Appeal against a criminal judgment (recurso de apelación de sentencia penal) filed in the present proceeding against [Nombre1], an adult, born on veintiocho de marzo de mil novecientos sesenta y siete, holder of identity card number CED1 - -, for the offense of Invasion of a Conservation or Protection Area, to the detriment of Natural Resources. Judges Christian Fernández Mora and David Fallas Redondo, as well as Judge Ivette Carranza Cambronero, participated in deciding the appeal. Attorneys Walter Brenes Soto, as private defense counsel for the accused; Julián Martínez Madriz, representative of the Ministerio Público; and Manrique Ruíz Leal, representing the Procuraduría General de La República, entered appearances in the appeal.

Findings:

1. By judgment number 29-2021, issued at dieciséis horas cuarenta y ocho minutos del quince de enero de dos mil veintiuno, the Tribunal de Juicio de Cartago ruled: “THEREFORE: In accordance with the foregoing, Articles 39, 41, and 50 of the Constitución Política; Articles 1, 2, 7, 8, 10, and 21.1 of the Convención Americana sobre Derechos Humanos; Articles 1, 2, 3, 4, 11, 16, 18, 19, 20, 30, 31, 33, 34, 35, 42, 45, 50, 51, 57 bis, 59 through 63, 71, and 103 of the Código Penal; Articles 122, 123, 124, 125, and 126 of the Civil Liability Rules (Reglas de Responsabilidad Civil) of Title IV of Book I of the 1941 Código Penal, which remain in force; Articles 1, 3, 19, 33, 57, and 58(a) of Ley Forestal N° 7575; Articles 1, 2, 32, 52 bis, and 59 of Ley Orgánica del Ambiente N° 7554; Articles 1, 2, 5, and 7 through 11 of Ley de Biodiversidad N° 7788; Article 89 of Ley de Aguas N° 276 del 27 de agosto de 1942; Articles 1, 2, 3, 41, 42, and 44 of Ley de Uso, Manejo y Conservación de Suelos N° 7779; Article 1045 of the Código Civil; Articles 1 through 9, 15 through 18, 31 through 34, 42, 45, 100, 101, 111 through 124, 140, 142, 175 through 184, 204 through 224, 265 through 270, 320, 341 through 359, and 360 through 367 of the Código Procesal Penal; Articles 1 through 8, 20, 21, 22, 23, 35 through 40, 41 through 49, 50, 73, 74, 76, 146, 147, 149, 150, and 153 of the Código Procesal Civil, applied on a supplementary basis; and Decreto Ejecutivo N° 39078-JP, ‘Arancel de honorarios por servicios profesionales de abogacía y notariado (Honorarios de Abogados, Abogadas y Notarios),’ in force when the civil damages action (acción civil resarcitoria) was filed, in deciding this matter, this Court finds the accused, [Nombre1], criminally responsible as the perpetrator of the offense of Invasion of a Conservation or Protection Area, committed to the detriment of Natural Resources, and in that capacity sentences him to THREE MONTHS’ IMPRISONMENT, to be served in the manner and place established by the applicable prison regulations, with credit for any time spent in pretrial detention. Because it is appropriate and the statutory requirements for its application to the prison sentence have been met, the benefit of a suspended sentence (Condena de Ejecución Condicional) is granted for a period of three years from the date this judgment becomes final, subject to the following condition: 1) that he not commit a new intentional offense punishable by imprisonment for more than six months during the probationary period. The civil damages action brought against civil defendant [Nombre1] is partially granted. The civil defendant is ordered to pay the following amounts: ¢2 070 000.00 (two million seventy thousand colones) for environmental damage (daño ambiental). He is ordered to pay attorney’s fees and costs (costas personales), assessed at ¢414 000.00 (four hundred fourteen thousand colones), for a total of ¢2 484 000.00 (two million four hundred eighty-four thousand colones); these amounts must be paid by deposit in this proceeding through the Sistema de Depósitos Judiciales within a maximum period of fifteen days after this judgment becomes final. Because it is not appropriate, restoration of the property to its condition before the offense is not ordered; instead, the civil defendant is ordered to perform the following actions: 1) Physically demarcate the protection area (área de protección) of [Dirección1] adjoining the property recorded in the Registro Público under registration number CED2 of the Partido de Cartago. 2) Carry out an environmental restoration process (proceso de restauración ambiental), as directed by the Administración Forestal del Estado, in the protection area of Quebrada Pato Azul adjoining the property recorded in the Registro Público under registration number CED2 of the Partido de Cartago, coordinating with that State entity regarding the proper treatment of that area. Certified copies of the relevant records (testimonio de piezas) shall be sent to the Ministerio Público regarding the members of the Tribunal Ambiental Administrativo and the officials of the Municipalidad de la Unión de Cartago because possible offenses of breach of official duties (incumplimiento de deberes), influence peddling (tráfico de influencias), and personal favoritism (favorecimiento personal) have been detected. Once the judgment becomes final, it shall be entered in the Registro Judicial, and the customary certified copies shall be sent to the Juzgado de Ejecución de la Pena, the competent body of the Ministerio de Ambiente y Energía, and the Instituto Nacional de Criminología for effective enforcement. 2. Attorney Walter Brenes Soto filed an appeal against the foregoing ruling.

3. After the corresponding deliberation was conducted in accordance with Article 466 of the Código Procesal Penal, as amended by Ley 8837, published on nueve de diciembre de dos mil once (Creación de Recurso de Apelación de la Sentencia), the Court considered the issues raised in the appeal.

4. The relevant statutory requirements have been observed throughout the proceedings.

Whereas:

I.Because it meets the statutory requirements, the appeal filed by [Nombre3], in his capacity as private defense counsel for the accused, [Nombre1], is admitted for consideration on the merits, since review of the case record shows that the appeal was timely filed within the statutory period and in accordance with the prerequisites for the proper consideration and resolution of the objections raised by the appellant, pursuant to the comprehensive review of the judgment required by Article 8,2 of the Convención Americana sobre Derechos Humanos.

II.Regarding the evidence offered: In his notice of appeal, the appellant offers as new evidence a set of photographs of the building constructed in the area that the accused is alleged to have invaded, for the purpose of demonstrating that the civil judgment entered against the accused would deprive him of free access to his property by requiring him to demarcate the area and plant new species. He emphasizes that the evidence is new because the order issued by the Court makes it necessary to demonstrate, by means of photographs, the sole entrance to the accused’s property. The evidence is rejected: Article 464 of the Código Procesal Penal provides: “The Court shall accept as new evidence only evidence that was timely offered but arbitrarily rejected, evidence that first emerges after the judgment, and evidence that, although it previously existed, the interested party had no effective opportunity to offer at the proper time.” The appellant’s arguments do not show that any of the circumstances established by the legislature for admitting new evidence at the appellate stage are present, since his sole argument for offering the photographs in question is that the Court’s decision requiring the accused to demarcate the protection area and plant new natural species there will prevent him from accessing his property.

He does not demonstrate that, before the judgment was issued, he had no opportunity to offer those photographs; that the Court arbitrarily rejected such an offer; or that the evidence emerged after the judgment. On the contrary, the accused has had the opportunity to offer those photographs since he constructed the dwelling; accordingly, there is no reason to admit that evidence at a stage intended to review the legality of the judgment rendered, rather than at a plenary stage in which the evidence presented in the adversarial proceedings is produced anew. Because the statutory circumstances for admitting new evidence during an appeal from a judgment are not present, the evidence offered by the appellant must be rejected.

III.The appellant expresses his disagreement with the civil judgment entered, citing two grounds: first, the lack of reasoning and the erroneous application of civil and environmental procedural law, due to the failure to assess the particular circumstances of the witnesses and the documentary evidence. Second, the lack of reasoning and erroneous assessment of the evidence concerning the civil judgment against the accused, because the evidence presented at trial was not evaluated, even though the witnesses’ accounts made clear that an estimate of the environmental damage could not be corroborated. He then explains the scope of the challenged judgment and contends that the essential grounds for the civil judgment were not established in the adversarial proceedings (contradictorio), because, under Article 317 of the former Code of Civil Procedure and Article 49 of the current Code of Civil Procedure, the burden of proof is reversed and the Procuraduría General de la República, as the civil plaintiff (actor civil), is responsible for proving all of its claims; therefore, the court could neither replicate nor conflate the criminal conviction with the civil action.

The Procuraduría General de la República had a duty to establish the causal relationship between the harm to the environment and the conduct at issue, which it failed to prove through documentary and testimonial evidence. None of the witnesses, Julio Gómez Gómez, [Nombre5], and [Nombre6], was able to estimate or establish with certainty the environmental damage caused by the accused; therefore, the court cannot state that this evidence formed the basis for the judgment against the civil defendant (demandado civil), when no quantification of the damage was submitted during the adversarial proceedings. At trial, those witnesses merely stated that the civil defendant had built the retaining wall at [Dirección2] without the required municipal permits, without specifically, directly, and unequivocally stating or affirming that, through that action, the accused had caused the environmental damage for which compensation was sought.

The court stated that SINAC report OSC-1101-2016 provided guidance for determining aspects of the rehabilitation of the encroached-upon area, but that it was not a comprehensive study quantifying the environmental damage. Likewise, that study concerns only the restoration of the segment affected by the accused’s conduct and is not a comprehensive environmental-damage study; therefore, the judge acted disproportionately by ordering an amount that constitutes unjust enrichment for the civil plaintiff. At no time was it established that the civil defendant had caused environmental or ecological damage in the area. The only fact established was that he had built without the required municipal permits, but not that, as a result, significant harm had been caused to resources, air, water, and plant life, or that this had destroyed the habitat and adversely affected the natural balance of the area, as alleged in the civil damages action (acción civil resarcitoria) for which compensation was sought.

He contends that there was no evidence establishing the civil liability of the defendant. He challenges the fact that, in addition to ordering his client to pay the stated amount for environmental damage that was never proven, the court decided to physically demarcate the protection area and carry out a restoration process, thereby assigning his client responsibility for performing work and incurring additional expenses that are the exclusive responsibility of the State. He maintains that his client’s testimony did not show intentional conduct and that the court seeks to portray the accused as having built a retaining wall while knowing that he was encroaching upon the protection area. During that same testimony, however, he was asked whether he knew of the restrictions and was shown the plans for his property, and he stated that he had been completely unaware of those restrictions and of how many meters had been encroached upon; therefore, the court misinterpreted the accused’s words.

He maintains that the court failed to consider that the prerequisites for the existence of the damage alleged by the Procuraduría had not been sufficiently established to warrant judgment, resulting in a violation of the accused’s rights in these proceedings, because no ecological damage within the meaning of Article 57 of the Ley Forestal and Article 1045 of the Civil Code was proven. According to the appellant, compliance with the challenged judgment would deprive the accused of unrestricted access to his property, a right protected by Article 45 of the Political Constitution, because he would have no access space through which to enter using his means of transportation. He requests that the appeal be granted, that the civil damages action be denied, and that Mr. [Nombre1] be absolved of civil liability. The appeal is granted: A review of the challenged judgment confirms the deficiencies in reasoning alleged by the appellant, which prevent the civil judgment entered in this case from being deemed legitimate.

In this regard, the principal error in the judgment consists of holding that, because the accused’s criminal liability for the offense of encroaching upon a protection area was established, the environmental damage and social harm claimed by the State’s representative were also proven, even though the requirements for establishing civil liability arising from a criminal offense, while premised on the offense’s existence, are not identical to those required to establish the completion of the criminal conduct. In other words, it is entirely possible for conduct that is statutorily defined, unlawful, and culpable to give rise to no civil liability because the requirements for such liability are absent, as would be the case where there is no damage or where no causal nexus (nexo de imputación) for that damage can be established. Accordingly, in this case, it was essential for the court to explain why the accused’s conduct in encroaching upon the protection area of the quebrada Pato Azul had caused environmental damage for which the State could receive monetary compensation.

However, far from complying with its legal obligation to explain the basis for concluding that such damage existed, the judgment takes its existence for granted, stating: “The documentary evidence clearly establishes that the property belonged to the civil defendant, but the core basis for the civil judgment is the existence of environmental damage, regarding which the plaintiff submitted suitable evidence to prove that claim. The civil defendant fails on this point and does not present evidence capable of breaking the causal nexus in order to establish his claim. It should be borne in mind that the evidence submitted by the civil defendant, as will be discussed below, seeks to establish that no environmental damage occurred and that construction of the wall within the protection area of the quebrada Pato Azul was technically and scientifically sound; however, an examination of the defendant’s testimony does not support that position and, consequently, based on the testimony of the civil defendant [Nombre1], the Court must rule in favor of granting the judgment as to some of the relief sought by the State.” It is true that the judgment refers to the conclusions the court drew from each item of evidence concerning the criminal charge, but it does not establish in any way how the statements of the various witnesses and the documents analyzed support the existence of the environmental damage attributed to the civil defendant by the State’s representative.

This becomes evident when the judge refers to report number OSC-1101-2016, issued by the Sistema Nacional de Áreas de Conservación, which contains a “…proposal for restoration of the Environmental Damage” in the protection area of the quebrada Pato Azul where it crosses the property of the accused, [Nombre1], but which the trial judge dismisses, stating: “This document merely guides us regarding how to develop the appropriate measures for rehabilitating the encroached-upon area, but it is not a comprehensive study providing a quantification of the environmental damage.” Most seriously, when analyzing the testimony of Julio Gómez Gómez, one of the individuals who prepared the technical report on which the civil plaintiff relied to support the claimed environmental damage and social harm, the court merely refers to the matters addressed by that witness concerning the existence of the offense of encroachment upon the protection area, rather than the alleged damage.

This is evident from the judgment, in which the court states: “The questions asked of Gómez Gómez establish that he holds a university degree in natural resource management from the Universidad Estatal a Distancia and has more than eleven years of experience at MINAE in the oversight and protection of natural resources, which establishes that the witness possesses sufficient qualifications for his statements concerning environmental matters and their management to be accepted as true. In his testimony, Gómez Gómez provides a fully transparent and precise account of the report submitted to the Court, because, when he appeared to testify, he explained when the event occurred and how MINAE in Cartago received the information, providing specific details identifying the encroachment upon the protection area that has been presented at trial and is the subject of this judgment. The details he provides are those of a person with command of the subject matter and, with reference to the case tried, he explains how they managed to enter the property where the wall encroaching upon the protection area of the quebrada Pato Azul was being built, as well as the coordination undertaken by him and his colleague [Nombre5] to notify the Tribunal Ambiental Administrativo and the Fiscalía de la Unión.

This witness is highly valuable and vitally important for understanding, from the standpoint of environmental-protection techniques, why the wall built by the civil defendant [Nombre1] was within the protection area of the quebrada Pato Azul.” The same occurs with the analysis of the testimony of [Nombre5], who accompanied the aforementioned witness during inspections of the site and who, as an official of the Sistema Nacional de Áreas de Conservación, possessed the technical expertise to address the environmental damage. Once again, the court referred only to matters related to proof of the charged offense and not to the alleged damage, as is evident when it states: “The Court considers [Nombre5] to be highly credible because his statements corroborate the matters separately reported by both the accused and the witness Gómez Gómez, including significant details such as his explanation of the property’s location, the manner in which the structure encroaching upon the protection area was built, and the visit in 2019 prompted by the preliminary hearing.” The defect in question is so evident that, because the evidentiary material submitted by the parties regarding the accused’s potential civil liability was not analyzed, the trial judge had to decide the case on the basis of his personal knowledge, departing from the existing technical opinion used to determine the amount of compensation for the damage contained in the aforementioned report number OSC-1101-2016, issued by the Sistema Nacional de Áreas de Conservación, and instead made an equitable assessment (valoración prudencial), which the law reserves for cases in which the amount of compensation cannot be determined by experts (Articles 124 and 125 of the current Rules on Civil Liability under the 1941 Criminal Code).

Thus, the trial judge stated in the judgment: “The Court finds that the evidence provided by the MINAE report does not contribute, in the historical reconstruction of the event, support for a specific amount of environmental damage; however, the foregoing regarding the need to decide this case through a combined assessment of the evidence leads unequivocally to the conclusion that the event occurred as narrated in the civil actions and that the amount stated by the civil plaintiff in its closing arguments and final specification of claims at the conclusion of the trial must be measured proportionately and reasonably, so that the amount is appropriate and fair” (Thus in the original). As can be seen, the court below (a quo) never explained how it reached the conclusion that the proven criminal conduct caused environmental and social damage of the kind alleged by the Procuraduría General de la República; rather, it simply assumed that such damage existed because the proven offense was environmental in nature, thereby failing to fulfill its legal duty to provide adequate grounds for the civil judgment against the accused, as required by Article 142 of the Código Procesal Penal.

Accordingly, the appeal filed must be granted and the judgment declared partially ineffective, solely with respect to the civil judgment entered against the accused [Nombre1] . Because the obligations imposed in the judgment concerning the demarcation of the protected area (área de protección) of the [Dirección3] stream and the implementation of the environmental restoration process (proceso de restauración ambiental) for that protected area are matters related to the resolution of the civil portion of the judgment, they must likewise be declared ineffective so that they may be adjudicated in the remand trial (juicio de reenvío) hereby ordered before a differently constituted panel of the same court, in observance of the prohibition against reformation to the appellant’s detriment (principio de no reforma en perjuicio), since only the accused, in his capacity as civil defendant, appealed, as provided in Articles 447 of the Código Procesal Penal and 65.6 of the Código Procesal Civil.

THEREFORE

The appeal filed by private defense counsel for the accused is granted; the judgment is declared partially ineffective solely with respect to the civil judgment entered against the accused [Nombre1] and the civil obligations imposed on the defendant in the judgment. A retrial is ordered before a differently constituted panel of the same court to rehear the challenged civil matters, in observance of the principle prohibiting modification to the appellant’s detriment (principio de no reforma en perjuicio), since only the accused, in his capacity as civil defendant (demandado civil), filed an appeal.

Documento PJEDITOR 1 Contra: [Nombre1] Delito: Invasión en un Área de Conservación o Protección Parte ofendida: Los Recursos Naturales Res: 2021-204 Tribunal de Apelación de Sentencia Penal de Cartago, sección Primera. A las once horas seis minutos del nueve de abril de dos mil veintiuno.

Recurso de apelación de sentencia penal interpuesto en la presente causa seguida contra [Nombre1] , mayor, nacido el veintiocho de marzo de mil novecientos sesenta y siete, con cédula de identidad número CED1 - - , por el delito de Invasión en un Área de Conservación o Protección, en perjuicio de Los Recursos Naturales. Intervienen en la decisión del recurso los jueces Christian Fernández Mora y David Fallas Redondo, así como, la jueza Ivette Carranza Cambronero. Se apersonaron en apelación los licenciados Walter Brenes Soto, en calidad de defensor particular del imputado; Julián Martínez Madriz, representante del Ministerio Público; y Manrique Ruíz Leal, en representación de la Procuraduría General de La República.

Resultando:

1. Que mediante sentencia número 29-2021 de las dieciséis horas cuarenta y ocho minutos del quince de enero de dos mil veintiuno, el Tribunal de Juicio de Cartago, resolvió: "POR TANTO: De conformidad con lo expuesto, artículos 39, 41 y 50 de la Constitución Política, artículos 1, 2, 7, 8, 10, 21.1 de la Convención Americana sobre Derechos Humanos, artículos 1, 2, 3, 4, 11, 16, 18, 19, 20, 30, 31, 33, 34, 35, 42, 45, 50, 51, 57 bis, 59 a 63, 71 y 103 del Código Penal, articulo 122, 123, 124, 125 y 126 de las Reglas de Responsabilidad Civil del Titulo IV del Libro I del Código Penal de 1941 vigentes, articulo 1, 3, 19, 33, 57, 58 inciso a) de la Ley Forestal N° 7575, artículo 1, 2, 32, 52 bis y 59 de la Ley Orgánica del Ambiente N° 7554, artículo 1, 2, 5, 7 a 11 de la Ley de Biodiversidad N° 7788, artículo 89 de la Ley de Aguas N° 276 del 27 de agosto de 1942, articulo 1, 2, 3, 41, 42, 44 de la Ley de Uso, Manejo y Conservación de Suelos N° 7779, artículo 1045 del Código Civil , artículos 1 a 9, 15 a 18, 31 a 34, 42, 45, 100, 101, 111 a 124, 140, 142, 175 a 184, 204 a 224, 265 a 270, 320, 341 a 359 y 360 a 367 del Código Procesal Penal, articulo 1 a 8, 20, 21, 22, 23, 35 a 40, 41 a 49, 50, 73, 74, 76, 146, 147, 149, 150, 153 del Código Procesal Civil aplicado de modo supletorio, Decreto Ejecutivo N° 39078-JP, “Arancel de honorarios por servicios profesionales de abogacía y notariado (Honorarios de Abogados, Abogadas y Notarios)” vigente al momento de la presentación de la acción civil resarcitoria, al resolver este asunto, este Tribunal, declara al imputado [Nombre1] autor responsable de un delito de Invasión de un área de conservación o protección, cometido en perjuicio de los Recursos Naturales, y en tal carácter se le impone la pena de TRES MESES DE PRISION, la cual deberá descontar en la forma y lugar que indiquen los respectivos reglamentos penitenciarios, previo abono de la preventiva que hubieren sufrido. Por ser procedente y cumplir con los requisitos de ley para su aplicación en la pena de prisión, se otorga el beneficio de Condena de Ejecución Condicional por el plazo de tres años, a partir de la firmeza de este fallo bajo las siguientes condiciones: 1) el no cometer nuevo delito doloso sancionado con prisión mayor de seis meses, durante el período de prueba. Se declara parcialmente con lugar la acción civil resarcitoria incoada contra el demando civil [Nombre1] . Se condena al demando civil al pago de las siguientes sumas: por concepto de daño ambiental un monto de ¢2 070 000.00 (dos millones setenta mil colones). Se condena al pago de las costas personales que se tasan en la suma de ¢414 000.00 (cuatrocientos catorce mil colones) para un total de ¢2 484 000.00 (dos millones cuatrocientos ochenta y cuatro mil colones); montos que deberá de cancelar mediante deposito en este proceso dentro del Sistema de Depósitos Judiciales en el plazo máximo de quince días después de la firmeza de este fallo. Por no tener procedente, no se ordena la restitución de las cosas al estado anterior al delito y en su lugar se condena al demandado civil a ejecutar la siguiente conducta: 1) Limitar físicamente el área de protección de la [Dirección1] dentro que colinda la propiedad inscrita en el Registro Público matricula CED2 del Partido de Cartago. 2) Ejecutar un proceso de restauración ambiental conforme lo disponga la Administración Forestal del Estado en el área de protección de la Quebrada Pato Azul dentro que colinda la propiedad inscrita en el Registro Público matrícula CED2 del Partido de Cartago, debiendo coordinar con dicha entidad del Estado el abordaje correcto de dicha área. Se ordena el testimonio de piezas para ante el Ministerio Público en contra de los integrantes del Tribunal Ambiental Administrativo y los funcionarios de la Municipalidad de la Unión de Cartago por detectarse posibles delitos de incumplimiento de deberes, tráfico de influencias y favorecimiento personal. Una vez firme la sentencia inscríbase en el Registro Judicial y envíense los testimonios de estilo para ante el Juzgado de Ejecución de la Pena, y al órgano competente del Ministerio de Ambiente y Energía y el Instituto Nacional de Criminología para su efectiva aplicación. NOTIFIQUESE. Msc. Andrés Olsen Villegas, [Nombre2] de Juicio." (sic)

2. Que contra el anterior pronunciamiento, el licenciado Walter Brenes Soto interpuso el recurso de apelación.

3. Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 466 del Código Procesal Penal, reformado por Ley 8837 publicada el nueve de diciembre de dos mil once (Creación de Recurso de Apelación de la Sentencia), el Tribunal se planteó las cuestiones formuladas en el recurso.

4. Que en los procedimientos se han observado las prescripciones legales pertinentes.

Redacta el [Nombre2] Fernández Mora, y;

Considerando:

I.Por cumplir con los requisitos legales, se admite para su estudio de fondo el recurso incoado por [Nombre3] , en su condición de defensor particular del imputado [Nombre1] , pues del estudio del sumario se colige que dicho recurso se presentó en tiempo, conforme al plazo de ley, y de acuerdo a los presupuestos que se requieren para el adecuado y correcto conocimiento de las inconformidades planteadas por el recurrente, en atención al examen integral de la sentencia, ordenado por el artículo 8,2 de la Convención Americana sobre Derechos Humanos.

II.Sobre la prueba ofrecida: En su escrito de interposición, el recurrente ofrece como prueba nueva, un conjunto de fotos del inmueble construido en la zona atribuida como invadida por el imputado, con el fin de demostrar que con la condena civil dictada se le privaría al imputado el libre acceso a su propiedad al obligársele al delimitar y sembrar nuevas especies. Enfatiza que la novedad de la prueba se debe a que la orden dictada por el tribunal obliga a que se tenga que demostrar, por medio de fotografías, la única entrada de la propiedad del imputado. La prueba se rechaza: El artículo 464 del Código Procesal Penal establece que: “El tribunal aceptará como nueva solo la prueba ofrecida en su oportunidad pero que sea arbitrariamente rechazada, la que aparezca como novedosa con posterioridad a la sentencia y aquella que, aunque existiendo previamente, no estuvo en posibilidad efectiva de ser ofrecida por el interesado en su momento”.

De la exposición realizada por el recurrente, no se observa que se esté en ninguno de los supuestos previstos por el legislador para admitir prueba nueva en fase de impugnación, pues el único argumento que utiliza para el ofrecimiento de las fotografías en cuestión, consiste en que la decisión del tribunal de obligar al imputado a delimitar la zona de protección y sembrar nuevas especies naturales en el lugar, le impedirá acceder a su propiedad, sin que demuestre que antes del dictado de la sentencia no estuvo en posibilidad de ofrecer esas fotografías; que el tribunal le hubiese rechazado arbitrariamente dicho ofrecimiento; o bien, que se trate de un elemento de prueba que haya surgido con posterioridad a la sentencia. Por el contrario, la posibilidad de ofrecer dichas fotografías han estado a disposición del imputado desde que construyó la vivienda, razón por la que no existe razón para admitir dichos elementos probatorios en una fase que lo que pretende es analizar la legalidad del fallo dictado y no una etapa plenaria en la que se produzca nuevamente la prueba recibida en el contradictorio. Al no encontrarnos ante los supuestos de ley para admitir prueba nueva en fase de apelación de sentencia, procede el rechazo de la prueba ofrecida por el recurrente.

III.El recurrente manifiesta su inconformidad con la condena civil dictada, señalando dos motivos para ello: el primero, por la falta de fundamentación y errónea aplicación de la lay procesal civil y ambiental, al no valorarse las circunstancias particulares de los testigos y de la prueba documental. El segundo motivo, por la falta de fundamentación y errónea valoración de la prueba en cuanto a la condena civil del imputado, al omitir valorarse los elementos de prueba que se ventilaron en el debate, porque de lo relatado por los testigos quedó claro que no se podía corroborar una estimación del daño ambiental. Seguidamente, expone los alcances del fallo impugnado y considera que en el contradictorio no se dieron los medios fundamentales para la condena civil, debido a que, según el artículo 317 del antiguo Código Procesal Civil y el 49 del Código Procesal Civil vigente, la carga de la prueba se invierte y le corresponde a la Procuraduría General de la República, como actor civil, probar la totalidad de sus pretensiones, por lo que el tribunal no podía copiar ni confundir la condena penal con la acción civil.

La Procuraduría General de la República tenía el deber de demostrar la causalidad de las lesiones al ambiente, lo que no logró acreditar mediante la prueba documental y testimonial. Ninguno de los testigos, Julio Gómez Gómez, [Nombre5] y [Nombre6] , pudo estimar ni demostrar con certeza el daño ambiental ocasionado por el imputado, razón por la que el tribunal no puede decir que con esta prueba es que se condenó al demandado civil, cuando no existió una cuantificación del daño presentada dentro del contradictorio. Esos testigos se limitaron a decir en el debate que el demandado civil construyó, sin los permisos municipales respectivos, el muro de contención en la [Dirección2] , sin mencionar o asegurar de manera concreta, directa y contundente, que mediante dicha acción el imputado produjo el daño ambiental que se pretendía resarcir. El tribunal indicó que el informe OSC-1101-2016 del SINAC, orientó la determinación de los aspectos de la rehabilitación de la zona invadida, pero no es un estudio pleno para cuantificar el daño ambiental.

Asimismo, ese estudio es solo para la restauración del segmento afectado por el comportamiento del imputado, pero no es un estudio pleno del daño ambiental, por lo que el juzgador es desproporcional al disponer un monto que implica un enriquecimiento sin causa para el actor civil. En ningún momento se tuvo por acreditado que el demandado civil hubiera generado un daño ambiental o ecológico en la zona, lo único que se tuvo por cierto fue que construyó sin los permisos municipales requeridos, pero no que, como consecuencia de ello, se hubiera generado una afectación significativa a los recursos, aire, agua y flora, y que esto hubiese producido una destrucción del hábitat, influyendo negativamente en el equilibro natural de la zona, conforme se definió en el escrito de acción civil resarcitoria respecto del cual se pretendía una indemnización. Considera que no existía prueba para establecer la responsabilidad civil del demandado.

Cuestiona que aparte de condenar a su representado por el monto indicado por daño ambiental que nunca fue probado, el tribunal decidió limitar físicamente el área de protección y ejecutar un proceso de restauración, con lo que se le está delegando a su representado ejecutar e incurrir en más gastos que le corresponden exclusivamente al Estado. Sostiene que de la declaración de su representado no se desprendía un actuar doloso y el tribunal pretende hacer ver que el imputado, a sabiendas de que estaba invadiendo la zona de protección, hizo un muro de retención; pero durante la misma declaración se le interrogó si conocía las limitaciones, mostrándole los planos de su propiedad y alegó que desconocía totalmente de dichas limitaciones y de los metros invadidos, por lo que el tribunal malinterpretó las palabras del imputado. Sostiene que el tribunal no tomó en cuenta que no se dieron los presupuestos suficientes para la existencia del daño que se alegó por parte de la Procuraduría para proceder con la condena, lo que resulta en una violación de los derechos del imputado en este proceso, pues no se demostró que haya existido un daño ecológico establecido por el artículo 57 de la Ley Forestal y el artículo 1045 del Código Civil.

Para el recurrente, si se cumpliera lo dispuesto por la sentencia impugnada, se le privaría al imputado de la libre entrada a su propiedad, derecho tutelado por la Constitución Política en el artículo 45, puesto que no tendría espacio hacia la entrada para poder ingresar con sus medios de transporte. Solicita que se declare con lugar el recurso, se declare sin lugar la acción civil resarcitoria y se absuelva al señor [Nombre1] de la condena civil. El recurso se declara con lugar: De la lectura del fallo impugnado es posible observar que se corroboran los vicios de fundamentación que alega el recurrente, que impiden que pueda dársele legitimidad a la condena civil impuesta en este caso. Sobre el particular, el principal yerro de la sentencia consiste en establecer que como se determinó la responsabilidad penal de imputado por el delito de infracción a una zona de protección también quedó acreditado el daño ambiental y el daño social reclamado por la representación del Estado, cuando los presupuestos para la acreditación de la responsabilidad civil derivada del hecho punible, aunque parten de su existencia, no son idénticos a los de consumación de la conducta delictiva.

En otras palabras, es perfectamente posible que un hecho típico, antijurídico y culpable no genere responsabilidad civil alguna, por faltar los presupuestos para su configuración, como lo sería la inexistencia del daño, o la imposibilidad de establecer un nexo de imputación de dicho daño. Es por ello que, en este caso, resultaba imprescindible que el tribunal explicara por qué la conducta del imputado de invadir la zona de protección de la quebrada Pato Azul había generado un daño ambiental que era resarcible económicamente para el Estado. Sin embargo, lejos de cumplir con la obligación legal de fundamentar por qué se llegó a la conclusión de la existencia del mencionado daño, en la sentencia se da por sentado, afirmándose: “Con la prueba documental se deriva evidentemente que el fundo era propiedad del demandado civil, pero el núcleo que permite la condena civil es la existencia del daño ambiental, el cual el actor aporta prueba idónea para acreditar esa pretensión, el demandado civil falla en este punto y no presenta elementos que permitan eliminar el nexo de causalidad para lograr acreditar su pretensión.

Téngase presente que la prueba aportada por el demandado civil, como se dirá más adelante, pretende logra (sic) acreditar que el daño ambiental no se da, y que la construcción del muro dentro del área de protección de la quebrada Pato Azul era técnica y científicamente correcta; pero con el estudio de la declaración de la parte demandada, ello no se logra sostener y por consecuencia, el Tribunal, con la declaración del demandado civil [Nombre1] , se tiene que decantar por disponer la condena en parte de los extremos pretendidos por el Estado”. Es cierto que en la sentencia se hace referencia a lo que el tribunal concluyó de cada elemento de prueba en relación con la imputación penal, pero de ninguna forma establece cómo lo dicho por los diferentes testigos y documentos que analiza permiten establecer la existencia de el daño ambiental que le atribuyó la representación estatal al demandado civil.

Lo anterior se hace patente cuando el juzgador se refiere al Informe número OSC-1101-2016, emitido por el Sistema Nacional de Áreas de Conservación, en el que se realiza una “…propuesta de restauración del Daño Ambiental” en el área de protección de la quebrada Pato Azul a su paso por la propiedad del imputado [Nombre1] , pero que el juzgador de mérito desdeña, señalando que: “Este documento solo nos orienta para los aspectos de cómo desarrollar los elementos propicios de rehabilitación de la zona invadida, pero no es un estudio pleno para dar una cuantificación del daño ambiental”. Lo más grave del asunto es que al analizar el testimonio del señor Julio Gómez Gómez, quien fue una de las personas que realizó el informe técnico en el que el actor civil respaldó la existencia del daño ambiental y social reclamado, el tribunal simplemente hace referencia a los aspectos expresados por ese testigo en relación con la existencia del delito de invasión a la zona de protección, pero no respecto al alegado daño, lo cual se evidencia en la sentencia cuando el tribunal indica: “Con las preguntas realizadas a Gómez Gómez, se determina que éste es licenciado en manejo de recursos naturales por la Universidad Estatal a Distancia y posee experiencia por más de once en el MINAE en lo que es control y protección de los recursos naturales, lo que permite determinar que el declarante posee la cualidad suficiente para poder tener por cierto en todo lo que atañe al tema medioambiental y su manejo.

Gómez Gómez da una precisión del reporte entregado al Tribunal en su declaración con una transparencia total, pues éste al ser presentado a rendir declaración, expone la época donde se da el hecho y la manera que llega a ellos, en el MINAE de Cartago, la información con detalles singulares para ubicar la invasión del área de protección que se ha traído a debate y es objeto de la presente sentencia. Los detalles que aporta son de una persona que domina el tema, y en referencia al caso sometido a debate, éste expone como logran ingresar al fundo donde se construía el muro que invadía la zona de protección de la quebrada Pato Azul, así́ como las coordinaciones realizadas por éste y su compañero [Nombre5] para informa al Tribunal Ambiental Administrativo y a la Fiscalía de la Unión. Este testigo es de gran valor y de vital importancia para comprender, desde el punto de vista de la técnica de protección medioambiental, porque el muro que construye el demandado civil [Nombre1] estaba dentro del área de protección de la quebrada Pato Azul”.

Igual sucede en relación con el análisis del testimonio del señor [Nombre5] , quien acompañó al testigo mencionado a realizar inspecciones en el sitio y quien, como funcionario del Sistema Nacional de Áreas de Conservación tenía las competencias técnicas para referirse a dicho daño ambiental, pues nuevamente el tribunal solo hizo referencia a los aspectos relacionados con la acreditación del delito atribuido y no en cuanto al tema del daño alegado, lo cual se evidencia cuando señala: “El Tribunal considera a [Nombre5] una persona con gran credibilidad, pues de sus manifestaciones, se ratifican los elementos que tanto el imputado como el testigo Gómez Gómez han reportado de manera separada, con el detalle de relevancia como lo es la explicación que da sobre la ubicación del inmueble, la manera que construye la edificación que invade el área de protección y la visita en el 2019 motivada por la audiencia preliminar”.

El vicio en cuestión es tan evidente, que debido a la ausencia de análisis del material probatorio que fue suministrado por las partes para referirse a la eventual responsabilidad civil del imputado, el juzgador de mérito debió resolver el caso de acuerdo con sus conocimientos personales, llegando a apartarse del criterio técnico existente para la determinación del monto correspondiente a la indemnización del daño que constaba en el referido informe número OSC-1101-2016, emitido por el Sistema Nacional de Áreas de Conservación, y realizó una valoración prudencial, reservada por la ley para aquellos supuestos donde no sea posible determinar el monto de la indemnización por medio de peritos (artículos 124 y 125 de las Reglas vigentes sobre responsabilidad civil del Código Penal de 1941). Es así como el juzgador indicó en la sentencia: “El Tribunal estima que los elementos portados por el informe del MINAE no llegan a aportar en la reconstrucción histórica del hecho sustento a un monto determinado de daño ambiental, pero lo indicado sobre la necesidad de resolver este caso por medio del estudio concatenado de la prueba, deriva inequívocamente en que el evento se da como esta narrado en las acciones civiles y se debe de medir de modo proporcional y razonable el monto que nos informa el actor civil en sus conclusiones y la concreción de pretensiones al final del debate, para que el monto sea el adecuado y justo” (Así en el original).

Como se observa, el a quo nunca justificó cómo llegó a la conclusión de que la conducta delictiva acreditada generó un daño ambiental y social como el alegado por la Procuraduría General de la República, sino que simplemente partió de su existencia porque el delito acreditado era de tipo ambiental, con lo que omitió su deber legal de fundamentar adecuadamente la condena civil del imputado, tal como lo dispone el artículo 142 del Código Procesal Penal, razón por la que debe declararse con lugar el recurso incoado y disponer la ineficacia parcial de la sentencia, únicamente en cuanto a la condena civil dispuesta en contra del imputado [Nombre1] . En virtud de que las obligaciones dispuestas en sentencia relacionadas con la limitación del área de protección de la quebrada [Dirección3] y la ejecución del proceso de restauración ambiental del área de protección, constituyen aspectos relacionados con lo que deba resolverse en la parte civil de la sentencia, debe también declararse su ineficacia para que sean sustanciados en el juicio de reenvío que aquí se está disponiendo realizar ante otra integración del mismo tribunal, respetando el principio de no reforma en perjuicio, al haber recurrido únicamente el imputado en su condición de demandado civil, tal como lo disponen los artículos 447 del Código Procesal Penal y 65.6 del Código Procesal Civil.

POR TANTO

Se declara con lugar el recurso de apelación incoado por la defensa particular del imputado; se dispone la ineficacia parcial de la sentencia, únicamente en cuanto a la condena civil dispuesta en contra del imputado [Nombre1] y las obligaciones civiles dispuestas en sentencia en contra del justiciable. Se ordena la realización de un juicio de reenvío ante otra integración del mismo tribunal para sustanciar nuevamente los aspectos civiles cuestionados, respetando el principio de no reforma en perjuicio, al haber recurrido únicamente el imputado en su condición de demandado civil.
