Attorney Juan Gerardo Alfaro López, Bar Association membership number veintidós mil cuatrocientos uno, acts as special litigation counsel for the claimant, and attorney Jonatán Picado León, Bar Association membership number doce mil sesenta y dos, acts as counsel for the respondent. Proceedings were conducted before the Agrarian Court of the Second Judicial Circuit of Guanacaste, Santa Cruz. This Court hears the appeal against Order-Judgment number 161-2020 issued at dieciséis horas y cuarenta y seis minutos del siete de julio de dos mil veinte.- Judge Castro García writes the opinion; and,

WHEREAS:

I- Proven facts. Facts 1 through 3 are adopted as such because they are supported by evidence in the record. Fact number four is not adopted because what was stated was not a fact but rather an assertion from the initial application for the advance interim measure. No ruling is made regarding fact 5 because it is not the subject of the appeal. The following facts of this nature are added at this level of review: 6) There is a teak plantation subject to forestry oversight (regencia forestal) on properties registered in the name of [Nombre4] of [[Nombre2] ] S.A. (evidence: judicial inspection, images 364 to 365 in PDF format, and registry certifications in the property images in the name of [Nombre4] of [[Nombre2] ] S.A., images 585 to 610 and 408 to 409; Forestry Oversight forms numbers 000778 and 0000779 dated by Forestry Supervisor Víctor Hugo Venegas Sánchez, bearing a February 2020 receipt stamp from the SINAC Subregion of Santa Cruz Carrillo Guanacaste, for harvesting a plantation on properties [Valor 001], [Valor 002], and [Valor 003], covering treinta hectáreas, and on property [Valor 004], covering diez hectáreas; and the oversight agreement of 19 de febrero del 2020 filed with the Colegio de Ingenieros Agrónomos, images 270 to 273 of the digital case file in PDF format). 7) The company [[Nombre2] ] [Nombre5] has maintained a roster of insured employees with the Caja Costarricense de Seguro Social since 2019, executed a purchase and sale agreement with Forlumber Limitada for standing teak trees, which is being performed on the properties of [[Nombre6] ] registered in the name of its [Nombre4], and entered into a forestry oversight agreement (evidence: Private Purchase and Sale Agreement for Teak Trees entered into with Forlumber Limitada; copy of the respondent company’s payroll records filed with the Caja Costarricense del Seguro Social, images 318 to 306 and 280 to 293; Forestry Oversight forms numbers 000778 and 0000779 dated by Forestry Supervisor Víctor Hugo Venegas Sánchez, bearing a February 2020 receipt stamp from the SINAC Subregion of Santa Cruz Carrillo Guanacaste, for harvesting a plantation on properties [Valor 001], [Valor 002], and [Valor 003], covering treinta hectáreas, and on property [Valor 004], covering diez hectáreas; and the oversight agreement of 19 de febrero del 2020 filed with the Colegio de Ingenieros Agrónomos, images 270 to 273 of the digital case file in PDF format).

II.- [[Nombre2] ] appeals (digital case file, images 299 to 304 in PDF format) Order-Judgment No. 161-2020, issued at dieciséis horas y cuarenta y seis minutos del siete de julio de dos mil veinte, which concerns the ruling on the advance interim measure sought by [[Nombre1] ] against [Nombre 019] S.A., issued without a hearing for that company (digital case file, images 550 to 555 in PDF format). In that ruling, the advance interim measure requested by [[Nombre1] ] was granted, and the trial court ordered: “In accordance with the cited facts and law, the interim measure requested by [[Nombre1] ] against [[Nombre2] ] CORPORATION, represented by [[Nombre3] ], whose particulars appear in the record, is hereby granted. The respondent is ordered to suspend the cutting or felling of teak timber on the properties at issue, as well as the sale of the teak timber located on the properties involved in these proceedings, with notice that failure to comply may constitute the offense of disobedience of authority.

This order shall be communicated by official letter to the Dirección General Forestal - Área Regional Tempisque and the Dirección de Tributación Directa, and that letter shall be made available to the interested party for service. The request for judicial deposit (depósito judicial) of the timber and the request for attachment (embargo) are reserved until the claimant complies with the following: 1) State the value of these proceedings. 2) State the amount for which attachment is requested and the assets upon which it is to be levied, and provide the security deposit and government fee payment. The foregoing shall be completed within the following cinco días, with notice that the reserved interim measures will otherwise be decided based on the materials in the record. Notice is hereby given that the interim measure ordered expires one month after it is entered if it is not enforced due to the fault of the party and if the corresponding action is not filed within that period.

The claim shall be served personally upon the respondent’s representative in view of the criminal warning given herein. Let notice be given.-” III- The grounds for appeal are set out below and grouped by subject matter: 1.- Regarding information not provided by the applicant for the provisional measure (medida cautelar). It argues that the provisional measure is untenable because there has been no contractual breach whatsoever and because the alleged contractual relationship with [[Nombre1] ] is false, specifically the claim that, in exchange for his investment of more than eight million dollars in the reforestation project and the purchase of farms, he would be permitted to use and enjoy them upon his retirement. This assertion is unsupported by evidence, and the certification he submitted will be challenged in the corresponding proceedings on the merits (proceso de conocimiento); they do not accept it.

The appeal states that [[Nombre1] ] is clearly the father and husband of the shareholders of [Nombre 019] S. A., and that family and property matters are being conflated with the agrarian matter, thereby harming the agrarian activity itself. It adds that the rights he claims to hold—which they deny—could be protected by other means without affecting the agrarian activity that the company has continuously conducted for more than 30 years. Indeed, the dispute he seeks to introduce cannot prejudice the continuity of the agrarian activity, which serves a higher public interest. This is evident from the challenged ruling itself, whose first proven fact states that the cultivated teak “… IS A MATURE CROP AT THE HARVESTING STAGE.” In other words, according to the forestry engineers, failure to fell the trees at this stage of the plantation would damage the harvest and cause it to lose its value.

It appeals the following statement made in the challenged decision regarding the likelihood of success on the merits (apariencia de buen derecho): “… although the usufruct (usufructo) that the plaintiff claims is not supported by the registry records, it is important to note that his investment in the project has been quantified by the certified public accountant….” It characterizes this as unheard of because the claim concerning the contract he invokes is unsupported by any contract, usufruct, or evidence whatsoever. This is compounded by the applicant’s downplaying of his family relationship with the shareholders who own the entirety of the company’s capital stock. His property and family disputes are not grounds for suspending a longstanding agrarian activity. The plaintiff seeks in bad faith to financially suffocate the defendant; this defeats any likelihood of success on the merits, and his request for provisional relief is not suited to the purpose being protected.

It states that the plaintiff was a shareholder and founder of the company together with his wife, [[Nombre3] ]. Since 1991, however, he has held no ownership interest whatsoever in the enterprise operated by the company. Nor does his status as the husband of the legal representative and shareholder, or as the father of her daughters, give him such an interest. These disputes must be pursued separately from the agrarian activity, which is a priority of the agrarian jurisdiction. It states that the plaintiff administered the farm under a power of attorney granted for that purpose, but that the power was revoked precisely because of his mismanagement. All of this may be disputed before the appropriate fora, without paralyzing the agrarian activity. 2.- Ongoing agrarian activity. It asserts that the reforestation and teak-felling activities have been conducted for many years, as they constitute the ordinary business of [[Nombre2] ] S.A. This is not as the plaintiff portrays it when he states that teak is suddenly being felled, as though this were an extraordinary event on the farm.

This can be verified by inspecting the farms. It adds that contracts with third parties exist for that purpose and that there is an active payroll of more than six employees. If the plaintiff claims to hold economic rights against the company, that issue may certainly be litigated, but it is unacceptable to paralyze the agrarian activity when contracts with third parties exist. The decision entails: (i) a serious breach by the corporation, (ii) nonpayment of the farmworkers, with severe social consequences, and (iii) disruption of the farm’s customary agrarian activity. It is a disproportionate, unreasonable measure inconsistent with what it purports to protect: an economic right concerning the farm. This is not a measure suited to the purpose it protects. The plaintiff fraudulently concealed the existence of the contract with third parties for the purchase and sale of teak trees. The company entered into an obligation with the buyer, Formulber Limitada, legal entity identification number CED2, represented by [Nombre7] .

Its business activity is the purchase and sale of timber within the national territory for export. The contract, signed with the company on July 20, 2020, concerns the sale of 50 containers of standing teak. It states that the agreement submitted as evidence provided: “… the BUYER shall extract said timber… in accordance with applicable law, as well as the provisions of regulation number 38863, Regulations Governing the Processing of Permits and Oversight of Timber Harvesting.” The price was determined in accordance with the customary practice for teak sales, as a price in dollars per container based on the average circumference of the logs. That third party is adversely affected by the ruling under appeal. The appellant company is also harmed because the crop is at the harvesting stage, as the court below reasoned. The price established in that contract is the market price, based on objective parameters.

Forestry and environmental managers (regentes forestales y ambientales) are involved in the process. It believes that the judicial authority was misled by the plaintiff’s statement that: “the timber extraction is not even being carried out; it should be noted that the timber had not yet been piled or stacked and, given the inclement weather caused by the season’s heavy rains, the felled timber could clearly undergo rapid deterioration that would prevent its proper use because of the loss in economic value resulting from the decline in its quality.” For these reasons, the ruling must be reversed because the plaintiff’s assertion in this regard is untrue. The appellant states that part of the timber was felled by Río Trading S.A. pursuant to a contract signed on February 20, 2020, a copy of which is attached. However, because of COVID-19, that company suspended its operations, and [[Nombre8] ] S.A., legal entity identification number [CED3 ], was then promptly engaged.

It adds that the sold timber has been removed despite the inclement weather and upon payment of the corresponding price. The product has been sawn and removed. It contends that the foregoing must be supplemented by the existence of the contract already described with Formulber Limitada, which has the right to fell and remove the timber sold to it. It alleges that the agrarian production process has been halted unnecessarily, because the property dispute the plaintiff seeks to raise can be resolved through other mechanisms without paralyzing existing contracts and obligations with third parties. The appellant argues that the plaintiff fails to mention that some of the timber observed to have been felled pertains to contracts that he himself signed under the representative authority he held, which was revoked because he misused it. Indeed, he signed contracts with Cooperativa de Electrificación Rural de Guanacaste, Coopeguanacaste R.L., establishing permanent rights-of-way and electrical-line easements (servidumbres permanente de paso común y de paso de líneas eléctricas).

Accordingly, Coopeguanacaste R.L. has felled a substantial number of trees along the route of that easement without removing them. 3.- Direct harm to the agricultural employees of [[Nombre2] ] S.A. It asserts that, in addition to the foregoing, the company’s workforce is being harmed in its fundamental right to work because the employer’s cash flow has been cut off. It states that it is attaching payroll records from the Caja Costarricense del Seguro Social confirming the existence of the workers employed on the farms whose operations the plaintiff seeks to halt. These workers must be retained to work on and care for the farm so as to prevent forest fires in view of the danger posed by constant burning on neighboring land. This requires maintaining several shifts to watch over the property. It characterizes as perverse the plaintiff’s interest in halting the activity and preventing the cash liquidity needed to sustain the agrarian activity.

Likewise, there are payment arrangements that cannot be honored, INS insurance policies, taxes, social security contributions, and all farm maintenance expenses. The order broadly harms the public interest. 4.- Regarding the risk posed by delay (peligro de demora), as well as reasonableness and proportionality. It partially quotes the reasoning in the challenged order (auto): “… indeed, because this is a complex ordinary proceeding for breach of contract, in which the recovery of an investment of more than eight million dollars is sought, its complexity will entail a considerable duration because it is subject to an appeal in cassation (recurso de casación), and this requirement has therefore been more than adequately established.” It contends that this finding must be reversed because an alleged interest in economic recovery, “which will take years,” is being weighed against the irreversible harm of halting the agrarian production activity of a plantation at the harvesting stage.

In the engineers’ opinion, such a halt is inadvisable because of the damage suffered by timber that is ready to be felled. It therefore considers the suspension of the agrarian production activity to lack reasonableness and proportionality. It contends that, if the purpose is to protect a potential property right, it would be reasonable and proportionate to seek any other means except the destruction or frustration of the agrarian activity. [Nombre9] when the plaintiff, the husband of the legal representative and father of the shareholders, asserts rights even though he has held no interest whatsoever in the company since 1991, other than serving as an administrator under a power of attorney granted for that purpose, which he improperly used. It states that the provisional measure is being misused as a means of coercion. It submitted the following as evidence: 1. Copy of the “Private Contract for the Purchase and Sale of Teak Trees” entered into with FORLUMBER LIMITADA. 2.

Copy of the defendant company’s payroll records filed with the Caja Costarricense del Seguro Social. 3. Copy of the Contract for the Sale of Teak Timber Trees. 4. Copy of the contracts entered into with Coopeguanacaste. 5. Copy of the forestry-management contracts (contratos de regencia forestal).

IV- As a preliminary matter, it is appropriate to cite what this Court decided in Judgment number 000942-F-2019 of fifteen hours and thirty-eight minutes on catorce de noviembre de dos mil diecinueve: “The Agrarian Jurisdiction Law contains several procedural gaps that must be filled first by the Labor Code and, failing that, by the civil procedural rules. Therefore, irrespective of the entry into force of the Agrarian Procedural Code, Labor Code number 9343 has applied on a supplementary basis since 25 de julio de 2017, and Civil Procedural Code number 9342 since 8 octubre de 2018. The agrarian procedural code regulates standard precautionary measures (medidas cautelares típicas), such as the order restricting departure from the country (arraigo) and prejudgment attachment (embargo preventivo) (articles 33 and 34 ibid.). Given the absence of special provisions in the agrarian procedural code governing non-standard precautionary measures (medidas cautelares atípicas), and given the supplementary application of the Labor Code, that body of law must be applied first.

It should be clarified that, according to the digital case file, this matter commenced on 14 de mayo del 2019. At that time, the labor procedural law was already in force, regulating precautionary measures in Section V, provisions 489 through 494. The first provision establishes the following: ‘Before proceedings are commenced and throughout their course, including the enforcement stage, the adjudicative body may order appropriate and necessary precautionary measures to provisionally protect and safeguard the subject matter of the proceedings and the effectiveness of the judgment. It may also order any preparatory or anticipatory measure necessary to preserve the exercise of a future right, as well as any other non-standard measure that does not exceed the bounds of reasonableness and proportionality. In such cases, the adjudicative body may prudently order everything necessary to achieve the purpose of the measure, so as to avoid overreach.

Regarding the types of measures, both precautionary and preparatory, their effects, and the manner in which they are implemented, replaced, or lifted, the provisions of civil procedural law shall apply, subject to the exceptions set forth below.’ This rule must be read together with provision 490 of that Code. The foregoing establishes that: 1. They may be imposed before or during the proceedings, including the judgment-enforcement stage. 2. They seek to provisionally protect and safeguard the subject matter of the proceedings and the effectiveness of the judgment, and to preserve the exercise of a future right. 3. Non-standard measures are permitted, provided that they are reasonable and proportionate to safeguard the potential future right. 4. They may be ordered upon a party’s request or by the court on its own motion. 5. The court must safeguard the counter-security (contracautela) on its own motion, which must be prudent and prevent overreach. 6.

Civil procedure applies on a supplementary basis regarding the types of measures, their effects, and the manner in which they are implemented, replaced, or lifted, subject to the exceptions established by labor law. 7. In implementing the precautionary measure, the court must act diligently to prevent frustration of its intended purpose. Based on the foregoing, this Chamber considers it appropriate to continue applying its longstanding approach to the admissibility requirements for such measures. In addition to having relied on the repealed 1989 Civil Procedural Code, those requirements drew upon the doctrine developed by the Constitutional Chamber of the Supreme Court of Justice, which is binding erga omnes pursuant to provision 13 of the Constitutional Jurisdiction Law. In Judgment number 7190 of 15 hours 24 minutes on 6 de diciembre de 1994, it stated the following: ‘...According to the most authoritative legal scholarship, protective or precautionary measures (medidas asegurativas o cautelares) arise in proceedings from the need to ensure effective judicial protection (tutela jurisdiccional efectiva) and may therefore be conceptualized as “a set of procedural powers vested in the judge—whether exercising judicial or administrative adjudicative authority—to rule before the final decision, for the specific purpose of preserving the factual conditions indispensable for the issuance and enforcement of the final act.” Legal scholarship understands instrumentality and provisionality to be two fundamental characteristics of precautionary measures and requires that their principal defining elements be: a) lawful and legally possible; b) provisional, because they terminate upon issuance of the final act; c) supported by grounds, meaning that they must have a genuine factual basis relating to the particular case; d) modifiable, in the sense that they may be increased or reduced to adapt them to new needs; e) ancillary, because they are justified within principal proceedings; f) preventive in nature, because their purpose is to avert harm to the interests and rights represented in the principal proceedings; g) protective in effect, insofar as they seek to preserve a factual or legal situation during the course of the proceedings, preventing circumstances that could impair the effectiveness of the judgment or final act; and h) homogeneous and not identical in character to the substantive right protected, so that they constitute effective preventive measures rather than anticipatory enforcement acts.’ The foregoing detailed explanation demonstrates that the likelihood of success on the merits (apariencia de buen derecho) must be considered because, in assessing proportionality, it is necessary to determine from the alleged facts and relief sought whether the decision to be made by the judicial body is directed toward preserving a factual or legal situation during the course of the proceedings and preventing circumstances that could impair the effectiveness of the judgment or final act, as explained by the High Constitutional Chamber...

Given the renewed emphasis placed on reasonableness in the most recent labor procedural legislation, this Court has considered it relevant to revisit the development of that assessment based on the criteria of the aforementioned Constitutional Chamber. In Decision 732-2001 of 12 hours 24 minutes on 26 de enero de 2001, the Constitutional Chamber defined the principle of reasonableness as follows: ‘V.- THE PRINCIPLE OF REASONABLENESS AS A CONSTITUTIONAL STANDARD. Constitutional case law has been clear and consistent in holding that the principle of reasonableness constitutes a standard of constitutionality … To conduct the reasonableness analysis, United States legal scholarship suggests first examining so-called “technical reasonableness,” within which the specific rule (statute, regulation, etc.) is examined. Once it has been established that the selected rule is appropriate for regulating a particular matter, it must be determined whether the means chosen are proportionate to the intended end.

After the “technical reasonableness” criterion has been satisfied, “legal reasonableness” must be analyzed. To this end, that scholarship proposes examining: a) balancing reasonableness, which is a form of legal assessment used when, given a particular antecedent circumstance (e.g., income), a particular obligation is imposed (e.g., a tax), in which case it must be determined whether the obligation is equivalent or proportionate; b) equality-based reasonableness, which is the form of legal assessment based on the premise that equal antecedent circumstances must produce equal consequences, without arbitrary exceptions; and c) purpose-based reasonableness, which assesses whether the objective sought is consistent with the purposes contemplated by the legislature when approving the measure. Within this same analysis, it is not enough to assert that a means is reasonably suited to an end; it is also necessary to ascertain the nature and extent of the limitation that such means imposes on an individual right.

Thus, if the same end can be achieved through another means that imposes a less burdensome limitation on individual rights, the means chosen is not reasonable...’ (See likewise Judgments Nos. 843-02 of 30 de enero de 2002; 5374-03 of 20 de junio de 2003; 340-04 of 16 de enero de 2004; 846-05 of 28 de enero de 2005; 1800-05 of 23 de febrero de 2005; 2236-05 of 2 de marzo de 2005; 1806-06 of 15 de febrero de 2006; 1807-06 of 15 de febrero de 2006 and 1557-07 of 7 de febrero de 2007 and 1571-08 of 15 de enero de 2008).’ In addition to the foregoing, Judgment number 8858-98 of the aforementioned High Chamber, issued at 16 hours 33 minutes on 15 de diciembre de 1998, further developed the case law concerning that principle as follows: ‘Thus, an act limiting rights is reasonable when it satisfies three conditions: it is necessary, suitable, and proportionate. The necessity of a measure directly concerns the existence of a factual basis that makes it necessary to protect an interest or set of interests of the community—or of a particular group—by adopting a differentiating measure.

In other words, if such action is not taken, important public interests will be harmed. If the restriction is not necessary, it cannot be considered reasonable and therefore constitutionally valid. Suitability, in turn, entails an assessment of whether the type of restriction to be adopted does or does not fulfill the purpose of addressing the identified need. A measure’s unsuitability would indicate that other mechanisms may exist that address the existing need more effectively, some of which may achieve the proposed purpose without restricting the enjoyment of the right in question. Proportionality, for its part, requires a comparison between the purpose pursued by the act and the type of restriction imposed or sought to be imposed, so that the magnitude of the limitation is not markedly greater than the benefit that it is intended to obtain for the community. Of the latter two elements, it could be said that the first is based on a qualitative assessment, whereas the second is based on a quantitative comparison of the two matters under consideration.’ Several aspects relevant to this matter may be inferred from the foregoing excerpts.

The first is that if the intended end can be achieved through another means that imposes a less burdensome limitation on individual rights, then the means chosen is not reasonable; furthermore, a reasonable measure must be necessary, suitable, and proportionate. VI. When the Constitutional Chamber analyzes reasonableness, it introduces necessity as one of the conditions applicable when rights are to be restricted, in addition to suitability and proportionality. It is therefore appropriate to revisit what that Constitutional Court stated within the framework of provision 41 of the Political Constitution, insofar as precautionary measures constitute a fundamental right. In the words of the Constitutional Chamber of the Supreme Court of Justice, it may be determined that a procedural necessity prevails with respect to precautionary measures: ‘It is in this sense that precautionary—or protective—measures arise in proceedings as a genuine procedural necessity, insofar as they make it possible to guarantee effective protection of access to justice (once again, both judicial and administrative); accordingly, they may be conceptualized as the “set of procedural powers vested in the judge—whether exercising judicial or administrative adjudicative authority—to rule before the final decision, for the specific purpose of preserving the factual conditions indispensable for the issuance and enforcement of the final act” (Judgment number 7190-94, issued at fifteen hours and twenty-four minutes on seis de diciembre de mil novecientos noventa y cuatro),’ Constitutional Chamber of the Supreme Court of Justice, Judgment [Telf1] of primero de febrero de 2006.

Accordingly, this Court understands that a state of necessity (estado de necesidad) refers to a situation of present danger to legally protected interests. Effective protection of the right alleged to be in danger therefore gives rise to a dilemma.

This entails the diminution of legally protected interests of another litigant or institution. In the specific case of interim measures (medidas cautelares) in agrarian matters, their admissibility requires the existence of abnormal and exceptional circumstances, which must be weighed in each case. The need to preserve procedural order is coupled with the risk posed by delay (peligro en la demora), meaning that the longer the proceedings take, the outcome could be rendered ineffective by changes in the circumstances sought to be protected through the litigation, thereby depriving the litigant of genuine access to justice. Regarding the diminution of the rights of other persons who could be affected by the granting of the interim measure, the applicable limit is that the relief ordered through the measure must not be unlawful or harmful. Reasonableness and proportionality therefore enter into the balancing process.” Decision clarifying the framework for the supplementary application (aplicación supletoria) of procedural legislation to agrarian proceedings and the basis for interim measures.

V- The grounds stated in the challenged decision, issued pursuant to a preliminary precautionary measure (medida cautelar anticipada), should be cited. That decision ordered the suspension of teak felling (corta de teca) and timber harvesting (aprovechamiento forestal) in order to halt and prevent the removal and sale of all timber existing on the properties. To that end, the Dirección General Forestal - Área Regional Tempisque and the Dirección de Tributación Directa were notified of the prohibition against exporting teak timber belonging to [[Nombre2] ] Sociedad Anónima. That decision found the measure to be proportionate and reasonable for the purpose of halting and preventing the removal of the entire plantation. The challenged ruling held that the granted measure satisfied the requirements of risk from delay (peligro de la demora) and likelihood of success on the merits (apariencia de buen derecho), because the matter involved an ordinary proceeding for breach of contract seeking recovery of an investment exceeding eight million dollars, and because the proceeding could even be subject to an appeal in cassation (recurso de casación).

During the judicial inspection (reconocimiento judicial), two parcels planted with teak trees were observed, along with a logged area and trunks lying on the ground, making it possible that timber from the apparent investment was being removed; there was also timber that was not being harvested and could deteriorate and lose its economic value. The applicant’s usufruct (usufructo) was also deemed proven “on a prima facie basis,” because the record contains a certification from a certified public accountant attesting to the investment that the plaintiff claims to have made in the parcels, notwithstanding, as that decision states, that such right does not appear in the properties’ registry entries. Indeed, the measures requested by and granted to [[Nombre1] ] seek to protect the right of use and enjoyment that he claims to hold over the parcels planted with teak, in which he stated that he had invested a substantial sum of money.

Having reviewed the record, the grounds for appeal, and the evidence in the preliminary precautionary-measure proceeding whose decision was appealed, this Chamber finds, in accordance with sections 1 and 2 of the Ley de Jurisdicción Agraria and sections 489 through 494 of the Código de Trabajo, applied on a supplementary basis, that the appealed decision must be reversed because the preliminary precautionary measure ordered does not satisfy the standards of reasonableness or proportionality, and because the suspension ordered in decision number 161-2020 of 16:46 hours on July 7, 2020 adversely affects the agricultural activity (actividad agraria). The case file was received by this Court for consideration of the appeal in November 2020. This Court orders reversal primarily because priority must be given to the necessary safeguarding, protection, and continuity of the cultivation and harvesting of teak observed on the parcels registered to [Nombre4] de [Nombre 019] S.A. The applicant for the precautionary measure claims ownership of that crop, whose existence was confirmed by the observations made during the judicial inspection conducted for purposes of the preliminary precautionary measure.

This is further supported by the evidence submitted by [Nombre 019] S.A. at this procedural stage and in its appeal. That documentary evidence concerns its operation of an agricultural enterprise (empresa agraria) engaged in the cultivation, development, and marketing of teak. According to the evidence to be examined, that activity is conducted by [Nombre 019] S.A., which operates as a going agricultural concern. Within this “Agricultural Enterprise” (“Azienda Agraria”), there are, among other matters, contractual obligations to third parties arising from the sale of standing teak timber from the properties, employer obligations (obligaciones obrero patronales), and forestry oversight arrangements (regencias forestales). The ordered suspension causes harm to agricultural acts (actos agrarios) that need not be halted in order to safeguard the interests that [[Nombre1] ] claims to hold in those teak crops.

Other reasonable, proportionate, and appropriate precautionary measures are available to protect his claim of ownership of the teak while ensuring the development and harvesting of the existing teak timber. Because the trees have a life cycle and are subject to biological and climatic risks, they require the material acts inherent in that activity (maintenance), as well as technical measures to ensure their healthy development and optimal marketing.

VI- The reversal (revocatoria) ordered by this Court is decided at this procedural stage, before the initial stage of filing the complaint, answer, and reply in the ordinary proceeding has concluded. The pleading submitted by [[Nombre1] ] was filed after issuance of the interlocutory judgment on the precautionary measure (auto sentencia cautelar) and the appeal, and there remain disputes as to whether or not it was properly filed, which must be resolved by the trial court. It must also be clarified that the finding concerning the existence of the crop-growing operation and agricultural enterprise (empresa agraria) of [[Nombre2] ] S.A. arises within the scope of the subject matter of the anticipatory precautionary measure (medida cautelar anticipada) and does not prejudge the merits of the substantive right to be litigated in any eventual ordinary trial. This is because, in the appeal under consideration, and subsequently but still within the anticipatory precautionary-measure proceeding, various items of documentary evidence were submitted; when [[Nombre1] ] entered an appearance on October 23, 2020, he was deemed served and made no statement concerning them.

They are set forth below. First, a contract entitled Private Contract for the Purchase and Sale of Teak Trees was attached, executed by [[Nombre3] ] as attorney-in-fact for the selling company and [Nombre7] , in his capacity as manager vested with powers of attorney for Forlumber Limitada, under which the latter purchases 50 containers of timber from the standing trees from which the timber is to be extracted, as marked by the Forest Regency (Regencia Forestal) for that number of trees, in compliance with the regulations, permit procedures, and controls governing harvesting (aprovechamiento) on agricultural-use land without forest, pursuant to official guidelines. Its term was three months from its execution on July 20, 2020, extendable by agreement. The price and method of payment were established in accordance with the annexes, with an advance payment of $25.000 dólares at the start of operations, to be deposited into the seller’s bank account, and monthly electronic invoices were to be issued as directed by the buyer.

Conditions concerning the extraction and quality of the trees were established. The seller’s obligations included maintaining the Forest Regency in force, providing the forestry regent’s reports and certificates of origin, and allowing unrestricted access to the properties, among others. The buyer was responsible for the extraction process and for bearing its costs and transportation expenses. It was required to preserve the native trees at the site and comply with environmental legislation, including that governing water resources, protection areas (áreas de protección), waste management, chemical products, occupational safety, and insurance policies, among other matters. The seller was also to verify that the trees cut were those sold. The contract further contained various conditions and annexes concerning the quality, weighing method, and calculation of the timber extracted (images 318 to 306).

As its second item of evidence, it submitted the company’s payroll records from the Caja Costarricense del Seguro Social for June through December 2019, listing approximately 17 employees (images 280 to 293); a corporate authorization certificate (personería) for [[Nombre2] ], whose attorneys-in-fact are its president and secretary, [[Nombre3] ] and [[Nombre10] ], respectively, appointed since August 2012 (image 277); and two Forest Regency forms, numbers 000778 and 0000779, bearing the dates entered by Forestry Regent Víctor Hugo Venegas Sánchez and a February 2020 received stamp from the SINAC Subregión de Santa Cruz Carrillo Guanacaste, for harvesting a plantation on properties [Valor 001], [Valor 002], and [Valor 003], covering thirty hectares, and on property [Valor 004], covering ten hectares, together with the regency contract dated February 19, 2020, filed with the Colegio de Ingenieros Agrónomos (images 270 to 273).

It also submitted deeds establishing electric-line and right-of-way easements (servidumbres de líneas eléctricas y de paso) in favor of the Cooperativa de Electrificación Rural del Guanacaste, dated March 15, 2019, encumbering properties [Valor 003], [Valor 001], and [Valor 002] belonging to [[Nombre2] ] S.A., in which [[Nombre1] ] appeared on behalf of the company. The easement was granted free of charge, and it states that the Cooperativa may, at its own expense, cut branches or trees located within the easement corridor or within its strips that come within five meters of the lowest lines (images 267 to .255). In a subsequent pleading, [[Nombre2] ] S.A. states that the possession (posesión) claimed by [[Nombre1] ] is impossible in view of the criminal convictions he has received. It asserts that the image the plaintiff has attempted to portray—of a helpless older adult who made an investment “in pursuit of his retirement pension,” which is now being abruptly taken from him—is inaccurate.

What exists is a family relationship, not a business relationship (vínculo negocial). He is a person of considerable means, in a position of power, who seeks to deprive his wife and daughters of protection and dispossess them of property that has belonged to them since 1990, thereby causing them financial harm through economic violence, consistent with his criminal record. It attached a criminal judgment convicting him of Complicity in Cocaine Trafficking, issued in 1994, and a judgment from that jurisdiction finding him guilty of Attempted Aggravated Fraud in Ideal Concurrence of Offenses (Concurso Ideal), as well as another judgment involving his relatives. Accordingly, they state, he is currently serving a four-year sentence of house arrest with electronic monitoring, and his claim of possession is therefore impossible given his criminal status. Criminal judgments were submitted (images 25 to 253 of the digital case file in pdf format), including the 1994 conviction of [[Nombre1] ] for the offense of drug trafficking and the criminal judgment of May 30, 2017, in case file EXPN1, issued by the Tribunal del Juicio de San José, Tercer Circuito Judicial, at 13:15 hours on May 30, 2017, in which he was convicted of attempted aggravated fraud and use of a forged document in ideal concurrence of offenses and was placed under house arrest for four years in lieu of imprisonment.

Also submitted was a motion for prompt disposition (escrito de pronto despacho) dated October 19, 2020, filed before the trial court, stating that the appeal must urgently be decided and the measure vacated because of the harm to the agricultural activity. That pleading states that [[Nombre1] ] is a very wealthy person who abuses his power by inflicting economic violence upon [[Nombre3] ] and his daughters. The present matter is not agricultural but concerns a family relationship. He failed to inform the court that he is serving a prison sentence and therefore cannot exercise possession or management of the company’s properties. He conceals his history of cocaine trafficking, which creates reasonable doubt as to the credibility of his allegations against his wife and daughters. It also states that doña [[Nombre3] ] is an older adult. The application for a Precautionary Measure is based on false facts.

There is no evidence of any contract or agreement permitting [[Nombre1] ] to use or enjoy the properties for his retirement or during his retirement years. It is false that he developed a personal agricultural enterprise; rather, it was a family enterprise, and he was not granted any right of possession. It explains that, while acting as administrator and in his capacity as husband and father, [[Nombre1] ] committed numerous abuses and diverted funds to his personal accounts without involving his wife and daughters, who are shareholders of the defendant company, which is why his general power of attorney with full authority (poder generalísimo) was revoked. Upon learning of that revocation, he asked his daughters to turn over the shares they had owned since the early 90´s, threatening retaliation against the company and against them if they refused; he then carried out that threat. He dismissed his daughter [[Nombre10] ] from the company SNH and cut off all financial assistance to [[Nombre11] ].

He canceled payments for their BMI company health insurance in order to pressure them. His employees subsequently filed an environmental complaint against [[Nombre2] ] S.A. before MINAE. He stopped paying the CCSS and his employees’ payroll and told his daughters to deal with matters concerning the land themselves. No dispossession occurred. They state that his purpose in committing these acts is to destroy the agricultural activity to the detriment of his wife and daughters. They request that the precautionary measure be lifted after an adversarial hearing (contradictorio) and that both accounts be examined. They state that the measure is adversely harming the agricultural enterprise’s operations, listing the following:

  • 1)There is a current timber purchase contract with Forlumber Limitada that is being breached because of this precautionary measure. The company’s entire operation has been halted and it is sustaining daily losses while continuing to pay its payroll and cutting-equipment rentals, even though everything had already been contracted. Consequently, [[Nombre2] ] is in a highly compromised position because it has no means of reimbursing these losses. The buyer is demanding explanations, which causes the appellant, the plaintiff’s daughters, and his wife great distress, uncertainty, and anxiety.
  • 2)When the precautionary measure took effect, timber had already been cut and was ready for loading in accordance with the specifications of the contract with Forlumber Limitada. That timber is lying on the ground and, because of inclement weather and rain, many trees are exposed to the elements, with their bark peeling off and covered in sediment and insects. This jeopardizes compliance with the contractual quality requirement, which states that the timber may not have peeling bark or be contaminated because it is intended for export. Some trees are beginning to show damage to the heartwood (duramen) (the heart of the tree), rendering them unusable. This represents an enormous loss in the product’s economic value and deterioration in its quality. (Photos Attached)
  • 3)Without income, it will be impossible to continue paying the CCSS payroll contributions (payroll attached). This constitutes social harm.
  • 4)Payments to employees, administrators, laborers, accountants, and other expenses are going unpaid, leaving many families that depend on this agricultural activity without protection.
  • 5)It will be impossible to make payments under the existing arrangement with the CCSS or to pay taxes to Tributación, including income and municipal taxes, among others. This causes serious harm to society and to the agricultural enterprise.
  • 6)It will be impossible to pay severance benefits (prestaciones) to the laborers dismissed during [[Nombre1] ]’s administration. The pleading included CCSS payroll records, Billing Details for August 2020, and photographs showing a large number of logs lying exposed on the ground (images 16 to 23 of the digital case file in pdf format). After that pleading was filed, while transmission to the Tribunal Agrario of the appeal now being decided remained pending, the applicant for the anticipatory precautionary measure entered an appearance before the trial court through a pleading dated October 23, 2020, arguing that the motion for reversal filed by [Nombre 019] S.A. against the order entered at 15 hours 15 minutes on October 1, 2010—which denied the motion for reversal filed against interlocutory judgment No. 161-2020, entered at sixteen hours and forty-six minutes on July 7, 2020—must be denied (images 3 to 6; all references are to the digital case file in pdf format). Accordingly, by entering an appearance, he was deemed served with all arguments and evidence submitted by [Nombre 019] S.A. and described in this recital (considerando), pursuant to Article 10 of the Ley de Notificaciones Judiciales.

VII- It should be mentioned that, in the initial filing requesting an advance interim measure (medida cautelar anticipada) (images 567 to 579 of the digital case file in PDF format), it is stated that [[Nombre1] ] has been an agricultural entrepreneur, cattle rancher, and aviator. He is an older adult. He married [[Nombre3] ], from whom he has been de facto separated since late 1997. He states that, in the 1990s, he began cultivating teak as a long-term investment to provide a retirement fund for his old age. To that end, he founded and became a shareholder of [Nombre 019] S.A. and subsequently held a right to use and enjoy the land (uso y disfrute de la tierra). With his own money, over the years he purchased several properties on behalf of the aforementioned company, in exchange for being able to exploit them for agricultural and livestock purposes, particularly teak cultivation and cattle raising.

He refers to Exhibit B as evidence, which consists of a certificate of corporate standing (certificación de personería) for the company. He states that he has maintained this activity for 20 years with his own funds and that, for this purpose, the company granted him sufficient power of attorney, always with the knowledge of its current president, [[Nombre3] ]. Allegations six through ten state that, with the knowledge of the company’s legal representative, he was granted the use and enjoyment of the company-owned properties so that [[Nombre1] ] could conduct his agricultural and livestock business there in consideration for the money he had invested in purchasing those properties over the years. The company’s legal books were thus delivered to him in custody and as security. He conducted this activity for the last 20 years, providing the money to purchase the properties in exchange for their indefinite use and for developing a long-term teak-growing project.

He states that the first properties, acquired in the 1990s, were adjoining and nearby properties located in [[Nombre6] ], canton of [[Nombre4] 010], [Dirección1] [ ], numbers: [Valor 008], [Valor 009] and [Valor 010]. Also included were properties [Valor 011], [Valor 012], [Valor 002], [Valor 011], [Valor 013], [Valor 014], [Valor 015], [Valor 001] and [Valor 016]. He further states that he was granted suitable power of attorney to process exploitation permits, including forestry contracts, registration of forestry oversight (regencia), certificates of origin, permits, among others. He states that the acquired properties were former cattle parcels covered in scrubland and dense brush. The first two were named [[Nombre4] ] and [[Nombre12] ]. Because of their originally rugged conditions, the land first had to be cleared, burned, and prepared. Cattle were kept on some of the properties, but most were devoted to teak planting, which would be harvested once mature for cutting; this would take an average of approximately 20 years.

He states that, during the initial stage, he devoted himself to preparing the first properties acquired; pseudo-teak stakes were purchased in the Nicoya area and planted on the cleared land. The work progressed gradually from the first through the third year. That technique failed, compounded by a fire on neighboring land that burned the remainder of the property. Consequently, the first planting was lost. He adds that he subsequently established his own nursery on his land, where there is also a house and an aerial spraying business, and began producing his own plants. During the dry seasons, according to his account, land preparation normally began in March of each year, and cultivation started on [[Nombre4] ] and [[Nombre12] ], and later on the others. This had been done for 20 years under the aforementioned agreement on properties owned by [[Nombre2] ] S.A, where a successful cattle-raising and teak-growing business was developed through his own personal, financial, and entrepreneurial efforts.

He describes the work he had to perform to care for the plants, including growth management, fertilization, brush clearing, and the continued planting of all the properties that the company acquired with money from [[Nombre1] ]. All of the foregoing was done under the same aforementioned agreement. He explains that the first thinnings (raleas) are performed after 4 or 5 years and are discarded. He was able to sell a couple of them to cover some basic costs of his enterprise. However, the actual recovery and return on the investment would occur after 20 years, namely in the year 2020, when the mature timber could be sold. This was intended to serve as [[Nombre1] ]’s pension to support him in his old age, particularly in view of his health problems. He estimates that approximately 900 trees were planted per hectare and that, by February, each hectare should contain 250 to 300 primary trees and approximately 200 to 300 offshoots growing from the rootstock, approximately 8 to 12 years old and with trunks that could already measure approximately 70 to 80 centimeters.

This was due to proper management of regrowth. He states that there should be at least 600 trees per hectare, distributed across approximately 700 hectares of teak. He states that the properties contain Cocobolo, Ron Ron, and other precious-wood trees that were being protected and left untouched because they are endangered species. In his initial filing, he recounts that all expenses associated with teak cultivation were paid by the appellant, and he calculates his investment at 8.128.893, 08 dollars. That amount does not include the purchase of the land, the investment in cattle, or other expenses that are still being quantified. He attaches as evidence a certification from a certified public accountant. In allegation 27 of his initial filing, he states that, unexpectedly, once the teak had matured for cutting in February del 2020, [[Nombre13] ] informed him that, acting on instructions from the company represented by [[Nombre3] ], he had installed gates at the entrances to the properties and prohibited [[Nombre1] ] and his crews of laborers from entering.

From that time onward, they have been unable to enter and have been denied access. This occurred even though, for 20 years, he had been the person who developed the cultivation operation and kept cattle there without any impediment. This coincided in time with a communication from his attorney, Erick Ramos. He was unable to take any action because of a serious illness and heart surgery, as documented in the medical report he attached. Finally, the appellant states that he was informed that the forestry manager (regente) for the properties, whom he had retained, was replaced by another person identified as [Nombre5], who submitted a certificate of origin to the Área de Conservación Tempisque on 20 de febrero del 2020 concerning part of the teak plantation. That date coincides with the period when he was denied entry. He states that, on 3 de abril del 2020, the aforementioned environmental manager filed a complaint concerning those properties, indicating that there were irregularities involving the cutting of trees within a water-resource protection area (área de protección hídrica).

The required inspection was conducted, and MINAE officials were able to verify on 6 de abril del 2020 that teak trees had been felled on that property in unauthorized cultivation areas and that trees in the water-resource protection area had also been completely cleared. They also observed the felling of at least one Jobo tree. He characterizes these events as extremely serious and requiring an urgent protective measure, given the environmental damage to the properties’ water-resource protection areas. He stated that this evidence shows that the teak timber he cultivated is being cut and that there is discussion of a possible sale. Furthermore, the property’s registry record contains a notation of a transfer by the company in favor of a Banco Nacional trust, which requires urgent precautionary measures because any resulting damage would be irreparable. As grounds for the interim measure and advance taking of evidence (prueba anticipada), the filing cites the need to prevent environmental damage in light of the findings in the MINAE report of 28 de abril del 2020 concerning felling within water-body protection areas, tree girdling, and trees felled and uprooted with machinery.

It also cites the need to protect the health and life of an older adult with physical ailments who has additionally suffered psychological harm caused by being dispossessed of what was intended to be his retirement fund. It partially quotes the findings of the medical report concerning his condition. It seeks to prevent the irreparable loss of his twenty-year investment and efforts through the intended sale of the timber to third parties. It also seeks to prevent the sale of the properties, according to information being circulated and the notation appearing in the registry entry, and to prevent the felling of precious-wood trees. He believes that the requirements for interim measures (medidas cautelares) have been met. He requested:

  • 1)a judicial inspection (reconocimiento judicial) to verify the condition of the plantations, the felling of precious-wood trees and trees in protection areas, the existence of cattle belonging to the appellant, and any other matters the court deems relevant.
  • 2)A court-ordered expert assessment (pericia judicial) by a forestry engineer to determine the current condition of the plantations, their market value, the costs of a plantation in its current condition, the existence of recent cutting, and an estimate of the damage to the plantations that takes into account the teak that was cut and the damage to the plantation and the environment.
  • 3)A request that MINAE provide the forestry-management reports for the properties in question and related documentation from the years 2019 to 2020 concerning the new forestry management and his dispossession of possession. As an advance interim measure, he requests:
  • 1)That the company be ordered to refrain from cutting or felling trees of any kind or modifying the plantations in any manner. That it not sell or otherwise dispose of them until the merits of the dispute have been resolved, and that it not sell any cattle.
  • 2)That the Dirección General Forestal and Área de Conservación Tempisque be notified of the filing of the action.
  • 3)That the Dirección Aduanera del Ministerio de Hacienda be notified of the existence of this action so that the export of teak timber originating, according to the company’s certificates of origin, from [[Nombre2] ] S.A. may be prevented. As standard interim measures (medidas cautelares típicas), he requests that notice of the action be recorded in the registry entries covering the teak plantations and cattle not owned by the company. This is based on the claims for reverse accession (accesión invertida), possible acquisitive prescription (usucapión), or breach of contract. He argues that the company never paid any money toward the purchase of the properties and has breached the obligations that would allow the properties to belong to it, which constitutes unjust enrichment (enriquecimiento sin causa). He invokes Article 78 of the Código Procesal Civil and believes that he has established a prima facie case (apariencia de buen derecho), given the possession he has exercised for 20 years through acts of cultivation, as evidenced by the accountant’s certification. He asks that the measures be granted without hearing the opposing party. As evidence, he attached a certificate of corporate standing for [[Nombre2] ] and [Valor 020] S.A. (images 582 to 583, 483 and 486 to 487), property-registry certificates for the properties registered to [Nombre4] of [Nombre 019] S.A. (images 585 to 610, 408 to 409), a two-page document entitled Report on the Results of Previously Agreed-Upon Procedures issued by public accountant [Nombre14] (images 611 to 612), the Medical Report of 20 de mayo del 2020 concerning [[Nombre1] ] (images 614 to 615), the MINAE Environmental Complaint Inspection Report, official letter ACT-OSRSCC-318-2020 of 28 de abril del 2020, copies of checks issued by [Valor 020] S. A. to [[Nombre3] ] and receipts for funds paid by [[Nombre2] ], stating that those expenses were paid to her through checks issued by [Valor 020] [Nombre5] (images 464 to 477), payments for expenses and attorney’s fees associated with the possessory-information proceeding (información posesoria) for the property, paid by [Valor 020] S.A, which resulted in the registration of property [Valor 021] (images 437 to 428), notarized property-registry certificates for the properties registered to [Nombre4] of [Nombre 019] S.A., dated 23 de setiembre de 1998 and 5 de octubre de 1998 (images 427 to 422, 419 to 420, images 413 to 410), and a copy of the registered deed of sale dated 16 de junio de 1990, under which [[Nombre15] ] sold to [[Nombre2] ] S.A.

represented by [[Nombre1] ], regarding property registration [[Placa1] ] (images 420 to 422); a copy of the certified deed of sale of property [Valor 016] in [[Nombre6] ], from [[Nombre16] ] to [[Nombre2] ] [Nombre5], dated June 25, 1991, in which [[Nombre1] ] appeared on behalf of the company (images 396 to 407); copies of deeds documenting the company [[Nombre2] ]’s purchases of properties in 1990, in which it was represented by [[Nombre1] ] (images 378 to 391); and the articles of incorporation of the company [[Nombre2] ] [Nombre5] by [[Nombre1] ] and [[Nombre3] ], dated May 29, 1990, in which they appear as shareholders and as president and vice president (images 375 to 376). All the evidence cited is in the digital case file in PDF format). In addition, a judicial inspection (reconocimiento judicial) was conducted on June 17, 2020 (digital case file, images 364 to 365, PDF format), during which it was recorded that, first, a property planted with Transvala grass and enclosed by a four-strand wire fence was observed.

Another property, known as [[Nombre17] ], had a chained gate that prevented entry. Inside, cattle tracks and fresh manure were observed. The record states that the inspection then proceeded to another property known as [Valor 022], used for teak cultivation, where, next to a stream, three areas of cut and sawn timber were observed, and some of the logs were stacked on supports. The inspection proceeded to [[Nombre18] ], where approximately 3 hectares of felled timber were found on the ground on both sides of the road. It is stated that, in this area, a large amount of timber appears to have been extracted, as evidenced by the trunks and branches observed, and that the river protection area (área de protección del río) was not respected. (Images 364 to 365 of the digital case file in PDF format), as well as photographs showing teak trunks already felled and lying on the ground, two of them in the channel of a stream).

VIII- For this Chamber, the combined consideration of this evidence and the cited evidence submitted by the company [[Nombre2] ] leads to the conclusion that the stay requested by [[Nombre1] ] and granted by the trial judge is not appropriate to ensure that the former will be able to enforce a potential judgment in ordinary proceedings. Staying all maintenance and harvesting activities would frustrate the purpose of his interest—which, according to his initial application for an interim measure (medida cautelar), is to secure recovery of his investment—both for him and for the company, because the timber would be damaged and could not be marketed. This is because it is a product that deteriorates if it is not tended and harvested at the technically appropriate ages of the crop. The documents concerning the registry history of the various registered properties acquired since the 1990s, the incorporation of [[Nombre2] ] S.A., the serious alleged family disputes, and [[Nombre1] ]’s criminal record are not relevant to the purpose of this interim measure, which must safeguard the continuation and harvesting of the teak crop.

In this Chamber’s view, the appellant company is correct in asserting that, at this stage of the proceedings, there is no evidence of the usufruct agreement (contrato de usufructo) that the applicant for the interim measures claims to hold; the certified public accountant’s certification upon which the interlocutory judgment relied to deem that issue proven is insufficient. It is a document issued at the claimant’s unilateral request, and the underlying documents supporting the conclusions provided by the public accountant retained for that purpose are not in the record. Furthermore, a standing timber purchase and sale agreement (contrato de compra venta de madera en pie) between [[Nombre19] ] [Nombre5] and Formulber Limitada was being performed when the interim judgment was issued; the seller has insured workers and must meet the payment of those obligations and others inherent to a teak-farming enterprise.

Accordingly, the interlocutory judgment must be reversed insofar as it ordered [[Nombre19] ] S.A. to suspend the cutting or felling of teak timber on the properties at issue, as well as the sale of the teak timber located on the real properties involved in these proceedings, with a warning that failure to comply would constitute the offense of disobedience to authority. The order was communicated by official letter to the Dirección General Forestal - Área Regional Tempisque and the Dirección de Tributación Directa. The trial court must therefore notify those government offices of the ruling herein and advise them that the suspension decreed in the appealed decision has been lifted because that decision is being reversed. Regarding the environmental damage reported by SINAC in the cited document, it must be noted that an investigation has begun before that administrative authority to determine who is responsible for cutting trees in the stream protection areas (áreas de protección), since it is unknown whether the cutting was performed by the officials of the Cooperativa that holds electric-line and right-of-way easements (servidumbres) in its favor, representatives of [Nombre 026] S.A., employees of the company purchasing the teak timber, or a third party unrelated to the foregoing; the conclusions reached must be reported in the case record.

The trial court shall request that information from the competent MINAE officials in the area. In addition, [Nombre 026] S.A. has a duty to monitor the properties to ensure the effective protection of their native trees and the forest cover (cobertura forestal) of the protection areas surrounding the water bodies located on the properties. Any situations involving risks of damage or actual damage identified in those areas must be reported immediately to SINAC or the Fiscalía Ambiental. It should be noted that, because interim measures are temporary, they may be modified if either party demonstrates a change in circumstances, or by the judge at any stage of the ordinary proceedings currently pending review. [Nombre9] in this case, in which an anticipatory interim measure (medida cautelar anticipada) was adjudicated before completion of the stage for admitting the complaint in the principal proceedings, the answer, and the reply.

IX- Counter-security (Contracautela). By virtue of the reversal ordered herein, which lifts the suspension of [[Nombre2] ] S.A.’s activities, the teak cultivation and harvesting operations conducted on the properties under its [Nombre4] shall continue. Given the claim of the applicant for the anticipatory interim measure, who states that he seeks protection to recover the investment that he claims to have made from his own funds, counter-security is imposed on the aforementioned company, requiring it to submit semiannual income and expenditure reports concerning its teak-plantation cultivation, maintenance, and marketing activities once this ruling becomes final. The foregoing is intended to document the expenses and profits arising from the maintenance of the teak crops and the actual marketing of the teak harvest that is the subject of this anticipatory interim measure.

X- In light of the foregoing reasoning, pursuant to sections 1, 2, 26, and 54 of the Ley de Jurisdicción Agraria and sections 489 and 490 of the Código de Trabajo, resolution number 161-2020, issued at sixteen hours forty-six minutes on siete de julio del dos mil veinte, must be reversed insofar as appealed with respect to its order requiring [[Nombre19] ] S.A. to suspend the cutting or felling of teak timber on the properties at issue, as well as the sale of the teak timber located on the real properties involved in these proceedings, with a warning that failure to comply would constitute the offense of disobedience to authority, and its order that notice thereof be sent by official letter to the Dirección General Forestal - Área Regional Tempisque and the Dirección de Tributación Directa. Instead, insofar as appealed, the request for an order requiring the company to refrain from cutting or felling trees of any kind or otherwise modifying the plantations, and from selling or transferring them until the merits of the dispute have been decided, is denied.

The request to notify the Dirección General Forestal and Área de Conservación Tempisque of the filing of the action, and to notify the Dirección Aduanera del Ministerio de Hacienda so that the export of teak timber originating, according to the certificates of origin (guías de origen), from [[Nombre2] ] may be prevented, is likewise denied. The following counter-security is imposed sua sponte on [[Nombre19] ] S.A.: a) once this ruling becomes final, it shall submit semiannual income and expenditure reports concerning its teak-plantation cultivation, maintenance, and marketing activities; b) it shall monitor the properties to ensure the effective protection of their native trees and the forest cover of the protection areas surrounding the water bodies located on the properties. Any situations involving risks of damage or actual damage identified in those areas must be reported immediately to SINAC or the Fiscalía Ambiental.

The trial court shall: a) notify the government agencies to which it sent official letters concerning the suspension of [[Nombre19] ] [Nombre5].’s agricultural activities of the reversal ordered herein; b) request from the SINAC regional office the records of the actions taken in response to the tree cutting in stream protection areas documented in MINAE’s Environmental Complaint Inspection Report (Informe de Inspección por Denuncia Ambiental), official letter ACT-OSRSCC-318-2020 dated 28 de abril del 2020 XI- NOTE BY JUDGE LÓPEZ BARRANTES. The undersigned judge concurs with the decision reached in this ruling; however, he considers that the supplementary legislation applicable to agrarian interim measures (medidas cautelares agrarias) is civil procedural law rather than labor procedural law. In this regard, it is important to note that agrarian procedural legislation contains fairly limited provisions concerning interim measures, since it regulates only prejudgment attachment (embargo preventivo) and the notice of pending action (anotación de demanda), both of which are specifically prescribed measures.

Accordingly, as provided in Article 6 of the Ley de Jurisdicción Agraria, both proceedings and rulings shall be governed by the procedures established in that law and, insofar as compatible, by the provisions of the respective procedural codes and the Ley Orgánica del Poder Judicial. Article 26, in turn, provides: “where the law is silent, the rules of labor legislation shall be applied by analogy or, failing that, the respective code of procedure, for the purpose of ensuring the due promptness and effectiveness of the proceeding” (The underlining does not appear in the original). For many years, this Court has maintained a settled line of case law regarding these particular provisions, strictly applying the Código de Trabajo and, where that legislation is silent, applying the Código Procesal Civil. Nevertheless, the aforementioned Article 26 refers to application by analogy, a concept defined by the Real Academia Española as a: “Relationship of similarity between different things.” Upon analyzing Articles 6, 26 and 79 of the Ley de Jurisdicción Agraria, the undersigned concludes that the application of labor procedural legislation is not the rule.

In other words, when the content of those legal provisions is harmonized, it follows that, where the Ley de Jurisdicción Agraria has left a gap concerning a procedural matter, the procedural legislation that must be applied is that which, in addition to being analogous, ensures the due promptness and effectiveness of agrarian proceedings, except in matters expressly addressed by the agrarian procedural law itself, as occurs with the appellate stage. Accordingly, it is the undersigned’s view that the rules of the Código Procesal Civil must apply in interim-measure proceedings because they are compatible with and similar to agrarian matters, given the similarity between the types of proceedings and claims filed in both jurisdictions. This is unlike the Código de Trabajo, which focuses on the employment relationships disputed before that specialized jurisdiction and therefore procedurally regulates the handling of disputes or obligations arising from employment contracts.

Thus, a review of Articles 489 through 494 shows that none of them is intended to address the claims ordinarily heard in agrarian matters. Solely to highlight these differences between agrarian and labor matters, reference may be made to Constitutional Chamber Judgment No. 1220-1990, which invalidated the exemption of parties from posting security (garantía) in prejudgment attachments, as previously governed by Articles 26, 33 and 34 of the Ley de Jurisdicción Agraria. In labor matters, by contrast, pursuant to Article 491, such prejudgment attachment may currently be ordered without the posting of any security, provided that two witnesses are offered to establish “prima facie” the personal performance of services and the truth of the fact or facts supporting the relief sought in the complaint. The foregoing is attributable precisely to the different dimensions of the two fields and the disputes heard in each.

Although both agrarian and labor law have a social focus, the application of either the Código de Trabajo or the Código Procesal Civil to this legal discipline must always take into account the principles of agrarian procedure (principios procesales agrarios), which have been extensively developed both by legal scholarship and by case law itself. Accordingly, it is the undersigned’s view that agrarian interim-measure proceedings must be governed first by the Ley de Jurisdicción Agraria and, where that law contains a gap, by the rules of the Código Procesal Civil in force when the complaint was filed, interpreted in light of the procedural principles of Agrarian Law, since that body of rules is analogous to this discipline.

POR TANTO:

On the matters appealed, Ruling No. 161-2020, issued at dieciséis horas cuarenta y seis minutos del siete de julio del dos mil veinte, is reversed insofar as it ordered [[Nombre19] ] S.A. to suspend the cutting or felling of teak timber on the properties at issue, as well as the sale of the teak timber located on the real properties involved in these proceedings, with notice that failure to comply could constitute the offense of disobedience to authority; and insofar as it ordered notice of that directive to be sent by official letter to the Dirección General Forestal - Área Regional Tempisque and the Dirección de Tributación Directa. In its place, and as to the matters appealed, the request for an order requiring the company to refrain from cutting or felling trees of any kind or from modifying the plantations in any manner, and from selling or otherwise disposing of them until the merits of the dispute have been resolved, is denied.

The request to notify the Dirección General Forestal and Área de Conservación Tempisque of the filing of the complaint and to notify the Dirección Aduanera del Ministerio de Hacienda so that it may prevent the exportation of teak timber originating, according to the certificates of origin (guías de origen) of the company [[Nombre2] ], is likewise denied. The following counter-security (contracautela) is imposed sua sponte upon [[Nombre19] ] [Nombre5].: a) it shall submit semiannual income and expense reports arising from its teak-plantation cultivation, maintenance, and marketing activities, once this ruling becomes final; b) it shall monitor the properties to ensure that their native trees and the forest cover (cobertura forestal) in the protection areas surrounding the bodies of water located on the properties are effectively protected. It shall immediately report to SINAC or the Fiscalía Ambiental any situations posing a risk of damage or any damage found in those areas.

The trial court shall: a) notify the government agencies to which it sent official letters concerning the suspension of the agrarian activities of [[Nombre19] ] S.A. of the reversal ordered herein; b) request from the SINAC regional office the records of the actions taken in connection with the cutting found in stream protection areas in the MINAE Environmental Complaint Inspection Report (Informe de Inspección por Denuncia Ambiental), official letter ACT-OSRSCC-318-2020 dated 28 de abril del 2020. VOTO N° 1209-F-2020 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las dieciocho horas cincuenta y nueve minutos del tres de diciembre de dos mil veinte.- MEDIDA CAUTELAR ANTICIPADA de [[Nombre1] ], [...] ; e [Valor 020] SOCIEDAD ANÓNIMA, cédula jurídica CED1 - - ; contra, [[Nombre2] ] SOCIEDAD ANÓNIMA, cédula jurídica [...], representada por su apoderada generalísima sin límite de suma, [[Nombre3] ], [...]. Actúa como apoderado especial judicial de la parte actora el licenciado Juan Gerardo Alfaro López, colegiado veintidós mil cuatrocientos uno y como abogado representante de la demandada el licenciado Jonatán Picado León, colegiado doce mil sesenta y dos. Tramitado ante el Juzgado Agrario del Segundo Circuito Judicial de Guanacaste, Santa Cruz. Conoce este Tribunal apelación contra auto-sentencia número 161-2020 de las dieciséis horas y cuarenta y seis minutos del siete de julio de dos mil veinte.- Redacta la jueza Castro García; y,

CONSIDERANDO:

I- Hechos probados . De esta naturaleza se prohíjan los hechos 1 a 3 por estar fundados en elementos probatorios que constan en autos. No así el número cuatro por haberse consignado no un hecho sino una manifestación del escrito inicial de la medida cautelar anticipada. Respecto al hecho 5 se omite pronunciamiento por no ser objeto del recurso. De esta naturaleza se incorporan en esta Instancia: 6) Existe plantación de teca sometidas a regencia forestal en fincas inscritas a [Nombre4] de [[Nombre2] ] S.A. (prueba: reconocimiento judicial imagen 364 a 365 modo pdf y certificaciones registrales en imágenes de las fincas a [Nombre4] de [[Nombre2] ] S.A. en imagen 585 a 610, 408 a 409, formularios de Regencia Forestal números 000778 y 0000779 de fechas del Regente Víctor Hugo Venegas Sánchez, con sello de recibido del SINAC Subregión de Santa Cruz Carrillo Guanacaste de febrero del 2020 para aprovechamiento de plantación en fincas [Valor 001], [Valor 002], [Valor 003] de treinta hectáreas y en finca [Valor 004] en diez hectáreas y contrato de regencia del 19 de febrero del 2020 presentado ante el Colegio de Ingenieros Agrónomos en imagen 270 a 273 de expediente digital modo pdf.). 7) La sociedad [[Nombre2] ] [Nombre5] tiene una planilla de trabajadores asegurada desde el año 2019 ante la Caja Costarricense de Seguro Social, rubricó contrato de compra venta de árboles de teca en pie con Forlumber Limitada en ejecución sobre las fincas de [[Nombre6] ] inscritas a su [Nombre4] y contrato de regencia forestal (prueba/ Contrato Privado de Compraventa de Árboles de Teca suscrito con la sociedad Forlumber Limitada.

Copia de las planillas de la sociedad demandada en la Caja Costarricense del Seguro Social en imagenes 318 a 306 y 280 a 293, formularios de Regencia Forestal números 000778 y 0000779 de fechas del Regente Víctor Hugo Venegas Sánchez, con sello de recibido del SINAC Subregión de Santa Cruz Carrillo Guanacaste de febrero del 2020 para aprovechamiento de plantación en fincas [Valor 001], [Valor 002], [Valor 003] de treinta hectáreas y en finca [Valor 004] en diez hectáreas y contrato de regencia del 19 de febrero del 2020 presentado ante el Colegio de Ingenieros Agrónomos en imagen 270 a 273 de expediente digital modo pdf)

II.Se recurre por [[Nombre2] ] (expediente digital imagen 299 a 304 modo pdf), el auto sentencia No. 161-2020 de las dieciséis horas y cuarenta y seis minutos del siete de julio de dos mil veinte, que corresponde a la resolución de medida cautelar anticipada de [[Nombre1] ] contra [Nombre 019] S.A. emitida sin audiencia a esa sociedad. (expediente digital imagen 550 a 555 modo pdf). En tal resolución se acogió la medida cautelar anticipada solicitada por [[Nombre1] ] y se ordenó por el juzgado de instancia: " De conformidad con las citas de hecho y de derecho se declara con lugar la medida cautelar solicitada por [[Nombre1] ], contra de [[Nombre2] ] SOCIEDAD ANÓNIMA, representada por [[Nombre3] ], de calidades que constan en autos. Se ordena a la demandada suspender la actividad de corta o tala de madera de teca en las fincas del conflicto, así como la venta de la madera de teca existente en los inmuebles involucradas en éste proceso, lo anterior bajo apercibimiento de incurrir en delito de desobediencia a la autoridad en caso de incumplimiento, comuníquese ésta orden mediante oficio a la Dirección General Forestal - Área Regional Tempisque y a la Dirección de Tributación Directa y póngase dicho oficio a disposición de la parte interesada para su diligenciamiento.

Se reserva la solicitud de depósito judicial de la madera y solicitud de embargo para una vez que la accionante cumpla lo siguiente: 1) Estimar las presentes diligencias. 2) Indique el monto por el cual pide el embargo, bienes sobre el cual debe recaer y aporte el depósito de garantía y entero de gobierno. Cumpla lo anterior en los siguientes cinco días bajo apercibimiento de resolver con los elementos que consten en autos las cautelares reservadas en éste resolución. Se hace saber que la medida cautelar decretada caduca en un mes a partir de su decreto cuando no se ejecute por culpa de la parte y si dentro de dicho plazo no se interpone la demanda respectiva. Notifíquese a la demanda de forma personal a su representante en virtud del apercibimiento penal que se hace. Notifíquese.-"

III- Como temas de apelación se exponen los que se citan a continuación y se agrupan por temas: 1.- Respecto a información no rendida por el solicitante de la medida cautelar. Aduce, la medida cautelar es inviable por no mediar incumplimiento contractual alguno y ser falsa la relación contractual que indica tiene con la sociedad [[Nombre1] ], referida a que a cambio de su inversión de más de ocho millones de dólares en el proyecto de reforestación y compras de fincas, se le permitiera el uso y disfrute de las mismas para la época de retiro o jubilación. Hecho carente de prueba y sobre la la certificación que aportó, será impugnada en el proceso de conocimiento respectivo y no lo aceptan. Cita el recurso, es claro que [[Nombre1] ] es el padre y esposo de las accionistas de [Nombre 019] S. A. y se confunden aspectos de familia y patrimoniales con el tema agrario, lesionando la misma actividad agraria.

Agrega, los derechos que indica ostenta, que niegan por su parte, podrían ser tutelados por otros medios, sin que se afecte la actividad agraria que la empresa desarrolla ininterrumpidamente desde hace más de 30 años. Pues, la discusión que desea introducir, no puede perjudicar la continuidad de la actividad agraria, que responde a un interés público superior. Lo cual se hace ver en la misma pieza recurrida cuando se indica en el el hecho probado primero que la teca cultivada “… ES UN CULTIVO ADULTO EN ÉPOCA DE APROVECHAMIENTO”. Es decir, la falta de tala en esta edad de la plantación dañaría la cosecha y se perdería su valor; según criterio de los ingenieros forestales. Apela, en la decisión impugnada se expuso respecto a la apariencia de buen derecho: “… si bien el usufructo que dice el actor registralmente no lo soportan si es importante hacer ver que su inversión al proyecto ha sido cuantificada por la contadora pública…”.

Lo que califica de inaudito, por cuanto lo indicado respecto al contrato que invoca, no esta sustentado en contrato, usufructo o prueba alguna . Aunado a la minimización del solicitante de su relación familiar de las accionistas de la totalidad del capital social de la sociedad. Y sus discusiones patrimoniales y familiares, no son motivo para suspender la actividad agraria de muchos años. Lo que pretende el actor es busca ahogar a la demandada de mala fe; lo cual quiebra cualquier apariencia de buen derecho y su petición cautelar no es adecuada al fin tutelado. Expone, ha de citarse que el actor fue socio y fundador de la sociedad junto con su esposa [[Nombre3] ]. Sin embargo desde el año 1991 no existe ninguna participación accionaria en la empresa desarrollada por la sociedad. Tampoco su vínculo de esposo con la representante legal y accionista, ni sus hijas. Discusiones que deben desarrollarse al margen de la actividad agraria.

Aspecto prioritario de la jurisdicción agraria. Indica, el actor fue administrador de la finca con un poder otorgado al efecto, pero se le revocó precisamente por su mala administración. Todo lo cual es discutible en las sedes que correspondan, que se paralice la actividad agraria. 2.- Actividad agraria en desarrollo. Reclama, existe una actividad agraria de reforestación y corta de Teca en ejecución desde hace muchos años al ser la actividad ordinaria de [[Nombre2] ] S.A. Y no como lo relata el actor, cuando menciona de forma repentina se está cortando Teca; como si fuera un hecho extraordinario en la finca. Lo cual se constata al recorrer las fincas. Agrega, para ese fin existen contratos con terceros, una planilla activa de más de seis empleados. Si el actor dice tener derechos económicos contra la sociedad, bien puede discutirse, pero es inaceptable que se paralice la actividad agraria cuando existen contratos con terceros.

Lo decido conlleva a: (i) un incumplimiento grave para la sociedad anónima, (ii) el impago para los trabajadores de la finca con grave afectación social, (iii) la alteración de la actividad agraria habitual de la finca. Siendo una medida desproporcional, irrazonable e inconsecuente con lo que se pretende tutelar: un derecho económico sobre la finca. No estamos ante una medida adecuada al fin que tutela. Sobre la existencia del contrato con terceros de compraventa de árboles de teca, de forma dolosa se oculto por el actor. Pues se obligó la sociedad con la compradora Formulber Limitada, cédula jurídica CED2, representada por [Nombre7] . Cuyo giro comercial es la compraventa de madera dentro del territorio nacional para la exportación. Contrato suscrito con la empresa el 20 de julio del 2020 sobre la venta de 50 contenedores de Teca en pie. Refiere, en ese acuerdo que se aportó como prueba se citó: “… el COMPRADOR extraerá dicha madera… de conformidad con la legislación aplicable, así como lo dispuesto en el reglamento número 38863, Reglamento para trámite de permisos y control de aprovechamiento maderable”.

El precio se determinó como corresponde en la práctica de venta de teca, a un precio en dólares por contenedor según el promedio de circunferencias de las trozas. Se le afecta a ese tercero con lo resuelto en la resolución apelada. Además del daño a la sociedad recurrente, al estar el cultivo en época de aprovechamiento, como lo razona el a quo. En ese contrato sobre el precio, corresponde al que rige el mercado con parámetros objetivos. Existe la participación de regentes forestales y ambientales vinculados al proceso. Y se estima que la autoridad judicial fue inducido a error al citarse por el actor que: “la extracción de madera la cual ni siquiera está siendo aprovechada, nótese que la misma aún no había sido amontonada o empateada y dado las inclemencias del tiempo por fuertes lluvias de la época, es evidente que la madera cortada podría sufrir un proceso de deterioro rápido que será impedimento para poderse aprovechar de forma idónea dado la pérdida de valor económico, debido a la desmejora de la calidad”.

Razones por las cuales ha de revocarse lo fallado al no resultar cierta la afirmación del actor al respecto. Indica la recurrente, parte de la madera fue cortada por la sociedad Río Trading S.A. según contrato suscrito el 20 de febrero del 2020 de lo cual se adjunta copia. Pero por motivo del COVID-19 esa sociedad paralizó la actividad y se procedió de forma diligente a contratar a [[Nombre8] ] S.A., cédula jurídica [CED3 ]. Agrega, la madera vendida ha sido retirada a pesar de las inclemencias del tiempo y pagando el precio correspondiente.Producto que ha sido aserrado y retirado. Lo mencionado, reclama, debe ser complementado con las existencia del contrato ya descrito con Formulber Limitada, que tiene derecho a cortar y retirar madera que se le vendió. Acusa, sin necesidad se ha detenido el proceso productivo agrario, pues la discusión patrimonial que desea plantear el actor, se resuelve con otros mecanismos ajenos a la paralización de contratos y obligaciones existentes con terceros.

Argumenta la recurrente, se omite por el actor citar, sobre parte de la madera que pudo observarse talada, que corresponde a la que él mismo firmó con el poder de representación que tenía, revocado por mal uso del mismo. Pues suscribió contratos con la Cooperativa de Electrificación Rural de Guanacaste, Coopeguanacaste R.L., constituyendo servidumbres permanente de paso común y de paso de líneas eléctricas. Y en atención a ello, Coopeguanacaste R.L. ha talado una importante cantidad de árboles en el trazo por donde pasa tal servidumbre sin retirarlos. 3.- Afectación directa a las personas empleadas agrícolas de la sociedad [[Nombre2] ] S.A. Reclama, además de lo mencionado, la planilla de trabajadores de la sociedad son perjudicados en su derecho fundamental al trabajo, al cortarse el flujo de caja del patrono. Indica, adjunta planillas de la Caja Costarricense del Seguro Social que acreditan la existencia de los trabajadores de las fincas cuya paralización se pretende.

Los que resultan necesarios mantener por trabajar y cuidar la finca, a fin de evitar incendios forestales ante el peligro de quemas constantes en terrenos vecinos. Lo que obliga a mantener varios turnos de cuido en la propiedad. Califica de perverso el interés del actor de detener la actividad e impedir la liquidez de caja necesaria que permita mantener la actividad agraria. Asimismo, existen arreglos de pago que no podrán honrar, pólizas del INS, impuestos, cargas sociales y todos los gasto de mantenimiento de las fincas. Lo ordenado es una afectación generalizada al interés público. 4.- Sobre el peligro de demora, así como la racionalidad y proporcionalidad. Cita parcialmente que en el auto recurrido se razonó: : “… efectivamente al tratarse de un proceso ordinario complejo de incumplimiento de contrato, donde se pretende recuperar una inversión de más de ocho millones de dólares, su grado de complejidad implicará una duración considerable al contar con recurso de casación, quedando de sobra comprobado tal requisito”.

Lo que reclama sea revocado al confrontarse un supuesto interés de recuperación económica, “que tardará años” contra el daño irreversible de detener la actividad agraria de producción de una plantacion en época de aprovechamiento. Que a criterio de ingenieros no resulta recomendable por el daño que sufre la madera ya lista para ser cortada. Por lo que estima inexistente la racionalidad y proporcionalidad el suspender la actividad agraria de producción. Esboza, resulta racional y proporcional, en caso de pretende la tutela de un eventual derecho patrimonial, buscar cualquier otro medio, menos destruir o frustrar la actividad agraria. [Nombre9] cuando el actor, esposo de la representante legal y progenitor de las accionistas, reclame derechos cuando desde el año 1991 no tiene participación alguna en la sociedad, más que como administrador con poder otorgado al efecto, el cual empleó indebidamente.

Señala, la medida cautelar está siendo mal utilizada como forma de coerción. Aportó como prueba: 1. Copia del “Contrato Privado de Compraventa de Árboles de Teca” suscrito con la sociedad FORLUMBER LIMITADA. 2. Copia de las planillas de la sociedad demandada en la Caja Costarricense del Seguro Social. 3. Copia del Contrato de Venta de Árboles de Madera de Teca. 4. Copia de los Contratos suscritos con Coopeguanacaste. 5. Copia de los contratos de regencia forestal.

IV- De forma previa cabe citarse lo decido por este Tribunal en Voto número 000942-F-2019 de las quince horas y treinta y ocho minutos del catorce de noviembre de dos mil diecinueve: " la Ley de Jurisdicción Agraria contiene varios vacíos procesales que deben ser integrados por el Código de Trabajo en primer orden y en su defecto, por la normativa procesal civil. Por ello, independientemente de la vigencia del Código Procesal Agrario, son de aplicación supletoria el Código de Trabajo número 9343 a partir del 25 de julio de 2017 y del Código Procesal Civil número 9342, el 8 octubre de 2018. En el código del proceso agrario se encuentra reguladas las medidas cautelares típicas, tales como el arraigo y el embargo preventivo (artículos 33 y 34 ibid.). Dada la ausencia de regulación especial en el cuerpo procesal agrario sobre medidas cautelares atípicas, y dada la supletoriedad del Código de Trabajo, se debe emplear en primer orden ese cuerpo legal.

Se aclara este asunto inició el 14 de mayo del 2019 según escritorio digital. Para ese momento ya se encontraba en vigor la ley del proceso laboral la cual regula las medidas cautelares en la sección V, numerales 489 a 494. El primer ordinal regula lo siguiente: “Antes de iniciarse el proceso y durante su tramitación, inclusive en la fase de ejecución, el órgano jurisdiccional podrá ordenar las medidas cautelares adecuadas y necesarias para proteger y garantizar, provisionalmente, el objeto del proceso y la efectividad de la sentencia. También, podrá ordenar cualquier medida preparatoria o anticipada necesaria para la preservación del ejercicio de un futuro derecho, así como cualquier otra medida atípica que no exceda los límites de racionalidad y proporcionalidad. En estos casos, el órgano puede disponer de forma prudente todo lo necesario para lograr el objetivo de la medida, de modo que no se incurra en extralimitaciones.

Con respecto a la tipología de las medidas, tanto cautelares como preparatorias, a los efectos y a la forma de practicarlas, sustituirlas o levantarlas, se estará a lo dispuesto en la legislación procesal civil, con las excepciones que se indican a continuación”. Esta norma se debe complementar con el canon 490 de ese código. De lo anterior se establece: 1. Pueden ser instauradas antes o durante el curso del proceso incluyendo la etapa de ejecución de sentencia. 2. Procuran proteger y garantizar provisionalmente el objeto del proceso y la efectividad de la sentencia, preservar el ejercicio del derecho futuro. 3. Se admiten medidas atípicas las cuales deben ser racionales y proporcionales para garantizar el eventual futuro derecho. 4. Puede ser ordenada a solicitud de parte o de oficio. 5. Se tutela la contracautela de oficio, la cual debe de ser prudente y evitar la extralimitación. 6. Supletoriamente se remite al proceso civil en cuanto a la tipología, los efectos la forma de practicarlas, sustituirlas o levantarlas con las excepciones dada por la legislación laboral. 7.

En la práctica de la cautelar el tribunal debe actuar de manera diligente para evitar se frustre el fin perseguido. De lo anterior considera esta Cámara es dable continuar manteniendo el criterio de vieja data respecto a los requisitos de procedibilidad de las medidas. Las cuales, además, de haber empleado el derogado Código Procesal Civil de 1989, se alimentaban de la doctrina emanada de la Sala Constitucional de la Corte Suprema de Justicia, la cual es vinculante erga omnes de conformidad al numeral 13 de la Ley de la Jurisdicción Constitucional. En la sentencia número 7190 de las 15 horas 24 minutos del 6 de diciembre de 1994, ha indicado lo siguiente: "...Las medidas asegurativas o cautelares, según la más calificada doctrina, surgen en el proceso como una necesidad que permita garantizar una tutela jurisdiccional efectiva y por ello se pueden conceptualizar como "un conjunto de potestades procesales del juez -sea justicia jurisdiccional o administrativa- para resolver antes del fallo, con el específico fin de conservar las condiciones reales indispensables para la emisión y ejecución del acto final".

La doctrina entiende que la instrumentalidad y la provisionalidad son dos características fundamentales de las medidas cautelares y que sus principales elementos configurativos, exigen que deban ser: a) lícitas y jurídicamente posibles; b) provisionales, puesto que se extinguen con el dictado del acto final; c) fundamentadas, es decir, tener un sustento fáctico real con relación al caso particular; d) modificables, en el sentido que son susceptibles de aumentarse o disminuirse para adaptarlas a nuevas necesidades; e) accesorias, puesto que se justifican dentro de un proceso principal; f) de naturaleza preventiva, ya que tienen como objeto evitar inconveniencias a los intereses y derechos representados en el proceso principal; g) de efectos asegurativos, al pretender mantener un estado de hecho o de derecho durante el desarrollo del proceso, previniendo situaciones que puedan perjudicar la efectividad de la sentencia o acto final; h) ser homogéneas y no responder a características de identidad respecto del derecho sustantivo tutelado, con el fin de que sean medidas preventivas efectivas y no actos anticipados de ejecución".

De lo explicado de manera amplia se denota que se debe observar la apariencia de buen derecho, porque en el examen de proporcionalidad es menester observar a partir de la lectura de los hechos y pretensiones que la decisión a tomar por el órgano judicial tienda a mantener un estado de hecho o de derecho durante el desarrollo del proceso, previniendo situaciones que puedan perjudicar la efectividad de la sentencia o acto final, según lo explica la Alta Sala Constitucional...Dado lo reiterado en la novísima regulación procesal laboral sobre la razonabilidad, esta Sede ha considerado relevante retomar el desarrollo de tal examen a partir de los criterios de la Sala Constitucional referida. En la decisión 732-2001 de las 12 horas 24 minutos del 26 de enero de 2001 de la Sala Constitucional se delimitó el principio de razonabilidad de la siguiente manera: “V.- DEL PRINCIPIO DE RAZONABILIDAD COMO PARÁMETRO CONSTITUCIONAL.

La jurisprudencia constitucional ha sido clara y conteste en considerar que el principio de razonabilidad constituye un parámetro de constitucionalidad … Para realizar el juicio de razonabilidad la doctrina estadounidense invita a examinar, en primer término, la llamada "razonabilidad técnica" dentro de la que se examina la norma en concreto (ley, reglamento, etc.). Una vez establecido que la norma elegida es la adecuada para regular determinada materia, habrá que examinar si hay proporcionalidad entre el medio escogido y el fin buscado. Superado el criterio de "razonabilidad técnica" hay que analizar la "razonabilidad jurídica". Para lo cual esta doctrina propone examinar: a) razonabilidad ponderativa, que es un tipo de valoración jurídica a la que se concurre cuando ante la existencia de un determinado antecedente (ej. ingreso) se exige una determinada prestación (ej. tributo), debiendo en este supuesto establecerse si la misma es equivalente o proporcionada; b) la razonabilidad de igualdad, es el tipo de valoración jurídica que parte de que ante iguales antecedentes deben haber iguales consecuencias, sin excepciones arbitrarias; c) razonabilidad en el fin, en este punto se valora si el objetivo a alcanzar, no ofende los fines previstos por el legislador con su aprobación.

Dentro de este mismo análisis, no basta con afirmar que un medio sea razonablemente adecuado a un fin; es necesario, además, verificar la índole y el tamaño de la limitación que por ese medio debe soportar un derecho personal. De esta manera, si al mismo fin se puede llegar buscando otro medio que produzca una limitación menos gravosa a los derechos personales, el medio escogido no es razonable...” (En igual sentido Votos Nos. 843-02 del 30 de enero de 2002; 5374-03 del 20 de junio de 2003; 340-04 del 16 de enero de 2004; 846-05 del 28 de enero de 2005; 1800-05 del 23 de febrero de 2005; 2236-05 del 2 de marzo de 2005; 1806-06 del 15 de febrero de 2006; 1807-06 del 15 de febrero de 2006 y 1557-07 del 7 de febrero de 2007 y 1571-08 del 15 de enero de 2008)”. Sumado a lo anterior, en el voto de la Alta Sala en mención número 8858-98 de las 16 horas 33 minutos del 15 de diciembre de 1998 se amplía el desarrollo jurisprudencial de tal principio de la siguiente manera: “Así, un acto limitativo de derechos es razonable cuando cumple con una triple condición: es necesario, idóneo y proporcional.

La necesidad de una medida hace directa referencia a la existencia de una base fáctica que haga preciso proteger algún bien o conjunto de bienes de la colectividad -o de un determinado grupo- mediante la adopción de una medida de diferenciación. Es decir, que si dicha actuación no es realizada, importantes intereses públicos van a ser lesionados. Si la limitación no es necesaria, tampoco podrá ser considerada como razonable, y por ende constitucionalmente válida. La idoneidad, por su parte, importa un juicio referente a si el tipo de restricción a ser adoptado cumple o no con la finalidad de satisfacer la necesidad detectada. La inidoneidad de la medida nos indicaría que pueden existir otros mecanismos que en mejor manera solucionen la necesidad existente, pudiendo algunos de ellos cumplir con la finalidad propuesta sin restringir el disfrute del derecho en cuestión. Por su parte, la proporcionalidad nos remite a un juicio de necesaria comparación entre la finalidad perseguida por el acto y el tipo de restricción que se impone o pretende imponer, de manera que la limitación no sea de entidad marcadamente superior al beneficio que con ella se pretende obtener en beneficio de la colectividad.

De los dos últimos elementos, podría decirse que el primero se basa en un juicio cualitativo, en cuanto que el segundo parte de una comparación cuantitativa de los dos objetos analizados." De los extractos anteriores se infieren varios aspectos, los cuales tienen incidencia en este asunto. El primero radica, si el fin se puede alcanzar buscando otro medio que produzca una limitación menos gravosa a los derechos personales, entonces el medio escogido no es razonable; y por otra parte lo razonable debe ser necesario, idóneo y proporcional.VI. Cuando la Cámara Constitucional analiza la razonabilidad, introduce el tema de la necesidad cuando se va a limitar derechos como una de las condiciones (además de lo idóneo y proporcional) es la necesidad. Conviene en consecuencia retomar lo indicado por esa Instancia Constitucional enmarcado dentro de lo preceptuado en el canon 41 de la Constitución Política en cuanto las medidas cautelares constituyen un derecho fundamental.

En términos de la Sala Constitucional de la Corte Suprema de Justicia se puede determinar en las cautelares prevalece una necesidad de orden procesal: “Es en este sentido que las medidas cautelares –o asegurativas– surgen en el proceso como una verdadera necesidad procesal, en tanto permite garantizar una efectiva tutela al acceso a la justicia (se repite, tanto jurisdiccional como administrativa); de donde, se pueden conceptualizar como el “conjunto de potestades procesales del juez –sea justicia jurisdiccional o administrativa– para resolver antes del fallo, con el específico fin de conservar las condiciones reales indispensables para la emisión y ejecución del acto final” (sentencia número 7190-94, de las quince horas veinticuatro minutos del seis de diciembre de mil novecientos noventa y cuatro)”, Sala Constitucional de la Corte Suprema de Justicia, voto [Telf1] del primero de febrero de 2006.

De ahí comprende esta instancia, el estado de necesidad refiere a una situación de peligro actual para los intereses protegidos por el derecho. Para la tutela efectiva de ese derecho que se alega estar en peligro, conlleva a un dilema. El cual implica la disminución de intereses jurídicos protegidos de otro justiciable u institución. En el supuesto específico de las medidas cautelares en materia agraria, para su procedibilidad se debe estar en presencia de situaciones anormales y excepcionales, las cuales han de ser ponderadas en cada caso. La necesidad de orden procesal se ha unido al peligro en la demora, sea en cuanto más tarde el proceso, su resultado podría ser nugatorio por la variación de las circunstancias que se aspiran a tutelar en el litigio, y con ello carecer la persona justiciable de un acceso real a la justicia. En el punto de la disminución de los derechos de las otras personas que podrían verse involucradas en la asunción de la cautelar, el límite para tal es que lo resuelto en la medida no sea ilícito y dañino.

De ahí ingresa en el proceso de ponderación la razonabilidad y proporcionalidad." Resolución que aclara el régimen de aplicación supletoria de legislación procesal a los procesos agrarios y el fundamento de las medidas cautelares.

V- Cabe citarse el fundamento en la decisión recurrida emitida en virtud de una medida cautelar anticipada, en donde se ordenó paralizar la corta de teca y el aprovechamiento forestal, con el fin de detener e impedir la extracción de la totalidad de la madera existente en las fincas y su venta. Y para ello se ordenó comunicar a la Dirección General Forestal - Área Regional Tempisque y a la Dirección de Tributación Directa, la prohibición de exportar madera de teca de la empresa [[Nombre2] ] Sociedad Anónima. Esa resolución estimó, que esa medida era proporcional y racional, a fin de detener e impedir la extracción de la totalidad de la plantación. Se consideró en la pieza recurrida, la medida acogida cumplía con los presupuestos de peligro de la demora y apariencia de buen derecho, por estarse ante un proceso ordinario de incumplimiento de contrato, donde se pretende la recuperación de la inversión de más de ocho millones de dólares y ser un proceso que cuenta hasta con recurso de casación.

Haberse observado en el reconocimiento judicial dos terrenos cultivados de madera de teca, un sector talado y troncos en el suelo y ser posible con ello que se esté extrayendo madera de su aparente inversión y existir madera que no esta siendo aprovechada que podrá deteriorarse y perder su valor económico. Y se tuvo por demostrado el usufructo por el solicitante de la medida "de manera indiciaria", pues consta una certificación de contadora pública que da fe pública de la inversión que indica el actor realizó en los terreno, a pesar, cita esa resolución, que tal derecho no conste registralmente en los asientos registrales de las fincas. Pues las medidas pedidas y acogidas por [[Nombre1] ] buscan la tutela del derecho de uso y disfrute que indica ostentar en los terrenos cultivados de teca y donde se mencionó por él, ha invertido una cuantiosa suma de dinero. Analizados los autos, agravios y elementos probatorios del proceso de medida cautelar anticipada cuya resolución se apeló, estima esta Cámara, acorde con los ordinales 1 y 2 de la Ley de Jurisdicción Agraria, ordinales 489 a 494 del Código de Trabajo aplicado supletoriamente, ha de revocarse lo apelado por no cumplir la medida cautelar anticipada dictada con los criterios de razonabilidad, ni proporcionalidad y existir una afectación a la actividad agraria con la paralización ordenada en la resolución número 161-2020 de las 16:46 horas del 7 de julio del 2020.

Expediente ingresado a este Tribunal para conocimiento de la apelación en el mes de noviembre del 2020. Revocatoria que se decreta en esta Instancia, fundamentalmente por resultar prioritaria y necesaria la tutela, protección y continuidad de la actividad agraria de cultivo y aprovechamiento de teca observada en los terrenos que registralmente se encuentran a [Nombre4] de [Nombre 019] S.A. Cultivo reclamado por el solicitante de la medida cautelar como propio y que acorde con lo observado en el reconocimiento judicial celebrado a efecto de la medida cautelar anticipada, existen. Aunado a las pruebas aportadas por [Nombre 019] S.A. en esta etapa procesal y al recurrir. Que es documental sobre la existencia del ejercicio de su parte de una empresa agraria de cultivo, desarrollo y comercialización de teca. Que según los medios probatorios que se analizarán, es desarrollada por [Nombre 019] S.A. que funciona como una empresa agraria en marcha.

En cuya "Azienda Agraria" donde confluyen obligaciones contractuales con terceras personas por la comercialización de la madera en pie de teca de las fincas con terceros, obligaciones obrero patronales y regencias forestales, entre otras. Que con la paralización ordenada, se genera un daño a los actos agrarios que no resultan necesarios a fin de poder resguardar los intereses que indica [[Nombre1] ] ostenta sobre esos cultivos de teca. Existiendo otro tipo de medidas cautelares razonables, proporcionales y adecuadas para velar por sus intereses de reclamo de titularidad de teca, y que aseguren el desarrollo y aprovechamiento de la madera de teca existente. Que al tener un ciclo de vida y estar sometida al riesgo biológico y climático, requieren actos materiales propios de esa actividad (mantenimiento) y técnicos que aseguren su desarrollo sano y una óptima comercialización.

VI- La revocatoria que se decreta en esta Sede, se concluye en esta etapa procesal, sin que se haya fenecido la etapa primera de presentación de demanda, contestación y replica del proceso ordinario. Cuyo escrito por [[Nombre1] ], se aportó de forma posterior a la emisión del auto sentencia cautelar y apelación, y sobre el cual penden discusiones respecto a su adecuada presentación o no; que debe resolver el juzgado de instancia. Además de aclararse que la conclusión de la existencia del cultivo y empresa agraria de [[Nombre2] ] S.A. surge al tenor del objeto de la medida cautelar anticipada, sin que sea un adelanto de criterio respecto al derecho de fondo a discutirse en el eventual juicio ordinario. Lo anterior por cuanto en la apelación que se conoce y de forma posterior siempre dentro del proceso de medida cautelar anticipada, se aportaron diversos elementos probatorios documentales que al apersonarse [[Nombre1] ] en fecha 23 de octubre del 2020, se da por notificado y no realiza manifestación al respecto sobre tales; que se indicarán de seguido.

En primer orden, se adjuntó un contrato denominado: Contrato Privado de Compraventa de Árboles de Teca, suscrito por [[Nombre3] ] como apoderada de la sociedad vendedora y [Nombre7] , en su condición de gerente con poderes de Forlumber Limitada, donde ésta última compra 50 contenedores de madera de los árboles en pie de donde se extraerá la madera, según se demarque por la Regencia Forestal para esa cantidad de árboles, que deberá respetar los reglamentos, trámites de permisos y control del aprovechamiento en terrenos de uso agropecuario y sin bosque según lineamientos oficiales. Con plazo de vigencia de tres meses a partir de su suscripción en fecha 20 de julio del 2020; prorrogables por acuerdo. Se fijó el precio y forma de pago según anexos y con pago adelantado por $25.000 dólares al inicio de la operación, a depositarse en cuenta bancaria de la vendedora, debiendo así emitirse facturas electrónicas mensuales, según indique el comprador.

Se establecieron condiciones de extracción y calidad de los árboles. Con obligaciones a cargo de la vendedora (mantener en vigencia la Regencia Forestal, informes de regente, certificados de origen de Regente, libre acceso a las fincas, entre otros). A cargo de la compradora ser responsable del proceso de extracción, asumir los costos del mismos y el transporte. Su deber de conservar los árboles nativos del lugar, cumplir con la legislación ambiental en cuenta recurso hídrico, áreas de protección, gestión de residuos, productos químicos, seguridad laboral, pólizas, entre otros. Además, la verificación por la vendedora de que los árboles cortados correspondan a los vendidos. Además condiciones diversas y anexos en calidad y modo de pesaje y cálculo de la madera extraída (imagen 318 a 306). Como prueba dos aporta planillas de la sociedad de la Caja Costarricense del Seguro Social de los meses de junio a diciembre del 2019 con una nómina de 17 trabajadores aproximadamente (imágenes 280 a 293), personería de [[Nombre2] ] cuyas apoderadas son su presidenta y secretaria: [[Nombre3] ] y [[Nombre10] ], respectivamente nombradas desde agosto del 2012 (imagen 277).

Dos formularios de Regencia Forestal números 000778 y 0000779 de fechas del Regente Víctor Hugo Venegas Sánchez, con sello de recibido del SINAC Subregión de Santa Cruz Carrillo Guanacaste de febrero del 2020 para aprovechamiento de plantación en fincas [Valor 001], [Valor 002], [Valor 003] de treinta hectáreas y en finca [Valor 004] en diez hectáreas y contrato de regencia del 19 de febrero del 2020 presentado ante el Colegio de Ingenieros Agrónomos (imagen 270 a 273). Escrituras de constitución de servidumbres de líneas eléctricas y de paso a favor de la Cooperativa de Electrificación Rural del Guanacaste del 15 de marzo del 2019 y en contra de la finca de [[Nombre2] ] S.A. en finca [Valor 003], [Valor 001], [Valor 002], en donde comparece en representación de la sociedad [[Nombre1] ]. Servidumbre constituida de forma gratuita y donde se indica que la Cooperativa podrá cortar por su cuenta las ramas o árboles que se encuentren dentro del corredor de la servidumbre y en las franjas de las mismas se acerquen a menos de cinco metros de las líneas más bajas (imagen 267 a .255).

Por escrito posterior de [[Nombre2] ] S.A. se indica que la relación de posesión que alega [[Nombre1] ] no es posible, dadas las condenas penales que ha recibido. Manifestando que la imagen que ha pretendido aparentar el actor de adulto mayor desvalido que realizó una inversión en “búsqueda de su pensión de retiro”, que ahora se le quita abruptamente, no es tal. Pues lo existe es una relación familiar y no un vínculo negocial. Persona que tiene muchos recursos (situación de poder) y lo que busca es desproteger y desposeer a su esposa e hijas de una propiedad que les pertenece a ellas desde 1990, a fin afectarles patrimonialmente, mediante violencia patrimonial, acorde con sus antecedentes penales. Adjunta sentencia penal donde se le condena por Tráfico de Cocaína en Grado de Complicidad emitida en el año 1994 y fallo en esa sede, donde se le declaró culpable de Tentativa de Estafa Mayor en Concurso Ideal y otro en contra de sus familiares.

Por lo que actualmente, mencionan, se encuentra descontando una pena de cuatro años de arresto domiciliario con monitoreo electrónico y por ello su pretensión de posesión es imposible por su estatus penal. Se aportan sentencias penales (imagen 25 a 253 de expediente digital modo pdf), en donde recibió condena en 1994 a [[Nombre1] ] por el delito de tráfico de drogas y sentencia penal del 30 de mayo del 2017 bajo expediente EXPN1 del Tribunal del Juicio de San José, Tercer Circuito Judicial de las 13:15 horas del 30 e mayo del 2017, en donde se le condena por el delito de tentativa de estafa mayor y uso de documento falso en concurso ideal y se le impone arresto domiciliario en sustitución de la pena de prisión por cuatro años. Además de escrito de pronto despacho del 19 de octubre del 2020, ante el juzgado de instancia, en donde se indica de la urgencia se debe resolver el recurso y se deje sin efecto la medida, en virtud del daño a la actividad agraria.

Refiere ese memorial a que [[Nombre1] ] es una persona muy adinerada que abusa de su poder con violencia patrimonial sobre [[Nombre3] ] y sus hijas. El tema presente no es agrario, sino de relación familiar. Omitió indicar al despacho descuenta pena de prisión, por lo que no puede ostentar la posesión y administración de las fincas de la sociedad. Oculta sus antecedentes de tráfico de cocaína, por lo que se duda razonablemente de la credibilidad del dicho contra su esposa e hijas. También, se cita, doña [[Nombre3] ] es adulta mayor. Y la solicitud de Medida Cautelar está basada en hechos falsos. No existe prueba de la existencia de un contrato o convenio que le permitiera a [[Nombre1] ] el uso o disfrute de las fincas para su retiro o época de jubilación. Resulta falso desarrollara un emprendimiento agrario personal, sino que era familiar; sin que se le otorgara derecho de posesión. Explica, durante la administración [[Nombre1] ] en condición de esposo y padre, cometió múltiples abusos y desvíos de dinero a sus cuentas personales, sin participar a su esposa e hijas; accionistas de la sociedad demandada, razón por la cual se le revocó el poder generalísimo que ostentaba.

Y al enterarse de esa revocatoria, solicitó a sus hijas que le entregaran las acciones que ellas poseían desde principios de los 90´s, o tomaría represalias contra la sociedad y contra ellas; lo que cumplió. Pues despidió a su hija [[Nombre10] ] de la empresa SNH, y le cortó toda ayuda económica a [[Nombre11] ]. Canceló los pagos de sus seguros médicos de la empresa BMI a fin de presionar. De seguido sus empleados interpusieron una denuncia ambiental contra [[Nombre2] ] S.A. ante el MINAE. Dejó de pagar la CCSS y las planillas de sus empleados y le dijo a sus hijas que resolvieran ellas lo referido a los terrenos. Sin que existiera despojo. Su fin con tales actos, señalan, es acabar la actividad agraria en perjuicio de su esposa e hijas. Se reclama el levantamiento de la medida cautelar ante el contradictorio y se estudien ambas historias. Menciona, la medida esta lesionando la actividad de la empresa agraria de forma negativa, enumerando:

  • 1)Existencia de contrato de compra de madera vigente con la empresa Forlumber Limitada, que se está incumpliendo por esta medida cautelar. Empresa tiene toda la operación paralizada con pérdidas diarias, sosteniendo su planilla y alquileres del equipo de corta, cuando ya está todo previamente contratado. Por lo que [[Nombre2] ] se encuentra en una posición muy comprometida ya que no tiene como retribuir estas pérdidas. Y solicita explicaciones la compradora, lo cual le genera a la apelante, las hijas e esposa del actor gran angustia, incertidumbre y ansiedad.
  • 2)Cuando inició a regir la medida cautelar ya había madera cortada y lista para cargar según especificaciones en el contrato con la empresa Forlumber Limitada. Misma que se encuentra en el suelo y debido a las inclemencias del tiempo y lluvias, hay gran cantidad de árboles a la intemperie con desprendimiento de corteza o cascara y aterrados de sedimentos e insectos. Lo que deteriora el compromiso de calidad que indica el contrato, que señala no pueden llevar desprendimientos de corteza, ni pueden estar contaminados, por ser madera de exportación. Existen árboles que están comenzando a presentar daños en el duramen (corazón del árbol) que los tornan inservibles. Enorme pérdida del valor del económico del producto y la desmejora de su calidad.   • 3)Al no percibir ingresos, no se podrá seguir cumpliendo con los pagos de las planillas de la CCSS (adjunta planilla). Siendo un daño social lo anterior.
  • 4)Se esta dando el incumplimiento de pago de empleados, administradores, peones, contadores y demás gastos. Dejando desprotegidas a muchas familia que dependen de esta actividad agraria.
  • 5)Imposibilidad de pagar el arreglo existente con la CCSS, ni impuestos a Tributación, renta, municipales y otros. Daño grave social y a la empresa agraria.
  • 6)No se podrá pagar indemnización por prestaciones a los peones despedidos durante la administración de [[Nombre1] ]. Con el escrito se aportaron planillas de CCSS, DEtalles de Facturación de agosto 2020 y fotografías que muestran gran cantidad de troncos en el suelo a la intemperie (imagen 16 a 23 de expediente digital modo pdf). Luego de la presentación de ese escrito, y pendiente el envío al Tribunal Agrario del recurso de apelación que se resuelve, se apersona ante el juzgado de instancia el solicitante de la medida cautelar anticipada en memorial del 23 de octubre del 2020, donde alega que debe ser rechazada la revocatoria de [Nombre 019] S.A., contra el auto de las 15 horas 15 minutos del 1 de octubre de 2010, que rechazó la revocatoria interpuesta contra el auto sentencia No. 161-2020 de las dieciséis horas y cuarenta y seis minutos del siete de julio de dos mil veinte (imagen 3 a 6, todas las citas del expediente digital modo pdf). Por lo que al apersonarse, se da por notificado de todas las argumentaciones y pruebas aportadas por [Nombre 019] S.A. descritas en este considerando, al tenor del artículo 10 de la Ley de Notificaciones Judiciales.

VII- Cabe mencionarse que, en el escrito inicial de medida cautelar anticipada (imagen 567 a 579 expediente digital modo pdf) se indica que [[Nombre1] ] ha sido empresario agrario, ganadero y aviador. Es adulto mayor. Contrajo matrimonio con [[Nombre3] ], actualmente separado de hecho desde finales de 1997. Describe, en los años 90 inicio el cultivo de teca como inversión a largo plazo para tener un fondo de retiro en su vejez. Con ese fin crea como fundador y accionista a sociedad [Nombre 019] S.A. y luego, como titular de una relación de uso y disfrute de la tierra. Y con dinero propio compra varias fincas a lo largo de los años a favor de la sociedad citada, a cambio de poder explotarlas para fines agrícolas y ganaderos. En especial el cultivo de teca y cría de ganado. Refiere a prueba anexo B que corresponde a certificación de personería de la sociedad. Menciona, esa actividad la ha mantenido a lo largo de 20 años con dinero propio y para tal fin la sociedad le otorgó poder suficiente de la compañía siempre bajo el conocimiento de su actual presidenta [[Nombre3] ].

El hecho sexto a décimo cita, con el conocimiento de la representante legal de la sociedad se le concedió a él, el uso y disfrute de las fincas propiedad de la empresa, para que en tales [[Nombre1] ] desarrollará su negocio agrícola y ganadero como contraprestación al dinero invertido por él en la compra de dichas fincas a través de los años. Entregándosele así en depósito y como garantía, los libros legales de la compañía. Actividad que ha desarrollado en los últimos 20 años y en donde él aportaba el dinero para la compra de las fincas a cambio del uso por tiempo indefinido de tales inmuebles y desarrollar un proyecto de cultivo de teca a largo plazo. Cita, las primeras fincas adquiridas en los años 90 fueron colindantes y cercanas, ubicadas en [[Nombre6] ], cantón de [[Nombre4] 010], [Dirección1] [ ] números: [Valor 008], [Valor 009] y [Valor 010]. Además de la finca [Valor 011], [Valor 012], [Valor 002], [Valor 011], [Valor 013], [Valor 014], [Valor 015], [Valor 001] y [Valor 016].

Incluso, cita, se le otorgó poder idóneo para tramitar permisos de explotación , en cuenta contratos forestales, registro de regencia, certificado de origen, permisos, entre otros. Menciona, la finca adquirida eran antiguas parcelas ganaderas de charrales y montazales. Las dos primeras denominadas [[Nombre4] ] y [[Nombre12] ]. Causa de sus condiciones originales agrestes, se debió primero chapiar, quemas y preparación. En algunos se tuvo ganado, pero la mayoría se dedicó a la siembra de teca, que una vez madura para la corta, se aprovecharía; lo cual tardaría unos 20 años en promedio. Cita, al inicio en una primera etapa se dedicó a la preparación de las primeras fincas adquiridas, se compraba en la zona Nicoya una seudo estaca de teca y se sembraba en el terreno limpio. Avanzando en forma paulatina del primer al tercer año. Técnica que falló, aunado a un incendio de terreno vecino que quemó el resto de la finca.

Por lo que la primera siembra resultó perdida. Agrega, en forma posterior en su terreno hizo un vivero propio, donde además hay una casa y un negocio de fumigación aérea; iniciando la producción de las propias plantas. En los veranos, se relata, normalmente en marzo de cada año se empezaba a preparar el terreno y se inició el cultivo en [[Nombre4] ] y [[Nombre12] ], luego en las demás. Lo anterior dese hace 20 años y desarrollado bajo el acuerdo referido, en las fincas propiedad de [[Nombre2] ] S.A, donde se desarrolló un negocio exitoso de ganadería y cultivo de teca con esfuerzo personal económico y empresarial propio. Describe, los actos que debió realizar para el cuidado de las plantas, crecimiento, fertilización, chapia y la continuidad de la siembra de todas las fincas, que fue adquiriendo la sociedad con dinero de [[Nombre1] ]. Todo lo anterior, bajo el mismo acuerdo citado. Las primeras raleas, expone, se realizan a los 4 o 5 años que son desechadas.

Un par que pudo vender para sufragar algunos costos básicos de su emprendimiento. Sin embargo, la verdadera recuperación y rendimiento de la inversión ocurriría luego de 20 años, sea en el año 2020, cuando ya se podría vender la madera madura. Lo cuál iba a ser la pensión de [[Nombre1] ] para protegerse en su etapa de vejez; sobre todo por sus quebrantos de salud. Estima, se sembraron unos 900 árboles por hectárea y para febrero deberían existir por hectárea de 250 a 300 árboles primarios y unos 200 a 300 hijos nacidos de la cepa de la raíz con unos 8 a 12 años y con tallos que podrían tener ya unos 70 a 80 centímetros. Lo anterior gracias al adecuado manejo de rebrotes. Señala, en total deberían existir al menos 600 árboles por hectárea, distribuidos en unas 700 hectáreas de teca. Menciona, en las fincas existen árboles de Cocobolo, Ron Ron y otras maderas preciosas que se estaban cuidando y no eran tocadas por ser especies en peligro de extinción.

Reseña en su escrito inicial, todos los gastos del cultivo de la teca eran cubiertos por el apelante y calcula su inversión en la suma de 8.128.893, 08 dólares. Monto que no considera la compra de la tierra, la inversión de ganado, ni otros gastos que están en proceso de cuantificación. Anexa como prueba la certificación de contador público autorizado. En el hecho 27 de su escrito inicial, menciona que de forma sorpresiva, una vez madura la teca para su corta en febrero del 2020, [[Nombre13] ] le comunicó que por instrucciones de la sociedad, representada por [[Nombre3] ], colocó portones en los ingresos de las fincas y le prohibió a [[Nombre1] ] y sus cuadrillas de peones el ingreso. Momento a partir del cual no han podido ingresar y se les ha negado el acceso. Lo anterior, aun y cuando por 20 años, ha sido quien desarrolló el cultivo y la tenencia de ganado, sin impedimento alguno. Lo que coincide de forma temporal con la comunicación de su abogado Erick Ramos.

Sin que pudiera establecer ninguna acción, dada una enfermedad grave e intervención quirúrgica de corazón, según consta en el dictamen médico que adjunta. Finalmente, el apelante indica fue informado de que el regente que tenían las fincas; había sido contratado él, fue cambiado por otro identificado como [Nombre5] que presentó el 20 de febrero del 2020 certificado de origen en el Área de Conservación Tempisque, referido a parte de la plantación de teca. Fecha coincidente con la época en la que se le prohibió el paso. Indica, el 3 de abril del 2020 el regente ambiental citado presentó denuncia sobre dichas fincas, indicando que había anomalías por corta de árboles en área de protección hídrica. Se realizó la inspección de rigor y los funcionarios del MINAE lograron constatar el 6 de abril del 2020 que se había dado tala de árboles de teca, en dicha finca en áreas de cultivo no autorizado y además arrasaron con árboles en el área de protección hídrica.

Observaron también la tala de al menos un Jobo. Hechos que califica de gravísimos y que requieren de urgente medida de protección; dado el daño ambiental a las áreas de protección hídrica de las fincas. Indicó que con esas probanzas, se muestra que se está cortando la madera de teca por él cultivada y se habla de una posible venta. Pues al margen de la finca existe una anotación de traspaso de la sociedad a favor de un fideicomiso del Banco Nacional; lo cual requiere medidas urgentes de cautela por lo irreparable del eventual daño. Se menciona, como fundamento de la medida cautelar y prueba anticipada, evitar daño ambiental, dado lo encontrado según informe del MINAE del 28 de abril del 2020 respecto a tala en áreas de protección de cuerpos de agua, anillamiento de árboles, talados y arrancados con maquinaria. Proteger la salud y vida de un adulto mayor con afecciones físicas, que además ha sufrido daño psicológico provocado por el despojo de lo que sería su fondo de retiro.

Y cita parcialmente lo indicado en el dictamen médico sufrido. Resistir el despojo irreparable de su inversión y esfuerzo de veinte años; que se pretende con la venta a terceros de la madera. Además de vender las fincas, según circula información y se observa la anotación en el asiento registral. Evitar la tala de maderas preciosas. Estima, se cumplen los presupuestos de las medidas cautelares. Solicitó:1) reconocimiento judicial, para constatar el estado de las plantaciones, la tala de maderas preciosas y en áreas de protección, existencia de ganaod del recurrente y lo que estime el despacho pertinente. 2) Pericia judicial por ingeniero forestal para que determine el estado actual de las plantaciones, el valor de mercado, los costos de una plantación en la condición actual, constatación de cortas recientes , estimación del daño a las plantaciones que considere: la teca cortada, daño a la plantación y ambiental. 3) Solicitar a MINAE los informes de regencia de las fincas en cuestión, documentación relacionada de los años 2019 a 2020 con la nueva regencia forestal y despojo de la posesión. Como medida cautelar anticipada solicita:

  • 1)Se ordene a la sociedad se abstenga de cortar o talar árboles de cualquier naturaleza o modifique de algún modo las plantaciones. No venda o enajene, hasta tanto no se resuelva el fondo de la controversia, ni se venda ganado.
  • 2)Comunicar a la Dirección General Forestal y Área de Conservación Tempisque de la interposición de la demanda.
  • 3)Comunicar a la Dirección Aduanera del Ministerio de Hacienda, de la existencia de esta demanda para que se impida la exportación de madera de teca provenientes, según las guías de origen de la empresa [[Nombre2] ] S.A.. Como medidas cautelares típicas, solicita la anotación de la demanda en los asientos registrales, que comprenden las plantaciones de teca y ganado no propiedad de la sociedad. Lo anterior dadas las pretensiones de accesión invertida y la posible usucapión o por el incumplimiento contractual. Pues la sociedad nunca canceló dinero por la compra de las propiedades y han incumplido las obligaciones que le permiten sean de su propiedad; lo que es un enriquecimiento sin causa. Invoca el artículo 78 del Código Procesal Civil y estima ostenta apariencia de buen derecho dada la posesión que ha ostentado por 20 años de actos de cultivo, que prueba con la certificación de contador. Pide se otorguen las medidas sin audiencia a la contraria. Como pruebas adjuntó certificación de personería de la sociedad [[Nombre2] ] e [Valor 020] S.A. (imagen 582 a 583, 483 y 486 a 487), certificaciones registrales de las fincas a [Nombre4] de [Nombre 019] S.A. (imagen 585 a 610, 408 a 409), documento denominado Informe de Resultado de Procedimiento Previamente Convenidos emitido por la contadora pública [Nombre14] de dos páginas (imagen 611 a 612). Dictamen Médico del 20 de mayo del 2020 de [[Nombre1] ] (imagen 614 a 615), Informe de Inspección por Denuncia Ambiental del MINAE oficio ACT-OSRSCC-318-2020 del 28 de abril del 2020, copias de cheques emitidos por la sociedad [Valor 020] S. A. a favor de [[Nombre3] ] y recibos de dinero cancelados por [[Nombre2] ] . que citan que mediante los cheques de [Valor 020] [Nombre5] se le cancelaron esos gastos (imagen 464 a 477), los pagos de gastos y honorarios de abogada para trámite de información posesoria de finca cancelados por [Valor 020] S.A, que resultó en la inscripción de la finca [Valor 021] (imagen 437 a 428), certificaciones registrales notariales de las fincas a [Nombre4] de [Nombre 019] S.A., con fechas del 23 de setiembre de 1998, 5 de octubre de 1998 (imagen 427 a 422, 419 a 420, imagen 413 a 410), copia de testimonio inscrito de compra del 16 de junio de 1990 donde [[Nombre15] ] vende a [[Nombre2] ] S.A. representada por [[Nombre1] ] la finca matrícula [[Placa1] ] (imagen 420 a 422), copia de testimonio de compra venta de finca de [[Nombre16] ] a [[Nombre2] ] [Nombre5] del 25 de junio de 1991 de finca [Valor 016] de [[Nombre6] ], donde compareció por la sociedad [[Nombre1] ] (imagen 396 a 407), copias de escrituras de compra de la sociedad [[Nombre2] ] de fincas de fechas de 1990 que eran representadas por [[Nombre1] ] (imagen 378 a 391), acta de constitución de la sociedad [[Nombre2] ] [Nombre5] por [[Nombre1] ] y [[Nombre3] ] el 29 de mayo de 1990, en donde aparecen tales como accionistas y presidente y vicepresidente (imagen 375 a 376). Todas las pruebas citadas en expediente digital modo pdf). Por otra parte, se realizó un reconocimiento judicial en fecha 17 de junio del 2020 (expediente digital imagen 364 a 365 modo pdf) en donde se consignó haber observado en primer orden una finca con pasto de la especie trasvala, cercada a cuatro hilos de alambre Otra finca conocida como [[Nombre17] ], con portón con cadena que impedía el paso. Y adentro haberse visualizado huellas de ganado y estiércol fresco. Menciona el acta, se pasó a otra finca conocida como [Valor 022] , dedicada al cultivo de Teca, donde contiguo a una quebrada se observaron tres sectores de madera cortados, aserrada y parte de las trozas estaba empateada. Se pasó a [[Nombre18] ], donde se encontraron aproximadamente 3 hectáreas de madera cortada y en el suelo a ambos lados del camino. Se indica, en este sector se observa se extrajo gran parte de madera, debido a los troncos y ramas que se visualizaron y donde no se respetó el área de protección del río. (imagen 364 a 365 de expediente digital modo pdf) y fotografias donde se observan troncos de teca ya cortados y en el suelo, así como dos de ellas en el cauce de una quebrada).

VIII- Para esta Cámara, de la integración de estas probanzas con las citadas de la sociedad [[Nombre2] ], se llega a la conclusión que la medida de paralización solicitada por [[Nombre1] ] y concedida por el juzgador de instancia, no resultan adecuadas para garantizarle al primero el aseguramiento de una eventual sentencia judicial dentro de un proceso ordinario, pues al paralizarse toda actividad de mantenimiento y aprovechamiento, el objeto de su interés que es según su escrito inicial de medida cautelar, asegurarse la recuperación de su inversión, y en caso de mantenerse esa paralización se esfumaría para él y la sociedad, al dañarse la madera y no permitir la comercialización. Pues es un producto que se deteriora si no es asistido ni cosechado en las edades del cultivo que técnicamente corresponda. Los documentos de antecedentes registrales de las diversas fincas inscritas adquiridas desde la década de los años noventa, constitución de la sociedad anónima [[Nombre2] ] S.A., y los graves conflictos familiares acusados, así como antecedentes penales de [[Nombre1] ], no son de interés al objeto de esta medida cautelar, que debe velar por la continuidad del cultivo de teca y su aprovechamiento.

Para esta Cámara lleva razón la sociedad recurrente cuando reclama que no existe a esta altura procesal prueba del contrato de usufructo que indica ostentar el solicitante de las medidas cautelares, siendo esa certificación de contadora pública que se tomó de base en el auto sentencia para tener ese aspecto por demostrado, insuficiente. Pues es un documento emitido a voluntad unilateral del actor y sin que consten los documentos base de las conclusiones vertidas por la contadora pública al efecto solicitada. Por otra parte, existe contrato de compra venta de madera en pie de [[Nombre19] ] [Nombre5] y Formulber Limitada en marcha cuando se emitió la sentencia cautelar, la vendedora tiene asegurados trabajadores y debe afrontar los pagos de esas obligaciones y otras, propias de una empresa agrícola de teca. Razón por la cual se ha de revocarse el auto sentencia en cuanto ordenó a [[Nombre19] ] S.A. suspender la actividad de corta o tala de madera de teca en las fincas del conflicto, así como la venta de la madera de teca existente en los inmuebles involucradas en éste proceso.

Bajo apercibimiento de incurrir en delito de desobediencia a la autoridad en caso de incumplimiento. La comunicación de esa ordenanza mediante oficio a la Dirección General Forestal - Área Regional Tempisque y a la Dirección de Tributación Directa. De tal forma que debe el juzgado de instancia comunicar a esas oficinas gubernamentales lo aquí resuelto y advertir que se revocó la suspensión que hubiera sido decretada en la decisión apelada que se revoca. Respecto de los daños ambientales informados por el SINAC en documento citado, ha de indicarse que la investigación ha iniciado en esa instancia administrativa a fin de constatar que persona es la responsable de los cortes de árboles en las áreas de protección de la quebrada, pues se desconoce si fueron las personas funcionarias de la Cooperativa que ostenta a su favor servidumbres de líneas eléctricas y de paso, personeros de la sociedad [Nombre 026] S.A., empleados de la sociedad compradora de la madera de teca o un tercero ajeno a los anteriores; de lo cual deberá informarse a los autos las conclusiones a las que se arriba.

Debiendo el juzgado de instancia requerir esa información a los funcionarios del MINAE competentes de la zona. Aunado al deber de la sociedad [Nombre 026] S.A. a vigilar que en forma efectiva se protejan los árboles nativos de las fincas y la cobertura forestal de las áreas de protección de los cuerpos de agua existentes en los fundos. Debiendo denunciar ante el SINAC o Fiscalía Ambiental de forma inmediata situaciones de riesgos de daños o daños que se constaten en esas zonas. Ha de acotarse que al ser las medidas cautelares temporales, tales podrán ser modificadas si se demuestra el cambio de condiciones por alguna de las partes o la persona juzgadora en cualquier etapa del proceso ordinario que esta pendiente de estudio. [Nombre9] en este caso, cuando se resolvió una medida cautelar anticipada en donde no ha fenecido la etapa de admisión del escrito de demanda del proceso principal, contestación y réplica.

IX- Contracautela . En virtud de la revocatoria aquí decretada que levanta la suspensión de actividades a [[Nombre2] ] S.A. continuará la operación de cultivo y aprovechamiento de teca desarrollada en las fincas a su [Nombre4] y dado el reclamo del solicitante de medida cautelar anticipada en donde indica busca la tutela de la recuperación de la inversión que indica ha realizado de su propio peculio, se impone una contracautela a la sociedad citada a fin de que rinda informes de egresos e ingresos semestrales, en virtud de la actividad ejercida de cultivo, mantenimiento y comercialización de plantación de teca; firme esta resolución. Lo anterior con la finalidad de documentar los gastos y ganancias del mantenimiento de los cultivos de teca y efectiva comercialización de la cosecha de la teca objeto de esta medida cautelar anticipada.

X- En virtud de los razonamientos expuestos, con fundamento en el ordinal 1,2,26 y 54 de la Ley de Jurisdicción Agraria, canon 489 y 490 ambos del Código de Trabajo, deberá revocarse en lo apelado la resolución número 161-2020 de las dieciséis horas cuarenta y seis minutos del siete de julio del dos mil veinte en cuanto ordenó a [[Nombre19] ] S.A. suspender la actividad de corta o tala de madera de teca en las fincas del conflicto, así como la venta de la madera de teca existente en los inmuebles involucradas en éste proceso. Bajo apercibimiento de incurrir en delito de desobediencia a la autoridad en caso de incumplimiento. Y enviar comunicación de esa ordenanza mediante oficio a la Dirección General Forestal - Área Regional Tempisque y a la Dirección de Tributación Directa. En su lugar y en lo apelado, se rechaza la solicitud de ordenarse a la sociedad se abstenga de cortar o talar árboles de cualquier naturaleza o se modifique de algún modo las plantaciones.

No venda o enajene, hasta tanto no se resuelva el fondo de la controversia. Se comunique a la Dirección General Forestal y Área de Conservación Tempisque de la interposición de la demanda y a la Dirección Aduanera del Ministerio de Hacienda, para que se impida la exportación de madera de teca provenientes, según las guías de origen de la empresa [[Nombre2] ]. Se impone de oficio como contracautela a [[Nombre19] ] S.A.: a) rinda informes de egresos e ingresos semestrales, en virtud de la actividad ejercida de cultivo, mantenimiento y comercialización de plantación de teca; firme esta resolución. b) Ejercer la vigilancia en las fincas a fin de asegurar en forma efectiva se protejan los árboles nativos de las fincas y la cobertura forestal de las áreas de protección de los cuerpos de agua existentes en los fundos. Debiendo denunciar ante el SINAC o Fiscalía Ambiental de forma inmediata situaciones de riesgos de daños o daños que se constaten en esas zonas.

Proceda el juzgado de instancia a: a) comunicar a las dependencias gubernamentales a las que les dirigió oficios de la suspensión de actividades agrarias a [[Nombre19] ] [Nombre5]., la revocatoria aquí resuelta. b) Requiera al SINAC oficina regional, las actuaciones desarrolladas en virtud de los hechos de corta en áreas de protección de quebrada encontradas en Informe de Inspección por Denuncia Ambiental del MINAE oficio ACT-OSRSCC-318-2020 del 28 de abril del 2020 XI- NOTA DEL JUEZ LÓPEZ BARRANTES . El suscrito juez comparte la decisión tomada en esta resolución; sin embargo, considera que la legislación aplicable supletoriamente en materia de medidas cautelares agraria, es la procesal civil y no la laboral. En ese sentido, es importante señalar que en la legislación procesal agraria existe una regulación bastante simple tocante al tema de medidas cautelares, pues solo se regulan el embargo preventivo y la anotación de demanda, ambas de naturaleza típica.

De acuerdo a ello, conforme lo indica el artículo 6 de la Ley de Jurisdicción Agraria, tanto las actuaciones y resoluciones se regirán por los procedimientos señaladas en esa ley, y en lo que fuere compatible, por las disposiciones de los respectivos códigos procesales y de la Ley Orgánica del Poder Judicial. Por su parte el artículo 26 dispone "ante el silencio de la ley, para aplicar, por analogía, las normas de la legislación laboral, o en su defecto, el código de procedimientos respectivo, con el objeto de proveer la debida celeridad y eficacia al proceso" (Lo subrayado no corresponde a su original). Sobre esas normas en particular ha existido durante muchos años una línea pacífica de jurisprudencia emitida por parte de este Tribunal en aplicar estrictamente el Código de Trabajo y ante un eventual silencio de esa otra normativa, aplica el Código Procesal Civil. No obstante, el cardinal 26 supracitado refiere a aplicar por analogía, concepto que según la Real Academia Española se trata de una: "Relación de semejanza entre cosas distintas".

Ahora bien, haciendo un análisis de los artículos 6, 26 y 79, de la Ley de Jurisdicción Agraria, el suscrito concluye que la aplicación de la normativa procesal laboral no significa la regla, es decir, armonizando el contenido de esos dos preceptos legales, lo que se puede extraer es que ante ausencia de norma en materia procesal que la Ley de Jurisdicción Agraria haya dejado vacío, debe de aplicarse aquella normativa procesal que aparte de ser análoga, prevea la debida celeridad y eficacia del proceso agrario, salvo en aquellos expresamente contemplados en la misma ley procesal agraria como ocurre en el caso de la etapa recursiva. Siendo así, en procesos cautelares es criterio del suscrito deben de aplicarse las normas del Código Procesal Civil al ser compatibles y semejantes con la materia agraria dada la similitud en la tipologías de procesos y pretensiones que se interponen en ambas sedes.

Contrario al Código de Trabajo, el cual tiene un enfoque orientado en las relaciones laborales que existen en conflicto ante esa sede especializada y así regular a nivel procesal la tramitación de las controversias u obligaciones derivados en los contratos de trabajo. Por ello, al revisar los artículos 489 a 494, se logra extraer que ninguno de ellos va orientado en satisfacer las pretensiones que normalmente se tramitan en materia agraria. Solo para efectos de resaltar esas diferencias de materia -agrario y laboral-, puede citarse la sentencia de la Sala Constitucional bajo número 1220-1990, que dejó sin efecto eximir de garantía a las partes en los embargos preventivos conforme lo reguló en su momento el artículo 26, 33 y 34 de la Ley de Jurisdicción Agraria. Por su parte, en materia laboral actualmente de acuerdo al artículo 491 dicho embargo preventivo se puede decretar sin rendición alguna de garantía cuyo requisito es aportar dos testigos que comprueben "prima facie" la prestación personal del servicio y la veracidad del hecho o hechos que fundamenta la petición de la demanda.

Lo anterior, obedece precisamente a las distintas dimensiones que tienen ambas materias y los conflictos que se conocen en cada una de ellas. Si bien es cierto, tanto lo agrario, así como lo laboral tienen un enfoque social, aplicar sea el Código de Trabajo o Código Procesal Civil a esta disciplina jurídica, debe de hacerse siempre teniendo en cuenta los principios procesales agrarios que han sido desarrollados ampliamente tanto por la doctrina así como por la misma jurisprudencia. Conforme lo anterior, es criterio del suscrito que en los procesos cautelares agrarios debe de aplicarse primeramente la Ley de Jurisdicción Agraria, y ante un eventual vacío de esa ley, debe de procederse aplicar las reglas del Código Procesal Civil vigente al momento de presentarse la demanda, a la luz de los principios procesales del Derecho Agrario, al ser esa normativa semejante a esta disciplina.

POR TANTO:

Se revoca en lo apelado la resolución número 161-2020 de las dieciséis horas cuarenta y seis minutos del siete de julio del dos mil veinte, en cuanto ordenó a [[Nombre19] ] S.A. suspender la actividad de corta o tala de madera de teca en las fincas del conflicto, así como la venta de la madera de teca existente en los inmuebles involucradas en éste proceso. Bajo apercibimiento de incurrir en delito de desobediencia a la autoridad en caso de incumplimiento. Y enviar comunicación de esa ordenanza mediante oficio a la Dirección General Forestal - Área Regional Tempisque y a la Dirección de Tributación Directa. En su lugar y en lo apelado, se rechaza la solicitud de ordenarse a la sociedad se abstenga de cortar o talar árboles de cualquier naturaleza o se modifique de algún modo las plantaciones. No venda o enajene, hasta tanto no se resuelva el fondo de la controversia. Se comunique a la Dirección General Forestal y Área de Conservación Tempisque de la interposición de la demanda y a la Dirección Aduanera del Ministerio de Hacienda, para que se impida la exportación de madera de teca provenientes, según las guías de origen de la empresa [[Nombre2] ] .

Se impone de oficio como contracautela a [[Nombre19] ] [Nombre5].: a) rinda informes de egresos e ingresos semestrales, en virtud de la actividad ejercida de cultivo, mantenimiento y comercialización de plantación de teca; firme esta resolución. b) Ejercer la vigilancia en las fincas a fin de asegurar en forma efectiva se protejan los árboles nativos de las fincas y la cobertura forestal de las áreas de protección de los cuerpos de agua existentes en los fundos. Proceda el juzgado de instancia a: a) comunicar a las dependencias gubernamentales a las que les dirigió oficios de la suspensión de actividades agrarias a [[Nombre19] ] S.A., la revocatoria aquí resuelta. b) Requiera al SINAC oficina regional, las actuaciones desarrolladas en virtud de los hechos de corta en áreas de protección de quebrada encontradas en Informe de Inspección por Denuncia Ambiental del MINAE oficio ACT-OSRSCC-318-2020 del 28 de abril del 2020.
