Ordinary proceeding brought in his personal capacity by Attorney Nombre440, an adult, unmarried, attorney, resident of Playa Hermosa, Cantón de Garabito, Puntarenas, identification card CED237, Bar Association membership No. CED88800, against Municipalidad de Nombre7959, represented by Attorney Ericka Matarrita Carrillo, Bar Association membership No. CED88801.
BACKGROUND:
I.By a filing received on 31 de agosto de 2016, the plaintiff filed suit against Municipalidad de Nombre7959, and his claims were specified at the preliminary hearing held on 08 de agosto de 2019, seeking the following judgment: “1. That Municipalidad de Nombre7959 be ordered to comprehensively eliminate the source of pollution associated with the solid waste existing along Playa Azul. 2. That Municipalidad de Nombre7959 be ordered to remediate the environmental damage existing along Playa Azul, pursuant to the Comprehensive Solid Waste Management Plan of Municipalidad de Garabito, as well as the Comprehensive Solid Waste Law and its Regulations. 3. That the defendant be ordered to pay both categories of legal costs.” (See image 266 of the digital court case file).
II.By order issued at 10:59 on 15 de mayo de 2017, service of the complaint was ordered. (See images 179 through 180 of the digital court case file).
III.By a filing dated 13 de julio de 2017, counsel for Municipalidad denied the complaint and, in its defense, raised the objection of mandatory joinder of necessary defendants (litis consorcio pasivo necesario). That objection was denied by Decision No. 1105-2019, issued at 14:30 on 27 de julio de 2019. (See images 182 through 189 and 238 through 242 of the digital court case file).
IV.By order issued at 14:29 on 21 de febrero de 2019, the plaintiff was granted an opportunity to respond to the answer to the complaint and the objections raised. (See image 229 of the digital court case file).
V.The preliminary hearing was held on 08 de agosto de 2019, with the parties in attendance. The relief sought was defined in the terms set forth in the first background paragraph of this judgment. The disputed facts were identified, the corresponding documentary evidence was admitted, and the plaintiff’s request for a judicial inspection (reconocimiento) was expressly denied. The defendant was permitted to present Engineer Laura Zumbado Ramos as an employee witness, who would testify regarding the cleanup activities conducted by the municipality in the Playa Azul area. (See images 265 through 268 of the digital court case file and the digital recording).
VI.The oral and public trial hearing was held on 22 de abril de 2021. During that hearing, insofar as relevant, the parties delivered their opening statements; testimony was received from witness Laura Zumbado Ramos; the parties delivered their closing arguments; and this Court ordered that the present proceeding follow the procedure established in Article 111, subsection 1) of the Administrative Procedure Code.-
No nullities requiring a declaration, and/or defects requiring correction, have occurred in the proceedings.

CONSIDERING:
By a filing dated 20 de abril de 2021, counsel for Municipalidad de Garabito submitted as evidence to assist adjudication copies of official communications CRST-0018-2020 and CRST-0129-2021, issued by ICT and Comisión Nacional del Programa Bandera Azul Ecológica, under which Playa Azul was granted the Bandera Azul Ecológica award in the beaches category, and the plaintiff was given an opportunity to respond thereto. For his part, the plaintiff requested, a efectos vivendi and as evidence to assist adjudication, the complete contents of the case file concerning the interim relief (medida cautelar) processed under case file No. 21-001174-1027-CA, relating to the situation at the Garabito sanitary landfill. Opinion of this Chamber: As is well known, regardless of whether evidence to assist adjudication is proposed, offered, or submitted by the parties, it remains evidence of the Court, which has broad discretion to determine whether it is relevant, useful, and necessary.
Consequently, its exclusion cannot in any way impair the right of defense in particular or due process (Debido Proceso) in general. In this case, those deciding find that the documentation submitted by the municipal representation, consisting of certifications CRST-0018-2020 and CRST-0129-2021, issued by ICT and Comisión Nacional del Programa Bandera Azul Ecológica, under which Playa Azul was granted the Bandera Azul Ecológica award, is relevant, useful, and necessary insofar as it establishes the positive actions undertaken by local committees, including Municipalidad, aimed at improving the beach’s sanitary and environmental conditions. As for the plaintiff’s request for the case file concerning the interim relief processed under case file No. 21-001174-1027-CA, relating to the situation at the Garabito sanitary landfill, a efectos vivendi, the Court denied it at the trial hearing because the evidence offered was neither relevant nor material to the subject matter of this proceeding. Accordingly, because this issue has already been decided, we refrain from ruling on it here.
The purpose of this proceeding is to obtain a judgment ordering the Municipality of Nombre7959 to comprehensively eliminate the source of pollution associated with the solid waste found along Playa Azul and to restore the existing environmental damage, pursuant to the Comprehensive Solid Waste Law, its Regulations, and the Comprehensive Solid Waste Management Plan. In summary, and without prejudice to the literal wording of his arguments, which have been examined in their entirety by this Court, the plaintiff alleged: A) Regarding the facts: That Playa Azul is located in the Canton of Garabito, Province of Puntarenas, and is considered one of the 4 most polluted beaches in the country. That the Municipality of Nombre7959 has a Comprehensive Solid Waste Management Plan; however, the Municipality of Nombre7959 has failed to address the environmental emergency affecting Playa Azul, which continues to have a high level of pollution from solid waste, such as plastic and other materials.
That the Municipality bears administrative liability for omission (responsabilidad administrativa por omisión) because it failed to act and comply as required by the cited Law, insofar as it has not taken sufficient and necessary measures to comprehensively combat the pollution affecting Playa Azul, thereby violating the fundamental principle set forth in Article 50 of our Political Constitution. These arguments were reiterated by the plaintiff at the supplemental trial hearing. Counsel for the Municipality stated: That although Playa Azul exhibits levels of pollution, it is subjective to assert, based on news reports, that it ranks fourth nationwide in terms of pollution, because the National Water Laboratory, as the specialized body with jurisdiction over the matter, is responsible for issuing an opinion to that effect, pursuant to Decreto Ejecutivo N° 26066-S del 09 de junio de 1997. That any pollution problem affecting Playa Azul is not attributable to an omission or negligence by the Municipality; rather, this problem affects most beaches adjacent to the Río Tárcoles watershed as a direct consequence of solid and liquid waste originating in the upper, middle, and lower portions of that watershed.
That this situation was identified by the Constitutional Chamber when it stated: “Roberto Dobles Mora, in his capacity as Minister of Health; Rodrigo Arias Sánchez, in his capacity as Minister of the Presidency; Olman Chacón Garita, in his capacity as Manager of the Instituto Costarricense de Acueductos y Alcantarillados; and Eduardo Doryan Garrón, in his capacity as Executive President of the Caja Costarricense de Seguro Social, or whoever may hold those offices in their stead, as well as Nombre20665 de Atenas, Nombre20665 de San Mateo, Nombre20665 de Orotina, Nombre20665 de Puriscal, Nombre20665 de Turrubares, Nombre20665 de Garabito, Nombre20665 de San Ramón, Nombre20665 de Palmares, Nombre20665 de Naranjo, Nombre20665 de Valverde Vega, Nombre20665 de Grecia, Nombre20665 de Alajuela, Nombre20665 de Mora, Nombre20665 de Poás, Nombre20665 de Barva, Nombre20665 de Santa Barbara, Nombre20665 de Belén, Nombre20665 de Flores, Nombre20665 de San Rafael de Heredia, Nombre20665 de San Pablo de Heredia, Nombre20665 de Moravia, Nombre20665 de San Isidro de Heredia, Nombre20665 de Santo Domingo de Heredia, Nombre20665 de Vásquez de Coronado, Nombre20665 de Tibás, Nombre20665 de Montes de Oca, Nombre20665 de Curridabat, Nombre20665 de Alajuelita, Nombre20665 de Escazú, Nombre20665 de Santa Ana, Nombre20665 de Desamparados, Nombre20665 de La Unión de Tres Ríos, Nombre20665 de Cartago, and Nombre20665 de San José, are hereby ordered to immediately take the necessary actions to comprehensively eliminate the sources of pollution existing throughout the Río Grande de Tárcoles watershed and to adopt measures to begin the process of remediating the environmental damage caused in that watershed, insofar as possible, for which purpose they shall undertake the coordination warranted by the circumstances with a view to comprehensively resolving the problem that is the subject of this amparo proceeding (amparo)…” (Voto No. 5894-07 de las 11:50 horas del 27 de abril del 2007).
That, accordingly, since the year 2007, the Constitutional Chamber has ordered multiple government institutions, Ministries, autonomous institutions, and Municipalities to take action to combat the source of pollution existing throughout the Río Grande de Tárcoles watershed, thereby confirming that the problem has multiple contributing parties and is therefore national in scope. That the cited decision led to the creation of the “Comisión de Gestión Integral de la Cuenca del Río Grande de Tárcoles” through Decreto Ejecutivo No. 38071 publicado en La Gaceta No. 34 del 18 de febrero de 2014. That, over the years, the State and the institutions involved have taken action to reduce the level of pollution; however, such action does not produce immediate results but instead entails a complex process that is conducted in an orderly, gradual, and continuous manner, as has been done to date. That, pursuant to Articles 8, 9, and 28 of the “Ley General de Residuos Sólidos” No. 8839 and the “Plan Nacional para la Gestión Integral de Residuos 2010-2021,” the Municipality represented by counsel prepared, in the year 2014 and in collaboration with the “Fundación Centro de Productividad Nacional” (CEPRONA), the “Plan de Gestión Integral de Residuos Sólidos PMGIRS-Garabito 2014-2019.” That, as reported by municipal officials Vanessa González Ramírez, Coordinator of the Comité Bandera Azul Ecológica de Nombre7959, and Luís Morales Vargas, Head of the Vector Control Crew, in their official letter BAE-059-2016, maintenance has been provided to Playa Azul since the year 2012 with support from private enterprise and a group of environmentalists.
That, in the year 2016, support was even provided by that municipality’s vector control crew, whose members carried out spraying in the communities of Playa Azul, collected non-traditional waste, and cleaned the beach. That, likewise, Engineer Laura Zumbado Ramos of the Municipal Environmental Management Department reported in her official letters UTGA-2017-002 dated 04 de enero de 2017 and UTGA-2017-120 dated 03 de julio de 2017 that the local government had undertaken measures aimed at mitigating environmental pollution on the various beaches and in territories adjacent to the Ríos Tárcoles watershed, including Playa Azul, as detailed below: 1. Collection of ordinary waste: The Municipality of Nombre7959 provides ordinary waste collection service to the canton of Tárcoles, specifically Playa Azul, on Tuesdays and Thursdays between 9 am and 12 pm. 2. Collection of waste from the Municipal Beach: The Municipality of Nombre7959 cleans beaches in the canton of Garabito, specifically Playa Azul, where approximately 46 waste collections totaling 19,933.57 tons were recorded from agosto 2015 to marzo 2017.
The foregoing was carried out in coordination with private enterprise or by the Municipality using its own personnel and equipment. That, pursuant to Decreto Ejecutivo No. 38071 publicado en La Gaceta No. 34 del 18 de febrero de 2014, the Municipality of Nombre7959 is a member of the “Subcomisión Área de Conservación Pacífico Central (ACOPAC),” whose purpose is planning, development, collaboration, and accountability to the “Comisión de Gestión Integral de la Cuenca del Río Grande de Tárcoles,” the latter being responsible at the national level for establishing a management body for coordination, planning, protection, and rehabilitation through the joint design and construction of viable technical solutions that promote sustainable development, the population’s quality of life, and the protection of the natural resources and biodiversity of the territories within that watershed. That, in light of the foregoing, the plaintiff is incorrect in alleging an omission by the municipal authority in relation to a problem whose solution requires the joint collaboration and participation of several government institutions as entities sharing responsibility as generators of the polluting waste. These arguments were reiterated at the supplemental public oral trial hearing.
The following are deemed proven:
The plaintiff filed an ordinary proceeding (proceso ordinario), stating:
In the specific case, as a first point, according to the facts deemed proven (hechos tenidos por demostrados), no formal or substantive omission (omisión formal o material) has been established, insofar as the Municipalidad de Nombre7959 demonstrated that, over time, it has been addressing the problem occurring at Playa Azul due to the accumulation generated by material carried by the Río Grande de Tárcoles and discharged in the area where Playa Azul is located, to the extent of its territorial jurisdiction. Even assuming that the Río Grande de Tárcoles constitutes the source of pollution (foco de contaminación) to which the plaintiff vaguely or imprecisely refers, the fact remains that he did not demonstrate that the relevant source is located in the portion of the riverbed situated within the territorial jurisdiction of the respondent Municipality. The documentary evidence (prueba documental) submitted by the Municipality shows that this municipal corporation has taken steps aimed at giving effect to the guarantee established in the cited legislation (50 de la C.P y 2 de la Ley No. 8339), through Playa Azul cleanup programs.
In other words, the Municipality demonstrated that it had taken affirmative action to protect the environment and eliminate the solid waste (desechos sólidos) carried to Playa Azul, as recorded in oficio BAE-059-2016 del 19 de diciembre del 2016, appearing at images 149 and 150; oficio No. UTGA-2017-002 del 04 de enero de 2017, appearing at images 151 through 168; and oficio No. UTGA-2017-120 del 03 de julio de 2017, appearing at images 191 through 218, all from the digital judicial case file (expediente digital judicial). The foregoing was reiterated in the testimony (declaración testimonial) of Environmental Engineer Laura Zumbado Ramos, who holds a Master’s degree in Sustainable Urban Planning and serves as Environmental Management Coordinator for the Municipality. She stated that Playa Azul, because it is located adjacent to the mouth of the Río Grande de Tárcoles, suffers from a pollution problem due to the amount of waste carried by the river, although that waste is generated in the upper, middle, and lower portions of the watershed (cuenca), not in the canton of Garabito, and is deposited by the Río Tárcoles in the Playa Azul area; it is not caused by a pollution problem originating in Playa Azul or within the territorial jurisdiction in which the respondent Municipality exercises its authority, according to the content and scope of articles 3 and 4 of the Código Municipal.
She was also unequivocal in informing the Court of the various actions undertaken by the Municipalidad de Nombre7959 through its departments and jointly with other organizations to clean Playa Azul. She further identified, from her professional perspective and knowledge of the problem, the geographic area in which a source of pollution affecting the Río Grande de Tárcoles could be understood to be located, which lies outside the territorial jurisdiction of the respondent Municipality. Accordingly, it cannot be concluded that, when the plaintiff filed the action on 31 de agosto de 2016, the Municipalidad de Nombre7959 had failed to take action to protect the environment in the manner alleged by the plaintiff. On the contrary, the evidence obtained to assist the Court in reaching its decision (prueba para mejor resolver) establishes that the Instituto Costarricense de Turismo and the Comisión Nacional del Programa Bandera Azul Ecológica, through oficios CRST-0018-2020 and CRST-0129-2021, awarded Playa Azul the Bandera Azul Ecológica distinction, demonstrating that the efforts to improve the beach’s sanitary and environmental conditions produced a positive result.
A second conclusion reached by the Court, which we reiterate, is that the principal source of pollution in the area is the Río Grande de Tárcoles. This river originates in the Coronado area of San José and empties into the sea in Tárcoles, Garabito; as it passes through numerous communities, its waters carry a large quantity of solid waste, which the river ultimately deposits in the Playa Azul area. It is clear that addressing this source of pollution entails a complex process requiring the participation of various institutions and civil society throughout the entire watershed, beginning in Coronado and continuing to the last community before the river empties into the Pacific Ocean. Nevertheless, regarding this problem, it has also been established that, as a result of the order issued by the Sala Constitucional in voto No. 5894-07 de las 11:50 horas del 27 de abril del 2007, the “Comisión de Gestión Integral de la Cuenca del Río Grande de Tárcoles” was created (Decreto Ejecutivo No. 38071 publicado en La Gaceta No. 34 del 18 de febrero de 2014) to pursue the comprehensive restoration of the Cuenca del Río Grande de Tárcoles.
Thus, although the plaintiff alleged that the Municipalidad de Nombre7959 had failed to comprehensively address the source of pollution associated with the solid waste found along Playa Azul, no such omission was established. The plaintiff did not establish that the Municipalidad de Nombre7959 failed to fulfill its obligation to safeguard environmental protection in the Playa Azul area, nor, to the extent that it might have jurisdiction, that it failed to address any source of pollution that could affect the beach by failing to collect solid waste in the relevant area. On the contrary, the Municipalidad de Nombre7959 did establish that concrete measures were taken within its organization to prevent and eradicate sources of pollution in the Playa Azul area. It was also established that the Municipality institutionally participates alongside a number of entities in comprehensively addressing the pollution problem that the mouth of the Río Grande de Tárcoles poses for the central Pacific region, because the river carries a large quantity of pollutants generated in the upper, middle, and lower portions of the Cuenca del Río Grande del Tárcoles and deposits them at its mouth. Accordingly, because the omission attributed to the Municipalidad de Garabito was not established, the appropriate disposition is to dismiss this action in its entirety.
The municipal representative did not expressly raise the defense of lack of legal entitlement (falta de derecho); however, because that defense concerns a substantive prerequisite (presupuesto material) that the Court must address on its own motion, it rules on the matter. Regarding the defense of lack of legal entitlement, returning to what was stated by the First Chamber (Sala Primera), it is necessary to consider the proof of the facts as a fundamental part thereof, because what is determined under that heading will establish whether the legal grounds for the relief sought exist. The legislation in force provides that one of the defenses that may be raised in judicial proceedings is Lack of Legal Entitlement, and legal scholarship states the following regarding that defense: “...To speak of lack of legal entitlement is akin to speaking of the absence of a legal rule; it would therefore be more accurate to speak of the absence of substantive prerequisites or of elements of the substantive claim—not the procedural claim, since we all possess the latter.
Despite this terminological imprecision, lack of legal entitlement thus appears to refer to what Italian legal scholarship calls the conditions of the ‘action’ or requirements of the claim, which are understood to encompass the constitutive requirements, thereby conveying that without them the right of action is not properly exercised and that they must consequently be regarded as the necessary and sufficient elements for determining, in a specific case, the arising of the right to the relief sought. According to legal scholarship, there are three such requirements of the claim, which must be present for the claim seeking a favorable decision to be upheld: (a) a specific legal fact, that is, a particular relationship between a fact and a legal rule; (b) standing (legitimación); and (c) procedural interest (interés procesal). Lack of legal entitlement would therefore consist of the absence of the substantive prerequisites in each specific case....” Accordingly, since no protectable right has been established in favor of the plaintiff, the complaint is dismissed in all respects.
Pursuant to section 193 of the Code of Administrative Procedure (Código Procesal Contencioso Administrativo), court costs and attorney’s fees (costas procesales y personales) constitute a burden imposed on the unsuccessful party by virtue of having lost. Exemption from such an award is available only when, in the Court’s judgment, there was sufficient cause to litigate or when judgment is rendered on the basis of evidence of which the opposing party was unaware. In this case, there are no grounds for departing from the general rule that costs are awarded against the unsuccessful party. Accordingly, both categories of costs in the proceeding are imposed on the plaintiff and shall be assessed during the judgment-enforcement stage (fase de ejecución de sentencia) at the request of the Municipalidad de Garabito.
POR TANTO:
The supplementary evidence for adjudication (prueba para mejor resolver) offered by the municipal representative is admitted. The plaintiff is found to lack legal entitlement, and the complaint filed by Mr. Nombre440 against the Municipalidad de Nombre7959 is therefore dismissed in all respects. Both categories of costs in the proceeding shall be borne by the plaintiff and shall be assessed during the judgment-enforcement stage at the request of the municipal representative. TRIBUNAL PROCESAL CONTENCIOSO ADMINISTRATIVO, SECCIÓN CUARTA, SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ, ANEXO A, a las siete horas con veinticinco minutos del veintinueve de abril del año dos mil veintiuno.
Proceso de conocimiento incoado en lo personal por el Licenciado Nombre440 , quien es mayor, soltero, abogado, vecino de Playa Hermosa, Cantón de Garabito, Puntarenas, cédula CED237 carné de Abogado No. CED88800 contra la Municipalidad de Nombre7959 representada por la Licenciada Ericka Matarrita Carrillo, carné de Abogada No. CED88801.
RESULTANDO:
I.Por escrito recibido el día 31 de agosto de 2016, el actor presentó demanda en contra de la Municipalidad de Nombre7959 cuyas pretensiones fueron precisadas en la audiencia preliminar realizada el día 08 de agosto de 2019 a efectos de que en sentencia: "1. Se ordene a la Municipalidad de Nombre7959 eliminar de manera integral el foco de contaminación asociado a los residuos sólidos que existe a lo largo de playa azul. 2. Se ordene a la Municipalidad de Nombre7959 restaurar el daño ambiental existente a lo largo de playa azul, en aplicación del Plan de Gestión Integral de residuos sólidos de la Municipalidad de Garabito; así como, de la Ley Integral de Residuos Sólidos y su Reglamento. 3. Que se condene al demandado al pago de ambas costas." (Ver imagen 266 del expediente digital judicial).
II.Por auto de las 10:59 horas del 15 de mayo de 2017, se dio traslado de la demanda. (Ver imágenes de la 179 a la 180 del expediente digital judicial).
III.Por escrito de fecha 13 de julio de 2017, la representación de la Municipalidad contestó negativamente la demanda y en su defensa opuso la excepción de litis consorcio pasivo necesario. Excepción que fue rechazada mediante resolución No. 1105-2019, de las 14:30 horas del 27 de julio de 2019. (Ver imágenes de la 182 a la 189 y de la 238 a la 242 del expediente digital judicial).
IV.Por auto de las 14:29 horas del 21 de febrero de 2019 se dio audiencia de la contestación de la demanda y excepciones opuestas al actor. (Ver imagen 229 del expediente digital judicial).
V.La audiencia preliminar se celebró el día 08 de agosto de 2019, con asistencia de las partes. La pretensión se definió en los términos del primer resultando de este fallo. Se determinaron los hechos controvertidos y se admitió la prueba documental correspondiente y se rechazó expresamente la solicitud de reconocimiento solicitada por el actor. A la parte accionada se le admitió como testigo funcionaria la deposición de la Ingeniera Laura Zumbado Ramos quien se manifestaría sobre las gestiones de limpieza realizadas por el municipio en la zona Playa Azul. (Ver imágenes de la 265 a la 268 del expediente digital judicial y respaldo digital).
VI.La audiencia de juicio oral y público fue celebrada el día 22 de abril de 2021. En la misma y en lo que resulta relevante, las partes emitieron sus alegatos de apertura; se recibió la declaración de la testigo Laura Zumbado Ramos y las partes emitieron sus alegatos de conclusiones y este Tribunal dispuso darle al presente proceso el trámite previsto en el artículo 111, inciso 1) del Código Procesal Contencioso Administrativo.-
Que en los procedimientos no se han observado nulidades que deban ser declaradas, y/o vicios que hayan de ser subsanados.
Redacta el Juez Ponente Salas Leitón.
CONSIDERANDO:
La representación de la Municipalidad de Garabito, por escrito de fecha 20 de abril de 2021, presentó como prueba para mejor resolver copia de los oficios CRST-0018-2020 y el CRST-0129-2021, emitidos por el ICT y la Comisión Nacional del Programa Bandera Azul Ecológica en las que se le otorgó el galardón Bandera Azul Ecológica en categoría de playas a Playa Azul y de la cual se le dio audiencia al actor. Por su parte el actor solicitó a efectos vivendi y como prueba para mejor resolver el contenido integral del expediente de la medida cautelar tramitada bajo expediente No. 21-001174-1027-CA, referido a la situación del relleno sanitario de Garabito. Criterio de esta Cámara: Como es sabido, sin importar que la prueba para mejor resolver sea propuesta, ofrecida o aportada por las partes, la misma continúa siendo prueba del Tribunal, quien tiene amplia discrecionalidad para determinar si resulta pertinente, útil y necesaria.
Siendo una consecuencia de ello, que su rechazo en modo alguno pueda producir quebranto al derecho de defensa en particular ni al Debido Proceso en general. En la especie, es criterio de quienes resuelven, que las constancias aportadas por la representación municipal, consistente en las certificaciones CRST-0018-2020 y el CRST-0129-2021, emitidos por el ICT y la Comisión Nacional del Programa Bandera Azul Ecológica en las que se le otorgó el galardón Bandera Azul Ecológica a Playa Azul; resulta pertinente, útil y necesaria, en el tanto acredita las acciones positivas realizadas por comités locales, y entre ellos, la Municipalidad que buscan mejorar las condiciones higiénicas y ambientales de la playa. Por su parte la gestión que realizó el actor, en cuanto solicitó a efecto vivendi el expediente de la medida cautelar tramitada bajo expediente No. 21-001174-1027-CA, referido a la situación del relleno sanitario de Garabito; el Tribunal resolvió su rechazo en la audiencia de juicio, en razón de que la prueba ofrecida no cuenta con pertinencia ni trascendencia con respecto al objeto del presente proceso, razón por la que en esta oportunidad, siendo un asunto ya resuelto, omitimos pronunciamiento.
El objeto del presente proceso lo es para que en sentencia se ordene a la Municipalidad de Nombre7959 eliminar de manera integral el foco de contaminación, asociado a los residuos sólidos que hay a lo largo de Playa Azul y a restaurar el daño ambiental existente, en aplicación de la Ley Integral de Residuos Sólidos, su Reglamento y el Plan de Gestión Integral de Residuos Sólidos. En síntesis y sin perjuicio de la literalidad de sus argumentaciones, las cuales han sido estudiadas en su totalidad por este Tribunal, el actor alegó: A) Sobre los hechos: Que Playa Azul se ubica en el Cantón de Garabito, Provincia de Puntarenas, y es considerada una de las 4 playas más contaminadas del país. Que la Municipalidad de Nombre7959 cuenta con un Plan de Gestión Integral de Residuos Sólidos sin embargo la Municipalidad de Nombre7959 no ha atendido la emergencia ambiental que se vive en Playa Azul, misma que mantiene un alto índice de contaminación por desechos sólidos, como plástico y otros.
Que la Municipalidad es responsable administrativamente por omisión al no proceder y cumplir conforme se lo exige la citada Ley, en tanto no ha tomado las medidas suficientes y necesarias para combatir integralmente la contaminación que presenta Playa Azul, violentando con ello el principio fundamental contenido en el artículo 50 de nuestra Constitución Política. Alegatos reiterados por el actor en la audiencia complementaria de juicio. La representación de la Municipalidad indicó: Que si bien Playa Azul presenta índices de contaminación, es un criterio subjetivo afirmar mediante noticias periodística que la misma ocupe el cuarto lugar por contaminación a nivel país, toda vez que es al Laboratorio Nacional de Aguas, como ente especializado y competente en la materia, al que le corresponde emitir un criterio en tal sentido, según lo dispuesto por el Decreto Ejecutivo N° 26066-S del 09 de junio de 1997.
Que el problema que pueda presentar Playa Azul, por contaminación no obedece a la omisión o negligencia de la Municipalidad, sino que esa problemática se da en la mayoría de las Playas aledañas a la cuenca del Río Tárcoles, como consecuencia directa de los residuos sólidos y líquidos proveniente de la parte alta, media y baja de dicha cuenca. Que tal situación fue evidenciada por la Sala Constitucional cuando indicó: "Se ordena a Roberto Dobles Mora, en su condición de Ministro de Salud, a Rodrigo Arias Sánchez en su condición de Ministro de la Presidencia, a Olman Chacón Garita, en su calidad de Gerente del Instituto Costarricense de Acueductos y Alcantarillados y a Eduardo Doryan Garrón en su condición de presidente Ejecutivo de la Caja Costarricense de Seguro Social, o a quienes en su lugar ejerzan esos cargos, así como también al Nombre20665 de Atenas, al Nombre20665 de San Mateo, al Nombre20665 de Orotina, al Nombre20665 de Puriscal, al Nombre20665 de Turrubares, al Nombre20665 de Garabito, al Nombre20665 de San Ramón, al Nombre20665 de Palmares, al Nombre20665 de Naranjo, al Nombre20665 de Valverde Vega, al Nombre20665 de Grecia, al Nombre20665 de Alajuela, al Nombre20665 de Mora, al Nombre20665 de Poás, al Nombre20665 de Barva, al Nombre20665 de Santa Barbara, al Nombre20665 de Belén, al Nombre20665 de Flores, al Nombre20665 de San Rafael de Heredia, al Nombre20665 de San Pablo de Heredia, al Nombre20665 de Moravia, al Nombre20665 de San Isidro de Heredia, al Nombre20665 de Santo Domingo de Heredia, al Nombre20665 de Vásquez de Coronado, al Nombre20665 de Tibás, al Nombre20665 de Montes de Oca, al Nombre20665 de Curridabat, al Nombre20665 de Alajuelita, al Nombre20665 de Escazú, al Nombre20665 de Santa Ana, al Nombre20665 de Desamparados, al Nombre20665 de La Unión de Tres Ríos, al Nombre20665 de Cartago y al Nombre20665 de San José, que de inmediato adopten las acciones necesarias para eliminar de manera integral los focos de contaminación que existen a lo largo de la cuenca del río Grande de Tárcoles y se tomen medidas para iniciar el proceso de reparación del daño ambiental ocasionado en esa cuenca, en la medida en que ello fuere posible, para lo cual deberán realizar la coordinación que el caso amerite tendiente a solucionar integralmente el problema objeto de este amparo..." (Voto No. 5894-07 de las 11:50 horas del 27 de abril del 2007).
Que así, la Sala Constitucional desde el año 2007 ordenó a múltiples instituciones gubernamentales, Ministerios, Instituciones autónomas y Municipalidades, tomar acciones para combatir el foco de contaminación que existe a lo largo de la cuenca del Río Grande de Tárcoles, ratificando con ello que la problemática tiene varios agentes y por ende reviste la condición nacional. Que el citado voto dio paso a la creación de la "Comisión de Gestión Integral de la Cuenca del Río Grande de Tárcoles" a través del Decreto Ejecutivo No. 38071 publicado en La Gaceta No. 34 del 18 de febrero de 2014. Que el Estado y las instituciones involucradas, a lo largo de los años han tomado acciones para bajar el índice de polución, sin embargo, la misma no es de efectos inmediatos, sino que comprende un proceso complejo que se maneja de forma ordenada, gradual y continua como se ha hecho hasta el momento. Que su representada conforme lo dispuesto en los artículos 8, 9 y 28 de la "Ley General de Residuos Sólidos" No. 8839 y el "Plan Nacional para la Gestión Integral de Residuos 2010-2021", elaboró en el año 2014 en colaboración con la "Fundación Centro de Productividad Nacional" (CEPRONA) el "Plan de Gestión Integral de Residuos Sólidos PMGIRS-Garabito 2014-2019".
Que tal y como informaron los personeros municipales Vanessa González Ramírez, Coordinadora del Comité Bandera Azul Ecológica de Nombre7959 y Luís Morales Vargas, Encargado de la Cuadrilla de Vectores, en su oficio BAE-059-2016, desde el año 2012, se ha brindado mantenimiento a Playa Azul con el apoyo de la empresa privada y grupo de ambientalistas. Que incluso en el año 2016, se contó con el apoyo de la cuadrilla de vectores de ese municipio, quienes realizaron fumigaciones en los caseríos de Playa Azul, limpieza de basura no tradicional y limpieza de playa. Que de la misma forma la Ingeniera Laura Zumbado Ramos, del Departamento de Gestión Ambiental Municipal, comunicó en sus oficios UTGA-2017-002 de fecha 04 de enero de 2017 y UTGA-2017-120 de fecha 03 de julio de 2017, que el gobierno local ha realizado acciones tenientes a la mitigación de la contaminación ambiental de las diferentes playas y territorios aledaños a la cuenca del Ríos Tárcoles, incluida Playa Azul, y que se detallan: 1.
Recolección de residuos ordinarios: La Municipalidad de Nombre7959 brinda el servicio de recolección de residuos ordinarios al cantón de Tárcoles, específicamente Playa Azul los días martes y jueves en el rango de horas de 9 am a 12 pm. 2. Recolección de residuos de Playa Municipal: La Municipalidad de Nombre7959 realiza limpiezas de playas del cantón de Garabito, específicamente en Playa Azul, donde se registra desde agosto 2015 a marzo 2017 aproximadamente 46 recolecciones de residuos que equivalen a 19,933.57 toneladas. Lo anterior efectuado en coordinación con la empresa privada o bien la Municipalidad con su propio recurso humano y equipo. Que por disposición del Decreto Ejecutivo No. 38071 publicado en La Gaceta No. 34 del 18 de febrero de 2014, la Municipalidad de Nombre7959 es integrante de la "Subcomisión Área de Conservación Pacífico Central (ACOPAC)", cuyo objeto es la planificación, el desarrollo, la colaboración y rendición de cuentas a la "Comisión de Gestión Integral de la Cuenca del Río Grande de Tárcoles", siendo esta última la encargada a nivel nacional de generar una instancia gestora en aspectos de coordinación, planificación, protección y rehabilitación a través del diseño y construcción conjunta de soluciones técnicas viables, que promueva el desarrollo sostenible, la calidad de vida de la población, la protección de los recursos naturales y la biodiversidad de los territorios incluidos en dicha cuenca.
Que por lo expuesto, no lleva razón el actor al argumentar una omisión del ente municipal, ante una problemática cuya solución requiere de la colaboración y participación conjunta de varias instituciones gubernamentales, como entes con responsabilidad compartida como generadores de los residuos contaminantes. Alegatos que fueron reiterados en la audiencia complementaria de juicio oral y público.
Como tales se tienen:
El actor presentó proceso ordinario indicando:
La representación municipal no opuso expresamente la excepción de falta de derecho, sin embargo por tratarse dicha excepción de un presupuesto material que debe hacer referencia el Tribunal de oficio se manifiesta al respecto. Con respecto a la excepción de falta de derecho, retomando lo dicho por la Sala Primera, es menester remitirse a la demostración de los hechos, como parte fundamental de ello, porque de lo que en ese acápite se determina, se podrá desprender si existen o no las bases legales para lo pretendido. Establece la legislación vigente que una de las excepciones oponibles en los procesos judiciales es la Falta de Derecho y sobre esa excepción la doctrina nos indica: "...Hablar de falta de derecho es como hablar de falta de norma jurídica, por lo que lo correcto sería hablar entonces de falta de presupuestos materiales o falta de elementos en la pretensión material -no procesal pues ésta todos la poseemos, a pesar de la imprecisión terminológica falta de derecho parece entonces referirse a las denominadas por la doctrina italiana como condiciones de la "acción" o requisitos de la pretensión y que se sabe comprende los requisitos constitutivos, para hacer comprender que sin ellos el derecho de acción no se ejerce adecuadamente y que los mismos debe, por consiguiente, ser considerados como los extremos necesarios y suficientes para determinar en concreto, el nacimiento del derecho a la pretensión.
Tales requisitos de la pretensión, que deben concurrir, para que pueda considerarse estimatoria la misma, la cual busca la resolución favorable, son, según la doctrina, tres: (a) un cierto hecho específico jurídico, o sea, una cierta relación entre un hecho y una norma; (b) la legitimación, (c) el interés procesal. Entonces la falta de derecho estaría representada por la inexistencia de los presupuestos materiales para cada caso concreto...". Así las cosas, no habiéndose acreditado derecho amparable a favor del actor; se declara improcedente la demanda en todos sus extremos.
De conformidad con el numeral 193 del Código Procesal Contencioso Administrativo, las costas procesales y personales constituyen una carga que se impone a la parte vencida por el hecho de serlo. La dispensa de esta condena solo es viable cuando hubiere, a juicio del Tribunal, motivo suficiente para litigar o cuando la sentencia se dicte en virtud de pruebas que desconociera la parte contraria. En este caso, no se observan motivos que permitan excepcionar la máxima de condena al vencido. Por ello, se imponen ambas costas del proceso a cargo de actor, las cuales se liquidarán en fase de ejecución de sentencia a solicitud de la Municipalidad de Garabito.
POR TANTO:
Se admite la prueba para mejor resolver ofrecida por la representación municipal. Se declara la falta de derecho por parte del actor y por ende se declara improcedente en todos sus extremos la demanda interpuesta por el señor Nombre440 contra la Municipalidad de Nombre7959. Son ambas costas del proceso a cargo del actor, las cuales se liquidarán en fase de ejecución de sentencia a solicitud de la representación municipal. NOTIFÍQUESE.
