Recurso filed by Fernando Asdrúbal Sandoval Ulate, identity card 0304200966, on behalf of Luz Marina Rivera Rivera, identity card 0102340656, against the Municipality of Turrialba.
Resultando:
1.- By brief submitted at 14:49 hours on September 17, 2020, the petitioner files a proceeding for non-compliance with what was resolved in Judgment No. 2020-004513 of 9:30 hours on March 6, 2020.- Magistrate Salazar Alvarado drafts the opinion; and,
Considerando:
I.- By Judgment No. 2020-004513 of 9:30 hours on March 6, 2020, the following was ordered:
“(…) The recurso is granted. It is ordered that Luis Fernando León Alvarado and Vilma Mora Jiménez, in that order, Mayor and President of the Municipal Council, both of the canton of Turrialba, as well as María Gabriela Páez Vargas and Luis Fernando Mata Solano, in that order, Director of Water and Head of the Turrialba Subregional Office of the Sistema Nacional de Áreas de Conservación, both of the Ministerio de Ambiente y Energía, within a period NO LONGER THAN SIX MONTHS, counted from the notification of this judgment, adopt the measures that are necessary within the scope of their respective competencies, in order to foresee and provide a definitive solution to the environmental problem denounced by the protected party (…)”.
II.- By brief received at 14:49 hours on September 17, 2020, the petitioner alleges disobedience of what was ordered by this Chamber on that occasion. In this regard, it should be noted that as of the date on which the petitioner comes before this Court alleging disobedience, the period granted by the Chamber to comply with the mentioned judgment had not expired. Therefore, based on the foregoing, the proceeding must be dismissed as premature.

Recurso de interpuesto por Fernando Asdrúbal Sandoval Ulate, cédula de identidad 0304200966, a favor de Luz Marina Rivera Rivera, cédula de identidad 0102340656, contra la Municipalidad de Turrialba.
Resultando:
1.- Por escrito presentado a las 14:49 horas del 17 de setiembre del 2020, el recurrente presenta gestión de incumplimiento de lo resuelto en la Sentencia N° 2020-004513 de las 9:30 horas del 06 de marzo del 2020.- Redacta el Magistrado Salazar Alvarado; y,
Considerando:
I.- Mediante Sentencia N° 2020-004513 de las 9:30 horas del 06 de marzo del 2020, se dispuso lo siguiente:
“(…) Se declara con lugar el recurso. Se ordena a Luis Fernando León Alvarado y a Vilma Mora Jiménez, por su orden, Alcalde y Presidenta del Concejo Municipal, ambos del cantón de Turrialba, así como a María Gabriela Páez Vargas y a Luis Fernando Mata Solano, por su orden, Directora de Aguas y Jefe de la Oficina Subregional de Turrialba del Sistema Nacional de Áreas de Conservación, ambos del Ministerio de Ambiente y Energía que, dentro del plazo no mayor a SEIS MESES, contados a partir de la notificación de esta sentencia, adopten las medidas que sean necesarias dentro del ámbito de sus respectivas competencias, a fin de que prevean y brinden una solución definitiva a la problemática ambiental denunciada por la amparada (…)”.
II.- Por escrito recibido a las 14:49 horas del 17 de setiembre del 2020, la recurrente acusa desobediencia de lo ordenado por esta Sala en esa oportunidad. Al respecto, cabe señalar que a la fecha en que el promovente acude ante este Tribunal en desobediencia, no había vencido el plazo otorgado por la Sala para cumplir la sentencia mencionada. Así, por lo expuesto, la gestión debe desestimarse por prematura.
Por tanto:
No ha lugar a la gestión formulada.
