THE STATE Nº4-2021-I ADMINISTRATIVE AND CIVIL COURT OF THE TREASURY, SECOND JUDICIAL CIRCUIT, SAN JOSÉ, GOICOECHEA, at fifteen hours and thirty minutes on veintisiete de enero de dos mil veintiuno.- Ordinary proceeding (proceso de conocimiento) brought by WPP CONTINENTAL DE COSTA RICA S.A., corporate identification number (cédula jurídica) 3-101-155289, represented by its special judicial attorney-in-fact (apoderado especial judicial), Lic. Julio A Fonseca Pión, Bar Association membership number 13814, against the State, represented by State Attorney Elizabeth Li Quirós.
BACKGROUND
I.On 6 de marzo del 2019, this ordinary proceeding was filed, asserting the claims transcribed verbatim below, which were ratified at the preliminary hearing (audiencia preliminar) of 12 de noviembre de 2019: “1.- PRINCIPAL CLAIM. We request that the judgment declare: a.- That the following administrative acts (actos administrativos) are absolutely null and void: (i) Official Letter CN-ARS-A2-1741-2018 (ii) Decision DRCN-AJ-J-706-2018 (iii) Decision DM-A-1069-2019 b.- That, upon annulment of the aforementioned administrative acts, the Ministry of Health is obligated to authorize my client to continue receiving solid waste at the Relleno Sanitario Los Mangos until the capacity of its cells 8, 9, 10 and 11 has been exhausted. c.- That the State must compensate my client for the damages and losses (daños y perjuicios) it has caused, with liability imposed in the abstract and the determination of the amount reserved for enforcement of the judgment (ejecución de sentencia), pursuant to article 122 subsection m) of the CPCA. d.- That the judgment shall order indexation (indexación) at the State’s expense, pursuant to article 123 of the CPCA. e.- That the State must pay both categories of costs (ambas costas) in this action. 2.- ALTERNATIVE CLAIM IV.- CLAIM In the hypothetical event that our principal claim is denied, I then request that the following be declared: a.- That the State must expropriate the Relleno Sanitario Los Mangos from my client. b.- That the State must release my client from environmental and sanitary liability for the technical closure (cierre técnico) of that landfill. c.- That the State must assume responsibility for operating the Relleno Sanitario Los Mangos, including its full operation and maintenance expenses, until it reaches technical closure. d.- That, in determining the fair compensation (justiprecio) for the expropriation of the landfill, in addition to the other legally established parameters, the following factors must be taken into account: (i) Updated value of the land comprising the landfill (ii) Loss of my client’s commercial opportunity resulting from its withdrawal from competition in the market (iii) Lost profits from the metric tons of remaining capacity e.- That the State must pay both categories of costs in this action.” (See images 2 through 12 of the digital court file and audio recording of the preliminary hearing).
II.After service as required by law (traslado de ley), the State’s representative opposed the complaint and raised the defenses of res judicata (cosa juzgada) and lack of legal entitlement (falta de derecho). (See images 166 through 178 of the digital court file).
III.The preliminary hearing provided for in ordinal 90 of the Administrative Procedure Code (Código Procesal Contencioso Administrativo) was held on 12 de noviembre del 2019, with all parties participating. At that hearing, the claims were ratified, the res judicata defense was denied by oral decision 2054-2019, and documentary and testimonial evidence was admitted. IV.On 7 de enero de 2021, the oral and public trial hearing (audiencia de juicio oral y público) was held in a mixed virtual format with the parties present. The testimonial evidence admitted at the preliminary hearing was not taken because the plaintiff withdrew it, and the required closing arguments were presented orally (audio recording of the oral and public trial hearing).
V.This judgment is issued unanimously within the statutory period, following deliberation by the members of the Court, and no grounds capable of invalidating the proceedings are found.

CONSIDERING
Of relevance to the resolution of this matter, the following is deemed duly established:
(Folios 3493 to 3496 of Volume 11 of the administrative record). 20.- Whereas, in connection with health order (orden sanitaria) OS-ARS-A2-025-2015 of 30 de julio de 2015, which sought to enforce the prior act CN-ARS-A2-0477-2015, the plaintiff company filed a motion for reconsideration with a subsidiary appeal (recurso de revocatoria con apelación en subsidio); the appeal was decided by resolution DM-A-461-2016 of the then Minister of Health, who, insofar as relevant here, stated in the Por tanto: “… Now, in order to complete the technical closure of the site, the Health Authorities at the three Management Levels (the Central Level, through the Directorate for the Protection of the Human Environment, as well as the Central North Regional Directorate and the Directorate of the Alajuela 2 Health Governing Area) must coordinate the necessary actions with the Municipalidad de Alajuela to complete the technical-closure process for the aforementioned sanitary landfill (relleno sanitario), which could entail transporting and disposing of soil, or soil and waste, in the cells that remained unfilled so that—from that point onward—the technical closure of the site may continue, since until that occurs, said technical closure cannot be completed…” (Folios 3429 to 3439 of Volume 11 of the administrative record). 21.- In light of the matters stated in the preceding point, the plaintiff began bringing waste into the landfill again, which consequently led to the issuance of the aforementioned official letter CN-ARS-A2-738-2016 of 2 de junio de 2016 by the Área Rectora de Salud Alajuela 2, Región Central Norte del Ministerio de Salud.
In addition to reiterating the closure plan for pits 9 and 10, that letter emphasized that the Minister’s decision did not constitute authorization to continue receiving waste and that this activity had to be suspended immediately, a statement subsequently confirmed by the Minister of Health himself in official letter DM-A-936-16 of 13 de junio de 2016 (Folios 3445-3446 and 3497 to 3504 of Volume 11 of the administrative record). 22.- Following a complaint and an inspection conducted by Health authorities, on 29 de enero de 2018 the Área Rectora de Salud Alajuela 2, Región Central Norte del Ministerio de Salud issued health order OS-CN-ARS-A2-016-2018, ordering the suspension of waste-transport activities and the transfer of solid waste from collection units to higher-capacity units. (Folios 3614 to 3634 of Volume 12 of the administrative record). 23.- Whereas, in judgment 10883-2018 of 6 de julio de 2018, the Sala Constitucional decided an amparo proceeding (recurso de amparo) under expediente 18-007857-0007-CO, stating, insofar as relevant: “Giselle Amador Muñoz and Ronald Enrique Mora, in their respective capacities as Minister and Director of the Área Rectora de Salud de Alajuela 2, both of the Ministerio de Salud, or whoever may hold those offices in their stead, are ordered, within 15 business days from notification of this judgment, to adopt, within the exercise of their authority, the measures necessary to provide a comprehensive and definitive solution to the problem reported by the petitioner, in connection with the operation of the sanitary landfill in question, provided that no other legal ground prevents them from doing so.” (Images 320 to 335 of judicial expediente 18-007857-0007-CO submitted on the evidentiary CD). 24.- Whereas, on 17 de setiembre de 2018, by virtue of the judgment cited in the preceding recital (considerando), the petitioner requested authorization to receive waste at the Chanchera so that it could finish filling cells 8 through 11, inclusive.
(Folios 3818 to 3823 of Volume 12 of the administrative record). 25.- By official letter CN-ARS-A2-1741-2018 dated 21 de setiembre de 2018, the Área Rectora de Salud Alajuela 2, Región Central Norte del Ministerio de Salud denied the request submitted by the plaintiff company on 17 de setiembre de 2018, stating that the proceeding concerned the complaint brought before the Sala Constitucional regarding the transfer of waste, not the operation of the landfill, which held no permits of any kind. (Folios 3824 to 3826 of Volume 12 of the administrative record). 26.- The plaintiff company challenged the foregoing act; its motion for reconsideration was denied by resolution DRCN-AJ-J-706-2018 of the Dirección Regional Rectoría de la Salud Central Norte, and its appeal was denied by resolution DM-A-1069-2019 of the Minister of Health. (Folios 3830 to 3832, 3844 to 3846, and 3886 to 3892 of Volume 12 of the administrative record).
Of importance to the resolution of this matter, the following have not been proven: 1) That the plaintiff company disproved the unauthorized waste-transfer activity on the property known as the “Los Mangos” landfill. (The record). 2) That the plaintiff company established that the only way to carry out the technical closure of an incomplete cell or a cell awaiting filling is by means of a method proposed by it. (The record). 3) That the plaintiff established that the method ordered by the health authorities is incorrect or inconsistent with the rules of science and technology, or that it causes environmental damage. (The record). 4) That authorization exists for the use of cells 8, 9, 10 and 11 of the “Los Mangos” landfill at the location known as “La Chanchera” outside the terms of the settlement agreement approved by judgment 1084-2011 of the Settlement Section of this Court. (The record). 5) That judgment 10883-2018 of 6 de julio de 2018, issued by the Sala Constitucional, concerned the operation of the sanitary landfill as the final destination of waste. (The record).
In summary, in its complaint and closing arguments, the plaintiff bases its theory of the case on the fact that it owns the “Los Mangos” sanitary landfill, which undertook the conversion of the former “La Chanchera” dumpsite, and that it is environmentally and legally responsible for that project. Pursuant to the settlement agreement reached in judicial proceeding 11-002733-1027-CA, heard before this Court, provision was made for the treatment of solid waste and an attempt to complete the technical closure of the conversion process for the former “La Chanchera” dumpsite; the State permitted operation of the sanitary landfill until a specified date that has already passed, but the landfill did not reach its full volumetric capacity for receiving solid waste. It contends that this settlement agreement does not constitute res judicata (cosa juzgada), not only because the requirements for that effect are absent, given that the measures challenged here were adopted after that agreement, but also because the agreement was made in pre-action precautionary proceedings (proceso ante causam cautelar), rather than proceedings on the merits.
After that agreement, the plaintiff again requested permission to continue receiving solid waste at its landfill, pursuant to the order issued by the Sala Constitucional in judgment 10883-2018, which, in its view, is binding upon it even though it was not a party. It asserted that, as of the filing date of the complaint, cells 8 through 11, inclusive, had not yet reached their full capacity for receiving solid waste. It therefore requested authorization from Área de Salud Alajuela 2 solely for the purpose of completing those 4 cells—not for any other activity, such as an alleged transfer station—but the request was denied by official letter CN-ARS-A2-1741-2018. Ordinary motions for reconsideration (revocatoria) and appeal (apelación) were filed against that decision. The motion for reconsideration was decided by the Dirección Regional de Rectoría de la Salud Central Norte, rather than by the authority that issued the underlying measure; it was denied and the appeal was referred to the Minister, who denied it by decision DM-A-1069-2019.
Both decisions referred to an alleged waste-transfer station that does not exist and was not the subject of the request submitted, and they also failed to expressly address the procedural allegations raised in the appeal. As a result of the refusal to allow the volumetric space in the cells to be completed, it is materially impossible to achieve the technical closure of the sanitary landfill, which constitutes a violation of article 3° of Decreto 38928-S, the regulations governing sanitary landfills, specifically the technical definition of “service life” (vida útil) provided therein and its connection to the preliminary design approved for the project. Its modification “jeopardizes fulfillment of the proposed environmental objectives and its proper operation because, if the landfill’s full capacity is not used, the calculations and projections made during the design stage, which contemplate use of 100% of the cells, would change as a result of the modification of the operating parameters.” Consequently, acceptance of less than 100% use of each cell is impossible, as provided in articles 12 and 32 of the aforementioned regulations.
This situation does not fall within any of the exceptional circumstances (force majeure), and the decision made by the Ministerio de Salud is contrary to the rules of science and technology and constitutes misuse of public purpose (desviación del fin público), in addition to disregarding the decision of the Sala Constitucional requiring a comprehensive and definitive solution for the sanitary landfill, because the decision, instead of providing a solution, perpetuates the problem. Accordingly, if that position is maintained, the State must expropriate and take charge of the landfill, relieving the plaintiff company of environmental and health-related responsibility. Regarding the decision on the motion for reconsideration, the plaintiff contends that it is void because it was decided by a body other than the one that issued the measure, in violation of 350.1 of the LGAP and 60 of the Ley Orgánica del Ministerio de Salud, an issue that the decision on the appeal before the Minister of that portfolio failed to address. The plaintiff contends that this conduct caused it pecuniary damage (daño material), objective non-pecuniary damage (daño moral objetivo), and consequential losses (perjuicios).
In summary, the State’s representative states, both in its answer and in its closing arguments, that this matter was already resolved when the settlement agreement of 8 de julio de 2011 became final, establishing 8 de julio de 2013 as the final deadline for receiving waste. Furthermore, the reference to judgment 2018-10883 of the Sala Constitucional concerns the entry of solid waste into the sanitary landfill and the operation of a transfer station unauthorized by either the Ministry or the Municipality, and never the operation of the landfill itself. This is demonstrated by the attempt to obtain a ruling from that Court, which denied the application by decision issued at 9:15hrs on 17 de noviembre de 2019. It asserts that the claims are contrary to the legal system and impossible, because there is a settlement agreement with the effect of substantive res judicata (cosa juzgada material) that expressly refers to the prohibition against receiving waste in pits 8 through 11 of the “La Chanchera” landfill.
The plaintiff is thus seeking in this proceeding to circumvent the terms of that agreement, because: “Once the agreed period had elapsed, its technical closure would proceed regardless of whether the cells authorized to receive the waste had available space, since the period agreed upon by both parties was non-extendable… this complaint seeks to contravene what was already agreed upon by both parties regarding the definitive closure of the Relleno Sanitario Los Mangos, which is owned by the plaintiff, because its principal claim seeks authorization to continue receiving solid waste, which necessarily entails reopening the landfill for operation.” Consequently, whether available capacity exists is irrelevant; the deadline has passed, and the agreement must therefore be complied with. It clarifies that, within judicial proceeding 11-002733-1027-CA, the request to annul the settlement agreement was already decided by judgment 758-2019-C.
It was likewise denied in the enforcement file (legajo de ejecución) for that proceeding by judgment 414-2020, and that denial was affirmed on appeal by judgment 530-2020-I of Sección I del Tribunal de apelaciones. This demonstrates that the plaintiff seeks to reiterate arguments in these proceedings and once again attempt to disregard the res judicata effects of the settlement agreement or, alternatively, to reopen or review its terms. Thus, the challenged decisions lawfully deny the reopening of the landfill and also demonstrate that the complaint is legally untenable (demanda improponible). It notes that the argument concerning a conflict with the technical definition of service life established in the regulations was not raised as a ground for challenge at the administrative level and therefore may not be introduced as a different argument in this proceeding. Regarding the fact that the motion for reconsideration was decided by an authority other than the one that issued the underlying measure, it contends that this is not sufficient grounds to invalidate the decision.
Consequently, there is no basis for the claim for damages because there is no underlying right on which it may be based. It therefore requests dismissal of the complaint and an award of costs, together with the corresponding interest.
With regard to the merits of the matter, it is important to set forth a series of general considerations concerning the thema decidendi, specifically, the obligational regime (régimen obligacional) entailed by the final treatment of solid waste through the sanitary-landfill method. Generally speaking, it may currently be said that every productive and potentially profit-making activity is subject to a series of limitations inherent in the so-called police power (control de policía) exercised by the State, understood as a whole, which manages private interests in the production of goods and services. The foundations of this activity are found in the Constitution itself, particularly Articles 11, 21, 45, 46, 50 and 69 of our Constitution, and are usually embodied in matters pertaining to land-use law (derecho urbanístico), both in the regulation of construction activity and in the development of human activities.
Thus, a plurality of public powers converge within land-use law, including powers of oversight, supervision, control, and authorization, whether concurrent or, in some cases, joint. Limiting ourselves to the regulatory regime governing productive activities, among such manifestations of land-use police power (poder de policía urbanística) we find interventions in private activity before, during, and after it is carried out, through permits, licenses, and authorizations in the first instance, and through inspections and oversight in the second and third instances mentioned. By way of example, establishing a retail business selling goods, such as a grocery store, requires, at a minimum and at the private level, the participation of the property owner, either because the owner is the developer of the activity or because the owner provides authorization, a lease, or some other arrangement allowing the physical space under the owner’s control to be used for the activity.
At the public level, it requires the participation of the local government through the municipal location decision and a favorable land-use certificate (certificado positivo de uso de suelo); the Ministry of Health through the sanitary operating permit (permiso sanitario de funcionamiento); and the Ministry of Finance through registration as a taxpayer, all of which are necessary to obtain the municipal business license (patente municipal) that lawfully authorizes the pursuit of the activity for profit. Additional concurrent powers may apply depending on the nature of the activity to be conducted, potentially requiring the participation of the Secretaría Técnica Nacional Ambiental (SETENA) for the approval of environmental management plans (planes de manejo ambientales) and environmental fragility and viability studies (estudios de fragilidad y viabilidad ambiental), as well as the Ministerio de Ambiente y Energía, the Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento, the Ministerio de Agricultura y Ganadería, among others.
It bears emphasizing, of course, that the participation of such public bodies depends on the type of good or service involved, and that they likewise possess ex post control and oversight powers, as do other institutions such as the Tribunal Ambiental Administrativo. It is therefore unsurprising that the public sector exercises control over private activity, as lawfully authorized by the Constitution, in order to guarantee a healthy and ecologically balanced environment, proper land use, and observance of the limits governing the development and exploitation of private property. Again, the intensity of such controls varies depending on the activity involved. Activities classified or classifiable as hazardous must bear more stringent administrative controls, which may even include the requirement to obtain technical opinions from designated responsible professionals, prepare management plans and activity-development plans, and undergo controlled inspections, among other forms of intervention in private activity.
If an irregularity or noncompliance is detected, and particularly if there is neglect or a failure to take corrective action, such controls may lead to the suspension or even permanent closure of the activity concerned. In this context, the final disposal of solid waste is quintessentially a hazardous activity subject to particularly intensive administrative oversight. Focusing specifically on final treatment through the sanitary-landfill system, and leaving aside other final waste-treatment systems such as incineration, this activity has particular characteristics in terms of its obligational regime that distinguish it from other activities, as will now be explained. Specifically, we find that the obligational regime surrounding sanitary-landfill operations has a dual legal-administrative character, with personal elements on the one hand and real-property elements on the other. In other words, the enabling administrative act (acto administrativo habilitante) produces effects both for a particular regulated party (administrado), who not only benefits from the corresponding enabling authorization (título habilitante) but is also made responsible for the activity, and, simultaneously, upon the property where the activity is to be carried out.
This creates an encumbrance with real-property effects that goes beyond a merely temporary administrative act and becomes a genuine land-use restriction (limitación urbanística) affecting the property, its owner, and subsequent owners, in what legal doctrine calls the creation of a propter rem obligation (obligación propter rem). This proposition may be demonstrated—continuing with the example above—by the case of a particular grocery store that fails to comply with sanitary measures and consequently loses its municipal business license and sanitary operating permit. There is no impediment to a new regulated party subsequently correcting the conduct, or simply refraining from the action for which the predecessor was cited, complying with the parameters governing the activity, and obtaining, at the same location, another authorization identical to the previous one. This scenario cannot be applied ceteris paribus (all other things being equal) by analogy to sanitary-landfill operations, because the associated liability regime continues for a considerable period after the commercial activity of receiving waste has ended.
It also affects the use of the property, as a land-use restriction, by successors holding title to the real property, who under no circumstances acquire it originally but instead take it subject to such limitations on the exercise of ownership rights. They may even be required, without any right to compensation pursuant to the second paragraph of Article 45 of the Constitution, to tolerate intervention on the land by public authorities when necessary, or the possibility that the same activity may be continued, restarted, or modified. For the proper balancing of the foregoing, it is clear that the exercise of such powers must itself be subject to control and to objective parameters that allow administrative oversight—without being tautological—to be reviewed in turn, in this case by this administrative litigation jurisdiction (jurisdicción de lo contencioso-administrativo), pursuant to Articles 11 and 49 of the Constitution in relation to Articles 1, 2, 36, 42 and 122 of the Código Procesal Contencioso Administrativo.
Specifically, sanitary-landfill operations are marked by a particular predominance of technical criteria as the objective standard for controlling and overseeing not only the regulated party but also the overseeing administrative authority itself. This is, of course, subject to Article 16 of the Ley General de Administración Pública, which provides: “1. Under no circumstances may acts be issued that contravene unequivocal rules of science or technology, or elementary principles of justice, logic, or expediency. 2. The Judge may review the conformity of the discretionary elements of the act with these non-legal rules as though exercising judicial review of legality,” thereby giving concrete effect to the principle prohibiting arbitrariness (principio de la interdicción de la arbitrariedad), both during the preparatory stages, throughout the performance of the activity, and subsequently, once the activity has ceased.
At the regulatory level, parameters are set forth in the Reglamento sobre Rellenos Sanitarios, initially established by Decree 27378-S, which was in force from 23 de octubre de 1998 until 14 de noviembre de 2014, and subsequently by Decree 38928-S, which remains in force. The first regulation defines a sanitary landfill (relleno sanitario) as the “Technique whereby waste is deposited in cells duly prepared for that purpose, where it is spread, arranged, compacted, and covered daily. Its purpose is to prevent and avoid harm to health and the environment, particularly through contamination of bodies of water, soil, and the atmosphere, and to protect the population by preventing the proliferation of arthropods, carrion birds, and rodents, which are harmful to health”; the second defines it as “the technique whereby solid waste is deposited, spread, arranged, compacted, and covered daily using machinery.
Its purpose is to prevent and avoid harm to health and the environment, particularly through contamination of bodies of water, soil, and the atmosphere, and to protect the population by preventing the proliferation of arthropods and rodents.” It is also necessary to address the technical concept of a cell (celda), which is understood as the “geometric configuration given to solid waste and its covering material, duly compacted, as part of the sanitary-landfill technique.” Generally speaking, the activity under examination consists of excavating pits in the ground, thereby using the subsoil, technically known as “cells,” which are prepared to receive, compact, and ultimately confine solid waste. The cited regulations permit two working methods, known as the “Manual Sanitary Landfill” (Relleno Sanitario Manual) and the “Mechanized Sanitary Landfill” (Relleno Sanitario Mecanizado). The latter is mandatory when the landfill is intended to receive waste from populations generating more than 40 metric tons per day (Article 5 of Decree 38928-S) and is the method relevant to this case, insofar as it “requires heavy equipment both for its construction and operation, as well as mechanisms to control and monitor its functioning” (Article 3.l ejusdem).
This activity necessarily entails use of the soil and subsoil of a particular property, altering the composition of the land in accordance with the nature of the approved project, since cells may be designated for the final disposal of ordinary and/or hazardous waste. The former is defined as “Household waste generated in dwellings and from any other source that has a composition similar to waste from dwellings. Special-management or hazardous waste regulated under the Ley de Gestión Integral de Residuos is excluded,” and the latter as “Waste that, because of its chemical reactivity and its toxic, explosive, corrosive, radioactive, biological, bioinfectious, and flammable characteristics, or because of the duration of exposure, may cause harm to health or the environment.” As a consequence of the foregoing, such waste remains in the subsoil, technically confined—in principle—and it is precisely this circumstance that restricts the powers of ownership (facultades de dominio) under Article 264 of the Código Civil, manifesting itself as a real-property encumbrance (afectación real) and a propter rem obligation (an obligation attached to the property itself).
Accordingly, given the nature of the activity in question, the land on which the indicated pits (fosas) are located remains encumbered, regardless of ownership, and governed by technical aspects associated with the approved management project and the type of waste destined for that physical space. The latter is a distinguishing feature from other activities, given the need for continued intervention at the site after the closure or cessation of waste acceptance—an activity that may be characterized as operational and commercial pursuant to sections 32 to 35 of the regulation under review—by the party responsible for the project. This activity is known as technical closure (cierre técnico) (articles 41 to 44 ibid.) and is carried out together with the property owner, who must permit this intervention. Even after technical closure, each pit remains subject to restrictions on future use for a minimum of 20 years (article 46 of the cited regulation), which shape the conditions or possibilities for construction by the responsible party, a third party, or the owner.
Unlike other industrial or commercial activities, a sanitary landfill (relleno sanitario) is always finite in duration, since authorization for commercial operation—acceptance of waste for profit—is possible only while the landfill has remaining useful life (vida útil), a concept defined in the aforementioned regulation as the “Estimated period of time required to fill all cells with waste, including their final configuration in accordance with the design criteria contained in the corresponding design report and the other requirements established in this regulation” (art. 3.p). Thus, generally speaking, anyone who obtains an authorizing act (acto habilitante) and becomes responsible for the sanitary-landfill activity must necessarily know, even before that authorizing act is issued—and may not claim ignorance of the applicable legal framework—that an obligation regime applies not only during the period authorized for commercialization of the service, namely, the acceptance of solid waste for profit, but also, once all cells in the approved project have reached the end of their useful life, during a period in which closure works must be carried out.
That party must bear the associated costs both while the cells remain active and during the technical-closure period. It must also bear the burden of the investments required, in light of scientific and technical developments, in the landfill, its cells, and the surrounding areas, to comply with the environmental and sanitary measures ordered by the competent authority. The owner who has allowed this use of the property must, in turn, bear the restrictions for the period described above. This would be the ordinary, typical scenario for an activity such as the one under review. However, there are two exceptional situations that interrupt the sequence of events described: one involving events of force majeure (fuerza mayor) (art. 32), and the other arising from suspension, revocation, or non-renewal of the permit for reasons attributable to the regulated party (administrado) (articles 30, 45).
In both situations, implementation of the project is interrupted, necessarily requiring a design adjustment. Specifically, unlike the comparison used above—the supplier—the sanitary landfill cannot simply be closed or cease operations. Instead, the two aforementioned events result, more than in inactivity, in the performance of new tasks: specifically, the advancement of the technical-closure works (arts. 41 to 44 of the regulation) and the need to submit the corresponding plans and design for implementing the technical closure. In other words, the cited situations make it impossible to continue carrying out the authorized activity—acceptance of waste for profit—but do not prevent or release the responsible party from performing the technical-closure works. In this regard, this is neither a new burden nor an additional burden, because from the inception of the authorizing act, the responsible party is subject to the obligation to perform this closure activity, which therefore does not constitute an extraordinary task.
This is an appropriate point at which to note the information provided by the regulation that there are two forms of technical closure: one that does not include new cells (art. 43), and the so-called conversion of a dump into a sanitary landfill (reconversión del vertedero a relleno sanitario). The rules governing the latter are essentially the means of regularizing informal waste-final-disposal activities (actividades informales de destino final de desechos), namely dumps (vertederos), and the process is essentially that applicable to a new sanitary landfill (art. 44). This brings us to one of the final general matters: the responsible party’s refusal or failure both to submit technical-closure designs and to carry out the works themselves. In this regard, we refer to the solution established in section 149 of the Ley General de Administración Pública, which provides for the possibility of compulsory compliance (cumplimiento forzoso), substitute execution (ejecución sustitutiva), and compulsory enforcement through execution against the regulated party’s assets (ejecución forzosa mediante apremio sobre el patrimonio del administrado) (recourse action (acción de regreso)).
Any of these will necessarily require the property owner to permit the intervention under the indicated terms, without any possibility of objection, without prejudice to a potential claim for damages attributable to the refusing party whose conduct caused the problem.
PREEXISTENCE OF A CONSOLIDATED LEGAL SITUATION (SITUACIÓN JURÍDICA CONSOLIDADA) VIS-À-VIS THE CLAIMS IN THE PROCEEDING. INAPPLICABILITY OF THE PROCEDURAL DOCTRINE KNOWN AS “RES JUDICATA (COSA JUZGADA)”: As indicated in the first section of the findings (resultando) of this judgment, as well as in the claimant’s submissions in this proceeding, what is at issue here is a claim for annulment (pretensión anulatoria) of three administrative acts (actos administrativos) (claim 1.a), specifically, official letter CN-ARS-A2-1741-2018, decision DRCN-AJ-J-706-2018, and decision DM-A-1069-2019. The claimant further considers that any declaration of nullity of these actions would consequently have the effect of requiring the respondent, specifically the Ministerio de Salud, to authorize the continued receipt of solid waste at Relleno Sanitario Los Mangos until cells 8, 9, 10 and 11 reach capacity (claim 1.b), and, concomitantly, would give rise to a duty to compensate for the damages and losses caused by the effects of those actions (claim 1.c).
As can clearly be seen, the arguments under consideration reflect a clear causal and substantive connection among the claims, which must first be analyzed in light of the respondent’s assertions of res judicata. Tribunal’s view: As resolved on an interlocutory basis in decision 2054-2019, the legal requirements have not been met for concluding that decision 1084-2011, issued by the Área de Conciliación of this Tribunal in judicial expediente 11-002733-1027-CA and judicially approving (homologa) the agreement between the parties to this proceeding, can directly affect the claims in this case; nevertheless, it does create a consolidated legal situation that breaks the chain of causation alleged by the claimant company, as explained below. The central contention is that any annulment of the challenged acts would remove the impediment to the continued receipt of solid waste in cells 8, 9, 10 and 11 of the area known as “La Chanchera.” This contention cannot be accepted in view of the consolidated legal situation created by the aforementioned judicial approval decision 1084-2011, with respect to the following matters: The record shows that authorization for the area known as “La Chanchera” was granted for two purposes: first, to carry out the technical closure of the project comprising cells 1 through 7, which is the subject of health order (orden sanitaria) CN-ARS-A2-011-2011 (proven fact 9); and second, “to treat the waste already located in the sector known as La Chanchera and also, jointly in that same sector, to begin processing newly received waste.” However, a final deadline was established for the receipt of new waste, namely, July 8, 2013.
It should be emphasized that this deadline has not subsequently been amended or eliminated, either administratively or judicially, and has therefore become a consolidated situation. In other words, after that date the claimant possessed no enabling authorization (título habilitante) to engage in the receipt of waste; instead, the actions taken have concerned the completion of closure works. Accordingly, even if the challenged acts were declared null and void, the obligation sought by the claimant—requiring the Ministerio de Salud to grant the permit on the terms alleged—would not arise automatically or derivatively. For this reason, in light of the aforementioned consolidated legal situation, claim 1.b cannot be granted. Following this line of reasoning, it is immaterial to discuss whether an agreement reached through conciliation in precautionary proceedings (conciliación en cautelar) does or does not give rise to res judicata, because, as explained above, that issue cannot affect what has been decided.
For greater clarity in analyzing the claim for annulment of acts CN-ARS-A2-1741-2018, resolution DRCN-AJ-J-706-2018, and resolution DM-A-1069-2019, it is necessary to explain the context in which they were issued and their relationship, if any, to the amparo proceeding (recurso de amparo) brought under constitutional case file 18-007857-0007-CO. When Voto 10883-2018 of the Constitutional Chamber was issued, the circumstances surrounding the “Los Mangos” landfill project could be traced, in terms of the proceedings taken, to the application filed on 15 July 2016, in which the plaintiff herein had submitted the closure plan for cells 9 and 10, given that the closure project for cells 8 and 11 had been approved on 3 March 2015 through official letter CN-ARS-A2-0477-2015 and, accordingly, the approved schedule of activities was being carried out (appearing at folio 3325 of Volume 11 of the administrative case file).
Unlike the previous project, the project submitted for the aforementioned cells 9 and 10 was rejected on 20 June 2016 by means of a decision issued by health officials and officials of the Municipality of Alajuela under the act identified as DR-CN-1752-2016 (appearing at folios 3493 to 3496 of Volume 11 of the administrative case file), which was challenged and upheld both at first instance and on appeal. Consequently, when the complaint was received and an inspection was conducted regarding an alleged waste-transfer operation in January 2018 (folios 3629 to 3634 of Volume 12 of the administrative case file), the plaintiff herein had not yet fully complied with its obligations during the technical-closure stage, because it had not submitted the closure plan for cells 9 and 10 in accordance with the applicable guidelines. It was from that point onward that the dispute with the plaintiff arose concerning the aforementioned activity, which lacked both a sanitary permit and municipal authorization.
This resulted in sanitary orders and inspections (see, for example, the inspections dated 5 March and 9 July, both in 2018, appearing at folios 3656, 3657, and 3760 to 3767 of Volume 12 of the administrative case file), and even a criminal complaint under case file 18-002968-0305-PE (folios 3777 to 3786 of Volume 12 of the administrative case file). These matters need not be analyzed by this Chamber for purposes of the merits of the dispute, as they were not challenged in this proceeding; nevertheless, they constitute a relevant secondary event that the plaintiff did not disprove in the record. Its assertion that the waste-transfer operation did not exist or had never existed is therefore refuted by the aforementioned evidence contained in the record. We clarify that we consider these to be relevant secondary events because it was this activity that gave rise to the processing of the aforementioned amparo case file, which concluded in July 2018 with the issuance of Voto 10883-2018.
It was thereafter that the underlying petition filed by the plaintiff, received on 17 September 2018 (appearing at folios 3818 to 3820), was submitted to the Área Rectora de Salud Alajuela 2 of the Ministerio de Salud under the heading “Outstanding Tasks for the Technical Closure of the Los Mangos Sanitary Landfill Pursuant to the Constitutional Chamber’s Order in Voto No.10883-2018.” In that filing, the plaintiff company asserted that the Ministerio had failed to enforce the aforementioned constitutional ruling by neither providing a comprehensive and final solution for the operation of the Relleno Sanitario Los Mangos nor permitting its technical closure, which, in its view, “necessarily entails receiving a greater quantity of solid waste…in order to fill cells 8 through 11, inclusive. The quantity of waste must be determined by considering, beyond the time involved, the volume that remains to be filled and the tonnage required for that purpose.
Proceeding in any other manner is tantamount to preventing the technical closure of the landfill and, therefore, to failing to comply with the judicial order issued by the Constitutional Chamber.” It further stated that “The technical information required for this Ministerio to determine the corresponding tonnage has already been submitted in judicial case file 11-002733-1027-CA and is known to the Administration,” without providing any additional information of any kind. It should be emphasized here, based on the sequence of events described thus far, that the plaintiff’s request necessarily entailed affecting three previously settled situations: first, the effects of the court-approved settlement agreement (acuerdo conciliatorio), which established the final date of the landfill’s waste-receiving operational stage (8 July 2013); second, modification of the already approved and implemented design for cells 8 and 11, which dated back to March 2015; and third, the fact that, at that time, the plaintiff had not submitted the technical-closure design for pits 9 and 10 for review, assessment, and possible approval.
It bears emphasizing that the aforementioned petition included no information beyond the written request itself, in the terms transcribed above. Against this backdrop, the Ministerio issued the first act whose annulment is sought, denying the request made. This act, dated 21 September 2018, was issued by the Área Rectora de Salud Alajuela 2 of the Ministerio de Salud and identified as CN-ARS-A2-1741-2018. In its conclusions, it stated that, in light of the judicially approved settlement agreement, only technical-closure activities could be conducted at the landfill after 8 July 2013; that the amparo concerned only the irregular operation of a transfer station lacking permits from both the health authorities and the municipality; and that unauthorized activities were required to be suspended. The plaintiff filed a motion for reconsideration with a subsidiary appeal (recurso de revocatoria con apelación en subsidio) against that act on 5 October 2018, reiterating that its petition was based on the Constitutional Court’s ruling, that the transfer station was not an activity conducted by the company it represented, and that additional waste had to be authorized to enter the site to fill cells 8 through 11 in order to complete the technical closure.
The response to the motion for reconsideration was the second act challenged herein: resolution DRCN-AJ-J-706-2018, issued by the Dirección Regional Rectoría de la Salud Central Norte, which denied the horizontal appeal (recurso horizontal) and upheld the challenged underlying act. It based its decision on the appellant’s duty to ensure that only authorized activities were conducted on the property, requiring suspension of the transfer-station operation; on the fact that, pursuant to Article 77 of the Código Procesal Contencioso Administrativo, the settlement agreement had the effect of substantive res judicata (cosa juzgada material) until another ruling annulled or modified it; and on the finding that “As for the assertion that receipt of waste is essential to complete the technical-closure work, that matter has already been raised on several occasions at the institutional level and before the Tribunal Contencioso Administrativo, without having been accepted to date.” It referred the appeal to the Ministro for determination.
Finally, upon consideration of the appeal against the aforementioned underlying act, the last challenged act was issued: resolution DM-A-1069-2019, issued by the Ministro de Salud, which denied the appeal on the grounds, among others, that the repeatedly cited constitutional ruling “…never ordered the reopening of the Los Mangos garbage dump, as Mr. Chacón Gamboa erroneously interprets it; nor can his argument that ‘The company I represent is not the party interested in that transfer station…’ be accepted, since, despite his assertion, the fact remains that this activity is being conducted without the corresponding Sanitary Operating Permit (Permiso Sanitario de Funcionamiento); therefore, the arguments advanced in his appeal cannot be accepted….” Court’s Analysis: The plaintiff’s line of argument in challenging these three administrative acts may be summarized as questioning the factual-ground element (motivo), which in turn resulted in misuse of the purpose element (fin) of the act.
Its theory of the case rests on three fundamental assertions: that the constitutional jurisdiction ordered a solution to the landfill problem; that the solution is technical closure; that the only means of carrying out the technical closure is to allow new waste to enter and fill pits 8 through 11 in the “La Chanchera” sector; and, consequently, that the State’s refusal through the challenged acts is unlawful. This Chamber does not fully agree with that position for several reasons. The point on which it does agree is that, given the time that has elapsed, the sanitary landfill must formalize its technical closure, particularly considering that this should have occurred as early as July 2013. This situation is unrelated to whether the Constitutional Chamber issued a ruling; instead, as explained above, it constitutes a natural or ordinary event in the development of the activity at issue.
Thus, whether the defendant has complied with Voto 10883-2018 of the Constitutional Chamber has no bearing whatsoever on the merits of the matter under discussion here. It is nevertheless clear that, apart from this not being the proper avenue for challenging noncompliance with the order of the aforementioned Constitutional Court, this argument—as the State noted in its conclusions—was already considered and rejected by that court in case file 18-007857-0007-CO, specifically in the resolution issued at 9:15 a.m. on 17 November 2019. Having thus resolved this point, we proceed to analyze the remaining substantive aspects of the matter.
VIII.ANALYSIS OF THE LEGALITY OF THE CHALLENGED ACTS Having disposed of the argument set forth in the preceding recital (considerando), we return to the plaintiff company’s previously cited theory of the case: that, in the plaintiff’s view, the State, through the challenged acts, is preventing the technical closure (cierre técnico) of the landfill. In support thereof, it relies on the fact—undisputed by the parties—that four cells in the “La Chanchera” area of the landfill remain unfilled; that the project approved from the outset must be followed; and that res judicata (cosa juzgada) in expediente 11-002733-1027-CA is inapplicable. It argues that it must be permitted to complete or achieve the closure of each cell through authorization to receive new solid waste to fill them, which constitutes a matter of science and technology under Article 16 of the LGAP in relation to Articles 8 through 11 of the Reglamento sobre Rellenos Sanitarios, and thereby complete the technical closure.
The State, for its part, insists that whether space remains available in the cells is irrelevant, since the settlement agreement (acuerdo conciliatorio) established a final, non-extendable deadline for receiving new material—a deadline that the plaintiff accepted in the settlement agreement and has attempted, in various proceedings, to have set aside for its own benefit. Court’s assessment: The reasoning advanced by the plaintiff cannot be accepted by this Chamber for several reasons. The first is the lack of support for two central propositions: first, the alleged duty to adhere to the project initially approved by the Ministry of Health itself; and second, the assertion that the remaining cells can be filled, and the technical closure thus completed, only by receiving additional waste. Based on what has been stated thus far, this Court understands that the plaintiff does not seek the reopening of the ordinary sanitary landfill, but rather permission to receive waste specifically as a means of closing it.
However, the evidentiary deficiency that prevents this request from being granted is evident, and the central propositions identified above lack support for the following reasons: A review of the record shows that the “original design” was progressively modified throughout the landfill’s history, from the operation of cells 1 through 7 to the project submitted and incorporated into the settlement agreement in expediente 11-002733-1027-CA, which governed the operation of cells 8 through 11. In other words, it may be concluded—as is apparent from the 12 volumes of the administrative record (expediente administrativo)—that the initial project was not implemented as envisioned, either in terms of its design or its planned timeline. In that regard, no administrative authorization for the project involving cells 8 through 11 in the area known as “La Chanchera” appears in the record other than the authorization resulting from the oft-mentioned settlement agreement.
It may therefore be concluded that this is precisely the design model or project applicable to the matter before us. Under those terms, the project design was unequivocal: as of July 8, 2013, the activity of receiving new solid waste was to cease, closure work was to begin immediately, and the project or design for the closure of the cells was to be submitted. This leads to the second reason why, in the view of those deciding this matter, the application cannot be granted: the project has had an approved closure design for cells 8 and 11 since March 2015 (official letter CN-ARS-A2-0477-2015, cited above), and the plaintiff has neither argued that the State is preventing implementation of that plan nor shown that the plan includes the action it seeks to have authorized here. Nor has it provided any technical evaluative or evidentiary material justifying the proposed modification of the project or showing that such a modification was previously requested through administrative channels.
As to cells 9 and 10, they do not have an approved design precisely because the plaintiff has failed to fulfill its duty to submit one, particularly given that the proposal submitted in June 2016 was rejected and that, subsequently—including in connection with this action—no technical proposal to that effect has been presented. It is therefore concluded that the plaintiff has adopted a legally objectionable position by failing to comply with its legal duty to submit the closure project for the two identified cells. Third, the record contains no technical evidentiary support for the assertion that receiving new material is the only means of carrying out the technical closure. The plaintiff’s argument is partially valid insofar as it contends that, under the regulations applicable to this case, the cells may be closed only once they have exhausted their useful life (vida útil), which, in simple terms, means once they have been filled.
However, the repeated assertion that the “only” way to fill the cells is with new material is untenable. This Court finds no technical evidentiary basis to support that assertion; no documentary or expert evidence (prueba pericial) was offered to that effect. Instead, the administrative record reveals the prior existence of final administrative acts (actos administrativos en firme) that were not challenged at the relevant time and in which the health authorities stated that the cells must be filled with soil, or with soil and removable waste from the landfill itself, as follows from resolution DM-A-936-16 of the Minister of Health. That act further reiterates that responsibility for bearing the cost of designing the closure plan rests with the party responsible for the landfill and that the plan must be submitted for review and possible administrative approval—an obligation that, it bears repeating, the plaintiff has not fulfilled with respect to pits 9 and 10.
The solution established by the respondent health authority has not been technically discredited in this matter, nor has any evidence been submitted that would lead this Chamber to find any irregularity, disproportionality, or irrationality in the existing administrative decision. Conclusion: The challenged underlying act (acto base), CN-ARS-A2-1741-2018, contains two determinations: the denial of the request to admit new material, together with the instruction/order relating to the amparo proceeding (recurso de amparo) and the prohibition concerning the transfer station. This position was maintained in the other challenged acts, resolution DRCN-AJ-J-706-2018 and resolution DM-A-1069-2019. For the reasons already stated, it is concluded that the administrative position contained in those administrative acts is reasonable and in accordance with law. Accordingly, no defects have been established in the grounds (motivo) of the challenged acts, and the alleged misuse of purpose (desvío del fin del acto) has likewise not been proven. These grounds of complaint must therefore be rejected.
Concurrently, the plaintiff company challenges the legal validity of act DRCN-AJ-J-706-2018 with respect to its form, on grounds of jurisdiction (competencia), arguing that the decision-making structure for the administrative appeal at the same level (recurso horizontal) was disrupted because the motion for revocation (recurso de revocatoria) was decided by a body other than the one that issued the underlying act. In summary, the underlying act identified as CN-ARS-A2-1741-2018 was issued by the Dirección Área Rectora de Salud Alajuela 2, which belongs to the Dirección Regional de Rectoría de la Salud Central Norte del Ministerio de Salud, whereas the decision on the motion for revocation, identified as DRCN-AJ-J-706-2018, was issued by the Dirección Regional de Rectoría de la Salud Central Norte del Ministerio de Salud. In the plaintiff’s view, this situation entails the existence of two appellate levels (instancias de alzada), which is irregular, as well as a defect concerning the issuing authority’s jurisdiction and/or an evasion of responsibility by the party that issued the underlying act.
Court’s assessment: As a matter of principle, a separate challenge to the decision on an appeal at the same level—that is, a motion for revocation—is inadmissible, because allowing an appeal against a decision resolving another appeal would generate an endless series of challenges. An exception exists where the revocation decision itself modifies or eliminates the underlying act under review, thereby becoming a new underlying act, or where, because no appeal (recurso de apelación) was filed or because such an appeal cannot be filed—as in the case of a motion for reconsideration (recurso de reconsideración)—the decision rendered at the same level concludes the administrative proceedings (sede administrativa) and makes the determination final. However, where the motion for revocation is accompanied by an appeal, except in the first circumstance identified above, a separate challenge to it is inadmissible because the challenge is meaningful only when brought jointly, insofar as any defect in the appellate decision would also affect the revocation decision.
In this regard, the plaintiff is correct that the authorities issuing the underlying act and deciding the revocation are different, because the latter was decided by the superior of the former, and the record does not establish the existence of the corresponding assumption of authority (avocación). However, the scope of this defect must be analyzed, since it affects the formal component and renders the act voidable (relative nullity) (anulabilidad del acto [nulidad relativa]), rather than absolutely null (absolute nullity) (nulidad absoluta) due to a defect in its grounds, content, or purpose. Thus, in assessing whether the defect was material, we note that the challenged act did not modify the underlying act CN-ARS-A2-1741-2018, and the plaintiff does not explain how its interests were affected by the fact that the revocation was decided by the superior of the authority that issued the underlying act.
Nor does it allege denial of the right to defend itself (indefensión), much less that the decision would have been different had another body ruled on the matter. Accordingly, Article 223 of the Ley General de la Administración Pública provides: “1. Only the omission of substantial procedural formalities shall render the proceedings null and void. 2. A formality shall be deemed substantial where its proper observance would have prevented or changed the final decision in significant respects, or where its omission caused a denial of the right to defend oneself.” Therefore, since an allegation of nullity merely for nullity’s sake cannot be accepted, it is determined that no material grounds exist for invalidating the proceedings and that a possible declaration of nullity would not be capable of modifying the determinations made in the other challenged acts. This argument must therefore be rejected.
Consistent with the determinations set forth in the preceding recitals, principal claim a), concerning the nullity of the administrative acts (i) Official Letter CN-ARS-A2-1741-2018, (ii) Resolution DRCN-AJ-J-706-2018, and (iii) Resolution DM-A-1069-2019, must be rejected because it has been confirmed that no defects invalidate the determinations made in the administrative proceedings and that those determinations are reasonable and proportionate. As to claim b), it must be rejected on grounds of relatedness (conexidad), and that conclusion remains unchanged even if it is analyzed as an independent claim, for the reasons reiterated in the preceding recitals. Consequently, in the absence of a sufficient unlawful basis, the elements required to give rise to a claim for compensation are not present. The claims for compensation for loss and damage (daños y perjuicios), identified as claims c), d), and e) of the complaint, must therefore be rejected.
INADMISSIBILITY. MANDATORY COMPLIANCE WITH THE OBLIGATIONS OF THE SANITARY LANDFILL (RELLENO SANITARIO) OPERATOR: Throughout these proceedings, the plaintiff did not set forth, as part of its theory of the case, the grounds, reasons, and evidence supporting the alternative claims (pretensiones subsidiarias) in the event that the principal claims were rejected; that is, it was incumbent upon the plaintiff to explain how, under the circumstances, the defendant has a positive legal duty to submit to the alternative claims, namely: the obligation to expropriate the Los Mangos sanitary landfill (alternative claims a and d), and the consequent obligation to release the plaintiff from environmental and public-health liability for the technical closure (cierre técnico) of the landfill, by assuming responsibility for its entire operation and maintenance expenses until technical closure is achieved (alternative claims b and c).
In the opinion of this Court, as previously stated, the evidence in the record establishes precisely the opposite of what the plaintiff asserted: the existence of an obligation on the part of the party bringing this action to duly submit the closure plan for cells 9 and 10 in the area known as “La Chanchera” at the “Los Mangos” landfill, and to fully comply with the approved plan for cells 8 and 11 at the same site, following the technical guidelines established by the defendant health authority. Thus, the relief sought is intended to allow the plaintiff to evade unilaterally the obligations that it must bear as the party subject to the legal effects of the landfill authorization (acto habilitante), and the record contains no objective justification for relieving it of those commitments. Consequently, given the absence of a factual and legal basis for the alternative claims asserted, they must be rejected in their entirety.
In accordance with the analysis conducted in this judgment, the defense of lack of legal entitlement must be granted, in light of the manner in which this matter is resolved and as set forth in the preceding recitals (considerandos).
Pursuant to Article 193 of the Administrative Litigation Procedure Code (Código Procesal Contencioso Administrativo), attorneys’ fees and court costs constitute a burden imposed upon the unsuccessful party by reason of having lost. Waiver of such an award is permissible only when, in the Court’s judgment, there was sufficient cause to litigate or when the judgment is rendered on the basis of evidence whose existence was unknown to the opposing party. In this case, no grounds justifying an exemption are apparent; therefore, attorneys’ fees and court costs must be awarded against the plaintiff, together with the corresponding statutory interest, which shall accrue beginning on the day following the date on which this judgment becomes final, as requested by the defendant, such amounts to be determined during the judgment-enforcement stage (ejecución de sentencia).
POR TANTO
The defense of lack of legal entitlement is granted. Consequently, the complaint filed by WPP CONTINENTAL DE COSTA RICA S.A. against the STATE is hereby DENIED in all respects. Attorneys’ fees and court costs shall be borne by the plaintiff, together with statutory interest on those amounts calculated from the day following the date on which this ruling becomes final until payment in full, such amounts to be determined during the judgment-enforcement stage. EL ESTADO Nº4-2021-I TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA, SEGUNDO CIRCUITO JUDICIAL, SAN JOSÉ, GOICOECHEA, a las quince horas treinta minutos del veintisiete de enero de dos mil veintiuno.- Proceso de conocimiento interpuesto por WPP CONTINENTAL DE COSTA RICA S.A., cédula jurídica 3-101-155289, representada por su apoderado especial judicial el Lic. Julio A Fonseca Pión, carné del colegio de abogados 13814, contra el Estado, representado por la Procuradora Elizabeth Li Quirós.
RESULTANDO
I.En fecha 6 de marzo del 2019, se interpone el presente proceso de conocimiento que tiene como pretensiones las que se transcriben literalmente a continuación, las cuales fueron ratificadas en la audiencia preliminar del 12 de noviembre de 2019: "1.- PRETENSIÓN PRINCIPAL. Solicitamos declarar en sentencia: a.- Que los siguientes actos administrativos, son absolutamente nulos: (i) Oficio CN-ARS-A2-1741-2018 (ii) Resolución DRCN-AJ-J-706-2018 (iii) Resolución DM-A-1069-2019 b.- Que, al anularse los actos administrativos recién citados, el Ministerio de Salud está en la obligación de autorizar a mi representada para continuar recibiendo desechos sólidos en el Relleno Sanitario Los Mangos, hasta colmar la capacidad de sus celdas 8, 9, 10 y 11. c.- Que el Estado debe indemnizar a mi representada por la daños y perjuicios que le ha causado, condenándose en abstracto y reservando su liquidación para la ejecución de sentencia en los términos del artículo 122 inciso m) del CPCA. d.- Que el fallo deberá condenar a la indexación a cargo del Estado, en los términos del artículo 123 del CPCA. e.- Que el Estado debe pagar ambas costas de esta acción. 2.- PRETENSIÓN SUBSIDIARIA IV.- PRETENSIÓN En el hipotético caso de que nuestra pretensión principal sea rechazada, solicito, entonces, declarar lo siguiente: a.- Que el Estado debe expropiar de mi representada el relleno sanitario Los Mangos. b.- Que el Estado debe relevar a mi representada de la responsabilidad ambiental y sanitaria por el cierre técnico de dicho relleno. c.- Que el Estado debe encargarse de la operación del relleno sanitario Los Mangos, incluyendo su operación completa y gastos de mantenimiento, hasta que alcance su cierre técnico. d.- Que, en la fijación del justiprecio por la expropiación del relleno sanitario, además del resto de parámetros establecidos legalmente, deberán tomarse en cuenta los siguientes factores: (i) Valor actualizado de los terrenos que conforman el relleno (ii) Pérdida del chance comercial de mi representada por dejar de competir en el mercado (iii) Utilidades dejadas de percibir por las toneladas métricas de capacidad remanente e.- Que el Estado debe pagar ambas costas de esta acción.” (Ver imágenes 2 a 12 del expediente judicial digital y audio de audiencia preliminar).
II.Otorgado el traslado de ley, la representación del Estado contesta negativamente la demanda e interpone la defensa de cosa juzgada y falta de derecho. (Ver imágenes 166 a 178 del expediente judicial digital).
III.La audiencia preliminar establecida en el ordinal 90 del Código Procesal Contencioso Administrativo, fue celebrada el día 12 de noviembre del 2019, con la participación de todas las partes, en la cual, se ratificaron las pretensiones, se resolvió el rechazo de la excepción de cosa juzgada por resolución oral 2054-2019 y se aceptó prueba documental y testimonial. (Imágenes 256 a 260 del expediente judicial digital y audio de audiencia preliminar)
IV.En fecha 7 de enero de 2021 se realizó la audiencia de juicio oral y público en modalidad virtual mixta con la presencia de las partes, no se evacuó la prueba testimonial aceptada en audiencia preliminar ante el desistimiento de ésta por parte de la actora y se emitieron las conclusiones de rigor de manera oral (audio de audiencia de juicio oral y público).
V.Se dicta esta sentencia dentro del plazo de ley, por unanimidad y previa deliberación de los integrantes del Tribunal, sin que se observen causales capaces de invalidar lo actuado.

CONSIDERANDO
De importancia para la resolución de este asunto, se tiene como debidamente acreditado lo siguiente:
De importancia para la resolución del presente asunto, tenemos como no demostrado: 1) Que la firma actora desacreditara la actividad de transferencia de residuos no autorizada en el inmueble denominado relleno “Los Mangos”. (Los autos). 2) Que la empresa accionante acreditase que la única forma de realizar el cierre técnico de una celda incompleta o pendiente de llenar sea por un método propuesto por ellos. (Los autos). 3) Que la accionante acreditase que la forma ordenada por las autoridades sanitarias sea incorrecta o desacorde con reglas de la ciencia y de la técnica, o bien, provoquen daño ambiental. (Los autos). 4) Que exista habilitación para la utilización de las celdas 8, 9, 10 y 11 del relleno “Los Mangos” en el lugar denominado “La Chanchera” fuera de los términos del acuerdo conciliatorio homologado por resolución 1084-2011 de la sección de conciliación de este Tribunal. (Los autos). 5) Que el voto 10883-2018 del 6 de julio de 2018 dictado por la Sala Constitucional tuviese relación con el funcionamiento del relleno sanitario como destino final de residuos. (Los autos).
En síntesis, el actor en su demanda y en conclusiones basa su teoría del caso en el hecho de ser propietario del relleno sanitario “Los Mangos”, el cual se encargó de la tarea de reconversión del antiguo botadero “La Chanchera”, siendo el responsable ambiental y sanitario de ese proyecto. En ocasión del acuerdo conciliatorio alcanzado dentro del expediente judicial 11-002733-1027-CA tramitado en esta sede, se dispuso el tratamiento de desechos sólidos e intentar concluir el cierre técnico del proceso de reconversión del antiguo botadero “La Chanchera”, permitiendo el Estado la operación del relleno sanitario hasta una fecha cierta que ya se cumplió, empero, el relleno no alcanzó la totalidad de la capacidad volumétrica para recibir desechos sólidos. Considera que dicho acuerdo conciliatorio no constituye cosa juzgada no sólo por la falta de los elementos para que ello ocurra, dado que lo aquí atacado constituyen actos posteriores a dicho acuerdo, sino que además, dicho acuerdo fue enmarcado en un proceso ante causam cautelar y no de conocimiento.
Posterior a dicho acuerdo, la accionante solicitó nuevamente continuar recibiendo desechos sólidos en su relleno, ello al tenor de lo ordenado por la Sala Constitucional en el voto 10883-2018 que, a su criterio, pese a no ser parte, sí les vincula, afirmando que, a la fecha de interposición de la demanda, las celdas 8 a 11 inclusive continúan sin colmar la capacidad de recepción de desechos sólidos, por lo que solicitó al Área de Salud Alajuela 2 la autorización con el exclusivo propósito de completar esas 4 celdas (no para otra actividad como una supuesta estación de transferencia), resultando la petición rechazada por oficio CN-ARS-A2-1741-2018. A ello, se interpusieron los recursos ordinarios de revocatoria y apelación, siendo resuelta la revocatoria por la Dirección Regional de Rectoría de la Salud Central Norte, y no por el emisor del acto base, siendo éste rechazado y elevado el recurso ante el Ministro, el cual por resolución DM-A-1069-2019 rechazó el recurso de alzada, aludiendo en ambos casos a una supuesta estación de transferencia de desechos que no existe y que no fue objeto de la solicitud planteada, además de omitir pronunciamiento expreso respecto a alegaciones de forma expuestos en el recurso.
Consecuencia de lo anterior, ante la negativa de completar el espacio volumétrico de las celdas, es materialmente imposible alcanzar el cierre técnico del relleno sanitario y una violación al artículo 3° del Decreto 38928-S, reglamento sobre rellenos sanitarios, concretamente, a la definición técnica de “vida útil” dada por dicha normativa y a su vinculación con el diseño preliminar aprobado con el proyecto, siendo que su modificación “pone en riesgo el cumplimiento de los objetivos ambientales propuestos y el correcto funcionamiento del este, ya que, al no utilizar la capacidad del relleno en su totalidad, los cálculos y proyecciones realizados en la etapa de diseño, que contemplan el uso del 100% de las celdas, variarían por modificar los parámetros de operación”, siendo consecuentemente imposible la aceptación de menos del 100% de uso de cada celda tal y como lo contiene el artículo 12 y 32 de la citada reglamentación, no estando dentro de los escenarios de excepción (fuerza mayor), siendo contrario a las reglas de la ciencia y la técnica la decisión tomada por el Ministerio de Salud y una desviación del fin público, sin mencionar una desaplicación de lo resuelto por la Sala Constitucional de dar una solución integral y definitiva al relleno sanitario, ya que lo resuelto en lugar de dar solución, mantiene el problema, con ello, de mantenerse la postura, debe consecuentemente el Estado expropiar y hacerse cargo del relleno, relevando a su representada de la responsabilidad ambiental y sanitaria.
En cuanto a la resolución que resolvió la revocatoria, considera que posee nulidad por haber sido resuelta por un órgano diverso al que dictó el acto, violentando el 350.1 de la LGAP y 60 de la Ley Orgánica del Ministerio de Salud, aspecto omitido de pronunciamiento den el acto de alzada ante el Ministro del ramo indicado. Esta conducta considera la parte actora que le ha provocado Daño material y daño moral objetivo, así como perjuicios.
En resumen, indica la representación Estatal tanto en la contestación como en conclusiones, que el presente asunto ya fue zanjado en ocasión de la firmeza del acuerdo conciliatorio del 8 de julio de 2011 que establecía un plazo máximo de ejecución en la recepción de residuos al 8 de julio de 2013. Además, la invocación al voto de la Sala Constitucional 2018-10883 lo que refiere es al ingreso de desechos sólidos al relleno sanitario y operación de una estación de transferencia no autorizada ni por el Ministerio ni por la Municipalidad, nunca a la operación del relleno como tal, cosa que se demuestra con el intento de obtener pronunciamiento de ese Tribunal, el cual rechazó la gestión por resolución de las 9:15hrs del 17 de noviembre de 2019. Afirma que las pretensiones son contrarias al ordenamiento jurídico e imposibles, en tanto existe un acuerdo conciliatorio con efecto de cosa juzgada material, el cual hace expresa referencia a la imposibilidad de recibir residuos en las fosas 8 a 11 del relleno “La Chanchera”, con lo que se busca en esta sede burlar lo ahí dispuesto ya que “Una vez cumplido el plazo convenido, se procedería a su cierre técnico independientemente de que las celdas autorizadas para recibir los desechos estuvieran o no con espacio, ya que el plazo convenido entre ambas partes era improrrogable… la presente demanda pretende contravenir lo ya convenido entre ambas partes sobre el cierre definitivo del Relleno Sanitario Los Mangos propiedad de la actora, ya que su pretensión principal es que se le autorice a seguir recibiendo desechos sólidos, lo que necesariamente implica reabrir el Relleno para su funcionamiento”, resultando consecuentemente irrelevante que exista o no capacidad disponible, el plazo devino con lo que el acuerdo debe cumplirse.
Aclara que dentro del expediente judicial 11-002733-1027-CA ya se resolvió la petitoria de anulación del acuerdo conciliatorio por resolución 758-2019-C, rechazado igualmente en legajo de ejecución de dicho expediente por resolución 414-2020 y confirmado su rechazo en apelación por resolución 530-2020-I de la Sección I del Tribunal de apelaciones, con lo que se evidencia que lo que busca la parte es venir en autos a reiterar argumentos e intentar nuevamente el desconocimiento de los efectos de cosa juzgada del acuerdo conciliatorio o en su defecto, reabrir o revisar lo ahí dispuesto. Así, las resoluciones cuestionadas resuelven el rechazo de la reapertura del relleno ajustándose a derecho, así como demostrando que estamos en presencia de una demanda improponible. Señala que el argumento referido a la contradicción con la definición técnica de vida útil dispuesto en el reglamento no fue un agravio expuesto en sede administrativa, con lo que no puede venir a introducirse como argumento diferente en esta sede.
Referente a que el recurso de revocatoria fue resuelto por instancia diferente a la emisora del acto base, considera que no es motivo suficiente para invalidar lo resuelto. Consecuentemente, no existe sustento para la reclamación de daños y perjuicios al no existir derecho sobre la cual sustentarse. Solicitando con ello el rechazo de la demanda y la condenatoria en costas con los respectivos intereses.
En atención al asunto de fondo, es importante traer a colación una serie de consideraciones generales respecto al thema decidendi, concretamente, del régimen obligacional que trae consigo el tratamiento final de residuos sólidos, bajo la modalidad de relleno sanitario. De manera general podemos señalar en la actualidad que toda actividad productiva y eventualmente lucrativa posee una serie de limitaciones propias del llamado control de policía que ejerce el Estado, entendido como un todo, que gestiona los intereses particulares en la generación de bienes y servicios, encontrando las bases de esta actividad en la propia Constitución, mirando los numerales 11, 21, 45, 46, 50 y 69 de nuestra Carta Magna, usualmente materializados en aspectos propios del derecho urbanístico en el control de la actividad tanto constructiva, como el desarrollo de las actividades humanas. Así, dentro del derecho urbanístico convergen una pluralidad de competencias públicas, tanto de fiscalización, vigilancia, control y autorización, ya sea concurrentes o, en algunos casos, conjuntas.
Limitándonos al régimen de control de las actividades productivas, encontramos, dentro de tales manifestaciones del poder de policía urbanística, intervenciones en la actividad privada antes, durante y después de que ésta sea llevada a cabo, a través de permisos, licencias y autorizaciones en el primer caso, inspecciones y fiscalizaciones en el segundo y tercer caso citado. A manera de ejemplo, para el establecimiento de un comercio de bienes (como lo sería un abastecedor), encontramos como mínimo a nivel privado la participación del propietario del inmueble ya sea por ser éste el propio desarrollador de la actividad, o dando su autorización, arriendo u otra modalidad para que el espacio físico de su dominio sea destinado al desarrollo de la actividad. Por su parte, a nivel público la participación del gobierno local en la resolución municipal de ubicación, el certificado positivo de uso de suelo; por parte del Ministerio de Salud con el permiso sanitario de funcionamiento, del Ministerio de Hacienda la inscripción como contribuyente, todos necesarios para la obtención de la patente municipal que permite lícitamente el ejercicio de la actividad con fines de lucro.
Ahora bien, es posible seguir agregando competencias concurrentes dependiendo de la naturaleza de la actividad a realizar, pudiendo encontrarse la necesaria participación de la Secretaría Técnica Nacional Ambiental (SETENA) con la aprobación de planes de manejo ambientales y estudios de fragilidad y viabilidad ambiental, Ministerio de Ambiente y Energía, el Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento, el Ministerio de Agricultura y Ganadería, entre otros, insistiendo claro está, que la participación de tales órganos públicos está supeditado al tipo de bien o servicio que se trate, teniendo de igual forma competencias de control y fiscalización a posteriori, incluyendo otras instituciones como el Tribunal Ambiental Administrativo. Con ello, no es de extrañar que la esfera pública infiera un control en la actividad privada legítimamente habilitada desde la Constitución, en aras de la garantía de un ambiente sano y ecológicamente equilibrado, un correcto uso de la tierra y el respeto a los límites del desarrollo y explotación de la propiedad privada.
Nuevamente, la intensidad de tales controles varía dependiendo de la actividad que se trate, siendo aquellos calificados o calificables de riesgo, los que deben soportar con mayor fuerza los controles administrativos, llevando incluso a la exigencia de contar con criterios técnicos (profesionales asignados – responsables), planes de manejo y desarrollo de la actividad, inspecciones controladas, entre otras formas de intervención en la actividad privada los cuales, ante la detección de una irregularidad o incumplimiento, y eventualmente la desidia o inatención correctiva de la conducta, llevar a la paralización o incluso cierre definitivo de la actividad que se trate. Ahora bien, en este estado de las cosas, la actividad de la disposición final de residuos sólidos constituye, por excelencia, en una de las actividades de riesgo cuyo control administrativo es, particularmente, intenso. Focalizándonos, claro está, en la modalidad de tratamiento final a través del sistema de relleno sanitario, y dejando de lado otros sistemas de tratamiento final de residuos como lo sería la incineración, esta actividad presenta características particulares, en cuanto al régimen obligacional, que difiere de otras actividades como de inmediato se puntualizará.
Concretamente, afirmamos que el régimen obligacional que gira en torno a la actividad de relleno sanitario posee una dualidad jurídico administrativa, con elementos de tipo personal por un lado y con elementos de carácter real por otro, es decir, el acto administrativo habilitante provoca efectos tanto frente a determinado administrado que no sólo se va a beneficiar del respectivo título habilitante y que lo constituye, a su vez, en el responsable de ésta, sino que, simultáneamente, ello va a provocar una afectación de alcances reales al inmueble en el que se va a realizar la actividad, que trasciende de un mero acto administrativo de carácter temporal, convirtiéndose en una verdadera limitación urbanística para el inmueble, su titular y los titulares subsiguientes, en lo que la doctrina denomina o conoce como la creación de una obligación propter rem. Esta afirmación la podemos demostrar – siguiendo con el ejemplo supra – con el caso del incumplimiento de medidas sanitarias de determinado abastecedor el cual pierde su patente y su permiso sanitario de funcionamiento, no existiendo inconveniente para que, a posteriori, un nuevo administrado que corrija la conducta o simplemente, no realice la acción que le fue reprochada a su antecesor y se ajuste a los parámetros de la actividad, pueda obtener – en el mismo lugar – otra habilitación idéntica a la anterior.
Este escenario no es posible de llevarlo ceteris paribus (en igualdad de condiciones) en un paralelismo a la actividad de relleno sanitario dado que éste extiende el régimen de responsabilidad aún mucho tiempo después de que la actividad comercial (de recepción de desechos) haya finalizado, y que afecta a manera de limitación urbanística, el aprovechamiento del inmueble a los sucesores titulares de la matrícula inmueble, los cuales bajo ningún supuesto adquieren de manera originaria, sino soportando tales limitantes en el ejercicio de las facultades de dominio, al punto de tener que soportar, sin derecho a reclamo alguno conforme el párrafo segundo del numeral 45 constitucional, intervenciones de autoridades públicas en el terreno, en caso de ser necesario, o la posibilidad de continuar, reiniciar o modificar la misma actividad. Ahora bien, para un correcto equilibrio de lo dicho anteriormente, es claro que debe existir un control en el ejercicio de tales potestades y parámetros objetivos que permitan, sin sonar tautológico, que el control administrativo pueda ser controlado a su vez, en este caso, por esta jurisdicción de lo contencioso – administrativo en aplicación de los artículos 11 y 49 Constitucional en relación con los numerales 1, 2, 36, 42 y 122 del Código Procesal Contencioso Administrativo.
Concretamente, en la actividad de relleno sanitario encontramos una particular predominancia del criterio técnico como parámetro objetivo de control y fiscalización no sólo del administrado, sino de la propia administración fiscalizadora, ello claro está, en una sujeción a lo dispuesto en el numeral 16 de la Ley General de Administración Pública que dispone que “1. En ningún caso podrán dictarse actos contrarios a reglas unívocas de la ciencia o de la técnica, o a principios elementales de justicia, lógica o conveniencia. 2. El Juez podrá controlar la conformidad con estas reglas no jurídicas de los elementos discrecionales del acto, como si ejerciera contralor de legalidad”, permitiendo concretizar esta norma el principio de la interdicción de la arbitrariedad, ello tanto en las etapas preparatorias, durante la ejecución de la actividad y posteriormente, una vez cesada ésta. A nivel normativo, encontramos parámetros en el Reglamento sobre Rellenos Sanitarios, inicialmente establecido mediante decreto 27378-S que rigió desde el 23 de octubre de 1998 hasta el 14 de noviembre de 2014 y posteriormente por el decreto 38928-S que rige hasta la actualidad, definiéndose el relleno sanitario en la primera norma como la “Técnica mediante la cual los residuos se depositan en celdas debidamente acondicionadas para ello y donde los mismos se esparcen, acomodan, compactan y cubren diariamente.
Su fin es prevenir y evitar daños a la salud y al ambiente, especialmente por la contaminación de los cuerpos de agua, de los suelos, de la atmósfera y a la población al impedir la propagación de artrópodos, aves de carroña y roedores, que son agentes nocivos para la salud” y en la segunda como “la técnica mediante la cual diariamente los desechos sólidos se depositan, esparcen, acomodan, compactan y cubren empleando maquinaria. Su fin es prevenir y evitar daños a la salud y al ambiente, especialmente por la contaminación de los cuerpos de agua, de los suelos, de la atmósfera y a la población al impedir la propagación de artrópodos y roedores”, siendo necesario traer a colación el concepto técnico de “celda”, que es concebida como “conformación geométrica que se da a los desechos sólidos y a su material de cobertura, debidamente compactados, como parte de la técnica de relleno sanitario”.
De manera general, la actividad bajo estudio consiste en la apertura en el suelo (aprovechamiento de subsuelo) de fosas cuya denominación técnica es de “celda” la cual es habilitada para la recepción, compactación y finalmente confinamiento de residuos sólidos. La citada reglamentación permite dos metodologías de trabajo, el denominado “Relleno Sanitario Manual” y el “Relleno Sanitario Mecanizado”, siendo obligatorio este último cuando el relleno es destinado para la recepción de residuos de poblaciones que generen más de 40 toneladas diarias (art. 5° del decreto 38928-S) y que es el que interesa en este caso, en tanto es una metodología que “requiere de equipo pesado tanto para su construcción como para su operación, así como de mecanismos de control y vigilancia de su funcionamiento” (art. 3.l ejusdem). Esta actividad incluye, necesariamente, de un aprovechamiento del suelo y del subsuelo de determinado inmueble, generando una variación de la composición del terreno, conforme la naturaleza del proyecto aprobado, dado que es posible el destino de celdas para la disposición final de residuos ordinarios y/o peligrosos, definidos respectivamente como “Residuos de carácter doméstico generados en viviendas y en cualquier otra fuente, que presentan composiciones similares a los de las viviendas.
Se excluyen los residuos de manejo especial o peligroso, regulados en la Ley de Gestión Integral de Residuos” los primeros y “Residuos que por su reactividad química y sus características toxicas, explosivas, corrosivas, radioactivas, biológicas, bioinfecciosas e inflamables, o que por su tiempo de exposición puedan causar daños a la salud o al ambiente” los segundos. Consecuencia de lo dicho hasta el momento, es que tales desechos permanecen en el subsuelo, técnicamente confinados – en principio – y es justamente ello lo que provoca la limitación en las potestades de dominio (264 del Código Civil) que se manifiesta como una afectación real y una obligación propter rem (obligación propia de la cosa). Con ello, dada la naturaleza de la actividad referida, el terreno donde se encuentren las indicadas fosas queda afecta independientemente del propietario y regido por aspectos técnicos, vinculados del proyecto de gestión aprobado y el tipo de residuos que son destinados a ese espacio físico, siendo este último aspecto un elemento diferenciador con otras actividades, dada la necesidad de mantener una intervención en el sitio, posteriormente al cierre o cese de recepción de residuos (actividad que podemos calificar de operativa – comercial conforme los numerales 32 a 35 del reglamento bajo estudio), a cargo del responsable del proyecto, actividad denominada cierre técnico (artículos 41 a 44 ídem), en conjunto con el propietario del inmueble que debe soportar esta intervención.
Y posterior al cierre técnico, aún persiste, sobre cada fosa, un aprovechamiento limitado a futuro mínimo de 20 años (artículo 46 del reglamento citado), que modula las condiciones o posibilidades de edificación por parte del responsable, un tercero o el propietario. Contrario a otras actividades de tipo industrial – mercantiles, el relleno sanitario desde la perspectiva temporal siempre es de carácter finita, dado que la habilitación de funcionamiento comercial (recepción lucrativa de residuos) solamente es posible en tanto exista vida útil del relleno, concepto que es definido en la ya citada normativa reglamentaria como “Período de tiempo estimado para completar la totalidad de las celdas con residuos incluyendo su configuración final conforme a los criterios de diseño contenidos en la memoria de diseño respectiva y demás requisitos establecidos en este reglamento” (art. 3.p). Así, a manera general, aquél que obtiene un acto habilitante y se constituye en responsable de la actividad de relleno sanitario debe saber, necesariamente y desde la etapa previa a la emisión de dicho acto habilitante, sin posibilidad de alegar desconocimiento del marco jurídico aplicable, que existe un régimen obligacional que lo somete no solamente durante el período habilitado para la comercialización del servicio (recepción lucrativa de desechos sólidos), sino que soporta, superada la vida útil de todas las celdas del proyecto aprobado, un período de elaboración de obras de cierre, debiendo cubrir por su cuenta los costos que ello conlleva, tanto en la etapa en que las celdas se encuentran activas como durante el período de cierre técnico, no omitiendo destacar la carga que debe soportar igualmente en cuanto a las inversiones necesarias desde la perspectiva de la ciencia y de la técnica que deban realizarse en el campo del relleno, sus celdas y alrededores, con la finalidad del cumplimiento de medidas ambientales – sanitarias ordenadas por la autoridad competente; mientras que por otra parte, el propietario que ha permitido que sobre su dominio se realice este aprovechamiento, debe soportar las limitaciones durante el tiempo tal y como se ha descrito anteriormente.
Ahora bien, este sería un escenario típico normal de una actividad como la estudiada, ya que encontramos dos supuestos de carácter excepcional y que interrumpen el curso de eventos que hemos expuesto: uno relacionada con eventos de fuerza mayor (art. 32) y el otro producto de la suspensión, revocación o no renovación del permiso por causas imputables al administrado (artículos 30, 45). En ambos supuestos, el proyecto es interrumpido de su ejecución, provocando necesariamente un ajuste de diseño. Concretamente, a diferencia del ejemplo que hemos usado anteriormente en comparación – el abastecedor – el relleno sanitario no puede limitarse a su clausura / paralización de actividades, sino que, justamente, los dos eventos antes mencionados, lo que provocan es, más que una inactividad, la ejecución de nuevas tareas, para ser exacto, el adelantamiento de las obras de cierre técnico (arts. 41 a 44 del reglamento) y la necesidad de presentar los respectivos planes y diseño para la ejecución del cierre técnico.
En otras palabras, los supuestos citados lo que provocan es la imposibilidad de continuar con el ejercicio de la actividad habilitada (recepción lucrativa de residuos), pero no inhibe o exime al responsable de las obras de cierre técnico. Téngase que, al respecto, esto no se trata ni de una carga nueva, ni de una carga adicional, ya que, desde la génesis del acto habilitante, el responsable soporta la obligación de realizar esta actividad de cierre, lo que no lo constituye en una tarea extraordinaria. Momento oportuno que nos permite traer a colación el dato que nos brinda el reglamento de que existen dos modalidades de cierre técnico: aquél que no incluye celdas nuevas (art. 43) y el denominado reconversión del vertedero a relleno sanitario, siendo las reglas de este último – básicamente – la solución para regularizar actividades informales de destino final de desechos (vertedero), siendo básicamente el trámite de un relleno sanitario nuevo (art. 44).
Lo anterior nos lleva a uno de los últimos aspectos generales, referentes a la renuencia u omisión del responsable tanto de presentar los diseños de cierre técnico, como ejecutar las obras como tal. Al respecto, nos remitimos a la solución que señala la Ley General de Administración Pública en su numeral 149, que nos brinda la posibilidad de: cumplimiento forzoso, ejecución sustitutiva y ejecución forzosa mediante apremio sobre el patrimonio del administrado (acción de regreso). Cualquiera de ellas va a implicar, necesariamente, que el propietario del inmueble soporte la intervención en los términos indicados, sin posibilidad de reclamo alguno, lo anterior sin perjuicio del eventual escenario de reclamo de daños y perjuicios imputables al renuente que, causalmente, provoque el inconveniente.
PREEXISTENCIA DE UNA SITUACIÓN JURÍDICA CONSOLIDADA FRENTE A LAS PRETENSIONES DEL PROCESO. INAPLICACIÓN DEL INSTITUTO PROCESAL DENOMINADO “COSA JUZGADA”: Como se ha indicado en el apartado primero del resultando de esta sentencia, así como la exposición de la accionante en este proceso, acá se discute una pretensión anulatoria de tres actos administrativos (pretensión 1.a), específicamente, el oficio CN-ARS-A2-1741-2018, la resolución DRCN-AJ-J-706-2018 y la resolución DM-A-1069-2019. A su vez, considera que, ante la eventual declaratoria de nulidad de estas actuaciones, ello provoca, consecuentemente, el efecto de obligar al demandado, concretamente el Ministerio de Salud, a autorizar la continuación de recepción de desechos sólidos en el Relleno Sanitario Los Mangos, hasta colmar la capacidad de sus celdas 8, 9, 10 y 11 (pretensión 1.b) y concomitantemente, el deber de indemnización de daños y perjuicios provocados por los efectos de tales actuaciones (pretensión 1.c).
Como puede claramente observarse, existe en el planteamiento bajo estudio una clara causalidad y conexidad con las pretensiones, que es relevante analizar de previo, frente a las alegaciones de la demandada de cosa juzgada. Criterio del Tribunal: Tal y como fue resuelto de manera interlocutoria vía resolución 2054-2019, no estamos en presencia de los supuestos legales para indicar que la resolución 1084-2011 emitida por el Área de Conciliación de este Tribunal dentro del expediente judicial 11-002733-1027-CA, que homologa el acuerdo entre las partes de este proceso, pueda afectar directamente las pretensiones de esta causa; sin embargo, sí genera una situación jurídica consolidada que rompe la causalidad alegada por la empresa actora, tal y como se indicará de seguido. La idea central afirmada es que, en una eventual anulación de los actos cuestionados, se levanta el impedimento de continuación de recepción de desechos sólidos para las celdas 8, 9, 10 y 11 del área denominada “La Chanchera”, lo cual resulta no atendible ante la situación jurídica consolidada que provoca la resolución judicial de homologación 1084-2011 ya citada, en cuanto a los siguientes aspectos: De los autos se desprende que la habilitación del área denominada “La Chanchera”, fue concedida con dos finalidades, por un lado, de procurar el cierre técnico del proyecto de las celdas 1 a 7, que es el objeto de la orden sanitaria CN-ARS-A2-011-2011 (hecho probado 9), y por otra parte, “darle tratamiento a los desechos ya ubicados en el sector conocido como la Chanchera, como también conjuntamente en ese mismo sector; empezar a tratar el ingreso de nuevos desechos”, empero, estableciéndose un término final para el ingreso de nuevos desechos, a saber, el 8 de julio de 2013.
Cabe resaltar que este plazo no ha sido modificado ni eliminado administrativa o judicialmente con posterioridad, constituyéndose en una situación consolidada. En otras palabras, no existe un título habilitante a favor del aquí accionante con posterioridad a dicha fecha para la actividad de recepción de residuos, sino que las actuaciones han girado en torno a la finalización de obras de cierre, con ello, aún en la eventualidad de que se declarasen nulos los actos cuestionados, no se produciría – automáticamente o de manera derivada – el nacimiento de la obligación pretendida por la actora, de que se obligue al Ministerio de Salud al otorgamiento del permiso en los términos alegados. Por esta razón, frente a la situación jurídica consolidada referida, la pretensión indicada como 1.b no sería de recibo. Con esta línea de pensamiento, resulta inconducente la discusión sobre si lo acordado en una conciliación en cautelar produce o no cosa juzgada, dado que, conforme se ha expuesto, esta discusión no tiene la virtud de afectar lo que se ha resuelto.
Para mayor claridad del análisis de la pretensión anulatoria de los actos CN-ARS-A2-1741-2018, la resolución DRCN-AJ-J-706-2018 y la resolución DM-A-1069-2019, es necesario indicar el contexto en que éstos fueron emitidos y la relación (o no) de éstos frente al recurso de amparo emitido en el expediente constitucional 18-007857-0007-CO. Al momento de emitirse el voto de la Sala Constitucional 10883-2018, el estado de las cosas en el proyecto de relleno “Los Mangos” podía remontarse – en actuaciones – a la gestión planteada el 15 de julio de 2016 en el que la aquí accionante había presentado el plan de cierre de las celdas 9 y 10, dado que el proyecto de cierre de las celdas 8 y 11 había sido aprobado desde el 3 de marzo de 2015 por oficio CN-ARS-A2-0477-2015 y por ello, se estaba ejecutando el cronograma de actividades aprobado (visible a folio 3325 del Tomo 11 del expediente administrativo).
A diferencia del anterior proyecto, el presentado para las señaladas celdas 9 y 10 fue rechazado el 20 de junio de 2016 por resolución realizada por funcionarios de salud y del municipio de Alajuela bajo el acto identificado como DR-CN-1752-2016 (visible a folios 3493 a 3496 del Tomo 11 del expediente administrativo), acto que fue impugnado y confirmado en instancia y alzada. Con ello, al momento en que se recibe la denuncia y se realiza la inspección por una supuesta actividad de transferencia de residuos en enero 2018 (folios 3629 a 3634 del Tomo 12 del expediente administrativo), la aquí actora aún no había cumplido a cabalidad con sus obligaciones en la etapa de cierre técnico, al no haber presentado, en ajuste a los lineamientos requeridos para ello, el plan del cierre de las celdas 9 y 10. Es a partir de ese momento, que inicia el conflicto con la actora por la citada actividad que no contaba con permiso sanitario ni autorización municipal, lo cual repercutió en órdenes sanitarias e inspecciones (véase al ejemplo la inspección de fechas 5 de marzo y 9 de julio, ambos del 2018, visibles a folios 3656, 3657, 3760 a 3767 del Tomo 12 del expediente administrativo) y hasta una denuncia penal bajo el expediente 18-002968-0305-PE (Folios 3777 a 3786 del Tomo 12 del expediente administrativo) que, para el fondo de la litis, no son de análisis por esta cámara ya que no fueron cuestionados en este asunto, mas sí constituyen un evento secundario de relevancia que la accionante no desacreditó en autos, por lo que su afirmación de que no existía o existió la actividad de transferencia de residuos queda desacreditada con la citada prueba que rola en autos.
Aclaramos, que estimamos que se tratan de eventos secundarios relevantes, dado que es esta actividad la que provoca el nacimiento de la tramitación del ya referido expediente de recurso de amparo y que culmina en el mes de julio de 2018 con la emisión del voto 10883-2018. Posterior a ello, es que encontramos la petición base planteada por la actora con fecha de recibido 17 de setiembre de 2018 (visible a folios 3818 a 3820) dirigida al Área Rectora de Salud Alajuela 2 del Ministerio de Salud en la cual rotula como “Tareas pendientes para cierre técnico del Relleno Sanitario Los Mangos sobre lo ordenado por la Sala Constitucional en el Voto No.10883-2018”. Esta gestión de la sociedad demandante afirma que el Ministerio es omiso en la ejecución del citado voto constitucional al no darle una solución integral y definitiva al funcionamiento del Relleno Sanitario Los Mangos y no permitir el cierre técnico de éste, el cual, a su parecer implica “necesariamente, recibir una mayor cantidad de desechos sólidos…para poder rellenar las celdas 8 a 11 inclusive.
Esa cantidad de desechos deberá definirse considerando, más allá del tiempo, el volumen aún pendiente de rellenar y el tonelaje requerido para ello. Proceder de cualquier otra manera, es sinónimo de impedir el cierre técnico del relleno y por tanto el incumplimiento de la orden judicial emitida por la Sala Constitucional” indicando adicionalmente que “La información técnica para que este Ministerio determine el tonelaje respectivo, ya ha sido aportado dentro del expediente judicial 11-002733-1027-CA, y es conocida por la Administración”, sin aportar información adicional de ninguna naturaleza. Cabe acá recalcar, según el orden de eventos expuestos hasta el momento, que este requerimiento planteado por la accionante, implicaba, necesariamente, la afectación de tres situaciones consolidadas previas: primero, los efectos del acuerdo conciliatorio que establecían el término final de la etapa de operación de recepción de residuos del relleno (8 de julio de 2013), segundo, la modificación del diseño - ya aprobado y puesto en ejecución – de las celdas 8 y 11 que se remontaban a marzo de 2015, y tercero, que para ese momento no se contaba por parte de la accionante con la presentación a estudio, valoración y eventual aprobación del diseño de cierre técnico de las fosas 9 y 10, subrayando que, la citada petición, no adjuntó información adicional a la simple petición escrita en los términos que han sido transcritos supra.
Es frente a este escenario que el Ministerio emite el primer acto cuya nulidad se solicita, que responde de manera negativa el requerimiento planteado y que se identifica como acto de fecha 21 de setiembre de 2018 del Área Rectora de Salud Alajuela 2 del Ministerio de Salud CN-ARS-A2-1741-2018, el cual en conclusiones afirma que dado el acuerdo conciliatorio homologado judicialmente, después del 8 de julio de 2013 sólo es posible realizar en el relleno la actividad de cierre técnico, que el recurso de amparo se refiere solamente a la actividad irregular de estación de transferencia que no cuenta con permiso de salud ni del municipio, insistiendo en la obligatoriedad de suspender actividades no autorizadas. Frente a este acto, la parte actora plantea un recurso de revocatoria con apelación en subsidio en fecha 5 de octubre de 2018 reiterando que su petición se fundamenta en lo resuelto por el Tribunal Constitucional, que la estación de transferencia no es una actividad propia de su representada y en la necesidad de que, para realizar el cierre técnico, se deba autorizar el ingreso de más residuos para poder rellenar las celdas 8 a 11.
En respuesta al recurso de revocatoria, es que aparece el segundo acto aquí impugnado, la resolución DRCN-AJ-J-706-2018 emitida por la Dirección Regional Rectoría de la Salud Central Norte, que declara sin lugar el recurso horizontal planteado y confirma el acto base cuestionado, fundamentando la decisión en la existencia de un deber del recurrente de que en dicho terreno solamente se realicen actividades autorizadas, debiendo suspender la actividad de estación de transferencia, que el acuerdo conciliatorio tiene alcances de cosa juzgada material conforme el 77 del Código Procesal Contencioso Administrativo hasta que haya otro pronunciamiento que lo anule o lo modifique, e indicando que “En cuanto que es imperioso el recibo de residuos para terminar las obras de cierre técnico, ese punto ya ha sido planteado en varias ocasiones a nivel institucional y en el Tribunal Contencioso Administrativo, sin que hasta el momento haya sido acogido” remitiendo al Ministro el conocimiento en alzada.
Por último, en ocasión del conocimiento del recurso de apelación contra el acto base referido, es que aparece el último acto cuestionado, la resolución DM-A-1069-2019 emitido por el Ministro de Salud, que rechaza el recurso de apelación presentado alegando, entre otros motivos que la resolución constitucional harto mencionada “…en ningún momento ordenó la apertura del botadero de basura Los Mangos, como erróneamente lo interpreta el señor Chacón Gamboa, tampoco es de recibo su argumento al citar que: “La empresa que represento no es la interesada en esa estación de transferencia…”, toda vez que, a pesar de su decir, la realidad es que se está realizando esta actividad a pesar de no contar con el respectivo Permiso Sanitario de Funcionamiento, por lo que los argumentos esgrimidos en su recurso no son de recibo…”. Criterio del Tribunal: La línea argumentativa de la parte actora para atacar estos tres actos administrativos se puede resumir en un cuestionamiento en cuanto al elemento motivo que repercute en una desviación del componente fin del acto, basando su teoría del caso en tres afirmaciones fundamentales: La existencia de una orden de la jurisdicción constitucional de darle solución al problema del relleno; que la solución es el cierre técnico, que la única forma de poder realizar el cierre técnico es a través del ingreso de nuevos residuos para llenar las fosas 8 a 11 del sector “La Chanchera” y en consecuencia, la negativa del Estado a través de los actos impugnados deviene en ilegal.
Esta tesis no es compartida en su totalidad por esta Cámara de juzgadores por varios motivos, advirtiendo que, en el aspecto que sí concuerda, es que el relleno sanitario – por el tiempo que ha pasado – debe formalizar el cierre técnico, sobre todo si se contabiliza que ello debió haberse dado desde julio del 2013 y esta situación es ajena a la existencia o no, del pronunciamiento de la Sala Constitucional, sino que ello deviene, tal y como se ha expuesto supra, en un acontecimiento natural u ordinario del desarrollo de la actividad bajo cuestionamiento. Así, la cuestión de si el voto de la Sala Constitucional 10883-2018 ha sido o no incumplido por el demandado, lo cierto es que en nada influye el fondo de lo que aquí se discute, aunque queda claro que, además de no ser esta la vía para cuestionar un incumplimiento de lo ordenado por el citado Tribunal de lo Constitucional, lo cierto es que, tal y como lo indicó el Estado en conclusiones, ya este argumento fue conocido y rechazado en esa instancia, dentro del expediente 18-007857-0007-CO, concretamente, en la resolución de las 9:15 horas del 17 de noviembre de 2019. Resuelto así este punto, analicemos los demás aspectos del fondo del asunto.
VIII.ANÁLISIS DE LEGALIDAD DE LOS ACTOS CUESTIONADOS Purgado el argumento expuesto en el considerando anterior, nos apegamos a la ya citada idea de la firma actora en su teoría del caso de que el Estado no permite – a criterio del accionante – el cierre técnico del relleno en ocasión de los actos cuestionados, y para ello, se sustenta en el hecho (incontrovertido por las partes) de que en el relleno área “La Chanchera” existen 4 celdas que aún se encuentran sin llenar, debiendo respetarse el proyecto aprobado desde el inicio y la inaplicabilidad de la cosa juzgada del expediente 11-002733-1027-CA, debiéndose permitir finalizar o alcanzar el cierre de cada celda, a través de la autorización para recibir nuevos desechos sólidos para colmar éstas, elemento de ciencia y técnica conforme el artículo 16 de la LGAP en relación con los numerales 8 a 11 del Reglamento sobre Rellenos Sanitarios y así consumar el cierre técnico.
Por su parte, el Estado insiste que la existencia o no de disponibilidad de espacio en las celdas resulta irrelevante, en tanto lo resuelto en el acuerdo conciliatorio establecía un término final improrrogable para la recepción de nuevo material, plazo que la parte accionante aceptó en el acuerdo conciliatorio y que ha pretendido, en diferentes instancias, desaplicar en su beneficio. Criterio del Tribunal: El razonamiento planteado por la parte accionante no puede ser atendido por esta Cámara de juzgadores por varios motivos. El primero de ellos, es la falta de asidero con dos ideas centrales: por un lado, el deber de tenerse que apegar al proyecto inicialmente aprobado por el propio Ministerio de Salud, y por otro, que solamente a través de la recepción de más desechos se puede colmar las celdas faltantes y así finalizar el cierre técnico. Interpreta este Tribunal, al son de lo expuesto hasta el momento, que la parte actora no pretende la reapertura del relleno sanitario ordinario, sino como una medida para, justamente, realizar el cierre de éste.
Empero, el problema probatorio para atender este pedimento se vuelve evidente y en consecuencia las ideas centrales señaladas carecen de sustento por las siguientes razones: De la revisión de los autos, encontramos que el “diseño original” ha sido progresivamente modificado a lo largo de la historia del relleno sanitario, desde el funcionamiento de las celdas 1 a 7 y hasta llegar al proyecto presentado y contenido en el acuerdo conciliatorio dentro del expediente 11-002733-1027-CA que enmarcó la funcionalidad de las celdas 8 a 11. Es decir, podemos afirmar que el proyecto inicialmente no se ejecutó – tal y como se desprende de los 12 tomos del expediente administrativo – como estaba pensado, ni en cuanto a diseño, ni en cuanto a la realización temporal que estaba planeado. Ahora bien, en ese orden de ideas, no se encuentra otra autorización administrativa al proyecto de celdas 8 a 11 del área denominada “La Chanchera” que no haya sido el producto del acuerdo conciliatorio harto mencionado, por lo que podemos afirmar que, justamente, ése es el modelo o proyecto de diseño que ha de entenderse aplicable al caso que nos ocupa.
Al tenor de lo expuesto, el diseño del proyecto en esos términos fue tajante, a partir del 8 de julio de 2013, se acababa la actividad de recepción de desechos sólidos nuevos y debía iniciarse, de inmediato, con las obras de cierre, debiendo presentarse el proyecto o diseño de clausura de las celdas. Acá nos lleva al segundo motivo que hace inatendible la gestión a criterio de quienes resuelven este asunto, y es que el proyecto ya cuenta con un diseño aprobado de cierre para las celdas 8 y 11 desde marzo del año 2015 (oficio CN-ARS-A2-0477-2015 citado líneas atrás), no existiendo ni argumentos por parte de la actora en el sentido de que el Estado impida la ejecución de este plan, que éste contenga la acción que se pretende acá se autorice, ni elementos valorativo o probatorios técnicos que justifiquen la variación del proyecto en el sentido pretendido o que ello haya sido previamente solicitado en sede administrativa; y en cuanto a las celdas 9 y 10, éstas no cuentan con diseño aprobado, justamente por el hecho de que la accionante no ha cumplido con su deber de presentar éste, sobre todo considerando de que el planteado en junio del 2016 fue rechazado, no existiendo, posterior a ello ni con ocasión de la presente demanda, un planteamiento técnico en ese sentido, concluyéndose, en consecuencia, de que existe una posición jurídica reprochable del demandante, ante la omisión del cumplimiento del deber legal de presentar el proyecto de cierre de las dos celdas indicadas.
Como tercer punto, es que de los autos no se desprende respaldo probatorio técnico a la afirmación de que la recepción de nuevo material es la única forma de realizar el cierre técnico. Acá la argumentación de la actora es parcialmente válida en cuanto al argumento de que las celdas – conforme la reglamentación aplicable al caso – solamente pueden cerrarse cuando agoten su vida útil, que, en palabras simples, se resume a que éstas se encuentren colmadas. Mas no resulta sustentable de que, se insiste, la “única” forma de colmar las celdas sea con nuevo material, esta afirmación no encuentra este Tribunal asidero probatorio técnico para respaldarlo, no se ofreció prueba documental ni pericial en ese sentido, sino que, lo que se logra apreciar del expediente administrativo, es la preexistencia de actos administrativos en firmes y que no fueron cuestionados en su momento, en el que se indica por parte de las autoridades de salud, que las celdas deben llenarse con tierra o tierra y desechos extraíbles del propio relleno, tal y como se desprende de la resolución DM-A-936-16 del Ministro de Salud, reiterando tal acto de que la carga de costear con el diseño del plan de cierre, corresponde al responsable del relleno, y que éste debe presentarse para su valoración y eventual aprobación administrativa, cosa que, se reitera, no se ha cumplido por parte de la demandante en cuanto a las fosas 9 y 10.
Tal solución emanada por la autoridad sanitaria demandada no ha sido desacredita técnicamente en este asunto, ni se han aportado elementos probatorios que hagan valorar a esta Cámara que exista algún tipo de irregularidad, desproporcionalidad o irracionalidad en la decisión vigente administrativa señalada. Corolario: El acto base cuestionado CN-ARS-A2-1741-2018, contiene dos pronunciamientos, el rechazo de la petición de ingreso de nuevo material, junto con la indicación / orden relacionado con el recurso de amparo y el impedimento de la estación de transferencia, posición mantenida en los otros actos cuestionados, la resolución DRCN-AJ-J-706-2018 y la resolución DM-A-1069-2019. Por las razones ya indicadas, se concluye que la posición administrativa contenida en dichos actos administrativos es razonable y ajustada a derecho, por lo que no se logra determinar vicios en el elemento motivo de los actos cuestionados y, en consecuencia, la alegación del desvío del fin del acto tampoco ha sido demostrada. Por ello, estos agravios deben ser rechazados.
De manera concomitante, la empresa actora cuestiona la validez jurídica del acto DRCN-AJ-J-706-2018 en el componente forma con motivo de la competencia, al romperse la composición resolutiva del recurso horizontal planteado, por cuanto la revocatoria fue resuelta por un órgano diferente al que emitió el acto base. En síntesis, el acto base identificado como CN-ARS-A2-1741-2018 fue emanado por la Dirección Área Rectora de Salud Alajuela 2, perteneciente a la Dirección Regional de Rectoría de la Salud Central Norte del Ministerio de Salud, mientras que la resolución del recurso de revocatoria, identificado como DRCN-AJ-J-706-2018, fue emitida por la Dirección Regional de Rectoría de la Salud Central Norte del Ministerio de Salud. Esta situación, a criterio de la demandante, implica la existencia de dos instancias de alzada, lo cual es irregular, además del vicio en cuanto a la competencia del acto y/o una huida de responsabilidad de quien emitió el acto base.
Criterio del Tribunal: En tesis de principio, la impugnación autónoma del recurso que resuelve horizontalmente, sea el recurso de revocatoria, resulta improcedente en ocasión de impedir la posibilidad de interponer recurso sobre lo que resuelve un recurso, lo cual de permitirse generaría una impugnación de manera interminable, existiendo como excepción cuando el propio acto de revocatoria modifica o elimina el acto base que está conociendo (constituyéndose por ende en un nuevo acto base), o cuando, ante la no interposición del recurso de apelación o la imposibilidad de interponer éste (como es el caso del recurso de reconsideración), lo que se resuelve horizontalmente da por finalizada la sede administrativa y consolida lo resuelto. Empero, en los supuestos en que el recurso de revocatoria le deviene un recurso de apelación, salvo el primer supuesto ya indicado, resulta improcedente su planteamiento autónomo, ya que la impugnación tiene sentido de manera conjunta, en tanto un eventual vicio en el acto de apelación, afectaría por reflejo lo resuelto en revocatoria.
En este orden de ideas, lleva razón la parte actora de que las autoridades que emiten el acto base y quien resuelve la revocatoria son diferentes, a razón de que quien resuelve este último, es el superior del primero, sin que se logre determinar en autos la existencia de la avocación respectiva. Empero, hay que analizar los alcances de este vicio, en cuanto afecta el componente formal y provoca la anulabilidad del acto (nulidad relativa), no su nulidad absoluta (vicio en motivo, contenido, fin). Así, en un análisis de trascendencia del vicio, señalamos que el acto cuestionado no modificó el acto base CN-ARS-A2-1741-2018, y la parte actora no expone cuál es la afectación a su esfera de intereses que haya sido el superior del emisor del acto base el que haya resuelto la revocatoria, tampoco alega indefensión y mucho menos, que la decisión hubiera sido diferente si otro órgano se hubiese pronunciado.
Así las cosas, al tenor del artículo 223 de la Ley General de la Administración Pública que dispone que: "1. Sólo causará nulidad de lo actuado la omisión de formalidades sustanciales del procedimiento. 2. Se entenderá como sustancial la formalidad cuya realización correcta hubiera impedido o cambiado la decisión final en aspectos importantes, o cuya omisión causare indefensión". Tenemos que, haciendo que la alegación de nulidad por la nulidad misma, no sea atendible, con lo que se logra determinar que no existen elementos de trascendencia para invalidar lo actuado y una eventual declaratoria de nulidad no posee la capacidad de modificar lo resuelto por los demás actos cuestionados, este argumento debe ser rechazado.
En línea con lo resuelto en indicado en considerandos anteriores, la pretensión principal a), relativa a la nulidad de los actos administrativos (i) Oficio CN-ARS-A2-1741-2018 (ii) Resolución DRCN-AJ-J-706-2018 (iii) Resolución DM-A-1069-2019 debe rechazarse, al confirmarse que no existen vicios que invaliden lo resuelto en sede administrativa, así como la razonabilidad y proporcionalidad de lo ahí indicado. En cuanto a la pretensión b), por conexidad, esta pretensión debe rechazarse, situación que se mantiene, aún si se analizase como una pretensión autónoma, reiterando, dadas las razones expuestas en los considerandos anteriores. Consecuente, ante la ausencia de una base antijurídica suficiente, no se presentan los elementos suficientes para dar origen a una constitución de un crédito indemnizatorio, con lo que lo procedente es el rechazo de las pretensiones indemnizatorias de daños y perjuicios identificado como la pretensión c), d) y e) de la demanda.
IMPROCEDENCIA. OBLIGATORIEDAD DEL CUMPLIMIENTO DE LAS CARGAS DEL TITULAR DEL RELLENO SANITARIO: A lo largo de este proceso, la parte actora no expuso en su teoría del caso, los motivos, razones y pruebas que sustentan las pretensiones subsidiarias, en el caso del rechazo de las principales, es decir, correspondía a la parte exponer cómo, en el marco de las cosas, existe un deber jurídico – positivo de la demandada de soportar las pretensiones subsidiarias, a saber: La obligación de expropiar el relleno sanitario los mangos (pretensiones subsidiarias a y d) y la consecuente obligación de liberar de responsabilidad ambiental y sanitaria por el cierre técnico del relleno a la actora, encargándose de la operación completa y gastos de mantenimiento hasta que alcance su cierre técnico (pretensiones subsidiarias b y c). A consideración de este Tribunal, conforme se expuso anteriormente, lo que se logra comprobar de los autos es, justamente, lo contrario a lo afirmado por la parte actora: La existencia de una obligación por parte de quien promueve la acción de presentar, como debe ser, el plan de cierre de las celdas 9 y 10 el área denominada “La Chanchera” del relleno “Los Mangos” y del cumplimiento a cabalidad del plan aprobado de las celdas 8 y 11 del mismo sitio, siguiendo los lineamientos técnicos que ha establecido la autoridad sanitaria demandada.
Con ello, lo pretendido lo que busca es rehuir, unilateralmente, al régimen obligacional que debe soportar al ser la destinataria de los efectos jurídicos del acto habilitante de relleno sanitario, no existiendo de los autos una justificación objetiva para relevarla de estos compromisos. En consecuencia, ante la ausencia de sustento fáctico – normativo de las pretensiones subsidiarias presentadas, lo correspondiente es el rechazo de éstas en su totalidad.
De conformidad con el análisis realizado en esta sentencia, la excepción de falta de derecho debe declararse con lugar, en ocasión de la forma en cómo se resuelve este asunto y expuesto en considerandos anteriores.
De conformidad con el numeral 193 del Código Procesal Contencioso Administrativo, las costas procesales y personales constituyen una carga que se impone a la parte vencida por el hecho de serlo. La dispensa de esta condena solo es viable cuando hubiere a juicio del Tribunal, motivo suficiente para litigar o bien, cuando la sentencia se dicte en virtud de pruebas cuya existencia desconociera la parte contraria. En la especie, no se denota causal justificante de exención, por lo que lo procedente es la condenatoria en costas a cargo de la actora, en conjunto con los correspondientes intereses legales que correrán a partir del día siguiente de la firmeza de esta sentencia, tal y como lo ha solicitado la parte demandada, sumas que deberán de liquidarse en la etapa de ejecución de sentencia
POR TANTO
Se declara con lugar la defensa de falta de derecho. En consecuencia, se declara SIN LUGAR en todos los extremos la demanda interpuesta por la empresa WPP CONTINENTAL DE COSTA RICA S.A. en contra del ESTADO. Son las costas a cargo de la actora, con intereses legales sobre tales sumas contabilizados desde el día siguiente de la firmeza de la presente resolución y hasta su efectivo pago, sumas que deberán de liquidarse en la etapa de ejecución de sentencia.
