WHEREAS:
Drafted by Judge Alvarado Paniagua; and,
CONSIDERING:
I.The appellant invokes the nullity (nulidad) of the judgment because there were 46 failed notices, which proves the failure of the notification system and is not attributable to the party it represents; it therefore requested that they be cured (sanearlas) by repeating them to prevent the judgment from being rendered null for failure to respect the right of defense (derecho de defensa) and due process (debido proceso). The Court does not agree that any defect exists as alleged by the appellant, since the records of service (actas de notificación) to fax numbers [Valor 043], [Valor 044], and [Valor 045] show that five attempts were made, each at 30-minute intervals, on two different dates, as established in Article 50 of the Ley de Notificaciones y Citaciones Judiciales; therefore, no defect entailing nullity is evident in those records. The fact that automatic service (notificación automática) was attempted five times, pursuant to the cited Article, at three fax numbers does not constitute conclusive proof of a technical failure attributable to the notification system.
Reaching that conclusion from a premise that constitutes an appeal-to-the-majority fallacy does not support the conclusion sought by the appellant through this ground of appeal (agravio). Pursuant to Article 26 of the Ley de Jurisdicción Agraria, nullity is warranted when prejudice results in denial of the right of defense (indefensión). In this case, regardless of whether the judgment was transmitted incompletely by fax or whether automatic service occurred after the five attempts, even if that were so, the appellant achieved its objective of filing the appeal (recurso de apelación), and therefore the purpose of the procedural act was fulfilled. The argument that the other parties were not notified because of the alleged failure of the notification system, which also returned “failed transmission” for their faxes, is likewise unavailing, since Article 194 of the Código Procesal Civil de 1989, applicable to this specific case because it was the law in force when these proceedings commenced and pursuant to Transitorio I of the current Ley 9342 Código Procesal Civil, provides that nullity may be requested only by the prejudiced party.
Accordingly, the appellant lacks standing (legitimación) to invoke nullity on behalf of those who did not appeal; in any event, it does not appear that such nullity occurred so as to warrant its declaration by this Court on its own motion (de manera oficiosa). In any event, the alleged nullity would not affect the judgment, as the appellant claims, but instead concerns a notification issue related to that procedural act (records of service). It is therefore contradictory to request, on the one hand, that the judgment be declared null on the stated ground and, on the following page, to request that no further nullities be declared. Its assertions thus lack coherence and are not addressed, since they do not constitute grounds of appeal against the challenged judgment. The nullity alleged by the appellant against the judgment under appeal must be rejected.- In the same vein, in a brief filed with this Court dated 9 de agosto del 2019, counsel for the plaintiff requests that the appeal be declared improperly admitted.
This request must be denied because, pursuant to Article 59 of the Ley de Jurisdicción Agraria, judgments are subject to appeal, and the judgment was served automatically on 25 de julio del 2019, such that service is deemed completed on 29 de julio, with the time limit beginning to run on 30 de julio and martes 6 de agosto being the fifth day for filing an appeal. The holidays of 25 de julio and 2 de agosto del 2019 must be considered when calculating the time limit. For this reason, and pursuant to Articles 11 and 50 of the Ley de Notificaciones Judiciales, the appellant’s appeal was properly admitted.-
II.This Court adopts the statement of facts deemed proven (hechos tenidos por demostrados) in the judgment under appeal, as it faithfully reflects what occurred in the record and the ruling on the incidental proceeding concerning newly arisen facts (incidente de hechos nuevos).-
III.The Court likewise concurs with the findings regarding facts not proven (hechos no probados), as there is no evidence thereof in the case file (expediente).-
IV.The special judicial attorney-in-fact of Inversiones [[Nombre12] ] Sociedad Anónima appeals the judgment rendered at eight twenty hours on veinticuatro de julio del dos mil diecinueve, on the following grounds: With regard to limitation (prescripción), he considers that the evidence should have been assessed to determine whether, in filing the complaint, the plaintiff exceeded the ten-year period established by Article 868 of the Civil Code. He considers that the analysis of the evidence did not support the conclusion reached in the judgment, because the court merely applied a legal principle wholly unrelated to extinctive prescription (prescripción negativa), namely Article 320, concerning recovery of property (reivindicación), and which is entirely unrelated to the principle it inferred, that the right of ownership is not subject to extinctive prescription. Without addressing its duty to analyze the evidence in order to determine whether extinctive prescription had occurred, the court erroneously concluded that the defense of extinctive prescription does not apply to actions for recovery of property and duplicate titles (duplicidad de títulos), because the right of ownership is not subject to extinctive prescription (Article 320 of the Civil Code).
By this conclusion, it rejects the argument that the defendant Inversiones [[Nombre12] ] had 90 years of possession, including that of its predecessors in title (now 99 years, because possession began in 1920). In her reasoning, the court below makes assertions contrary to agrarian law in support of the proposition that ownership is not subject to prescription: a) The plaintiff proved that it possessed the property by means of its survey plan. b) Possession under the survey plan covered a forested area which, because of its rugged terrain, did not permit typical agricultural and livestock activities. c) It does not accept the alleged 90 years of possession for purposes of prescription, but only possession beginning in 2004, when the probate proceeding (sucesorio) of [[Nombre26] ] was opened (ignoring that she was the first possessor in 1920); d) According to the court below, the plaintiff possessed the property because it defended its possession through possessory proceeding (interdicto) 05-23 (which had lapsed); e) And, according to the court, the plaintiff exercised possession because, after the possessory proceeding and several months before the ordinary proceeding, it filed advance evidence proceedings (diligencias de prueba anticipada).
In other words, it asserts that his client alleged possession for more than 90 years, including the possession of its predecessors in title, and that the plaintiff performed no agricultural work or activity, leaving the land unproductive and allowing more than 10 years to pass without pursuing any legal action (that is, the limitation period). He asserts that the judgment cannot order recovery of property on the ground that ownership is not subject to prescription as against another owner, but only as against an unlawful possessor. The court below errs by combining all actions protecting ownership into a single action, when each is independent, recovery of property being the remedy granted to an owner to obtain the return of its property from an unlawful possessor. In support of his argument, the appellant cites case law from the First Chamber of the Supreme Court of Justice, as well as legal scholarship to that effect.
Another ground of appeal concerns his contention that there is no evidence that the plaintiff is an agricultural landowner engaged in agricultural acts and an agricultural activity; on the contrary, the plaintiff’s property is commercial in nature and was used exclusively as a hotel. He states that the plaintiff had never had a survey plan for the approximately 44 hectares and therefore, when surveying the land, it did not take into account the area possessed, but instead extended downward in an attempt to dispossess the defendant. He indicates that one of the plaintiff’s immediate predecessors in title, [[Nombre27] ], stated in his testimony that, in the upper portion, the property extended as far as an existing fence. He stated verbatim: “...then don [[Nombre19] ] divided the remainder of the property he had (sic: the one his siblings had contributed so it could be registered through possessory information proceedings (información posesoria) and each interest divided), and he allotted the upper portion to Doña [[Nombre26] ] (sic); he gave her the area from Guido’s fence outward, thus giving her part of another property (...) The fence that divided the property in the upper portion must have been there for more than 30 years (folio 1015 verso).
Therefore, if that is so, the plaintiff had a survey plan prepared in 2007 that forces in the approximately 44 hectares, including the upper portion where the hotel is located, which was improperly purchased, as well as a portion in the lower area to which it had no right because the new survey plan encompassed the property registered to [Nombre12] from the heirs whose interests his client had been purchasing, until that sale was legally formalized when the property was registered independently; nevertheless, it bears repeating that some portions had already been sold. This witness testified contrary to the plaintiff’s claims.” Another ground raised by the appellant is that the judgment is inconsistent because it awarded more than, and something different from, what was requested. In her eagerness to decide the case, the judge awarded more than was requested in the relief sought, as well as matters very different from those requested by the plaintiff in its lengthy prayer for relief, confusing the elements of an action for recovery of property and arriving at wholly inconsistent reasoning.
Claim 4) of the complaint can be summarized as requesting boundary demarcation (deslinde) and a dividing fence, followed by placement in possession of the entire property in accordance with survey plan [Valor 003]. Claim 5) identified “the disputed area” as lying between cartographic points 15 and 3 and extending approximately 100 meters toward [Dirección2] along the entire length of the plaintiff’s property. The judgment determined the disputed area as lying between vertices 16 and 64 and vertices 7 and 67, which is entirely different from the relief sought. He argues that, in point three, the court orders restitution to the plaintiff within 15 days and establishes an entire series of specifications that were neither requested nor analyzed by an expert, defining unrequested boundary features, such as the location of the fences on the plaintiff’s survey plan [Valor 003], using live/dead posts of average quality and height spaced 2 1/2 meters apart, with 4 strands of average-quality barbed wire; it also authorizes the plaintiff to construct them and recover their cost in proceedings to enforce the judgment (ejecución de sentencia).
Thus, numerous forms of relief not requested were awarded. He should be exempted from costs because all the other defendants declared in default were excused from that payment, and he therefore considers that he should receive the same treatment. He likewise objects to the award of damages, although the judgment awarded an extremely excessive amount under that heading, leaving the amount to be determined by an expert in proceedings to enforce the judgment. He reiterates that the action for recovery of property is time-barred because the owner has been in possession for nearly 100 years. The property corresponding to survey plan [Valor 004] has been possessed openly, publicly, peacefully, and without interruption by [[Nombre26] ] cc [[Nombre26] ] since 1920, including the possession of her predecessors in title; it was subsequently possessed by the Estate and is now possessed by Inversiones [[Nombre12] ], which, when the plaintiff installed the fences to take part of the land, had possessed it for 99 years.- Throughout all those years, and particularly during the last 10 years, the plaintiff never asserted any right.
Thus, for far longer than the period required for extinctive prescription, neither the plaintiff nor its predecessors in title made any claim concerning the two different properties or the erroneously prepared cadastral survey plan [Valor 003], and he therefore considers this action to be time-barred.- He states that the plaintiff never pursued any judicial action, principally because [[Nombre1] ] S.A. is a company owned by North Americans that has never performed any agricultural work or activity, has maintained its property as civil and unproductive property, and has allowed more than ten years to pass without pursuing any judicial action on the grounds it now presents; accordingly, the action must be declared time-barred. He requests reversal of the order for agrarian recovery of property against another owner who is a lawful possessor with 99 years of possession, contending that there was no analysis of the duplicate titles.
The court below examined the case on the basis that the judicial outcome should favor the party who, in addition to holding title, also has possession: in this case, his client, which has possessed the property for 99 years. When the plaintiff entered its property to deprive it of possession through a possessory proceeding, Inversiones [[Nombre12] ] prevailed in that proceeding, and therefore its possession was not interrupted in any way. He states that the case law is very simple: previously, when recovery of property was disputed between two owners, the Chamber, on the basis of Article 455 of the Civil Code, ruled in favor of the older title. The newer doctrine ruled in favor of the party who, in addition to holding title, also had possession, and he transcribes part of Voto 127-95 of the First Chamber of the Court concerning limitation in cases involving recovery of property and adverse possession (usucapión).
For the foregoing reasons, he considers that the judgment should be reversed because, if the evidence is analyzed in its entirety and not solely on the basis of one question in a party examination (confesional), it can be established that the plaintiff’s own witnesses stated that the property extended to the edge of a large drop-off and had been duly separated by barbed wire for many years. After presenting this argument, he lists the events without their constituting grounds of appeal as such. He considers that the plaintiff lacks standing (legitimación activa), because it did not properly prove that it was an agricultural landowner, given that its hotel activity is commercial and therefore civil in nature; he reiterates that an action for recovery of property is brought by an owner against an unlawful possessor, whereas the defendant is an owner. He alleges lack of standing to be sued (legitimación pasiva), because his client is an agricultural landowner and not an unlawful possessor.
He states that the plaintiff and its predecessors in title always respected the boundary with the property shown on survey plan [Valor 004], which had been possessed openly, publicly, peacefully, and without interruption by [[Nombre26] ] cc [[Nombre26] ] since 1920. In answering the complaint, all the defendants stated that Inversiones [[Nombre12] ] Sociedad Anónima had lawfully purchased from the heirs the property recorded in the Partido de [[Nombre20] ] under Number [Valor 022], cadastral survey plan [Valor 021], with an area of 15 hectares 2037,64 square meters and 90 years of agrarian possession. The plaintiff never proved by any means that his client’s possession was unlawful. This occurred after the plaintiff had its new survey plan prepared, violently installed the fence, and was ruled against in a possessory proceeding. He alleges a lack of identity of the property (falta de identidad de la cosa), because the plaintiff does not identify what rights it holds, where they are located, or of what possession it was dispossessed; in the first claim of the complaint, it requests recovery of 4 hectares, while in the final amendment to the complaint, which was not directed against Inversiones [[Nombre12] ], it states that his client dispossessed it and therefore seeks recovery of 20 hectares of the property.
He considers the complaint generic insofar as it refers to numerous possessors who must be identified by the exact area each possesses. The plaintiff clearly states that it has never exercised possessory acts in the area whose restitution it seeks. He also states that its property is forestland and has no agricultural activity. (See appeal in file dated 06/08/2019 09:15:10).-
V.To decide this case, the premises of the analysis must be clear, and from there the type of principal action submitted for our consideration must be determined. The plaintiff claims its property right over a strip of land that it states forms part of its property registered in the Public Registry under property number [[Placa9] ] and described in cadastral plan [Valor 003]; for its part, the defendant, Inversiones [[Nombre12] ] Sociedad Anónima, states on appeal that the disputed strip of land is its registered property because it is included within property number [[Placa10] ], described in plan [Valor 021]. This is a double-titling dispute (conflicto de doble titulación), in which it must be determined which of the two titles prevails over the other. One of the appellant’s grounds of appeal (agravios) is that the case was erroneously analyzed as though it involved a revendicatory action (acción reivindicatoria), and that the defense of adverse prescription (excepción de prescripción negativa) was rejected as though this were the statutory situation governed by Article 320 of the Civil Code, overlooking the fact that the party it represents is not an unlawful possessor (poseedora ilegítima), since it holds a valid property title.
This is not a case involving a registered owner (propietario registral) against an unlawful possessor who dispossessed the owner of a strip of land; rather, both parties hold registered title (título registral). In light of these factual premises, the analysis is directed toward determining which of the two titles prevails and which must be extinguished in the Registry. It should be noted that the court below (a-quo) analyzes the double titling and determines the prevailing title on the basis that both parties hold registered title, as may be seen in recital XV (considerando XV). Therefore, the appellant’s contention that the court below resolved the dispute on the basis of a revendicatory action, as though it had not resolved the duplication of titles (duplicidad de títulos), is incorrect, because it did resolve that issue in the aforementioned recital XV; accordingly, its ground of appeal in this respect is not accepted.
Although it is true that the court analyzes several actions that it considers to arise from the joinder of claims (acumulación de pretensiones), the fact remains that the principal action decided is the double-titling action. In this specific case, moreover, the issue presented is not merely formal double titling: the plaintiff alleges that it was dispossessed of its right and requests restoration of possession (reintegrado en la posesión) of the disputed area. This is a consequence arising from the recognition that its title is valid, after which the appropriateness of restitution (restitución) must be analyzed. For that reason, it may appear that the court is discussing a revendicatory action, when the relevant issue is to determine which party’s title prevails and then to order restitution and demarcation (delimitación) of the area in question.
VI.This issue has been addressed by the First Chamber of the Supreme Court of Justice, which ruled as follows in decision number 823 at 03:35 hours on 16 de noviembre del 2007: “IV. The central issue in this appeal concerns multiple titles to the same immovable property, where two persons, acting in good faith and in reliance on public notice through the Registry (publicidad registral), acquire land and this situation arises from deficiencies in the Costa Rican system. In this regard, it is appropriate to recall the position adopted by the Court of Cassation and subsequently by the First Chamber of the Supreme Court of Justice. In that respect, the former Court of Cassation held in judgment no. 132 at 15 hours 30 minutes on 25 de septiembre de 1974 that: ‘The problem of duplicate titles (títulos repetidos) to the same immovable property, even those validated by prescription, can only be resolved by giving preference to the person who possesses all attributes of ownership (atributos del dominio), specifically possession (posesión).
Numerous judgments of this Court have so held, including Nº 80 at 15 hours on 29 de julio de 1958, pages 126 et seq. of the corresponding volume of the Collection.’ In the same vein, in a more recent case, this Chamber held in judgment no. 84 at 14 hours 30 minutes on 22 de mayo de 1992: ‘.....- As regards duplicate titles, the most recent case law has established that it is not the oldest title that governs, but rather the superior title, which is characterized fundamentally by possession; and it has already been stated that the plaintiff never possessed the property, because it was always in the possession first of the seller and, after her death, of the purchasers,….’ It follows from the cited case law that a conflict may arise among different titles and that mere registered ownership (titularidad registral), even if proven, is not sufficient to resolve this type of dispute. Rather, the dispute must be resolved in favor of the person who proves the connection between formal ownership—that recorded in the Public Registry—and material possession (posesión material) of the land.
In this specific case, the testimonial evidence established that the original boundary (colindancia) between the two properties was the dividing fence running along the edge where the steep slope began, and that this boundary coincided with the dividing line established by the expert in the technical study appearing at folios 943 and 1331, where the overlap area (área de traslape) between the two properties is stated to begin, corresponding to the upper portion where the steep slope begins. In this regard, witness [[Nombre28] ] testified: ‘Don [[Nombre19] ] sold the lower portion because, when he divided the land among his siblings, they all decided that this low-lying portion was unsuitable for cultivation because it was very rugged, and they decided it would be better for him to sell it. [[Nombre26] ] and the other siblings agreed to this, which is why [[Nombre19] ] sold it to [[Nombre27] ].
When [[Nombre27] ] purchased the property, there were fences along the edge of the steep slope dividing the properties’ (f.1025). [[Nombre29] ] testified to the same effect at folio 1022 verso, stating that the steep slope separated [[Nombre26] ]’s property—the appellant’s land—from the plaintiff’s property, and that there was a fence along its edge. Witness [[Nombre25] ], at folio 1024 verso, stated that he had worked building fences for the defendant and did not wish to work below the steep slope because he knew that the upper fence—meaning the place where the steep slope begins—was the boundary between the two properties, and that other persons ultimately performed the brush-clearing work (chapeas) on the plaintiff’s land. During the judicial inspection (reconocimiento judicial) recorded at folio 1026, remnants of an old fence were observed, as were its holes and fallen posts along that boundary, indicating that they were traces of the old fence that formed the boundary in that part of the steep slope.
As stated, the old fence existed in that area in accordance with the original division at the time the plaintiff and its predecessor in title (transmitente) acquired the property on 6 de noviembre de 1991, when it was subdivided as a lot sold from the parent property (finca madre) [Valor 049], as described in plan [Valor 003], which is divided by the overlap, as shown in the aforementioned expert report (informe pericial). The exercise of possession over that area was demonstrated not only by the demarcation provided by the old fence, which was removed around the year dos mil cuatro- dos mil cinco when the possessory injunction proceedings (interdictos) between the parties began, as shown in case files EXPN2 and EXPN3 (to which we will refer below).- Proof of the existence of the old fence along the boundary where the steep slope begins between the two properties is the decisive fact demonstrating the holding of the land (tenencia de la tierra) as it was physically distributed between the parties’ respective predecessors in title.
The land occupied by the appellant co-defendant is stated to have been used for agriculture and livestock raising, while on the land occupied by the plaintiff, the overlap area corresponding to the steep slope remained forested because of the property’s rugged terrain. The fact that land retains forested areas does not mean that it has been abandoned or lies uncultivated, because conserving that forest resource and the ecosystem existing within it also constitutes a form of exercising possession, as established by Articles 45 and 50 of our Political Constitution, as will be discussed below. Moreover, this title [Valor 030], with plan [Valor 003], in addition to exercising the attributes of ownership for the reasons already explained, is also the older of the two titles. Both properties originated from parent property [Valor 049], which came into existence through registration in possessory information proceedings (información posesoria) conducted by [[Nombre19] ], who, upon registering it, was obligated to subdivide the lots corresponding to his siblings.
Accordingly, on 6 de noviembre de 1991 property [Valor 002] came into existence, having been subdivided as a lot sold pursuant to plan [Valor 003]. Irrespective of any reasons that may exist but are unknown, property [Valor 050], with plan [Valor 004], came into existence on 19 de enero de 1996, with an area of 19 ha 3795.18 m2 and a description in the aforementioned public instrument (escritura pública) stating that the subdivided lot did not adjoin the remainder of the parent property because of prior subdivisions (segregaciones precedentes). The plan identified therein is therefore regarded as a reference, since the parent property had undergone several subdivisions. Indeed, the property of the appellant defendant, which originated from the consolidation (reunión) of several interests awarded in the probate proceedings (proceso sucesorio) of [[Nombre26] ], the original owner of property [Valor 050], has an area smaller than the original area, namely 152037,64 m2, and is currently described as property number [Valor 035], with plan [Valor 021]; this is the plan used in the expert overlap study.
As may be seen, of the two properties subdivided from the same source, the plaintiff’s property came into existence first, on 6 de noviembre de 1991, and the appellant defendant’s property on 19 de enero de 1996. Thus, in addition to holding the disputed area by conserving the natural resource within the area demarcated by the old fence that divided the two parcels, the plaintiff also holds the older title. It therefore satisfies the two historical criteria used in the case law to resolve double-titling disputes, as explained supra through the cited case law, with which the appellant is familiar and which it also invokes regarding double titling.- This is the central issue to be resolved in this specific case. Turning to another matter, and considering the claims asserted in the complaint, which involve the effects of the facts arising from that double titling, the expert opinion (dictamen pericial) shows that the overlap area within the plaintiff’s property includes not only land encompassed by overlapping plan [Valor 021], but also land enclosed when the defendant, Inversiones [[Nombre12] ] S.A, placed a fence perpendicular to the steep slope along the southern sector of its plan.
This encompasses an area of land under plan [Valor 003] that is not within the area depicted in the defendant’s plan, but instead extends beyond its boundaries and into the plaintiff’s land. This means that the area is not within what we would call a duplicate title, because it lies outside the area covered by that title. The court below’s analysis in the judgment of the revendicatory action as to these areas is therefore not superfluous. Nor should it be overlooked that, in addition to the double-titling dispute, the plaintiff states that it was dispossessed of the overlapping area and requests that it be restored to that area, with the boundaries placed in their original location—where the steep slope begins—in accordance with the possession it held before the dispute over the removal of fences began and gave rise to the possessory injunction proceedings between the parties.-
VII.Once the principal issue in the action involving duplicate title (acción por doble titulación) has been resolved, the appellant’s grounds for appeal shall be analyzed in detail, in the order in which the appellant presented them. The appellant begins the substantive grounds for appeal by arguing that, in ruling on the alleged limitation period (prescripción), it should have been determined whether, in filing the complaint, the plaintiff exceeded the ten-year period established by Article 868 of the Civil Code. This was not properly analyzed, because the defense was rejected through application of Article 320 of that Code, which concerns an action for recovery of ownership (acción reivindicatoria), and on the basis of that provision it was held that ownership rights are not subject to limitation. This case, however, concerns an action involving duplicate title, in which both titles purportedly have an equal chain of title.
The appellant is correct in that respect, because this is not a case involving a possessor who could defeat the ownership right on the ground that the possessor acquired it through adverse possession (usucapión); rather, the defendant is another registered titleholder, not an unlawful possessor without title. It should be noted that the title held by each party constitutes a right validated by prescription, and therefore neither party could invoke extinctive prescription (prescripción negativa) against the other based on Article 868 ibídem, because this is a case of duplicate titles. Even if more than ten years have elapsed since the registration of each perfected title, one of them must be extinguished, since the principle of legal certainty makes it impossible for two or more titles to exist over the same property. Such a situation is resolved by selecting the superior title, which is the one accompanied by physical possession (posesión material); and if that title is also the oldest, these two factors make it possible to determine which title prevails.
The appellant states that the party it represents alleged possession for more than 90 years, when added to the possession of its predecessors in title, and that the plaintiff performed no agricultural work or activity, leaving the land unproductive, and allowed more than 10 years to pass without bringing any legal action (that is, extinctive prescription). This reasoning is not accepted because, as already analyzed, it was the plaintiff who exercised conservation possession (posesión de conservación) over the disputed area, which was demarcated by the original old fence between the two properties where the “guindo” begins. What need would the plaintiff have had to bring an action before ten years elapsed if the disputed strip had always remained in its possession since it acquired the property? It was not until approximately 2004 and 2005 that the disputes between the parties began, with both parties removing fences, and not earlier, such that a ten-year period might be calculated under the appellant’s theory.
For the foregoing reasons, the defense of extinctive prescription against the claim based on duplicate titles must be rejected, since both titles have been validated by prescription, and what remains is to determine which is the superior, prevailing title and to extinguish the one that is not. The appellant’s argument alleging possession for more than 90 years derived from [[Nombre26] ], who possessed the property beginning in 1920, is consistent with the assertion that its title was validated by prescription. As with the plaintiff’s title, this dispute is not resolved by determining whether either party has a right subject to extinctive prescription, but by determining which is the superior title, as analyzed in the preceding recital (considerando).- Another ground for appeal concerns the claim that the plaintiff is not an agricultural landowner because its activity is commercial, devoted exclusively to a hotel, and therefore civil in nature, such that it cannot bring an action for recovery of ownership against another party that is an agricultural landowner.
As explained supra, agricultural possession (posesión agraria), traditionally understood as the pursuit of an agricultural activity consisting of the production of an animal or plant biological cycle, following one or multiple transformations in pursuit of an economic purpose, is not the only manner in which possession may be exercised. In light of the development of protections for the natural resources existing within property rights, it is precisely inaction that the law encourages under Articles 45 and 50 of the Political Constitution, leaving behind the policy of clearing forests promoted by the Ley de Tierras y Colonización, which encouraged such agricultural practices as evidence of possession, regardless of the resulting harm to the environment and to natural resources such as water, soil, forests, and so forth. Property rights have now evolved in parallel with the development of human rights, as in the case of the right to a healthy and ecologically balanced environment.
This means that the exercise of property rights must also take this human right into account, as regulated in our Political Constitution through the amendment to Article 50, which states: “The State shall seek the greatest well-being of all inhabitants of the country by organizing and encouraging production and the most appropriate distribution of wealth. Every person has the right to a healthy and ecologically balanced environment. Accordingly, every person has standing to report acts that infringe that right and to seek reparation for the harm caused. The State shall guarantee, defend, and preserve that right. The law shall determine the corresponding liabilities and penalties.” At first, property was understood as being essentially possession-based; however, recognition of the cross-cutting effect of environmental law on property rights in these forested areas has brought about a change in the holding of that right, establishing an obligation to protect the forest, its resources, the ecosystem it contains, and the natural landscape.
The plaintiff was dispossessed of this form of possession when both parties began filing summary possessory proceedings (interdictos). Property rights are possessory and dynamic, but the environmental dimension gives that dynamism a more comprehensive protective character.- Any other interpretation would remove the incentive that the owner had to keep those lands idle in accordance with that conservationist conduct. Accordingly, the appellant’s contention that the plaintiff lacked possession because it conducted no agricultural activity is not accepted, since the plaintiff exercises the substance of its property right through its right of possession for the conservation of forest resources, particularly because this was irregular terrain where tree cover (cobertura arbórea) is important to prevent soil erosion due to the slope. (See the contour lines described in the expert report at folio 943).- The appellant’s grounds for appeal asserting that the court below justified the plaintiff’s possession by stating that the plaintiff possessed the property because it defended its possession through summary possessory proceeding 05-23 (which had lapsed), and that it exercised possession because, after that proceeding and several months before the ordinary proceeding, it filed motions to preserve evidence in advance (diligencias de prueba anticipada), are not accepted.
This Court does not share that view, because the court below does not appear to have based its finding of possession on the filing of those proceedings. Rather, the principal evidentiary basis it relied on was testimonial evidence, among other evidence, pursuant to the principle of free evaluation of evidence (libre valoración probatoria) established in Article 54 of the Ley de Jurisdicción Agraria.- The appellant also states that no consideration was given to the fact that it prevailed in summary possessory proceeding 05-23, in which its possession was recognized. This ground for appeal is not accepted. It was during this period that the dispute over the aforementioned boundary, and consequently the overlap and dispossession of the area at issue, appears to have begun. In summary possessory proceeding EXPN3, Voto 258-F-2007 of the Tribunal Agrario ordered that the appellant defendant be maintained in possession up to the boundary of the new fence that the defendant had installed and that the plaintiff had removed manu militari.
For that reason, judgment granting relief was entered against the plaintiff, given that summary possessory protection (tutela interdictal) applies to current and immediate possession, regardless of whether an older fence existed elsewhere and had previously been removed by the defendant company, since such proceedings do not definitively determine matters of ownership or possession, which fall within the exclusive jurisdiction of declaratory proceedings (proceso declarativo). The outcomes of the summary possessory proceedings therefore have no relevance in determining matters concerning the removal and/or demarcation of boundaries. They are relevant, however, for identifying when the disputes between the parties began: when the original fence located along the edge of the guindo between the two adjoining properties was removed, rather than in the area where the new dividing line was erected and dispossessed the plaintiff.
Accordingly, the appellant’s argument that the right belongs to the defendant, Inversiones [[Nombre12] ], based on the ruling in its favor in the aforementioned summary possessory proceeding recognizing its current and immediate possession through Voto 258-F-2007, cannot be accepted. Another ground for appeal is the assertion that the plaintiff had never had a survey plan (plano) for the approximately 44 hectares and that, when measuring the land, it did not take into account the area actually possessed but instead extended the measurement downslope in an attempt to dispossess the defendant. This assertion lacks evidentiary support, given the existence of the original fence, remnants of which were observed in situ during the judicial inspection (reconocimiento judicial) documented at folios 1025 and 1026, as described supra. The appellant challenges the testimony of [[Nombre27] ], who stated that the upper portion of the property extended as far as an existing fence, contending that because the hotel is located in the upper portion, the testimony is unfavorable to the plaintiff.
The witness’s statement does not appear confusing, because it may also be interpreted as referring to the area where the guindo begins as the upper portion, which is precisely where the original old fence dividing the two properties was said to have existed. This interpretation is consistent with the testimony of the other witnesses already analyzed supra.
VIII.The appellant alleges inconsistency in the judgment under appeal, because it considers that the judgment granted more than and something different from what was requested. Claim 4 of the complaint may be summarized as requesting boundary demarcation (deslinde) and a dividing fence, followed by restoration of possession of the entire property in accordance with plan [Valor 003]. Claim 5) The disputed area was identified as lying between cartographic points [Dirección7] and approximately [Dirección8] toward [Dirección9], throughout the full extent thereof within the plaintiff’s property. The judgment, however, determined that the disputed area lay between vertices 16 and 64 and vertices 7 and 67, which is entirely different from the claim. This Court does not agree with the appellant’s argument for two reasons: a) it must be noted that the claims in the complaint were expanded, as shown at folio 575, as the appellant acknowledges at the end of its appeal when stating that such expansion was not directed against the party it represents.
This Court likewise disagrees with that contention, because the pleading expanding the complaint, appearing at folio 575, clearly states that the expanded claims encompass Inversiones [[Nombre12] ] S.A. and reads: “The defendants shall restore to the plaintiff herein the area or portion of the land comprising the property registered in the province of [[Nombre20] ], real-property folio registration [[Placa1] ], measuring approximately twenty hectares, which the defendants occupy without any right whatsoever; said land is located according to cadastral plan (plano catastrado) number [Valor 003] and pertains to the property owned by the plaintiff, province of [[Nombre21] ] ([Nombre30]), registration [[Placa3] ], approximately from boundary point (derrotero) 16 in a straight line from east to west to a point between boundary points 64 and 65, with a fence approximately 300 meters long, and from boundary point 7 approximately to a point between boundary points 66 and 67, with another fence approximately 200 meters long, an area to be determined by the surveying expert” (see folio 579).
As may be observed, the wording of the claim even allows some degree of flexibility between what was requested and what was granted, because in disputes involving determination of an overlapping area (área de traslape), an exact description of the area is not required, given that, based on an approximate description of the subject matter of the dispute, it may be determined precisely through expert technical evidence (prueba técnica pericial). As stated in the cited claim, the claimed area was to be determined by the surveying expert, which is what occurred in this particular case. Because the adversarial principle (principio del contradictorio) was observed, including in connection with the taking of the expert evidence, it is concluded that there was no violation of the right of defense (derecho de defensa), since the party knew the subject matter at issue in the proceeding; and because that was the matter under dispute, the precise determination of the overlapping disputed area was not unexpected and is consistent with the claims in the complaint, including those subsequently added.
The appellant likewise contends that the judgment ruled on the installation of the fence with the characteristics specified therein, although this was not requested in that manner in the complaint. This argument is rejected, because the trial judge ruled on matters derived from the principal action. They are the natural consequence of the action. Given the factual circumstances, involving dispossession (desposesión) and alteration of boundaries, it was necessary to grant such relief subject to the outcome of the principal action—whether an action concerning dual titles or duplicate titles—and, in this case, demarcation by means of a fence having the stated characteristics is among the implementing measures arising from the principal claim for purposes of enforcing the judgment, including at the registry level. Even if not expressly requested, the trial judge, by virtue of the duty to provide accurate registry information, correct errors, and rectify measurements, as the lower court judge did, must contribute to the system information that promotes legal certainty (seguridad jurídica), since it is her duty to do so.
This is a registry and cadastral obligation imposed by law, because information of a public nature must be accurate. The judge therefore acted properly in ordering the registry amendments necessary for that purpose. The appellant states that numerous matters not requested were granted, but does not identify them, which prevents this Chamber from considering that generalized argument.
As another ground of appeal, the sole co-defendant that appealed requests exemption from payment of both procedural costs and attorney fees (costas procesales y personales), contending that the party it represents is in the same position as the remaining defendants, who were exempted because they were declared in default (rebeldía). It further states that, because of its default status, it had no opportunity to formally oppose the complaint.- In its broadest sense, an order to pay procedural costs and attorney fees arises when a judicial decision requires a particular person to pay litigation expenses that, absent such an order, the person would not be required to pay. Therefore, an award of costs almost always concerns the expenses incurred by the opposing party or parties. The rule is that costs are awarded against the litigant who has lost the proceeding. This is the system adopted by both sections 55 and 56 of the Ley de Jurisdicción Agraria.
There are two theories concerning the purpose of and circumstances warranting an award of costs. Under one, such an award is appropriate only when the losing party has acted recklessly or in bad faith; under the other, it always applies to the losing party unless the judge exempts that party from payment based on special considerations that must be specified. DE SANTO (Víctor). Diccionario de Derecho Procesal, Buenos Aires, Universidad, 1991, p.86. Our Ley de Jurisdicción Agraria follows the latter theory; that is, the principle of objective defeat (principio del vencimiento objetivo) governs, unless an exceptional circumstance, also provided for by the legislature, warrants exempting the losing party from such an award. Accordingly, in procedural matters, this principle has an exception found in article 55 of the Ley de Jurisdicción Agraria. We refer to exemption from costs (exención de costas).
It is an exception, meaning that the rule is to award costs and that, if the exception is applied, the judge must state the reasons for the exemption. In the present matter, there is no partial award, no reciprocal defeat (vencimiento recíproco), the complaint does not include excessive claims, and the prevailing opposing party did not pursue idle or unnecessary measures. Therefore, in accordance with the foregoing and section 55 of the Ley de Jurisdicción Agraria, there is no compelling reason to grant the appellant’s request. Although it is true that the appellant was declared in default, it subsequently joined the proceeding and accepted it in the state in which it stood at the time of its appearance; nevertheless, it did so by asserting its opposition pursuant to the adversarial principle and even exercised the available remedies, which does not amount to tacit acquiescence (allanamiento tácito), as occurs with default. Furthermore, unlike the remaining defaulting defendants, it was not exempted because Inversiones [Nombre 012] S.A. was the party that moved the fences marking the original boundaries.-
X.For the same reasons asserted in requesting exemption from costs, the appellant requests that no damages (daños y perjuicios) be awarded against it. It states that the judgment awarded a greatly excessive amount of damages, leaving the amount to be determined by an expert during enforcement of the judgment (ejecución de sentencia). It should be noted that the relief was granted for loss of enjoyment of the property, and payment of two million colones was ordered as compensation to the owner for having been unable to access the overlapping area of its property for several years following its dispossession. This is justifiable and is not considered excessive, contrary to the appellant’s contention, because even if the land contains only forest from which no economic benefit is obtained, the plaintiff was deprived even of the simple enjoyment of the attributes of ownership and was unable to benefit from any gains that might arise from its potential scenic beauty or from enjoying its environmental benefits for present and future generations (such as payment for environmental services).
The foregoing falls within the general category established by the lower court judge as inability to exercise possession, for which she awarded the sum of two million colones.- Finally, it is noted that the appellant does not state why it considers the award excessive or the reasons underlying that value judgment.-
XI.In the final part of her appeal (recurso de apelación), she identifies as a grievance (agravio) what she titles as follows: “I request that the recovery claim (reivindicación) be declared time-barred because the owner has possessed the property for almost 100 years.” This grievance is not understood, since on earlier pages of her appeal she opposed a ruling on the statute-of-limitations defense (prescripción) raised against the recovery claim, because the matter involved duplicate titles (títulos repetidos) and Article 320 of the Civil Code was inapplicable, contrary to the ruling of the lower-court judge, and she transcribes case-law citations to that effect. Later in that section, she reiterates the arguments concerning the negative prescription (prescripción negativa) of the action, because the plaintiff made no claim concerning the properties when the fences were erected, by which time the defendant had already possessed the property for 99 years.
This argument was already resolved supra when we addressed prescription as to its consolidation in duplicate titles. Other final grievances include her assertion that the evidence was not analyzed in its entirety and that the court should not have determined, solely from one question in a judicial examination (confesional), that the property extended to a steep drop-off, duly separated by barbed wire for many years. It should be noted that it is not true that the lower-court judge derived that fact from a question in the judicial examination, since she specifically did not give effect to that deemed admission (confesión ficta), because she found that the two questions asked were generic and that the second had even already been admitted in the answer to the complaint. She states that her right must be assessed according to the 1985 survey plan (plano), whereas the plaintiff’s plan was prepared later, in 1987, and that the latter overlaps the plan of [[Nombre26] ], which is [Valor 004].
This grievance is likewise without merit, because under Article 301 of the Civil Code, “the surveying of land, whether challenged or not, is not by itself sufficient to prove possession of that same land.” Based on this provision, determining which plan is older is irrelevant, since the relevant factors that must be assessed to determine the prevailing title in a duplicate-title action have already been explained, and those considerations do not include determining which plan is older or whether one modifies the other. It should be noted that there are differences in area between plan [Valor 004] of [[Nombre26] ] and the plan that currently represents the property of the defendant-appellant, [Valor 021], which means that the first plan has undergone modifications and, consequently, that there is no certainty that the information it depicts corresponds to the physical reality. Moreover, at that time the parent property (finca madre) had undergone several segregations (segregaciones), making the plan even less precise where it states that it is provided for reference only.
However, as already stated in the quotation from Article 301, the surveying of land does not prove the existence of possession. Finally, she alleges a lack of standing to sue (legitimación activa), on the ground that the plaintiff is not an agricultural possessor (poseedora agraria); a lack of standing to be sued (legitimación pasiva), because she considers that the defendant holds a registered title obtained from the heirs of [[Nombre26] ]; and a lack of identity of the property, because the plaintiff has not possessed what she seeks to recover and restitution is therefore unwarranted.- These issues have already been resolved in the preceding recitals (considerandos), as they are repeated grievances. In closing, it should be noted that the plaintiff’s claim is not classified as a recovery action, contrary to the appellant’s assertion that the action filed is of that nature and must be dismissed because this is a duplicate-title action.
We do not agree, because the lower-court judge ruled on the double-titling action (acción de doble titulación), and because that is the principal action, she also had to address the restitution and boundary demarcation (delimitación de linderos) sought in the complaint, since these matters were part of the dispossession (despojo), and restoration of the disputed area follows as a legal consequence of declaring the plaintiff’s title to prevail over the defendant’s title.
XII.For the foregoing reasons, the judgment shall be affirmed insofar as it was appealed, and the negative-prescription defense is rejected for the reasons stated at this level of review.
POR TANTO:

VOTO N° 1205-F-2020 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las doce horas trece minutos del dos de diciembre de dos mil veinte.- PROCESO ORDINARIO promovido por [[Nombre1] ] SOCIEDAD ANÓNIMA, cédula jurídica [CED1 ] , representada por su presidente con facultades de apoderado generalísimo sin límite de suma [[Nombre2] ], [...]; contra [[Nombre3] ], [...]; [[Nombre4] ] , [...]; [[Nombre5] ], [...]; [[Nombre6] ], [...]; SUCESIÓN DE [[Nombre7] ], quien fue [...], representada por su albacea [[Nombre8] ], [...]; [[Nombre9] ], [...]; [[Nombre10] ] , [...]; [[Nombre11] ], [...]; INVERSIONES [[Nombre12] ], cédula jurídica [...], representada por su presidente con facultades de apoderado generalísimo sin límite de suma [[Nombre13] ], [...] ; [[Nombre14] ] SOCIEDAD ANÓNIMA , [...], representada por su presidente [[Nombre15] ], [...]; [[Nombre16] ], [...]; [[Nombre17] ], [...]; [[Nombre18] ], [...]; y contra [[Nombre19] ], [...].
Actúan como apoderados especiales judiciales de la sociedad actora el licenciado Gonzalo Alfonso Monge Corrales, colegiado tres mil doscientos veintidós; y del codemandado Inversiones [[Nombre12] ] el letrado Ricardo Zeledón Zeledón , colegiado mil cuatrocientos veintidós; y como abogada directora de los codemandados [[Nombre9] ], [[Nombre11] ] la licenciada Ana María Vargas Moya, colegiada dos mil novecientos veintidós, y esta última también representa pero en su carácter de apoderada especial judicial a los accionados [[Nombre16] ], [[Nombre10] ], [[Nombre6] ], [[Nombre4] ], [[Nombre5] ], [[Nombre3] ]. Tramitado ante el Juzgado Agrario del Primer Circuito Judicial de Guanacaste, con sede en Liberia.-
RESULTANDO:
Redacta la Jueza Alvarado Paniagua, y;
CONSIDERANDO:
I.La parte apelante invoca nulidad de la sentencia porque hubo 46 notificaciones fallidas, lo que prueba el malogrado sistema de notificaciones, no imputable a su representada, por lo que ha solicitado sanearlas repitiéndolas para evitar nulidad del fallo por irrespetar el derecho de defensa y debido proceso. No se comparte exista algún vicio como lo aduce el recurrente, pues de las actas de notificación a los número de fax [Valor 043], [Valor 044] y [Valor 045] se observa se practicaron los cinco intentos con interválos de 30 minutos cada uno en dos fecha diferentes conforme lo establecido en el artículo 50 de la Ley de Notificaciones y Citaciones Judiciales, por lo que no se observa en tales actas algún vicio que implique nulidad. El que la notificación automática se practicara por los cinco intentos conforme al artículo citado, a tres números de fax , ello no hace plena prueba de la existencia de una falla técnica atribuible al sistema de notificaciones, llegar a esa conclusión a partir de una premisa que es una falacia de apelación a la mayoría, no conlleva a la conclusión a la que pretende el apelante con este agravio.
Conforme a lo establecido en el artículo 26 de la Ley de Jurisdicción Agraria, la nulidad se impone cuando haya un perjuicio que produzca indefensión, en este caso, independientemente si transmisión de fax le pasó de manera incompleta la sentencia o si se produjo la notificación automática con los cinco intentos, pese a ello en caso de que así fuera, el apelante logra su objetivo de interponer el recurso de apelación, por lo que el fin del acto se cumplió. En cuanto al argumento que las otras partes no han sido notificadas por la supuesta falla del sistema de notificaciones al dar "envío fallido" al fax también para ellos, tampoco es de recibo, pues el artículo 194 del Código Procesal Civil de 1989 aplicable al caso concreto al ser la norma vigente al iniciarse este proceso y por lo dispuesto en el Transitorio I de la actual Ley 9342 Código Procesal Civil, establece la nulidad no podrá ser requerida sino por la parte perjudicada, de allí que el apelante carece de legitimación para invocar nulidad a favor de quienes no apelaron, siendo que en todo caso, no se observa ésta se haya producido como para dictarla de manera oficiosa por este Tribunal.
La nulidad alegada en todo caso no afectaría la sentencia como lo afirma el apelante, sino que se trata de un tema de notificación que se relaciona con ese actuación procesal (actas de notificación), por lo que resulta contradictorio por un lado pedir la nulidad de la sentencia con base en el motivo dicho, y en la página siguiente, solicita no se declaren más nulidades, por lo que carece de coherencia sus manifestaciones, a las que no se hacen referencia alguna dado no se trata de agravios contra la sentencia impugnada. - Deberá rechazarse la nulidad alegada por el apelante contra la sentencia que apela.- En este mismo orden de ideas, el abogado de la parte actora en escrito presentado ante este Tribunal fechado 9 de agosto del 2019, solicita sea declarada mal admitida la apelación, lo cual no ha de atenderse porque de conformidad con el artículo 59 de la Ley de Jurisdicción Agraria las sentencias cuentan con recurso de apelación, y la misma fue notificada de forma automática el 25 de julio del 2019, por lo que se tiene por hecha el día 29 de julio, comenzando a correr el plazo el 30 de julio siendo el martes 6 de agosto el día quinto para apelar.
Debe considerarse los feriados del 25 de julio y 2 de agosto del 2019 para el cómputo del plazo. Por tal motivo y de conformidad con los artículos 11 y 50 de la Ley de Notificaciones Judiciales, la apelación del recurrente ha sido bien admitida.-
II.Este Tribunal prohija la relación de hechos tenidos por demostrados en el fallo recurrido al ser fiel reflejo de lo acontecido en autos y lo resuelto sobre incidente de hechos nuevos.-
IV.El apoderado especial judicial de la sociedad Inversiones [[Nombre12] ] Sociedad Anónima, apela la sentencia de las ocho horas veinte minutos del veinticuatro de julio del dos mil diecinueve, al considerar lo siguiente: En cuanto a la prescripción se refiere, considera la prueba debió valorarse para determinar si la parte actora al plantear la demanda se sobrepasó en el plazo de diez años a que limita el artículo 868 del Código Civil. Considera el análisis de la prueba no condujo a la conclusión de la sentencia pues solo aplicó un principio jurídico ajeno completamente a la prescripción negativa como es el artículo 320 referido a la reivindicación y que completamente ajeno al principio que extrajo de que el derecho de dominio no es prescriptible negativamente. Sin hacer referencia a su obligación de analizar la prueba para concluir si había o no prescripción negativa, concluyó de manera errada al afirmar que para efectos de las acciones reivindicatorias y de duplicidad de títulos no procede la excepción de prescripción negativa, dado que el derecho de dominio es imprescriptible negativamente (artículo 320 Código Civil).
Con esta conclusión refuta el argumento que la demandada Inversiones [[Nombre12] ] tenían 90 años de posesión sumada la de sus transmitentes (hoy 99 años porque la posesión comenzó en 1920). En su planteamiento la a-quo llega a las afirmaciones contrarias a derecho agrario para sostener la imprescriptibilidad del dominio: a) La actora demostró que poseyó la finca por medio de su plano. b) La posesión con el plano fue sobre un área de bosque que por estar quebrada no permitía ejercer actividades agrarias típicas de agricultura y ganadería. c) No acepta la posesión alegada de 90 años para prescripción sino a partir del 2004 cuando se abrió el sucesorio de [[Nombre26] ] (ignorando que ella fue la primera poseedora en 1920), d) Según la a-quo la actora poseyó porque defendió su posesión por medio del interdicto 05-23 (caduco), e) Y según ella, ejerció posesión porque luego del interdicto, y meses antes del ordinario planteó diligencias de prueba anticipada.
Es decir, afirma su representada alegó una posesión de más de 90 años, sumada la posesión de sus transmitentes y que la actora no ejerció ninguna labor o actividad agraria, estando ese terreno improductivo, pasando más de 10 años sin ejercer ninguna acción legal (es decir la prescripción). Afirma, la sentencia no puede declarar reivindicación alegando la imprescriptibilidad del dominio contra otro propietario, solo contra el poseedor ilegítimo. La a-quo comete el error de juntar todas las acciones protectoras de la propiedad en una sola, cuando todas ellas son independientes, siendo la reivindicación la otorgada al propietario para lograr la restitución de un bien suyo por un poseedor ilegítimo. El apelante para respaldar su dicho, cita jurisprudencia de la Sala Primera de la Corte Suprema de Justicia, así como citas de doctrina en ese sentido. Otro agravio es referido a que considera, no existen pruebas de que la actora sea un propietario agrario, con ejercicio de hechos agrarios y una actividad agraria, todo lo contrario la propiedad de la actora es de carácter comercial, dedicaba exclusivamente a hotel.
Dice que la actora nunca había tenido un plano de las aproximadas 44 hectáreas, entonces al medir el terreno no tomó en cuenta lo poseído sino que bajó para tratar de desposeer a la demandada. Indica uno de los transmitentes inmediatos de la propiedad a la actora, [[Nombre27] ], en su declaración dice que la propiedad llegaba en la parte alta hasta donde había una cerca puesta. A le letra dice: "...después don [[Nombre19] ] repartió el resto de la finca que él tenía (sic: la que pusieron sus hermanos para inscribir por información posesoria y repartir cada derecho) y repartió la parte de arriba a Doña [[Nombre26] ] (sic) le dio de la cerca del guido, de ahí hacia afuera, entonces le dio una parte de otra finca (...) La cerca que dividía la propiedad en la parte de arriba, tenía de estar desde hace más de 30 años (folio 1015 vuelto). ¿Entonces siendo así, la actora se va a levantar un plano en el 2007, el cual forza las más o menos 44 hectáreas, tomando la parte alta donde se encuentra el hotel y que fue comprado indebidamente, más una parte en la zona de abajo sin tener derecho porque el nuevo plano abarcó la propiedad inscrita a [Nombre12] de los herederos que había ido vendiendo su representada, hasta concretar jurídicamente tal venta cuando la finca se inscribió en forma independiente, no obstante, se insiste alguna secuencias ya estaban vendidas.
Este testigo declara en contra de los reclamado por la actora.- Otro agravio del recurrente, es el indicar existe incongruencia, porque la sentencia otorgó más y distinto de lo pedido. El afán de la Juzgadora de resolver el caso otorgó más de lo pedido en la pretensión, así como aspectos muy diferentes a los solicitados por el actor en su larga pretensión, confundiendo lo presupuestos de la acción reivindicatoria para alcanzar un razonamiento totalmente incongruente. La pretensión 4) de la demanda, se resume en pedir el deslinde y una cerca divisoria para posteriormente poner en posesión la totalidad de la finca conforme al plano [Valor 003]. Pretensión 5) se identificó "el área en conflicto" entre los puntos cartográficos 15 al 3 y aproximadamente 100 metros hacia el [Dirección2] en toda su extensión en el inmueble de la actora. La sentencia determinó el área en conflicto entre los vértices 16 y 64 y el vértice 7 y 67, absolutamente diferente a la pretensión.
Arguye, en el punto tres ordena la restitución a la demanda, dentro de los 15 días y establece toda una serie de bases no pedidas ni analizadas por un perito, definiendo características de delimitación no pedidas, como el lugar por donde irían las cercas en el plano [Valor 003] de la actora, colocando postes vivos/muertos de calidad y altura promedio a una distancia de 2 1/2 metros entre cada poste a 4 hilos de alambres de púas de calidad promedio, y se le autoriza a la actora a hacerlos y cobrarlos en ejecución de sentencia, se otorgaron muchos aspectos no pretendidos. Sobre las costas debe exonerársele, pues a todos los demás declarados rebeldes se les eximió de ese pago, por lo que considera debe correr igual suerte. Igual se opone a lo otorgado por daños y perjuicios, sin embargo, la sentencia condenó un rubro muy exagerado de éstos, dejándolos para fijarlos por medio de un perito en ejecución de sentencia.
Reitera la prescripción a la reivindicación porque el propietario tiene una posesión de casi 100 años. La finca correspondiente al plano [Valor 004] ha sido poseída en forma quieta, pública, pacífica, sin interrupción, por [[Nombre26] ] cc [[Nombre26] ], desde los años 1920, sumada la posesión de sus transmitentes, luego la poseyó la Sucesión y ahora Inversiones [[Nombre12] ], que tendría al momento cuando la actora puso las cercas para tomar una parte del terreno, una posesión de 99 años.- Durante todos estos años, y muy particularmente durante los últimos 10 años la actora nunca reclamó ningún derecho. Esto es durante mucho más del tiempo de la prescripción negativa , la actora ni sus transmitentes hicieron ningún reclamo en relación con las dos diferentes fincas, ni con el plano catastrado levantado con error [Valor 003], por lo que considera esta acción se encuentra prescrita.- Indica la actora nunca ejerció ninguna acción judicial, principalmente porque [[Nombre1] ] S.A., es una empresa de norteamericanos que nunca ha ejercido ninguna labor o actividad agraria, ha mantenido su propiedad como una propiedad civil e improductiva, y han pasado más de diez años sin ejercer ninguna acción judicial por los motivos que presenta ahora, de allí debe declararse la prescripción de la acción.
Pide revocar la reivindicación agraria contra otro propietario poseedor legítimo con 99 años de posesión y no ha habido un análisis de los títulos repetidos, caso estudiado por la a-quo en el sentido de que el resultado judicial consiste en darle la razón a quien además de título tiene la posesión: en este caso su representada, pues desde hace 99 años tiene la posesión cuando el actor ingresó a sus propiedad a privarlo de la posesión a través de un interdicto Inversiones [[Nombre12] ] le ganó el proceso y por tal la posesión no fue interrumpida en ninguna forma. Dice que la jurisprudencia es muy simple: antes cuando se discutía una reivindicación entre dos propietarios, la Sala con base en el 455 del Código Civil, le dio la razón al título más antiguo. La nueva tesis le dio la razón a quien además del título también tenía la posesión y transcribe parte del Voto 127-95 de la Sala Primera de la Corte, sobre la prescripción en casos de reivindicación y usucapión.
Por lo anterior, considera debe revocarse la sentencia: porque si se analiza la prueba en su integridad y no solo con una pregunta de una confesional, se podrá constatar que los mismos testigos de la actora indican que la propiedad llegaba hasta la orilla de una gran caída, debidamente separada por alambres de púas desde hace muchos años, y posterior a este argumentos enumera los acontecimientos sin que ello sean agravios propiamente dichos. Considera existe una falta de legitimación activa, pues la actora no probó correctamente ser propietario agrario, pues su actividad es comercial del hotel y por tal civil, y reitera que la acción reivindicatoria la dirige el propietario contra el poseedor ilegítimo, y en el caso de la demandada se trata de propietario. Aduce falta de legitimación pasiva, pues su representada es propietaria agraria y no poseedora ilegítima. Indica la actora y sus transmitentes siempre respetaron el lindero con el plano [Valor 004] poseída en forma quieta, pública, pacífica, sin interrupción, por [[Nombre26] ] cc [[Nombre26] ] desde los años 1920.
Todos los demandados expresaron al contestar la demanda que Inversiones [[Nombre12] ] Sociedad Anónima, le compró legítimamente a los herederos de la finca del Partido de [[Nombre20] ] Número [Valor 022], plano catastrado [Valor 021], con una superficie de 15 hectáreas 2037,64 metros cuadrados, con una posesión agraria de 90 años. La actora jamás probó por ningún medio, la ilicitud de la posesión de su representada. Esto ocurrió después de levantar su nuevo plano, ponerle violentamente la cerca y ser condenados en un interdicto. Alega falta de identidad de la cosa, pues la actora no identifica cuáles son los derechos de la actora, donde se encuentran ubicados, de cuál posesión se le desposeyó, la demanda en la primera pretensión solicitan reivindicar 4 hectáreas, en la última ampliación de la demanda no dirigida contra Inversiones [[Nombre12] ] señala que su representada le ha despojado y por eso pretende reivindicar 20 hectáreas de la propiedad.
Considera la demanda es genérica cuando se refiere a gran cantidad de poseedores a los cuales debe identificar en el área exacta que poseen. La actora es clara al señalar que nunca ha ejercido actos posesorios en el área de la cual pretende la restitución. También indica es que su propiedad es de bosque y no tiene actividad agraria. (Ver recurso de apelación en archivo del 06/08/2019 09:15:10).-
V.Para la resolución de este caso, debe tenerse claras las premisas de análisis y a partir de allí determinar el tipo de acción principal sometida a nuestro conocimiento. Tenemos que la parte actora reclama su derecho de propiedad sobre una franja de terreno, que indica forma parte de su finca inscrita en el registro público matrícula [[Placa9] ] y descrita en el plano catastrado [Valor 003], por su parte la accionada Inversiones [[Nombre12] ] Sociedad Anónima, al apelar indica la franja de terreno en disputa es de su propiedad registral al estar comprendida dentro de la finca matrícula [[Placa10] ] descrita en el plano [Valor 021]. Estamos ante un conflicto de doble titulación, donde ha de definirse cuál de los dos títulos es el que prevalece sobre el otro. Uno de los agravios del apelante, es que en forma errada se analiza el caso como si se tratara de una acción reivindicatoria y rechaza la excepción de prescripción negativa como si se tratara del supuesto normativo regulado en el artículo 320 del Código Civil, olvidando que su representada no es una poseedora ilegítima, dado que ostenta de propiedad válido.
No estamos frente al caso de un propietario registral frente a un poseedor ilegítimo que le despojó de una franja de terreno, sino que ambas partes cuentan con su título registral. Ante tales premisas fácticas, el análisis va dirigido a determinar cuál de los dos títulos es el prevalente y cuál es el que debe extinguirse registralmente. Debe indicarse, que la a-quo hace el análisis sobre la doble titulación y determina el título prevalente tomando a partir de que ambas partes tienen título registral, ello se observa en el considerando XV, por lo que el agravio del recurrente al afirmar la a-quo resuelve el conflicto fundamentada en una acción reivindicatoria como si no resolviera la duplicidad de títulos, ello no es así, pues sí lo hace en el citado considerando XV, de allí no se comparta su agravio en este sentido. Si bien es cierto analiza varias acciones que ella considera se originan por la acumulación de pretensiones, lo cierto del caso es que la principal acción que se resuelve es la de doble titulación.
Y como en el caso concreto el problema planteado no sólo es una doble titulación formal, sino que el actor acusa como su derecho que fue despojado, y solicita le sea reintegrado en la posesión del área en conflicto, lo implica una consecuencia derivada de que una vez se reconozca su título es el válido, a partir de allí debe analizar la procedencia de la restitución, por tal motivo puede confundirse está hablando de una acción reivindicatoria, cuando lo que interesa es determinar a cuál de las partes le corresponde la prevalencia del título y luego ordenar la restitución y delimitación en el área en cuestión.
VI.Este tema ha sido tratado por la Sala Primera de la Corte Suprema de Justicia que ha resuelto en voto número 823 de las 03:35 horas del 16 de noviembre del 2007 lo siguiente: “IV. El tema medular del presente recurso gira alrededor de la multiplicidad de títulos sobre un mismo inmueble, cuando dos personas de buena fe y al amparo de la publicidad registral, adquieren un terreno y esta situación surge por deficiencias del sistema costarricense. Sobre el particular, cabe recordar la posición asumida por la Sala de Casación y luego por la Sala Primera de la Corte Suprema de Justicia. En ese sentido, consideró la antigua Sala de Casación en sentencia no. 132 de las 15 horas 30 minutos del 25 de septiembre de 1974, que: “El problema de los títulos repetidos sobre un mismo inmueble, aún los convalidados por la prescripción, no puede menos de resolverse dando la preferencia a quien ostenta completos los atributos del dominio, en el caso de la posesión.
Así lo han acordado numerosas sentencias de esta Corte, entre ellas la Nº 80 de 15 horas del 29 de julio de 1958, páginas 126 y siguientes del respectivo tomo de la Colección.” En ese mismo sentido en un caso más reciente, esta Sala en sentencia no. 84 de las 14 horas 30 minutos del 22 de mayo de 1992 estableció: “.....- Y en los títulos repetidos se refiere, la más reciente jurisprudencia ha establecido que rige no el más antiguo sino el título mejor, lo que está caracterizado fundamentalmente por la posesión, y ya se expresó que el actor nunca ha poseído el inmueble, pues siempre ha estado en posesión primero de la vendedora y a partir de su muerte por la adquirentes,…”. Se extrae de la jurisprudencia transcrita, que la contradicción que se puede presentar entre diversos títulos, bajo el supuesto de que la mera titularidad registral, aunque sea demostrada, no constituye elemento suficiente para solucionar una controversia de este tipo, pues la solución se impone a favor de quien pruebe el vínculo existente entre la propiedad formal, sea la que consta en el Registro Público, junto con la posesión material del terreno.
En el caso concreto se ha determinado por la prueba testifical que la colindancia original entre ambas fincas, lo era la cerca divisoria que transcurría en el borde del inicio del guindo, siendo esa línea divisoria coincidente con la línea divisoria que estableció el perito en su estudio técnico visible a folios 943 y 1331 donde se indica se inicia el área de traslape entre ambas fincas, que corresponde a la parte alta donde inicia el guindo. En este sentido, el testigo [[Nombre28] ], declaró: “ don [[Nombre19] ] vendió a la parte abajo, porque cuando repartió entre sus hermanos, todos decidieron que esa parte del bajo, no servía para siembra porque era muy quebrado y decidieron que mejor la vendiera. [[Nombre26] ] y los demás hermanos estuvieron de acuerdo con eso, por eso [[Nombre19] ] la vendió a [[Nombre27] ]. Cuando [[Nombre27] ] compró la propiedad, habían cercas en la orilla del guindo, que venía dividiendo las propiedades” (f.1025).
En igual sentido declararon [[Nombre29] ] a folio 1022 vuelto, quien dijo que entre la finca de [[Nombre26] ] (terreno de la parte apelante) y el del actor, lo que dividía era el guindo y allí había una cerca a la orilla del mismo. El testigo [[Nombre25] ] a folio 1024 vuelto, dijo que trabajó haciendo cercas para el demandado y no quiso trabajar para abajo del guindo, porque sabía que la cerca de arriba -refiriéndose a donde inicia el guindo-, era la colindancia entre ambas fincas, y que al final quienes realizaron ese trabajo de chapeas en el terreno de la actora, fueron otras personas. Del reconocimiento judicial visible a folio 1026 se observaron vestigios de una cerca antigua, así como sus huecos y postes caídos a lo largo de esa colindancia, lo que implica son rastros de la antigua cerca que era la colindancia en ese sector del guindo. Como se dijo, en ese sector existía la cerca antigua conforme a la división inicial al momento en que la parte actora y su transmitente adquirió el inmueble el 6 de noviembre de 1991 cuando se segregó como lote vendido de la finca madre [Valor 049] conforme a los descrito en el plano [Valor 003], que está partido por el traslape, según se visualiza en el informe pericial dicho.
No sólo se demostró el ejercicio de la posesión sobre esa área por la demarcación de la cerca antigua que fuera removida para el año dos mil cuatro- dos mil cinco aproximadamente cuando se inician los interdictos entre ambas partes, según se observa expedientes EXPN2 y EXPN3 (a los que nos referiremos más adelante).- La prueba de la existencia de la antigua cerca en el límite donde inicia el guindo entre ambas fincas, es el hecho determinante para demostrar la tenencia de la tierra en que fue distribuida en la realidad material entre sus anteriores transmitentes de ambas partes. En el terreno ocupado por la codemandada apelante, se indica hubo desarrollo de agricultura y ganadería, y en el terreno ocupado por la parte actora, el área de traslape que correspondía al guindo, se mantenía bosque por la naturaleza quebrada del inmueble. El hecho que un terreno se mantenga con áreas boscosas, no implica exista un abandono o que el terreno sea inculto, pues el ejercicio de conservación de ese recurso forestal y del ecosistema que en él se desarrolla, también implica una modalidad del ejercicio de la posesión, tal y como lo establecen los artículos 45 y 50 de nuestra Constitución Política como más adelante se dirá.
Y es que este título [Valor 030] con plano [Valor 003], además de ejercer los atributos del dominio por lo ya explicado, cuenta además con la característica de ser el título más antiguo entre ambos. Ambas fincas nacen de la finca madre [Valor 049] que nace por inscripción en información posesoria tramitado por [[Nombre19] ], quien al inscribirlo tenía el compromiso de segregar los lotes correspondientes a sus hermanos. Es por ello, que en fecha 6 de noviembre de 1991 nace la finca [Valor 002] que fuera segregado como lote vendido según plano [Valor 003], e independientemente de las razones que puedan existir que se desconocen, la finca [Valor 050] con plano [Valor 004], nace en fecha 19 de enero de 1996, con una cabida de 19 ha 3795.18 m2, y con una descripción en la citada escritura pública, donde se consigna que este lote segregado no es colindante con el resto de la finca madre por existir segregaciones precedentes, por lo que se considera el plano allí indicado como una referencia, pues la finca madre ha tenido varias segregaciones.
De hecho la cabida de la finca de la parte demandada apelante, que se origina por la reunión de varios derechos adjudicados en proceso sucesorio de [[Nombre26] ] quien era la propietaria originaria de la finca [Valor 050], cuenta con una cabida menor a la original, sea de 152037,64 m2 y se describe actualmente como finca número [Valor 035] con plano [Valor 021], siendo con este plano que se hace el estudio pericial de traslape. Como se observa entre ambas fincas segregadas del mismo origen, la de la actora nace primero el 6 de noviembre de 1991 y el de la demandada apelante el 19 de enero de 1996, por lo que además del ejercicio de la tenencia del área en disputa con una posesión de conservación del recurso natural dentro del área delimitada por la cerca antigua que dividía ambos fundos, cuenta también de manera adicional con el título más antiguo, cumpliendo con ello los dos criterios históricos que se han utilizado jurisprudencialmente para resolver el conflicto de doble titulación, según se explicó supra con la cita jurisprudencial, de conocimiento de la apelante, quien también hace mención de esta jurisprudencia sobre la doble titulación.- Este es el tema central a resolver en el caso concreto.
En otro orden de ideas, y en atención a las pretensiones de la demanda, que involucra los efectos de los hechos que se originan por esa doble titulación, vemos en el dictamen pericial que el área de traslape dentro de la finca del actor no solo abarca terreno comprendido en el plano que traslapa [Valor 021], sino que la parte demandada Inversiones [[Nombre12] ] S.A, coloca la cerca perpendicular al guindo por el sector sur de su plano, abarcando un área de terreno con el plano [Valor 003] que no está dentro de lo dibujado en su plano, sino que rebasa sus límites introduciéndose en el terreno de la parte actora, lo que implica esa área no está dentro de lo que llamaríamos título repetido, pues estaría fuera de lo que este comprende, por lo que no sobra el análisis sobre la acción reivindicatoria que hace la a-quo en la sentencia para estas áreas, sin dejar de lado, que como además del conflicto de doble titulación, la parte actora indica ha sido despojada del área traslapada, y solicita le sea restituida en la misma colocándose los límites en el lugar original (donde comienza el guindo), conforme a la posesión que tenía antes de que se iniciara el conflicto de remoción de cercas que originó los procesos interdictales entre ambas partes.-
VII.Una vez resuelto el tema principal de la acción por doble titulación, se procede a analizar en forma detallada los agravios del apelante, en el orden expuestos por éste. Inicia sus agravios de fondo, alegando que para la resolución de la prescripción alegada, debió valorarse para determinar si la parte actora al plantear la demanda se sobrepasó en el plazo de diez años a que limita el artículo 868 del Código Civil, lo que no se analizó correctamente, pues se rechaza aplicando el artículo 320 del citado Código que se refiere a la acción reivindicatoria y afirma con base en esta norma que el derecho de dominio no es prescriptible, y en este caso se trata de una acción de doble título, donde ambos tendrían igual linaje de propiedad. Lleva razón en ese sentido el apelante, pues no se está ante un poseedor que pueda desvirtuar el derecho de propiedad por haber adquirido por usucapión el mismo, pues se trata el demandado de otro titular registral, y no un poseedor ilegítimo sin título.
Nótese, que la titularidad de ambas partes se trata de un derecho convalidado por la prescripción, porque lo que entre ambos no se podrían oponer prescripción negativa con base en el artículo 868 ibídem, pues se está ante un problema de duplicidad de títulos, y aunque transcurran más de diez años de inscripción en cada título consolidado, uno de ellos debe de extinguirse, pues por el principio de seguridad jurídica no es factible exista dos o más títulos sobre un mismo inmueble, y tal situación encuentra su solución eligiendo al mejor título que es aquel que ostenta la posesión material, y si además se le suma el hecho que es el título más antiguo, son dos elementos que permiten determinar al título prevalente. Indica el recurrente, que su representada alegó una posesión de más de 90 años, sumada la posesión de sus transmitentes, y que la actora no ejerció ninguna labor o actividad agraria, estando ese terreno improductivo, pasando más de 10 años sin ejercer ninguna acción legal (es decir la prescripción negativa).
No se comparte este razonamiento, pues como ya se analizó, que la parte actora era quien ejercía la posesión de conservación sobre el área en conflicto, delimitada por la cerca vieja original entre ambos fundos donde inicia el "guindo", qué necesidad tendría de accionar antes de que pasaran los diez años, si la tenencia de la franja en conflicto siempre estuvo bajo su posesión desde la adquisición de la finca, y no es sino hasta aproximadamente en el año 2004 y 2005 que se inician los conflictos entre ambas partes con las remociones de cercas por ambos y no antes como para eventualmente contabilizar un plazo decenal según tesis del apelante. Por lo expuesto, debe rechazarse la prescripción negativa contra la pretensión por títulos repetidos ya que ambos están convalidados por la prescripción, y lo que resta es determinar el mejor título prevalente y el extinguiendo el que no lo es. El argumento del apelante al alegar una posesión de más de 90 años derivada de [[Nombre26] ] quien poseyó desde 1920, es coherente con esta afirmación que su título es convalidado con la prescripción y al igual que el título de la actora, este conflicto no se resuelve determinando algún derecho prescriptible negativamente entre ellos, sino definiendo cuál es el mejor título, como se analizó en el considerando anterior.- Otro agravio de quien recurre, es referido a que la parte actora no es un propietario agrario, pues su actividad es comercial, dedicada exclusivamente a un hotel y por tal es civil, por lo que no puede reclamar contra otra que si es propietaria agraria por medio de reivindicación.
Como se explicó supra, la posesión agraria conocida en la forma tradicional del ejercicio de actividad agraria, consistente en la producción de un ciclo biológico animal o vegetal, previa una o múltiples transformaciones para la obtención de un fin económico, no es la única forma del ejercicio de la posesión, pues de acuerdo a la evolución sobre la tutela del recurso natural que existe en el derecho de propiedad, es precisamente la inacción lo que la ley estimula a partir de lo establecido en el artículo 45 y 50 de la Constitución Política, quedando atrás la política de voltear bosque promovida por la Ley de Tierras y Colonización, que promovía ese tipo de prácticas agrícolas para demostrar posesión, sin importar las consecuencias al daño al ambiente y a los recursos naturales del agua, suelo, bosque, etc. Actualmente el derecho de propiedad ha venido evolucionando de manera paralela al desarrollo de los derechos humanos, como lo es el caso del derecho a un ambiente sano y ecológicamente equilibrado, lo que implica, el uso del derecho de propiedad debe ser además, en atención a este derecho humano, regulado en nuestra constitución política a través de la reforma en su artículo 50 que dice: " El Estado procurará el mayor bienestar a todos los habitantes del país, organizando y estimulando la producción y el más adecuado reparto de la riqueza.
Toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado. Por ello, está legitimada para denunciar los actos que infrinjan ese derecho y para reclamar la reparación del daño causado. El Estado garantizará, defenderá y preservará ese derecho. La ley determinará las responsabilidades y las sanciones correspondientes”. En un primer momento se entendía una propiedad eminentemente posesiva, y al reconocer la transversalidad el derecho ambiental sobre el derecho de propiedad, estas zonas boscosas ha generado un cambio en la tenencia de este derecho, en el sentido de establecer la obligación de proteger el bosque, sus recursos, el ecosistema que él contiene, así como el paisaje natural . Este tipo de posesión ejercida por la parte actora, les fue despojada desde la época que ambas partes comenzaron a plantear los interdictos. El derecho de propiedad es posesivo y dinámico, pero con la variable ambiental hay un dinamismo de una manera más global de protección.- Si se interpreta de otra manera se estaría quitando el estímulo al propietario que tenía al mantener esos terrenos ociosos que venían cumpliendo acorde a esa conducta conservacionista.
Por ello, no se comparte el agravio del recurrente al indicar la parte actora carece de posesión, al no ejercer actividad agraria, pues su contenido al derecho de propiedad lo ejerce a través del derecho de posesión conservación del recurso bosque, máxime se trataba de un terreno irregular, donde la cobertura arbórea es importante para evitar la erosión de suelos debido a su declive. (véase la curvas de nivel que se describen en el informe pericial de folio 943).- No se comparte los agravios del recurrente al afirmar que la a-quo justifica la posesión de la actora, aduciendo que ésta poseyó porque defendió su posesión por medio del interdicto 05-23 (caduco) y que ella ejerció posesión porque luego del interdicto y meses antes del ordinario planteó diligencias de prueba anticipada. Ello no es compartido por este Tribunal, pues no se observa la a-quo haya fundamentado la posesión por el planteamiento de tales procesos, pues la base principal probatoria que ha utilizado es la prueba testimonial principalmente entre otras, ello con base en el principio de libre valoración probatoria establecido en el artículo 54 de la Ley de Jurisdicción Agraria.- Indica tampoco se consideró que resultó victorioso en el proceso interdictal 05-23 en el que se reconoce su posesión.
No se comparte este agravio. Es esta época que se observa el inicio del conflicto por el citado lindero y por ende el traslape y despojo del área de marras, y se ordenó mantener en la posesión dentro del proceso interdictal EXPN3 mediante voto 258-F-2007 del Tribunal Agrario a la accionada apelante dentro del límite de la cerca nueva que la parte demandada había colocado, y que a manu militari la actora había quitado, y por tal motivo se dictó la sentencia estimatoria en su contra, ello considerando la tutela interdictal lo es para una posesión actual y momentánea, sin importar si existía una cerca antigua en otro lugar que anteriormente fuera removida por la sociedad accionada, dado que en este proceso no se resuelve en forma definitiva aspectos de propiedad o posesión, siendo ello competencia exclusiva del proceso declarativo. De allí carezca de relevancia los resultados de los procesos interdictales para definir aspectos de remoción y/o demarcación de linderos, pero si interesa mencionarlos para hacer referencia al inicio de las controversias entre las partes, a partir de que se removió la cerca original que se ubicaba en el filo del guindo entre ambas colindancias, y no en el sector donde se levantó la nueva división que despojó de su tenencia a la parte actora.
Por ello no es de recibo, admitir el argumento del apelante al indicar que el derecho corresponde la parte accionada Inversiones [[Nombre12] ], por lo declarado a su favor en el citado proceso interdictal que reconoce su posesión actual y momentánea por Voto 258-F-2007. Otro agravio del recurrente, lo es el afirmar que la actora nunca había tenido un plano de las aproximadas 44 hectáreas y al medir el terreno no tomó en cuenta lo poseído sino que bajó para tratar de desposeer a la demandada. Esta afirmación no encuentra sustento probatorio, dada la existencia de la cerca original cuyos vestigios fueron observados in situ, según lo observado en reconocimiento judicial de folios 1025 y 1026, según se describió supra. Ataca la declaración de [[Nombre27] ], cuando éste afirma que la propiedad llegaba en la parte alta hasta donde había una cerca puesta, siendo que la parte alta es donde se encuentra el hotel, por lo describe una declaración en contra de la actora.
Esta expresión del testigo no se observa confusa, pues también puede interpretarse que la parte alta a la que hace referencia lo es el sector donde inicia el guindo, que es justamente donde se indica existía la cerca vieja original que dividía ambas fincas, siendo esta interpretación coherente con las declaraciones de los otros testigos ya analizados supra.
VIII.Alega incongruencia en el fallo apelado, porque considera la sentencia otorgó más y distinto de lo pedido. En la pretensión 4 de la demanda, se resume en pedir el deslinde y una cerca divisoria para posteriormente poner en posesión la totalidad de la finca conforme al plano [Valor 003]. Pretensión 5) Se identificó el área en conflicto entre los puntos cartográficos [Dirección7] y aproximadamente [Dirección8] hacia [Dirección9] en toda su extensión en el inmueble de la actora. Por su parte, lo otorgado en la sentencia, determinó el área en conflicto entre los vértices 16 y 64 y el vértice 7 y 67 absolutamente diferente a la pretensión. No se comparte este agravio del recurrente, por dos razones: a) debe observarse la pretensión de la demanda fue ampliada según se observa en folio 575, tal y como lo reconoce al final de su recurso de apelación, al indicar tal ampliación no se hace contra su representada, lo cual tampoco se comparte por este Tribunal, por cuanto el escrito de ampliación de demanda visible a folio 575, es claro en indicar tales pretensiones que se amplían abarca a Inversiones [[Nombre12] ] S.A. y que dice: "Que los demandados deberán restituir a la aquí actora, al área o parte del terreno de la finca del partido de [[Nombre20] ], folio real matrícula [[Placa1] ] en una extensión aproximada de veinte hectáreas que sin derecho alguno ocupan los demandados, terreno el cual se encuentra ubicado según el plano catastrado número [Valor 003] y al cual se refiere el inmueble propiedad de la actora, Partido [[Nombre21] ] ([Nombre30]) matrícula [[Placa3] ], aproximadamente del derrotero 16 en línea recta de este a oeste hasta un punto entre los derroteros 64 y 65 una cerca de aproximadamente 300 metros de longitud y desde el derrotero 7 aproximadamente hasta un punto entre los derroteros 66 y 67 otra cerca de aproximadamente 200 metros de longitud, zona que será determinada por el perito topógrafo" (ver folio 579) Como puede observarse la pretensión dada su redacción incluso permite cierta relatividad entre lo pedido y otorgado, pues en conflictos donde sea la determinación del área de traslape, no se requiere de una descripción exacta de la zona, dado que a partir de un aproximado al describir el objeto del litigio, se puede determinar de manera exacta con la prueba técnica pericial, y tal como se indicó en la citada pretensión que el área reclamada será determinada por el perito topógrafo, siendo lo que ocurre en el caso concreto.
Al ejercerse el principio del contradictorio, que también se cumplió respecto a la práctica de la prueba pericial, se concluye no hay algún vicio de derecho de defensa, pues la parte conocía el objeto del proceso en discusión, y al ser lo debatido, tal precisión del área traslapada en conflicto no resulta sorpresiva, y es acorde con las pretensiones de la demanda ( incluye las ampliadas posteriormente) . Igualmente considera, se resuelve sobre la colocación de la cerca con las características que allí se indican, cuando ello no fue peticionado así en la demanda. No se comparte este agravio, pues la persona juzgadora está resolviendo aspectos que serían derivados de la acción principal. Son el efecto natural de la acción. Por la situación fáctica, al darse un tema de desposesión y de alteración de límites, es necesario estos sean otorgados sujetos al resultado de la acción principal, - sea la de doble títulos o de títulos repetidos-, y en este caso la delimitación con la cerca con las características que se indican, son parte de los aspectos ordenatorios que son consecuencia de la pretensión principal para efectos de la ejecutividad de la sentencia, incluso a nivel registral, aunque no sea así expresamente pedido, la persona juzgadora en virtud del deber de otorgar información registral veraz, corrigiendo errores, rectificando medidas como lo hace la a-quo, ello para aportar al sistema elementos en pro de la seguridad jurídica, pues es su deber hacerlo, siendo ello una obligación registral y catastral que le impone la ley, ya que al ser información de orden público, ella debe ser veraz, de allí la jueza hace bien ordenar las modificaciones registrales necesarias con ese fin. Indica el apelante, se otorgaron muchos aspecto no pretendidos, pero no hace mención a cuáles de ellos se refiere, lo que imposibilita a esta Cámara conocer ese agravio genérico.
Como otro agravio la parte co demandada única apelante, solicita le sea exonerada al pago de ambas costas por considerar al igual que el resto de demandados que fueron exonerados por la declaratoria de rebeldía, en iguales condiciones se encuentra su representada. Además de que no tuvo oportunidad de formalizar una oposición por su condición de rebelde.- En su sentido más genérico, la condenatoria a pagar las costas procesales y personales se produce cuando hay una resolución judicial que impone a determinada persona el pago de estos gastos procesales que, sin dicha imposición, no estaría obligada a pagar. Por tanto, el contenido de la condena en costas se refiere casi siempre a los gastos de la parte o partes contrarias. La regla es, que la condena en costas está prevista para la parte litigante que ha sido vencida en el proceso. Es el sistema que adopta tanto el numeral 55 y 56 de la Ley de Jurisdicción Agraria.
Existen dos teorías en cuanto a la finalidad y oportunidad de la condenatoria en costas. Para una, solo procede cuando la parte que pierde el litigio ha actuado con temeridad o mala fe; mientras para la otra se aplica siempre al perdidoso, salvo que el Juez le exima de su pago por consideraciones especiales, que debe determinar. DE SANTO (Víctor). Diccionario de Derecho Procesal, Buenos Aires, Universidad, 1991, p.86. Nuestra Ley de Jurisdicción Agraria, se inclina por ésta última teoría, es decir, rige el principio del vencimiento objetivo, salvo que opere alguna situación excepcional, también previstas por el legislador, se exima al perdidoso de dicha condenatoria. Por ello, en materia procesal, este principio de vencimiento objetivo tiene una excepción que la encontramos en el artículo 55 de la Ley de Jurisdicción Agraria. Nos referimos a la exención de costas. Es una excepción, es decir que la regla es que se condene en costas y si se aplica la excepción, la persona juzgadora debe razonar los motivos de la exoneración.
En el presente asunto no hay condenatoria parcial, no hay vencimiento recíproco, ni la demanda comprende pretensiones exageradas, ni hubo gestiones ociosas o innecesarias que haya promovido la contraparte victoriosa; por lo que de conformidad con lo expuesto a la luz del numeral 55 de la Ley de Jurisdicción Agraria, no existe razón de peso para acceder a lo solicitado por la recurrente. Si bien es cierto, ha sido declarado rebelde, posteriormente se integra al proceso asumiéndolo en el estado en el que estaba cuando se incorporó, lo cierto que lo hace ejerciendo su oposición mediante el principio del contradictorio, e incluso ejerce los recursos oponibles, lo que no implica un allanamiento tácito como ocurre con la rebeldía. Además, no se le exonera al igual que el resto de demandados rebeldes, porque ha sido Inversiones [Nombre 012] S.A., quien movió las cercas de los linderos originales.-
X.Por las mismas razones que expone al solicitar la exoneración en costas, solicita la no condenatoria en daños y perjuicios, indica la sentencia condenó un rubro muy exagerado de éstos, dejándolos para fijarlos por medio de un perito en ejecución de sentencia. Nótese, lo otorgado por no disfrute del bien, y se ordena el pago de dos millones de colones como indemnización al propietario por no poder accesar al área traslapada de su propiedad, por varios años desde su despojo, es justificable y no se considera exagerado como lo indica el apelante pues aún teniendo solo bosque del que no se le obtenga provecho económico, la parte actora ha sido privada incluso del simple disfrute de los atributos no pudiendo beneficiarse incluso de ganancias que pueda generar una eventual belleza escénica o el disfrute del beneficio para el ambiente en el presente y para futuras generaciones (como por ejemplo pago de servicios ambientales), lo anterior se estaría comprendido en el rubro general que estableció la a-quo como imposibilidad de ejercer posesión, para lo que otorgó la suma de dos millones de colones.- Finalmente, se indica que el apelante no argumenta los motivos por lo que considera existe exageración en ese otorgamiento, y las razones que motivan ese juicio de valor.-
XI.En la parte final de su recurso de apelación, indica como agravio lo que titula así: "Pido declarar prescripción a la reivindicación porque el propietario tiene una posesión de casi 100 años". No se entiende este agravio, pues páginas anteriores de su recurso, se oponía se resolviera la prescripción opuesta respecto a la reivindicación, pues se trataba de títulos repetidos y no era de aplicación el artículo 320 del Código Civil como lo resolvió la a-quo, y transcribe citas de jurisprudencia en ese sentido. Posteriormente en ese apartado, reitera los argumentos de la prescripción negativa de la acción, porque la actora no hizo ningún reclamo en relación con las fincas, cuando se puso las cercas y ya la demandada tenía una posesión de 99 años. Este argumento ya fue resuelto supra al referirnos al prescripción respecto a la consolidación de la misma en títulos repetidos. Otros agravios finales, es referirse a que la prueba no se analizó en su integridad, y no debió solo con una pregunta de una confesional, constatar que la finca llegaba hasta una gran caída, debidamente separada por alambres de púas desde hace muchos años.
Nótese, no es cierto la a-quo tome ese hecho derivado de una pregunta de la confesional, pues precisamente no da validez a esa confesión ficta, por cuanto consideró que las dos preguntas que se hicieron eran genéricas, y que incluso la segunda de ellas ya había sido admitida en la contestación de demanda. Indica debe considerarse su derecho conforme al plano de 1985 que el plano de la actora fue levantado posteriormente en 1987, siendo éste último el que se superpone al de [[Nombre26] ] que es el [Valor 004]. Este agravio tampoco es de recibo, pues con base en el artículo 301 del Código Civil, "la mensura de un terreno, sea o no protestada, no basta por sí sola para probar la posesión del mismo terreno". Con base en esta norma, carece de relevancia determinar cuál plano es más antiguo, pues ya se explicaron cuáles son los elementos de interés que se deben valorar para determinar el título prevalente en una acción de títulos repetidos, y dentro de las consideraciones no está el determinar el plano más antiguo o si alguno modifica al otro.
Nótese, por las diferencias de cabida entre los planos [Valor 004] de [[Nombre26] ] y el que representa actualmente la finca de la demandada impugnante, [Valor 021] hay diferencias de cabida, lo que implica el primer plano ha sufrido modificaciones lo que implica no hay certeza en los datos que representa respecto a la realidad material, aunado a que en aquel momento la finca madre había sufrido varias segregaciones, lo que lo hizo más impreciso cuando se indica se toma solo para referencia. Sin embargo, como ya se indicó en la cita del artículo 301, la mensura de un terreno, no hace prueba de la existencia de la posesión. Finalmente, aduce una falta de legitimación activa, al considerar la actora no es poseedora agraria, una falta de legitimación pasiva, porque considera la demandada tiene su título inscrito obtenido de los herederos de [[Nombre26] ] y falta de identidad del bien, pues lo que pretende reivindicar no lo ha poseído , por lo que no procede la restitución.- Estos aspectos ya han sido resueltos en los considerandos anteriores ya que son agravios reiterados.
Cabe finalizar indicando, la pretensión de la parte actora no la encasilla como acción reivindicatoria como lo afirma el recurrente, al indicar la acción planteada es de esa naturaleza, y que debe declararse sin lugar, dado que se está ante acción de títulos repetidos. Ello no se comparte, por cuanto la a-quo ha dado resolución a la acción de doble titulación, y siendo esa la acción principal, debe referirse también a la restitución y delimitación de linderos también acusados en la demanda, siendo que ello ha sido parte del despojo, y cuya reposición del área en conflicto es consecuencia de los efectos jurídicos de declararle a la actora su título como prevalente respecto al del demandado.
XII.Por lo expuesto, se confirmará la sentencia en lo que ha sido objeto de apelación, rechazándose la prescripción negativa por los motivos dados en esta instancia.
POR TANTO:
