THE STATE No. 99-2020-V.

TRIBUNAL CONTENCIOSO ADMINISTRATIVO, FIFTH SECTION, SECOND JUDICIAL CIRCUIT OF SAN JOSÉ. Goicoechea, at catorce horas tres minutos on veintiséis de noviembre de dos mil veinte.

Ordinary proceeding (proceso de conocimiento) instituted by Nombre10172, of legal age, single, attorney, resident of Ciudad Colón, and holder of identity card number CED89872, in his capacity as MAYOR OF MORA (see proof of representative authority at image 254 of the digital court file), with attorney Cindy Gabriela Monge Soto acting as special litigation counsel (special judicial power of attorney (poder especial judicial) appearing at image 552 of the digital court file). As shown at image 553 of the digital court file, since marzo de 2020 the Mayor of Mora has been Mr. Alfonso Jiménez Cascante, AGAINST THE STATE, represented by State Attorney Heilyn Sáenz Calderón (who entered an appearance pursuant to the document appearing at image 295 of the digital court file).

PROCEDURAL BACKGROUND:

  1. 1On 9 de julio de dos mil quince, the complaint giving rise to this proceeding was filed, based on the facts alleged and the law invoked. It was initially brought as a proceeding seeking a declaration that an administrative act was adverse to the public interest (Proceso de Lesividad al interés publico), challenging resolution N° 655-13-TAA of the Tribunal Ambiental Administrativo; however, the relief sought was reformulated at the Preliminary Hearing held on veintisiete de junio de dos mil dieciséis, leaving a declaratory ordinary proceeding as follows: “1) Annulment (nulidad) of report ACOPAC OSPR-535-10. 2) Annulment of resolution number 655-13-TAA. 3) Annulment of resolution number 004-2015-TAA of the Tribunal. 4) Determination of the actual amount of the environmental damage caused by the Municipalidad, through a report to be prepared by a suitably qualified expert, in view of the request to annul report ACOPAC OSPR-535-10. 5) An order requiring the State to pay the attorney’s fees and litigation costs (costas personales y procesales) in this matter.” (Image 370 of the digital court file).
  2. 2Together with the complaint, the plaintiff requested an urgent provisional interim measure within the proceedings (Medida Cautelar Intraprocesal Provisionalísimas) (Image 274 of the digital court file), seeking suspension of the enforceable effects of resolution Number 655-13-TAA, issued at 11:52 on once de agosto de de dos mil catorce by the Tribunal Ambiental Administrativo.
  3. 3By order issued at 9:59 on catorce de julio de dos mil quince, a hearing was granted regarding both the requested interim measure and the complaint (Image 278 of the digital court file).
  4. 4With respect to the interim measure, counsel for the State opposed it in the filing appearing beginning at image 287 of the court file. The Case-Management Judge of this Court, by resolution N° 2257-2015-T issued at 10:20 on 31 de agosto de 2015, denied the request for an interim measure (Image 296 of the court file). Following the appeal filed by counsel for the plaintiff (Image 305 of the court file), the appellate court for this jurisdiction, by resolution N° 512-2015-I issued at 9:50 on 16 de octubre de 2015, affirmed the lower court’s ruling (Image 325 of the court file).
  5. 5Counsel for the State answered the complaint, asserting the defense of lack of legal entitlement (Falta de Derecho) (Image 327 of the digital court file).
  6. 6At the Preliminary Hearing held beginning at 8:40 on veintisiete de julio de 2016, attended by counsel for both parties, the plaintiff reformulated its claims as stated in paragraph one of this procedural background; the disputed facts were identified; and both documentary and testimonial evidence were admitted, as follows: for the plaintiff, the testimony of municipal engineer Mr. Alonso Mora Arroyo and an expert opinion (peritaje) from a geologist, whose reasonable fees were set at doscientos cincuenta mil colones. The plaintiff was also allowed the testimony of engineer Ronald Mora Vargas (Image 369 of the digital court file).
  7. 7Regarding the expert opinion, by order issued at 11:34 on primero de agosto de dos mil dieciséis, the Case-Management Judge appointed expert Nombre113634 (Image 375 of the court file), who accepted the appointment in the document appearing at image 379 of the court file. He submitted his first report in octubre de 2016, and it appears at image 390 of the file. By order issued at 15:44 on once de octubre de dos mil dieciséis, the parties were given an opportunity to respond to it (Image 420 of the court file), and counsel for the State addressed it in the filing at image 462, lodging an objection.
  8. 8On dieciséis de febrero de dos mil diecisiete, the matter was assigned to the Fifth Section of the Tribunal Contencioso Administrativo (Image 472 of the digital court file).
  9. 9By order dated veintiuno de marzo de dos mil diecisiete, the trial hearing was scheduled for 8:30 on siete de mayo de dos mil dieciocho (Image 473 of the digital court file).
  10. 10In response to the arguments raised by counsel for the plaintiff Municipalidad concerning the expert opinion (Image 485 of the court file), the Tribunal, by order issued at 15:40 on cuatro de mayo de dos mil dieciocho, vacated the trial setting and ordered that the file be returned to the case-management stage for the appropriate action (Image 487 of the court file).
  11. 11By order issued at 10:43 on 9 de mayo de dos mil dieciocho, the Case-Management Judge of this Court ordered the expert to reformulate his report so that it would comply with what had been ordered at the Preliminary Hearing (Image 493 of the court file).
  12. 12The State objected by filing a motion for reconsideration (revocatoria) of the Case-Management Judge’s order requiring reformulation of the expert opinion (Image 496 of the court file). That motion was denied by order issued at 9:05 on dieciséis de mayo de dos mil dieciocho (Image 500 of the digital court file).
  13. 13The expert submitted his new report, appearing beginning at image 503 of the digital court file. By order issued at 11:42 on primero de junio de dos mil dieciocho, the parties were given an opportunity to respond to it (Image 519), and the plaintiff did not object (Image 522). Counsel for the State, for its part, stated that it was impossible to address the expert opinion because copies thereof had not been attached (Image 521), an assertion rejected by the Case-Management Judge in an order issued at 13:39 on once de julio de dos mil dieciocho (Image 526 of the court file). The State renewed its request for copies (Image 534 of the file), and the Case-Management Judge, by order issued at 11:24 on treinta y uno de agosto de dos mil dieciocho, referred to the prior ruling and ordered that, once that new order had been served, the file be forwarded to the Trial Tribunal (Image 536).
  14. 14By order dated veintitrés de mayo de dos mil diecinueve, the trial was rescheduled for 8:30 on veintiuno de octubre de dos mil veinte (Image 541 of the digital court file).
  15. 15By order of this Court issued at 13:57 on doce de octubre de dos mil veinte, the scheduled Trial Hearing had to be suspended because of the Covid pandemic affecting the country and pursuant to the directives issued by both the Ministerio de Salud and the Corte Plena del Poder Judicial. The parties were, however, encouraged to waive the testimonial and expert evidence so that the matter could be converted into a pure question of law (Puro Derecho) (Image 558 of the digital court file).
  16. 16In response, counsel for the Municipalidad and the State, respectively (Images 563 and 564), agreed to waive their testimonial and expert evidence and to convert the matter into a pure question of law.
  17. 17By order issued at 15:53 on tres de noviembre de dos mil veinte, the parties were granted cinco días hábiles to submit closing arguments in the matter (Image 566). Both the plaintiff (Image 570) and the defendant (Image 583) did so.
  18. 18The statutory requirements have been observed throughout the proceedings, and this Tribunal has identified no defect or omission capable of resulting in a nullity that must be remedied. This judgment is issued in writing after receipt of the corresponding closing arguments and within the statutory period, following the requisite deliberation and by unanimous decision.

Judge Giusti Soto drafted the judgment, with the concurring votes of Judge Álvarez Molina and Judge Mena García;

WHEREAS.

I.Proven facts (hechos probados). The following facts are deemed relevant for purposes of these proceedings:

  • 1)On 30 de octubre de 2009, Mr. Nombre113635 filed a complaint (queja) with the Environmental Tribunal (Tribunal Ambiental) regarding the large-scale extraction of material from private property without a quarry permit (permiso de tajo), where MINAET officials had previously shut down the operation; he stated that he had made inquiries with Setena and the Mining Registry (Registro Minero) and that no permits appeared to have been granted for that property belonging to Inversiones Vargas Amaya S.A., and he attached photographs (Page 4 of physical administrative case file N° 380-09-02-TAA, and Image 235 of the digital court case file).
  • 2)In connection with the complaint filed, the Administrative Environmental Tribunal (Tribunal Ambiental Administrativo), by decision (resolución) N° 1608-09-TAA at 9:30 hours on 10 de diciembre de 2009, requested: that the Directorate of Geology and Mines (Dirección de Geología y Minas) inspect the site; that the Mayor of Mora state whether the materials described in the complaint and shown in the photographs submitted by the complainant had been used; and that the Puriscal subregional office of SINAC conduct an inspection and issue a report assessing the economic value of the environmental damage (valoración económica del daño ambiental) caused, including the necessary remediation and mitigation measures (medidas de reparación y mitigación) (Page 6 of physical administrative case file N° 380-09-02-TAA, and Image 233 of the digital court case file).
  • 3)Mr. Eduardo Naranjo, President of the Asociación de Desarrollo de Piedras Negras de Mora, submitted to the Environmental Tribunal a document dated 10 de febrero de 2010, in which he asked it to take into account that the materials had been extracted from the site of a housing project that was to be developed, that the owner of the lot had donated the material to repair the area’s gravel roads, and that this had been coordinated with the Road Management Unit (Unidad de Gestión Vial) (Page 10 of physical administrative case file N° 380-09-02-TAA, and Image 229 of the digital court case file).
  • 4)On 12 de febrero de 2010, the Municipal Mayor of Mora responded to the Administrative Environmental Tribunal by official letter (oficio) DAM-011-2009, submitting a report from the Technical Road Management Unit (Unidad Técnica de Gestión Vial) and requesting that the case file be closed because no environmental damage existed. He attached official letter UGA-INF-02-2010, corresponding to an “Environmental Inspection Report” (“Informe Inspección Ambiental”), prepared on the basis of an inspection conducted on 11 de setiembre de 2010 by the Environmental Management Unit of the Engineering Department of the Municipalidad de Mora, which recommended that the Environmental Tribunal close the complaint because no environmental damage existed, require the property owner to submit a tree-planting plan consistent with the property’s land use (uso del suelo), and document the use of the material extracted from the land in terms of the linear meters of road repaired or maintained (Pages 21 and 17 of physical administrative case file N° 380-09-02-TAA, and Images 218 and 222 of the digital court case file).
  • 5)On 19 de febrero de 2010, the National Mining Registry (Registro Nacional Minero) submitted a report on a site visit conducted on the preceding 5 de febrero, at Dirección13866, identifying a quarry on private property. They were able to enter and observed a small quarry showing signs of prior extraction, but found neither personnel nor machinery. They stated that they asked some children passing by the site, who told them that material had been extracted approximately one month earlier. They further stated that a review of the records found neither a pending nor a granted application for the reported area (Page 23 of physical administrative case file N° 380-09-02-TAA, and Image 76 of the digital court case file).
  • 6)On 18 de febrero de 2010, the President and Secretary of the Asociación de Desarrollo Integral de Piedras Negras de Mora requested permission from Vargas Amaya S.A. to extract material and move machinery through its property so the material could be used to gravel the roads between the communities of Piedras Negras and Dantas (Page 82 of physical administrative case file N° 380-09-02-TAA, and Image 99 of the digital court case file).
  • 7)In a document dated 2 de marzo de 2010 and addressed to the Asociación de Desarrollo Integral de Piedras Negras, the legal representative (representante legal) of Vargas Amaya stated that the company accepted the request to extract gravel from the property for the benefit of the community, subject to obtaining the corresponding permits (Page 83 of physical administrative case file N° 380-09-02-TAA, and Image 97 of the digital court case file).
  • 8)By official letter N° ACOPAC-OSRP-535-10 DATED 11 de agosto de 2010, engineer Ronald Mora Vargas of the Puriscal Subregional Office of SINAC submitted the requested damage assessment report (informe de valoración del daño) to the Environmental Tribunal (Page 36 of physical administrative case file N° 380-09-02-TAA, and Image 203 of the digital court case file).
  • 9)By Environmental Tribunal decision N° 536-11-TAA at 10:50 hours on 24 de junio de 2011, administrative proceedings (procedimiento administrativo) were initiated in case file 380-09-02-TAA against Inversiones Vargas Amaya S.A., charging it with operating a quarry without the necessary permits and causing environmental damage assessed at ¢9.604.000.00 (Page 46 of physical administrative case file N° 380-09-02-TAA, and Image 192 of the digital court case file).
  • 10)In a document dated 22 de marzo de 2012, the legal representatives of Vargas Amaya informed the Environmental Tribunal that they had never authorized anyone to remove material from the site and that they had learned from a neighbor that the municipality’s machinery had removed the material (Page 62 of physical administrative case file N° 380-09-02-TAA, and Image 176 of the digital court case file).
  • 11)The Environmental Management Unit (Unidad de Gestión Ambiental) of the Municipalidad de Mora issued official letter N° UGA-INF-01-2012, dated 29 de agosto de 2012, in response to an internal request from the municipality’s Legal Counsel’s Office (Asesoría Legal) to inspect the location from which materials had been extracted according to the complaint filed with the Environmental Tribunal. The letter states that the inspection was conducted on 29 de agosto de 2012 and recommends requesting that the Environmental Tribunal reconsider the criteria used in this case to assess ecological damage (valoración del daño ecológico), because its effects were not observable two years later and only the natural succession of the ecosystem could be seen. It further recommended requesting an opinion from the UTGV coordinator on matters within that official’s purview, as well as considering the defense by the Legal Counsel’s Office regarding the municipality’s involvement, insofar as the quantity of material removed was unsupported by an objective assessment of the actual circumstances and the municipality’s purpose (Page 139 of physical administrative case file N° 380-09-02-TAA, and Image 100 of the digital court case file).
  • 12)In decision N° 696-13-TAA at 7:52 hours on cinco de agosto de 2013, the Environmental Tribunal ruled on a motion (gestión) by the representative of the reported company and therefore reiterated the decision initiating administrative proceedings against Vargas Amaya S.A., now also including the Asociación de Desarrollo Integral de Piedras Negras and the Mayor of the Municipalidad de Mora, charging them with operating a quarry and using materials without the required permits, with the environmental damage economically assessed at ¢9.604.000.00 (Page 122 of physical administrative case file N° 380-09-02-TAA, and Image 115 of the digital court case file).
  • 13)Beginning at 8:50 hours on 5 de setiembre de 2013, the “Oral and Public Hearing” (“Audiencia Oral y Pública”) was held in case file N° 380-09-02-TAA, at which the Municipalidad de Mora was represented by its special attorney-in-fact (apoderado especial), Carlos Lanzas Quesada. On that occasion, each representative in attendance was able to state their position on the case; the testimony of the witnesses offered was also received, and the parties presented their closing arguments orally (Page 150 of physical administrative case file N° 380-09-02-TAA, and Image 88 of the digital court case file).
  • 14)In decision N° 655-13-TAA at 11:52 hours on 11 de agosto de 2014, the Administrative Environmental Tribunal ruled on the complaint, finding the Municipalidad de Mora liable for causing significant adverse environmental damage to natural resources through the extraction of materials and the resulting impact on soil resources, without permits from the Directorate of Geology and Mines of MINAET and the Environmental Technical Secretariat (Secretaria Técnica Ambiental). It imposed the sum of ¢ 9.604.000.00 as compensatory damages (indemnización compensatoria) for environmental damage and the social cost of extracting materials from a property located at Dirección13867. It also demanded payment (intimó el pago) of the sanction imposed on the Municipalidad de Mora for the first time (Page 168 of physical administrative case file N° 380-09-02-TAA, and Image 70 of the digital court case file).
  • 15)On 13 de octubre de 2014, counsel for the Municipalidad de Mora filed a motion for revocation (recurso de revocatoria) against Environmental Tribunal decision N° 655-13-TAA at 11:52 hours on 11 de agosto de 2014 (Page 180 of physical administrative case file N° 380-09-02-TAA, and Image 53 of the digital court case file).
  • 16)By decision N° 881-14-TAA at 8:45 hours on 21 de octubre de 2014, the Environmental Tribunal dismissed as untimely the motion for revocation filed against decision N° 655-13-TAA at 11:52 hours on 11 de agosto de 2014 (Page 193 of physical administrative case file N° 380-09-02-TAA, and Image 45 of the digital court case file).
  • 17)On 24 de octubre de 2014, counsel for the Municipalidad de Mora filed a “Motion for Supplementation and Clarification and Application of the Nullity Regime” (“Recurso de adición y aclaración y régimen de nulidades”) against Environmental Tribunal decision N° 881-14-TAA at 8:45 hours on 21 de octubre de 2014 (Page 200 of physical administrative case file N° 380-09-02-TAA, and Image 38 of the digital court case file).
  • 18)In decision N° 004-2015-TAA at 14:30 minutes on 13 de enero de 2015, the Administrative Environmental Tribunal granted the motion for supplementation and clarification (adición y aclaración), but denied the motion for revocation, affirming the ruling in the case in all respects. It also demanded payment of the sanction imposed on the Municipalidad de Mora for the second time (Page 211 of physical administrative case file N° 380-09-02-TAA, and Image 27 of the digital court case file).
  • 19)In official letter N° AL-OF-0742-2015 of 19 de agosto de 2015, the Head of the Legal Counsel’s Office of the Comisión Nacional de Emergencias responded to a request from the Procuraduría General de la República, stating that the institution’s records contained no application by the Municipalidad de Mora requesting authorization to receive materials from a third party under the state of emergency declaration (declaratoria de emergencia) issued through Decreto N° 34553-MP in connection with the national emergency caused by Tormenta Tropical Alma (Images 347 and 348 of the digital court case file).
  • 20)In official letter N° DGM-RNM-829-2015 of 9 de setiembre de 2015, the head of the National Mining Registry of the Directorate of Geology and Mines of MINAE, in response to a request from the Procuraduría General de la República, stated that a review of the national mining registry (padrón nacional minero) showed that, for property N° 104708-0200, no application or concession for the extraction of materials existed in the name of the Municipalidad de Mora in 2009 (Images 353 and 354 of the digital court case file).

II.Unproven facts (hechos no probados). The following are relevant for purposes of these proceedings:

  • 1)That the Municipalidad de Mora had requested or obtained any permission from Vargas Amaya S.A. to extract material from its property. (That circumstance has not been proven).
  • 2)That the Municipalidad de Mora had requested or obtained any permission from the public authorities to proceed with the extraction and use of material from the property of Vargas Amaya S.A. located in Piedras Negras de Mora (That circumstance has not been proven).
  • 3)The “pressing and urgent need” to repair roads in Piedras Negras de Mora and that the deterioration of that portion of the cantonal road network had resulted from the effects of Tropical Storm Alma, which struck the country in 2008 (That circumstance has not been proven).
  • 4)That the road repairs carried out by the Municipalidad de Mora in Piedras Negras de Mora in 2009 were included in the General Plan approved by the Board of Directors of the Comisión Nacional de Prevención del Riesgo as part of the implementation of the declaration of emergency (declaratoria de emergencia) contained in Decreto Ejecutivo N° 34553-MP (That circumstance has not been proven).
  • 5)The actual personnel and installed machinery capacity of the Municipalidad de Mora to transport material (That circumstance has not been proven).
  • 6)The lack of professional qualifications (inidoneidad) of Engineer Ronald Mora Vargas to issue the “Assessment of Ecological Damage” report attached to official letter N° ACOPAC-OSRP-535-10. (That circumstance has not been proven).

III.Subject matter of the proceedings (objeto del proceso). Having analyzed the allegations and requests of the parties involved in this dispute, and in light of the claimant’s reformulation of its claims, the subject matter is determined to be a declaratory proceeding seeking the annulment of administrative action (nulidad de actuación administrativa), as well as a determination of the environmental damage (daños ambientales) caused.

IV.Arguments (alegatos). The Claimant asserts that on 30 de octubre de 2009, a complaint filed with the Tribunal Ambiental Administrativo by Mr. Nombre113635 was received concerning the apparent operation of a quarry (tajo) on the property owned by Inversiones Vargas Amaya S.A., located at Dirección13868, for alleged damage caused without the required permits, concession, or environmental feasibility approval (viabilidad ambiental); that complaint was processed under administrative case file (expediente administrativo) 380-09-02-TAA. By resolution N° 1608-09TAA of 10 de diciembre de 2009, the Tribunal Ambiental asked the Alcalde de Mora to report whether he had used materials obtained from excavation at the quarry and to explain the reasons for doing so. On 12 de febrero de 2010, the Alcalde reported that a social-interest project was to be developed on the property and that, because of the land’s topographic conditions, earthworks (movimientos de tierra) were required; the municipality assisted with that work, and the material resulting from it was used to repair community roads without causing instability of the land, felling of trees, damage to bodies of water, or damage to the natural landscape.

The Asociación Integral de Piedras Negras de Mora requested permission to extract material for the graveling (lastrado) of the Piedras Negras-Dantas road. Inversiones Vargas Amaya made the request to use the materials conditional upon obtaining the corresponding permits. In the administrative proceeding, the Tribunal Ambiental issued resolution 655-13-TAA at 11:52 on 11 de agosto de 2014, served on 6 de octubre de 2014, ordering the Municipality to pay ¢9.604.000 colones for environmental damage and social cost arising from the alleged damage caused to the aforementioned property. A motion for reconsideration (recurso de revocatoria) was filed and denied by resolution N° 004-2015-TAA of 30 de enero de 2015, thereby exhausting administrative remedies (agotada la vía administrativa). They contend that during the proceedings they proved that a social-interest housing project for low-income residents of the community of Piedras Negras was to be developed on the specified property and that the business purpose of Vargas Amaya is to develop housing solutions.

They further contend that, when the material was moved and removed, it became apparent that it could be used on roads in the area that were in poor condition as a result of the disasters caused by Tropical Storm “Alma”; consequently, the owner of the property donated it for that purpose, and arrangements were made with the Asociación de Desarrollo to use the donated material to restore passage along the routes in Piedras Negras. The Municipality assisted the Asociación de Desarrollo in extracting the material from the site and placing it on the cantonal road network; no permits were obtained because those activities were authorized by Decreto de Emergencia N° 34553-MP, published in La Gaceta on 10 de junio de 2008, as the matter involved an urgent need. In official letter ACOPAC-OSPR-535-10, Engineer Ronald Mora Vargas, Head of the Oficina Subregional de Puriscal del Área de Conservación Pacífico Central, submitted a damage assessment report stating the amount that was ultimately imposed.

They contend that the Tribunal Ambiental based its ruling on that report, which was absolutely null and void (nulo de pleno derecho) and inconsistent with reality, and which stated that approximately 3.430 cubic meters of earth had been moved, although it was proven that at most 500 cubic meters were used, without considering that the municipality lacked the capacity to transport the stated number of cubic meters, a matter the Tribunal Ambiental failed to assess. They contend that the report serving as the basis for the ruling raises reasonable doubts because it was prepared by a Forestry Engineer when a geological engineer was required. They allege that the Tribunal Ambiental failed to address the matter (preterición), improperly assessed and received the evidence, and misinterpreted the disputed facts. They state that the Asociación de Desarrollo did not participate in the private oral hearing (audiencia oral y privada) held on 5 de setiembre de 2013, although its participation was critically important, thereby leaving the municipality without an adequate defense (estado de indefensión).

They assert that neither the body of evidence offered by the municipality nor its arguments that it had merely assisted the Asociación de Desarrollo in maintaining its road network were assessed as a whole. They state that the Tribunal Ambiental ruled superficially and expediently, avoiding a rigorous analysis in weighing the interests being protected—namely, that the 500 cubic meters of material extracted by the municipality from private property with the owner’s proper authorization were used to promptly restore use of the road network connecting Piedras Negras with other communities, under the authority of Decreto Ejecutivo N° 34553-MP. They state that the administrative judges applied the law in an aberrant manner without considering its purpose so as to obtain a holistic view of the case. They assert that Decreto Ejecutivo 34553-MP remained in force for nearly four years from its publication on 10 de junio de 2010 and consider that the administrative acts carried out were covered by those emergency regulations, given that time constraints and urgent need required immediate attention to the Road Network.

They claim that Report ACOPAC-OSPR-535-10 is null and void because the professional who prepared it lacked the necessary qualifications and because it lacked the technical rigor required to determine the quantity of material extracted and the municipality’s ability to transport it. They cite the lack of technical rigor involved in having a forestry engineer issue a report on earthworks and earth extraction, for which he omitted basic technical variables required for such reports, including verification of the initial topography, contour lines, and final topography of the site to determine the number of cubic meters of material. They raised this issue before the Tribunal Ambiental, but their argument was not addressed.

V.For its part, the Defendant states that no permit for the extraction of materials was proven in the administrative proceedings (sede administrativa); indeed, the owners of the property, Vargas Amaya, informed the Tribunal Ambiental in a document dated 22 de marzo de 2012 that they had not authorized anyone to extract materials and that they had learned from a neighbor that municipal machinery had done so. Moreover, authorization to extract the material and permission for the machinery to pass through were requested by the Asociación de Desarrollo after the events, and that request was made conditional upon obtaining the respective permits. In addition, the Registro Nacional Minero certified that, according to its database, in 2009 no application for a concession to extract materials from that location had been filed in the name of the Municipalidad de Mora. They deny that the municipality’s actions were covered by Decreto Ejecutivo N° 34553-MP, through which a state of emergency was declared in the cantons of San José, Guanacaste, and Puntarenas.

They state that it is not true that the municipality brought the Asociación de Desarrollo into the proceedings, since it was the representatives of Vargas Amaya who did so; moreover, the municipality never offered the association’s representatives as evidence on its behalf. They state that, in the administrative proceedings, the sanctioned conduct did not concern the property’s topographic conditions or the earthworks undertaken to build the subsidized homes in the project; instead, the Tribunal Ambiental imposed a sanction for the environmental damage caused by the municipality’s unlawful extraction of materials. They maintain that the administrative decisions issued by the Tribunal Ambiental are legally sound, since there was no violation of the right of defense because the municipality never offered members of the Asociación de Desarrollo as key defense witnesses; on the contrary, they were brought into the proceedings at the request of Vargas Amaya.

Furthermore, the proceedings established that the Municipalidad de Mora extracted the materials from the property without any permission and to the detriment of the environment. In addition, the municipality did not claim that it was covered by the executive decree until it filed a motion for supplementation and clarification and invoked the rules governing nullities (régimen de nulidades), and did not even raise the issue in its motion for reconsideration. In any event, those earthworks were not authorized, because emergency situations were duly regulated. They contend that Ley N° 8668 of 10 de octubre de 2008, titled “Regulation of the Extraction of Materials from Quarries and Public-Domain Watercourses by Municipalities,” exempts municipalities from obtaining an extraction permit in emergency situations, requiring only coordination with the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias and the communication of certain information to the Dirección de Geología y Minas.

In this case, however, the Comisión de Emergencia certified that the Municipalidad de Mora had taken no such action, which is corroborated by the information provided by the Dirección de Geología y Minas. They assert that environmental protection is a priority and may not be disregarded even during a state of emergency. Regarding report ACOPAC-OSPR-535-10 issued by SINAC, it assessed the environmental damage and was issued by the competent body. The qualifications of the official who issued it cannot properly be challenged, because the volume of material extracted and the environmental damage did not involve a dispute concerning the geological conditions inherent to the land or the material itself.

VI.Preliminary matters. To provide context for the case before us, two important matters must be mentioned. The first is that this proceeding began as an action for a declaration of harm to the public interest (“Lesividad”); indeed, the resolution of the Concejo Municipal de Mora was entered into the record for that purpose (see document included beginning at image 240 of the digital court file), whereby that body declared such harm in order to satisfy one of the requirements for processing that special type of administrative litigation proceeding (proceso contencioso). However, during the procedural phase, specifically at the Preliminary Hearing (Audiencia Preliminar) held on veintisiete de junio de dos mil dieciséis (Image 369 of the digital court file), when the claims for relief (pretensiones) were examined, the legal representative of the municipalidad de Mora requested that the claims concerning the declaration of harm to the public interest be removed and set forth new claims, thereby joining the issues (trabando la litis) from that point forward as to the five claims that are the subject of this proceeding (see the first recital of facts (resultando primero) of this judgment) and on which a ruling will be issued.

It should be noted that this change occurred while the plaintiff maintained the arguments and grounds asserted in its complaint. Furthermore, this Panel must indicate that, upon reading the pleading instituting the action (libelo de interposición de la demanda), the section setting forth the facts is difficult to understand because of the way it is drafted. In addition, its allegations of nullity (nulidad)—initially pursued, as stated above, through an action for a declaration of harm to the public interest and later as an action seeking outright annulment—identified numerous alleged errors that were not attributed directly and specifically to each of the challenged decisions; instead, a generalized approach was used, creating uncertainty regarding the necessary connection between the arguments and the acts alleged to be null, insofar as two decisions of the Tribunal Ambiental Administrativo were challenged.

With respect to the damage-assessment report (informe de valoración del daño), which is also alleged to be null, its arguments were more specific. Based on these considerations, this Court will proceed to analyze the acts sought to be annulled.

VII.Analysis of the decisions of the Tribunal Ambiental Administrativo alleged to be null and void. Specifically, the following acts have been challenged: resolution N° 655-13-TAA of 11:52 hours on 11 de agosto de 2014, which ruled on the complaint filed, finding the Municipalidad de Mora liable and imposing upon it, as compensatory damages, the sum of ¢9.604.000.00 for environmental damage and social cost arising from the extraction of materials from a property located at Dirección13867 (Image 70 of the digital court record); and resolution N° 004-2015-TAA of 14:30 minutes on 13 de enero de 2015, which granted a motion for supplementation and clarification (gestión de adición y aclaración) and therefore proceeded to consider the motion for reconsideration (revocatoria) filed against the aforementioned decision on the merits, ultimately affirming the ruling (Image 27 of the digital court record).

To address this issue, the analysis will be divided into several parts, as follows: a) Arguments asserted. As indicated in the preceding recital (considerando), although two separate decisions issued by the Tribunal Ambiental Administrativo were challenged in the proceeding conducted under number 380-09-02-TAA, which was reviewed through separate certified copies appearing both in the digital court record (submitted by the plaintiff) and in physical form, the grounds for nullity asserted by the representatives of the Municipalidad de Mora were presented without an express and specific reference to each of the aforementioned decisions. Indeed, in the written closing arguments submitted after the parties were heard following authorization to convert this matter to proceedings involving Pure Questions of Law (Puro Derecho), the plaintiff maintained most of those arguments in the same manner, without specifying them as to each act, except that, in its closing arguments, the municipality’s legal representative cited the failure to state reasons (falta de motivación) as a ground for the nullity sought, as well as the legal basis for that nullity.

The foregoing requires this Panel to enumerate those arguments so that they may be kept in view and subsequently related to the acts when those acts are analyzed. Thus: - The municipality admits extracting and using at least 500 cubic meters of material from the property belonging to Vargas Amaya S.A.; - It states that it proved in the administrative record that a low-income housing project was intended to be carried out on that property, as well as the business activity of the company owning the tract; - It indicates that the purpose for which the material was used was to repair public roads in the locality of Piedras Negras following the events caused by Tropical Storm Alma in the year 2009; - The existence of haste and urgency in undertaking those repairs; - That, for that purpose, it coordinated with the Asociación de Desarrollo Integral de Piedras Negras; - That Decreto Ejecutivo N° 34.553-MP applies to its case; - That the municipality lacks the capacity to transport the quantity of material it is alleged to have extracted and used; - It alleges the disregard, improper assessment and taking of evidence, as well as the misinterpretation of the facts; - That the representative of the Asociación de Desarrollo Integral de Piedras Negras did not participate in the oral and public hearing held in the administrative proceeding, which it considers vitally important and which resulted in a denial of the right to defend itself (indefensión); - The failure to assess the evidence offered as a whole, or its argument that there had been cooperation with the association in maintaining the road network; - It characterizes the Tribunal Ambiental’s decision as “hasty and simplistic.” With respect to the report attached to official letter N° ACOPAC-OSRP-535-10, it further alleged: - The lack of appropriate qualifications of the professional who prepared it, because he was a forestry engineer; - The lack of technical rigor in determining the quantity of material extracted; and - The omission of variables in determining the environmental damage.

In the closing arguments submitted by the plaintiff’s representative, these latter assertions were linked to the contents of the report submitted by the court-appointed expert in this matter. b) Matters preceding the issuance of the final decision in the administrative proceeding at issue. In this regard, it is worth noting that, although the proceeding was initially brought only against Vargas Amaya S.A., the owner of the land from which the material was extracted (Folio 46 of physical administrative record N° 380-09-02-TAA, and Image 192 of the digital court record), following a motion filed by that company’s representative, both the Municipalidad de Mora and the Asociación de Desarrollo Integral de Piedras Negras were joined as co-respondents in connection with the facts under investigation (Folio 122 of physical administrative record N° 380-09-02-TAA, and Image 115 of the digital court record).

The first procedural act undertaken by the Tribunal Ambiental after the complaint was filed was resolution N° 1608-09-TAA of 9:30 hours on 10 de diciembre de 2009, through which, among other matters, it requested that the Alcalde de Mora indicate whether the municipality had used materials of the type described in the complaint, based on the photographs submitted (Folio 6 of physical administrative record N° 380-09-02-TAA, and Image 233 of the digital court record). In response, although it was not yet a party to the proceeding, the municipality replied through official letter DAM-011-2009, submitting report N° UGA-INF-02-2010 from the Unidad Técnica de Gestión Vial, prepared following an inspection on 11 de setiembre de 2010. In that document, the Alcalde Municipal de Mora requested that the Tribunal Ambiental close the proceeding because he considered that no environmental damage had occurred (Folios 21 and 17 of physical administrative record N° 380-09-02-TAA, and Images 218 and 222 of the digital court record).

In addition, the administrative record contained, among other evidence discussed below, the following: - A report from the Registro Nacional Minero dated 19 de febrero de 2010 concerning the visit it conducted to the site at the express request of the Tribunal Ambiental. According to the report, a “small” quarry (tajo) was identified on private property, with signs of prior extractions but no personnel or machinery present; some local residents stated that material had been extracted from it one month earlier. The Registro Minero further stated that, after reviewing its records, it found no pending or granted application for the reported area (Folio 23 of physical administrative record N° 380-09-02-TAA, and Image 76 of the digital court record). - Official letter N° ACOPAC-OSRP-535-10 dated 11 de agosto de 2010 (challenged in this action and analyzed below), signed by engineer Ronald Mora Vargas of the Subregional de Puriscal del SINAC and submitted to the Tribunal Ambiental in response to its express request for an assessment of the alleged damage.

That document determined the amount of the damage to be nine million six hundred four thousand colones (Folio 36 of physical administrative record N° 380-09-02-TAA, and Image 203 of the digital court record). - Official letter N° UGA-INF-01-2012 dated 29 de agosto de 2012, a report arising from an inspection conducted on 29 de agosto de 2012 by the Unidad Técnica de Gestión Vial de la Municipalidad de Mora at the request of the Asesoría Legal of that municipality, in connection with the complaint filed concerning the extraction of materials from the property of Vargas Amaya S.A. The report recommended asking the Tribunal Ambiental to reconsider the criteria used to assess the ecological damage in official letter ACOPAC-OSRP-535-10 because, two years later, the inspectors did not observe its effects but instead observed the ecosystem’s natural succession (Folio 139 of physical administrative record N° 380-09-02-TAA, and Image 100 of the digital court record). - In addition, beginning at 8:50 hours on 5 de setiembre de 2013, an “Oral and Public Hearing” was held, attended by the participating parties who appeared; of relevance here, the Municipalidad de Mora was represented by its special attorney-in-fact, Carlos Lanzas Quesada.

On that occasion, each representative was able to state the party’s position on the case. Witness testimony was also received, specifically from two officials called by the Municipalidad de Mora, who underwent the corresponding examination. The parties also presented their closing arguments at that stage of the proceeding (Folio 150 of physical administrative record N° 380-09-02-TAA, and Image 88 of the digital court record). c) Resolution N° 655-13-TAA of 11:52 hours on 11 de agosto de 2014. As indicated, through that resolution, the Tribunal Ambiental Administrativo ruled on the merits of the complaint filed concerning the extraction of materials from a quarry without the corresponding permits. The text of the resolution shows that its background findings (resultandos) chronologically recount the actions taken. In its recitals, the Tribunal Ambiental found, among other proven facts, that no permit existed for the extraction of materials from the property of Vargas Amaya; that the Municipalidad de Mora had extracted and used the materials to repair roads in the locality; and that the reports from the Municipalidad de Mora and the Subregional de Puriscal del SINAC had been submitted into the record.

It also found it unproven that the municipality or the Asociación de Desarrollo held the respective permits from public authorities or from the company owning the tract. Addressing the merits specifically, the Tribunal Ambiental analyzed the documentary and testimonial evidence to determine that no permit existed authorizing the municipality to extract and use material from that site in the year 2009. It specifically analyzed the testimony of Municipalidad de Mora officials Gretel Alfaro and Alonso Arroyo, who were examined on the day of the oral and public hearing held in the proceeding. On that basis, it determined that the local government entity was responsible for the extraction and improper use of that material and found that damage had occurred “through anthropogenic action” due to the alteration and deterioration of the soil resource. The evidence, particularly official letter ACOPAC-OSRP-535-10, established that the activities at issue included the extraction of materials, earthworks (movimiento de tierra) causing erosion, drainage and soil removal, and the exposure of rock containing mineral material.

It held that these activities constituted a clear violation of article 50 of the Constitución Política and article 54 of the Ley de Biodiversidad. It should also be noted that, applying article 109 of the Ley de Biodiversidad, the Tribunal Ambiental found that the Municipalidad had not proven the absence of degradation or adverse effects at the site, because the burden of proof rested on the respondent. It determined that liability was strict rather than fault-based (responsabilidad objetiva y no subjetiva), referring for that purpose to the Declaración de Río and citing legal scholarship and legislation, including the provisions of section 111 of the Ley Orgánica del Ambiente. It found that the slope from which the extraction occurred had been technically measured using the Instituto de Políticas para la Sostenibilidad method based on biophysical damage. In addition to the aforementioned laws, it also based its decision on the Ley de Aguas, the Código de Minería, the Ley General de la Administración Pública, the Ley Forestal, and its regulations.

On all these grounds, it concluded that the Municipalidad de Mora had actively participated in extracting and using the material, had done so without the corresponding permits, and had therefore caused damage for which a financial penalty should be imposed based on the damage assessment requested by the Tribunal Ambiental from SINAC.

On the other hand, it excluded the Asociación de Desarrollo Integral de Piedras Negras, finding that it had requested permission from the company to extract and use materials after the events had already occurred in 2009, and it excluded the company, stating that liability could not be attributed to it when an unrelated third party had caused the environmental damage. As can be seen, an examination of the content of the decision challenged herein reveals that there was sufficient support for the conclusions regarding the existence of damage and the identity of the party that caused it. In this regard, it must not be overlooked that the charges brought against the co-respondents in the administrative proceeding (procedimiento administrativo) concerned precisely the operation of a quarry (tajo) and the use of materials without the required permits, together with the economic valuation of the environmental damage in the amount of ¢9.604.000.00.

The Tribunal Ambiental’s analysis was supported by evidence contained in the administrative record (autos administrativos), particularly the documents linking the municipality to the extraction and use of the material. Thus, this situation is corroborated not only by the photographs submitted by the complainant (folios 1 and 2 of the administrative file), but also because the municipality’s own representatives and the inspection reports submitted by that local government body acknowledged it. Indeed, in the complaint at issue here, the Municipal Mayor himself states that they used at least 500 cubic meters of extracted material (see complaint), meaning that the Municipalidad de Mora indisputably participated actively in 2009 in the alleged acts, a circumstance that, for the reasons stated, cannot even be regarded as disputed. Furthermore, and to reaffirm the foregoing, the administrative file contained evidence that, after the Municipality’s actions, the President and Secretary of the Asociación de Desarrollo Integral de Piedras Negras de Mora, on 18 de febrero de 2010, requested permission from Vargas Amaya S.A. to extract material and allow machinery to pass through its property, for use in gravelling the roads between the communities of Piedras Negras and Dantas (Folio 82 del expediente administrativo físico N° 380-09-02-TAA, e Imagen 99 del expediente judicial digital).

The company responded to that request when its representative, in a document dated 2 de marzo de 2010, raised no objection to it but made it conditional upon obtaining the corresponding permits (Folio 83 del expediente administrativo físico N° 380-09-02-TAA, e Imagen 97 del expediente judicial digital). Those permits were not submitted by the Municipalidad de Mora either in the administrative proceedings or before the courts, since the municipal government invokes the applicability to its case of Decreto Ejecutivo N° 34553-MP, an issue that will be examined later in another section of this judgment. All of this shows that authorization from the landowner never existed, contrary to the municipality’s assertion, for example, in report UGA-INF-02-2010 (Folio 17 del expediente administrativo e Imagen 222 del expediente judicial digital). To the contrary, the administrative file contains additional evidence consisting of the document dated 22 de marzo de 2012, in which the legal representatives of Vargas Amaya S.A. informed the Tribunal Ambiental that they had never authorized anyone to remove material from the site and that they had learned from a neighbor that municipal machinery had carried out the work (Folio 62 del expediente administrativo físico N° 380-09-02-TAA, e Imagen 176 del expediente judicial digital). d) Regarding decision N° 004-2015-TAA of 14:30 hours on 13 de enero de 2015.

Before addressing that decision, it should be noted that, after decision 655-13-TAA, the representative of the Municipalidad de Mora filed a motion for reconsideration (recurso de revocatoria) against it on 13 de octubre de 2014 (Folio 180 del expediente administrativo físico N° 380-09-02-TAA, e Imagen 53 del expediente judicial digital), which was dismissed as untimely by decision N° 881-14-TAA of 8:45 hours on 21 de octubre de 2014 (Folio 193 del expediente administrativo físico N° 380-09-02-TAA, e Imagen 45 del expediente judicial digital). The municipality’s representative then filed, on the following 24 de octubre, a “Motion for Supplementation and Clarification and Application of the Invalidity Rules” (“Recurso de adición y aclaración y régimen de nulidades”) against Tribunal Ambiental decision N° 881-14-TAA of 8:45 hours on 21 de octubre de 2014 (Folio 200 del expediente administrativo físico N° 380-09-02-TAA, e Imagen 38 del expediente judicial digital).

In decision N° 004-2015-TAA of 14:30 minutes on 13 de enero de 2015 (challenged herein), the Tribunal Ambiental Administrativo annulled decision 881-14, considered the motion for reconsideration that had been filed, rejected all its arguments, and affirmed the ruling on the merits (Folio 211 del expediente administrativo físico N° 380-09-02-TAA, e Imagen 27 del expediente judicial digital). Thus, upon analyzing the content of the decision at issue, this Court observed that the Administrative Tribunal considered and resolved the arguments that the municipality was now raising against the decision on the merits. In response to the argument that earthworks (movimiento de tierra) were necessary even for the development of the housing project planned for that property, it rejected that argument, stating that the corresponding permits were required for those earthworks and that the municipality itself was responsible for ensuring compliance with that requirement.

The decision reaffirmed that no permits existed for the extraction and use of materials. It found no violation of due process (debido proceso) arising from the failure of the Asociación de Desarrollo’s representative to participate in the oral hearing because, in the Administrative Tribunal’s view, that did not alter in any way the failure to obtain permits. Relatedly, it rejected the argument that the municipality had merely provided assistance to the association, since the decision stated that it was “unheard of” for the local government body to provide its machinery and personnel without first verifying the existence of the relevant permits. It also rejected the argument concerning urgent necessity, finding that it was not sufficient for the municipality itself to deem such a state of necessity to exist and rely on it to extract material from private property without permits. It also addressed the testimony of official Alonso Mora, stating that he had not established any technical matter capable of relieving the municipality of liability.

As can be seen, all the new arguments raised through the motion for reconsideration were duly addressed by the Administrative Tribunal. e) Regarding the arguments raised in the complaint at issue here seeking annulment of the challenged decisions. At the outset, it should be noted that not all those arguments relate specifically to the decisions; some concern formal aspects of the proceeding, even though annulment of the proceeding itself was not requested. That said, the claimant’s arguments will now be analyzed as follows: It contends that it proved in the administrative record that the property from which the materials were extracted was to be used for a social-interest housing project and that the company’s business activities were connected with such projects. Nevertheless, this Court finds that this circumstance bears no relationship to the allegations made in the administrative proceeding, particularly the determination of the municipality’s own conduct in connection with the extraction and use of the materials.

Accordingly, that argument would not in itself provide grounds for annulment of either the decisions or the proceeding, the latter not having been requested in this case. On the other hand, it generically alleges failure to address an issue (preterición), without explaining or connecting it to the case; it also alleges improper assessment and taking of evidence (evacuación de la prueba), as well as misinterpretation of the facts. Regarding these last two matters, the municipality asserts that neither the evidence it offered nor its arguments were assessed as a whole, stating that it had claimed that it was collaborating with the Asociación to maintain the road network. It contends that the Tribunal Ambiental failed to understand that situation and therefore characterizes the challenged decision as “cursory and simplistic.” These arguments, it bears repeating, are highly generic and amount primarily to dissatisfaction with the ruling because the adjudicative body did not adopt the municipality’s position, something that under no circumstances could be regarded as a criterion or basis for declaring a decision void.

Indeed, the claimant never proved, either in the administrative proceedings or before the courts, the existence of the “haste and urgency” allegedly requiring that the material be used to repair public roads in the locality of Piedras Negras following the natural phenomenon of 2008. Nor did it prove, in connection with that assertion, that the need necessarily arose as a consequence of the effects caused by Tropical Storm Alma’s passage through the national territory. Moreover, it also failed to prove that the necessary permits had been obtained. This case concerns environmental protection, a good essential to human beings and their very existence on Earth, as may be inferred from the constitutional provision introduced through the reform of 1994 in section 50, second and third paragraphs, which recognized a healthy and ecologically balanced environment as a fundamental right, established public standing (legitimación popular) to report any violation, and imposed upon the State government the obligation to: “...guarantee, defend, and preserve that right....” This higher-ranking rule gave rise to a substantial body of ordinary international and national law developing the special protection that must be afforded to the environment.

Its use is therefore not unrestricted, since the law has established limits and requirements, such as obtaining the relevant permits for extracting materials. In the specific case of municipalities, the applicable law is Ley N° 8668, entitled “Regulation of the Extraction of Materials from Quarries and Public-Domain Watercourses by Municipalities” (“Regulación de la extracción de materiales de canteras y cauces de dominio público por parte de las municipalidades”), which applies even in emergency situations. Because the municipality separately invoked the applicability of, and an exemption under, an emergency decree issued specifically because of the state of emergency caused in the country by Tropical Storm Alma in 2008, that argument will be examined separately. Thus, although the purpose for which the local government of Mora claims the material was used may be commendable and expected as part of the service that governments must provide within their communities, that purpose cannot by itself allow it to evade the obligation to comply with the statutory requirements while exercising the bundle of municipal powers (haz de competencias municipales) established in the rule directly applicable to its case, namely the Código Municipal, within the jurisdictional framework set forth in its Article 4.

Those powers include public service, which is generally governed by the principles established in Article Four of the Ley General de la Administración Pública, without disregarding the principle of legality (principio de legalidad), which requires every public official to act in accordance with the law and is enshrined in Article 11 of the Ley General and the corresponding section of the Constitución Política.

Nor is the scope that the plaintiff seeks to give to its allegation that it coordinated with the Asociación de Desarrollo Integral de Piedras Negras understood, since even if that organization had requested municipal assistance—in this case, to address the locality’s road network—the provision of aid or cooperation in coordination with the canton’s civic forces cannot be regarded as a basis for failing to comply with established legal requirements, such as the prior permits (permisos previos) required for the extraction of materials. For example, Law N° 8668, which applies specifically to municipalities, provides that municipalities may obtain special permits from MINAE, provided that they meet certain requirements, such as having an environmental feasibility determination (resolución de viabilidad ambiental) issued by SETENA (Article 2). This demonstrates the importance of a prior technical study (estudio técnico previo) and of a permit that the municipality must obtain to extract materials from quarries and watercourses, all in protection of the right to the environment (derecho al ambiente).

Indeed, Article 3 of that same Law provides that even where an emergency has been declared, municipalities must still have a permit issued by the Dirección de Geología y Minas, for which coordination with and approval by the Comisión Nacional de Prevención de Riesgos are required. That did not occur in this case, because the Municipalidad de Mora argues that it was not required to have a permit, as its actions were covered by Decreto Ejecutivo N° 34553-MP (an issue that will be discussed below). Another argument advanced is that the municipality’s personnel and machinery capacity to transport the quantity of material attributed to it was not taken into account. Notwithstanding this allegation, the fact remains that, once it was raised, the party making it bore the burden of proving that circumstance unequivocally; and in this case, neither in the administrative proceedings (sede administrativa) nor before the court (sede jurisdiccional) is there a technical report on the actual capacity that the local government could effectively deploy to transport materials, much less evidence concerning what it actually repaired on the road network with those materials.

Because this is a technical matter, it cannot merely be mentioned in a written submission or testimony; it must be supported by evidence of the same technical nature in order to be deemed proven. Moreover, even if the alleged lack of capacity had been proven, the reality—acknowledged even by the plaintiff’s own representative—would remain that material was indeed extracted and used without the express permission of the owners of the property (fundo) or of the public authorities responsible for ensuring compliance with the applicable requirements (see the evidence submitted before the court by the State’s representative, appearing at images 347 and 353 of the digital judicial case file (expediente judicial digital)), which demonstrates that no permits existed in the Registro Nacional Minero or the Comisión Nacional de Prevención de Riesgos. Lastly, it has been alleged that the representative of the Asociación de Desarrollo Integral de Piedras Negras did not participate in the oral and public hearing (audiencia oral y pública) held in the administrative case file (expediente administrativo), which the municipal representative considers to have been of vital importance and claims caused a denial of the right of defense (indefensión).

An argument must have its own basis and stand on its own merits, and in this case the municipality does not explain why the participation of the Asociación de Desarrollo was of “vital importance.” This was also noted by the Tribunal Ambiental, which stated in its decision on the merits (resolución de fondo) that it did not see how statements by that association’s representatives would have changed the outcome, since the plaintiff’s representative has not proven that their participation was proposed as part of its evidentiary submissions (elenco probatorio). It must also be borne in mind that the Association was a charged party (imputada), meaning that it was a party to the administrative proceeding (procedimiento administrativo), and was absolved of responsibility with respect to the complaint under review; the plaintiff in this case has made no allegation concerning that portion of the ruling.

Accordingly, as presented, this argument is speculative and lacks sufficient force to give rise to absolute nullity (nulidad absoluta). Thus, after analyzing all the arguments, it must be stated that none of them, for the reasons given, would entail the nullity of the challenged decisions, because the record does not establish the actual existence of an omission or defect in any essential element of the administrative acts (actos administrativos) that would constitute a flaw (vicio) of such a nature as to entail absolute nullity (Articles 132, 133, 136, 158, 166, 169 of the Ley General de la Administración Pública). Even the allegation of inadequate reasoning (falta de motivación) set forth in the conclusions submitted by the municipality’s special attorney-in-fact finds no support in the arguments analyzed. As has been held in this jurisdiction, there must be no nullity for nullity’s sake, since it would be a legal aberration to maintain that any type of flaw or unsupported and unrelated allegation would entail the nullity of an act.

Indeed, accepting that position would be contrary to the principle of preservation of administrative acts (principio de conservación de los actos administrativos), except where it has been proven that a flaw exists that necessarily requires a declaration of nullity, which is not the case here.

VIII.Application of Decreto Ejecutivo N° 34553-MP to the Specific Case. As part of its arguments, the plaintiff states that this Decreto Ejecutivo constitutes the legal basis for its actions, asserting in its complaint that permits were not obtained because such actions were authorized by the Emergency Decree published in La Gaceta on 10 de junio de 2008, which remained in force for almost four years, as this was a matter of urgent necessity, namely, the maintenance of the cantonal road network. More specifically, in the closing arguments submitted prior to this judgment, the municipal representatives quoted verbatim Articles One and Three of those regulations, without linking them to the assertion made in the complaint, namely, that they did not obtain the permits pursuant to the Decree. In this regard, that declaration of national emergency (declaratoria de emergencia nacional) was issued in response to the effects of a low-pressure system in both the Pacific Ocean and the Atlantic Ocean, which caused a tropical storm in the year 2008, producing prolonged severe weather conditions, soil saturation, overflowing rivers, flooding, damage to road infrastructure, among other effects, and compelling the Government of the Republic to declare a state of emergency (estado de emergencia) for several cantons of the country, including Mora, pursuant to Article One of the Decree under review.

Now then, as indicated supra, the other article cited by the plaintiff’s representatives is Article Three, which provides: “This declaration of emergency shall encompass all actions and works necessary for addressing, rehabilitating, reconstructing, and replacing damaged infrastructure, housing, communications, and agriculture, and, in general, all damaged public services located within the coverage area specified in Article 1) of this Decree, all of which must be included in the General Emergency Plan approved by the Board of Directors of the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias in order to qualify for assistance under the concept of emergency.” (Underlining not in the original). When the article is read in its entirety, rather than selectively as quoted in the Municipality’s closing arguments, another omission by the municipal government becomes apparent: its failure to prove in the record that the allegedly urgent situation involving the roads of Piedras Negras de Mora was included in the approved General Plan so that the Decree and its benefits would apply.

This is further linked to the fact that, as Article 4 of the regulations under review provides, the planning, management, oversight, and coordination of programs and activities for the protection, rescue, assistance, rehabilitation, and reconstruction of areas declared to be under a state of emergency were entrusted to the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias or to the designated implementing units. Furthermore, although that Decree provides, for example in Article Eight: “Privately owned properties located within the geographical area established in this declaration of emergency shall be subject to all legal easements (servidumbres legales) necessary to carry out the actions, processes, and works undertaken by public entities in responding to the emergency, provided that this is absolutely indispensable for its timely response, in accordance with the provisions governing the first phase of the emergency,” this does not apply to the situation reviewed in the administrative proceedings (sede administrativa), which concerned the extraction and use of materials from private property; even so, it should be noted that the article refers to “legal easements.” Accordingly, neither these regulations nor Ley N° 8488, to which the Decree at issue refers, expressly or implicitly supports the interpretation that the Municipalidad de Mora has sought to advance in its own favor, since that declaration of emergency did not exempt it from complying with requirements and procedures, as the municipal government failed to do when it extracted and used materials from property belonging to Vargas Amaya S.A. in the year 2009.

Although this occurred while the Decree was in force, it was not proven that the local roads of Piedras Negras de Mora were directly affected as a consequence of the weather conditions resulting from the tropical storm called Alma, which passed through the country in the year 2008; nor was it proven that the repairs that the plaintiff municipality claims to have performed on the cantonal road network in the year 2009 formed part of the plan approved to implement the Emergency Decree; and it has likewise not been proven in the record that the Municipalidad de Mora had obtained the necessary permits for the conduct attributed to it. That situation was precisely what led the Tribunal Ambiental, as previously stated, to determine in the administrative proceedings that the plaintiff municipality caused environmental damage (daño ambiental). For all these reasons, the argument that the Municipalidad de Mora was authorized by Decreto Ejecutivo N° 34553-MP to act as it did, thereby giving rise to the complaint filed and adjudicated through administrative proceedings, cannot be accepted.

IX.Alleged nullity (nulidad) of the report contained in official letter N° ACOPAC-OSRP-535-10 dated 11 de agosto de 2010. The third challenged act, whose nullity is alleged in the complaint before us, is the report issued by the Área de Conservación Pacífico Central, Subregión Puriscal of the Sistema Nacional de Áreas de Conservación (SINAC), in response to an express request made by the Tribunal Ambiental in connection with the complaint filed and at issue in these proceedings. In the administrative proceedings (sede administrativa), resolution N° 1608-09-TAA of 9:30 a.m. on 10 de diciembre de 2009 was issued, requesting that the Puriscal subregional office of SINAC conduct an inspection and issue an economic assessment report on the environmental damage (daño ambiental) caused (Page 6 of physical administrative file N° 380-09-02-TAA and Image 233 of the digital court file). Accordingly, on 11 de agosto de 2010, that office submitted the requested material to the Tribunal Ambiental (Image 203 of the digital court file and page 36 of the administrative file).

The report was prepared by engineer Ronald Mora Vargas following a site visit conducted on 9 de agosto de 2010, during which the length of the slope (talud) from which the municipality had removed the material was measured. Using that information, the report confined itself to determining the economic valuation (valoración económica) of the environmental damage. For this purpose, direct-use, option, and existence values were established, resulting in an initial cost for the earthworks (movimiento de suelo) at the site in the amount of ¢4.802.000 colones. Additional percentages were then applied for each affected element according to a matrix, assessing erosion, drainage, and removal in relation to the soil, as well as the impact of the extraction method. Each amount and percentage produced by the study for those elements was justified, yielding a final amount of 9.604.000 colones. It should be noted that this was the amount applied by the Tribunal Ambiental in resolution N° 655-13-TAA of 11:52 a.m. on 11 de agosto de 2014, when it found the Municipalidad de Mora responsible for the environmental damage and ordered it to pay the valuation amount calculated by SINAC.

Subsequently, following resolution of the motion for reconsideration (recurso de revocatoria) filed against that decision, resolution N° 004-2015-TAA of 2:30 p.m. on 13 de enero de 2015 affirmed and maintained the ruling. The complaint challenges that report on the following grounds: the professional who prepared it was allegedly unqualified because he was a forestry engineer; there was allegedly insufficient technical rigor in determining the quantity of material extracted; and variables were allegedly omitted when determining the environmental damage. In addition, as a supplementary argument, the plaintiff asserted in its closing arguments that the amount of material extracted had been five hundred cubic meters, rather than the three thousand four hundred thirty stated in the report. It also argued that the municipal government lacked the transportation capacity to handle that amount of material, linking this assertion to the testimony given by engineer Alonso Mora Arroyo, a municipal official, at the oral hearing in the administrative proceedings.

He stated that the roadwork covered six kilometers, averaging six meters in width, over a graveled area of 33 thousand meters, and that approximately 500 square meters were used for that purpose. Regarding these arguments, as to the alleged lack of qualifications of the forestry engineer who prepared the report, the plaintiff does no more than make that assertion, without technically proving that a professional in that field would be incapable of preparing it. Consequently, the challenge, as presented, cannot be accepted and would not establish the nullity sought. As to the Municipality’s available capacity and the number of cubic meters the municipal government claims it used, the fact remains that, as stated in the preceding recital (considerando), when these same allegations were analyzed, the municipality did not conclusively prove its transportation capacity, even though that was its own argument.

Moreover, the statements made by its witness before the Tribunal Ambiental actually confirm the conduct attributed to the municipality, for which it lacked the necessary permits. Nor has it technically disproved the quantity of material stated in the report now under review. Even assuming that the statements made by the municipal official at the administrative oral hearing were true, the quantity of material mentioned merely corresponds to the amount admitted by the municipal government but, once again, does not disprove the amount stated in the environmental-damage valuation report. The plaintiff further alleges a lack of technical rigor and the omission of variables from the challenged report, without identifying the variables to which it refers. At the Preliminary Hearing (Audiencia Preliminar) held on veintisiete de junio de dos mil dieciséis (Image 369 of the digital court file), the case-management judge of this Court granted the plaintiff’s request to appoint an expert geologist (perito geólogo) to: “...prepare a report in accordance with th (sic) claim N° 4, detailed above, using the documentation contained in the file,” a determination with which the plaintiff, represented at that hearing by its special judicial attorney-in-fact, agreed.

It should be recalled that, at the same hearing, the plaintiff amended its claims, with the fourth claim stated as follows: “4) That the actual quantification of the environmental damage caused by the Municipality be established through a report prepared by a qualified expert, in view of the request for nullity of report ACOPAC OSPR-535-10.” (Emphasis not in the original). It follows that, among the evidence the municipality considered necessary to support its amended claim and the type of proceeding pursued, there had to be an expert report (peritaje) establishing the “actual quantification of the environmental damage,” with reference to the report whose annulment was sought and which is being analyzed in this section of the present judgment. Following the appointment of expert Nombre113634 (see the resolution of 11:34 a.m. on 1 de agosto de 2016, appearing at Image 375 of the digital court file), that professional submitted his “Geological Expert Report” (Informe Pericial Geológico) to the Court (Image 390 of the digital court file).

The parties were afforded an opportunity to respond to it by resolution of 3:44 p.m. on once de octubre de dos mil dieciséis (Image 420 of the court file), and the State’s representative addressed it in the filing appearing at Image 462, opposing it. Subsequently, the representative of the plaintiff Municipality made submissions concerning its expert evidence, particularly asserting that it had not been prepared in accordance with what had been authorized (Image 485 of the court file). For that reason, the matter was returned to the case-management stage so that the appropriate judge could rule on it. By resolution of 10:43 a.m. on 9 de mayo de dos mil dieciocho, the judge ordered the expert to revise his report so that it would comply with what had been ordered at the Preliminary Hearing (Image 493 of the court file). The expert then submitted his new report, appearing beginning at Image 503 of the digital court file and also entitled “Geological Expert Report”; it should be noted that, in this regard, the title chosen for both expert reports did not itself reflect what had been requested and authorized.

Upon review of its contents, the expert geologist essentially examined and addressed the aspects of the SINAC Report that he believed were flawed. In other words, the expert report focused on reviewing and criticizing that report, even concluding that it lacked precision. He stated that, although the methodology used was not incorrect, the error lay in the factors assessed, and he indicated that: “...The estimate of ecological damage (Ing. Mora, report ACOPAC-OSRP-535-10) is not considered accurate in terms of the assessment performed; therefore, it is recommended that said amount be disregarded.” He further stated: “Given that the request for this expert report indicates that [it be] base (sic) solely on the information in the file and report ACOPAC-OSRP-535-10, it is not possible to provide a new environmental-damage value using the assessment performed by Ing. Mora because of the inconsistencies in the aforementioned report.” He also made certain recommendations that, in his opinion, should be considered in order to evaluate the events and establish a new environmental-damage valuation.

In light of the foregoing, this Tribunal finds that the expert never understood the subject matter and purpose of the expert examination assigned to him. If he had any questions at the outset, he should have sought clarification; instead, in both expert reports—the original and the requested revision—he attacked the SINAC report. Indeed, the contents show that his objective was always to identify the “shortcomings or errors” in the other report, without focusing on what he was actually required to do: quantify the actual environmental damage in this case. This is particularly significant because the municipality itself has admitted, including in this complaint, that it extracted and used the material, although not in the quantity stated in the SINAC report that was used to impose the penalty for the environmental damage determined in the administrative proceedings. Accordingly, when the plaintiff changed the nature of its original complaint—from a proceeding for a declaration of harm to the public interest (proceso de lesividad) to an ordinary nullity proceeding (proceso de conocimiento de nulidad)—and established its new claims while seeking an expert report that would serve its purposes, it should have clearly requested an analysis of the contents of the SINAC report rather than a new environmental-damage valuation, which was what the Court authorized and what the expert evidence received failed to provide.

For that reason, the expert report now being analyzed as part of the evidence submitted in these proceedings did not fulfill its purpose and therefore does not establish the nullity sought. At most, its contents reveal a difference of professional opinion, without establishing grounds—which was not its purpose—for declaring null the report attached to official letter N° ACOPAC-OSRP-535-10.

X.Conclusion. For all the reasons stated in the substantive recitals of this judgment, this panel finds that neither the expert evidence nor the arguments presented establish the nullity of the three actions forming the subject matter of these proceedings or determine the actual quantification of the environmental damage. The complaint must therefore be dismissed in its entirety.

XI.Analysis of the defenses raised. The State’s representative raised the defense of failure to state a legally valid claim (falta de Derecho), which must be upheld for all the reasons stated and rulings made in the preceding recitals.

XII.Costs. Pursuant to section 193 of the Código Procesal Contencioso Administrativo, court costs and attorney fees (costas procesales y personales) constitute a burden imposed on the losing party by virtue of having lost. An exemption from such an award is available only when, in the Tribunal’s judgment, there was sufficient cause to litigate or when the judgment is rendered on the basis of evidence whose existence was unknown to the opposing party. In this case, this Tribunal finds that no exemption applies. The plaintiff must therefore be ordered to pay both categories of costs, as well as any interest that may accrue thereon once the amounts have been determined and become due.

THEREFORE (POR TANTO).

The defense of lack of legal entitlement (Falta de Derecho) is sustained. The action brought by Municipalidad de Mora against El Estado is hereby DISMISSED. Both sets of costs in this action shall be borne by the plaintiff, together with any interest that may accrue thereon once the amounts thereof have been determined and become due and payable. Let notice be served.

TRIBUNAL CONTENCIOSO ADMINISTRATIVO, SECCIÓN QUINTA, SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ. Goicoechea, a las catorce horas tres minutos del veintiséis de noviembre de dos mil veinte.

Proceso de conocimiento establecido por Nombre10172 , mayor, soltero, abogado, vecino de Ciudad Colón y portador de la cédula de identidad número CED89872, en su calidad de ALCALDE MUNICIPAL DE MORA (ver personería a imagen 254 del expediente judicial digital), fungiendo como apoderada especial judicial de la Municipalidad la abogada Cindy Gabriela Monge Soto (poder especial judicial visible a imagen 552 del expediente judicial digital) Según se aprecia a imagen 553 del expediente judicial digital, el Alcalde Municipal de Mora desde marzo de 2020 lo es el señor Alfonso Jiménez Cascante, CONTRA EL ESTADO, representado por la Procuradora Heilyn Sáenz Calderón (apersonada según documento que corre a imagen 295 del expediente judicial digital).

RESULTANDO:

  1. 1En fecha 9 de julio de dos mil quince, se formuló la demanda que dio origen al presente proceso, según los hechos que exponen y el derecho en el que se fundamentan, inicialmente planteada como Proceso de Lesividad al interés publico en contra de la resolución N° 655-13-TAA del Tribunal Ambiental Administrativo, pero, sus pretensiones fueron reformuladas en Audiencia Preliminar celebrada el veintisiete de junio de dos mil dieciséis, quedando un proceso de conocimiento declarativo, así: "1) La nulidad del informe ACOPAC OSPR-535-10. 2) La nulidad de la resolución número 655-13-TAA. 3) La nulidad de la resolución número 004-2015-TAA del Tribunal. 4) Se establezca la cuantificación real de los daños ambientales causados por la Municipalidad, mediante informe que lleve a a cabo un perito idóneo, ello por la solicitud de la nulidad del informe ACOPAC OSPR-535-10. 5) Condenar al Estado, al pago de las costas personales y procesales del presente asunto." (Imagen 370 del expediente judicial digital).
  2. 2Conjuntamente con la demanda, la parte actora solicitó Medida Cautelar Intraprocesal Provisionalísimas (Imagen 274 del expediente judicial digital) de suspender los efectos ejecutorios de la resolución Número 655-13-TAA de las 11:52 horas del once de agosto de de dos mil catorce dictada por el Tribunal Ambiental Administrativo.
  3. 3Mediante resolución de las 9:59 horas del catorce de julio de dos mil quince, se otorgó audiencia tanto de la Medida Cautelar pedida, así como de la demanda (Imagen 278 del expediente judicial Digital).
  4. 4En torno a la Medida Cautelar, la representación del Estado pidió se opuso en escrito que corre a partir de la imagen 287 del expediente judicial. Siendo que la Jueza de Trámite del despacho, en resolución N° 2257-2015-T de las 10:20 horas del 31 de agosto de 2015, rechazó el pedido de Medida Cautelar (Imagen 296 del expediente judicial). Ante apelación presentada por la representación de la actora (Imagen 305 del expediente judicial), el Tribunal de Apelaciones de la jurisdicción en resolución en resolución N° 512-2015-I de las 9:50 horas del 16 de octubre de 2015, confirmó la resolución del a quo (Imagen 325 del expediente judicial).
  5. 5La representación del Estado contestó la demanda planteando la excepción de Falta de Derecho (Imagen 327 del expediente judicial digital)
  6. 6En la Audiencia Preliminar celebrada a partir de las 8:40 horas del veintisiete de julio de 2016, en la cual se contó con la participación de las representaciones de ambas partes, la actora reformuló sus pretensiones tal y como se indicaron en el apartado primero de estos resultandos; se determinaron los hechos controvertidos; se admitió tanto la prueba documental, como testimonial, así: a la parte actora al ingeniero municipal el señor Alonso Mora Arroyo, y el peritaje de un geólogo, fijando sus honorarios prudenciales en doscientos cincuenta mil colones. Y a la parte actora le admitió el testimonio del ingeniero Ronald Mora Vargas (Imagen 369 del expediente judicial digital).
  7. 7En cuanto al peritaje, en resolución de las 11:34 horas del primero de agosto de dos mil dieciséis, la Jueza de Trámite nombró al perito Nombre113634 (Imagen 375 del expediente judicial), quien aceptó el cargo en documento visible a imagen 379 del expediente judicial. Su primer informe lo rindió en octubre de 2016 y corre agregado a imagen 390 del expediente. Del cual se dio audiencia a las partes en resolución de las 15:44 horas del once de octubre de dos mil dieciséis (Imagen 420 del expediente judicial), siendo la representación del Estado la que se refirió al mismo en escrito de imagen 462 formulando su oposición.
  8. 8En fecha dieciséis de febrero de dos mil diecisiete, el asunto fue turnado a la Sección Quinta del Tribunal Contencioso Administrativo (Imagen 472 del expediente judicial digital).
  9. 9Mediante resolución del veintiuno de marzo de dos mil diecisiete, se señaló las 8:30 horas del siete de mayo de dos mil dieciocho para celebrar la audiencia de juicio (Imagen 473 del expediente judicial digital).
  10. 10Ante manifestaciones esgrimidas por la representación de la Municipalidad actora respecto del peritaje (Imagen 485 del expediente judicial), el Tribunal mediante resolución de las 15:40 horas del cuatro de mayo de dos mil dieciocho dejó sin efecto el señalamiento a juicio y ordenó la devolución del expediente a la fase de trámite para lo que correspondiera (Imagen 487 del expediente judicial).
  11. 11La Jueza de Trámite del despacho en resolución de las 10:43 horas del 9 de mayo de dos mil dieciocho, le ordenó al perito reformular su informe para que el mismo cumpliera con lo ordenado en la Audiencia Preliminar (Imagen 493 del expediente judicial).
  12. 12El Estado se opuso planteando revocatoria de la resolución de la Jueza de Trámite en que ordenó la reformulación del peritaje (Imagen 496 del expediente judicial), recurso que fue rechazado mediante resolución de las 9:05 horas del dieciséis de mayo de dos mil dieciocho (Imagen 500 del expediente judicial digital).
  13. 13El perito presentó su nuevo informe visible a partir de la imagen 503 del expediente judicial digital. Del cual se dio audiencia a las partes mediante resolución de las 11:42 horas del primero de junio de dos mil dieciocho (Imagen 519), siendo que la parte actora no objetó el mismo (Imagen 522). Por su parte, la representación del Estado indicó le era imposible referirse al peritaje al no haberse adjuntado las copias del mismo (Imagen 521), situación que fue rechazada por la Jueza de Trámite en resolución de las 13:39 horas del once de julio de dos mil dieciocho (Imagen 526 del expediente judicial). El Estado reiteró su pedido de copias (Imagen 534 del expediente), y la Jueza de Trámite en resolución de las 11:24 horas del treinta y uno de agosto de dos mil dieciocho, remitió a lo ya resuelto y ordenó que una vez notificado ese nuevo auto, se pasará el expediente al Tribunal de Juicio (Imagen 536).
  14. 14Mediante resolución del veintitrés de mayo de dos mil diecinueve, se señaló nuevamente para juicio para las 8:30 horas del veintiuno de octubre de dos mil veinte (Imagen 541 del expediente judicial digital).
  15. 15En resolución del despacho de las 13:57 horas del doce de octubre de dos mil veinte, se debió suspender la celebración de la Audiencia de Juicio Programado, por la pandemia de Covid que afecta al país y de conformidad con las directrices emitidas tanto por el Ministerio de Salud, como de la Corte Plena del Poder Judicial. Pero, instando a las partes a prescindir de la prueba testimonial y pericial para convertir el asunto a Puro Derecho (Imagen 558 del expediente judicial digital).
  16. 16Ante lo cual, las representantes de la Municipalidad como del Estado en su orden (Imágenes 563 y 564), estuvieron anuentes a prescindir de su prueba testimonial y pericial, así como mutar a puro derecho.
  17. 17En resolución de las 15:53 horas del tres de noviembre de dos mil veinte, se otorgó a las partes cinco días hábiles para que emitieron conclusiones para el caso (Imagen 566). Lo cual realizaron, la parte actora (Imagen 570) y la demandada (Imagen 583).
  18. 18En los procedimientos se han observado las prescripciones de ley y este Tribunal no ha determinado vicio u omisión susceptibles de producir nulidades que deban ser subsanadas. Se dicta esta sentencia por escrito una vez recibidas las conclusiones correspondientes y dentro del plazo de ley, previa deliberación de rigor y por unanimidad.

CONSIDERANDO.

I.Hechos probados. De relevancia para efectos del presente proceso se tienen los siguientes:

  • 1)En fecha 30 de octubre de 2009, el señor Nombre113635 , planteó queja ante el Tribunal Ambiental sobre una explotación masiva de material en una propiedad privada, sin que se cuente con el permiso de tajo, en donde anteriormente funcionarios del MINAET habían clausurado la explotación, refiriendo que indagó en la Setena y el Registro Minero y no aparecen permisos otorgados para esa propiedad de la empresa Inversiones Vargas Amaya S.A. y adjuntó fotografías (Folio 4 del expediente administrativo físico N° 380-09-02-TAA, e Imagen 235 del expediente judicial digital).
  • 2)El Tribunal Ambiental Administrativo, con ocasión de la queja planteada, en resolución N° 1608-09-TAA de las 9:30 horas del 10 de diciembre de 2009, solicitó: A la Dirección de Geología y Minas una inspección del lugar; al Alcalde de Mora indicar si ha usado materiales que se indican en la queja y según fotografías aportadas por el quejoso, y a la oficina subregional de Puriscal del SINAC realizar inspección y emitir un informe de valoración económica del daño ambiental ocasionado, conteniendo las medidas de reparación y mitigación necesarios (Folio 6 del expediente administrativo físico N° 380-09-02-TAA, e Imagen 233 del expediente judicial digital).
  • 3)El Presidente de la Asociación de Desarrollo de Piedras Negras de Mora, el señor Eduardo Naranjo, presentó al Tribunal Ambiental documento fechado 10 de febrero de 2010 en el cual le indicó que tomara en cuenta que los materiales extraídos se realizaron en un proyecto de vivienda que se iba a desarrollar y que la dueña del lote había regalado el material para reparar los caminos de lastre de la zona y que de ello coordinaron con la Unidad de Gestión Vial (Folio 10 del expediente administrativo físico N° 380-09-02-TAA, e Imagen 229 del expediente judicial digital).
  • 4)El 12 de febrero de 2010, el Alcalde Municipal de Mora contestó al Tribunal Ambiental Administrativo mediante oficio DAM-011-2009 aportando un informe de la Unidad Técnica de Gestión Vial y solicitando el archivo del expediente al no existir un daño al ambiente, acompañándolo del oficio UGA-INF-02-2010 que corresponde a un "Informe Inspección Ambiental", realizado por inspección del 11 de setiembre de 2010 por Gestión Ambiental del Departamento de Ingeniería de la Municipalidad de Mora, mediante el cual se recomendaba al Tribunal Ambiental el archivo de la denuncia por no existir daño ambiental, que se solicitara al dueño de la propiedad un plan de arborización acorde al uso del suelo de la propiedad y documentar el uso del material extraído del terreno en metros lineales de camino reparado o al que se le dio mantenimiento (Folio 21 y 17 del expediente administrativo físico N° 380-09-02-TAA, e imágenes 218 y 222 del expediente judicial digital).
  • 5)El Registro Nacional Minero en fecha 19 de febrero de 2010, rindió informe de visita al lugar que se realizó el 5 de febrero anterior, en el Dirección13866 , identificando un tajo dentro de propiedad privada, que pudieron entrar visualizando un pequeño tajo con indicios de extracciones anteriores, pero no se encontraron ni personal ni maquinaria. Indican que le preguntaron a unos niños que pasaban por el lugar quienes les indicaron que como hacía un mes se había estado sacando material. Además, indican que revisados los registros no se encontró solicitud en trámite ni otorgada del área denunciada (Folio 23 del expediente administrativo físico N° 380-09-02-TAA, e Imagen 76 del expediente judicial digital).
  • 6)El Presidente y la Secretaria de la Asociación de Desarrollo Integral de Piedras Negras de Mora, el 18 de febrero de 2010, le solicitaron permiso a la empresa Vargas Amaya S.A. para la extracción de material y paso de maquinaria en su propiedad para ser usado para el lastreado de los caminos entre la comunidad de Piedras Negras y Dantas (Folio 82 del expediente administrativo físico N° 380-09-02-TAA, e Imagen 99 del expediente judicial digital).
  • 7)El representante legal de la empresa Vargas Amaya, en documento fechado 2 de marzo de 2010, dirigido a la Asociación de Desarrollo Integral de Piedras Negras, le indicó su aceptación de la solicitud de extraer lastre de la finca para el beneficio de la comunidad, pero lo condicionaron a conseguir los permisos correspondientes (Folio 83 del expediente administrativo físico N° 380-09-02-TAA, e Imagen 97 del expediente judicial digital).
  • 8)Mediante oficio N° ACOPAC-OSRP-535-10 FECHADO 11 de agosto de 2010, el ingeniero Ronald Mora Vargas de la Subregional de Puriscal del SINAC, entregó al Tribunal Ambiental el informe de valoración del daño pedido (Folio 36 del expediente administrativo físico N° 380-09-02-TAA, e Imagen 203 del expediente judicial digital).
  • 9)Mediante resolución del Tribunal Ambiental N° 536-11-TAA de las 10:50 horas del 24 de junio de 2011, se dio la apertura del procedimiento administrativo expediente 380-09-02-TAA, contra la empresa Inversiones Vargas Amaya S.A. imputándole la explotación de un tajo sin los permisos necesarios y el daño ambiental valorado en ¢9.604.000.00 (Folio 46 del expediente administrativo físico N° 380-09-02-TAA, e Imagen 192 del expediente judicial digital).
  • 10)En documento fechado 22 de marzo de 2012, los representantes legales de la empresa Vargas Amaya, manifestaron al Tribunal Ambiental que ellos en ningún momento autorizaron a nadie para sacar material del sitio y que se enteraron por un vecino que fue la maquinaria de la municipalidad la que había sacado el material (Folio 62 del expediente administrativo físico N° 380-09-02-TAA, e Imagen 176 del expediente judicial digital).
  • 11)La Unidad de Gestión Ambiental de la Municipalidad de Mora, emitió el oficio N° UGA-INF-01-2012 fechado 29 de agosto de 2012, ante el pedido interno de la Asesoría Legal del municipio, de realizar una inspección del lugar donde se extrajeron materiales según la queja planteada ante el Tribunal Ambiental, inspección que indican se realizó el 29 de agosto de 2012, y según el cual recomiendan solicitar al Tribunal Ambiental reconsiderar los criterios de la valoración del daño ecológico usados en este caso, pues no se observan sus efectos transcurridos dos años después, sino la sucesión natural del ecosistema. Además, se pidió solicitar el criterio del coordinador de la UTGV en los temas propios de su competencia, así como valorar la defensa de la asesoría legal de la intervención de la municipalidad en cuanto a la cantidad del material removido que no cuenta con un criterio objetivo respecto de la realidad y el propósito de la municipalidad (Folio 139 del expediente administrativo físico N° 380-09-02-TAA, e Imagen 100 del expediente judicial digital).
  • 12)En resolución N° 696-13-TAA 7:52 horas del cinco de agosto de 2013, el Tribunal Ambiental resolvió gestión del representante de la empresa denunciada por lo que reiteró la resolución la apertura del procedimiento administrativo contra la sociedad Vargas Amaya S.A., incluyendo ahora a la Asociación de Desarrollo Integral de Piedras Negras y al Alcalde la Municipalidad de Mora imputándoles la explotación de un tajo y aprovechamiento de materiales sin contar con los permisos y la valoración económica del daño ambiental de ¢9.604.000.00 (Folio 122 del expediente administrativo físico N° 380-09-02-TAA, e Imagen 115 del expediente judicial digital).
  • 13)A partir de las 8:50 horas del día 5 de setiembre de 2013, se realizó la "Audiencia Oral y Pública" en el expediente N° 380-09-02-TAA, en la que, por la Municipalidad de Mora participó su apoderado especial Carlos Lanzas Quesada. En esa oportunidad cada representante que asistió pudo externar su posición del caso, además se recibieron los testigos ofrecidos y las partes expresaron sus conclusiones verbalmente (Folio 150 del expediente administrativo físico N° 380-09-02-TAA, e Imagen 88 del expediente judicial digital).
  • 14)El Tribunal Ambiental Administrativo en resolución N° 655-13-TAA de las 11:52 horas del 11 de agosto de 2014 resolvió sobre la queja planteada, disponiendo la responsabilidad de la Municipalidad de Mora de ocasionar daño ambiental negativo significativo en perjuicio de los recursos naturales por la extracción de materiales y la afectación al recurso suelo, sin los permisos de la Dirección de Geología y Minas del MINAET y la Secretaria Técnica Ambiental, imponiéndole como indemnización compensatoria la suma de ¢ 9.604.000.00 por concepto de daño ambiental y costo social por la extracción de materiales de una propiedad ubicada en el Dirección13867 . Además, intimó por primera vez el pago de la sanción impuesta a la Municipalidad de Mora (Folio 168 del expediente administrativo físico N° 380-09-02-TAA, e Imagen 70 del expediente judicial digital).
  • 15)La representación de la Municipalidad de Mora, el 13 de octubre de 2014 presentó recurso de revocatoria contra la resolución del Tribunal Ambiental N° 655-13-TAA de las 11:52 horas del 11 de agosto de 2014 (Folio 180 del expediente administrativo físico N° 380-09-02-TAA, e Imagen 53 del expediente judicial digital).
  • 16)Mediante resolución N° 881-14-TAA de las 8:45 horas del 21 de octubre de 2014, el Tribunal Ambiental, rechazó por extemporáneo el recurso de revocatoria presentado contra la resolución N° 655-13-TAA de las 11:52 horas del 11 de agosto de 2014 (Folio 193 del expediente administrativo físico N° 380-09-02-TAA, e Imagen 45 del expediente judicial digital).
  • 17)El 24 de octubre de 2014, la representación de la municipalidad de Mora planteó "Recurso de adición y aclaración y régimen de nulidades" contra la resolución del Tribunal Ambiental N° 881-14-TAA de las 8:45 horas del 21 de octubre de 2014 (Folio 200 del expediente administrativo físico N° 380-09-02-TAA, e Imagen 38 del expediente judicial digital).
  • 18)El Tribunal Ambiental Administrativo en resolución N° 004-2015-TAA de las 14:30 minutos del 13 de enero de 2015, acogió la adición y aclaración, pero rechazó el recurso de revocatoria confirmando en todos sus extremos lo resuelto en el caso. Además, intima por segunda vez el pago de la sanción impuesta a la Municipalidad de Mora (Folio 211 del expediente administrativo físico N° 380-09-02-TAA, e Imagen 27 del expediente judicial digital).
  • 19)En oficio N° AL-OF-0742-2015 de 19 de agosto de 2015, el Jefe de la Asesoría legal de la Comisión Nacional de Emergencias, contestó pedido de la Procuraduría General de la República, indicando que en los registros de la institución no constaba gestión de la Municipalidad de Mora en la que se requiriera autorización para recibir materiales por parte de tercero al amparo de la declaratoria de emergencia mediante Decreto N° 34553-MP con ocasión de la emergencia nacional acaecida por la Tormenta Tropical Alma (Imágenes 347 y 348 del expediente judicial digital).
  • 20)En oficio N° DGM-RNM-829-2015 del 9 de setiembre de 2015, la jefatura del Registro Nacional Minero de la Dirección de Geología y Minas del MINAE, al contestar solicitud de la Procuraduría General de la República, indica que revisado el padrón nacional minero en la finca N° 104708-0200 para el año de 2009 no existió solicitud o concesión para extracción de materiales a nombre de la Municipalidad de Mora (Imágenes 353 y 354 del expediente judicial digital).

II.Hechos no probados. De relevancia para efectos del presente proceso se tienen los siguientes:

  • 1)Que la Municipalidad de Mora hubiese pedido u obtenido permiso alguno de la empresa Vargas Amaya S.A. para extraer material de su propiedad. (No se ha comprobado esa circunstancia).
  • 2)Que la Municipalidad de Mora hubiese pedido u obtenido permiso alguno de las autoridades públicas para proceder con la extracción y uso de material de la propiedad de la empresa Vargas Amaya S.A. ubicada en la localidad de Piedras Negras de Mora (No se ha comprobado esa circunstancia).
  • 3)La "premura y urgencia" de la reparación de caminos de la localidad de Piedras Negras de Mora y que el deterioro de esa parte de la red vial cantonal hubiese sido como consecuencia de los efectos de la Tormenta Tropical Alma que azotó al país en el año 2008 (No se ha comprobado esa circunstancia).
  • 4)Que la reparaciones de los caminos de la localidad de Piedras Negras de Mora realizadas por la Municipalidad de Mora en el año 2009, estuvieran contemplados dentro del Plan General aprobado por la Junta Directiva de la Comisión Nacional de Prevención del Riesgo, como parte de la implementación de la declaratoria de emergencia que contenía el Decreto Ejecutivo N° 34553-MP (No se ha comprobado esa circunstancia)
  • 5)La capacidad real humana y de maquinaria instalada de la Municipalidad de Mora para transportar material (No se ha comprobado esa circunstancia).
  • 6)La inidoneidad del Ingeniero Ronald Mora Vargas para emitir el informe de "Valoración de daños Ecológicos" que se adjuntó al oficio N° ACOPAC-OSRP-535-10. (No se ha comprobado esa circunstancia).

III.Objeto del proceso. Analizadas las alegaciones y peticiones de las partes involucradas en este conflicto, ante la reformulación de pretensiones realizada por la parte actora, se determina como objeto del proceso uno declarativo de nulidad de actuación administrativa, así como la determinación de los daños ambientales causados.

IV.Alegatos. La parte Actora aduce que el 30 de octubre de 2009 se recibió la denuncia del Tribunal Ambiental Administrativo formulada por el señor Nombre113635 por la aparente explotación de un tajo que se encuentra en el inmueble propiedad de la empresa Inversiones Vargas Amaya S.A, ubicado en el Dirección13868 , por supuestos daños sin contar con los permisos, concesión ni viabilidad ambiental, denuncia que se tramitó bajo el número de expediente administrativo 380-09-02-TAA. Que el Tribunal Ambiental por resolución N° 1608-09TAA de 10 de diciembre de 2009, le solicitó al Alcalde de Mora informar si había usado materiales provenientes de la extracción del tajo y que explicara las razones de tal proceder. Que el Alcalde el 12 de febrero de 2010 informó que en la propiedad denunciada se iría a desarrollar un proyecto de interés social y que por las condiciones topográficas del terreno se requirió hacer movimientos de tierra, en lo cual la municipalidad cooperó y el material producto de esos movimientos fue usado para el arreglo de caminos de las comunidades, sin provocar inestabilidad del terreno, ni tala de árboles, ni a cuerpos de agua, ni al paisaje natural.

Que la asociación Integral de Piedras Negras de Mora solicitó permiso para la extracción de material para el lastrado del camino Piedras Negras-Dantas-. Que la empresa Inversiones Vargas Amaya condicionó el pedido de uso de materiales a que se solicitaran los permisos correspondientes. Que en el procedimiento administrativo seguido el Tribunal Ambiental emitió la resolución 655-13-TAA de las 11:52 horas del 11 de agosto de 2014, notificada el 6 de octubre de 2014, en donde se condena a la Municipalidad al pago de ¢9.604.000 colones por concepto de daño ambiental y costo social por los presuntos daños ocasionados en la propiedad mencionada. Que se interpuso el recurso de revocatoria, el que fue declarado sin lugar en resolución N° 004-2015-TAA de 30 de enero de 2015, dándose por agotada la vía administrativa. Alegan que durante el procedimiento ellos probaron que en la propiedad indicada se iba a desarrollar un proyecto de viviendas de interés social para personas de escasos recursos de la comunidad de Piedras Negras y que el giro comercial de la sociedad Vargas Amaya es el desarrollar soluciones habitacionales.

Además, que al realizar el movimiento y retiro de material se notó la posibilidad de aprovecharlos en caminos de la zona que se encontraban en malas condiciones a raíz de los desastres provocados por la tormenta tropical "Alma" por lo que el dueño de la propiedad lo cedió para ello, por lo que se coordinó con la Asociación de Desarrollo para usar el material donado en la habilitación del paso en las rutas de Piedras Negras. Que la Municipalidad colaboró con la Asociación de desarrollo en la extracción del material del lugar y puesto en la red cantonal, de lo cual no se obtuvieron permisos al estar autorizados por el Decreto de Emergencia N° 34553-MP publicado en La Gaceta del 10 de junio de 2008, por ser un asunto de urgente necesidad. Que en el oficio ACOPAC-OSPR-535-10 el Ingeniero Ronald Mora Vargas, Jefe de la Oficina Subregional de Puriscal del Área de Conservación Pacífico Central, remitió un informe de valoración de daños por el monto que finalmente fue sancionado.

Alegan que el Tribunal Ambiental basó su fallo en ese informe nulo de pleno derecho y alejado de la realidad, que contiene un dato de un movimiento de tierra aproximado de 3.430 metros cúbicos de tierra, cuando quedó comprobado que a la sumo se usaron 500 metros cúbicos, sin tomar en cuenta que la municipalidad no tiene la capacidad de haber transportado los metros cúbicos que se mencionan, situación que no fue valorado por el Tribunal Ambiental. Alegan que del informe que sirvió de base resaltan dudas razonables, pues incluso quien lo confeccionó es un Ingeniero Forestal, cuando se requería de un ingeniero en geología. Se alega la preterición del Tribunal Ambiental, así como la indebida valoración y evacuación de la prueba y la mala interpretación de los hechos debatidos. Indican que la Asociación de Desarrollo no participó de la audiencia oral y privada celebrada el 5 de setiembre de 2013, siendo ello de vital importancia, dejando en un estado de indefensión a la municipalidad.

Aducen que no se valoró de forma integral la comunidad de la prueba ofrecida por la municipalidad ni sus argumentos en el sentido de que fue la colaboración prestada a la asociación de desarrollo para la atención de su red vial. Indica que el Tribunal Ambiental resolvió de forma ligera y facilista evitando hacer un ejercicio académico en la ponderación de los intereses que se estaban tutelando, sea que los 500 metros cúbicos de material que extrajo la municipalidad de una propiedad privada con la debida autorización del mismo, fue usado para restablecer de forma mediática el uso de la red vial que comunica Piedras Negras con otras poblaciones y con la autorización del Decreto Ejecutivo N° 34553-MP. Indica que se aplicó la aberración de la legalidad por los jueces administrativos sin meditar el fin para tener una visión holística del caso. Aducen que el Decreto Ejecutivo 34553-MP que estuvo vigente durante casi cuatro años desde el 10 de junio de 2010 cuando se publicó, siendo que consideran que los actos administrativos llevados a cabo estaban cobijados por tal normativa de emergencia, dada la premura del tiempo y la urgente necesidad obligó la atención inmediata de la Red Vial.

Aducen la nulidad del Informe ACOPAC-OSPR-535-10, por la falta de idoneidad del profesional que lo elaboró y la falta de rigor técnico para determinar la cantidad de material extraído y las posibilidades del ayuntamiento de movilizarlos. Aluden a la falta de rigor técnico para que un ingeniero forestal emita un informe sobre movimientos y extracción de tierra, para lo cual omitió variables técnicas básicas para esos informes como la constatación de la topografía inicial, la verificación de curvas de nivel y la topografía final del sitio para determinar la cantidad de metros cúbicos de material. De lo cual advirtieron al Tribunal Ambiental no obstante su argumento no fue atendido.

V.Por su parte, la Demandada indica, que no se probó en la sede administrativa ningún permiso para la explotación de materiales, de lo cual incluso los dueños de la propiedad, la sociedad Vargas Amaya en documento de 22 de marzo de 2012 le indicaron al Tribunal Ambiental que ellos no habían autorizado a nadie a extraer materiales, y se enteraron por un vecino que la maquinaria de la municipalidad lo había hecho. Incluso, la autorización para la extracción y el permiso de paso de maquinaria fue solicitada por la Asociación de Desarrollo posterior a los hechos, y dicha solicitud quedó supeditada a la obtención de los permisos respectivos y ello aunado a que el Registro Nacional Minero certificó que en su base de datos para el año 2009 no había solicitud alguna de concesión para extraer materiales de ese lugar a nombre de la Municipalidad de Mora. Rechazan que el accionar de la municipalidad estuviera amparada al Decreto Ejecutivo N° 34553-MP, mediante el cual se declaró estado de emergencia de los cantones de San José, Guanacaste y Puntarenas.

Indican que no es cierto que a la Asociación de Desarrollo la llamara al procedimiento la municipalidad, pues fueron los representantes de la empresa Vargas Amaya, además que la municipalidad nunca ofreció a los representantes de la asociaron como prueba de ellos. Indican que en sede administrativa la conducta sancionada no versó en las condiciones topográficas de la propiedad ni sobre el movimiento de tierra para construir las casas de bono del proyecto, sino que el Tribunal Ambiental sancionó el daño ambiental causado por la municipalidad al extraer materiales al margen de la ley. Expresan que las resoluciones administrativas adoptadas por el Tribunal Ambiental se encuentran ajustadas a derecho, pues no existe violación al derecho de defensa pues la municipalidad nunca ofreció a la asociación de desarrollo como testigos claves de su defensa, por el contrario fueron llamados al procedimiento a instancia de la empresa Vargas Amaya.

Por otra parte en el procedimiento quedó acreditada que fue la municipalidad de Mora la que extrajo los materiales de la propiedad sin permiso alguno y en perjuicio del medio ambiente. Además, la municipalidad no adujo estar amparada al decreto ejecutivo sino hasta una gestión de adición y aclaración y régimen de nulidades, ni siquiera en el recurso de revocatoria. Y de todas formas no se estaba autorizado a esos movimientos de tierra, pues las situaciones de emergencia estaban debidamente regladas. Alegan que existe la Ley N° 8668 de 10 de octubre de 2008 para "Regulación de la extracción de materiales de canteras y cauces de dominio público por parte de las municipalidades" exime a las municipalidades de permiso de explotación en situaciones de emergencia bastando con la coordinación con la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias comunicada a la Dirección de Geología y Minas de cierta información, siendo que en este caso la Comisión de Emergencia certificó que no se había dado gestiona alguna de parte de la municipalidad de mora, lo que se reafirma con lo indicado por la Dirección de Geología y Minas.

Aducen que la protección ambiental es prioritaria y no puede obviarse ni siquiera en estado de emergencia. En torno al informe ACOPAC-OSPR-535-10 rendido por el SINAC, el cual valoró el daño ambiental y lo emitió el órgano competente. En torno al cuestionamiento del funcionario que lo emitió, no es posible, pues el volumen del material extraído y el daño ambiental, no se rebatía las condiciones geológicas propias del terreno ni el material en sí.

VI.Aspectos iniciales. Para una contextualización del caso que nos ocupa, debe hacerse mención a dos aspectos importantes: El primero referido a que este proceso inició como uno de "Lesividad", incluso para ello se aportó a los autos el acuerdo del Concejo Municipal de Mora (véase documento que corre agregado a partir de la imagen 240 del expediente judicial digital), mediante el cual ese órgano declaró la lesividad con el fin de cumplir con uno de los requisitos para la tramitación de ese tipo especial de proceso contencioso. No obstante, en la fase de trámite, en específico, en la Audiencia Preliminar celebrada el veintisiete de junio de dos mil dieciséis (Imagen 369 del expediente judicial digital), al analizarse las pretensiones, el representante legal de la municipalidad de Mora, solicitó se eliminaran las pretensiones referidas a la declaración de lesividad y determinó las nuevas a partir de ese momento trabando la litis en las cinco pretensiones que son el objeto de este proceso (ver resultando primero de esta sentencia) y sobre las cuales se resolverá.

Debe mencionarse que el cambio mencionado se dio manteniendo la parte actora las argumentaciones y sustento de su demanda. Por otra parte, debe indicar este Colegio que de la lectura del libelo de interposición de la demanda, el mismo es un escrito en el apartado donde se narran los hechos, por su redacción resulta de difícil entendimiento, aunado a que sus alegaciones de nulidad, como se dijo en un principio por la vía de la lesividad, y luego como anulación pura, la demanda mencionó una cantidad de supuestos yerros que no fueron achacados de forma directa y concreta a cada uno de las resoluciones impugnadas, sino que se usó una técnica generalizada, lo que genera una imprecisión del ligamen necesario entre la argumentación y los actos argüidos de nulidad, ello en el tanto se recurrieron dos resoluciones del Tribunal Ambiental administrativo. Y, respecto del informe de valoración del daño que también se acusa nulidad, sus argumentaciones sí fueron más definidas. Sustentado en estas apreciaciones, este Tribunal se abocará al análisis de los actos que se pretenden anular.

VII.Análisis de las resoluciones del Tribunal Ambiental Administrativo de las que se aduce nulidad. A saber, se han impugnado los siguientes actos: la resolución N° 655-13-TAA de las 11:52 horas del 11 de agosto de 2014 mediante la cual se resolvió sobre la queja planteada, disponiendo la responsabilidad de la Municipalidad de Mora imponiéndole como indemnización compensatoria la suma de ¢9.604.000.00 por concepto de daño ambiental y costo social por la extracción de materiales de una propiedad ubicada en el Dirección13867 (Imagen 70 del expediente judicial digital) y, la resolución N° 004-2015-TAA de las 14:30 minutos del 13 de enero de 2015, que acogió una gestión de adición y aclaración y por ello entró a conocer de la revocatoria planteada contra la resolución de fondo anteriormente mencionada y que culminó con la confirmación de lo resuelto (Imagen 27 del expediente judicial digital). Para abarcar este tema, se dividirá el estudio en varias partes, así: a) De los argumentos esgrimidos.

Tal y como se indicó en el considerando anterior, pese a que se impugnaron dos resoluciones separadas emitidas por el Tribunal Ambiental Administrativo en el expediente tramitado bajo el número 380-09-02-TAA el cual se tuvo a la vista en sendas certificaciones que constan tanto en el expediente judicial digital (aportado por la parte actora), así como en físico. Según se indicó, los argumentos de nulidad que expresó la representación del ayuntamiento de Mora, se dieron sin una alusión expresa y concreta a cada una de las resoluciones mencionadas, incluso, en las conclusiones rendidas por escrito ante audiencia dada a las partes luego de autorizar el cambio de este asunto a la modalidad de Puro Derecho, la parte actora mantuvo la mayoría de esas argumentaciones en la misma forma indicada, sea sin ser específico para cada acto, salvo que en las conclusiones, la representación legal municipal, mencionó la falta de motivación como causa de la nulidad que pretenden así como el sustento normativa de aquella.

Lo anterior obliga a este Colegio a enumerar esas argumentaciones a efectos de tenerlas a la vista y poder luego, cuando se analicen los actos, intentar relacionarlas. Así: - Se admite por parte de la municipalidad, la extracción y uso de al menos 500 metros cúbicos de material de la propiedad perteneciente a la empresa Vargas Amaya S.A.; - Dice haber probado en los autos administrativos que en esa propiedad se pretendía realizar un proyecto habitacional de interés social y el giro comercial de la empresa propietaria del fundo; - Indica que el fin del uso del material lo fue para aprovecharlo en la reparación de caminos públicos de la localidad de Piedras Negras, derivado de lo acaecido con la tormenta Alma en el año de 2009; - La existencia de premura y urgencia para atender esas reparaciones; - Que para ello coordinaron con la Asociación de Desarrollo Integral de esa localidad; - Que en su caso aplica lo dispuesto por el Decreto Ejecutivo N° 34.553-MP; - Que la municipalidad no tiene capacidad para el transporte de la cantidad de material que se le achaca extrajo y usó; - Aduce la preterición, indebida valoración y evacuación de la prueba, así como la mala interpretación de los hechos; - Que el representante de la Asociación de Desarrollo Integral de Piedras Negras no participó en la audiencia oral y pública realizada en el expediente administrativo, lo cual consideran de vital importancia y que ello trajo indefensión; - La no valoración integral de la prueba ofrecida, ni su argumentación de que hubo una colaboración con la asociación para atender la red vial; - Acusan de "ligera y facilista" la resolución del Tribunal Ambiental.

Y, respecto del informe adjunto al oficio N° ACOPAC-OSRP-535-10, adujeron: - La falta de idoneidad del profesional que lo elaboró al ser un ingeniero Forestal; - La falta de rigor técnico para determinar la cantidad del material extraído; y - Que se omitieron variables para la determinación del daño ambiental, estás últimas argumentaciones, en las conclusiones rendidas por la representación de la actora, las ligó a lo expresado en el Informe rendido por el perito judicial nombrado en este asunto. b) Aspectos previos al dictado de la resolución final en el procedimiento administrativo que nos ocupa. En ese sentido, vale la pena indicar que si bien al inicio del procedimiento solo se dio curso del mismo contra la empresa Vargas Amaya S.A. propietaria del terreno en donde se realizó la extracción (Folio 46 del expediente administrativo físico N° 380-09-02-TAA, e Imagen 192 del expediente judicial digital), precisamente ante gestión realizada por el representante de dicha sociedad, se integraron como co encartados de los hechos investigados, tanto a la Municipalidad de Mora, como a la Asociación de Desarrollo Integral de Piedras Negras (Folio 122 del expediente administrativo físico N° 380-09-02-TAA, e Imagen 115 del expediente judicial digital).

Ahora bien, como primer acto procesal realizado por el Tribunal Ambiental, luego de la presentación de la queja, fue la resolución N° 1608-09-TAA de las 9:30 horas del 10 de diciembre de 2009, mediante la cual, entre otros aspectos, le solicitó al Alcalde de Mora indicar si había usado materiales de los que se indicaban en la queja según las fotografías aportadas (Folio 6 del expediente administrativo físico N° 380-09-02-TAA, e Imagen 233 del expediente judicial digital), ante lo cual, sin ser parte aun del procedimiento, el ayuntamiento contestó en oficio DAM-011-2009 aportando un informe de la Unidad Técnica de Gestión Vial N° UGA-INF-02-2010 realizado previa inspección del 11 de setiembre de 2010, en cuyo documento el Alcalde Municipal de Mora le solicitó al Tribunal Ambiental el archivo del expediente al considerar no existió un daño al ambiente (Folio 21 y 17 del expediente administrativo físico N° 380-09-02-TAA, e Imágenes 218 y 222 del expediente judicial digital).

Además, en el expediente administrativo se contaba, entre otras que más adelante se verán, la siguiente prueba: - Un informe del Registro Nacional Minero fechado 19 de febrero de 2010, de la visita que realizaron al lugar ante pedido expreso del Tribunal Ambiental, según el cual se identificó un "pequeño" tajo dentro de propiedad privada, con indicios de extracciones anteriores, sin personal ni maquinaria, de donde algunos lugareños indicaron se había extraído material un mes atrás, además el Registro Minero expresó que revisados sus registros no se encontró ninguna solicitud en trámite ni otorgada del área denunciada (Folio 23 del expediente administrativo físico N° 380-09-02-TAA, e Imagen 76 del expediente judicial digital). - El oficio N° ACOPAC-OSRP-535-10 fechado 11 de agosto de 2010 (impugnado en esta demanda y que con posterioridad se analizará), suscrito por el ingeniero Ronald Mora Vargas de la Subregional de Puriscal del SINAC, que entregó al Tribunal Ambiental ante su pedido expreso de valorar del daño pedido, documento en el cual se determinó la suma de nueve millones seiscientos cuatro mil colones como monto del daño (Folio 36 del expediente administrativo físico N° 380-09-02-TAA, e Imagen 203 del expediente judicial digital). - El oficio N° UGA-INF-01-2012 fechado 29 de agosto de 2012, informe derivado de una inspección que realizara, el 29 de agosto de 2012, la Unidad Técnica de Gestión Vial de la Municipalidad de Mora por pedido de la Asesoría Legal del mismo municipio, todo con ocasión de la queja planteada por la extracción de materiales de la propiedad de la empresa Vargas Amaya S.A., en el cual recomiendan solicitar al Tribunal Ambiental reconsiderar los criterios de la valoración del daño ecológico que determina el oficio ACOPAC-OSRP-535-10, pues no observaron sus efectos transcurridos dos años después, sino la sucesión natural del ecosistema (Folio 139 del expediente administrativo físico N° 380-09-02-TAA, e Imagen 100 del expediente judicial digital). - Además, a partir de las 8:50 horas del día 5 de setiembre de 2013, se realizó la "Audiencia Oral y Pública", en la que participaron las partes involucradas que acudieron, y en lo que interesa, representando a la Municipalidad de Mora participó su apoderado especial Carlos Lanzas Quesada.

En esa oportunidad cada representante pudo externar su posición del caso, además se recibieron testigos, expresamente dos funcionarios ofrecidos por la Municipalidad de Mora que fueron sometidos al respectivo interrogatorio. Asimismo, en ese acto del procedimiento las partes expresaron sus conclusiones (Folio 150 del expediente administrativo físico N° 380-09-02-TAA, e Imagen 88 del expediente judicial digital). c) De la resolución N° 655-13-TAA de las 11:52 horas del 11 de agosto de 2014. Como se indicó, mediante esa resolución, el Tribunal Ambiental Administrativo resolvió el fondo de la queja presentada por la extracción de materiales de un tajo sin contar con los permisos correspondientes. En el contenido de esta resolución, se denota que desde los resultandos se hace mención cronológicamente a las actuaciones realizadas. Ya en sus considerandos, el Tribunal Ambiental, entre otros tuvo, como probado la inexistencia de un permiso para la extracción de materiales en la propiedad de la empresa Vargas Amaya, que la municipalidad de Mora había realizado la extracción y uso de los materiales para la reparación de caminos de la localidad, así como el informe de la Municipalidad de Mora y el de la Subregional de Puriscal del SINAC aportados a los autos.

Además, tuvo como no probado que la municipalidad o la Asociación de Desarrollo contaran con los permisos respectivos de autoridades públicas o de la empresa propietaria del fundo. Ya, específicamente sobre el fondo, el Tribunal Ambiental analizó la prueba documental y testimonial para determinar la inexistencia de permiso alguno para que la municipalidad extrajera y utilizara material de ese lugar en el año de 2009, analizando concretamente los testimonios de los funcionarios de la municipalidad de Mora Gretel Alfaro y Alonso Arroyo que fueron interrogados el día de la audiencia oral y pública realizada en el procedimiento, con lo cual determinaron que el ente local era el responsable de la extracción y el uso indebido de ese material, considerando la existencia de un daño "por acción antropogénica" ante el cambio y deterioro del recuso suelo, ya que a partir de la prueba, en especial del oficio ACOPAC-OSRP-535-10, se comprobó la existencia en la especie de extracción de materiales, movimiento de tierra provocando erosión, drenaje y remoción de tierra y la exposición del material rocoso con material mineral al descubierto, según lo sustentaron en clara violación al artículo 50 de la Constitución Política y del artículo 54 de la Ley de Biodiversidad.

Además, merece indicarse que el Tribunal Ambiental, en aplicación del artículo 109 de la Ley de Biodiversidad, no consideró que la Municipalidad hubiese probado la ausencia de degradación o no afectación en el lugar, siendo esa carga de la prueba es del denunciado. Determinó la existencia de una responsabilidad objetiva y no subjetiva, para cual hizo referencia a la Declaración de Río, citó doctrina y normativa, como la dispuesto en el numeral 111 de la Ley Orgánica del Ambiente, considerando se había medido técnicamente el talud de donde se dio la extracción con el método del Instituto de Políticas para la Sostenibilidad basado en daño biofísico. También, sustentó normativamente su resolución además de las leyes mencionadas, en la de Aguas, el Código de Minería, la ley General de la Administración Pública, la Ley Forestal y su reglamento. Con todo lo cual concluyó la participación activa en la extracción y uso del material por parte de la Municipalidad de Mora, que lo había realizado sin los permisos respectivos y que por ello se había ocasionado un daño y debía imponerse una sanción económica que derivaba de la valoración del daño pedida por el Tribunal Ambiental al Sinac.

Por otra parte, excluyó a la Asociación de Desarrollo Integral de Piedras Negras al considerar que ésta había pedido permiso a la empresa para extracción y uso de materiales después de los hechos ya acaecidos en el 2009, y a la empresa, indicando que no podía achacarle responsabilidad cuando había sido un tercero ajeno el que había provocado el daño ambiental. Como puede observarse, la resolución aquí impugnada en el estudio de su contenido denota la existencia de sustento suficiente para arribar a las conclusiones en cuanto a la existencia de un daño y quien lo había cometido. En ese sentido no hay que dejar de lado el hecho de que la imputación de cargos hecha a los co encartados en el procedimiento administrativo, había sido precisamente por la explotación de un tajo y aprovechamiento de materiales sin contar con los permisos y la valoración económica del daño ambiental por la suma de ¢9.604.000.00.

El resultado del análisis del Tribunal Ambiental, contó con prueba que constaba en los autos administrativos, en especial los documentos mediante los cuales se vinculaba al municipio en las labores de extracción y uso del material. Así, dicha situación se corrobora no solo de las fotografías aportadas por el quejoso (folios 1 y 2 del expediente administrativo), sino además, porque la misma representación de la municipalidad y los informes de inspección presentados por ese ente local así lo aceptaron, pues incluso en la demanda que nos ocupa, el propio Alcalde Municipal indica que al menos utilizaron 500 metros cúbicos de material de la extracción (ver escrito de demanda), sea que indiscutiblemente, la Municipalidad de Mora sí participo activamente en el año de 2009 en los hechos imputados, situación que por lo indicado, ni siquiera puede ser considerada controvertida. Además, y para reafirmar lo anterior, se tenía en el expediente administrativo, como prueba, que posterior a los actos de la Municipalidad, el Presidente y la Secretaria de la Asociación de Desarrollo Integral de Piedras Negras de Mora, el 18 de febrero de 2010, solicitaron permiso a la empresa Vargas Amaya S.A. para extracción de material y el paso de maquinaria en su propiedad para ser usado en el lastreado de los caminos entre las comunidades de Piedras Negras y Dantas (Folio 82 del expediente administrativo físico N° 380-09-02-TAA, e Imagen 99 del expediente judicial digital).

Lo cual fue atendido por la empresa mencionada, cuando su representante en documento fechado 2 de marzo de 2010, no se opuso a lo pedido, pero condicionándolo a la obtención de los permisos correspondientes (Folio 83 del expediente administrativo físico N° 380-09-02-TAA, e Imagen 97 del expediente judicial digital), permisos que no fueron aportados por la Municipalidad de Mora, ni en sede administrativa, ni en la jurisdiccional, pues el ayuntamiento alude la aplicación, en su caso, del Decreto Ejecutivo N° 34553-MP, aspecto que se analizará más adelante en otro apartado de esta sentencia. De todo lo cual se denota que nunca existió autorización del propietario del terreno, como lo indica el municipio, por ejemplo en el informe UGA-INF-02-2010 (Folio 17 del expediente administrativo e Imagen 222 del expediente judicial digital), por el contrario, en el expediente administrativo se cuenta con otra prueba que es el documento fechado 22 de marzo de 2012, en el que los representantes legales de la empresa Vargas Amaya S.A, manifestaron al Tribunal Ambiental que ellos en ningún momento habían autorizado a nadie para sacar material del sitio y que se enteraron por un vecino que fue la maquinaria de la municipalidad la que lo había realizado (Folio 62 del expediente administrativo físico N° 380-09-02-TAA, e Imagen 176 del expediente judicial digital). d) Sobre la la resolución N° 004-2015-TAA de las 14:30 horas del 13 de enero de 2015.

Antes de referirnos a la mencionada resolución, debe indicarse que con posterioridad a la resolución 655-13-TAA, la representación de la Municipalidad de Mora, planteó contra aquella recurso de revocatoria el 13 de octubre de 2014 (Folio 180 del expediente administrativo físico N° 380-09-02-TAA, e Imagen 53 del expediente judicial digital), mismo que fue rechazado por extemporáneo mediante resolución N° 881-14-TAA de las 8:45 horas del 21 de octubre de 2014 (Folio 193 del expediente administrativo físico N° 380-09-02-TAA, e Imagen 45 del expediente judicial digital). Y, la representación del municipio, el 24 de octubre siguiente, planteó "Recurso de adición y aclaración y régimen de nulidades" contra la resolución del Tribunal Ambiental N° 881-14-TAA de las 8:45 horas del 21 de octubre de 2014 (Folio 200 del expediente administrativo físico N° 380-09-02-TAA, e Imagen 38 del expediente judicial digital).

Siendo que el Tribunal Ambiental Administrativo en resolución N° 004-2015-TAA de las 14:30 minutos del 13 de enero de 2015 (aquí impugnada), anuló la resolución 881-14 y entró a conocer del recurso de revocatoria presentado, rechazando todas sus alegaciones y confirmó lo resuelto por el fondo (Folio 211 del expediente administrativo físico N° 380-09-02-TAA, e Imagen 27 del expediente judicial digital). Así, analizando el contenido de la resolución que nos ocupa, este Tribunal pudo observar que el Tribunal Administrativo analizó y resolvió los alegatos que contra la resolución de fondo ahora esgrimía la municipalidad, en ese sentido ante el alegato de que se requería incluso el movimiento de tierra para el desarrollo del proyecto habitacional que se proyectaba en esa propiedad, se rechazó dicho argumento indicando que para ese movimiento se debía contar con los permisos correspondientes, de lo cual la misma municipalidad debía ser garante.

Reafirmó la resolución la inexistencia de permisos para proceder con la extracción y uso de materiales. No consideró la violación alegada al debido proceso por la no participación en la audiencia oral del representante de la Asociación de Desarrollo pues ello, a criterio del Tribunal Administrativo no implicaba variación alguna en torno a la omisión de permisos, ligado a lo anterior rechazó el argumento de que el municipio lo que prestó fue una colaboración a la asociación, pues se indicó en la resolución que era "inaudito" que el ente local prestara su maquinaria y personal sin cerciorarse de la existencia de los permisos respectivos. También rechazó el tema aludido respecto de la urgente necesidad, pues consideró que no bastaba con que el propio municipio considerara ese estado de necesidad, valiéndose de ello para extraer material de una propiedad privada sin contar con permisos. Se refirió además al testimonio del funcionario Alonso Mora, de quien indicó que no dejó acreditado ningún aspecto técnico para poder eximir de responsabilidad al municipio.

Como puede observarse, todos los nuevos alegatos esgrimidos por la vía del recurso de revocatoria, fueron atendidos en su oportunidad por el Tribunal Administrativo. e) De los alegatos esgrimidos en la demanda que nos ocupa, tendientes a la anulación de las resoluciones impugnadas. De inicio, debe indicarse que dichas alegaciones no todas están relacionadas propiamente con las resoluciones, sino que, algunas se refieren a aspectos formales del procedimiento, sin que se hubiese pedido la nulidad propia del mismo. Dicho lo anterior, de seguido, se analizarán las argumentaciones de la parte actora, así: Se aduce que ellos probaron en los autos administrativos que la propiedad de donde extrajeron los materiales iba a ser destinada a un proyecto habitacional de interés social y el giro comercial de la empresa ligado a ese tipo de proyectos, no obstante, considera este Tribunal que esa circunstancia no tendría ningún ligamen con lo imputado en el procedimiento administrativo y en especial con la determinación del propio accionar municipal relacionado a los hechos de la extracción y uso de los materiales, por lo que ese argumento no tendría en sí efecto alguno de nulidad ni de las resoluciones, ni del procedimiento (de lo cual se ha indicado no fue solicitado en la especie).

Por otra parte, de manera genérica aduce preterición sin explicar o ligarlo al caso; además manifiesta una indebida valoración y evacuación de la prueba, así como la mala interpretación de los hechos. En estos últimos dos aspectos, lo que expresa el municipio, es que no se valoró integralmente la prueba por ellos ofrecida, ni su argumentación, pues indica que adujo la existencia de una colaboración con la Asociación para atender la red vial, situación que acusan no fue entendida por el Tribunal Ambiental y por ello tildan de: "ligera y facilista" la resolución que impugnan. Dichos alegatos, se reitera, son muy genéricos y más se inclinan por una insatisfacción de lo resuelto, por no haber seguido su idea por parte del órgano resolutor, aspecto que bajo ninguna circunstancia podría considerarse parámetro o base para declarar la nulidad de una resolución. En efecto, alegar que el fin del uso del material lo fue para aprovecharlo en reparación de caminos públicos de la localidad de Piedras Negras, derivado de lo acaecido por el fenómeno natural del año de 2008, siendo que en este caso nunca probó la parte actora, ni en sede administrativa ni en la jurisdiccional, la existencia de la "premura y urgencia" en realizar esa labor, como tampoco probó ligado a ello, que la necesidad derivara indefectiblemente como consecuencia de los efectos provocados por el paso de la Tormenta Tropical Alma por territorio nacional, aunado a la omisión también de probar que no se contó con los permisos necesarios, pues se trata, en la especie de la protección al ambiente, bien de primera necesidad para el ser humano y su misma existencia en la tierra, tal y como puede derivarse del contenido normativo constitucional que desde la reforma del año 1994 se dispuso en el numeral 50 párrafos segundo y tercero, cuando se incluyó como derecho fundamental el ambiente sano y ecológicamente equilibrado, estableciendo una legitimación popular para denunciar cualquier violación y la obligación del Estado gobierno de: "...garantizará, defenderá y preservará ese derecho...".

Norma de rango superior que dio pie a un gran número de normativa internacional y nacional ordinaria que desarrolla esa protección especial que debe tenerse para con el ambiente, y que por ello su uso no es indiscriminado, pues la normativa ha establecido límites y requisitos, como el contar con los permisos respectivos para la extracción de materiales, siendo que para el caso concreto de las Municipalidades, nos encontramos con la Ley N° 8668 denominada "Regulación de la extracción de materiales de canteras y cauces de dominio público por parte de las municipalidades"; aun aplicables en situaciones de emergencia y que por haberlo alegado de forma separada, se estudiará el alegato de la aplicación y eximente que aduce el municipio en su caso de un decreto de emergencia emitido precisamente por el estado de emergencia que generó la Tormenta Tropical Alma en el año 2008 en el país. Así, aunque el fin del uso del material que alega el gobierno local de Mora puede ser loable y esperable, como parte del servicio que deben prestar los gobiernos en su comunidad, este no puede por sí mismo evadir la obligación de cumplir con los requisitos establecidos en las leyes en el cumplimiento del haz de competencias municipales consagrados en la norma aplicable a su caso de modo directo, como lo es el Código Municipal en lo establecido como marco competencial en su artículo 4, entre ellas el servicio público regido de forma general por los principios que establece el artículo cuarto de la Ley General de la Administración Pública, todo sin dejar de lado el principio de legalidad que obliga a todo funcionario del aparato público de apegarse a la legalidad, que se encuentra contenido en el artículo 11 de la Ley General y mismo numeral de la Constitución Política.

Tampoco se comprende el alcance que la parte actora quiere darle a su alegato de que ellos coordinaron con la Asociación de Desarrollo Integral de Piedras Negras, pues aunque aquella agrupación hubiese pedido el auxilio municipal, en este caso para atender la red vial de la localidad, la prestación de una ayuda o colaboración en coordinación con las fuerzas cívicas del cantón, no puede ser considerada una posibilidad para no cumplir con los requisitos legales establecidos, como lo son los permisos previos para la extracción de materiales, por ejemplo lo establecido en la ley N° 8668 de aplicación especial para las municipalidades y que, según la cual, los ayuntamientos pueden obtener permisos especiales del MINAE, siempre y cuando cumplan requisitos, como lo es el contar con una resolución de viabilidad ambiental emitida por la SETENA (artículo 2) lo cual determina la importancia que reviste un estudio técnico previo y un permiso que debe obtener el municipio para la extracción de materiales de canteras y cauces, todo en protección del derecho al ambiente.

Incluso, en esa misma Ley, en su artículo tercero establece la posibilidad de que en casos de haberse declarado una emergencia, aun así los ayuntamientos deben contar con un permiso emitido por la Dirección de Geología y Minas, para lo cual se debe cumplir con la coordinación y aval de la Comisión Nacional de Prevención de Riesgos, situación que no sucedió en este caso, pues el argumento de la Municipalidad de Mora es que no tenía que contar con un permiso, pues su actuación estaba amparada a lo dispuesto en el Decreto Ejecutivo N° 34553-MP (aspecto que se desarrollará más adelante). Otro aspecto argüido, lo es que no se tomó en cuenta la capacidad humana y de maquinaria del ayuntamiento para poder transportar la cantidad de material que se le achacó. No obstante este alegato, lo cierto es que, al haber esgrimido el mismo, a quien le tocaba probar de forma indubitable esa situación lo era a quien lo alegó, y en este caso, ni en sede administrativa, ni en la jurisdiccional, se cuenta con un informe técnico de la real capacidad que puede desplegar efectivamente ese gobierno local para el transporte de materiales, ni mucho menos relacionado con una prueba de qué fue lo que en realidad reparó en torno a la red vial con aquellos materiales, pues no solo debe mencionarse en un escrito o en un testimonio, sino que ello debe tener, al tratarse de un asunto técnico, un respaldo de la misma naturaleza, para ser tenido como probado.

Mas, aunque se hubiese probado una falta de capacidad en el sentido que se alega, nunca deja de existir en este caso, la realidad, incluso aceptada por la misma representación de la parte actora, de que sí se extrajo material y lo usó sin el permiso expreso de los dueños del fundo, ni de las autoridades públicas encargadas de velar por el cumplimiento de requisitos para ello (véase la prueba aportada en sede jurisdiccional por la representación del Estado visible a imágenes 347 y 353 de expediente judicial digital), mediante las cuales se demuestra la inexistencia de permisos en el Registro Nacional Minero y en la Comisión Nacional de Prevención de Riesgos. Por último, ha sido alegado que el representante de la Asociación de Desarrollo Integral de Piedras Negras, no participó en la audiencia oral y pública realizada en el expediente administrativo, lo cual considera la representación municipal era de vital importancia y alega le trajo indefensión.

Un argumento debe tener su propia base y sostenerse por el mismo, y en este caso, la municipalidad no indica porqué era de "vital importancia" el que participara la Asociación de Desarrollo, lo que incluso captó el Tribunal Ambiental, pues en su resolución de fondo indicó que no veía como las manifestaciones de los representantes de dicha asociación hubiesen cambiado la forma en que se resolvió, pues, la representación de la parte actora no ha probado que ellos propusieran esa participación como parte de su elenco probatorio, hay que tomar en cuenta además, que esa Asociación estaba imputada, sea era parte del procedimiento administrativo y fue excluida de responsabilidad respecto de la queja tramitada y sobre tal aspecto resolutivo, la aquí parte actora no ha presentado alegato alguno, así que, por la forma en que se aduce este argumento, el mismo vendría a ser especulativo y carente de fuerza para provocar una nulidad absoluta.

Así las cosas, luego del análisis de todos los alegatos, se debe indicar que, ninguno de ellos, por lo expresado, conllevarían a la nulidad de las resoluciones impugnadas, pues no se ha probado en autos la existencia real de una falta o defecto de algún elemento esencial de los actos administrativos que constituyera vicio, de tal naturaleza que conlleve a una nulidad absoluta (Artículos 132, 133, 136, 158, 166, 169 de la Ley General de la Administración Pública), pues incluso el alegato de falta de motivación expresada en las conclusiones emitidas por la apoderada especial del municipio, no tiene eco con las argumentaciones que se han analizado, y como se ha mantenido en esta jurisdicción, no debe existir la nulidad por la nulidad misma, pues sería una aberración jurídica el sostener que cualquier tipo de vicio o alegato sin sustento, ni ligamen, conllevaría la nulidad de un acto, incluso admitir esa tesis, sería contrario al principio de conservación de los actos administrativos, salvo ante la existencia probada de un vicio tal que no pueda escapar de la declaración de nulidad, lo que no ocurre en este caso.

VIII.De la aplicación al caso concreto del Decreto Ejecutivo N° 34553-MP. La parte actora, como parte de su argumentación, indica que este Decreto Ejecutivo es el basamento jurídico de su actuar, indicando en su demanda que no se obtuvieron permisos al estar autorizados por el Decreto de Emergencia publicado en La Gaceta del 10 de junio de 2008 y que estuviera vigente por casi cuatro años, por ser un asunto de urgente necesidad, sea la atención a la red vial cantonal. Ya en modo más específico, en las conclusiones emitidas de previo a la presente sentencia, la representación municipal citó textualmente los artículos primero y tercero de esa normativa, sin hacer un ligamen a la aseveración realizada en la demanda, sea que no obtuvieron los permisos en aplicación del Decreto. Al respecto, esa declaratoria de emergencia nacional se dio ante las afectaciones derivadas por un sistema de baja presión tanto en el océano pacífico, como en el atlántico, que provocó una tormenta tropical en el año 2008, ocasionando condiciones de temporal con saturación de suelos, desbordamiento de ríos, inundaciones, afectaciones a infraestructura vial, entre otras y que obligó al gobierno de la República decretar el estado de emergencia para varios cantones del país, entre ellos el de Mora, lo anterior según lo dispuesto en el artículo primero del Decreto que se analiza.

Ahora bien, como se indicó supra, el otro artículo citado por la representación de la parte actora lo es el tercero, en el cual se indica: "Se tienen comprendidas dentro de esta declaratoria de emergencia a todas las acciones y obras necesarias para la atención, rehabilitación, reconstrucción y reposición de la infraestructura, las viviendas, las comunicaciones y la agricultura dañadas y en general todos los servicios públicos dañados que se ubiquen dentro de la zona de cobertura señalada en el artículo 1) de este Decreto, todo lo cual debe constar en el Plan General de la Emergencia aprobado por la Junta Directiva de la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, para poder ser objeto de atención conforme al concepto de emergencia." (Lo subrayado no es del original). Ya visto el artículo de forma completa y no sesgado como la cita realizada en las conclusiones de la Municipalidad, se denota otra omisión de parte del ayuntamiento, sea el probar en los autos que la situación que aduce de urgencia con los caminos de Piedras Negras de Mora, estuviera inserta en el Plan General aprobado para que fuera aplicable el Decreto y sus beneficios, ligado lo anterior a que, como lo indica el artículo 4 de la normativa que se analiza, el planeamiento, dirección, control y coordinación de los programas y actividades de protección, salvamento, atención, rehabilitación y reconstrucción de las zonas declaradas en estado de emergencia, recayó sobre la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, o las unidades ejecutoras que se designaran.

Además, si bien en ese Decreto, por ejemplo en el artículo octavo, se indica: " Los predios de propiedad privada ubicados en el área geográfica establecida en esta declaratoria de emergencia, deberán soportar todas las servidumbres legales necesarias para poder ejecutar las acciones, los procesos y las obras que realicen las entidades públicas en la atención de la emergencia, siempre y cuando ello sea absolutamente indispensable para la atención oportuna de la misma, de conformidad con lo dispuesto en la primera fase de la emergencia", no es el caso aplicable a la situación que se analizó en sede administrativa por la extracción y uso de materiales de una propiedad privada, y aun así, nótese que el artículo refiere a "servidumbres legales". Así las cosas, ni en esta normativa, ni en la Ley N° 8488, que es a la cual se remite el decreto que nos ocupa, se puede inferir expresa o tácitamente, lo que ha querido entender la municipalidad de Mora a su favor, pues esa declaratoria de emergencia no implicó la eximente de cumplir con requisitos y procedimientos, como el que incurrió ese ayuntamiento cuando extrajo y usó materiales de la propiedad de la empresa Vargas Amaya S.A. en el año de 2009, si bien durante la vigencia del decreto, no se probó que los caminos vecinales de Piedras Negras de Mora se vieran afectados de forma directa y como consecuencia de las condiciones climáticas derivadas de la tormenta tropical llamada Alma que pasó por el país en el año de 2008; tampoco se probó que las reparaciones que indica la municipalidad actora realizó en la red vial cantonal en el año 2009, fueran parte del plan aprobado como implementación del Decreto de emergencia, y tampoco se ha probado en autos que para la actuación achacada a la municipalidad de Mora, hubiese contado con los permisos necesarios, situación que dio pie precisamente a que el Tribunal Ambiental, como se ha indicado, dispusiera en sede administrativa que la municipalidad aquí actora fuese la causante de un daño ambiental.

Por todo lo cual, no es dable aceptar el argumento de que la Municipalidad de Mora estaba autorizada por el Decreto Ejecutivo N° 34553-MP para actuar como lo hizo, de lo cual derivó la queja interpuesta y resuelta administrativamente.

IX.De la nulidad alegada del informe contenido en el oficio N° ACOPAC-OSRP-535-10 fechado 11 de agosto de 2010. El tercer acto impugnado y aludida su nulidad en la demanda que nos ocupa, lo es el informe que emitiera el Área de Conservación Pacífico Central, Subregión Puriscal del Sistema Nacional de Áreas de Conservación (SINAC), el cual se dio ante el pedido expreso que hiciera el Tribunal Ambiental con ocasión de la queja presentada y que es objeto en este proceso, ya que en sede administrativa se emitió la resolución N° 1608-09-TAA de las 9:30 horas del 10 de diciembre de 2009, mediante la cual se solicitó a la oficina subregional de Puriscal del SINAC la realización de una inspección y que se emitiera un informe de valoración económica del daño ambiental ocasionado (Folio 6 del expediente administrativo físico N° 380-09-02-TAA, e Imagen 233 del expediente judicial digital). Así, esa dependencia, el día 11 de agosto de 2010, presentó ante el Tribunal Ambiental lo pedido (imagen 203 del expediente judicial digital y folio 36 del expediente administrativo), informe elaborado por el ingeniero Ronald Mora Vargas, previa visita de campo realizada el día 9 de agosto de 2010, momento en el cual se midió la longitud del talud de donde la municipalidad había retirado el material.

Con esa información el informe se ciñó a determinar la valoración económica del daño ambiental, para lo cual se establecieron valores de uso directo, de opción, y de existencia, con lo que se determinó un costo inicial del movimiento de suelo en el sitio con un resultado del monto de ¢4.802.000 colones, al cual se le agregaron los porcentajes adicionales por elemento afectado de acuerdo a una matriz, evaluando los de erosión, drenaje, remoción respecto del suelo, y el impacto del método de extracción, justificándose cada uno de los montos y porcentajes que arrojó el estudio en cada uno de esos elementos, con lo cual se arribó al monto final de 9.604.000 colones. Debe indicarse que dicho monto fue el que aplicó el Tribunal Ambiental en su resolución N° 655-13-TAA de las 11:52 horas del 11 de agosto de 2014, cuando declaró autora del daño ambiental a la Municipalidad de Mora y le impuso el pago de ese rubro de valoración realizado por el SINAC y que posterior a la resolución del recurso de revocatoria planteado contra aquella resolución, en la N° 004-2015-TAA de las 14:30 horas del 13 de enero de 2015, se confirmó y se mantuvo lo dispuesto.

Ahora bien, en la demanda lo que se aduce en contra de dicho informe es: - la falta de idoneidad del profesional que lo elaboró por ser un ingeniero Forestal; - la falta de rigor técnico para determinar la cantidad del material extraído; y - que se omitieron variables para la determinación del daño ambiental. Además, y como complemento de ello, en las conclusiones de la parte actora se adujo que la cantidad de material extraído había sido de quinientos metros cúbicos y no los tres mil cuatrocientos treinta que se indicaron en ese informe, además del argumento de la falta de capacidad de transporte del ayuntamiento para manejar dicha cantidad de material, lo anterior ligado a la declaración realizada por el Ingeniero Alonso Mora Arroyo, funcionario municipal, en la audiencia oral en sede administrativa, en la cual hizo referencia a que lo intervenido en caminos fue de seis kilómetros a un promedio de seis metros de ancho en un área de lastreado de 33 mil metros llegando a utilizar en ello alrededor de 500 metros cuadrados.

En cuanto a estos argumentos, se debe indicar respecto de la inidoneidad del ingeniero forestal que realizó dicho informe, no se hace más que esa mención, sin probar técnicamente que un profesional en ese ramo estaría imposibilitado de realizarlo, por lo que, ese ataque, en la forma esgrimida, no puede ser de recibo, ni tampoco alcanzaría para la nulidad que se pretende. En cuanto a la capacidad instalada de la Municipalidad y la cantidad de metros cúbicos que dice el ayuntamiento usó, lo cierto es que, como se indicó en el considerando anterior, cuando se analizaron estos mismos alegatos, la municipalidad no probó fehacientemente su capacidad instalada de transporte, pese a que se trataba de su argumento. Además, con las manifestaciones de su testigo rendidas ante el Tribunal Ambiental, más bien se reafirma la actuación achacada a la municipalidad para la cual no contó con los permisos necesarios.

Ni tampoco, de forma técnica, ha desvirtuado la cantidad de material que indica el informe que ahora se analiza, ya que, aun partiendo de que lo indicado por el funcionario municipal en la audiencia oral administrativa fuese cierto, la cantidad de material mencionado solo concuerda con la que ha admitido el ayuntamiento, pero, se insiste, sin desvirtuar la indicada en el informe de valoración del daño ambiental. Por otra parte, se alega falta de rigor técnico y que se omitieron variables en el informe impugnado, sin que para ello se determinaran a cuáles se referían. Ahora bien, en la Audiencia Preliminar celebrada el veintisiete de junio de dos mil dieciséis (Imagen 369 del expediente judicial digital), fue admitido por la jueza tramitadora de este despacho, la petición de la parte actora del nombramiento de un perito geólogo para que: "...realice un informe conforme a al (sic) pretensión N° 4, detallada anteriormente, con la documentación que consta en el expediente", determinación con la cual la parte actora representada por su apoderado especial judicial en dicho acto estuvo conforme.

Hay que recordar que en esa misma audiencia, la parte actora modificó sus pretensiones, y como numerada cuarta se determinó: "4) Se establezca la cuantificación real de los daños ambientales causados por la Municipalidad, mediante informe que lleve a cabo un perito idóneo, ello por la solicitud de la nulidad del informe ACOPAC OSPR-535-10." (El subrayado no es del original). De lo cual se extrae que como parte de las probanzas que consideró la municipalidad necesarias para dar sustento a su modificada pretensión y tipo de proceso, debía contar con un peritaje que estableciera la "cuantificación real de los daños ambientales" haciendo referencia al informe que se ha pedido anular y que en este apartado de la presente sentencia estamos analizando. Luego del nombramiento del perito Nombre113634 (ver resolución de las 11:34 horas del 1 de agosto de 2016 visible a imagen 375 del expediente judicial digital), dicho profesional presentó al despacho su "Informe Pericial Geológico" (imagen 390 del expediente judicial digital), del cual se dio audiencia a las partes en resolución de las 15:44 horas del once de octubre de dos mil dieciséis (Imagen 420 del expediente judicial), siendo la representación del Estado la que se refirió al mismo en escrito de imagen 462 formulando su oposición.

Posteriormente, la representación de la Municipalidad actora realizó manifestaciones respecto de su prueba pericial, en especial aludiendo a que la misma no se había realizado conforme a lo admitido (Imagen 485 del expediente judicial), razón por la cual el asunto fue regresado a la etapa de trámite para que la jueza correspondiente resolviera al respecto, la que en resolución de las 10:43 horas del 9 de mayo de dos mil dieciocho, le ordenó al perito reformular su informe para que el mismo cumpliera con lo ordenado en la Audiencia Preliminar (Imagen 493 del expediente judicial). Siendo que el perito presentó su nuevo informe visible a partir de la imagen 503 del expediente judicial digital, también denominado "Informe Pericial Geológico" nótese que en ese sentido, el título escogido en ambos peritajes, no reflejaba en sí lo pedido y admitido. Ahora, analizado su contenido, el perito geólogo básicamente lo que hizo fue estudiar y referirse a los aspectos que consideró no estaban bien del Informe del SINAC, sea que, ese peritaje se centró a un estudio y reproche de aquél informe, ya que incluso concluyó que ese era poco preciso, indicando que la metodología usada si bien no era incorrecta, el error radicaba en los factores evaluados e indicó que: "...La estimación del daño ecológico (Ing.

Mora, informe ACOPAC-OSRP-535-10) no se considera acertada en términos de la evaluación realizada, por lo tanto se recomienda desestimar dicho monto" y además manifestó que: "Dado que la solicitud de este peritaje indica que base (sic) solamente en la información del expediente y del informe ACOPAC-OSRP-535-10, no es posible dar un nuevo valor del daño ambiental utilizando la evaluación realizada por el Ing. Mora, debido a las inconsistencias del informe antes citado", asimismo realizó ciertas recomendaciones que él consideró debían ser tomadas en cuenta para poder evaluar los hechos y establecer una nueva valoración del daño ambiental. Debido a lo anterior, este Tribunal considera que el perito nunca entendió el objeto y fin de la pericia que se le asignó, ya que, desde un inicio, si tenía alguna duda debió consultar, pero lo que hizo fue atacar el informe del SINAC en ambas pericias (Original y la reformulación pedida), tanto que, de su contenido se extrae que su norte fue siempre la de determinar las "falencias o errores" del otro informe, sin enfocarse en lo que realmente debía realizar, sea la cuantificación real de los daños ambientales en el presente caso, ello ligado a que la misma municipalidad, aun en esta demanda, ha aceptado que ellos extrajeron y usaron el material, pero no en la cantidad que se indica en el informe del SINAC y que fuese usado para imponerle la sanción por el daño ambiental determinado en sede administrativa.

Así las cosas, si la parte actora, ante el cambio de giro de su demanda original, sea de un proceso de lesividad a uno de conocimiento de nulidad, al establecer sus nuevas pretensiones y querer un peritaje que sirviera a sus fines, debió pedir claramente un análisis del contenido del informe del SINAC y no la determinación de una nueva valoración del daño ambiental, que fue lo admitido y no logrado mediante la pericia recibida. Situación por la cual, el peritaje que ahora se analiza como parte de la prueba allegada a este proceso, no cumplió su cometido, por lo que tampoco llevaría a la nulidad que se pretende, pues a lo sumo, lo que se denota del contenido del mismo es una discrepancia de criterios entre profesionales, sin que se haya determinado, que no era su fin, motivos para la nulidad del informe adjunto al oficio N° ACOPAC-OSRP-535-10.

X.Colofón. Por todo lo expuesto en los considerandos de fondo de esta sentencia, a criterio de este Colegio, ni con la prueba pericial, ni con los alegatos esgrimidos, se puede determinar la nulidad de las tres actuaciones que se contemplan como objeto del presente proceso, ni la determinación de una cuantificación real de los daños ambientales. Por lo cual, la demanda debe ser declarada sin lugar en todos sus extremos .

XI.Análisis de las defensas opuestas. La representación de Estado formuló las defensa de falta de Derecho, la cual debe acogerse debido a todo lo expresado y resuelto en los considerandos precedentes.

XII.Costas. De conformidad con el numeral 193 del Código Procesal Contencioso Administrativo, las costas procesales y personales constituyen una carga que se impone a la parte vencida por el hecho de serlo. La dispensa de esta condena solo es viable cuando hubiere, a juicio del Tribunal, motivo suficiente para litigar o bien, cuando la sentencia se dicte en virtud de pruebas cuya existencia desconociera la parte contraria. En la especie, estima este Tribunal, no se verifica ninguna eximente, por lo que debe condenarse a la parte actora al pago de ambas costas así como los eventuales intereses que pudieren generarse sobre las mismas, una vez que sean determinados y exigibles sus montos.

POR TANTO.

Se acoge la defensa de Falta de Derecho. Se declara SIN LUGAR la demanda incoada por la Municipalidad de Mora contra el Estado. Son ambas costas de esta acción a cargo de la actora, así como los eventuales intereses que pudieren generarse sobre las mismas, una vez que sean determinados y exigibles sus montos. Notifíquese.
