SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- At nine hours and thirty-seven minutes on once de noviembre de dos mil veinte.- POSSESSORY INFORMATION PROCEEDING filed by [[Nombre1] ], [...]. The INSTITUTO DE DESARROLLO RURAL (Inder), represented by [Nombre2], of legal age, divorced, attorney, identification card CED1, resident of San Ramón, and the PROCURADURÍA GENERAL DE LA REPÚBLICA (PGR), represented by Deputy Attorney General Heilyn Sáenz Calderón, of legal age, attorney, identification card CED2, participate as parties to the proceeding. [Nombre3], bar registration number once mil cuatrocientos treinta, acts as special judicial representative (apoderada especial judicial) for the applicant (promovente). The matter was heard before the Juzgado Agrario del Primer Circuito Judicial de la Zona Sur, Pérez Zeledón. This Court hears the appeal against judgment 133 of 8 de setiembre 2020.

Judge Ruth Alpízar Rodríguez drafts the opinion; and,

CONSIDERANDO:

I- The applicant filed a possessory information proceeding seeking registration in the applicant’s name, in the Registro Público Inmobiliario, of the property described as follows: “NATURE…: Pasture and coffee-growing land, LOCATED: …[Dirección1] [ ], [ ], [[Dirección2] ], [Nombre [Nombre4]], Province of [[Nombre5]]. BOUNDARIES…: NORTH: [Dirección3], [ ]; SOUTH: [[Nombre6]], [[Nombre7]]; EAST: [Dirección4], [ ], [[Nombre8]] and [[Nombre6]]; and WEST: [[Nombre9]] and [[Nombre10]]. AREA: CUARENTA Y SIETE MIL CIENTO TREINTA Y SIETE SQUARE METERS. …Cadastral survey plan (plano catastrado) number: [Valor 002]. It has sixty-three meters and fifty centimos of road frontage along [Dirección5] (filings section: file 19/10/2018 03:47).-

II.The Procuraduría and the Instituto de Desarrollo Rural participate as parties (associated documents section: file 08/02/2019 09:24; filings section: files 04/04/2019 07:05 and 29/04/2019 02:23).-

III.Judge Jenny Corrales Torres, of the Juzgado Agrario de Pérez Zeledón, ruled as follows in judgment 133 of 8 de setiembre 2020: “POR TANTO: …These POSSESSORY INFORMATION PROCEEDINGS filed by [[Nombre1]] ARE DISMISSED (sic). The participants are hereby informed that this ruling may be challenged; therefore, if any party intends to file an appeal against it, please also submit the appeal electronically to the address [...]. This is due to the introduction of oral proceedings in agrarian matters. Furthermore, if the party wishes the appellate court to grant an oral hearing, it must state so in the same appeal brief. Likewise, the parties are advised to designate, as a matter of priority, an email address at which to receive notices, because documents recorded in audio or video format (oral judgment) may be sent to them through this medium (associated documents section: file 08/09/2020 15:03).-

IV.The applicant appeals, expressly stating the grounds therefor (filings section: file 16/09/2020 08:37:23). The applicant offered the following evidence for further clarification (prueba para mejor), attached to the appeal: a) three birth-record searches for the witnesses, obtained from the Registro Civil database, to establish their ages; b) a second certified copy (segundo testimonio) of public deed [Valor 003] of 3 de diciembre 2004, from the notarial protocol (protocolo) of notaries Cintya Bustos Cordero and Luz Marina Valverde Hidalgo, to establish the chain of possession (cadena posesoria). A hearing concerning that evidence was granted by this Court’s ruling of 16 de octubre 2020. [Nombre11] did not comment on the matter. In a brief dated 21 de octubre siguiente, the PGR requested that its admission be denied because: a) numeral 593 of the Código de Trabajo refers only to evidence requested by the adjudicator; b) the referenced deed does not introduce a new fact, and it cannot be alleged that it was unknown, because it comes from the protocol of notary Bustos, the applicant’s judicial representative.

Furthermore, considering the purpose for which it was submitted, it should be emphasized that deeds alone are insufficient to prove possession, as stated in decisions 282 of 19 de marzo 2013 and 489 of 19 de mayo 2011 of this Court; c) the birth certificates are likewise not useful, because the ages stated by the witnesses when testifying are not disputed. It argues that evidence on appeal must relate to new facts or to evidence that was impossible for the party to submit with the action, neither of which applies in this case. The PGR’s objections are unfounded, because the documentary evidence (prueba documental) in question relates to the facts of the proceeding and the allegations made in the appeal and is useful for analyzing the disputed issues; it is therefore admitted pursuant to artículo 52 Ley de Jurisdicción Agraria and 11 Ley de Informaciones Posesorias. The birth certificates serve to verify the ages of the persons who testified, a fact of particular importance in this type of proceeding because the land is located within a protected wildlife area (área silvestre protegida).

As for the deed, although it does appear in the protocol of the title-seeking party’s attorney, it is a public document that must be assessed together with the remaining evidence submitted in the proceeding.

V.The conclusions concerning the proven and unproven facts are upheld, except for proven facts 7 and 11 (which concern procedural steps) and 2 (because of its confusing wording), as they are consistent with the information contained in the case file, subject to the following clarifications, of which the Court must take note. The factual proposition (one for each fact) deemed proven must be stated precisely and comprehensibly, and the specific items of evidence supporting that conclusion must be identified. The appealed judgment employs an incorrect and confusing technique consisting of transcribing the fact as alleged by the applicant in its submissions (see fact two), which may result in the repetition of partial and imprecise information or make the intended meaning unclear. Several factual details are also included within a single “fact” (as occurs with the third). Images from an electronic case file are also incorrectly cited as references because the parties cannot access that file in the same manner in which the adjudicator views it (continuously), since they have access only to separate files.

Moreover, the specific items of evidence supporting that conclusion are not identified. The following is added to 1): The land is a coffee plantation with a house and, according to the cadastral survey plan, its sole northern boundary is [[Nombre12]] (evidence: plan [Valor 009] in the filings section: file 19-10-2018 15:47:29, and the record of the judicial inspection (reconocimiento judicial) conducted on 20 de enero 2020). The following is added to 6): The reserve was created by Decreto Ejecutivo 5389 of 28 de octubre 1975, and the property for which title is sought lies entirely within it (see SINAC certification in the filings section: file 19-10-2018 15:47:29). The following are added as proven facts:

  • 12)On diecinueve de julio de dos mil dos, before notary Zeneyda Víquez Saldana, [[Nombre13]] and [[Nombre8]] executed a private document in which the former sold the latter an unregistered parcel of land measuring veinte mil novecientos sesenta y seis square meters and ochenta y ocho square decimeters, without citing a cadastral survey plan. The transferor stated that she had possessed the property for more than diez años (see copy of deed in the filings section, image 45: file 19/10/2018 03:47:29).
  • 13)On tres de diciembre de dos mil cuatro, public deed doscientos cincuenta y tres-dos in volume segundo of notary Luz Marina Valverde’s protocol, acting jointly as notary with [Nombre14], states that [[Nombre13]] sold [[Nombre15]] an unregistered property, bounded on the east by the same seller, measuring diecisiete mil [Dirección6] square meters and [Dirección7] square decimeters, according to a sketch prepared by a surveyor. The transferor stated that she had possessed the property for more than diez años (see copy of deed in the filings section, image 39: file 16/09/2020 08:37:23).
  • 14)On veintiuno de febrero de dos mil cinco, public deed catorce-cinco in volume quinto of notary Cintya Bustos Cordero’s protocol states that [[Nombre15]] sold [[Nombre1]] an unregistered property measuring diecisiete mil cuatrocientos setenta square meters and noventa y nueve square decimeters, according to a sketch prepared by a surveyor. The transferor stated that she had possessed the property for more than diez años (see copy of deed in the filings section, image 39: file 19/10/2018 03:47:29).
  • 15)On treinta de noviembre dos mil cinco, public deed trescientos treinta y dos-once in volume once of notary Cintya Bustos Cordero’s protocol states that [[Nombre16]] sold [[Nombre8]] an unregistered property measuring approximately una hectárea, without citing a cadastral survey plan. The transferor stated that he had possessed the property for more than diez años and had acquired it through a sale by his father, [[Nombre17]], in approximately mil novecientos ochenta y cinco (see copy of deed in the filings section, image 41: file file 19/10/2018 03:47:29).
  • 16)On veintisiete de junio de dos mil dieciocho, public deed doscientos noventa y cinco-catorce in volume décimo cuarto of notary Royran Arias Navarro’s protocol states that [[Nombre8]] donated to [[Nombre1]] two unregistered parcels of land: a) the first, measuring veinte mil novecientos sesenta y seis square meters and ochenta y ocho square decimeters, without citing a cadastral survey plan and with its boundaries stated confusingly, including the Municipalidad de Pérez Zeledón on the [Dirección8]. The transferor stated that he had possessed the property for more than diez años and that one of the transferors was [[Nombre13]], who sold it to him in dos mil dos pursuant to a sale authenticated by notary Zeneyda Víquez Araya; b) the second, measuring approximately diez mil square meters, without citing a cadastral survey plan. The transferor stated that he had possessed the property for more than diez años and that one of the transferors was [[Nombre16]], who sold it to him in dos mil cinco pursuant to deed CED3 executed before notary Cintya Butos Cordero (see copy of deed in the filings section, image 43: file file 19/10/2018 03:47:29).
  • 17)The property was valued at cinco millones de colones and the proceeding at tres millones de colones (see initial filing, image 5 in the filings section: file 19-10-2018 15:47:29).-

VI.Appealed judgment 133 of 8 de setiembre 2020 rejected the present proceeding because ten-year possession (posesión decenal) predating the entry into force of Decreto Ejecutivo 5389 of 28 de octubre 1975, which created the Reserva Forestal Los Santos, was not established. The applicant appeals on the basis of the following grounds of error (agravios), which are summarized and organized to facilitate their analysis:

  • 1)He challenges the first fact found not proven, which states that it was not established that the property for which title is sought had been in the possession (posesión) of private parties since 10 years before the creation of the Reserva Forestal Los Santos, decree of 28 de octubre del 1975, despite the statements in the initial filing, which were confirmed by each witness. He emphasizes that the testimony (testimonial) was received by a judge other than the one who rendered the judgment, in relation to the principle of immediacy (principio de inmediatez). Regarding the witnesses, he states that they are older adults who have lived most of their lives in the [[Nombre18] ] area and clearly know the property and its former owners. He emphasizes their limited schooling and the nervousness they feel when interviewed by the Judge, both entirely normal circumstances; even so, they were clear and categorical that they had known the former owners of the property since childhood. [[Nombre19] ], born on [Valor [Nombre20]] ([Valor 005]), stated that he came to live in the community of [[Nombre18] ] 60 years ago (1960), that is, 15 years before the declaration of the Reserva Forestal los Santos.

He clearly described the chain of possession (cadena de posesión) of the property, without confusion, because he personally knew all the owners, and listed them through the present day. He emphasizes that the witness did not hesitate and deserves full credibility because he knows the property and its owners; although it is true that at 6 years of age one is not aware of who owns a property, at 11 years of age it is possible even to work to help support one’s family. Therefore, he would be (sic) very well informed and could state with certainty what he testified to. It must also be taken into account that from 1960 onward, very few families lived in that rural community, everyone knew one another, and they clearly understood possession of their land and its boundaries (colindancias). He attaches the witness’s birth certificate to prove his age, since only his voice can be heard in the recording of the hearing and the Judge who received the evidence is not the same one who rendered the judgment on the merits (sentencia de fondo).

As for [[Nombre21] ], he is [Valor 006], was born on [Valor 007], and has lived in the aforementioned area since he was 5 years old. He stated that he remembers living in the area since 1956 and identified the persons who possessed the property: [[Nombre22] ], [[Nombre23] ], and [[Nombre17] ]. [[Nombre17] ] divided it among his children, [[Nombre16] ] and [[Nombre13] ]. They sold it to his father, [[Nombre8] ], who transferred it to [[Nombre1] ]. He emphasizes that [[Nombre21] ] was categorical that he had known the former owners since he was a child and deserves full credibility. He spoke fluently (sic), never hesitated, and provided details of his experiences relating to the property; he therefore supplied valuable information for determining that it had been possessed for more than 10 years before the declaration of the Reserva Forestal. As for [[Nombre24] ], who was born on [Valor 008], he stated that he has lived in that locality his entire life and has always known the property.

He recounted with complete certainty the owners of the property, beginning with the first possessor he remembers: [[Nombre22] ], [[Nombre23] ], and [[Nombre17] ], who donated it to his children, [[Nombre16] ] and [[Nombre13] ], who sold it to his father, [[Nombre8] ]. He clarifies that he sought witnesses who could attest to possession of the property since 10 years before the declaration of the Reserva Forestal. All of them clearly described the chain of possession of the property and had known it since as early as 15 years before that declaration, as they stated. For this reason, he disagrees with the Judge’s assessment that no evidence was submitted in that regard.

  • 2)He also challenges the second fact found not proven. He states that there is no lack of evidence concerning [[Nombre15] ]’s possession, the person from whom that woman obtained the property, or the date. For this purpose, he attached the second certified copy (segundo testimonio) of public deed (escritura pública) [Valor 003] of 3 de diciembre 2004, from the notarial protocol (protocolo) of notary Cintya Bustos Cordero. It establishes that the person who transferred possession to [[Nombre15] ] was [[Nombre13] ], daughter of [[Nombre17] ] and sister of [[Nombre16] ], just as the witnesses stated, thereby conclusively proving possession. He states that the property was outside the possession of the [[Nombre25] ] Family for approximately two and a half months because he acquired that property by deed 14-5 of 21 de febrero 2005, from the fifth protocol of Notary Cintya Bustos Cordero. Mrs. [[Nombre15] ] possessed it for only two and a half months, which is why the witnesses did not mention her when recounting the chain of possession: the change of ownership to Mrs. [[Nombre15] ] occurred many years ago, in late 2004 and early 2005; they possibly saw her at the property only a couple of times and therefore do not remember her name.

But [[Nombre13] ], who was originally from the locality, and her possession of the property are easy to remember, as are the person to whom she sold it and the person from whom she received possession. He emphasizes that the witnesses are senior citizens over 65 years of age, all originally from the town or having lived in the community for at least the past 60 years; they clearly describe the property’s chain of possession and deserve full credibility. To that end, he submits a copy of the aforementioned deed and of the protocol of Notary Public Luz Valverde Elizondo.

  • 3)He argues that the Ley de Informaciones Posesorias establishes two requirements (presupuestos) in Articles 4 and 6, which he transcribes and which were satisfied, because a public document was attached demonstrating possession of the property for nearly 20 years by the corresponding possessory owners, and the witnesses clearly stated that they knew the property, the conditions of its possession, and its prior chain of possession, dating back even before 1965, which is what the law requires for registration in the Public Property Registry (Registro Público de la Propiedad). There is sufficient documentary and testimonial evidence that leaves no room for doubt regarding the possession and the chain of possession at issue. They contend that the evidence was ample and should have been interpreted consistently with reality and the needs of the proceeding, in order to provide them with legal certainty (seguridad jurídica) and avoid infringing their rights; instead, the witnesses were disregarded without considering that they are campesinos with a high rate of illiteracy and that it is necessary to hear more than what they expressly say in order to understand and ascertain the substantive truth of the facts (verdad real de los hechos) from their words. Finally, he requests approval of the proceeding because all requirements imposed by the Ley de Informaciones Posesorias were fully satisfied.

VII. REGARDING THE ASSERTED GROUND FOR NULLITY (MOTIVO DE NULIDAD)

Although annulment of the challenged judgment is not expressly requested, the first ground of appeal (agravio) emphasizes that the testimony was received by a different judicial officer from the one who rendered the judgment, in relation to the principle of immediacy. Section 592 of the repealed Código de Trabajo, applicable to this matter pursuant to Transitorio I of Ley 9343 of 25 de enero de 2016 by express reference from Article 60 of the Ley de Jurisdicción Agraria, requires this Court, when considering an appeal, first to review the case file (expediente) to determine whether there is a procedural defect (vicio procesal) affecting the proceeding or the challenged decision that must be remedied, where legally appropriate. Likewise, Article 26 of the Ley de Jurisdicción Agraria provides, insofar as relevant: “When appropriate, the courts may, on their own initiative, declare nullities and order procedural steps to be repeated in order to correct irregularities that could affect the validity of the proceeding.” Therefore, if it is found that a formality capable of causing actual denial of a fair opportunity to present one’s case (indefensión) has been omitted, an attempt must first be made to remedy the defect; only in cases that truly warrant it should the acts or decisions be annulled to the extent necessary to restore the ordinary course of the proceeding.

Under these provisions, this Court has maintained that a declaration of procedural nullity (nulidad procesal) is appropriate only when such a ruling is absolutely indispensable to prevent denial of a fair opportunity to present one’s case or to restore the ordinary course of the proceeding due to a violation of essential procedural requirements (Articles 194 through 198 of the Código Procesal Civil, applied on a supplementary basis). The ground for nullity asserted by the appellant is unavailing. In this type of adversarial proceeding (proceso contencioso), the fact that the judgment was rendered by a judicial officer other than the one who received the evidence is not a ground for nullity. The principle of immediacy is therefore not violated because, although this arrangement would be ideal, neither the Ley de Informaciones Posesorias nor the procedural rules governing agrarian matters currently establish it as an indispensable requirement for the validity of judgments in this type of proceeding.

VIII. REGARDING THE FIRST AND SECOND GROUNDS OF APPEAL

The appellant disagrees with the facts deemed unproven in the appealed judgment. The appellant considers that possession in the appellant’s favor for 10 years before the creation of the Reserva Forestal Los Santos, decree of 28 de octubre del 1975, as well as [[Nombre15] ]’s possession, the person from whom she obtained the property, and the date on which she did so, were indeed proven. Before analyzing the matters raised on appeal, it is important to bear in mind that the 47137 m2 property for which title is sought, as described in survey plan (plano) [Valor 009], consists of two parcels acquired from different persons and on different dates, according to the applicant’s (parte promovente) statement. In this regard, in the initial filing submitted on 19 de octubre 2018, the applicant stated that the land for which title was sought had been obtained as follows: a) one portion from [[Nombre15] ] through a purchase and sale (compraventa) in 2005 (purchase and sale executed as a notarized instrument); and b) the other portion through a donation from the applicant’s father, [[Nombre8] ], several years earlier (without specifying when), although it was formalized on 27 de junio 2018 (deed executed by notary Royran Arias).

The applicant for title (titulante) also clarified that the land donated by the applicant’s father had been acquired by him from [[Nombre16] ] on 30 de noviembre 2005 (purchase and sale in deed 388-11 of notary Cintya Bustos) and from [[Nombre13] ] (private purchase and sale completed on 19 de julio 2002 and authenticated by notary Zeneyda Víquez). The applicant did not specify the dimensions of any of the lots acquired by the applicant’s father or of the two properties that ultimately comprise the applicant’s land. Nor did the Trial Court (Juzgado) order the applicant, as it should have, to clarify that information. Nevertheless, the sum of the measurements stated in the documents submitted with the initial filing yields a result similar to that shown on the base survey plan. In a filing submitted on 21 de octubre 2019 in response to an order issued by the Trial Court, the applicant for title stated that the applicant had possessed the land since 2003. Despite the inconsistency with the information previously provided, the applicant was not ordered to clarify that information.

IX.Given that the grounds for appeal challenge the manner in which the evidence was assessed in the judgment under appeal, it must be borne in mind that section 54 of the Ley de la Jurisdicción Agraria establishes the system of free evaluation of evidence (libre valoración probatoria). This requires the court to examine and select the sources of evidence obtained in order to determine their effectiveness in resolving the dispute submitted for its consideration, through perception, representation or reconstruction, and deductive or inductive reasoning. The court must state the principles of equity or law on which it bases its judgment. “The system of free evaluation of evidence supersedes the traditional system of statutory evidence (prueba legal), as well as that of sound judicial discretion (sana crítica), which govern civil proceedings. The manner in which agrarian proceedings have been conceived allows the judge to assess broadly the facts alleged by the parties.

This system is not arbitrary; on the contrary, under the free evaluation of evidence, that evaluation must be reasoned and critical and must be based on logic, experience, and psychology. In the reasoning of the judgment, the judge must set forth the grounds for the conviction that leads the judge to decide in the terms stated. Unlike the statutory evidentiary-weight system (sistema de tarifa legal), under which evidence is assessed subject to pre-established legal rules, and even the admissibility of evidence must be established beforehand by the Legal System, under the system of free assessment the judge is free to admit evidence according to the judge’s own judgment” (votos 398 de 6 de junio del 2001 de la Sala Primera. To the same effect, votos 206 de 26 de marzo de 1999, 46 del 26 de abril de 1995; 66 del 6 de febrero de 2009 y 364 de 28 de mayo del 2009 del Tribunal Agrario y 3657 del 7 de mayo de 2003 de la Sala Constitucional).

X.Regarding the assessment of the testimonial evidence (prueba testimonial), the judgment under appeal transcribes certain information from the statements and indicates: “The testimonial evidence in this case does not establish that ten-year possession… The witnesses [[Nombre21] ], [[Nombre19] ] AND [[Nombre24] ] appeared before this court on 07 de mayo del año 2020 to give testimony, and none of the 3 statements established the chain of possession (cadena de la posesión) arising from the portion that the petitioner states he obtained from Ms. [[Nombre15] ]. In this regard, we clearly observe that the taking of testimonial evidence establishes the title claimant’s current possession, but not ten-year possession commencing ten years before the decree creating the reserve with respect to the entire property. Although they state, and it may be inferred, that they know how the second portion—that is, the portion donated to him by the petitioner’s father—came into the petitioner’s possession, they have no knowledge of the portion of the property purchased from Ms. [[Nombre15] ].” The appellant alleges that the statements made in the initial filing were confirmed by each witness, emphasizing that they are older adults who have lived most of their lives in the [[Nombre18] ] area and clearly know the property and its previous owners, but that they have little formal education and become nervous when questioned by the Judge.

Even so, the appellant considers that they were clear in stating that they had known the property’s previous owners since they were children. In view of the specific allegations concerning each statement, the pertinent portions of the testimony given by those witnesses in mayo 2020 are summarized below in relation to the appeal and the chain of possession (associated documents section: archivo 07/05/2020 14.55:10). [[Nombre21] ], a farmer, [Valor 006] (according to the birth certificate), testified: He has lived in [[Nombre12] 018] since he was 5 years old. He states that he lived on the property beginning in the sixties (without specifying which property), for many years. When he arrived at the location, he became familiar with the property, which belonged to [[Nombre22] ], without specifying how long that person possessed it; it then belonged to [[Nombre23] ], followed by [[Nombre17] ], and afterward to that person’s children, including [[Nombre16] ].

He states that [[Nombre1] ] purchased it in parcels, which he has been “adding together.” He knows that one portion was purchased from [[Nombre16] ], another from [[Nombre13] ], who is [[Nombre17] ]’s granddaughter, and another portion from [[Nombre8] ]. [[Nombre1] ] has had the property for approximately fifteen years. The property measures approximately 5 hectares, approximately 47 thousand and some meters (sic). [[Nombre19] ], [Valor 005] (according to the birth certificate), a farmer, stated: He has lived in [[Nombre18] ] since he was 7 years old. He has known the property for a long time; it is approximately 3 kilometers from where he lives. When he arrived in [[Nombre12] 018], the owner of the property was [[Nombre17] ]; it subsequently passed to his son [[Nombre16] ] and granddaughter [[Nombre13] ]. He believes that [[Nombre1] ] purchased it from [[Nombre17] ] and did so approximately 15 years ago.

He says that the property measures approximately forty-five thousand meters. He then clarifies that, before [[Nombre17] ], the owners of the property were [Nombre 022] and [[Nombre12] 023]. [[Nombre24] ], [Valor 010] (according to the birth certificate), stated: He has lived in [[Nombre18] ] since he was 8 years old. He says that he works on the property and lives approximately 20 minutes away from it. When he arrived at the location, the property belonged to [[Nombre22] ], who left it to a son by inheritance; that son sold it to [[Nombre23] ]; it then passed to [[Nombre17] ], and from that person to a son named [[Nombre16] ]. [[Nombre1] ] purchased from a granddaughter of [[Nombre17] ], from [Nombre12] [[Nombre13] ] and [[Nombre16] ]. [[Nombre1] ] has owned the property for fifteen years. It measures approximately 5 hectares. None of the witnesses states that the land for which title is sought consists in part of an area that formerly belonged to [[Nombre15] ] (which, according to the measurements cited in the documentary evidence (documental) offered by the title claimant, is an area comprising at least 2/5 of the property).

Accordingly, the conclusion reached in this regard in the judgment under appeal is correct. The appellant’s arguments for changing it are unavailing. Their status as older adults and any nervousness they may experience when testifying before the judicial authority are not factors that, after listening to their testimony, appear to have affected their statements in this case. On the contrary, despite their age, they clearly recounted the information known to them, referring to periods and the surnames of the persons who had owned the property. Indeed, in the context of this case, the witnesses necessarily had to be older persons because they must attest to the possession exercised over the land since at least 1965, given that the forest reserve was created in 1975. In 1965, the witnesses were 13, 14, and 17 years old; they are therefore considered to have had sufficient discernment at that time and may testify regarding events that occurred or became known to them then, unless they no longer remember them or are prevented from doing so for health reasons.

They also attested to when they first became familiar with the land, why they knew it, and its size, agreeing that it has an area of nearly 5 hectares. They further emphasized that they are residents of the area and live near the property. However, as the trial judge correctly emphasizes, their accounts confirm only the chain of possession and the duration of possession for what the title claimant stated comprises approximately 3/5 of the entire property (corresponding to the portion donated by his father, which had previously belonged to members of the [[Nombre25] ] family and measures approximately 30996,88 m2). Indeed, two of the witnesses do not even state that, before the title claimant, the property was owned by his father, [[Nombre8] ], because they unambiguously testify that [[Nombre1] ] purchased it 15 years earlier (2005), directly from [[Nombre17] ] or from his son and granddaughter.

This is despite the fact that, according to the title claimant, [[Nombre8] ] possessed the property for several years (without specifying how many), from the time he acquired it in el 2005 until he donated it to him in el 2018, although he asserts that the transfer occurred earlier without clarifying when (later, as will be indicated, he inconsistently stated that he had possessed the property since el 2003). As to the other 2/5, corresponding to 17470,99 m2 that the petitioner includes within the property and states that he acquired from [[Nombre15] ], the witnesses make no reference whatsoever to her ever having previously owned it. This Court further emphasizes that, unusually given the type of proceeding, the questioning was conducted by the title claimant’s attorney, with the judge asking only supplemental questions. That attorney repeatedly asked questions concerning the property’s chain of possession, and the witnesses answered without displaying any doubt or uncertainty in that regard.

The allegation in the first ground for appeal—that the witnesses had known the land since the sixties and clearly recounted the chain of possession—is true. However, aside from the fact that they appear to refer only to a portion of the property for which title is sought, there are inconsistencies in their testimony concerning the persons who transferred the land to the title claimant, since at least two of the witnesses (one of whom even states that he works on the property) do not state that it belonged to his father, [[Nombre8] ] (whom they do not even mention as having possessed the land), and none of the 3 mentions [[Nombre15] ]. Accordingly, the assessment and conclusions regarding the testimonial evidence are correct, and this ground for appeal must be rejected.

XI.As to the second and third grounds for appeal, they are likewise without merit. As the PGR emphasizes, to prove possession (posesión) as a matter of fact, merely submitting public deeds (escrituras públicas) is insufficient. The appellant seeks to cure the evidentiary deficiency in the witness testimony concerning [[Nombre15] ] by submitting, as evidence with the appeal, public deed [Valor 003] dated 3 de diciembre 2004, from the notarial record (protocolo) of notary Cintya Bustos Cordero, and asserts that it shows that the person who transferred possession to [[Nombre15] ] was [[Nombre13] ], the daughter of [[Nombre17] ] and sister of [[Nombre16] ]. The appellant emphasizes that [[Nombre15] ] possessed it for only two months, which is why the witnesses did not mention her when recounting the chain of possession (cadena posesoria). Although this is true, and it may be understood that because of that brief period the witnesses did not identify Mrs. [[Nombre15] ] as possessing the land, this is insufficient to establish the chain of possession required in a case such as this one, in which title to property is at stake that, unless it is duly proven to be privately owned, would be in the public domain (dominio público) and of environmental interest.

For that reason, the Ley de Informaciones Posesorias contains more stringent provisions in this regard, such as Section 7, and the chain of transfer must be proven clearly and beyond doubt. As explained in the preceding Considerando, this was not duly established because the witnesses’ testimony does not support the conclusion that the applicant for title’s father possessed the area for which title is sought, despite their proximity to the property and their knowledge of it. That inconsistency is not cured even by considering that the cited deed explains why the witnesses did not refer to [[Nombre15] ]. Moreover, in a filing submitted on 21 de octubre 2019, which has the force of a sworn statement (declaración jurada) pursuant to Section 3 of the cited Law, in compliance with an order issued by the Court in that regard, the applicant for title stated that he had possessed the land since 2003.

He was ordered to clarify that information because the initial filing was ambiguous regarding the length of time he had possessed the area for which title was sought. In that regard, according to the documentary evidence (prueba documental) submitted by the applicant for title, his father, [[Nombre8] ], acquired an area of 20996,88 m2 from [[Nombre13] ] in 2002, and the other approximately one hectare from [[Nombre16] ] only in 2005. He also states that it was in that year that he acquired the remaining 17470,99 m2 from [[Nombre15] ]. There is therefore no logical and reasonable explanation for his assertion that he has possessed the property since 2003 if, according to those documents, either he or his father acquired more than half of its area in years after 2003. Based on the foregoing, it is concluded that the documentary and witness evidence (prueba testimonial) was properly analyzed, comprehensively and in accordance with Section 54 of the Ley de Jurisdicción Agraria, as demonstrated by the reasoning set forth in this regard in the judgment under appeal.

The witness testimony was not disregarded, nor were the witnesses’ statements interpreted incorrectly in any way. The documentary evidence was likewise not improperly analyzed at first instance (primera instancia). In this regard, apart from the undeniable fact that the witnesses did not mention [[Nombre15] ] in their testimony as having possessed the land, deed [Valor 011] dated 27 de junio de 2018, through which the appellant seeks to cure or explain the reason for that omission, was not timely submitted before the judgment under appeal was issued (it was attached to the appeal). This Court must also point out that the deed by which the applicant for title’s father purportedly donated to him the two areas that he claims to have acquired in prior years from members of the [[Nombre25] ] family identifies the adjoining landowners (personas colindantes) in a highly confusing manner; among them, the Municipalidad de Pérez Zeledón is listed as adjoining one of the areas to the east (see copy of the deed in the filings section, image 43: file file 19/10/2018 03:47:29).

That information was not clarified by the applicant for title, nor was the appropriate action ordered at first instance. Nevertheless, given the disposition of the case, there is no need to order any proceedings at second instance (segunda instancia) for its correction, because the applicant for title did not identify that entity as an adjoining landowner, even though it is listed as such in the deed by which he acquired the land in 2018.

XII. Based on the foregoing, as to the matters appealed, the judgment under appeal is affirmed

VOTO N° 1102-F-2020 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las nueve horas treinta y siete minutos del once de noviembre de dos mil veinte.- INFORMACIÓN POSESORIA promovida por [[Nombre1] ] , [...]. Intervienen en el proceso el INSTITUTO DE DESARROLLO RURAL (Inder), representado [Nombre2] , mayor, divorciada, abogada, cédula CED1 , vecina de San Ramón; y la PROCURADURÍA GENERAL DE LA REPÚBLICA (PGR), representada por la procuradora adjunta Heilyn Sáenz Calderón , mayor, abogada, cédula CED2 . Actúa como apoderada especial judicial de la promovente: [Nombre3] , colegiada once mil cuatrocientos treinta. Tramitado ante el Juzgado Agrario del Primer Circuito Judicial de la Zona Sur, Pérez Zeledón. Conoce este Tribunal de la apelación contra la sentencia 133 de 8 de setiembre 2020.

Redacta la jueza Ruth Alpízar Rodríguez; y,

CONSIDERANDO:

I- El promovente interpuso proceso de información posesoria para que se inscriba a su nombre, en el Registro Público Inmobiliario la finca que se describe así: "NATURALEZA…: Terreno de potrero y café, SITUADO: …[Dirección1] [ ], [ ] , [[Dirección2] ], [Nombre [Nombre4]] , de la Provincia de [[Nombre5] ]. LINDEROS…: NORTE: [Dirección3] , [ ] ; SUR: [[Nombre6] ], [[Nombre7] ], ESTE: [Dirección4] , [ ], [[Nombre8] ] y [[Nombre6] ], y OESTE: [[Nombre9] ] y [[Nombre10] ]. MIDE: CUARENTA Y SIETE MIL CIENTO TREINTA Y SIETE METROS CUADRADOS. …Plano Catastrado número: [Valor 002] . La misma cuenta con calle frente a [Dirección5] de sesenta y tres metros con cincuenta céntimos (apartado de escritos: archivo 19/10/2018 03:47).-

II.Participan como partes a la Procuraduría y al Instituto de Desarrollo Rural (apartado de documentos asociados: archivo 08/02/2019 09:24; apartado de escritos: archivos 04/04/2019 07:05 y 29/04/2019 02:23).-

III.La jueza Jenny Corrales Torres, del Juzgado Agrario de Pérez Zeledón, en sentencia 133 de 8 de setiembre 2020, resolvió: "POR TANTO: …SE RECHAZAN (sic) estas diligencia de INFORMACIÓN POSESORIA promovidas (sic) por [[Nombre1] ]. Se les hace saber a los intervinientes que esta resolución es impugnable, por lo que si alguna de las partes va a presentar recurso de apelación contra la misma, favor remitir además el recurso de apelación por formato electrónico a la dirección [...]. Ello por motivo de la inserción de la oralidad en materia agraria. Además, sí es el deseo de la parte que el Tribunal de alzada les confiera una audiencia oral, deberán de hacerlo saber en el mismo escrito de apelación. En igual sentido se les recomienda a las partes señalar prioritariamente un correo electrónico donde recibir notificaciones, ello porque a través de este medio, se les puede enviar documentos grabados en audio o video (sentencia oral) (apartado de documentos asociados: archivo 08/09/2020 15:03).-

IV.La parte promovente apela con indicación expresa de sus motivos (apartado de escritos: archivo 16/09/2020 08:37:23). Ofreció como prueba para mejor, agregadas al recurso de apelación: a) tres consultas de nacimiento de las personas testigas, tomadas de la base de datos del Registro Civil, para demostrar su edad; b) segundo testimonio de la escritura pública [Valor 003] de 3 de diciembre 2004, del protocolo de la notaria Cintya Bustos Cordero y Luz Marina Valverde Hidalgo, para demostrar la cadena posesoria. La audiencia sobre tal se confirió en resolución del 16 de octubre 2020 de este Tribunal. El [Nombre11] no pronunció al respecto. La PGR, en memorial del 21 de octubre siguiente, solicitó se denegase su admisión, porque: a) en el numeral 593 Código de Trabajo, solo hace referencia a prueba solicitada por la persona juzgadora; b) la escritura referida no agrega un hecho nuevo y no se puede alegar que se desconocía, dado que proviene del protocolo de la notaria Bustos, apoderada judicial del promovente.

Además, dado para lo que se aporta, resaltar que para probar la posesión no basta con aportar escrituras, como se indica en votos de este Tribunal 282 de 19 de marzo 2013 y 489 de 19 de mayo 2011; c) tampoco son útiles las certificaciones de nacimiento, dado que no se cuestiona la edad que manifestaron al declarar. Reclama que la prueba en segunda instancia debe referirse a hechos nuevos o que haya sido de imposible para la parte aportarla con la acción, lo cual no se da en este caso. Las objeciones de la PGR no son de recibo, dado que la documental referida se relaciona con los hechos del proceso y lo alegado en el recurso, y resultan útiles para analizar lo debatido, por lo que se admiten, con fundamento en el artículo 52 Ley de Jurisdicción Agraria y 11 Ley de Informaciones Posesorias. Las certificaciones de nacimiento sirven para verificar la edad de las personas declarantes, dato que en este tipo de procesos, por ubicarse el terreno dentro de un área silvestre protegida, es de especial importancia.

En cuanto a la escritura, si bien es cierto consta en el protocolo de la abogada de la parte titulante, es un documento público que debe ser valorado en conjunto con el resto de la prueba aportada al proceso.

V.Se comparte lo concluido sobre lo hechos probados e indemostrados, salvo los hechos probados 7 y 11 (que son trámites) y 2 (por su redacción confusa), por estar acordes con la información que consta en el expediente, con las siguientes aclaraciones, de las cuales debe tomar nota el Juzgado. El enunciado fáctico (uno por cada hecho) que se tiene por demostrado debe redactarse en forma precisa y comprensible, e indicarse con base en qué elementos probatorios concretos se llega a dicha conclusión. En la sentencia recurrida se utiliza una técnica incorrecta y confusa, que consiste en transcribir el hecho como lo invoca la parte promovente en sus gestiones (ver hechos dos), lo cual no puede conllevar que se repitan datos parciales e imprecisos o bien no se entienda la idea. También se incluyen varios datos fácticos en un mismo “hecho” (como sucede con el tercero). Y se citan incorrectamente como referencia imágenes de un expediente electrónico que no es accesible a las partes de la manera que la persona juzgadora lo visualiza (en forma continua), pues ellas solo tienen acceso a archivos independientes.

Además no se concretiza qué elementos probatorios son los que sirven para llegar a esa conclusión. Al 1) se adiciona: El terreno es de cafetal con una casa y según el plano catastrado, por el norte colinda únicamente con [[Nombre12] ] (como elementos probatorios: plano [Valor 009] en apartado de escritos: archivo 19-10-2018 15:47:29 y acta de reconocimiento judicial realizado el 20 de enero 2020). Al 6) se agrega: La reserva fue creada mediante decreto ejecutivo 5389 de 28 de octubre 1975 y el inmueble a titular está completamente dentro de tal ( ver certificación del SINAC en apartado de escritos: archivo 19-10-2018 15:47:29) . Como hechos probados se agregan:

  • 12)El diecinueve de julio de dos mil dos, ante la notaria Zeneyda Víquez Saldana, se suscribió un documento privado por [[Nombre13] ] y [[Nombre8] ], en el cual la primera vendió al segundo, un terreno sin inscribir de veinte mil novecientos sesenta y seis metros con ochenta y ocho decímetros cuadrados, sin citarse plano catastrado. La transmitente afirmó poseer la finca por más de diez años (ver copia de escritura en apartado de escritos, imagen 45: archivo 19/10/2018 03:47:29).
  • 13)El tres de diciembre de dos mil cuatro, en escritura pública doscientos cincuenta y tres-dos del tomo segundo del protocolo de la notaria Luz Marina Valverde y en connotariado con [Nombre14] , se consigna que [[Nombre13] ] vendió a [[Nombre15] ] una finca sin inscribir, colindante por el este con la misma vendedora, de diecisiete mil [Dirección6] metros [Dirección7] decímetros cuadrados, según croquis realizado por un topógrafo. La transmitente afirmó poseer la finca por más de diez años (ver copia de escritura en apartado de escritos, imagen 39: archivo 16/09/2020 08:37:23).
  • 14)El veintiuno de febrero de dos mil cinco, en escritura pública catorce-cinco del tomo quinto del protocolo de la notaria Cintya Bustos Cordero, se consigna que [[Nombre15] ] vendió a [[Nombre1] ] , una finca sin inscribir, de diecisiete mil cuatrocientos setenta metros con noventa y nueve decímetros cuadrados, según croquis realizado por un topógrafo. La transmitente afirmó poseer la finca por más de diez años ( ver copia de escritura en apartado de escritos, imagen 39: archivo 19/10/2018 03:47:29).
  • 15)El treinta de noviembre dos mil cinco, en escritura pública trescientos treinta y dos-once del tomo once del protocolo de la notaria Cintya Bustos Cordero, se consigna que [[Nombre16] ] vende a [[Nombre8] ], una finca sin inscribir, de una hectárea aproximadamente, sin citarse plano catastrado. El transmitente afirmó poseer la finca por más de diez años y que la obtuvo por venta que le hizo su padre [[Nombre17] ], aproximadamente en mil novecientos ochenta y cinco (ver copia de escritura en apartado de escritos, imagen 41: archivo archivo 19/10/2018 03:47:29).
  • 16)El veintisiete de junio de dos mil dieciocho, en escritura pública doscientos noventa y cinco-catorce, del tomo décimo cuarto del protocolo del notario Royran Arias Navarro, se consigna que [[Nombre8] ] dona a [[Nombre1] ] dos terrenos sin inscribir: a) el primero de veinte mil novecientos sesenta y seis metros con ochenta y ocho decímetros cuadrados, sin citarse plano catastrado y se citan confusamente las colindancias, citándose entre tales a la Municipalidad de Pérez Zeledón por el [Dirección8]. El transmitente afirmó poseer la finca por más de diez años y que una de las transmitentes fue [[Nombre13] ], quien le vendió en el dos mil dos, según compraventa autenticada por la notaria Zeneyda Víquez Araya; b) el segundo de diez mil metros cuadrados aproximadamente, sin citarse plano catastrado. El transmitente afirmó poseer la finca por más de diez años y que uno de las transmitentes fue [[Nombre16] ], quien le vendió en el dos mil cinco, según escritura CED3 otorgada ante la notaria Cintya Butos Cordero (ver copia de escritura en apartado de escritos, imagen 43: archivo archivo 19/10/2018 03:47:29).
  • 17)El inmueble se estimó en cinco millones de colones y el proceso en tres millones de colones (ver escrito inicial, imagen 5 en apartado de escritos: archivo 19-10-2018 15:47:29).-

VI.En la sentencia impugnada 133 de 8 de setiembre 2020 se improbó el presente proceso, por no demostrarse la posesión decenal con anterioridad a la vigencia del Decreto Ejecutivo 5389 de 28 de octubre 1975, que creó la Reserva Forestal Los Santos. La parte promovente apela , con base en los siguientes agravios, que se resumen y ordenan para facilitar su análisis:

  • 1)Refuta el primer hecho no probado, en el cual se indica que no se logró acreditar que el inmueble que se pretende titular haya estado en posesión de particulares desde 10 años antes de la creación de la Reserva Forestal Los Santos, decreto de 28 de octubre del 1975, pese a lo indicado en el escrito inicial, que fue confirmado por cada testigo. Resalta la testimonial fue recibida por un juez distinto al que dictó la sentencia, en relación con el principio de inmediatez. Con respecto a los testigos, dice, son personas adultas mayores, que han vivido la mayoría de su vida en la zona de [[Nombre18] ] y conocen claramente la finca y sus dueños anteriores. Resalta la poca escolaridad de ellos y los nervios que sienten al ser entrevistados por el Juez, situaciones completamente normales, pero aun así fueron claros y tajantes en que conocían los dueños anteriores de la finca, desde que eran niños. [[Nombre19] ] , nacido el [Valor [Nombre20]] ([Valor 005]) mencionó que llego a vivir en la comunidad de [[Nombre18] ] hace 60 años (1960), es decir, 15 años antes de la declaratoria de la Reserva Forestal los Santos.

El menciona claramente la cadena de posesión de la finca, sin confusión, por conocer todos los dueños, de forma personal, y los enumera hasta la actualidad. Resalta no titubeó y merece total credibilidad, por conocer la finca y los dueños, si bien es cierto a las 6 años no está consciente del dueño de una finca a las los 11 años es posible hasta trabajar para llevar sustento a su familia. Por ende, si estuviera (sic) muy enterado y con certeza pueda afirmar lo que declara. Además debe tomarse en cuenta para para los años 1960, en adelante, en dicha comunidad rural vivían muy pocas las familias, todos se conocían y tenían muy claro la posesión de sus terrenos y sus colindancias. Adjunta certificación de nacimiento del testigo para demostrar su edad, ya que en la grabación de la audiencia solo se escucha su voz, y el Juez que recibió la prueba no es el mismo que dicta sentencia de fondo. En cuanto a [[Nombre21] ], tiene [Valor 006], nació el [Valor 007] y vive en la zona citada desde los 5 años de edad.

El indica que recuerda que desde 1956 vive en la zona y citó quienes fueron las personas poseedoras de la finca: [[Nombre22] ], [[Nombre23] ], [[Nombre17] ]. [[Nombre17] ] lo repartió entre sus hijos [[Nombre16] ] e [[Nombre13] ]. Ellos se lo venden a su padre [[Nombre8] ], quien se lo traspasa a [[Nombre1] ]. Resalta [[Nombre21] ] fue tajante en que conocía los dueños anteriores desde que era un niño y merece total credibilidad. Fue fluido (sic), nunca dudo, expreso detalles de sus vivencias relacionadas con la finca, por lo que aportó información valiosa para determinar que fue poseída más de 10 años antes de la declaratoria de la Reserva Forestal. En cuanto a [[Nombre24] ], quien nació el [Valor 008], indicó que toda su vida ha vivido en esa localidad y conoce la finca desde siempre. Narró con plena certeza los dueños de la finca, desde el primer poseedor que recuerda: [[Nombre22] ] , [[Nombre23] ], [[Nombre17] ], quien se la donó a sus hijos, [[Nombre16] ] e [[Nombre13] ], quienes la venden a su padre [[Nombre8] ].

Aclara, buscó testigos que pudiesen dar fe de la posesión de la finca desde 10 años antes de la declaratoria de Reserva Forestal. Todos señalaron claramente la cadena de posesión de la finca y la conocen hasta 15 años antes de eso, lo cual manifestaron. Por eso no se coincide con la apreciación de la señora Jueza, cuando dice que no presentamos prueba al respecto.

  • 2)Refuta también el segundo hecho no probado. Indica no existe falta de prueba de la posesión de [[Nombre15] ], de quien obtuvo la finca dicha señora y la fecha. Para ello adjunto el segundo testimonio de la escritura pública [Valor 003] de 3 de diciembre 2004, del protocolo de la notaria Cintya Bustos Cordero. En ella consta que quien le traspasó la posesión a [[Nombre15] ] fue [[Nombre13] ], hija de [[Nombre17] ] y hermana de [[Nombre16] ], tal y como lo indicaron los testigos, lo que demuestra la posesión de forma fehaciente. Indica, la finca estuvo fuera de la posesión de la Familia [[Nombre25] ] por unos dos meses y medio, porque él adquiere dicha finca en escritura 14-5 del 21 de febrero 2005, del protocolo quinto de la Notaria Cintya Bustos Cordero. Solo dos meses y medio poseyó la señora [[Nombre15] ] , razón por la cual los testigos no la mencionan al momento de narrar la cadena de posesión, debido a que hace muchos años, finales del 2004 e inicios 2005, que sucede ese cambio de dueña, a doña [[Nombre15] ] posiblemente la vieron un par de veces en la finca, razón por la cual no recuerdan su nombre.

Pero [[Nombre13] ] , quien era oriunda de la localidad, es fácil de recordar su posesión en la finca y a quien le vende y de quien recibe la posesión. Resalta los testigos son ciudadanos de oro, de más de 65 años, todos oriundos del pueblo o han vivido en la comunidad los últimos 60 años como mínimo, son claros cuando describen la cadena de posesión la finca y merecen toda credibilidad. Aporta con ese fin copia de la escritura citada y del protocolo de la Notaria Publica Luz Valverde Elizondo.

  • 3)Sostiene, la Ley de Informaciones Posesorias, establecer dos presupuestos, en los artículos 4 y 6, los cuales transcribe y fueron cumplidos, dado que se adjuntó documento público donde se demuestra la posesión de la finca por casi 20 años con los dueños poseedores que corresponde y los testigos fueron claros en conocer la finca y las condiciones de la misma en cuanto a su posesión y la cadena de posesión anterior, antes aun de 1965, que es lo que le exige la ley para inscribir en el Registro Público de la Propiedad. Existe prueba suficiente sea documental y testimonial que no deja margen de error de la posesión y de la cadena de posesión que nos interesa. Reclaman que la prueba fue basta y debió ser interpretada de forma congruente con la realidad y la necesidad del proceso, para brindarles seguridad jurídica y no vulnerar sus derechos, pero se hizo caso omiso a los testigos sin recordar que son campesinos con un alto índice de analfabetismo y sabiendo que debe escucharse más de lo dicen para entender y rescatar la verdad real de los hechos de sus palabras. Finalmente, pide se apruebe el proceso por haber cumplido cabalmente con la totalidad de requisitos exigidos por la Ley de Informaciones Posesorias.

VII. SOBRE EL MOTIVO DE NULIDAD INVOCADO

Aunque no se pide expresamente la nulidad de la sentencia impugnada, en el primer agravio se resalta la testimonial fue recibida por una persona juzgadora distinta a la que dictó la sentencia, en relación con el principio de inmediatez. El numeral 592 Código de Trabajo derogado, aplicable a este asunto según Transitorio I de la Ley 9343 de 25 de enero de 2016, por remisión expresa del artículo 60 de la Ley de Jurisdicción Agraria, impone que al analizar una apelación, este Tribunal debe primero revisar el expediente, para determinar si existe un vicio procesal que afecte el proceso o la resolución impugnada que deba ser subsanado, si es pertinente legalmente. Asimismo, el artículo 26 Ley de Jurisdicción Agraria, en lo que interesa dispone: "Cuando sea del caso, los tribunales podrán, por iniciativa propia, declarar nulidades y disponer la reposición de trámites, a fin de corregir irregularidades que pudieran afectar la validez del proceso".

Por ende, si se encontrase que se ha omitido alguna formalidad, capaz de causar efectiva indefensión, debe primer intentarse subsanar el defecto y solo en casos que de verdad lo ameriten, decretar la nulidad de las actuaciones o resoluciones, hasta donde sea necesario para orientar el curso normal del juicio. Al amparo de dichas regulaciones, esta Sede ha mantenido el criterio de que la declaratoria de nulidad procesal procede cuando sea absolutamente indispensable su pronunciamiento, para evitar indefensión o para orientar el curso normal del procedimiento, por violación a formas esenciales en el trámite (artículos 194 a 198 del Código Procesal Civil, aplicados supletoriamente). El motivo de nulidad invocado por la parte recurrente no es de recibo. Que la dictase la sentencia una persona juzgadora diferente a quien recibió la prueba, en este tipo de procesos contenciosos, no es causal de nulidad.

No se rompe por ende con el principio de inmediatez, dado que aunque es lo idóneo, actualmente no se establece normativamente como requisito de validez indispensable de la sentencia ni en la Ley de Informaciones Posesorias ni en la normativa procesal que rige la materia agraria en cuanto a este tipo de procesos.

VIII. SOBRE LOS AGRAVIOS PRIMERO Y SEGUNDO

La parte apelante está en desacuerdo con los hechos tenidos por indemostrados en la sentencia recurrida. Considera si se probó la posesión a su favor 10 años antes de la creación de la Reserva Forestal Los Santos, decreto de 28 de octubre del 1975 y la posesión de [[Nombre15] ], de quién obtuvo la finca ella y en qué fecha. Antes de analizar lo agraviado, es importante tener presente que el inmueble a titular de 47137 m2, descrito en el plano [Valor 009], está conformado por dos terrenos, adquiridos de diversas personas y en diferentes fechas, según lo que declaró la parte promovente. Al respecto, en el escrito inicial presentado el 19 de octubre 2018, afirmó que lo que pretendía titular lo obtuvo de: a) un sector de [[Nombre15] ], mediante compraventa, en el 2005 (compraventa protocolizada); b) el otro sector por donación de su padre [[Nombre8] ], hacía varios años (sin precisar cuándo), pero se formalizó el 27 de junio 2018 (escritura del notario Royran Arias).

Aclaró también el titulante, que lo donado por su padre, tal lo había adquirido de [[Nombre16] ], el 30 de noviembre 2005 (compraventa en escritura 388-11 de notaria Cintya Bustos) y de [[Nombre13] ] (compraventa privada realizada el 19 de julio 2002, autenticada por notaria Zeneyda Víquez). La parte promovente no específica las medidas de ninguno de los lotes adquiridos por su padre ni tampoco de las dos fincas que conforman finalmente su terreno. El Juzgado tampoco previno, como era lo correcto, aclarar esos datos. Sin embargo, la suma de las medidas citadas en los documentos aportados con el escrito inicial da un resultado similar al consignado en el plano base. En escrito presentado el 21 de octubre 2019, para cumplir prevención hecha al respecto por el Juzgado, el titulante afirmó que posee el terreno desde el 2003. Pese a esa confusión en relación con lo antes informado, no se previno aclarar el dato.

IX.Dado que los agravios objetan la forma como se apreció la prueba en la sentencia recurrida, debe tenerse presente que el numeral 54 Ley de la Jurisdicción Agraria establece el sistema de la libre valoración probatoria. Ello exige al tribunal estudiar y seleccionar las fuentes de prueba obtenidas, a fin de establecer su eficacia para resolver el conflicto sometido a su conocimiento, a través de la percepción, la representación o reconstrucción y el razonamiento deductivo o inductivo. El tribunal debe expresar los principios de equidad o de derecho sobre los cuales basa su criterio. "El sistema de la libre valoración de la prueba supera el clásico sistema de la prueba legal así como el de la sana crítica, que rigen en el proceso civil. La forma como ha sido concebido el proceso agrario le permite al juez valorar ampliamente los hechos alegados por las partes. Dicho sistema no es arbitrario, por el contrario en la libre valoración de la prueba la misma deber ser razonada, crítica, basarse en la lógica, la experiencia y la sicología.

En la motivación del fallo el juez debe exponer los motivos de convicción que lo llevan a resolver en los términos que lo hace. A diferencia del sistema de tarifa legal, en el cual las pruebas se aprecian con sujeción a reglas legales previas, e incluso la admisibilidad de pruebas debe estar previamente señalado por el Ordenamiento Jurídico, en el sistema de libre apreciación el juez tiene libertad para admitir pruebas conforme a su criterio” (votos 398 de 6 de junio del 2001 de la Sala Primera. En igual sentido votos 206 de 26 de marzo de 1999, 46 del 26 de abril de 1995; 66 del 6 de febrero de 2009 y 364 de 28 de mayo del 2009 del Tribunal Agrario y 3657 del 7 de mayo de 2003 de la Sala Constitucional).

X.En la sentencia recurrida, sobre la apreciación de la prueba testimonial, se transcriben algunos datos de las declaraciones y se indica: “ La prueba testimonial en este caso, no acredita esa posesión decenal… Se hicieron presentes a este despacho el día 07 de mayo del año 2020, a rendir declaración los testigos [[Nombre21] ], [[Nombre19] ] Y [[Nombre24] ], siendo que de las 3 ponencias, ninguno acredito la cadena de la posesión derivada de la parte que indica el promovente que obtuvo de la señora [[Nombre15] ] En este orden de ideas, observamos con claridad que con la recepción de prueba testimonial se demuestra la posesión actual del titulante, no así la decenal con diez años antes de la creación del decreto de la totalidad de la finca si bien es cierto exponen y se puede colegir que de la segunda parte o sea de la parte que le fue donada por el padre del promovente si tienen conocimiento como paso a posesión del promovente no tienen conocimiento de la parte de la finca comprada a la señora [[Nombre15] ]”.

La parte recurrente alega que lo afirmado en el escrito inicial fue confirmado por cada testigo, quienes resalta son personas adultas mayores, que han vivido la mayoría de su vida en la zona de [[Nombre18] ] y conocen claramente la finca y sus dueños anteriores, pero son personas de poca escolaridad y tienen nervios al ser entrevistados por el Juez. Aun así, considera que fueron claros en que conocían los dueños anteriores de la finca, desde que eran niños. Dado lo que alega en concreto con respecto a cada declaración, se resume en lo pertinente, en función de lo apelado y la cadena posesoria, lo declarado por tales en mayo 2020 (apartado de documentos asociados: archivo 07/05/2020 14.55:10). [[Nombre21] ], agricultor, de [Valor 006] (según certificación de nacimiento), declaró: Desde los 5 años vive en [[Nombre12] 018]. Asegura vivió en la finca en desde los años sesenta (sin precisar cuál), por muchos años.

Cuando llegó al lugar, conoció la finca y le pertenecía a [[Nombre22] ] , sin precisar cuánto tiempo la poseyó, luego a [[Nombre23] ] , seguido de [[Nombre17] ], después los hijos de tal, entre ellos [[Nombre16] ] Indica que [[Nombre1] ] lo compró en lotes, que ha ido “arrimando”. Sabe que una parte la compró a [[Nombre16] ] y otra a [[Nombre13] ], que es nieta de [[Nombre17] ] y otra parte a [[Nombre8] ]. [[Nombre1] ] tiene como quince años de tener la finca. La finca mide como 5 hectáreas, como 47 mil y algo de metros (sic). [[Nombre19] ] , [Valor 005] (según certificación de nacimiento), agricultor, expresó: Vive en [[Nombre18] ] desde que tenía 7 años de edad. Conoce la finca desde hace tiempo, queda como a 3 kilómetros de donde vive. Cuando llegó a [[Nombre12] 018], el dueño de la finca era [[Nombre17] ], después pasó a su hijo [[Nombre16] ] y nieta [[Nombre13] ]. Le parece que [[Nombre1] ] le compró a [[Nombre17] ] y la compró hace como 15 años.

Dice que la finca mide como cuarenta y cinco mil metros. Luego aclara que antes de [[Nombre17] ] fueron dueños de la finca [Nombre 022] y [[Nombre12] 023]. [[Nombre24] ], de [Valor 010] (según certificación de nacimiento), manifestó: Vive en [[Nombre18] ] desde que tenía 8 años de edad. Dice que trabaja en la finca y que vive como a 20 minutos de ella. Cuando llegó al lugar, la finca era de [[Nombre22] ], quien se la heredó a un hijo que le vendió a [[Nombre23] ], luego pasó a [[Nombre17] ] y de tal a un hijo llamado [[Nombre16] ]. [[Nombre1] ] le compra a una nieta de [[Nombre17] ] de [Nombre12] [[Nombre13] ] y [[Nombre16] ]. [[Nombre1] ] es dueño de la finca desde hace quince años. Mide como 5 hectáreas. Ninguno de los testigos refiere conocer que el terreno que se titula, esté conformado por una zona que hubiese sido de [[Nombre15] ] (que de acuerdo con las medidas citadas en la documental ofrecida por el titulante, es un área de al menos 2/5 de la finca).

Por ende, lo concluido en la sentencia recurrida al respecto es correcto. Lo argumentado por la parte apelante para variarlo no es de recibo. El que sean personas adultas mayores y el nerviosismo que puedan tener por declarar ante la autoridad judicial, no son elementos que en este caso, escuchados sus testimonios, haya afectado sus manifestaciones. Por el contrario, refirieron con claridad, pese a su edad, los datos que conocían, refiriéndose a épocas y apellidos de las personas que habían sido dueñas. Incluso para el contexto del caso, se requería necesariamente que fueran personas mayores de edad, dado que tienen que dar fe de la posesión ejercida en el terreno desde al menos 1965, al haberse creado la reserva forestal en 1975. Para 1965, los testigos tenían 13, 14 y 17 años de edad, por lo que se consideran tenían suficiente discernimiento en ese momento y pueden declarar sobre hechos sucedidos o conocidos en ese momento, salvo que en la actualidad no los recuerden o razones de salud lo impidan.

Dieron también fe de la época desde la cual conocen el terreno y el por qué y de su medida, coincidiendo en que tiene un área de casi 5 hectáreas. Resaltaron además ser vecinos de la zona y vivir próximos a la finca. Pero como bien lo resalta la juzgadora de instancia, lo que relatan solo confirma la cadena posesoria y tiempo de poseer de lo que la persona titulante aseguró es 3/5 aproximadamente de la finca total (que corresponde a lo donado por su padre que antes fue de integrantes de la familia [[Nombre25] ], de aproximadamente 30996,88 m2). Incluso dos de los testigos, ni siquiera refieren a que antes del titulante, quien fue dueño de la finca fue su padre [[Nombre8] ], pues declaran sin ambigüedad que [[Nombre1] ] compró hacía 15 años (2005) y lo hizo directamente a [[Nombre17] ] o a su hijo y nieta. Esto pese a que [[Nombre8] ], según relata el titulante, poseyó por varios años la finca (sin precisar cuántos), desde que la adquirió en el 2005 hasta que se la donó en el 2018, aunque asegura la transmisión se dio antes, pero no aclaró cuándo (luego, como se indicará, afirmó contradictoriamente que posee la finca desde el 2003).

Con respecto a los otros 2/5, que corresponde a 17470,99 m2 que el promovente incluye dentro de la finca y que dice adquirió de [[Nombre15] ], los testigos no hacen referencia alguna a que ella haya sido siquiera dueña anteriormente. Resalta este Tribunal además, que el interrogatorio, en forma inusual dado el tipo de proceso, fue realizado por la abogada del titulante, haciendo la persona juzgadora solo preguntas complementarias. Dicha abogada insistió mucho en preguntas relacionadas con la cadena posesoria de la finca y los testigos contestaron sin mostrar dudas o incertezas al respecto. Lo alegado en el primer agravio, en cuanto a que los testigos conocían el terreno desde los años 60 y que relatan la cadena posesoria con claridad, es cierto. Pero aparte de que solo parecen referirse a un sector de la finca a titular, existen inconsistencias en lo declarado sobre las personas que transmitieron el terreno al titulante, dado que al menos dos de los testigos (uno de ellos incluso asegura trabajar en la finca) no refieren haya sido ni de su padre [[Nombre8] ] (a quien no citan siquiera como poseedor del terreno) y ninguno de los 3 cita a [[Nombre15] ]. Por ende, lo apreciado y concluido sobre la prueba testimonial es correcto y el agravio debe ser rechazado.

XI.En cuanto al segundo y tercer agravios, tampoco son de recibo. Como lo resalta la PGR, para probar posesión como hecho, no basta con aportar escrituras públicas. El apelante pretende subsanar lo que no se probó con la testimonial respecto a [[Nombre15] ], aportando como prueba con la apelación, la escritura pública [Valor 003] de 3 de diciembre 2004, del protocolo de la notaria Cintya Bustos Cordero y asegura que en ella consta que quien le traspasó la posesión a [[Nombre15] ] fue [[Nombre13] ] , hija de [[Nombre17] ] y hermana de [[Nombre16] ]. Resalta [[Nombre15] ] solo la poseyó por dos meses, razón por la cual los testigos no la mencionan al momento de narrar la cadena de posesión. Aunque ello es cierto y pueda entenderse que por ese poco espacio temporal los testigos no citaron a la señora [[Nombre15] ] como poseedora del terreno, lo indicado no es suficiente para tener por acreditada la cadena posesoria que amerita un caso como el presente, en el cual al está de por medio la titularidad sobre un bien que, de no probarse debidamente se tiene propiedad privada, sería de dominio público y de interés ambiental.

Existen por eso normas más exigentes al respecto en la Ley de Informaciones Posesorias, como el numeral 7, y la cadena de transmisión debe ser probada en forma nítida e indubitable. Como se explicó en el considerando anterior, ello no fue debidamente acreditado, pues de lo declarado por los testigos, no se puede concluir que el padre del titulante haya poseído el área a titular, pese a la cercanía de tales con el inmueble y lo que conocen sobre tal. Esa inconsistencia no se subsana ni aun considerando que la escritura referida, explica por qué no se refirieron los testigos a [[Nombre15] ]. Pero además, en escrito presentado el 21 de octubre 2019, que tiene valor de declaración jurada conforme lo dispone el numeral 3 Ley citada, para cumplir prevención hecha al respecto por el Juzgado, el titulante afirmó que posee el terreno desde el 2003. Se le previno aclarar ese dato por la ambigüedad que presentaba el escrito inicial en relación al tiempo de posesión que tenía sobre el área a titular.

Al respecto, según la documental que el titulante aporta, su padre, [[Nombre8] ] adquirió un sector de 20996,88 m2 de [[Nombre13] ] en el 2002 y la otra hectárea aproximadamente de [[Nombre16] ] hasta el 2005. En ese año es que el afirma también que adquirió el resto de 17470,99 m2 de [[Nombre15] ]. No existe entonces explicación lógica y razonable que justifique por qué afirma posee la finca desde el 2003, si se adquirió por él o por su padre –según esos documentos-, más de la mitad de su cabida en años posteriores al 2003. Conforme lo expuesto, se concluye la prueba documental y testimonial fue analizada debidamente, en forma integral y con base en lo dispuesto en el numeral 54 Ley de Jurisdicción Agraria, lo cual se evidencia en la fundamentación que al respecto se expone en la sentencia apelada. No se hizo caso omiso de las testimoniales y en forma alguna se interpretó incorrectamente lo declarado por las personas testigas.

La documental tampoco fue indebidamente analizada en primera instancia. Al respecto, aparte de que es innegable que los testigos no mencionaron en sus declaraciones a [[Nombre15] ] como poseedora del terreno, la escritura [Valor 011] de 27 de junio de 2018 con la cual la parte apelante intenta subsanar o explicar el motivo de esa omisión, no fue aportada oportunamente antes de emitirse la sentencia recurrida (se adjuntó con la apelación). Debe también este Tribunal resaltar que la escritura por medio de la cual el padre del titulante aparece donándole las dos áreas que afirma adquirió en años anteriores de integrantes de la familia [[Nombre25] ], expresa en forma muy confusa las personas colindantes, y dentro de tales se cita a la Municipalidad de Pérez Zeledón como colindante por el este con uno de los sectores ( ver copia de escritura en apartado de escritos, imagen 43: archivo archivo 19/10/2018 03:47:29).

Ese dato no fue aclarado por la parte titulante ni se ordenó lo pertinente en primera instancia. No obstante, dada la forma como se resuelve, no amerita ordenar en segunda instancia trámite alguno para su corrección, pues dicha entidad no ha sido citada por la parte titulante como colindante, pese a que se cita como tal en la escritura por la cual adquiere el terreno en el 2018.

XII. Conforme lo explicado, en lo apelado, se confirma la sentencia recurrida

En lo apelado, se confirma la sentencia recurrida.
