Document Review *200024020007CO* Decision No. 2020018217 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine fifteen a.m. on the twenty-fifth of September, two thousand twenty.
Amparo proceeding (recurso de amparo) filed by JORGE DIEGO UMAÑA LEAL, identity card 0601330969, against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS, EL CONCEJO MUNICIPAL DE DISTRITO DE LEPANTO, and LA MUNICIPALIDAD DE PUNTARENAS.
FINDINGS OF FACT:
The foregoing, given that the respondent municipality was restricting the distribution of drinking water on the island by showing no interest in constructing the public roads established in the Plan Regulador de Isla Caballo, which it had itself prepared, and given that, under the regulations, AyA could provide drinking-water service only to properties fronting a public road. In this regard, the Executive Presidency asked whether Municipalidad de Puntarenas was willing to pay for the drinking-water consumption of all residents, since, if the situation remained such that only one path was designated as a public road, only one public water source could be installed on the island to supply the inhabitants. However, as of the date of the response to this amparo proceeding (recurso de amparo), the respondent has provided no reply whatsoever. The appropriate steps have been taken to provide a prompt solution to the needs of the island’s inhabitants; nevertheless, completion of the works requires the cooperation and willingness of the municipalities involved, since no portion of the aqueduct (acueducto) for Isla Caballo can be designed or constructed unless each municipal entity undertakes the actions within its jurisdiction.
The Institute will continue with the pre-feasibility assessment (pre-factibilidad), studies, and evaluations for construction of the well, pumping main (línea de impulsión), storage tank, and transmission main (línea de conducción) from the peninsula to the island. Nevertheless, they clarify that the failure of Municipalidad de Puntarenas to take the corresponding actions prevents them from making satisfactory progress on the project, because precise data and decisions are required regarding how the local government will act to implement the regulatory plan (plan regulador). They state that the Institute’s delay in completing the aqueduct cannot be considered arbitrary, capricious, or unjustified, because they believe it is attributable to the negligence and lack of interest of Municipalidad de Puntarenas, insofar as AyA, through its General Management and Executive Presidency, has sent various official communications requesting both information and cooperation. They request that the petition filed be dismissed.
Justice Garro Vargas authored the opinion; and,
WHEREAS:
The petitioner complains that, several months after the respondent institute undertook to place into operation the water-supply system (acueducto) that would provide drinking water to the residents of Isla Caballo, it still does not exist, which he believes violates his fundamental rights.
II- PRELIMINARY MATTER. By an order issued at 11:33 hours on 26 de febrero de 2020, the mayor of Puntarenas was granted a hearing to submit his report. However, he did not submit it. Article 45 of the Ley de la Jurisdicción Constitucional provides that if the report is not submitted within the applicable period, the facts shall be deemed true and the amparo petition (recurso de amparo) shall be decided without further proceedings, unless the court considers a preliminary inquiry necessary, all without prejudice to the liabilities—understood to be disciplinary liabilities—incurred by the public servant who failed to submit the report. In matters such as this, the Chamber has held that deeming the facts true does not mean automatically granting the petition, because the proper course is for the Chamber to examine whether the amparo is warranted based on the factual account presented by the petitioner.
The following facts relevant to the resolution of this matter are deemed duly established:
The following relevant facts are deemed unproven: 1) That there is certainty as to the State’s natural heritage (patrimonio natural del Estado) and the boundaries of the public zone (zona pública) and restricted zone (zona restringida) on Isla Caballo (the case record). 2) That the Municipalidad de Puntarenas complies with the Regulatory Plan on Isla Caballo (the case record).
Our Political Constitution implicitly recognizes the fundamental right of persons subject to government administration (administrados) to the proper and efficient operation of public services, that is, for such services to be provided to high standards of quality. The necessary correlative of that right is the obligation of public administrations to provide them continuously, regularly, promptly, effectively, and efficiently. This latter obligation arises from the systematic relationship among several constitutional provisions, such as Article 140, subsection 8, which imposes on the Executive Branch the duty to “Oversee the proper operation of administrative services and offices”; Article 139, subsection 4, insofar as it incorporates the concept of the “proper conduct of Government”; and Article 191, insofar as it incorporates the principle of “administrative efficiency.” This atypical or unenumerated individual guarantee is heightened where essential public services, such as the supply of drinking water, are concerned.
It was established that, nearly 5 years after this Constitutional Court, in judgment No 2015014553 of 14:30 on 22 de septiembre de 2015, ordered the Instituto Costarricense de Acueductos y Alcantarillados and the Municipalidad de Puntarenas to immediately adopt the corresponding measures to include the community of Isla Caballo, within one year, in a drinking-water supply project, the inhabitants of that Island still lack the infrastructure needed to obtain drinking water because, as demonstrated, they depend for their needs on deliveries made by the company awarded the direct procurement contract (contratación directa) for the distribution of drinking water to Isla Caballo (report and case record). The record shows that, when this constitutional rights action (recurso de amparo) was filed, the respondent entity was working on the pre-feasibility assessment (pre-factibilidad), studies, and evaluations for the Isla Caballo Aqueduct project, and the works to be carried out had been defined—the drilling of a well, improvements to the existing pipeline networks of the system into which it would be integrated, the construction of a pumping main (línea de impulsión) running from the well to a storage tank to be built on the Nicoya Peninsula, and the construction of a transmission main (línea de conducción) running from the storage tank on the Peninsula to another storage tank on the Island.
However, as explained by the General Deputy Manager and the head of the Puntarenas Cantonal Office of the Central Pacific Region of the Deputy Management for Peripheral Systems, both of the Instituto Costarricense de Acueductos y Alcantarillados, the involvement of the respondent body and local entity is necessary to construct those works or assume costs, and it is necessary to ascertain who holds the concession or owns the property through which the pipeline is proposed to pass, in order to comply with legal requirements, formalize the permits, and define the actions to be taken by the institution they represent (reports). In this context, although it is not for this Court to identify those directly responsible for that omission, as this falls outside its jurisdiction, the fact remains that the respondent body’s cooperation has been limited and that of the local entity has been nonexistent, even though precise information and decisions are required from them.
As reported by the Acueductos y Alcantarillados authorities, despite an order from the Concejo Municipal de Distrito, the municipal intendant of Lepanto continues to withhold the information requested concerning boundary demarcation (amojonamiento) and the concession holder for the property identified as the optimal point through which to route the pipeline. Moreover, when consulted about the circumstances of the residents of Isla Caballo and the creation of a road network on that island, the mayor of Puntarenas informed the respondent Instituto that the local government “will not construct roads, undertaking only the commitment to create the path needed to lay the pipeline up to the storage tank (…) the Municipalidad de Puntarenas is responsible for relocating the families to the location indicated by the Plan Regulador.” In light of the principle of interinstitutional coordination (principio de coordinación interinstitucional), this situation is unacceptable, because the respondent municipal authorities cannot in this manner disregard their obligation to safeguard local interests and services within their jurisdiction, since by law they are responsible for all matters relating to works carried out within their jurisdiction, whether by executing them, supervising them, or taking whatever other action may be appropriate.
Furthermore, the respondent entity’s attempt to place full responsibility for the delay on the co-respondents cannot be accepted, because it neither followed up insistently nor took other measures in response to the lack of a reply of which it complains. In short, it is clear that intervention is required from the entities and body involved, and even the participation of other public agencies, since there is no certainty regarding boundary demarcation on the island, the occupation of and concession over the public zone (zona pública), or, still less, the State Forest Estate (patrimonio forestal del Estado), each acting within the scope of its authority but in a coordinated manner to determine the technical and legal viability of the project in question and allow the project to move forward, if appropriate. In this particular matter, it must be reiterated that without the respondents’ cooperation, Acueductos y Alcantarillados cannot advance in implementing the project intended to supply drinking water to the inhabitants of Isla Caballo. Accordingly, the Chamber finds that the alleged violation occurred. On this understanding, the action must be granted, as set forth below.
I have dissented in cases seeking to remedy, through a constitutional rights action, mere administrative inaction involving infrastructure works such as sidewalks, bridges, graveling and paving of streets, culverts, among others, on the ground that such matters may be litigated through ordinary legality proceedings (vía de legalidad ordinaria), because the Chamber is not, and should not become, a sole or omnipresent forum that diminishes the other avenues of judicial protection established for that purpose by the constitutional framers and the legislature. I have clarified, however, that I do consider cases involving administrative inaction on the foregoing matters to be eligible for protection through these proceedings when that inaction directly impairs the exercise of fundamental rights governed by the Political Constitution or international human rights treaties, provided that they are capable of being heard through proceedings as highly expedited and as exceptional and urgent in nature as the constitutional rights action, viewed as a procedural remedy.
Such is the case of the appellant, who comes before this Court because there is an imminent risk to the health of the people—including older adults and minors—who live on Isla Caballo de Puntarenas, due to the lack of infrastructure that would allow drinking water to be supplied to that locality. For this reason, in this specific case I have deemed it necessary for the Chamber to exercise its jurisdiction to determine whether the alleged omissions violate the fundamental rights of the protected persons residing on Isla Caballo de Puntarenas, who require drinking-water service in order to live.
As a matter of principle, I consider that cases concerning the Administration’s inaction in repairing, constructing, modifying, or demolishing any infrastructure work should be dismissed because such an omission is a question of legality whose adjudication falls within the ordinary courts, before which the interested party may litigate their objections more fully. However, when such administrative inaction results in a violation of other fundamental rights protected by this jurisdiction, or affects groups considered vulnerable, I do address the merits of the matter, as occurs in this constitutional rights action, in which it is alleged that the Instituto Costarricense de Acueductos y Alcantarillados and the Municipalidad de Puntarenas have not placed into operation the aqueduct that would provide drinking water to the inhabitants of Isla Caballo. The situation described constitutes an exception to my general position on this matter, and I therefore deem it necessary for this Constitutional Court to examine the merits of the case in order to verify or reject the appellant’s allegations.
The parties are hereby advised that, if they submitted any paper document, as well as any objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced through new technologies, these must be collected from the Court’s offices within a maximum period of 30 business days from notification of this judgment. Otherwise, any material not collected within that period will be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session N° 27-11 of 22 de agosto del 2011, article XXVI, and published in Boletín Judicial number 19 of 26 de enero del 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 de mayo del 2012, article LXXXI.
POR TANTO:
The action is granted. Annette Henchoz Castro, José Francisco Rodríguez Johnson, and Wilbert Madriz Arguedas, in their respective capacities as General Deputy Manager of the Instituto Costarricense de Acueductos y Alcantarillados, municipal intendant of Lepanto, and mayor of Puntarenas, or whoever holds those offices, are jointly and in coordination ordered to: a) determine, within the SIX MONTHS following notification of this judgment, the legal and technical viability of the project to provide Isla Caballo with a system such as the one requested; b) adopt the measures necessary to ensure that, within a maximum period of TWENTY-FOUR MONTHS from notification of this same decision, a definitive solution is provided to the problem that gave rise to these proceedings, if appropriate. In the meantime, the Instituto Costarricense de Acueductos y Alcantarillados shall continue supplying drinking water to the residents of Isla Caballo at the frequency and in the quantity necessary for the locality’s current population.
They are advised that failure to comply with this order will constitute the offense of disobedience and that, pursuant to article 71 of the Law governing this jurisdiction, any person who receives an order issued in a constitutional rights action that they are required to comply with or enforce, and who fails to comply with or enforce it, shall be sentenced to imprisonment for three months to two years, or a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The Instituto Costarricense de Acueductos y Alcantarillados, the Municipalidad de Puntarenas, and the Concejo Municipal de Distrito de Lepanto are ordered to pay the costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed during enforcement of the judgment before the administrative-law courts. Justice Hernández López issues a separate opinion. Justice Salazar Alvarado issues an opinion. Let notice be served.

Revisión del Documento *200024020007CO* SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas quince minutos del veinticinco de setiembre de dos mil veinte .
Recurso de amparo promovido por JORGE DIEGO UMAÑA LEAL, cédula de identidad 0601330969, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS, EL CONCEJO MUNICIPAL DE DISTRITO DE LEPANTO Y LA MUNICIPALIDAD DE PUNTARENAS.
RESULTANDO:
Redacta la Magistrada Garro Vargas; y,
CONSIDERANDO:
El recurrente reprocha que varios meses después de que el instituto recurrido se comprometió a poner en funcionamiento el acueducto con el que se proveería de agua potable a los habitantes de Isla Caballo, a la fecha, este no existe, lo que estima vulnera sus derechos fundamentales.
II- CUESTIÓN PRELIMINAR. Por auto de las 11:33 horas del 26 de febrero de 2020, se otorgó audiencia al alcalde de Puntarenas, para rendir el informe. Sin embargo, no lo rindió. El artículo 45 de la Ley de la Jurisdicción Constitucional estipula que si el informe no es rendido dentro del plazo correspondiente, se tendrán por ciertos los hechos y se entrará a resolver el amparo sin más trámite, salvo que el tribunal estime necesaria alguna averiguación previa, todo sin perjuicio de las responsabilidades –se entiende que disciplinarias- en que incurra el servidor omiso en el informe. En asuntos así, la Sala ha dicho que tener por ciertos los hechos no implica acoger automáticamente el recurso, pues lo procedente es que la Sala entre a estudiar la procedencia del amparo con la base fáctica expuesta por la recurrente.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
Se estiman no demostrados, los siguientes de relevancia: 1) Que exista certeza del patrimonio natural del Estado y de los límites de la zona pública y la zona restringida en Isla Caballo (los autos). 2) Que la Municipalidad de Puntarenas cumpla el Plan Regulador en Isla Caballo (los autos).
Nuestra Constitución Política recoge, implícitamente, el derecho fundamental de los administrados al buen y eficiente funcionamiento de los servicios públicos, esto es, que sean dados con elevados estándares de calidad, el cual tiene como correlato necesario la obligación de las administraciones públicas de prestarlos de forma continua, regular, célere, eficaz y eficiente. Esta última obligación se desprende de la relación sistemática de varios preceptos constitucionales, tales como el 140, inciso 8, el cual le impone al Poder Ejecutivo el deber de “Vigilar el buen funcionamiento de los servicios y dependencia administrativas”, el 139, inciso 4, en cuanto incorpora el concepto de “buena marcha del Gobierno” y el 191 en la medida que incorpora el principio de “eficiencia de la administración”. Esa garantía individual atípica o innominada se acentúa cuando se trata de servicios públicos esenciales como el abastecimiento de agua potable.
Se acreditó que prácticamente 5 años después de que este Tribunal Constitucional en la sentencia No 2015014553 de las 14:30 horas de 22 de septiembre de 2015, ordenó al Instituto Costarricense de Acueductos y Alcantarillados y a la Municipalidad de Puntarenas que adoptaran en forma inmediata las previsiones correspondientes, para incluir, en un plazo de un año, a la comunidad de Isla Caballo, en un proyecto de suministro de agua potable, los habitantes de esa Isla continúan sin contar con la infraestructura que permita abastecerse de agua potable, pues, según se demostró, para satisfacer sus necesidades dependen del reparto que realiza la empresa que resultó adjudicada en la contratación directa para la distribución de agua potable a Isla Caballo (informe y los autos). Consta que al momento en el que se interpuso este recurso, el ente recurrido se encuentra trabajando en la pre- factibilidad, estudios y valoraciones del proyecto del Acueducto de Isla Caballo, y están definidas las obras que se deben realizar -perforación de un pozo, mejoras a las redes de tuberías existentes del sistema al cual se llegue a integrar, la construcción de una línea de impulsión, que iría desde el pozo hasta un tanque de almacenamiento a construir en la península de Nicoya y la construcción de una línea de conducción que iría desde el tanque de almacenamiento en la Península hasta otro tanque de almacenamiento en la Isla.
Sin embargo, según explicaron la subgerente General y el jefe la Oficina Cantonal de Puntarenas de la Región Pacífico Central de la Subgerencia de Gestión de Sistemas Periféricos, ambos del Instituto Costarricense de Acueductos y Alcantarillados, es necesario el concurso del órgano y del ente local recurrido, para construir esas obras o asumir costos y conocer quién es el concesionario o propietario del inmueble, donde se propone pasar la tubería para cumplir con los requisitos legales, para formalizar los permisos y definir las acciones a seguir por parte de su representado (informes). En este contexto, si bien no le corresponde a este Tribunal señalar quiénes son los responsables directos de esa omisión, por ser ajeno al ámbito de su competencia, lo cierto del caso es que la colaboración del órgano recurrido es escasa y la del ente local es nula, pese a que se requieren datos precisos y decisiones de su parte.
Véase que, según informan las autoridades de Acueductos y Alcantarillados, aunque existe una orden del Concejo Municipal de Distrito, el intendente municipal de Lepanto continúa sin brindar la información que se le requirió respecto del amojonamiento y del concesionario del inmueble que se definió como el punto óptimo para pasar la tubería, y que al ser consultado respecto de la condición en la que se encuentran los pobladores de Isla Caballo y de la creación de una red vial en esa isla, el alcalde de Puntarenas le comunicó al Instituto recurrido que el gobierno local que “no realizará la construcción de vías, asumiendo únicamente el compromiso de realizar el sendero para llevar a cabo la tubería hasta el tanque de almacenamiento (…) es la Municipalidad de Puntarenas la llamada a realizar la reubicación de las familias donde indica el Plan Regulador”. A la luz del principio de coordinación interinstitucional, dicha situación resulta inaceptable, pues no pueden las autoridades municipales recurridas desentenderse de esa forma de su obligación de velar por los intereses y servicios locales dentro de la jurisdicción a su cargo, puesto que, por ley, están encargadas de todo lo atinente a las obras que se realicen en su jurisdicción (sea ejecutando, fiscalizando o lo que corresponda).
Por otra parte, tampoco resulta de recibo que el ente recurrido responsabilice completamente a los co- recurridos del retardo que se ha producido, pues no ha insistido ni ha tomado otras medidas ante la falta de respuesta que reprocha. En suma, resulta claro que se requiere la intervención de los entes y del órgano involucrado, e incluso se requiere la participación de otras dependencias públicas, puesto que no existe certeza de amojonamiento en la isla, ni de la ocupación y concesión de la zona pública, menos del patrimonio forestal del Estado, cada uno en el marco de sus competencias, pero de manera coordinada para definir la procedencia técnica y legal del proyecto en cuestión y para permitir el avance del proyecto, si es que procede. En este particular, es menester reiterar que sin la colaboración de los recurridos, Acueductos y Alcantarillados no puede avanzar en la concreción del proyecto que procura suministrar agua potable a los habitantes de Isla Caballo. Así las cosas, estima la Sala que se produjo el agravio reclamado. Bajo esta inteligencia, se impone acoger el recuso, conforme se dirá.
He venido salvado el voto en aquellos casos que se trate de corregir por medio del recurso de amparo la simple inactividad de la administración, en obras de infraestructura tales como aceras, puentes, lastreado y asfaltado de calles, alcantarillas entre otras, con el argumento de que pueden ser discutidos en la vía de legalidad ordinaria, considerando que la Sala no es, ni debe constituirse, en una instancia única u omnipresente que demerite las otras vías de tutela judicial creadas por el constituyente y el legislador al efecto. He aclarado sin embargo que sí estimo como tutelables en esta vía casos de inactividad de la administración en los temas señalados si con ella se produce afectación directa al ejercicio de derechos fundamentales regulados en la Constitución Política o a los tratados internacionales de derechos humanos, siempre que sean susceptibles de ser conocidos en un proceso muy sumario y de especial naturaleza y urgencia como es el amparo como instituto procesal.
Tal es el caso del recurrente quien acude a este Tribunal porque existe un riesgo inminente a la salud de las personas -entre ellas personas adultas mayores y menores de edad- que habitan en Isla Caballo de Puntarenas, ante la falta de infraestructura que permita el suministro de agua potable a esa localidad. Es por esa razón, que en este caso concreto he considerado necesario que la Sala ejerciera su competencia, para comprobar o descartar si las omisiones señaladas, vulneran los derechos fundamentales de las personas amparadas que habitan en Isla Caballo de Puntarenas y que requieren del servicio de agua potable para vivir.
Considero, en tesis de principio, que los casos relacionados con la inactividad de la Administración en la reparación, construcción, modificación o demolición de cualquier obra de infraestructura, deben ser desestimados por constituir esa omisión un tema de legalidad, cuya discusión corresponde a la jurisdicción ordinaria, ante la cual la persona interesada puede debatir, con mayor amplitud, sus disconformidades. Sin embargo, cuando de aquella conducta administrativa omisiva se derive alguna violación a otros derechos fundamentales tutelados en esta jurisdicción, o se afecten grupos considerados vulnerables, sí entro a conocer el fondo del asunto, tal y como sucede en este recurso de amparo, en el que se acusa que el Instituto Costarricense de Acueductos y Alcantarillados y la Municipalidad de Puntarenas no han puesto en funcionamiento el acueducto con el que se proveería de agua potable a los habitantes de Isla Caballo. La situación descrita constituye una excepción a mi posición general en esta materia, por lo que estimo necesario que este Tribunal Constitucional analizara por el fondo el asunto, con el fin de verificar o descartar los alegatos del recurrente.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
POR TANTO:
Se declara con lugar el recurso. Se ordena a Annette Henchoz Castro, José Francisco Rodríguez Johnson y a Wilbert Madriz Arguedas, respectivamente, en condición de subgerente General del Instituto Costarricense de Acueductos y Alcantarillados, deintendente municipal de Lepanto y de alcalde de Puntarenas, o a quienes ocupen esos cargos, de manera conjunta y coordinada: a) definan dentro de los SEIS MESES siguientes a la notificación de esta sentencia, la procedencia legal y técnica del proyecto para dotar a Isla Caballo de un sistema como el que se reclama; b) adopten las medidas necesarias para que en el plazo máximo de VEINTICUATRO MESES contado a partir de la notificación de este mismo fallo, se brinde una solución definitiva al problema que dio origen a la interposición de este proceso, si es que resulta procedente. Mientras tanto, el Instituto Costarricense de Acueductos y Alcantarillados deberá continuar suministrando agua potable a los pobladores de Isla Caballo, en la frecuencia y cantidad necesaria según la población actual del lugar.
Se les advierte que de no acatar la orden dicha, incurrirán en el delito de desobediencia y, que de conformidad con el artículo 71 de la Ley de esta jurisdicción, se les impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena a Instituto Costarricense de Acueductos y Alcantarillados, a la Municipalidad de Puntarenas y al Concejo Municipal de Distrito de Lepanto al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo.
