At eleven hours and two minutes on veintiséis de octubre de dos mil veinte.

Appeal filed in these proceedings against [Nombre1], an adult, born on veinte de junio de mil novecientos cincuenta y siete, holder of identity card number CED1 - - , for the offense of mining operations, to the detriment of Los Recursos Naturales. Judges Jaime Robleto Gutiérrez and Marco Mairena Navarro and Judge Xiomara Gutiérrez Cruz participated in deciding the appeal. Attorney Ana Marisol Muñoz Prado, representative of the Ministerio Público, and Attorney Randall Aguirre Mena, in his capacity as Procurador Penal, entered appearances in the appeal.

Findings:

1. By judgment 111-2019, issued at eight hours on quince de julio de dos mil diecinueve, the Tribunal de Juicio de Turrialba ruled: “POR TANTO: In accordance with the foregoing; Articles 39 and 41 of the Political Constitution; 10 and 11 of the Universal Declaration of Human Rights; 8, subsection 2, of the American Convention on Human Rights; 14 of the International Covenant on Civil and Political Rights; 26 of the American Declaration of the Rights and Duties of Man; 1, 2, 3, 16, 37, 38, 40, 324, 326, 333, 335, 336, 341, 360, 363, 364, 365, and 366 of the Code of Criminal Procedure; 1, 2, 3, and 141 of the Mining Code (Ley 6797); and 227, subsection 3), of the Criminal Code, this single-judge Court RULES: 1) [Nombre1] is acquitted of all punishment and liability for the offense of Mining Operations and the offense of usurpation of public-domain property (Usurpación de bienes de dominio público), both of which he had been charged with committing to the detriment of Los Recursos Naturales. 2) The civil claim for damages (Acción Civil Resarcitoria) brought by the Produraduría General de la República against [Nombre1] is denied. The termination of any precautionary measure (medida cautelar) ordered in connection with these proceedings is hereby ordered. No special award of costs is entered. 2. Attorney Ana Marisol Muñoz Prado and Attorney Randall Aguirre Mena filed appeals against the foregoing decision.

3. Following the corresponding deliberation in accordance with Article 466 of the Code of Criminal Procedure, as amended by Ley 8837, published on nueve de diciembre de dos mil once (Creation of an Appeal from the Judgment), the Court considered the issues raised in the appeal.

4. The applicable legal requirements have been observed throughout the proceedings.

Whereas:

I.Master Ana Marisol Muñoz Prado, Assistant Prosecutor of Turrialba, pursuant to Articles 41 of the Political Constitution; 71 of the Criminal Code; and 16, 62, 142, 363 subsection c), 369 subsection d), 438, 439, 447, 448, 450, 458, 459, and 460 of the Code of Criminal Procedure, files an appeal (recurso de apelación) against judgment number 111-2019, issued at 8:00 a.m. on 15 de julio de 2019 by the Tribunal de Juicio Penal de Cartago, Turrialba division, whereby [Nombre1] was acquitted of one offense of mining exploitation (explotación minera) and one offense of usurpation of public-service property (usurpación de bienes de servicio público), alleged to have been committed to the detriment of the Natural Resources, and the civil action for damages (acción civil resarcitoria) brought against [Nombre1] was dismissed. As the sole ground of appeal, she alleges a violation of the rules of rational sound judgment (sana crítica racional), particularly the subprinciple of logical derivation (subprincipio de derivación).

The appellant states that the testimony of witnesses [Nombre3], [Nombre4], [Nombre5], [Nombre6], and [Nombre7] was erroneously assessed; serious errors were committed because the evidence was analyzed arbitrarily and piecemeal, through a subjective analysis of the testimony given by those who participated in the investigation that differs from what they actually stated, as shown by the audiovisual record of the trial, and this was precisely what led the court below (a quo) to resolve the case incorrectly. The Public Prosecutor’s Office alleged, in essence, that [Nombre1] owns a property located in Cartago, Turrialba, [Dirección1], adjacent to the Torreluna residential development, and that between marzo del 2011 and principios del 2012, on several occasions and without holding a concession or authorization from the State Mining Administration, he illegally excavated and extracted mineral materials, specifically ballast and gravel, to a depth of approximately two meters along two faces of the excavated area, causing economic environmental damage amounting to eleven million six hundred forty thousand colones.

These acts were classified as constituting Illegal Extraction of Mining Materials, provided for and punishable under Article 141 in relation to Article 2 of the Mining Code, law number 8246 del 24 de abril del 2002. Nevertheless, the Tribunal did not find the defendant responsible because it determined that the accused’s property is some distance from the Santa Rosa property, where the witnesses, the reports submitted, the indictment, and the private criminal complaint (querella) state that the illegal mining extraction occurred. In the Prosecutor’s view, the Tribunal erred because the judge analyzed this issue incorrectly: although, due to a clerical error, the first allegation of the indictment identifies the property where the events occurred as property registration number CED2, which is registered in the name of the accused, the fact remains that the reports submitted by the Dirección de Geología y Minas appearing at pages 1 through 5 and 15 through 21, the MINAE report at page 6, and those of the Organismo de Investigación Judicial at pages 8, 9, and 10 through 14 clearly establish that the location where the events occurred in Santa Rosa is adjacent to the Torreluna residential development.

This circumstance was also confirmed by the witnesses who testified at trial, including [Nombre6], who clearly identified the location where the events occurred in Santa Rosa and stated that Residencial Torreluna is near the site; witness [Nombre3] likewise referred to both circumstances; witnesses [Nombre5] and [Nombre4] also clearly stated that a residential development was under construction near the place where the material was being extracted, although they did not identify it by the name Torreluna. For the appellant, there is no doubt that this is the same geographical location. The appellant alleges that the evidence clearly establishes this, not only the documentary evidence (Report DM -05-SDRT-2011 appearing at page 8), but also the testimony of witness [Nombre6], who stated at trial that, during the investigation, he interviewed [Nombre8], who said that he had been hired by the accused, [Nombre1], to extract material at the site.

The officer also stated that he interviewed [Nombre9], who told him that [Nombre1] had rented his dump truck to extract materials from that property. These witnesses had also been located at the scene and interviewed by officials of the Dirección de Geología y Minas, as appears at page 4, specifically in memorandum DGM-SIGMA-042-2011 del fecha 9 de agosto del 2011. The testimony of [Nombre3] was likewise analyzed in a biased and subjective manner, because the Tribunal discounted the credibility of his account even though [Nombre3] clearly stated that, during the inspection he personally conducted, he located an individual, [Nombre10], who clearly told him that [Nombre1] was the person extracting the material at that location. Similarly, the court below did not state the reasons for discounting the credibility of those witnesses’ testimony and merely asserted that those individuals and their testimony had to be presented at trial in order to establish the accused’s participation in the acts.

In the appellant’s view, all of the foregoing amounts to an inadequate statement of reasons (falta de fundamentación) in the judgment and a failure to consider evidence (preterición de la prueba). The Prosecutor requests that the judgment be vacated and the case remanded (reenvío) for new proceedings. She offers the digital recording of the trial as evidence. Because it is pertinent and given the similarity of the claims, the sole criminal-law claim raised by attorney Randall Aguirre Mena, Criminal Prosecutor of the Procuraduría General de la República, pursuant to Articles 458, 459, and 460 of the Code of Criminal Procedure, is decided jointly. He alleges that the court erred in locating the site where the mining resources were extracted and likewise undertakes a new assessment of the witnesses to conclude that the defendant did order that prohibited action. He also refers to the exclusion of witness [Nombre9], whom the Tribunal erroneously dispensed with.

The claims are well-founded: It must be noted that the trial record forms part of the case file, and therefore it was unnecessary to offer it as evidence, as the appellant did. The Prosecutor’s appeal, moreover, consists of two claims: the first concerns the court below’s finding that property number CED2, registered in the name of defendant, private defendant (querellado), and civil defendant [Nombre1], is not the same property where it was effectively established that the materials at issue had been extracted; the judge even states that there is a significant distance between the two tracts. That first premise, on which the trial judge relied to acquit the defendant, does not correspond to the geographical facts contained in the court record. At page 64 of the PDF document is the indictment filed by the Public Prosecutor’s Office, the first allegation of which states that the site where the alleged criminal conduct was being committed is located at coordinates [Dirección2], [sic].

It is necessary to note that: “Costa Rica uses two metric coordinate systems: LAMBERT: (Full name: Lambert Conformal Conic Secant) This is an older system used to produce Costa Rica’s metric cartography. It is characterized by a secant cone, meaning that it intersects the country at two points (parallels). This results in two Lambert systems, North and South (a). Each of these two grids covers the entire country, but each should be applied only to certain areas. The 1:50000 topographic sheets, which are the country’s official sheets, have this particular feature. For example, the Barva sheet uses the Lambert North coordinate system, whereas the Golfito topographic sheet contains coordinate values in the Lambert South system. (b) Its datum, incidentally, is a local one called Ocotepeque because it is situated in the city of Ocotepeque in Honduras.” … “CRTM05: (Full name: Costa Rica Transverse Mercator 2005) This is a newer system intended to replace Costa Rica’s older metric cartography (Lambert).

It is characterized by a transverse cylindrical projection. It applies to the entire country. Because it has not yet been possible to replace the system on the maps, CRTM05 has instead been added to the cartographic sheets in orange. It can be clearly distinguished from Lambert because its Y-values (Latitude) are close to one million meters. (This is because distance measurement begins at the zero parallel, or equator.) Its datum is a geocentric datum called WGS84 (World Geodetic System 1984).” (COORDINATE SYSTEMS consulted at http://www.edeca.una.ac.cr/images/AplicTop2020/Semana2/Lectura%20Proyecciones.pdf el día 22 de octubre de 2020). It follows from the foregoing that the predominant metric cartography system in Costa Rica is the Lambert system, although it is expected eventually to be replaced by CRTM05. In the private criminal complaint and the civil action for damages, the location where the criminal conduct at issue allegedly occurred is also expressed using Lambert-system geolocation.

Moreover, pages 2, 15, and 74 of the PDF case file contain documents admitted into evidence and incorporated into the trial concerning on-site inspections (inspecciones in situ) conducted where the extraction was taking place, which identify the coordinates as [Dirección3] and [Dirección4] east; when compared with the coordinates stated in the prosecution’s indictment, namely [Dirección5] and [Dirección6] east, they indicate the same location, with a difference that is not significant. Thus, the assertion that property number CED2, registered in the name of defendant, private defendant, and civil defendant [Nombre1], bears no relationship to the site where the offense under investigation was allegedly being committed does not correspond to the geographical facts. This is clearly an error of logical derivation resulting from the failure to interpret the admitted documentary evidence correctly and compare it with the charges filed by the Public Prosecutor’s Office and the Procuraduría General de la República.

Accordingly, establishing the location where the unlawful act was allegedly perpetrated does not require an examination of the witnesses identified by the appellant, but rather an objective metric-cartography analysis such as the one undertaken here. Furthermore, in the prosecution’s indictment and request to commit the case for trial (solicitud de apertura a juicio), the testimony of the following witnesses was offered and subsequently admitted: first, those who testified at trial—Engineer [Nombre3], [Nombre5], and [Nombre6]—while other witnesses offered by other parties also testified at trial, including [Nombre7], [Nombre4], among others.

But the point at issue, which is essential to the claim raised by the prosecutorial representative (representante fiscal) in the appeal (recurso de apelación), is that the appellant contends that: a) the judge discounted the credibility of the account given by [Nombre3], the engineer who conducted the on-site inspection, who stated at trial that he had located an individual named [Nombre10], who clearly told him that [Nombre1] was the person extracting the material at that location; however, because [Nombre10] did not testify and was not included on the witness list, this was deemed sufficient grounds for disbelieving the engineer from the Dirección de Geología y Minas of the Ministerio de Ambiente y Energía, without the adjudicator properly assessing the information itself provided by this witness or considering whether he had any reason to misrepresent the truth. Accordingly, this Court finds that the judge’s reasoning concerning the evidentiary value of this testimony was incomplete and superficial; b) in the challenged judgment, the judge stated that key witnesses were required at trial to establish the accused’s participation in the acts, referring to [Nombre8], who allegedly drove the dump truck used for the extraction, when what occurred with that witness, according to page 297 of the PDF case file, was that the judge himself dispensed with the testimony of that witness, who had been duly admitted for trial, over the objection of the Prosecutor’s Office, which filed a motion for reconsideration (recurso de revocatoria) that was denied on this point.

Furthermore, the other witness referred to by the judge is [Nombre8], who had allegedly been hired by the defendant. As to this witness, page 323 of the PDF case file records that the trial prosecutor stated that he had spoken with the process-serving officer and that the witness could not be located; according to [Nombre8]’s mother, he “is fleeing from justice” because a warrant had been issued for his arrest for failure to pay child support. The judge therefore decided to dispense with the witness, declaring that his testimony could not be obtained (inevacuable), without objection from the parties. Consequently, although the aforementioned witnesses were procedurally dispensed with for valid reasons, what is unacceptable under the rule of logical derivation (regla de la derivación lógica) is that the court below (a quo) failed to consider the testimony of Hugo Lazarus Montero, an agent of the Organismo de Investigación Judicial, regarding what [Nombre9], the owner of the dump truck located at the site, told him (see page 351 of the PDF document).

The judge treated [Nombre9]’s statements as merely hearsay, which is incorrect. Had the judge considered the agent’s testimony in conjunction with the remainder of the evidentiary record (acervo probatorio), and had the statements made by [Nombre9] to officer Hugo Lazarus Montero not been excluded, the correct conclusion would have been that the accused, [Nombre1], owned the property where [Nombre9] was working. [Nombre9] was never identified as a potential defendant and therefore had no right to refrain from testifying (derecho de abstención), as the judge erroneously stated, regardless of the fact that officer Hugo Lazarus Montero subsequently prepared a written report of what he had witnessed. The Criminal State Attorney (Procurador Penal) is therefore correct in his argument. It is evident that the trial court conducted a biased and isolated analysis of the evidence, making a new examination of the case necessary in a retrial on remand (juicio de reenvío).

Consequently, the sole grounds raised by the representative of the Ministerio Público and the Procurador Penal are upheld, both appeals are granted, the challenged judgment is vacated in its entirety, together with the trial that preceded it, and the case is remanded to the court of origin for new proceedings.

II.Attorney Randall Aguirre Mena, Criminal State Attorney (Procurador Penal), pursuant to Articles 458, 459, and 460 of the Código Procesal Penal, files an appeal (recurso de apelación) against judgment number 111-2019 at 8:00 on 15 de julio de 2019, issued by the Tribunal de Juicio Penal de Cartago, sede Turrialba, a ruling whereby [Nombre1] was acquitted of one offense of one offense of mining exploitation (explotación minera) and one offense of usurpation of public-service property (usurpación de bienes de servicio público), charged as having been committed to the detriment of the Recursos Naturales, and the civil damages action (acción civil resarcitoria) brought against [Nombre1] was dismissed. As the sole ground for appeal (motivo de apelación), he alleges a lack of reasoned analysis (fundamentación intelectiva) and an erroneous assessment of the evidence in acquitting the accused and dismissing the civil damages action.

The criminal-law matters supporting the causal link (nexo causal) for the civil claim were already heard and adjudicated in the preceding Considerando; the ruling therein shall govern. He requests that the appeal be granted, that the challenged ruling and the trial preceding it be vacated in their entirety, and that the case be remanded (reenvío) for new proceedings resulting in a new judgment in accordance with law, including a determination concerning the civil damages action. The objection is sustained: Regarding the civil damages action, the challenged ruling, on page 352 of the PDF document, in Considerando IV of the judgment, states verbatim: “Regarding the civil damages action, because that connection or causal link between the damage caused to the natural resources and the accused was not established, given that, as indicated, it was not possible to establish that the property where the unlawful activity was carried out was connected to the defendant, or that he had participated in those acts directly or through an intermediary, it is improper to impose civil liability upon him.

In other words, as previously analyzed, the evidence failed to establish the accused’s participation in the acts in a manner that would even make it possible to determine whether such participation was intentional or negligent and gave rise to his obligation to provide compensation.” Evidently, the premises underlying this scant reasoning were disproved by this appellate judgment, particularly regarding the location where the acts occurred, and the issue of the accused’s liability will be addressed in a new trial on remand; the representative of the Procuraduría General de la República is therefore correct that the dismissal of the civil damages action brought against [Nombre1] lacks reasoned analysis. Accordingly, the appeal filed by Attorney Randall Aguirre Mena, Criminal State Attorney, is granted in all respects. The challenged judgment is vacated, and the case is remanded to the court of origin for new proceedings that shall include a new ruling concerning the civil damages action.

III.Note by Judge Gutiérrez Cruz. Regarding the ruling in Considerando I, I concur with my fellow judges’ vote that the appeals filed by the Ministerio Público and the Procuraduría General de la República must be granted, but I consider it necessary to briefly specify the reasons for that decision. Among the objections raised by the State Attorney is the failure to analyze the testimony of witness [Nombre7], which is essential and was not taken into account by the trial judge in the ruling, as the judge merely stated in general terms that this witness had provided nothing relevant concerning the acts. As the appellant asserts, although that witness was evasive, he did state that he worked for the accused and also identified him as the owner of the machinery—matters that would have enabled the trial judge to resolve the doubt on which the acquittal was based and that, because they were omitted, prejudice the interests of the prosecuting parties (actores penales).

Those statements, together with the information derived from the documents and the testimony of officials from the Organismo de Investigación Judicial and the Ministerio de Obras Públicas y Transportes, should have been assessed jointly. It must be made clear that the proposal is not to use the contents of the police reports concerning witness statements or to introduce them indirectly, since doing so would violate the principles of oral proceedings, immediacy, and adversarial proceedings (principios de oralidad, inmediación y contradictorio). What may be weighed, however, is the officers’ and the MOPT official’s live testimony concerning the results of the investigations and the information they gathered, including information about who owned the property and the machinery and who had ordered the work. This should have been weighed together with the information relating to ownership and the statements made by [Nombre7], and would have made it possible to reach different conclusions. The defect in the reasoning therefore arose because the Tribunal truncated the evidence and also analyzed the information derived from it in isolation; consequently, the appellants are correct.

POR TANTO

The appeals filed by the Fiscalía and the Procuraduría General de la República are granted in all respects. The challenged judgment is vacated in its entirety, as is the trial that preceded it. The case is ordered remitted to the court of origin for new proceedings in accordance with law. Judge Gutiérrez Cruz submits a note. Let notice be served.

Documento PJEDITOR Contra: [Nombre1] Delito: Explotación minera Ofendido: Los Recursos Naturales Res: 2020-630 Tribunal de Apelación de Sentencia Penal de Cartago, Sección Segunda. A las once horas dos minutos del veintiséis de octubre de dos mil veinte.

Recurso de apelación interpuesto en la presente causa seguida contra [Nombre1] , mayor, nacido el veinte de junio de mil novecientos cincuenta y siete, con cédula de identidad número CED1 - - , por el delito de Explotación minera, en perjuicio de Los Recursos Naturales. Intervienen en la decisión del recurso los jueces Jaime Robleto Gutiérrez y Marco Mairena Navarro y la jueza Xiomara Gutiérrez Cruz. Se apersonaron en apelación la licenciada Ana Marisol Muñoz Prado, representante del Ministerio Público, y el licenciado Randall Aguirre Mena, en su condición de Procurador Penal.

Resultando:

1. Que mediante sentencia 111-2019 de las ocho horas del quince de julio de dos mil diecinueve, el Tribunal de Juicio de Turrialba, resolvió: "POR TANTO: Conforme a lo expuesto, artículos 39 y 41 de la Constitución Política, 10 y 11 de la Declaración Universal de Derechos Humanos, 8 inciso 2 de la Convención Americana de Derechos Humanos, 14 del Pacto Internacional de Derechos Civiles y Políticos; 26 de la Declaración Americana de Derechos y Deberes del Hombre; 1, 2, 3, 16, 37, 38, 40, 324, 326, 333, 335, 336, 341, 360, 363, 364, 365, 366 del Código Procesal Penal, 1, 2, 3, 141 del Código de Minería (Ley 6797) y 227 inciso 3) del Código Penal; este Tribunal Unipersonal RESUELVE: 1) Se absuelve de toda pena y responsabilidad a [Nombre1] de un delito de Explotación Minera así como de un delito de Usurpación de bienes de dominio público, que en daño de Los Recursos Naturales, se le venía atribuyendo. 2) Se declara sin lugar la Acción Civil Resarcitoria incoada por la Produraduría General de la República contra [Nombre1] . Se ordena el cese de cualquier medida cautelar que se hubiese decretado con relación al presente proceso. Se resuelve sin especial condenatoria en costas. MEDIANTE LECTURA, [Nombre2].- Luis Carlos Castro Araya, Juez de Juicio. (sic)."

2. Que contra el anterior pronunciamiento, la licenciada Ana Marisol Muñoz Prado y el licenciado Randall Aguirre Mena interpusieron los recursos de apelación.

3. Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 466 del Código Procesal Penal, reformado por Ley 8837 publicada el nueve de diciembre de dos mil once (Creación de Recurso de Apelación de la Sentencia), el Tribunal se planteó las cuestiones formuladas en el recurso.

4. Que en los procedimientos se han observado las prescripciones legales pertinentes.

Redacta el Juez Robleto Gutiérrez, y;

Considerando:

I.La Master Ana Marisol Muñoz Prado, Fiscal Auxiliar de Turrialba, con fundamento en los artículos 41 de la Constitución Política; 71 del Código Penal; 16, 62, 142, 363 inciso c), 369 inciso d), 438, 439, 447, 448, 450, 458, 459, 460, del Código Procesal Penal; interpone recurso de apelación contra la sentencia número 111-2019 de las 8:00 horas del 15 de julio de 2019, dictada por el Tribunal de Juicio Penal de Cartago, sede Turrialba, fallo mediante el cual se absolvió a [Nombre1] de un delito de explotación minera y un delito de usurpación de bienes de servicio público, acusados como cometidos en perjuicio de los Recursos Naturales y declaró sin lugar la acción civil resarcitoria incoada en contra de [Nombre1] . Como único motivo de apelación, se alega violación a las reglas de la sana crítica racional, especialmente el subprincipio de derivación. La recurrente indica que se valoró de manera errónea, la declaración de los testigos [Nombre3] , [Nombre4] , [Nombre5] , [Nombre6] y [Nombre7] ; se incurrió en serios yerros pues se analizó la prueba de manera antojadiza y, fragmentada, haciendo un análisis subjetivado de lo depuesto por quienes participaron en la investigación, que distan de lo que realmente declararon tal cual se desprende del registro audiovisual del debate, y fue ello precisamente lo que condujo al a quo a la errónea resolución del caso.

El Ministerio Público acusó, en lo fundamental, que [Nombre1] es propietario de una finca ubicada en Cartago, Turrialba, [Dirección1] , contigua al residencial Torreluna, que entre marzo del 2011 y principios del 2012, en diversas ocasiones, sin contar con concesión o autorización de la Administración Mineral del Estado, llevó a cabo la excavación y extracción ilegal de materiales minerales propiamente lastre y grava con una profundización de aproximadamente dos metros en dos frentes del área excavada, causando un daño ambiental económico de once millones seiscientos cuarenta mil colones. Hechos que fueron tipificados como constitutivos de Extracción Ilegal de Materiales de Minería, previsto y sancionado en el artículo 141 en relación con el 2 del Código de Minería, ley número 8246 del 24 de abril del 2002. Pese a ello, el Tribunal no tuvo por demostrada la responsabilidad del imputado, porque estimó que el inmueble del encartado se encuentra distante de la finca de Santa Rosa, donde los testigos, los informes presentados, la acusación y la querella, refieren que se realizó la extracción ilegal minera.

En criterio de la Fiscal, el Tribunal yerra, porque el juez analiza este punto mal, por cuanto si bien, por error material, se señala en el primer punto de la acusación que la propiedad en la que se dan los hechos es la finca matrícula CED2, que se encuentra registralmente inscrita a nombre del endilgado, lo cierto es que los Informes presentado por la Dirección de Geología y Minas que rolan de folios 1 a 5, y 15 al 21, del MINAE de folio 6, los del Organismo de Investigación Judicial de folios 8, 9 y 10 al 14, son claros en que el lugar en el que se dan los hechos en la localidad de Santa Rosa, son contiguo al residencial Torreluna. Esta circunstancia que es también reafirmada por los testigos que declararon en debate, [Nombre6] , quien claramente señala el lugar en el que se dan los hechos en Santa Rosa, hace referencia a que el Residencial Torreluna, está cerca del lugar; en igual sentido el testigo [Nombre3] hace referencia a éstas dos circunstancias; también las testigos [Nombre5] y [Nombre4] , que si bien no señalan el nombre del residencial Torreluna, si hacen clara mención que cerca del lugar donde se estaba extrayendo el material se estaba construyendo un residencial.

Para la recurrente no existe duda que se trata de la misma ubicación geográfica. La reclamante alega que se deriva de forma clara de la prueba, no solo documental (Informe DM -05-SDRT-2011 visible a folio 8, sino de la declaración del testigo [Nombre6] , quien en juicio declaró, que entrevistó a [Nombre8] en la investigación. quien señaló que había sido contratado por el endilgado [Nombre1] para realizar la extracción del material en el lugar; indicó también el oficial que entrevistó a [Nombre9] , quien le expuso que [Nombre1] le alquiló la vagoneta para extraer materiales en dicha propiedad; se trata de testigos que también habían sido ubicados en el lugar de los hechos y entrevistados por los personeros de la Dirección de Geología y Minas tal y como rola a folios 4, propiamente en el memorándum DGM-SIGMA-042-2011 del fecha 9 de agosto del 2011. De igual forma sesgada y subjetiva fue analizada la declaración de [Nombre3] , pues el Tribunal le restó credibilidad al relato que el mismo ofreció, pues [Nombre3] claramente señaló que en la inspección realizada por su persona, logró ubicar a un sujeto [Nombre10] que le refirió claramente que [Nombre1] era la persona que se encontraba realizando la extracción del material en dicho lugar.

En el mismo orden de ideas el a quo no fundamenta las razones por las cuales le resta credibilidad a las declaraciones de dichos testigos y se limita solo a señalar que se requería contar en juicio con dichas personas y sus declaraciones, para verificar la participación del sindicado en los hechos, todo lo anterior a criterio de quien impugna, deviene en una falta de fundamentación de la sentencia y preterición de la prueba. La Fiscal solicita se anule la sentencia y se ordene el reenvío del proceso para una nueva sustanciación de la causa. Ofrece como prueba el soporte digital del juicio. Por resultar pertinente y en virtud de la similitud de los reclamos, se resuelve conjuntamente, el único reclamo que hace, en lo penal, el licenciado Randall Aguirre Mena, Procurador Penal, con base en los artículos 458, 459 y 460 del Código Procesal Penal, quien alega que existió un yerro en la localización del sitio de extracción de los recursos mineros por parte del juzgador, de igual manera, retoma una nueva valoración de los testigos para concluir que el encausado sí ordenó esa acción prohibida.

Se refiere de igual forma a la exclusión del testigo [Nombre9] , al prescindir el Tribunal del mismo erróneamente. Los reclamos son de recibo: Es necesario acotar, que el registro del debate es parte del expediente, por lo que no es necesario ofrecerlo como prueba como hizo la parte recurrente. Por otra parte, la impugnación de la Fiscalía se compone de dos reclamos: el primero de ellos, gira en torno a que el a quo consideró que el inmueble número CED2 a nombre del imputado, querellado y demandado civil [Nombre1] , no es la misma propiedad donde se verificó efectivamente que se habían extraído los materiales que nos ocupan, incluso el Juzgador señala que hay una distancia significativa entre ambos fundos. Esa primera premisa que utilizó la persona juzgadora para absolver al encausado no corresponde a la realidad geográfica que consta en el expediente judicial. A folio 64 del documento PDF, consta la acusación formulada por el Ministerio Público, en cuyo hecho primero, se describe que el sitio donde se está cometiendo la delincuencia que acusa se ubica conforme a las coordenadas [Dirección2], [sic]; Resulta necesario indicar que: “En Costa Rica se trabaja con dos sistemas de coordenadas métricas: LAMBERT: (Nombre completo: Cónica Conforme Secante de Lambert) Es un sistema antiguo con el cual se realizó la cartografía métrica de Costa Rica.

Se caracteriza por ser un cono secante o sea que toca al país en dos puntos (paralelos). Esto deriva en que haya dos sistemas Lambert el Norte y el Sur (a). Cada una de éstas dos cuadriculas cubren todo el país, pero solamente debe ser aplicado a ciertas áreas, las hojas topográficas 1:50000 que son las oficiales del país, tienen esta particularidad Ej: La hoja Barva tiene el sistema de coordenadas Lambert norte, pero la hoja topográfica Golfito tiene los valores del sistema de coordenadas en Lambert sur. (b) Por cierto su datum es local llamado Ocotepeque por estar situado en la ciudad de Ocotepeque en Honduras.” … “CRTM05: (Nombre completo: Costa Rica Transversal de Mercator del 2005) Es un sistema más nuevo con el cual se intenta reemplazar la cartografía métrica antigua (Lambert) de Costa Rica. Se caracteriza por ser una proyección cilíndrica transversal. Aplica a todo el país. Como todavía no se ha podido reemplazar en los mapas se ha optado por colocarlo en las hojas cartográficas en color anaranjado.

Se puede diferenciar claramente del Lambert porque sus valores en Y (Latitud) están cercanos al millón de metros. (Esto es porque inicia la medición de la distancia desde el paralelo cero o ecuador). Su datum es de tipo geocéntrico llamado WGS84 (World Geodetic System 1984).” (SISTEMAS DE COORDENADAS consultado en http://www.edeca.una.ac.cr/images/AplicTop2020/Semana2/Lectura%20Proyecciones.pdf el día 22 de octubre de 2020). De lo anterior se colige, que el sistema de cartografía métrica mayoritario en Costa Rica, es el sistema Lambert, aunque se espera que se llegue a sustituir eventualmente por el CRTM05. En la Querella, y en la Acción Civil Resarcitoria, el lugar donde se acusa la delincuencia de marras también se expresa mediante la geolocalización del sistema Lambert. Por si ello fuera poco, a folios 2, 15 y 74 del expediente en formato PDF, rolan documentos admitidos e incorporados al debate relativos a inspecciones in situ donde se estaba realizando la extracción y se indican como coordenadas [Dirección3] y [Dirección4] este; las cuales comparadas con las que se describen en la acusación fiscal, sea [Dirección5] y [Dirección6] este, apuntan al mismo lugar con una diferencia que no es significativa.

De tal manera, que no corresponde a la realidad geográfica, que la finca número CED2 a nombre del imputado, querellado y demandado civil [Nombre1] no tenga ninguna relación con el sitio donde se acusó que se estaba cometiendo el delito investigado. Esto claramente es un yerro de derivación lógica por no interpretar correctamente la prueba documental admitida y no compararla con las imputaciones formuladas por el Ministerio Público y la Procuraduría General de la República, de tal manera, que para establecer el lugar donde se perpetró aparentemente el ilícito no se requiere, como lo alega la parte recurrente, un examen de los testigos que indicó, sino un criterio objetivo de cartografía métrica como el que se ponderó. Por otra parte, en la acusación fiscal y solicitud de apertura a juicio se ofreció y luego se admitió el testimonio de los siguientes testigos: se enunciarán primero los que declararon en el debate, Ingeniero [Nombre3] , [Nombre5] , y [Nombre6] y también depusieron en el juicio otros testigos ofrecidos por otras partes, tales como [Nombre7] , [Nombre4] , entre otros.

Pero el punto en discusión y que es el que resulta esencial para el reclamo planteado por la represente fiscal en el recurso de apelación, consiste en que la impugnante aduce que: a) el juez le restó credibilidad al relato de [Nombre3] , Ingeniero quien realizó la inspección en el sitio, quien dijo en el debate que logró ubicar a un sujeto llamado [Nombre10] que le refirió claramente que [Nombre1] era la persona que se encontraba realizando la extracción del material en dicho lugar, pero al no declarar [Nombre10] , ni figurar en la lista de testigos, ello bastó para no creer en el ingeniero del Ministerio de la Dirección de Geología y Minas del Ministerio de Ambiente y Energía, sin que la persona juzgadora justipreciara el dato en sí que este deponente aportaba, valorara el por qué tendría un motivo para falsear la verdad o no, de ahí que este Tribunal considera que su motivación intelectiva respecto al valor de este testimonio es incompleto y superficial; b) en el fallo impugnado, el juez indica que se requería contar en juicio con testigos claves para verificar la participación del sindicado en los hechos, alude a [Nombre8] , quien supuestamente conducía la vagoneta con que se hacía la extracción, cuando lo que pasó con ese testigo fue que según rola a folio 297 del expediente PDF, el propio Juez prescindió de ese testigo que había sido debidamente admitido para el debate con la oposición de la Fiscalía, que presentó recurso de revocatoria y fue declarado sin lugar en este extremo.

Además, el otro declarante al que se refiere el juez es [Nombre8] , quien supuestamente había sido contratado por el imputado, este declarante tiene la particularidad, de que consta a folio 323 del expediente PDF, que el Fiscal de debate indicó que conversó con el oficial de presentaciones y no fue localizado, siendo que, de acuerdo a la madre de [Nombre8] , este “anda huyendo de la justicia” porque tenía una orden de captura por pensión alimentaria. Por eso el Juez tomó la decisión de prescindir del testigo y declararlo inevacuable, sin oposición de las partes. En consecuencia, si bien es cierto que procesalmente, se prescindió de los testigos supra indicados por razones válidas, lo que no resulta aceptable conforme a la regla de la derivación lógica, es que el a quo no tomó en consideración lo que depuso el agente del Organismo de Investigación Judicial, Hugo Lazarus Montero, acerca de lo que le manifestó [Nombre9] , propietario de la vagoneta que se encontraba en el sitio (ver folio 351 del documento PDF), siendo que para el juez, lo dicho por [Nombre9] , es meramente referencial, lo que no es cierto, si hubiera relacionado su testimonio con el resto del acervo probatorio y no se hubiesen excluido las manifestaciones que le hizo [Nombre9] al oficial Hugo Lazarus Montero, se hubiese concluido correctamente que el encausado [Nombre1] era el propietario del inmueble donde estaba trabajando [Nombre9] , quien nunca fue señalado como posible imputado, por lo que no tenía derecho de abstención, como erróneamente señaló el juez, independientemente de que el oficial Hugo Lazarus Montero posteriormente hiciera un informe escrito de lo que presenció, de ahí que el Procurador Penal lleva razón en su alegato.

Resulta evidente que el Tribunal de mérito hizo un análisis sesgado y aislado de las probanzas, lo que causa que sea necesario un nuevo examen de la causa en un juicio de reenvío. En consecuencia, se acogen los únicos motivos interpuestos por la representante del Ministerio Público y el Procurador Penal, se declara con lugar el recurso de apelación de ambos, se anula la sentencia impugnada en su totalidad, así como el debate que la precedió y se ordena el reenvío al Tribunal de origen para una nueva sustanciación

II.El licenciado Randall Aguirre Mena, Procurador Penal, con base en los artículos 458, 459 y 460 del Código Procesal Penal, interpone recurso de apelación contra la sentencia número 111-2019 de las 8:00 horas del 15 de julio de 2019, dictada por el Tribunal de Juicio Penal de Cartago, sede Turrialba, fallo mediante el cual se absolvió a [Nombre1] de un delito de un delito de explotación minera y un delito de usurpación de bienes de servicio público, acusados como cometidos en perjuicio de los Recursos Naturales y declaró sin lugar la acción civil resarcitoria incoada en contra de [Nombre1] . Como único motivo de apelación alega falta de fundamentación intelectiva y errada valoración de la prueba al absolver al imputado y declarar sin lugar la acción civil resarcitoria. Los aspectos penales que dan sustento al nexo causal para la pretensión civil ya fueron conocidos y dirimidos en el Considerando anterior, estese a lo ahí resuelto.

Se solicita declarar con lugar el recurso de apelación, anular totalmente el fallo recurrido, y el debate que lo antecedió, ordenando un reenvío para una nueva sustanciación que emita una nueva sentencia con apego a derecho incluyendo lo referente a la acción civil resarcitoria. Se acoge el reparo: En cuando a la acción civil resarcitoria, en el fallo cuestionado, en folio 352 del documento PDF, en el Considerando IV de la sentencia, se lee textualmente “En cuanto a la acción civil resarcitoria, al no haberse logrado establecer ese vínculo o nexo causal entre el daño causado a los recursos naturales con el imputado, toda vez que como se ha indicado, no fue posible establecer que la finca donde se realizó la actividad ilícita estuviera relacionada con el encartado, ni tampoco que este hubiera de manera directa o por interpósita persona participado en esos hechos, resulta improcedente derivar una responsabilidad civil para este.

Es decir, de la prueba como ya se analizó en líneas anteriores, no se logró acreditar la participación del acusado en los hechos que permitieran determinar incluso que la misma fuera de manera dolosa o negligente de la cual se derive su obligación de indemnizar.” Evidentemente, los supuestos de esta escasa fundamentación fueron desmentidos por esta sentencia de apelación, especialmente, en cuanto a la ubicación del lugar de los hechos, y el tema de la responsabilidad del imputado será objeto de un juicio de reenvío, por lo que, lleva razón la representación de la Procuraduría General de la República, que el rechazo de la acción civil resarcitoria incoada en contra de [Nombre1] carece de fundamentación intelectiva. En consecuencia, se declara con lugar en todos sus extremos el recurso de apelación interpuesto por el licenciado Randall Aguirre Mena, Procurador Penal. Se anula la sentencia impugnada y se ordena el reenvío al Tribunal de origen para una nueva sustanciación que incluya un nuevo pronunciamiento con relación a la acción civil resarcitoria.

III.Nota de la jueza Gutiérrez Cruz. Con respecto a lo resuelto en el Considerando I, concurro con el voto de mis compañeros en cuanto a que los recursos del Ministerio Público y la Procuraduría General de la República deben declararse con lugar mas considero necesario precisar brevemente las razones de dicha decisión. Entre los reclamos incluidos por el Procurador se encuentra la falta de análisis de lo dicho por el testigo [Nombre7] , que es esencial y no fue tomado en cuanta por el juzgador en el fallo, pues se limitó a señalar de forma general que este testigo no aportaba nada relevante con respecto a los hechos. Tal y como lo reclama el impugnante, aunque dicho testigo fue evasivo, sí refirió que trabajaba para el imputado, además lo señaló como propietario de la maquinaria, cuestiones que hubiesen permitido al juzgador dilucidar la duda con base en la cual dictó sentencia absolutoria y que, por haber sido omitidas, generan un agravio a los intereses de los actores penales.

Tales manifestaciones, unidas a la información derivada de los documentos y de las declaraciones de los funcionarios del Organismo de Investigación Judicial y de Ministerio de Obras Públicas y Transportes, debieron ser valoradas en conjunto. Debe quedar claro que no se propone utilizar lo consignado con respecto a declaraciones testimoniales en los informes de la policía, ni tampoco incorporarlas de manera indirecta, pues ello sería violatorio de los principios de oralidad, inmediación y contradictorio. Sin embargo, lo que sí puede aquilatarse es lo que de viva voz indicaron los oficiales y el funcionario del MOPT con respecto al resultado de las pesquisas y los datos que recolectaron, entre ellos los referentes a quién era el propietario de la finca, de la maquinaria y quién había ordenado los trabajos, lo que debió ser ponderado en conjunto con la información atinente a la propiedad y lo señalado por [Nombre7] y hubiese permitido arribara conclusiones distintas, por lo que el vicio en la fundamentación se produjo ya que el Tribunal mutiló la prueba y además analizó de forma aislada lo que surgía de esta, por lo que llevan razón los apelantes.

POR TANTO

Se declaran con lugar en todos sus extremos, los recursos de apelación interpuestos por la Fiscalía y la Procuraduría General de la República. Se anula la sentencia impugnada en su totalidad, así como el debate que la precedió. Se ordena remitir la causa al Tribunal de origen para una nueva sustanciación conforme a derecho. La jueza Gutiérrez Cruz pone nota. Notifíquese.
