia de un daño al remanente, sin embargo, éste sí se pudo observar en la diligencia de reconocimiento judicial, a pesar de lo cual, el juez desdeñó ese extremo. De mantenerse la sentencia, aseveran, se niega el pago del justo precio y se hace nugatorio el derecho a la indemnización, ello, porque los expropiados deben hacer frente a las obligaciones que generan esas áreas, donde no puede hacer uso. Estima que hay falta de fundamentación, en lo tocante al tema del daño al remanente; considera que es falso que las condiciones sean preexistentes, porque no es lo mismo un pequeño aeródromo que un aeropuerto, como tampoco lo es que aterricen avionetas a que lo hagan aviones de gran tamaño. A lo que aspiran, es a que se mantenga inalterado el patrimonio de los expropiados, en cuanto a la finca remanente. Aseguran, están conscientes del interés público que involucra el proyecto; empero, su finca se ve afectada en más de un 80%, dadas las severas limitaciones que afectan su deseabilidad y su uso, justamente, por estar en la zona aledaña al aeropuerto. Reiteran, el tema del daño al remanente es esencial y la sentencia dejó de lado el peritaje judicial, que sí lo cuantificó.- Con base en esas consideraciones, solicitan:
  • 1)Que se adicione la sentencia 1303-2020, agregando el extremo del daño al remanente, pérdida de valor, como consecuencia del despojo y limitaciones impuestas, en la suma de ¢215.318.430,98, establecida por el perito judicial;
  • 2)Indexar esa suma, para traerla a valor presente desde la puesta en posesión y hasta el efectivo pago y
  • 3)el pago de los intereses de ley. Subsidiariamente, piden que se le otorgue al juez de primera instancia un plazo perentorio, para hacer una nueva y justa fijación de la indemnización.- V).- ALEGATOS DEL ESTADO: El representante estatal, por su parte, indica que el recurso no cuestiona la indemnización otorgada por el valor del terreno, ni por los otros daños, sino que antes bien, se limita al daño al remanente. Solicita rechazar el recurso, con base en lo siguiente: Primero, afirma, no se pide la nulidad de lo resuelto y aunque reconoce que la resolución tiene errores materiales, éstos no vician el pronunciamiento al grado de tener que dejarlo sin efecto. El daño al remanente, afirma, sí fue analizado en la sentencia y se determinó que éste no existía. Los pagos a la empresa Palma Tica, expresa, no se establecieron en la resolución apelada y por ende no pueden revisarse mediante este recurso. Toda la información solicitada por el perito judicial, fue entregada a éste oportunamente.- En relación con el daño al remanente, considera que su existencia no fue demostrada y por ende, la denegatoria de este extremo, es correcta. Conforme al artículo 22 de la Ley de Expropiaciones, sostiene, sólo es posible reconocer los daños reales, ciertos y efectivos, que sean causa directa de la expropiación y no daños eventuales o hipotéticos. En el avalúo administrativo, argumenta, se hizo un estudio técnico y se determinó que el resto de la finca no sufría daño. Que el área expropiada, de 48.664 metros cuadrados, corresponde aproximadamente a un 12% del total de la finca, que mide 340.045, 58 metros cuadrados y que sólo una parte de ese resto colinda, servidumbre en medio, con la pista de aterrizaje. La parte que queda en manos de los expropiados, no sufre ninguna afectación, porque al reducirse la cabida más bien aumenta su valor; que el frente de la propiedad se incrementa en más de trescientos metros, que sus condiciones actuales se mantienen y que el frente queda de 1024 metros. Que el perito judicial, para valorar el remanente, utilizó el método del antes y el después, esto es, sacó el valor total de la finca, luego eliminó el área expropiada y determinó si el remanente quedaba afectado o no. Indicó que éste sí existía y fijó ese extremo en doscientos quince millones de colones, empero, asevera, tal cantidad carece de fundamentación y de una metodología clara sobre el daño y su magnitud. Que la principal razón aducida, es la cercanía con la pista de aterrizaje; sin embargo, dice, es un hecho que desde que la finca se adjudicó a los expropiados, soporta las limitaciones del artículo 90 de la Ley de Aviación Civil, la Ley de Construcciones y el Convenio de Chicago, en cuanto a la altura de las construcciones, las cuales, asegura, están vigentes desde antes de la adquisición, que data de 1996. Es decir, las limitaciones invocadas, no son producto de la expropiación, sino de limitaciones legales e internacionales, anteriores incluso a la adquisición del terreno.- Que el resto tampoco queda inutilizado y por eso no puede hablarse de fundos inadecuados. En suma, concluye, los pagos adicionales pretendidos no proceden, razón por la que solicita, confirmar la sentencia apelada.- VI).- SOBRE EL FONDO DEL ASUNTO. ALCANCES DEL FALLO. Ante todo, resulta indispensable establecer el alcance del recurso interpuesto y definir de ese modo, los aspectos sobre los cuales se pronunciará este Tribunal.- Ello, por cuanto algunos aspectos del fallo, ni siquiera fueron cuestionados y por otro lado, si bien durante la audiencia oral, la parte recurrente formuló una serie de alegatos sobre diversos temas, éstos finalmente no dieron lugar a pretensiones concretas.- Así, se indica que lo resuelto contiene defectos formales, como el nombre de los expropiados y confusiones al referirse a los peritos; empero, se trata en estos casos de errores materiales y la parte, consultada expresamente al respecto, indicó que no reclamaba nulidad alguna. Igualmente, señalaron los recurrentes, se incurrió en yerros en cuanto a los cultivos y los árboles que se ubican en el terreno objeto de despojo; no obstante, los expropiados se conformaron con la cantidad concedida en primera instancia sobre obras complementarias y plantaciones. Finalmente, se hacen una serie de objeciones en cuanto a la forma como se dispuso distribuir la indemnización; sin embargo, la sentencia no se ocupa de ello y los propios recurrentes manifiestan que eso se hizo en otras resoluciones previas, las cuales no es posible revisar en este momento, en que la competencia del Tribunal se limita a la revisión de la sentencia emitida. De modo que, sobre todos esos extremos no se hará pronunciamiento alguno. Tampoco se referirá el Despacho al precio unitario por metro cuadrado, dado a la finca expropiada, pues ello no es objeto del recurso; ni a lo resuelto sobre árboles y plantaciones, rampa de acceso o la restitución del plano catastrado, cuestiones sobre las que no se hizo ningún agravio. En tales circunstancias, el único aspecto cuestionado y sobre el cual giran todas las pretensiones formuladas, es el relativo al daño al remanente, aspecto al que se limitará el análisis de fondo y que se hace de seguido.- VII).- SOBRE EL DAÑO AL REMANENTE. El agravio fundamental de los recurrentes, estriba en afirmar que el señor Juez no valoró adecuadamente, el daño que la expropiación parcial del inmueble, le ocasiona al resto de éste.- Dicho menoscabo, dicen, quedó acreditado en el informe del perito designado en estrados judiciales y pudo haberse constatado en el reconocimiento judicial, empero, el Juez desdeñó la existencia de éste y rechazó ese extremo, a pesar de la prueba que consta en autos y sin la debida fundamentación.- El Tribunal, luego de la revisión de la sentencia, determina en primer término, que el señor Juez sí se pronunció, en forma amplia, al respecto y llegó a la conclusión que no había elementos de prueba fehacientes, sobre un eventual daño al remanente, razón que obliga a desestimar el vicio acusado, de falta de motivación. Por ser de relevancia, se transcribe lo argumentado por el a quo, en el Considerado V, "De la Indemnización", sobre el tema:
"(...) DAÑO AL REMANENTE. En el AA se implementó la fórmula Antes y Después para determinar la eventual existencia del antes mencionado rubro. Y, consecuentemente, se arriba a la conclusión de la inexistencia del daño al remanente, y asume que no existe perjuicio económico hacia el propietario, a consecuencia de la expropiación parcial con miras a la ampliación del Aeródromo de Drake (folio 60 exp. admvo). Al respecto, el Ing. Nombre162432 sostiene que no puede tomar como buenos los resultados obtenidos en el avalúo administrativo No 2016-126 sobre valor del área remanente y el Daño al remanente y se aparta de ellos, por ser estimados con el uso de datos inciertos sobre los que no existe la debida certeza, en términos técnicos o seguridad jurídica en los legales. En esa misma línea, trae a colación la la directriz VA- 01-2012 emanada de la Dirección General de Tributación del Ministerio de Hacienda, denominada Guía de Valoraciones Administrativas, y además, justifica, a partir de la ablación que la finca madre, el uso de la finca queda disminuido en su cabida, frente, regularidad y además en su capacidad producción, tal como adelante se muestra en el montaje catastral que aporta el expropiante. Y, añade, la finca madre es mutilada en su sección media por lo que el remanente se hace más irregular y no se mencionan las limitaciones en el uso que tendrá el remanente al tener encajado en su sección media la pista de un aeropuerto. En ese contexto, es en razonar que al implementar el método Antes y Después, el cálculo del valor unitario del terreno remanente dentro del AA, se lleva a cabo con base en un frente de 1.813,69 m, es decir, mayor al frente de 1.037,97 que tiene la finca madre antes de la expropiación, y al homologar el remanente con los referentes propuestos, a razón de una disminución en el área y un aumento en el frente, obtiene un valor unitario mayor para la finca después, explica el perito administrativo; así pues, infiere, no encuentra en su contenido, tampoco en los autos del expediente No 17-000117-1028-CA-6, algún documento que explique por dónde se construirá la mencionada servidumbre, cuando se inscriba cuál será el fundo sirviente y el fundo dominante, sus dimensiones, por donde colinda con el resto de la finca, por lo que quien revisa no encuentra sustento a la afirmación del perito administrativo en cuanto al frente del remanente. De suerte que, colige, no puede tomar como buenos los resultados obtenidos en el AA sobre valor del área remanente y el Daño al remanente y se aparta de ellos, por ser estimados con el uso de datos inciertos sobre los que no existe la debida certeza, en términos técnicos o seguridad jurídica en los legales. En

ese contexto, insiste, de acuerdo a la Directriz supra mencionada, que, a consecuencia de la expropiación, el uso de la finca queda disminuido en su cabida, frente, regularidad y además en su capacidad producción, tal como adelante se muestra en el montaje catastral que aporta el expropiante. E, indica, el remanente queda en el Área de influencia del aeropuerto, razón por la cual existen Superficies limitadoras de obstáculos. De tal manera que, en su concepto, el AA, no contempló los efectos de la expropiación parcial sobre el remanente, por lo que se transgrede el artículo 22, subraya. Por otro lado, desprende del plano sin catastrar firmado por el lng. Francisco Madrigal Gutierrez IT-4296, que la sumatoria de las superficies, contenidas en el CUADRO DE ÁREAS incluido en el plano sin catastrar que suministra el ente expropiante, da como resultado una superficie de 344.151,00 m², cifra que es superior en 4.105,42 m2 al área del remanente o resto de la finca que queda luego de la amputación a que se le somete en el proceso expropiatorio.

Esta incongruencia en la información que suministra el expropiante es inadecuada, a su juicio. De tal manera que, se aparta del Avalúo Administrativo. De tal manera que, determina la indemnización a cancelar en los siguientes términos, a saber: 1.- Daño al remanente por la expropiación en la suma de DOSCIENTOS QUINCE MIL TRESCIENTOS DIECIOCHO MIL CUATROCIENTOS TREINTA COLONES CON 98/100 (¢215.318.430,98).- Al respecto, este Despacho estima que al tenor del canon 22 LE, lo daños de entidad son per se indemnizables, sí y solo sí, tales son reales y permanentes. En otras palabras, en orden a la doctrina iusadministrativista, en lo que al daño al remanente en el caso concreto nos ocupa, no observa un daño evaluable, individualizable ni efectivo (cfr. art. 196 de la Ley General de la Administración Pública). Ello, resulta ser así debido a que el resto de la cabida de la finca madre se encuentra separada por una servidumbre de paso cuyo titular es, precisamente, el ente público expropiante; servidumbre que a la sazón separa esa propiedad de la pista de aterrizaje del Aeródromo de Bahía Drake.

De tal manera que, las restricciones, tal y como enfáticamente lo esgrime el demandante, en efecto, abrevan de la Ley General de Aviación Civil, Ley (N° 5150) del 14 de mayo de 1973, que al tenor del artículo 96 ibíd, reza así: "Las construcciones e instalaciones de los terrenos adyacentes o inmediatos a los aeródromos y aeropuertos, dentro de las zonas de protección y seguridad de éstos, estarán sujetas a las restricciones que señalen los reglamentos respectivos y a la que con fines de seguridad dicte la Dirección General de Aviación Civil". Con todo, el daño al remanente huelga de suyo inexistente, toda vez que las condiciones preexistentes previo a la expropiación parcial en autos, se han mantenido y se mantendrán incólumes materialmente por disposición legal. En otras palabras, el daño de estilo no se configura por el solo hecho de que la propiedad se encontraba ya de por sí limitada frente a la pista de aterrizaje del Aeródromo.

Se insiste, el terreno mantiene incólume tanto las restricciones, cuanto las limitaciones ínsitas a la Ley de rito, en tanto que la aeronaves seguirán aterrizando en la misma área donde lo han venido haciendo de vieja data. Adicionalmente, el señor perito judicial, valora lo que en su concepto da cuenta de un presunto DAÑO EN LA PLANTACIÓN DE PALMA ACEITERA EN EL REMANENTE (VP en remanente), cuyo valor fija en la suma de Nueve millones doscientos dos mil ciento veintiún colones con 25/100 (¢9.202.121,25), aunado a esto determina el valor de los DAÑOS EN LA PLANTACIÓN DE PALMA en la suma de Veintiún millones novecientos cincuenta y seis mil noventa y un colones con 25/100 (¢20.956.091,25) (folio 53 del peritaje judicial). Ahora bien, debe recordar el profesional que su encargo descansa sobre la revisión detallada y minuciosa del AA en autos, más aún, si se aparta del instrumento debe construir en forma razonada y técnica la base fáctica en la cual hace descansar cualquier otro rubro que eventualmente valore.

Debido a ello, no puede prohijar quien por turno dirime estas diligencias, las sumas que pregona el profesional, referidos tanto al supuesto daño en la plantación de palma aceitera en el remanente, cuanto los daños que presume se suscitaron en la plantación de palma. Por ende, importa resaltar que el artículo 35, p. 3° de la Ley N° 7495, prevé que el objeto del encargo judicial será, sino "(...) revisar el avalúo administrativo para que se ajuste al valor del bien en el momento en que fue valuado" (Énfasis suplido). Motivo por el cual, en el supuesto de que "(...) se apartara del avalúo administrativo, deberá explicar pormenorizadamente las razones por las que varía de criterio y estima que el bien tiene otro valor" (Énfasis añadido). Por consiguiente, no es dable prohijar tampoco los precios fijados por el profesional para sendos rubros, los cuales este ni por asomo se detuvo a explicar pormenorizadamente".

Como puede advertirse, el juzgador sí analizó este extremo y concluyó que no existe el daño al remanente, lo anterior, sobre la base de tres motivos: a) no encontró, un daño evaluable, individualizable ni efectivo en el resto de la finca; ese remanente, indicó, queda separado por una servidumbre de paso cuyo titular es el expropiante y que separa esa propiedad de la pista de aterrizaje del Aeródromo de Bahía Drake; b) las restricciones que tiene el terreno, derivan de lo dispuesto en el artículo 96 de la Ley General de Aviación Civil, Ley (N° 5150) del 14 de mayo de 1973, lo que torna inexistente el daño al remanente; se trata, adujo, de condiciones preexistentes a la expropiación parcial, las cuales se han mantenido y se mantendrán incólumes materialmente por disposición legal y, c) la propiedad se encontraba ya de por sí limitada frente a la pista de aterrizaje del Aeródromo y las aeronaves seguirán aterrizando en la misma área donde lo han venido haciendo de vieja data.

Este órgano colegiado, no concuerda con lo resuelto en este extremo y estima que sí es posible tener por acreditado un daño en el resto de la finca. El peritaje judicial, elaborado por el Ingeniero Nombre162432 , rola a imágenes 315 a 371 del expediente digital de primera instancia y el tema del daño al remanente, se aborda a partir de la imagen 321 de ese documento. Señala el Ingeniero Nombre162432, que los efectos que provoca la expropiación y su repercusión en el mayor y mejor uso del remanente, son los siguientes:

  • a)La finca, señala, sufre una reducción del 12,51% e su superficie, por lo que el área del remanente es de 340.045,58 metros cuadrados, "lo que para el propietario de una finca, cuyo mayor y mejor uso es la siembra de palma aceitera y la actividad de mantenimiento de ganado vacuno, implica una reducción en el área de siembra de palma, en el área de pasturas y volumen de alimento disponible y por lo tanto en los ingresos" b) Que en el resto de la finca madre o remanente, se ubicarán tres superficies limitadoras de obstáculos: superficie de aproximación, superficie de transición y superficie horizontal interna, para cada una de estas superficies existen limitaciones que afectan el mejor y mayor uso del remanente; en ellas, adujo, se localiza el cultivo de palma aceitera que en algunos se debe eliminar, por lo que se pierde el aprovechamiento de la finca. Indica el perito, las superficies de zonas libres A y B, entre ambas tienen una superficie de 12.229,00 m2 y se tiene la limitación del 100% ya que no pueden existir obstáculos sobre el nivel natural del terreno, ambas superficies están sembradas con el cultivo comercial de palma aceitera por lo que este cultivo debe ser eliminado lo que además del daño emergente que se le causa al expropiado también se afectan los ingresos dejados de percibir.

Se reduce así el aprovechamiento en un 3,60% de la finca. En la superficie de aproximación denominada transición Norte Superficie de Transición Sur (Zona A) y Superficie de transición Sur (Zona B), en los sectores más cercanos al lote que se expropia se tienen limitaciones en cuanto a la altura de las plantas de palma debido a que la palmera tiene un tronco erecto solitario que puede alcanzar más de 40 metros de altura en estado natural. En cultivos industriales para la obtención de aceite su altura se limita a los 10,-15 metros, con un diámetro de 30-60 cm cubierto de cicatrices de hojas viejas; c) regularidad. A causa del despojo de terreno que sufre la finca madre, el remanente o resto de finca se hace más irregular en su forma: Por tratarse de zona rural y de un predio de importante extensión, el efecto negativo existe pero es reducido; y d) contaminación sónica, el aeropuerto y su superficie de aproximación, queda incrustado en el plano medio del sector Oeste de la propiedad, por lo que la finca queda expuesta a una alta contaminación sónica.

Este órgano colegiado, coincide con el experto designado en autos, en que el remanente sí sufre menoscabo, aunque no en el porcentaje de afectación, ni en el monto propuesto en su experticia. Es cierto, pues ha quedado acreditado en autos, que la situación de la finca, antes y después de la expropiación, no es la misma. Con anterioridad al despojo, la propiedad únicamente colindaba con el aeródromo en el lindero Oeste; éste se ubicaba además, a 125 metros del inicio de la pista de aterrizaje.- Ahora, la pista quedó "encajada" en la finca, es decir, una parte del remanente ahora colinda directamente con el aeródromo, por el Norte, el Sur y el Este.- Si bien es cierto, existe prueba técnica que indica que el cambio de categoría de aquél, no incrementa la naturaleza de las limitaciones que impone un aeródromo de esas condiciones (que tienen fundamento legal), es un hecho que ahora existe una mayor cercanía con la pista, particularmente en los costados y en las denominadas zonas libres A y B. Esas áreas, antes a mayor distancia de la pista, no tenían las limitaciones específicas apuntadas por la Dirección de Aviación Civil y que se traducen en general, en impedimentos para siembra de productos que por su altura, puedan poner en riesgo la seguridad de las aeronaves.

Por eso, es posible afirmar, de manera cierta, que la expropiación no sólo conllevó una reducción de la cabida, sino también una menor capacidad de uso del terreno, en particular la siembra de palma aceitera -uso actual-. También se afectó la regularidad del inmueble y eso sin duda alguna incide en la deseabilidad del inmueble y afecta su precio, siendo éste justamente, el daño al remanente que el perito encontró, al realizar su experticia y que, como lo reclaman los recurrentes, debe ser indemnizado. No obstante lo anterior, en punto a la magnitud de esa afectación, se estima que el peritaje judicial no razona, de manera suficiente, las razones por las cuales estima que la reducción del valor del remanente, corresponde a un 0,74% sobre el precio por metro cuadrado dado al terreno antes de la expropiación.- Para esta Cámara, esa experticia no es del todo clara, en cuanto a las áreas específicas en donde habrá una imposibilidad absoluta o una reducción importante para su aprovechamiento.

Tampoco hay elementos contundentes, sobre a cuánto ascienden los ingresos que dejarán en su caso de percibirse y sin ello, no es posible conceder el monto allí establecido, superior a los doscientos quince millones de colones, como lo pretenden los apelantes. De otra parte, no hay evidencias de que allí exista un humedal. En realidad, dado que el área remanente es superior a las 34 hectáreas, la afectación, que se produce, no puede considerarse de tal magnitud como la indicada por el perito. Si bien hay una afectación a la baja del precio, que los propietarios no están en el deber de soportar y que obliga a indemnizarles, dados los factores desvalorizantes que soporta el inmueble como producto del despojo, es lo cierto que la finca, con todo y las limitaciones, puede seguir desarrollando su uso actual (agricultura y ganadería), por lo que debe fijarse el daño al remanente en un porcentaje mucho menor.

En su jurisprudencia, este órgano colegiado, cuando ha admitido la existencia de un daño al remanente en expropiaciones parciales, ha aplicado el criterio externado por múltiples expertos en este tipo de diligencias, que desde el punto de vista de su valoración, han señalado que este porcentaje tiene una afectación que va del uno al diez por ciento, de modo que, cuando aquélla es del 10%, eso quiere decir que hubo una afectación total del inmueble por cuanto se afecta el contenido esencial de la propiedad y se limitan gravemente los atributos del dominio; lo cual, evidentemente no se da en el caso concreto, en donde las nuevas situaciones de la finca no impiden en general, la continuación del uso actual de la finca, según se ha dicho (véase en similar sentido, sentencia de esta misma Sección, N°128-2021-I de las 11:40 horas del 08 del ocho de abril de 2021). Esta Cámara, a falta de prueba determinante sobre una afectación mayor, estima que la afectación es la mínima, es decir, del uno por ciento (1%), pues el peritaje judicial no arroja elementos de juicio suficientes, para conceder el monto total que fija en su experticia.

Ese daño, además, debe calcularse a partir del monto por metro cuadrado establecido en el avalúo administrativo, que fue el que se fijó en sentencia y con el cual se conformaron las partes, de cuatro mil quinientos cincuenta y seis colones (¢4.556,00). Así las cosas, de acuerdo con la certificación registral que consta en autos, la finca total, antes de la expropiación, es de 388.709,58 metros cuadrados, por lo que, una vez restada el área expropiada, de 48.664 metros cuadrados, el área remanente es de 340.045,58 metros cuadrados. Así lo indica claramente el avalúo administrativo y lo confirma el perito judicial, de modo que no hay controversia al respecto. Multiplicada esta última área, por el valor unitario del terreno, su precio es de mil quinientos cuarenta y nueve millones doscientos cuarenta y siete mil seiscientos sesenta y dos colones con cuarenta y ocho céntimos (¢1.549.247.662,48), ello, multiplicado por el uno por ciento (0,01), es igual a quince millones cuatrocientos noventa y dos mil cuatrocientos setenta y seis colones con sesenta y dos céntimos (¢15.492.476,62), suma está última en que se aprueba el daño al remanente.- VIII).- COSTAS E INTERESES.

En virtud de lo dispuesto sobre el daño al remanente, por existir una diferencia entre el avalúo administrativo y la cantidad establecida en sentencia, resulta de imperativa aplicación lo dispuesto en el artículo 11 de la Ley de Expropiaciones, conforme al cual, sobre esa diferencia, que en este caso asciende a ¢15.492.476,62, deben concederse intereses al tipo legal, a partir de la fecha de la desposesión, que acaeció el diez de noviembre de dos mil diecisiete y hasta el efectivo pago de dicha cantidad.- Del mismo modo, debe revocarse lo resuelto en cuanto a las costas, que deberán ser cubiertas por el Estado. Las personales, deben fijarse sobre esa misma diferencia, más los intereses que, en su caso, se liquiden y aprueben.- Se rechaza la petición de indexación, por improcedente y en lo demás, por no haber sido objeto de recurso, debe mantenerse incólume lo decidido.-

POR TANTO:

En lo que ha sido objeto de recurso, se revoca la sentencia apelada, únicamente en cuanto denegó el pago del daño al remanente, los intereses y resolvió sin especial condenatoria en costas. En su lugar, se concede el daño al remanente en la suma de quince millones cuatrocientos noventa y dos mil cuatrocientos setenta y seis colones con sesenta y dos céntimos (¢15.492.476,62), suma sobre la cual, deberá el expropiante cancelar intereses desde el diez de noviembre de dos mil diecisiete -fecha de la entrada en posesión- y hasta el efectivo pago de esa cantidad. Se condena al Estado, al pago de las costas del proceso; las personales deben fijarse sobre esa misma diferencia, más los intereses que, en su caso, se liquiden y aprueben.- En lo demás, por no haber sido objeto de recurso, se mantiene incólume lo decidido.
