NOTICE SHALL BE GIVEN BY READING.*- CÉSAR LARA FALLAS. TRIAL JUDGE OF [Nombre2] ." * * 2. Attorney Adrián Fernández Rodríguez filed an appeal against the foregoing decision. * * 3. After the corresponding deliberation was conducted in accordance with Article 466 of the Código Procesal Penal, as amended by Ley 8837 published on nueve de diciembre de dos mil once (Creación de Recurso de Apelación de la Sentencia), the Court considered the issues raised in the appeal.* * 4. The relevant legal requirements have been observed throughout the proceedings.* * Judge Fernández Mora drafts the decision; and,* Whereas:* *
I.Because it satisfies the legal requirements, the appeal filed by Adrián Fernández Rodríguez on behalf of the accused [Nombre1] and the jointly and severally liable civil defendant Truchas Reales de Costa Rica S.A. is admitted for consideration on the merits, since it was filed on time by a party with standing to do so and, upon review of the challenge (impugnación), the claims asserted can be understood, thereby permitting a comprehensive analysis of the judgment. *
II.In the appeal* filed*, it is alleged that the remand trial (juicio de reenvío) ordered by this Chamber did not concern their clients’ civil liability in general terms, but only the provisions of ruling 2019-420, which specifically states: “The annulment encompasses the fifth fact deemed proven in the private criminal complaint (querella), as well as the fifth and sixth facts of the civil action for damages (acción civil resarcitoria) that were deemed proven, which must be litigated again in the remand trial ordered.” It states that the fifth and sixth facts of the civil action claim that his client took water from the Buenavista River and did not pay the water-use fee (canon), which, according to the State, caused it harm. For its part, the fifth fact of the private criminal complaint states the same as the fifth fact of the civil action, concerning the nonpayment of the water-use fee. None of the facts referred to the existence of social harm (daño social) or environmental damage (daño ambiental); rather, they were limited solely to the issue of the harm resulting from nonpayment of the water-use fee for the use of the water.
On that premise, the only matters that could be litigated at trial were whether nonpayment of the water-use fee caused any harm to the State and the amount of that harm. Recovery for social harm was not included within the scope of the new trial, and therefore the judge violated the principle of consistency between the charge and the judgment (principio de correlación entre acusación y sentencia), established in Article 365 of the Code of Criminal Procedure (Código Procesal Penal). He considers that the judge violated Article 170 of the Organic Law of the Judiciary (Ley Orgánica del Poder Judicial) because he came into conflict with his hierarchical superior by departing from the decision of the Criminal Judgment Appeals Court of Cartago (Tribunal de Apelación de Sentencia Penal de Cartago). He states that, despite the judge’s efforts to justify the finding of social harm, there is no evidence in the case file (expediente) that environmental damage occurred.
It was the Office of the Attorney General (Procuraduría) that had the burden of proving the existence of such damage, but this was not demonstrated because the mere fact that the water was taken does not in itself constitute damage: in the project developed by Truchas Reales de Costa Rica S.A., the water is not consumed, but enters through one gate and exits through another in order to oxygenate the ponds, without causing any type of adverse effect on or contamination of the riverbed or the environment. Not even the witnesses for the civil plaintiff were able to establish that alleged damage, and there is no scientific evidence determining that the company’s activity caused damage. According to the appellant, there is no causal relationship (relación de causalidad) between the acts for which Mr. [Nombre1] was criminally convicted and those for which the State seeks compensation. In this specific case, payment of the water-use fee has no bearing on whether social harm occurred, because regardless of whether it was paid, the water was used in any event; stating that social harm was caused because the water was used breaks with a logical causation analysis, since it would then have to be said that environmental damage would also have occurred if the water-use fee had been paid, because in either scenario the water would have been used.
The judgment cannot withstand that logical causation analysis and must therefore be annulled. With respect to economic loss (daño patrimonial), which is the matter that could properly be the subject of the trial, he considers that this item likewise could not be recovered because the water-use fee could be charged only if there was an approved concession (concesión), as stated by the witnesses from the Water Directorate (Dirección de Agua): [Nombre3] , [Nombre4] and [Nombre5] . He considers that the unlawfulness of charging the water-use fee required the defense of lack of legal entitlement (excepción de falta de derecho) to be sustained, not due to lack of causation, but because of a legal impediment, since the State could not be awarded as compensation something that the State itself has deemed unlawful and that the State itself refused to collect; the record shows that the defendant offered to pay the State, but it refused to accept that payment at the preliminary hearing as a means of settlement (conciliación).
The appellant considers that these amounts could not be recovered through a civil action, but rather through debt-collection proceedings (proceso cobratorio), because this is not a case involving damage, but an administrative violation resulting from nonpayment of a water-use fee. Moreover, even if it were determined that the State was entitled to recover the economic loss, there is no way to quantify it because the Water Directorate and the Office of the Attorney General did not follow the correct mathematical procedure to determine the quantity of water consumed, as is evident from the testimony of witness [Nombre4] , regarding document DA-UHTPSOZ-0560-2017, dated October 25, 2017. After drawing a series of conclusions concerning those calculations, the appellant states that the flow measurements (aforos) cannot be taken again because they constitute non-reproducible evidence (prueba irrepetible), since the project currently holds a valid concession, according to Mr. [Nombre3] , and as shown by the documentary evidence submitted by the defense.
In other words, it is impossible in 2020 to measure the flow rates used by the project in 2015 and 2016, but the criminal judge does not understand this and directed the State to initiate judgment-enforcement proceedings (proceso de ejecución de sentencia) to quantify those amounts, thereby requiring Truchas Reales de Costa Rica S.A. to defend judgment-enforcement proceedings and incur the associated costs, even though it is known in advance that quantifying the alleged damage is physically and materially impossible. He requests that the appeal be granted, that the civil judgment entered against his clients be vacated, and that the State instead be ordered to pay the attorney’s fees (costas personales) generated by the civil action, with such award to be made in favor of both the defendant and Truchas Reales de Costa Rica.
The appeal is partially granted: The appellant alleges that the remand trial ordered by this Chamber through decision 2019-420 at 14:00 hours on September 6, 2019 did not encompass his clients’ civil liability in general terms, but solely the economic loss attributed to the nonpayment to the State of the water-use fee for the use of the waters of the [Dirección1] River; consequently, recovery for social harm was not included, and by awarding it the judgment was defective due to lack of congruence (falta de congruencia). However, a review of the aforementioned decision by this Court shows that the appellant is incorrect, because it clearly stated that the remand trial was to concern all matters relating to the defendants’ potential civil liability, as follows: “…the judgment and the corresponding trial must be partially annulled, solely with respect to all matters pertaining to the decision granting the civil action against José [Nombre1] and Truchas Reales de Costa Rica S.A. and the amounts consequently awarded for economic loss and social harm, as well as the award of costs (costas) relating to that action; the matter is remanded for the same court, differently constituted, to rule on this issue.
The annulment encompasses the fifth fact deemed proven in the private criminal complaint, as well as the fifth and sixth facts of the civil action that were deemed proven, which must be litigated again in the remand trial ordered” (Emphasis added). As can be seen, a different panel of this same Court found that the judgment ordering the civil defendants to pay damages lacked adequate reasoning (fundamentación) and ordered a remand trial to address all matters pertaining to the civil action, which included the attribution of economic loss and social harm.
The appellant is correct, however, that the judgment found the existence of social harm to the detriment of the State even though no proper corresponding allegation appears in the complaint filed by the Office of the Attorney General of the Republic (Procuraduría General de la República). In this regard, it should be noted that the fourth, fifth, and sixth facts of the civil action are those referring to the harm claimed by that State entity, as they state: “FOURTH: Thus, for the purpose of addressing the application submitted by [Nombre1] , officials [Nombre4] and [Nombre5] of the Water Directorate appeared on several occasions at the property in question and discovered the irregularity that the accused herein, knowing that he did not hold a water-use concession and acting for profit, diverted and appropriated for his own benefit public waters from the Buenavista River, even taking them in a greater quantity than he had requested in application number 2013822, for the purpose of trout farming, for which he had eleven ponds on his property.
In light of the foregoing, the accused was given legal warnings that State authorization was required for the use of the waters; nevertheless, the accused disregarded these warnings and instead continued to usurp water from the Buenavista River, as corroborated by inspections conducted by the Water Directorate on the dates set forth below. FIFTH: April 26, 2016, flow measurement 676.7 liters per second;* September of 201, flow measurement 00.9 liters per second; October 10, 201, flow measurement 124.3 liters per second; November 02, 201, flow measurement 1.344. liters per second; January 18, 2017, flow measurement 748. liters per second; May 30, 2017, flow measurement 73.8 liters per second, as a result of which the State failed to receive the sum of five million two hundred fifty-one thousand nine hundred eighty-five colones in water-use fees due to the water unlawfully taken by [Nombre1] .
SIXTH: The civil defendant, together with the company Truchas Reales de Costa Rica, caused economic loss to the State by unlawfully taking water from the Buenavista River for profit and without paying the corresponding water-use fee for its use; as a result, they contribute to programs such as SINAC, FONAFIFO, and CONCURE receiving less money due to the absence of that water-use fee, thereby causing significant harm because the water resource is not adequately protected owing to a lack of funds to support those specific programs. Moreover, because water is an asset in the public domain (bien demanial) and of social interest, we are all affected if its use is not regulated rationally and equitably, since its use must be proportional” (As in the original).
As can be seen, what the civil action claims with complete clarity is the existence of economic loss in the amount the State failed to receive in water-use fees corresponding to the water concession; however, the allegation becomes abstract with respect to social harm, since it merely states that because water is an asset of social interest, “we are all affected” (without specifying to whom the noun “all” refers: Costa Ricans, the community near the Buenavista River, humankind, etc.), and then states that such harm exists if its use is not regulated rationally, equitably, and proportionally. In view of the foregoing, even though the Office of the Attorney General of the Republic claimed the existence of social harm in its requested relief (pretensiones), it was required to allege that harm clearly so that the civil defendants could properly exercise their defense and submit whatever evidence and arguments they deemed appropriate to contest that allegation. Because the State’s counsel failed to proceed in that manner, the challenged judgment could not award damages for social harm, since doing so violates the principle of congruence between the complaint and the judgment (principio de congruencia entre demanda y sentencia) established by Article 61.2 of the Code of Civil Procedure (Código Procesal Civil), which provides: “61.2. Contents of the judgment.
Judgments (sentencias) must resolve each and every point that has been the subject of debate; they may not grant more than was requested, unless otherwise provided by law, and may not encompass matters other than those raised in the claims; excepted are those for which the law does not require a party’s initiative.” That provision is related to the requirements for filing a civil action for damages (acción civil resarcitoria), set forth in Article 112 of the Code of Criminal Procedure (Código Procesal Penal), which include: “d) The grounds on which it is based, indicating the capacity asserted and the damage for which compensation is sought, even if the amount is not specified.” In the present matter, the grounds invoked by the State’s representatives in seeking compensation consisted of the civil defendants’ failure to pay the fee for the water concession, which allegedly caused significant harm because State institutions were deprived of the resources needed to adequately protect water resources; however, those grounds never explained what that social damage (daño social) allegedly consisted of.
In this regard, it should be noted that the concept of social damage refers to a loss of societal well-being caused by human conduct contrary to law, and legal scholarship therefore states: “In this regard, we consider that it should be defined as any impairment, adverse effect, detriment, diminution, or loss of social well-being (within the context of the right to a healthy environment), caused by human conduct that is either contrary to or in compliance with the legal system (lawful or unlawful), and unjustly suffered by a plurality of individuals, who may constitute anything from a specific group to the community as a whole, by causing material or non-material harm to their diffuse or collective interests that are relevant to the legal system and that gives rise to a duty to remedy the harm caused” ([Nombre7] , . & Sibaja López, I. (2011). El daño social: su conceptualización y posibles aplicaciones.

As with any other type of damage, it must be certain rather than contingent; therefore, the description of the act giving rise to the civil claim must specify the nature of the impairment, adverse effect, detriment, diminution, or loss of social well-being in the particular case. For that reason, it is unacceptable to find liability for social damage when the allegation does not establish what that specific damage allegedly consisted of, but merely states in general terms that, because water is an asset of social interest, the population at large was affected by the defendant’s conduct in unlawfully taking water from the Buenavista River channel. It is true that the civil action for damages states that, by failing to pay the fee corresponding to the water concession, the defendant deprived programs dedicated to protecting water resources of funding; however, this is an immediate consequence of the pecuniary damage (daño patrimonial) claimed and awarded in the judgment, rather than an impairment of the community’s social well-being.
At most, therefore, it could be regarded as a material manifestation of social damage equivalent to the material damage awarded (a form of lost profits (lucro cesante) for the State). In any event, if such impairment of diffuse or collective interests existed, the civil complaint had to specifically establish what that non-pecuniary injury (lesión no patrimonial) to the community’s interests consisted of in the particular case, stating, for example, how the defendants’ use of the waters of the Buenavista River affected its flow and the water supply of other persons in the community, whether that conduct affected wildlife or aquatic life, or other actual possibilities that could have caused social damage to the community, rather than merely presenting a speculative argument such as that made in the final paragraph of the sixth factual allegation of the civil action for damages concerning the need to properly regulate the proportional use of water because it is an asset of social interest.
It was extremely important to establish the foregoing among the factual allegations of the civil action for damages because, as the appellant states and as recorded in resolution No. 0145-2013-SETENA (appearing at pages 19-26 of volume I of the principal case file), the project developed by Truchas Reales de Costa Rica S.A. was only going to use the water flow to oxygenate the ponds in which the trout were bred, and the water was returned to the river channel without exceeding the maximum limits permitted under the Reglamento de Vertido y Reúso de Aguas Residuales (see expert report DCF: 2017-01704-TOX at pages 626-628 of volume II of the principal case file). It is therefore unclear what social damage was allegedly caused by the defendant’s activity as established in the judgment, thus demonstrating the alleged defect of lack of congruence (falta de congruencia). Accordingly, the judgment must be reversed insofar as it awarded damages for social damage in this particular case.
The appellant is incorrect, however, in asserting that the award of pecuniary damages ordered in the judgment was likewise improper because, as already indicated, the defendant’s unlawful conduct in taking water from the Buenavista River channel without having a concession to do so constituted a form of lost profits for the State: had the convicted person acted in accordance with the law, he would have had to pay the applicable fee for that concession. The State is therefore entitled to claim the amounts it failed to receive. The appellant’s arguments that this charge was unlawful cannot be accepted because, pursuant to Article 171 of Ley de Aguas No. 276 of August 27, 1942, the charge constitutes a tax imposed on all uses of water, such that every person who uses public waters is obligated to pay those taxes and to have followed the established procedure for obtaining a concession. In this case, it was established that in 2013 the civil defendant [Nombre1] initiated the applicable procedure to obtain a water concession for use in the profit-making activity of trout farming; however, before obtaining State authorization to do so, he used the water for that activity, thereby depriving the administration of the money corresponding to the fee or tax that he should have paid during that period.
As can be seen, the conduct engaged in by the defendant, in addition to constituting the criminal offenses for which he has already been punished, also constituted administrative violations (infracciones administrativas), the effects of which could be determined in the applicable proceeding. In both cases, however, the unlawful conduct in question generated a monetary obligation in favor of the State. It was therefore unnecessary to initiate administrative proceedings in order to recover the monies not received; because criminal proceedings were already underway, the pecuniary damage at issue could properly be claimed in this forum. Likewise, the fact that the parties were unable to agree on an alternative resolution of the proceedings does not render the claim for pecuniary damage improper, since that claim has always been among the forms of relief sought by the civil plaintiff.
Finally, regarding the quantification of material damage (daño material), the appellant is also incorrect, because Article 368 of the Code of Criminal Procedure permits the court to grant in the abstract the amounts claimed by the civil plaintiff, to be liquidated during the judgment-enforcement stage (fase de ejecución de sentencia) when the evidence does not permit the requested amounts to be established with certainty. In that regard, the judgment under appeal agreed with the appellant that the calculations used by the State in its claim for pecuniary damage were inaccurate. The plaintiff must therefore present evidence to determine and enforce recovery for that damage through judgment-enforcement proceedings, without any prejudice to the appellant being apparent, since the civil plaintiff will bear the burden of proof (carga de la prueba), and the defendants in those proceedings may present their arguments and objections to any evidence that does not correspond to the data relating to the damage claimed, both as to its current accuracy and the methodology of the calculations used.

Que mediante sentencia número 351-2020 de las siete horas cincuenta y cinco minutos del ocho de julio de dos mil veinte, el Tribunal Penal del Primer Circuito Judicial de la Zona Sur, Pérez Zeledón, resolvió: "POR TANTO: De conformidad con lo expuesto artículos 39, 41 y 50 de la Constitución Política, numerales 1, 11, 18, 19, 20, 21, 30, 45, 50, 51, 59 al 63, 71, 75, 103, 106, 226 y 227 del Código Penal; artículos 122 al 125 de las Reglas Vigentes sobre Responsabilidad Civil del Código Penal de 1941; nominales 1 al 6, 9, 12, 13, 16, 37, 38, 40, 71, 111, 112, 142, 180 al 184, 265 al 270, 303, 341 al 368 del Código Procesal Penal; ordinales 1045 y 1046 del Código Civil; ordinales 1, 3, Ley Orgánica de la Procuraduría General de la República, artículos 1al 3, 6, 9 al 11 de la Ley de Biodiversidad N° 7788, numerales 1 al 3, 17, 21, 27, 137, 175 al 185 Ley de Aguas, nominales 1 y 2 de la Ley Orgánica del Ambiente; habiéndose declarado al acusado [Nombre1] autor responsable de un delito de USURPACIÓN DE BIENES DE DOMINIO PÚBLICO en concurso ideal con delito de USURPACIÓN DE AGUAS cometidos en perjuicio de LOS RECURSOS NATURALES, y en tal carácter se le impuso la pena de UN AÑO DE PRISIÓN, otorgándosele el Beneficio de Ejecución Condicional de la Pena por el plazo de tres años, este Tribunal resuelve: Se declara CON LUGAR la Acción Civil Resarcitoria incoada por el Estado en representación de la Procuraduría General de la República, en contra de los demandados civiles [Nombre1] y TRUCHAS REALES DE COSTA RICA SOCIEDAD ANÓNIMA, por lo que se condena a ambos demandados civiles al pago en forma solidaria a favor del Estado, por concepto de daño social provocado, el monto en TRES MILLONES DE COLONES (¢ 3000 000); además, se condena al pago del daño patrimonial provocado, el cual se condena en abstracto, debiendo recurrir el interesado a la vía civil correspondiente para su respectiva fijación.
Aunado a lo anterior, los demandados civiles deberán cancelar los intereses legales y moratorios desde el momento de la firmeza del presente fallo y hasta su efectivo pago. Se condena a los demandados civiles en forma solidaria al pago de las costas civiles del proceso, las cuales serán fijadas en el respectivo proceso de ejecución de sentencia. Una vez firme la presente sentencia, comuníquese al Registro Judicial y Adaptación Social, para lo que corresponda, y expídasen (sic) los respectivos testimonios de sentencia. NOTIFÍQUESE MEDIANTE LECTURA.*- CÉSAR LARA FALLAS. JUEZ DE JUICIO DE [Nombre2] ." * * 2. Que contra el anterior pronunciamiento, el licenciado Adrián Fernández Rodríguez interpuso el recurso de apelación. * * 3. Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 466 del Código Procesal Penal, reformado por Ley 8837 publicada el nueve de diciembre de dos mil once (Creación de Recurso de Apelación de la Sentencia), el Tribunal se planteó las cuestiones formuladas en el recurso.* * 4. Que en los procedimientos se han observado las prescripciones legales pertinentes.* * Redacta el Juez Fernández Mora, y;* Considerando:* *
I.Por cumplir con los requisitos legales, se admite para su estudio de fondo el recurso de apelación incoado por Adrián Fernández Rodríguez, en representación del imputado [Nombre1] y de la demandada civil solidaria Truchas Reales de Costa Rica S.A., pues fue interpuesto en tiempo, por un interviniente legitimado para ello, así como de la lectura de la impugnación, resulta posible comprender los reclamos realizados, en aras de proceder con el análisis integral del fallo. *
II.En el recurso* planteado* se alega que el juicio de reenvío ordenado por esta Cámara no versaba en términos genéricos sobre la responsabilidad civil de sus representados, sino solo sobre lo dispuesto en el voto 2019-420, que en concreto dice: “La anulación comprende el hecho quinto que se tuvo por acreditado en la querella, así como los hechos quinto y sexto de la acción civil resarcitoria que se consideraron demostrados, los que deberán ser nuevamente discutidos en el juicio de reenvío ordenado”. Señala que los hechos quinto y sexto de la acción civil lo que reclama es que su representado tomó agua del río Buenavista y no pagó el canon, lo cual según el Estado le generó un perjuicio. Por su parte, el hecho quinto de la querella indica lo mismo que el hecho quinto de la acción civil, relacionado con el no pago del canon. En ninguno de los hechos se hizo referencia a la existencia de un daño social o de un daño ambiental, sino que se limita únicamente al tema del daño por el no pago del canon por el uso del agua.
Bajo esa premisa, lo único que podía discutirse en el debate era si el no pago del canon generó algún daño al Estado y cuál era el monto de este. En el objeto de discusión del nuevo debate no estaba incluido el cobro del daño social, de manera que el juez incurrió en una violación al principio de correlación entre acusación y sentencia, previsto por el artículo 365 del Código Procesal Penal. Considera que el juzgador violentó el artículo 170 de la Ley Orgánica del Poder Judicial porque entró en conflicto con su superior jerárquico, apartándose de lo resuelto por el Tribunal de Apelación de Sentencia Penal de Cartago. Señala que, pese a los esfuerzos de justificación del juzgador sobre el daño social, no existe prueba en el expediente de que se haya dado un daño ambiental. Era la Procuraduría la que tenía el deber de probar que existió este daño, pero eso no se demostró porque el hecho de que se tomara el agua por sí solo no constituye un daño, porque en el proyecto desarrollado por la empresa Truchas Reales de Costa Rica S.A., el agua no se consume, sino que entra por una compuerta y sale por otra, con el fin de oxigenar los estanques, sin generar ningún tipo de afectación o contaminación al cauce del río o del medio ambiente.
Ni los testigos de la parte actora civil pudieron acreditar ese supuesto daño y no existe ninguna prueba científica que determine que la actividad de la empresa generó un daño. Para el recurrente no existe relación de causalidad entre los hechos por los que el señor [Nombre1] fue condenado penalmente y por los que el Estado pretende una indemnización. En el caso concreto, el pago del canon no tiene incidencia en la producción o no de un daño social, pues independientemente de que se haya pagado, el agua siempre se utilizó, y señalar que porque se utilizó el agua se generó un daño social rompe con el análisis lógico de causalidad, pues habría que decir que si se hubiera pagado el canon también se hubiera dado un daño ambiental, pues en ambos supuestos se habría utilizado el agua. La sentencia no soporta ese análisis lógico de causalidad, por lo que debe ser anulada. En cuanto al daño patrimonial, que es lo que sí podría ser objeto del debate, considera que ese rubro tampoco podía ser cobrado porque el canon solo podía cobrarse si existía una concesión aprobada, tal como lo dijeron los testigos de la Dirección de Agua: [Nombre3] , [Nombre4] y [Nombre5] .
Considera que la ilegalidad del cobro del canon obligaba a que se declarara con lugar la excepción de falta de derecho, pero no ya por falta de causalidad, sino por impedimento legal, pues no podría dársele al Estado como indemnización algo que el mismo Estado ha indicado que es ilegal y que el mismo Estado se negó a cobrar, pues consta que el imputado ofreció pagar al Estado, pero éste se negó a recibir ese pago en la audiencia preliminar como forma de conciliación. El recurrente considera que no es por medio de una acción civil como se podían cobrar dichos rubros, sino a través de un proceso cobratorio, pues no estamos en presencia de un daño, sino de una infracción administrativa por el no pago de un canon. Además, aunque se determinara que el Estado tenía derecho a cobrar el daño patrimonial, no existe forma alguna de cuantificarlo, por cuanto la Dirección de Aguas y la Procuraduría no siguieron el procedimiento matemático correcto para establecer la cantidad de agua que se consumió, para lo cual basta observar la declaración del testigo [Nombre4] , en relación con el documento DA-UHTPSOZ-0560-2017, de fecha 25 de octubre de 2017.
Luego de hacer una serie de conclusiones en relación con dichos cálculos, el recurrente manifiesta que los aforos no pueden volver a realizarse, porque se trata de prueba irrepetible, ya que el proyecto tiene actualmente una concesión y está vigente, según palabras del señor [Nombre3] , y según consta en la prueba documental aportada por la defensa. En otras palabras: es imposible medir en el año 2020 los caudales utilizados por el proyecto en el año 2015 y 2016, pero eso no lo entiende el juez penal, quien remitió al Estado a plantear un proceso de ejecución de sentencia para cuantificar esos rubros, obligando a la empresa Truchas Reales de Costa Rica S.A. a atender un proceso de ejecución de sentencia e incurrir en los costos que implica, cuando se sabe a priori que la cuantificación del daño pretendido es física y materialmente imposible. Solicita que se acoja el recurso, se deje sin efecto la condenatoria civil impuesta a sus representados y que en su lugar, se condene al Estado al pago de las costas personales generadas por la acción civil resarcitoria, condenatoria que debe ser en favor tanto del imputado como de la empresa Truchas Reales de Costa Rica.
El recurso se declara parcialmente con lugar: El recurrente alega que el juicio de reenvío ordenado por esta Cámara mediante la resolución 2019-420 de las 14:00 horas del 6 de setiembre de 2019 no abarcaba la responsabilidad civil de sus representados en términos genéricos, sino únicamente lo relacionado con el daño patrimonial atribuido por el no pago del canon al Estado por la utilización de las aguas del río [Dirección1], por lo que no estaba incluido el cobro por el daño social y al hacerlo la sentencia incurrió en el vicio de falta de congruencia. Sin embargo, de la revisión de la mencionada resolución de este despacho, se observa que no lleva razón el impugnante, pues de forma clara se señaló que el juicio de reenvío debía versar sobre todo lo referente a la eventual responsabilidad civil de los demandados, al indicarse: “…corresponde anular parcialmente la sentencia y el debate respectivo, solo en cuanto a todo lo atinente a la declaratoria con lugar de la acción civil resarcitoria contra José [Nombre1] y Truchas Reales de Costa Rica S.A. y los montos fijados, como consecuencia de ello, por daño patrimonial y daño social, así como la condenatoria en costas por dicha acción; se ordena el reenvío para que el mismo tribunal, con distinta integración, resuelva sobre este extremo.
La anulación comprende el hecho quinto que se tuvo por acreditado en la querella, así como los hechos quinto y sexto de la acción civil resarcitoria que se consideraron demostrados, los que deberán ser nuevamente discutidos en el juicio de reenvío ordenado” (El resaltado es suplido). Como se observa, otra integración de este mismo Tribunal consideró que la sentencia que había dispuesto la condenatoria de los demandados civiles, carecía de la adecuada fundamentación y ordenó la realización de un juicio de reenvío para conocer todo lo atinente a la acción civil resarcitoria, lo que incluía la atribución del daño patrimonial y daño social. En lo que sí lleva razón el recurrente es que la sentencia estableció la existencia de un daño social en perjuicio del Estado, pese a que no se encuentra el debido correlato en la demanda planteada por la Procuraduría General de la República. En ese sentido, debe señalarse que los hechos cuarto, quinto y sexto de la acción civil resarcitoria son los que hacen referencia al daño que reclama esa entidad del Estado, pues señalan: “CUARTO: Así pues, con la finalidad de atender la solicitud [Nombre1] , los funcionarios [Nombre4] y [Nombre5] de la Dirección de Agua, se apersonaron en varias ocasiones a la finca de marras, encontrándose con la irregularidad de que el aquí encartado, a sabiendas de que no tenía concesión de aprovechamiento de agua y con el propósito de lucro, desvió y tomó a su favor, aguas públicas del rio Buenavista, tomándolas incluso, en mayor cantidad de la requerida por él, en la gestión número 2013822, cuyo fin es el cultivo de truchas, para lo cual tenía once estanques dentro de su propiedad.
Dado lo anterior, se le hizo las advertencias legales al encartado, que era necesario la autorización del Estado para el aprovechamiento de aguas, no obstante, el encartado obvió estas advertencias y por el contrario continuó usurpando agua del río Buenavista, lo cual se logra corroborar mediante inspecciones que realiza la Dirección de Agua, en las fechas que a continuación se detallan. QUINTO: 26 de abril de 2016, aforo 676.7 litros por segundo;* de setiembre del 201, aforo 00.9 litros por segundo; 10 de octubre del 201, aforo 124.3 litros por segundo; 02 de noviembre del 201, aforo 1.344. litros por segundo; 18 de enero del 2017, aforo 748. Litros por segundo; 30 de mayo del 2017, aforo 73.8 litros por segundo, con lo cual, el Estado dejó de percibir la suma de cinco millones doscientos cincuenta y un mil novecientos ochenta y cinco colones, por concepto de canon, en razón del agua tomada ilegalmente por [Nombre1] .
SEXTO: El demandado civil en conjunto con la empresa Truchas Reales de Costa Rica, ocasionaron un daño patrimonial al Estado, al tomar de manera ilegal agua del río Buenavista con fines de lucro y sin pagar el canon correspondiente por su aprovechamiento, con lo cual, contribuyen a que programas como SINAC, FONAFIFO, CONCURE perciban menor cantidad de dinero, a falta de ese canon, resultando por ende, un perjuicio importante, pues se deja de proteger adecuadamente el recurso hídrico por falta de presupuesto para cubrir esos programas específicos. Aunado que por tratarse el agua de un bien demanial y de interés social, todos nos vemos afectados si no se regula de manera racional y equilibrada, ya que su uso debe ser proporcional” (Así en el original). Como se observa, la acción civil resarcitoria lo que reclama con total claridad es la existencia de un daño patrimonial por la suma dejada de percibir por el Estado por concepto del canon correspondiente a la concesión de aguas, pero la atribución se vuelve abstracta en relación con el daño social, puesto que simplemente refiere que por ser el agua un bien de interés social, “todos nos vemos afectados” (sin indicar a quién hace referencia el sustantivo “todos”: los costarricenses, la comunidad cercana al río Buenavista, la especie humana, etc.), para seguidamente indicar que esa afectación existe si no se regula su uso de manera racional, equilibrada y proporcional.
De acuerdo con lo anterior, por más que la Procuraduría General de la República reclame en sus pretensiones la existencia de un daño social, debió o atribuirlo de manera clara para que los demandados civiles pudieran ejercer adecuadamente su defensa y pudieran presentar las pruebas y alegatos que estimaran pertinentes en contra de dicha atribución. Al no proceder de esa manera la representación estatal, no podía existir una condena por daño social en la sentencia impugnada, pues ello implica una vulneración al principio de congruencia entre demanda y sentencia establecido por el artículo 61.2 del Código Procesal Civil, que dispone: “61.2. Contenido de la sentencia. Las sentencias deben resolver todos y cada uno de los puntos que hayan sido objeto de debate, no pueden conceder más de lo pedido, salvo disposición legal en contrario y no podrán comprender otras cuestiones que las demandadas; se exceptúan aquellas para las que la ley no exige iniciativa de parte”.
Dicha norma encuentra relación con los requisitos de interposición de la acción civil resarcitoria, comprendidos por el artículo 112 del Código Procesal Penal, entre los que se encuentra: “d) Los motivos en que se basa, con indicación del carácter que se invoca y el daño cuya reparación se pretenda, aunque no precise el monto”. En el presente asunto, los motivos invocados por la representación del Estado para reclamar una indemnización consistieron en la falta de pago del canon por la concesión de aguas por parte los demandados civiles, lo que habría generado un perjuicio importante al dejar de recibir las instituciones estatales los recursos para proteger adecuadamente el recurso hídrico, pero nunca se explicó entre dicha motivación en qué habría consistido ese daño social. En ese sentido, debe señalarse que el concepto de daño social hace referencia a una pérdida del bienestar de la sociedad por la acción humana contraria a derecho, y por eso señala la doctrina que: “En este sentido, consideramos que debe definirse como aquel menoscabo, afectación, detrimento, disminución o pérdida del bienestar social (dentro del contexto del derecho a un ambiente sano), ocasionado como producto de un comportamiento humano contrario al ordenamiento o en apego a este (lícito o ilícito), el cual sufre injustamente una pluralidad de individuos, quienes pueden constituir desde un grupo determinado hasta la colectividad en general, al producirles una afectación material o inmaterial a sus intereses difusos o colectivos, relevantes para el ordenamiento y, ante el cual, surge el deber de reparar lo causado” ([Nombre7] , . & Sibaja López, I. (2011).
El daño social: su conceptualización y posibles aplicaciones. Revista Judicial, Costa Rica, No. 101, pág. 140). Al igual que ocurre con cualquier otro tipo de daño, este debe ser cierto y no eventual, por lo que la descripción del hecho que motiva el reclamo civil debe especificar en qué consiste el menoscabo, afectación, detrimento, disminución o pérdida del bienestar social en el caso concreto. Es por eso que no resulta aceptable que pueda considerarse la existencia de una responsabilidad por daño social cuando la atribución no establece en qué habría consistido ese daño específico, sino que se indique de manera genérica que por ser el agua un bien de interés social, la generalidad de la población se ve afectada con la actuación del imputado al tomar agua de manera ilícita del cauce del río Buenavista. Es cierto que la acción civil resarcitoria indica que el imputado al no pagar el canon correspondiente a la concesión de aguas desfinanció programas dedicados a la protección del recurso hídrico, pero esto constituye una consecuencia inmediata de ese daño patrimonial reclamado y que fue concedido en sentencia, no una afectación al bienestar social de la comunidad, por lo que a lo sumo podría considerarse una manifestación material del daño social, que resulta equivalente al daño material que se concedió (una especie de lucro cesante para el Estado).
En todo caso, de haber existido tal menoscabo a intereses difusos o colectivos, tenía que establecerse en específico en la demanda civil en qué habría consistido en el caso concreto esa lesión no patrimonial a los intereses de la colectividad, estipulando por ejemplo: cómo la utilización de las aguas del río Buenavista por parte de los demandados afectó su caudal y el abastecimiento de agua de otras personas de la comunidad, si dicho comportamiento afectó la vida silvestre o acuática, entre otras posibilidades reales que podrían haber generado un daño social a la colectividad, y no simplemente un argumento especulativo como el planteado en el último párrafo del hecho sexto de la acción civil resarcitoria, relacionado con la necesidad de regular adecuadamente el uso proporcional del agua por ser un bien de interés social. Lo anterior era sumamente importante de establecerlo entre los hechos de la acción civil resarcitoria, porque como lo indica el recurrente y consta en la resolución No. 0145-2013-SETENA (visible a folios 19-26 del tomo I del expediente principal) el proyecto desarrollado por la empresa Truchas Reales de Costa Rica S.A., solamente iba a utilizar el caudal de agua para oxigenar los estanques donde se reproducían las truchas y el agua regresaba al cauce del río sin incumplir los límites máximos permitidos del Reglamento de Vertido y Reúso de Aguas Residuales (ver dictamen pericial DCF: 2017-01704-TOX de folios 626-628 del tomo II del expediente principal), por lo que no se entiende cuál habría sido el daño social que se causó con la actividad del imputado que se acreditó en sentencia, por lo que se evidencia el vicio de falta de congruencia señalado.
De ahí que deba revocarse la sentencia en cuanto a la concesión de la condena por concepto de daño social en el caso concreto. En lo que no lleva razón el recurrente es con que tampoco procediera la condena por el daño patrimonial que se dispuso en sentencia, pues como ya se ha indicado, la actuación ilícita del imputado de tomar las aguas del cauce del río Buenavista sin contar con la concesión para ello, constituyó una suerte de lucro cesante para el Estado, porque de haber actuado el sentenciado conforme a derecho, debió haber pagado el canon respectivo a dicha concesión, por lo que le asiste el derecho al Estado para reclamar dichas sumas dejadas de percibir, sin que resulten de recibo los alegatos realizados por el recurrente en relación a que fuese ilegal dicho cobro, pues según lo dispone el artículo 171 de la Ley de Aguas No. 276 del 27 de agosto de 1942, dicho cobro obedece a un impuesto establecido para todos los aprovechamientos de agua, de forma tal que toda persona que aproveche las aguas públicas existe la obligación de cancelar dichos impuestos y haber seguido el procedimiento establecido para obtener una concesión.
En este caso, lo que se acreditó fue que en el año 2013 el demandado civil [Nombre1] inició con el procedimiento respectivo para obtener una concesión de aguas para aprovecharlas en la actividad lucrativa del cultivo de truchas, pero antes de obtener la autorización estatal para ello, realizó el aprovechamiento de las aguas en dicha actividad, con lo que la administración dejó de percibir el dinero correspondiente al canon o impuesto que debió haber cancelado durante dicho periodo. Como se aprecia, el comportamiento desplegado por el imputado además de constituir los delitos penales por los cuales ya fue sancionado, también constituían infracciones administrativas, cuyos efectos podrían determinarse en el procedimiento respectivo. Sin embargo, en ambos casos, la conducta ilícita en mención generaban una obligación pecuniaria en favor del Estado, por lo que no resultaba necesario que se iniciara el procedimiento administrativo para poder recuperar los dineros no percibidos, sino que estando abierta la vía penal, el daño patrimonial en cuestión resultaba perfectamente reclamable en esta sede.
De igual forma, no porque las partes no hayan logrado acordar una salida alterna al proceso quiere decir que el reclamo por el daño patrimonial resulte improcedente, desde que dicho reclamo siempre ha figurado entre las pretensiones de la parte actora civil. Finalmente, en cuanto al tema de la cuantificación del daño material, cabe señalar que tampoco lleva razón el recurrente, puesto que el artículo 368 del Código Procesal Penal permite al tribunal acoger las partidas reclamadas por el actor civil en abstracto para ser liquidados en fase de ejecución de sentencia cuando los elementos probatorios no permitan establecer con certeza los montos solicitados. En ese sentido, la sentencia recurrida le dio la razón al impugnante en relación con el hecho de que los cálculos empleados por el Estado para el reclamo por el daño patrimonial no resultaban acertados, por lo que deberá la parte actora plantear los elementos de prueba para concretar y ejecutar el cobro por ese daño en la vía de ejecución de sentencia, sin que se evidencie algún perjuicio para la parte recurrente, desde que es la parte actora civil quien tendrá la carga de la prueba y podrán los demandados en dicho proceso realizar sus alegatos y oposiciones a cualquier tipo de elemento probatorio que no corresponda con los datos correspondientes al daño reclamado, tanto en lo referente a la actualidad como a la técnica de los cálculos empleados.
De conformidad con lo expuesto, corresponde declarar parcialmente con lugar el recurso incoado, revocar parcialmente la sentencia impugnada, únicamente en cuanto a la condena por concepto de daño social dispuesta, manteniendo incólume la sentencia en los demás aspectos de la condena civil, incluyendo la condena en abstracto por el daño patrimonial provocado.*
* * Por Tanto:* Se declara parcialmente con lugar el recurso incoado por el representante legal de los demandados civiles y se revoca parcialmente la sentencia impugnada, únicamente en cuanto a la condena por concepto de daño social dispuesta, manteniendo incólume la sentencia en los demás aspectos de la condena civil, incluyendo la condena en abstracto por el daño patrimonial provocado.
