VOTE N° 509-F-2021 AGRARIAN COURT (TRIBUNAL AGRARIO). SECOND JUDICIAL CIRCUIT OF SAN JOSÉ.- At sixteen hours and forty-six minutes on tres de junio de dos mil veintiuno.- SUMMARY TREE-REMOVAL PROCEEDING (SUMARIO DE DERRIBO) brought by [Nombre1], of legal age, married, homemaker, resident of Limón, identity card number CED1 - -; against [Nombre2], of legal age, married, merchant, resident of Limón, identity card number CED2 - -. Attorney Hilory Hunter Tatum acts as public defender for the plaintiff; and Attorney José Miguel Zeledón Gómez, bar number dos mil doscientos treinta y nueve, acts as special judicial representative (apoderado especial judicial) for the defendant. Heard before the Agrarian Court of the First Judicial Circuit of the Atlantic Zone, Limón.- Judge Castro García drafts the opinion; and;

WHEREAS

I.On veintisiete de enero del año dos mil veinte, the plaintiff [Nombre1] filed a summary action for the removal of trees, seeking a judgment declaring: “.. 2.- That the defendant’s failure to remove the trees be declared negligent and a threat to my life, the lives of my family, the land, and the house where I live. 3.- That it be declared that the defendants are obligated to remove said trees and, should they fail to do so, that I be authorized to cut them down. 4.- That the defendant be ordered to pay both categories of costs (ambas costas) of these proceedings.” (images 2 through 6 of the digital case file in PDF format).

II.The respondent [Nombre2] was served, denied the complaint, and raised the defense of lack of legal entitlement (excepción de falta de derecho) (service record dated 12 de mayo del 2020 in image 42, response in images 43 through 47 of the digital case file in PDF format).

III-Proven facts. This Chamber adopts the proven facts because they are supported by the body of evidence (acervo probatorio) contained in the record.

IV- Appeal. Judge Stephanie Alvarado Bejarano of the Agrarian Court of the First Judicial Circuit of the Atlantic Zone, by judgment number N° 108-2020 issued at ten hours and forty-nine minutes on diecisiete de diciembre de dos mil veinte, ruled: “The present summary tree-removal action filed by [Nombre1] against [Nombre2] is GRANTED; the complete cutting of dieciséis trees located at [Dirección1], adjacent to the plaintiff’s property and within the defendant’s property, is authorized. Those trees are described in the following table:.... The defendant is granted a period of QUINCE DÍAS to comply with the foregoing. Because the trees are located within the defendant’s property, the defendant may market or otherwise economically dispose of the timber resulting from the cutting, in accordance with Articles 505 and 506 of the Civil Code. Nevertheless, pursuant to Article 108.2 of the Code of Civil Procedure, the defendant shall bear the cutting expenses.

Alternatively, if the defendant has not carried out the required cutting within quince días, the plaintiff shall advance the expenses, which the defendant must reimburse through the procedural costs (costas procesales). The defendant is ordered to pay both categories of costs of the proceedings. Pursuant to Article 108.3, the defendant is ordered to pay damages (daños y perjuicios), which must be quantified through judgment-enforcement proceedings (trámite de ejecución de sentencia).-” (images 103 through 112 of the digital case file in PDF format). The defendant alleges nullity (nulidad) and files an appeal (recurso de apelación) against the cited judicial decision, stating: a) The right-of-defense principle (principio de defensa) was violated beginning with the judicial inspection (reconocimiento judicial), because the defendant had not been served. He understands that such an inspection is possible if the due-process principle (principio del debido proceso) is respected.

In this regard, he contends that the court prejudged the matter during that proceeding by stating that the trees endangered the plaintiff’s life, since it was asserted that they were very tall trees posing a danger to lives and homes. b) The appellant states that, when given an opportunity to respond concerning the judicial inspection, he requested that this evidence be expanded to include the distance between each tree to be cut and the boundary with the plaintiff’s property, in order to comply with Article 403 of the Civil Code; however, this was not done. The judgment must therefore be vacated. c) During the judicial inspection, at which he was absent, in addition to the assertion made by the judge who conducted the proceeding, the attending MINAE official stated in his report that there were 03 dwellings on land identified as belonging to [Nombre1]. It borders [Nombre2]’s property, where there is vegetation cover (cobertura vegetal) consisting of scrubland (charral) and scattered trees of various species, including several large timber species.

Using GPS, 11 Poro trees (Erythrina poeppigiana) and 06 Laurel trees (Cordia alliodora) were identified and georeferenced, “which were determined, IN THE EVENT of falling, TO BE CAPABLE of damaging the existing houses and their occupants, due to the height of the trees and their proximity to the houses; the trees are reported to be located within the defendant’s property. The phytosanitary condition (estado fitosanitario) of the trees identified as dangerous to the plaintiff’s houses IS CONSIDERED HEALTHY; however, climatic factors (rain, wind, etc.) COULD cause some of them to fall.” He counters that the defect giving rise to nullity (vicio de nulidad) was asserted from the outset. d) He argues that the trees’ removal is recommended despite their being healthy species, on the ground that they pose a threat to life, which is an overly broad concept. Under that understanding, any tree or branch could endanger life depending on its height and size.

Thus, the presence of trees in parks, markets, and public roads could endanger passersby. He expresses his disagreement with reliance on the risk to human life as support for the reasoning of the challenged decision. The appellant states that, under that theory, there would be sufficient legal grounds to sue the Municipalities and MOPT. Moreover, under that reasoning, an action could be brought to compel them to cut down every tree obstructing passage. He explains that he respects the lives of third parties and of those living near the land, but those trees were already on the site when they decided to build or live there. He further objects that the plaintiff’s constitutional right to private property must supposedly be respected, but not that of the appellant, whose property is registered and who is entitled to exercise all incidents of ownership (atributos del dominio). He states that all the trees are healthy and that he was not permitted to establish their distances from the boundary with the plaintiff’s property, as required by Article 403 of the Civil Code, which was not observed.

The new MINAE report did not include the requested distance measurements. He notes that if the trees sought to be cut were already there when the plaintiff and the occupants of the different houses on the neighboring lot arrived, and the trees are healthy, the conditions permitting their removal without the consent of the owner of the property on which they are planted have not been met: namely, that they be diseased or located within the 5 metros specified in Article 403 of the Civil Code. Indeed, the exact opposite has been demonstrated. He challenges the authority of the MINAE official to order the cutting of a healthy tree without the owner’s authorization because it is private property. Even if the official merely issued a recommendation, the judgment treats it as an order, although that recommendation does not supersede the constitutional right to private property. (images 115 through 16 of the digital case file in PDF format).- V- With respect to the claims of nullity (nulidades) raised, pursuant to section 26 of the Ley de Jurisdicción Agraria, they must be rejected by this Court.

There is no indication that the proceedings caused any denial of the right of defense (indefensión), since the appellant was entitled to challenge the various procedural acts and rulings concerning the judicial inspection (reconocimiento judicial) and matters addressed in the technical report. The ground for nullity relating to the judicial inspection, the alleged prejudgment expressed during that proceeding, and the failure to address his request that the distance from the trees at issue in these proceedings to the boundary with the plaintiff’s property be measured in order to determine the applicability of article 403 of the Código Civil are without merit. This conclusion follows from the proceedings and rulings in the case at bar, since a summary action for tree removal (demanda sumaria de derribo) was filed on 27 de enero 2020, requesting a judicial inspection to verify the danger posed by the trees and requesting that a MINAET forestry engineer inspect the condition of the trees so that their cutting could be authorized, given the risk to the safety of the family living at the site and to their belongings.

The order for service of process (auto de traslado) was issued at sixteen hours and ten minutes on veintinueve de enero del año dos mil veinte, and the judicial inspection was scheduled for 12 de febrero del 2020 (images 10 to 11 of the judicial case file in PDF format). On 12 de febrero del 2020, the judicial inspection was conducted without the presence of the respondent, who had not yet been served with the order for service of process, and the following was recorded: “The area in dispute is reached by way of [Dirección2]. There are three dwelling houses on the plaintiff’s property. Around the plaintiff’s property, on land belonging to the defendant, there are numerous very tall trees that pose a danger to life and to the dwellings. Fallen trees were observed on both sides of the plaintiff’s property, 3 in total. Once the inspection was completed, the engineer determined that 11 poró trees and 6 laurel trees pose a danger to the dwellings and persons; he further stated that, because of their limited height, the pejibaye trees do not pose a danger to the dwellings or persons, but do pose a danger to the electrical wiring.

The forestry engineer states that he will submit the corresponding report.” (images 21 and 22 of the judicial case file in PDF format). The SINAC technical report, official communication SINAC-ACLAC-OSRLT- 050-2020 of 14 de febrero del 2020, was issued and concluded: “There are 03 dwelling houses on land that Ms. [Nombre1] identifies as her own and that adjoins the other property identified as belonging to the defendant, [Nombre2]. Mr. [Nombre2]’s property is determined to have scrubland vegetation cover (cobertura vegetal de charral) and scattered, large trees of several species, including several timber species. _Using GPS, 11 Poro trees (Erythrina poeppigiana) and 06 Laurel trees (Cordia alliodora) were identified and georeferenced; it was determined that, if they were to topple, they could damage the existing houses and injure the persons who live in them, due to the height of the trees and their proximity to the houses; the trees are reported to be located within the defendant’s property._The phytosanitary condition (estado fitosanitario) of the trees identified as dangerous to the plaintiff’s houses is considered sound; however, climatic factors (rain, wind, etc.) could cause some of them to topple.

A georeferenced image showing the location of the houses and the trees whose cutting is recommended for safety reasons is provided.” (image 25 of the digital case file in PDF format). By order issued at 10:43 on 22 de mayo de dos mil veinte, the respondent was granted an opportunity, insofar as relevant, to comment on the contents of the judicial inspection and the report of the Sistema Nacional de Áreas de Conservación (image 48 of the digital case file in PDF format). In a filing dated 25 de mayo del 2020, the respondent asserted in this regard that due process (debido proceso) had been violated and that there had been prejudgment because the judicial inspection stated that the trees posed a threat to life. He requested a new judicial inspection to determine the distance between the trees and the boundary of the plaintiff’s property, in order to establish whether they were located within the area specified by law for cutting, as they were situated on private property.

In his filing, he requested that the distance of the trees to be cut be determined through a new judicial inspection or by an expert witness (perito) (images 51 to 52 of the digital case file in PDF format). By ruling issued at thirteen hours and fifty-one minutes on nueve de junio de dos mil veinte, his request for the defendant’s proposed judicial-inspection evidence was denied, and the case file was ordered submitted for a decision on the merits (image 58 of the digital case file in PDF format). That ruling was not challenged. Before judgment was issued, the Court, acting sua sponte and in order to prevent grounds for nullity, ordered the SINAC report supplemented to establish: a) the height and proximity of each of the trees (11 Poro trees ([Nombre3] poeppigiana) and 06 Laurel trees ([Nombre4] alliodora); and b) which trees were recommended for cutting. In a filing, the defendant requested that the supplemental report include, in addition to the distances between the trees to be cut, measurements from those trees to the boundary with the plaintiff’s property. (image 69 at the same location and in the same format). This was ordered by an order issued at 14:54 on 7 de julio de 2020 (image 71). The technical supplemental report was issued through official communication SINAC-ACLAC-SAC-408-2020 and stated: “The average total height of the specified trees is taken to be 30 m, and the distance from each tree considered dangerous to the nearest house is provided. Using GPS, 10 Poro trees (Erythrna poeppigiana) and 06 Laurel trees (Cordia alliodora) were identified and georeferenced. If they were to topple, they could damage the existing houses and injure the persons who live in them, due to the height of the trees and their proximity to the houses; these trees are located within the defendant’s property.

A new georeferenced image showing the location of the houses, with the horizontal distance specified for each tree, is provided, and the trees that must be felled are identified. ... Based on an estimated average total height of 30 m, it is recommended that the 16 specified trees be cut. Although number 16 is 37.66 m away, it is included among those considered necessary to fell because of the possible margin of error.” That document included a table detailing each tree recommended for felling, its distance, species, and georeferenced location (images 89 to 93 of the digital case file in PDF format). The parties were granted an opportunity to comment on it, and the defendant stated that the report should identify which trees were diseased. The court denied the request, indicating that this was a matter to be assessed in the judgment. The trial court also reasoned that the report clearly stated that the trees were healthy.

Regarding the judicial inspection conducted in the defendant’s absence, this Court notes that its findings were disclosed to the respondent and that, given the nature of the tree-removal proceeding, conducting the inspection in that manner was justified by the need to protect the safety and physical integrity of persons and various types of property, in light of the basis for the proceeding. By virtue of the opportunity to comment, the party was able to challenge the findings and raise any arguments he deemed appropriate. A judicial inspection may be conducted without all parties being present in a proceeding involving a potentially imminent risk of harm, provided that due process and the right of defense (derecho de defensa) are protected (article 26 of Ley de Jurisdicción Agraria). Furthermore, as stated in the judgment under appeal, the observation made during the judicial inspection regarding the risk that the trees could pose a danger to persons and property does not establish that there was prejudgment; rather, it was a description of what was observed at that time concerning the trees’ great height in relation to the dwellings and neighboring property.

This was confirmed in MINAET’s technical reports. Accordingly, the alleged defect giving rise to nullity does not exist. The claim of nullity based on the failure to measure the distance between the trees and the boundary of the plaintiff’s property in order to determine the applicability of article 403 of the Código Civil is likewise rejected, in view of what will be assessed in this judgment regarding the substantive ground of appeal and because the necessary, useful, and relevant evidence was received in the proceedings to adjudicate the summary tree-removal action filed. The grounds for nullity are denied.

VI- Regarding the ground of appeal (agravio) concerning respect for the right to property and the failure to apply Article 403 of the Civil Code. The appellant challenges two issues in his arguments: the ruling does not respect his right to property, as it orders the cutting (corta) of the 16 trees on private property, a constitutional right, and the failure to apply section 403 ibídem. The challenged ruling stated as its basis that, although the trees are healthy, the MINAE report indicated that, because of their height, they represented a risk or danger if they were to fall due to weather conditions, given their great height (an average of thirty meters); if they fell, they would damage the homes on the plaintiff’s neighboring property and endanger human life. This Chamber agrees with that consideration, since, in the balancing that must be undertaken when recognizing individuals’ human rights in judicial proceedings, the right to human life and health must always prevail over any other recognized human right, such as the right to private property.

This precedence must be applied within the framework of the right to sustainable development (derecho al desarrollo sostenible), under which the exercise of the right to a healthy and ecologically balanced environment must be ensured, while continuing to safeguard basic rights such as health and human life. The foregoing is consistent with the development of a Social State governed by the rule of law (Estado Social de Derecho) (Articles 21, 45 and 50 of the Political Constitution). In the event of a conflict between rights of different categories, it must be resolved by applying the higher-ranking right (voto 972-90 de las 14:10 horas dl 22 de agosto del 1990 of the Constitutional Chamber of the Supreme Court of Justice). That same High Court has ruled: “... The exercise of fundamental rights, such as private property and freedom of commerce, is not unrestricted and must be limited for reasons of social welfare.

The right to a healthy environment, health, and physical integrity are fundamental rights that the State must protect” (voto 240.92 de las 9:00 horas del 31 de enero de 1992 and, to the same effect, voto 1488-92 de las 16:03 horas del 3 de junio del 1992). Accordingly, as to the appealed judgment’s authorization to cut the 16 trees because their great height poses a risk of damage to the plaintiff’s adjoining property and to the physical integrity of the persons living there if they fall due to weather conditions, this Court concludes that such authorization to cut them is justified in order to protect life and the integrity of property and persons. The forest species may be replaced with others in order to restore the forest cover (cobertura forestal) at the site, which the defendant has responsibly maintained. This will preserve the existing vegetation, given the defendant’s manifest interest in devoting his property to forest conservation and protection, which is hereby recognized.

The foregoing eliminates the risk that, should the trees fall as a result of natural phenomena that have become so prevalent due to climate change, they could cause irreparable loss of human life among the families who live or remain there. Regarding the exercise of and limitations on the right to private property, the Constitutional Chamber has stated: “The inviolability of private property is a constitutional guarantee established in section 45 of the Political Constitution. Contrary to how it was conceived in earlier times, this right is not static in nature; rather, in accordance with the demands of our time, it must be regarded as flexible and dynamic, meaning that it confers upon its holders, both internally and externally, powers, duties, and limitations.... Currently, not only is the right of property owners subject to protection, but so too are various general or social interests that coexist with it” (Voto 5097-93).

The ground of appeal concerning the violation of his right to private property is therefore denied, because that right is subject to limitations in furtherance of protecting the life and safety of the plaintiff and her family members. This is supported by the cited rulings and by the procedure under Article 108 of the current Code of Civil Procedure, applied supplementarily (articulo 26 of the Agrarian Jurisdiction Law, Transitorio I,.3 de Ley 9343 and II de Ley 9342). Regarding the objection concerning the failure to apply Article 403 of the Civil Code, the appellant has argued that the judgment is null and void because the court failed to conduct a judicial inspection (reconocimiento judicial) to verify the distance between each tree sought to be removed and the boundary of the plaintiff’s property, which was necessary to determine whether the 5 meters required by the provision existed.

The appellant maintains that, given the prohibition on planting trees at a distance of less than five meters from the boundary, those located at a greater distance on his registered private property should not be removed. This claim must be denied because the summary tree-felling proceeding (proceso sumario de derribo) is based on considerations of safety and the protection of human life and the integrity of property when a risk exists. That risk was established in these proceedings from a review of the MINAE technical report and its addendum. The report states that the trees it identified and located have an average height of 30 meters and that, if they were to topple due to weather conditions, they could damage the structures and endanger the persons who live and remain on the plaintiff’s neighboring property. The cutting of the species is therefore technically and legally justified, and the fact that those persons moved to the location when the trees were already on the neighboring property is not a reason to rule that the persons remaining on the plaintiff’s parcel must bear the risk of damage.

Such a conclusion would not be reasonable under the case-law grounds cited supra. Regarding the claim that the appealed judgment creates the possibility that anyone could sue the State to remove tall trees, this Chamber rejects it. This is because this Court is charged with deciding the grounds of appeal against the particular trial judgment, and that contention is a hypothetical argument unrelated to the case at issue. This Court further notes that liability for damage caused by falling trees on roads and in public areas is a matter extensively litigated in contentious-administrative proceedings (vía contenciosa administrativa), based on the particular circumstances of each case presented. The State or municipal corporations are liable for such harm under the applicable legal provisions, and the same situation applies to private property. This proceeding, however, has a different basis: preventing the loss of human life and damage to tangible property where a risk exists.

Likewise, the technical justification for authorizing the felling of the 16 trees, despite the identified forest species being healthy, is, in this specific case, their great height, because if they were to fall due to weather phenomena, they would damage the structures on the plaintiff’s adjoining property and pose a risk to human life. In this regard, the MINAE report stated: “10 Poro trees (Erythrna poeppigiana) and 06 Laurel trees (Cordia alliodora) were identified and georeferenced using GPS. If they were to topple, they could damage the existing houses and the persons living in them, due to the height of the trees and their proximity to the houses; these trees are located within the defendant’s property.” The ground of appeal is therefore rejected. As stated, the poró trees to be cut may be replaced with other species native to that life zone, and the laurel trees may be replanted at the defendant’s discretion.

Those trees would perform an environmental function suitable for the ecosystem existing at the site. It must be noted that the requirement in Article 403 of the Civil Code concerning the distance of five meters between the boundary and the tree contemplates a linear distance at which the tree does not pose a danger to the adjoining parcel; that is not the case here. The purpose of the procedural rule governing the remedy of tree felling (instituto de derribo de árboles) is to prevent damage. Given their height, the species to be cut would encroach upon the adjoining plaintiff’s land and its structures if they fell. That established height constitutes a latent hazard warranting affirmance of the ruling herein. Therefore, pursuant to Article 108 of the Code of Civil Procedure, applied supplementarily (Article 26 of the Agrarian Jurisdiction Law), the appealed judgment must be affirmed as to the matters challenged.

VII- For the reasons stated, pursuant to Articles 1, 2 and 26 of the Agrarian Jurisdiction Law, 108 of the Code of Civil Procedure, applicable by virtue of Transitorio I de Ley 9343, I y II de Ley 9342, and 33 of the Ley Forestal, the appealed judgment is affirmed as to the matters challenged. The defendant is cautioned that, during the cutting process, he must comply with the technical measures and recommendations issued for the authorized logging (tala). If the timber is marketed, he must duly obtain and comply with the permits and legal requirements for that purpose (transportation permits, plates, among others), as well as observe the necessary safety measures during the felling process. The foregoing shall be carried out under the technical guidance of MINAE, which must issue the appropriate recommendations in the performance of its duties.

Por tanto

The appealed judgment is affirmed as to the matters challenged. The defendant is cautioned that, during the cutting process, he must comply with the technical measures and recommendations issued for the authorized logging. If the timber is marketed, he must duly obtain and comply with the permits and legal requirements for that purpose (transportation permits, plates, among others), as well as observe the necessary safety measures during the felling process. The foregoing shall be carried out under the technical guidance of MINAE, which must issue the appropriate recommendations in the performance of its duties.

VOTO N° 509-F-2021 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las dieciséis horas cuarenta y seis minutos del tres de junio de dos mil veintiuno.- SUMARIO DE DERRIBO establecido por[Nombre1] , mayor, casada, ama de casa, vecina de Limón, cédula de identidad número CED1 - - ; contra [Nombre2] , mayor, casado, comerciante, vecino de Limón, cédula de identidad número CED2 - - . Actúa como defensor público de la parte actora el licenciado Hilory Hunter Tatum; y como apoderado especial judicial del demandado el licenciado José Miguel Zeledón Gómez, colegiado dos mil doscientos treinta y nueve. Tramitado ante el Juzgado Agrario del Primer Circuito Judicial de la Zona Atlántica, Limón.- Redacta la jueza Castro García;y;

CONSIDERANDO

I.La actora [Nombre1] , interpone demanda sumaria de derribo de árbol en fecha veintisiete de enero del año dos mil veinte, para que en sentencia se declare: ".. 2.- Que se declare que la actitud de la demandada al no derribar los arboles es negligente y atenta contra mi vida, la de mi familia, el terreno y la casa donde vivo. 3.- Que se declare que los demandados tienen la obligación de derribar dichos árboles y en caso de no hacerlo se me autorice a cortarlos. 4.- Se imponga a la demandada la obligación de cancelar ambas costas de este proceso." (imagen 2 a 6 de expediente digital modo pdf).

II.El accionado [Nombre2] , fue notificado, contesta la demanda de forma negativa e interpone la excepción de falta de derecho (acta de notificación del 12 de mayo del 2020 en imagen 42, contestación en imagen 43 a 47 de expediente digital modo pdf.)

III-Hechos probados. Esta Cámara prohíja los hechos probados por estar fundados en el acervo probatorio que consta en autos.

IV- Recurso. La jueza Stephanie Alvarado Bejarano del Juzgado Agrario del Primer Circuito Judicial de la Zona Atlántica, mediante sentencia número N° 108-2020 de las diez horas cuarenta y nueve minutos del diecisiete de diciembre de dos mil veinte se resolvió: "Se ACOGE la presente demanda sumaria de derribo interpuesta por [Nombre1] contra [Nombre2] , se autoriza la corta total de dieciséis árboles que se ubican en la [Dirección1] con la propiedad de la parte actora, dentro de la propiedad de la parte demandada, los cuales se describen en el siguiente cuadro:....Para el cumplimiento de lo anterior, se le da un plazo a la parte demandada de QUINCE DÍAS. Por encontrarse los árboles dentro de la propiedad de la parte demandada, podrá esta comercializar o disponer económicamente de la madera resultante de la corta, lo anterior de conformidad con los artículos 505, 506 del Código Civil. Sin embargo, conforme el artículo 108.2 del Código Procesal Civil, los gastos de la corta correrán a cargo de las parte demandada.

Y en su defecto, si en el plazo de quince días la parte demandada no ha realizado la corta correspondiente, suplirá los gastos la actora, los cuales deberán ser reembolsados por la parte demandada por medio de las costas procesales. Se condena a la parte demandada al pago de ambas costas del proceso. Conforme al artículo 108.3 se condena a la parte demandada al pago de los daños y perjuicios, los cuales deben ser liquidados por medio del trámite de ejecución de sentencia.-" (imagen 103 a 112 expediente digital modo pdf). El demandado invoca la nulidad e interpone recurso de apelación contra la decisión judicial citada, señalando: a) Se transgredió el principio de defensa desde el reconocimiento judicial, sin estar notificado el demandado. Lo que entiende es posible, si se respeta el principio del debido proceso. Al respecto afirma, en tal acto se adelanta criterio al afirmar que dichos árboles atentan contra la vida de la actora, pues se afirmó que eran árboles de gran altura que representaban un peligro para la vida y las viviendas. b) Señala el apelante, por su parte al conceder audiencia del reconocimiento judicial, solicitó se ampliará esa prueba en cuanto a la distancia de cada uno de los árboles a cortar respecto al lindero con la actora, a fin de respetar el artículo 403 del Código Civil; pues ello no ocurre.

Por lo que debe anularse la sentencia. c) En el reconocimiento judicial en el cual estuvo ausente, aparte de la aseveración de la persona juzgadora que realizó ese acto, el funcionario del MINAE que asistió, en su informe menciona la existencia de 03 casas de habitación en un terreno que cita es de [Nombre1] . Colinda con finca de [Nombre2] , donde hay una cobertura vegetal de charral y árboles dispersos de varias especies de gran tamaño y de varias especies maderables. Se determinan y se georeferencian con GPS 11 árboles de Poro (Erythrina poeppigiana) y 06 Laurel (Cordia alliodora), " los cuales se determina que EN CASO de volcamiento PODRÍAN dañar las casas existentes y a las personas que las habitan; esto por la altura de los árboles y la cercanía a las casas; los cuales se indica que se ubican dentro de la propiedad del demandado.El estado fitosanitario de los árboles determinados como peligrosos para las casas de la demandante, SE CONSIDERAN SANOS; sin embargo por factores climatológicos (lluvias, vientos.etc) PODRIA producirse el volcamiento de algunos.

“ Refuta, se insistió en en vicio de nulidad desde el inicio. d) Arguye, se recomienda la corta de los árboles, a pesar de ser especies sanas por estimarse que atentan contra la vida; lo que es un concepto muy amplio. Pues, bajo ese entendimiento todo árbol o rama puede poner en riesgo la vida dependiendo de la altura y tamaño. De tal forma que la presencia de elementos forestales en parques, mercados, vías públicas pueden atentar contra la vida los transeúntes. Expresa su disconformidad con la referencia de riesgo de la vida humana en sostén del criterio de la pieza recurrida. Indicando el apelante, que bajo esa tesis existiría razón legal suficiente para demandar a las Municipalidades y al MOPT. Además que bajo ese criterio se podría accionar para obligarlos a cortar todos los árboles que afecten su paso. Razona, respeta la vida de terceras personas y personas vecinas del terreno, pero esos árboles ya estaban en el sitio cuando deciden construir o vivir en el lugar.

Y refuta, se debe respetar el principio constitucional del derecho a la propiedad privada de la actora, pero no la del recurrente que es fundo inscrito y tiene el derecho de ejercer todos los atributos del dominio. Refiere, todos los árboles están sanos y no se les permitió demostrar la distancias de los mismos respecto al lindero con el inmueble de la actora; acorde con el artículo 403 del Código Civil que no fue respetado. En el nuevo informe del MINAE no se incorporó lo que peticionó la medición de las distancias solicitadas. Reseña, si los árboles que se pretenden cortar ya estaban ahí cuando llegó la actora y las personas que habitan las diferentes casas del lote vecino, y los árboles están sanos, no se cumplen las condiciones por las que se permite la eliminación sin el consentimiento del propietario del fundo donde están plantados: que estén enfermos o bien, se ubiquen dentro de los 5 metros que indica el artículo 403 del Código Civil.

Y se ha demostrado todo lo contrario. Cuestiona, el funcionario del MINAE carece de facultades para ordenar la cortar un árbol sano y sin la autorización del propietario, al ser propiedad privada. Y aún cuando solo recomiende, se toma en la sentencia como una orden. Sin que esa recomendación se encuentre por encima del derecho constitucional de propiedad privada.( imagen 115 a 16 expediente digital pdf).- V- Respecto a las nulidades invocadas, con fundamento en el ordinal 26 de la Ley de Jurisdicción Agraria, han de rechazarse por esta Instancia. No se denota que en los procedimientos se hubiere causado indefensión alguna, al estar facultado el apelante de recurrir las diversas actuaciones y resoluciones del proceso referidas al reconocimiento judicial y temas del informe técnico. En referencia al motivo de nulidad respecto al reconocimiento judicial, el adelanto de criterio emitido en ese acto y la omisión de atención de su petición dirigida a que se midiera la distancia desde los árboles objeto de este proceso a la colindancia con la finca de la actora a fin de constatar la aplicación del artículo 403 del Código Civil, no resulta de recibo.

Lo anterior se concluye de lo actuado y resuelto en el subjúdice, pues se presentó demanda sumaria de derribo en fecha 27 de enero 2020 en donde se solicita reconocimiento judicial para verificar el peligro que representan los árboles y un ingeniero forestal del MINAET verifique verifique el estado del árbol para que sea autorizada la corta dado el riesgo a la integridad de la familia que habita el sitio y sus pertenencias. (imagen 2 a 6 de expediente digital modo pdf). Se emite el auto de traslado de las dieciséis horas y diez minutos del veintinueve de enero del año dos mil veinte y se fija reconocimiento judicial del 12 de febrero del 2020 (imagen 10 a 11 de expediente judicial modo pdf). El 12 de febrero del 2020 se realizó el reconocimiento judicial sin la presencia del accionado , a quien aún no se le había notificado el auto de traslado en donde se consignó: "Se llega al área en litis por una [Dirección2] .

En la propiedad de la actora existen tres casas de habitación. Alrededor de la propiedad de la parte actora en el terreno de la parte demandada existen gran cantidad de árboles de gran altura que representa un peligro para la vida y las viviendas. A ambos costados de la propiedad de la parte actora se observaron árboles caídos, en total 3. Una vez llevado a cabo el reconocimiento el ingeniero determina que 11 árboles de poró y 6 árboles de laurel representan peligrosidad con las viviendas y las personas, manifiesta además que, por la poca altura los árboles de pejibaye no representan un peligro para las viviendas y las personas, pero si para el cableado eléctrico. El ingeniero forestal indica que presentará el Informe correspondiente." (imagen 21 y 22 de expediente judicial modo pdf.). Se emite el informe técnico de SINAC oficio SINAC-ACLAC-OSRLT- 050-2020 del 14 de febrero del 2020 en donde se concluyó: " Existen 03 casas de habitación en un terreno que indica como suyo la señora [Nombre1] y colinda con la otra propiedad que se indica como del demandado [Nombre2] .

La propiedad del señor [Nombre2] , se determina con una Cobertura vegetal de charral y árboles dispersos de varias especies de gran tamaño y de varias especies maderables. _Se determinan y se georeferencian con GPS 11 árboles de Poro (Erythrina poeppigiana) y 06 Laurel (Cordia alliodora), los cuales se determina que en caso de volcamiento podrían dañar las casas existentes y a las personas que las habitan; esto por la altura de los árboles y la cercanía a las casas; los cuales se indica que se ubican dentro de la propiedad del demandado._El estado fitosanitano de los árboles determinados como peligrosos para las casas de la demandante, se consideran sanos; sin embargo por factores climatológicos (lluvias, vientos, etc) podría producirse el volcamiento de algunos. Se aporta imagen georeferenciada con la ubicación de las casas y de los árboles que por seguridad se recomienda ordenar la corta " (imagen 25 de expediente digital modo pdf).

Por auto de las 10:43 del 22 de mayo de dos mil veinte, que en lo que interesa, otorgó audiencia al accionado del contenido del reconocimiento judicial y del informe del Sistema Nacional de Áreas de Conservación (imagen 48 de expediente digital modo pdf). Por memorial del 25 de mayo del 2020 el accionado señala al respecto, media violación al debido proceso y se adelantó criterio, pues se señaló en el reconocimiento judicial que los árboles atentaban contra la vida. Solicitó un nuevo reconocimiento judicial para constatar la distancia de los árboles respecto al lindero de la finca de la actora. Para determinar si se encuentran dentro del área indicada por ley para ser cortados, al ubicarse en propiedad privada. Solicita en su memorial se determine en un reconocimiento judicial nuevo o por perito la distancia de los árboles a cortar (imagen 51 a 52 expediente digital modo pdf). Por resolución de las trece horas y cincuenta y uno minutos del nueve de junio de dos mil veinte, se rechazó su solicitud de la prueba del reconocimiento judicial de la demandada y se ordenó pasar el expediente al dictado de la resolución de fondo (imagen 58 de expediente digital modo pdf).

Lo que no se impugnó. En forma previa a la emisión de la sentencia, se ordenó de oficio por el Despacho, que en aras de salvaguardar nulidades se ampliara el informe del SINAC a fin de establecer: a) la altura y cercanía de cada uno de los árboles (11 árboles de Poro ([Nombre3] poeppigiana) y 06 Laurel ([Nombre4] alliodora). b) indicar sobre cuales árboles se recomienda la corta. (imagen 62 de expediente digital modo pdf). En memorial del demandado solicitó se incluya en esa ampliación en el informe, además de la distancia entre árboles a cortarse, la medición de tales con la colindancia de la actora. (imagen 69 de misma ubicación y modo). Lo cual fue ordenado en auto de las 14:54 horas del 7 de julio de 2020 (imagen 71). Se emite la ampliación técnica por oficio SINAC-ACLAC-SAC-408-2020, en donde se señaló: "Se toma como promedio de altura total de los árboles indicados en 30 m y se detalla la estancia de cada uno de los árboles considerados como peligrosos a la casa más cercana.

Se determinan y se georreferencian con GPS 10 árboles de Poro (Erythrna poeppigiana) y 06 Laurel (Cordia alliodora). Los que en caso de volcamiento podrían dañar las casas existentes y a las personas que las habitan; esto por la altura de los árboles y la cercanía a las casas; los cuales se ubican dentro de la propiedad del demandado. Se aporta nueva imagen georreferenciada con la ubicación de las casas con la distancia horizontal indicada para cada uno y se define cuales se deben talar. ... De acuerdo a una altura total promedio estimada de 30 m, se recomienda cortar los 16 árboles indicados. Aunque el número 16 está a 37.66 m, por el posible margen de error se incluye entre los que se considera necesario talar." Se incorporó en ese documento un cuadro donde se detalla cada árbol que se recomienda talar, la distancia, especie y ubicación georeferenciada (imagen 89 a 93 de expediente digital modo pdf).

De la cual se concedió la audiencia a las partes, indicando el demandado se debía citar cuáles estaban enfermos. Petición rechazada por el juzgado indicando que ello era un tema a valorar en la sentencia. Además de razonarse por el Despacho de instancia que el informe es claro en el sentido de que los árboles se encuentran sanos. De lo descrito menciona esta Cámara sobre el reconocimiento judicial celebrado en ausencia del demandado, su resultado fue puesto en conocimiento del accionado y debido a la naturaleza del proceso de derribo de árbol, se justifica una actuación de esa forma por razones de seguridad e integridad de las personas y los bienes de diversa naturaleza, dado el fundamento del proceso. En virtud de la audiencia la parte tuvo la oportunidad de recurrir y alegar lo que estimaba pertinente. La posibilidad de realizar un reconocimiento judicial sin las presencia de todas las partes es posible, en un proceso en donde podría existir un riesgo inminente de daños, siempre que se resguarde el debido proceso y el derecho de defensa (artículo 26 de Ley de Jurisdicción Agraria.

Por otra parte, tal y como se indicó en el fallo recurrido, lo citado en el acto del reconocimiento judicial sobre el riesgo de que los árboles fueran peligrosos para las personas y bienes, no conlleva a entender que hubo adelanto de criterio, sino una descripción de lo observado en el momento y con respecto a la gran altura de los mismos en relación con las viviendas y finca aledaña. Lo cual fue confirmado en los informes técnicos del MINAET. Por lo que no existe el vicio de nulidad apuntado. En relación con la nulidad sobre la omisión de haber medido la distancia entre los árboles y la colindancia de la finca de la actora a fin de determinar la aplicación del artículo 403 del Código Civil, no se acepta, en virtud de lo que se valorará en esta sentencia respecto al agravio de fondo y que en el proceso se evacuó prueba necesaria, útil y pertinente a fin de resolver el sumario de derribo planteado. Se deniegan los motivos de nulidad.

VI- Sobre el agravio del respeto del derecho de propiedad y falta de aplicación del artículo 403 del Código Civil. Refuta el recurrente dos temas en sus alegatos: la resolución no respeta su derecho de propiedad al ordenarse la corta de los 16 árboles en propiedad privada como derecho constitucional y la falta de aplicación del ordinal 403 Ibídem. En la pieza recurrida se expuso como fundamentación, que a pesar de que los árboles están sanos, se indicó en el informe del MINAE que tales, por su altura representaban un riesgo o peligro en caso de derribo por razones climatológicas, dada su gran altura (un promedio de treinta metros) en caso de caída se afectarían las viviendas de la finca vecina de la actora y poner en peligro la vida. Esta Cámara comparte esa consideración, pues dentro de la ponderación que ha de ejercerse al reconocer los derechos humanos de las personas en un proceso judicial, debe prevalecer siempre el derecho a la vida humana y la salud sobre cualquier otro derecho humano reconocido, como el derecho a la propiedad privada.

Prevalencia que debe aplicarse bajo la dimensión del derecho al desarrollo sostenible, donde debe asegurarse el ejercicio del derecho al ambiente sano y ecológicamente equilibrada, pero sin dejar de resguardar derechos básicos como la salud y la vida humana. Lo anterior, acorde con el desarrollo de un Estado Social de Derecho (artículos 21, 45 y 50 de la Constitución Política). En caso de colisión de derechos de diversa categoría, debe ser resuelta dándole aplicación al de mayor rango (voto 972-90 de las 14:10 horas dl 22 de agosto del 1990 de la Sala Constitucional de la Corte Suprema de Justicia. Ese mismo Alto Tribunal ha resuelto: " .. El ejercicio de los derechos fundamentales, como la propiedad privada y la libertad de comercio no es irrestricto y deben limitarse por razones de bienestar social social. El derecho a un ambiente sano, a la salud e integridad física son derechos fundamentales que el Estado debe proteger" (voto 240.92 de las 9:00 horas del 31 de enero de 1992 y en este sentido voto 1488-92 de las 16:03 horas del 3 de junio del 1992).

De tal forma que con lo resuelto en la sentencia apelada, en cuanto permitirse la corta de los 16 árboles porque su gran altura representan riesgo de daños en la finca colindante de la actora y la integridad física de las personas que ahí habitan, en caso de caída por motivos climatológicos, concluye esta Sede resulta justificada esa autorización de corta en aras de proteger la vida e integridad bienes y personas. Las especies forestales podrán ser reemplazada por otras, a fin de restaurar la cobertura forestal en el sitio que de forma responsable mantiene la parte demandada. Para así mantener esa vegetación existente, dado el manifiesto interés del accionado de destinar su fundo a la conservación y tutela forestal, que le es reconocido. Lo anterior sin el riesgo, de que en caso de caída ante los fenómenos naturales tan presentes como consecuencia del cambio climático, pudieran producir pérdidas humanas irreparables de las familias que ahí habitan o permanecen.

Sobre el ejercicio y limitaciones al derecho de propiedad privada la Sala Constitucional ha señalado: " La inviolabilidad de la propiedad privada es una garantía de rango constitucional recogida por el canon 45 de la Carta Política. Este derecho contrariamente a como se le concebía en otros tiempos, no es de naturaleza estática, sino que conforme a las exigencias de nuestro tiempo se le ha de considerar elástico y dinámico, esto es, que atribuye a sus titulares, tanto interna como externamente las facultades, deberes y limitaciones....Actualmente, no solo es tutelable el derecho de los propietarios, sino también diversos intereses generales o sociales que coexisten con aquel" (Voto 5097-93). Por lo que se deniega el agravio respecto a la violación a su derecho de propiedad privada, al mediar causas de limitaciones al mismo en ejercicio de la tutela de la vida y la seguridad de la persona actora y sus familiares.

Que encuentra sustento en las resoluciones citadas y el procedimiento del artículo 108 del Código Procesal Civil vigente, aplicado supletoriamente (articulo 26 de la Ley de Jurisdicción Agraria, Transitorio I,.3 de Ley 9343 y II de Ley 9342). Sobre el reproche de la inaplicación del artículo 403 del Código Civil. Al respecto ha indicado el apelante que la sentencia es nula por haberse omitido realizar un reconocimiento judicial a fin de constatar que la distancia entre cada árbol que se pide eliminar y la colindancia de la finca de la actora no fue atendida, la cual era necesaria para determinar si existían los 5 metros que requiere la norma. Entiende la parte recurrente, que dada la prohibición de plantar árboles en una distancia menor a los cinco metros de la colindancia, los que estuvieran a una longitud mayor en su propiedad privada inscrita no deben ser eliminados. Tal reclamo ha de denegarse, pues el proceso sumario de derribo obedece a razones de seguridad, resguardo de la vida humana e integridad de bienes en caso de riesgo.

Mismo que fue constatado en este proceso de la lectura del informe técnico del MINAE y su ampliación. Que señala que los árboles que identificó y ubicó son de altura promedio de 30 metros y que en caso de volcamiento por razones climatológicas, podrían afectar las estructuras y poner en peligro a las personas que habitan y se mantienen en la finca aledaña de la actora. Por lo que la corta de las especies se encuentra justificada técnica y legalmente, sin que el hecho de que llegaran a vivir al sitio, estando ya los árboles en la propiedad vecina, sea un motivo para decidir que el riesgo de daños debe ser soportado por las personas que permanecen en la parcela de la accionante. Lo que no resulta razonable según los fundamentos jurisprudenciales invocados supra. Respecto al reclamo de que con lo fallado en la sentencia recurrida surge la posibilidad de que cualquier persona pueda demandar al Estado para eliminar árboles de gran altura, indica esta Cámara que se rechaza.

Lo anterior, en virtud de que esta Sede se avoca a resolver los agravios contra la sentencia de instancia en particular y ese alegato es una argumentación hipotética que no corresponde al caso en cuestión. Por otra parte esta Instancia indica que la responsabilidad por daños ocasionados por caída de árboles en las vías y zonas públicas es un tema ampliamente discutido en la vía contenciosa administrativa, en cada caso concreto que se plantea. Pues el Estado o corporaciones municipales responden por tales menoscabos, en aplicación de las normas legales que correspondan y que en el caso de propiedades privadas ocurre idéntica situación. No obstante, este proceso tiene un fundamento diverso, cual es evitar en caso de riesgo la pérdida de vidas humanas y daños a los bienes materiales. En igual sentido, la justificación técnica para autorizar el derribo de los 16 árboles, a pesar de estar sanas las especies forestales identificadas, lo es en el caso concreto por la gran altura de tales, que en caso de caer por fenómenos climatológicos, afectarían las estructuras de la propiedad de la actora colindante y el riesgo de afectar la vida humana.

Indicó al respecto el informe del MINAE: " Se determinan y se georreferencian con GPS 10 árboles de Poro (Erythrna poeppigiana) y 06 Laurel (Cordia alliodora). los que en caso de volcamiento podrían dañar las casas existentes y a las personas que las habitan; esto por la altura de los árboles y la cercanía a las casas; los cuales se ubican dentro de la propiedad del demandado." Por lo que se rechaza el agravio. Como se señaló, los elementos forestales de poró a cortarse pueden ser reemplazados por otras especies que correspondan a las propias de esa zona de vida, así como replantar los de laurel a criterio del demandado.Mismos que cumplirían una función ambiental idónea al ecosistema existente en el lugar. Ha de indicarse que la exigencia del artículo 403 del Código Civil sobre la distancia de los cinco metros entre la colindancia y el árbol, son contemplados, considerando una distancia lineal donde el árbol no constituya un peligro para predio colindante; lo que no ocurre en este caso.

El espíritu de la norma procesal que regula el instituto de derribo de árboles es prevenir daños. Las especies a cortarse, por su altura en caso de caída, invadiría el terreno de la actora colindante y sus estructuras. Siendo esa altitud constatada un factor de peligrosidad latente que amerita confirmar lo aquí resuelto. Por lo que con fundamento en el artículo 108 del Código Procesal Civil de aplicación supletoria (artículo 26 de la Ley de Jurisdicción Agraria) se debe confirmar en lo apelado la sentencia recurrida.

VII- Por las razones expuestas, con fundamento en los artículos 1, 2 y 26 de la Ley de Jurisdicción Agraria, 108 del Código Procesal Civil aplicable en virtud del Transitorio I de Ley 9343, I y II de Ley 9342, 33 de la Ley Forestal, en lo apelado, se confirma la sentencia recurrida. Con la advertencia de que en el proceso de corta, deberá acatarse por el demandado las medidas y recomendaciones técnicas emitidas para la tala autorizada. Y en caso de ser comercializada, deberá obtener la debida obtención y cumplimiento de los permisos y requisitos legales para tal fin (guías de transporte, placas, entre otros), así como el seguimiento de las medidas de seguridad necesarias en el proceso de derribo. Lo anterior bajo la guía técnica del MINAE, que deberán emitir las recomendaciones adecuadas al respecto en cumplimiento de sus funciones.

POR TANTO

En lo apelado, se confirma la sentencia recurrida. Con la advertencia de que en el proceso de corta, deberá acatarse por el demandado las medidas y recomendaciones técnicas emitidas para la tala autorizada. Y en caso de ser comercializada, deberá obtener la debida obtención y cumplimiento de los permisos y requisitos legales para tal fin (guías de transporte, placas, entre otros), así como el seguimiento de las medidas de seguridad necesarias en el proceso de derribo. Lo anterior bajo la guía técnica del MINAE, que deberán emitir las recomendaciones adecuadas al respecto en cumplimiento de sus funciones.
