I.ON THE DOCUMENTARY EVIDENCE FOR BETTER ADJUDICATION (PRUEBA DOCUMENTAL PARA MEJOR RESOLVER) OFFERED BY THE PLAINTIFF BEFORE THE EVIDENTIARY HEARING (AUDIENCIA DE EVACUACIÓN DE PRUEBA) WAS HELD. Before setting forth the proven facts (hechos probados), unproven facts (hechos no probados), and substantive analysis of this matter, this Court must rule on the documentary evidence for better adjudication offered by counsel (apoderado) for the plaintiff one day before the mixed-format evidentiary hearing was held (images 13 to 17 of the document received on 03-11-2020, available in the pleadings folder of the virtual case file). That evidentiary submission consists of several “LEED Certifications” granted to Condominio Vertical Comercial Plaza Roble III, documents drafted in English. In this regard, this Court considers that, pursuant to Articles 24.1 of the Código Procesal Civil and 110, 148, and 220 of the Código Procesal Contencioso Administrativo, the documentary evidence for better adjudication offered by the plaintiff should not be admitted for the following reasons:
The following facts relevant to these proceedings are deemed duly established:
Nombre113486, an official of the Dirección de Agua, confirmed that the wells (pozos) had been sealed as ordered in the challenged resolution, and the order to seal the wells is deemed complied with..." (folios 317 to 324 of file II of administrative expediente 16098-P submitted on compact disc); 20) That Condominio Vertical Comercial Plaza Roble III has implemented a water-resource management program (programa de gestión del recurso hídrico) aimed at achieving efficient water consumption, resulting in savings in the number of cubic meters used for various purposes, and comprising the implementation of a series of systems, practices, or measures, such as: an absorption-well project (proyecto de pozos de absorción) for aquifer recharge (recarga del acuífero); replacement of flushometer urinals with waterless urinals; collection of rainwater and condensate from the Terrazas A and B and Pórtico buildings; installation of low-water-consumption sanitary fixtures throughout the condominium; and a water-harvesting system (sistema de cosecha de agua) in the Pórtico building to supply the sanitary fixtures in the Patio building (digital recording of the statement of expert witness Nombre113485, given at the mixed-format evidentiary hearing (audiencia de evacuación de prueba) of 04-11-2020, available in the associated-documents folder of the electronic case file; images 61 to 63, 65 to 75, 77 to 80, 82 to 94, 97 to 107 of the electronic case file as of the date this judgment was issued); 21) That Condominio Vertical Comercial Plaza Roble III has obtained the Bandera Azul Ecológica and ISO 14001-2004 certification for the results achieved in the various areas covered by its environmental management program (programa de gestión ambiental) (images 44 to 56 of the electronic case file as of the date this judgment was issued).
For purposes of these proceedings, the following relevant fact is deemed not proven: a) That, in the final administrative decision (acto definitivo), the Minister of Environment and Energy addressed whether the fact that, since 2006, the plaintiff company had implemented a stormwater (aguas pluviales) collection system and soakaway wells (pozos de absorción) for aquifer recharge (recarga del acuífero) could have any effect on the conservation, protection, restoration, and sustainable use of the water resource (recurso hídrico) sought to be drawn from well AB-2313, which aquifer is allegedly to be exploited, even though this was one of the arguments raised by the plaintiff in the motion for reconsideration (recurso de reposición) filed against the final decision (acto final) denying its concession application (solicitud de concesión) (this is not apparent from the document appearing at folios 317 to 324 of volume II of administrative record (expediente administrativo) 16098-P, submitted on compact disc).-
The plaintiff contends:
This Court considers the following: A) First, it is necessary to determine whether, pursuant to the amendment of the concession application submitted by the plaintiff company in a filing dated 25 de abril del 2013, for the use of well AB-2123 for garden irrigation, an internal fire-protection system, and an office cooling system (folios 178 to 184 of volume 1 of the administrative record provided on compact disc), the application falls within the factual circumstances contemplated in Articles 1 through 5 of Executive Decree number 35271-MINAE (Regulations Governing Drilling Permits and Water Concessions for Self-Supply in Condominiums, in force since 02 de junio del 2009). In that regard, those provisions establish the following: “... Article 1—Purpose and scope. The purpose of these regulations is to establish the guidelines to be followed in obtaining a drilling permit and/or water concession for self-supply in a condominium.
Article 2—Scope of application. The provisions herein shall apply only to condominiums located in areas where no public drinking-water supply is available, as established by a water-availability letter issued by the Instituto Costarricense de Acueductos y Alcantarillados or by another authorized public-service provider. Article 3—Definitions: Self-supply (autoabastecimiento): Self-supply means the distribution of water for human consumption within a condominium. Condominium (condominio): For purposes of proceedings before the Departamento de Aguas del Ministerio de Ambiente y Energía (*), condominium shall mean, under this decree, real property capable of independent use by different owners and having indivisible common elements, as well as any other type of condominium defined in the Reglamento a la Ley Reguladora de la Propiedad en Condominio, Decreto Nº 32303-MIVAH-MEIC-TUR. Article 4—Procedure.
Applications for a drilling permit and/or water concession for the self-supply of water for human consumption in condominiums must comply with the current requirements of the general drilling procedure established by Decreto Ejecutivo Nº 30387-MINAE-MAG and with the concession requirements established by Ley de Aguas Nº 276. In addition, a letter stating that water is unavailable, issued by the Instituto Costarricense de Acueductos y Alcantarillados or another authorized public-service provider, must be submitted. Proceedings for subsurface drilling and/or a water concession shall be conducted in accordance with the regulations cited in this article. Article 5—Termination of the concession. Pursuant to Article 25, subsection 2, of the Ley de Aguas, the water-use concession (concesión de aprovechamiento de agua) shall terminate when public operators are able to supply drinking water directly to the concession holder and the service is actually connected, in addition to the other grounds currently in force for terminating a concession...” (underlining not in the original).
This collegiate body considers that, pursuant to the provisions transcribed above, a concession for the use of water in condominiums shall be denied when the drinking-water service for human consumption is supplied through a water-supply and sewerage system by the competent service provider (namely, Nombre5630, ASADAS, or other authorized providers). Conversely, applications for concessions for the use of water in condominiums for self-supply for uses that do not involve human consumption of drinking water are not governed by Decreto 35271-MINAE, but by the Ley de Aguas, pursuant to Article 176 et seq. of that body of law. B) The foregoing is consistent with Article 14 of Executive Decree number 35884-MINAET (Regulations Governing Subsurface Drilling for the Exploration and Use of Groundwater, in force since 07 de mayo del 2010), which provides: “...Subsurface drilling for the use of groundwater shall not be authorized when the intended use is for population supply and such supply can be provided by a public water-supply and sewerage service provider offering that service.
For drilling to be authorized, a letter must be submitted from the entity providing service in the area where the property is located, stating either that there is no technical possibility of supplying the property where the water will be used or that the entity undertakes to assume control of the well for its use and water supply...” (emphasis not in the original). Although it is true that, on 16 de junio del 2004, the date on which the plaintiff company was granted a permit to drill well AB-2313 by resolution number IMN-DA-2004 (folios 128 and 129 of volume 1 of administrative record 16098P provided on compact disc), Executive Decrees number 35271-MINAE and 35884-MINAET had not yet entered into force, and notwithstanding that the property on which that well is located (property-record predecessor 100519045-000) had not yet been registered under the condominium regime, which occurred on 28 de agosto el 2008 (folio 93 of volume 1 of administrative record 16098P provided on compact disc); it is also true that the operative portion of resolution number IMN-DA-2004 of 16 de junio del 2004, issued by the Head of the Departamento de Aguas del Instituto Meteorológico Nacional del Ministerio de Ambiente y Energía, states: “...Drilling is authorized on the understanding that, once water is extracted, it will be used for domestic purposes and irrigation (...) Parque Central, S.A. must be informed that the permit authorizes drilling only, since use of the water requires an application for the corresponding water-use concession, as stipulated by the legislation in force...” (folios 128 and 129 of volume 1 of administrative record 16098P provided on compact disc).
This is supported by Article 35 of the Ley de Aguas itself, which provides that non-potable water—not suitable for human consumption—may be used for other public or domestic purposes, including irrigation or other needs of residents that do not require drinking water, such as washing automobiles, cooling systems, among others; C) At this point it must be emphasized that, pursuant to Articles 27, 35, and 37 of the Ley de Aguas, domestic uses, including irrigation or other uses (such as, in this case, the internal fire-protection system and the office cooling system), do not require a drinking-water supply system, with drinking water defined as: “...Treated water that complies with the maximum permissible aesthetic, organoleptic, physical, chemical, biological, microbiological, and radiological values established in these regulations and that, when consumed by the population, does not harm health...” (Article 4, subsection a, of Decreto Ejecutivo 38924-S—Reglamento para la Calidad del Agua Potable—).
This differs from the priority use that the Ley de Aguas calls a water-supply system for communities—or population use under Executive Decree number 35884-MINAET—in which water sources are used for human consumption; therefore, the safety and health of the population must be guaranteed through compliance with the maximum permissible limits for the physical, chemical, and microbiological parameters of drinking water. This is because, pursuant to Article 50 of the Constitución Política; Articles 50 through 52 of the Ley Orgánica del Ambiente; and Pillars 3 and 4 of the Política Nacional de Agua Potable for the period from 2017 to 2030, the criteria of conservation, protection, restoration, and sustainable use of water must prevail both in deciding whether to grant concessions for the use of this resource and in operating and administering drinking-water systems. D) In the present case, this Court considers that the challenged administrative acts, by which the application to use well AB-2313 for garden irrigation, an internal fire-protection system, and office cooling—submitted by the plaintiff company in its capacity as administrator of Condominio Plaza Roble—was denied and that decision was upheld, are contrary to Article 133, subsection 1), of the Ley General de la Administración Pública because the grounds (motivo) are unlawful.
This is because Articles 1 through 5 of Executive Decree number 35271-MINAE do not apply in this case; rather, the Ley de Aguas applies pursuant to Article 176 et seq. of that body of law, since, as shown by the amendment to the concession application for the use of well AB-2313 submitted by the plaintiff company in a filing dated 25 de abril del 2013, the requested uses—again, garden irrigation, an internal fire-protection system, and office cooling (folios 178 to 184 of volume 1 of administrative record 16098-P provided on compact disc)—do not require drinking water because they are not intended for human consumption. Accordingly, it was unnecessary to submit a letter stating that water was unavailable, issued by the service provider—in this case, AYA—as the plaintiff company was directed to do during the admissibility stage on 18 de marzo del 2013 (folios 175 and 176 of volume I of administrative record 16098-P provided on compact disc), to which the plaintiff responded in a filing dated 25 de abril del 2013, specifying that the water would be used solely for the aforementioned purposes, which did not require drinking water because they were not intended for human consumption (folios 178 to 184 of volume 1 of administrative record 16098-P provided on compact disc).
Indeed, the Dirección de Aguas not only admitted the concession application on 09 de enero del 2014 and assigned it expediente number 16098-P (folio 208 of volume I of administrative record 16098-P provided on compact disc), given that the project even had environmental approval (viabilidad ambiental) from the Secretaría Técnica Nacional Ambiental (SETENA)—folios 201 to 206 of volume I of administrative record 16098-P provided on compact disc—but also, in Technical Report on Application for a Groundwater Concession number AT-1038-2015, issued on 27 de marzo del 2015 by the Dirección de Agua del MINAE, recommended granting Condominio Plaza Roble a concession for well AB-2313 for the following uses and flow rates: i) cooling system, with an allocated flow rate of 0.01 liters per second; ii) fire-protection system, with an allocated flow rate of 0.01 liters per second; and iii) irrigation, with an allocated flow rate of 0.02 liters per second, for a total of 0.04, with an extraction schedule of 18 hours per day throughout the year for the internal fire-protection and office cooling systems, and 2 hours per day from December through June for irrigation.
In that regard, it stated: “...Comments: The recommended flow rate does not exceed either the requested flow rate or the flow rate recommended by SETENA. OBSERVATIONS: IN VIEW OF THE FACT THAT THE LEGAL REPRESENTATIVE OF CONDOMINIO VERTICAL COMERCIAL PLAZA ROBLE III, S.A.
MR. LUIS ARMANDO FLORES AGUIRRE APPLIED FOR A LAND-USE CHANGE (CAMBIO DE USO), ACCORDING TO THE NOTE DATED APRIL 25 OF Placa20761, WHICH IS CONTAINED IN THE FILE, AND Nombre5630 MEETS THE REQUIREMENTS FOR HUMAN CONSUMPTION, OFFICE, AND SHOPPING CENTER USES, AND WELL AB-213 MORE THAN ADEQUATELY SUPPLIES THE CONDOMINIUM’S WATER DEMAND; THE UNDERSIGNED CONSIDERS THAT GRANTING THE CONCESSION (CONCESIÓN) FOR WELL AB-2429 IS UNNECESSARY FOR THE FOREGOING REASONS, AND THEREFORE IT SHOULD BE TAKEN OUT OF OPERATION..." (folio 222 of volume II of administrative expediente 16098-P, submitted on compact disc). Consequently, it is contrary to the principles of reasonableness and proportionality that, through official letter AL-130-2015 dated April 10, 2015, the Legal Counsel’s Office of the Dirección de Agua once again instructed the representative of the plaintiff company to submit a letter of water unavailability issued by the service provider—in this case, AYA—(folio 223 of volume II of administrative expediente 16098-P, submitted on compact disc), and that, in view of the response given by the plaintiff’s attorney-in-fact in a pleading filed on September 17, 2015, stating that "...Since the water from the well is not intended for human consumption, it having been demonstrated that it is required to meet other needs, Article 14 of the Reglamento de Perforación del Subsuelo para la Exploración y Aprovechamiento de Aguas Subterráneas does not apply.
In light of the foregoing, we request that the proceeding continue without requiring the letter from the public drinking-water service provider..." (folios 226 to 229 of volume II of administrative expediente 16098-P, submitted on compact disc), the Director of the Dirección de Agua proceeded to ask the Deputy General Manager of AYA, through official letter DA-1709-2015 dated October 15, 2015, the following: "...Given that human-consumption use is supplied by the entity you represent, I hereby ask whether the Instituto Costarricense de Acueductos y Alcantarillados has water availability and can supply the applicant for the additional uses cited above, information necessary to conclude the requested proceeding..." (folio 232 of volume II of administrative expediente 16098-P, submitted on compact disc). This is because, given the nature of the uses for which the proposed use (aprovechamiento) of well AB-2312 was intended, the requirement set forth in sections 2 and 4 of Decreto Ejecutivo number 35271-MINAE—concerning the letter of water unavailability—was inapplicable, since those uses do not require a drinking-water supply system such as that provided by AYA, as they were not intended for human consumption—which, in this latter circumstance, the Ley de Aguas calls "Cañería para Poblaciones" and Decreto Ejecutivo 35884-MINAET calls "Uso Poblacional"—pursuant to Articles 27, 35, and 37 of the Ley de Aguas.
Therefore, contrary to what the State’s representative asserts, the provisions of Articles 1 through 5 of Decreto Ejecutivo 35271-MINAE are not being derogated from in this specific case; rather, the concession application under review does not fall within the factual circumstances contemplated by those regulations, as analyzed supra; E) At this point, it must be emphasized that although, through official letter GG-2015-01930 dated November 18, 2015, the General Manager of Nombre5630 informed the Director of the Dirección de Agua that: "...the developer is inquiring about internal fire-protection systems, understood to mean those installed inside office buildings, in which case the Institute is capable of supplying water not only for that system but also for the office cooling and garden-irrigation systems requested by the interested party, since these are uses that, in our view, fall within the concept of ‘domestic.’ It should be noted that this is not irrigation use for agricultural purposes, and therefore the flow-rate demand is not significant and falls within the Institute’s capabilities and sphere of action.
Based on these observations, the inquiry is deemed answered, and it is stated that the Institute can supply the demand for the additional uses required, since it has availability in the area, as stated by the UEN de Optimización de Sistemas AM in its official letter SB-GSGAM-OS-2015-0167..." (folios 236 to 238 of volume II of administrative expediente 16098-P, submitted on compact disc); it is also true that this document classifies the uses requested by the plaintiff as "domestic uses," which, under Articles 27, 35, and 37 of the Ley de Aguas, do not require drinking-water service because they are not intended for human consumption, especially in this case, where the water is intended for garden irrigation, an internal fire-protection system, and an office cooling system. The foregoing is relevant to this specific case because, contrary to what is maintained in the final administrative act, the results of the inquiries submitted to Nombre5630 are of "mandatory compliance" when they concern the provision of drinking-water service through the aqueduct system, since this constitutes one of that Institute’s exclusive powers pursuant to Article 2(a), (b), and (d) of the Ley Constitutiva del Nombre5630 (Ley number 2627).
Nevertheless, in this case, the application for a concession to use well AB-2313 is unrelated to uses requiring drinking-water service because they are not intended for human consumption; therefore, at least with respect to Nombre5630’s authority to provide drinking-water service through the aqueduct system, the statements in official letter GG-2015-01930 dated November 18, 2015 were not of "mandatory compliance" for MINAE. Moreover, from a technical standpoint, it is contradictory to classify the uses requested by the plaintiff company—irrigation, an internal fire-protection system, and office cooling—as domestic uses and supply them with drinking water, even though they do not entail human consumption of drinking water, contrary to Articles 27, 35, and 37 of the Ley de Aguas; 2 and 3 of Decreto Ejecutivo 35271-MINAE; 14 of Decreto Ejecutivo 35884-MINAET; and 51 and 52(c) of the Ley Orgánica del Ambiente.
This is further aggravated by the fact that the operative part of resolution number IMN-DA-2004 dated June 16, 2004, issued by the Head of the Departamento de Aguas of the Instituto Meteorológico Nacional del Ministerio de Ambiente y Energía, states that "...Drilling is authorized on the understanding that, once water is extracted, it will be used for domestic purposes and irrigation (...) Parque Central, S.A. must be informed that the permit is solely for drilling, since use of the water requires an application for the corresponding use concession, as stipulated in the legislation in force..." (folios 128 and 129 of volume 1 of administrative expediente 16098-P, submitted on compact disc). F) For all the foregoing reasons, this Court finds that resolutions number R-0434-2016-AGUAS-MINAE of 14:35 hours on May 16, 2016, which denied the application for a concession to use well AB-2313, and R-252-2017-MINAE of 14:10 hours on July 04, 2017, which denied the motion for reconsideration (recurso de reposición) and declared the administrative remedies exhausted (agotada la vía administrativa), are vitiated by absolute nullity (nulidad absoluta) in their essential elements of grounds, content, and purpose, because MINAE denied the application for a concession to use well AB-2313 on illegitimate grounds, given that, for the reasons analyzed in the preceding sections of this recital (considerando), Articles 2 and 4 of Decreto Ejecutivo 35271-MINAE were inapplicable to this specific case, since the uses for which the concession to use well AB-2313 was requested were not for human consumption and therefore did not require the drinking-water service provided by the Instituto de Acueductos y Alcantarillados.
This circumstance affects the purpose element of the challenged formal administrative actions, since supplying drinking water for uses that do not require it because they are not intended for human consumption—the factual circumstances governed by sections 2 and 4 of Decreto Ejecutivo 35271-MINAE and 14 of Decreto Ejecutivo number 35884-MINAET—is contrary to the principles of conservation, protection, recovery, and sustainability that must govern the management of water resources (Articles 50 through 52 of the Ley Orgánica del Ambiente and pillars 3 and 4 of the Política Nacional de Agua Potable for the period from 2017 to 2030). Consequently, resolutions R-0434-2016-AGUAS-MINAE of 14:35 hours on May 16, 2016 and R-252-2017-MINAE of 14:10 hours on July 04, 2017, issued by the Ministro de Ambiente y Energía, are declared absolutely null because they are contrary to Article 50 of the Constitución Política; Articles 50 through 52 of the Ley Orgánica del Ambiente; Articles 27, 35, 37, 176 et seq. of the Ley de Aguas; Article 2(a), (b), and (d) of the Ley Constitutiva del AYA; Articles 131, 132, and 133 of the Ley General de la Administración Pública; Articles 1 through 5 of Decreto Ejecutivo 35271-MINAE; and Article 14 of Decreto Ejecutivo number 35884-MINAET.
In view of the manner in which the matter is decided, no ruling is made on the plaintiff’s remaining arguments in support of the claim for absolute nullity, concerning the duration of the proceeding and excessive procedural requirements. Now, pursuant to Article 131(3) of the Código Procesal Contencioso Administrativo, the declaration of absolute nullity of resolutions number R-0434-2016-AGUAS-MINAE and R-252-2017-MINAE shall have ex nunc effect, so as to keep wells AB-2313 and Placa20764 sealed until the Ministerio de Ambiente y Energía decides the application for a concession to use them in accordance with law, under the terms to be stated in the following recital of this judgment.
As an initial matter, it should be noted that, at the preliminary hearing held on 08 March 2019, claim 2 of the complaint was amended and established as follows: “...2. That MINAE be ordered to issue the water concession (concesión de aguas) for well AB-2313. In the alternative, should the Court deny the foregoing request, it is requested that MINAE be ordered to assess my client’s concession application, taking into account the grounds asserted in this complaint in support of the request to annul the specified acts. In both cases, they request that the Court establish a reasonable maximum period for compliance with the order...” (see image 1142 of the virtual case file as of the date this judgment was rendered and the digital recording of the preliminary hearing of 08-03-2019, in the associated-documents folder of the virtual case file). This Court finds that determining whether it is appropriate to grant the plaintiff company the concession to use well AB-2313 entails not only a legal analysis, such as that conducted in the preceding recital (considerando), but also a technical study to establish whether the requested use will affect the groundwater (aguas subterráneas), because the conservation, protection, replenishment, and sustainable use of water resources constitute criteria that must be applied when granting concessions and permits to use any component of the water regime (régimen hídrico), pursuant to the subsection of Article 52 of the Ley Orgánica del Ambiente and pillars 3 and 4 of the Política Nacional de Agua Potable for the period from 2017 to 2030.
This is all the more pertinent in this specific case because, according to “...report N° 4182, dated 09 September 2004, prepared by Laboratorio BIOTROL, the analyzed water samples from well AB-2313, owned by Parque Central, S.A. and located in San Rafael de Escazú, are suitable for human consumption (...) Report N° 1009-2004 from Laboratorio AQYLASA states that, based on the physicochemical parameters analyzed in the water sample from well AB-2313, owned by Parque Central S.A., it complies with the values recommended by the drinking-water quality regulations...” (folios 118 to 127 and 136 to 137 of volume I of administrative case file 16098-P submitted on compact disc; emphasis not in the original). Moreover, because the subject matter of the proceeding has centered on legal issues—specifically, whether the uses requested by the plaintiff company for well AB-2313 fall within the factual circumstances governed by Articles 1 to 5 of Decreto Ejecutivo 35271-MINAE, concerning self-supply of drinking water for human consumption in condominiums—this adjudicatory panel finds that granting principal claim number 2 would place the defendant in a clear state of defenselessness (indefensión), since its defense has not addressed the technical matters relating to the conservation, protection, recovery, and sustainable use of the groundwater sought to be used.
Furthermore, although it has been established that Condominio Vertical Comercial Plaza Roble III has implemented a water-resource management program intended to achieve efficient water consumption and reduce the number of cubic meters used for various purposes, comprising the implementation of a series of systems, practices, or measures, such as: an absorption-well project to recharge the Pacacua aquifer; replacement of flushometer urinals with waterless urinals; collection of rainwater and condensation from the Terrazas A and B and Pórtico buildings; installation of low-water-consumption sanitary fixtures throughout the condominium; and a water-harvesting system in the Pórtico building to supply the sanitary fixtures in the Patio building (digital recording of the testimony of expert witness (testigo perito) Nombre113485, given at the mixed-format evidentiary hearing on 04-11-2020, available in the associated-documents folder of the virtual case file; images 61 to 63, 65 to 75, 77 to 80, 82 to 94, and 97 to 107 of the virtual case file as of the date this judgment was rendered), and although it has even obtained the Bandera Azul Ecológica and ISO 14001-2004 certification for the results achieved in the various areas covered by its environmental-management program (images 44 to 56 of the virtual case file as of the date this judgment was rendered), it is also true that, while these matters formed part of the arguments on which the plaintiff based the motion for reconsideration (recurso de reposición) that it filed against the final act (folios 242 to 251 of volume II of administrative case file 16098-P submitted on compact disc), MINAE did not address them in the definitive act (as is not apparent from folios 317 to 324 of volume II of administrative case file 16098-P submitted on compact disc).
This was so even though, at 09:00 hours on 11 May 2017, two attorneys from MINAE’s Legal Department appeared to conduct an inspection at Dirección13845, at which time two engineering professionals from that condominium showed the MINAE officials—among other things—the rainwater collection system and absorption tanks (folio 310 of volume II of administrative case file 16098-P submitted on compact disc). Consequently, in deciding the concession application for the use of well AB-2313 for garden irrigation, the internal fire-suppression system, and the office cooling system, MINAE must consider not only the legal aspects concerning the fact that the circumstances of this case do not fall within the factual scenario contemplated in Sections 1 to 5 of Decreto Ejecutivo número 35271-MINAE, and must decide the concession application in accordance with Section 176 et seq. of the Ley de Aguas, but also the technical matters relating to the conservation, protection, recovery, and sustainable use of the groundwater sought to be used, namely: i) Whether the Pacacua aquifer is the aquifer intended to be exploited through the extraction of water from well AB-2313; ii) Whether the infiltration system implemented by the plaintiff beginning in 2006 is capable of recharging the aquifer within a period sufficient to offset the requested flow rate, in liters per second, for each of the intended uses; iii) Whether operation of that infiltration system poses a risk of contaminating the aquifer.
It should be recalled that, for this purpose and pursuant to subsections III and VIII of Article 181 of the Ley de Aguas, MINAE may order the admission of expert evidence (prueba pericial) concerning matters requiring specialized knowledge or may, on its own motion or at a party’s request, order the admission of new evidence or the expansion of evidence already taken, through an administrative or judicial official commissioned for that purpose, or through the same Inspector de Aguas who conducted the visual inspection (inspección ocular). This is also without prejudice to the fact that, under subsections c) and d) of Section 2 of the Ley Constitutiva del Instituto de Acueductos y Alcantarillados, MINAE must consult the competent authority of that entity regarding matters related to controlling contamination of the waters sought to be used, which is another of the powers assigned to that entity by the legislature.
Lastly, MINAE must issue a reasoned final decision (resolución final motivada) on the concession application for the use of well AB-2313 for garden irrigation, the internal fire-suppression system, and the office cooling system at Condominio Vertical Comercial Plaza Roble III within three months after this judgment becomes final, taking into consideration the legal and technical parameters established in this recital. It must therefore inform the judge presiding over the Judgment Enforcement Phase (Fase de Ejecución de Sentencias) of this Court that it has complied with the order set forth in this ruling and must submit a copy of the decision issued. For all the foregoing reasons, principal claim number 2 is denied, and the subsidiary claim is granted on the terms stated above.
As an initial matter, this Court finds that the complaint was filed by the company administering Condominio Vertical Comercial Plaza Roble III, which applied for a concession to use well AB-2313 and whose application was denied by the Ministerio de Ambiente y Energía through the formal acts whose lawfulness is challenged in this proceeding. Accordingly, active and passive standing (legitimación activa y pasiva) are supported by Sections 10.1.a and 12.1 of the Código Procesal Contencioso Administrativo. The interest also remains current insofar as the challenged actions continue to produce effects within the plaintiff’s legal sphere and require a judicial decision resolving them. This adjudicatory panel further finds that, for all the reasons stated in recital VI (in part) of this judgment, the defense of lack of legal entitlement (excepción de falta de derecho) is granted solely with respect to ordering MINAE to grant the plaintiff company the concession to use well AB-2313 and, failing that, to assess the concession application in accordance with the arguments raised in the complaint.
Consequently, and for the reasons stated in recitals V and VI (in part) of this judgment, the defense of lack of legal entitlement is denied as to the remaining issues and, accordingly, the complaint filed by Parque Central, S.A. against the State is partially granted on the following terms, with any relief not expressly specified deemed denied:
Pursuant to section 193 of the Administrative Litigation Procedural Code (Código Procesal Contencioso Administrativo), court costs (costas procesales) and attorney fees (costas personales) constitute a burden imposed upon the losing party by virtue of having lost. Exemption from this award is warranted only when, in the Court’s judgment, there was sufficient reason to litigate or when the judgment is rendered on the basis of evidence whose existence was unknown to the opposing party. In this case, this panel finds no reason to apply the exceptions established by the applicable rules and depart from the principle that costs shall be awarded against the losing party. Accordingly, both categories of costs are imposed upon the defendant, and their amounts shall be determined during the judgment-enforcement phase (fase de ejecución de sentencia).
POR TANTO.
The documentary evidence offered for purposes of further adjudication (prueba documental para mejor resolver) by the representative of the plaintiff company is rejected. The defense of lack of legal entitlement (excepción de falta de derecho) is granted solely with respect to ordering the Minister of Environment and Energy either to grant the plaintiff company the concession for use (concesión de aprovechamiento) of well AB-2313 or, alternatively, to evaluate the concession application in accordance with the arguments raised in the complaint. Consequently, the defense is rejected as to all remaining claims, and the action filed by Parque Central, S.A. against the State is partially granted on the following terms, with any relief not expressly specified herein deemed denied:

Goicoechea, a las siete horas cuarenta y cinco minutos del veinticinco de noviembre del dos mil veinte.- Proceso de conocimiento interpuesto por PARQUE CENTRAL, S.A., cédula CED48524, cuyos Apoderados Especiales Judiciales son Nombre18248 , cédula de identidad número CED89768, Nombre21934 , cédula de identidad CED2804 y Raúl Guevara Villalobos, cédula número CED89769 (imágenes 268 a 270 del expediente virtual a la fecha de dictado de esta sentencia); contra EL ESTADO, cuya representante es la Procuradora Mariamalia Murillo Kopper, cédula número CED2530 (imagen 344 del expediente virtual a la fecha de dictado de esta sentencia).-
RESULTANDO:
Redacta la jueza Álvarez Molina, con el voto afirmativo de la jueza Sánchez Navarro y el juez Mena García; y,
CONSIDERANDO:
Io.- SOBRE LA PRUEBA DOCUMENTAL PARA MEJOR RESOLVER OFRECIDA POR LA ACTORA ANTES DE QUE SE CELEBRARA LA AUDIENCIA DE EVACUACIÓN DE PRUEBA. Previo al elenco de hechos probados, no probados y el análisis de fondo de este asunto, este Tribunal debe pronunciarse sobre la prueba documental para mejor resolver que ofreció el apoderado de la parte actora, un día antes de la realización de la audiencia de evacuación de prueba en modalidad mixta (imágenes 13 a 17 del documento recibido el 03-11-2020, visible en la carpeta de escritos del expediente virtual). Que dicho ofrecimiento probatorio, consiste en varias "Certificaciones Leed" otorgadas al Condominio Vertical Comercial Plaza Roble III, documentos que están redactados en idioma inglés. En ese sentido, este Tribunal considera que de acuerdo a lo establecido en los artículos 24.1 del Código Procesal Civil, 110, 148 y 220 del Código Procesal Contencioso Administrativo, la prueba documental ofrecida para mejor resolver por la demandante, no procede admitirse por las siguientes razones:
IIo.- HECHOS PROBADOS: Se tienen como debidamente acreditados los siguientes hechos que resultan relevantes para este proceso:
IIIo.- HECHO NO DEMOSTRADO: De relevancia para el presente proceso, se tiene por no demostrado el siguiente: a) Que en el acto definitivo, el Ministro de Ambiente y Energía se haya pronunciado sobre la incidencia que podría tener o no en la conservación, protección, recuperación y uso sostenible del recurso hídrico que se pretende aprovechar en el pozo AB-2313, el que la empresa demandante haya implementado desde el año 2006, un sistema colector de aguas pluviales y de pozos de absorción para la recarga del acuífero que presuntamente será objeto de explotación, a pesar de que fue uno de los alegatos que la demandante planteó en el recurso de reposición interpuesto contra el acto final en que se le denegó la solicitud de concesión (no se desprende del documento visible de folio 317 a 324 del legajo II del expediente administrativo 16098-P aportado en disco compacto).- IVo.- OBJETO DEL PROCESO. La parte actora sostiene:
Vo.- SOBRE LA ALEGADA NULIDAD DE LOS ACTOS ADMINISTRATIVOS R-0434-2016-AGUAS-MINAE Y R-252-2017-MINAE. Este Tribunal considera lo que de seguido se expone: A) En primera instancia, resulta necesario determinar si conforme a la modificación de la solicitud de concesión planteada por la empresa actora mediante escrito del 25 de abril del 2013, para el aprovechamiento del pozo AB-2123 en los usos de riego de jardines, sistema interno contra incendios y sistema de enfriamiento de oficinas (folios 178 a 184 del legajo 1 del expediente administrativo aportado en disco compacto), se adecua o no al supuesto de hecho previsto en los artículos 1 a 5 del Decreto Ejecutivo número 35271-MINAE (Reglamento para el Permiso de Perforación y Concesión de Agua para el Autoabastecimiento en Condominios, vigente desde el 02 de junio del 2009). En ese sentido, dichas normas establecen lo siguiente: "... Artículo 1º-Objetivo y alcance.
El objetivo del presente reglamento es fijar los lineamientos que se deben seguir para la obtención de un permiso de perforación y/o concesión de agua para el autoabastecimiento en condominio. Artículo 2º-Ámbito de aplicación. Lo aquí estipulado le será aplicable únicamente a aquellos condominios ubicados en zonas donde no hubiere abasto público de agua potable, determinado así por una carta de disponibilidad hídrica emitida por el Instituto Costarricense de Acueductos y Alcantarillados o por algún otro prestatario de servicio público autorizado. Artículo 3º-Definiciones: Autoabastecimiento: Se entiende por autoabastecimiento la distribución del agua para consumo humano dentro de un condominio. Condominio: Para efectos de trámites ante el Departamento de Aguas del Ministerio de Ambiente y Energía (*) se entenderá por condominio en el presente decreto, el inmueble susceptible de aprovechamiento independiente por parte de distintos propietarios, con elementos comunes de carácter indivisible, así como cualquier otro tipo de condominio definido en el Reglamento a la Ley Reguladora de la Propiedad en Condominio, Decreto Nº 32303-MIVAH-MEIC-TUR.
Artículo 4º-Trámite. Para el trámite de permiso de perforación y/o concesión de agua para autoabastecimiento de consumo humano en condominios, se deberá cumplir con los requisitos vigentes del trámite general de perforación establecidos mediante Decreto Ejecutivo Nº 30387-MINAE-MAG y concesión establecidos en la Ley de Aguas Nº 276. Además deberá aportar la carta de no disponibilidad hídrica emitida por el Instituto Costarricense de Acueductos y Alcantarillados o por algún otro prestatario del servicio público autorizado. Para el trámite de perforación del subsuelo y/o concesión de agua, se procederá conforme a la normativa citada en este artículo. Artículo 5º-Extinción de la concesión. De conformidad con el artículo 25 inciso 2 de la Ley de Aguas, la concesión de aprovechamiento de agua se extinguirá en el momento en que los operadores públicos logren abastecer directamente de agua potable al titular de la concesión y se de la conexión real del servicio, además de las causales vigentes que extinguen la concesión..." (el subrayado no es del original).
Estima este órgano colegiado, que de conformidad con las normas supra transcritas, se denegará la concesión de aprovechamiento de aguas en condominios, cuando el servicio de agua potable para consumo humano por medio de un sistema de acueducto y alcantarillado, lo brinde el prestador del servicio que resulte competente (a saber: Nombre5630, ASADAS u otros autorizados). A contrario sensu, a las solicitudes de concesión de aprovechamiento de aguas en condominios, para auto abastecimiento en usos que no impliquen el consumo humano de agua potable, no les es aplicable el Decreto 35271-MINAE, sino la Ley de Aguas conforme a lo dispuesto a partir del numeral 176 y siguientes de ese cuerpo normativo. B) Lo anterior resulta conteste con lo dispuesto en el artículo 14 del Decreto Ejecutivo número 35884-MINAET (Reglamento de Perforación del Subsuelo para la Exploración y Aprovechamiento de Aguas Subterráneas, vigente desde el 07 de mayo del 2010), que establece: "...No se autorizará la perforación de subsuelo para el aprovechamiento de aguas subterráneas cuando el uso pretendido sea el uso poblacional y pueda ser abastecido por un ente prestatario de servicio público de acueducto y alcantarillado, que brinden dicho servicio.
Para que se pueda autorizar la perforación, se deberá aportar carta del ente prestatario del servicio del sector donde se ubica el inmueble; en la que manifieste que para la propiedad en la que se usará el agua no existe posibilidad técnica de abastecimiento o bien el compromiso de que este ente asumirá el pozo para su aprovechamiento y suministro de agua..." (el resaltado no es del original). Si bien es cierto, para el 16 de junio del 2004, fecha en que se otorgó a la empresa actora el permiso de perforación del pozo AB-2313, por resolución número IMN-DA-2004 (folios 128 y 129 del legajo 1 del expediente administrativo 16098P aportado en disco compacto), los Decretos Ejecutivos número 35271-MINAE y 35884-MINAET, no habían entrado en vigencia, sin perjuicio de que el inmueble en que se encuentra dicho pozo (antecedente de folio real 100519045-000) no había sido inscrito bajo el régimen de condominio, lo cual sucedió el 28 de agosto el 2008 (folio 93 del legajo 1 del expediente administrativo 16098P aportado en disco compacto); también lo es, que en la parte dispositiva de la resolución número IMN-DA-2004 del 16 de junio del 2004, dictada por el Jefe del Departamento de Aguas del Instituto Meteorológico Nacional del Ministerio de Ambiente y Energía, se indica que "...Se autoriza la perforación en el entendido de que una vez que se extraiga agua, se utilizará para uso doméstico y riego (...) Se le deberá comunicar a la empresa Parque Central, S.A. que el permiso es solamente para perforar, ya que para el uso de las aguas se debe solicitar la concesión de aprovechamiento respectiva según lo estipulado en la legislación vigente..." (folios 128 y 129 del legajo 1 del expediente administrativo 16098P aportado en disco compacto), lo cual, tiene sustento en el propio artículo 35 de la Ley de Aguas, que establece que las aguas no potables -que no son aptas para consumo humano- son aplicables a otros usos públicos o domésticos, entre los que se encuentran los de riego u otras necesidades de los habitantes que no requieran agua potable, como por ejemplo: el lavado de automóviles, sistemas de enfriamiento, entre otros; C) En este punto es menester resaltar, que de conformidad con lo dispuesto en los artículos 27, 35 y 37 de la Ley de Aguas, los usos domésticos, entre los que se incluyen los usos de riego o de otra naturaleza (como en este caso, para el sistema interno contra incendios y el sistema de enfriamiento de las oficinas), no requieren de un sistema de suministro de agua potable entendida como "...Agua tratada que cumple con las disposiciones de valores máximos admisibles estéticos, organolépticos, físicos, químicos, biológicos, microbiológicos y radiológicos, establecidos en el presente reglamento y que al ser consumida por la población no causa daño a la salud..." (artículo 4 inciso a del Decreto Ejecutivo 38924-S -Reglamento para la Calidad del Agua Potable-).
Lo anterior, a diferencia del uso prioritario que la Ley de Aguas denomina como cañería para poblaciones -o uso poblacional en el Decreto Ejecutivo número 35884-MINAET-, en que el aprovechamiento de las fuentes de agua está destinado para consumo humano, por lo que, debe garantizarse la inocuidad y la salud de la población, mediante el cumplimiento de límites máximos permisibles de parámetros físicos, químicos y microbiológicos para el agua potable. Ello por cuanto, de conformidad con lo dispuesto en los artículos 50 de la Constitución Política; 50 a 52 de la Ley Orgánica del Ambiente y, los ejes 3 y 4 de la Política Nacional de Agua Potable para el período comprendido entre los años 2017 a 2030, deben privar los criterios de conservación, protección, recuperación y uso sostenible del agua, tanto para efectos de otorgar o no concesiones de aprovechamiento de este recurso, como para la operación y administración de los sistemas de agua potable.
En razón de lo anterior, no era necesario presentar una carta de no disponibilidad hídrica extendida por el prestador del servicio -en este caso, el AYA-, como se le previno en fase de admisibilidad a la empresa demandante el 18 de marzo del 2013 (folios 175 y 176 del legajo I del expediente administrativo 16098-P aportado en disco compacto) y que la accionante contestó mediante escrito fechado 25 de abril del 2013, en el cual, precisó que el aprovechamiento era únicamente para los usos antes indicados y que no requerían agua potable porque no están destinados al consumo humano (folios 178 a 184 del legajo 1 del expediente administrativo 16098-P aportado en disco compacto). Tan es así, que la propia Dirección de Aguas no sólo admitió el 09 de enero del 2014, la solicitud de concesión asignándole el número de expediente 16098-P (folio 208 del legajo I del expediente administrativo 16098-P aportado en disco compacto), dado que el proyecto incluso contaba con la viabilidad ambiental de la Secretaría Técnica Nacional Ambiental (SETENA) -folios 201 a 206 del legajo I del expediente administrativo 16098-P aportado en disco compacto-; sino que además, en el Informe Técnico sobre Solicitud de Concesión de Aguas Subterráneas número AT-1038-2015 emitido el 27 de marzo del 2015 por la Dirección de Agua del MINAE, se recomendó otorgar al Condominio Plaza Roble, la concesión del pozo AB-2313, para los siguientes usos y caudales: i) sistema de enfriamiento con un caudal asignado de 0.01 litros por segundo; ii) sistema contra incendio con un caudal asignado de 0.01 litros por segundo y, iii) riego con un caudal asignado de 0.02 litros por segundo, para un total de 0.04, con un régimen de extracción de 18 horas al día durante todo el año, en el caso de los sistemas internos contra incendios y enfriamiento de oficinas, y de 2 horas al día de diciembre a junio, en el caso de riesgo.
Al respecto, se indicó lo siguiente: "...Comentarios: El caudal recomendado no supera al caudal solicitado ni al caudal recomendado por parte de la SETENA. OBSERVACIONES: EN VISTA DE QUE EL REPRESENTANTE LEGAL DEL CONDOMINIO VERTICAL COMERCIAL PLAZA ROBLE III, S.A. SEÑOR LUIS ARMANDO FLORES AGUIRRE, GESTIONÓ UN CAMBIO DE USO, SEGÚN NOTA DEL 25 DE ABRIL DEL Placa20761 CONSTA EN EL EXPEDIENTE Y EL Nombre5630 SATISFACE LOS REQUERIMIENTOS DE LOS USOS CONSUMO HUMANO-OFICINAS Y CENTRO COMERCIAL Y EL POZO AB-213 ABASTECE CON CRECES LA DEMANDA DE AGUA DEL CONDOMINIO, EL SUSCRITO CONSIDERA QUE NO ES NECESARIO EL OTORGAMIENTO DE LA CONCESIÓN DEL POZO AB-2429 DADA LAS RAZONES ANTERIORES POR LO QUE DEBERÍA SALIR DE OPERACIÓN..." (folio 222 del legajo II del expediente administrativo 16098-P, aportado en disco compacto). En consecuencia, resulta contrario a los principios de razonabilidad y proporcionalidad que por oficio AL-130-2015 del 10 de abril del 2015, la Asesoría Jurídica de la Dirección de Agua, le volviera a prevenir al representante de la empresa actora, que presentara carta de no disponibilidad hídrica extendida por el prestador del servicio -en este caso, el AYA- (folio 223 del legajo II del expediente administrativo 16098-P aportado en disco compacto-, y que en razón de lo contestado por el apoderado de la demandante en memorial presentado el 17 de setiembre del 2015, en el sentido de que "...En razón de que el uso del agua proveniente del pozo no es para consumo humano, siendo demostrado que se requiere de la misma para suplir otras necesidades, no aplica el artículo 14 del Reglamento de Perforación del Subsuelo para la Exploración y Aprovechamiento de Aguas Subterráneas.
Con motivo de lo anterior, solicitamos continuar con el trámite obviando la carta del prestador del servicio público de agua potable..." (folios 226 a 229 del legajo II del expediente administrativo 16098-P aportado en disco compacto); el Director de Agua procediera a consultar al Subgerente del AYA, por oficio DA-1709-2015 del 15 de octubre del 2015, que "...Siendo que el uso de consumo humano abastecido por su representada me permito consultarle, si el Instituto Costarricense de Acueductos y Alcantarillados, cuenta con disponibilidad hídrica y puede suplir al solicitante de los usos extras anteriormente citados, información necesaria para concluir el trámite solicitado..." (folio 232 del legajo II del expediente administrativo 16098-P aportado en disco compacto). Ello por cuanto, en virtud de la naturaleza de los usos para los que se destinaría el proyecto de aprovechamiento del pozo AB-2312, no le era aplicable el requisito contenido en los numerales 2 y 4 del Decreto Ejecutivo número 35271-MINAE -relativo a la carta de no disponibilidad hídrica- ya que no requieren de un sistema de suministro de agua potable como el que brinda el AYA, pues no estaban destinados al consumo humano -que en este último supuesto, la Ley de Aguas denomina "Cañería para Poblaciones" y el Decreto Ejecutivo 35884-MINAET "Uso Poblacional"-, conforme a lo dispuesto en los artículos 27, 35 y 37 de la Ley de Aguas.
Por ende y contrario a lo que afirma la representante del Estado, no es que se esté derogando para el caso concreto lo establecido en los artículos 1 a 5 del Decreto Ejecutivo 35271-MINAE, sino que la solicitud de concesión objeto de estudio, no encuadra en el supuesto de hecho previsto en dicha normativa, tal y como se ha analizado supra; E) En este punto, es menester resaltar que si bien por oficio GG-2015-01930 del 18 de noviembre del 2015, el Gerente General del Nombre5630 indicó al Director de Agua que: "...el desarrollador consulta por sistemas contra incendio internos, se sobreentiende de los que se instalan dentro de los edificios de oficinas, en cuyo caso en (sic) Instituto se encuentra en capacidad de suministrar el agua no sólo para ese sistema, sino para el de enfriamiento de oficina y riego de jardines que solicita el interesado, pues se trata de usos que en nuestra percepción están dentro de la conceptualización de lo "doméstico".
Téngase presente que no se trata de un uso de riego para fines agrícolas, por lo que la demanda de caudal no es significativa y se encuentra dentro de las posibilidades y ámbito de acción del Instituto. A partir de éstos señalamiento, se tiene por contestada la consulta, se indica que el Instituto puede suplicar la demanda de esos usos extra que se requiere pues tiene disponibilidad en la zona, según lo manifiesta la UEN de Optimización de Sistemas AM mediante su oficio SB-GSGAM-OS-2015-0167..." (folios 236 a 238 del legajo II del expediente administrativo 16098-P aportado en disco compacto); también lo es, que en dicho documento se califica a los usos solicitados por la demandante, como "usos domésticos", los cuales conforme a lo establecido en los artículos 27, 35 y 37 de la Ley de Aguas, no requieren del servicio de agua potable, pues no están destinados al consumo humano, más en este caso, en que se pretende aprovechar el agua en riego de jardines, sistema interno contra incendios y sistema de enfriamiento de oficina.
Lo anterior adquiere relevancia en el caso concreto, pues contrario a lo que se sostiene en el acto definitivo, el resultado de las consultas planteadas al Nombre5630 son de "inexcusable cumplimiento", cuando están relacionadas con la prestación del servicio de agua potable mediante el sistema de acueductos, dado que constituye una de las competencias exclusivas y excluyentes de dicho instituto, conforme a lo dispuesto en el artículo 2 incisos a), b) y d) de la Ley Constitutiva del Nombre5630 (Ley número 2627). No obstante, en la especie, la solicitud de concesión de aprovechamiento del pozo AB-2313 no está relacionada con usos que requieran del servicio de agua potable, pues no están destinados al consumo humano, razón por la cual y al menos en cuanto a la competencia del Nombre5630 para la prestación del servicio de agua potable mediante el sistema de acueductos, lo indicado en el oficio GG-2015-01930 del 18 de noviembre del 2015, no resultaba de "inexcusable cumplimiento" para el MINAE.
Más aún, porque resulta contradictorio desde un punto de vista técnico, calificar de usos domésticos los solicitados por la empresa actora (riego, sistema interno contra incendios y enfriamiento de oficinas) y dotarlos de agua potable, a pesar de que no implican el consumo humano de agua potable, contrario a lo que establecen los artículos 27, 35 y 37 de la Ley de Aguas, 2 y 3 del Decreto Ejecutivo 35271-MINAE, 14 del Decreto Ejecutivo 35884-MINAET, 51 y 52 inciso c) de la Ley Orgánica del Ambiente. Con el agravante además, de que en la parte dispositiva de la propia resolución número IMN-DA-2004 del 16 de junio del 2004, dictada por el Jefe del Departamento de Aguas del Instituto Meteorológico Nacional del Ministerio de Ambiente y Energía, que "...Se autoriza la perforación en el entendido de que una vez que se extraiga agua, se utilizará para uso doméstico y riego (...) Se le deberá comunicar a la empresa Parque Central, S.A. que el permiso es solamente para perforar, ya que para el uso de las aguas se debe solicitar la concesión de aprovechamiento respectiva según lo estipulado en la legislación vigente..." (folios 128 y 129 del legajo 1 del expediente administrativo 16098-P aportado en disco compacto).
Dicha circunstancia, incide en el elemento fin de las conductas formales cuestionadas, toda vez que resulta contrario a los criterios de conservación, protección, recuperación y sostenibilidad que deben imperar en la gestión del recurso hídrico (artículos 50 a 52 de la Ley Orgánica del Ambiente; y, los ejes 3 y 4 de la Política Nacional de Agua Potable para el período comprendido entre los años 2017 a 2030), que se dote de agua potable a usos que no la requieren, dado que no están destinados al consumo humano -supuesto de hecho regulado en los numerales 2 y 4 del Decreto Ejecutivo 35271-MINAE y 14 del Decreto Ejecutivo número 35884-MINAET-. Que en consecuencia, se declara la nulidad absoluta de las resoluciones R-0434-2016-AGUAS-MINAE de las 14:35 horas del 16 de mayo del 2016 y R-252-2017-MINAE de las 14:10 horas del 04 de julio del 2017, dictadas por el Ministro de Ambiente y Energía, por resultar contrarias a lo dispuesto en los artículos 50 de la Constitución Política; 50 a 52 de la Ley Orgánica del Ambiente; 27, 35, 37, 176 y siguientes de la Ley de Aguas; 2 incisos a), b) y d) de la Ley Constitutiva del AYA; 131, 132, y 133 de la Ley General de la Administración Pública; 1 a 5 del Decreto Ejecutivo 35271-MINAE; 14 del Decreto Ejecutivo número 35884-MINAET.
Por la forma en que se resuelve, se omite pronunciamiento sobre los demás argumentos planteados por la demandante para sustentar la pretensión de nulidad absoluta, relativos a la duración del procedimiento y al exceso de trámites. Ahora bien, conforme a lo dispuesto en el inciso 3) del artículo 131 del Código Procesal Contencioso Administrativo, la declaratoria de nulidad absoluta de las resoluciones número R-0434-2016-AGUAS-MINAE y R-252-2017-MINAE, surtirá efectos ex nunc, con el objeto de mantener el sellado de los pozos AB-2313 y Placa20764, hasta tanto el Ministerio de Ambiente y Energía resuelva conforme a derecho, la solicitud de concesión para el aprovechamiento de los mismos, en los términos que se indicarán en el siguiente considerando de esta sentencia.
VIo.- SOBRE LA PRETENSIÓN PRINCIPAL Y SUBSIDIARIA NÚMERO 2 DE LA DEMANDA. En primera instancia, cabe indicar que en la audiencia preliminar celebrada el 08 de marzo del 2019, se modificó y fijó la pretensión 2 de la demanda, en el sentido de que "...2. Se ordene al MINAE a emitir la concesión de aguas para el pozo AB-2313. De forma subsidiaria, en caso de que el Tribunal rechace la solicitud antes indicada, se solicita que se ordene al MINAE, a valorar la solicitud de concesión de mi representada, tomando en cuenta los motivos alegados en esta demanda para pedir la nulidad de los actos señalados. En ambos casos, solicitan al Tribunal fijar un plazo máximo prudencial para cumplir lo ordenado..." (ver imagen 1142 del expediente virtual a la fecha de dictado de esta sentencia y el respaldo digital de la audiencia preliminar del 08-03-2019, en la carpeta de documentos asociados del expediente virtual).
Ahora bien, considera este Tribunal que la determinación de si resulta o no procedente otorgar la concesión de aprovechamiento del pozo AB-2313 a la empresa actora, implica no sólo un análisis jurídico como el realizado en el considerando precedente, sino también un estudio técnico a fin de establecer si el aprovechamiento solicitado causará o no un impacto en las aguas subterráneas, dado que la conservación, protección, renovación y el uso sostenible del recurso agua, constituyen criterios que deben aplicarse en el otorgamiento de concesiones y permisos para aprovechar cualquier componente del régimen hídrico, conforme a lo dispuesto en el inciso del artículo 52 de la Ley Orgánica del Ambiente y, los ejes 3 y 4 de la Política Nacional de Agua Potable para el período comprendido entre los años 2017 a 2030. Más aún en el caso concreto, ya que de conformidad con el "...informe N° 4182, con fecha 09 de setiembre del 2004, realizado por el Laboratorio BIOTROL, indica que las muestras de agua analizadas del pozo AB-2313, propiedad de Parque Central, S.A., ubicado en San Rafael de Escazú, es apta para el consumo humano (...) El reporte N° 1009-2004, del Laboratorio AQYLASA, indica que con base en los parámetros físico-químicos analizados a la muestra de agua del pozo AB-2313, propiedad de Parque Central S.A., cumple con los valores recomendados por el reglamento de calidad del Agua Potable..." (folios 118 a 127, 136 a 137 del legajo I del expediente administrativo 16098-P aportado en disco compacto; el resaltado no es del original).
Aunado a lo anterior, dado que el objeto del proceso se ha centrado en aspectos jurídicos, específicamente en cuanto a si los usos solicitados por la empresa actora para el aprovechamiento del pozo AB-2313, encuadran o no en el supuesto de hecho regulado en los artículos 1 a 5 del Decreto Ejecutivo 35271-MINAE -relacionado con el autoabastecimiento de agua potable para consumo humano en condominios-; estima este órgano colegiado que se colocaría en un evidente estado de indefensión a la parte demandada si se acogiera la pretensión principal número 2, pues su defensa no ha versado sobre los extremos técnicos relacionados con la conservación, protección, recuperación y uso sostenible de las aguas subterráneas que se pretenden aprovechar. Por otra parte, si bien se tiene por demostrado que en el Condominio Vertical Comercial Plaza Roble III, se ha implementado un programa de gestión del recurso hídrico, tendente a lograr un consumo eficiente del agua, que implique un ahorro en la cantidad de metros cúbicos que se utilizan para diversos usos y que comprende la implementación de una serie de sistemas, prácticas o medidas, tales como: proyecto de pozos de absorción para recarga del acuífero Pacacua; cambio de mingitorios de fluxómetro por secos; captación de aguas pluviales y de condensación de los edificios Terrazas A y B, Pórtico; instalación de loza sanitaria de bajo consumo de agua en todo el condominio; sistema de cosecha de agua del edificio Pórtico, para alimentar la losa sanitaria del edificio Patio (respaldo digital de la declaración del testigo perito Nombre113485 , rendida en audiencia de evacuación de prueba en modalidad mixta del 04-11-2020, visible en la carpeta de documentos asociados del expediente virtual; imágenes 61 a 63, 65 a 75, 77 a 80, 82 a 94, 97 a 107 del expediente virtual a la fecha de dictado de esta sentencia), y que incluso, han obtenido la Bandera Azul Ecológica y el certificado ISO 14001-2004, por los resultados obtenidos en los diferentes ámbitos que comprende su programa de gestión ambiental (imágenes 44 a 56 del expediente virtual, a la fecha de dictado de esta sentencia).
También lo es, que dichos aspectos aunque fueron parte de los alegatos en que la demandante basó el recurso de reposición que planteó contra el acto final (folios 242 a 251 del legajo II del expediente administrativo 16098-P aportado en disco compacto), no fueron objeto de pronunciamiento por el MINAE en el acto definitivo (no se desprende de los folios 317 a 324 del legajo II del expediente administrativo 16098-P aportado en disco compacto), a pesar de que incluso, a las 09:00 horas del 11 de mayo del 2017, dos abogados del Departamento Legal del MINAE, se presentaron a realizar una inspección al Dirección13845 , oportunidad en que dos Profesionales en Ingeniería de ese condominio, les mostraron a los funcionarios del MINAE -entre otros- el sistema colector de aguas pluviales y tanques de absorción (folio 310 del legajo II del expediente administrativo 16098-P aportado en disco compacto).
En consecuencia, a fin de resolver la solicitud de concesión para el aprovechamiento del pozo AB-2313, para los usos de riego de jardines; sistema interno contra incendios y sistema de enfriamiento de oficinas, el MINAE deberá no sólo tomar en consideración los aspectos jurídicos, relativos a la no configuración en la especie del supuesto de hecho previsto en los numerales 1 a 5 del Decreto Ejecutivo número 35271-MINAE, debiendo resolver la solicitud de concesión conforme a lo dispuesto a partir del numeral 176 y siguientes de la Ley de Aguas; sino también, los extremos técnicos relacionados con la conservación, protección, recuperación y uso sostenible de las aguas subterráneas que se pretenden aprovechar, a saber: i) Si el acuífero Pacacua, corresponde o no al que se pretende explotar con la extracción de agua del pozo AB-2313; ii) Si el sistema de infiltración que la demandante puso en práctica a partir del año 2006, tiene o no la virtud de recargar el acuífero en un tiempo tal, que permita compensar el caudal solicitado en litros por segundo, para cada uno de los usos gestionados; iii) Si hay o no riesgo de contaminación del acuífero con el funcionamiento de ese sistema infiltración.
Cabe recordar, que para tal efecto y de conformidad con lo dispuesto en los incisos III y VIII del artículo 181 de la Ley de Aguas, el MINAE podrá ordenar que se reciba prueba pericial acerca de las cuestiones que requieren conocimientos especiales o bien, podrá ordenar de oficio o a solicitud de parte, que se reciban nuevas pruebas o se amplíen las evacuadas, por medio de un funcionario administrativo o judicial que comisionará al efecto, o por el mismo Inspector de Aguas que practicó la inspección ocular. Sin perjuicio además, que de acuerdo a los incisos c) y d) del numeral 2 de la Ley Constitutiva del Instituto de Acueductos y Alcantarillados, el MINAE deberá consultar a la autoridad competente de esa entidad, los aspectos relacionados con el control de contaminación de las aguas cuyo aprovechamiento se pretende, que constituye otra de las competencias que le asignó el legislador a dicho ente.
Por último, el MINAE deberá dictar resolución final motivada sobre la solicitud de concesión para el aprovechamiento del pozo AB-2313, en los usos de riego de jardines, sistema interno contra incendios y sistema de enfriamiento de oficinas en el Condominio Vertical Comercial Plaza Roble III, en un plazo de tres meses contados a partir de la firmeza de esta sentencia, tomando en consideración los parámetros jurídicos y técnicos fijados en este considerando, por lo que, deberá informar a la persona Juzgadora de la Fase de Ejecución de Sentencias de este Tribunal, que ha procedido conforme a lo ordenado en este pronunciamiento, debiendo aportar copia de la resolución dictada. Por todo lo expuesto, se rechaza la pretensión principal número 2 y se acoge la pretensión subsidiaria en los términos ya expuestos.
VIIo.- SOBRE LOS PRESUPUESTOS DE FONDO. En primera instancia, este Tribunal considera que la demanda fue incoada por la empresa administradora del Condominio Vertical Comercial Plaza Roble III, que gestionó la concesión para el aprovechamiento del pozo AB-2313 y que le fue denegada por el Ministerio de Ambiente y Energía, mediante las conductas formales cuya legalidad se cuestiona en este proceso, por lo que, el marco de legitimación activa y pasiva se ampara en los ordinales 10.1.a y 12.1 del Código Procesal Contencioso Administrativo. Por su parte, el interés se mantiene actual, en el tanto las actuaciones cuestionadas siguen surtiendo efectos en la esfera jurídica de la demandante y requieren de una resolución jurisdiccional que las resuelva. Por su parte, encuentra este órgano colegiado que por todo lo expuesto en el considerando VI (en parte) de esta sentencia, se acoge la excepción de falta de derecho únicamente respecto a ordenar al MINAE que otorgue a la empresa actora, la concesión de aprovechamiento del pozo AB-2313 y que en su defecto, proceda a valorar la solicitud de concesión conforme a los alegatos que se plantearon en la demanda.
En consecuencia y por lo expuesto en los considerandos V y VI (en parte) de esta sentencia, se rechaza la excepción de falta de derecho en los extremos restantes y en consecuencia, se declara parcialmente con lugar la demanda interpuesta por Parque Central, S.A. contra el Estado, en los siguientes términos, entendiéndose por denegada en lo que no se indique de manera expresa:
VIIIo.- SOBRE LAS COSTAS. De conformidad con el numeral 193 del Código Procesal Contencioso Administrativo, las costas procesales y personales constituyen una carga que se impone a la parte vencida por el hecho de serlo. La dispensa de esta condena solo es viable cuando hubiere, a juicio del Tribunal, motivo suficiente para litigar o bien, cuando la sentencia se dicte en virtud de pruebas cuya existencia desconociera la parte contraria. En la especie, no encuentra este órgano colegiado motivo para aplicar las excepciones que fija la normativa aplicable y quebrar el postulado de condena al vencido. Por ende, se imponen ambas costas a la parte demandada, extremos que se liquidarán en la fase de ejecución de sentencia.
POR TANTO.
Se rechaza la prueba documental ofrecida para mejor resolver por el representante de la empresa actora. Se acoge la excepción de falta de derecho únicamente en cuanto a ordenar al Ministro de Ambiente y Energía, que otorgue a la empresa actora, la concesión de aprovechamiento del pozo AB-2313, o que en su defecto, proceda a valorar la solicitud de concesión conforme a los alegatos que se plantearon en la demanda. En consecuencia, se rechaza la excepción de falta de derecho en los extremos restantes y se declara parcialmente con lugar la demanda interpuesta por Parque Central, S.A. contra el Estado, en los siguientes términos, entendiéndose por denegada en lo que no se indique de manera expresa:
