Document Review DECISION 100-20 TRIBUNAL DE APELACIÓN DE SENTENCIA PENAL. Segundo Circuito Judicial de Guanacaste, Santa Cruz, at sixteen hours and twenty minutes on February 26, 2021.
Appeal (recurso de apelación) filed in the present case number 20-000087-1260-PE, brought against [Nombre1], identity card CED1, born on May 19, 1994, child of [Nombre1]; and [Nombre2], identity card CED2, born on October 22, 1993, child of [Nombre3] and [Nombre4], for the offense of MOVEMENT OF TIMBER FROM A FOREST OR PLANTATION WITHOUT PERMITS, to the detriment of NATURAL RESOURCES. Judges Rodrigo Guillermo Obando Santamaría and Wilson Flores Fallas, and Judge Cynthia Dumani Stradtmann, participate in deciding the appeal. Attorney Nancy Salguero Caicedo and Attorney Luis Diego Quesada Canales appeared before this court as representatives of the Ministerio Público.
PROCEDURAL BACKGROUND
Judge Obando Santamaría drafts the opinion; and,
CONSIDERING
I- Admissibility: Having reviewed the proceedings contained in the record, specifically the service of notice (notificación) of the judgment and the date on which the prosecutorial representative filed the appeal, the Court concludes that it was brought before the courts within the statutory period. In addition, the corresponding grounds of error (agravios) are asserted against a decision on the merits by parties with standing, thereby satisfying the requirements for consideration of the grounds for disagreement.
I- Substance of the appeal: The written appeal submitted by Prosecutor Nancy Salguero Caicedo appears on pages 56 through 62 and states as its sole ground for appeal: “Erroneous Assessment of the Evidence and Violation of the Rules of Rational Sound Judgment Due to Erroneous Inference from the Evidence” (sic). The petitioner contends that the assessment of the evidence contains a flawed reasoning error that culminated in the finding that the acts did not constitute an offense, whereas an assessment under the rules of sound judgment (sana crítica) would have established that the defendants were moving timber without carrying a transportation permit, invoices, or a certificate of origin, as charged by the Ministerio Público. She reviews the testimonial evidence to establish two points that, in her view, were not properly assessed by the trial court (a quo): i- That defendants [Nombre2] and [Nombre1] were driving a truck carrying timber without any supporting documentation and, when stopped by Officer José Zúñiga Rodríguez, they called their employer, who produced the purchase invoice, although it bore a time later than the time when the goods were stopped. ii- That the expert witness (perito) [Nombre7] stated that the timber was sawn timber and that the corresponding purchase invoice was required; when it is not carried—as in this case—the conduct constitutes illegal transportation because it cannot be established that the timber came from lawful sources throughout the chain from the field to the industry.
In her view, the cited statements, together with the evidence submitted by the defense itself, proved that the invoice was issued after the sale, thereby establishing the offense because the carriers lacked a document authorizing the movement. This was overlooked by the trial judge, who failed to assess all the evidence properly and failed to consider the precautionary principle (principio precautorio) that permeates environmental legislation. The foregoing is asserted as grounds of error, and she requests that the judgment under appeal be vacated and that the case be remanded for new proceedings. The claim cannot succeed. Based on the objections raised, the Court has meticulously examined the judgment under appeal because, in keeping with the review function of the appellate stage (etapa impugnaticia), this Chamber has consistently held that the required statement of reasons for a judgment is a fundamental pillar of due process (debido proceso), since its absence, under Article 142 of the Code of Criminal Procedure, renders the judgment ineffective.
Accordingly, it must be determined whether the challenged decision satisfies the requirement that it be clear, sufficient, lawful, and consistent with the rules of rational sound judgment. With those principles in mind, this appellate panel reviewed the oral content of the decision contained in the corresponding digital format (file 200000871260PE-11082020021138-2_Multi.MP4), which described the events at trial, summarized the evidence, and established the proven and unproven facts based on a reasoned analysis of the evidentiary elements (a sequence running from 21:02 to 38:15). It determined that, although the defendants were indeed apprehended while transporting the forest product at issue (58 formwork boards of the caña fistula species), that conduct did not constitute an offense because they did have a document supporting the purchase, although they were not carrying it at the time. The Court chose to apply that conclusion based on the evidence as a whole, since it was undisputed that both defendants were transporting sawn timber in the truck bearing license plate [Placa1].
Nevertheless, Judge Ana Isabel Chaves López properly weighed the facts by considering the legally protected interest (bien jurídico tutelado) under the Ley Forestal, namely the protection of natural resources. As the trial judge appropriately noted (timestamp 23:20 to 36:22), the Ministerio Público brought a charge based on formalistic criteria without weighing substantive unlawfulness (antijuridicidad material) or determining whether intentional conduct could be attributed to the accused, who were following the instructions of their employer, [Nombre5]. His testimony established that he instructed his employees to go to Aserradero La Mansión and collect the formwork boards at issue, but because that establishment was already closed at that hour, the invoice was sent to him later. The purchase nevertheless did occur, and he identified the document on page 33 as evidence of the lawful acquisition.
Those assertions were corroborated by [Nombre8], the owner of the sawmill, who stated that his business sold the pieces to [Nombre5], but because it was nighttime, the person responsible for issuing the invoice was no longer at the establishment. Nevertheless, after his customer’s employees were detained, he found a way to deliver the invoice to him, although this did not occur until hours later. Thus, the decision was properly based on the fact that, although a document authorizing the movement is required to transport forest products under Section 56 of the Ley Forestal, which provides: “Timber in log, squared, or sawn form originating from a forest or plantation may not be moved without the corresponding documentation,” that documentation did in fact exist, although the defendants were not carrying it at the time of the events. The documentary evidence nevertheless establishes that the product had a lawful origin, which is what the cited legislation requires.
Furthermore, the submission of the invoice (page 33) on the same day as the apprehension complied with Article 55 thereof, which provides that such documentation must be produced at the request of the Forestry Administration (Administración Forestal) to establish provenance. This is consistent with the precautionary principle governing natural resources, which is one of the principal purposes of the legislation, as provided in its first section:
“This law establishes, as an essential and priority function of the State, the duty to ensure the conservation, protection, and administration of natural forests and the production, use, industrialization, and promotion of the country’s forest resources intended for that purpose, in accordance with the principle of the proper and sustainable use of renewable natural resources.” Both the statement of the defendant (imputado), [Nombre2], and the testimony of the owner of the sawmill, [Nombre8], and the owner of the timber, [Nombre5], established that the seized pieces originated from a legitimate source, although the document recording the purchase was issued afterward—certainly an undesirable practice, but one that cannot be deemed criminal, because it was demonstrated that the timber had been lawfully acquired. As the Forestry Agency official, Orlando Matarrita Suárez, aptly noted in his testimony, the purpose is to establish that the product originates from lawful sources throughout the process, from cultivation to industrialization, which in this case was established by the body of testimonial and documentary evidence.
As the a quo held, this is a matter of statutory elements (tipicidad), and a sequential analysis must clearly be conducted in accordance with the theory of criminal liability (teoría del delito). In the sub exámine, there is an apparent absence of criminal intent (dolo), which entails knowledge and intent to carry out the objective elements of the offense (elementos objetivos del tipo); under the most basic principles of general criminal law, this is known to be the subjective element comprising the statutory elements, because without knowledge and intent there can be no conduct satisfying those elements. The conclusion that the subjective element of the offense was absent in this case was therefore correct. The failure to carry the invoice or transport permit (guía) could constitute an administrative violation (falta administrativa), but it is not sufficiently serious to support a finding that Ley Forestal was intentionally violated, because the parties subject to adjudication (justiciables) provided an immediate explanation to the police authority, there was no concealment of any kind, and the owner of the timber promptly appeared before the Fuerza Pública with the documentation.
Nevertheless, his employees had already been referred to the Fiscalía, where they were required to remain in detention for conduct that clearly did not constitute an offense. The consistent approach displayed by the trial judge in limiting the exercise of the State’s punitive power (ius puniendi), which must not be arbitrary and is subject to limits of legality and reasonableness that the a quo correctly recognized, should be emphasized. This entails the need to uphold the challenged decision because it accords with legal standards and reflects respect for citizens’ fundamental guarantees and rights. Finally, it is appropriate to recall that one of the stages in the theory of criminal liability is unlawfulness (antijuridicidad), which is not limited to the absence of grounds of justification (formal unlawfulness) but also encompasses harm (lesividad) to the protected legal interest (bien jurídico tutelado).
None of the evidence cited by the appellant would be capable of establishing that the temporary absence of the formal documents adversely affected the State’s interest in protecting forest resources. In this regard, it is important to consider that current prosecutorial criminal policy (política criminal persecutoria) omits from its theory of the case (teoría del caso) the component of substantive unlawfulness (antijuridicidad material), an aspect for which the legislature also provided through prosecutorial discretion based on the negligible harmfulness of the act (criterio de oportunidad por insignificancia de la lesividad del hecho), which should likewise be considered by the sentencing court. Accordingly, it would benefit the entire national criminal justice system to restore both the analysis of substantive unlawfulness as a component of the criminal wrong (injusto)—an analysis that does not appear to have been conducted in this case—and the sound practice of assessing, at every stage of the proceedings, the reasonableness of criminal prosecution in a democratic state governed by the rule of law. For the reasons stated, the ruling must be upheld and the appeal denied.

Revisión del Documento VOTO 100-20 TRIBUNAL DE APELACIÓN DE SENTENCIA PENAL. Segundo Circuito Judicial de Guanacaste, Santa Cruz, a las dieciséis horas y veinte minutos del veintiséis de febrero de dos mil veintiuno.
Recurso de apelación interpuesto en la presente causa número 20-000087-1260-PE, seguida contra [Nombre1] , cédula de identidad CED1, nació el 19 de mayo de 1994, hijo [Nombre1] , [Nombre2] , cédula de identidad CED2, nació el 22 de octubre 1993, hijo de [Nombre3] y [Nombre4] , por el delito MOVILIZACIÓN DE MADERA DE BOSQUE O PLANTACIÓN SIN PERMISOS, en perjuicio de LOS RECURSOS NATURALES. Intervienen en la decisión del recurso los jueces Rodrigo Guillermo Obando Santamaría, Wilson Flores Fallas y la jueza Cynthia Dumani Stradtmann. Se apersonó en esta sede, la licenciada Nancy Salguero Caicedo y el licenciado Luis Diego Quesada Canales como representantes del Ministerio Público.
RESULTANDO
Redacta el juez Obando Santamaría; y,
CONSIDERANDO
I- Sobre la admisibilidad: Revisadas las actuaciones que constan en autos, puntualmente la notificación de la sentencia y la fecha de interposición del recurso del representante fiscal, se concluye que fue traído a estrados judiciales dentro del plazo legal; además se expresan los agravios correspondientes contra un pronunciamiento de fondo y por los sujetos legitimados, cumpliendo con los requisitos que permiten conocer los motivos de inconformidad.
I- Sobre el contenido del recurso: En los folios 56 a 62 es visible el escrito de apelación que presentó la fiscala Nancy Salguero Caicedo, señalando como único motivo de apelación “Errónea valoración de la Prueba y Violación a las reglas de la Sana Crítica Racional por Errónea Derivación de la prueba” (sic). La petente propone que la valoración probatoria contiene un falso error de raciocinio que culminó en considerar los hechos como atípicos, cuando de ponderarse conforme a las reglas de la sana crítica se habría acreditado que los acusados movilizaban madera sin portar la guía de transporte, facturas o certificado de origen, que fue lo acusado por el Ministerio Público. Repasa la prueba testimonial para acreditar dos aspectos que, en su criterio, no fueron correctamente apreciados por el a quo: i- Que los justiciables [Nombre2] y [Nombre1] conducían un camión con madera, sin tener ningún documento de respaldo y cuando fueron requeridos por el oficial José Zúñiga Rodríguez llamaron a su patrón y él presentó la factura de compra pero traía una hora posterior al abordaje de la mercadería. ii- Que el perito [Nombre7] afirmó que se trataba de madera aserrada y que se requería la factura correspondiente a la adquisición, cuando no se porta -como en el caso- se incurre en transporte ilegal porque no se puede acreditar que proviene de fuentes legales desde el campo hasta la industria.
En su criterio con las afirmaciones citadas junto a la misma prueba aportada por la defensa, se comprobó que la factura fue emitida después de la venta, con lo cual quedó configurado el delito porque los transportistas carecían de un documento que legitimara la movilización, lo cual fue soslayado por la juzgadora de instancia al no valorar debidamente toda la prueba, dejando de considerar el principio precautorio que permea la legislación en materia ambiental. Lo anteriormente dicho es aducido como agravio y solicita que se anule la sentencia traída en alzada y se disponga el reenvío para nueva sustanciación. La queja no puede prosperar. A partir de los reparos planteados, se ha examinado de forma puntillosa el fallo venido en alzada, pues conforme a la función contralora que le corresponde a la etapa impugnaticia, esta Cámara ha sido reiterada en lo que atañe a la necesaria fundamentación de la sentencia como pilar conformante del debido proceso, pues su ausencia, al tenor del artículo 142 del Código Procesal Penal, produce la ineficacia del fallo; ante lo cual debe hacerse un escrutinio respecto de si la decisión combatida cumple con la exigencia de ser clara, suficiente, legítima y respetuosa de las reglas de la sana crítica racional.
Considerando dichas bases para el análisis, este Colegio de alzada se impuso del contenido oral de la resolución que consta en el formato digital respectivo (archivo 200000871260PE-11082020021138-2_Multi.MP4), en la que se describió los actos del debate, el sumario de la prueba y se fijaron los hechos probados e indemostrados a partir del análisis razonado de los elementos de convicción (secuencia que abarca de 21:02 a 38:15), estableciendo que si bien es cierto fueron aprehendidos cuando transportaban el producto forestal de marras (58 formaletas de la especia caña fistula), esa conducta no constituye delito porque sí contaban con un documento que respaldó la compra, pero en ese momento no lo portaban. El Tribunal se decanta por aplicar esa figura atendiendo a la integralidad de la prueba, pues no fue controvertido que ambos acusados transportaban en el camión placa [Placa1] madera aserrada, sin embargo la juzgadora Ana Isabel Chaves López hizo una correcta ponderación de los hechos, al considerar el bien jurídico tutelado por la Ley Forestal que es la protección de los recursos naturales.
Como apropiadamente lo señaló la jueza de instancia (punto horario de 23:20 a 36:22), el Ministerio Público planteó una acusación basada en criterios formalistas sin ponderar la antijuridicidad material y si hubo una conducta dolosa atribuible a los encartados, quienes estaban siguiendo las indicaciones de su patrón [Nombre5] , cuyo testimonio dejó asentado que él giró instrucciones a sus empleados para que acudieran al Aserradero La Mansión y recogieran las formaletas de marras, pero que como ese establecimiento ya estaba cerrado a esas horas, la factura se la remitieron después, pero que sí existió la compra e identifica el documento de folio 33 como el respaldo de la adquisición legítima. Esas aseveraciones fueron corroboradas por [Nombre8] , propietario del aserradero quien aseguró que su negocio vendió a [Nombre5] las piezas, pero que al ser horas de la noche, el encargado de expedir la factura ya no estaba en el establecimiento, sin embargo ante la detención de los trabajadores de su cliente, él buscó la forma de hacerle llegar la factura pero fue hasta horas después.
Entonces, de manera acertada se fundamentó la decisión en que si bien para transportar productos forestales se requiere de un documento que ampare la movilización, según el numeral 56 de la Ley Forestal, que reza: "No se podrá movilizar madera en trozas, escuadrada ni aserrada proveniente de bosque ni de plantación, si no se cuenta con la documentación respectiva", lo cierto es que esa documentación sí existía pero los acusados no la portaban para el momento de los hechos, sin embargo consta en la prueba documental que hubo un origen lícito del producto, que es lo exigido por la normativa de cita. Incluso, con la presentación el mismo día de la aprehensión, de la factura (folio 33) se cumplió con lo estipulado en el artículo 55 ibídem, que señala que dicha documentación debe ser presentada a requerimiento de la Administración Forestal, a efectos de acreditar la procedencia, lo cual es consecuente con el principio precautorio de los recursos naturales que es una de las finalidades preponderantes de la legislación, según dispone su numeral primero:
"La presente ley establece, como función esencial y prioritaria del Estado, velar por la conservación, protección y administración de los bosques naturales y por la producción, el aprovechamiento, la industrialización y el fomento de los recursos forestales del país destinados a ese fin, de acuerdo con el principio de uso adecuado y sostenible de los recursos naturales renovables".
Tanto de la manifestación del imputado [Nombre2] , como de las declaraciones del propietario del aserradero [Nombre8] y del dueño de la madera [Nombre5] , quedó comprobado el origen de las piezas incautadas proviniendo de una fuente legítima, pero el documento que consignaba la compra fue emitido después, ciertamente una práctica no deseable pero que no puede tenerse como delictiva, pues se logró demostrar que la madera fue adquirida legítimamente, que como bien apuntó en su testimonio el funcionario del Órgano forestal, Orlando Matarrita Suárez, lo que se busca es acreditar que el producto se origina en fuentes legales desde su cultivo hasta la industrialización, lo que en este caso quedó asegurado con el bagaje probatorio testimonial y documental. Tal y como lo sustentó el a quo estamos ante un tema de tipicidad y claramente sí debe hacerse un análisis escalonado conforme a la teoría del delito y, en el sub exámine, se vislumbra ausencia de dolo (que implica el conocimiento y la voluntad de la realización de los elementos objetivos del tipo), aspecto que desde los más básicos preceptos del derecho penal general se conoce es el elemento subjetivo conformante de la tipicidad, pues sin conocimiento y voluntad realizadora no habría acción típica, resultando acertada la conclusión de que en la especie hubo ausencia del elemento subjetivo del tipo.
La omisión de llevar a mano la factura o guía podría constituir una falta administrativa, pero no alcanza la entidad suficiente para considerar que se estuviese infringiendo dolosamente la Ley Forestal, porque los justiciables brindaron una explicación inmediata a la autoridad policial, no hubo ningún tipo de clandestinidad y el dueño de la madera acudió rápidamente ante la Fuerza Pública con la documentación, sin embargo ya sus empleados habían sido consignados ante la Fiscalía, donde tuvieron que asumir la detención por un hecho claramente atípico. Debe destacarse la actitud consecuente que exhibe la juzgadora de instancia al restringir el ejercicio del ius puniendi estatal, que no debe ser arbitrario, tiene límites de legalidad y racionalidad que fueron correctamente vislumbrados por el a quo. Lo anterior implica la necesidad de respaldar la decisión impugnada por ser acorde a los parámetros legales y a una visión respetuosa de las garantías y derechos fundamentales de los ciudadanos.
Finalmente, resulta oportuno recordar que uno de los escalones de la teoría del delito es la antijuridicidad, que no se limita a la ausencia de causas de justificación (formal) sino que congloba la lesividad al bien jurídico tutelado. Ninguna prueba de las mencionadas por el impugnante sería capaz de establecer que la ausencia momentánea de los documentos formales, produjo una afectación al interés estatal de protección del recurso forestal. En ese sentido, es importante considerar que la política criminal persecutoria actual deja de lado en su teoría del caso el componente de antijuridicidad material, arista que el legislador previó (además) mediante la figura del criterio de oportunidad por insignificancia de la lesividad del hecho, lo que también debería ser valorado por el Tribunal sentenciador. De ahí que conviene, para todo el sistema patrio de enjuiciamiento criminal, rescatar tanto el análisis de antijuridicidad material como componente del injusto, lo cual no se vislumbra que se haya ejercido en el caso, junto a la sana práctica de aquilatar, en todas las fases del proceso, la razonabilidad de la persecución penal en un Estado democrático de derecho. Por las razones señaladas, impera mantener lo resuelto y rechazar el recurso incoado.
POR TANTO
Se declara sin lugar el recurso de apelación interpuesto por la representación fiscal, en consecuencia, se mantiene incólume lo resuelto.
