Decision No. 2020015523 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at eleven fifty on dieciocho de agosto de dos mil veinte.

Mandatory legislative constitutional review (consulta legislativa preceptiva de constitucionalidad) submitted by the Directorio de la Asamblea Legislativa concerning the bill entitled “Approval of the Regional Agreement on Access to Information, Public Participation and Access to Justice in Environmental Matters in Latin America and the Caribbean (Escazú Agreement),” under consideration in legislative file (expediente legislativo) number 21.245.

BACKGROUND:

  1. 1The request for review, submitted in compliance with subsection a) of Article 96 of the Ley de la Jurisdicción Constitucional, was received by the Secretariat of the Chamber at 11:09 hrs. on 23 de julio de 2020, together with a certified copy of the legislative file. The Presidency of the Chamber deemed the request duly submitted by decision issued at 13:57 hrs. on 23 de jul0io de 2020.
  2. 2The statutory requirements have been observed in the conduct of the proceedings.

CONSIDERING:

I. SUBJECT MATTER OF THE REVIEW

This mandatory constitutional review is submitted by the Directorio de la Asamblea Legislativa in compliance with Article 10, subsection b), of the Constitución Política and Article 96, subsection a), of the Ley de la Jurisdicción Constitucional (LJC), in connection with the bill entitled “Approval of the Regional Agreement on Access to Information, Public Participation and Access to Justice in Environmental Matters in Latin America and the Caribbean (Escazú Agreement),” under consideration in legislative file number 21.245, because it concerns legislative approval of an international instrument or agreement.

II.PROCEEDINGS IN LEGISLATIVE FILE NUMBER 21.245 BEFORE THE ASAMBLEA LEGISLATIVA. For purposes of examining the admissibility of this legislative review, a chronological summary of the parliamentary proceedings must first be provided:

  • 1)On 04 de marzo de 2018, the Regional Agreement on Access to Information, Public Participation and Access to Justice in Environmental Matters in Latin America and the Caribbean was signed in the Cantón de Escazú (see certification from the Ministra de Relaciones Exteriores y Culto, appearing at folio 41 of the copy of the legislative file, volume I).
  • 2)The bill, which was introduced by the Poder Ejecutivo, was submitted to the Secretaría del Directorio de la Asamblea Legislativa at 11:40 horas on 01 de febrero de 2019 (folios 1-42 of the copy of the legislative file, volume I).
  • 3)By order (auto) dated 01 de febrero de 2019, the Acting Director of the Secretaría del Directorio de la Asamblea Legislativa, acting on the instructions of the Presidenta de la Asamblea Legislativa, referred the bill to the Comisión Permanente Especial de Relaciones Internacionales y de Comercio Exterior for its committee report (dictamen), as well as to the Departamento de Archivo for publication and to the Departamento de Servicios Parlamentarios for inclusion of the text in the integrated legislative system (folio 46 of the copy of the legislative file, volume I).
  • 4)On 18 de febrero de 2019, the Departamento de Archivo, Investigación y Trámite forwarded the bill to the Imprenta Nacional for publication, in accordance with Article 117 of the Reglamento de la Asamblea Legislativa (folio 85 of the copy of the legislative file, volume I).
  • 5)The bill was published in Alcance n.°48, Gaceta n.°44 of 04 de marzo de 2019 (cover page of the legislative file and https://www.imprentanacional.go.cr/pub/2019/03/04/ALCA48_04_03_2019.pdf ).
  • 6)The Comisión de Relaciones Internacionales y Comercio Exterior approved a motion submitted on 14 de marzo de 2019 to consult the Ministerio de Ambiente y Energía, the Ministerio de Planificación, and the Ministerio de Educación Pública regarding the text of the agreement (see folios 87-92 of the copy of the legislative file, volume I).

  • 14)By email dated 11 de mayo de 2020, the Secretaría de la Asamblea Legislativa submitted the constitutional consultation (consulta constitucional) to the Corte Suprema de Justicia (see folio 537 of the copy of the legislative file, volume III).
  • 15)At session n.°27-2020 of 18 de mayo de 2020, the Corte Plena ruled on the institutional consultation by a majority of 15 votes as follows: “1) To deem submitted and adopt Justice Vargas’s report and bring it to the attention of the Departamento de Secretaría del Directorio de la Asamblea Legislativa in response to the consultation submitted, expressly indicating that the bill under review does affect the organization and operation of the Poder Judicial. 2) To specifically indicate that the bill directly affects the budget of the Poder Judicial and that it would therefore be necessary to include the budgetary appropriations required to cover the obligations imposed by law. Justices Rivas, Solís, Rojas, Molinari, Vargas, Aguirre, Varela, Sánchez, Chacón, Ramírez, Solano, Burgos, Alfaro, Zúñiga, and substitute Justice Campos Esquivel voted accordingly. Justice Cruz voted, for the reasons stated, against adopting Justice Vargas’s report. Justices Castillo, Salazar Alvarado, Araya, and Garro abstained from voting. The President, Justice Cruz, states: ‘I must say that the preceding resolution and this one are declared final.’” (see folios 544-560 of the copy of the legislative file, volume III).
  • 16)At extraordinary session of the Plenario Legislativo n.°14 dated 9 de junio de 2020, the operative part (por tanto) of decision n.°2020-6134 of this Sala Constitucional was read, and the Presidency ordered that the legislative file be referred to the Comisión Permanente Especial de Consultas de Constitucionalidad for a period of eight business days (see folios 562 et seq. of the copy of the legislative file, volume III).
  • 17)On 11 de junio de 2020, the Secretaría del Directorio delivered legislative file n.°21.245 to the Comisión Permanente Especial de Consultas de Constitucionalidad (folio 611 of the copy of the legislative file, volume III).
  • 18)On 24 de junio de 2020, the Comisión Permanente Especial de Consultas de Constitucionalidad recommended that the Plenario Legislativo submit the legislative file to the Sala Constitucional for review, adding the response provided by the Corte Suprema de Justicia, so that the mandatory analysis of the regional agreement could continue and the Asamblea could subsequently proceed with the corresponding legislative process (folios 643-644 of the copy of the legislative file, volume III).
  • 19)On that same 24 de junio de 2020, the Commission forwarded the adopted report to the Departamento de la Secretaría del Directorio (see folio 645 of the copy of the legislative file, volume III).
  • 20)At extraordinary session n.°27 of 16 de julio de 2020 (the minutes state 2019), the Plenario Legislativo began discussing the unanimous report of the Comisión Permanente Especial de Consultas de Constitucionalidad, which was put to a vote and approved. A motion for reconsideration (moción de revisión) was subsequently submitted and rejected. Based on the foregoing, it was ordered that the legislative file be forwarded to this Sala Constitucional (folios 649-666 of the copy of the legislative file, volume III).
  • 21)The file contains instructions to the Secretaría del Directorio to proceed in accordance with the recommendation in the report, to place the bill in the second-reading portion of the agenda for the next session, and to resubmit the file to the Sala Constitucional for mandatory review so that it may continue its substantive analysis, after which the Asamblea may continue with the corresponding legislative process (folio 650 of the copy of the legislative file, volume III).

III. THE DEFECT OF UNCONSTITUTIONALITY IDENTIFIED BY THE CHAMBER IN THE PRIOR PROCEEDING

As is clear from the procedural history summarized above, the Asamblea Legislativa had already submitted an initial legislative review concerning this international agreement. In the prior advisory opinion, processed under file n.° 20-003368-0007-CO, this Chamber identified a fundamental defect that invalidated the parliamentary proceedings conducted up to that point. That decision was joined by a majority of this Court because it was established that an essential requirement set forth in the Constitución Política itself had not been fulfilled, namely, the mandatory consultation with the Corte Suprema de Justicia prescribed by Article 167.

Decision n.°2020-006134 set forth the following considerations:

“In accordance with the provisions of article 98 of the law governing this Jurisdiction, this Court reviewed the legislative procedure followed in processing the bill entitled «APPROVAL OF THE REGIONAL AGREEMENT ON ACCESS TO INFORMATION, PUBLIC PARTICIPATION AND ACCESS TO JUSTICE IN ENVIRONMENTAL MATTERS IN LATIN AMERICA AND THE CARIBBEAN (ACUERDO DE ESCAZÚ)», which is being processed under legislative expediente number 21.245. It is noted that the bill was introduced into the legislative process by the Executive Branch in exercise of its power to initiate legislation, as provided for in article 140, subsection 5), of the Political Constitution. It was also established that the bill under consultation was published, reported favorably out of committee, and approved on first reading. However, this Chamber notes that a substantive procedural step that should have been followed was not carried out. Article 8 of the "Acuerdo de Escazú" concerns "Access to justice in environmental matters," under which our country undertakes several commitments concerning judicial proceedings. That article literally provides as follows:

''Article 8 Access to justice in environmental matters Each Party shall guarantee the right of access to justice in environmental matters in accordance with the guarantees of due process (debido proceso).

Each Party shall ensure, within the framework of its national legislation, access to judicial and administrative bodies to challenge and appeal, with respect to both substance and procedure:

  • a)any decision, action or omission related to access to environmental information; b) any decision, action or omission related to public participation in environmental decision-making processes; and c) any other decision, action or omission that adversely affects or may adversely affect the environment or contravenes legal provisions related to the environment.

To guarantee the right of access to justice in environmental matters, each Party, taking its circumstances into account, shall have:

  • a)competent State bodies with access to specialized expertise in environmental matters; b) effective, timely, public, transparent and impartial procedures that are not prohibitively expensive; c) broad legal standing (legitimación activa) to defend the environment, in accordance with national legislation; d) the possibility of ordering precautionary and provisional measures (medidas cautelares y provisionales) for purposes including preventing, halting, mitigating or remedying environmental damage; e) measures to facilitate the production of evidence of environmental damage, where appropriate and applicable, such as reversal of the burden of proof (inversión de la carga de la prueba) and the shifting burden of proof (carga dinámica de la prueba); f) mechanisms for the timely enforcement of, and compliance with, the relevant judicial and administrative decisions; and g) remedial mechanisms, as appropriate, such as restitution to the condition existing before the damage, restoration, compensation or payment of a monetary penalty, satisfaction, guarantees of non-repetition, assistance to affected persons, and financial instruments to support remediation.

To facilitate public access to justice in environmental matters, each Party shall establish:

  • a)measures to reduce or eliminate barriers to the exercise of the right of access to justice; b) means of disseminating information about the right of access to justice and the procedures for making it effective; c) mechanisms for systematizing and disseminating the relevant judicial and administrative decisions; and d) the use of interpretation or translation from languages other than the official languages when necessary for the exercise of that right.

To give effect to the right of access to justice, each Party shall address the needs of persons or groups in situations of vulnerability by establishing support mechanisms, including free technical and legal assistance, as appropriate.

Each Party shall ensure that judicial and administrative decisions adopted in environmental matters, as well as the grounds on which they are based, are set forth in writing.

Each Party shall promote alternative dispute-resolution mechanisms in environmental matters, where appropriate, such as mediation, conciliation, and others that make it possible to prevent or resolve such disputes." It is noted that obligations are imposed on the Judiciary concerning, for example, free technical and legal assistance (subsection 5), public procedures (subsection 3.b), among other matters. All of this relates to the organization and operation of the Judiciary. Nevertheless, the corresponding Legislative Committee did not conduct the mandatory consultation (consulta obligatoria) with the Judiciary, as required by article 167 of the Political Constitution ("Article 167.- For the discussion and approval of bills concerning the organization or operation of the Judiciary, the Legislative Assembly shall consult the Supreme Court of Justice; a vote of two-thirds of the entire membership of the Assembly shall be required to depart from its opinion.").

In the decisions of this Chamber numbered 1998-005958, 2001-013273 and 2008-005179, it was established that when the provisions of a bill contain explicit rules ordering the creation, substantial alteration, or abolition of strictly adjudicative bodies or administrative bodies attached to the Judiciary, or when they create ex novo, substantially modify, or eliminate functions that are substantively adjudicative or administrative, the Judiciary must be consulted. Similarly, as precedent, reference may be made to the ruling issued in decision number 2017-004221 at 09:15 hours on 21 de marzo del 2017, which likewise found the procedural defect (vicio de procedimiento) of failing to consult the Judiciary regarding an international agreement and stated as follows:

"Through section 2 of the bill, the Judiciary is subjected to the obligations referred to in the judgment transcribed above; it creates new functions within its organization and administrative structure.

(...) As explained in the precedent cited above, this requires the mandatory constitutional consultation with the Judiciary, evidently because of the legal implications and resources it demands, as well as the need to create specialized administrative bodies attached to the Judiciary. In this regard, article 167 of the Political Constitution establishes the Legislative Assembly’s obligation to consult the Supreme Court of Justice when bills concerning the organization and operation of the Judiciary are discussed and approved. Accordingly, the defect identified is procedural and is binding in light of article 101 of the Ley de la Jurisdicción Constitucional, given the failure to comply with the provisions of that article of the Political Constitution." Accordingly, it is noted that the mandatory consultation with the Judiciary was omitted during the processing of the bill, which constitutes a substantive procedural defect (vicio sustancial del procedimiento) that violates Constitutional Law (Derecho de la Constitución) (the aforementioned constitutional article 167).

Consequently, the bill entitled «APPROVAL OF THE REGIONAL AGREEMENT ON ACCESS TO INFORMATION, PUBLIC PARTICIPATION AND ACCESS TO JUSTICE IN ENVIRONMENTAL MATTERS IN LATIN AMERICA AND THE CARIBBEAN (ACUERDO DE ESCAZÚ)», which is being processed under legislative expediente number 21.245, contains a procedural defect due to the failure to consult the Supreme Court of Justice, in accordance with article 167 of the Political Constitution. This defect is binding on the Legislative Assembly in light of article 101 of the Ley de la Jurisdicción Constitucional, which provides: "The Chamber’s opinion shall be binding only insofar as it establishes the existence of unconstitutional procedural steps in the bill under consultation.” Likewise, Justice Castillo Víquez and Justice Hernández López placed additional separate notes on the record. The latter did so with the express purpose that “they be taken into account in correcting this important agreement before its adoption.” The operative part (parte dispositiva) stated as follows:

“By majority vote, it is declared that there is a procedural defect due to the failure to submit the bill entitled Regional Agreement on Access to Information, Public Participation and Access to Justice in Environmental Matters in Latin America and the Caribbean to the Supreme Court of Justice for consultation in accordance with article 167 of the Political Constitution, a defect that is binding on the Legislative Assembly. Justice Castillo Víquez and Justice Hernández López append separate notes. Justice Rueda Leal dissents and finds no defects of either form or substance in the bill under consultation. Notice shall be given.” (Emphasis does not appear in the original ruling).

IV. ON THE ADMISSIBILITY OF THIS CONSULTATION

For purposes of examining the admissibility of this new mandatory legislative consultation (consulta legislativa preceptiva), it should first be noted that articles 96, subsection a), and 98, first paragraph, of the LJC expressly provide as follows:

“Article 96 . Through constitutional consultation proceedings (consulta de constitucionalidad), the constitutional jurisdiction shall issue a prior advisory opinion on legislative bills in the following circumstances:

  • a)Mandatorily, when they concern bills to amend the Constitution or this law, as well as bills seeking approval of international conventions or treaties, including reservations made or proposed with respect to either. (…)” Article 98. In the case of constitutional amendments, the consultation shall be made after approval on first reading, during the first legislative term, and before final approval. In the case of other bills or legislative acts subject to the lawmaking process, it shall be filed after approval on first reading and before approval on third reading. (…)” It follows from the foregoing that the mandatory constitutional consultation for the approval of international conventions or treaties “shall be filed after approval on first reading.” That essential admissibility requirement (requisito esencial de admisibilidad) is not satisfied in this case. It should be noted that, by declaring an essential defect in the legislative procedure, the vote on first reading held during Ordinary Plenary Session n.°135 of 13 de febrero de 2020 was implicitly—but indisputably—invalidated.

As this Chamber has already indicated, that vote was conducted without complying with the requirements expressly established in the Political Constitution, namely, that the corresponding opinion of the Supreme Court of Justice be obtained before approval. This is because the bill approving the regional agreement contains express provisions affecting the organization and operation of the Judiciary.

That ruling is binding on the Legislative Assembly because unconstitutional procedural steps were identified in the bill under consultation, as stated in the second paragraph of article 101 of the LJC, which provides:

“Article 101. (…) The Chamber shall issue its opinion on the consultation within the month following its receipt and, in doing so, shall rule on the aspects and grounds raised in the consultation or on any others that it considers relevant from a constitutional standpoint.

The Chamber’s opinion shall be binding only insofar as it establishes the existence of unconstitutional procedural steps in the bill under consultation.” Nevertheless, in this particular case, the intent is to obtain a new advisory opinion without satisfying the indispensable admissibility requirement, namely, that the bill have been put to a vote in the first debate after the institutional opinion of the Corte Suprema de Justicia had been obtained and assessed.

At this point, it appears essential to state that this Chamber has repeatedly held that institutional consultations (consultas institucionales) must be conducted at a procedural stage that gives the Asamblea a genuine opportunity to hear the opinion issued by the institution involved, so that it may address and take it into account during the legislative procedure (procedimiento legislativo). Otherwise, the purpose of mandatory institutional consultations is undermined.

Thus, for example, since judgment n.°1633-93, it has been emphasized that this type of consultation is not a mere procedural formality devoid of a substantive purpose; quite the contrary, it is intended precisely to ensure that the opinion is submitted in a timely manner and taken into account by the legislators. The cited decision held as follows:

“The consultation is not, however, a mere procedural formality devoid of substantive meaning or purpose, since it pursues an objective relating to the suitability or quality of the law to achieve the specific results sought through it. Accordingly, the consultation must take place at a procedural stage at which the Asamblea has a genuine opportunity to hear the advisory opinion, that is, to address and consider it; put differently, what explains and justifies Article 190 is that the Asamblea actually have a sufficient opportunity, during the process, to learn of and assess the advisory opinion before making a decision. Moreover, the requested opinion concerns a specific bill, namely, the bill submitted for legislative consideration through the exercise of the right of initiative. The opinion may result in an amendment to the bill, in which case—particularly if this occurs during what is commonly called the ‘committee stage’ (trámite de Comisión)—the consultation does not necessarily concern the ‘final bill’: on the contrary, in such a situation, the consultation would have led the legislative will to formulate a text different from the one originally introduced.” (Criterion reiterated in advisory opinions n.° 2001-02642 and n.° 2003-05404).

The foregoing is consistent with Articles 126 and 157 of the Rules of Procedure of the Asamblea Legislativa (Reglamento de la Asamblea Legislativa), which govern the procedural stages at which institutional consultations must be conducted. Those provisions state as follows:

“Article 126.—Mandatory and optional consultations. The Chair of the reporting committee shall conduct the mandatory consultations no later than the third session after the matter has been placed on the agenda.

Consultations conducted by committees shall be deemed to have been conducted by the Asamblea itself and, where applicable, Article 157 of these Rules of Procedure shall apply.

In the case of legislative committees, conducting mandatory or optional consultations shall not prevent the continuation of procedural steps or other non-final preparatory acts.” (As amended at session N° 45 of 24 de julio de 2019).

“Article 157.—Institutional consultations When, during the discussion of a bill, the Asamblea determines that the Tribunal Supremo de Elecciones, the Universidad de Costa Rica, the Poder Judicial, or an autonomous institution must be consulted, and the committee has not done so, consideration of the bill shall be suspended and the corresponding consultation shall be conducted. If no response to the consultation referred to in this Article is received within eight business days, it shall be understood that the consulted body has no objection to the bill. If, within that period, the consulted body submits observations on the bill, the bill shall automatically be referred to the corresponding committee if the Asamblea accepts those observations. If the Asamblea rejects them, while complying with the Constitución Política, the matter shall continue through the ordinary legislative process.” (Emphasis not in the original).

Following the declaration that the legislative procedure was invalid, the appropriate course was to return the parliamentary proceedings to the stage at which the constitutional defect (vicio de inconstitucionalidad) occurred and to comply with the procedure governed by Article 157 of the Rules of Procedure of the Asamblea Legislativa; that is, to return the proceedings to the Plenary so that the institutional consultation could be formally conducted and, if observations on the bill existed—as occurred in this particular case—to undertake the assessments necessary to determine whether the legislative file should be returned to committee to incorporate the suggestions made, or whether the bill required an enhanced majority vote (votación reforzada), in accordance with Article 167 of the Constitución Política, whose text is quoted below.

It must be emphasized that, when this regional agreement was submitted to the authorities of the Corte Suprema de Justicia for consultation, a majority voted as follows:

“1) To deem the report of Justice Vargas submitted and to adopt it, and to communicate it to the Departamento de Secretaría del Directorio de la Asamblea Legislativa in response to the consultation made, expressly indicating that the bill under consultation does affect the organization and functioning of the Poder Judicial. 2) To state specifically that the bill directly affects the budget of the Poder Judicial and that it would therefore be necessary to include the budget appropriations required to cover what is mandated by law. Justices Rivas, Solís, Rojas, Molinari, Vargas, Aguirre, Varela, Sánchez, Chacón, Ramírez, Solano, Burgos, Alfaro, Zúñiga, and alternate Justice Campos Esquivel voted accordingly. For the reasons stated, Justice Cruz voted not to adopt Justice Vargas’s report. Justices Castillo, Salazar Alvarado, Araya, and Garro abstained from voting. The President, Justice Cruz, states: ‘I must say that the preceding resolution and this one are hereby declared final.’” For that reason, given the existence of an opinion by the Corte Suprema de Justicia stating that approval of this agreement does affect the organization and functioning of the Poder Judicial, and given the express request that the corresponding budget appropriations necessary for its proper implementation be included, the appropriate course in this particular case was to return the file to the procedural stage at which the defect arose, in order to examine and assess the statements of the Poder Judicial authorities.

If the recommendations were accepted, the file would also have to be returned to the corresponding committee. Otherwise, if the Poder Judicial’s observations were not accepted, the bill would require the votes of two thirds of the total membership of the Asamblea, as established by Article 167 of the Constitución Política.

That procedure was recognized by this Chamber in judgment n.°2018-005758 with respect to the mandatory consultation with the Poder Judicial:

“As the persons submitting the consultation contend, Article 167 of the Constitución Política establishes the obligation of the Asamblea Legislativa to consult the Corte Suprema de Justicia regarding bills that concern the organization and functioning of the Poder Judicial. Likewise, Articles 126 and 157 of the Rules of Procedure of the Asamblea Legislativa set forth that duty and establish the procedure to be followed in such cases. Thus, the cited provisions state as follows: (…)

In view of the foregoing, it is therefore necessary to determine whether the subject matter of the bill under consultation falls within the circumstances established by Article 167 of the Constitution. In this regard, it should be recalled that the Chamber has repeatedly held that the concept of ‘organization and functioning’ referred to in the cited Article concerns matters relating to the judicial function (función jurisdiccional) of the Poder Judicial. Thus, decisions numbers 1998-5958 of 14:54 on 19 de agosto de 1998, 2001-13273 of 11:44 on 21 de diciembre de 2001, and 2008-5179 of 11 hours on 4 de abril de 2008 held that:

IV. The same Fundamental Charter further provides

‘Article 167.—For the discussion and approval of bills concerning the organization or functioning of the Poder Judicial, the Asamblea Legislativa shall consult the Corte Suprema de Justicia; a vote of two thirds of the total membership of the Asamblea shall be required to depart from its opinion.’ (Once again, emphasis added).

From the preceding discussion, as well as from the text of the provision just transcribed, the conditions under which a bill may not be referred to one of the full legislative committees (comisiones legislativas plenas) can be defined even more precisely. Indeed, the matters that mandatorily require consultation with the Corte Suprema de Justicia are those concerning ‘the organization or functioning of the Poder Judicial,’ where the term ‘functioning’ refers not only to matters involving the internal administrative regime of judicial offices, but also to the procedural matters governing the conduct of the various cases brought before those courts.” (…) This Chamber has addressed the scope of this legislative duty, construing such consultation as mandatory when the matter being discussed in the Asamblea is a bill intended to establish rules governing the functioning and organization of the Poder Judicial.

This encompasses not only provisions governing the creation of courts or judicial jurisdiction (competencias jurisdiccionales), but also those governing how such jurisdiction is exercised—that is, the manner in which the Poder Judicial performs its judicial function—including rules of procedure (normas procesales) as such.” “VII.- Sixth matter submitted for consultation. Meaning and scope of the consultation by the Asamblea Legislativa with the Corte Suprema de Justicia concerning the organization and operation of the Poder Judicial. Drafted by Justice Jinesta Lobo. The majority finds that the Tribunal Constitucional, as the highest interpreter of Constitutional Law and guardian of constitutional supremacy (Articles 10 of the Constitución Política and 1° of the Ley de la Jurisdicción Constitucional), must establish the meaning and scope of the concepts employed by the original constituent authority in Article 167 of the Constitution in order to determine, in each specific case, whether the mandatory consultation (consulta preceptiva) by the Asamblea Legislativa with the Corte Suprema de Justicia is required.

The provision under review states: ‘For the debate and approval of bills concerning the organization or operation of the Poder Judicial, the Asamblea Legislativa shall consult the Corte Suprema de Justicia; departure from the latter’s opinion shall require the vote of two-thirds of the entire membership of the Asamblea Legislativa.’ This is an essential or substantive formality of the legislative procedure, compliance with which is mandatory whenever the bill sought to be approved concerns the organization or operation of the Poder Judicial. Under this understanding, it is necessary to determine the content, meaning, and scope of the expression bills ‘(...) concerning the organization and operation of the Poder Judicial (...).’ It should be noted that such an interpretation is required in order to preserve the balance of powers, without favoring one constitutional body over another, so that each may exercise its functions independently and separately, as required by the constitutional text itself (Article 9° of the Constitution).

In other words, precisely defining these concepts prevents any conflict, overreach, or excessive exercise of the respective functions, in order to preserve the balance and restraint of powers, since the purpose of the provision is not only the functional independence and budgetary autonomy of the Poder Judicial, but also the balance between the Poder Legislativo and the Poder Judicial. Indeed, a broad interpretation by the Corte Plena of the terms employed by the original constituent authority could result in certain matters that, strictly speaking, do not concern the organization and operation of the Poder Judicial unjustifiably requiring an enhanced-majority law (ley reforzada), thereby unnecessarily slowing or obstructing the legislative function. Conversely, the failure of the Asamblea Legislativa to apply the constitutional provision, based on the mistaken view that the bill does not concern the organization and operation of the Poder Judicial, could impair the functional independence and budgetary autonomy of the Poder Judicial.

The majority of this Tribunal Constitucional finds that a bill concerns such matters when its provisions contain explicit rules establishing the creation, substantial modification, or abolition of strictly jurisdictional bodies or administrative bodies attached to the Poder Judicial, or when it creates ex novo, substantially modifies, or eliminates substantively jurisdictional or administrative functions. It must be borne in mind that the constitutional provision under discussion harmonizes two fundamental considerations: on the one hand, the independence of the Poder Judicial and, on the other, the legislature’s freedom to shape or configure the law, which is subject to no limitation other than Constitutional Law. Indeed, as a matter of principle, the ordinary legislature enjoys broad freedom to shape social, economic, and political realities through the exercise of legislative authority, which originally resides in the people and is constitutionally delegated to the Asamblea Legislativa because of its status as a representative political body (Articles 105 and 121, subsection 1°, of the Constitución Política).

That legislative authority may be subject only to the limits established by the constituent authority and, in general, by the body of constitutional law (bloque de constitucionalidad). Thus, to avoid improperly restricting the legislature’s freedom to shape the law, any provision establishing a condition or limitation that burdens that freedom must be interpreted according to its proper and reasonable meaning so as to facilitate its exercise. One significant constraint established by the constituent authority on legislative discretion is precisely Article 167 of the Constitution, which, in order to preserve the independence of the Poder Judicial, requires mandatory consultation regarding bills concerning the organization and operation of that branch of the Republic. Nevertheless, that limitation must be interpreted according to its true scope, so that it applies when the bill substantially, objectively, and unequivocally concerns such matters; otherwise, the ordinary legislature’s freedom to shape the law would be unnecessarily and unjustifiably restricted.

Accordingly, when a bill does not concern the matters already specified, the Poder Legislativo may dispense with consultation with the Corte Plena and, consequently, with the approval of a qualified or enhanced-majority law governing the matter.” (Emphasis not in the original).

What must be emphasized from the foregoing decision is precisely that consultation addressed to the Corte Suprema de Justicia must not be conceived as a mere administrative procedure, but rather as an essential or substantive formality of the legislative procedure, compliance with which is mandatory when the bill sought to be approved concerns the organization or operation of the Poder Judicial. This is intended to safeguard the balance of powers and the functional independence and budgetary autonomy of that branch of the Republic. Moreover, the consultation must be obtained at an appropriate procedural stage so that it can genuinely be taken into consideration; otherwise, the meaning and value properly attributable to these institutional consultations mandated by Article 157 of the Reglamento de la Asamblea Legislativa would be undermined.

In the case at bar (sub lite), in accordance with the procedural history (iter) described in the preceding Considerando, an attempt is being made to obtain this mandatory opinion without having remanded the legislative procedure to an earlier stage; that is, without the respective committee or the Plenary itself having taken note of the statements and requests submitted by the Corte Suprema de Justicia, and without completing the first-debate voting procedure, which, as noted above, was tainted by the unconstitutionality expressly declared by this Chamber in decision n.°2020-006134.

Consequently, because the record establishes that an essential element required for a decision on the merits is lacking, this legislative consultation is inadmissible. This is because the aforementioned procedure has not been redone and this expediente has not been submitted to a new vote in the first debate after compliance with the stated requirements (Articles 96, subsection a), and 98 LJC).

Nothing stated in this decision precludes the Directorio de la Asamblea Legislativa, once the parliamentary procedure has been corrected, from resubmitting the legislative consultation on constitutionality concerning the bill entitled “Approval of the Regional Agreement on Access to Information, Public Participation and Access to Justice in Environmental Matters in Latin America and the Caribbean (Escazú Agreement).”

V. CONCLUSION

Because a requirement for admissibility needed for a ruling on the merits is absent from this legislative consultation, it must be declared incapable of being answered (inevacuable).

VI. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are advised that if they submitted any paper document, as well as any objects or evidence contained on any additional electronic, computing, magnetic, optical, or telematic device or produced by new technologies, they must retrieve them from the clerk’s office within a maximum period of 30 business days from notification of this judgment. Otherwise, any material not retrieved within that period shall be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session N° 27-11 of 22 de agosto del 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 de enero del 2012, as well as pursuant to the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 de mayo del 2012, Article LXXXI.

THEREFORE:

By majority vote, the mandatory legislative consultation concerning the bill entitled “Approval of the Regional Agreement on Access to Information, Public Participation and Access to Justice in Environmental Matters in Latin America and the Caribbean (Escazú Agreement),” under consideration in legislative expediente number 21.245, is declared incapable of being answered. The Directorio de la Asamblea Legislativa shall take note of Considerando IV. Justice Rueda Leal dissents, admits the consultation, and finds no procedural or substantive defects in the bill under consultation. Notice shall be given.

Dissenting opinion of Justice Rueda Leal. With customary respect, I dissent for the following reasons.

In the judgment, the majority maintains that decision n.° 2020-006134 of 12:20 hours on 24 de marzo de 2020 “implicitly” invalidated the vote taken during the first debate at Ordinary Plenary Session n.° 135 of 13 de febrero de 2020. It also states that the Asamblea “...seeks to obtain this mandatory opinion without having remanded the legislative procedure to an earlier stage; that is, without the respective committee or the Plenary itself having taken note of the statements and requests submitted by the Corte Suprema de Justicia, and without completing the first-debate voting procedure, which, as noted above, was tainted by the unconstitutionality expressly declared by this Chamber in decision n.°2020-006134.” According to the majority’s opinion, the following should have occurred: “Following the declaration that the legislative procedure was invalid, the proper course was to remand the parliamentary proceedings to the stage at which the constitutional defect occurred and to comply with the procedure governed by Article 157 of the Reglamento de la Asamblea Legislativa; that is, the proceedings should have been returned to the Plenary so that the institutional consultation could be formally conducted and, if comments on the bill were submitted (as indeed occurred in this specific case), the necessary assessments could be made to determine whether the legislative expediente should be returned to committee to incorporate the suggestions made or, alternatively, whether the bill required an enhanced-majority vote.” In other words, the legislative proceedings should have been remanded to the first-debate stage, which did not occur. Based on these premises, the majority concludes that the consultation cannot be answered.

I disagree with that argument because it construes the legislative procedure (procedimiento legislativo) in a manner contrary to the principle of prompt and expeditious parliamentary action (principio de celeridad y agilidad parlamentaria). Under that principle, the rules governing legislative procedure must, insofar as possible, be interpreted in a manner that facilitates legislative consideration, rather than as an obstacle that must invariably be overcome. Legislative formalities, although relevant, are not an end in themselves. Thus, for example, between two possible interpretations of Article 157 of the Reglamento de la Asamblea Legislativa, the interpretation that most effectively advances the legislative process must be chosen, provided that it does not undermine free deliberation, the democratic principle (principio democrático), or the right of amendment (derecho de enmienda), among others.

In the case at bar (sub iudice), the majority insists on invalidating the procedure and returning it to an earlier stage. This disregards other options available to the Asamblea Legislativa, whether to correct the legislative procedure through other means—for example, by curing the defect (subsanación del vicio)—or to discontinue it by shelving the case file (archivo del expediente), pursuant to Article 146, subsection 6), of the Reglamento de la Asamblea Legislativa. Naturally, returning the legislative procedure to the first debate is not required in order to shelve the case file.

I further note that the bill was referred to the Comisión Permanente Especial de Consultas de Constitucionalidad. Relying on the opinion of the Departamento de Estudios, Referencias y Servicios Técnicos de la Asamblea Legislativa, that Commission found that the defect identified by the majority of the Sala in decision No. 2020-006134 had been cured through the consultation conducted with the Corte Suprema de Justicia.

At this point, the Asamblea Legislativa would face the choice of whether to accept those observations and whether to return the procedure to an earlier stage. If it chose not to accept them, the qualified majority (mayoría calificada) established in constitutional Article 167 would be required. In other words, once the opinion of the Poder Judicial had been received, the Asamblea Legislativa would have the option of accepting its warnings—in which case the procedure might be returned to an earlier stage, without necessarily requiring a qualified vote—or departing from them through a vote of two-thirds of its entire membership, contrary to the theory that the first debate was “implicitly” invalid.

The incompatibility of the majority decision with the aforementioned principle is apparent from a hypothetical analysis of Article 157 of the Reglamento de la Asamblea Legislativa:

“ARTICLE 157.- Institutional consultations When, during the consideration of a bill, the Asamblea determines that the Tribunal Supremo de Elecciones, the Universidad de Costa Rica, the Poder Judicial, or an autonomous institution must be consulted, and the Commission has not done so, consideration of the bill shall be suspended and the corresponding consultation shall be conducted. If no response to the consultation referred to in this article is received within eight working days, the consulted body shall be deemed to have no objection to the bill. If the consulted body submits observations on the bill within that period, the bill shall automatically be referred to the respective commission if the Asamblea accepts those observations. If the Asamblea rejects them, in compliance with the Constitución Política, the matter shall continue through the ordinary legislative process.” (Emphasis added).

What would happen if the Corte Suprema de Justicia had rejected the assertion that the bill affected it in any way, or had failed to respond to the consultation? In that event, invalidating the first debate and returning the procedure to an earlier stage would make no sense, because the Asamblea Legislativa could continue processing the bill.

Similarly, in the matter at hand (sub lite), an option remains that makes it unnecessary to invalidate the first debate: approval of the bill by a two-thirds majority of the members of the Asamblea Legislativa, pursuant to Article 167 of the Constitución Política.

In either scenario, the decision would rest with the Asamblea Legislativa, not the Sala Constitucional. For these purposes, subsections 3 and 4 of Article 146 of the Reglamento de la Asamblea Legislativa, concerning the procedure for the Sala’s advisory opinions (opiniones consultivas), may also be invoked:

“(…) 3.- The Plenary shall consider the Commission’s report on the Sala’s advisory opinion as the first item in the Internal Rules chapter. (…)

4- Depending on the decision adopted by the Asamblea, the bill shall be placed on the agenda of the commission or the Plenary at the session immediately following the vote on the report. (…)” To reiterate, in its report, the Comisión Permanente Especial de Consultas de Constitucionalidad informed the Plenary that the defect had been cured (subsection 3). Thereafter—ordinarily, because in this instance the Sala was consulted—the Asamblea would have the authority to analyze that report together with the observations of the Corte and decide whether the bill should be referred to the commission or remain before the Plenary (subsection 4). This demonstrates that the majority’s position disregards these powers of the Asamblea and the procedure established by its internal rules (interna corporis). Based on the foregoing arguments, I consider it permissible for the Plenary to consult the Poder Judicial, cure the omission, and continue with the proper legislative procedure, as occurred in the case under review (sub examine). The contrary position chosen by the majority of the Sala results in an evident delay in the parliamentary consideration of the bill entitled “Approval of the Regional Agreement on Access to Information, Public Participation and Access to Justice in Environmental Matters in Latin America and the Caribbean (Escazú Agreement).” Paul Rueda L.

SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las once y cincuenta minutos del dieciocho de agosto de dos mil veinte.

Consulta legislativa preceptiva de constitucionalidad formulada por el Directorio de la Asamblea Legislativa, sobre el proyecto de “Aprobación del Acuerdo Regional sobre el acceso a la información, la participación pública y el acceso a la justicia en asuntos ambientales en América Latina y el Caribe (Acuerdo de Escazú)” que se tramita en el expediente legislativo número 21.245.

RESULTANDO:

  1. 1La consulta, que se formula en cumplimiento de lo que establece el inciso a), del artículo 96, de la Ley de la Jurisdicción Constitucional, fue recibida en la Secretaría de la Sala a las 11:09 hrs. del 23 de julio de 2020, con una copia certificada del expediente legislativo. La Presidencia de la Sala tuvo por presentada la consulta mediante resolución de las 13:57 hrs. del 23 de jul0io de 2020.
  2. 2En la substanciación del proceso se han observado las prescripciones de ley.

Redacta la Magistrada Garro Vargas; y,

CONSIDERANDO:

I. OBJETO DE LA CONSULTA

Esta consulta preceptiva de constitucionalidad se formula por el Directorio de la Asamblea Legislativa en cumplimiento de lo dispuesto en el artículo 10, inciso b), de la Constitución Política, y 96, inciso a), de la Ley de la Jurisdicción Constitucional (LJC), en relación con el proyecto de “Aprobación del Acuerdo Regional sobre el acceso a la información, la participación pública y el acceso a la justicia en asuntos ambientales en América Latina y el Caribe (Acuerdo de Escazú)”, que se tramita en el expediente legislativo número 21.245, por tratarse de la aprobación legislativa de un instrumento o acuerdo internacional.

II.TRAMITACIóN DEL EXPEDIENTE LEGISLATIVO NúMERO 21.245 EN LA ASAMBLEA LEGISLATIVA. Para los efectos de examinar la admisibilidad de esta consulta legislativa, procede, en primer lugar, realizar una síntesis cronológica del trámite parlamentario:

  • 1)El 04 de marzo de 2018 se firmó en el Cantón de Escazú, el acuerdo regional sobre el acceso a la información, la participación pública y el acceso a la justicia en asuntos ambientales en América Latina y el Caribe (ver certificación de la Ministra de Relaciones Exteriores y Culto, visible a folio 41 de la copia del expediente legislativo, tomo I).
  • 2)El proyecto, que es de iniciativa del Poder Ejecutivo, fue presentado a la Secretaría del Directorio de la Asamblea Legislativa, a las 11:40 horas del 01 de febrero de 2019 (folios 1-42 de la copia del expediente legislativo, tomo I).
  • 3)Mediante auto del 01 de febrero de 2019, el Director a.i. de la Secretaría del Directorio de la Asamblea Legislativa envió el proyecto, por disposición de la Presidenta de la Asamblea Legislativa, a la Comisión Permanente Especial de Relaciones Internacionales y de Comercio Exterior para su dictamen, y además, al Departamento de Archivo para su publicación, así como al Departamento de Servicios Parlamentarios para incluir el texto en el sistema integrado legislativo (folio 46 de la copia del expediente legislativo, tomo I).
  • 4)El 18 de febrero de 2019 , el Departamento de Archivo, Investigación y Trámite procedió a remitir el proyecto a la Imprenta Nacional, para su respectiva publicación, de conformidad con lo dispuesto en el artículo 117 del Reglamento de la Asamblea Legislativa (folio 85 de la copia del 5)El proyecto fue publicado en el Alcance n.°48, Gaceta n.°44 del 04 de marzo de 2019 (carátula del expediente legislativo y https://www.imprentanacional.go.cr/pub/2019/03/04/ALCA48_04_03_2019.pdf ).

6)En la Comisión de Relaciones Internacionales y Comercio Exterior fue aprobada una moción planteada el 14 de marzo de 2019 para que el texto del acuerdo fuera consultado al Ministerio de Ambiente y Energía, al Ministerio de Planificación y al Ministerio de Educación Pública (ver folios 87-92 de la copia del expediente legislativo, tomo I).

7)El 1° de mayo de 2019 se puso a Despacho para continuar con el trámite del proyecto de aprobación tramitado en expediente legislativo n.°21.245 (ver folio 130 de la copia del expediente legislativo, tomo I).

8)El 18 de julio de 2019, el Departamento de Estudios, Referencias y Servicios Técnicos de la Asamblea Legislativa, elaboró el Informe Jurídico AL-DEST-IJU-143-2019, relativo al proyecto de ley (folios 156-169 de la copia del expediente legislativo, tomo I).

9)En la sesión del 12 de agosto de 2019 la Comisión Permanente Especial de Relaciones Internacionales y Comercio Exterior dictaminó afirmativamente el proyecto consultado (folios 201-249 de la copia del expediente legislativo, tomo I).

10)El dictamen unánime afirmativo sobre el proyecto fue entregado a la Secretaría del Directorio Legislativo el 19 de agosto de 2019 (folio 253 de la copia del expediente legislativo, tomo I).

11)En la sesión Plenaria Ordinaria n.°135 del 13 de febrero de 2020, se aprobó en PRIMER DEBATE el proyecto de ley que se tramita en el 12)Mediante oficio de 19 de febrero de 2020 el Departamento de Secretaría del Directorio dispuso pasar el expediente a consulta preceptiva de constitucionalidad ante esta Sala.

  • 13)Por opinión consultiva n.°2020-006134 de las 12:20 hrs. de 24 de marzo de 2020 , esta Sala, por mayoría, evacuo la consulta legislativa preceptiva de constitucionalidad en el siguiente sentido: “Por mayoría se declara que existe un vicio de procedimiento por falta de consulta del proyecto de Ley denominado Acuerdo Regional sobre el Acceso a la Información, la participación pública y el acceso a la justicia en asuntos ambientales en América Latina y el Caribe, a la Corte Suprema de Justicia de conformidad con el artículo 167 de la Constitución Política, vicio que resulta vinculante para la Asamblea Legislativa. El Magistrado Castillo Víquez y la Magistrada Hernández López ponen notas. El Magistrado Rueda Leal salva el voto y no encuentra vicios ni de forma ni de fondo en el proyecto consultado. Comuníquese” (resolución visible a folios 563-602 de la copia del expediente legislativo, tomo III) 14) Por correo electrónico de 11 de mayo de 2020 la Secretaría de la Asamblea Legislativa realizó la consulta constitucional a la Corte Suprema de Justicia (ver folio 537 de la copia del expediente legislativo, tomo III).
  • 15)En la sesión n.°27-2020 de 18 de mayo de 2020 la Corte Plena se pronunció sobre la consulta institucional planteada por una mayoría de 15 votos en el sentido que: “1) Tener por rendido y acoger el informe de la magistrada Vargas, y hacerlo de conocimiento del Departamento de Secretaría del Directorio de la Asamblea Legislativa, en respuesta a la consulta formulada, con la indicación expresa de que el proyecto de ley consultado sí afecta la organización y funcionamiento del Poder Judicial . 2) Hacer especial indicación de que dicho proyecto incide de modo directo en el presupuesto del Poder Judicial, por lo que sería necesario incluir las partidas presupuestarias requeridas para cubrir lo exigido por ley. Así votaron los magistrados y magistradas Rivas, Solís, Rojas, Molinari, Vargas, Aguirre, Varela, Sánchez, Chacón, Ramírez, Solano, Burgos, Alfaro, Zúñiga, y el suplente Campos Esquivel. El magistrado Cruz, votó, por las razones expresadas, por no acoger el informe de la magistrada Vargas. Los magistrados y magistrada Castillo, Salazar Alvarado, Araya y Garro se abstienen de votar. Indica el Presidente, magistrado Cruz: "Debo decir, el acuerdo anterior y este se declaran firmes.” (ver folios 544-560 de la copia del expediente legislativo, tomo III).
  • 16)En la sesión extraordinaria del Plenario Legislativo n.°14 de fecha 9 de junio de 2020 , se dio lectura al por tanto de la resolución n.°2020-6134 de esta Sala Constitucional y la Presidencia ordenó que el expediente legislativo se trasladara a la Comisión Permanente Especial de Consultas de Constitucionalidad por un plazo de ocho días hábiles (ver folios 562 y siguientes de la copia del expediente legislativo, tomo III).
  • 17)El 11 de junio de 2020 la Secretaría del Directorio entregó a la Comisión Permanente Especial de Consultas de Constitucionalidad, el legislativo, tomo III).
  • 18)La Comisión Permanente Especial de Consultas de Constitucionalidad, en fecha 24 de junio de 2020, recomendó al Plenario Legislativo remitir el respuesta brindada por la Corte Suprema de Justicia, con el fin que se continúe con el análisis preceptivo del acuerdo regional para que, posteriormente, esa Asamblea continúe con el trámite legislativo correspondiente (folios 643-644 de la copia del expediente legislativo, tomo III).
  • 19)El propio 24 de junio de 2020 la Comisión remitió al Departamento de la Secretaría del Directorio el informe adoptado (ver folio 645 de la copia del expediente legislativo, tomo III).
  • 20)En sesión extraordinaria n.°27 de 16 de julio de 2020 (en el acta se consigna 2019), el Plenario Legislativo inició la discusión del informe unánime de la Comisión Permanente Especial de Consultas de Constitucionalidad, el cual se sometió a votación y se aprobó. Posteriormente se presentó una moción de revisión y se desechó. Con base en lo anterior, se dispuso trasladar el expediente legislativo a esta Sala Constitucional (folios 649-666 de la copia del expediente legislativo, tomo III).
  • 21)En el expediente consta la instrucción a la Secretaría del Directorio de proceder conforme a la recomendación del informe, y que ubique dicho proyecto de ley en el capítulo de segundos debates de la próxima sesión y remitir nuevamente el expediente en consulta preceptiva a la Sala Constitucional para que continúe su análisis respecto al fondo, para que posteriormente esta Asamblea continúe con el trámite legislativo correspondiente (folio 650 de la copia del expediente legislativo, tomo III).

III. SOBRE EL VICIO DE INCONSTITUCIONALIDAD DETECTADO POR LA SALA EN EL ANTECEDENTE

Como se desprende del iter reseñado, la Asamblea Legislativa ya planteó una primera consulta legislativa en relación con este acuerdo internacional. En la anterior opinión consultiva, tramitada en el expediente n.° 20-003368-0007-CO, esta Sala detectó un vicio esencial que invalidó el procedimiento parlamentario que se había cumplido hasta ese momento. Dicha decisión fue suscrita por la mayoría de este Tribunal, ya que se constató que no se cumplió con un requisito esencial establecido en la propia Constitución Política, a saber, la consulta de carácter obligatorio a la Corte Suprema de Justicia, prevista en el artículo 167.

En la resolución n.°2020-006134 se realizaron las siguientes consideraciones:

“De conformidad con lo establecido en el artículo 98, de la ley que rige esta Jurisdicción, este Tribunal revisó el procedimiento legislativo para la tramitación del proyecto de «APROBACIÓN DEL ACUERDO REGIONAL SOBRE EL ACCESO A LA INFORMACIÓN, LA PARTICIPACIÓN PÚBLICA Y EL ACCESO A LA JUSTICIA EN ASUNTOS AMBIENTALES EN AMÉRICA LATINA Y EL CARIBE (ACUERDO DE ESCAZÚ)», que se tramita en el expediente legislativo número 21.245. Se observa que el proyecto de ley fue presentado ante la corriente legislativa por parte del Poder Ejecutivo en ejercicio de su poder de iniciativa, previsto en el artículo 140, inciso 5), de la Constitución Política. También se acreditó que el proyecto en consulta fue publicado, dictaminado y aprobado en primer debate. Ahora bien, observa esta Sala un trámite sustancial que debió haberse seguido, y que no se hizo. El artículo 8 del "Acuerdo de Escazú" se refiere al "Acceso a la justicia en asuntos ambientales", donde nuestro país adquiere varios compromisos en cuanto a los procesos judiciales. Literalmente dicho artículo establece lo siguiente:

''Artículo 8 Acceso a la justicia en asuntos ambientales Cada Parte garantizará el derecho a acceder a la justicia en asuntos ambientales de acuerdo con las garantías del debido proceso.

Cada Parte asegurará, en el marco de su legislación nacional, el acceso a instancias judiciales y administrativas para impugnar y recurrir, en cuanto al fondo y el procedimiento:

  • a)cualquier decisión, acción u omisión relacionada con el acceso a la información ambiental; b)cualquier decisión, acción u omisión relacionada con la participación pública en procesos de toma de decisiones ambientales; y c) cualquier otra decisión, acción u omisión que afecte o pueda afectar de manera adversa al medio ambiente o contravenir normas jurídicas relacionadas con el medio ambiente.

Para garantizar el derecho de acceso a la justicia en asuntos ambientales, cada Parte, considerando sus circunstancias, contará con:

  • a)órganos estatales competentes con acceso a conocimientos especializados en materia ambiental; b) procedimientos efectivos, oportunos, públicos, transparentes, imparciales y sin costos prohibitivos; c)legitimación activa amplia en defensa del medio ambiente, de conformidad con la legislación nacional; d) la posibilidad de disponer medidas cautelares y provisionales para, entre otros fines, prevenir, hacer cesar, mitigar o recomponer daños al medio ambiente; e) medidas para facilitar la producción de la prueba del daño ambiental, cuando corresponda y sea aplicable, como la inversión de la carga de la prueba y la carga dinámica de la prueba; f) mecanismos de ejecución y de cumplimiento oportunos de las decisiones judiciales y administrativas que correspondan; y g) mecanismos de reparación, según corresponda, tales como la restitución al estado previo al daño, la restauración, la compensación o el pago de una sanción económica, la satisfacción, las garantías de no repetición, la atención a las personas afectadas y los instrumentos financieros para apoyar la reparación.

Para facilitar el acceso a la justicia del público en asuntos ambientales, cada Parte establecerá:

  • a)medidas para reducir o eliminar barreras al ejercicio del derecho de acceso a la justicia; b) medios de divulgación del derecho de acceso a la justicia y los procedimientos para hacerlo efectivo; c)mecanismos de sistematización y difusión de las decisiones judiciales y administrativas que correspondan; y d) el uso de la interpretación o la traducción de idiomas distintos a los oficiales cuando sea necesario para el ejercicio de ese derecho.

Para hacer efectivo el derecho de acceso a la justicia, cada Parte atenderá las necesidades de las personas o grupos en situación de vulnerabilidad mediante el establecimiento de mecanismos de apoyo, incluida la asistencia técnica y jurídica gratuita, según corresponda.

Cada Parte asegurará que las decisiones judiciales y administrativas adoptadas en asuntos ambientales, así como su fundamentación, estén consignadas por escrito.

Cada Parte promoverá mecanismos alternativos de solución de controversias en asuntos ambientales, en los casos en que proceda, tales como la mediación, la conciliación y otros que permitan prevenir o solucionar dichas controversias." Se observa que se establecen obligaciones para el Poder Judicial, relacionadas, por ejemplo, con la asistencia técnica y jurídica gratuita (inciso 5), procedimientos públicos (inciso 3.b), entre otros. Todo lo cual está relacionado con la organización y funcionamiento del Poder Judicial. Sin embargo, la Comisión Legislativa correspondiente, no procedió a realizar la consulta obligatoria al Poder Judicial, conforme lo establece el artículo 167 de la Constitución Política ("Artículo 167.- Para la discusión y aprobación de proyectos de ley que se refieran a la organización o funcionamiento del Poder Judicial, deberá la Asamblea Legislativa consultar a la Corte Suprema de Justicia; para apartarse del criterio de ésta, se requerirá el voto de las dos terceras partes del total de los miembros de la Asamblea.").

En los votos de esta Sala, números 1998-005958, 2001-013273 y 2008-005179, se estableció que, cuando un proyecto de ley contiene en su articulado normas explícitas que disponen la creación, la variación sustancial o la supresión de órganos estrictamente jurisdiccionales o de naturaleza administrativa adscritos al Poder Judicial, o bien crea, ex novo, modifica sustancialmente o elimina funciones materialmente jurisdiccionales o administrativas, debe realizarse la consulta al Poder Judicial. En el mismo sentido, como antecedente se puede citar lo resuelto mediante el voto número 2017-004221 de las 09:15 horas del 21 de marzo del 2017, donde también se incurrió en el vicio de procedimiento de no consultar al Poder Judicial un convenio internacional, donde se dijo lo siguiente:

"Con el numeral 2 del proyecto de Ley, se le impone al Poder Judicial las obligaciones o las que se refiere la sentencia trascrita; crea nuevas funciones dentro de su organización y estructura administrativa.

(...) Lo anterior, conforme se explica en el precedente arriba citado, implica la necesaria consulta constitucional del Poder Judicial, evidentemente, por los implicaciones jurídicas y recursos que le demanda, así como por la necesidad de crear órganos especializados de naturaleza administrativa adscritos al Poder Judicial. En tal sentido, el artículo 167 de la Constitución Política establece la obligación de la Asamblea Legislativa de consultar a la Corte Suprema de Justicia cuando se discuta y se aprueben proyectos de ley que se refieran a la organización y funcionamiento del Poder Judicial. En tal sentido, el vicio que se puntualiza es uno de procedimiento, vinculante a la luz del artículo 101 de la Ley de la Jurisdicción Constitucional, dada la falta de cumplimiento de lo dispuesto en dicho numeral de la Constitución Política." Así entonces, se observa que en la tramitación del proyecto de ley se omitió la consulta obligatoria al Poder Judicial, lo cual implica un vicio sustancial del procedimiento, violatorio del Derecho de la Constitución (artículo 167 Constitucional mencionado).

En consecuencia, el proyecto de «APROBACIÓN DEL ACUERDO REGIONAL SOBRE EL ACCESO A LA INFORMACIÓN, LA PARTICIPACIÓN PÚBLICA Y EL ACCESO A LA JUSTICIA EN ASUNTOS AMBIENTALES EN AMÉRICA LATINA Y EL CARIBE (ACUERDO DE ESCAZÚ)», que se tramita en el expediente legislativo número 21.245, contiene un vicio de procedimiento por falta de consulta a la Corte Suprema de Justicia, de conformidad con el artículo 167 de la Constitución Política. Vicio que resulta vinculante para la Asamblea Legislativa, a la luz del artículo 101 de la Ley de la Jurisdicción Constitucional, según el cual: "El dictamen de la Sala sólo será vinculante en cuanto establezca la existencia de trámites inconstitucionales del proyecto consultado”.

Asimismo, el Magistrado Castillo Víquez y la Magistrada Hernández López dejaron constancia de notas adicionales. Esta última, con el expreso propósito de “ que sean tomadas en cuenta en la corrección de este importante acuerdo previo a su adopción”. En la parte dispositiva se señaló lo siguiente:

“Por mayoría se declara que existe un vicio de procedimiento por falta de consulta del proyecto de Ley denominado Acuerdo Regional sobre el Acceso a la Información, la participación pública y el acceso a la justicia en asuntos ambientales en América Latina y el Caribe, a la Corte Suprema de Justicia de conformidad con el artículo 167 de la Constitución Política, vicio que resulta vinculante para la Asamblea Legislativa. El Magistrado Castillo Víquez y la Magistrada Hernández López ponen notas. El Magistrado Rueda Leal salva el voto y no encuentra vicios ni de forma ni de fondo en el proyecto consultado. Comuníquese”. (Lo destacado no corresponde a la resolución original).

IV. SOBRE LA ADMISIBILIDAD DE LA PRESENTE CONSULTA

A efectos de examinar la admisibilidad de esta nueva consulta legislativa preceptiva, se debe indicar, en primer término, que los artículos 96, inciso a) y 98, párrafo primero, de la LJC disponen, expresamente, lo siguiente:

“Artículo 96 . Por la vía de la consulta de constitucionalidad, la jurisdicción constitucional ejercerá la opinión consultiva previa sobre los proyectos legislativos, en los siguientes supuestos:

  • a)Preceptivamente, cuando se trate de proyectos de reformas constitucionales, o de reformas a la presente ley, así como de los tendientes a la aprobación de convenios o tratados internacionales, inclusive las reservas hechas o propuestas a unos u otros. (…)” Artículo 98. Cuando se trate de reformas constitucionales, la consulta deberá hacerse después de su aprobación en primer debate, en primera legislatura, y antes de la definitiva. Cuando se trate de otros proyectos o actos legislativos sujetos al trámite de emisión de las leyes, deberá interponerse después de aprobados en primer debate y antes de serlo en tercero. (…)” De lo anterior se desprende que la consulta preceptiva de constitucionalidad para la aprobación de convenios o tratados internacionales “deberá interponerse después de aprobados en primer debate”.

Dicho requisito esencial de admisibilidad no se cumple en el caso concreto. Nótese que, al declararse un vicio esencial en el procedimiento legislativo, implícitamente -pero inobjetablemente- se invalidó la votación recaída en el primer debate ocurrida en la sesión Plenaria Ordinaria n.°135 del 13 de febrero de 2020. Tal votación se realizó, como ya lo indicó esta Sala, al margen de los requisitos establecidos expresamente en la Constitución Política, sea que, de previo a la aprobación, se recabara el correspondiente criterio de la Corte Suprema de Justicia. Lo anterior, por cuanto, el proyecto de ley de aprobación del convenio regional contiene expresas disposiciones que inciden en la organización y funcionamiento del Poder Judicial.

Dicha resolución es vinculante para la Asamblea Legislativa, por detectarse trámites inconstitucionales en el proyecto consultado, tal como se indica en el párrafo segundo del artículo 101 de la LJC, que dice:

“Artículo 101 . (…) La Sala evacuará la consulta dentro del mes siguiente a su recibo, y, al hacerlo, dictaminará sobre los aspectos y motivos consultados o sobre cualesquiera otros que considere relevantes desde el punto de vista constitucional.

El dictamen de la Sala sólo será vinculante en cuanto establezca la existencia de trámites inconstitucionales del proyecto consultado” .

Pese a ello, en este caso concreto, se pretende obtener una nueva opinión consultiva sin cumplirse el requisito indispensable de admisibilidad, sea, que el proyecto haya sido sometido a votación en primer debate luego de haber recabado y valorado la opinión institucional de la Corte Suprema de Justicia.

En este punto parece esencial manifestar que esta Sala ha señalado, de forma reiterada, que las consultas institucionales deben realizarse en un momento procesal capaz de provocar que la Asamblea tenga una oportunidad real de escuchar el criterio vertido por la institución involucrada, de forma tal que pueda atenderlo y tomarlo en cuenta en el procedimiento legislativo. De lo contrario, se desnaturaliza el propósito de las consultas institucionales obligatorias.

Así, por ejemplo, desde la sentencia n.°1633-93, se enfatizó que este tipo de consultas no se erigen como meras formalidades procesales carentes de una finalidad sustantiva, sino que, muy por el contrario, procuran justamente que el criterio sea allegado oportunamente y tomado en cuenta por los legisladores. En la resolución indicada, se consideró lo siguiente:

“No es la consulta, sin embargo, una mera formalidad procesal, carente de sentido o finalidad sustantiva, puesto que con ella se persigue una finalidad tocante a la idoneidad o calidad de la ley para obtener los resultados concretos que se quiere lograr con ella. De tal manera que la consulta debe hacerse en oportunidad procesal tal que la Asamblea tenga oportunidad real de escuchar la opinión consultiva, es decir, de atenderla y considerarla; dicho de otro modo, lo que explica y justifica el artículo 190 es que la Asamblea cuente realmente con una oportunidad suficiente, durante el proceso, para conocer y apreciar la opinión consultiva antes de tomar una decisión. Se trata, por otra parte, de una opinión que se pide sobre un proyecto determinado, que no es otro que el que ha sido sometido al conocimiento legislativo mediante el ejercicio de la iniciativa. La consecuencia de la opinión puede ser la enmienda del proyecto, caso en el cual (sobre todo si esto ocurre en el llamado usualmente "trámite de Comisión") implica que la consulta no versa necesariamente sobre el "proyecto definitivo": por el contrario, la consulta en tal supuesto, habría conducido la voluntad legislativa a configurar un texto diverso del originalmente presentado”. (Criterio reiterado en las opiniones consultivas n.° 2001-02642 y n.° 2003-05404).

Lo anterior es congruente con lo dispuesto a tales efectos en los artículos 126 y 157 del propio Reglamento de la Asamblea Legislativa, que regulan los momentos procesales en los que se deben realizar las consultas institucionales. Dichos numerales disponen lo siguiente:

“Artículo 126.-Consultas obligatorias y facultativas . La Presidencia de la Comisión dictaminadora deberá realizar las consultas obligatorias, a más tardar en la tercera sesión después de haber ingresado el asunto al orden del día.

Las consultas de las comisiones se considerarán como hechas por la propia Asamblea y, en lo pertinente, se aplicará lo dispuesto en el artículo 157 de este Reglamento.

En el caso de las comisiones legislativas, la realización de las consultas obligatorias o facultativas no impedirá la continuidad de los trámites u otros actos preparatorios no definitivos”. (Así reformado en sesión N° 45 del 24 de julio de 2019).

“Artículo 157.- Consultas institucionales Cuando en la discusión de un proyecto la Asamblea determine que debe ser consultado el Tribunal Supremo de Elecciones, la Universidad de Costa Rica, el Poder Judicial o una institución autónoma, y no lo hubiera hecho la Comisión, se suspenderá el conocimiento del proyecto, procediéndose a hacer la consulta correspondiente. Si transcurridos ocho días hábiles no se recibiere respuesta a la consulta a que se refiere este artículo, se tendrá por entendido que el organismo consultado no tiene objeción que hacer al proyecto. En caso de que el organismo consultado, dentro del término dicho, hiciera observaciones al proyecto, éste pasará automáticamente a la comisión respectiva, si la Asamblea aceptara dichas observaciones. Si ésta las desechare, respetando lo que determina la Constitución Política, el asunto continuará su trámite ordinario”. (Lo destacado no corresponde al original).

A partir de la declaratoria de la invalidez del procedimiento legislativo, lo procedente era retrotraer el trámite parlamentario al momento en que se produjo el vicio de inconstitucionalidad y cumplir con el procedimiento regulado en el artículo 157 del Reglamento de la Asamblea Legislativa, es decir, que se devolviera el trámite al Plenario para realizar formalmente la consulta institucional y, de existir observaciones al proyecto (como así sucedió en el caso concreto), hacer las valoraciones necesarias a efecto de determinar si el expediente legislativo debía regresar a la comisión para incorporar las sugerencias realizadas, o bien, definir si el proyecto requiere de una votación reforzada, conforme con lo que establece el artículo 167 de la Constitución Política, cuyo texto abajo se citará.

Es preciso insistir que, al consultarse este acuerdo regional a las autoridades de la Corte Suprema de Justicia, hubo un voto mayoritario en el siguiente sentido:

“1) Tener por rendido y acoger el informe de la magistrada Vargas, y hacerlo de conocimiento del Departamento de Secretaría del Directorio de la Asamblea Legislativa, en respuesta a la consulta formulada, con la indicación expresa de que el proyecto de ley consultado sí afecta la organización y funcionamiento del Poder Judicial. 2) Hacer especial indicación de que dicho proyecto incide de modo directo en el presupuesto del Poder Judicial, por lo que sería necesario incluir las partidas presupuestarias requeridas para cubrir lo exigido por ley. Así votaron los magistrados y magistradas Rivas, Solís, Rojas, Molinari, Vargas, Aguirre, Varela, Sánchez, Chacón, Ramírez, Solano, Burgos, Alfaro, Zúñiga, y el suplente Campos Esquivel. El magistrado Cruz, votó, por las razones magistrados y magistrada Castillo, Salazar Alvarado, Araya y Garro se abstienen de votar. Indica el Presidente, magistrado Cruz: "Debo decir, el acuerdo anterior y este se declaran firmes.” Por ese motivo, al existir un criterio de la Corte Suprema de Justicia en el sentido de que la aprobación de este acuerdo sí afecta la organización y funcionamiento del Poder Judicial y, además, al haberse hecho una expresa solicitud de que se requiere la inclusión de las partidas presupuestarias correlativas para su adecuada implementación, lo procedente en el caso concreto era retrotraer el expediente al momento procesal en el que se configuró el vicio, con el fin de examinar y valorar las manifestaciones de las autoridades del Poder Judicial.

De aceptarse las recomendaciones, incluso, el aceptarse las observaciones del Poder Judicial, el proyecto requerirá una votación de las dos terceras partes del total de los miembros de la Asamblea, según lo establece el artículo 167 de la Constitución Política.

Dicho trámite fue el reconocido por esta Sala en la sentencia n.°2018-005758, respecto a la consulta obligatoria al Poder Judicial:

“Tal como lo invocan los(as) consultantes, el numeral 167 de la Constitución Política establece la obligación de la Asamblea Legislativa de consultar a la Corte Suprema de Justicia aquellos proyectos que versen sobre la organización y funcionamiento del Poder Judicial. Asimismo, los numerales 126 y 157 del Reglamento de la Asamblea Legislativa recogen dicho deber, estableciendo el procedimiento a seguir en esos supuestos. Así, las normas de cita disponen lo siguiente: (…)

Ahora bien, con vista en lo anterior resulta, entonces, necesario determinar si la materia sobre la que versa el proyecto de ley consultado, se encuentra o no dentro de los supuestos fijados por el numeral 167 constitucional. Sobre el particular, conviene recordar que ya, en reiteradas ocasiones, la Sala ha establecido que el concepto de “organización y funcionamiento” al que hace referencia el artículo de cita versa sobre aspectos relativos a la función jurisdiccional del Poder Judicial. Así, en los votos números 1998-5958 de las 14:54 del 19 de agosto de 1998, 2001-13273 de las 11:44 del 21 de diciembre de 2001 y 2008-5179 de las 11 horas del 4 de abril de 2008, se dispuso que:

IV. Ahora bien, dispone la misma Carta Fundamental

"Artículo 167.- Para la discusión y aprobación de proyectos de ley que se refieran a la organización o funcionamiento del Poder Judicial, deberá la Asamblea Legislativa consultar a la Corte Suprema de Justicia; para apartarse del criterio de ésta, se requerirá el voto de las dos tercera partes del total de los miembros de la Asamblea." (nuevamente, el énfasis es agregado).

De la discusión precedente, así como del texto de la norma recién transcrita, es dable precisar aún más las condiciones dentro de las cuales no se puede trasladar un proyecto de ley a una de las comisiones legislativas plenas. En efecto, los asuntos que preceptivamente requieren de una consulta a la Corte Suprema de Justicia son aquellos que se refieran "a la organización o funcionamiento del Poder Judicial", donde el término "funcionamiento" alude no sólo a los aspectos de régimen interno administrativo de los despachos judiciales, sino también a las cuestiones procesales que rigen la sustanciación de los diversos asuntos sometidos a esos estrados”.

(…) Esta Sala se ha referido a los alcances de este deber del legislador, entendiendo que dicha consulta resulta obligatoria cuando lo discutido en la Asamblea es un proyecto de ley que pretenda establecer reglas de funcionamiento y organización del Poder Judicial, entendido esto no apenas como las disposiciones que regulen la creación de tribunales de justicia o competencias jurisdiccionales, sino incluso aquellas que dispongan sobre modo de ejercicio de dichas competencias, es decir, sobre la forma en que el Poder Judicial lleva a cabo su función jurisdiccional, incluidas normas propiamente procesales”.

“VII.- Sexto aspecto consultado. Sentido y alcance de la consulta de la Asamblea Legislativa a la Corte Suprema de Justicia en materia de organización y funcionamiento del Poder Judicial. Redacta el Magistrado Jinesta Lobo. La mayoría estima que el Tribunal Constitucional como sumo interprete del Derecho de la Constitución y custodio de la supremacía constitucional (artículos 10 de la Constitución Política y 1° de la Ley de la Jurisdicción Constitucional), debe fijar el sentido y alcance de los conceptos empleados por el constituyente originario en el artículo 167 constitucional, para determinar, en cada caso concreto, si procede o no la consulta preceptiva de la Asamblea Legislativa a la Corte Suprema de Justicia. El numeral de análisis dispone que “Para la discusión y aprobación de proyectos de ley que se refieran a la organización o funcionamiento del Poder Judicial, deberá la Asamblea Legislativa consultar a la Corte Suprema de Justicia; para apartarse del criterio de ésta, se requerirá el voto de las dos terceras partes del total de los miembros de la Asamblea Legislativa”.

Se trata de una formalidad esencial o sustancial del procedimiento legislativo de observancia obligatoria cuando el proyecto de ley que se pretenda aprobar verse sobre la organización o funcionamiento del Poder Judicial. Bajo esta inteligencia, se impone determinar el contenido, sentido y alcance de la expresión proyectos de ley “(…) que se refieran a la organización y funcionamiento del Poder Judicial (…)”. Cabe apuntar que tal exégesis se impone en aras de mantener el equilibrio de poderes, sin privilegiar a uno u otro órgano constitucional, de manera que cada uno pueda ejercer sus funciones de manera independiente y separada como lo impone el propio texto constitucional (artículo 9° de la Constitución). En otros términos, la precisión de tales conceptos evita cualquier colisión, extralimitación o exacerbación de las respectivas funciones, en aras de mantener el equilibrio y la contención de los poderes, por cuanto, el fin de la norma lo constituye no sólo la independencia funcional y la autonomía presupuestaria del Poder Judicial, sino, también, el equilibrio entre el Poder Legislativo y Judicial.

En efecto, una interpretación amplia de los términos empleados por el constituyente originario, por parte de la Corte Plena, podría conducir a que determinadas materias que, en sentido estricto no están referidas a la organización y funcionamiento del Poder Judicial, ameriten, injustificadamente, de una ley reforzada, con lo cual se ralentiza o entorpece, innecesariamente, la función legislativa. De otra parte, la desaplicación por la Asamblea Legislativa de la norma constitucional, al considerar, equívocamente, que el proyecto no versa sobre organización y funcionamiento del Poder Judicial, podría provocar una lesión a la independencia funcional y autonomía presupuestaria del Poder Judicial. La mayoría de este Tribunal Constitucional estima que un proyecto de ley versa sobre tales extremos cuando contiene en su articulado normas explícitas que disponen la creación, la variación sustancial o la supresión de órganos estrictamente jurisdiccionales o de naturaleza administrativa adscritos al Poder Judicial o bien crea, ex novo, modifica sustancialmente o elimina funciones materialmente jurisdiccionales o administrativas.

Debe tomarse en consideración que la norma constitucional de comentario armoniza dos aspectos de carácter fundamental, por una parte la independencia del Poder Judicial y por otra el ejercicio de la libertad de configuración o conformación del legislador, la cual no tiene otro límite que el Derecho de la Constitución. En efecto, por principio, el legislador ordinario goza de una amplia libertad de conformación de la realidad social, económica y política, a través del ejercicio de la potestad legislativa, la cual reside originariamente en el pueblo y es constitucionalmente delegada en la Asamblea Legislativa por su carácter de órgano político representativo (artículos 105 y 121, inciso 1°, de la Constitución Política). Esa potestad legislativa, únicamente, puede tener los límites que establece el constituyente y, en general, el bloque de constitucionalidad, de modo que para evitar una limitación indebida de la libertad de configuración legislativa, cualquier disposición que establezca una condición o límite que la agrave debe ser interpretado en sus justos y razonables términos, para facilitar su ejercicio.

Un valladar importante, establecido por el constituyente, a la discrecionalidad legislativa, lo constituye, precisamente, el ordinal 167 de la Constitución, en aras de mantener la independencia del Poder Judicial al disponer una consulta preceptiva de los proyectos de ley referidos a la organización y funcionamiento que le atañen a ese Poder de la República. No obstante, ese límite debe ser interpretado en su verdadera dimensión, de modo que opere cuando de manera sustancial, objetiva y cierta el proyecto de ley se refiere a tales materias, de lo contrario se limita, innecesaria e injustificadamente, la libertad de configuración del legislador ordinario. Es así que cuando el proyecto de ley no versa sobre las materias ya precisadas, el Poder Legislativo puede prescindir de la consulta a la Corte Plena y, por consiguiente, de la aprobación de una ley calificada o reforzada para regular la materia.” (Lo destacado no corresponde al original).

De la anterior resolución es preciso destacar, justamente, que la consulta dirigida a la Corte Suprema de Justicia no debe ser concebida como un mero trámite administrativo, sino que, por el contrario, es una formalidad esencial o sustancial del procedimiento legislativo, que es de observancia obligatoria cuando el proyecto de ley que se pretenda aprobar verse sobre la organización o funcionamiento del Poder Judicial. Esto, en aras de resguardar el equilibrio de los poderes, la independencia funcional y la autonomía presupuestaria de dicho poder de la República. Además, debe ser recabada en un momento procesal oportuno a fin de ser realmente tomada en consideración, pues, de lo contrario, se desnaturaliza el sentido y el valor que corresponde reconocer a estas consultas institucionales preceptuadas en el artículo 157 del Reglamento de la Asamblea Legislativa.

En el sub lite, conforme al iter desarrollado en el considerando anterior, se pretende recabar esta opinión preceptiva sin haber retrotraído el procedimiento legislativo; sea, sin que comisión respectiva o el propio Plenario hayan tomado nota de las manifestaciones y pretensiones expuestas por la Corte Suprema de Justicia y sin cumplir el trámite de la votación en el primer debate que, como se ha venido apuntando, estuvo viciada por la inconstitucionalidad expresamente declarada por esta Sala en la resolución n.°2020-006134.

En consecuencia, al acreditarse en autos que se carece de un elemento esencial para pronunciarse por el fondo, esta consulta legislativa resulta inadmisible. Esto, por cuanto no se ha repuesto el trámite mencionado y no se ha sometido este expediente a una nueva votación en primer debate, luego de haber cumplido los recaudos señalados (artículos 96, inciso a) y 98 LJC).

Lo dicho en esta resolución no obsta para que, una vez subsanado el trámite parlamentario, el Directorio de la Asamblea Legislativa presente nuevamente la consulta legislativa de constitucionalidad sobre el proyecto de “Aprobación del Acuerdo Regional sobre el acceso a la información, la participación pública y el acceso a la justicia en asuntos ambientales en América Latina y el Caribe (Acuerdo de Escazú)”.

V. CONCLUSIóN

Al no existir un requisito de admisibilidad para el pronunciamiento de fondo en esta consulta legislativa, se impone declararla inevacuable.

VI. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

POR TANTO:

Por mayoría se declara inevacuable la consulta legislativa preceptiva sobre el proyecto de “Aprobación del Acuerdo Regional sobre el acceso a la información, la participación pública y el acceso a la justicia en asuntos ambientales en América Latina y el Caribe (Acuerdo de Escazú)” que se tramita en el expediente legislativo número 21.245. Tome nota el Directorio de la Asamblea Legislativa respecto del considerando IV. El Magistrado Rueda Leal salva el voto, admite la consulta y no encuentra vicios ni de forma ni de fondo en el proyecto consultado. Notifíquese.

Voto salvado del Magistrado Rueda Leal. Con el respeto acostumbrado, salvo el voto por estos motivos.

En la sentencia, la mayoría sostiene que la resolución n.° 2020-006134 de las 12:20 horas del 24 de marzo de 2020 “implícitamente” invalidó la votación recaída en el primer debate, ocurrida en la sesión Plenaria Ordinaria n.° 135 del 13 de febrero de 2020. También afirma que la Asamblea “…pretende recabar esta opinión preceptiva sin haber retrotraído el procedimiento legislativo; sea, sin que comisión respectiva o el propio Plenario hayan tomado nota de las manifestaciones y pretensiones votación en el primer debate que, como se ha venido apuntando, estuvo viciada por la inconstitucionalidad expresamente declarada por esta Sala en la resolución n.°2020-006134.” Según criterio de la mayoría, lo que debió suceder es lo siguiente: “ A partir de la declaratoria de la invalidez del procedimiento legislativo, lo procedente era retrotraer el trámite parlamentario al momento en que se produjo el vicio de inconstitucionalidad y cumplir con el procedimiento regulado en el artículo 157 del Reglamento de la Asamblea Legislativa, es decir, que se devolviera el trámite al Plenario para realizar formalmente la consulta institucional y, de existir observaciones al proyecto (como así sucedió en el caso concreto), hacer las valoraciones necesarias a efecto de determinar si el expediente legislativo debía regresar a la comisión para incorporar las sugerencias realizadas, o bien, definir si el proyecto requiere de una votación reforzada” Es decir, se debía retrotraer el trámite legislativo al primer debate, lo que no acaeció. A partir de estas premisas, la mayoría concluye que la consulta deviene inevacuable.

Discrepo de tal argumento, por cuanto efectúa una lectura del procedimiento legislativo contraria al principio de celeridad y agilidad parlamentaria. Con base en él, la normativa relacionada con el procedimiento legislativo debe ser interpretada, en lo posible, de manera que favorezca el trámite legislativo, no como un obstáculo que deba vencerse sin reserva. Las formalidades legislativas, si bien relevantes, no significan un fin en sí mismo. Así, por ejemplo, entre dos posibles lecturas del artículo 157 del Reglamento de la Asamblea Legislativa, deberá escogerse aquella que -sin ir en detrimento de la libre deliberación, el principio democrático o el derecho de enmienda, entre otros- de manera más efectiva impulse la prosecución del trámite legislativo.

En el sub iudice, la mayoría insiste en invalidar el procedimiento y retrotraerlo. Con esto se ignoran otras posibilidades abiertas a la Asamblea legislativa, sea en el sentido de enderezar el procedimiento legislativo por otras vías, (verbigracia, mediante la subsanación del vicio), sea inclinándose por no continuarlo (archivo del expediente, artículo 146 inciso 6) del Reglamento a la Asamblea Legislativa). Naturalmente, no se requiere retrotraer el procedimiento legislativo a primer debate para archivar el Además, observo que el proyecto legislativo fue enviado a la Comisión Permanente Especial de Consultas de Constitucionalidad. Esta última, apoyada en el criterio del Departamento de Estudios, Referencias y Servicios Técnicos de la Asamblea Legislativa, consideró que el vicio señalado por la mayoría de la Sala en el voto n.° 2020-006134 había sido subsanado a través de la consulta efectuada a la Corte Suprema de Justicia.

En este punto, la Asamblea Legislativa estaría frente a la disyuntiva de acoger esas observaciones o no, de retrotraer el procedimiento o no. En caso de no acogerlas se requeriría la mayoría calificada estatuida en el numeral 167 constitucional. Es decir, una vez recibido el criterio del Poder Judicial, la Asamblea Legislativa tendría la posibilidad de acoger sus advertencias (situación en la que eventualmente se retrotraería el procedimiento y que no requeriría de manera necesaria una votación calificada) o apartarse de ellas mediante una votación de dos terceras partes del total de sus miembros (en contra de la tesis de la supuesta invalidez “implícita” del primer debate).

La incompatibilidad del voto de mayoría con el mencionado principio se evidencia en un análisis hipotético del ordinal 157 del Reglamento de la Asamblea Legislativa:

“ARTICULO 157.- Consultas institucionales Cuando en la discusión de un proyecto la Asamblea determine que debe ser consultado el Tribunal Supremo de Elecciones, la Universidad de Costa Rica, el Poder Judicial o una institución autónoma, y no lo hubiera hecho la Comisión, se suspenderá el conocimiento del proyecto, procediéndose a hacer la consulta correspondiente. Si transcurridos ocho días hábiles no se recibiere respuesta a la consulta a que se refiere este artículo, se tendrá por entendido que el organismo consultado no tiene objeción que hacer al proyecto. En caso de que el organismo consultado, dentro del término dicho, hiciera observaciones al proyecto, éste pasará automáticamente a la comisión respectiva, si la Asamblea aceptara dichas observaciones. Si ésta las desechare, respetando lo que determina la Constitución Política, el asunto continuará su trámite ordinario.” (El subrayado es agregado).

¿Qué sucedería si la Corte Suprema de Justicia hubiese rechazado alguna afectación por parte del proyecto de ley o no hubiese respondido la consulta? En tal supuesto, carecería de sentido invalidar el primer debate y retrotraer el procedimiento, pues la Asamblea Legislativa podría continuar el trámite.

De manera análoga, en el sub lite persiste una posibilidad que vuelve innecesario invalidar el primer debate: la aprobación del proyecto con mayoría de dos terceras partes de los miembros de la Asamblea Legislativa, con base en el numeral 167 de la Constitución Política.

En cualquiera de tales escenarios, la decisión correspondería a la Asamblea Legislativa, no a la Sala Constitucional. A estos efectos, se puede acudir también a los incisos 3 y 4 del ordinal 146 del Reglamento de la Asamblea Legislativa, referido al trámite de las opiniones consultivas de la Sala:

“(…) 3.- El Plenario conocerá el dictamen de la Comisión sobre la opinión consultiva de la Sala, como primer punto en el capítulo de Régimen Interno. (…)

4- Según el acuerdo que tome la Asamblea, el proyecto de ley entrará en el orden del día de la comisión o el Plenario en la sesión inmediata siguiente a la votación del informe. (…)” Se explica de nuevo, que, en su dictamen, la Comisión Permanente Especial de Consultas de Constitucionalidad indicó al Plenario que el vicio había sido subsanado (inciso 3). Luego ‑ordinariamente, pues en este caso se optó por consultar a la Sala‑, la Asamblea tendría la potestad de analizar ese dictamen junto con las observaciones de la Corte, y acordar si el proyecto de ley va a la comisión o se mantiene en el Plenario (inciso 4). Con lo anterior se evidencia, que la postura de la mayoría viene a desconocer estas potestades de la Asamblea y el trámite establecido por interna corporis. A partir de los argumentos expuestos, considero viable que el Plenario consulte al Poder Judicial, subsane la omisión y continúe con el debido procedimiento legislativo, como ocurrió en el sub examine. La tesitura contraria, escogida por la mayoría de la Sala, redunda en un evidente atraso en el trámite parlamentario del proyecto “Aprobación del Acuerdo Regional sobre el acceso a la información, la participación pública y el acceso a la justicia en asuntos ambientales en América Latina y el Caribe (Acuerdo de Escazú)”.
