DORA CRISTINA VARGAS VALVERDE DECISION NO. 1044-F-2020 AGRARIAN COURT. SECOND JUDICIAL CIRCUIT OF SAN JOSÉ.- At eight twenty-one a.m. on October twenty-ninth, two thousand twenty.- POSSESSORY INFORMATION PROCEEDING brought by [Nombre1], of legal age, divorced once, resident of San Carlos, identification card CED1 - - . The PROCURADURÍA GENERAL DE LA REPÚBLICA participates, represented by Lydiana Rodríguez Paniagua, of legal age, single, attorney, resident of Alajuela, identification card CED2 - - , in her capacity as deputy state attorney; and the INSTITUTO DE DESARROLLO RURAL, legal entity identification number CED3 - - - , represented by Marjorie Mayela Madrigal Muñoz, bar membership number twenty-one thousand three hundred forty-two. The proceeding was heard before the Agrarian Court of the Second Judicial Circuit of Alajuela, San Carlos. This Court reviews judgment order (auto de sentencia) 207-2020 on the basis of subject-matter jurisdiction, issued at nine oh-four a.m. on August twenty-seventh, two thousand twenty.
Judge Alvarado Paniagua drafts the opinion; and,
WHEREAS:
I.The ruling issued at 9:04 a.m. on 27 de agosto del 2020 is appealed. That ruling ordered this proceeding closed due to opposition by the State, pursuant to Articles 5 and 8 of the Ley de Informaciones Posesorias, accepting the rationale that titling (titulación) had already been denied in case file EXPN1 because the land forms part of the Parque Nacional Volcán Arenal. (See closure ruling dated 27/08/2020 09:04:26).-
II.The petitioner, [Nombre1], appeals the ruling issued at nine oh-four a.m. on August twenty-seventh, two thousand twenty, arguing that the possessory information proceeding was denied in case file EXPN1 does not mean that the petitioner had not owned the property for many years or that she is no longer the owner of the land for which title is sought. The proceeding must continue so that the title may be approved, and this is a non-contentious proceeding (proceso no contencioso) that does not produce res judicata on the merits (cosa juzgada material), and therefore may be pursued again through this procedure. In the first case file, it was deemed proven that the land for which title is sought is located within the Parque Nacional Volcán Arenal; that the property is entirely covered by forest cover (cobertura boscosa); that it is demarcated by natural boundaries and cleared boundary lines; and that it has been conserved, according to the land-use study (estudio del uso del suelo).
Consequently, it is improper for INDER to argue at this stage that the possessory information proceeding should be denied because the property is within the Parque Nacional Volcán Arenal. It was denied solely because, due to their youth, the witnesses did not provide testimony establishing ten years of possession before the creation of the Park. She therefore requests that the challenged ruling be reversed and that the proceeding continue.- (See appeal brief in file dated 31/08/2020 02:26:38).-
III.Article 5 of the Ley de Informaciones Posesorias provides that the Procuraduría General de la República and the Instituto de Desarrollo Agrario (now Instituto de Desarrollo Rural INDER) shall be treated as parties. Article 8 specifically states: “If, within the periods indicated in Article 5, opposition by the State or IDA arises, the case file shall be ordered closed and the administrative remedies shall be deemed exhausted so that the title claimant may bring an action in the contentious-administrative jurisdiction (vía contencioso-administrativa) against the State or said Institute to litigate the claimant’s rights to avail themselves of the provisions of this law.”.- The quoted provision clearly specifies the effects of opposition by the State or said Institute: namely, that the titling proceeding cannot continue and that recourse must be had to declaratory proceedings (vía declarativa).
Through case law and for reasons of procedural economy (economía procesal), it has been held that such opposition must be substantiated and may not be asserted merely for its own sake; rather, the State entity must explain the grounds for its opposition. In this specific case, the State’s representative states that the land for which title is sought lies within the Parque Nacional Volcán Arenal and that, for this reason, the same proceeding involving the same survey plan (plano) A-2060182-2018 had already been denied in case file EXPN1, with that denial constituting a final ruling on the merits. This opposition does not consist of statements by the Procuraduría concerning factors that must be assessed to determine whether titling should be granted; instead, its arguments assert public-domain status (demanialidad) as the categorical basis for its opposition. How can a property title be approved with knowledge that a dispute exists in which one party says the property is in the public domain (bien de dominio público), while the petitioner asserts that it belongs to her as a private individual?
This legal issue cannot be resolved in these non-contentious proceedings because the adversarial principle (principio de contradictorio) is limited by the very nature of this proceeding. The evidence offered, including technical, testimonial, and documentary evidence, must be presented subject to adversarial safeguards, which are fully available only in ordinary plenary proceedings (proceso de conocimiento ordinario) that would produce res judicata on the merits. Continued insistence on obtaining title to real property for which title was previously denied following an assessment on the merits clearly shows that this procedure is no longer appropriate for litigating a disputed issue such as public-domain status. The proper course is instead to resort to declaratory proceedings to obtain a final ruling with res judicata effect on the merits. Article 178.2 of the Código Procesal Civil, consistent with the aforementioned Article 8, states that if a person entitled to do so opposes the application in a non-contentious proceeding, the proceeding shall be terminated and the parties must litigate their claims in the appropriate forum.
This is because the proceeding would cease to be non-contentious once such a dispute exists. The property title must be recognized and approved unequivocally—that is, clearly and without room for doubt—with indisputable certainty that the person seeking title is the true owner. That is not the case here, because the doubts as to whether the property is in the public domain are well-founded in light of the witness testimony collected in the prior proceeding that denied titling, the judicial inspection (reconocimiento judicial), and the other documentary evidence, given the property’s cartographic and geological location within the Parque Nacional Volcán Arenal. A property title cannot be granted where such questions exist. Declaratory proceedings—that is, plenary proceedings guaranteeing a full adversarial process—are the appropriate avenue, NOT non-contentious proceedings, in which no dispute whatsoever should exist.- The existence of the property right has already been addressed as a disputed issue in a prior proceeding, and that dispute carries over into the present proceeding.
It therefore cannot continue to be litigated through a non-contentious procedure such as the one before us, given the State’s formal and substantiated opposition.- For the foregoing reasons, the challenged ruling issued at nine oh-four a.m. on August twenty-seventh, two thousand twenty, must be affirmed.-
I- The undersigned judge considers that the appealed ruling ordering the closure of the proceeding should be affirmed in view of the grounded opposition (oposición fundada) filed by the State Attorney who appeared in this proceeding, but for reasons different from those set forth in the majority opinion regarding the public-domain status (demanialidad) of property located within protected wild areas (áreas silvestres protegidas) and containing forests. In previous majority decisions, this section of the Tribunal Agrario has held that, pursuant to Article 45 of the Constitución Política, Article 7 of the Ley de Informaciones Posesorias, and decisions of the Sala Constitucional de la Corte Suprema de Justicia, the legislature, in safeguarding the right of ownership over unregistered properties that have been under the control and possession of private individuals as owners, established the legal possibility of registering real property located within protected wild areas and containing forest cover (cobertura boscosa), regardless of the management category established in that part of the national territory.
The foregoing applies provided that it is proven that the person seeking title and the previous possessors, if prior possession is being relied upon, exercised ten years of possession before the property was designated by law or decree as a protected wild area (Article 7 of the Ley de Informaciones Posesorias, which was referred twice for consultation to the Sala Constitucional). It must also be shown that possession was exercised with respect for the natural resources and the balance of the ecosystems existing on the land. In addition, all conditions required by the Código Civil regarding the manner of possession (Articles 285, 286, and 856), the legal requirements of the Ley de Informaciones Posesorias, and the land-use planning (ordenamiento territorial), road, and environmental rules applicable to the specific case must be satisfied. This must be duly established before the corresponding registration may be approved.
Furthermore, it has also been held that the management of natural resources and forests is the responsibility of both the State and all persons residing in the country; therefore, forest species and forest ecosystems may form part of private property and serve the purposes of co-management (comanejo) of environmental elements promoted in various international environmental instruments. In such a case, the exercise of the right of ownership over that real property shall be subject to the restrictions and limitations inherent to land of this nature. II- Likewise, this section of the Tribunal, in a majority decision, had repeatedly held that a ruling denying or approving a possessory information proceeding (información posesoria) lacked the effects of formal res judicata (cosa juzgada formal) that would prevent persons whose applications had been denied from again seeking a registrable title in a subsequent proceeding of the same nature.
That is, through a non-contentious jurisdiction proceeding (proceso de jurisdicción no voluntaria) governed by the repealed Código Procesal Civil, Ley 7130. With respect to proceedings known as non-contentious judicial activity proceedings (procesos de actividad judicial no contenciosa), that Code provided, insofar as relevant to the effect of rulings issued in such proceedings, in Article 822: “This ruling shall not constitute res judicata, even when it has been reviewed by the higher court, except as expressly provided for probate proceedings and divorce or separation by mutual consent.” For that reason, this section of the Tribunal had held that rulings deciding possessory information proceedings did not have the effects of formal res judicata. Generally, no opposition was filed in such proceedings under the terms of Articles 5 and 8 of the Ley de Informaciones Posesorias. III- With the entry into force of the new Código Procesal Civil, Ley 9342, as of 8 de octubre del 2018, the effects of formal res judicata are also expressly established for proceedings referred to in the new statute as non-contentious proceedings (procesos no contenciosos), because Article 64 thereof establishes, as a general rule, the effect of substantive res judicata (cosa juzgada material) for final judgments in ordinary proceedings and the effect of formal res judicata for all other proceedings.
This changed the corresponding rule contained in the former civil procedure code. In this case, the ground on which the prosecuting authority raises its opposition under Articles 5 and 8 is the invocation of formal res judicata with respect to the decision already rendered in the prior proceeding in which the possessory information application was denied. IV- Accordingly, given the change concerning the formal res judicata effect of rulings in non-contentious proceedings, as prescribed by the Código Procesal Civil, Ley 9342, which applies supplementarily to this matter (Article 26 of the Ley de Jurisdicción Agraria), and because the Procuraduría General de la República resorted to the grounded-opposition procedure under Articles 5 and 8 of the Ley de Informaciones Posesorias, the ruling issued at 9:04 a.m. on 27 de agosto del 2020 must be affirmed for the reasons stated herein.
POR TANTO:

VOTO N° 1044-F-2020 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las ocho horas veintiuno minutos del veintinueve de octubre de dos mil veinte.- PROCESO DE INFORMACIÓN POSESORIA promovida por [Nombre1] , mayor, divorciada una vez, vecina de San Carlos, cédula CED1 - - . Interviene la PROCURADURÍA GENERAL DE LA REPÚBLICA, representada por Lydiana Rodríguez Paniagua, mayor, soltera, abogada, vecina de Alajuela, cédula CED2 - - , en su condición de procuradora adjunta; y el INSTITUTO DE DESARROLLO RURAL, cédula jurídica CED3 - - - , representado por Marjorie Mayela Madrigal Muñoz, colegiada veintiún mil trescientos cuarenta y dos. Actúa como abogada directora de la parte actora, la licenciada Denia Vásquez Pacheco, carnet CED4 . Tramitado ante el Juzgado Agrario del Segundo Circuito Judicial de Alajuela, San Carlos. Conoce este Tribunal el auto de sentencia 207-2020 en razón de la materia de las nueve horas cuatro minutos del veintisiete de agosto del dos mil veinte.
Redacta la Jueza Alvarado Paniagua; y,
CONSIDERANDO:
I.Se apela la resolución de las 9:04 horas del 27 de agosto del 2020, misma que resuelve archivar este proceso por oposición estatal conforme lo estipulado en el artículo 5 y 8 de la Ley de Informaciones Posesorias, acogiendo el fundamento que en el expediente EXPN1 ya se había rechazado la titulación pues el terreno forma parte del Parque Nacional Volcán Arenal. (Ver resolución de archivo de fecha 27/08/2020 09:04:26).-
II.La promovente [Nombre1] , apela la resolución de las nueve horas cuatro minutos del veintisiete de agosto del dos mil veinte, argumentando el que se haya rechazado el expediente EXPN1 la información posesoria, ello no significa la promovente no haya sido la dueña desde hace muchos años, y no siga siendo la dueña del terreno que se pretende titular. Debe continuarse con el trámite para que se apruebe el título, y se está ante un proceso no contencioso que no produce cosa juzgada material, por lo que puede volverse a tramitar por esta vía. En el primer expediente se tuvo por demostrado que el terreno a titular se ubica dentro del Parque Nacional Volcán Arenal, que la propiedad tiene cobertura boscosa en su totalidad, que está delimitada con linderos naturales y carriles, que se ha conservado según estudio del uso del suelo, en consecuencia es improcedente que a estas alturas el INDER venga alegando la información posesoria sea rechazada por estar dentro del Parque Nacional Volcán Arenal, y fue rechazada únicamente porque los testigos por razón de su juventud no brindaron una declaración de posesión decenal anterior a la creación del Parque, por lo que solicita se revoque la resolución impugnada y se continúe con el trámite.- (Ver escrito de apelación en archivo de fecha 31/08/2020 02:26:38).-
III.El artículo 5 de la Ley de Informaciones Posesorias, dispone tener como partes a la Procuraduría General de la República y al Instituto de Desarrollo Agrario (hoy Instituto de Desarrollo Rural INDER). Y específicamente el artículo 8 dice: "Si dentro de los términos indicados en el artículo 5, surgiere oposición del Estado o del IDA, se ordenará archivar el expediente y se tendrá por agotada la vía administrativa a efecto de que el titulante pueda accionar en la vía contencioso-administrativa, contra el Estado o dicho Instituto, en discusión de sus derechos a acogerse a las disposiciones de la presente ley" .- Esta norma transcrita, es clara en indicar los efectos de la oposición Estatal o de dicho Instituto, es decir, la imposibilidad de continuar con el trámite de titulación, y acudir a la vía declarativa. Vía jurisprudencial y por economía procesal, se ha interpretado que dicha oposición debe ser fundada, y no indicarse una oposición por la oposición misma, sino que el ente estatal debe explicar las razones de su oposición.
En el caso concreto, la representación estatal indica el terreno que se pretende titular está dentro del Parque Nacional Volcán Arenal, y por tal motivo ya se había denegado este mismo trámite en el expediente EXPN1 con el mismo plano A-2060182-2018, siendo que el rechazo lo fue con pronunciamiento de fondo que ya se encuentra en firme. Esta oposición, no se trata de las manifestaciones de la Procuraduría sobre elementos que deben valorarse para verificar si procede o no la titulación, si no que sus argumentos van dirigidos a que existe demanialidad como afirmación categórica de su oposición. ¿Cómo ha de aprobarse un título de propiedad a sabiendas existe un conflicto donde una parte dice es bien de dominio público, y la promovente aduce le pertenece como particular? No es factible definir dentro de estas diligencias no contenciosas tal situación jurídica, pues el principio de contradictorio es limitado por la naturaleza misma de este proceso.
El ofrecimiento de prueba, como por ejemplo la técnica, testimonial y documental, merece ser practicada bajo la garantía del contradictorio, el cual sólo se desarrolla plenamente en un proceso de conocimiento ordinario, que produciría cosa juzgada material. Seguir insistiendo en titular un bien inmueble donde ya en oportunidad anterior se ha denegado el título con una valoración de fondo, es claro que ya esta vía no es la pertinente para discutir un tema controversial como lo es la demanialidad, sino que lo propio es acudir a la vía declarativa para obtener en definitiva un pronunciamiento con cosa juzgada material. El artículo 178.2 del Código Procesal Civil en consonancia con el citado artículo 8 supra, indica que si a la solicitud del proceso no contencioso, se opusiere alguien con derecho para hacerlo, se dará por terminado el mismo, y las partes deberán discutir sus pretensiones en la vía que corresponda.
Ello por cuanto el proceso no contencioso dejaría de serlo al existir tal controversia. El título de propiedad debe ser reconocido y aprobado de manera diáfana (clara que no deje lugar a dudas), donde de manera indubitable se tenga certeza de quien titula es su verdadero propietario, y ello no ocurre en el caso bajo examen, pues las dudas generadas sobre si es bien de dominio público o no, son dudas fundadas con la prueba testimonial recabada en el proceso anterior que rechazó la titulación, reconocimiento judicial y demás prueba documental, dada la ubicación cartográfica y geológica del inmueble dentro del Parque Nacional Volcán Arenal. No es factible otorgar un título de propiedad donde existen tales cuestionamientos, siendo la vía declarativa (proceso de conocimiento que garantiza el contradictorio de manera amplia) la apropiada, y NO la no contenciosa donde no debe existir controversia alguna.- El análisis sobre la existencia del derecho de propiedad ya se ha resuelto como tema controversial en un proceso anterior, siendo que dicha discusión se traslada al presente, por lo que no podría seguirse su cuestionamiento en un trámite no contencioso como el que nos aquí ocupa, al existir oposición formal y fundada por parte del Estado.- Por lo expuesto, debe confirmarse la resolución impugnada dictada a las nueve horas cuatro minutos del veintisiete de agosto del dos mil veinte.-
I- La suscrita jueza estima ha de confirmarse la resolución recurrida que ordenó el archivo del proceso en virtud de oposición fundada opuesta por la Procuradora apersonada a este proceso, pero por razones diversas a las expuestas en el voto de mayoría respecto a la demanialidad de bienes inmersos en áreas silvestres protegidas y con bosques. Esta sección del Tribunal Agrario, en votos precedentes de mayoría, ha estimado que al tenor del artículo 45 de la Constitución Política, 7 de la Ley de Informaciones Posesorias y votos de la Sala Constitucional de la Corte Suprema de Justicia, el legislador en resguardo del derecho de propiedad sobre fincas no inscritas que han estado bajo dominio y posesión de particulares en condición de personas dueñas, dispuso la posibilidad legal de inscribir inmuebles que se encuentren dentro de áreas silvestres protegidas y contengan cobertura boscosa; sea cualquiera la categoría de manejo instaurada en ese espacio del territorio nacional.
Lo anterior, siempre que se demuestre que la persona titulante y las poseedoras anteriores en caso de que aproveche la posesión previa, han ejercido la posesión decenal anterior de la afectación por Ley o decreto a área silvestre protegida (artículo 7 de la Ley de Informaciones Posesorias consultado en dos ocasiones ante la Sala Constitucional). Y que la posesión hubiera sido desarrollada en respeto de los recursos naturales y el equilibrio de los ecosistemas existentes en el terreno. Además de que se cumplan todas las condiciones exigidas en el Código Civil respecto al modo de la posesión (artículo 285,286 y 856), los requisitos legales de la Ley de Informaciones Posesorias y normas de ordenamiento territorial respecto a caminos y ambientales aplicables al caso concreto. Lo cual debe estar debidamente acreditado para aprobar la inscripción respectiva. Por otra parte, se ha considerado también que el manejo de los recursos naturales y bosques, corresponde tanto al Estado como a todas las personas habitantes del país, por lo que las especies forestales y ecosistemas boscosos, son susceptibles de formar parte de la propiedad privada y cumplir con los fines del comanejo de los elementos del ambiente impulsado en diversos instrumentos internacionales ambientales.
Caso en el cual, el ejercicio del derecho de propiedad sobre ese bien inmueble, estará sujeto a los límites y limitaciones propios de terrenos de esta naturaleza. II- De igual forma, esta sección del Tribunal, en voto de mayoría, había sostenido reiteradamente, que la resolución que denegaba o aprobaba una información posesoria, carecía de los efectos de cosa juzgada formal. Que impidieran a las personas a las que les había denegado su gestión, reiterar la pretensión de obtención de título inscribible en proceso posterior de igual naturaleza. Es decir, mediante proceso de jurisdicción no voluntaria que se encontraba regulado en el derogado Código Procesal Civil, Ley 7130. Dicho código establecía respecto a los procesos denominados de actividad judicial no contenciosa, en lo de interés al efecto de las resoluciones emitidas dentro de esos procesos en el artículo 822: " Esta resolución no producirá cosa juzgada ni aun cuando haya sido objeto de pronunciamiento del superior, salvo lo dispuesto expresamente para el proceso sucesorio y el de divorcio o separación por mutuo consentimiento." Razón por la cual esta sección del Tribunal había sostenido la falta de efectos de cosa juzgada formal en resoluciones que resolvían los procesos de información posesoria.
Y donde generalmente no se interponía una oposición en los términos del artículo 5 y 8 de la Ley de Informaciones Posesorias. III- Con la entrada en vigencia del nuevo Código Procesal Civil Ley 9342 a partir del 8 de octubre del 2018, los efectos de cosa juzgada formal se determinan en forma expresa también para los procesos que en la nueva norma se denominan procesos no contenciosos, pues en el artículo 64 Ibídem se establece como regla general el efecto de cosa juzgada material para las sentencias firmes de procesos ordinarios y para todos los demás procesos, el efecto de cosa juzgada formal. Cambiándo así la regla al respecto contenida en el código del rito civil anterior. En este caso, la causa por la cual se opone en los términos del artículo 5 y 8 el ente procurador, es la invocación de la cosa juzgada formal, respecto a lo ya resuelto en el proceso anterior donde se denegó la información posesoria.
IV- Así las cosas, dado el cambio respecto al efecto de cosa juzgada formal de las resoluciones de procesos no contenciosos según prescribe el Código Procesal Civil Ley 9342, aplicado supletoriamente a esta materia (artículo 26 de la Ley de Jurisdicción Agraria), habiéndose acudido a la vía de oposición fundada del articulo 5 y 8 de la Ley de Informaciones Posesorias la Procuraduría General de la República, ha de confirmarse, por las razones aquí expuestas, la resolución de las 9:04 horas del 27 de agosto del 2020.
POR TANTO:
