Ideological Falsehood DECISION 131 -21 CRIMINAL JUDGMENT APPEALS COURT. Second Judicial Circuit of Guanacaste, Santa Cruz, at nueve horas, treinta minutos del veintitrés de marzo de dos mil veintiuno.
Appeal filed in the present case number 14-001151-0396-PE, brought against [Nombre1], identification card number CED1, born on 5 de octubre de 1973, child of [Nombre2] and [Nombre3], for the offense of IDEOLOGICAL FALSEHOOD, to the detriment of NATURAL RESOURCES. Judge Cynthia Dumani Stradtmann and Judges Wilson Flores Fallas and Guillermo Arce Arias participated in deciding the appeal. The defendant [Nombre1], attorney Luis Aguilar Herrera as defense counsel for the convicted defendant, and attorney Luis Diego Quesada Canales as representative of the Public Prosecutor’s Office appeared before this Court.
RESULTS
Judge Arce Arias drafts the decision; and,
CONSIDERING
Upon review of the proceedings in the record, specifically service of the judgment (f. 158) and the date on which the appellate brief was filed (f. 160), it is concluded that it was filed within the statutory period by a party with standing, as it was submitted by the convicted defendant’s legal counsel; it also sets forth the corresponding grounds of grievance against a decision on the merits. Accordingly, because it meets the requirements for consideration of the grounds of disagreement, the appeal is declared admissible for the corresponding examination.
As reflected in the corresponding records (f. 242), the oral hearing was held with Judges Marlene Mendoza Ruiz, Cynthia Dumani Stradtmann, and Wilson Flores Fallas participating. However, as stated in the heading of this decision, the Appeals Chamber is composed, for purposes of rendering this judgment, of Judge Guillermo Arce Arias, because Judge Mendoza, who appeared at the oral hearing, now holds another position. In this regard, it is appropriate to mention that this arrangement was adopted on the basis of the Constitutional Chamber’s ruling, which stated: “...it is constitutionally valid that, in those oral cassation proceedings or hearings in which no evidence is received orally, or in which the parties’ arguments are already set forth in writing and nothing new is submitted, judges other than those who participated in the hearing may take part in rendering the decision if, and only if, they are capable of doing so and there are justified reasons—which must be placed on the record—preventing those who attended the oral hearing from meeting at an upcoming date to examine and decide the matter...” (Constitutional Chamber, N° 6681 de las 15:30 horas del 10 de diciembre de 1996 and Nº 17553 de las 12:23 h. del 30 de noviembre de 2007)” (Constitutional Chamber, N° 6880 de las 15:05 hrs. del 22 de mayo de 2013).
Based on the guidance provided in the cited precedent, it should therefore be noted that no new evidence was offered at the oral hearing held in this case, nor were any arguments presented that differed from those submitted in writing; consequently, the change in the composition of this Court entails no prejudice to the parties. It should also be noted that Judge Arce Arias had access to the audiovisual recording of that hearing and reviewed it before deciding this matter.
First Ground. Violation of due process for failure to recognize the breach of the duty to inform the accused, through a timely, express, precise, clear, detailed, and logically consistent statement, of the alleged facts and their legal consequences, both when formally advising the accused of the charges (intimación) and in the indictment (acusación). The appellant argues that the indictment did not include facts concerning the circumstances under which the disputed timber transport permit (guía de madera) was used, including who used it, when it occurred, where it took place, the means by which it was used, how it came into the possession of the forestry authorities, the activities undertaken by those authorities to determine the logging permits and origin of the timber, or, much less, how those allegedly false statements said to have been entered in the permit, concerning the fact it was required to establish, could have created a genuine possibility of harm.
In his claim, the appellant asserts that the foregoing omissions are evident both when the facts were initially communicated to him and when he was informed of the facts charged at trial. He adds that this led the trial court to disregard the testimony of witness [Nombre5], who stated at trial that the cuts on the logs were not recent and therefore could well have corresponded to remnants of trees of the relevant species from the period during which the defendant served as forestry supervisor (regente forestal) for the referenced agroforestry system (sistema agroforestal). This circumstance is not negated by the fact that, in the timber-harvesting report (informe de aprovechamiento forestal), the defendant stated that no trees remained to be cut, because only a short period elapsed between the closing of the report dated 17 de junio de 2014 and the date of the disputed permit, 24 de junio de 2014, which would support a finding that those logs came from trees cut during the period of forestry supervision (regencia forestal).
The appellant considers the foregoing further supported by the fact that the accused acknowledged that, when preparing the transport permit, he made an error by using a form containing pre-established information, which resulted in the erroneous statement that the logs came from a plantation when, in fact, they came from an agroforestry system. On this ground, he requests a finding that the alleged conduct was legally misclassified (errónea adecuación típica), that the judgment be reversed, and that a judgment of acquittal be entered. At the oral hearing, the Public Prosecutor’s Office opposed this ground and requested that it be denied. The claim cannot prevail. Upon reading and analyzing the indictment submitted at trial, it is apparent that it passed through the various procedural stages during which the parties may exercise their rights and challenge the prosecution’s claim. Thus, once the matter reaches trial, it is because a judge—specifically, the judge presiding over the intermediate stage (etapa intermedia)—has determined that the indictment contains sufficient elements to satisfy the requirements established by Articles 303 et seq. of the Code of Criminal Procedure.
Accordingly, even if there were hypothetically deficiencies in the statement of facts provided by the Public Prosecutor’s Office to the defendant when he gave his preliminary statement (declaración indagatoria), during the intermediate stage all proceedings are disclosed to the parties, who are once again afforded an opportunity to defend against the factual allegations in the indictment. Even then, once the case is committed for trial on the basis of a judicially admitted indictment, it is during the trial stage that the greatest safeguards arise for the person subject to prosecution, enabling that person to confront the charges. It may thus be seen that the structure of our criminal proceedings allows the accused, during the course of the case, to challenge before a judicial body the facts formally alleged against him. Moreover, it is mistaken to contend that the indictment must contain each and every detail that might make up an alleged criminal event; what is required is that it contain the most relevant details and those necessary to permit the exercise of the right of defense. A straightforward reading of the indictment in this matter shows that the trial was based on the following factual account:
“The accused [Nombre1], in his capacity as forestry supervisor, issued certificate of origin number CED2, dated 11 de febrero del 2013 and valid through 15 de mayo del 2014, in favor of Desarrollos Ganaderos Nueva Era S.A, represented by [Nombre6] (absent defendant), thereby generating forestry-supervision contract 003215 G and authorizing harvesting (aprovechamiento) under an Agroforestry System for the species Cedro amargo, laurel, roble sabana, and madero negro, on the property registered in the Guanacaste land registry [Dirección1], located in Quebrada Grande and known as property [Dirección2]. After the forestry-supervision contract expired, on 17 de junio del 2014, the accused [Nombre1] prepared a forestry-supervision report (informe de regencia) in which he closed the harvesting authorized under the aforementioned certificate of origin. Subsequently, the accused [Nombre1], in his capacity as forestry supervisor for Desarrollos Ganaderos Nueva Era, issued transport permit for logs number 0050697 H, dated 24 de junio del 2014, and falsely entered in the field for Assigned License Plate No.: ‘not required because it is a plantation product,’ despite knowing that certificate of origin CED3 G, which supported that permit, authorized harvesting from an agroforestry system and not from a forest plantation, and despite also knowing that the forestry-supervision contract had expired and that he had requested closure of the harvesting operation through the aforementioned forestry-supervision report.” (sic) (f.140) It should be noted that, in the foregoing statement of facts, the basic elements can be identified, such as when the events occurred, where they took place, who was responsible for them, and what his conduct consisted of, all of which allowed the accused to exercise a full defense against the allegations, without his defense being impaired by the failure to describe all the particulars raised in the appeal brief (libelo de impugnación).
The appeal seeks to challenge the lack of specific circumstances concerning the use of the transport permit alleged to contain ideologically false information, which does not form part of the essential factual allegations (núcleo fáctico) charged; rather, the charge concerns inserting false facts into an authentic document, with the potential to cause harm. As to the claim that the indictment (acusación) failed to indicate how the document could have caused harm, it must be recalled that proof of actual harm is not required, but only its potential—that is, the possibility that it could cause harm without the harm having to materialize—and therefore this is not a matter that must be described in the indictment in the manner asserted by the appellant. Under this same ground, the appellant states that the insertion of false information into the document was due to an unintentional act by the accused; that claim forms part of another, more specific ground and will therefore be resolved there.
The appeal also maintains that the trial court (tribunal de sentencia) disregarded the statement of the witness [Nombre5] that the cuts on the logs were not recent and therefore could very well have corresponded to remnants of trees of the relevant species from the period during which the defendant served as forest regent (regente forestal) for the aforementioned agroforestry system (sistema agroforestal). This is nothing more than an attempt by the defense to have a subjective explanation of the facts—a conjecture—necessarily treated as the conclusion that the judges should have reached after analyzing all the evidence presented at trial (debate). Based on the foregoing, this Chamber finds nothing in the charging instrument (pieza acusatoria) that could even potentially have prejudiced the defendant’s defense, much less anything that would render the judgment null and void.
Second Ground. Violation of due process (debido proceso) due to an inconsistency in the judgment, insofar as it is based on a contradictory indictment and is therefore wholly invalid. Under this ground, it is alleged that the first fact proven in the indictment states that the defendant concluded his tenure as forest regent on 15 de mayo de 2014, whereas the second fact states that, after that date, specifically on 24 de junio de 2014, the accused, purportedly acting as forest regent for the aforementioned company, issued the disputed transport permit, which was improper because his tenure had already expired; this inconsistency consequently resulted in a contradictory judgment. He requests that the claim be granted, the judgment reversed, and a judgment of acquittal entered in favor of the accused. At the oral hearing, the Public Prosecutor’s Office (Ministerio Público) opposed the request and asked that the ground be rejected. This claim is unfounded. According to the facts found proven in the judgment, there were two events that were clearly defined and temporally established, the first of which states:
“The accused [Nombre1], in his capacity as forest regent, issued certificate of origin number CED2, dated 11 de febrero del 2013 and valid until 15 de mayo del 2014, in favor of Desarrollos Ganaderos Nueva Era S.A, represented by [Nombre6] (absent defendant), thereby generating forest-regency agreement (contrato de regencia) 003215 G and authorizing harvesting (aprovechamiento) within an Agroforestry System of the species Cedro amargo, laurel roble sabana and madero negro, on the property registered in the province of Guanacaste [Dirección1], located in the locality of Quebrada Grande and known as the [Dirección2] property; after the forest-regency agreement expired, on 17 de junio del 2014, the accused [Nombre1] prepared a forest-regency report (informe de regencia) in which he closed out the harvesting authorized under the aforementioned certificate of origin. (...)” (sic) (f.146) (emphasis not in the original) It was then also found proven that:
“Subsequently, the accused [Nombre1], in his capacity as forest regent for Desarrollos Ganaderos Nueva Era, issued transport permit for logs (guía de transporte para madera en troza) number 0050697 H, dated 24 de junio del 2014, and falsely entered under the field ‘Assigned license plate No.’: ‘‘not required because it is a plantation product,’’ despite knowing that certificate of origin CED4, which supported that permit, authorized harvesting from an agroforestry system and not from a forest plantation (plantación forestal), and despite also knowing that the forest-regency agreement had expired and that he had requested closure of the harvesting operation through the aforementioned forest-regency report.” (f.146) (emphasis not in the original) It follows from the foregoing that there is no dispute that the first fact established that the defendant was a Forest Regent and that, by the time he prepared the transport permit containing false information, the forest-regency agreement had already expired, a circumstance which, as explained in that same finding, was known to the accused when he prepared it.
This creates no inconsistency whatsoever in the judgment, because it is entirely consistent with the evidence presented at trial that the defendant had been the forest regent for the company identified and that, after his agreement expired, he issued a permit containing false information while fully aware of that circumstance. The error alleged by the appeal in this section is therefore not apparent.
Third Ground. Violation of due process due to erroneous legal classification of the offense (adecuación típica) and the resulting erroneous imposition of sentence, because the defendant could not lawfully have issued the transport permit in question and therefore it could not have constituted a public document (documento público) into which he could have inserted false statements concerning the fact that the document was required to prove, with the potential to cause harm. The appellant states that, in recital V (considerando V), entitled “Legal Grounds,” the challenged judgment finds as follows: i.- that the proven facts constitute the offense of ideological falsification (Falsedad ideológica), because the accused personally entered in the transport permit that the timber came from a plantation when it actually came from an agroforestry system; ii.- that this act was carried out in a public document because the person who issued it possessed public-certification authority (fe pública) as a forest regent; iii.- that the act was intentional (dolosa) because the defendant knowingly and willingly carried out the aforementioned objective elements; iv.- that the act was substantively and formally unlawful (antijurídica material y formalmente) because it violated the legally protected interest (bien jurídico) of public trust and, consequently, the legal system as well; v.- that there was no evidence establishing the existence of any justification defense (causa de justificación); and vi.- that culpability (culpabilidad) had been established because its elements had been satisfied.
He argues that the facts do not constitute the offense of ideological falsification because merely preparing the document is insufficient to establish “the operative verb,” since that verb constitutes the offense only when the allegedly false information is inserted into a public or authentic document issued by someone legally empowered to do so. That requirement was not met in this case because the statement that the defendant possessed public-certification authority as a forest regent is unfounded and false, given that the alleged facts establish that the defendant ceased to be the company’s forest regent as of 15 de mayo de 2014, when his tenure expired. Thus, by 24 de junio de 2014 he was no longer the forest regent for the company in question; because he was not a forest regent on the date of the events, the operative verb could never have been established, and he consequently lacked legal authority to issue the permit, which therefore was not a public document into which false statements could have been inserted.
According to the appellant, this also means that intent (dolo) could not have been established because, although he may have knowingly and willingly prepared the permit, that knowledge and intent could not cure his lack of legal capacity to prepare it. He adds that the foregoing would also preclude any violation of the cited legally protected interest because the document was not a public document, since the defendant no longer held the position of forest regent when it was issued. This also has implications for the culpability analysis, because such an analysis would be irrelevant if the facts did not legally constitute the offense. He requests that a judgment of acquittal be entered in favor of the accused. At the oral hearing, the Public Prosecutor’s Office requested that the ground be rejected. The appellant is incorrect. For a better understanding of the ruling, it is appropriate to examine the judgment’s legal reasoning, at least the section so designated. The judgment states as follows:
V.LEGAL GROUNDS.- When analyzed in light of the Theory of the Offense (Teoría del Delito) and the Principle of Legality (Principio de Legalidad), the facts found proven constitute the criminal offense of ideological falsification. Each of the objective elements of that criminal offense has been established. First, the operative or governing verb (verbo típico o rector), namely ‘‘to insert,’’ has been established because it was proven that the accused personally prepared the transport permit for logs and wrote, recorded, or inserted into it the statements indicating that the timber came from a plantation when it actually came from an agroforestry system. The objective element requiring that the insertion be made in a public document has likewise been established, that document being the Transport Permit for Logs, because information is entered into that document by a person who possesses public-certification authority, such as a forest regent.
Moreover, because of the information it contains and its nature, the permit must prove to the law-enforcement authorities responsible for roadside inspection (Traffic Police, Public Police Force, among others) the origin and status of the timber being transported in a particular vehicle. Furthermore, the subjective element of that criminal offense has been established, namely intentional conduct, because, as indicated in the section concerning the reasoning underlying the factual findings (fundamentación intelectiva), the accused knowingly and willingly carried out the objective elements described above. The conduct is not merely conduct constituting the offense (típica), but also rises to the level of unlawfulness (antijuricidad), because it violated the legally protected interest of public trust (substantive unlawfulness) and likewise violated the legal system (formal unlawfulness). There was no evidence establishing the existence of any justification defense.
Culpability, as the final stage of the Theory of the Offense, has also been established, since all three elements of culpability were satisfied. First, criminal capacity (capacidad de culpabilidad) was proven—that is, at the time of the events the accused was criminally responsible (imputable), meaning that he acted without any mental illness that prevented him from controlling his conduct. Second, it was established that, at the time of the events, the accused understood the unlawfulness of his conduct because there is no evidence establishing any mistake of law (error de prohibición) under which he believed that the conduct was lawful. Third, a finding of blameworthiness (juicio de reproche) may be made against the accused because, despite possessing the full mental capacity to control his conduct and knowing that it was unlawful, he did not choose the lawful course.” (sic) (f. 156)
Based on the foregoing, one can discern the exercise of matching the conduct to the statutory definition, or assessing the statutory elements of the acts, against the objective and subjective requirements necessary for the offense to be established. Thus, Article 367 of our Criminal Code provides as follows: “The penalties provided for in the preceding article shall apply to anyone who inserts or causes to be inserted into a public or authentic document false statements concerning a fact that the document is intended to prove, in such a manner that harm may result.” With the criminal offense thus defined, the next step is to apply a straightforward and clear assessment of what is relevant to this offense, regarding which legal scholarship has stated:
“Ideological falsehood (falsedad ideológica)—which some also call historical falsehood—concerns exclusively the representational content of the document, without the indicia of authenticity being modified or imitated in any way. It involves a document whose form is genuine, as are its makers, but which contains false statements concerning facts that it is intended to prove; it presents as true—or real—facts that did not occur, or presents facts that occurred in a particular manner as though they had occurred in a different manner. (...) In short, an ideologically falsified document has an authentic form and false content (...) ideological falsehood presupposes that the perpetrator has a legal obligation to tell the truth concerning the historical existence of an act or fact and its surrounding circumstances, insofar as these produce effects provided for by law.” ([Nombre7], . Special Part of Criminal Law. Volume II. Sixth Edition. Editorial Astrea. Buenos Aires, 1997. Pages 426 et seq.)
This examination of the nature of the offense of Ideological Falsehood helps us appreciate the importance of establishing the conditions required for a person to be deemed the perpetrator of this offense, as well as the type of document, the information inserted or caused to be inserted by the perpetrator, the falsity of that information, and the document’s capacity to cause harm, since these constitute the objective elements of the offense that must be established from the facts through analysis of the evidence admitted in the case. Consequently, it must be borne in mind that the perpetrator of the offense is the certifying officer (fedatario), the professional vested with public certification authority (fe pública) and responsible for preparing and authenticating the document. Accordingly, the fact that the accused had ceased to serve as forestry manager (regente forestal) because the forestry-management contract (contrato de regencia) had expired does not preclude his having committed the charged criminal act.
Thus, according to the appellant, a forestry manager loses the status of public certifying officer (fedatario público) when the forestry-management contract ends; this is incorrect because, although he cites Ley Forestal, specifically Article 21 thereof, in support of his position, that provision is systematically included in Chapter I of Title Three, which governs forest management (manejo de los bosques), specifically privately owned properties covered by forest, and this supports the conclusion that such authority does not arise from that particular provision but from the practice of his profession. Returning to the central issue in this matter, the accused [Nombre1] was the professional responsible for issuing Certificate of Origin number CED5, valid until May 15, 2014, in favor of Desarrollos Ganaderos Nueva Era S.A., under forestry-management contract 003215 G, and subsequently the harvesting closure report (informe de cierre de aprovechamiento) dated June 17, 2014.
Although the forestry-management contract ended, this does not per se mean that, before public authorities and society at large, the accused forestry engineer lost his status as a public certifying officer, because, first, the report was not subjected to a closure assessment (evaluación de cierre) by the forestry administration, as is apparent from subsections b) and f) of Article 5 of the law at issue. Second, the State and the law entrusted him with issuing documentation of public interest, the content of which is essential to the fulfillment of obligations incumbent upon the State but which, for reasons of administrative efficiency, are delegated to professionals of this kind. Accordingly, documents issued or signed by him in connection with that forestry oversight (regencia) continued to carry public-certification weight before national authorities and third parties, provided that they contained relevant information relied upon by third parties before the appropriate bodies.
The defendant was also aware of this, because only ten days after the technical closure of the forestry oversight, he issued a log transport permit (guía de transporte de madera en troza), falsely stating that the timber originated from a plantation when in fact it came from an agroforestry source, moreover while fully aware that his forestry oversight of that property had ended. This constituted an additional element considered by the trial judges in establishing the defendant’s responsibility for the acts. The quoted reasoning of the judgment then states that it was proven that the accused personally prepared the log transport permit and inserted into it the statement that plates were not required because the timber originated from a forest plantation. The reasoning also refers to the type of document, and it is useful here to clarify the terms employed. The Third Chamber has stated in several of its judgments that:
“With respect to the nature of the document and the powers or authority held by the defendant, the following observations are necessary. Article 359 of the Criminal Code provides for the punishment of anyone who: ‘...makes, in whole or in part, an authentic document or alters a genuine one, in such a manner that harm may result...’ and Article 360 punishes ‘...anyone who inserts or causes to be inserted into a public or authentic document false statements concerning a fact that the document is intended to prove, in such a manner that harm may result.’ As the Chamber explained in judgment No. 70-F-95, at 9:00 a.m. on February 17, 1995: ‘The offense has two alternative objects: the public document, which is one prepared by a public official who is not necessarily connected to the administration through appointment, swearing-in, or representation, but rather through two other parameters that broaden the concept in criminal law (on this subject, see judgments of the Third Chamber of the Supreme Court of Justice N° 208-F, at 09:30 on 10-06-1994, and N° 375-F-at 10:20 hrs on 23-09-1994); and the authentic document, prepared by a person who, by reason of his or her profession, trade, or occupation, records in it statements that are presumed to be accurate and accepted by others as true unless proven otherwise.
Examples of the foregoing are certificates issued by certified accountants, notaries, or physicians; property surveys prepared and signed by surveyors; signatures authenticated by attorneys; and so forth.’ An authentic document need not be prepared by a person vested with public certification authority. Its principal characteristic lies in its authenticity, which derives from the existence of legal rules granting it that effect, including rules requiring certain documents to be prepared or signed by a person who, by virtue of his or her profession or trade, is presumed qualified to understand the content of the data, its nature, and its consequences, and who is accredited before the State or professional associations—to which the registration function is ordinarily delegated—to carry out that activity. Authenticity indicates and proves that the document was prepared or signed by the persons identified therein; that is, it constitutes conclusive proof of its origin or authorship.
Civil-law scholarship states: ‘Although presumptions of authenticity relate to the signature (that is, identification of the author), and not to the content, which concerns truthfulness, as discussed above, except for those relating to accounting books, insurance policies, and minutes of meetings of co-owners of buildings subject to the condominium-property regime, it is clear that the presumption of authenticity of the signature implicitly entails recognition of the truthfulness of the content because, as the Court has long maintained in a doctrine that remains valid today, “it is understood that no one authenticates a writing with his or her signature without being fully informed of its content; anyone who claims otherwise would have to provide proof. Hence, under Art. 642 of the C.J., if the person against whom a private document subject to acknowledgment is offered admits that the signature is his or hers, the truth of the statements contained therein is implicitly deemed acknowledged; that is, once the signature is acknowledged, the content of the document is implicitly acknowledged.
This is natural and understandable, because it is presumed that no one signs without knowing what he or she is signing if able to read, and if unable to do so, without having a trusted person read what he or she is about to authenticate. Conversely, if the signature is denied, the content of the document is deemed denied.” (Ramírez Gómez, José Fernando, Documentary Evidence: General Theory, Señal Editorial, 4th ed., Medellín, 1991, p. 90).’ Under the Costa Rican legal system, certain documents must be authenticated before they can be accorded the intended legal effect; that is, an ordinary private paper (lacking the legal attribute of authenticity) is insufficient to produce those effects (...) Needless to say, professionals are required to report the truth, because the exclusive authority legally conferred upon them is based not only on technical considerations but also on the ethical principles that govern, or should govern, the activities of every member of a professional association.
In choosing to establish exclusive authority—that is, by denying the possibility that any person may prepare management plans (planes de manejo) and requiring that they be prepared by someone who possesses specified academic training and is a member of a professional association—the legislature based that decision on the trustworthiness and credibility that such professionals are deemed to possess. They are entrusted with a function (which the State itself could potentially perform), not with a privilege or mere concession that may be abused. As already noted, management plans are specifically regulated (that is, they must meet certain minimum legal requirements), and the exclusive authority referred to above entails the authenticity of the document, supported by the signature of a professional registered with an association and authorized to practice his or her profession.’ (Sala Tercera voto 00396-2006 and, to the same effect, see Sala Tercera voto 00406-2007)” For the foregoing reasons, and in addition to the provisions of the “Procedural Regulations for Timber Harvesting on Agricultural and Non-Forest Land and in Special Situations” (“Reglamento de Procedimientos para el Aprovechamiento Maderable en terrenos de uso agropecuario y sin bosque y situaciones especiales”) R-SINAC-028-2010, “timber transport permits” (“guías de transporte de madera”) are “authentic” documents insofar as they are specifically regulated and their preparation is entrusted to certain professionals—in this case, Forestry Engineers—who possess broad authority to certify relevant information before the forestry administration or other national authorities; therefore, those professionals who issue them are required to state the truth, because that exclusive authority was conferred upon them by the legal system on the basis of technical and ethical considerations.
Although the judgment states that the transport permit is a public document (documento público), now considering it to be an authentic document (documento auténtico) does not affect the meaning or logical consistency of the judgment, nor does it affect the evidentiary derivation of the facts or require remand for correction, because both terms are described in the applicable criminal offense. The judgment next states that the permit prepared by the accused, together with the information it contains, constitutes evidence before police and roadside enforcement authorities regarding the timber being transported, its quantity, type, and origin—among other matters—hence its capacity to cause harm, because it may be used to evade timely oversight and enforcement concerning timber harvesting, as occurred in the present case. It may thus be seen that the objective elements of the criminal offense are indeed described and substantiated in the section of the judgment containing the legal analysis, as well as in its reasoning on the evidence, because the judgment is a logical unit that must be assessed comprehensively as a whole.
Finally, with regard to the subjective element of the criminal offense, the reasons why the trial judges concluded that the accused acted intentionally rather than carelessly when issuing the transport permit are extensively developed in the decision, with a precise identification of the factual circumstances relied upon. Thus, the decision at issue provides as follows:
“The reasons why the Court he (sic) found the accused’s intentional conduct proven and rejected the defendant’s account that it was a clerical error are as follows: First. It he (sic) been established that, at the time the Transport Permit was prepared, the defendant had extensive experience, which enabled him to distinguish between an agroforestry system (sistema agroforestal) and a plantation system (sistema de plantación), and that such experience also required him to ensure and verify the information he entered in public documents in which he attested under public authority (fe pública) to what he was entering. It should be noted that, in his testimony, the defendant stated that he had been a forestry professional for thirty years (...) such that the years of experience stated by the defendant make it implausible that this was merely a clerical or unintentional error; indeed, it should be noted that this information was entered not only in the first part of that Roundwood Transport Permit (Guía de Transporte de Madera en Troza), but also in the lower portion titled ‘Receipt for Use by the Forestry Industry’ (‘Comprobante para uso de la Industria Forestal’), which, in the Court’s view, makes it possible to exclude the theory of unintentional error (...) Second.
It has been established that the accused knew he could no longer issue that permit because the forestry-supervision agreement (contrato de regencia) and certificate of origin (certificado de origen) had already expired, since it has been established that they expired on 15 de mayo del 2014 and the permit was issued on 24 de junio of that same year. It should be noted that the defendant himself even acknowledged this situation when he stated in his testimony that ‘a transport permit was prepared for cedarwood residue covered by the certificate of origin after the forestry-supervision agreement had already been closed ... the forestry-supervision agreement ceases to be valid once it is closed, which occurs when the forestry-supervision report (informe de regencia) is prepared upon closure of the harvesting plans (planes de aprovechamiento). (...) Third. The Court considers that the accused acted intentionally and not out of ignorance or clerical error, because, in addition to the foregoing factors, there is a substantial difference between entering on a roundwood transport permit that the timber resources come from a plantation and therefore do not require tags, as was found to have been stated on that permit, and entering that they come from an agroforestry system, which was established to be the system from which the timber being transported at the time of the detention originated.
(...) the accused [Nombre1] stated as follows: ‘that document was issued to transport the residue from the trees whose harvesting was covered by that certificate. Thus, the transport permit that was prepared was for the cedar residue covered by that certificate, because during the period of forestry supervision it was not known what specific use would be made of that residue, whether for firewood or another use ... the permit was for the branches, because the logs had already been transported’; testimony that, in the Court’s view, cannot be credible for the following reasons: The first point that must be noted is that the defendant had gone into the field to inspect the alleged timber residue that was to be transported, as he stated: ‘to prepare the permit, I went into the field to inspect the residue and verify that it came from the same tree covered by the certificate of origin’; this information makes it possible to find that Mr. [Nombre1] observed the alleged timber residue that was to be transported and regarded it as such—timber residue—according to his account; however, it is not credible that it was residue, because it is illogical that a roundwood transport permit would have had to be prepared in order to transport timber residue (...) The defendant’s statement that the permit was prepared because it was for transporting residue is not credible, inasmuch as serious contradictions have been found in the accused’s statements, such as the defendant’s initial statement that ‘the permit was for branches, because the logs had already been transported,’ which contradicts the Roundwood Transport Permit itself, where, in the box titled ‘Information on the Timber Being Transported’ (‘información de la Madera que Transporta’), he entered that 18 bitter cedar logs were being transported; this renders Mr. [Nombre1]’s statement at trial unworthy of belief.
(...) Fourth. (...) namely, the time at which the timber was being transported, which was not an authorized time for such transportation; this establishes that he selected that time in an effort to prevent the false information contained in the permit from being discovered and, consequently, to prevent the timber from being seized.” (sic)(boldface in the original) (f. 149 et seq.)
It is therefore concluded that the finding that the defendant acted intentionally was based on several considerations, all of which, when analyzed comprehensively, do indeed establish that the person prosecuted, [Nombre1], was fully aware of his conduct and, with that cognitive awareness of the elements necessary to constitute the act, decided to carry it out voluntarily. Thus, the conduct satisfying the elements of the offense was contrary to the legal system, as is more than evident, and harmed the legally protected interest of public trust (fé pública), because he entered false information in an authentic document that was used before the authorities to evade their oversight of national timber harvesting. Accordingly, the judgment is clear and unequivocal in so finding, and no error is apparent in that respect.
Fourth Ground. Violation of due process arising from the erroneous legal classification of the charged acts and the consequent erroneous imposition of sentence, due to the failure to recognize that there was no duty to carry a transport permit for the transportation of roundwood that could have been violated by entering in that permit allegedly false statements that the document was required to prove, thereby creating the potential for harm. The appellant considers that, contrary to what the challenged decision states, in 2014, when the transport permit was issued, forestry supervisors were indeed authorized to issue such permits for both forest plantations and agroforestry systems, as authorized by the Procedural Manual for Timber Harvesting on Agricultural and Non-Forest Land and in Special Situations in Costa Rica (Manual de Procedimientos para el Aprovechamiento Maderable en Terrenos de Uso Agropecuario y Sin Bosque y Situaciones Especiales en Costa Rica), resolution R-SINAC-028-2010 of 28 de junio de 2010, published in Gazette number 163, which provides: “In cases involving forest plantations, agroforestry systems, and planted trees, the Forestry Supervisor shall issue the transport permits for timber originating from such cases, subject to the exceptions set forth in the current Forestry-Supervision Regulations.” The defendant invoked this provision in his defense when testifying before the Trial Court, but the judges failed to address it and erred by stating in the judgment that it was an unproven element, thereby treating legal rules as matters that must be “proven,” even though it is widely recognized that legal rules are not subject to proof.
The Public Prosecution Service opposed this ground at the oral hearing. The ground must be rejected. It cannot be overlooked that the appellant describes an error committed by the Trial Court in its analysis, namely, requiring evidence concerning the existence of regulation R-SINAC-028-2010 to be introduced at trial. The judgment states as follows: “The Court does not omit to assess and analyze the fact that the defendant referred to this issue in his testimony when he stated as follows: ‘in 2010, forestry supervisors were given the ability to issue transport permits for the three aforementioned categories ... (sic) there is no difference for the supervisor in preparing the permit depending on whether the tree grew naturally or was planted. The 2015 training took place because, in that year, a decree was issued stating the same thing as the Procedural Manual for Harvesting Trees on Non-Forested Agricultural Land.
At that time, forestry supervisors’ authority to prepare permits for transporting timber originating from agroforestry systems was removed, and they retained authority exclusively to issue permits for timber originating from plantations; from that point forward, permits for timber originating from agroforestry systems were issued only by Minaet. Since 2015, transport permits for the forest-plantation system have remained under the authority of private forestry supervisors.’ (...) testimony that lacks any evidentiary support because there is no evidence demonstrating that, during 2014—the year in which the timber transport permit was prepared—such authorization existed on the part of the forestry administration; it should be noted that the defendant stated that there was a resolution numbered 28-2010, yet that resolution is not in the record, even though the defendant said that he would submit it to substantiate his statement and failed to do so.” (sic) (f. 152) The trial court clearly erred by seeking to make the existence of a legal provision subject to proof.
Nevertheless, that error is not sufficiently significant to warrant vacating or modifying the judgment. The Procedural Manual for Timber Harvesting on Agricultural and Non-Forest Land and in Special Situations in Costa Rica, of the National System of Conservation Areas, R-SINAC-028-2010, provides, as relevant, as follows:
"CHAPTER III.- Control devices.- In accordance with Articles 31 and 56 of Ley Forestal Nº 7575 and Articles 30, 31, and 32 of the Regulations to that Law, which establish the use of control-verification devices for timber in transit and in forest industries, and for the purpose of monitoring and controlling timber harvesting (aprovechamiento forestal), the timber transport waybill (guía para transporte de madera), whether for logs or sawn timber, shall be used as a device evidencing logging permits (permisos de corta) and the origin of forest products. When the forest products consist of logs that do not come from Forest Plantations (Plantaciones Forestales), each log must individually bear a numbered plastic tag.
1. Procedure for issuing control devices. The procedures for issuing and using waybills, plastic tags, and other devices for transporting timber are detailed below.
1.1 Persons responsible for the custody and issuance of waybills and tags:
1.1.1 Each Área de Conservación, through the administrative officer or staff member designated by the Director Regional, shall request waybills and tags for all Subregiones from the Departamento de Proveeduría del SINAC and shall distribute them to each Oficina Subregional. (...)
1.2 Waybills and tags must be issued upon presentation of an authorization form signed by the Jefe Subregional or by the competent official whom the latter designates for that purpose; the form must be retained in the case file (ANEXO 17). In cases involving forest plantations (plantaciones forestales), agroforestry systems (sistemas agroforestales), and planted trees (árboles plantados), the Forestry Regent (Regente Forestal) shall issue the transport waybills for timber originating from such sources, subject to the exceptions set forth in the current Reglamento de Regencias.
1.2.1 The Jefe Subregional or designated official shall issue the form for the delivery of waybills and tags after reviewing the Forestry Supervision Report (Informe de Regencia), which must comply with the current Reglamento de Regencias. Likewise, AFE officials must verify: (...)
[...] That the Forestry Supervision Report is supported by a forestry supervision contract (contrato de regencia) that complies with the current Reglamento de Regencias.
[...] That unused waybills are returned to the AFE, together with copies of the used waybills, duly completed and stamped by the industrial facility that received the timber (the stamps must state the address and corporate name), which shall be attached to the case file. (...)
1.4 The AFE shall reserve to itself the issuance of transport tags and waybills for the following categories of permits:
a. Applications concerning agricultural-use land without forest cover (bosque) that do not exceed three trees per hectare, up to a maximum of 10 trees per property per year (PUA-Pp).
b. Applications concerning properties with no more than 3 timber trees per hectare that exceed 10 trees per property per year (PUA-IF).
c. Special applications contemplated under national environmental legislation (PE).
d. Harvesting applications (solicitudes de aprovechamiento) in forest areas (Forest Management Plans (Planes de Manejo en Bosque)), taking into account the specific provisions established in the current Reglamento de Regencias.
1.5 The issuance of waybills and/or tags for transporting products originating from individually planted trees (CO-AP) and Agroforestry Systems (CO-SAF), as applicable, shall be made upon submission of the Certificate of Origin (Certificado de Origen, CO), as well as a copy of the forestry supervision contract registered with the Colegio de Ingenieros Agrónomos. The Certificate shall bear an acknowledgment-of-receipt stamp from the corresponding Oficina Subregional of the AFE, stating the date of receipt and the name and signature of the official designated by the Jefe Subregional for this purpose.
1.5.1 The Certificate of Origin (CO) shall be a single document—only one document per harvesting operation to be carried out on each property—and shall be prepared on CIA security paper, with a copy for the AFE; it must be prepared and signed by a Forestry Regent. The Certificate of Origin (CO) must contain the minimum information required under the current Reglamento de Regencias.
1.5.2 Any Certificate of Origin that does not comply with the current Reglamento de Regencias shall not receive the acknowledgment-of-receipt stamp referred to in the preceding section of this document; consequently, the waybills and tags shall not be authorized or issued.
1.6 For the transportation of logs, the plastic-tag system established in the Executive Decree currently in force for that purpose shall be used, with orange tags for timber originating from agroforestry systems and yellow tags for logs originating from agricultural-use land without forest cover or from Forest Management Plans (Planes de Manejo Forestal) in forests. (...)
2. General provisions governing control devices 2.1 Pursuant to Article 42 of Ley Forestal Nº 7575, a log (troza) is deemed to be a section of a tree that is free of branches and has a diameter greater than or equal to 29 centimeters at its narrowest end. Therefore, roundwood pieces (piezas rollizas) that do not meet this condition shall not require waybills or tags for transportation. This means that under no circumstances shall waybills or tags be issued for roundwood pieces with diameters of less than 29 centimeters.
2.2 All timber in log, squared, or sawn form must be accompanied by the corresponding transport waybill designed for that purpose by the AFE or CIAgro, as applicable; the document may not be issued with a validity period exceeding two months.
2.3 Only logs originating from plantations, agroforestry systems, and individual trees may be transported without tags, subject to the exceptions contained in Ley Forestal. (...)" Several important points may be drawn from the foregoing regulatory provisions. First, during the period in which these Regulations were in force, Forestry Regents were authorized to issue waybills; the issuance of waybills had to conform to the Certificate of Origin; a log was defined as a section of a tree free of branches and having a diameter greater than or equal to 29 centimeters; transported logs had to be accompanied by a transport waybill and also had to use the tag system; and, finally, in certain cases, a Forestry Regent was authorized to issue transport waybills for timber originating from agroforestry systems. As is evident, it is not true, as the appellant asserts, that on the date when the transport waybill was issued Forestry Regents were authorized to issue timber transport waybills in all cases.
A simple reading of the regulations transcribed above shows that there are cases in which the forestry authority reserves to itself the issuance of transport tags and waybills, as is true of the list set forth in Section 1.4 of the Regulations. This entirely refutes the contention that Forestry Regents had unrestricted authorization to issue transport waybills for forest resources. More significantly, however, the timber transported did not match the Certificate of Origin, because it was identified as plantation timber when it actually originated from an agroforestry system. It was also established that the cargo consisted of cedar logs—not residue or branches, but logs with diameters greater than 29 centimeters—and that transporting such logs required both a waybill and tags, regardless of whether the waybill was issued by the Forestry Regent or by the forestry administration. Accordingly, the insertion of false information into the transport waybill for logs constitutes the offense of making a false statement in an official document (falsedad ideológica) in the case before us and warrants the imposition of the corresponding sentence; the authority to issue such waybills is not in dispute. For all the foregoing reasons, the appeal filed by the defense is denied.

Falsedad Ideológica VOTO 131 -21 TRIBUNAL DE APELACIÓN DE SENTENCIA PENAL. Segundo Circuito Judicial de Guanacaste, Santa Cruz, a las nueve horas, treinta minutos del veintitrés de marzo de dos mil veintiuno.
Recurso de apelación interpuesto en la presente causa número 14-001151-0396-PE, seguida contra [Nombre1] , cédula de identidad número CED1, nació el 5 de octubre de 1973, hijo de [Nombre2] y [Nombre3] , por el delito de FALSEDAD IDEOLÓGICA, en perjuicio de LOS RECURSOS NATURALES. Intervienen en la decisión del recurso la jueza Cynthia Dumani Stradtmann y los [Nombre4] Wilson Flores Fallas y Guillermo Arce Arias. Se apersonaron en esta sede, el imputado [Nombre1] , el licenciado Luis Aguilar Herrera como defensor del sentenciado, el licenciado Luis Diego Quesada Canales como representante del Ministerio Público.
RESULTANDO
Redacta el juez Arce Arias; y,
CONSIDERANDO
Revisadas las actuaciones que constan en autos, puntualmente la notificación de la sentencia (f. 158) y la fecha de interposición del libelo impugnaticio (f. 160), se concluye que fue presentado dentro del plazo legal y por los sujetos procesales legitimados, pues fue planteado por la defensa técnica del sentenciado; además se expresan los agravios correspondientes contra un pronunciamiento de fondo. En consecuencia, cumpliendo con los requisitos que permiten conocer los motivos de inconformidad, se declara admisible para su correspondiente examen.
Como se hace constar en los registros respectivos (f. 242), la audiencia oral se realizó con la intervención de las juezas Marlene Mendoza Ruiz, Cynthia Dumani Stradtmann y el juez Wilson Flores Fallas. Sin embargo, como se consigna en el encabezado de esta resolución, para el dictado de esta sentencia la Cámara de Apelación se integra con el juez Guillermo Arce Arias, por cuanto la jueza Mendoza, que se presentó a la vista oral, ocupa otro cargo. Al respecto es prudente mencionar que se ha dispuesto de tal modo, con base en lo indicado por la Sala Constitucional, órgano que ha señalado: "...resulta constitucionalmente válido que en aquellas vistas o audiencias orales de casación en las que no se reciban elementos de prueba en forma oral o, que las argumentaciones de las partes consten ya por escrito, sin que se aporte nada nuevo, puedan intervenir otros jueces, distintos a los que participaron la vista, a la hora de tomar la decisión, si y sólo si, están en capacidad de hacerlo y existen razones justificadas (que deberán constar) que impidan que quienes estuvieron en la audiencia oral se reúnan en fecha próxima a estudiar y resolver el asunto...” (Sala Constitucional, N° 6681 de las 15:30 horas del 10 de diciembre de 1996 y Nº 17553 de las 12:23 h. del 30 de noviembre de 2007)» (Sala Constitucional, N° 6880 de las 15:05 hrs. del 22 de mayo de 2013).
Cabe señalar, entonces, partiendo de lo instruido en el citado antecedente, que en la audiencia oral realizada en esta causa no se ofreció prueba novedosa y no se expusieron alegatos distintos de los aportados por escrito, por lo que el cambio en la integración de este tribunal no implica perjuicio alguno para las partes. Cabe señalar, además, que el juez Arce Arias tuvo acceso a la grabación audiovisual de dicha audiencia y se impuso de la misma de previo a resolver el presente asunto.
Primer Motivo. Violación del debido proceso, por no advertir el quebranto del deber de instruir al acusado mediante una relación oportuna, expresa, precisa, clara, circunstanciada y lógicamente no contradictoria, de los hechos acusados y sus consecuencias legales, en la intimación y en la acusación. Sostiene el apelante que en la acusación no se incluyeron hechos referidos a las circunstancias en las que la guía de madera cuestionada se usó, entre ellas, quién lo hizo, cuándo sucedió, dónde se llevó a cabo, en qué medio la utilizó, tampoco cómo llegó a manos de las autoridades forestales, ni las actividades que realizaron estas para determinar los permisos de corta y procedencia de la madera, ni mucho menos el modo en que esas supuestas declaraciones falsas que se dice se insertaron en la guía, concernientes al hecho que debía demostrar, pudieron generar la posibilidad real de un perjuicio.
Señala en su queja el recurrente, que las omisiones anteriores se aprecian en el momento de la primera intimación de hechos, al momento de ser impuesto de los hechos acusados en juicio, agregando a esto que lo anterior llevó a obviar por parte del tribunal de sentencia, lo afirmado por el testigo [Nombre5] , quien en juicio declaró que los cortes de las trozas no eran recientes, por lo que bien pudieron corresponder a restos de árboles de la especie correspondiente, durante el período de la regencia forestal que realizó el imputado en el sistema agroforestal mencionado, circunstancia que no resulta opacada por el hecho que en el informe de aprovechamiento forestal el mismo haya indicado que no quedaban más árboles por cortar, pues entre el cierre del informe de fecha 17 de junio de 2014 y la fecha de la guía cuestionada, 24 de junio de 2014, transcurrió un corto período de tiempo que permitiría establecer que esas trozas provenían de árboles cortados durante la regencia.
Considera quien reclama, que lo anterior se ve reafirmado porque el encartado aceptó que, al momento de confeccionar la guía de transporte, incurrió en un error al utilizar un formato con información preestablecida, lo que provocó que se indicara erróneamente que se trataba de madera de troza proveniente de plantación, cuando en realidad provenía de un sistema agroforestal. Solicita por este motivo, se declare la existencia de errónea adecuación típica de la conducta acusada, se revoque el fallo y se dicte sentencia absolutoria. El Ministerio Público se opuso a este motivo en audiencia oral solicitando su rechazo. El reclamo no puede prosperar. Al realizar la lectura y análisis de la pieza acusatoria llevada a juicio, la misma superó las distintas etapas procesales, en las que las partes pueden hacer uso de sus derechos y atacar la pretensión fiscal. Es así que, una vez que el asunto llega a juicio, es porque se ha considerado por parte de un juzgador, propiamente el de la etapa intermedia, que la acusación contiene los elementos suficientes para cumplir con los requerimientos exigidos por los artículos 303 y siguientes del Código Procesal Penal.
De esta forma, aun y cuando de manera hipotética existieran falencias en la intimación de hechos realizada por el Ministerio Público al imputado al momento de rendir su declaración indagatoria, en la etapa intermedia se ponen todas las actuaciones en conocimiento de las partes y se otorga nuevamente la posibilidad de ejercer defensa en contra de ese elenco fáctico acusatorio; aun así, elevada la causa a juicio con una acusación admitida jurisdiccionalmente, es en la etapa de debate en la que surgen las mayores garantías para el justiciable a fin de que pueda enfrentar la acusación en su contra. Véase entonces que el diseño de nuestro proceso penal permite al endilgado, durante su tramitación, atacar ante un órgano de carácter jurisdiccional, los hechos imputados en su contra formalmente. Por otra parte, es erróneo pretender que la acusación deba de contener todos y cada uno de los detalles que puedan configurar un supuesto evento criminal, pues lo que se exige es que en ella se encuentren aquellos más relevantes y que permitan el ejercicio de la defensa. De una lectura simple de la acusación en el presente asunto, se tiene que el debate se sustentó en el siguiente cuadro fáctico:
"El acusado [Nombre1] , en su condición de regente forestal, otorgó el certificado de origen número CED2 , con fecha 11 de febrero del 2013 y vigencia hasta 15 de mayo del 2014, en favor de Desarrollos Ganaderos Nueva Era S.A, representada por [Nombre6] (imputado ausente) generando con ello el contrato de regencia 003215 G y autorizando el aprovechamiento en Sistema Agroforestal de las especies de Cedro amargo, laurel roble sabana y madero negro, en la finca del partido de Guanacaste [Dirección1], ubicada en la localidad de Quebrada Grande, conocida como finca [Dirección2] , después del vencimiento del contrato de regencia, en fecha 17 de junio del 2014, el acusado [Nombre1] , realizó un informe de regencia en el cual hizo el cierre del aprovechamiento derivado del certificado de origen citado. Posteriormente, el acusado [Nombre1] , en calidad de regente forestal de Desarrollos Ganaderos Nueva Era, emitió la guía de transporte para madera en troza número 0050697 H, con fecha 24 de junio del 2014, e insertó falsamente en el dato de No de placa asignada: ´´no se requiere por ser producto de plantación``, esto a sabiendas de que el certificado de origen CED3 G el cual respaldaba dicha guía, autorizaba el aprovechamiento proveniente de un sistema agroforestal y no de plantación forestal, además, conociendo el vencimiento del contrato de regencia y la solicitud de cierre del aprovechamiento que había efectuado mediante el informe de regencia antes dicho." (sic) (f.140) Adviértase que, en la anterior exposición de hechos, se logra encontrar aquellos elementos básicos, tales cómo cuándo se dieron los hechos, dónde se llevaron a cabo, el responsable de los mismos y en qué consistió su actuación, todo lo cual permitía al encartado ejercer una plena defensa frente a los mismos, sin que se viera afectada su defensa por no encontrarse descritas todas las indicaciones que se realizan en el libelo de impugnación.
La apelación va dirigida a reclamar la no circunstanciación del uso de la guía calificada de falsa ideológicamente, lo cual no forma parte del núcleo fáctico que se imputa, sino el insertar en un documento auténtico hechos falsos, con la posibilidad de causar perjuicio. En cuanto al reclamo de no señalarse en la acusación referencias a cómo pudo llegar a causar perjuicio el documento, debe recordarse que no se requiere la demostración de la afectación, sino la potencialidad de este, es decir, la posibilidad de que llegue a causar perjuicio sin que se requiera la materialización del mismo, por lo que no es este un aspecto que se exija describir en la acusación de la manera pretendida por el apelante. Refiere en este mismo motivo el recurrente, que el insertar datos falsos en el documento se debió a un hecho no intencional por parte del encartado, reclamo que forma parte de otro motivo más específico y por lo tanto se resolverá en aquel.
Asimismo se sostiene en la apelación que el tribunal de sentencia obvió lo afirmado por el testigo [Nombre5] , al expresar que los cortes de las trozas no eran recientes, por lo que bien pudieron corresponder a restos de árboles de la especie correspondiente durante el período de la regencia forestal que realizó el imputado en el sistema agroforestal mencionado, lo que no es más que una apuesta de la defensa por pretender que una explicación subjetiva de los hechos, una conjetura, deba ser necesariamente la conclusión a la que debieron llegar los juzgadores luego de analizar la totalidad del elenco probatorio evacuado en debate. De lo anterior, esta Cámara no observa ninguna situación en la pieza acusatoria que tuviera la posibilidad al menos de generar agravio a la defensa del imputado y mucho menos que provoque la nulidad del fallo.
Segundo Motivo. Violación al debido proceso, por contradicción en la sentencia, en tanto se basa en una acusación contradictoria y por ello sin validez alguna. Se alega en este motivo que en el primer hecho demostrado de la acusación se afirma que el imputado concluyó su regencia forestal en fecha 15 de mayo de 2014, mientras que en el hecho segundo se expresa que con posterioridad aquella fecha, propiamente el 24 de junio de 2014, el endilgado, ostentando la condición de regente forestal de la mencionada empresa, emitió la guía de transporte cuestionada, lo cual resulta improcedente toda vez que ya había vencido su regencia, por lo que esta contradicción generó un fallo por consecuencia contradictorio. Solicita acoger el reclamo, revocar la sentencia y declarar absolutoria en favor del endilgado. El Ministerio Público, en la vista oral, se opuso solicitando se rechace el motivo. Este reclamo resulta improcedente. De conformidad con los hechos que se tienen como demostrados en la sentencia, se tienen dos eventos claramente definidos y determinados temporalmente, el primero de ellos se refiere a que:
"El acusado [Nombre1] , en su condición de regente forestal, otorgó el certificado de origen número CED2 , con fecha 11 de febrero del 2013 y vigencia hasta 15 de mayo del 2014, en favor de Desarrollos Ganaderos Nueva Era S.A, representada por [Nombre6] (imputado ausente) generando con ello el contrato de regencia 003215 G y autorizando el aprovechamiento en Sistema Agroforestal de las especies de Cedro amargo, laurel roble sabana y madero negro, en la finca del partido de Guanacaste [Dirección1], ubicada en la localidad de Quebrada Grande, conocida como finca [Dirección2] , después del vencimiento del contrato de regencia, en fecha 17 de junio del 2014, el acusado [Nombre1] , realizó un informe de regencia en el cual hizo el cierre del aprovechamiento derivado del certificado de origen citado. (...)" (sic) (f.146) (subrayado no pertenece al original) Seguidamente, se tuvo por demostrado también que:
"Posteriormente, el acusado [Nombre1] , en calidad de regente forestal de Desarrollos Ganaderos Nueva Era, emitió la guía de transporte para madera en troza número 0050697 H, con fecha 24 de junio del 2014, e insertó falsamente en el dato de No. de placa asignada: ´´no se requiere por ser producto de plantación``, esto a sabiendas de que el certificado de origen CED4 el cual respaldaba dicha guía, autorizaba el aprovechamiento proveniente de un sistema agroforestal y no de plantación forestal, además, conociendo el vencimiento del contrato de regencia y la solicitud de cierre del aprovechamiento que había efectuado mediante el informe de regencia antes dicho." (f.146) (subrayado no pertenece al original) De lo anterior resulta que no existe controversia en que se haya demostrado que en el primer hecho el imputado era Regente Forestal y que para el momento en que realizó la Guía de transporte con información falsa, ya había vencido el contrato de regencia, lo que, según se explica en el mismo, era conocido por el endilgado al momento de su confección, lo que no ocasiona contradicción alguna en el fallo, pues resulta de plena conformidad con la prueba evacuada en debate, que el imputado fue el regente forestal de la empresa señalada y que, luego de vencer su contrato, emitió una guía con información falsa, conociendo plenamente esta condición. No se aprecia entonces el yerro que plantea el recurso en este acápite.
Tercer Motivo. Violación al debido proceso por errónea adecuación típica y consecuente errónea imposición de pena, al no haber podido legalmente el imputado expedir la guía de transporte que se cuestiona y por ende no haber tenido ella la condición de documento público, respecto del cual hubiere podido insertar declaraciones falsas concernientes al hecho que el documento debía probar, pudiendo causar perjuicio. Expresa el apelante que el fallo impugnado afirma en su considerando V denominado "Fundamentación Jurídica" lo siguiente: i.- que los hechos demostrados configuran el delito de Falsedad ideológica, ya que el encartado insertó de propia mano en la guía de transporte que la madera provenía de plantación, cuando en realidad lo era de un sistema agroforestal; ii.- que dicha acción se llevó a cabo en un documento público ya que quien la emitió tenía fe pública como regente forestal; iii.- que la acción fue dolosa por el conocimiento y la voluntad de realizar los elementos objetivos antes dichos; iv.- que la acción resultó antijurídica material y formalmente al violentar el bien jurídico fe pública y con ello también el ordenamiento jurídico; v.- que no existieron elementos de prueba que determinaran la existencia de alguna causa de justificación; vi.- que se había configurado la culpabilidad por haberse satisfecho sus elementos.
Considera que los hechos no configuran el delito de falsedad ideológica, pues la sola confección del documento no es suficiente para que se configure "el verbo", pues ese verbo adquiere sentido típico cuando esa inserción de información supuestamente falsa, se hace en un documento público o auténtico, emitido por quien tuviese potestad legal para ello, lo que no se cumple en este caso pues se indica que el imputado tenía fe pública como regente forestal lo que resulta infundado al ser un dato falso, por cuanto de los hechos acusados se tiene que el justiciable dejó de ser regente forestal de esa empresa a partir del 15 de mayo de 2014 al vencer la regencia, esto es que al 24 de junio de 2014 ya no era regente forestal de la empresa de marras, por lo que, no siendo regente forestal para la fecha de los hechos, el verbo nunca pudo configurarse y en consecuencia no tenía facultad legal para emitir la guía y la misma no resultaba así un documento público en el que se hubiere podido insertar declaraciones falsas, lo que, considera el recurrente, trae como consecuencia que tampoco podía configurarse el dolo, pues si bien pudo tener conocimiento y voluntad de hacer la guía, ese conocimiento y voluntad no alcanzaba para cubrir su falta de capacidad legal para hacerla.
Agrega que lo anterior también impediría que se violentara el bien jurídico referido pues el documento no era un documento público ya que al ser emitido el imputado ya no poseía la condición de regente forestal, lo que tiene implicaciones también en el análisis de la culpabilidad por cuanto resultaría irrelevante su estudio frente a la no configuración típica de los hechos. Solicita se dicte en favor del endilgado una sentencia absolutoria. El Ministerio Público en la vista oral solicitó rechazar el motivo. No lleva razón el recurrente. Para una menor comprensión de lo resuelto, es oportuno apreciar la fundamentación jurídica del fallo, al menos en el apartado que así lo indica. La sentencia expresa así lo siguiente:
V.FUNDAMENTACIÓN JURÍDICA..- Los hechos tenidos por demostrados al ser analizados a la luz de la Teoría del Delito y del Principio de Legalidad configura el tipo penal de falsedad ideológica. Se han configurado cada uno de los elementos objetivos de dicho tipo penal. Primeramente se ha tenido por configurado el verbo típico o rector cual es ´´insertar``, ya que se ha tenido por acreditado que el encartado de su propia mano confeccionó la guía de transporte de madera en troza y dentro de la misma escribió, plasmó o insertó las manifestaciones relacionadas con que la madera provenía de plantación cuando en realidad provenían de sistema agroforestal. Asimismo se ha tenido por configurado el elemento objetivo de que dicha inserción lo fue en un documento público, siendo este la Guía de Transporte de Madera en Troza, ya que en dicho documento se inserta informaciones que quien las da posee fe pública como lo es un regente forestal, guía que además por la información que contiene y por la naturaleza debe de probar ante las autoridades policiales que poseen fiscalización en carretera (Policía de Tránsito, Fuerza Pública, entre otros) la madera que es transportada en un determinado vehículo.
Por otra parte, se ha configurado el elemento subjetivo de dicho tipo penal, siendo esta la acción dolosa, ya que como se ha indicado en el acápite de fundamentación intelectiva, el encartado tuvo el conocimiento y voluntad de llevar a cabo los elementos objetivos antes indicados. La acción no solamente resulta ser típica, sino que trasciende hasta la antijuricidad, ya que se violentó el bien jurídico tutelado de la fe pública (antijuricidad material) asimismo como que se violentó el ordenamiento jurídico (antijuricidad formal). No han existido elementos de prueba que determinen la configuración de alguna causa de justificación. Por otra parte, se ha configurado la culpabilidad como último estadio de la Teoría del Delito, siendo que los tres elementos de la culpabilidad se han configurado. En primer término se ha tenido por demostrado la capacidad de culpabilidad, esto es que el encartado para el momento de los hechos era una persona imputable, es decir que actuó sin poseer ninguna enfermedad mental que le impidiera determinar su conducta.
En segundo término se configuró que el encartado poseía para el momento de los hechos entendimiento de la antijuricidad de su conducta, ya que no existe prueba alguna para determinar la configuración de algún error de prohibición de que la acción no estaba ajustada a derecho. En tercer término es posible realizar un juicio de reproche al encartado, ya que poseyendo todas las capacidades mentales para determinar su conducta y teniendo el conocimiento de la antijuricidad no se decantó por lo que era lícito." (sic) (f. 156)
A partir de lo anterior, se aprecia el ejercicio de configuración típica o examen de tipicidad de los hechos, esto frente a los requerimientos objetivos y subjetivos para que el mismo se configure. Así, nuestro Código Penal en su artículo 367 dispone lo siguiente: "Las penas previstas en el artículo anterior son aplicables al que insertare o hiciere insertar en un documento público o auténtico declaraciones falsas, concernientes a un hecho que el documento deba probar, de modo que pueda resultar perjuicio." Establecido así el tipo penal, lo segundo es hacer uso de una sencilla y clara apreciación acerca de lo que interesa en este tipo penal, respecto al cual la doctrina ha señalado:
"La falsedad ideológica -que algunos también llaman histórica- recae exclusivamente sobre el contenido de representación del documento sin que se modifiquen ni imiten para nada los signos de autenticidad. En ella nos encontramos con un documento cuya forma es verdadera, como lo son también sus otorgantes, pero que contiene declaraciones falsas sobre hechos a cuya prueba esté destinado.; en él se hacen aparecer como verdaderos -o reales- hechos que no han ocurrido, o se hacen aparecer hechos que han ocurrido de un modo determinado, como si hubiese ocurrido de otro diferente. (...) En resumen, en el documento ideológicamente falsificado hay una forma auténtica y un documento falso (...) la falsedad ideológica presupone presupone en el agente la obligación jurídica de decir verdad sobre la existencia histórica de un acto o hecho y sus modalidades circunstanciales, en cuanto sean ella productoras de efectos previstos por el derecho." ([Nombre7], .
Derecho Penal Parte Especial. Tomo II. Sexta Edición. Editorial Astrea. Buenos Aires, 1997. Páginas 426 y siguientes) Este acercamiento con la naturaleza del delito de Falsedad Ideológica nos sirve a efectos de dimensionar la importancia de establecer las condiciones que se exigen para que una persona pueda ser autora de este delito, así como el tipo de documento, la información insertada o hecha insertar por el autor, la falsedad de la misma y la capacidad de dicho documento de causar perjuicio, pues lo anterior conforma los elementos objetivos del tipo penal que deben de constatar en los hechos a partir del análisis de la prueba arribada al caso. En consecuencia, teniendo presente que el autor del delito es el fedatario, es el profesional que tiene fe pública y a su cargo conformar y autenticar el documento. De modo que, el hecho de que el imputado haya dejado de ser regente forestal por vencimiento del contrato de regencia, no es óbice para que haya cometido la acción delictiva configurada.
Así, en palabras del apelante, la condición de fedatario público la pierde el regente forestal al concluir el contrato de regencia, lo cual no es cierto, pues a pesar de citar en favor de su tesis la Ley Forestal, propiamente en su artículo 21, se trata de una disposición que se encuentra sistemáticamente incluida en el capítulo I del Título Tercero, el cual se encarga de regular el manejo de los bosques, propiamente de las propiedades privadas cubiertas de bosque, lo que permite considerar que dicha potestad no deviene de esa norma en particular, sino del ejercicio de su profesión. Regresando al tema nuclear de este asunto, el imputado [Nombre1] fue el profesional encargado de emitir el Certificado de Origen número CED5 vigente hasta el día 15 de mayo de 2014 en favor de Desarrollos Ganaderos Nueva Era S.A., mediante un contrato de regencia 003215 G, y posteriormente el informe de cierre de aprovechamiento de fecha 17 de junio de 2014.
Ahora bien el contrato de regencia concluyó, esto no determina per se que, ante las autoridades públicas y la sociedad en general, el ingeniero forestal imputado haya perdido la condición de fedatario público, pues en primer término el informe no fue objeto de evaluación de cierre por parte de la administración forestal, tal y como se desprende de los incisos b), f) del artículo 5 de la ley de marras. En segundo lugar, el Estado y la ley han depositado en él la confianza para que emita o expida documentación de interés público, cuyo contenido resulta esencial para el cumplimiento de obligaciones que corresponden al Estado pero que por razones de dinámica ejecutiva se delegan en este tipo de profesionales, por lo que los documentos expedidos o firmados por él respecto a esa regencia, ante las autoridades nacionales y ante terceros sigue teniendo valor de fe pública, siempre que en ellos conste información de relevancia que se haga valer por terceros ante las instancias correspondientes, lo que estaba en conocimiento también del justiciable, pues tan solo diez días después del cierre técnico de la regencia, el endilgado emitió una guía de transporte de madera en troza, insertando falsamente que el origen de la madera era de plantación cuando en realidad se trataba de un origen agroforestal, más aun, teniendo plena conciencia de que su regencia en esa finca había concluido, lo que constituye un elemento más que se tomó en consideración por los juzgadores de instancia para establecer la responsabilidad del justiciable en los hechos.
Seguidamente, se indica en la fundamentación del fallo transcrita, que se demostró que el imputado fue quien con su propia mano confeccionó la guía de transporte de madera en troza y dentro de la misma insertó la manifestación referida a que no requería de placas porque el origen de la madera era de plantación forestal. Asimismo en la fundamentación se hace referencia al tipo de documento y resulta aquí ventajoso aclarar los términos empleados. La Sala Tercera ha referido en varios de sus fallos que :
"En lo que se refiere a la naturaleza del documento y a las facultades o atribuciones que tenía el justiciable, es preciso hacer las siguientes reflexiones. El artículo 359 del Código Penal dispone la sanción de quien: "...hiciere en todo o en parte un documento auténtico o alterare uno verdadero, de modo que pueda resultar perjuicio..." y el 360 reprime "...al que insertare o hiciere insertar en un documento público o auténtico declaraciones falsas, concernientes a un hecho que el documento deba probar, de modo que pueda resultar perjuicio." Conforme lo expuso la Sala en sentencia No. 70-F-95, de 9:00 horas de 17 de febrero de 1995: "El delito tiene dos objetos alternativos,n el documento público que es el realizado por un funcionario público, no necesariamente vinculado ala administración por un nombramiento, juramentación o representación, sino por otros dos parámetros ue extienden -en el derecho penal- el concepto (sobre ello v. sentencias de la Sala Tercera de la Corte Suprema de Justicia N° 208-F, de 09:30 horas de 10-06-1994, y N° 375-F-de las 10:20 hrs de 23-09-1994); y el documento auténtico realizado por quien, en razón de su profesión, oficio u ocupación, consigna en él declaraciones que se presumen ciertas, aceptadas como verdaderas ante los demás salvo prueba en contrario.
Ejemplos de los anterior son las certificaciones extendidas por contadores autorizados, por notarios o por médicos, los planos de fincas levantados y firmados por topógrafos, la firma autenticada por abogado, etc." El documento auténtico no requiere ser confeccionado por quien detente fe pública. Su característica principal radica en su autenticidad y deriva de la existencia de normas jurídicas que le otorgan esa eficacia, entre ellas las que establecen la necesidad de que ciertos documentos sean elaborados o firmados por una persona que, en virtud de su profesión u oficio, se presume capacitada para conocer el contenido de los datos, su naturaleza y sus consecuencias y se encuentra acreditada ante el Estado o los organismos colegiados profesionales -en los que usualmente se delega la función de registro- para dar cumplimiento a esa actividad. La autenticidad se denota y hace prueba de que el documento fue elaborado o suscrito por las personas que en él se consignan, es decir, es prueba fehaciente de su origen o autoría.
La doctrina civil señala: “No empece a que las presunciones de autenticidad se remiten a la firma (se trata de la identificación del autor), mas no al contenido que tiene que ver con la veracidad, según se analizó, salvo las atinentes a los libros de contabilidad, pólizas de seguros y las actas de las asambleas de los copropietarios de las edificaciones sometidas al régimen de propiedad horizontal, lo claro es que implícitamente la presunción de autenticidad de la firma conlleva al reconocimiento de la veracidad del contenido, porque como desde antaño lo ha sostenido la Corte en doctrina que hoy conserva vigencia, ‘se entiende que nadie autentica con su firma un escrito si no se ha informado plenamente de su contenido; si sostiene lo contrario, tendría que dar la prueba. De ahí que según el art. 642 del C.J., si el documento privado que ha de ser objeto de reconocimientos confiese ser suya la firma para que implícitamente se tenga por reconocida la verdad de las declaraciones que contiene; es decir que reconocida la firma implícitamente se reconoce el contenido del documento.
Es lo natural y explicable, porque se supone que nadie firma sin saber qué firma si puede leer, y si no puede, haciendo que una persona de su confianza le lea lo que va a autenticar. Al contrario si se niega la firma, se entiende negado el contenido del documento. (Ramírez Gómez, José Fernando, La prueba documental: teoría general, Señal Editorial, 4ª ed., Medellín, 1991, p. 90). En el ordenamiento legal costarricense, ciertos documentos deben ser autenticados para que sea posible asignarles la eficacia jurídica que de ellos se pretende, es decir que un simple papel privado (sin el rasgo legal de la autenticidad) es insuficiente para provocar esos efectos (...) Huelga señalar, que los profesionales están obligados a informar la verdad, pues la atribución exclusiva que legalmente se les confirió no solo se funda en consideraciones de carácter técnico, sino que toma en cuenta también los principios éticos que rigen o deben regir la actividad de todo profesional colegiado.
Al optar el legislador por establecer una atribución exclusiva, es decir, negando la posibilidad de que cualquier persona elabore planes de manejo y exigiendo que quien lo haga sea aquella que posea una cierta formación académica y se encuentre incorporada en un Colegio profesional, tal decisión se funda en la confiabilidad y la credibilidad que se estima pueden tener esos profesionales. Se les atribuye una función (que, eventualmente, el mismo Estado podría realizar) y no un privilegio o una simple concesión que pueda ser objeto de abuso. Ya se vio que los planes de manejo se encuentran específicamente regulados (es decir: han de cumplir con ciertos requisitos legales mínimos) y la atribución exclusiva a la que se ha hecho referencia, conlleva la autenticidad del documento, respaldado por la firma del profesional inscrito en un colegio y autorizado para ejercer su profesión." (Sala Tercera voto 00396-2006 y en este mismo sentido v. Sala Tercera voto 00406-2007) Por lo anterior, y sumando a ello lo dispuesto por el "Reglamento de Procedimientos para el Aprovechamiento Maderable en terrenos de uso agropecuario y sin bosque y situaciones especiales" R-SINAC-028-2010, las "guías de transporte de madera, son documentos "auténticos" en el tanto se encuentran específicamente regulados y cuya confección se atribuye a ciertos profesionales, en este caso Ingenieros Forestales, que poseen amplias facultades de certificar datos relevantes ante la administración forestal u otras autoridades nacionales, por lo que aquellos profesionales que las emitan están obligados a informar la verdad, pues esa atribución exclusiva les fue otorgada por el ordenamiento jurídico con base en consideraciones de carácter técnico y ético.
Si bien en la sentencia se indica que la guía de transporte se trata de un documento público, que se considere ahora que es un documento auténtico no causa ninguna afectación al sentido y logicidad, ni afecta la derivación probatoria de los hechos, ni requiere de un reenvío para su corrección, pues ambos términos, se encuentran descritos en el tipo penal aplicado. Seguidamente se señala en la sentencia que la guía elaborada por al encartado, ese documento con la información que contiene, es prueba ante las autoridades policiales y fiscalizadoras en carretera de la madera que se transporta, la cantidad, tipo y origen de la misma -entre otras cosas- de ahí la posibilidad de causar perjuicio, pues puede ser utilizada con la finalidad de evadir el control y la fiscalización oportuna sobre la explotación forestal, tal y como en el presente caso sucedió. Véase entonces que los elementos objetivos del tipo penal se encuentran efectivamente descritos y fundamentados en el apartado de la sentencia correspondiente al análisis jurídico, pero también en la fundamentación intelectiva, pues la sentencia es una unidad lógica que debe apreciarse de manera integral como un todo.
Finalmente, en cuanto al elemento subjetivo del tipo penal, las razones por las cuales llegaron a considerar los juzgadores de juicio que se trató de una acción dolosa y no descuidada del encartado al emitir la guía de transporte, es ampliamente desarrollada en el fallo, con indicación precisa de las circunstancias de hecho utilizadas para ello. Así, dispone la resolución de interés lo siguiente:
"Las razones por las cuales el Tribunal he (sic) tenido por demostrado la acción dolosa del encartado y descartada la versión del error material del imputado son las siguientes: Primero. se he (sic) tenido por demostrado que el imputado contaba para el momento de la confección de la Guía de Transporte con una vasta experiencia, lo que le permitía diferenciar entre un sistema agroforestal y un sistema de plantación, además de que dicha experiencia le requería asegurarse y cersiorarse de la información que plasmaba en documentos públicos en los cuales daba fe pública de lo que estaba insertando. Nótese que en la declaración del imputado se tiene que este indicó que poseía treinta años de ser profesional forestal (...) de tal manera que los años de experiencia indicados por el imputado no permiten tener como creíble que esto se debió a un simple error material o involuntario, pues incluso nótese que esa información no solamente se insertó en la primera parte de dicha Guía de Transporte de Madera en Troza, sino que también se inserto en la parte inferior denominada "Comprobante para uso de la Industria Forestal" lo que a criterio del Tribunal permite excluir la tesis del error involuntario (...) Segundo.
Se ha tenido por demostrado que el encartado conocía que esa guía ya no la podía emitir porque ya el contrato de regencia y el certificado de origen habían vencido, pues se ha tenido por acreditado que este venció el 15 de mayo del 2014 y la guía se emitió el 24 de junio de ese mismo año. Nótese que incluso el mismo imputado reconoció esa situación, esto al indicar en su declaración que ´´ se confeccionó una guía de transporte de residuos de madera de cedro para el certificado de origen habiendo ya cerrado el contrato de regencia ...el contrato de regencia pierde valía cuando se da por cerrado, que es cuando se hace el informe de regencia con el cierre de los planes de aprovechamiento. (...) Tercero. Considera el Tribunal que la actuación del encartado fue dolosa y no por desconocimiento o error material, ya que debe de sumar a los anteriores aspectos, que existe una diferencia sustancial entre insertar en una guía de transporte de madera en troza que los recursos madereros provienen de plantación y que por ello no se requieren placas, como se ha tenido que se consignó en dicha guía, e insertar que proviene de un sistema agroforestal, tal y como se ha tenido por demostrado que era el sistema del cual provenía la madera que era transportada al momento de la detención.
(...) el encartado [Nombre1] manifestó lo siguiente ´´ ese documento fue extendido para trasladar los residuos de los árboles cuyo aprovechamiento estaba amparado en ese certificado. Entonces la guía de transporte que se hizo es para los residuos de cedro de ese certificado ya que para el tiempo de la regencia no se sabía sobre el uso específico que le iban a dar a esos residuos, si era para leña u otra utilidad... la guía era para las ramas, ya que los troncos habían sido trasladados" declaración que estima el Tribunal no puede resultar creíble por las siguientes razones: Lo primero que debe de indicarse es que el imputado había ido al campo a revisar los supuestos residuos de la madera que iban a transportar, esto al indicar ´´ para la confección de la guía fui al campo a revisar los residuos para ver que se trata del mismo árbol amparado en el certificado de origen´´ información que permite tener como cierto que el señor [Nombre1] observó los supuestos residuos de madera que se iban a transportar siendo que así lo consideró -que eran residuos de madera- según su dicho, lo que no resulta creíble que hayan sido residuos porque resulta ilógico que para transportar residuos de madera se haya tenido que confeccionar guía de transporte de madera en troza (...) La declaración del imputado con relación a que la guía se confeccionó porque era para transporte de residuos no resulta creíble en el sentido de que las manifestaciones del encartado se han encontrado serias contradicciones, tales como que primeramente el imputado indicó que ´´la guía era para ramas, ya que los troncos habían sido trasladados´´ lo que resulta contradictorio con lo consignado en la propia Guía de Transporte para Madera en Troza donde insertó en el cuadro denominado "información de la Madera que Transporta" que se transportaba 18 trozas de cedro amargo, lo que no permite credibilidad al dicho en juicio por parte del señor [Nombre1] .
(...) Cuarto. (...) siendo este la hora en que se transportaba la madera, lo cual era una hora no habilitada para realizar dicho transporte, lo que determina que buscó esa hora para procurar no ser descubierta la información falsa contenida en dicha guía y consecuentemente que la madera no fuera decomisada. " (sic)(negrita corresponde al original) (f. 149 y siguientes) Entonces se considera que la determinación del actuar doloso del imputado fue establecido a partir de varias consideraciones, todas las cuales, efectivamente, analizadas de manera integral, permiten establecer que el justiciable [Nombre1] tenía pleno conocimiento de su actuar y bajo esa apreciación cognoscitiva de los elementos necesarios para la configuración del hecho, decidió realizarlo con plena voluntad. De esta forma, la acción típica resultó contraria al ordenamiento jurídico, lo que es más que evidente, y afectó el bien jurídico fé pública, pues insertó datos falsos en un documento auténtico que fue utilizado ante las autoridades para evadir el control de las autoridades sobre la explotación forestal nacional. De ahí que la sentencia es clara y contundente en establecerlo de esa forma, sin que se aprecie error alguno en ello.
Cuarto Motivo. Violación al debido proceso por errónea adecuación típica de los hechos acusados y consecuente errónea imposición de pena, al no advertir que existía deber alguno de portación de una guía de transporte para movilización de madera en troza, que pudiese haber sido violado, por insertarse en aquella guía supuestas declaraciones falsas que ese documento debía probar, pudiendo así deparar perjuicio. Considera el apelante que contrario a lo que indica el fallo impugnado, para el año 2014 en que se emitió la guía de transporte, los regentes sí estaban habilitados para expedir esas guías, tanto en plantaciones forestales como en sistemas agroforestales, autorizados así por el Manual de Procedimientos para el Aprovechamiento Maderable en Terrenos de Uso Agropecuario y Sin Bosque y Situaciones Especiales en Costa Rica, resolución R-SINAC-028-2010 de 28 de junio de 2010 publicado en Gaceta número 163 que dispone: "Para los casos de plantaciones forestales, sistemas agroforestales y árboles plantados, será el Regente Forestal quien expedirá las guías de transporte de madera proveniente de dichas casos, con las salvedades consideradas en el Reglamento de Regencias vigente." la cual el imputado alegó en su defensa al deponer ante el Tribunal de juicio, sin que los juzgadores se preocuparan por ello, cometiendo el error de expresar en la sentencia que fue un elemento no demostrado, considerando así que las normas están sometidas a ser "probadas", pese a que es ampliamente conocido que las normas no se someten a demostración.
El Ministerio Público se opuso a este motivo en audiencia oral. El motivo debe rechazarse. No puede inobservarse que el apelante describe un error que cometió el Tribunal de juicio al analizar, cual fue pretender que se llevara prueba a juicio a cerca de la existencia de reglamento R-SINAC-028-2010. En la sentencia se puede leer lo siguiente: "No omite el Tribunal de valorar y analizar que el imputado se refirió a este aspecto en su declaración, esto al indicar lo siguiente "en 2010 se dio la posibilidad de que el regente forestal pudiera extender guía de transporte para esas tres modalidades mencionadas... (sic) no hay diferencia para el regente en cuanto a la confección de la guía si el árbol ha sido de crecimiento natural o de plantación. La capacitación del 2015 fue porque en ese año hubo un decreto donde se decía lo mismos del Manual de Procedimientos para Aprovechamiento de árboles en terreno de uso agropecuario no boscoso.
En ese momento se quitó la facultad al regente de que hiciera guías para el transporte de madera que provenga de sistemas agroforestales y se les dejó exclusivamente para que extendieran las guías para madera que fuera procedente de plantaciones y a partir de ese momento las guías procedentes de sistemas agroforestales solo se extendían por parte de Minaet. En las plantaciones forestales desde 2015 para acá, las guías de transporte de ese sistema han quedado en dominio de los regentes forestales privados." (...) declaración que no posee sustento probatorio alguno porque no existe prueba que demuestre que durante el año 2014 -año de elaboración de la guía de transporte de madera- existiera esa habilitación por parte de la administración forestal, nótese que el imputado indicó que existía una resolución que era 28-2010 sin embargo no se cuenta con dicha resolución aún y cuando el imputado dijo que la iba a aportar para comprobar su dicho y no lo hizo." (sic) (f. 152) Evidentemente hay un yerro en el tribunal de mérito al pretender someter a demostración la existencia de normativa.
Sin embargo esa equivocación no tiene el peso suficiente para ocasionar la nulidad del fallo ni su modificación. El Manual de Procedimientos para el Aprovechamiento Maderable en Terrenos de Uso Agropecuario y sin Bosque y Situaciones Especiales en Costa Rica, del Sistema Nacional de Áreas de Conservación, R-SINAC-028-2010, dispone de interés lo siguiente:
"CAPÍTULO III.- Dispositivos de control.- Acorde con los artículos 31 y 56 de la Ley Forestal Nº 7575 y los artículos 30, 31 y 32 del Reglamento a dicha Ley, donde se establece el uso de dispositivos de verificación de control para madera en tránsito y en industrias forestales; y con la finalidad de dar seguimiento y control al aprovechamiento forestal, se utilizará la guía para transporte de madera (en troza o aserrada) como dispositivo de demostración de los permisos de corta y procedencia de los productos forestales. Cuando los productos forestales correspondan a trozas que no corresponden a Plantaciones Forestales, estas deberán portar en forma individual placas plásticas numeradas.
1. Procedimiento para la entrega de los dispositivos de control. A continuación se detallará los procedimientos para la entrega, empleo de guías, placas plásticas y otros dispositivos para el transporte de madera.
1.1 Responsables de la custodia y entrega de guías y placas:
1.1.1 Cada Área de Conservación a través del encargado administrativo o funcionario (a) que el Director Regional designe, gestionará ante el Departamento de Proveeduría del SINAC la obtención de guías y placas para todas las Subregiones y las distribuirá a cada Oficina Subregional. (...)
1.2 La entrega de guías y placas debe efectuarse contra boleta de autorización firmada por el Jefe Subregional o el funcionario competente que este designe para tal fin, misma que debe quedar en el expediente (ANEXO 17). Para los casos de: plantaciones forestales, sistemas agroforestales y árboles plantados, será el Regente Forestal quien expedirá las guías de transporte de madera proveniente de dichos casos, con las salvedades consideradas en el Reglamento de Regencias vigente.
1.2.1 El Jefe Subregional o designado emitirá la boleta de entrega de guías y placas, previa revisión del Informe de Regencia, mismo que debe cumplir con lo establecido en el Reglamento de Regencias vigente. Así mismo los funcionarios de la AFE, deberán verificar: (...)
[...] Que el informe de regencia se encuentre amparado a un contrato de regencia que cumpla con lo establecido en el Reglamento de Regencias vigente.
[...] Que las guías no utilizadas sean devueltas a la AFE, conjuntamente con las copias de las guías utilizadas debidamente llenas y selladas por la industria que recibió la madera (los sellos deben llevar dirección y razón social), las cuales se adjuntarán al expediente. (...)
1.4 La AFE se reservará la entrega de placas y guías de transporte para las siguientes categorías de permisos:
a. Solicitudes en terrenos de uso agropecuario y sin bosque, que no excedan los tres árboles por hectárea, hasta un máximo de 10 árboles por inmueble por año (PUA-Pp).
b. Solicitudes en predios que no superen los 3 árboles maderables por hectárea y que exceden los 10 árboles por inmueble por año (PUA-IF).
c. Solicitudes especiales contempladas en la legislación ambiental nacional (PE).
d. Solicitudes de aprovechamiento en áreas de bosque (Planes de Manejo en Bosque); lo anterior tomando en cuenta las consideraciones particulares establecidas en el Reglamento de Regencias vigente.
1.5 La entrega de guías y/o placas para transporte de productos procedentes de árboles plantados individualmente (CO-AP) y Sistemas Agroforestales (CO-SAF), según corresponda, se hará contra entrega del Certificado de Origen (CO), así como de la copia del contrato de regencia forestal inscrito en el Colegio de Ingenieros Agrónomos. A este Certificado se le colocará un sello de recibido de la Oficina Subregional correspondiente de la AFE, indicando fecha de recibido, nombre y firma del funcionario designado por el Jefe Subregional para este acto.
1.5.1 El Certificado de Origen (CO), será único (solo un documento por aprovechamiento a efectuar por inmueble) y formulado en papel de seguridad del CIA, con copia para la AFE; éste deberá ser elaborado y firmado por un Regente Forestal. Dicho Certificado de Origen (CO) deberá contener a información mínima requerida de conformidad con el Reglamento de Regencias vigente.
1.5.2 Aquel Certificado de Origen que no cumpla con lo establecido en el Reglamento de Regencias vigente, no se le estampará el sello de recibido al que hace referencia el punto anterior del presente documento y en consecuencia no se autorizará o entregará las guías y placas.
1.6 Para el transporte de madera en troza se utilizará el sistema de placas plásticas definido en el Decreto Ejecutivo vigente para tal efecto, empleando placas color anaranjado para madera procedente de sistemas agroforestales y placas de color amarillo para trozas procedentes de terrenos de uso agropecuario y sin bosque o trozas provenientes de Planes de Manejo Forestal en bosque. (...)
2. Disposiciones generales para los dispositivos de control 2.1 De conformidad con el artículo 42 de la Ley Forestal Nº 7575, se considera troza a la sección del árbol libre de ramas, con un diámetro mayor o igual a 29 centímetros en el extremo más delgado, por tanto, las piezas rollizas que no cumplen esta condición no requerirán guías ni placas para ser transportadas. Esto implica que por ninguna razón se otorgará guías y placas para piezas rollizas con diámetros inferiores a 29 centímetros.
2.2 Toda madera en troza, escuadrada o aserrada, deberá portar la guía de transporte correspondiente, diseñada para tal efecto por la AFE y por el CIAgro, según corresponda; documento que no podrá extenderse con una vigencia superior a dos meses.
2.3 Sólo podrá transportarse sin placas las trozas procedentes de plantación, sistemas agroforestales y árboles individuales, con las excepciones que incluye la Ley Forestal. (...)" De la lectura de la normativa reglamentaria detallada, se logra extraer varios aspectos importantes, el primer lugar que durante el período de vigencia de este Reglamento, se facultó al regente forestal para emitir guías; que la emisión de las guías debe de estar conforme al certificado de origen; que la consideración de troza es aquella sección del árbol libre de ramas con un diámetro mayor o igual a 29 centímetros; que para transportar trozas deben de portar la guía de transporte y además debe utilizar el sistema de placas, y finalmente, que en ciertos casos, el regente forestal esta autorizado para emitir las guías de transporte para madera proveniente de sistemas agroforestales. Como resulta evidente, no es cierto, como lo afirma el recurrente, que para la fecha en que se emitió la guía de transporte los regentes estuvieran habilitados para la expedición de las guías de transporte de madera en todos los casos, pues de una simple lectura de la regulación supra transcrita, se extrae que existen casos en los que la autoridad forestal se reserva la entrega de placas y guías de transporte, tal es el caso de la lista descrita en el punto 1.4 del Reglamento; esto desvirtúa por completo la apreciación de una autorización plena a los regentes forestales para la emisión de guías de transporte para recursos forestales.
Sin embargo, más evidente resulta que la madera transportada no correspondía con el certificado de origen, pues se indicó que era de plantación cuando lo cierto es que provenía de un sistema agroforestal, así como que se transportaban trozas de cedro, no residuos ni ramas, sino trozas con un diámetro superior a los 29 centímetros, como también quedó demostrado; asimismo que para transportar esa madera en troza se requería de una guía y placas, indistintamente de si la guía fuera emitida por el regente forestal o la administración forestal. De esta forma, el insertar datos falsos en la guía de transporte de madera en troza es lo constitutivo del delito de falsedad ideológica en el caso que nos ocupa y con ello la imposición de la pena correspondiente, sin que la facultad de emitir esas guías esté en discusión. Por todo lo anteriormente dispuesto, se declara sin lugar el recurso de apelación interpuesto por la defensa.
POR TANTO
Se declara sin lugar el recurso de apelación interpuesto. NOTIFÍQUESE.
