Decision: 2021-619 Case file: 17-000835-0573-PE(6) CRIMINAL JUDGMENT APPEALS COURT (TRIBUNAL DE APELACIÓN DE SENTENCIA PENAL). Segundo Circuito Judicial de San José. Goicoechea, at thirteen hours and five minutes on veintisiete de abril de dos mil veintiuno.- APPEAL filed in the present case brought against Nombre01, of legal age, Costa Rican, identity card number CED01, born in Alajuela on 04 de marzo de 1967, son of Nombre02 and Nombre03, married, employed as a farm laborer, resident of Heredia, Sarapiquí; for the offense of VIOLATION OF THE HUNTING AND TRAFFICKING LAW, to the detriment of WILDLIFE. Judge Rafael Mayid González González participated in the decision. Attorney Andrés Alfaro Ramírez, Criminal State Attorney, and attorney Fanny Badilla Sánchez, public defender for the accused, appeared before this Court.
WHEREAS:
I.By judgment number 212-2020, issued at nueve horas cuarenta minutos on catorce de octubre de dos mil veinte, the Tribunal de Juicio de Heredia, Sede Sarapiquí, ruled: “WHEREFORE: In accordance with the foregoing and pursuant to Articles 1, 7, and 8 of the American Convention on Human Rights; Articles 2, 9, 10, and 11 of the Universal Declaration of Human Rights; Articles 7, 35, 36, 39, and 41 of the Political Constitution; Articles 1, 30, and 45 of the Criminal Code; Articles 93 and 95 of the Ley de Conservación de la Vida Silvestre; Articles 1, 3, 4, 5, 6, 7, 9, 32, 182, 265 through 267, 360, 362, 364, 365, 366, and 367 of the Code of Criminal Procedure; Article 1045 of the Civil Code; and in accordance with the universal principle of in dubio pro reo, Nombre01 IS ACQUITTED OF ALL PUNISHMENT AND LIABILITY for the offense of hunting and one offense of trafficking with which he has been charged, to the detriment of wildlife.
The civil action brought by the Procuraduría General de la República is dismissed; likewise, no special award of costs is made in connection with the private prosecution (querella) or the civil action, because there was a plausible basis for litigation. Any precautionary measure (medida cautelar) imposed on the accused in connection with this case is hereby terminated. The forfeiture (comiso) and destruction of the firearms and machete-type weapons seized in this matter are ordered. This case shall be closed once the judgment becomes final. All parties are hereby notified orally of the foregoing. The recording supporting the ruling shall be made available to the parties, who must provide the Court with a portable storage device for that purpose. The foregoing is recorded in the courtroom recording system of the Tribunal de Juicios de Sarapiquí under the unique case-file number. Delivery of the judgment concludes at 11:08 hours.” (sic)
III.Following the corresponding deliberation in accordance with Article 465 of the Code of Criminal Procedure, the Court considered the issues raised in the appeal.
Judgment drafted by Criminal Judgment Appeals Judge González González; and,
CONSIDERING:
I.Attorney Andrés Alfaro Ramírez, in his capacity as Criminal State Attorney representing the private prosecution and civil claim for damages (acción civil resarcitoria) filed by the State of Costa Rica, by a brief submitted on cuatro de noviembre de dos mil veinte (cf. 164 to 179), appeals judgment N˚ 212-2020 of the Tribunal de Juicio de Heredia, Sede Sarapiquí, issued at nueve horas cuarenta minutos on catorce de octubre de dos mil veinte. Thus, after reviewing the challenge and the procedural record contained in the case file, it was determined that the appeal must be admitted for consideration because it was filed within the statutory period. It likewise satisfies the formal requirements that, under the principles of flexibility, accessibility, breadth, and informality—which are inherent in and characterize this means of challenge (medio impugnativo)—are necessary for its proper consideration as part of a comprehensive review of the judgment and to guarantee the right to appeal in criminal matters established in Article 8.2(h) of the American Convention on Human Rights, as well as in Articles 458 et seq. of the Code of Criminal Procedure, as amended by Ley N. 8837 del 9 de junio de 2010.
II.In the first ground for challenge, it is alleged that there was a “Lack of reasoning due to an erroneous and contradictory intellectual assessment of the evidence, in violation of the rules of reasoned sound judgment (sana crítica racional), logic, and common experience.” It is argued that the testimony of Nombre04 and Nombre05 was assessed in a biased and incomplete manner, as was the documentary evidence gathered during the proceedings, leading to a finding of doubt concerning the possible commission of the offense attributed to the accused (encartado) and resulting in a ruling dismissing the private prosecution (querella) and the civil action for damages (acción civil resarcitoria) brought by the State. It states that this decision was based on the limited credibility afforded to the account provided by Nombre04, questions concerning the evidence gathered, and the criticism directed at the Public Prosecution Service regarding useful investigative steps that were not undertaken and that, in the trial court’s view, should have been carried out.
This led the trial court to make biased, incomplete, and erroneous assessments, in violation of the rules of sound judgment and the principle of freedom of proof (libertad probatoria). It explains that the errors in the reasoning are as follows: A. Regarding the absent and erroneous reasoning underlying the discrediting of the account given by the witness Nombre04. It argues that the finding of doubt was based largely on the alleged contradictions and inaccuracies in the testimony given by the witness Nombre04 at trial, stating that the witness’s presentation had been contrived to secure the conviction of the defendant (justiciable), Nombre01, to such an extent that it was found that he had falsified his account during the adversarial proceedings (contradictorio) and that this could expose him to criminal liability for perjury (falso testimonio). Nevertheless, neither the opening of a separate evidentiary record (testimonio de piezas) against the witness nor a request that the Public Prosecution Service open one was ever ordered.
In addition to being contradictory, this is unacceptable because, if the trial court issued a judgment of acquittal in favor of the accused based on the alleged falsity of the witness’s account, this necessarily required the justice system to take the measures needed to bring the possible offender before the courts, which, in turn, would lend “soundness and credibility to the judgment” (sic). It maintains that the reasons for which the trial court discredited the witness Nombre04 stem from an incomplete and erroneous analysis of the evidence gathered during the investigation, which in no way shows that the witness made false statements. It explains that the trial court questioned the witness Nombre04’s statement that the operation under his charge—which was conducted on November 12, 2017—resulted in the apprehension of the accused and Nombre06 (deceased), while two other unidentified individuals escaped after encountering SINAC officials and fled.
The witness Nombre04 stated that he knew who those two individuals were but that he “preferred not to do so.” According to the appellant, the trial court concluded from this that the witness intended to conceal those persons’ identities so that they would not be brought to justice to answer for the conduct under adjudication, to the detriment of the accused, who was in fact being tried, and that this therefore supported an inference that the witness was lying. It contends that this assessment is erroneous and unfounded because the witness never stated that he was certain of the identity of the other two persons who accompanied the accused on the night of the events and fled, but rather that he “believed he knew who they were,” without being certain of their identities. It condemns as unacceptable and dangerous the expectation that the witness provide the names of two persons whom he believed had participated in the events under investigation, despite not being entirely certain, because this could result in someone being identified as responsible for a criminal act for which that person might bear no responsibility, with the paradoxical consequence that the witness could also incur criminal and civil liability for lying in his testimony.
It maintains that this demonstrates that the reasoning used to diminish the credibility of Mr. Nombre04 is erroneous and unfounded. It asserts that the witness’s credibility was also diminished by accepting as true the statements made by the public defense in its closing arguments, in which it asserted that Nombre04 had lied in his testimony when he became upset by the questions asked by defense counsel. Although that theory was accepted by the adjudicating body, no explanation of the matter was ultimately provided. It acknowledges that the witness became upset by some of defense counsel’s questions because counsel questioned matters and details about which the witness had already testified, to such an extent that the trial court had to admonish the defense, point out that its questions were repetitive, and ask the witness to remain calm. According to the appellant, this supports the assertion that the witness’s annoyance and discomfort with the defense’s questions was actually provoked by that party’s own manner of litigating when it questioned him about matters he had already addressed, and it shows that Nombre04 did not provide false information merely because he became upset by that particular circumstance.
It challenges the trial court’s failure to analyze this issue and its omission of valid reasons for accepting defense counsel’s claim. It states that another factor underlying the lack of credibility attributed to Nombre04’s account was that the testimony of Nombre07 revealed differences that made the latter’s statements credible. Nevertheless, the judgment neither examines the respects in which the testimony differed nor explains the reasons that led the trial court to conclude that Nombre05 was telling the truth while Nombre04 was lying. It asserts that what is “strange” is that both witnesses provided clear, precise, and consistent accounts whose essential aspects matched those described in the private prosecution and civil action for damages, as well as the information contained in report SINAC-PNBC-EC-D-007-2017, which constitutes the initial report of a crime (noticia criminis); the addendum to that report; seizure records (actas de decomiso) numbers PNBC-EC-D-012-2017 and PNBC-EC-D-013-2017; and discovery record (acta de hallazgo) N˚ PNBC-EC-001-2017.
It emphasizes that both witnesses agreed that: i) because of anonymously submitted complaints regarding hunting in the area, a preliminary inspection was conducted on November 8, 2017, at the same location where the events occurred, and several “tapescos” (wooden traps) were found at the base of several trees, containing “Cócora” seeds to attract wild animals, which supported the inference that the animals were to be cornered so they could be shot and hunted; ii) the operation during which the accused was detained began during the afternoon of November 11, 2017, when the official Nombre04 positioned himself outside the forested area where the events took place, approximately 300 meters away, and from there, with the aid of binoculars, observed the accused enter, along a trail, the same forested area where the tapescos had been found, carrying a shotgun-type firearm and a bag on his back; iii) this was reported to additional SINAC officials, who assisted with surveillance throughout the afternoon and night of November 11, and at “twelve hours” (sic) on November 12 they approached the entrance to and exit from the forested area and observed four persons coming toward them, carrying flashlights, long shotgun-type firearms, and bags; iv) after the officials ordered them to stop and identified themselves as SINAC officials, two of the individuals fled and left at the scene a bag containing a paca with two firearm wounds and Cócora seeds, as well as a shotgun-type firearm, while one firearm apiece, ammunition, flashlights, and machetes were seized from the defendant and Nombre06 (deceased), all of which are instruments suitable for hunting activities; and v) they agreed regarding the seizures made, the evidence found, the contents of all the bags, and the caliber of the firearms.
It maintains that the witnesses’ accounts were consistent and were corroborated by the documentary evidence, making it incomprehensible that the trial court should “prase” (sic) Nombre05 for telling the truth and providing a plausible account of the events, while reproaching the witness Nombre04 for departing from reality and falsifying his account in an effort to secure the defendant’s conviction. It asks, “how can one account be accepted as true while the other, which is almost identical to the first, is simultaneously deemed false? How can mutually exclusive assertions be accepted?” (sic). It maintains that this reveals errors in the reasoning used to weigh the testimony of the aforementioned witnesses in relation to the documentary evidence, resulting in a biased and incomplete analysis of the evidence and a gap in the reasoning. It insists that Nombre04’s testimony was discredited through empty assertions or assertions taken from defense counsel’s closing arguments, without any support or effort to corroborate them, leading the trial court to reach an erroneous conclusion regarding the existence of doubt as to the commission of the unlawful act, in violation of Article 142 of the Code of Criminal Procedure (Código Procesal Penal).
B. Regarding the lack of reasoning in relation to the violation of the rules of reasoned sound judgment. It maintains that the trial court accepted the defense’s theory that the accused’s participation in the events under investigation as a co-perpetrator (coautor) or participant (partícipe) had not been established because it was unclear what specific tasks each of the four persons involved had performed; precisely who had fired the shots that killed the paca was unknown; and the quarry was found in the bag thrown down by a different, unidentified person. Moreover, according to the appellant, the trial judge stated that the testimonial and documentary evidence was insufficient to establish with absolute certainty that the defendant was a co-perpetrator of the acts attributed to him because other explanations could not be excluded, such as that other persons had committed the offense or that the defendant had been at the location and time merely by coincidence.
It criticizes this conclusion as unacceptable because it is based on hypothetical situations that, although possible, are highly unlikely and depart entirely from the rules of reasoned sound judgment and from a comprehensive assessment of the evidence. It explains that the fact that Nombre04 did not observe co-accused (coencartado) Nombre06 or the other two individuals enter through the same place as the defendant does not rule out the possibility that the other participants arrived through another area or at a different time. Nor does the fact that the accused was not observed reaching an agreement with the other individuals to hunt at the location where the events occurred carry any weight as an argument, because that agreement could have been reached in secret or through telephone conversations or at locations away from the site, on a different date and at a different time; nor does this exclude the possibility that the accused participated as a co-perpetrator in the offense being adjudicated.
It objects to the trial court’s criticism that neither the private prosecution nor the indictment (acusación) specified the functions performed by each person involved, given that this was “impossible” (sic), because neither the initial report of a crime nor the witnesses’ statements recorded that they had observed all four persons involved firing the shots or constructing the traps (tapescos).
It alleges that the court failed to consider that the accused (imputado) was caught by SINAC officials, together with the other persons involved, as they were leaving a forested area along a trail leading to several previously constructed “tapescos” used for hunting; all of them were located at the same time (minutes after midnight), at a distance of one or two meters from one another, carrying long firearms and bags, including one containing the dead paca and “Cócora” seeds, while the others contained machetes and “items suitable for carrying out hunting activities.” These constitute strong, clear, and compelling circumstantial evidence (indicios) supporting the reasonable conclusion that the accused and the other defendants, acting by common agreement and with full functional control over the act (dominio funcional del hecho), committed the offenses of hunting and transporting a wild animal belonging to a reduced population or a species in danger of extinction.
It emphasizes that, although local residents frequent the site for walks or outings at various times of day, it is also known as a suitable place for illegal hunting, to such an extent that the operation and surveillance—as well as the prior visit—were conducted by SINAC officials in response to anonymous reports of alleged illegal-hunting offenses, in which the accused in this case was identified as the alleged perpetrator. It describes as “neither common nor logical” for people to enter or leave that area armed, or to venture into it during the afternoon and not leave until midnight the following day, much less for persons who have no relationship with others they encounter in the hiking area, or with the activities those persons are carrying out, to leave together with them, walking a short distance—one or two meters—from one another. It argues that the judge reproached the Ministerio Público for failing to conduct forensic examinations (pericias técnicas) on the paca’s body that would have made it possible to identify the caliber of the weapon that fired the projectiles and thus determine who fired the shot, and another examination to determine the exact time at which the animal died, “suggesting that it would have been possible to establish the perpetrator or perpetrators only through such evidence, and that (sic) only the person who fired the shot had functional control over the act, which, as we have seen, is unacceptable, given that the accused and the other participants were carrying weapons and possessed implements suitable for hunting activities.” It adds that the fact that one of the individuals who fled was carrying the bag containing the dead paca does not mean that the defendant cannot be held responsible as a principal (autor), based on the analysis of the evidence and the rules of sound judicial reasoning (sana crítica) set out supra.
It explains that the identified error caused prejudice because it resulted in an acquittal that violated the rules governing the statement of reasons (fundamentación) and assessment of evidence (valoración de la prueba), thereby infringing the State’s right to effective judicial protection (tutela judicial efectiva), when the private prosecution (querella) and civil damages action (acción civil resarcitoria) brought by the Procuraduría were dismissed. It requests that the judgment be declared invalid and that a retrial (juicio de reenvío) be ordered. In a second ground of appeal, it alleges infringement of the principle of freedom of evidence (libertad probatoria). It asserts that the trial court faulted the parties for failing to prove that the paca was in danger of extinction or belonged to a reduced population because no regulatory decree so providing had been submitted, and that, for this reason, the alleged conduct did not constitute an offense (atípica).
Nevertheless, it had previously stated that the species fell within those categories. It characterizes that assertion as false because certification number PNBC-EC-041, dated 29 de mayo de 2019, issued by the technician and witness Nombre05 (contained in the civil damages action file), was offered and admitted into evidence; that certification states that the paca is a protected wildlife species because it is included on the list of species with reduced populations and also identifies the regulations and instruments on which that information was based. It adds that this document was admitted when the witness Nombre05 was questioned, and he affirmed that it established the category applicable to the paca—reduced population. It considers the trial judge’s assertions mistaken, entirely unsupported, and unacceptable, since it is clear that the evidence did exist and that the paca is a protected species because of its reduced population.
It also demonstrates that the judge failed to pay attention to the trial proceedings (debate), since he forgot that this evidence had been admitted and it was therefore excluded from the evidentiary analysis conducted in the judgment. According to the appellant, this establishes a violation of the principle of freedom of evidence because the judge expected the category to which the wildlife belonged to be proved in one particular manner, while rejecting any other possibility inconsistent with what he internally regarded as valid. It requests that the claim be granted, that the judgment be declared invalid, and that a retrial be ordered.
III.Because the foregoing claims are intrinsically related, insofar as both concern the erroneous and inadequate statement of reasons (fundamentación) in the judgment, they will be considered jointly. Granted. Having examined the challenged judgment, which is in oral format (cf. digital file number 170008350573PE-14102020094020-2_Multi-0.wmv), and the records of the trial preceding it, this appellate chamber (cámara de apelación) can affirm that, in the sub examine, the errors of inadequate and erroneous reasoning alleged by the criminal prosecutor did indeed occur. It was clear from the judgment on the merits that the trial court based the acquittal of the defendant Nombre01 on the application of the in dubio pro reo principle (principio in dubio pro reo). In summary, it relied on the lack of credibility it attributed to the witness Nombre04 and the insufficiency of the evidence to establish that the accused participated in hunting a paca in the area of La Isla, on the ridge between the río Sarapiquí and the Río San Fernando, within the Parque Nacional Braulio Carrillo.
Nevertheless, as the appellant correctly points out, in addition to providing reasons for the judgment using a poorly refined oral technique—because the court did not present its reasoning linearly, but instead made leaps in reasoning and argument that prevented a fluent understanding of what it was attempting to justify—the trial judge also undeniably committed serious errors in weighing the testimony of Nombre04 and applying the rules of sound judicial reasoning (reglas de la sana crítica), and required specific evidence to prove the alleged facts, in violation of the principle of freedom of proof (principio de libertad probatoria). In this regard, one of the first arguments the trial judge used to discredit Nombre04’s testimony was that he began his testimony by providing general information, but when questioned in detail became “uncomfortable and annoyed by defense counsel’s questions” (cf. beginning at counter 29:41), which the a quo regarded as an indication of bias and distortion of the testimony intended to prejudice the accused, because the rules of experience (reglas de la experiencia) indicate that when a person “testifies to very general matters, he comes with a rehearsed script, but it is in response to specific questions that the witness becomes uncomfortable and annoyed by defense counsel’s questions and fails to tell the truth” (cf. ibid.).
As can be seen, the judge relied on a “rule of experience” without even explaining its source or why it should be considered valid or generally accepted—particularly the proposition that giving a general account means that the witness comes with a rehearsed script—because it is unquestionable that, in testimony, the richness of detail or generality of the events will always depend on the questioning conducted by the parties. Thus, if open-ended questions are used, the account given may, of course, most often be characterized by general aspects that convey the idea being communicated. Conversely, if the questions are direct or closed-ended and concern specific aspects of that account, the witness’s statement should, of course, include details, provided that the witness claimed to have witnessed, experienced, or participated in the event being described. In the present case, the trial court overlooked the fact that, although the witness Nombre04 began his account by providing general information about the events when he testified (cf. digital file number 170008350573PE-29092020012854-2_Multi-1.wmv), he did so because that was what the representative of the Ministerio Público—who began the examination—asked him to do when, through an open-ended question, he requested that the witness describe the events known to him.
Indeed, as his testimony and, of course, the adversarial examination progressed, Nombre04 provided details about where, when, and how they discovered the hunting platforms (tapescos)—structures made of branches that hunters build so they can lie in wait for prey as it travels to feeding areas—in the area of La Isla; how, based on the park rangers’ experience and the lunar cycle, the hunt was expected to take place three days later; and how they identified the only route into and out of the place where the hunting platforms were located. He also explained how, when, and where he first observed the defendant, and the results of his apprehension several hours after he was seen entering the hunting site. Nor did he omit any of the items of circumstantial evidence (indicios) that were seized from the persons accompanying the accused, including firearms, flashlights, machetes, and the prey, which was a paca that had been killed specifically with firearms.
In other words, the witness did provide details about the events, and therefore to claim that he lacked credibility because such details were absent constitutes a clear violation of the principle of logical derivation (principio de derivación lógica). The trial judge further stated that Nombre04 first discovered the area and the hunting platforms and, three days later, saw the accused emerge from the wooded area with the paca, from which he concluded that the accused had gone there with the three persons accompanying him and that they had hunted the animal. However, when questioned by defense counsel, Nombre04’s testimony was evasive, and he appeared “opposed to possibilities that might create doubt regarding his theory or perspective,” despite having been placed under oath and being required to tell the truth (cf. beginning at counter 39:30). At the appellant’s request, this appellate chamber undertook a review of Nombre04’s testimony, which is contained in digital file 170008350573PE-29092020012854-2_Multi-1.wmv, and found no indication whatsoever that the witness was evasive or displayed an unjustified desire to dismiss the defense theory.
As the criminal prosecutor maintains, when the public defender conducted her examination (cf. beginning at counter 34:22), she employed a deficient questioning technique because she attempted to elicit information that the witness had already provided, to the point that it was unsurprising that the judge repeatedly admonished her, warning her that the witness was not being asked to repeat his prior testimony (cf. counter 38:00). It was in this context that the public defender again asked about matters to which the witness had referred on numerous occasions—concerning the firearms carried by the persons descending from the mountain, their calibers, and which ones were seized—which even led her to assert within her question that Nombre04 had stated that the four persons were carrying weapons. This prompted the witness to clarify to the defender that he had not been speaking of four weapons; rather, he had stated up to that point that he saw four armed persons descending and that, as the judge had noted when admonishing defense counsel regarding the repetitive nature of her questioning, three weapons had been seized and there had been no mention of a fourth weapon (cf. beginning at counter 40:52).
This was precisely what annoyed the public defender, who characterized Nombre04’s response as a reprimand for the question posed to him. However, although the judge admonished the witness, he also acknowledged that questioning such as that taking place could at times be “difficult or tiring” (sic), clearly alluding to the repeated or misleading nature of the questions. Nevertheless, he still asked the witness to answer how many weapons he observed and how many were seized, and the witness did so (cf. counter 43:45). As may be inferred, the witness did not attempt through his answers to evade his duty to provide reliable information, much less did he display animosity toward the defense theory. Instead, he acted within the scope of his obligation to tell the truth as a witness by correcting the public defender’s approach, because she attempted to question him on the basis of a statement he had not previously made, namely, whether every person in the group was carrying a firearm.
Moreover, it cannot be overlooked that the witness ultimately clarified the matter, stating that he did see all four persons carrying firearms and that, although he was unable to see the caliber of the weapon that was never seized, he could affirm that it was a long gun of the type used for hunting. Apart from this incident, there was no other conflict between the witness and the public defender; consequently, the argument that the witness Nombre04 was evasive or reluctant to answer questions favorable to the defense theory, as an indication of mendacity, is not legitimate. Furthermore, as another basis for rejecting his testimony as credible, the judgment criticized Nombre04 for failing to intervene when he first observed the accused Nombre01 carrying a carbine-type firearm and entering the wooded area where the hunting platforms had been found, despite knowing that it was a hunting site, that he was a “forestry inspector” who was required to act and prevent any environmental harm, and that the distance was “short.” Nevertheless, the judgment never explained why 150 meters—the distance between the place from which Nombre04 was conducting surveillance and the pasture through which the defendant was walking—could be regarded as short enough for the witness to order him to stop and approach the accused.
The a quo entirely failed to consider that the witness was also very clear in stating that he was conducting surveillance with binoculars from that distance; that the intention was not to alert the hunters to the presence of Parque Nacional Braulio Carrillo inspectors in the area—to the point that they had to enter the site in a private vehicle—and that they sought to obtain evidence of the hunting activities they believed were going to occur. In this respect, Nombre04 was criticized because, although he stated that he was an inspector with the Sistema Nacional de Áreas de Conservación—which was not disputed—he acted as a law-enforcement officer responding to an offense rather than preventing it; that is, he did not prevent Nombre01 from entering the hunting area but instead conducted surveillance so that he could intervene later, when the accused returned with the prey. However, this argument is illegitimate because it disregards the fact that wildlife inspectors have police authority to assist in the enforcement of and compliance with the Ley Conservación de la Vida Silvestre, N˚ 7317, and that their powers include “…stopping, traveling through, entering, and conducting inspections within any property or vessel, as well as within the industrial and commercial facilities involved, and seizing wildlife organisms, parts, products, and derivatives, together with the equipment used in the commission of an offense or an activity prohibited by this law.
In the case of private residences, authorization must be obtained from the competent judicial authority or the owner” (article 16 ibid.). In other words, wildlife inspectors such as Nombre04 have police authority and the power to conduct investigations into the crimes, petty offenses (contravenciones), and administrative violations (infracciones administrativas) described in the Ley Conservación de la Vida Silvestre, including the criminal offense under investigation (article 93 subsection a ibid.). Consequently, the fact that Nombre04 conducted surveillance to determine whether the accused or other persons were engaging in illegal hunting was not inconsistent with his duties, much less a valid basis for discrediting his testimony. A very similar defect arose in the judgment when it sought to establish that Nombre04’s testimony lacked credibility because he refused to disclose the names of the other two persons who fled when the accused was apprehended, despite knowing their names and being required to tell the truth.
The trial court argues that Nombre04’s attitude, in withholding the names of these individuals, permits the inference that he was concealing something or attempting to favor those persons, since it was his duty to report this to the Public Prosecutor’s Office (cf. timestamp 48:04 of the judgment file). Nevertheless, upon examining Nombre04’s testimony, it appears that, when the public defender asked him who was carrying the bag containing the game animal, referring to the moment when the accused was apprehended, he stated: “I am not going to give you names. I know who was carrying it, but I am not going to give names, because at the time, the report did not specifically identify any person by name, except Nombre01 and Nombre06, in that report. We know who the other persons are, but they are not in the report because we did not catch them in the act, nor did we conduct the investigations properly enough to implicate them in the events” (cf. trial recording number 170008350573PE-29092020012854-2_Multi-1.wmv, at timestamp 44:33).
As may be inferred, the witness’s refusal to provide the names of the persons whom he believed had fled was not motivated by personal favoritism or an attempt to conceal something, as the trial judge erroneously stated, but rather because they had not been “caught in the act,” that is, in flagrante delicto (flagrancia), and the investigations had not been properly conducted so as to “implicate them in the events.” This implicitly indicated that Nombre04 did not wish to state the names of the persons whom he believed had participated because there was no substantiated evidence linking them to the commission of an offense, which constitutes a proper application of the rules of criminal procedure, since they could not even be regarded as accused persons (imputados) (Article 13 of the Code of Criminal Procedure). Yet, although the foregoing is already sufficient to establish the judge’s error in reasoning, it cannot be overlooked that the public defender, who was conducting the examination at that time, accepted as valid the witness’s refusal to provide those names, to the point that she instructed him not to disclose them and reformulated the question to ask whether the accused was the person carrying the bag in which the game animal was found, which Nombre04 denied without hesitation (cf. timestamp 45:22).
Consequently, it was ruled out that, by refusing to provide the names of the unidentified individuals, the witness had attempted to undermine the defense theory or evade disclosing information favorable to the accused, since, it bears repeating, when he was directly questioned about matters that might be viewed as diminishing the accused’s participation in the events under investigation, he never hesitated to state them. In short, the defect alleged by the appellant concerning the erroneous reasoning of the judgment as to Nombre04’s lack of credibility is evident and, as explained below, also affected the determination of the facts and caused prejudice to the interests represented by the Office of the Attorney General of the Republic. Thus, among the reasons given in the judgment, it was stated that a conviction could not be reached and that, instead, a state of reasonable doubt existed because: i) Although the accused was observed heading toward the mountainous sector where the hunting platforms (tapescos) were located, there was a distance of one kilometer between the two points, which, according to the rules of experience (reglas de la experiencia), should be regarded as “a considerable distance,” given that it was a mountainous area with undergrowth and a slope.
However, it should be clarified that Nombre04 testified that, when they found the hunting platforms—8 de noviembre de 2017—three days after the accused’s apprehension, the seizure of the firearms, and the discovery of a hunted wild game animal, what they observed was a “trail” (trillo) running through the mountain to the site where these structures were located, and that the sole entry and exit point was where the surveillance was being conducted (cf. timestamp number 02:42). Accordingly, the mountainous terrain or undergrowth, besides not increasing the distance, as the court below appears to have understood, would not have affected the commission of the acts in any way, because there was a “trail,” that is, according to the rules of experience, a rough path through the undergrowth that would have made travel between the two points easier. Thus, the distance would not have constituted a circumstance that rendered the criminal act impossible or diminished the accused’s participation.
This is particularly so given that slightly more than ten hours elapsed between the time the accused was seen entering the location (14:30 hours) and returning (00:30 hours del día siguiente), during which a person, even in an area such as that described by Nombre04, could have traveled there and back after hunting a wild animal. This relates to another matter on which the trial court believed the doubt concerning the accused’s participation in the charged acts was based: the absence of evidence establishing that Nombre01 had acted in collusion (contubernio) with his brother Nombre06 and the other two individuals to commit the criminal act, or that they had met in the forest to stalk and hunt the animal that they subsequently carried to the outskirts of the area. The trial judge based this finding on the belief that it was unknown when the tepezcuintle was hunted—that is, when it was shot—because no expert examination (pericia) had been conducted in that regard (cf. timestamp 55:20 of the judgment file).
This argument violates the principle of freedom of proof (principio de libertad probatoria) (Article 182 of the Code of Criminal Procedure), because the court below, as though applying a system of predetermined evidentiary weight (prueba tasada), found that the time of the tepezcuintle’s death could be established only through an expert examination, entirely overlooking the fact that this system for assessing evidence has long been superseded and that facts or circumstances may now be proved by any admissible and lawful means. In this case, by discrediting Nombre04’s testimony, the court failed to consider that he provided several guidelines forming part of the rules of experience, particularly those concerning the hunting of wild animals in that area, including that hunters hunt only at night because they need the animals to reach feeding sites—trees that bear edible fruit, such as the Cócora tree—and that it is there, while positioned on the hunting platforms and taking advantage of the darkness—which is why they make use of lunar phases that provide greater darkness at night—that they dazzle the animals with flashlights and then shoot them, before removing their game from the forested area.
In this context, the trial court’s question as to whether the game animal might have been captured before Nombre01 entered the mountain would be answered in the negative based on Nombre04’s testimony, because the accused entered in the afternoon, that is, during daylight, when the animals were not engaged in feeding activity, making it impracticable to surprise or dazzle them and, much less, to shoot them, given the high probability that they would detect the hunters. Likewise, it cannot be overlooked that the judgment rejected the proposition that Nombre01 had met the other individuals inside the forest, including those who were traveling with him and carrying the dead tepezcuintle in a bag, on the ground that it was impossible—as argued by the representatives of the Public Prosecutor’s Office and the Office of the Attorney General of the Republic—to find that the bag Nombre01 had been seen carrying when he entered the hunting area was subsequently carried by one of the unidentified individuals, because Nombre01 was apprehended with “a bag.” However, this is another example of the trial judge’s failure, as alleged by the appellant, to genuinely weigh Nombre04’s testimony.
It is sufficient to note that, during his trial testimony, he stated: “The animal was inside a bag. When these persons left, we saw them because they were five meters away from us; we saw them clearly. One of the persons, who did not drop anything, happened to be carrying the bag that Nombre01 had carried up. Exactly the same bag. That is what he was carrying. The other young man was carrying that other small bag, which we did see him with. They were four or five meters away from us, and with our four good, high-quality flashlights, we illuminated them, and the bag carried by the second person who fled was dropped right there, together with a carbine.” (cf. the digital trial file cited above, at timestamp 32:10. Emphasis supplied). In other words, although it was not the bag containing the game animal, it was established, according to this witness, that after entering the forest the accused had given his bag to one of the individuals who was bringing out the game animal.
This constituted additional circumstantial evidence (indicio) that should have been weighed in conjunction with the facts that all the individuals were traveling together; they were using the trail leading to the hunting area; all of them were carrying firearms; they had a tepezcuintle carcass with firearm wounds; one bag contained seeds or fruit from the Cócora tree, which is food for that game animal and matched the fruit that the inspectors saw on the hunting platforms built near the trees used as feeding sites by wild animals; and the accused was in the area not merely at some arbitrary time, but at a time that, according to the rules of experience, was suitable for hunting. Nor should it be omitted that they were also carrying flashlights, an instrument suitable for dazzling animals while hunting. None of this was analyzed by the court below, which ultimately required direct evidence (prueba directa) of the hunting, without considering that circumstantial evidence (prueba indiciaria) is also an admissible method of proving relevant facts or circumstances, as follows from the principle of freedom of proof.
Accordingly, because the errors in the reasoning of the judgment and in the application of the rules of sound judicial assessment (reglas de la sana crítica), in violation of Articles 142 and 184 of the Code of Criminal Procedure, have been demonstrated, the appeal against the judgment filed by the Office of the Attorney General of the Republic, in its capacity as private prosecutor (querellante) and civil claimant (actor civil), must be granted and the judgment declared entirely ineffective. Consequently, a retrial on remand (juicio de reenvío) is ordered so that the same court, differently constituted, may adjudicate the matter in accordance with law.
THEREFORE:
The appeal against the judgment filed by attorney Andrés Alfaro Ramírez, in his capacity as Criminal Prosecutor representing the private criminal complaint (querella) and civil action for damages (acción civil resarcitoria) brought by the State of Rica, is granted. Consequently, the judgment is declared wholly ineffective, and a retrial (juicio de reenvío) is ordered before the same court, but with a differently constituted panel, so that it may proceed to issue a decision in accordance with law. Resolución: 2021-619 TRIBUNAL DE APELACIÓN DE SENTENCIA PENAL. Segundo Circuito Judicial de San José. Goicoechea, al ser las trece horas cinco minutos, del veintisiete de abril de dos mil veintiuno.- RECURSO DE APELACIÓN interpuesto en la presente causa seguida contra Nombre01, mayor, costarricense, cédula de identidad número CED01, nacido en Alajuela, el 04 de marzo de 1967, hijo de Nombre02 y Nombre03, casado, de oficio peón de finca, vecino de Heredia, Sarapiquí; por el delito de INFRACCIÓN A LA LEY DE CAZA Y TRASIEGO, en perjuicio de LA VIDA SILVESTRE. Intervienen en la decisión los jueces Rafael Mayid González González. Se apersonaron en esta sede el licenciado Andrés Alfaro Ramírez Procurador Penal y la licenciada Fanny Badilla Sánchez defensora pública del imputado.
RESULTANDO:
I.Que mediante sentencia número 212-2020, de las nueve horas cuarenta minutos, del catorce de octubre de dos mil veinte, el Tribunal de Juicio de Heredia, Sede Sarapiquí, resolvió: "POR TANTO: De conformidad con lo expuesto y con sustento en los artículos 1, 7 y 8 de la Convención Americana de Derechos Humanos, artículos 2, 9, 10 y 11 de la Declaración Universal de Derechos Humanos, artículos 7, 35, 36, 39 y 41 de la Constitución Política, artículos 1, 30 y 45 del Código Penal, artículos 93 y 95 de la Ley de Conservación de la Vida Silvestre, artículos 1, 3, 4, 5, 6, 7, 9, 32, 182, 265 a 267, 360, 362, 364, 365, 366 y 367 del Código Procesal Penal, articulo 1045 del Código Civil; y de conformidad con el principio universal de In Dubio Pro Reo SE ABSUELVE DE TODA PENA Y RESPONSABILIDAD a Nombre01, del delito de Caza y un delito de Trasiego, que se le ha venido acusando en perjuicio de La Vida Silvestre.
Se declara sin lugar la acción civil incoada por la Procuraduría General de la República, así mismo se resuelve sin especial condena en costas en la querella y la acción civil por existir razón plausible para litigar. Se ordena el cese de cualquier medida cautelar que pese sobre el imputado, en razón de esta causa. Se ordena el comiso y destrucción de las armas de fuego y de las armas tipo machete que han sido decomisadas en el presente asunto Archívese la presente causa una vez que la sentencia adquiera firmeza. Quedan todas las partes notificadas de lo anterior por la vía de la oralidad. El respaldo de lo resuelto se deja a disposición de las partes, para lo cual deberán aportar al Tribunal un dispositivo de almacenamiento portátil. Lo anterior se encuentra registrado en el sistema de grabación de la sala de debates del Tribunal de Juicios de Sarapiquí, bajo el número único del expediente. Se finaliza el dictado de la sentencia a ser las 11:08 horas". (sic)
II.Que contra el anterior pronunciamiento, el licenciado Andrés Alfaro Ramírez Procurador Penal, interpuso recurso de apelación.
III.Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 465 del Código Procesal Penal, el Tribunal se planteó las cuestiones formuladas en el recurso de apelación.
Redacta el juez de Apelación de Sentencia Penal González González; y,
CONSIDERANDO:
I.El licenciado Andrés Alfaro Ramírez, en su condición de Procurador Penal representante de la querella y acción civil resarcitoria interpuesta por el Estado de Costa Rica, mediante escrito presentado en fecha cuatro de noviembre de dos mil veinte (cfr. 164 a 179), interpone recurso de apelación en contra de la sentencia N˚ 212-2020 del Tribunal de Juicio de Heredia, Sede Sarapiquí, de las nueve horas cuarenta minutos del catorce de octubre de dos mil veinte. Así, luego del estudio de la impugnación planteada y los antecedentes procesales que informan el sumario, se pudo determinar que esta debe ser admitida para su conocimiento, por cuanto fue presentada en tiempo conforme al plazo de ley. Igualmente, cumple con los requisitos de forma que de acuerdo a los principios de flexibilidad, accesibilidad, amplitud e informalidad -que son propios y caracterizan dicho medio impugnativo-, resultan necesarios para el adecuado conocimiento de estos en orden al examen integral del fallo, y para garantizar el derecho al recurso en materia penal previsto en el artículo 8.2 h) de la Convención Americana sobre Derechos Humanos, así como en los numerales 458 y siguientes del Código Procesal Penal, reformados mediante la Ley N. 8837 del 9 de junio de 2010.
II.En el primer motivo de impugnación se aduce “Falta de fundamentación por errónea y contradictoria valoración intelectiva de la prueba, que infringe las reglas de la sana crítica racional, la lógica y la experiencia común”. Alega que se hizo na valoración sesgada e incompleta de la declaración de Nombre04 y Nombre05; así como de la prueba documental recabada dentro del proceso, lo que llevó a establecer un estado de duda con relación a la posible comisión del delito que se le atribuyó al encartado y tuvo como efecto el dictado de una resolución que declaró sin lugar la querella y la acción civil resarcitoria incoadas por el Estado. Establece que dicha decisión se fundó en la poca credibilidad que se le dio a la versión suministrada por Nombre04, el cuestionamiento sobre la prueba que se recabó, así como sobre el reproche efectuado contra el Ministerio Público, con respecto a diligencias útiles no practicadas y que a juicio del juzgador debieron haberse realizado, lo que llevó al juzgador a realizar valoraciones sesgadas, incompletas y equivocadas, en infracción de las reglas de la sana crítica y el principio de libertad probatoria.
Explica que los errores de fundamentación son: A. Sobre la ausente y errónea fundamentación en torno a la desacreditación de la versión dada por el testigo Nombre04. Arguye que el estado de duda se basó, mayoritariamente, en las presuntas contradicciones e imprecisiones del testigo Nombre04 durante su declaración en juicio, refiriéndose que la exposición de dicho testigo fue forzada para buscar la condena del justiciable Nombre01, al punto que se consideró que falseó su relato en el contradictorio y que ello le podría generar responsabilidad penal por falso testimonio. No obstante, nunca se ordenó ni solicitó al Ministerio Público el la apertura de un testimonio de piezas contra el testigo, hecho que además de resultar contradictorio, también es inaceptable, puesto que si el juzgador emitió una sentencia absolutoria a favor del encartado, basándose en la presunta falsedad del relato del testigo, ello conllevaba, ineludiblemente, a que la administración de justicia hiciera lo necesario para llevar ante los estrados judiciales al posible infractor, lo cual, a su vez, le daría “solidez y credibilidad al fallo” (sic).
Estima que las razones por las cuales el tribunal de juicio desacreditó al testigo Nombre04 obedecen a un análisis incompleto y equivocado de la prueba recabada durante la investigación, que de ninguna manera refleja que el deponente haya hecho manifestaciones falsas. Explica que el juzgador cuestionó que el testigo Nombre04 externara que el operativo a su cargo -que se realizó el 12 de noviembre de 2017- diera como resultado la aprehensión del encartado y de Nombre06 (fallecido); y la evasión de otros dos individuos no identificados, que al toparse con los funcionarios del SINAC se dieron a la fuga. Afirmando el testigo Nombre04 que él sabía quienes eran esas dos personas, pero que “prefería no hacerlo”. Ante esto, según el quejoso, la persona juzgadora concluyó que el testigo pretendía encubrir a esas personas para no llevarlas ante la justicia, para que respondieran por los hechos bajo juzgamiento, en detrimento del encartado que sí estaba siendo juzgado y, por ende, ello permitía inferir que el testigo mentía.
Señala que esta apreciación es equivocada y carente de sustento, ya que el testigo nunca manifestó estar seguro sobre la identidad de las otras dos personas que acompañaban al encartado la noche de los hechos y que se dieron a la fuga, sino que “creía saber quienes eran”, sin que estuviera seguro sobre la identidad de dichos individuos. Fustiga como inaceptable y peligroso que se pretendiera que el testigo diera los nombres de dos personas que él cree participaron en los hechos bajo investigación, sin estar completamente seguro, por cuanto podría generar que se señale a alguien como responsable de un hecho delictivo en el que podría no tener responsabilidad, con la paradoja que también le acarrearía responsabilidad penal y civil al testigo por mentir en su declaración. Sostiene que esto demuestra que el razonamiento empleado para restarle credibilidad al señor Nombre04 es erróneo y carente de sustento.
Asevera que también se le restó credibilidad a dicho deponente, al tenerse por ciertas las manifestaciones de la defensa pública, cuando hizo sus alegatos conclusivos, puesto que aseveró que Nombre04 mintió en su deposición cuando se mostró molesto con las preguntas efectuadas por la defensa técnica, empero, a pesar de que dicha tesis fue receptada por el órgano juzgador, finalmente no se dio una explicación sobre el particular. Acepta que el testigo se molestó con algunas preguntas que hizo la defensora, debido a que la litigante cuestionó aspecto y detalles sobre los cuales el testigo había declarado con anterioridad, al punto que el juzgador tuvo que llamar la atención de la defensa haciéndole ver la reiteración de sus preguntas y pidió calma al testigo. Esto permite aseverar, según el recurrente, que la molestia e incomodidad del testigo con las preguntas de la defensa fue, en realidad, una provocada por la propia manera de litigio de dicha parte, cuando formuló su interrogatorio sobre aspectos que ya el testigo había referido, y refleja que Nombre04 no suministró información falsa por haberse molestado por esa circunstancia en particular.
Cuestiona que el juzgador dejara de analizar este aspecto, y omitiera dar razones válidas para aceptar el reclamo de la defensa técnica. Señala que otro punto que marcó la falta de credibilidad en el relato de Nombre04, fue que al deponer Nombre07 se evidenciaron diferencias que tornan creíble el dicho de este último. No obstante, no se ahonda en los aspectos en que difieren los testimonios, ni tampoco sobre las razones que lo llevaron a concluir que Nombre05 dice verdad y Nombre04 miente. Asegura que lo “extraño”, es que ambos testigos rindieron un relato claro, preciso y coincidente en sus aspectos medulares con lo descrito en la querella y la acción civil resarcitoria, y lo indicado en el informe SINAC-PNBC-EC-D-007-2017, que constituye la noticia criminis; la ampliación de dicho informe, el acta de decomiso número PNBC-EC-D-012-2017 y PNBC-EC-D-013-2017; y el acta de hallazgo N˚ PNBC-EC-001-2017.
Recalca que ambos testigos fueron concordantes en que : i) debido a quejas recibidas de manera anónima, sobre caza en la zona, se efectuó una inspección previa el 8 de noviembre de 2017, en el mismo lugar de los hechos, en donde se localizó varios “tapescos” (trampas construidas con madera) al pie de varios árboles, que en su interior tenían semillas de “Cócora” para atraer a los animales silvestre, lo que permitía inferir que querían acorralarlos con el fin de dispararles y cazarlos; ii) el operativo en que se detuvo al endilgado dio inicio el 11 de noviembre de 2017 en horas de la tarde, cuando el funcionario Nombre04 se ubicó en las afueras del área boscosa donde tuvieron lugar los acontecimientos, aproximadamente a 300 metros, desde donde, con la ayuda de binoculares, observó al encartado ingresar, por un trillo, a la misma zona boscosa donde se encontraron los tapescos, portando un arma fuego tipo escopeta y un bolso en sus espaldas; iii) que ello fue comunicado a más funcionarios del SINAC, quienes colaboraron para hacer vigilancia, lo cual llevó toda la tarde y noche del 11 de noviembre, siendo que a las “doce horas” (sic) del doce de noviembre se acercaron al sitio de entrada y salida de la zona boscosa, y pudieron observar cuatro personas que venían hacia ellos, portando focos, armas de fuego largas, tipo escopeta y bolsos, iv) luego de darles la señal de alto e identificarse como funcionarios del SINAC, dos de los individuos huyeron y dejaron en el sitio un bolso que contenía un tepezcuintle con dos impactos de armas de fuego y semillas de Cócora, así como un arma de fuego tipo escopeta, mientras que el justiciable y Nombre06 (fallecido), se les decomisó un arma de fuego a cada uno, municiones, focos y machetes, que resultan ser instrumentos aptos para la realización de las faenas de caza; v) concordaron en cuanto a los decomisos efectuados y los indicios hallados, así como el contendido de todos los bolsos, y el calibre de las armas.
Sostiene que los testigos coincidieron en sus versiones, y estas se corroboraron en la prueba documental, por lo que resulta incomprensible que el tribunal de juicio “alave” (sic) a Nombre05 por decir la verdad y dar una versión verosímil sobre los hechos, mientras que al testigo Nombre04 se le reprocha apartarse de la realidad y falsear su relato con el afán de lograr la condena del imputado. Cuestiona “¿cómo es que un relato es tomado como verdadero y el otro que es casi idéntico al anterior es falso a la vez? ¿ Cómo es que puede aceptarse afirmaciones excluyentes entre sí?” (sic). Estima que se evidencia los errores de razonamiento que se dieron al ponderarse las deposiciones de los testigos mencionados, con relación a lo indicado en la prueba documental, lo cual desemboca en un análisis sesgado e incompleto de la prueba y un vacío de fundamentación. Insiste en que se desacreditó el testimonio de Nombre04 con afirmaciones vacías o extraídas de las manifestaciones realizadas por la defensa técnica en conclusiones, sin tener respaldo alguno, ni hacerse un esfuerzo por corroborarlas, lo que lleva al juzgador a concluir de manera equivocada, sobre la existencia de un estado de duda sobre la comisión del hecho ilícito, en quebranto del artículo 142 del Código Procesal Penal.
B. Sobre la falta de fundamentación con relación a la violación a las reglas de la sana crítica racional. Sostiene que el juzgador apoyó la tesis de la defensa, en cuanto a que no se logró acreditar la participación del sindicado en los hechos bajo investigación en calidad de coautor o partícipe, por no tenerse claridad de cuáles tareas en específico efectuaron los cuatro involucrados; desconocerse con precisión quién efectuó los disparos que le dieron muerte al tepezcuintle; y que la presa fue hallada en el bolso que fue arrojado por una persona distinta (no identificado). Además de que, según el quejoso, el juez de juicio aseveró que la prueba testimonial y documental era insuficiente para arribar a una certeza absoluta de que el justiciable fue coautor de los hechos que se le venían atribuyendo, puesto que no es posible excluir otras explicaciones, como que fueran otras personas las autoras del ilícito o que el imputado estuviera en el sitio y el momento por mera casualidad.
Critica como inaceptable esta conclusión, puesto que se basa en situaciones hipotéticas que, aunque posibles, son bastante improbables, y se apartan por completo de las reglas de la sana crítica racional y de un análisis conjunto de la prueba. Explica que, el que Nombre04 no observara al coencartado Nombre06, ni a los otros dos individuos, ingresar por donde lo hizo el aquí justiciable, no descarta que los demás participantes hayan arribado por otra zona o en otro momento distinto. Tampoco el que no se haya observado al endilgado ponerse de acuerdo con los otros individuos para cazar en el sitio de los hechos, es un argumento que cae por su propio peso, pues este acuerdo pudo darse en la clandestinidad o bien, a través de conversaciones telefónicas o sitios alejados del sitio, en fecha y hora distintas, lo cual tampoco excluye la posibilidad de que el encartado participara en el ilícito objeto de juzgamiento como coautor.
Objeta el cuestionamiento del juzgador, sobre que no se especificó en la querella, ni en la acusación, cuáles funciones hizo cada uno de los sujetos involucrados, a partir de que es “imposible” (sic), puesto que ni en la noticia criminis, ni en las declaraciones de los testigos se consignó que hayan observado a los cuatro involucrados hacer los disparos o construir las trampas (tapescos). Alega que se dejó de ponderar que el imputado fue sorprendido por funcionarios del SINAC, junto a los otros involucrados, cuando venían saliendo de una zona boscosa utilizando un trillo que conducía a varios “tapescos” previamente construidos para labores de caza; todos fueron ubicados a la misma hora (minutos después de la media noche); a una distancia de uno o dos metros uno de los otros; portando armas de fuego larga y bolsos, entre estos uno que contenía el tepezcuintle muerto y semillas de “Cócora”, mientras en los otros machetes y “artículos aptos para realizar las labores de cacería”, lo que constituyen indicios fuertes, claros y contundentes que permiten afirmar, razonablemente, que el acriminado y los otros justiciables, de común acuerdo y con pleno dominio funcional del hecho, incurrieron en los delitos de caza y trasiego de animal silvestre en población reducida o en peligro de extinción.
Recalca que si bien el sitio es frecuentado por lugareños para hacer caminatas o paseos a distintas horas del día, también es un lugar conocido por su aptitud para efectuar caza ilegal, a tal punto que el operativo y la vigilancia- así como la visita previa- se dieron por los funcionarios del SINAC al atender denuncias anónimas sobre presuntos delitos de caza ilegal, en los que se mencionó como presunto responsable al aquí imputado. Cita como “nada común y lógico” que las personas ingresen o salgan de esa zona armadas, ni que se internen desde horas de la tarde para salir hasta la media noche del día siguiente y, menos aún, que sin tener relación con otras personas que se topen en la zona de caminata, o con las actividades que estos despliegan, se salga en conjunto con aquellos, caminando a corta distancia -uno o dos metros- unos de otros. Aduce que el juzgador realizó un reproche hacia el Ministerio Público por no practicar pericias técnicas en el cuerpo del tepezcuintle, que permitiera identificar el calibre del arma que disparó los proyectiles y así identificar quién disparo; y otra pericia que permitiera determinar la hora exacta en que se produjo la muerte del animal, “queriendo dar a entender que solamente a través de esas probanzas hubiese sido posible establecer al autor o autores del hecho y sobre (sic) solamente quien hizo el disparo tenía el dominio funcional del hecho, algo que como vimos es inaceptable, dado que el imputado y el resto de partícipes portaban armas y tenían instrumentos aptos para desarrollar actividades de cacería”.
Agrega que, el que uno de los individuos que huyó fue quien portaba el bolso que contenía el tepezcuintle muerto, no implica que no pueda atribuírsele responsabilidad como autor al encartado, tomando como base la reflexión que sobre la prueba y las reglas de la sana crítica se hizo supra. Explica que, con el yerro apuntado se ocasionó como agravio el que se emitiera un fallo absolutorio que infringió las reglas de fundamentación y valoración de la prueba, que lesionó la tutela judicial efectiva del Estado, al declararse sin lugar la querella y la acción civil resarcitoria incoadas por la Procuraduría. Solicita se declare la ineficacia de la sentencia y se disponga el juicio de reenvío. En un segundo motivo de apelación alega la infracción al principio de libertad probatoria. Afirma que el tribunal de instancia reprochó que no se demostrara que el tepezcuintle estuviera en peligro de extinción o con una población reducida, al no aportarse decreto reglamento que así lo estipulara, y que por esa razón la conducta atribuida resultaba atípica.
Empero, previamente había indicado que dicha especie se ubicaba dentro de esas categorías. Cataloga como falsa tal aseveración, ya que se ofreció e incorporó la certificación emitida por el técnico y testigo Nombre05, número PNBC-EC-041 de fecha 29 de mayo de 2019 (ubicada en el legajo de acción civil resarcitoria), en el que consta que el tepezcuintle es una especie silvestre protegida por encontrarse incluida dentro de listado de especies en población reducida y se consignó también la normativa e instrumentos en los que se basó esa información. Agrega que este documento fue incorporado cuando se interrogó al testigo Nombre05, quien aseguró que en ella se establecía la categoría en la que se encontraba el tepezcuintle -población reducida-. Considera que las aseveraciones del juez de juicio fueron equivocadas, sin sustento alguno e inaceptables, puesto que es claro que la prueba sí existía y que el tepezcuintle es una especie protegida por su población reducida.
A la vez que, acredita que el juzgador no pudo atención al desarrollo del debate, puesto que olvidó que se incorporó esta probanza y, así quedó fuera del análisis probatorio realizado en sentencia. Con ello se acredita, según el quejoso, la violación al principio de libertad probatoria, puesto que el juzgador esperaba que se demostrara la categoría a la que pertenecía la vida silvestre de una manera en particular y descartando cualquier otra posibilidad ajena a la que internamente él tenía por válida. Solicita se declare con lugar el reclamo se declare la ineficacia de la sentencia, disponiéndose el juicio de reenvío.
III.Por encontrarse los reclamos anteriormente intrínsecamente relacionados, por cuando ambos se refieren a la errada y omisa fundamentación de la sentencia, es que se conocerán de modo conjunto. Con lugar. Examinada la sentencia impugnada, que se encuentra en formato oral (cfr. archivo digital número 170008350573PE-14102020094020-2_Multi-0.wmv) y los registros del debate que la preceden, puede esta cámara de apelación aseverar que, en el sub examine, sí se presentaron los yerros de falta y errada fundamentación que alega el procurador penal. Del fallo de mérito, quedó claro que el tribunal de juicio fundó la absolutoria del imputado Nombre01 en la aplicación del principio in dubio pro reo. En síntesis, bajo la falta de credibilidad que le otorgó al testigo Nombre04, y la insuficiencia probatoria para poder determinar que el sindicado participó en la cacería de un tepezcuintle en la zona de la Isla, sobre la fila entre el río Sarapiquí y el Río San Fernando, dentro del Parque Nacional Braulio Carrillo.
No obstante, como bien lo señala el impugnante, el juzgador de juicio, además de realizar una motivación del fallo bajo una técnica oral poco depurada, ya que no efectúa una exposición lineal, sino que tiene saltos de razonamiento y argumentación que impiden una fluidez de comprensión de lo que trata de justificar, resulta insoslayable que aquel también comete errores graves al ponderar y aplicar las reglas de la sana crítica al testimonio de Nombre04, y exige prueba específica para demostrar los hechos acusados, en quebranto del principio de libertad probatoria. En este sentido, uno de los primeros argumentos que utilizó el juzgador de juico para demeritar la declaración de Nombre04, fue que aquel inició su deposición dando información general, pero cuando se le preguntó en detalle se puso “incómodo y molesto con las preguntas de la defensa” (cfr. a partir del contador 29:41), lo que para el a quo resulta ser un indicio de subjetividad y de tergiversación del testimonio para afectar al encartado, debido a que las reglas de la experiencia informan que cuando una persona “va declarando aspectos muy generales, pues viene con un guion aprendido, pero a raíz de preguntas concretas, es cuando el testigo se pone incómodo y molesto con las preguntas de la defensa, y falta a la verdad” (cfr. ibídem).
Como se aprecia, el juzgador se apoya en una “regla de la experiencia” de la que ni siquiera explica su fuente o por qué debe considerarse válida o mayoritariamente acogida -sobre todo el aspecto de que cuando se da un relato general es que se viene con un guion aprendido), por cuanto resulta incuestionable que, en un testimonio, la riqueza de los detalles o la generalidad de los acontecimientos siempre pasará por el interrogatorio que realicen las partes. Así, si se utiliza la técnica de preguntas abiertas, por supuesto que el relato que se otorgará puede estar marcado, en la mayoría de las ocasiones, por aspectos generales que permitan representar la idea que se transmite. Más, si las preguntas son directas o cerradas, sobre aspectos concretos de ese relato, por supuesto que los detalles deberían conformar la manifestación del deponente, si es que aquel aseguró haber presenciado, vivido o ser parte del acontecimiento sobre el que se expone.
En la especie, perdió de vista el tribunal de mérito que, si bien el testigo Nombre04, cuando declaró (cfr. archivo digital número 170008350573PE-29092020012854-2_Multi-1.wmv), inició su relato dando datos generales sobre los hechos, ello se debió a que así se le pidió el representante del Ministerio Público -quien fue quien inició el interrogatorio-, al requerirle, en un interrogatorio abierto, que expusiera sobre los hechos que conocía. Precisamente, cuando avanzó su declaración y, por supuesto el contradictorio, Nombre04 dio detalles sobre dónde, cuándo y cómo descubrieron los tapescos (estructuras de ramas que construyen los cazados para poder acechar a las presas cuando estas se dirigen a las zonas de alimentación) en la zona de La Isla; cómo se esperaba, conforme a la experiencia de los guardaparques y, por el movimiento de la luna, que la cacería ocurriera tres días después y la identificación del único ingreso y salida hasta ese lugar donde estaban los tapescos.
Aclaró también cómo, cuándo y dónde observó a justiciable por primera vez, y los resultados de su aprehensión horas luego de que se le vio ingresando al sitio de cacería. Sin omitir todos y cada uno de los indicios que se lograron decomisar a las personas que venía con el endilgado, entre estos, las armas de fuego, los focos, machetes y la presa, que se trató de un tepezcuintle al cual se le había dado muerte, precisamente, con la utilización de armas de fuego. Es decir, el testigo sí dio detalles sobre los acontecimientos, por lo que argüir la falta de credibilidad ante la ausencia de estos, resulta un violación clara del principio de derivación lógica. Por otro lado, el juzgador de juicio expuso que Nombre04 descubrió primero la zona y los tapescos, y tres días después vio salir al encartado de la zona boscosa con el tepezcuintle, de lo cual concluyó que aquel fue con las tres personas con las que venía e hicieron la caza del animal.
Sin embargo, cuando lo interrogó la defensa técnica, la declaración de Nombre04 fue evasiva y se mostró “contrario a las posibilidades que generaran duda de acuerdo a su tesis o perspectiva”, a pesar de que se le juramentó y debía decir verdad (cfr. a partir del contador 39:30). Esta cámara de apelación, a petición del impugnante, se dio a la tarea de revisar la deposición de Nombre04, la cual consta en el archivo digital 170008350573PE-29092020012854-2_Multi-1.wmv, y no evidencia, en modo alguno, que el testigo haya sido evasivo, o mostrara un afán injustificado por descartar la tesis defensiva. Tal y como lo sostiene el procurador penal, cuando se dio el interrogatorio por parte de la defensa pública (cfr. a partir del contador 34:22), se evidenció una técnica de interrogatorio deficiente, debido a que trataba de obtener información que ya el testigo había suministrado, al punto que no fue extraño que el juez le llamara en reiteradas veces la atención, advirtiéndole que no se trataba de que el testigo volviera a repetir lo depuesto (cfr. contador 38:00).
Fue en este contexto que la defensora pública volvió a preguntar temas que el testigo había hecho referencia en muchas ocasiones (sobre las armas de fuego que traían las personas que venían bajando de la montaña, sus calibres, y cuales decomisaron), lo que la llevó, incluso, a afirmar, dentro de su pregunta, que Nombre04 había indicado que las cuatro personas venían armas, lo cual motivó que el testigo le aclarara a la defensora que él no estuvo hablando de cuatro armas, que él había indicado, hasta ese momento, que vio bajando a cuatro personas armadas y que, como lo había referido el juez (cuando llamó la atención de la defensa sobre lo reiterado de su interrogatorio) se decomisaron tres, y no se ha hablado de una cuarta arma (cfr. a partir del contador 40:52). Esto fue lo que, precisamente, molestó a la defensora pública, quien calificó la actuación de Nombre04 como una reprimenda por la consulta que se le realizó.
Sin embargo, el juzgador, si bien llamó la atención al testigo, también aceptó que en ocasiones sabía que era “difícil o cansado” (sic) un interrogatorio como el que acaecía, en clara alusión a la reiteración de preguntas o lo capcioso de estas, empero, siempre le pidió que contestara cuántas armas observó y cuántas se decomisó, y así el deponente lo hizo (cfr. contador 43:45). Como se colige, el testigo con sus respuestas no trató de evadir su deber de suministrar información de calidad, ni mucho menos mostró animadversión hacia la tesis defensiva, sino que lo que hizo fue algo que se encuentra al amparo de su obligación de decir la verdad como testigo, y fue corregir a la defensora pública en su proceder, ya que intentaba preguntarle sobre la base de una manifestación que él no había manifestado previamente, como lo era si todos las personas que viajaban traían un arma de fuego. Sumado a esto, no puede obviarse que el testigo, finalmente, aclaró lo consultado, y dijo que sí vio a las cuatro personas con armas de fuego y que si bien no pudo ver el calibre de aquella que nunca se decomisó, sí podía asegurar que era una larga de tipo cacería.
Con excepción a este, no existió ningún otro conflicto entre el testigo y la defensora pública, por lo que el argumento de que el testigo Nombre04 fue evasivo o mostró renuencia a contestar temas que beneficiaban la tesis de defensa, como un criterio de mendacidad, no resulta legítimo. Sumado a ello, se reclama en el fallo, como otro argumento para refutar su declaración como creíble, el que Nombre04 no interviniera al encartado Nombre01 cuando lo observó la primera vez, con un arma de fuego tipo carabina e ingresando a la zona boscosa donde habían encontrado los tapescos, a pesar de que conocer que ese era un lugar de cacería; él era un “inspector forestal” que debía actuar y prevenir cualquier daño ambiental; y que la distancia era “poca”. No obstante, nunca se explicó en la sentencia por qué 150 metros, que era la distancia que existía entre el sitio desde donde Nombre04 estaba realizando la vigilancia y el potrero donde caminaba el imputado, podía considerarse poca, como para que se le diera la orden de detención y se pudiera abordar al sindicado.
Obvió por completo considerar el a quo, que también el testigo fue muy claro en señalar que él hacía una vigilancia con binoculares a esa distancia; que la intención era no advertir a los cazadores sobre la presencia de inspectores del Parque Nacional Braulio Carrillo en la zona (al punto que se tuvo que ingresar al sitio en un vehículo particular); y que procuraban acreditar las acciones de cacería que suponían iban a darse. Sobre este aspecto, se reclama a Nombre04, que a pesar de que indicó ser un inspector del Sistema Nacional de Áreas de Conservación (lo cual no fue controvertido) actuó como policía represiva, es decir, que no evitó que Nombre01 ingresara a la zona de cacería, sino que realizó la vigilancia para intervenirlo con posterioridad, sea, cuando regresaba con la presa. No obstante, este argumento resulta ilegítimo, por cuanto desconoce que los inspectores de vida silvestre tienen autoridad de policía para coadyuvar a la aplicación y cumplimiento de la Ley Conservación de la Vida Silvestre, N˚ 7317, y dentro de sus atribuciones está el “…detener, transitar, entrar y practicar inspecciones, dentro de cualquier finca y embarcación, lo mismo que en las instalaciones industriales y comerciales involucradas, así́ como para decomisar los organismos, las partes, los productos y los derivados de vida silvestre, junto con el equipo utilizado en la comisión de un delito o actividad prohibida por esta ley.
En el caso de los domicilios privados se deberá́ contar con el permiso de la autoridad judicial competente o del propietario” (artículo 16 ibídem). Es decir, los inspectores de vida silvestre, como lo es Nombre04, tienen autoridad de policía y la facultad realizar investigaciones en torno a los delitos, contravenciones e infracciones administrativas que describe la Ley Conservación de la Vida Silvestre, entre estas el tipo penal que se investiga (artículo 93 inciso a ibid.). Consecuentemente, el que Nombre04 efectuara labores de vigilancia para determinar si el encartado, u otras personas, estaban realizando caza ilegal, no resulta contrario a sus funciones y, menos aún, un argumento válido para demeritar su testimonio. Un vicio no muy diferente se presentó en el fallo cuando se trató de establecer la falta de credibilidad en el testimonio de Nombre04, a partir de que este no quiso referir el nombre de las otras dos personas que huyeron cuando se aprehendió al encartado, a pesar de conocer sus nombres y estar obligado a decir la verdad.
El tribunal de instancia, argumenta que la actitud de Nombre04, al ocultar el nombre de estos individuos, es una que permite inferir que aquel estaba ocultando algo o trata de favorecer a estas personas, por cuanto su deber era comunicar ello al Ministerio Público (cfr. registro 48:04 del archivo de sentencia). No obstante, al examinar el testimonio de Nombre04, se tiene que aquel declaró, cuando la defensora pública le preguntó ¿quién llevaba el bolso con la presa?, en alusión al momento en que se aprehendió al encartado, que: “No le voy a decir nombres. Sé quien lo llevaba, pero no voy a decir nombres, porque en el momento, en el informe no está preciso el nombre de ninguna persona, solo el nombre de Nombre01 y de Nombre06, dentro de ese informe. Las otras personas sabemos quienes son, pero no están en el informe porque no los agarramos en el acto, ni hicimos las investigaciones bien, como para involucrarlos en los hechos” (cfr. registro del debate número 170008350573PE-29092020012854-2_Multi-1.wmv, en su contador 44:33).
Como se puede colegir, la negativa del testigo a dar los nombres de las personas que estima fueron las que huyeron, no se debió a un favorecimiento personal, o a que trataba de ocultar algo, como erradamente lo indica el juzgador de juicio, sino a que no los “agarraron en el acto”, es decir, en flagrancia, ni tampoco se hicieron las investigaciones adecuadamente para “involucrarlos en los hechos”. Esto, implícitamente, advertía que Nombre04 no quería decir los nombres de las personas que estimaba había participado, por carecer de indicios comprobados que los relacionaran con la comisión de un delito, lo que resulta una aplicación adecuada de las normas procesales, por cuanto ni siquiera podía considerarse aquellos como imputados (artículo 13 del Código Procesal Penal). Empero, si bien lo dicho ya es suficiente para advertir el error argumentativo del juez, no puede soslayarse que la defensa pública, quien era la que llevaba el interrogatorio en ese momento, aceptó como válida le negativa del testigo a dar esto nombres, al punto que le indicó que no se los dijera, y reformuló la pregunta para cuestionar si el sindicado era quién llevaba el bolso donde se encontró la presa, lo cual, sin reparo alguno, Nombre04 negó (cfr. contador 45:22).
Corolario, se descartaba que el testigo, con su negativa a decir los nombre de los individuos no identificados, haya tratado de perjudicar la tesis defensa, o de evadir alguna información que perjudicara al encartado, ya que, se insiste, cuando se le preguntó directamente sobre aspectos que podría pensarse restaban participación al encartado en los eventos investigados, aquel nunca dudo en referirlo. En síntesis, el vicio alegado por el quejoso, entorno la errada motivación del fallo en cuanto a falta de credibilidad en el testimonio de Nombre04, se evidencia y, como de seguido se expondrá, también afectó la determinación de los hechos y generó un agravio a los intereses que representa la Procuraduría General de la República. Así, dentro de los argumentos otorgados en sentencia, se indicó que no se puede arribar a una conclusión condenatoria, sino a un estado dubitativo, por cuanto: i) Si bien se observó al imputado dirigirse al sector de montaña donde estaban los tapescos, entre uno y otro lado hay un kilómetro de distancia, que apegado a las reglas de la experiencia, al ser una zona de montaña, con maleza y pendiente, debe considerarse “bastante distancia”.
No obstante, valga aclarar que Nombre04 depuso que, cuando ellos encontraron los tapescos -8 de noviembre de 2017-, a tres días de la aprehensión del justiciable, el decomiso de las armas de fuego y el hallazgo de una presa de vida silvestre cazada, lo que evidenciaron fue un “trillo” que se abría paso en la montaña hasta el sitio donde estaban estas estructuras, y que el único ingreso y salida era donde se estaba realizando la vigilancia (cfr. registro número 02:42). De ahí que, el tema de lo montañoso de la zona o las malezas, además de que no aumentan la distancia, como pareciera entenderlo el a quo, en nada afectaría la ejecución de los hechos, por cuanto existía un “trillo”, es decir, según las reglas de la experiencia, un camino rústico entre la maleza que permitiría el trayecto entre un punto y otro con mayor facilidad. De modo que, la distancia no representaría una circunstancia que imposibilitaría el hecho delictivo, o demeritaría la participación del encartado.
Sobre todo, partiendo de que entre el momento en que se vio ingresar al imputado al lugar (14:30 horas) y regresar (00:30 horas del día siguiente), pasaron poco más de diez horas, en la que una persona, aún en una zona como la que señaló Nombre04, podría ir y regresar luego de efectuar la cacería de un animal silvestre. Esto tiene relación con otro aspecto sobre el cual el tribunal de juicio estima se funda la duda de la participación del endilgado en los hechos acusados, y fue que no existe prueba que permita determinar que Nombre01 estaba en contubernio con su hermano Nombre06 y los otros dos sujetos, para cometer el hecho delictivo, o que estos se reunieran en el bosque para acechar y cazar al animal que, posteriormente, trasladaban hasta las afueras del lugar. Esto lo asienta el juzgador de juicio, a partir de que estima se desconoce cuándo se dio la caza del tepezcuintle (cuando se le disparó), por cuanto echa de menos que se le hiciera una pericia en ese sentido (cfr. marcador 55:20 del archivo de sentencia).
Este argumento lesiona el principio de libertad probatoria (artículo 182 del Código Procesal Penal), por cuanto el a quo, como si se tratara de prueba tasada, estima que la muerte del tepezcuintle solo se puede fijar a partir de una pericia, obviando por completo que este sistema de valoración de la prueba está ampliamente superado, y que ahora es admisible probar los hechos o las circunstancias por cualquier medio admisible y legítimo. En este caso, al demeritarse la declaración de Nombre04, se dejó de analizar que aquel dio varias pautas que integran las reglas de la experiencia, especialmente, la de caza de animales silvestres en dicha zona, entre estas, que los cazadores solo cazan de noche, debido a que requieren que los animales lleguen hasta los sitios de alimentación (árboles que dan frutos comestibles, como el de Cócora); que es ahí donde, subidos en los tapescos y aprovechándose de la oscuridad (por ello se aprovechan de los movimientos de luna que permitan mayor opacidad de la noche) encandilan con los focos a los animales y luego les disparan, para luego sacar a sus presas desde la zona boscosa.
Bajo este contexto, el cuestionamiento del tribunal de instancia, sobre que se desconoce si la presa fue capturada antes de que ingresara a la montaña Nombre01, tendría una respuesta negativa a partir de la deposición de Nombre04, por cuanto el sindicado ingresó en horas de la tarde, es decir, de día, para cuando los animales no andan en faenas de alimentación, no es factible sorprenderlos, ni encandilarlos, y, mucho menos, disparales por la alta probabilidad de que descubran a sus cazadores. Asimismo, no puede obviarse que se desacreditó en sentencia que Nombre01 se encontrara con los otros individuos dentro del bosque, entre estos, aquellos que venían con él y portaban el tepezcuintle muerto en un bolso, a partir de que no fue posible, como lo argüían el representante del Ministerio Público y la Procuraduría, tener por cierto que el bolso con el que se observó al imputado Nombre01 ingresar a la zona de cacería, luego lo portaba alguno de los individuos no identificados, por cuanto a Nombre01 se le detuvo con “un bolso”.
Sin embargo, este es otro ejemplo de que el juzgador de instancia, tal y como lo alega el recurrente, no efectuó una verdadera ponderación de la declaración de Nombre04. Basta con indicar que aquel, durante su declaración en juicio, refirió: “El animal estaba metido entre un bolso. Cuando estas personas se fueron nosotros los vimos, porque los teníamos a cinco metros, los vimos claramente. Una de las personas, que no dejó nada botado, llevaba casualmente el bolso que Nombre01 trepó. Exactamente el mismo bolso. Eso llevaba. El otro muchacho llevaba ese otro bolsito, que sí se lo vimos. Los teníamos a cuatro o cinco metros, con nosotros con cuatro focos buenos, de buena calidad, los alumbramos, y el bolso que llevaba la segunda persona que se dio a la fuga lo dejó tirado ahí no más, junto con una carabina”. En otras palabras, aunque no era el bolso donde estaba la presa, sí pudo acreditarse, según este deponente, que el endilgado había entregado su bolso a uno de los individuos que traía la presa y luego de que ingresó al bosque, por lo que resultaba un indicio más que se debió ponderar, armónicamente con la circunstancia de que todos los individuos venían juntos, estaban utilizando el trillo que llevaba hasta la zona de cacería; todos traían armas de fuego; un cuerpo de tepezcuintle que tenía orificios de arma de fuego; dentro de un bolso semillas o fruta del árbol de Cócora, que es alimento para dicha presa y que coincide con los frutos que vieron los inspectores en los tapescos construidos cerca de los árboles que utilizan como comederos los animales silvestres; y que el endilgado no era a cualquier hora que estaba en la zona, sino en una que es, por reglas de la experiencia, apta para la cacería.
Sin omitir que también llevaban focos, y que este es un instrumento apto para encandilar cuando se caza. Nada de esto fue analizado por el a quo, quien terminó por exigir prueba directa de la cacería, sin considerar que la prueba indiciaria también es un método admisible para probar hechos o circunstancias relevantes, conforme se desprende del principio de libertad probatoria. Así las cosas, al demostrarse los yerros en la fundamentación de la sentencia y la aplicación de las reglas de la sana crítica, en quebranto de los artículos 142 y 184 del Código Procesal Penal, procede declarar con lugar el recurso de apelación de sentencia que interpuso la Procuraduría General de la República, en su condición de querellante y actor civil, y decretar la ineficacia integral de la sentencia. Consecuentemente, se dispone el juicio de reenvío, para que el mismo tribunal, pero con diferente integración, procesa a resolver conforma a derecho.
POR TANTO:
Se declara con lugar el recurso de apelación de sentencia interpuesto por el por el licenciado Andrés Alfaro Ramírez, en su condición de Procurador Penal representante de la querella y acción civil resarcitoria interpuesta por el Estado de Rica. Consecuentemente, se decreta la ineficacia integral de la sentencia y se dispone el juicio de reenvío, para que el mismo tribunal, pero con diferente integración, procesa a resolver conforma a derecho.
