Amparo proceeding filed by SUZZZETH ESPINIZA CRUZ, identity card 0108960654, and EDWIN H. ESTRADA HERNÁNDEZ, identity card 01041601278; against the MUNICIPALIDAD DE POCOCÍ, the INSTITUTO COSTARRICENSE DE ELECTRICIDAD (ICE), and the SISTEMA NACIONAL DE ÁREAS DE CONSERVCIÓN (SINAC).
Findings:
In this regard, the administrator of the protected zone stated: “No complaint was filed concerning the reported electrical wiring, despite its location in the Zona Protectora de Acuíferos Guácimo y Pococí, because the georeferencing analysis conducted using the institution’s GIS database shows that the electrification project is located among privately owned properties, extending approximately 500 meters along legally registered properties, as well as along the road, which is a public easement (servidumbre pública) extending approximately 800 meters and has existed for many years; no impact on forest, water, or wildlife resources at the site was found as a result of those actions.” The findings of that inspection may be verified in official letter number SINACACTo- DASP-ZPAGP-12 dated May 9, 2020. She states that, regarding the approval allegedly issued by SINAC for the reported works, the same report, under official letter number SINAC-ACTo-DASPZPAGP- 12, clarified that document SINAC-ACTo-ASP-PNE-2013 concerned a certification issued by the official responsible for Patrimonio Natural del Estado regarding the location of real property within the protected wildlife area (Área Silvestre Protegida, ASP) and did not constitute any approval.
She asserts that, as a result of this amparo proceeding (amparo), the Dirección Regional ordered a new inspection of the site; accordingly, a new site visit was conducted on May 12, 2020, which concluded that there were no traces of vegetation affected by works because of the age of the road. In addition, the historical records for the area were reviewed, showing that the current route had already been established and most of it cleared since 2005: “both the electrical wiring and the section of gravel road observed during the inspection fall within the Area shown as cleared in that aerial photograph”; all of the foregoing is documented in report number ACTo-DRFVS-EPMF-116-2020 dated May 12, 2020. Based on the foregoing, she concludes that there are no recent works within the ASP, as the petitioner alleges, nor has SINAC issued any approval for the construction of works in that protected zone. 5.
In a written submission added to the Chamber’s digital case file at 15:20 hours on May 14, 2020, Manuel Hernández Rivera, in his capacity as Mayor of Pococí, reports under oath. He states that the municipality has not performed any work affecting the Guácimo and Pococí aquifers, because the work performed consisted of basic and necessary road maintenance on a public road duly shown as such on cadastral plans and registered as such with MOPT under code N' 7-02-249. He asserts that the entity he represents has not violated any of the petitioner’s constitutional rights, because no work has been performed to divert, transfer, or modify watercourses; rather, the road-maintenance work on this public road has been performed with a view to preserving aquifer recharge areas and water sources. He relates that the Departamento de Unidad Técnica de Gestión Vial Municipal reported, through official letter UTGVM-0305-2020 dated May 13, 2020, that work was performed in 2017 on calle Gavilán, located in the district of Jiménez, a road registered in MOPT’s sectoral-planning database under code C.7-01-249 and named “Calle Navarro (En.C.60) Buenos Aires hasta el fin del camino, con una distancia de 1.2 km.” According to a review conducted, the portion located within the protected zone is 654 meters long.
However, in 2018, work was performed on a 900 In section of the road, of which 454m linear meters are within the protected area and the remainder lies outside it; nevertheless, this road is publicly recorded as such, as shown in plan L-726516-2001, among others. He explains that the work was performed within the right-of-way (derecho de vía), on the roadway (calzada), by adding granular material, without causing a significant impact on the protected zone, since this community has existed for many years. He states that thirteen dwellings and two recreational country homes are recorded in this neighborhood. He notes that the new municipal administration, which had only recently taken office in May 2020, prioritizes the adoption of a new regulatory plan (plan regulador), in which environmental protection will be a central pillar for improving residents’ quality of life and promoting the canton’s development. 6.- In a written submission added to the Chamber’s digital case file at 14:31 hours on May 28, 2020, Justice Rueda Leal requested to be recused from hearing this matter. 7.- Through drawing 8050, the Presidency of the Corte Suprema de Justicia appointed substitute Justice Marta Eugenia Esquivel Rodríguez to replace Justice Rueda Leal for the hearing of this matter. 8.- By decision issued at 9:50 hours on June 8, 2020, the Presidency of the Chamber ordered Justice Rueda to be recused from hearing this matter. 9.
In a written submission added to the Chamber’s digital case file at 13:37 hours on June 4, 2020, the petitioner states: “In the referenced proceeding, I identified Lic. Elibeth Venegas Villalobos in her capacity as the head of the Municipalidad de Pococí; what I actually meant was in her capacity as Mayor, and I now wish to add ‘or whoever currently holds that office of municipal Mayor,’ because this action is not brought personally against Ms. Elibeth, but against the Municipalidad administration, which tolerated and continues to tolerate the reported conduct. I also wish to submit a new photograph of the site on calle Gavilán, obtained from Google and dated February 22, 2020, showing a new dwelling that did not appear in the previous photographs. The encroachment upon the Zona Protectora de los Acuíferos de Guácimo y Pococí continues, and I request that all work of any kind in that protected zone by any public entity be suspended until the filed proceeding is decided.” 10.- By decision issued at 8:55 hours on June 30, 2020, the scope of this amparo proceeding was expanded. 11.-In a written submission added to the Chamber’s digital case file at 14:12 hours on July 6, 2020, Manuel Hernández Rivera, in his capacity as Mayor of Pococí, reports under oath.
He states that the email address [email protected] has been disabled since May 1, 2020; indeed, even during the previous mayor’s administration, it was not enabled to receive public inquiries regarding road projects. He states that the communication channel for such cases is the Unidad Técnica de Gestión Vial website, information for which appears at www.munipococi.go.cr. The contact email addresses are listed there as [email protected] and [email protected], together with telephone number 2710-2143. In any event, on July 6, 2020, the petitioner’s inquiries were forwarded to the Coordinator of the Unidad Técnica de Gestión Vial pursuant to official letter UTGVM-0547-2020, and the following response was provided: “1. The purchase-order number and date correspond to purchase order N"00045l, dated October 22, 2017, for the purchase of granular base material and the regravelling of nearby roads in Buenos Aires. 2.
The work was coordinated with the Asociación de Desarrollo Integral de Buenos Aires, with which we have a very good community relationship, as it is an ADI that works hard on community projects. 3. No more extensive technical studies are performed because this is merely road maintenance on an existing road, and part of the work consists of repairing the road surface. 4. No agreement is entered into with any institution because this is unnecessary, given that we have our own equipment, machinery, and personnel, although on some occasions community residents help monitor or inspect the materials placed.” He reiterates that the entity he represents has not violated any of the petitioner’s constitutional rights, because no work has been performed to divert, transfer, or modify watercourses. This municipality’s investment has been made exclusively within the designated public road, which forms part of the cantonal road network and is publicly recorded on several cadastral plans.
Furthermore, the work was performed within the right-of-way, on the roadway, by adding granular material, without causing a significant impact on the protected zone, since this community has existed for many years. He notes that thirteen dwellings and two recreational country homes are recorded in this neighborhood. Furthermore, no residential construction permits have been issued in the area this year. 12.-In a written submission added to the Chamber’s digital case file at 5:48 hours on July 14, 2020, the petitioner states that his proceeding is not intended to dispute that calle Gavilán is public, but instead concerns the section located beyond the boundary line of the Zona Protectora de los Acuíferos de Guácimo y Pococí, that is, within the protected zone. Outside that zone, the road is public and the houses exist; public lighting also exists; moreover, the ASADA clearly understands that a water-pipeline branch runs along that road but does not extend beyond the boundary line.
He states that calle Gavilán is public up to the boundary marker of the protected zone, immediately after río Santa Clara. In other words, beyond that point, it cannot validly be declared public, because only institutions responsible for distributing water for human consumption may perform works in protected zones. He notes that this assertion is evident in the Mayor’s response, which acknowledges that the road crosses the protected zone declared in 1986; therefore, because calle Gavilán was declared public in 2001, that declaration violates environmental regulations. He adds that “on the other hand, calle Gavilán exists and is public up to río Santa Clara; beyond that point, namely to the west and south, the section of road whose public status I challenge, and where I challenge the installation of public lighting and the improvements made to its gravel surface, lies within the aquifer zone; that is what I seek to correct and preserve for the enjoyment of future generations.” Finally, he requests that the Mayor produce the construction permit for the last house on that road, because it appears to have been built beginning in February 2020. 13.- The legal requirements have been observed in the proceedings conducted. Justice Esquivel Rodríguez drafts the decision; and,
Whereas:
I.Subject matter of the appeal. The appellants state that the Municipalidad de Pococí improved and graveled a road within the protective zone (zona protectora) of the Acuíferos de Guácimo y Pococí, created by decree No. 17390-MAG-S, and that, moreover, ICE installed poles and electrical lines at the site, on calle Gavilán, located in areas within that zone. They believe that those works should not have been carried out at those locations and therefore must be removed. They also mention that they submitted a request to the respondent municipality and have received no response. II.- Proven facts. The following facts are deemed duly established and relevant to the decision in this matter, either because they have been substantiated or because the respondent authority failed to address them, as ordered in the initial ruling: On April 14, 2010, in the Región Huetar Caribe, ICE received the request for electrification of the calle Gavilán sector, in Buenos Aires de Guápiles Pococí, expediente 2010-03-43 (see ICE report).
On May 11, 2010, by means of official letter 1550-0588-2020, ICE stated that, based on the field study, the 1.02 km project was feasible (see ICE report). In 2013, ICE included the case in that year’s peripheral-development budget, prepared the design, and projected a length of 1053 meters to benefit five customers (see ICE report). On April 30, 2013, in response to an inquiry by ICE as to whether the works could be constructed at that site, MINAE issued note SINAC-ACTo-ASP-PNE-214, through which certification SINAC-ACTo-ASP-PNE-213 was received, indicating that the proposed project was located partially within the Zona Protegida de los Acuíferos Guácimo – Pococí. It established that, for the purpose of removing trees, “the corresponding permit must be obtained (Art. 27 Ley 7575 Ley Forestal), and protection areas (áreas de protección) must be respected (Ley 7575”); it also recommended practices aimed at promoting ecosystem balance and the sustainable use of the forest.
In addition, during a joint field visit (ICE-MINAE), ICE was informed that there had been no expropriations in that particular area, nor had the State paid landowners for their properties, and therefore there was no restriction on constructing the electrical grid, which would be located on a public road (see ICE report). On October 1, 2013, ICE began constructing the works with the corresponding environmental viability (viabilidad ambiental), as recorded in resolution No. 2765-2010-SETENA, expediente administrativo No. D1-818-2010-SETENA. No tree cutting (corta de árboles) was required, so the corresponding procedures before the MINAE authorities were unnecessary (see ICE report). On October 29, 2013, ICE sent a note to the Área de Mantenimiento to schedule energization of the works (see ICE report). In 2017, the Municipalidad de Pococí performed work on calle Gavilán, located in the district of Jiménez and registered in the MOPT sector-planning database under code C.7-01-249, named “Calle Navarro (En.C.60) Buenos Aires hasta el fin del camino, con una distancia de 1.2 km.” The portion located within the protective zone is 654 meters long (see municipality report).
In 2018, the respondent municipality performed work on 900 m of the road, of which 45 4m linear meters are within the protected area (área protegida), with the remainder outside it. Furthermore, the work was performed within the right-of-way (derecho de vía) (a coded road shown on several registered cadastral maps), on the roadway, by adding granular material, without affecting the protected area. Thirteen residences and two country properties used for recreation are recorded in this neighborhood, where it was verified that traffic is constant in an area that was affected by the road more than 19 years ago (see report submitted by the municipality and evidence provided). At 11:25 a.m. on October 4, 2019 (reiterated on March 26, 2020), the appellant sent the following inquiry to [email protected]: “Under (sic) what work-order number?, on (sic) what date ¿, (sic) at whose request? , under (sic) what (sic) study ¿ , (sic) who signed the execution order ¿, (sic) who endorsed the study ¿, (sic) or pursuant to an agreement with what (sic) institution in the region?
(sic) Were the works performed to gravel and open a section of calle Gavilán, which is located 1100 meters south of the Catholic church in Buenos Aires de Jiménez de Pococí. The opened section is located beyond the rio Santa Clara, on that road, and beyond the protection-area boundary marker shown in photograph 1. The gravelling and opening of calle Gavilán were works performed within the protective zone of the Guácimo Pococí aquifer, that is, within a zone that was inviolable and has been protected since January 1987, when executive decree 17390-MAGS was promulgated, creating the ‘zona protectora de los acuíferos de Guácimo Pococí,’ which remains in force. I am attaching a screenshot photograph of the indicated site, as well as photographs showing the gravelling presumably carried out by that Municipality, located within the protected zone after crossing the rio Santa Clara on calle Gavilán.
I would appreciate a response with the promptness warranted by the matter, since a protected zone of a clearly delimited aquifer was violated (…)” (see evidence provided). Under both the previous administration and the current one, the email address [email protected] has not been a means authorized by the respondent municipality for receiving inquiries such as the one submitted by the appellant. Furthermore, on May 1, 2020, that address was disabled by the respondent municipality (see report submitted). On October 4, 2019, the appellant sent ICE an email stating the following: “Under what work-order number, on what date, at whose request, under what study, who signed the execution order, who endorsed the study, was an electrical grid, including lamps, installed on calle Gavilán, which is located 1100 meters south of the Catholic church in Buenos Aires de Jiménez de Pococí.
The lamps and electrical poles, including transformers, were installed within the protective zone of the Guácimo Pococí aquifer, that is, within a zone that was inviolable and has been protected since January 1987, when executive decree 17390-MAG-S was promulgated, creating the ‘zona protectora de los acuíferos de Guácimo Pococí,’ which remains in force.” (see ICE report and evidence provided). On October 9, 2019, ICE issued response 1550-1194-2019 to the protected party, explaining that the case corresponded to expediente 2010-03-043 and arose from a request by residents of that road to extend the electrical distribution grid; that the works had been performed on a public road in 2013; and that the relevant consultations had been made with MINAE at the time, there had been no objection to construction, and the provisions of Decreto Ejecutivo N° 17390-MAG-S had not been violated (see ICE report).
On October 11, 2019, ICE received an email from the appellant stating the following: “Thank you for the response; nevertheless, I am interested in obtaining a copy of the official letters containing the request from the residents of calle Gavilán, the inquiry sent to MINAE, and the response from that government agency, as you indicate in the official letter. If you can assist me with that information by telephone, I would appreciate it; otherwise, I request a PDF image of each particular official letter” (see ICE report and evidence provided). On October 16, 2019, ICE responded to the protected party’s email and stated: “Because this is a customer file, we cannot provide you with information unless the applicant’s consent has been obtained; the legal grounds supporting this action are provided below, where you may review the legal arguments. Nevertheless, you were informed that MINAE’s authorization note is SINAC-ACTo-ASP-PNE-214, dated April 30, 2013; if you wish, you may request a copy from the corresponding Institution” (see ICE report and evidence provided).
On October 17, 2019, ICE received a response from the petitioner stating: “Thank you very much for the information. My request concerns an amparo proceeding (recurso de amparo), which I intend to pursue before the Sala constitucional because the area of the protective zone of the Acuíferos Guácimo Pococí was encroached upon, pursuant to the decree I previously mentioned” (see ICE report). On October 28, 29, and 30, 2019, following the appellant’s complaint, which SINAC received on October 10, 2019, the Administradora de la Zona Protectora Acuíferos Guácimo Pococí inspected the area and found that the public lighting had been installed a long time earlier. In that regard, the administrator of the Zona Protectora stated in official letter SINACACTo- DASP-ZPAGP-12 of May 9, 2020: “During the field visit, Mr. Edwin Estrada’s complaint in the Buenos Aires sector was addressed; the road is indeed in good condition, and public lighting was found that had been installed for quite some time, although the installation date cannot be determined.
Thereafter, georeference points were taken to establish the exact location on the ASP map (…) No complaint was filed regarding the reported electrical wiring, despite its location in the Zona Protectora de Acuíferos Guácimo y Pococí, because the georeferencing analysis performed using the institutional GIS database shows that the electrification project runs between private properties, for approximately 500 meters along legally registered properties, as well as along the road, which is a public easement (servidumbre pública) extending approximately 800 meters and which has existed for many years; no impact on forest, water, or wildlife resources at the site was found to have resulted from those actions. (…) The document concerning the Recurso de Amparo refers to official letter number SINACACTo-ASP-PNE-213 dated May 02, 2013, which is a certification prepared by Lic. Carlos Calvo, head of Patrimonio Natural del Estado de ACTo.
That certificate was prepared at the request of engineer Bladimir Pérez Chaves, ICE Environmental Manager for the Región Huetar Atlántica, seeking an opinion regarding the location of electrification project LD Buenos Aires 892/003 in relation to the Áreas Silvestres Protegidas del Sistema Nacional de Áreas de Conservación (SINAC), commonly referred to as a location certificate; that document does not constitute approval by the Área de Conservación Tortuguero for project development. Therefore, based on SINAC’s own powers and those of our Regional office, as described in Ley de Biodiversidad N° 7788, the corresponding work to address and follow up on the citizen complaint was performed, and no consequential impact warranting the filing of a criminal complaint was found” —emphasis added— (see SINAC report and evidence provided). On May 12, 2020, the Dirección Regional del SINAC inspected the site again and concluded that, due to the age of the road, there were no signs of vegetation having been affected by the works.
It further stated that “Electrification within the protected wilderness area (área silvestre) extends for approximately 540 meters through cleared areas within the public road. The graveled road within the Zona Protectora is 660 meters long, while 190 meters have no material (at the end of the dead-end road).”
In addition to the foregoing, it reviewed the history of the area and established that, since 2005, the current route had already been established and most of it cleared: “both the electrical wiring and the section of gravel road observed during the inspection lie within the Area shown as cleared in that aerial photograph”—according to report number ACTo-DRFVS-EPMF-116-2020 of 12 de mayo del 2020—(see SINAC report and evidence submitted). On 6 de julio de 2020, the respondent municipality forwarded the appellant’s inquiries to the Coordinator of the Technical Road Management Unit. Subsequently, through official letter UTGVM-0547-2020, that Unit replied to Legal Services as follows: “1. The material was obtained under purchase order 4513 dated 22 de agosto de 2017. The work was coordinated with the Development Association of the community of Buenos Aires. There is no work order because these projects are coordinated with the community and carried out using municipal equipment.
No studies are conducted because these are road-maintenance projects consisting of repairing the existing roadway surface without disturbing adjacent areas or areas outside the roadway and drainage ditches. No agreement is executed because the Municipality provides both the materials and the necessary equipment in coordination with the community itself. The areas where the work was performed are part of the Cantonal Road Network, and the Municipality must therefore ensure their proper maintenance” (see report submitted and evidence provided). Within the reported area, there are no recent works or any approval issued by SINAC for the construction of works in that protective zone (see SINAC report). III.- Regarding the specific case. In the sub judice matter, the appellants allege that the Municipalidad de Pococí improved and graveled a road within the protective zone of the Acuíferos de Guácimo y Pococí, created by decree No. 17390-MAG-S, and that ICE, for its part, installed utility poles and power lines at the site, on calle Gavilán, located in areas within that zone.
They contend that such works should not have been carried out at those sites and must therefore be removed. Upon review of the record, it has been established that, following a request for electrification of the calle Gavilán sector in Buenos Aires de Guápiles Pococí, ICE carried out the project in 2013 and energized the area. Likewise, in 2017, the Municipalidad de Pococí performed work on that road (which had been established several years earlier); subsequently, in 2018, it worked on a 900 In stretch of the road, of which 454 m linear meters are within the protected area and the remainder outside it. In this regard, as to ICE, the record shows that, on 4 de octubre de 2019, the appellant sent that institution an email asking the following: “Under what work-order number, on what date, at whose request, pursuant to what study, who signed the work order, and who approved the study for the installation of a power grid, including streetlights, on calle Gavilán, located 1100 metros south of the Catholic church of Buenos Aires de Jiménez de Pococí?
The streetlights and utility poles, including transformers, were installed within the protective zone of the Guácimo Pococí aquifer, that is, within a zone that was inviolable and has been protected since Enero del año 1987, when executive decree 17390-MAG-S was enacted, creating the ‘protective zone of the Guácimo Pococí aquifers,’ which remains in force.” In response, on 9 de octubre de 2019, ICE informed the protected party that the work had resulted from a request by residents of that road to extend the electricity distribution grid; that the work had been carried out on a public road in 2013; that the appropriate consultations had been made with MINAE at the time; that there had been no objection to its construction; and that the provisions of Decreto Ejecutivo N° 17390-MAG-S had not been violated. The record further shows that, on 28, 29 y 30 de octubre de 2019, following a complaint by the appellant received by SINAC on 10 de octubre de 2019, the Administrator of the Zona Protectora Acuíferos Guácimo Pococí inspected the area and found that the public lighting had been installed a long time earlier.
In this regard, through official letter SINACACTo- DASP-ZPAGP-12 of 9 de mayo del 2020, the administrator of the protective zone stated: “When the field visit was conducted, Mr. Edwin Estrada’s complaint in the Buenos Aires sector was addressed. The road was indeed in good condition, and public lighting that had been installed for quite some time was present; it is not possible to determine when it was installed. Thereafter, georeference points were taken to establish the exact location on the ASP map (…) No complaint was filed concerning the reported electrical wiring, despite its location within the Zona Protectora de Acuíferos Guácimo y Pococí, because the georeferencing analysis conducted using the institutional GIS database shows that the electrification project lies between privately owned properties, extending approximately 500 metros along legally registered parcels, and that the road is a public easement (servidumbre pública) approximately 800 metros long that has existed for many years; no adverse effect on forest, water, or wildlife resources at the site was identified as a result of those actions.
(…) The amparo proceeding (Recurso de Amparo) document refers to an official letter numbered SINACACTo-ASP-PNE-213 and dated 02 de mayo del 2013, which is a certification prepared by Lic. Carlos Calvo, the official in charge of Patrimonio Natural del Estado at ACTo. That certificate was prepared at the request of engineer Bladimir Pérez Chaves, Environmental Manager for ICE in the Región Huetar Atlántica, seeking an opinion regarding the location of the LD Buenos Aires 892/003 electrification project in relation to the Áreas Silvestres Protegidas del Sistema Nacional de Áreas de Conservación (SINAC), commonly known as a location certificate; that document does not constitute any approval by the Área de Conservación Tortuguero for the development of projects. Therefore, based on the respective powers of SINAC and our Regional Office, as described in the Ley de Biodiversidad N° 7788, the appropriate work was undertaken to address and follow up on the citizen complaint, and no relevant adverse effect warranting the filing of a criminal complaint was found”—emphasis added.
Subsequently, on 12 de mayo del 2020, as a result of this amparo, the SINAC Regional Directorate inspected the site again and concluded that there were no signs of vegetation affected by works, given the age of the road. It further stated that “Electrification within the protected wilderness area (área silvestre) extends for a section of approximately 540 metros over cleared areas within the public road. The gravel road within the Protective Zone is 660 metros long, and 190 metros have no material (at the end of the dead-end road).” In addition to the foregoing, it reviewed the history of the area and established that, since 2005, the current route had already been established and most of it cleared: “both the electrical wiring and the section of gravel road observed during the inspection lie within the Area shown as cleared in that aerial photograph”—according to report number ACTo-DRFVS-EPMF-116-2020 of 12 de mayo del 2020.
Finally, SINAC reports under oath that, within the reported area, there are no recent works or any approval issued by SINAC for the construction of works in that protective zone. In addition to the foregoing, the Municipalidad de Pococí reports under oath that it performed work on calle Gavilán in 2017. Subsequently, in 2018, it worked on the road (which has existed for 19 años) along a length of 900 m, of which 454 m linear meters are within the protected area and the remainder outside it. Moreover, the work was performed within the right-of-way (derecho de vía) (a coded road shown on several cadastral plans), on the roadway, by adding granular material without affecting the protected area. Finally, it states that this neighborhood contains thirteen residential dwellings and two recreational country homes, and that constant traffic in the area was verified. Against this background, the Chamber finds no infringement of the right to the environment.
SINAC is indeed emphatic in stating (since 2019, in response to a complaint by the appellant) that “No complaint was filed concerning the reported electrical wiring, despite its location within the Zona Protectora de Acuíferos Guácimo y Pococí, because the georeferencing analysis conducted using the institutional GIS database shows that the electrification project lies between privately owned properties, extending approximately 500 metros along legally registered parcels, and that the road is a public easement approximately 800 metros long that has existed for many years; no adverse effect on forest, water, or wildlife resources at the site was identified as a result of those actions.” Along the same lines, the municipality maintains that the road has existed for years (it is coded and shown on several cadastral plans), and that the work was performed within the right-of-way, on the roadway, by adding granular material without affecting the protected area (it should be noted that only part of the road lies within that area).
Accordingly, it must be borne in mind that the Chamber is not an additional administrative-instance tribunal; it is therefore not for the Chamber to determine whether the respondents’ technical opinions regarding the wiring and graveling challenged by the petitioner are correct and, on that basis, to order action consistent with the moving party’s requested relief. Such disagreements must be litigated through the appropriate administrative or judicial proceedings. In view of the foregoing, the appeal is dismissed. I V.- In another vein, the appellant states that a request was sent to the respondent municipality and no response has been received. In this regard, it may be inferred that, at 11:25 horas on 4 de octubre de 2019 (reiterated on 26 de marzo de 2020), the moving party sent the following inquiry to [email protected]: “Under (sic) what work-order number?, on (sic) what date ¿, (sic) at whose request? , pursuant to (sic) what (sic) study ¿ , (sic) who signed the work order ¿, (sic) who approved the study ¿, (sic) or under an agreement with what (sic) institution in the region?
(sic) Were the works carried out to gravel and open a portion of calle Gavilán, which is located 1100 metros south of the Catholic church of Buenos Aires de Jiménez de Pococí. The opened portion is located after the rio Santa Clara, on that road, and after the boundary marker of the protection area shown in photograph 1. The graveling and opening of calle Gavilán were works carried out within the protective zone of the Guácimo Pococí aquifer, that is, within a zone that was inviolable and has been protected since Enero del año 1987, when executive decree 17390-MAGS was enacted, creating the ‘protective zone of the Guácimo Pococí aquifers,’ which remains in force. I am attaching a screenshot photograph of the indicated site, as well as photographs showing the graveling presumably carried out by that Municipality, which is within the protected area after crossing the rio Santa Clara on calle Gavilán. I would appreciate a response with the urgency warranted by the matter, since a protected zone of a clearly delimited aquifer was violated (…)”.
However, under both the previous administration and the current one, the email address [email protected] has not been an authorized means for the respondent municipality to receive inquiries such as the one submitted by the petitioner. Furthermore, on 1° de mayo de 2020, that address was disabled by the respondent municipality. In view of these circumstances, because that request was not sent through a means authorized for such purposes (and it should be noted that the respondent did not process it before the constitutional amparo proceeding (amparo) was filed), it is not possible to determine whether there was any administrative delay infringing the protected party’s fundamental rights. Accordingly, this claim is also declared inadmissible. V.- Documentation submitted to the case file (expediente). The parties are hereby advised that, if they submitted any paper document, as well as any objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, they must retrieve them from the court within a maximum period of 30 business days from notice of this judgment.
Otherwise, any material not retrieved within that period shall be destroyed, pursuant to the “Regulations on Electronic Case Files before the Judiciary” (“Reglamento sobre Expediente Electrónico ante el Poder Judicial”), approved by the Corte Plena at session N° 27-11 of 22 de agosto del 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 de enero del 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 de mayo del 2012, Article LXXXI. Observations of the SALA CONSTITUCIONAL decided by ballot SCIJ of the Ministry of Finance SCIJ of the Procuraduría General de la República
Sentencia con datos protegidos, de conformidad con la normativa vigente SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas y veinte minutos del veintiuno de julio de dos mil veinte .
Recurso de amparo interpuesto por SUZZZETH ESPINIZA CRUZ, cédula de identidad 0108960654, y EDWIN H. ESTRADA HERNÁNDEZ, cédula de identidad 01041601278; contra la MUNICIPALIDAD DE POCOCÍ, el INSTITUTO COSTARRICENSE DE ELECTRICIDAD (ICE) y el SISTEMA NACIONAL DE ÁREAS DE CONSERVCIÓN (SINAC).
Resultando:
Considerando:
I.Objeto del recurso. Los recurrentes señalan que la Municipalidad de Pococí acondicionó y lastró un camino dentro de la zona protectora de los Acuíferos de Guácimo y Pococí, creada mediante el decreto No. 17390-MAG-S y, por otro lado, el ICE instaló postes y líneas eléctricas en el sitio, en la calle Gavilán, localizada en áreas dentro de esa zona. Consideran que esas obras no debieron realizarse en esos sitios, por lo que deben ser eliminadas. Por otro lado, mencionan que enviaron una gestión a la municipalidad recurrida, y no han obtenido respuesta. II.-Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque la autoridad recurrida haya omitido referirse a ellos, según lo prevenido en el auto inicial: El 14 de abril de 2010, en la Región Huetar Caribe, el ICE recibió la solicitud de electrificación para el sector de calle Gavilán, en Buenos Aires de Guápiles Pococí, expediente 2010-03-43 (ver informe del ICE).
El 11 de mayo de 2010, mediante oficio 1550-0588-2020, el ICE indicó que, a partir del estudio de campo, era factible el proyecto de 1.02 km (ver informe del ICE). En el 2013, el ICE asignó el caso dentro del presupuesto para desarrollo periférico de ese año, por lo que realizó el diseño y determinó una proyección de 1053 metros para beneficiar a cinco clientes (ver informe del ICE). El día 30 de abril de 2013, ante una consulta realizada por el ICE para conocer si se podía o no construir la obra en ese sitio, el MINAE emitió la nota SINAC-ACTo-ASP-PNE-214, donde se recibió la certificación SINAC-ACTo-ASP-PNE-213, que indicaba que el proyecto a desarrollar se encontraba ubicado parcialmente dentro de la Zona Protegida de los Acuíferos Guácimo – Pococí. Allí se estableció que, para efectos de eliminar árboles, “se debe contar con el respectivo permiso (Art. 27 Ley 7575 Ley Forestal) se deben respetar las áreas de protección (Ley 7575”); sumado a que se recomendaron prácticas encaminadas a favorecer el equilibrio de los ecosistemas y el aprovechamiento sustentable del bosque.
Sumado a ello, en una visita de campo conjunta (ICE-MINAE), se le indicó al ICE que en esa zona en particular no había expropiaciones ni se habían pagado terrenos a los propietarios por parte del Estado y, por ende, no existía limitación para la construcción de la red eléctrica, la cual se ubicaría en vía pública (ver informe del ICE). El 1 de octubre de 2013, el ICE inició la construcción de la obra, con la viabilidad ambiental respectiva, según consta en la resolución No. 2765-2010-SETENA, expediente administrativo No. D1-818-2010-SETENA, para la cual no fue necesario la corta de árboles, por lo que se prescindió de los trámites correspondientes ante las autoridades del MINAE (ver informe del ICE). El 29 de octubre de 2013, el ICE envió una nota al Área de Mantenimiento para programar la energización de la obra (ver informe del ICE). En el 2017, la Municipalidad de Pococí realizó trabajos en la calle Gavilán, ubicada en el distrito de Jiménez, inscrita en la base de datos de planificación sectorial del MOPT con el código C.7-01-249, denominada “Calle Navarro (En.C.60) Buenos Aires hasta el fin del camino, con una distancia de 1.2 km”.
Asimismo, la longitud que se encuentra dentro de la zona protectora es de 654 metros ( ver informe de la municipalidad). En el 2018, el municipio recurrido intervino el camino con una longitud de 900 m, de los cuales 45 4m lineales están en el área protegida, y el restante fuera de ella. Además, los trabajos realizados se hicieron sobre el derecho de vía (camino codificado, publicitado en varios planos catastrados), en la calzada, con la incorporación de material granular, sin afectar la zona protegida. En este barrio están contabilizadas trece casas de habitación y dos quintas para uso recreacional, donde se verificó que existe un tránsito constante en la zona, que fue impactada con el camino hace más de 19 años (ver informe rendido por la municipalidad y prueba aportada). A las 11:25 horas del 4 de octubre de 2019 (reiterado el 26 de marzo de 2020), la parte recurrente envió a la dirección [email protected] la siguiente consulta: “Bajo (sic) qué número de orden de trabajo?, en (sic) qué fecha ¿, (sic) a solicitud de quién? , bajo (sic) que (sic) estudio ¿ , (sic) quién firma la orden de ejecución ¿, (sic) quién avala el estudio ¿, (sic) o en convenio con que (sic) institución de la región?
(sic) Se realizaron los trabajos para lastrar y habilitar una parte de la calle Gavilán, la cual se ubica a 1100 metros al sur de la iglesia católica de Buenos Aires de Jiménez de Pococí. La parte habilitada, se ubica luego del rio Santa Clara, en esa calle, y del mojón del área de protección mostrado en la fotografía 1. El lastrado y la habilitación de la calle Gavilán, fueron obras realizadas dentro de la zona protectora del acuífero de Guácimo Pococí, es decir dentro de una zona que era inviolable y está protegida desde el mes de Enero del año 1987, en que se promulgó el decreto ejecutivo 17390-MAGS, creando la "zona protectora de los acuíferos de Guácimo Pococí el cual se encuentra vigente. Adjunto fotografía de captura de pantalla del sitio indicado, así como fotografías que muestran el lastrado ejecutado presumiblemente por esa Municipalidad, que se encuentran dentro de la zona protegida, una vez se pasa el rio Santa Clara sobre esa calle Gavilán.
Agradezco la respuesta con la inmediatez que el caso amerita, pues se violó, una zona protegida de un acuífero, bien delimitado (…)” (ver prueba aportada). Tanto en el anterior gobierno como en el actual, la dirección electrónica [email protected] no ha sido un medio autorizado por la municipalidad recurrida para recibir consultas como la planteada por el recurrente. Además, el 1° de mayo de 2020, esa dirección fue inhabilitada por el municipio recurrido (ver informe rendido). El 4 de octubre de 2019, el recurrente envió un correo electrónico al ICE, donde manifestó lo siguiente: “Bajo qué número de orden de trabajo, en qué fecha, a solicitud de quien, bajo que estudio, quién firma la orden de ejecución, quién avala el estudio, para instalar una red eléctrica con lámparas incluidas en la calle Gavilán, la cual se ubica a 1100 metros al sur de la iglesia católica de Buenos Aires de Jiménez de Pococí.
Las lámparas y los postes eléctricos, con transformadores incluidos, fueron instaladas dentro de la zona protectora del acuífero de Guácimo Pococí, es decir dentro de una zona que era inviolable y está protegida desde el mes de Enero del año 1987, en que se promulgó el decreto ejecutivo 17390-MAG-S, creando la “zona protectora de los acuíferos de Guácimo Pococí” el cual se encuentra vigente.” (ver informe del ICE y prueba aportada). El 9 de octubre de 2019, el ICE le emitió al tutelado la respuesta 1550-1194-2019, donde le explicó que el caso correspondía al expediente 2010-03-043 y obedecía a una solicitud de los vecinos de esa calle para extender la red de distribución eléctrica, así como que esa obra se ejecutó sobre calle pública en el año 2013 y en su momento se realizaron las consultas correspondientes con el MINAE, no hubo objeción en su construcción y no se violentó lo estipulado en el Decreto Ejecutivo N° 17390-MAG-S (ver informe del ICE).
El 11 de octubre de 2019, el ICE recibió un correo electrónico del recurrente, donde indicó lo siguiente: “Gracias por la respuesta, no obstante me interesa obtener una copia de los oficios de solicitud de los vecinos de calle Gavilán, la consulta al MINAE y la respuesta de esa dependencia estatal, tal y como usted señala en el oficio. Si llamando a sus líneas telefónicas, me asisten con esa información, les agradezco; caso contrario les solicito una imagen en pdf de cada oficio en particular” (ver informe del ICE y prueba aportada). El 16 de octubre de 2019, el ICE respondió el correo del amparado e indicó que: “ Al tratarse de un expediente de un cliente no podemos remitirle información a menos que se cuente con el consentimiento del solicitante, señalándole para ello el fundamento jurídico que respalda dicha actuación, abajo puede ver los argumentos legales. No obstante, se le indicó la nota de autorización del MINAE es la SINAC-ACTo-ASP-PNE-214 con fecha 30 de abril de 2013, si gusta puede solicitar copia en la Institución correspondiente” (ver informe del ICE y prueba aportada).
El 17 de octubre de 2019, el ICE recibió una respuesta del petente, mediante la cual manifestó: “ Muchas gracias por la información. Mi solicitud obedece a un recurso de amparo, que pretendo continuar ante a la Sala constitucional, por haberse invadido el área de la zona protectora de los acuíferos Guácimo Pococí, según decreto que en su oportunidad mencioné” (ver informe del ICE). El 28, 29 y 30 de octubre de 2019, luego de la denuncia del recurrente, recibida en el SINAC el 10 de octubre de 2019, la Administradora de la Zona Protectora Acuíferos Guácimo Pococí inspeccionó la zona y encontró que el alumbrado público había sido instalado hace mucho tiempo. Al respecto, la administradora de la Zona Protectora indicó mediante oficio SINACACTo- DASP-ZPAGP-12 del 9 de mayo del 2020: que “Cuando se realiza la gira, se atiende la queja del Señor Edwin Estrada en el sector de Buenos Aires, efectivamente la calle está en buenas condiciones y se encuentra alumbrado público con bastante tiempo de instalación, no es posible precisar el tiempo de instalación.
Posterior a eso se toman los puntos de georreferencia para establecer la ubicación exacta en el mapa del ASP (…) No se interpone denuncia referente al cableado eléctrico denunciado, pese a estar en Zona Protectora de Acuíferos Guácimo y Pococí pues, en el análisis de georreferenciación realizado con la base de datos institucional de SIG, muestra que el proyecto de electrificación se encuentra entre terrenos privados, a través de unos 500 metros a lo largo de fincas inscritas legalmente, así como la calle que es servidumbre pública con extensión de alrededor de 800 metros, el cual existe de hace muchos años, no encontrando afectación del recurso forestal, hídrico o de vida silvestre en el sitio a raíz de dichas acciones. (…) En el documento del Recurso de Amparo se habla de un oficio con numeración SINACACTo-ASP-PNE-213 con fecha 02 de mayo del 2013, el cual es una certificación realizada por el Lic. Carlos Calvo, encargado de Patrimonio Natural del Estado de ACTo.
Dicho certificado se realizó a solicitud del ingeniero Bladimir Pérez Chaves, Gestor Ambiental del ICE de la Región Huetar Atlántica, donde se solicita emitir criterio de ubicación en relación a las Áreas Silvestres Protegidas del Sistema Nacional de Áreas de Conservación (SINAC), del proyecto de electrificación LD Buenos Aires 892/003, lo que comúnmente se llamaría certificación de ubicación, dicho documento no representa ningún visto bueno por parte del Área de Conservación Tortuguero para el desarrollo de proyectos. Por ende, partiendo de las competencias propias del SINAC y nuestra oficina Regional según las competencias descritas en la Ley de Biodiversidad N° 7788, se realizó el respectivo trabajo de atención y seguimiento de la queja ciudadana, no encontrando afectación vinculante para la interposición de denuncia penal” -énfasis añadido- (ver informe del SINAC y prueba aportada). El 12 de mayo del 2020, la Dirección Regional del SINAC inspeccionó nuevamente el sitio y concluyó que no hay rastros de vegetación afectada por obras debido a la antigüedad de la calle.
Además, indicó que “La electrificación en el área silvestre avanza por un tramo de 540 metros aproximadamente, sobre áreas despejadas dentro del camino público. El camino lastreado dentro de la Zona Protectora mantiene una longitud de 660 metros y 190 metros no cuentan con material (al final del camino, sin salida)”. Aunado a lo anterior, verificó los antecedentes de la zona y evidenció que, desde el 2005, el trazado actual ya estaba establecido y la mayoría del recorrido despejado: “tanto el cableado eléctrico como la sección de camino lastreado observados en la inspección se ajustan dentro del Área que se muestra como despejada en dicha fotografía área” -según informe número ACTo-DRFVS-EPMF-116-2020 del 12 de mayo del 2020- (ver informe del SINAC y prueba aportada). El 6 de julio de 2020, el municipio accionado remitió al Coordinador de la Unidad Técnica de Gestión Vial las consultas del recurrente.
Luego, por oficio UTGVM-0547-2020, esta Unidad le contestó a Servicios Jurídicos lo siguiente: “1. El material es retirado de la orden de compra 4513 de fecha 22 de agosto de 2017. Los trabajos son coordinados con la Asociación de Desarrollo de la comunidad de Buenos Aires. No existe una orden de ejecución ya que son proyectos coordinados con la comunidad y realizados con equipo municipal. No se realiza estudios ya que son proyectos de mantenimiento vial, que consiste en reparar la superficie de ruedo existente, sin intervenir zonas aledañas o fuera de la calzada y cunetas. No se realiza convenio ya que la Municipalidad aporta tanto los materiales como el equipo necesario en coordinación con la misma comunidad. Las zonas intervenidas se encuentran en la Red Vial Cantonal, por lo que la Municipalidad debe velar por su respectivo mantenimiento” (ver informe rendido y prueba aportada). Dentro de la zona denunciada no existen obras recientes ni un visto bueno emitido por el SINAC para la construcción de obras en esa zona protectora (ver informe del SINAC).
III.- Sobre el caso concreto. En el sub lite, los recurrentes acusan que la Municipalidad de Pococí acondicionó y lastró un camino dentro de la zona protectora de los Acuíferos de Guácimo y Pococí, creada mediante el decreto No. 17390-MAG-S y, por otro lado, el ICE instaló postes y líneas eléctricas en el sitio, en la calle Gavilán, localizada en áreas dentro de esa zona. Consideran que tales obras no debieron realizarse en esos sitios, por lo que deben ser eliminadas. Revisados los autos, se tiene por demostrado que, ante una solicitud de electrificación para el sector de calle Gavilán, en Buenos Aires de Guápiles Pococí, el ICE ejecutó la obra en el 2013 y energizó la zona. Asimismo, en el 2017, la Municipalidad de Pococí realizó trabajos en tal calle (establecida desde hace varios años); luego, en el 2018 intervino el camino con una longitud de 900 In, de los cuales 454 m lineales están en área protegida y el restante fuera de ella.
Al respecto, en relación con el ICE, se evidencia que, el 4 de octubre de 2019, el recurrente envió un correo electrónico a esa institución, donde consultó lo siguiente: “Bajo qué número de orden de trabajo, en qué fecha, a solicitud de quien, bajo que estudio, quién firma la orden de ejecución, quién avala el estudio, para instalar una red eléctrica con lámparas incluidas en la calle Gavilán, la cual se ubica a 1100 metros al sur de la iglesia católica de Buenos Aires de Jiménez de Pococí. Las lámparas y los postes eléctricos, con transformadores incluidos, fueron instaladas dentro de la zona protectora del acuífero de Guácimo Pococí, es decir dentro de una zona que era inviolable y está protegida desde el mes de Enero del año 1987, en que se promulgó el decreto ejecutivo 17390-MAG-S, creando la “zona protectora de los acuíferos de Guácimo Pococí” el cual se encuentra vigente.”. Ante ello, el 9 de octubre de 2019, el ICE le contestó al tutelado que lo anterior obedecía a una solicitud de los vecinos de esa calle para extender la red de distribución eléctrica, así como que esa obra se ejecutó sobre calle pública en el año 2013 y en su momento se realizaron las consultas correspondientes con el MINAE, no hubo objeción en su construcción y no se violentó lo estipulado en el Decreto Ejecutivo N° 17390-MAG-S.
Por otro lado, se desprende que, el 28, 29 y 30 de octubre de 2019, luego de una denuncia del recurrente, recibida en el SINAC el 10 de octubre de 2019, la Administradora de la Zona Protectora Acuíferos Guácimo Pococí inspeccionó la zona y encontró que el alumbrado público había sido instalado hace mucho tiempo. Al respecto, la administradora de la zona protectora indicó mediante oficio SINACACTo- DASP-ZPAGP-12 del 9 de mayo del 2020: que “Cuando se realiza la gira, se atiende la queja del Señor Edwin Estrada en el sector de Buenos Aires, efectivamente la calle está en buenas condiciones y se encuentra alumbrado público con bastante tiempo de instalación, no es posible precisar el tiempo de instalación. Posterior a eso se toman los puntos de georreferencia para establecer la ubicación exacta en el mapa del ASP (…) No se interpone denuncia referente al cableado eléctrico denunciado, pese a estar en Zona Protectora de Acuíferos Guácimo y Pococí pues, en el análisis de georreferenciación realizado con la base de datos institucional de SIG, muestra que el proyecto de electrificación se encuentra entre terrenos privados, a través de unos 500 metros a lo largo de fincas inscritas legalmente, así como la calle que es servidumbre pública con extensión de alrededor de 800 metros, el cual existe de hace muchos años, no encontrando afectación del recurso forestal, hídrico o de vida silvestre en el sitio a raíz de dichas acciones.
(…) En el documento del Recurso de Amparo se habla de un oficio con numeración SINACACTo-ASP-PNE-213 con fecha 02 de mayo del 2013, el cual es una certificación realizada por el Lic. Carlos Calvo, encargado de Patrimonio Natural del Estado de ACTo. Dicho certificado se realizó a solicitud del ingeniero Bladimir Pérez Chaves, Gestor Ambiental del ICE de la Región Huetar Atlántica, donde se solicita emitir criterio de ubicación en relación a las Áreas Silvestres Protegidas del Sistema Nacional de Áreas de Conservación (SINAC), del proyecto de electrificación LD Buenos Aires 892/003, lo que comúnmente se llamaría certificación de ubicación, dicho documento no representa ningún visto bueno por parte del Área de Conservación Tortuguero para el desarrollo de proyectos. Por ende, partiendo de las competencias propias del SINAC y nuestra oficina Regional según las competencias descritas en la Ley de Biodiversidad N° 7788, se realizó el respectivo trabajo de atención y seguimiento de la queja ciudadana, no encontrando afectación vinculante para la interposición de denuncia penal” -énfasis añadido- .
Posteriormente, el 12 de mayo del 2020, a raíz de este amparo, la Dirección Regional del SINAC inspeccionó nuevamente el sitio y concluyó que no hay rastros de vegetación afectada por obras debido a la antigüedad de la calle. Además, indicó que “La electrificación en el área silvestre avanza por un tramo de 540 metros aproximadamente, sobre áreas despejadas dentro del camino público. El camino lastreado dentro de la Zona Protectora mantiene una longitud de 660 metros y 190 metros no cuentan con material (al final del camino, sin salida)”. Aunado a lo anterior, verificó los antecedentes de la zona y evidenció que, desde el 2005, el trazado actual ya estaba establecido y la mayoría del recorrido despejado: “tanto el cableado eléctrico como la sección de camino lastreado observados en la inspección se ajustan dentro del Área que se muestra como despejada en dicha fotografía área” -según informe número ACTo-DRFVS-EPMF-116-2020 del 12 de mayo del 2020-.
Finalmente, el SINAC informa bajo juramento que, dentro de la zona denunciada no existen obras recientes ni algún visto bueno emitido por el SINAC para la construcción de obras en esa zona protectora. Aunado a lo anterior, la Municipalidad de Pococí informa bajo juramento que en el 2017 realizó trabajos en la calle Gavilán. Luego, en el 2018 intervino el camino (que existe desde hace 19 años) con una longitud de 900 m, de los cuales 454 m lineales están en el área protegida, y el restante fuera de ella. Además, los trabajos realizados se hicieron sobre el derecho de vía (camino codificado, publicitado en varios planos catastrados), en la calzada, con la incorporación de material granular sin afectar la zona protegida. Finalmente, menciona que en este barrio están contabilizadas trece casas de habitación y dos quintas para uso recreacional, donde se verificó que existe un tránsito constante en la zona.
Desde este panorama, la Sala descarta alguna lesión al derecho al ambiente. Ciertamente, el SINAC es enfático en señalar (desde el 2019 ante una denuncia del recurrente), que “No se interpone denuncia referente al cableado eléctrico denunciado, pese a estar en Zona Protectora de Acuíferos Guácimo y Pococí pues, en el análisis de georreferenciación realizado con la base de datos institucional de SIG, muestra que el proyecto de electrificación se encuentra entre terrenos privados, a través de unos 500 metros a lo largo de fincas inscritas legalmente, así como la calle que es servidumbre pública con extensión de alrededor de 800 metros, el cual existe de hace muchos años, no encontrando afectación del recurso forestal, hídrico o de vida silvestre en el sitio a raíz de dichas acciones”. Incluso, en este mismo orden de ideas, la municipalidad sostiene que el camino existe desde hace años (se encuentra codificado y publicitado en varios planos catastrados), así como que los trabajos realizados se hicieron sobre el derecho de vía, en la calzada, con la incorporación de material granular sin afectar la zona protegida (nótese que solo una parte del camino está en tal zona).
Así las cosas, adviértase que la Sala no es una instancia más de la administración, de modo que no le corresponde definir si llevan razón o no los recurridos en sus criterios técnicos respecto al cableado y lastreo que reclama el petente y, con base en ello, ordenar que se actúe conforme a las pretensiones de la parte promovente . Tales disconformidades deben ser discutidas ante la vía administrativa o judicial correspondientes. En mérito de lo anterior, se declara sin lugar el recurso. I V.- En otro orden de ideas , la parte recurrente menciona que envió una gestión a la municipalidad recurrida y no ha obtenido respuesta. Al respecto, se colige que, a las 11:25 horas del 4 de octubre de 2019 (reiterado el 26 de marzo de 2020), la parte promovente remitió a la dirección [email protected] la siguiente consulta: “Bajo (sic) qué número de orden de trabajo?, en (sic) qué fecha ¿, (sic) a solicitud de quién? , bajo (sic) que (sic) estudio ¿ , (sic) quién firma la orden de ejecución ¿, (sic) quién avala el estudio ¿, (sic) o en convenio con que (sic) institución de la región?
(sic) Se realizaron los trabajos para lastrar y habilitar una parte de la calle Gavilán, la cual se ubica a 1100 metros al sur de la iglesia católica de Buenos Aires de Jiménez de Pococí. La parte habilitada, se ubica luego del rio Santa Clara, en esa calle, y del mojón del área de protección mostrado en la fotografía 1. El lastrado y la habilitación de la calle Gavilán, fueron obras realizadas dentro de la zona protectora del acuífero de Guácimo Pococí, es decir dentro de una zona que era inviolable y está protegida desde el mes de Enero del año 1987, en que se promulgó el decreto ejecutivo 17390-MAGS, creando la "zona protectora de los acuíferos de Guácimo Pococí el cual se encuentra vigente. Adjunto fotografía de captura de pantalla del sitio indicado, así como fotografías que muestran el lastrado ejecutado presumiblemente por esa Municipalidad, que se encuentran dentro de la zona protegida, una vez se pasa el rio Santa Clara sobre esa calle Gavilán.
Agradezco la respuesta con la inmediatez que el caso amerita, pues se violó, una zona protegida de un acuífero, bien delimitado (…)”. Sin embargo, tanto en el anterior gobierno como en el actual, la dirección electrónica [email protected] no ha sido un medio autorizado por la municipalidad recurrida para recibir consultas como la planteada por el recurrente. Además, el 1° de mayo de 2020, esa dirección fue inhabilitada por el municipio recurrido. Desde este panorama, al no ser enviada esa gestión a un medio autorizado para tales efectos (nótese que tampoco fue tramitada por el recurrido de previo a la interposición del amparo), no es posible determinar si existe alguna dilación administrativa contraria a los derechos fundamentales de la parte tutelada . Así las cosas, se declara improcedente también este extremo. V.- Documentación aportada al expediente . Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia.
De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI. Por tanto:
Se declara sin lugar el recurso.
