Appeal of a criminal judgment (recurso de apelación de sentencia penal) filed in these proceedings brought against [Nombre1], of legal age, born on seis de febrero de mil novecientos setenta y cuatro, holder of identity card number CED1 - -; [Nombre2], of legal age, born on veintitrés de abril de mil novecientos ochenta y cuatro, holder of identity card number CED2 - -; and Asociación de Empleados Administrativos de Palma Tica, for the offense of violation of the Ley de Conservación de vida silvestre, in the form of wetland drainage (drenaje de humedal), to the detriment of Los Recursos Naturales. Judge Ivette Carranza Cambronero and Judges Christian Fernández Mora and David Fallas Redondo participated in deciding the appeal. Attorney [Nombre3] Campos Piedra appeared in the appeal as private defense counsel for the accused [Nombre1] and Special Judicial Attorney-in-Fact for Asociación de Empleados Administrativos de Palma Tica.
Whereas:
1. By Judgment number 132-2019, issued at seventeen hours and fifty minutes on veintitrés de agosto de dos mil diecinueve, the Tribunal de Juicio de Osa, Ciudad Cortés, Puntarenas, ruled: “POR TANTO: In accordance with the foregoing, Articles 39 and 41 of the Constitución Política, 35, 261 of the Código Penal; 98 of Law number 7317; 1, 9, 360, 361, 363, 364, 365, 366 of the Código Procesal Penal, [Nombre2] IS ACQUITTED OF ALL PUNISHMENT AND LIABILITY for the offense of VIOLATION OF THE LEY DE CONSERVACIÓN DE VIDA SILVESTRE IN THE FORM OF WETLAND DRAINAGE, to the detriment of LOS RECURSOS NATURALES. The costs of the proceedings shall be borne by the State. With respect to CO-ACCUSED [Nombre1], in accordance with the foregoing and Articles 39 and 41 of the Constitución Política; 8 subsection 1) of the Convención Americana de los Derechos Humanos; 10 of the Declaración Universal de los Derechos Humanos; 9 subsection 2) of the Pacto Internacional de Derechos Civiles y Políticos; 1, 11, 30, 45, 59 to 63, 71 to 74 of the Código Penal; 98 subsection a) of Law number 7317, known as the Ley de Conservación de Vida Silvestre; and 124 of the Reglas Vigentes sobre Responsabilidad Civil del Código Penal de 1941, pursuant to Law number 4891 of 8 de noviembre de 1971; 1045 of the Código Civil; 1 to 15, 184 et seq., 265, 341 to 372 of the Código Procesal Penal; 17 and 44 of the Arancel de Profesionales en Derecho, Executive Decree number 20307–J, [Nombre1] is declared the sole perpetrator of and responsible for the offense of VIOLATION OF THE LEY DE CONSERVACIÓN DE VIDA SILVESTRE IN THE FORM OF WETLAND DRAINAGE, committed to the detriment of LOS RECURSOS NATURALES, and is therefore sentenced to ONE YEAR OF IMPRISONMENT. The convicted person shall serve that sentence, with credit for any pretrial detention (prisión preventiva) already served, at the place and in the manner determined by the prison regulations. Because he qualifies therefor, and pursuant to Article 59 et seq. of the Código Penal, he is granted the benefit of a SUSPENDED SENTENCE (EJECUCIÓN CONDICIONAL DE LA PENA) for a probationary period of THREE YEARS, with the understanding that, if he commits a new intentional offense punishable by imprisonment for more than six months, the Court shall revoke the benefit hereby granted. The customary certified copies shall be forwarded to the Instituto Nacional de Criminología and the Sentence Enforcement Judge, and the judgment shall be entered in the Registro Judicial. The costs of the proceedings shall be borne by the State. Likewise, the civil action for damages (acción civil resarcitoria) brought by the Procurador General de la República on behalf of the State against the civil defendants [Nombre1] AND, JOINTLY AND SEVERALLY, ASOCIACION DE EMPLEADOS ADMINISTRATIVOS DE PALMA TIVA ASOEPATICO is granted, and the latter are ordered to pay the former the following amounts. For the property, social, and environmental damage caused, the sum of VEINTE MILLONES OCHOCIENTOS TREINTA Y SEIS MIL COLONES CON CIEN CENTÍMOS COLONES. They are also ordered to pay interest at the rate established (Tasa Pasiva) by the Banco Central on the amount awarded for environmental damage, from the date this judgment becomes final until payment in full. The request for an unliquidated award (condenatoria en abstracto) made by the Procuraduría General de la República is denied because the opportunity to request such an award had already expired at the Preliminary Hearing, given that, when specifying its claims, that petitioner requested the amount awarded. REGARDING THE REQUESTED PRECAUTIONARY MEASURE (MEDIDA CAUTELAR): Pursuant to Article 140 of our Código Procesal Penal and at the request of the Ministerio Público and the Procuraduría General de la Republica, restoration of matters to the condition existing before the act (restablecimiento de las cosas al estado que tenían antes del hecho) is ordered. For this purpose, a period of two years is granted for the complete restoration of the property registered with the Registro Nacional de la propiedad, Puntarenas registration number CED3, cadastral plan P-1447406-2010, located in the district of Piedras Blancas, Cantón Osa, Provincia de Puntarenas, specifically at horizontal coordinates [Dirección1] and vertical coordinates [Dirección2], LCRS projection, between the riverbed of río Sierpe and Quebrada Solórzano. A final report shall be required from the SISTEMA NACIONAL DE AREAS DE CONSERVACION OSA of MINAE so that a technical report may determine the least invasive method for removing all the oil palms planted at the site, as well as recommendations for managing the reforestation product. Accordingly, the Sistema Nacional de Áreas de Conservación Osa of Minaet is granted a period of six months after this judgment becomes final to issue that technical report. Following those recommendations, the civil defendants shall have the remaining two-year period to ensure that the site has been duly restored or to proceed in accordance with the technical report, depending on whether it recommends reforestation and removal of the oil palm or not. It is placed on the record that the full reading of this judgment is scheduled for SIXTEEN HOURS AND TWENTY-FIVE MINUTES ON NEXT FRIDAY, 30 DE AGOSTO DEL AÑO DOS MIL DIECINUEVE. The accused were asked whether they wished to appear for the reading at the stated time and date or to be notified through their private defense counsel by the designated means; as they stated that they wished to be notified by the designated means and would not appear for the reading, the Court takes note thereof for the appropriate purposes. That is all. It is placed on the record that these proceedings have been recorded in the audiovisual system and that the operative portion of this judgment has been orally communicated to the parties. 2. Attorney [Nombre3] Campos Piedra filed an appeal against the foregoing ruling.
3. After the corresponding deliberation was conducted in accordance with Article 466 of the Código Procesal Penal, as amended by Law 8837, published on nueve de diciembre de dos mil once (Creation of the Appeal from a Judgment), the Court considered the issues raised in the appeal.
4. The relevant legal requirements were observed throughout the proceedings.

Considerations:
I.Because the statutory requirements have been met, the Court shall hear the appeal of the criminal judgment filed by [Nombre3] [Nombre5], private defense counsel for the accused [Nombre6] [Nombre1] [Nombre1] and Special Judicial Attorney-in-Fact for Asociación de Empleados Administrativos de Palma Tica (ASOEPATICO), against Decision number 132-2019, issued at 17:50 hours on 23 de agosto de 2019 by the Tribunal Penal de Osa, Ciudad Cortés, Puntarenas. That judicial ruling acquitted [Nombre7] [Nombre2] [Nombre2] and convicted [Nombre1] of the offense of violating the Ley de Conservación de Vida Silvestre, in the form of wetland drainage, to the detriment of the natural resources. It likewise granted the civil action for damages brought by the Procuraduría General de la República against civil defendant [Nombre1] and ASOEPATICO.
II.On 08 de enero de 2020, an oral hearing was held in these appellate proceedings, with the participation of Judges Max Escalante, substituting for Judge Ivette Carranza Cambronero, who was on vacation, Christian Fernández Mora, and David Fallas Redondo. At that procedural stage, the defense and the Procuraduría General de la República presented their arguments concerning the appeal; however, no additional grounds were presented and no evidence was taken. Accordingly, there is no impediment to the appeal being heard by the present panel, with the participation of Judge Carranza Cambronero, who reviewed the audiovisual recording of that proceeding. The foregoing is pursuant to the ruling of the Sala Constitucional, number 2013-06880, issued at 15:05 on 22 de mayo de 2013.
III.In the first ground raised, private defense counsel alleges disagreement with the assessment of the evidence due to a violation of the rules of rational sound judgment (sana crítica racional) regarding the conviction of the defendant [Nombre6] [Nombre1] [Nombre1] . In his view, the trial court (a quo) relied on mere expansive interpretations, handled the evidence as it pleased without assessing it seriously and objectively, and credited only the prosecution testimony in order to find the accused to be the perpetrator of the acts. He adds that, in her logical reasoning (iter lógico), the judge contradicted herself because, in acquitting [Nombre8] [Nombre2] [Nombre2] , she accepted as true that, after being notified on 13 de setiembre de 2011 that the work had been halted, she duly brought it to the attention of the Board of Directors of ASOEPATICO, which refrained from taking the appropriate measures.
However, there is no evidence that the accused [Nombre1] or any other member of the Board of Directors received any similar notification until 24 de enero de 2012, in the administrative proceeding before the Tribunal Ambiental. On the contrary, on 13 de setiembre de 2011, all members of that association decided to suspend the work until they could determine whether the area was in fact a wetland and whether any permit had to be obtained, as recorded in the corresponding minutes incorporated into administrative case file 8813-2912, which is in the record. He maintains that, in those proceedings, his clients pursued what had been agreed regarding the permits required to obtain approval of the environmental license, which was granted on 21 de diciembre de 2012. Furthermore, according to the complainant, it was only after complying with the orders of the Secretaría Técnica Ambiental that the nature of the soil was determined, and it was through forensic report N. DCF- 2014-03621-BIO that his clients acquired actual and objective knowledge that the area was considered a wetland.
This was confirmed at trial by the testimony of [Nombre6] , a worker with more than seventeen years of experience in dredging activities, who did not consider it a wetland and stated that they had been told it was an area that had been worked by banana companies for years. This is a subject about which the accused has no knowledge whatsoever; the expert witness [Nombre9] himself explained that, to determine that the area was a wetland, it had to be registered as such or satisfy three wetland-identification standards relating to wetlands, hydric soils, and hydrophytic plants, and therefore a study was required. He submits that, although this is an area where a large amount of water accumulates, it has not been established that this is a natural consequence and, therefore, that it is a natural wetland; nor was it determined, even through the studies conducted, that it is a palustrine wetland, which is an essential element of the offense (elemento esencial del tipo).
He argues that, considering the property’s total area of 139 hectares, as of 30 de agosto de 2011, 46 hectares remained to be planted, for which the permit was subsequently granted, but it is unknown when “the 11 in dispute” were planted. According to the defense, by the time the Board of Directors was informed, the channels had already been constructed, and its task was to remove the machinery in compliance with the order, as [Nombre10] , [Nombre11] and [Nombre6] testified. He insists that no new planting was ordered and therefore does not understand the criticism that his client should have recorded a dissenting vote when they were merely complying with the order. The same applies when the judge states that the accused should have ensured that the work did not continue, even though it had already been completed from the outset. As a ground of prejudice, the appellant insists that the defect exists and adds that the reasoning employed sought to apply the theory of control over the act (teoría del dominio del hecho) incorrectly.
He requests that the judgment be declared invalid and that the accused be acquitted of the charged offense because the criminal intent (dolo) required to establish the conduct was lacking. In the fourth ground of his appeal, the interested party challenges the application of substantive law (ley sustantiva). He insists that the judgment fails to address whether the accused could be required to know that a parcel of land was a wetland, when there is no evidence of such knowledge. Nor, he asserts, is there evidence that the accused expressly ordered the appointed individuals William Mora Amador or Miguel Navarro Valverde, or the machinery operators, to drain or dry the area because he knew of its wetland status and because they needed to plant it. On the contrary, the evidence shows that the workers did not even know the accused, since they worked for [Nombre12] and [Nombre13] , who hired personnel to design drainage systems throughout the property, which already had a network of primary, secondary, and tertiary channels dating from the era of the Compañía Bananera.
He adds that an attempt was made to have [Nombre13] explain why he performed the work without the aforementioned permits, but he was deemed a suspect witness and declined to testify. Moreover, according to the appellant, the judge failed to consider that, under Decreto No. 35803-MINAET, the Sistema Nacional de Conservación was responsible only for the protection of wetlands forming part of the Patrimonio Nacional del Estado and declared to be within a protected area; therefore, wetlands not meeting those conditions were not regarded as wetlands. He argues that this wording remained in force from 16 de abril de 2010 until its interpretation was modified by the Sala Constitucional in voto 16938-2011 de 7 de diciembre de 2011, and therefore, on the date of the events, the disputed area was not considered a wetland. The defense concludes that, for that reason, this case involves a mistake of law (error de prohibición) or a lack of statutory correspondence (falta de tipicidad).
Furthermore, the inspection conducted by the judge during the trial establishes that the area was not drained or dried because it retains the characteristics of a wetland. He states that the prejudice caused is the very defect alleged and again requests the criminal and civil [Nombre14] of his client. The complaints are upheld and, because their content is identical, are resolved jointly. Although the appellant raises two issues in an intermingled manner, concerning the judgment’s lack of legal and evidentiary reasoning (fundamentación jurídica y probatoria), he is correct on only one of the challenged points, as explained below. The appellant understands—and also insisted at the oral hearing—that, at the time the investigated events occurred, it could be inferred from Article 1 of Decreto Ejecutivo 35803-MINAET that SINAC administered only wetlands forming part of the Patrimonio Natural del Estado and located in a protected area, meaning that artificial wetlands did not require a permit from the Ministerio de Energía y Minas (MINAE).
He states that this wording remained in force until, subsequently, through resolution number 16938-11 de 7 de diciembre de 2011, the Sala Constitucional interpreted it otherwise and that, although a new decree, Decreto Ejecutivo number 35803, was issued in response to the position of that highest constitutional body, some confusion existed because only wetlands located in protected areas were considered wetlands. However, this Tribunal finds that the complainant is attempting to impose his own position in opposition to the constitutional case law he cites, since the referenced precedent leaves no doubt that wetlands have been subject to state protection, under the responsibility of SINAC, since the issuance of the Decreto Ejecutivo in question, dated 7 de enero de 2010, and remain so to the present day. First, Article 98 of Ley de Conservación de la Vida Silvestre provides, insofar as relevant: “…Anyone who, without prior authorization from the Sistema Nacional de Áreas de Conservación, drains, dries, fills, or eliminates lakes, non-artificial lagoons, or any other wetlands, whether or not officially declared as such, shall be punished by imprisonment for one (1) to three (3) years.” Article 40 of Ley Orgánica del Ambiente, in turn, provides: “Wetlands are ecosystems dependent on aquatic regimes, whether natural or artificial, permanent or temporary, lentic or lotic, fresh, brackish, or saline, including marine areas extending to the outer boundary of seagrasses or coral reefs or, in their absence, to a depth of six meters at low tide.” Likewise, Convención de Ramsar, approved by Ley N. 7224 de 9 de abril de 1991, defines wetlands in Article 1 as follows: “…wetlands are areas of marsh, fen, peatland, or water, whether natural or artificial, permanent or temporary, with water that is static or flowing, fresh, brackish, or saline, including areas of marine water whose depth at low tide does not exceed six meters…”.
In this case, it must be established at the outset that forensic expert examination (pericia forense) number DCF: 2014-03621-bio DE 5 de diciembre de 2014, performed by Guillermo [Nombre15] , an official of the Sección de Biología Forense of the Departamento de Ciencias Forenses, concluded that the land under study is a wetland. Now, the aforementioned resolution number 16938-11 of the Sala Constitucional addressed a constitutional challenge (acción de inconstitucionalidad) against Articles 1, 2, and 3 of Decreto Ejecutivo No. 35803-MINAET, dated 07 de enero de 2010, entitled “Criterios Técnicos para la Identificación, Clasificación y Conservación de Humedales.” The first provision states, as it still does today: “…Article 1—General Considerations. Wetland ecosystems, whether or not created by decree or law and regardless of their ownership, must be protected and conserved; MINAET, through the Sistema Nacional de Áreas de Conservación and pursuant to national and international law, shall ensure their conservation.
However, only wetlands forming part of the Patrimonio Natural del Estado shall be administered by SINAC.” In response, the constitutional court held: “…An examination of this provision discloses nothing contrary to constitutional law (Derecho de la Constitución). In this regard, the provision correctly states that all wetland ecosystems, regardless of their ownership, must be protected by the Administration, and it also correctly states that only wetlands forming part of the State’s natural heritage—because they satisfy the legal requirements for inclusion therein—must be administered by that public system. This means that wetlands located on private property cannot be administered by the State, although it must be recalled that they are subject to a constitutionally mandated protective restriction…”. In other words, contrary to the appellant’s understanding, it is not true that the wording of the provision had to be clarified by the Sala Constitucional or that any confusion exists in that regard, since the provision itself imposes on SINAC the duty to protect every type of wetland and to administer only those located within the Patrimonio Natural del Estado.
This makes sense, as the Sala states, because the State cannot exercise administrative authority, strictly speaking, over wetlands located on private property. It follows that the State retains the power to grant permits to third parties for the exploitation or use of wetlands, as a consequence of the Administration’s duty to ensure the protection and conservation of wetlands, even when they are located on private property.
Now, it is true that the same constitutional ruling partially declared articles two and three of the decree in question unconstitutional, insofar as they established that the inland and marine wetland ecosystems (ecosistemas de humedales continentales y marinos) forming part of the State’s Natural Heritage (Patrimonio Natural del Estado) are only those that have been designated as a Protected Wildlife Area (Área Silvestre Protegida). However, the restriction specifically applies to State-owned property, not to property held by private individuals, as the ruling provides that: “…both provisions are legally erroneous and constitute a threat to the right to a healthy and ecologically balanced environment, established in article 50 of the Constitution, because—first— it is not true that the wetland ecosystems forming part of that public heritage are only those designated as a Protected Wildlife Area.
This is because formal legislation determines the characteristics of the areas forming part of that heritage, since, as indicated above, all wetlands located on State-owned property are included in that heritage, given that they are classified as forest lands (terrenos forestales); and, in the case of mangroves or salt forests (bosques salados) and estuaries (esteros), because they form part of the public area of the maritime-terrestrial zone (zona marítimo terrestre), they constitute a forest reserve (reserva forestal). Accordingly, pursuant to article 13 of Ley Forestal, No. 7575 of February 13, 1996, as amended, they form part of the State’s Natural Heritage…”.
Thus, where a wetland (humedal) is exploited within a property whose owner is not the State, it is clear that the corresponding permits should have been obtained from SINAC. In the case before us, the defendant is specifically alleged to have proceeded, on 30 de agosto de 2011, to drain and dry a wetland without the respective SINAC permits, on a property registered in the name of ASOEPATICO, across a large portion thereof and also in an area that the parties refer to as the “punta de plancha,” near two rivers. Thus, from the standpoint of objective statutory classification (tipicidad objetiva), the objective elements of the offense are, in principle, present. This explains the defendant’s statements that, following the intervention of MINAE, which ordered that the work be halted, steps were taken to obtain the corresponding permits, which were granted for the entire area except the zone near the rivers.
In this regard, it should be noted that it was charged and proven that the property in question contains a palustrine wetland (humedal palustrino) between the channel of the Sierpe River and the Solórzano stream, known as the Heredia canal, covering an area of approximately 11.8512 hectares, corresponding to 118.512 meters, upon which the defendant’s unlawful action was carried out. Likewise, the accused is alleged to have constructed seven canals, work that was halted by MINAE officials and that, subsequently, on 23 de setiembre de 2011, the defendant and his associates continued their criminal conduct by planting oil palm throughout the entire property.
Notwithstanding the foregoing, the appellant is correct regarding the determination of the subjective element (elemento subjetivo) of the conduct of the defendant [Nombre1], since his responsibility for the acts was erroneously inferred solely from his status as President of the Board of Directors of ASOEPATICO, the owner of the property. In this regard, the trial judge faulted him for having hired the personnel who drained the land and carried out the illegal logging (tala ilegal), “without any responsibility to record a dissenting vote (salvar el voto), when it became final through the minutes of the Board of Directors” (see page 128 of the judgment). However, on the one hand, the judgment overlooks, as the appellant argues, that none of the [Nombre16] whose testimony was received, and who worked as employees of ASOEPATICO, stated that they were under the direct orders of [Nombre1]. On the contrary, none of the [Nombre16] [Nombre10], [Nombre6], and [Nombre11] were under the command of the defendant [Nombre1]; instead, they mentioned other persons, such as [Nombre18] (a defendant declared absent), or a gentleman named Rafael, who has since died.
They even agreed that these persons had always told them or led them to believe that they had the permits to exploit the land (see pages 66, 67, 81 and 109 of the judgment). On the other hand, the minutes of the Board of Directors of the entity in question, which the judge cited when referring to the [Nombre14] of the co [Nombre7] [Nombre20], were also disregarded as to their complete content, since nowhere did they state that the defendant had been expressly informed that the land on which the progress of the oil-palm planting was authorized and managed was in fact a wetland, much less that he had directly ordered its use without the respective administrative permits. Nor can it be concluded with certainty that he should have inferred this merely from being informed of the use of tractors, since it was likewise not established that he possessed specialized knowledge of the matter. This is reflected in the minutes appearing at pages 571 to 591 of the main case file.
Moreover, the judge failed to consider that the minutes of 13 de enero de 2011, appearing at page 571 of the physical case file, stated that the Board of Directors had entrusted the planting work to [Nombre12] and [Nombre13]. In this regard, they state:
“Article seven: management of preparations for planting at the Salamá property; Mr. Navarro observes that the land must be prepared before winter begins. Planning and surveying of the land must begin. The supplies needed to perform the fieldwork are arranged through Palma Tica, and they charge it (sic) to the Mortgage that must be signed for the plants plus the cost of the supplies. It is agreed to authorize Mr. Navarro and [Nombre18] to manage preparations for planting at the Salamá property, negotiations with the company (Palma Tica), and the evaluation of contracts to perform surveying work, land assessment, planting, and any other work that may be warranted. Each month, a report on how planting work is progressing at the Salamá property shall be presented at the meeting of the Board of Directors. Resolution 269…” Certainly, the assessment of the factual information omitted from the judgment was essential to the formulation of its operative provisions and could have led to a conclusion different from the one reached.
Furthermore, this court cannot overlook the fact that the trial judge reasoned throughout the judgment that the defendant should have recorded a dissenting vote and supervised the work and that, by failing to do so, he must bear the consequences—page 136 of the judgment—thus framing the argument around an omission (conducta omisiva) by the perpetrator, which was not charged in this case. Instead, as stated above, the accusation attributes to the defendant the commission of active intentional conduct (conducta dolosa activa). Consequently, the reasoning employed in the judgment is also inconsistent for this reason.
Accordingly, the first and fourth grounds of the appeal are granted. The challenged judgment is vacated with respect to the criminal liability of the accused [Nombre1]. The case is remanded (reenvío) to the court of origin so that a newly constituted panel may conduct a new trial. The civil judgment entered in the proceedings meets the same fate, since the applicable basis for attribution was subjective civil liability (responsabilidad civil subjetiva), that is, liability arising exclusively from the defendant’s participation in the punishable act. In all other respects, the judgment remains undisturbed, namely, with respect to the [Nombre14] [Nombre2] and the order concerning restoration of matters to the condition in which they existed before the act under investigation, neither of which was challenged. Regarding this last point, it should be noted that it is supported by the second paragraph of Article 98 of the Ley de Conservación de Vida Silvestre, which establishes the criminal offense (tipo penal) under consideration and provides: “...Furthermore, the offender shall be required to restore matters to the condition in which they existed before the work affecting the wetland began; for this purpose, the Sistema Nacional de Áreas de Conservación is authorized to carry out the corresponding work, but at the offender’s expense...” Consequently, the decision adopted constitutes a direct application of the regulations governing this matter and, because it was not challenged, as stated above, it must become final.
IV.In the second ground, the appellant alleges an erroneous assessment of the evidence concerning the civil judgment. Likewise, in the third claim, he alleges a lack of descriptive and legal reasoning regarding the accused’s intentional participation (participación dolosa). In view of the manner in which the matter is resolved, no ruling is issued on these points because it is unnecessary.

The first and fourth grounds of the appeal against the judgment filed by [Nombre3] [Nombre5], private defense counsel for the defendant [Nombre6] [Nombre1] [Nombre1] and Special Judicial Attorney-in-Fact of the Asociación de Empleados Administrativos de Palma Tica (ASOEPATICO), are granted. Recurso de apelación de sentencia penal interpuesto en la presente causa seguida contra [Nombre1] , mayor, nacido el seis de febrero de mil novecientos setenta y cuatro, con cédula de identidad número CED1 - - ; [Nombre2] mayor, nacida el veintitrés de abril de mil novecientos ochenta y cuatro, con cédula de identidad número CED2 - - ; y Asociación de Empleados Administrativos de Palma Tica; por el delito de Infracción a la Ley de Conservación de vida silvestre en la modalidad de drenaje de humedal, en perjuicio de Los Recursos Naturales. Intervienen en la decisión del recurso la jueza Ivette Carranza Cambronero, así como, los jueces Christian Fernández Mora y David Fallas Redondo. Se apersonó en apelación el licenciado [Nombre3] Campos Piedra en calidad de defensor particular del imputado [Nombre1] y Apoderado Especial Judicial de la Asociación de Empleados Administrativos de Palma Tica.
Resultando:
1. Que mediante sentencia número 132-2019 de las diecisiete horas cincuenta minutos del veintitrés de agosto de dos mil diecinueve, el Tribunal de Juicio de Osa, Ciudad Cortés, Puntarenas, resolvió: "POR TANTO: De conformidad con lo expuesto, artículos 39 y 41 de la Constitución Política, 35, 261 del Código Penal; 98 de la Ley numero 7317; 1, 9, 360, 361, 363, 364, 365, 366 del Código Procesal Penal, SE ABSUELVE DE TODA PENA Y RESPONSABILIDAD a [Nombre2] , por el delito de INFRACCION A LA LEY DE CONSERVACIÓN DE VIDA SILVESTRE EN LA MODALIDAD DE DRENAJE DE HUMEDAL, en perjuicio de LOS RECURSOS NATURALES. Son los gastos del proceso a cargo del Estado. Con relación al CO-IMPUTADO [Nombre1] , de conformidad con lo expuesto y artículos 39 y 41 de la Constitución Política, 8 inciso 1) de la Convención Americana de los Derechos Humanos, 10 de la Declaración Universal de los Derechos Humanos, 9 inciso 2) del Pacto Internacional de Derechos Civiles y Políticos, 1, 11, 30, 45, 59 a 63, 71 a 74, del Código Penal, 98 inciso a) de la Ley número 7317, denominada, Ley de Conservación de Vida Silvestre, y 124, de las Reglas Vigentes sobre Responsabilidad Civil del Código Penal de 1941, según Ley número 4891, del 8 de noviembre de 1971, 1045, del Código Civil, 1 a 15, 184 y siguientes, 265, 341 a 372, del Código Procesal Penal, 17 y 44, del Arancel de Profesionales en Derecho, Decreto Ejecutivo número 20307–J, se declara a [Nombre1] autor único y responsable de un delito de INFRACCIÓN A LA LEY DE CONSERVACIÓN DE VIDA SILVESTRE EN LA MODALIDAD DE DRENAJE DE HUMEDAL, cometido en perjuicio de los RECURSOS NATURALES, y en virtud de ello se le impone una pena de UN AÑO DE PRISIÓN. Dicha pena la deberá descontar el sentenciado, previo abono de la preventiva sufrida si la hubiere, en el lugar y forma que determinen los reglamentos penitenciarios. Por calificar para ello y al amparo de lo dispuesto por el artículo 59 y siguientes del Código Penal, se le otorga el beneficio de EJECUCIÓN CONDICIONAL DE LA PENA, por un período de prueba de TRES AÑOS en el entendido de que si comete nuevo delito doloso sancionado con pena de prisión superior a los seis meses el Tribunal le revocará el beneficio que ahora le concede. Remítanse los testimonios de estilo ante el Instituto Nacional de Criminología y al Juez(a) de Ejecución de la Pena e inscríbase en el Registro Judicial. Son los gastos del proceso a cargo del Estado. Asimismo, se declara con lugar la acción civil resarcitoria, establecida por el Procurador General de la República, en representación del Estado en contra de los demandados civiles [Nombre1] Y SOLIDARIAMENTE A LA ASOCIACION DE EMPLEADOS ADMINISTRATIVOS DE PALMA TIVA ASOEPATICO condenándose, a éstos últimos a hacerle pago al primero de las siguientes partidas. Por concepto de daño patrimonial, social y ambiental causado, la suma de VEINTE MILLONES OCHOCIENTOS TREINTA Y SEIS MIL COLONES CON CIEN CENTÍMOS COLONES. Así como al pago de intereses al tipo fijado, (Tasa Pasiva), por el Banco Central sobre el monto acordado en concepto de daño ambiental, a partir de la firmeza de esta sentencia y hasta su efectiva cancelación. Se rechaza la petición de condenatoria en abstracto solicitado por la Procuraduría General de la República, en cuanto a que la oportunidad para peticionar dicha condenatoria ya precluyó en la Audiencia Preliminar, esto en razón de que al concretar pretensiones por parte de dicho petente fue por el monto otorgado. EN CUANTO A LA MEDIDA CAUTELAR SOLICITADA: Según lo que establece el artículo 140 de nuestro Código Procesal Penal y a solicitud del Ministerio Público y la Procuraduría General de la Republica, se ordena el restablecimiento de las cosas al estado que tenían antes del hecho, para lo cual se otorga el plazo de dos años en los cuales se haga el restablecimiento total de la finca inscrita en el Registro Nacional de la propiedad partido de Puntarenas número CED3, plano catastrado P-1447406-2010, ubicada en el distrito de Piedras Blancas, Cantón Osa, de la Provincia de Puntarenas, específicamente en las coordenadas horizontales [Dirección1] y verticales [Dirección2], proyección LCRS, entre el cauce del río Sierpe y la Quebrada Solórzano, para lo cual se requerirá de un informe definitivo por parte del SISTEMA NACIONAL DE AREAS DE CONSERVACION OSA del MINAE para que mediante informe técnico se determine la forma menos invasiva para proceder con la eliminación de la totalidad de la palma aceitera que se sembró en el sitio, así como las recomendaciones del manejo del producto de la reforestación. Razón por la cual se otorga un plazo de seis meses posterior la firmeza de la presente sentencia para que el Sistema Nacional de Áreas de Conservación Osa del Minaet, emita dicho informe técnico, ahora bien, posterior a dichas recomendaciones cuentan los demandados civiles con un término de dos años restantes para que el sitio haya sido debidamente restaurado ó procedan conforme al informe técnico en caso de que su recomendación sea la reforestaci ón y extracción de la Palma Aceitera o no. Se deja constancia que para la lectura integral de la presente sentencia se señalan las DIECISÉIS HORAS CON VEINTICINCO MINUTOS DEL PRÓXIMO VIERNES 30 DE AGOSTO DEL AÑO DOS MIL DIECINUEVE, habiéndose consultado a los imputados sobre su deseo de presentarse a la lectura en la hora y fecha indicada o su deseo de ser notificado por medio de su defensor particular en el medio señalado y siendo que los mismos manifestaron que se les notificara por el medio señalado y que no se van a presentar a la lectura, toma nota el Tribunal para lo que corresponda. Es todo. Se deja constancia de que lo actuado queda constando en sistema audio video y se ha notificado oralmente la parte dispositiva de la presente sentencia a las partes. NOTIFIQUESE.- Licenciada. Roxana Segura Godoy, Jueza de juicio.-" (sic)
2. Que contra el anterior pronunciamiento, el licenciado [Nombre3] Campos Piedra interpuso el recurso de apelación.
3. Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 466 del Código Procesal Penal, reformado por Ley 8837 publicada el nueve de diciembre de dos mil once (Creación de Recurso de Apelación de la Sentencia), el Tribunal se planteó las cuestiones formuladas en el recurso.
4. Que en los procedimientos se han observado las prescripciones legales pertinentes.
Informa la Jueza Carranza Cambronero, y;
Considerando:
I.Por cumplir con los requisitos legales exigidos, se conoce del recurso de apelación de la sentencia penal incoado por [Nombre3] [Nombre5] , defensor particular del imputado [Nombre6] [Nombre1] [Nombre1] y Apoderado Especial Judicial de la Asociación de Empleados Administrativos de Palma Tica (ASOEPATICO), contra la resolución número 132-2019, de las 17:50 horas, de 23 de agosto de 2019, dictada por el Tribunal Penal de Osa, Ciudad Cortés, Puntarenas. Dicho pronunciamiento judicial absolvió a la [Nombre7] [Nombre2] [Nombre2] y condenó al justiciable [Nombre1] , por el delito de infracción a la Ley de Conservación de Vida Silvestre, en la modalidad de drenaje de humedad, en perjuicio de los recursos naturales. De igual forma, declaró con lugar la acción civil resarcitoria incoada por la Procuraduría General de la República contra el demandado civil [Nombre1] y ASOEPATICO.
II.El día 08 de enero de 2020, se celebró audiencia oral en este procedimiento de apelación, con la intervención de los jueces Max Escalante, en sustitución de la jueza Ivette Carranza Cambronero que se encontraba disfrutando de vacaciones, Christian Fernández Mora y David Fallas Redondo. En esa oportunidad procesal, la defensa y la Procuraduría General de la República expusieron sus argumentos frente al recurso, sin embargo, no se ampliaron fundamentos ni se evacuó probanza alguna. En virtud de ello, no existe inconveniente para que el recurso sea conocido por la presente integración, con la participación de la jueza Carranza Cambronero, que se impuso del registro audiovisual de esa diligencia. Lo anterior, conforme lo dispuesto por la Sala Constitucional en la resolución número 2013-06880, de las 15:05 de 22 de mayo de 2013.
III.En el primer motivo incoado, el defensor particular alega inconformidad con la valoración de la prueba por violación a las reglas de la sana crítica racional en cuanto a la condenatoria del justiciable [Nombre6] [Nombre1] [Nombre1] . En su criterio, el a quo se basó en meras interpretaciones extensivas, manejó a su antojo la prueba sin valorarla de forma seria y objetiva, dándole credibilidad solo a los testimonios de cargo para tener al acusado como autor de los hechos. Añade, que dentro del iter lógico, la jueza se contradijo puesto que, para absolver a la [Nombre8] [Nombre2] [Nombre2] tuvo por cierto que ella, habiendo sido notificada de la paralización de las obras, el 13 de setiembre de 2011, cumplió con ponerlo en conocimiento de la Junta Directiva de ASOEPATICO, que se abstuvo de tomar las medidas correspondientes. Sin embargo, no existe ninguna prueba de que el acusado [Nombre1] o cualquier otro miembro de la Junta Directiva hubiese recibido notificación similar alguna, sino hasta el 24 de enero de 2012, en el procedimiento administrativo ante el Tribunal Ambiental.
Por el contrario, ese 13 de setiembre de 2011 todos los miembros de esa asociación, tomaron la decisión de suspender las obras hasta poder determinar si en efecto la zona era un humedal y si era necesario adquisición de algún permiso, como consta en la respectiva acta que se incorporó al expediente administrativo 8813-2912, que consta en autos. Aduce que, en ese procedimiento sus representados gestionaron lo acordado, en cuanto a los permisos para obtener la viabilidad de la licencia ambiental, que fue concedida el 21 de diciembre de 2012. Además, según el quejoso, fue solo luego de cumplir con lo ordenado por la Secretaría Técnica Ambiental, fue que se determinó la naturaleza del suelo y con el dictamen criminalístico N. DCF- 2014-03621-BIO, que sus representados tuvieron conocimiento real y objetivo de que el área es considerada un humedal. Lo que se ratificó durante el juicio con el testimonio de [Nombre6] , trabajador con más de diecisiete años de experiencia en actividades de dragado, para quien no era un humedal, y quien dijo que se les dijo que era una zona que por años había sido trabajado por bananeras.
Se trata de una materia en la cual el acusado no tiene ningún conocimiento, el mismo perito [Nombre9] explicó que para determinar que la zona era un humedal, era indispensable que estuviera registrado o cumpliera con tres normas de identificación de humedales, suelos hídricos y plantas hidrófilas, por lo que debía existir un estudio. Opina, que aunque se trata de una zona en la que se concentra gran cantidad de agua, no ha quedado claro que eso sea una consecuencia natural y por ende, se trate de un humedal natural, ni siquiera con los estudios realizados, ni se definió que se trate de un humedal palustrino y ese es un elemento esencial del tipo. Argumenta, que tomando en cuenta el área total de la finca de 139 hectáreas, para el 30 de agosto de 2011, faltaban de sembrar 46 hectáreas, sobre las que luego se concedió el permiso, pero no se sabe en qué momento se sembraron “las 11 en disputa”.
Para la defensa, para cuando se informó a la Junta Directiva ya estaban hechos los canales y su tarea fue retirar la maquinaria para cumplir con lo ordenado, según lo declararon [Nombre10] , [Nombre11] y [Nombre6] . Insiste en que no fueron ordenadas nuevas siembras, por lo que no entiende que se reproche que su representado debía salvar el voto si solo estaban acatando lo ordenado. Lo mismo, cuando la juzgadora afirma que el acusado debió cerciorarse que no se continuaran con las obras, pero estas ya estaban concluidas desde el primer momento. Como agravio, el recurrente insiste en la existencia del vicio y añade que, de la forma que argumenta, se pretendió aplicar la teoría del dominio del hecho en forma incorrecta. Solicita se declare la invalidez del fallo y se absuelva al acusado del delito atribuido por la falta de dolo necesario para la configuración de la conducta. En el motivo cuarto de su impugnación, el interesado cuestiona la aplicación de la ley sustantiva.
Insiste en que la sentencia es omisa en cuanto a que al acusado le fuera exigible tener conocimientos de que un terreno es un humedal, cuando no existe tampoco prueba de ello. Tampoco, afirma, existe prueba de que el endilgado hubiese ordenado expresamente a los señores comisionados William Mora Amador o Miguel Navarro Valverde, o a los encargados de la maquinaria que drenaran o secaran el área por tener conocimiento de su calidad de humedad y porque necesitaban sembrar. Por el contrario, la prueba arroja que los trabajadores ni siquiera conocían al encartado, pues trabajan para [Nombre12] y [Nombre13] , que contrataron personal en el diseño de drenajes en la totalidad de la finca, que ya tenía una red de canales primarios, secundarios y terciarios que datan del a época de la Compañía Bananera. Agrega que se trató de que [Nombre13] explicara por qué hizo las tareas sin los citados permisos, pero fue considerado testigo sospechoso y se abstuvo de declarar.
Por otra parte, según el recurrente, la jueza no tomó en cuenta que conforme al Decreto No. 35803-MINAET el Sistema Nacional de Conservación, solo le correspondía la tutela de humedales constituidos dentro del Patrimonio Nacional del Estado, declarados dentro de una zona protegida, por lo que aquellos que no estaban en esa condición no eran considerados humedales. Argumenta que esa redacción estuvo vigente desde el 16 de abril de 2010, hasta que su interpretación fue modificada por la Sala Constitucional en el voto 16938-2011 de 7 de diciembre de 2011, por lo que, para la fecha de los hechos, la zona en conflicto no era considerada humedal. Concluye, la defensa que, por esa razón, existe en la especie un error de prohibición o una falta de tipicidad. Además, con la inspección que realizó la jueza durante el juicio, se acredita que la zona no sea drenado o secado porque mantiene las características de humedal.
Indica que el agravio causado es el vicio mismo que alega y de nuevo solicita la [Nombre14] penal y civil de su representado. Las quejas se declaran con lugar y, por su contenido idéntico, se resuelven de forma conjunta. A pesar de que dos son los temas que plantea el recurrente, de forma entremezclada, referidos a la falta de fundamentación jurídica y probatoria del fallo, solo lleva razón en uno de los aspectos que impugna, según se dirá. Quien recurre, entiende -insistió en eso también durante la audiencia oral celebrada-, que para el momento en que ocurrieron los hechos investigados, del artículo primero del Decreto Ejecutivo 35803-MINAET, se intuía que el SINAC solo administraba los humedales constituidos dentro del Patrimonio Natural del Estado y en una zona protegida, o sea, que los humedales artificiales no necesitan permiso del Ministerio de Energía y Minas (MINAE). Indica que, esa redacción estuvo vigente hasta que, posteriormente, mediante resolución número 16938-11 de 7 de diciembre de 2011, la Sala Constitucional interpretó lo contrario y que, si bien ante la posición de ese máximo órgano constitucional, se dictó uno nuevo, el Decreto Ejecutivo número 35803, existía cierta confusión porque solo se consideraban humedales aquellos ubicados en zonas protegidas.
Sin embargo, para este Tribunal el quejoso intenta imponer su particular posición frente a la jurisprudencia constitucional que menciona, puesto que, el precedente aludido no da lugar a ninguna duda en cuanto a que los humedales son objeto de protección estatal, a cargo del SINAC, desde el momento de emisión del Decreto Ejecutivo en cuestión, del 7 de enero de 2010 y hasta la actualidad. En primer lugar, desde el artículo 98 de Ley de Conservación de la Vida Silvestre, se dispone en lo que interesa: “…Será sancionado con pena de prisión de uno (1) a tres (3) años, quien, sin previa autorización del Sistema Nacional de Áreas de Conservación, drene, seque, rellene o elimine lagos, lagunas no artificiales y los demás humedales, declarados o no como tales.” Por su parte, el artículo 40 de la Ley Orgánica del Ambiente, indica que: “Los humedales son los ecosistemas con dependencia de regímenes acuáticos, naturales o artificiales, permanentes o temporales, lénticos o lóticos, dulces, salobres o salados, incluyendo las extensiones marinas hasta el límite posterior de fanerógamas marinas o arrecifes de coral o, en su ausencia, hasta seis metros de profundidad en marea baja”.
Igualmente, la Convención de Ramsar, aprobada por Ley N. 7224 de 9 de abril de 1991, define en el artículo primero que: “…los humedales son extensiones de marismas, pantanos, turberas o aguas de régimen natural o artificial, permanentes o temporales, estancadas o corrientes, dulces, salobres o saladas incluyendo las extensiones de agua marina cuya profundidad en marea baja no exceda de seis metros…”. En la especie, debe asentarse desde ahora, mediante pericia forense número DCF: 2014-03621-bio DE 5 de diciembre de 2014, realizada por Guillermo [Nombre15] , funcionario de la Sección de Biología Forense, del Departamento de Ciencias Forenses, se concluyó que el terreno en estudio corresponde a un humedal. Ahora bien, en la resolución mencionada, número 16938-11, de la Sala Constitucional, se conoció de una acción de inconstitucionalidad contra los artículos primero, segundo y tercero del del Decreto Ejecutivo No. 35803-MINAET, del 07 de enero de 2010, denominado “Criterios Técnicos para la Identificación, Clasificación y Conservación de Humedales”.
El primer numeral dispone aún hoy que: “…Artículo 1º—Consideraciones Generales. Los ecosistemas de humedales estén o no creados por decreto o ley, independientemente de quién sea su propietario, deben ser protegidos y conservados el MINAET a través del Sistema Nacional de Áreas de Conservación, al amparo de la normativa nacional e internacional, deberá velar por la conservación de los mismos. Sin embargo, sólo los humedales que están constituidos dentro del Patrimonio Natural del Estado deben ser administrados por el SINAC”. Frente a lo que el tribunal constitucional estableció que: “…Del examen de esa norma no se desprende cuestión alguna contraria al Derecho de la Constitución. En este sentido, el precepto indica correctamente que todos los ecosistemas de humedal, independientemente de quién sea su propietario, deben ser protegidos por la Administración, y en forma correcta también señala, que solo los humedales que forman parte del patrimonio natural del Estado (porque tienen o reúnen los requisitos para integrarlo, por Derecho) deben ser administrados por ese sistema público.
Lo anterior implica que, los que se encuentran en propiedades privadas, no pueden ser administrados por el Estado, aunque debe recordarse que sobre ellos pesa una limitación protectora de carácter constitucional…”. Es decir, contrario a lo que entiende el recurrente, no es cierto que la formulación de la norma debió ser aclarada por la Sala Constitucional y que exista alguna confusión al respecto, puesto que desde la enunciación misma se impone al SINAC la obligación de proteger todo tipo de humedal, y de administrar solo aquellos que se encuentren dentro del Patrimonio Natural del Estado. Lo que tiene sentido, como lo establece la Sala, en la medida en que el Estado no podrá ostentar capacidades de administración -propiamente dichas- sobre aquellos humedales que se encuentren en una propiedad privada. De ahí que, la potestad de otorgar permisos de explotación o de uso de humedales a favor de terceros, la conserva el Estado, como derivación del deber de la Administración de velar por su protección y conservación de los humedales, aun y cuando se encuentren en una propiedad privada.
Ahora bien, es cierto que ese mismo pronunciamiento constitucional declaró inconstitucional parcialmente los artículos dos y tres del decreto en cuestión, al establecer que los ecosistemas de humedales continentales y marinos que forman parte del Patrimonio Natural del Estado no son solo aquellos que cuenten con declaratoria de Área Silvestre Protegida. Sin embargo, la afectación precisamente se refiere a la propiedad estatal, no a aquella en manos de particulares, al disponerse que: “…ambas normas son jurídicamente erróneas y constituyen una amenaza al derecho a un ambiente sano y ecológicamente equilibrado, previsto en el artículo 50 de la Constitución, porque -en primer lugar- no es cierto que los ecosistemas de humedales que forman parte de ese patrimonio público, son solo, los que cuentan con una declaratoria de área silvestre protegida. Lo anterior porque es la ley formal la que determina las características de las zonas que forman parte de dicho patrimonio, ya que, de acuerdo con lo indicado arriba, todos los humedales que se encuentren en propiedades del Estado, integran ese patrimonio, dado que se les clasifica como terrenos forestales, y en el caso de los manglares o bosques salados y los esteros, al ser parte de la zona pública de la zona marítimo terrestre, constituyen reserva forestal, de manera que, conforme con lo dispuesto en el artículo 13 de la Ley Forestal, No. 7575 del 13 de febrero de 1996 y sus reformas, forman parte del patrimonio natural del Estado…”.
De modo que, tratándose de la explotación de un humedal, dentro de un inmueble cuyo titular no es el Estado, es claro que se debieron gestionar los permisos correspondientes al SINAC. En el caso que nos ocupa, precisamente se atribuye al justiciable que, el día 30 de agosto de 2011, procedió a drenar y secar un humedal sin los respectivos permisos del SINAC, en un inmueble a nombre de ASOEPATICO, en una gran extensión del mismo y también en una parte que las partes refieren como “punta de plancha” cerca de dos ríos. De modo que, desde el punto de vista de la tipicidad objetiva, en principio, confluyen los elementos objetivos del tipo. Lo anterior, explica las manifestaciones del imputado en cuanto a que, después de la intervención del MINAE que ordenó la paralización de las obras, se procedió a gestionar los permisos correspondientes que fueron concedidos en toda el área, excepto en la zona cercana a los ríos.
Al punto, conviene reseñar que, se acusó y se demostró que la finca en cuestión posee un humedal palustrino entre el cauce del río Sierpe y la quebrada Solórzano, conocido como canal Heredia, que abarca un área de 11.8512 hectáreas aproximadamente, que corresponden a 118.512 metros, sobre el que recayó la acción ilícita del acusado. De igual forma, se atribuye al sindicado la construcción de siete canales, obras que fueron paralizadas por funcionarios del MINAE y que, posteriormente, el día 23 de setiembre de 2011, el acusado y sus compañeros de acción continuaron con su actuar delictivo, al cultivar la totalidad del terreno con palma aceitera.
No obstante lo expuesto, en lo que sí lleva razón el apelante es en cuanto a la determinación del elemento subjetivo en la conducta del acusado [Nombre1] , pues su responsabilidad en los hechos se derivó erróneamente de su sola condición de Presidente de la Junta Directiva de ASOEPATICO, titular del inmueble. Al respecto, la juzgadora de instancia le reprochó que fue quien contrató el personal para que realizara los drenajes del terreno, realizara la tala ilegal “sin ninguna responsabilidad de salvar el voto, cuando quedó en firme mediante acta de Junta directiva” (cfr. folio 128 de la sentencia). Sin embargo, por una parte, soslaya la sentencia que, como se reclama, ninguno de los [Nombre16] recibidos, que se desempeñaron como empleados de ASOEPATICO, indicó estar bajo las órdenes directas de [Nombre1] . Por el contrario, ninguno de los [Nombre16] [Nombre10] , [Nombre6] , y [Nombre11] se encontraban bajo el mando del acusado [Nombre1] , sino que mencionan otras personas como [Nombre18] (imputado declarado ausente), o un señor don Rafael, que ya murió.
Incluso, coinciden en afirmar que estas personas siempre les dijeron o les hicieron creer que contaban con los permisos de explotación del terreno (cfr. folios 66, 67, 81 y 109 de la sentencia). Por otro lado, las mismas actas de la Junta Directiva de la entidad en cuestión, que fueron reseñadas por la juzgadora al momento de referirse a la [Nombre14] de la co [Nombre7] [Nombre20] , fueron también obviadas en cuanto a su contenido completo, puesto que en ninguna parte se consignó que se informara expresamente al imputado que el terreno cuyo avance de plantación de palma aceitera se autorizó y gestionó era efectivamente un humedal y, menos aún, que ordenase directamente proceder con su uso sin los respectivos permisos administrativos, sin que pueda deducirse con certeza que debió deducirlo simplemente cuando se informó sobre el uso de tractores, puesto que tampoco se acreditó que poseyera conocimientos especializados en la materia.
Así, consta en las actas de folios 571 a 591 del expediente principal. Más aún, la juzgadora omitió considerar que, en el acta de 13 de enero de 2011, visible a folio 571 del expediente material, se consignó que la labor de siembra, la Junta Directiva la encomendó a los señores [Nombre12] y [Nombre13] . Al respecto, se indica:
“Artículo siete: gestión de preparación de siembra de finca Salamá, el Sr Navarro hace la observación de que se deben realizar los preparativos del terreno antes de que comience el invierno. La gestión de planeación, reconocimiento del terreno se debe empezar. Los insumos para la elaboración de trabajos de campo se gestionan por medio de Palma Tica y ellos la carga (sic) a la Hipoteca que se debe firmar por las plantas más el dinero de los insumos. Se acuerda autorizar al Sr Navarro y [Nombre18] la gestión de preparación de la siembra de finca Salamá, negociación con la empresa (Palma Tica), valoración de contrataos para realizar trabajos de levantamiento topográfico, reconocimiento del terreno, siembra y otros que ameritan. Cada mes en sesión de Junta Directiva se presentará un informe de cómo se están llevando las labores de siembra en finca Salamá. Acuerdo 269…” Ciertamente, la valoración de los datos fácticos echados de menos en el fallo, resultaba esencial en la construcción del dispositivo, al punto, que pudo haber conducido a una conclusión distinta a la alcanzada.
Por lo demás, este tribunal tampoco puede pasar por alto, que la persona juzgadora de instancia razonó a lo largo del fallo, que el imputado debió salvar su voto y fiscalizar las labores y que, al no hacerlo, debe asumir las consecuencias -folio 136 de la sentencia-, con lo que se argumenta alrededor de una conducta omisiva del agente, que no fue acusada en la especie. Más bien, la acusación, según se indicó líneas atrás, atribuye al justiciable el despliegue de una conducta dolosa activa. De ahí que el razonamiento empleado en la sentencia resulta también incongruente por este motivo.
Así las cosas, se declaran con lugar los motivos primero y cuarto del recurso interpuesto. Se anula la sentencia impugnada en cuanto a la responsabilidad penal del encartado [Nombre1] . Se ordena el reenvío de la causa al tribunal de origen a fin de que, mediante una nueva integración se proceda a la celebración de nuevo juicio. Igual suerte corre la condenatoria civil ordenada en autos, cuyo criterio de imputación se atribuyó a título de responsabilidad civil subjetiva, sea, derivada exclusivamente de la participación del acusado en el hecho punible. En lo demás, el fallo permanece incólume, sea, en cuanto a la [Nombre14] [Nombre2] y en cuanto a lo dispuesto en relación al restablecimiento de las cosas al estado anterior al hecho investigado, ambos extremos no impugnados. En cuanto a este último punto, conviene indicar que, el mismo encuentra soporte en el párrafo segundo del artículo 98 de la Ley de Conservación de Vida Silvestre, que prevé el tipo penal en estudio, según el cual: “...Además, el infractor será obligado a dejar las cosas en el estado en que se encontraban antes de iniciar los trabajos de afectación del humedal; para ello, se faculta al Sistema Nacional de Áreas de Conservación, a fin de que efectúe los trabajos correspondientes, pero a costa del infractor...”. De ahí que la decisión adoptada constituye la aplicación directa de la normativa en esta materia y, al no haber sido objeto de impugnación, como se adelantó, debe adoptarse su firmeza.
IV.En el segundo motivo, el recurrente reclama errónea valoración de la prueba en relación a la condena civil. Asimismo, en el reclamo tercero, aduce falta de fundamentación descriptiva y jurídica en torno a la participación dolosa del endilgado. Por la forma en que se resuelve, por innecesario, se omite pronunciamiento en cuanto a estos extremos.
Por Tanto:
Se declaran con lugar los motivos primero y cuarto del recurso de apelación de la sentencia incoado por [Nombre3] [Nombre5] , defensor particular del imputado [Nombre6] [Nombre1] [Nombre1] y Apoderado Especial Judicial de la Asociación de Empleados Administrativos de Palma Tica (ASOEPATICO). Se anula la sentencia impugnada en cuanto a la responsabilidad penal del encartado [Nombre1] . Se ordena el reenvío de la causa al tribunal de origen a fin de que, mediante una nueva integración se proceda a la celebración de nuevo juicio. Igual suerte corre la condenatoria civil ordenada en autos, cuyo criterio de imputación se atribuyó a título de responsabilidad civil subjetiva, sea, derivada exclusivamente de la participación del acusado en el hecho punible. En lo demás, el fallo permanece incólume, específicamente, en cuanto a la [Nombre14] [Nombre2] [Nombre2] y en cuanto a lo dispuesto en relación con el restablecimiento de las cosas al estado anterior al hecho investigado, ambos extremos no impugnados. Por innecesario, se omite pronunciamiento en cuanto a los reclamos segundo y cuarto de esta misma impugnación. Hágase saber.
