SECOND JUDICIAL CIRCUIT OF SAN JOSÉ.- At nine hours and nineteen minutes on quince de febrero de dos mil veintiuno.- PROVISIONAL MEASURE (MEDIDA CAUTELAR) filed by the plaintiff within the POSSESSORY INJUNCTION PROCEEDING brought by [[Nombre1] ], [...]; and [[Nombre2] ], [...]; against [Nombre3] , of legal age, single, architectural technician, resident of San José, identity card number CED1 - - . Attorney Luis Eduardo Leal Vega, bar number two thousand one hundred forty-three, acts as counsel for the plaintiff; and attorney Karolina Rojas Mora, bar member fifteen thousand four hundred forty-seven, acts as special judicial representative (apoderada especial judicial) for the defendant. Proceeded before the Agrarian Court of the Second Judicial Circuit of Guanacaste, seated in Santa Cruz. This Court hears the appeal against Judgment N° 151-2020, issued at ten hours and five minutes on veinticinco de junio del año dos mil veinte.- Judge Castro García writes the opinion; and, WHEREAS (CONSIDERANDO) I- A ruling on the list of proven facts is omitted, given the manner in which this appellate instance will decide the matter.

II- The defendant timely appeals (digital case file/pleadings/date 02/12/2020 03:30:34) interlocutory provisional-measure judgment No. 151-2020, issued at 10:05 hours on 25 de julio del 2020 (digital case file/documents/date 25/06/2020 10:05:57), which granted the provisional measures requested by the plaintiff and ordered [Nombre3] to: “A) Refrain from planting crops on the disputed property, bringing in livestock, leasing it to third parties, and/or carrying out any other agricultural activity until this proceeding has been finally decided; likewise, he shall refrain from constructing permanent or fixed structures, planting perennial or semi-perennial crops, carrying out earthworks (movimientos de tierra), opening internal roads, removing boundary markers, removing gates providing access to the property or gates located within it, or altering the topography of said property, the latter being understood to include obstructing culverts or streams located on the land at issue in this dispute.

  • B)He is prohibited from felling trees on the property in dispute, in order to preserve its existing natural resources and ecosystem until this proceeding has been finally decided. This order is imposed upon the aforementioned defendant [Nombre3] with the warning that, should he fail to comply with what is ordered herein, formal criminal proceedings may be instituted against him for the offense of disobeying authority. In view of the foregoing warning carrying criminal consequences, the defendant [Nombre3] is ordered to be served PERSONALLY at the address provided in the case record. For this purpose, the Centralized Service Office of this Judicial Circuit is commissioned.” As grounds for appeal, the defendant asserts the need to establish the residual nature of the relief and to conduct a judicial inspection (reconocimiento judicial) to verify that requirement and the other prerequisites for provisional measures.

Alternatively, the residual nature in particular must be assessed, at least by an expert, in order to evaluate the actual imminent danger or risk. Such evidence is nonexistent, and the interlocutory judgment justifies that omission on the basis of the pandemic. The defendant argues that the inspection may be conducted under strict health protocols, allowing the adjudicator to personally ascertain the actual situation. This would provide an adequate overview for granting or denying the provisional measures and achieve procedural balance between the parties. During the judicial inspection, observations may be made to the Court, without its being bound to one party’s version, as occurred in the matter on appeal. The defendant invokes a violation of the procedural principle of equality of the parties established in article 2.1 of the Code of Civil Procedure. This is essential because the party requesting the measure could use the proceedings to delay the case, or the relief sought might lack any practical purpose.

It is insufficient to rely on the mere assertion of one party to order the measure; in this specific case, the measures were ordered solely on the basis of a notarized record containing the version of those same parties, together with photographs that do not establish any of the events reported to the court as having “supposedly” occurred that day. The defendant contends that the proceedings and decision are contrary to the Agrarian Court’s criteria and that the evidence submitted reveals no indication of tree felling, road opening, or any harm to the environment. Regarding the likelihood of success on the merits (apariencia de buen derecho), the defendant states that it was not established, given the existence of trial and appellate judgments ruling that the ownership of the right purportedly sought to be protected does not belong to the plaintiffs, and that the appellants are the only persons required to maintain it as necessary for its proper conservation.

With respect to the risk arising from delay (peligro de demora), article 242 of the Code of Civil Procedure must be observed, and provisional measures must be adopted to prevent serious harm before judgment is rendered. The defendant alleges a lack of evidence and objects to the decision granting the measures on the basis of circumstantial evidence consisting of photographs showing several people together, which are used to allege supposed road openings, tree felling, and other acts. The defendant challenges the failure to provide photographs of the machinery used to open the roads, the chainsaws, and the other tools used to fell the trees. The defendant states that the evidence submitted with this appeal demonstrates that the alleged acts never occurred and requests that the measures be vacated. Such acts against the environment have never been carried out; the only action taken has been to provide the property with the proper maintenance required, which can be verified. Documentary evidence is attached to the appeal.

III- Upon reviewing the case record, this Chamber notes that the ordinary in rem action (demanda real ordinaria) requested the following provisional measure: “Pursuant to article 242 of the repealed Code of Civil Procedure, which applies supplementarily in agrarian matters and establishes the judge’s protective authority to adopt such precautionary measures as the judge deems appropriate to prevent serious harm or harm that would be difficult for the parties to remedy, and for the purpose of prohibiting any modification of or alteration to the forest located in situ on the property and causing the activity to cease, we request that the Court, in order to prevent the environmental damage caused by the defendant on the property, where he is felling trees of various species native to the area and constructing trails or roads with a backhoe, thereby altering the property’s topography, filling in culverts and streams, apply a provisional measure based on a colorable right (buen derecho) to halt that activity so that the property does not continue to suffer impairment or deterioration attributable to the defendant’s modification or alteration of the property, including alteration of its topography and the felling of various timber trees, which the defendant has been doing since 04 de febrero del presente año.

We, the undersigned, filed the corresponding complaint with the Ministerio de Ambiente y Energía at its offices in the city of Santa Cruz, Guanacaste; that institution forwarded the report to the Fiscalía de Santa Cruz, and the report states that environmental damage has been caused as a result of the acts of interference (actos de perturbación) carried out by the defendant since 04 de febrero del año 2020. We request that the provisional measure sought be ordered urgently and without delay in order to prevent irreparable harm or serious injury to either party before the matter is adjudicated or before the judgment entered becomes final; without prejudging the merits of the case, but rather with the principal aim of preserving the purpose for which provisional measures were created, because it is urgently necessary for Your Honor to conduct an on-site judicial inspection (inspección judicial ocular) to verify the irreparable harm caused, including the construction of trails using heavy machinery, the felling of trees, the obstruction of culverts, the removal of the property’s access gate, the filling with earthen material of the culvert through which a stream flows, the construction of roads throughout the property, and the robbery or theft of timber.

We alone kept the property’s undergrowth cleared, and we maintained the wild flora and fauna without felling trees native to the area, all for the purpose of keeping the forest in its original condition. REQUEST: That the Fiscalía de Santa Cruz, Guanacaste, be asked to provide the report prepared by the Ministerio de Ambiente y Energía between 04 y 08 de febrero de 2020 by officials of that institution who appeared in response to a complaint filed by us to investigate the environmental damage caused on the farm that is the subject of this litigation, which report was forwarded to the Fiscalía de Santa Cruz, Guanacaste; the corresponding official letter shall be sent.” As evidence, the plaintiffs requested a judicial inspection “to verify the acts of interference that occurred on 04 y 08 de febrero del año 2020, consisting of the destruction of the wooden gate providing access to the property and the construction of a new access gate to the property ten meters away from the wooden gate.” The relevant allegations in the initial pleading described the plaintiffs as holders of a longstanding possessory right (derecho de posesión) over land used for agriculture and forest conservation.

They described events occurring on 04 de febrero del año 2020 at the site which, in their view, were attributable to the defendant, including finding the property’s entrance gate open and three laborers clearing brush. [Nombre4] stated that his possession had been usurped (initial pleading in digital case file/pleadings/). Without any response having been filed by the defendant, the provisional measure was decided. The judicial inspection was not conducted because, by decision of the trial court in its order serving the complaint, it was replaced with documentary evidence consisting of a notarized record and photographs submitted by the plaintiff; the stated reason for that decision was that, due to the emergency caused by the Covid virus in the national territory, the judicial inspection would not be conducted because of the risks involved.

IV- In view of the foregoing, pursuant to section 26 of the Ley de Jurisdicción Agraria, this Court finds that a procedural omission (omisión procesal) occurred in connection with the provisional granting of an interim measure (medida cautelar) without a hearing of the opposing party, requiring the appeal (recurso de apelación) to be declared improperly admitted. It should be noted that, pursuant to Article 96 of the Código Procesal Civil, applied on a supplementary basis (transitory provision I.3 of Ley 9343 and II of Ley 9342), when an interim measure is granted without the opposing party having been afforded an opportunity to participate, a novel procedure begins whereby a person adversely affected may challenge the ruling if that person disagrees with it; this procedure was not provided for in the repealed code of civil procedure. In accordance with the provisions of section 96 ibidem, once an interim measure has been adopted without a hearing of the opposing party, that decision is not subject to any appeal.

The affected person must instead file an objection (oposición) before the same court that granted it, within three days following notice of the decision, submitting a reasoned request that the measure be lifted or modified, together with any evidence deemed pertinent. The trial judge shall then convene the parties for an oral hearing to be held as soon as possible, at which it shall be decided whether the provisional measures are to be maintained, modified, or lifted. In this case, interim measures were granted to the plaintiff without the defendant having been served with the order giving notice of the action (auto de traslado). Although the defendant filed a submission that it termed an appeal, in light of its content and the procedural rules cited regarding the new procedure, it must be understood as the aforementioned objection proceeding. Therefore, exercising the case-management powers (facultades de ordenación) established in section 26 of the Ley de Jurisdicción Agraria, it is ordered that this submission—which, given its content, must be understood as the defendant’s objection to the interim measure granted (expediente digital/escritos/ fecha 02/12/2020 03:30:34)—be processed by the trial court in accordance with the procedure prescribed by law as described above, and that the appropriate ruling be issued.

This Court expressly states that section 96 ibidem provides that a decision granting an interim measure without a hearing of the opposing party is not subject to any appeal. The decision that ultimately resolves the objection filed is subject to appeal, pursuant to sections 58 and 59 of the Ley de Jurisdicción Agraria. Therefore, on the basis of Articles 1, 2, 26, 58 and 59 of the Ley de Jurisdicción Agraria and 96 of the Código Procesal Civil, applied on a supplementary basis, the appeal filed against order-judgment (auto sentencia) number No. 151-2020 of 10:05 hours on 25 de julio del 2020 must be declared improperly admitted. Accordingly, the arguments supporting the objection and the grounds for nullity (motivos de nulidad) are not decided; they would be reviewed if this proceeding returns to this Court.

POR TANTO:

The appeal filed against order-judgment number No. 151-2020 of 10:05 hours on 25 de julio del 2020 is declared improperly admitted. The submission incorporated into the digital case file on 2 de diciembre del 2020 shall be processed under the applicable objection procedure.

VOTO N° 125-F-2021 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las nueve horas diecinueve minutos del quince de febrero de dos mil veintiuno.- MEDIDA CAUTELAR interpuesta por la parte actora dentro del PROCESO INTERDICTAL promovido por [[Nombre1] ], [...]; y [[Nombre2] ], [...]; contra [Nombre3] , mayor, soltero, técnico en arquitectura, vecino de San José, cédula de identidad número CED1 - - . Actúa como abogado director de la parte actora el licenciado Luis Eduardo Leal Vega, carné dos mil ciento cuarenta y tres; y como apoderada especial judicial de la parte demandada la letrada Karolina Rojas Mora, colegiada quince mil cuatrocientos cuarenta y siete. Tramitado ante el Juzgado Agrario del Segundo Circuito Judicial de Guanacaste, con sede en Santa Cruz. Conoce este Tribunal del recurso de apelación contra la Sentencia N° 151-2020 de las diez horas y cinco minutos del veinticinco de junio del año dos mil veinte.- Redacta la jueza Castro García; y,

CONSIDERANDO

I- Se omite pronunciamiento sobre el elenco de los hechos probados, dada la forma en que se resolverá en esta Instancia.

II- La parte demandada recurre, dentro del plazo legal (expediente digital/escritos/ fecha 02/12/2020 03:30:34), el auto sentencia cautelar No. 151-2020 de las 10:05 horas del 25 de julio del 2020 (expediente digital/documentos/ fecha 25/06/2020 10:05:57), que acogió las medidas cautelares solicitadas por la parte actora y decretó a [Nombre3] : " A) Abstenerse de efectuar sembradíos en el inmueble de litis, introducir ganado, arrendar a terceras personas y/o realizar cualquier otra actividad agraria hasta tanto no se resuelva en definitiva el presente proceso, así como en el mismo sentido deberá abstenerse de realizar construcciones permanentes o fijas, cultivos perennes o semiperennes, movimientos de tierra, abrir caminos internos, derribar linderos, portones de acceso al inmueble o internos de éste así como modificar la topografía de dicha heredad, entendiéndose esto último como obstruir alcantarillas o riachuelos presentes en el terreno objeto de esta controversia.

  • B)Se le prohíbe efectuar talas de árboles en el fundo en litigio, en aras de preservar los recursos naturales y ecosistema existentes en la misma hasta tanto no se resuelva en definitiva el presente proceso. Se impone esta orden al citado demandado [Nombre3] con el apercibimiento de que en caso contrario, se les podrá iniciar formal causa penal por el delito de desobediencia a la autoridad en caso de incumplirse con lo aquí ordenado. Dada la prevención con efectos penales referida, se ordena notificarle al demandado [Nombre3] en forma PERSONAL en la dirección aportada en autos. Para lo anterior se comisiona a la Oficina Centralizada de Notificaciones de éste Circuito Judicial." Como agravios expone la necesidad de demostrar la residualidad hacer un reconocimiento judicial para comprobar ese y los otros presupuestos de las medidas cautelares. O bien, en especial la residualidad y debe hacerse, a al menos de un perito con el fin de valorar el verdadero peligro o riesgo inminente.

Prueba inexistente y se justifica el auto sentencia en que esa omisión es por causa de la pandemia. Esgrime, el acto se puede realizar bajo los estrictos protocolos de salud, pudiendo la persona juzgadora constatar por ella misma la situación real. Lo anterior, a fin de obtener un panorama adecuado para el otorgamiento o denegatoria de las cautelares y lograr un equilibrio procesal entre las partes. En el reconocimiento judicial pueden hacerse las observaciones al Órgano Judicial; sin que se apegue con una versión de las partes como lo es el caso en apelación. Invoca la violación al principio procesal de la igualdad procesal establecido en el artículo 2.1 del Código Procesal Civil. Lo que es esencial por cuanto quien solicita la medida, podría utilizar el trámite para retardar el procedimiento o que lo peticionado carezca de sentido práctico. Siendo insuficiente valorar con fundamento en la simple manifestación de una de las partes para ordenar la medida y en el caso concreto, se ordenan las medidas, únicamente con el contenido de un acta notarial con la versión de las mismas partes, además de unas fotografías que no acreditan ningunos de los hechos puestos en conocimiento del despacho de lo que "supuestamente" ocurrió ese día.

Lo actuado y decidido, acusa, es contrario a los criterios del Tribunal Agrario y de las pruebas aportadas no se denota algún indicio sobre talas, apertura de caminos o algún daño al medio ambiente. Señala, respecto a la apariencia de buen derecho, no se acredita dada la existencia de sentencias de primera y segunda instancia que decretaron que quien ostenta la titularidad del derecho que supuestamente se quiere proteger que no le pertenece a los actores y son los apelantes los únicos que le deben dar mantenimiento; como corresponde para su respectiva conservación. En referencia al peligro de demora se debe respetar el ordinal 242 del Código Procesal Civil y tomarse las cautelares para evitar que se cause una lesión grave, previo al dictado de la sentencia. Acusa la ausencia de elementos probatorios y no está conforme con la resolución que acoge las medidas con pruebas indiciarias de fotografías de varias personas juntas, donde se achacan supuestas aperturas de caminos, tala de árboles, y otros.

Refuta la razón por la cual no se aportan fotos de la maquinaria para la apertura de los caminos, las moto-sierras y demás herramientas para la tala de los árboles. Indica, con este recurso aporta las pruebas de las que se concluye nunca existieron los actos acusados y pide se dejen sin efecto tales medidas. Nunca se han efectuados este tipo de actos en contra del medio ambiente y lo único que se ha realizado es darle el debido mantenimiento a la propiedad como corresponde; lo que es verificable. Adjunta pruebas documentales con su recurso.

III- Analizados los autos por esta Cámara, se denota que en la demanda real ordinaria presentada se solicitó como medida cautelar : "De conformidad con lo que dispone el artículo 242 del Código Procesal Civil, derogada, de aplicación supletoria en materia agraria, que establece el poder cautelar del juez para tomar las medidas precautorias que considere pertinentes a fin de evitar o se cause un daño grave o de difícil reparación para las partes, y con el objeto de prohibir que en el inmueble se modifique o se innove el bosque que se encuentra in sito y a efectos de que se cese la actividad, solicitamos al Tribunal que para que se evite el daño ambiental producido por el demandado en el inmueble, en el cual se encuentra talando árboles de las distintas especies de la zona, y construyendo senderos o caminos con un bajop, que ha realizado alteraciones en la topografía del inmueble, aterrando alcantarillas y riachuelos, es por ello que solicitamos al Tribunal que un buen derecho aplique una medida cautelar para que se cese esa actividad a fin de que el inmueble no continúe sufriendo un menoscabo o deterioro atribuible a la modificación o alteración que hace el demandado en el inmueble, modificando su topografía y talando una serie de árboles maderables, lo cual ha venido realizando el demandado a partir del 04 de febrero del presente año.

Los suscritos hicimos la denuncia correspondiente ante el Ministerio de Ambiente y Energía, en las oficinas situadas en la ciudad de Santa Cruz, Guanacaste, quienes pasaron el informe a la Fiscalía de Santa Cruz, y en dicho informe se indica que se ha causado un daño ambiental, derivado de los actos de perturbación que ha realizado el demandado a partir del 04 de febrero del año 2020. Solicitamos que con carácter de urgencia se dicte la medida cautelar solicitada, sin demora alguna, a fin de evitar daños irreparables o alguna lesión grave a alguna de las partes, antes de que se falle en asunto, o bien que lo ordenado en sentencia se encuentre firme; sin perjuicio de descubrir el fondo del asunto, sino con el objeto principal de no desnaturalizar el fin para el cual fueron creadas las medidas cautelares, pues con carácter de urgencias es necesario que su autoridad realice una inspección judicial ocular para verificar los daños causados que son de carácter irreparable, tales como construcción de senderos con maquinaria pesada, derribo de árboles, obstrucción de alcantarillas, derribo del portón de acceso a la propiedad, relleno con material de tierra a la alcantarilla por donde cursa una quebrada, y en general construcción de caminos la propiedad, y robo o hurto de la madera.

La propiedad se mantenía socolada por nosotros únicamente, y se le daba un mantenimiento a la flora y fauna silvestre sin derribar árboles autóctonos de la zona, todo con el fin de mantener el bosque en su estado primitivo. SOLICITUD: Que se solicite a la Fiscalía de Santa Cruz, Guanacaste, el informe realizado por el Ministerio de Ambiente y Energía, entre los días 04 y 08 de febrero de 2020, por funcionarios de esa institución que se apersonaron por motivo de una denuncia presentada por nosotros para investigar el daño ambiental ocasionado en la finca objeto de esta litis, el cual fue remitido a la fiscalía de Santa Cruz, Guanacaste, envíese el oficio correspondiente." Como prueba se pide se realice un reconocimiento judicial " a fin de verificar los actos de perturbación ocurridos los días 04 y 08 de febrero del año 2020, en cuanto a la destrucción del portón de madera de acceso a la propiedad, y la construcción de un nuevo portillo de acceso al inmueble construido a diez metros de distancia del portón de madera." Como hechos del escrito inicial, en lo de interés, se describió ser titulares de un derecho de posesión de vieja data destinado a agricultura y conservación de bosques.

Describieron hechos del 04 de febrero del año 2020, en el sitio que según estiman son responsabilidad del demandado, en cuenta encontrar el portón de entrada a la propiedad abierto, la presencia de tres peones chapeando. [Nombre4] su posesión ha sido usurpada (escrito inicial en expediente digital/escritos/). Sin mediar contestación de la demandada, se resolvió la medida cautelar. No se realizó el reconocimiento judicial, que por decisión del despacho de instancia en el auto de traslado, se sustituyó por una documental de acta notarial aportada y fotografías aportadas por la parte actora, razonándose esa decisión que debido a la emergencia que se presentaba por el virus de Covid en el territorio nacional, no se realizaría el reconocimiento judicial, dados los riesgos.

IV- Visto lo anterior, al tenor del ordinal 26 de la Ley de Jurisdicción Agraria, se estima por esta Sede ha ocurrido una omisión procesal respecto al trámite de la admisión provisional de una medida cautelar sin audiencia a la parte contraria que conduce a declarar mal admitido el recurso de apelación. Ha de mencionarse que al tenor del artículo 96 del Código Procesal Civil aplicado supletoriamente, (transitorio I.3 de Ley 9343 y II de Ley 9342), se dicta que al ser acogida una medida cautelar sin que se hubiera dado participación a la parte contraria, se inicia un procedimiento novedoso de oposición a lo resuelto en caso de disconformidad del afectado, que no estaba contemplado en el derogado código de rito civil. Acorde con lo prescrito en el 96 Ibídem, adoptada una medida cautelar sin audiencia a la contraria, esa decisión carece de recurso alguno. Y debe proceder la persona afectada a oponerse ante la misma instancia judicial que la acogió en el plazo de tres días desde la notificación de la resolución.

Solicitando de forma razonada su levantamiento o modificación, con la prueba que estime pertinente. Para que la persona juzgadora de instancia convoque a las partes a una audiencia oral a celebrarse a la mayor brevedad posible, donde se decidirá si las medidas provisionales se mantienen, modifican o se levantan. En este caso, se concedió el otorgamiento de medidas cautelares a la parte actora, sin que se hubiere notificado del auto de traslado a la accionada. Y si bien interpuso una gestión que denominó recurso de apelación, por su contenido y las reglas procesales citadas respecto al nuevo procedimiento, debe entenderse se está ante el proceso de oposición referido. Por lo que, con las facultades de ordenación del numeral 26 de la Ley de Jurisdicción Agraria, se decreta que a esa gestión, que debe de entenderse de oposición de la demandada a la medida cautelar concedida, dado su contenido (expediente digital/escritos/ fecha 02/12/2020 03:30:34) ha de otorgársele por el despacho de instancia el trámite de ley descrito y resolver lo que corresponda.

Se indica por esta Sede, de forma expresa el 96 ibídem establece que la resolución que resuelve el otorgamiento de una medida cautelar sin audiencia a la contraria, carece de recurso alguno. Recurso que sí ostenta la que en definitiva resuelva la oposición interpuesta, según el ordinal 58 y 59 de la Ley de Jurisdicción Agraria. Por lo que, con fundamento en el artículo 1, 2, 26, 58 y 59 de la Ley de Jurisdicción Agraria y 96 del Código Procesal Civil aplicado supletoriamente, ha de declararse mal admitido el recurso de apelación interpuesto contra el auto sentencia número No. 151-2020 de las 10:05 horas del 25 de julio del 2020. Por lo que no se resuelven los alegatos de la oposición y motivos de nulidad, que serian revisados en caso de volver este trámite.

POR TANTO:

Se declara mal admitido el recurso de apelación interpuesto contra el auto sentencia número No. 151-2020 de las 10:05 horas del 25 de julio del 2020. Otórguesele a la gestión incorporada al expediente digital en fecha 2 de diciembre del 2020 el trámite de oposición correspondiente.
