BACKGROUND
I.By order (auto) issued at nine hours and twenty-two minutes on tres de marzo del año dos mil veintitrés, judicial employee [Nombre 001] was charged with: “apparent noncompliance with the Contract Governing Telework in the Poder Judicial with the Judicial Employee and the Regulations Governing the Telework Service-Delivery Modality in the Poder Judicial (circular 36-2021, approved by Corte Plena at session number 7-2021, held on 15 de febrero del 2021, article XVIII (Article 194 of the Ley orgánica del Poder Judicial). Alleged Improper Collection of Geographic-Zone Compensation (Zonaje) (Circular number 110-2010 of diecisiete de noviembre del dos mil diez and Article 194 of the Ley Orgánica del Poder Judicial, Circular number 165-2014 of once de agosto del dos mil catorce). Background: 1. Corte Plena, at session number 7-2021, held on 15 de febrero del 2021, article XVIII, approved the Regulations Governing the Telework Service-Delivery Modality in the Poder Judicial, and section 18 of those Regulations established the various options for providing services under the telework modality (modalidad de teletrabajo), as follows: ‘The telework modality provides for five options, specifying the number of days on which the teleworking person shall work in and outside the offices of the Poder Judicial.
These are: Telework option 1: Four days in the judicial offices or chambers of the Poder Judicial and one day outside them. Telework option 2: Three days in the judicial offices or chambers of the Poder Judicial and two days outside them. Telework option 3: Two days in the judicial offices or chambers of the Poder Judicial and three days outside them. Telework option 4: One day in the judicial offices or chambers of the Poder Judicial and four days outside them. Telework option 5: Exceptional cases approved by the Consejo Superior in which, due to the nature of the service provided by the judicial employee, it is feasible and necessary for that person not to report for work in person…’ (sic). 2. That you, [Nombre 001], during the period from 01 de abril del 2022 to 01 de marzo del 2023, served in the position of Judge of the Tribunal de Apelación Civil y Trabajo de la Zona Atlántica (Limón).

That, based on the foregoing, it is presumed that you, [Nombre 001], improperly collected and received, from the first half of enero del 2022 through the second half of mayo del 2022, a total of exactly one million four hundred fourteen thousand six hundred colones as a geographic-location allowance, because during the weeks described in the preceding point, you, [Nombre 001], worked remotely at an address other than the temporary residence you specified on the form described in point 2. (…)”. (Sic).
II.By ruling issued as the final decision (acto final) in proceeding N° 2023-003252 at eight hours and eleven minutes on cinco de octubre de dos mil veintitrés, the Judicial Inspection Tribunal (Tribunal de la Inspección Judicial) ordered: “The objection based on lack of subject-matter jurisdiction (incompetencia en razón de la materia) is denied. Pursuant to Articles 174, 175, 176, 190, 194, 195, and 208 of the Organic Law of the Judiciary (Ley Orgánica del Poder Judicial), the Regulations Governing the Provision of Telework Services in the Judiciary (Reglamento para regular la modalidad de prestación de servicios en teletrabajo en el Poder Judicial), and the Regulations Governing Payment of the Geographic-Location Allowance in the Judiciary (Reglamento para el pago de Zonaje en el Poder Judicial) (Circular 110-2010), the complaint against [Nombre 001] is sustained, the offense is classified as extremely serious, and the sanction of suspension from office without pay for two months is imposed.
She is also advised that, pursuant to Articles 66(5) and 209 of the Ley Orgánica del Poder Judicial, she has the right to appeal this decision to the Superior Council of the Judiciary (Consejo Superior del Poder Judicial) within three days and to request that, beforehand, the matter be reviewed by the Labor Relations Commission (Comisión de Relaciones Laborales) of this Institution. Once this final decision becomes binding, the ruling shall be communicated to the Dirección de Gestión Humana so that the corresponding notation—the classification and sanction—may be entered in the personnel file and disciplinary record of the aforementioned employee, pursuant to Article 228 of the General Law of Public Administration (Ley General de la Administración Pública). Once this decision becomes final, and in accordance with Article 36 of the Reglamento para regular la modalidad de prestación de servicios en teletrabajo en el Poder Judicial, it is ordered that this decision be brought to the attention of the Dirección de Gestión Humana for action within its remit.
Likewise, the Payments Unit of that Directorate shall analyze the issue of the geographic-location allowance collected by the accused herein to determine whether the amounts received while he was teleworking from his residence outside the First Judicial Circuit of the Atlantic Region should be recovered. Notice shall be given.- F) Enar Carranza Rodríguez. Ericka Sanabria Salazar. Cristian Hernández Agüero. Judicial Inspectors General”. (Sic).
III.By a written submission dated 11 de octubre de 2023, Lic. Rodrigo Flores Garrido, privately retained defense counsel for the accused (encausado), filed an appeal against the final decision in proceeding N° 2023-003252 of the Tribunal de la Inspección Judicial, issued at eight hours and eleven minutes on cinco de octubre de dos mil veintitrés.
IV.By a written submission dated 11 de octubre de 2023, the accused, [Nombre 001], filed an appeal against the final decision in proceeding N° 2023-003252 of the Tribunal de la Inspección Judicial, issued at eight hours and eleven minutes on cinco de octubre de dos mil veintitrés.
V.By resolution N° 24-2024, issued at fifteen hours and forty-five minutes on dieciocho de abril del dos mil veinticuatro, the Comisión de Relaciones Laborales made the following recommendation in this case: “After analyzing this matter in light of the proven facts and the evidence in the record (autos), this Commission recommends denying the appeals and affirming the decision issued by the Tribunal de la Inspección Judicial insofar as it concerns the breach of the telework contract, and sustaining the appeals and closing the disciplinary proceedings related to the improper collection of the geographic-location allowance.”
VI.The statutory requirements and time limits have been observed in the proceedings, and no errors or omissions resulting in nullity or denial of a defense are apparent.
CONSIDERING
The Tribunal de la Inspección Judicial deemed the following facts proven: “1) At the time of the events under investigation, the accused, [Nombre 001], served as a Judge of the Tribunal de Apelación Civil y de Trabajo de la Zona Atlántica, sede Limón; as of seis de marzo de 2023, he had accrued sixteen years-of-service increments at the Institution and had no disciplinary sanctions on record. (See official communications PJ-DGH-713-2023 and PJ-DGH-AP-0720-2023, according to information from the Dirección de Gestión Humana; this is also an undisputed fact). 2) Under the Contract Governing Telework in the Judiciary with the Judicial Employee, executed by the person under investigation, [Nombre 001], and the Dirección de Gestión Humana on 24 de junio del año 2021, he undertook to perform the duties of his position as Judge 5 by providing services under a home-based telework arrangement one day per week, specifically on Fridays, from 07:00 to 16:30 hours, at the following address: Guápiles, Barrio Santa Clara, de Motos Honda 50 norte, 100 este y 75 sur.
Accordingly, on the other days of the week, namely Monday through Thursday, he was required to report for work at the Tribunal de Apelación Civil y de Trabajo de la Zona Atlántica, sede Limón, during the same hours. (See the copy of the aforementioned contract included on the compact disc). 3) During the period from enero del 2022 through mayo del 2022, the accused failed to comply with the conditions governing the home-based telework arrangement described in the immediately preceding proven fact, because during that period he worked in person at the Tribunal de Apelación Civil y Trabajo de la Zona Atlántica, sede Limón, for one week each month and worked remotely during the remaining weeks, thereby failing to report to his workplace from Monday through Thursday of each week. As detailed below.

(See Contrato para Regular el Teletrabajo en el Poder Judicial con la Persona Servidora Judicial, signed by the investigated party [Nombre 001] and the Dirección de Gestión Humana; Control de días laborados en la modalidad presencial de jueces del Tribunal de Apelación Civil y de Trabajo de la Zona Atlántica, Limón, contained on compact disc; and also the uncontested fact). 10) From the first half of enero del 2022 through the second half of mayo del 2022, the accused improperly collected and received a total of exactly one million four hundred fourteen thousand six hundred colones as a geographic allowance, because during the weeks described in the immediately preceding proven fact, he worked under the home-based telework arrangement at an address other than the temporary residence he had listed on geographic allowance application form number ZON- 2021010646, dated 21 de setiembre del 2021. (Same reference as for proven facts 8 and 9).
The Tribunal de la Inspección Judicial did not identify any facts as unproven in this case.
Licenciado Rodrigo Flores Garrido, counsel for the accused, bases the appeal (recurso de apelación) filed on the following grounds: “FACTS SET FORTH IN THE STATEMENT OF CHARGES (TRASLADO DE CARGOS). Before setting forth the alleged errors, it is appropriate to highlight the matters addressed in the statement of charges in this case. The following charges were brought:
The serious issue is that, under this state of uncertainty, the decision-making body (órgano decisor) fell into inconsistency and intellectual contradiction by deeming the charge proven when it had practically admitted that it was not certain the alleged act had occurred; nevertheless, without hesitation, it upheld the charge and issued the corresponding finding of wrongdoing, which influenced or carried weight in the extremely severe sanction imposed. ERRONEOUS APPLICATION OF ARTICLE 36 OF THE REGULATIONS GOVERNING THE PROVISION OF TELEWORK SERVICES IN THE JUDICIARY. Among the errors in the challenged decision (resolución recurrida) in rejecting the preliminary objections alleging lack of subject-matter jurisdiction (excepciones de falta de competencia en razón de la materia) is the following statement: “Furthermore, the Regulations governing the provision of telework services in the Judiciary, approved by the Full Court at session (…), establish in article 36 the possibility of initiating disciplinary proceedings (régimen disciplinario) when the obligations established in the respective regulations or contract are breached, while of course following due process (debido proceso).” Now, in order to assess the decision-making body’s statement, it is necessary to examine matters of vital importance contained in the aforementioned Regulations that cannot be disregarded when considering the application of disciplinary proceedings, as understood by the members of the Judicial Inspection Tribunal, particularly the author of the challenged opinion (voto impugnado).
In this regard, and because it is deemed appropriate, one should begin by quoting the objective of the previous regulations governing telework at the institution, which stated: “Article 2- Objective. These regulations are intended to govern service relationships under the telework arrangement and in accordance with the new Information and Communications Technologies developed, or that may be developed, within the Judiciary, in order to ensure continued fulfillment of the objectives set forth in institutional plans, so that activities are carried out effectively and efficiently. “(Italics, boldface, and underlining supplied). The amendment to the regulations in question, adopted at session number 7. 2021, held on 15 de febrero de 2021, provides as follows: “Article 2. Purposes of these regulations. The purposes of these regulations are: a) To promote workforce participation by encouraging the provision of services under the telework arrangement. b) To facilitate a balance between the personal, family, and working lives of Judiciary personnel. c) To contribute to inclusion and gender equality. d) To increase the productivity of judicial employees. e) To strengthen judicial employees’ ability to adapt to public-health risks, as well as environmental, social, and economic challenges. f) To improve service quality. g) To promote the telework arrangement as a means of guaranteeing service continuity where necessary in accordance with the public and institutional interest. h) To reduce the expenditure of public resources within the Judiciary. i) To reduce the organization’s environmental impact. j) To strengthen sustainable development within the institution by adapting to environmental, social, economic, and public-health changes, in accordance with institutional policies and national and international environmental regulations.” The position expressed by the members of the decision-making body in the challenged decision unjustifiably disregards or avoids taking into account essential aspects of the objectives pursued by those Regulations, adopting as the guiding premise of its decision the contradiction inherent in protecting formality merely for formality’s sake.
Both the previous and current versions of the Regulations establish that the objective of telework is the effective and efficient performance of activities while ensuring continued fulfillment of the objectives set forth in institutional plans. The amendment emphasizes that the purposes of the Regulations include increasing productivity, improving service quality, and ensuring service continuity. This work arrangement also serves to support the personal, family, and working lives of Judiciary personnel. Now, pursuant to the text of article 36 of the aforementioned Regulations, we have the following: “Consequences of breach of the contract entered into by the teleworker, as well as of the provisions of these regulations. If the employee allegedly breaches the obligations established in these regulations or the respective contract, the immediate supervisor shall take the following actions: a) Initiate the actions necessary for the competent bodies to commence the applicable disciplinary proceedings, in accordance with the provisions of the Organic Law of the Judiciary, following due process through which the substantive truth of the facts (verdad real de los hechos) is established. b) Notify the Human Resources Directorate so that the contract-termination proceeding (procedimiento de resolución contractual) may be initiated in accordance with the institutional interest and the seriousness of the offense.” It is the position of defense counsel (defensa técnica) that the decision-making body’s erroneous interpretation of this provision caused it to assume jurisdiction to examine and rule upon a contractual act, namely the Institutional Telework Contract, a matter that, it bears repeating, is legally outside the purview of the Disciplinary Body.
Moreover, it did so incorrectly because, as noted, it failed to analyze the contract’s constituent elements, which are essential, such as a manifestation of intent free from defects and fulfillment or satisfaction of the purposes established as the contractual object. From the foregoing, it may be understood that, with respect to telework contracts, the Judicial Inspection’s responsibilities include monitoring compliance with working hours, as well as work performance and ensuring that the public service—which must be provided effectively and efficiently—is not adversely affected; incidentally, none of these matters was charged. None of the foregoing extensive discussion was considered in the challenged decision when rejecting the defenses alleging lack of subject-matter jurisdiction; that is, no reasoning was provided in support of the ruling. PERFORMANCE OF THE CONTRACTUAL OBJECT. As seen above, the decision-making body considered neither the purposes of the Regulations governing the provision of telework services in the Judiciary nor the objective of the Contract Governing Telework in the Judiciary with the Judicial Employee.
In this regard, it is evident that the accused’s performance under the work arrangement achieved the purposes sought through the objective of the Telework Contract, because Mr. [Nombre 001] issued more judgments than the established work quotas required. His excellent performance resulted from his effective use of working time, which exceeded the time established for the ordinary workday, enabling him to more than fulfill the objectives set forth in institutional plans. Moreover, there were no complaints from users and no interruption in service provision, thereby guaranteeing its continuity. The regrettable argument advanced by the respected members of the decision-making body, to the effect that performance was not a matter charged, disregards one of the essential purposes pursued by the Regulations and the Telework Contract, demonstrating that protection of proper public service was deemed irrelevant and therefore was not considered in the decision in this case, although it should have been.
Finally, regarding the statement in the challenged decision concerning telework shifts performed in person by the judges of the Civil and Labor Appeals Tribunal of the First Circuit of the Atlantic Zone, Limón seat, who attended in person for one full week each month on the understanding that this did not undermine the purpose contained in option 4 of article 18 of the Regulations, the decision failed to consider that this was an arrangement for service provision adopted by the Council of Judges, as the body competent to organize the court office’s work, always with the goal of providing the public service of administering justice efficiently and effectively while guaranteeing its continuity and quality. The fact that this working arrangement was subsequently submitted to the Superior Council of the Judiciary for consideration and was not endorsed by that body cannot be grounds for a finding of wrongdoing, because, in addition to the decision on the consultation having been respected, it did not diminish the authority exercised up to that time pursuant to the agreement adopted by the Council of Judges, of which the accused was not a member.
Had the decision-making body considered the defense arguments submitted to it in this regard—which, it bears repeating, were never analyzed in the challenged decision—the disciplinary body would have endeavored to look beyond the notion of formality merely for formality’s sake. Based on the foregoing facts and grounds, it is clear that the defenses or preliminary objections raised (excepciones previas opuestas) should be granted, in accordance with what has been stated here and extensively argued in the final-submissions brief. The appellate tribunal (ad quem) is therefore requested to grant them and dismiss the disciplinary case because it contains an incurable absolute defect (vicio absoluto de imposible subsanación). ABSENCE OR INSUFFICIENCY OF REASONING REGARDING THE CHARGE OF NONCOMPLIANCE WITH THE REGULATIONS GOVERNING THE PROVISION OF TELEWORK SERVICES IN THE JUDICIARY. Another error in the challenged decision is its failure to analyze—and the resulting impossibility of determining—the reasons why the decision-making body did not accept as a fact consistent with the substantive truth of the matter investigated the error or defect in the accused’s manifestation of intent when he signed the telework contract.
As occurred with the ruling on the preliminary objections, with respect to the charge of noncompliance with the aforementioned Regulations, although the reasons supporting the existence of an error when indicating the selected telework arrangement on the form were specifically summarized, the Tribunal members did not explain why they rejected the arguments of the accused personally and of defense counsel (defensa material y la técnica). Of the defense arguments submitted, only the following was assessed: “At this point, it is appropriate to address the defense argument that an agreement had already been adopted by the Council of Judges providing for work under that arrangement, with one week in person at the court office and the remaining weeks of the month by telework; that the accused did not participate in adopting that agreement but merely proceeded to perform his duties as directed by the Tribunal’s highest administrative body, without questioning it while serving on an interim basis because he believed it complied with institutional guidelines.
In this Tribunal’s view, that argument is unacceptable because there was a signed contract (contrato), with which the investigated party was required to comply. This is so much the case that, when public servant Burnella Sinclair Mitchell, judicial coordinator of the Tribunal de Apelación Civil y de Trabajo de la Zona Atlántica, sede Limón, requested by email dated 7 de abril de 2022 that the Consejo Superior maintain that arrangement—namely, that each of the four judges of that Tribunal attend one week per month to complete the five days of in-person work assigned to them—and that, if that scenario were not approved, it be determined that the judges would have to attend two days every two weeks, so that the mandatory in-person day would be completed twice per month, that request was denied by the Consejo Superior in a resolution adopted at session número 34, held on 26 de abril de 2022, Artículo LXVII, which was reviewed through the Nexus PJ system.
Subsequently, at the Consejo de Jueces held on 16 de mayo de 2022, in which the investigated party [Nombre 001] participated, it was agreed that each of the four judges would continue working in person one day per week, pursuant to artículo18 opción 4 of the Reglamento para regular la modalidad de prestación de servicios en teletrabajo en el Poder Judicial, with the accused being required to work in person on Tuesdays according to the schedule agreed upon as of 6 de junio de 2022. Fridays of each week were also designated as optional, for instances in which the judges encountered an unforeseen circumstance on the day they were scheduled to work in person, allowing them to fulfill their in-person attendance requirement on Friday. Accordingly, during the period from junio 2022 through enero 2023, the accused continued working under in (sic) an arrangement different from the one to which he had committed in the aforementioned contract, because during that period he appeared to work in person at the Tribunal de Apelación Civil y de Trabajo de la Zona Atlántica, sede Limón, only on Tuesdays of each week, departing from the signed contract and despite the fact that the Consejo Superior had rejected the Tribunal’s request (…) thus demonstrating once again that, during that period, he worked under an arrangement different from the one to which he had committed in the contract he signed and which was referenced above.” The foregoing demonstrates the absence of any analysis and, consequently, any statement of reasons (motivación) regarding the claim of mistake or defect in consent (error o vicio de la voluntad) concerning the telework contract (contrato de teletrabajo) signed by my client, with the decision-making body (órgano decisor) relying solely on the fact that Mr. [Nombre 001] did not carry out the telework arrangement that he had signed.
Likewise, as explained supra, the purpose set forth in the Contrato de Teletrabajo was duly fulfilled; therefore, there can be no finding of breach of contract (incumplimiento contractual) or of the repeatedly cited Reglamento. CONSEQUENCE OF THE FAILURE TO PROVIDE REASONS REGARDING THE CLAIM OF MISTAKE IN SIGNING THE CONTRACT. Based on the foregoing, with respect to the Contrato de Teletrabajo signed by my client, he explained that a clerical error (error material) occurred when he selected an option on the form created for that purpose. Pursuant to artículo 18 of the Reglamento para regular la modalidad de prestación de servicios en teletrabajo en el Poder Judicial, he mistakenly selected opción 1, downloading and signing the form by which he committed to work 4 days at the office and 1 day outside it, when in fact he believed that he had signed the form for opción número 4, namely, the one providing for 1 day at the office and 4 days outside it.
Having stated his reasons, under which, by applying the rules of sound judicial discretion (sana crítica), the explanation given by the accused should have been accepted and the existence of a mistake recognized, because his intention at all times was to telework under modalidad 4. Of particular importance to that decision was the fact that he was a person with risk factors, as he suffered from chronic hypertension and excess weight, which he duly substantiated. Under those conditions, it would be contrary to reason, logic, and common sense for him, given the virulence and mortality associated with SARS-Cov-2, which led to the declaration of the health emergency, to select the arrangement that exposed him to the greatest risk of infection. It is likewise consistent with the rules of sound judicial discretion that, had Mr. [Nombre 001] realized that he had made a selection error, he would have taken the necessary steps to modify the mistakenly selected telework arrangement, citing the risk factors supported by a medical opinion.
For that reason, correction of the work arrangement to the one most suitable for him would have been warranted—an arrangement under which, incidentally, he worked in the belief that he was acting correctly—and the mistake could also have been remedied by adding an addendum (adendum) to the contract. There is no explanation of the reasoning on the basis of which the decision-making body should have disbelieved Mr. [Nombre 001]’s statements and proceeded on the premise that the contract possessed legal validity and effectiveness (validez y eficacia jurídica), while repeatedly emphasizing the circumstances that it deemed to constitute a breach of contract, all as a result of its failure to assess the claim concerning the existence of a defect or mistake in contractual consent (voluntad contractual). ABSENCE OF REASONS REGARDING THE ALLEGATION OF THE ALLEGED IMPROPER COLLECTION OF THE GEOGRAPHIC DIFFERENTIAL ALLOWANCE (ZONAJE).
As quoted above, the challenged decision stated the following: “Now then, it was likewise established that the person prosecuted herein improperly collect (sic) and received the geographic differential allowance from the first (sic) half of enero through the second half of mayo del año 2022. Indeed, Mr. [Nombre 001] signed the geographic differential allowance request form número ZON-2021010101646 dated 21 de setiembre del 2021 (…). Therefore, under those working conditions, the accused (sic) improperly collected and received the geographic differential allowance because he received it while teleworking from his place of residence or actual domicile (domicilio real), a situation that was not even brought to the attention of the Dirección de Gestión Humana, Unidad de Pagos, so that it could analyze whether payment of the geographic differential allowance was appropriate under those working conditions.
Accordingly, because the facts described in the statement of charges (formulación de cargos) have been reliably established, in this Chamber’s view and in light of the foregoing, there is no doubt that there are grounds in this case to apply the disciplinary regime (régimen disciplinario) against the public servant charged herein, [Nombre 001].” (Boldface, italics, and underlining supplied). Among the arguments omitted from consideration that had been presented in response to the final hearing (audiencia final), it was reiterated that my client worked under the Teletrabajo opción 4 schedule and not opción 1, as mistakenly stated in the contract he signed. It was also emphasized as an important consideration that, regardless of which work-schedule arrangement applied, it was clear that he was required to pay rent for a place where he could spend the night, prepare meals, rest after the workday, and meet any other need arising from travel away from his “actual domicile.” Under these circumstances, the following questions necessarily arose: What legal provision had been violated?
Where was it established that, even when working under Teletrabajo opción 4—that is, attending the office in person 1 day—the entitlement to payment of that benefit ended or had to be suspended, and what means would be available to cover the expenses that public servants were required to incur to perform their duties when they had to travel from their actual domiciles to their offices? What had the institution provided for and authorized under those circumstances? Travel expenses (viáticos)? It is also entirely valid to ask: where is it established that telework expenses at the “actual domicile” must be borne by the worker? It was also argued that no consideration had been given to the fact that judicial public servants who have “temporary domiciles” (domicilios accidentales) had undertaken rental obligations and that payment was not contingent on the vicissitudes arising from the health emergency, particularly when the public servant was required to report in person to the workplace.
Likewise, my client received no instruction indicating that, because he was actually working under Teletrabajo opción 4, he should have relinquished the geographic differential allowance payment system and had to use another procedure to claim those expenses or, alternatively, pay them out of his own pocket when he had to travel to the Tribunal de Apelación Civil y de Trabajo de la Zona Atlántica. The factual truth (verdad real) is that Mr. [Nombre 001] incurred lodging expenses because of the work arrangements agreed upon by the Colegio de Jueces and was required to maintain the lease commitment for his “temporary domicile” in the city of Limón, as witness [Nombre 002] stated. The Tribunal de la Inspección was informed that, as of that date, no administrative proceeding (procedimiento administrativo) had been initiated for Mr. [Nombre 001] to reimburse the amount that the Inspector Auxiliar Instructor stated he had improperly collected and received, yet that information was neither analyzed nor considered in the decision.
As explained in the final-argument brief (libelo de alegatos finales), it may readily be inferred that the health emergency caused by the SARS-Cov-2 pandemic created new institutional challenges regarding how continuity in the provision of public services was to be maintained, given the restrictions imposed by the Ministerio de Salud in response to the threat posed by the pandemic. This caused justified concern among the general population, including judicial public servants, and raised questions regarding how judicial offices were to operate and how they were to interact with users. In addressing the situation, loose ends and gaps such as the one presented here inevitably remained. Thus, conspicuously absent was the adoption of a resolution establishing that the geographic differential allowance payment forms of public servants who chose Teletrabajo opción 1 or 4 were rescinded or rendered ineffective, as well as a determination that telework could not be performed outside the “temporary domicile.” INCONSISTENCY IN THE RULING REGARDING THE ALLEGATION OF THE ALLEGED IMPROPER COLLECTION OF THE GEOGRAPHIC DIFFERENTIAL ALLOWANCE.
In addition to the failure to analyze the arguments presented regarding the lack of merit of the allegation at issue, there is an extremely serious inconsistency or contradiction in the challenged decision. In recital IV (considerando IV), it stated the following: “(…) it was established that the person prosecuted herein improperly collect (sic) and received the geographic differential allowance (…).” (Emphasis supplied). This stands in stark contrast to the statement in recital V.- (considerando V.-): “(…) it is ordered that this decision be brought to the attention of the Dirección de Gestión Humana for action within its purview. Likewise, the Unidad de Pagos of that Directorate shall analyze the issue of the accused’s collection of the geographic differential allowance in order to determine whether recovery of those amounts received while teleworking from his place of residence, outside the Primer Circuito Judicial de la Zona Atlántica, is appropriate.” (Italics, boldface, and underlining supplied).
What was ordered is strange and unheard of: if the decision-making body stated that it was certain the geographic differential allowance had been improperly collected, why did it refer the case for the matter of that collection to be analyzed and for the Departamento de Gestión Humana to determine whether recovery of the amounts paid was appropriate? That instruction demonstrates that, to date, the decision-making body is not certain that an improper collection occurred.
Furthermore, because it assumed jurisdiction (competencia) that did not belong to it, the disciplinary body finds it necessary for the Dirección de Gestión Humana to rule on the payment of the geographic differential allowance (Zonaje) under the conditions of telework (teletrabajo) option 1 or 4, when the official was teleworking from their “legal residence” (“domicilio real”), where they personally had to bear the costs involved in performing the workday in this manner, or whether, in the case of the same remote work, the judicial employee was required to continue teleworking at their “temporary residence” (“domicilio accidental”). Thus, once that Department had determined that the payment was improper and had taken the appropriate steps to recover the funds, the case would then be referred to the institution’s Dirección Jurídica so that it could conduct the corresponding administrative proceeding (procedimiento administrativo), in accordance with the Ley General de Administración Pública.
Once the opinion of the Departamento de Gestión Humana had been assessed and the Dirección Jurídica had established that willful misconduct or negligence had caused financial harm (perjuicio patrimonial), requiring reimbursement of the improperly received monetary amount, disciplinary proceedings (régimen disciplinario) would then be initiated. DISPROPORTIONALITY OF THE SANCTION IMPOSED AND HARM TO THE PROPER DELIVERY OF PUBLIC SERVICES. Finally, the reasoning outlined by the decision-making body for severely punishing Judge [Nombre 001] is raised as a ground of appeal (agravio), as it classified the offense as extremely serious and imposed a sanction of two months’ suspension without pay. This was done even though, as extensively argued in the exercise of the substantive and technical defense (defensa material y técnica), there are no grounds for applying the disciplinary regime in this case.
Paradoxically, the Tribunal’s decision seriously impairs the proper delivery of public services because it suspends a judge who has demonstrated a commitment to excellence in service delivery through his proven performance and who, during his seventeen years working at the institution, has had no incidents in his professional or private life warranting the application of the disciplinary regime. REQUEST. In accordance with the foregoing and the cited legal provisions, I request that the objections raised (excepciones interpuestas) be upheld and that, based on the matters extensively set forth above, the final decision issued at 08:11 hours on 5 de octubre del año en curso be reversed, that this case against Judge [Nombre 001] be dismissed, and that the case file (expediente) be closed.”
Mr. [Nombre 001] bases his disagreement on the following grievances (agravios): “(…) FACTS SET FORTH IN THE STATEMENT OF CHARGES (TRASLADO DE CARGOS). Before presenting the grievances, it is considered appropriate to highlight the matters included in the statement of charges in this proceeding, under which the following allegations were made:
ABSENCE OF REASONING (FUNDAMENTACIÓN) AND ASSESSMENT (VALORACIÓN) OF ELIGIBILITY FOR PAYMENT OF THE LOCATION ALLOWANCE (ZONAJE) DURING THE TELEWORK (TELETRABAJO) SCHEDULE DEEMED PROVEN IN PROVEN FACT 3 OF THE JUDGMENT (ONE WEEK PER MONTH IN PERSON AND THREE REMOTELY THROUGH TELEWORK) Continuing with the outrageous conclusions arising from the Tribunal’s decision, as stated from the outset in responding to the notice of charges, pursuant to an agreement of the Council of Judges, of which the accused was not a member, it was agreed that each judge would attend in person one week per month and work the remaining three weeks remotely through telework. The Tribunal had operated in this manner since the pandemic and until the Consejo Superior del Poder Judicial denied the authorization requested by the Tribunal. Thus, during the period from January 2022 through May 2022, the employee [Nombre 001] did in fact provide services in person at the office on the following dates: Del 24 al 28 de Enero del 2022, del 07 al 11 de febrero del 2022, del 28 de marzo al 01 de abril del 2022, del 25 al 29 de abril del 2022 and mayo del 16 al 20 de mayo del 2022, as well as during earlier periods, since this was how the Tribunal was organized.
When the undersigned signed and submitted location-allowance form ZON-2021010646 on 21 de setiembre del 2021, he listed his actual domicile (domicilio real) as: [...], and his temporary domicile (domicilio accidental) as: [...]. It is also true that the address listed in the telework agreement as the domicile from which home-based telework was to be performed was the same address listed as the actual domicile on location-allowance form ZON-2021010646, namely, the address of his home in Guápiles. However, he did so because, from the beginning of his appointment to the Tribunal, an internal rotating telework arrangement had been adopted by agreement of the Council of Judges, as a result of the difficulties experienced by the institution in maintaining continuity of service, under which personnel attended in person one week per month and worked remotely during the other three weeks. This arrangement was already in place and operating in this manner when the undersigned submitted location-allowance form ZON-2021010646.
Accordingly, during the week in which he provided services in person from Monday through Friday, he traveled to Limón and resided for that week at: [...], apartments at the rear, thereby incurring lodging, food, transportation, and other expenses for which the location allowance is established by regulation. In total, during the period from January 2022 through May of that same year, he worked the periods from 24 al 28 de Enero del 2022, 07 al 11 de febrero del 2022, 28 de marzo al 01 de abril del 2022, 25 al 29 de abril del 2022 and mayo del 16 al 20 de mayo del 2022. It is not the case that the employee was required to provide home-based telework services at the address listed on the location-allowance form, as the Tribunal arbitrarily and recklessly interpreted it. Indeed, it was among the matters proven in the disciplinary proceeding and reflected in the ruling that, by means of an administrative act of the Council of Judges, the Tribunal adopted a telework arrangement consisting of one week of in-person work and three weeks of telework.
Whether or not that arrangement complied with the regulations would require an assessment of the validity of the act approved by a Council of Judges, which is not part of this proceeding. For purposes of processing the request for recognition of the location-allowance salary supplement (sobresueldo de zonaje), there was an actual domicile, understood as the place where he resided permanently and maintained his principal residence with his immediate family, which was the same address listed in the telework agreement, and a temporary domicile, understood as a temporary residence or occasional dwelling, located at: [...]. That was the place to which the employee [Nombre 001] relocated during the one week per month in which he provided services in person at the Tribunal. Therefore, the assertion by the drafting inspector Carranza Rodríguez that the “accused improperly claimed and received the location-allowance component because he received it while teleworking from his residence or actual domicile” is untrue.
Indeed, as she deemed proven in proven fact three, during the period from January through May 2022 the employee [Nombre 001] worked “one week per month in person at the Tribunal de Apelación Civil y Trabajo de la Zona Atlántica, sede Limón, and the remaining weeks under a home-based telework arrangement.” The conclusion serving as the basis for imposing a penalty for the facts related to the location allowance is therefore completely false. The inspector cannot deem it proven in proven fact three that services were provided under a telework arrangement involving one week in person and three weeks at home and, at the same time, apparently driven solely by the determination to impose a penalty at all costs, as though it were the only possible option, conclude that the undersigned improperly received that salary component. It bears repeating that she deemed it proven in proven fact three that, during the period from January through May 2022, he worked one week per month in person at the Tribunal de Apelación Civil y Trabajo de la Zona Atlántica, sede Limón, and the remaining weeks under a home-based telework arrangement.
He worked in person, it bears repeating, during the periods from 24 al 28 de Enero del 2022, 07 al 11 de febrero del 2022, 28 de marzo al 01 de abril del 2022, 25 al 29 de abril del 2022 and mayo del 16 al 20 de mayo del 2022. During those weeks, the undersigned remained from Monday through Saturday at the temporary domicile listed on location-allowance payment application ZON-2021010646. Thus, the manner in which the conclusion is reached and argued recklessly and rashly distorts the factual record, apparently for the sole purpose—it cannot be understood otherwise—of imposing a penalty at all costs. And what a penalty: suspending for two months a judge with an impeccable career, a demonstrated record of work performance, and no disciplinary history since joining the institution. It is inconceivable that the Tribunal de la Inspección could simply treat the receipt of the location allowance as improper when its members are well aware that the salary supplement was established as follows: “...Article 3º- The location allowance is granted to compensate the beneficiary for the greater expenses and different living conditions that the beneficiary is required to incur when, in the institutional interest, the beneficiary provides services at a location other than the place where the beneficiary’s actual domicile is established, in accordance with the zones and percentages specified in Article 7 of these Regulations...”.
Under this provision, the supplement is granted to judicial officials as compensation for the greater expenses and different living conditions they must face when, in the institutional interest, they are appointed to a location other than the place where their actual domicile is established. It is a supplement intended to reimburse extraordinary housing, utility, food, transportation, and other expenses that a person must incur when, in the institutional interest, that person is relocated to reside in one of those zones; its purpose is to compensate for the extraordinary expenses that a person appointed to one of those zones must incur. Consequently, if, during the period in question, the undersigned remained in Limón for one week, rented an apartment, purchased food, paid for utilities, and incurred transportation expenses, he incurred precisely the expenses for which the salary supplement was established, and therefore could never be deemed to have claimed it improperly.
It is true that the Regulations do not address contemporary circumstances such as telework service, which is why work is underway on a regulatory amendment, a matter of which the members of the Consejo Superior are fully aware. Nevertheless, if he worked one week per month and remained on telework during the other three, during the in-person week he relocated his domicile to Limón, to the address listed on location-allowance form ZON-2021010646: [...]. The Tribunal’s conclusion that he received the salary supplement while at his home performing telework is therefore untrue. Accordingly, in assessing the undersigned’s conduct in relation to the alleged offense of improperly claiming the location allowance, it must be concluded that the conduct lacks the elements of the offense (tipicidad), because he did have a temporary domicile to which he relocated for at least one week per month and worked in person during that period.
It must therefore be inferred that [Nombre 001]’s conduct satisfies the requirements or rules established in the Reglamento de Zonaje, for which reason the conduct is NOT an offense because it is provided for in the Regulations. Moreover, if we analyze unlawfulness (antijuridicidad), it must be concluded that the conduct was authorized by the Reglamento de Zonaje and that there was no injury to the protected legal interest (bien jurídico), because although Mr. ALVARADO collected the location allowance for 4 months, it is also true that he maintained a temporary domicile for 1 or 2 weeks per month during that period and had to equip an office in his home with everything necessary to perform his work. His conduct was therefore consistent with the requirements of the Reglamento de Zonaje, which means that if the conduct was authorized by the Regulations and there was no injury to the protected legal interest—because the work was performed in a timely manner, in compliance with the schedules and work quotas—and there was likewise no financial loss, it must be concluded that the conduct does not constitute an offense and is legally permissible.
Regarding this final point, although the Tribunal knew that the person subjected to these proceedings did perform work in person and had to use the temporary domicile for that purpose, it failed to address any of these matters and merely stated that a violation of the Regulations existed and that the payment was improper, without providing any reasoning or grounds or analyzing the reasons leading it to conclude that there had been a contractual breach. DISPROPORTIONALITY OF THE PENALTY IMPOSED AND HARM TO THE PROPER PROVISION OF PUBLIC SERVICES. Finally, the reasoning advanced by the decision-making body to punish the undersigned severely, by classifying the offense as extremely serious and imposing a penalty of two months’ suspension without pay, is raised as a ground for appeal. This is so even though, as extensively argued in the exercise of the substantive and technical defense, there are no grounds for applying the disciplinary regime in this case.
Paradoxically, the Tribunal’s decision causes serious harm to the proper provision of public services because it suspends a judge who has demonstrated that his values include excellence in service delivery, as evidenced by his documented performance, and who, in his seventeen years of working at the institution, has had no incidents in his professional or private life warranting application of the disciplinary regime.
In imposing the sanction, the Tribunal argues that I have 16 years of experience and must therefore know the expected conduct; however, telework (teletrabajo) is something new, a recently implemented arrangement that has been applied more generally and widely for no more than three years, and that only began to be implemented institution-wide after the end of the pandemic. Accordingly, it is not true that the accused’s 16 years of experience should be analyzed with the superficiality and oversimplification employed by the Tribunal. There has been a change in circumstances: this entire new reality arose after the pandemic, with the implementation of telework as a new working arrangement. As stated in the response to the notice of charges (traslado de cargos), various regulatory provisions concerning telework during the pandemic have been issued by Corte and Consejo Superior. Indeed, a proposed amendment to the zone allowance regulations (reglamento de zonaje) would introduce a mixed form of service for persons who work partly in person and partly through telework, as a response by Corte precisely to this existing reality and new form of service delivery. Therefore, it is not true that the matter should be assessed with the severity applied by the Tribunal in imposing a sanction. In the worst-case scenario, there is uncertainty regarding the interpretation of a regulatory provision, something that arises daily in the exercise of judicial authority (potestad jurisdiccional), and one cannot proceed from the severe conclusion that these are extremely serious acts and come close to revoking my appointment. If the application of disciplinary law (derecho sancionatorio) necessarily derives its significance from the improper administration of justice and the institution’s public image, it cannot be concluded, as is being done here, that I am committing an extremely serious offense and should be sanctioned with such severity. I have never been the subject of disciplinary proceedings; I have always met and exceeded my work quotas, consistently giving more than expected. I have been an honorable judge who has fully fulfilled the institution’s purposes, and Inspección Judicial cannot act as it is doing and reward my career with such an outrage. This is something that discourages you and directly affects the morale of anyone in my position. REQUEST. In accordance with the foregoing and the cited legal provisions, I request that the defenses raised (excepciones interpuestas) be granted and that, based on the matters extensively set forth above, the final decision issued at 08:11 hours on October 5 of this year be reversed, these proceedings be dismissed, and the case file (expediente) be closed.” (Sic).
For his part, Rodrigo Flores Garrido, counsel privately retained by the accused, bases the appeal filed on the following grounds:
Given that the appeal filed by Rodrigo Flores Garrido, counsel privately retained by the accused, focuses on several interrelated grounds, and that some of them are closely related to the arguments presented by appellant [Nombre 001], acting in his own defense, they shall be analyzed as follows.
V.1. Regarding the defense’s first ground, namely, the alleged absence or insufficiency of reasoning in the appealed decision concerning the objection or defense asserting lack of subject-matter jurisdiction. The accused’s legal defense contends that the challenged decision contains insufficient reasoning regarding the objections or defenses asserting lack of subject-matter jurisdiction, arguing that the disciplinary forum lacks jurisdiction to examine matters concerning contractual breaches and to determine financial losses. Opinion of the appellate body (órgano de alzada). This Panel (Órgano Colegiado) disagrees with the position advanced by the accused’s legal defense because, as the court below (a quo) correctly stated in the reasoning for its judgment, the authority to adjudicate in this forum possible breaches of the telework contract governed by the Reglamento para regular la modalidad de prestación de servicios en teletrabajo en el Poder Judicial is established in the very rule governing that arrangement, specifically Article 36, which provides: “Article 36.
Consequences of noncompliance with the contract executed by the teleworker, as well as with the provisions of these regulations. If the public servant allegedly fails to comply with the obligations established in these regulations or the respective contract, the immediate superior shall take the following actions: a) Initiate the actions necessary for the competent bodies to commence the applicable disciplinary proceedings (régimen disciplinario), pursuant to the Ley Orgánica del Poder Judicial, following due process (debido proceso) in which the actual truth of the facts is established. b) Notify the Dirección de Gestión Humana so that contractual termination proceedings may be initiated in accordance with the institutional interest and the seriousness of the offense” (Underlining and boldface not in the original). In this Chamber’s opinion, the Administration’s conduct has at all times been lawful, since, in the present case, because Mr. [Nombre 001] breached the telework contract, the proper course is to conduct the corresponding disciplinary procedure, as required by the regulations.
Accordingly, the lack of jurisdiction alleged by Mr. Flores Garrido has no legal basis. As the appealed decision states, the Sala Constitucional has reiterated that there is no impediment whatsoever to investigating and deciding administratively whatever is appropriate regarding the contractual breach alleged against Mr. [Nombre 001]. In that regard, it is clear that the insufficient reasoning alleged by the accused’s legal defense is unsupported, given that the facts alleged against the accused, which form the basis of the order serving notice of charges (auto de traslado de cargos) issued in these disciplinary proceedings, plainly do fall within the cognizance of this administrative disciplinary forum. Therefore, the ground asserted lacks the force required to alter the ruling and is consequently rejected.
V.2. As a second ground, the appellant’s legal defense alleges an erroneous interpretation of the decisions of the Sala Constitucional, a ground closely related to the first ground already analyzed, contending that: “the intention of the justices of the Sala Constitucional was not to confer upon the disciplinary body the authority to assume or replace the jurisdictional and administrative bodies in the exercise of their powers, but rather to permit them to be adjudicated without impediment. Liabilities arising from the same act or acts may be adjudicated in the different judicial or administrative forums in which the conduct must be processed, but within the framework established for the exercise of their respective powers. Thus, the disciplinary body may not rule on the criminal, civil, or financial matters and liabilities of its personnel unless those matters have first been considered by the legally competent bodies established by law.
In this regard, the fundamental meaning of the constitutional case law cited, judgment N° 1265-95 de las 15:36 horas del 7 de marzo de 1995, was misinterpreted, because it established that liabilities arising from the same act do not preclude their adjudication in different proceedings, without this entailing a violation of the ‘non bis in idem’ or ‘noter in idem’ principle.” (Boldface in the original). Opinion of the appellate body. Regarding the arguments presented by the legal defense, this Panel must state that they are unfounded, since consideration must be given to the position established by the Procuraduría General de la República in its opinion N°245-99 del 16 de diciembre de 1999, which summarizes the relevant criteria advanced by the Sala Constitucional regarding the absence of a violation of non bis in idem when a person is subject to two proceedings in different forums. The points relevant to these disciplinary proceedings are as follows: “* The non bis in idem principle forms an integral part of due process (4410-97 de 29 de julio de 1997). * No constitutional provision prohibits imposing different types of sanctions for the same act.
(Votos 6699-94 de 15 de noviembre de 1994, 5412-95 de 4 de octubre de 1995, 6775-95 de 28 de noviembre de 1995, 5599-96 de 22 de octubre de 1996). * A breach of duty does not have uniform consequences, because it may consist of a violation of a merely disciplinary rule, without other consequences, or may constitute a criminal offense, or may entail compensation. The non bis in idem principle would be violated only where the liabilities and sanctions are of the same type. (Votos 1265-95 de 7 de marzo de 1995, 6687-96 de 10 de diciembre de 1996). * The same act may be subject to administrative and criminal sanctions because the administrative and criminal forums are independent with respect to the imposition of sanctions. (Votos 1569-93 de 31 de marzo de 1993, 3484-94 de 8 de julio de 1994, 4100-94 de 9 de agosto de 1994, 364-95 de 18 de enero de 1995, 2628-95 de 23 de mayo de 1995, 364-95 de 18 de enero de 1995, 5450-96 de 16 de octubre de 196).” (Underlining and boldface not in the original).
As may be seen, this case-law standard leaves the appellant’s argument unsupported insofar as he maintains that the conduct alleged against Mr. [Nombre 001] cannot be adjudicated administratively because, as stated above, the administrative forum is legally authorized to investigate conduct contrary to the regulatory provisions governing telework and the geographic-area allowance in the Judicial Branch; accordingly, any sanctions resulting from application of the disciplinary regime are, of course, administrative in nature. It should be noted that the geographic-area allowance is governed by the Reglamento para el Pago de Zonaje del Poder Judicial, Article 11 of which provides: “Article 11.-Any public servant who improperly receives payment of the geographic-area allowance shall have the amount disbursed by the Judicial Branch deducted pursuant to Article 173 of the Código de Trabajo and the ‘Reglamento General para el control y recuperación de acreditaciones que no corresponden,’ Decreto Ejecutivo N° 34574-H del 14 de mayo de 2008.
Furthermore, if the public servant knew that the benefit was not applicable and failed to notify the Departamento de Gestión Humana, or obtained it improperly, the disciplinary regime established in the Ley Orgánica del Poder Judicial shall apply.” Thus, the Administration is duly authorized to commence administrative disciplinary proceedings and, where appropriate, to impose a disciplinary sanction. Lastly, regarding the defense’s assertion that the jurisdiction of the Dirección de Gestión Humana was improperly assumed—which, in its opinion, entails nullity—because the appealed judgment stated: “Likewise, the Unidad del Pagos of that Directorate shall analyze the issue of the accused’s collection of the geographic-area allowance in order to determine whether recovery is appropriate for the amounts received while teleworking from his residence outside the Primer Circuito Judicial de la Zona Atlántica”; this Superior Body finds that no jurisdiction was improperly assumed because noncompliance with the regulations governing the geographic-area allowance must first be established before the corresponding instructions may be issued to the technical departments—in this case, Gestión Humana—so that they may calculate and recover the amounts improperly received on that basis.
As may be seen, there is neither any defect in the proceedings nor any improper assumption of jurisdiction, as alleged by the appellant’s representative, that could even warrant consideration of the claimed nullity. Therefore, the asserted ground is rejected.
V.3 As the fifth and sixth grounds for grievance (motivos de agravio), the defense alleges Performance of the Purpose of the Contract and an Absence or Insufficiency of Reasoning regarding the charge of noncompliance with the regulations governing the provision of services through telework in the Judiciary. Attorney Flores Garrido maintains that the appealed decision lacks or contains insufficient reasoning regarding the charge of noncompliance with the Regulations Governing the Provision of Services through Telework in the Judiciary (Reglamento para regular la modalidad de prestación de servicios en teletrabajo en el Poder Judicial), emphasizing that there was a defect in the accused’s expression of intent (manifestación de voluntad) when he signed the telework contract. This point is related to the second ground raised by appellant [Nombre 001] in his appeal, according to which the alleged violations did not occur.
Finding of the appellate body (órgano de alzada): The appellant’s contention is unfounded, since it is clear that, when signing the respective telework contract, the accused [Nombre 001] should have exercised due care and verified that the option he wished to select was correct and suited his interests. His claim at this stage that he mistakenly selected the option of four in-person days and one telework day instead of four telework days and one in-person day cannot be accepted. At the time, Mr. [Nombre 001] should have verified whether the telework option he had selected for the contract he was signing, which would be sent to the Telework Program for proper registration, was correct in light of his circumstances and interests. He should not have acted as he did, namely, by changing the arrangement concerning the number of days on which he would telework without first reaching an agreement with the employer, and without even giving prior notice to obtain authorization ensuring compliance with institutional interests and the proper provision of public services.
It must be recalled that an error creates no right, and from the outset Mr. [Nombre 001] was the interested party responsible for ensuring that the number of telework days was specified in the contract. Article 23 of the Regulations Governing the Provision of Services through Telework in the Judiciary provides, insofar as relevant: “Article 23. Compliance with regulations. The teleworker must comply with all conditions established by the rules, regulations, and institutional directives applicable to this arrangement.” Therefore, as established by the evidence entered into the record (autos), it has been proven that the accused failed to comply with the terms of his telework contract. Instead of attending his workplace in person four days per week and teleworking one day per week, he unilaterally decided, without notifying the employer, to telework four days and attend in person one day. Accordingly, this appellate body fully concurs with the arguments set forth by the Tribunal de la Inspección Judicial in the thorough reasoning supporting its judgment, specifically regarding the failure to comply with the agreed terms governing the days on which the appellant [Nombre 001] had undertaken to report to the office in person, as the challenged decision clearly states: “(…) Having assessed the evidence supporting the statement of proven facts (relación de hechos probados), as well as the arguments presented by the respondent in his defense and the exculpatory evidence (prueba de descargo) submitted, this Chamber finds it clear that the accused [Nombre 001] failed to comply with the conditions governing the provision of services under the home-based telework arrangement, to which he committed by signing the Contract Governing Telework with the Judiciary on 24 de junio de 2021.
A copy of that contract is contained on a compact disc admitted into evidence, and it clearly shows that, in his capacity as Judge 5 of the Tribunal de Apelación Civil y de Trabajo de la Zona Atlántica, based in Limón, he would work under that home-based arrangement one day per week, specifically on Fridays, from 07:00 to 16:30, at the following address: [...]; consequently, on the other days of the week, namely Monday through Thursday, he was required to report for work at that Tribunal. It was duly proven that the person under investigation did not do so, since during the period from enero del 2022 through mayo del 2022, he worked in person one week per month and worked under the home-based telework arrangement during the remaining weeks, thereby failing to report to the workplace from Monday through Thursday of each week. This was established through the evidence consisting of the Record of Days Worked In Person by Judges of the Tribunal de Apelación Civil y de Trabajo de la Zona Atlántica, Limón, and the Excel file entitled ‘Copia de GIS 386421 TT presencial,’ documents contained on a compact disc.
As indicated, these constitute the evidentiary basis for the data in the table accompanying proven fact 3, which shows, for the period from enero to mayo del año 2022, the week during which the accused worked in person, the weeks during which he worked under the telework arrangement, and the days of each month on which he was required to report to his workplace in person but failed to do so, remaining instead under the telework arrangement. This demonstrates his failure to comply with the conditions of the contract he signed. At this juncture, it is appropriate to address the defense argument that the Colegio de Jueces had already reached an agreement under which the judges would work in person at the office one week per month and telework during the remaining weeks; that the accused did not participate in that agreement, but merely proceeded to perform his duties as directed by the Tribunal’s highest administrative body, without questioning the arrangement while serving on an interim basis because he believed it complied with institutional guidelines.
In this Tribunal’s view, that argument is unacceptable because there was a signed contract with which the person under investigation was required to comply. Indeed, when Burnella Sinclair Mitchell, judicial coordinator of the Tribunal de Apelación Civil y de Trabajo de la Zona Atlántica, Limón office, requested by email dated 7 de abril de 2022 that the Consejo Superior maintain that arrangement—namely, that each of the four judges of that Tribunal attend one week per month to complete the five in-person days required of them and that, if that arrangement were not approved, it be determined that the judges would have to attend two days every two weeks so as to satisfy the mandatory in-person day twice per month—the request was denied by the Consejo Superior in an agreement adopted at session number 34, held on 26 de abril de 2022, Article LXVII, which was reviewed through the Nexus PJ system.
Thereafter, at a meeting of the Consejo de Jueces held on 16 de mayo de 2022, in which the person under investigation [Nombre 001] participated, it was agreed that the four judges would continue working under the telework arrangement and that each would work in person one day per week, in accordance with Article 18, option 4, of the Regulations Governing the Provision of Services through Telework in the Judiciary. Under the schedule agreed upon as of 6 de junio de 2022, the accused was assigned to work in person on Tuesdays. Fridays of each week were also designated as optional days for situations in which a judge encountered an unforeseen circumstance on the day he or she was scheduled to work in person, allowing the judge to satisfy the in-person attendance requirement on Friday. Thus, during the period from junio 2022 through enero de 2023, the accused continued working under an arrangement different from the one to which he had committed in the aforementioned contract.
During that period, he reported to work in person at the Tribunal de Apelación Civil y de Trabajo de la Zona Atlántica, Limón office, only on Tuesdays of each week, departing from the signed contract even though the Consejo Superior had rejected the Tribunal’s request. The table accompanying proven fact 6 identifies, by month, the days on which the accused was required to work in person but instead worked under the telework arrangement, as well as the day on which he worked in person. This once again demonstrates that, during that period, he worked under an arrangement different from the one to which he had committed in the contract he signed and which was referenced above.” (Sic). The decision under appeal is therefore unequivocal in addressing the reasons that led the lower Tribunal (Tribunal de instancia) to adopt its decision. Those reasons are entirely persuasive in establishing that Mr. [Nombre 001] unquestionably failed to comply with the telework contract and that it was his responsibility to verify the terms under which it had been executed so that he could comply with them fully.
If he believed otherwise, he should have sought the necessary contractual adjustments and amendments after first reaching an agreement with the administration; under no circumstances should he have proceeded as he did, unilaterally changing the agreed terms in clear breach of the contract then in force. Accordingly, the grounds for grievance raised lack the force necessary to alter the decision, and they are therefore rejected.
V.4 As the third, seventh, eighth, and ninth grounds for grievance, counsel for the appellant alleges a lack of congruence between the charges and the ruling, as well as what he calls the “consequence of the lack of reasoning regarding the claim of error in signing the contract,” and the absence of reasoning concerning the charge of allegedly improperly collecting the zone allowance (zonaje). These allegations are closely related specifically to the issue of the zone allowance and will therefore be addressed jointly. Defense counsel maintains that there is a lack of congruence between the charges and the ruling because the allegation concerns the improper collection of the zone allowance, yet in its judgment the Judicial Inspection Tribunal continues to arrogate to itself authority belonging to the Human Resources Directorate, which it does not possess, and despite this state of uncertainty, the adjudicatory body finds the charge proven.
He further adds that, in the reasoning underlying the decision, the adjudicatory body stated that it was certain that the zone allowance had been improperly collected; nevertheless, at the end of the challenged decision, it refers the case for the issue of that collection to be analyzed and for the Human Resources Department to determine whether the amounts paid should be recovered. Therefore, in his view, there was no certainty that the improper collection had occurred. He likewise contends that there is a lack of reasoning regarding the charge of improperly collecting the zone allowance, asserting that the court below (a quo) erred in assuming that, because the accused chose the option of teleworking four days and attending in person one day, he was not entitled to receive the zone allowance. He argues that the challenged judgment is internally inconsistent in its ruling on the charge of allegedly improperly collecting the zone allowance.
In the third ground of his appeal, appellant [Nombre 001] alleges the absence of reasoning and assessment regarding the propriety of paying the zone allowance under the teleworking schedule found proven in proven fact 3 of the judgment—one week per month in person and three weeks remotely by telework. As is apparent, he refers to the same arguments outlined by defense counsel, and they will therefore be analyzed in this section. Opinion of the appellate body: This Collegiate Body finds that the appellants’ appellate arguments are without merit, for the reasons set forth below. It should be noted that the accused alleges that, during the period in question, he continued renting an apartment at the address stated on the zone-allowance payment application form, and that, by sanctioning him for collecting the zone allowance, his labor rights are being disregarded, in contradiction of the teleworking agreement itself, which provides that the teleworker is entitled to “retain the same rights, benefits, and obligations applicable to the characteristics of the service under the in-person modality.” However, the defense’s argument rests on the assumption that, in this case, his right to receive the zone allowance was being denied merely because he worked under the teleworking modality; that is not so.
First, it must be noted that this case does not involve disregarding the rights applicable to the characteristics of the accused’s service under the in-person modality. Rather, it involves applying the regulations governing eligibility for payment of the zone allowance and the improper collection thereof by the employee under investigation. Thus, the appellant’s rights, benefits, and obligations as a judicial officer are neither being altered nor disregarded because he provided his services under the teleworking modality. Instead, he is being reproached for having claimed and improperly received the zone allowance without meeting one of the essential eligibility requirements. Indeed, for payment of the zone allowance to be proper, the governing regulations require the employee to be staying at a residence other than his actual residence, specifically so that he may fulfill his employment obligations; this plainly causes him to incur an additional expense that he would not incur if he continued working at his habitual or actual residence.
That additional expense is precisely what payment of the zone allowance is intended to cover. In the present case, however, as has been duly established by the evidence in the record, the accused appellant did not satisfy that requirement. In this regard, it should be noted that, when signing the teleworking agreement, the accused [Nombre 001] identified his actual residence as the place from which he would perform telework, namely: Guápiles, Barrio Santa Clara, 50 meters north, 100 meters east, and 75 meters south of Motos Honda. It is therefore clear that, on the days when the accused provided his services under the teleworking modality, he performed his duties from his actual or habitual residence, rather than from his temporary residence, since, as emphasized, he himself so stated in the teleworking agreement. To reiterate, the accused’s labor rights are not being disregarded because he was working under the teleworking modality; rather, he is being reproached for having collected and received zone-allowance payments without meeting one of the eligibility requirements.
It is also appropriate to note that the accused did not submit suitable evidence establishing that, contrary to what he himself stated in the teleworking agreement, he had in fact performed his duties from his temporary residence on the days when he was teleworking. It is therefore clear that the accused [Nombre 001] committed the disciplinary offense because, while performing his duties under the teleworking modality from his actual residence, he claimed and received the zone allowance even though payment was improper because he failed to satisfy an essential requirement: that he be compelled to relocate to the temporary residence in order to perform his duties. In other words, the regulations governing payment of the zone allowance and the resulting sanction for failure to meet the requirement are not being applied to the accused exceptionally, much less in a manner that disregards the labor rights to which he is entitled when not working under the teleworking modality.
Rather, it is clear that, as with any employee, he is being required to meet a condition imposed by the regulations governing payment of the aforementioned allowance—a condition that, according to the information he himself entered in the teleworking agreement he signed, was not met because he provided his services from his actual residence on teleworking days. It should be noted that, as stated in the challenged decision, if the accused decided to change the conditions under which he would perform telework, he should have promptly notified the Human Resources Directorate so that the teleworking agreement could be amended and situations such as the present one avoided. Likewise, he should have reported or disclosed the circumstances arising when he entered into the teleworking agreement that could affect his eligibility for payment of the zone allowance. He did not do so, however, as established by the documentary evidence consisting of the teleworking agreement, in which Mr. [Nombre 001] himself stated that the address of his actual residence was the place from which he would perform his duties under the teleworking modality.
Furthermore, in responding to the order serving the charges (auto de traslado de cargos), the person under investigation clearly admits what has been stated thus far: on the days when he was teleworking, he performed his duties from his actual residence. He does so when stating that, under the work schedule adopted during that period, he stayed at the temporary residence when he traveled to Limón to perform his duties in person one week per month, and stayed at his actual residence when teleworking during the remaining three weeks of the month. As the court below correctly notes, this is an undisputed fact. For the foregoing reasons, the appellant’s position is deemed without merit, nor can the position set forth in the advisory opinion issued by the Labor Relations Commission be accepted. The conduct charged and sanctioned in the present disciplinary proceeding is that the accused, in addition to breaching the teleworking agreement, claimed and received the zone allowance even though, while performing his duties under the teleworking modality, he did so from his actual residence, as he stated when signing the teleworking agreement and admitted when responding to the order serving the charges.
If this appellate body were to accept both appellate arguments, it would, as noted, be ignoring the reality established by the evidence in the record and allowing a Judge of the Republic—who, moreover, contemptuously disregarded the teleworking agreement entered into with the Judiciary—to benefit from payment of a salary component to which he was clearly not entitled. All of this would be to the detriment of the public treasury. As a judge of the Republic, he is expected to maintain the highest standards of honesty, respect, integrity, and adherence to the law and institutional guidelines, particularly considering that, in performing his adjudicative duties—as a judge of the Civil and Labor Court of Appeals—his judgment may ultimately determine, among other types of proceedings, disputes arising between citizens from breaches of legal agreements. Finally, concerning the ninth ground for grievance raised by defense counsel—namely, the alleged inconsistency or contradiction in the challenged decision—which purportedly arises because, on the one hand, the trial Tribunal finds it established that the accused improperly collected and received the zone allowance, but subsequently orders that the decision be referred to the Human Resources Directorate for action within its authority, stating that the Directorate’s Payments Unit must analyze the accused’s collection of the zone allowance and determine whether the amounts received while teleworking from his residence outside the First Judicial Circuit of the Atlantic Zone should be recovered.
Mr. Flores Garrido asks, “Why, if the adjudicatory body stated that it was certain that the zone allowance had been improperly collected, did it refer the case so that the matter could be analyzed and the Human Resources Department could determine whether the amounts paid should be recovered?” He contends that this instruction demonstrates that, to date, the adjudicatory body is not certain that the improper collection occurred. This appellate body respects but does not share defense counsel’s view. This is because the conduct charged and duly proven—namely, that the accused improperly collected the zone allowance because he did not satisfy one of the essential eligibility requirements, which was to perform the work from a temporary residence—must not be confused with the mandatory measure of seeking recovery of the sums disbursed to the accused to the detriment of the public treasury. It should be noted that the existence of the disciplinary offense has been established in the administrative proceedings, namely, the accused’s improper collection of the zone allowance. However, the appropriate technical body must perform the corresponding calculations to determine the amount improperly disbursed to employee [Nombre 001] and arrange for its recovery.
Accordingly, there is no reason to conclude that the lower court (a quo) committed an inconsistency (incongruencia) or contradiction in the challenged decision, since the instruction issued to the Human Resources Directorate to determine whether the sums disbursed should be recovered as a result of the substantiated improper collection by the accused (encausado) constitutes a phase subsequent to the finding of misconduct in disciplinary proceedings (sede disciplinaria). Therefore, the order issued by the lower court is consistent with the law and the case record. As is evident, the grounds of appeal raised by the aggrieved party’s counsel and by the aggrieved party personally lack sufficient basis to overturn the decision under appeal and are therefore rejected.
V.5 As the fourth and tenth grounds of appeal, Attorney Flores Garrido alleges that the court below erroneously applied Article 36 of the Regulations Governing the Telework Service Arrangement in the Judicial Branch; he also alleges that the judgment under appeal imposes a disproportionate sanction and is detrimental to the proper provision of public services. In this regard, he cautions that the purposes of the telework regulations, as set forth in Article 2 of that legal instrument, must not be overlooked and that formality should not be pursued merely for formality’s sake, since the respondent performed excellently, exceeding the quotas established for his position and fulfilling the purpose of the employment contract at all times. He adds that there was an agreement of the Council of Judges to organize the work of the court office in that manner. He further states that the sanction is disproportionate and considerably detrimental to public services, since Mr. [Nombre 001] performed excellently during the period at issue.
These grievances are related to the first, second, and fourth grounds of disagreement asserted by the respondent [Nombre 001], namely: absence of the alleged breach of contract; absence of the alleged violations; and disproportionality of the sanction imposed and detriment to the proper provision of public services. The appellant states that he complied at all times with the assigned work quotas, achieved excellent performance, and never adversely affected public services. He likewise considers that the sanction imposed by the court below is disproportionate and detrimental to the proper provision of public services. Opinion of the appellate body: Regarding the arguments made by the appellant’s counsel, this appellate body must point out that, in the case before us, the evidence in the record establishes that, during the period from June 2022 through January 2023, the respondent continued working under an arrangement different from the one to which he had committed in the aforementioned Telework contract, since during that period he reported for in-person work at the Civil and Labor Court of Appeals for the Atlantic Zone, Limón seat, only on Tuesdays of each week, thereby departing from the conditions established in the telework contract he had signed, despite the fact that this Council had denied the request submitted by the Council of Judges of the aforementioned court office.
Likewise, and no less importantly, it was established that the appellant improperly claimed and received payment of the geographic-zone allowance (zonaje) for the period from January through May 2022, both months inclusive, as though he had been working in person at the court office and, therefore, residing throughout that period at his temporary residence (domicilio accidental). These duly established facts leave both the appellate argument and the recommendation made by the Labor Relations Committee without support. Indeed, as found proven and analyzed in the challenged decision, Attorney [Nombre 001] signed geographic-zone allowance application form No. ZON-2021010646 dated September 21, 2021—a copy of which, it bears noting, was added to the record—stating the following address as his permanent residence (domicilio real): “Limón, Pococí, Guápiles, 400 meters north, 100 east, and 75 south of the Santa Clara Service Station, last house on the right on a dead-end street”; and the following address as his temporary residence: “Limón - Central- Central Limón, Limón, Limón Centro, Barrio Santa Eduviges, 150 meters east of Pulpería Acon, apartments at the last entrance on the right on a dead-end street, apartments at the back.” Attorney [Nombre 001] was granted this salary component, allowing him to receive a total of exactly one million four hundred fourteen thousand six hundred colones under that heading.
Nevertheless, as the challenged decision clearly states and as established by the documentary evidence cited in that same ruling, during the period from January through May 2022, when the respondent claimed and received the geographic-zone allowance, he worked between 2 and 4 weeks per month—as specified in the table contained in Proven Fact 9—under a home-based telework arrangement (teletrabajo domiciliario), at the address stated in the Contract Governing Telework in the Judicial Branch, namely [...], that is, at an address different from his temporary residence, which is: [...]. This information is obtained from geographic-zone allowance application form No. ZON-2021010646 dated September 21, 2021; official letter No. DGH-SAS-UPS-515-2023 dated February 24, 2023, issued by the Salary Payments Unit; the Employee Salary Components Inquiry dated February 23, 2023; documentation issued by the Human Resources Directorate; the Contract Governing Telework in the Judicial Branch for Judicial Personnel, signed by the appellant, Attorney [Nombre 001], and the Human Resources Directorate; as well as the Record of Days Worked In Person by Judges of the Civil and Labor Court of Appeals for the Atlantic Zone, Limón seat.
Accordingly, under those working conditions, there can be no doubt that Attorney Alvarado did improperly claim and receive the geographic-zone allowance, since he received it while teleworking from his place of residence or permanent residence and not, as the defense seeks to suggest, from his temporary residence. This is compounded by the fact that the Human Resources Directorate, Payments Unit, was not informed of the situation so that it could determine whether payment of the geographic-zone allowance was appropriate under those working conditions. These facts, it bears repeating, are duly established by evidence contained in the case file; nevertheless, the argument for acquittal seeks to disregard the existence of that evidence, an approach that, as stated and as will be analyzed, this collegiate body cannot accept. To reiterate, it has not only been duly established that the respondent breached the telework contract and, moreover, did so by working in person only one week per month during the period at issue and, during the other period, one day per week; it has also been established that he claimed and received the geographic-zone allowance even though, during the period from June 2022 to January 2023 and the period from January to May 2022, on the days when he was teleworking, the respondent performed his duties from his permanent residence, as he had stated in the telework contract he signed with the institution.
Despite all this, the defense seeks the investigated party’s acquittal on the grounds that, while performing his duties under this arrangement, the respondent increased his productivity and, far from adversely affecting public services, benefited them, and that the respondent has no disciplinary sanctions on his record. The argument supporting this position is worthy of respect, but this Council does not agree with it. First, it should be noted that he is a judge of the Republic who signed a Telework contract, which he was required to perform under the agreed conditions intended to ensure the provision of the public services entrusted to him, as well as the fulfillment of those duties that judicial functions require to be performed in person. The disciplinary complaint giving rise to this decision is not intended to measure productivity, since that would simply require a study by the Planning Directorate and the Statistics Subprocess; in any event, that matter has neither been challenged nor alleged in this disciplinary proceeding.
In this regard, it should be noted that the purpose of the disciplinary system in cases such as this is to ensure proper conduct, diligence, and compliance with the working hours and work arrangement to which an official commits upon signing a telework contract, as well as compliance with the conditions permitting payment of the geographic-zone allowance. Accordingly, the duly established disciplinary offense and the respondent’s improper conduct cannot be minimized on the basis that he increased his productivity, particularly when the offense, by its nature, is classified as extremely serious because it involves both a breach of the conditions of the telework contract and the improper receipt of the geographic-zone allowance, which directly affects public funds, pursuant to Articles 194 and 195 of the Organic Law of the Judicial Branch. Under this analysis, it is clear that both the classification and the extent of the sanction imposed satisfy the previously noted requirements of reasonableness and proportionality, as they are consistent with the facts found to have been established and the considerations set forth throughout this decision.
It should be specified that the sanction imposed is considered reasonable because it is clear that safeguarding the principles governing the provision of the entrusted public service—and that it is necessary and mandatory to safeguard the principles governing the provision of that public service, particularly for those entrusted with the arduous and delicate task of the Administration of Justice—constitutes an obligation. If the Administration has delegated such a delicate function to judges, they are expected and required to perform it in strict compliance with the guidelines established for that purpose and, unquestionably, with verification that those selected to hold judicial office meet the statutory requirements. In this regard, the respondent is reminded that, when he agreed to work for the Judicial Branch, he accepted that his conduct was required to comply with the rules governing all judicial personnel, and his conduct is all the more blameworthy given that he has more than 15 years of experience exercising judicial functions.
Therefore, as a Judge of the Republic, his actions and conduct must leave no room for doubt and must always inspire trust, respect, and commitment. The Ibero-American Code of Judicial Ethics establishes that judges undertake a commitment to the institution, submitting to all actions taken to improve the judicial system, actively committing themselves to its proper operation, and fulfilling their specific individual obligations (Article 42). Moreover, the integrity of a judge’s conduct outside the strict sphere of judicial activity contributes to the public’s well-founded confidence in the judiciary (Article 53), and a judge must not behave in a manner that a reasonable observer would regard as seriously violating the prevailing values and sentiments of the society in which the judge serves (Article 54). Finally, judges must be aware that the exercise of judicial functions entails requirements that do not apply to other citizens (Article 55).
Accordingly, this Chamber does not find that the errors alleged by the appellant occurred, since the facts that have been deemed duly established and that this appellate body endorses lead to the conclusion that the first-instance decision-making body clearly and adequately stated the reasons for sanctioning the official [Nombre 001] with a two-month suspension from office without pay, and provided a clear basis for doing so.
It should be noted that this Panel (Colegio) broadly agrees with the grounds relied upon for the classification assigned to the misconduct committed by the respondent, given that, in accordance with the ruling of the court below (a quo) in the challenged decision, that classification is consistent with the duly established facts and strictly complies with the applicable rule. The classification of the alleged and proven misconduct as a very serious offense (falta gravísima) is supported by sections 194 and 195 of the Ley Orgánica del Poder Judicial, the Reglamento para regular la modalidad de prestación de servicios en teletrabajo en el Poder Judicial, and the Reglamento para el pago de Zonaje en el Poder Judicial (Circular 110-2010). It follows from the foregoing that the lower tribunal (Tribunal de instancia) adequately and sufficiently stated the reasons that led it to impose that disciplinary sanction (sanción), which is considered fair and consistent with the alleged and duly established facts, and which is intended to prompt the employee [Nombre 001] to reconsider and correct his conduct, on the understanding that if this objective is not achieved and a new breach is established, a more severe sanction will be imposed.
From this perspective, it must be made clear that the sanction imposed fulfills the educational purpose invoked by the institution’s disciplinary system (régimen disciplinario). For the foregoing reasons, the objection underlying the ground of appeal (motivo de apelación) under review is without merit and is therefore rejected.
In accordance with all the foregoing, the objections supporting the grounds of appeal (motivos de apelación) under review lack merit and the force required to alter the ruling and are therefore rejected. Consequently, insofar as it was appealed, the decision contained in Vote No. 2023-003252, issued at ocho horas once minutos del cinco de octubre de dos mil veintitrés, is affirmed in all respects.
In accordance with the foregoing, the following was decided by majority vote:

“ARTÍCULO VII Documento N° 23-000476-0031-DI Conoce este Consejo en alzada el acto final del procedimiento N° 2023-003252 de las ocho horas once minutos del cinco de octubre de dos mil veintitrés, dictada por el Tribunal de la Inspección Judicial, dentro del proceso disciplinario número 23-000476-0031-DI, seguido contra [Nombre 001], Juez del Tribunal de Apelación Civil y Trabajo de la Zona Atlántica, sede Limón, cédula de identidad número [Valor 001], mediante la cual se declaró con lugar la causa, se calificó la falta como gravísima y se le impuso la sanción de dos meses de suspensión sin goce de salario.
RESULTANDO
I.En auto de las nueve horas veintidós minutos del tres de marzo del año dos mil veintitrés, se acusó al servidor [Nombre 001] de: “aparente incumplimiento del Contrato para Regular el Teletrabajo en el Poder Judicial con la Persona Servidora Judicial y del Reglamento para regular la modalidad de prestación de servicios en teletrabajo en el Poder Judicial (circular 36-2021, aprobado por Corte Plena, en la sesión número 7-2021, celebrada el 15 de febrero del 2021, artículo XVIII (Artículo 194 de la Ley orgánica del Poder Judicial). Presunto Cobro Indebido de Zonaje (Circular número 110-2010 del diecisiete de noviembre del dos mil diez y artículo 194 de la Ley Orgánica del Poder Judicial, Circular número 165-2014 del once de agosto del dos mil catorce). Antecedentes: 1. Corte Plena, en la sesión número 7-2021, celebrada el 15 de febrero del 2021, artículo XVIII, aprobó el Reglamento para regular la modalidad de prestación de servicios en teletrabajo en el Poder Judicial, siendo que en el numeral 18 de ese Reglamento, se dispusieron las diferentes opciones de prestación de servicios bajo la modalidad de teletrabajo, pues se estableció lo siguiente: “La modalidad de teletrabajo considera cinco opciones, en las cuales se indican la cantidad de días que la persona teletrabajadora laborar· en las oficinas del Poder Judicial y fuera de ella.
Estas son: Teletrabajo opción 1: Cuatro días en las oficinas o despachos judiciales del Poder Judicial y un día fuera de ellas. Teletrabajo opción 2: Tres días en las oficinas o despachos judiciales del Poder Judicial y dos días fuera de ellas. Teletrabajo opción 3: Dos días en las oficinas o despachos judiciales del Poder Judicial y tres días fuera de ellas. Teletrabajo opción 4: Un día en las oficinas o despachos judiciales del Poder Judicial y cuatro días fuera de ellas. Teletrabajo opción 5: Casos excepcionales aprobados por el Consejo Superior en los que por la naturaleza del servicio prestado por la persona servidora judicial resulta viable y necesario que no se presente a laborar de manera presencial…” (sic). 2. Que usted [Nombre 001] durante el período del 01 de abril del 2022 hasta el 01 de marzo del 2023, se ha destacado en el puesto de Juez del Tribunal de Apelación Civil y Trabajo de la Zona Atlántica (Limón).
A partir de lo anterior, concretamente se le acusa a usted [Nombre 001] los siguientes hechos: HECHOS RELACIONADOS CON LA MODALIDAD DE TELETRABAJO DISTINTA A LAS CONTEMPLADAS EN EL REGLAMENTO PARA REGULAR LA MODALIDAD DE PRESTACIÓN DE SERVICIOS EN TELETRABAJO EN EL PODER JUDICIAL: 1. Que en el Contrato para Regular el Teletrabajo en el Poder Judicial con la Persona Servidora Judicial, suscrito el 24 de junio 2021, por usted [Nombre 001] y la Dirección de Gestión Humana, su persona se comprometió a desempeñar las funciones de su cargo, como Juez del Tribunal de Apelación Civil y Trabajo de la Zona Atlántica (Limón), mediante la prestación del servicio en la modalidad de teletrabajo domiciliario, durante un día por semana, específicamente el día viernes. 2. Que durante el período de enero del 2022 hasta mayo del 2022, usted [Nombre 001] aparentemente incumplió las condiciones de la prestación del servicio en la modalidad de teletrabajo domiciliario descrita en punto anterior, a la cual su persona se comprometió realizarla durante 1 día por semana, específicamente el día viernes, pues se presume que usted [Nombre 001], durante ese período, ha laborado una semana al mes, de manera presencial en el Tribunal de Apelación Civil y Trabajo de la Zona Atlántica (Limón), y las restantes semanas lo hizo bajo la modalidad de teletrabajo domiciliario, omitiendo de esa manera presentarse los días viernes de cada semana, a su lugar de trabajo. HECHOS RELACIONADOS CON EL PRESUNTO INCUMPLIMIENTO A LAS CONDICIONES PACTADAS EN EL CONTRATO PARA REGULAR EL TELETRABAJO EN EL PODER JUDICIAL. 1. Que usted [Nombre 001] durante el período del 01 de abril del 2022 hasta el 01 de marzo del 2023, se ha destacado en el puesto de Juez del Tribunal de Apelación Civil y Trabajo de la Zona Atlántica (Limón). 2. Que en el Contrato para Regular el Teletrabajo en el Poder Judicial con la Persona Servidora Judicial, suscrito el 24 de junio 2021, por usted [Nombre 001] y la Dirección de Gestión Humana, su persona se comprometió a desempeñar las funciones de su cargo como Juez del Tribunal de Apelación Civil y Trabajo de la Zona Atlántica (Limón), mediante la prestación del servicio en la modalidad de teletrabajo domiciliario, durante un día por semana, específicamente el día viernes. 3.
Que durante el período de junio del 2022 hasta enero del 2023, usted [Nombre 001] aparentemente incumplió las condiciones de la prestación del servicio en la modalidad de teletrabajo domiciliario descrita en punto anterior, a la cual su persona se comprometió realizarla durante 1 día por semana, específicamente el día viernes, pues se presume que usted [Nombre 001], durante ese período, se ha presentado ha laborar de manera presencial en el Tribunal de Apelación Civil y Trabajo de la Zona Atlántica (Limón), únicamente los días martes de cada semana, omitiendo de esa manera cumplir con las condiciones a las que usted se comprometió en dicho contrato. Que de acuerdo con las situaciones descritas en los puntos anteriores, se le acusa a usted [Nombre 001] de presuntamente incumplir las condiciones de la prestación del servicio en la modalidad de teletrabajo domiciliario, concretamente sobre el día en que su persona se comprometió a laborar bajo dicha modalidad de teletrabajo domiciliario. HECHOS RELACIONADOS CON EL PRESUNTO COBRO INDEBIDO DE ZONAJE 1. Que en el Contrato para Regular el Teletrabajo en el Poder Judicial con la Persona Servidora Judicial, suscrito el 24 de junio 2021, por usted [Nombre 001] y la Dirección de Gestión Humana, su persona se comprometió a desempeñar las funciones de su cargo como Juez del Tribunal de Apelación Civil y Trabajo de la Zona Atlántica (Limón), mediante la prestación del servicio en la modalidad de teletrabajo domiciliario, durante un día por semana, específicamente el día viernes, en la siguiente dirección: Guápiles, Barrio Santa Clara, de Motos Honda 50 norte, 100 este y 75 sur. 2.
Que usted [Nombre 001], suscribió la boleta de solicitud de zonaje número ZON-2021010646 de fecha 21 de setiembre del 2021, en la que consignó como domicilio real la siguiente dirección: Limón, Pococí, Guápiles, de la Estación de Servicio Santa Clara 400 metros norte, 100 al este y 75 al sur, última casa a mano derecha en calle sin salida, y como domicilio accidental consignó la siguiente dirección: Limón - Central- Central Limón, Limón, Limón Centro, Barrio Santa Eduviges, de la Pulpería Acon, 150 metros este, apartamentos en última entrada a la derecha en calle sin salida, apartamentos al fondo. 3. Que en razón de lo anterior, la Administración procedió con el pago de dicho componente salarial en favor de usted [Nombre 001] desde la primera quincena del mes enero del 2022 hasta la segunda quincena del mes de mayo del 2022, por lo que su persona percibió la suma total de un millón cuatrocientos catorce mil seiscientos colones exactos. 4.
Que durante el período de enero 2022 hasta mayo del 2022, usted [Nombre 001] laboró entre 2 y 4 semanas al mes bajo la modalidad de teletrabajo domiciliario, en una dirección distinta a su domicilio accidental (descrito en el punto 2), pues se presume que su persona laboró en la dirección consignada en el Contrato para Regular el Teletrabajo en el Poder Judicial, sea Guápiles, Barrio Santa Clara, de Motos Honda 50 norte, 100 este y 75 sur. Las semanas que usted [Nombre 001] laboró bajo la modalidad de teletrabajo domiciliario, se detallan a continuación.

Que con base en lo anterior, se presume que usted [Nombre 001] cobró y percibió de forma indebida, desde la primer quincena del mes enero del 2022 hasta la segunda quincena del mes mayo del 2022, la suma total de millón cuatrocientos catorce mil seiscientos colones exactos por concepto de zonaje, por cuanto durante las semanas que se describieron en el punto anterior, usted [Nombre 001] laboró bajo la modalidad de teletrabajo domiciliario en una dirección distinta al domicilio accidental que su persona señaló en la boleta descrita en el punto 2. (…)”. (Sic).
II.Mediante pronunciamiento emitido en el acto final del procedimiento N° 2023-003252 de las ocho horas once minutos del cinco de octubre de dos mil veintitrés, el Tribunal de la Inspección Judicial dispuso: “Se rechaza la excepción interpuesta de incompetencia en razón de la materia. Con fundamento en los artículos 174, 175, 176, 190, 194, 195 y 208 de la Ley Orgánica del Poder Judicial, el Reglamento para regular la modalidad de prestación de servicios en teletrabajo en el Poder Judicial, así como el Reglamento para el pago de Zonaje en el Poder Judicial (Circular 110-2010); se declara con lugar la queja en contra de [Nombre 001], calificando la falta como gravísima, y se le impone lasanción de dos meses de suspensión del cargo sin goce de salario. Asimismo, sele hace saber que de conformidad con lo dispuesto en los artículos 66 inciso 5 y 209 dela Ley Orgánica del Poder Judicial, tiene derecho a recurrir este fallo ante el Consejo Superior del Poder Judicial, dentro de tercero día, así como a solicitar que de previo, el asunto sea revisado por la Comisión de Relaciones Laborales de esta Institución.
Firme este acto final, comuníquese lo resuelto a la Dirección de Gestión Humana, para que proceda con la anotación respectiva -calificación y sanción- en el expediente personal y prontuario de la citada servidora, de conformidad con lo dispuesto por el artículo 228 de la Ley General de la Administración Pública. Contra la firmeza de esta resolución y en atención a lo establecido en el artículo 36 del Reglamento para regular la modalidad de prestación de servicios en teletrabajo en el Poder Judicial, se ordena poner esta resolución en conocimiento de la Dirección de Gestión Humana, para lo de su cargo. Igualmente deberá la Unidad de Pagos de esa Dirección, analizar el tema del cobro de zonaje por parte del aquí acusado, para que determine si procede la recuperación de esos montos que se recibieron estando en teletrabajo desde su lugar de residencia, fuera del Primer Circuito Judicial de la Zona Atlántica. III.Mediante escrito de fecha 11 de octubre de 2023, el Lic. Rodrigo Flores Garrido, defensor privado del encausado, presenta recurso de apelación contra el acto final del procedimiento del Tribunal de la Inspección Judicial N° 2023-003252 de las ocho horas once minutos del cinco de octubre de dos mil veintitrés.
IV.Mediante escrito de fecha 11 de octubre de 2023, el encausado [Nombre 001], presenta recurso de apelación contra el acto final del procedimiento del Tribunal de la Inspección Judicial N° 2023-003252 de las ocho horas once minutos del cinco de octubre de dos mil veintitrés.
V.La Comisión de Relaciones Laborales mediante resolución N° 24-2024 de las quince horas cuarenta y cinco minutos del dieciocho de abril del dos mil veinticuatro, recomendó para el presente caso, lo siguiente: “Una vez analizado el presente asunto, de acuerdo con los hechos demostrados y la prueba que consta en autos, esta Comisión recomienda declarar sin lugar los recursos de apelación y confirmar la resolución dictada por el Tribunal de la Inspección Judicial en lo que respecta al incumplimiento del contrato de teletrabajo y, declarar con lugar los recursos de apelación y archivar las diligencias disciplinarias relacionados al cobro indebido de zonaje”.
VI.En los procedimientos se han seguido las prescripciones y términos de ley, y no se aprecian errores u omisiones que produzcan nulidades o indefensión.
CONSIDERANDO
El Tribunal de la Inspección Judicial, tuvo como hechos probados los siguientes: “1) El encausado [Nombre 001], para el momento de los hechos investigados, se desempeñaba como Juez del Tribunal de Apelación Civil y de Trabajo de la Zona Atlántica, sede Limón, al seis de marzo de 2023 registra dieciséis anualidades en la Institución y no reporta sanciones disciplinarias. (Ver oficios PJ-DGH-713-2023 y PJ-DGH-AP-0720-2023, según información de la Dirección de Gestión Humana; además es un hecho no controvertido). 2) En el Contrato para Regular el Teletrabajo en el Poder Judicial con la Persona Servidora Judicial, suscrito por el investigado [Nombre 001] y la Dirección de Gestión Humana el 24 de junio del año 2021, se comprometió a desempeñar las funciones de su cargo como juez 5, mediante la prestación del servicio en la modalidad de teletrabajo domiciliario, durante un día por semana, específicamente los días viernes, en un horario de 07:00 a 16:30 horas y en la siguiente dirección: Guápiles, Barrio Santa Clara, de Motos Honda 50 norte, 100 este y 75 sur.
Por lo que los otros días de la semana, sea de lunes a jueves, debía presentarse a laborar en el Tribunal de Apelación Civil y de Trabajo de la Zona Atlántica, sede Limón, en mismo horario. (Ver copia del referido contrato agregado en disco compacto). 3) Durante el período de enero del 2022 hasta mayo del 2022, el acusado incumplió las condiciones de la prestación del servicio en la modalidad de teletrabajo domiciliario descrita en el hecho probado inmediato anterior, pues durante ese período, ha laborado una semana al mes, de manera presencial en el Tribunal de Apelación Civil y Trabajo de la Zona Atlántica, sede Limón, y las restantes semanas lo hizo bajo la modalidad de teletrabajo domiciliario, omitiendo de esa manera presentarse los días de lunes a jueves de cada semana a su lugar de trabajo. Tal y como se detalla a continuación.

(Ver Contrato para Regular el Teletrabajo en el Poder Judicial con la Persona Servidora Judicial, suscrito por el investigado [Nombre 001] y la Dirección de Gestión Humana; Control de días laborados en la modalidad presencial de jueces del Tribunal de Apelación Civil y de Trabajo de la Zona Atlántica, Limón, contenido en disco compacto; además hecho no controvertido). 10) El acusado cobró y percibió de forma indebida, desde la primer quincena del mes enero del 2022 hasta la segunda quincena del mes mayo del 2022, la suma total de millón cuatrocientos catorce mil seiscientos colones exactos por concepto de zonaje, por cuanto durante las semanas que se describen en el hecho probado inmediato anterior, laboró bajo la modalidad de teletrabajo domiciliario en una dirección distinta al domicilio accidental que señaló en la boleta de solicitud de zonaje número ZON- 2021010646 de fecha 21 de setiembre del 2021. (Misma referencia de los hechos probados 8 y 9).
El Tribunal de la Inspección Judicial, no determinó para el presente caso hechos no probados.
El Licenciado Rodrigo Flores Garrido, defensor del encausado, sustenta el recurso de apelación formulado en los siguientes motivos: “HECHOS DEL TRASLADO DE CARGOS. De previo a entrar en la exposición de los agravios, se estima oportuno destacar lo que ha sido objeto de traslado de cargos en la presente causa, teniéndose así que se acusó:
El señor [Nombre 001], motiva su inconformidad en los siguientes agravios: “(…) HECHOS DEL TRASLADO DE CARGOS. De previo a entrar en la exposición de los agravios, se estima oportuno destacar lo que ha sido objeto de traslado de cargos en la presente causa, teniéndose así que se acusó:
Por su parte, el licenciado Rodrigo Flores Garrido, defensor privado del encausado sustenta el recurso formulado en los siguientes motivos de agravio:
En virtud de que el recurso de apelación formulado por el Licenciado Rodrigo Flores Garrido, defensor privado del encausado se centra en varios motivos que resultan relacionados entre sí; así como que, algunos de estos guardan estrecha relación con los argumentos expuestos por el recurrente [Nombre 001], en el ejercicio de su defensa material, se procederá a su análisis como sigue.
V.1. Respecto al primer agravio de la defensa, esto es, la acusada ausencia o insuficiente motivación de la resolución recurrida en cuanto a la excepción o defensa interpuestas de falta de competencia por razón de la materia. Sostiene la defensa técnica del encausado, la resolución impugnada presenta una insuficiente motivación de la resolución recurrida respecto a las excepciones o defensas interpuestas por razón de la materia, al afirmar que no existe competencia para analizar en sede disciplinaria lo concerniente a los incumplimientos contractuales, así como el establecimiento de perjuicios patrimoniales. Criterio del órgano de alzada. Disiente este Órgano Colegiado de la tesis planteada por la defensa técnica del encausado, ya que como bien lo indicó el a quo en la fundamentación de su sentencia, la posibilidad de conocer en esta sede los posibles incumplimientos al contrato de teletrabajo regulado en el Reglamento para regular la modalidad de prestación de servicios en teletrabajo en el Poder Judicial, se establece en la misma norma que regula dicha modalidad, propiamente en el artículo 36 que establece: “Artículo 36.
De las consecuencias del incumplimiento del contrato suscrito por la persona teletrabajadora, así como de las disposiciones del presente reglamento. En caso de que la persona servidora incurra en un presunto incumplimiento de las obligaciones establecidas en el presente reglamento o respectivo contrato, el superior jerárquico deberá adoptar las siguientes acciones: a) Iniciar las acciones necesarias para la apertura del régimen disciplinario que proceda por parte de los órganos competentes, conforme lo establecido en la Ley Orgánica del Poder Judicial, previo debido proceso en donde se constate la verdad real de los hechos. b) Poner en conocimiento de la Dirección de Gestión Humana para que se inicie el procedimiento de resolución contractual, de conformidad con el interés institucional y la gravedad de la falta” (Subrayado y negrita no pertenecen al original). En criterio de esta Cámara, la actuación de la Administración ha sido en todo momento conforme a derecho, siendo que, en el presente caso, al estarse frente a un incumplimiento del contrato de teletrabajo por parte del señor [Nombre 001], lo procedente es desarrollar el procedimiento disciplinario correspondiente, como dicta la normativa.
De ahí que, la falta de competencia alegada por el licenciado Flores Garrido no encuentra asidero jurídico. Tal y como señala el voto recurrido, la Sala Constitucional ha reiterado que no existe impedimento alguno para que en sede administrativa se investigue y resuelva lo conducente, respecto al incumplimiento contractual acusado al señor [Nombre 001]. En ese orden, es claro que la insuficiente fundamentación alegada por la defensa técnica del encausado carece de sustento, habida cuenta que, resulta claro y evidente que los hechos acusados al encausado y que sustentan el auto de traslado de cargos que se formuló en el presente proceso disciplinario, si resultan objeto de conocimiento en esta sede disciplinaria administrativa. Siendo así, el motivo de agravio formulado carece de la fuerza requerida para variar lo resuelto y por ello se rechaza.
V.2. Como segundo agravio, la defensa técnica del inconforme alega una errónea interpretación de las resoluciones de la Sala Constitucional, agravio que se encuentra estrechamente relacionado con el primer motivo ya analizado, en donde aduce que: “la intención de los magistrados de la Sala Constitucional no era de atribuir al órgano disciplinario la potestad de subrogar o sustituir a los órganos jurisdiccionales y administrativos en sus competencias, sino que se conocieran sin problema alguno. Las responsabilidades derivadas de un mismo hecho o hechos en los diferentes ámbitos judiciales o administrativos en los que la conducta corresponda ser tramitada, pero desde el marco establecido para el ejercicio de sus competencias. Así el órgano disciplinario no se puede pronunciar sobre aspectos y responsabilidades penales, civiles o patrimoniales de sus servidores, sin que éstas hubiesen previamente pasado por el conocimiento de los órganos legalmente competentes establecidos por ley.
Al respecto, se mal interpretó el sentido primordial en la jurisprudencia constitucional citada, sentencia N° 1265-95 de las 15:36 horas del 7 de marzo de 1995, pues en ella se estableció, que las responsabilidades que surjan de un mismo hecho, no son óbice para que puedan ser conocidas en distintas instancias, sin que ello implique violación al principio “non bis in idem” o de “noter in idem””. (Negrita pertenece al original). Criterio del órgano de alzada. Respecto a los alegatos expuestos por la defensa técnica, este Órgano Colegiado debe señalar que no lleva razón, ya que debe tenerse en consideración lo establecido por la Procuraduría General de la República, en su dictamen N°245-99 del 16 de diciembre de 1999, en el que realiza una síntesis de los criterios de importancia esgrimidos por la Sala Constitucional respecto a la no violación del non bis in idem cuando a una persona se le siguen dos procedimientos en sedes distintas.
Se señalan los que resultan de interés para el presente disciplinario, se tiene: “* El principio de non bis in ídem es parte integrante del debido proceso (4410-97 de 29 de julio de 1997). * No existe ninguna disposición constitucional que prohíba sancionar de formas distintas un mismo hecho. (Votos 6699-94 de 15 de noviembre de 1994, 5412-95 de 4 de octubre de 1995, 6775-95 de 28 de noviembre de 1995, 5599-96 de 22 de octubre de 1996). * La transgresión de un deber no tiene efectos unívocos, ya que puede consistir en la violación de una norma meramente disciplinaria, sin otras consecuencias, o puede configurar un delito del derecho penal, o puede implicar el resarcimiento. El principio non bis in ídem sería violado únicamente en el supuesto de tratarse de responsabilidades y sanciones de la misma especie. (Votos 1265-95 de 7 de marzo de 1995, 6687-96 de 10 de diciembre de 1996). * Un mismo hecho puede ser objeto de sanciones administrativas y penales, por existir independencia entre la sede administrativa y la penal en cuanto a la imposición de sanciones.
(Votos 1569-93 de 31 de marzo de 1993, 3484-94 de 8 de julio de 1994, 4100-94 de 9 de agosto de 1994, 364-95 de 18 de enero de 1995, 2628-95 de 23 de mayo de 1995, 364-95 de 18 de enero de 1995, 5450-96 de 16 de octubre de 196)”. (Subrayado y negrita no pertenecen al original). Como se advierte, el criterio jurisprudencial deja sin sustento la tesis del inconforme, según la cual, en sede administrativa no resulta posible conocer las conductas acusadas al señor [Nombre 001], por cuanto, como se indicó supra, la sede administrativa se encuentra legalmente habilitada para investigar las conductas que resultan contrarias a las disposiciones reglamentarias que regulan el teletrabajo y zonaje en el Poder Judicial y en ese orden, claro está, las sanciones que pudiesen resultar con motivo de la aplicación del régimen disciplinario son de tipo administrativo. Nótese, para el caso del reconocimiento del Zonaje, se cuenta con el Reglamento para el Pago de Zonaje del Poder Judicial, el cual en su artículo 11, establece: “Artículo 11.-Al servidor que reciba indebidamente el pago de zonaje, se le deducirá el monto erogado por el Poder Judicial, conforme lo establecido en el artículo 173 del Código de Trabajo y en el "Reglamento General para el control y recuperación de acreditaciones que no corresponden", Decreto Ejecutivo N° 34574-H del 14 de mayo de 2008.
Asimismo, si hubiese tenido conocimiento que dicho beneficio no le correspondía, y no lo comunicó al Departamento de Gestión Humana, o bien, lo obtuvo en forma indebida, se le aplicará el régimen disciplinario previsto en la Ley Orgánica del Poder Judicial”. De modo tal, que la Administración se encuentra debidamente habilitada para la apertura del procedimiento administrativo disciplinario y, de ser procedente, la imposición de una sanción disciplinaria. Por último, respecto a lo indicado por la defensa respecto a que se incurre en una subrogación de competencia de la Dirección de Gestión Humana, lo que, a su juicio implica nulidad, al señalar la sentencia recurrida que: “Igualmente deberá la Unidad del Pagos de esa Dirección, analizar el tema del cobro de Zonaje por parte del aquí acusado, para que determine si procede la recuperación de esos montos que se recibieron estando en teletrabajo desde su lugar de residencia, fuera del Primer Circuito Judicial de la Zona Atlántica”; es criterio de este Superior que no existe ninguna subrogación de competencia, pues primeramente se tiene que establecer el incumplimiento de la regulación del zonaje para que se giren las instrucciones correspondientes a las instancias técnicas, en este caso Gestión Humana, a fin de que se proceda con el correspondiente cálculo y recuperación de los montos percibidos de forma indebida por ese concepto.
Como se advierte, no existe ningún vicio en el proceso como tampoco una subrogación de la competencia como acusa el representante del inconforme, que permita considerar siquiera la procedencia de la nulidad alegada. Por tanto, se procede al rechazo del agravio formulado.
V.3 Como quinto y sexto motivo de agravio la defensa aduce el Cumplimiento del Objeto del Contrato y la Ausencia o Insuficiente motivación en cuanto al cargo de incumplimiento del reglamento para regular la modalidad de prestación de servicios en teletrabajo en el Poder Judicial. El licenciado Flores Garrido sostiene que, en pronunciamiento recurrido, se presenta una ausencia o insuficiente motivación en cuanto al cargo de incumplimiento del Reglamento para regular la modalidad de prestación de servicios en teletrabajo en el Poder Judicial, al enfatizar que existió un vicio en la manifestación de voluntad del encausado a la hora de firmar el contrato de teletrabajo. Este punto, guarda relación con el segundo motivo expuesto por el recurrente [Nombre 001] en su recurso de apelación, según el cual, las infracciones endilgadas no existieron. Criterio del órgano de alzada: No lleva razón el inconforme, pues es claro que el encausado [Nombre 001], al momento de firmar el respectivo contrato de teletrabajo, debió guardar el debido cuidado y verificar que la opción a la cual deseaba acogerse era la correcta y se ajustaba a sus intereses, sin que resulte de recibo alegar en esta sede, que fue por un error que eligió la opción de cuatro días presenciales y uno de teletrabajo en lugar de la de cuatro días de teletrabajo y uno presencial.
El señor [Nombre 001] debió en su momento, verificar si la opción de teletrabajo que había seleccionado para el contrato que estaba suscribiendo y que se remitiría al Programa de Teletrabajo para su debido registro, era la correcta de acuerdo a sus posibilidades e intereses, más no, proceder como lo hizo, esto es, a variar sin el previo acuerdo con la parte patronal, la modalidad en cuanto al número de días en que se acogería al teletrabajo, omitiendo siquiera un aviso previo para obtener una autorización que asegurara el cumplimiento de los intereses institucionales y del buen servicio público. Recuérdese, el error no crea derecho, y el interesado y responsable en que se dispusiera el número de días de teletrabajo en el contrato lo era el señor [Nombre 001], desde un inicio. El artículo 23 del Reglamento para regular la modalidad de prestación de servicios en teletrabajo en el Poder Judicial, dispone en lo que interesa: “Artículo 23.
Del cumplimiento de normativa. La persona teletrabajadora debe cumplir con todas las condiciones que establezca la normativa, los reglamentos y directrices institucionales aplicables a esta modalidad”. Por ello, tal y como se logra comprobar a partir los elementos de prueba incorporados en autos, se tiene por demostrado que el encausado no se ajustó a los términos establecidos en su contrato de teletrabajo, ya que en vez de asistir cuatro días presenciales a su lugar de trabajo en forma presencial y, mantenerse en teletrabajo un día a la semana, procedió por decisión unilateral y sin aviso a la parte patronal, a realizar cuatro días de teletrabajo y uno presencial. De allí que, este órgano de alzada comparta en su totalidad los argumentos expuestos por el Tribunal de la Inspección Judicial en la exhaustiva fundamentación de su sentencia, propiamente, en cuanto al incumplimiento de los términos pactados respecto a los días en que el aquí inconforme [Nombre 001], se había comprometido a asistir en forma presencial al despacho, como claramente se señala en la resolución impugnada: “(…) Esta Cámara, valorados los elementos de prueba en los que se sustenta la relación de hechos probados, así como los argumentos expuestos por el denunciado en su defensa y la prueba de descargo aportada, tiene claro el incumplimiento por parte del acusado [Nombre 001], de las condiciones de la prestación del servicio en la modalidad de teletrabajo domiciliario, al cual se comprometió firmando el Contrato para Regular el Teletrabajo con el Poder Judicial el 24 de junio de 2021, del cual consta copia en disco compacto que se tiene como prueba, y del que se desprende claramente, que en su condición de juez 5 del Tribunal de Apelación Civil y de Trabajo de la Zona Atlántica, se Limón, laboraría en esa modalidad de trabajo domiciliario durante un día por semana, específicamente los días viernes, en un horario de 07:00 a 16:30 horas y en la siguiente dirección: [...]; por lo que los otros días de la semana, sea de lunes a jueves, debía presentarse a laborar en ese Tribunal.
Lo cual quedó debidamente demostrado no realizó el aquí investigado, pues durante el período de enero del 2022 hasta mayo del 2022, ha laborado una semana al mes, de manera presencial y las restantes semanas lo hizo bajo la modalidad de teletrabajo domiciliario, omitiendo de esa manera presentarse los días de lunes a jueves de cada semana al lugar de trabajo. Así quedó acreditado con la prueba consistente en Control de días laborados en la modalidad presencial de jueces del Tribunal de Apelación Civil y de Trabajo de la Zona Atlántica, Limón, Archivo excell denominado como "Copia de GIS 386421 TT presencial", documentos contenidos en disco compacto, y que como se indicó son el sustento probatorio de los datos contenidos en la tabla del hecho probado 3, de la que se desprende en ese período de enero a mayo del año 2022, la semana que el acusado laboró de manera presencial, las semanas que laboró bajo la modalidad de teletrabajo y los días de cada mes que debía acudir a su lugar de trabajo de forma presencial y no lo hizo, sino que se mantuvo en la modalidad de teletrabajo, quedando evidenciado el incumplimiento de las condiciones del contrato que firmó.
En este punto conviene referirse al argumento defensivo de que ya existía un acuerdo tomado por el Colegio de Jueces, en donde se había acordado laborar en esa modalidad, una semana presencial en el despacho y las restantes del mes en teletrabajo, que en dicho acuerdo el encausado o tomó parte, sino que simplemente se avocó a realizar sus labores como el órgano administrativo superior del Tribunal lo había dispuesto, sin cuestionar desde su posición de interinazgo, por estimar estaba ajustada a los lineamientos institucionales. A criterio de este Tribunal no es aceptable ese argumento, porque existía un contrato firmado, al cual se debía ajustar el investigado, tanto así que cuando la servidora Burnella Sinclair Mitchell, coordinadora judicial del Tribunal de Apelación Civil y de Trabajo de la Zona Atlántica, sede Limón, en correo electrónico del 7 de abril de 2022, gestionó al Consejo Superior que se mantuviera esa modalidad, sea que cada uno de los cuatro jueces de ese Tribunal asistiera una semana al mes a cumplir los cinco días presenciales que le correspondían, y que en caso que no fuera aprobado ese escenario, se determinara que los jueces tendrán que asistir dos días cada dos semanas, de modo que se cumple con el día presencial abligatorio dos veces al mes; dicha gestión fue denegada por el Consejo Superior en acuerdo adoptado en sesión número 34 celebrada el 26 de abril de 2022, Artículo LXVII, la cual se tuvo a la vista por medio del sistema Nexus PJ.
Posterior a ello, en Consejo se Jueces celebrado del 16 de mayo de 2022, y en el que participó el investigado [Nombre 001], se acordó continuar laborando en la modalidad de teletrabajo y realizando labores en la modalidad presencial un día a la semana cada uno de los cuatro jueces, de acuerdo con el artículo 18 opción 4 del Reglamento para regular la modalidad de prestación de servicios en teletrabajo en el Poder Judicial; correspondiéndole al acusado laborar de manera presencial los días martes según rol acordado a partir del 6 de junio de 2022. Se estableció además como opcionales los días viernes de cada semana, para cuando a los jueces se le presentara alguna situación imprevista el día que le correspondía laborar de manera presencial, pudiendo cumplir con la presencialidad el día viernes. Siendo así, durante el período de junio 2022 hasta enero de 2023, el acusado continuó laborando bajo en una modalidad distinta de la que se comprometió en el referido contrato, pues durante ese período se presentó a laborar de manera presencial en el Tribunal de Apelación Civil y de Trabajo de la Zona Atlántica, sede Limón, únicamente los días martes de cada semana, apartándose del contrato firmado y a pesar de que el Consejo Superior había rechazado la gestión del Tribunal.
En la tabla contenida en el hecho probado 6 se describe por mes, los días que el acusado debía laborar de manera presencial pero lo hizo bajo la modalidad de teletrabajo, y el día que laboró de manera presencial, quedando una vez más evidenciado que en ese lapso de tiempo trabajó bajo una modalidad distinta de la que se comprometió en el contrato que firmó y que se hizo referencia en líneas anteriores”. (Sic). El pronunciamiento venido en alzada así es contundente al abordar las razones que llevan al Tribunal de instancia a la adopción de la decisión vertida, las que resultan del todo convincentes en cuanto a que de parte del señor [Nombre 001] medió, sin lugar a duda, un incumplimiento del contrato de teletrabajo, siendo que resultaba responsabilidad de este último el verificar los términos en que lo había constituido para efectos de cumplirlo a cabalidad. Y, en caso de que considerara que no era así, debió, previo acuerdo con la administración, procurar que se realizaran los ajustes y modificaciones contractuales, pero en modo alguno, proceder como en efecto lo hizo, a variar unilateralmente los términos acordados en claro incumplimiento del acuerdo contractual vigente. En ese orden, los agravios formulados carecen de la fuerza requerida para variar lo resuelto y por ello, se rechazan.
V.4 Como tercer, sétimo, octavo y noveno motivo de agravio, el representante legal del inconforme alega una falta de congruencia entre lo acusado y lo resuelto; así también, lo que denomina como “consecuencia de la falta de motivación respecto al alegato de error en la firma del contrato”; y la Inexistencia de motivación en cuanto al cargo del presunto cobro indebido de zonaje. Estos alegados se encuentran estrechamente relacionados propiamente con el tema del zonaje por lo que se desarrollarán de forma conjunta. La defensa técnica sostiene que existe una falta de congruencia entre lo acusado y lo resuelto, porque se acusa un presunto cobro indebido de zonaje, pero en la sentencia del Tribunal de la Inspección Judicial, continúa subrogando la competencia de la Dirección de Gestión Humana que no le corresponde, y pese a ese estado de incertidumbre, el órgano decisor acredita el cargo. Agrega, a su vez, que, en la fundamentación del pronunciamiento, el órgano decisor manifestó que tenía certeza del cobro indebido de zonaje; sin embargo, al final de la resolución impugnada, remite el caso para que se analice el tema de dicho cobro y se determine por el Departamento de Gestión Humana, si procede la recuperación de los montos pagados, por lo que, según su criterio, no existía certeza de la existencia del cobro indebido.
Considera, asimismo, se presenta una falta de motivación respecto al cargo de cobro indebido de zonaje, afirmando el recurrente, que el a quo yerra al suponer que en virtud de que el encausado se ajustó a la opción de teletrabajar cuatro días y asistir uno en forma presencial, no tenía derecho a recibir el pago de zonaje. Aduce, en el fallo impugnado se presenta una incongruencia en lo resuelto respecto al cargo de presunto cobro indebido de zonaje El recurrente [Nombre 001] en el tercer motivo de su recurso, esto es, la inexistencia de fundamentación y valoración de la procedencia del pago de zonaje en jornada de teletrabajo tenida por demostrada en el hecho probado 3 de la sentencia (una semana al mes presencial y tres remotas en teletrabajo), como se advierte, se refiere a los mismos argumentos esbozados por la defensa técnica, por lo que serán analizados en este apartado. Criterio del órgano de alzada: Estima este Órgano Colegiado, no llevan razón los recurrentes en sus alegatos recursivos por lo que se dirá.
Nótese, el encausado alega que, durante el período en cuestión se mantuvo alquilando un apartamento en la dirección anotada en la boleta de solicitud de pago por zonaje, así como que, al sancionársele por cobrar el rubro de zonaje, se le están desconociendo los derechos laborales, incurriéndose en contradicción con lo que dispone el propio contrato de teletrabajo, el cual establece que la persona teletrabajadora tiene derecho a que “se le mantengan los mismos derechos, beneficios y obligaciones que le sean aplicables a las características del servicio bajo la modalidad presencial”. No obstante, el alegato de la defensa se fundamenta en el supuesto que, en el presente caso, se le estuviera desconociendo su derecho al pago de zonaje por el simple hecho de laborar mediante la modalidad de teletrabajo; sin embargo, ello no es así. En primer lugar, debe advertirse, en el caso que nos ocupa no se están desconociendo los derechos que le son aplicables a las características del servicio bajo la modalidad presencial del encausado, sino lo que se está aplicando, es la normativa que rige para la procedencia del pago del rubro de zonaje y el indebido cobro por parte del servidor investigado.
De modo tal, al aquí inconforme no se le están variando ni desconociendo sus derechos, beneficios ni obligaciones como funcionario judicial por haber prestado sus servicios bajo la modalidad de teletrabajo, sino que lo que se le está reprochando, es el hecho de que sin cumplir uno de los requisitos esenciales para la procedencia del pago por zonaje, lo reclamó y percibió indebidamente. En efecto, para la procedencia del pago por concepto de zonaje, el reglamento que lo regula establece como requisito el que la persona servidora se encuentre ubicada en un domicilio distinto a su domicilio real, precisamente, en aras de poder cumplir con sus obligaciones laborales, lo cual, claro está, le genera un costo adicional en el que no incurriría si permaneciera laborando en su residencia habitual o real. Y ese gasto adicional, es lo que precisamente pretende cubrirse con el pago del zonaje. Pero en el caso que nos ocupa, como ha quedado debidamente acreditado con la prueba constante en autos, ese requisito no se cumplió por parte del encausado aquí inconforme.
En ese sentido, se advierte, al momento de suscribir el contrato de teletrabajo, el encausado [Nombre 001] señaló su domicilio real como el lugar en que ejecutaría el teletrabajo, esto es, Guápiles, Barrio Santa Clara, de Motos Honda 50 norte, 100 este y 75 sur. De ese modo, es claro, que durante los días en que el encausado prestó sus servicios bajo la modalidad de teletrabajo, él se mantuvo desplegando sus labores desde su domicilio real o habitual, no así desde el domicilio accidental, pues se insiste, él mismo así lo hizo constar así en el contrato de teletrabajo. Se reitera, no es que al encausado se le estén desconociendo sus derechos laborales por estar laborando bajo la modalidad de teletrabajo, sino que lo que se le reprocha, es el haber cobrado y percibido pagos por rubro de zonaje, sin cumplir uno de los requisitos para su procedencia. Resulta oportuno acotar además que, el aquí encausado no aportó prueba idónea que viniera a acreditar que efectivamente, y contrario a lo que él mismo consignara en el contrato de teletrabajo, durante los días en que permanecía en teletrabajo hubiera desplegados sus funciones desde su domicilio accidental.
Por ello, es claro que el encausado [Nombre 001] incurre en la falta disciplinaria, porque ejecutando sus funciones bajo la modalidad de teletrabajo desde su domicilio real, reclamó y percibió el pago del rubro de zonaje, cuando ello resultaba improcedente al incumplir un requisito esencial, como lo es, que con el propósito de cumplir sus funciones se viera obligado a trasladarse al domicilio accidental. Es decir, la aplicación de la normativa que regula el pago del zonaje y la consecuente sanción por el incumplimiento del requisito, no se está aplicando al encausado en forma excepcional y menos aún, desconociendo los derechos laborales que le asisten cuando no se encuentra bajo la modalidad de teletrabajo; sino que es claro, al igual que a cualquier persona servidora, se le está exigiendo un requisito que dispone la normativa que regula el pago del tan mencionado rubro y que conforme lo consignado por él mismo en el contrato de teletrabajo que suscribiera, no se cumple pues durante los días de teletrabajo, brindó sus servicios desde su domicilio real.
Conviene señalar, tal y como se indica en la resolución impugnada, si el encausado decidió variar las condiciones en que iba a realizar el teletrabajo, debió comunicarlo oportunamente a la Dirección de Gestión Humana para que se procediera a la modificación del contrato de teletrabajo, y evitar situaciones como la que nos ocupa. Asimismo, debió comunicar o poner en conocimiento, las circunstancias que se presentaban al acogerse al contrato de teletrabajo, y que podían afectar los requisitos para verse beneficiado del pago de zonaje. Sin embargo, ello no fue así, tal y como se acredita con la prueba documental consistente en el contrato de teletrabajo, en el que el mismo licenciado [Nombre 001], consignó la dirección de su domicilio real, como el lugar desde el que ejecutaría sus labores mediante la modalidad de teletrabajo. A mayor abundamiento, al contestar el auto de traslado de cargos, en forma clara, el investigado admite lo que hasta aquí se ha indicado, esto es, que durante los días en que se encontraba en teletrabajo, él ejecutaba sus funciones desde su domicilio real; y ello así, cuando señala que, con el rol de trabajo adoptado durante ese período, al viajar a Limón para realizar funciones de presencialidad una semana al mes, permanecía en el domicilio accidental y, cuando realizaba teletrabajo las restantes tres semanas del mes, permanecía en su domicilio real.
Como bien lo señala el a quo, nos encontramos frente a un hecho no controvertido. Por lo expuesto, se estima no lleva razón la parte apelante ni resulta de recibo la tesis expuesta en el dictamen recomendativo emitido por la Comisión de Relaciones Laborales, pues se estima lo que se acusa y sanciona en el proceso disciplinario que nos ocupa, es el hecho de que el encausado, además de incumplir el contrato de teletrabajo, reclama y percibe el pago del zonaje, aún y cuando mientras ejecutó sus funciones bajo la modalidad de teletrabajo, lo hizo desde su domicilio real, como así lo consignó al momento de suscribir el contrato de teletrabajo y admite al contestar el auto de traslado de cargos. De acceder este órgano de alzada a ambas tesis recursivas, como se indicó, estaría ignorando la realidad de lo que la prueba constante en autos ha podido acreditar en el proceso, y aprobando el que un Juez de la República, que además de haber irrespetado en forma despectiva el contrato de teletrabajo suscrito con el Poder Judicial, se beneficie con el pago de un componente salarial que claramente no le correspondía.
Todo ello, en perjuicio del erario. Como juez de la República, de él se espera el más alto nivel de honestidad, respeto, probidad y apego a la legalidad y lineamientos institucionales, sobre todo si se considera que, al ejercer sus funciones como persona juzgadora -como juez del Tribunal de Apelación Civil y de Trabajo-, bajo su criterio, eventualmente, entre otros tipos de procesos, se definen los conflictos suscitados entre ciudadanos por incumplimientos de convenios jurídicos. Finalmente, en lo que interesa al noveno motivo de agravio de la defensa técnica, esto es, la acusada Incongruencia o contradicción en la resolución impugnada, que según se aduce, se presenta porque, por un lado, el Tribunal de instancia tiene por acreditado que el aquí endilgado cobró y percibió de forma indebida el rubro de zonaje, pero posteriormente, ordena poner la resolución en conocimiento de la Dirección de Gestión Humana, para lo de su cargo, indicando que deberá la Unidad de Pagos de esa Dirección, analizar el tema del cobro de zonaje por parte del aquí acusado, y determine si procede la recuperación de esos montos que se recibieron estando en teletrabajo desde su lugar de residencia, fuera del Primer Circuito Judicial de la Zona Atlántica.
Cuestiona el licenciado Flores Garrido, “¿por qué si el órgano decisor manifestó tener certeza del cobro indebido de zonaje, remitió el caso para que se analizara el tema de dicho cobro y se determinara por el Departamento de Gestión Humana, si procedía la recuperación de los montos pagados?” Considera, esa instrucción pone de manifiesto que el órgano decisor no tiene a la fecha certeza de la existencia del cobro indebido. Este órgano de alzada respeta, pero no comparte el criterio de la defensa técnica. Ello así, porque no debe confundirse el hecho acusado y debidamente comprobado, esto es, que el aquí encausado procedió al cobro indebido del rubro de zonaje pues no cumplía con uno de los requisitos esenciales para su procedencia, cual es el realizar el trabajo desde un domicilio accidental; con la obligada disposición de procurar recuperar las sumas giradas a favor del encausado en detrimento del erario.
Nótese, en sede administrativa se ha comprobado la existencia de la falta disciplinaria, esto es, el cobro indebido del rubro por concepto de zonaje en que incurrió el encausado, pero será por parte del órgano técnico que se deberán realizar los cálculos respectivos para determinar el monto girado en forma indebida a favor del funcionario [Nombre 001], y la recuperación respectiva. De ese modo, no existe motivo alguno para considerar que el a quo ha incurrido en una Incongruencia o contradicción en la resolución impugnada, toda vez que la orden girada a la Dirección de Gestión Humana para que se determina la procedencia de recuperación de las sumas giradas con ocasión del acreditado cobro indebido por parte del encausado, constituye una fase posterior a la comprobación de la falta en sede disciplinaria por lo que lo ordenado por el a quo, resulta ajustado a derecho y al mérito de los autos. Como se advierte, los agravios formulados por la defensa técnica y material del agraviado, carecen de sustento para derribar el pronunciamiento venido en alzada, y por ello se rechazan.
V.5 Como cuarto y décimo motivo de agravio, el licenciado Flores Garrido acusa la que el a quo incurre en una errónea aplicación del artículo 36 del Reglamento para Regular la modalidad de prestación de servicio del Teletrabajo en el Poder Judicial; así como que en la sentencia impugnada se presenta la Desproporcionalidad de la sanción impuesta y perjuicio para la buena prestación del servicio público. Advierte al efecto, no deben dejarse de lado los fines que persigue el reglamento de teletrabajo regulados en el artículo 2 de ese instrumento jurídico y que no debe pretenderse la formalidad por la mera formalidad, ya que el encausado tuvo un excelente desempeño por encima de las cuotas establecidas para su cargo, cumpliendo en todo momento con el objeto del contrato de trabajo. Agrega, existía un acuerdo del Colegio de Jueces para organizar las labores del despacho de esa forma. A su vez, señala que la sanción resulta desproporcionada y que perjudica considerablemente al servicio público, ya que el desempeño del señor [Nombre 001] fue excelente durante el periodo acusado.
Estos agravios guardan relación con el primer, segundo y cuarto motivo de inconformidad que alega el encausado [Nombre 001], esto es, Inexistencia del incumplimiento contractual acusado; Inexistencia de las infracciones endilgadas y, desproporcionalidad de la sanción impuesta y perjuicio para la buena prestación del servicio público. Refiere el agraviado, de su parte cumplió en todo momento con las cuotas de trabajo asignadas, con un excelente rendimiento, y en ningún momento afectó el servicio público. Considera, asimismo, que la sanción impuesta por el a quo resulta desproporcional y causa perjuicio para la buena prestación del servicio público. Criterio del órgano de alzada: Respecto a lo indicado por la defensa técnica del inconforme, debe señalarse por este órgano de alzada, en el caso que nos ocupa, con la prueba que consta en autos se ha logrado comprobar que durante el período de junio 2022 hasta enero de 2023, el encausado continuó laborando bajo una modalidad distinta a la que se comprometió en el referido contrato de Teletrabajo, pues durante ese período se presentó a laborar de manera presencial en el Tribunal de Apelación Civil y de Trabajo de la Zona Atlántica, sede Limón, únicamente los días martes de cada semana, apartándose de las condiciones dispuestas en el contrato de teletrabajo suscrito y ello así, pese a que este Consejo, había rechazado la gestión del Consejo de jueces del despacho de cita.
Asimismo, y no menos importante, quedó acreditado que el aquí inconforme, cobró y percibió de forma indebida el pago por rubro de zonaje correspondiente al período que corre de enero a mayo de 2022, ambos inclusive, tal y cual hubiese estado laborando en forma presencial en el despacho y, por tanto, viviendo durante todo ese período en el domicilio accidental. Estos hechos debidamente acreditados, dejan sin sustento la tesis recursiva, así como la recomendación que plantea la Comisión de Relaciones Laborales. En efecto, tal y como se tiene por probado y se analiza en la resolución impugnada, el licenciado [Nombre 001] suscribió la boleta de solicitud de zonaje N° ZON-2021010646 de fecha 21 de setiembre del 2021, y valga señalar, de la que consta copia agregada los autos, consignando como domicilio real la siguiente dirección: “Limón, Pococí, Guápiles, de la Estación de Servicio Santa Clara 400 metros norte, 100 al este y 75 al sur, última casa a mano derecha en calle sin salida”; y como domicilio accidental la dirección: “Limón - Central- Central Limón, Limón, Limón Centro, Barrio Santa Eduviges, de la Pulpería Acon, 150 metros este, apartamentos en última entrada a la derecha en calle sin salida, apartamentos al fondo.”.
Este componente salarial le fue reconocido al licenciado [Nombre 001], permitiéndole percibir la suma total de un millón cuatrocientos catorce mil seiscientos colones exactos por ese concepto. Pese a ello, como claramente indica la resolución recurrida y se comprueba con la prueba documental que se cita en el mismo voto, durante el período que corre del mes de enero hasta el mes de mayo del 2022, en que el acusado cobró y percibió el rubro de zonaje, él laboró entre 2 y 4 semanas al mes -conforme se especifica en la tabla contenida en el hecho probado 9-, bajo la modalidad de teletrabajo domiciliario, en la dirección consignada en el Contrato para Regular el Teletrabajo en el Poder Judicial, sea [...], es decir, en una dirección distinta al domicilio accidental que corresponde a: [...]. Esta información se obtiene de la boleta de solicitud de zonaje N° ZON-2021010646 de fecha 21 de setiembre del 2021, del oficio número DGH-SAS-UPS-515-2023 del 24 de febrero de 2023, emitido por la Unidad de Pagos Salariales, Consulta de Componentes Salariales por Empleado del 23 de febrero de 2023, documentación emitida por la Dirección de Gestión Humana, Contrato para Regular el Teletrabajo en el Poder Judicial con la Persona Servidora Judicial, suscrito por el inconforme Licenciado [Nombre 001] y la Dirección de Gestión Humana; además del Control de días laborados en la modalidad presencial de jueces del Tribunal de Apelación Civil y de Trabajo de la Zona Atlántica, sede Limón.
De ese modo, en esas condiciones laborales, no queda duda en cuanto a que el licenciado Alvarado si cobró y percibió de forma indebida el rubro del zonaje, toda vez que lo recibió realizando teletrabajo desde su lugar de residencia o domicilio real y no, como pretende hacer ver la defensa, desde su domicilio accidental. Lo anterior, con el agravante de que esa situación no fue puesta en conocimiento de la Dirección de Gestión Humana, Unidad de Pagos, para que analizara si procedía o no el pago del rubro de zonaje, bajo esas condiciones de trabajo. Estos hechos, se insiste, se encuentran debidamente demostrados con prueba que rola en el expediente, y pese a ello, la tesis absolutoria pretende ignorar la existencia de esa prueba, aspecto que como se indicó y se analizará, no resulta posible admitir por parte de este órgano colegiado. Se reitera, no solo queda debidamente demostrado que el encausado incumplió el contrato de teletrabajo, y por si fuera poco, lo hizo laborando en forma presencial únicamente una semana al mes durante el período acusado y, en el otro período, durante un día a la semana; sino que también queda acreditado, cobró y percibió el rubro de zonaje, aún y cuando durante el período que corre de junio de 2022 a enero del 2023 y, en el período que corre de enero a mayo de 2022, los días en que se encontraba en teletrabajo el encausado ejecutaba sus funciones desde su domicilio real, como así lo consignó en el contrato de teletrabajo que suscribió con la institución.
Pese a todo ello, la tesis defensiva pretende la absolutoria del investigado, bajo el razonamiento de que, durante la ejecución de sus funciones mediante esta modalidad el encausado incrementó su producción y, lejos de afectar el servicio público, éste se vio favorecido; así como porque el encausado no cuenta con sanciones disciplinarias en su prontuario. El argumento en que se apoya esta tesis propuesta resulta respetable, pero no es compartido por este Consejo. Nótese, en primer orden, se trata de un juez de la República que suscribió un contrato de Teletrabajo, el cual debía ser cumplido bajo las condiciones pactadas y mediante las que, se procura asegurar el servicio público encomendado, así como la atención de los deberes que la función jurisdiccional exige ejecutar en forma presencial. La queja disciplinaria que genera el presente pronunciamiento no busca una medición de productividad, pues para ello sencillamente se requeriría un estudio de la Dirección de Planificación y el Subproceso de Estadística; y en todo caso, ese aspecto no se le cuestiona ni ha sido objeto de acusación en este procedimiento disciplinario.
En ese sentido, conviene señalar, el régimen disciplinario lo que persigue en estos casos es asegurar la buena conducta, seriedad y cumplimiento del horario y modalidad de trabajo al que se compromete el funcionario al suscribir el contrato de teletrabajo; así como de las condiciones que permiten el pago por reconocimiento del rubro de zonaje. Por ello, no es posible considerar que, por haber incrementado su producción se minimice la falta disciplinaria debidamente acreditada y el actuar irregular del encausado; sobre todo, cuando se trata de una falta que, por su naturaleza, resulta incluso gravísima por tratarse de un incumplimiento de las condiciones del contrato de teletrabajo, así como del cobro indebido del rubro de zonaje, lo cual afecta directamente el erario conforme lo disponen los numerales 194 y 195 de la Ley Orgánica del Poder Judicial. Bajo este análisis, es claro que tanto la calificación como el quantum de la sanción acordada cumple con las condiciones de razonabilidad y proporcionalidad advertidas anteriormente, al resultar acordes con los hechos tenidos como comprobados y las consideraciones expuestas a lo largo del presente pronunciamiento.
Conviene precisar, la sanción impuesta se considera razonable pues es claro que la protección a los principios que regulan la prestación del servicio público encomendado, necesario y obligatorio proteger los principios que regulan la prestación del servicio público encomendado, en especial, para las personas a quienes se les encomienda la ardua y delicada labor de Administración de Justicia, se constituye en una obligación. Si la Administración ha delegado en las personas juzgadoras tan delicada función, se espera y exige que su ejecución se realice en estricto acatamiento de los lineamientos establecidos al efecto y sin duda alguna, verificando el cumplimiento de los requisitos de ley por parte de quienes resulten elegidos para el ejercicio de un cargo en la judicatura. Se le recuerda al encausado en tal sentido, que al momento en que aceptó laborar para el Poder Judicial, asintió en que su conducta debía ser consecuente con las normas que rigen para todo servidor o servidora judicial, siendo de mayor reproche su comportamiento al contar con más de 15 años de ejercicio de la función jurisdiccional.
Por ello, como Juez de la República, no puede quedar margen de duda sobre sus actuaciones y comportamiento, los cuales deben siempre generar confianza, respeto y compromiso. El Código Iberoamericano de Ética Judicial, establece que la persona juzgadora asume un compromiso para con la institución, sometiéndose a todas las acciones que se realicen para mejorar el sistema judicial, asumiendo un compromiso activo en el buen funcionamiento y cumpliendo con sus obligaciones específicas de carácter individual (Artículo 42). Además, la integridad de la conducta del juez fuera del ámbito estricto de la actividad jurisdiccional contribuye a una fundada confianza de los ciudadanos en la judicatura. (Artículo 53) y no debe comportarse de una manera que un observador razonable considere gravemente atentatoria contra los valores y sentimientos predominantes en la sociedad en la que presta su función (Artículo 54).
Finalmente, debe ser consciente de que el ejercicio de la función jurisdiccional supone exigencias que no rigen para el resto de los ciudadanos (Artículo 55). Así las cosas, no observa esta Cámara que se hayan producido los yerros que aduce la parte recurrente, pues de los hechos que se han tenido por debidamente demostrados y que este Órgano de alzada prohíja, se concluye que el órgano decisor de primera instancia expuso de manera clara y adecuada, los motivos por los cuales se sanciona al funcionario [Nombre 001] con una suspensión de dos meses en el ejercicio de su cargo sin goce de salario, lo cual fundamenta de manera diáfana. Conviene señalar, este Colegio coincide ampliamente con el sustento empleado respecto a la calificación otorgada a la falta cometida por el denunciado, habida cuenta que conforme lo resuelto por el a quo en la resolución cuestionada, la calificación resulta ajustada a los hechos debidamente comprobados y en estricta sujeción a lo dispuesto en la norma.
La calificación otorgada a la falta acusada y acreditada, esto es, como falta gravísima, encuentra asidero en lo establecido por el numeral 194 y 195 de la Ley Orgánica del Poder Judicial, el Reglamento para regular la modalidad de prestación de servicios en teletrabajo en el Poder Judicial, así como el Reglamento para el pago de Zonaje en el Poder Judicial (Circular 110-2010). De lo anterior se colige, el Tribunal de instancia fundamentó adecuada y suficientemente, los motivos que le llevaron a imponer dicha sanción, misma que se considera justa y acorde con los hechos acusados y debidamente acreditados, y con la que se espera que el servidor [Nombre 001], recapacite y corrija su conducta, bajo el entendido, que en caso de que este objetivo no se logre y se acredite un nuevo incumplimiento, procederá la aplicación de una sanción más severa. Desde esta perspectiva, es preciso dejar patente que, resulta claro, con la sanción impuesta se cumple el fin educativo que invoca el régimen disciplinario en la institución. Por lo expuesto, el reproche que sustenta el motivo de apelación bajo análisis carece de sustento y por ello, se rechaza.
Conforme todo lo anteriormente expuesto, los reproches que sustentan los motivos de apelación bajo análisis carecen de sustento y de la fuerza requerida para variar lo resuelto, y por ello se rechazan. En consecuencia, en lo que ha sido objeto de recurso, se confirma en todos sus extremos la resolución contenida en el Voto N° 2023-003252 de las ocho horas once minutos del cinco de octubre de dos mil veintitrés.
Conforme lo anterior se acordó por mayoría:
La integrante Orozco Álvarez, se aparta del voto de mayoría, manteniendo su posición al respecto, al estimar que se debe resolver acogiendo parcialmente el recurso de apelación de la defensa técnica, por los motivos cuarto, sétimo, octavo y décimo; del recurrente el primero, segundo, tercero y cuarto motivo, por lo que se confirma el acto final del procedimiento N° 2023-003252 de las ocho horas once minutos del cinco de octubre de dos mil veintitrés, dictada por el Tribunal de la Inspección Judicial, dentro del proceso disciplinario número 23-000476-0031-DI, seguido contra [Nombre 001], Juez del Tribunal de Apelación Civil y Trabajo de la Zona Atlántica, sede Limón, cédula de identidad número [Valor 001], mediante la cual se declaró con lugar la causa, pero modificando la calificación de la falta a leve e imponiendo la sanción de amonestación escrita sobre los hechos relacionados con el incumplimiento del contrato de teletrabajo. Se exime de toda responsabilidad al señor [Nombre 001], por los hechos acusados con relación al cobro indebido de zonaje.”
