Document Review *200131520007CO* Decision No. 2020015207 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine fifteen a.m. on August fourteenth, two thousand twenty.
Writ of amparo (recurso de amparo) filed by YERLING ANDREA RODRÍGUEZ RAMÍREZ, identity card No. 0115170343, against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (ICAA) AND THE MINISTERIO DE AMBIENTE Y ENERGÍA (MINAE).
Findings of Fact:
Justice Araya García drafts the opinion; and,
Considering:
I.Subject matter of the proceeding. The appellant alleged that, through official letter No. GG-2019-04071 of 21 de noviembre de 2019, ICAA requested that the Dirección de Agua of MINAE deregister well AB-1477 without providing another alternative for supplying water to the affected condominiums, including Condominio Horizontal Residencial Villas del Río. She considered the right of access to drinking water to have been violated.
The protected party resides in Condominio Horizontal Residencial Villas del Río (undisputed fact).
In 1993, Ramón and Rafael Villanea V. applied to the Dirección de Agua of MINAE for a permit to drill well AB-1477 for domestic and livestock-watering use (see the report of the Director of the Dirección de Agua of MINAE and the evidence submitted, which were added to the digital case file).
On 5 de diciembre de 2008, an application for a water-use concession (concesión) in the name of Fideicomisos del Coco S.A. was submitted to the Dirección de Agua of MINAE to use the well located on the property of the company it represented (No. AB – 1477) for 10 persons; the application was assigned expediente No. 13206-P (see the report of the Director of the Dirección de Agua of MINAE and the evidence submitted, which were added to the digital case file).
On 19 de octubre de 2009, an application to change the use of the water was submitted in the aforementioned case file, stating that it would be used for the self-supply of a condominium housing 438 persons (see the report of the Director of the Dirección de Agua of MINAE and the evidence submitted, which were added to the digital case file).
On 16 de marzo de 2011, one of the representatives of Fideicomiso del Coco S.A. informed the Dirección de Agua of MINAE that well No. AB – 1477 had been assigned to ICAA (see the report of the Director of the Dirección de Agua of MINAE and the evidence submitted, which were added to the digital case file).
Through official letter No. PRE – 0270-2011 of 29 de abril de 2011, the Dirección de Agua of MINAE received notice from ICAA that the institution would use the well to supply the population (see the report of the Director of the Dirección de Agua of MINAE and the evidence submitted, which were added to the digital case file).
By means of official letter No. DA-2659-2011 of 21 de junio de 2011, the Dirección de Agua of MINAE registered well No. AB – 1477 in the name of ICAA (see the report of the Director of the Dirección de Agua of MINAE and the evidence submitted, which were added to the digital case file).
Through official letter No. DA – 1161-2011 of 23 de marzo de 2011, it was ordered that expediente No. 13206-P be closed: “(…) Notwithstanding the foregoing, in addition to the proceeding in expediente 13206-P, which has been closed, four additional case files have been submitted to this Dirección. Specifically: expediente 13745-P in the name of E Hijos Magunro S.A.; and 14315-P and 14316-P in the name of Ardos de La Guácima. The latter were consolidated into a single expediente, 14315-P. None of them has been granted a concession, and all seek a concession for well AB-1477 (…)”. These case files were also closed because of the registration request submitted by ICAA (see the report of the Director of the Dirección de Agua of MINAE and the evidence submitted, which were added to the digital case file).
On 9 de noviembre de 2017, the Dirección de Agua of MINAE conducted a field investigation at the site of well No. AB – 1477, with the following result: “(…) report DA-UHTPCOSJ-3252-2017 was prepared and signed by Geologist Mariel González, an official of the Dirección de Agua of MINAE, who reported that she spoke with the security guard at Condominio Villas del Río, who told her that there was no well at that site and that the water was obtained from the well located in Condominio Villanea. The well located in Condominio Villanea is the same well AB-1477 registered in the name of AyA, with no concession recorded in favor of Condominio Villanea. Nevertheless, she states that the condominium is operating the well and that four pipelines extend from it: one leading to the storage tank, another to the distribution tank of Condominio Villanea, another to the distribution tank of Condominio Villas del Río, and a fourth whose destination she does not know; according to the security guard, it leads to the distribution network of Condominio Villalobos (…)” (see the report of the Director of the Dirección de Agua of MINAE and the evidence submitted, which were added to the digital case file).
Through official letter No. AL – 0119-2019 of 17 de mayo de 2019, following the inspection and because the well was supposedly to have been managed by ICAA, the Dirección de Agua of MINAE made the corresponding inquiry (see the report of the Director of the Dirección de Agua of MINAE and the evidence submitted, which were added to the digital case file).
Through official letter No. GG-2019-04071 of 21 de noviembre de 2019, the General Manager of ICAA requested that the Dirección de Agua of MINAE deregister well No. AB-1477 because the entity had never used it (see the report of the Director of the Dirección de Agua of MINAE and the evidence submitted, which were added to the digital case file).
On 17 de enero de 2020, through official letter No. GG-2020-00145, the General Management of ICAA asked the Dirección de Agua of MINAE the following: “(…) With reference to official letter GG- 2019-04071, in which deregistration of well AB – 1477 was requested (…) we respectfully request an update on the status of that application, since SINIGIRH (query dated 09 de enero de 2020) still shows that flow registered in the name of AyA (…)” (see the evidence submitted by the Director of the UEN Gestión Ambiental of ICAA, added to the digital case file).
On 4 de junio de 2020, through official letter No. DA – 0900-2020, the Dirección de Agua of MINAE replied to the General Management of ICAA as follows: “(…) With reference to official letter GG-2019-04071 of 21 de noviembre del 2019 and official letter GG-2020- 00145 of 15 de enero de 2020, I inform you that no response had been issued because the Dirección continues to be concerned as to whether your institution has considered the problem prevailing at the site and the fact that your letter leaves the water-supply service for the population currently and prospectively served by well AB-1477 without coverage. We understand that AyA itself never assumed responsibility for the well, even though the purpose of the application originally submitted by your institution was to provide the service, for which reason it requested the original registration of this well. Since 2011, the flow extracted from well AB-1477 has been registered in the name of the entity you represent, at your express request.
To date, several condominiums receive water from this well. Your letter, in turn, reminds us that, pursuant to opinion C-236-2008 of the Procuraduría General de la República, supplying water between private-law entities located on different property registry folios is not legally permissible; nevertheless, it recommends that we issue service-availability certifications so that the interested parties may continue with the process, which is clearly contrary to law. We cannot and will not proceed in this manner. Moreover, the Dirección de Agua does not issue letters certifying service availability, as this is reserved for service operators; what we issue are attestations or certifications regarding the processing or existence of a water concession. Because we cannot rule ultra petita (beyond the relief requested) and because Article 18 of the Ley de Agua provides that AyA shall register the water sources it uses to provide the service it is legally required to furnish—and, according to your letter, this is not such a case—we hereby grant your request to remove the flow from well AB-1477, registered in AyA’s name, from the Registro Nacional de Concesiones y Cauces.
I must also state that, because the entity you represent is legally responsible for supplying water to the population and is also the technical governing authority for the sector, we understand that it is the entity called upon to resolve these types of problems so that no legal difficulties arise concerning the use and disposition of the water and well in question, thereby ensuring that the population served is guaranteed the Human Right of Access to Water (Derecho Humano de Acceso al Agua), since deregistration of the well leaves the population served in the condominiums outside the law (…)” (see the evidence submitted by the Director of the UEN Gestión Ambiental of ICAA, added to the digital case file).
As of 31 de julio de 2020, the date on which the Director de Aguas del MINAE submitted his report, the application to deregister (desinscripción) the well in question “(…) is under review. However, if the well is deregistered, the residents of Condominio Villas del Río must seek another source, since the well cannot be used by that condominium because it is located in another condominium, which is neither a public-service provider nor holds a water concession (concesión de agua). To date, neither condominium is entitled to use the water from well AB-1477 because they have not had and do not have a water concession granted by MINAE (…)” (see the report of the Director de Agua del MINAE, official letter No. DA-1135-2020 of 31 de julio de 2020, added to the digital case file).
III.Unproven fact (hecho no probado). The following sole fact, which is material to deciding this matter, is deemed unproven: that, prior to deregistering well No. AB – 1477, the necessary precautions were taken to guarantee the protected party and the residents of the condominiums supplied by it a supply of drinking water through an alternative means or method.
IV.Background. In her report, the Directora de la UEN Gestión Ambiental del ICAA drew attention to the fact that the Sala Constitucional had occasion to hear two cases that, in her opinion, were related to the issue raised in the case at bar (sub lite). Indeed, in judgment No. 2019-024832 at 09:15 hours on 13 de diciembre de 2019, amparo proceeding (recurso de amparo) No. 19-021831-0007-CO was examined, the subject matter of which was as follows:
“(…) I.- SUBJECT MATTER OF THE PROCEEDING. The petitioner considers that his fundamental rights have been infringed. He states that he owns lot No. 37, with subsidiary property No. 102563-F-000, located in Condominio Horizontal Residencial Villas del Río, located in la Guácima de Alajuela. He alleges that, through official letter No. AL-01 19-2019 of 13 de mayo de 2019 from the Asesoría Legal del Ministerio del Ambiente y Energía, the UEN Gestión Ambiental del Instituto Costarricense de Acueductos y Alcantarillados was required to clarify the status of the water well that supplies water resources to the condominiums Villanea and Villas del Río. The Municipalidad de Alajuela was also ordered not to authorize any further construction in those developments. He asserts that, although several months have passed, the UEN Gestión Ambiental del Instituto Costarricense de Acueductos y Alcantarillados has not issued any response to the request.
He complains that, on the basis of that order, he was denied a land-use authorization (uso de suelo) to build on his lot (…) Nevertheless, it was not until 21 de noviembre de 2019 that, through official letter No. GG-2019-04071, of 21 de noviembre de 2019, signed by Manuel Salas Pereira, Gerente General del Instituto Nacional de Acueductos y Alcantarillados, they received the requested information and learned that AyA had not assumed responsibility for providing service to the condominiums, since AyA was requesting deregistration of the well, thereby leaving the condominiums, including Condominio Residencial Villas del Río, where the petitioner’s property is located, without an operating water supply. In this regard, the petitioner should be advised that, concerning his complaint about the order issued by the respondent authority not to grant land-use authorizations, this Chamber is not a supervisory body for the legality of administrative actions or decisions and therefore has no jurisdiction to review, under the applicable subconstitutional rules, whether the order prohibiting the granting of the aforementioned land-use authorization is proper, since this is a matter of ordinary legality.
Consequently, the petitioner may, if he sees fit, present his arguments to the respondent authority itself or, failing that, through the ordinary judicial process, forums in which he may fully litigate the merits of the matter and assert his claims. In view of the foregoing, the proceeding is dismissed with respect to this issue (…)”.
Additionally, by judgment No. 2020-012850 at 09:15 hours on 10 de julio de 2020, amparo proceeding No. 20-009213-0007 was decided, in which the following was discussed:
“(…) I.- Subject matter of the proceeding. The petitioner alleges that, because ICAA ordered MINAE to deregister well AB-1477, which is located in condominio Villanea and is also used by Condominio Villas del Rio, where he owns lot 41, the Municipalidad de Alajuela will not issue him a land-use authorization to build due to the lack of water resources. Furthermore, according to ICAA, the vital liquid will not be able to be supplied through well AB-2577 for another two years, a situation that falls short of a prompt and timely solution to the reported problem. He also complains of the lack of a response to the inquiries regarding that problem that he sent by email on 8 de mayo de 2020 to ICAA and MINAE (…) in this matter, the petitioner seeks the following: 1) That MINAE lift the restriction applied to the granting of land-use authorizations and notify the Municipalidad de Alajuela accordingly. 2) That a precautionary measure (medida cautelar) be imposed on the Municipalidad de Alajuela so that it grants the land-use authorization, given that, when the restriction was imposed, AyA had well AB-1477 registered in its name. 3 That AyA immediately assume responsibility for supplying the water resources through the already existing well AB-1477 (…) with respect to item 3), it should be noted that determining whether ICAA must provide the service using water from well AB-1477 involves a dispute concerning ordinary legality that cannot be adjudicated by this Constitutional Court, since it does not involve, at least directly, any fundamental right (in this regard, it is emphasized that the petitioner does not reside on the property in question but instead seeks the availability of that service as a prerequisite for beginning construction).
The same applies to determining whether the technical requirements for providing the service have been met. It should be noted that an amparo proceeding is essentially a summary proceeding governed by simplicity or, in the terms of article 25 of the American Convention on Human Rights, a remedy that must be simple and prompt. Consequently, when it is necessary to review various administrative actions—procedures and formal acts reflected and embodied in an administrative case file—the matter ceases to fall within the scope of amparo, because recourse must be had to a plenary proceeding, that is, a proceeding involving full adjudication that may be conducted only before the ordinary courts. Amparo is not designed to compare or review technical or legal opinions rendered in light of the subconstitutional legal system, or to take new evidence to compare with the evidence contained in an administrative case file that has been processed deliberately over extended periods, as occurred with the water well at issue.
Consequently, the petitioner may, if he sees fit, present his arguments to the respondent authorities themselves or, failing that, through the ordinary judicial process, forums in which he may fully litigate the merits of the matter and assert his claims. In view of the foregoing, the proceeding is dismissed with respect to this issue (…)”.
From the foregoing quotations, the following conclusions may be drawn: a) the subject matter of amparo proceeding No. 19-021831-0007-CO differs from that of the present proceeding, since the former examined an alleged failure by ICAA to respond and the municipality’s refusal to grant land-use authorizations; b) the same may be said of amparo proceeding No. 20-009213-0007, which also examined the prohibition on granting land-use authorizations; and c) it is true that amparo proceeding No. 20-009213-0007 expressly requested “(…) That AyA immediately assume responsibility for supplying the water resources through the already existing well AB-1477 (…)”, and, in that regard, stated “(…) that determining whether ICAA must provide the service using water from well AB-1477 involves a dispute concerning ordinary legality that cannot be adjudicated by this Constitutional Court, since it does not involve, at least directly, any fundamental right (…)”; however, it also emphasized “(…) (in this regard, it is emphasized that the petitioner does not reside on the property in question but instead seeks the availability of that service as a prerequisite for beginning construction) (…)”.
In the case at bar, unlike the aforementioned amparo proceeding, the protected party stated that she resides in Condominio Horizontal Residencias Villas del Río—which was not disputed or denied by the respondents—making it possible to conclude, prima facie, that her right of access to drinking water may have been, at the very least, threatened by the conduct of the respondent authorities. Having clarified the foregoing, the merits of the matter are considered and decided as required by law.
V.The specific case. First and foremost, it must be made clear that it is not for this Court to determine whether well No. AB – 1477 should or should not have been registered or deregistered in ICAA’s name; still less is it for this Chamber to determine whether the developers of the condominiums, specifically Condominio Horizontal Residencial Villas del Río, obtain drinking water in violation of the subconstitutional legal system; nor is this the forum in which the Administration’s legal liability for any irregularities that may or may not have occurred must be determined. All of the foregoing exceeds the summary nature of the amparo proceeding, as well as the jurisdiction of this Sala Constitucional, as defined by law and by the Constitución Política itself. Any dispute in this regard must be raised and resolved either through the administrative process itself or before the appropriate ordinary court with jurisdiction over legality.
VI.That said, in the case at hand (sub lite), it was duly established that the ICAA requested the deregistration (desinscripción) of well No. AB – 1477 through official letter No. GG-2019-04071 of 21 de noviembre de 2019, 8 years after having applied for its registration (inscripción) for public water supply (abastecimiento poblacional) purposes (through official letter No. PRE – 0270-2011 of 29 de abril de 2011). For its part, the Dirección de Agua del MINAE did not decide to conduct an inspection of the site until 9 de noviembre de 2017, even though it had ordered the well registered in the name of the ICAA as of 21 de junio de 2011. Likewise, it was not until 17 de mayo de 2019 that the Dirección de Agua del MINAE decided to inquire with the ICAA regarding the status of the well. In addition to the foregoing, in his sworn report, the Director de Agua del MINAE stated that, as of 31 de julio de 2020, the deregistration request submitted by the ICAA: “(…) is undergoing review (…)”; however, in official letter No. 0900-2020 of 4 de junio de 2020, he had informed the Gerencia General del ICAA: “(…) we hereby proceed to address your request to deregister the flow rate (caudal) of well AB-1477, registered in the name of AyA in the Registro Nacional de Concesiones y Cauces (…)”.
From the foregoing, it may be concluded that the Administration’s handling of the underlying problem has been marked by evident neglect, inertia, inattention, contradiction, and lack of coordination, thereby infringing the protected party’s right of access to drinking water (agua potable), as well as that of the residents of the condominiums supplied with drinking water through well No. AB – 1477; particularly considering that the deregistration of the well in question is intended to be carried out or has already been carried out (this is unclear, given the aforementioned contradiction by the Dirección de Aguas del MINAE), without proof that drinking water has been provided through an alternative means or method. The ICAA certainly cannot disregard this problem, since, pursuant to article 2.a) of its Ley Constitutiva, it is responsible for: “(…) a) Directing and overseeing all matters necessary to provide the inhabitants of the republic with drinking-water services and with the collection and disposal of sewage, liquid industrial waste, and stormwater in urban areas (…)”.
Nor may the Dirección de Agua del MINAE disregard it, since, under article 41 of the Reglamento Orgánico del Ministerio de Ambiente y Energía, its functions include: “(…) g. Operating and keeping the Sistema Nacional de información sobre el recurso up to date (…) l. Addressing complaints and disputes concerning water resources (recurso hídrico) and resolving them in accordance with the applicable legislation (…) m. Monitoring and following up on water-use concessions (concesiones de aprovechamiento de aguas) and other authorizations (…)”. Accordingly, this Constitutional Chamber must intervene by ordering the respondent authorities to undertake the necessary coordination and carry out all actions within the scope of their authority to ensure access to drinking water for the persons supplied by well No. AB – 1477, in the manner or by the means or mechanism technically or legally appropriate, while the irregularities concerning its use, registration, and deregistration are finally resolved.
VII.The order issued includes the Gerencia General del ICAA because that was the authority upon which notice of the proceeding was served; the Directora de la UEN Gestión Ambiental del ICAA appeared in its place, without providing further details justifying her doing so.
VIII.Conclusion. In view of the foregoing, the appeal must be granted, with the consequences specified in the operative portion (parte dispositiva) of this judgment.
IX.Documentation submitted to the case file (expediente). The parties are hereby advised that, if they submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device or produced using new technologies, such materials must be collected from the court office within a maximum period of 30 business days from notification of this judgment. Otherwise, any material not collected within that period shall be destroyed, as provided in the “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, approved by the Corte Plena at session No. 27-11 of 22 de agosto de 2011, article XXVI, and published in the Boletín Judicial No. 19 of 26 de enero de 2012, as well as in the resolution approved by the Consejo Superior del Poder Judicial at session No. 43-12 held on 3 de mayo de 2012, article LXXXI.
Por tanto:
The appeal is granted. The person holding the office of Gerente General, as well as Viviana Ramos Sánchez, Directora de la UEN Gestión Ambiental, or whoever serves in that position, both of the Instituto Costarricense de Acueductos y Alcantarillados (ICAA), and José Miguel Zeledón Calderón, in his capacity as Director de Aguas del Ministerio de Ambiente y Energía (MINAE), or whoever holds that office in his stead, are ordered to undertake the necessary coordination and carry out all actions within the scope of their authority so that: a) within SIX MONTHS from notification of this judgment, the problem concerning the registration, deregistration, and use of well No. AB – 1477 is resolved; and b) in the meantime, all measures necessary to ensure access to drinking water for the persons supplied by well No. AB – 1477 are adopted, in the manner or by the means or mechanism technically or legally appropriate; whatever decision is ultimately adopted, service must be guaranteed until a permanent solution to the underlying problem is implemented.
The respondent authorities are warned that, pursuant to article 71 of the Ley de la Jurisdicción Constitucional, any person who receives an order issued in a writ of amparo proceeding (recurso de amparo), which that person is required to comply with or enforce, and fails to comply with or enforce it, shall be punished by imprisonment for three months to two years, or by a fine of twenty to sixty day-fines, provided that the offense is not subject to a more severe penalty. The State and the Instituto Costarricense de Acueductos y Alcantarillados (ICAA) are ordered to pay the legal costs, damages, and losses caused by the facts forming the basis of this ruling, which shall be assessed in the administrative litigation enforcement proceeding (ejecución de sentencia de lo contencioso administrativo). Let notice be given.

Revisión del Documento *200131520007CO* SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas quince minutos del catorce de agosto de dos mil veinte .
Recurso de amparo interpuesto por YERLING ANDREA RODRÍGUEZ RAMÍREZ, cédula de identidad No. 0115170343, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (ICAA) Y EL MINISTERIO DE AMBIENTE Y ENERGÍA (MINAE).
Resultando:
Redacta el Magistrado Araya García; y,
Considerando:
I.Objeto del recurso. La recurrente adujo que mediante el oficio No. GG-2019-04071 del 21 de noviembre de 2019, el ICAA solicitó a la Dirección de Agua del MINAE, desinscribir el pozo AB-1477, sin brindar otra opción para proporcionar de una manera alternativa, el líquido a los condominios afectados, entre ellos el Condominio Horizontal Residencial Villas del Río. Consideró violentado el derecho de acceso al agua potable.
II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
La tutelada reside en el Condominio Horizontal Residencial Villas del Río (hecho incontrovertido).
En el año 1993, se tramitó ante la Dirección de Agua del MINAE, un permiso de perforación del pozo AB-1477, por parte de Ramón y Rafael Villanea V., para uso doméstico y abrevadero (ver el informe del Director de Agua del MINAE, así como la prueba aportada, agregados al expediente digital).
El 5 de diciembre de 2008, se presentó ante la Dirección de Agua del MINAE, una solicitud de concesión a nombre de Fideicomisos del Coco S.A., para realizar aprovechamiento del pozo en la propiedad de su representada (No. AB – 1477), para 10 personas; a la gestión se le asignó el expediente No. 13206-P (ver el informe del Director de Agua del MINAE, así como la prueba aportada, agregados al expediente digital).
El 19 de octubre de 2009, se presentó al citado expediente, una solicitud de cambio de uso de agua, señalando que sería para autoabastecimiento en condominio de 438 personas (ver el informe del Director de Agua del MINAE, así como la prueba aportada, agregados al expediente digital).
El 16 de marzo de 2011, uno de los representantes del Fideicomiso del Coco S.A., comunicó a la Dirección de Agua del MINAE, que el pozo No. AB – 1477 fue cedido al ICAA (ver el informe del Director de Agua del MINAE, así como la prueba aportada, agregados al expediente digital).
Mediante el oficio No. PRE – 0270-2011 de 29 de abril de 2011, la Dirección de Agua del MINAE recibió por parte del ICAA, la comunicación de que el pozo sería utilizado por la institución para abastecimiento poblacional (ver el informe del Director de Agua del MINAE, así como la prueba aportada, agregados al expediente digital).
Por medio del oficio No. DA-2659-2011 de 21 de junio de 2011, la Dirección de Agua del MINAE inscribió a nombre del ICAA, el pozo No. AB – 1477 (ver el informe del Director de Agua del MINAE, así como la prueba aportada, agregados al expediente digital).
Mediante el oficio No. DA – 1161-2011 de 23 de marzo de 2011, se dispuso archivar el expediente No. 13206-P, “(…) No obstante, lo anterior, ante esta Dirección, se tiene presentados además del trámite del expediente 13206-P que se encuentra archivado, cuatro expedientes más. A saber: el expediente 13745-P a nombre de E Hijos Magunro S.A; 14315-P, 14316-P a nombre de Ardos de La Guácima. Estos últimos se integraron bajo un solo expediente 14315-P. Ninguno de ellos cuenta con concesión otorgada, todos solicitando concesión del pozo AB-1477 (…)”. Estos expedientes también fueron archivados, debido a la solicitud de inscripción planteada por el ICAA (ver el informe del Director de Agua del MINAE, así como la prueba aportada, agregados al expediente digital).
El 9 de noviembre de 2017, la Dirección de Agua del MINAE llevó a cabo una investigación de campo en el sitio donde se encuentra el pozo No. AB – 1477, con el siguiente resultado: “(…) genera el informe DA-UHTPCOSJ-3252-2017, suscrito por parte de la Geóloga Mariel González, funcionaria de la Dirección de Agua del MINAE, quien informa que conversó con el guarda del condominio Villas del Río, quien le manifestó que en el sitio no existe pozo alguno y que el agua, se obtiene del pozo ubicado en Condominio Villanea. El pozo que se ubica en este condominio Villanea es el mismo AB-1477 inscrito a nombre del AyA, sin que conste concesión alguna a favor del Condominio Villanea. No obstante, señala que el pozo está siendo explotado por el condominio y que del pozo salen cuatro tuberías: una que va al tanque de almacenamiento, otra que va al tanque de distribución del condominio Villanea, otra que va al tanque de distribución del condominio Villas del Río y una cuarta que no sabe a dónde va, según manifestaciones del guarda, va para la red de distribución del Condominio Villalobos (…)” (ver el informe del Director de Agua del MINAE, así como la prueba aportada, agregados al expediente digital).
Mediante el oficio No. AL – 0119-2019 de 17 de mayo de 2019, como consecuencia de la inspección, dado que el pozo supuestamente debía estar siendo administrado por el ICAA, la Dirección de Agua del MINAE, realizó la respectiva consulta (ver el informe del Director de Agua del MINAE, así como la prueba aportada, agregados al expediente digital).
Mediante el oficio No. GG-2019-04071 de 21 de noviembre de 2019, el Gerente General del ICAA solicitó a la Dirección de Agua del MINAE, desinscribir el pozo No. AB-1477, pues nunca fue utilizado por la entidad (ver el informe del Director de Agua del MINAE, así como la prueba aportada, agregados al expediente digital).
El 17 de enero de 2020, mediante el oficio No. GG-2020-00145, la Gerencia General del ICAA, consultó a la Dirección de Agua del MINAE, lo siguiente: “(…) En atención al oficio GG- 2019-04071, en el cual se solicitó la desinscripción del pozo AB – 1477 (…) requerimos muy amablemente se nos actualice el estado de dicha gestión, ya que en el SINIGIRH (consulta del 09 de enero de 2020) aún está inscrito dicho caudal a nombre del AyA (…)” (ver la prueba aportada por la Directora de la UEN Gestión Ambiental del ICAA, agregada al expediente digital).
El 4 de junio de 2020, mediante el oficio No. DA – 0900-2020, la Dirección de Agua del MINAE, contestó a la Gerencia General del ICAA, lo siguiente: “(…) En atención al oficio GG-2019-04071 del 21 de noviembre del 2019 y oficio GG-2020- 00145 del 15 de enero de 2020; le indico que no se había contestado en tanto prevalece la inquietud en la Dirección si su institución tiene en consideración el problema que impera en el sitio y con su oficio se está manteniendo al descubierto el servicio de abastecimiento de agua de la población servida con el pozo AB-1477, actual y futura, y que a raíz de que el mismo AyA, entendemos, nunca lo asumió, siendo que originalmente la gestión que su institución realizó era dar el servicio y por ello solicitó la inscripción original de este pozo. Desde el año 2011 el caudal extraído del pozo AB-1477 se encuentra inscrito a nombre de su representada, a solicitud expresa de ustedes.
A la fecha, de este pozo se surten varios condominios. Por su parte conforme su oficio, nos recuerda que no es viable legalmente conforme el criterio de la Procuraduría General de la República C-236-2008, el abastecimiento entre sujetos de derecho privado, localizados en folios reales distintos; no obstante, nos recomienda emitir disponibilidades para que los interesados puedan continuar con el trámite, lo que evidentemente va contra ley. No podemos ni vamos a proceder con esto, además la Dirección de Agua no emite cartas de disponibilidad, reservado a entes operadores de servicios, lo que emitimos son constancias o certificación de trámite o existencia de concesión de agua. Siendo que no podemos resolver ultra petita y conforme lo dispone el artículo 18 de la Ley de Agua, el AyA inscribe las fuentes de agua con que abastece el servicio que por Ley brinda, no siendo este el caso por lo que indica en su oficio, se procede a atender su solicitud de desinscribir el caudal del pozo AB-1477 registrado a nombre de AyA de Registro Nacional de Concesiones y Cauces.
No quiero dejar de manifestar, que al ser su representada, por ley, la responsable por del abastecimiento de agua a la población pero además Rector técnico del sector, entendemos que es la llamada a solventar este tipo de problemas con el propósito de que no se tengan dificultades legales para el uso y disposición del agua y pozo de cita, con el fin que la población servida tenga garantizado el Derecho Humano de Acceso al Agua, esto en razón de que con las desinscripción del pozo la población servida de los condominios queda al margen de la ley (…)” (ver la prueba aportada por la Directora de la UEN Gestión Ambiental del ICAA, agregada al expediente digital).
Para el 31 de julio de 2020, fecha en la cual el Director de Aguas del MINAE rindió su informe, la solicitud de desincripción del pozo en cuestión “(…) se encuentra en proceso de análisis. No obstante, en caso de desinscribir el pozo, los vecinos del Condominio Villas del Río deben de buscar otra fuente, toda vez que el pozo no puede ser utilizado por dicho condominio, al estar éste ubicado en otro condominio, quien no es un prestador del servicio público, ni cuenta con concesión de agua. A la fecha ninguno de los Condominios tiene derecho a aprovechar el agua del pozo AB-1477 toda vez, que no han tenido y no tienen concesión de agua otorgada por el MINAE (…)” (ver el informe del Director de Agua del MINAE, oficio No. DA-1135-2020 de 31 de julio de 2020, agregado al expediente digital).
III.Hecho no probado. De importancia para resolver el presente asunto, se estima como no demostrado el siguiente hecho: único.- que previo a desinscribir el pozo No. AB – 1477, se hayan tomado las previsiones necesarias para garantizar a la tutelada y los habitantes de los condominios que se abastecen del mismo, la dotación del agua potable a través de un medio o forma alternativos.
IV.Antecedentes. En su informe, la Directora de la UEN Gestión Ambiental del ICAA, llamó la atención sobre el hecho que la Sala Constitucional tuvo la oportunidad de conocer dos casos, en su criterio, relacionados con lo planteado en el sub lite. En efecto, mediante la sentencia No. 2019-024832 de las 09:15 horas de 13 de diciembre de 2019, se analizó el recurso de amparo No. 19-021831-0007-CO, cuyo objeto era el siguiente:
“(…) I.- OBJETO DEL RECURSO. El recurrente estima lesionados sus derecho fundamentales. Refiere que es propietario del lote No. 37, con finca filial No. 102563-F-000, localizado en el Condominio Horizontal Residencial Villas del Río, localizado en la Guácima de Alajuela. Acusa que mediante el oficio de la Asesoría Legal del Ministerio del Ambiente y Energía No. AL-01 19-2019 del 13 de mayo de 2019, se le requirió a la UEN Gestión Ambiental del Instituto Costarricense de Acueductos y Alcantarillados que aclarara la condición del pozo de agua que suministra el recurso hídrico a los condominios Villanea y Villas del Río. Asimismo, se ordenó a la Municipalidad de Alajuela que no autorizara más construcciones en esos proyectos. Afirma que pese a que han pasado varios meses, la UEN Gestión Ambiental del Instituto Costarricense de Acueductos y Alcantarillados no ha emitido repuesta alguna a lo pedido.
Reclama, que con fundamento en dicha orden, le denegaron el otorgamiento de uso de suelo para construir en el lote de su propiedad (…) No obstante, no fue hasta el 21 de noviembre de 2019, cuando mediante el oficio No. GG-2019-04071, del 21 de noviembre de 2019, suscrito por Manuel Salas Pereira, Gerente General del Instituto Nacional de Acueductos y Alcantarillados, recibieron la información solicitada, dándose por enterados que el AyA no asumió su responsabilidad de servicio en los condominios, puesto que el AyA solicita desinscribir el pozo, por ende, dejando sin operación del agua a los condominios, entre estos el Condominio Residencial Villas del Río, donde se encuentra ubicada la propiedad del recurrente. Al respecto, es dable indicar al recurrente, que en relación con su reclamo en cuanto a la orden emanada por la autoridad recurrida, de no otorgar permisos de uso de suelo, se advierte que esta Sala no es un contralor de la legalidad de las actuaciones o resoluciones de la Administración, de modo que no le compete revisar la procedencia de conformidad con la normativa infraconstitucional vigente, si procede o no la orden emanada referente a la prohibición de otorgar el uso de suelo referido, pues se trata de una cuestión de legalidad común.
Por consiguiente, deberá el recurrente, si a bien lo tiene, plantear sus alegatos ante la propia autoridad accionada o, en su defecto, en la vía jurisdiccional ordinaria, sedes en las cuales podrá, en forma amplia discutir el fondo del asunto y hacer valer sus pretensiones. En virtud de lo expuesto, se declara sin lugar el recurso en cuanto a este extremo (…)”.
Adicionalmente, por medio de la sentencia No. 2020-012850 de las 09:15 horas de 10 de julio de 2020, se resolvió el recurso de amparo No. 20-009213-0007, en el que se discutió:
“(…) I.- Objeto del recurso. El recurrente alega que debido a que el ICAA ordenó al MINAE la desinscripción del pozo AB-1477, que se encuentra en el condominio Villanea y que también es utilizado por el Condominio Villas del Rio, donde es propietario del lote 41, la Municipalidad de Alajuela no le extiende el permiso de uso de suelo para construir por falta del recurso hídrico. Además, según el ICAA, hasta dentro de dos años se podrá suministrar el preciado líquido mediante el pozo AB-2577, situación que se aleja de una solución pronta y oportuna al problema denunciado. También reclama falta de respuesta de las consultas que sobre ese problema remitió el 8 de mayo de 2020, vía correo electrónico, ante el ICAA y el MINAE (…) en este asunto la pretensión del recurrente es la siguiente:
De la lectura de lo transcrito, es posible concluir lo siguiente: a) el objeto del recurso de amparo No. 19-021831-0007-CO, es distinto al del presente proceso, pues en aquél se estudió una supuesta falta de respuesta por parte del ICAA y la negativa municipal a otorgar usos de suelos, b) lo mismo cabe decir en cuanto al recurso de amparo No. 20-009213-0007, en el que también se analizó lo relativo a la prohibición del otorgamiento de usos de suelos y, c) ciertamente en el recurso de amparo No. 20-009213-0007 expresamente se pidió “(…) Que el AyA se haga responsable del abastecimiento del recurso hídrico mediante el pozo AB-1477, ya existente, de forma inmediata (…)”, y sobre el particular se señaló “(…) que dilucidar si el ICAA debe brindar el servicio tomando el agua del pozo AB-1477, obedece a un conflicto de legalidad ordinaria, no dirimible en este Tribunal Constitucional, toda vez que no involucra, al menos en forma directa, derecho fundamental alguno (…)”, lo cierto es que también se enfatizó “(…) (en este sentido, se subraya que el recurrente no habita en la finca aludida, sino que pretende la disponibilidad del servicio aludido como requisito previo para iniciar una construcción) (…)”.
En el sub lite, a diferencia del recurso de amparo en mención, la amparada aseguró que reside en el Condominio Horizontal Residencias Villas del Río (lo que no fue cuestionado o desmentido por los recurridos), lo que permite afirmar, prima facie, que su derecho de acceso al agua potable pudo verse, cuando menos, amenazado por el proceder de las autoridades recurridas. Teniendo claro lo expuesto, se conoce el fondo del asunto y se resuelve conforme a Derecho corresponde.
V.Sobre el caso concreto. Ante todo se debe dejar claro que no le corresponde a este Tribunal definir si el pozo No. AB – 1477 debió o no ser inscrito o desinscrito a nombre del ICAA; mucho menos corresponde a esta Sala determinar si los desarrolladores de los Condominios, en específico el Condominio Horizontal Residencial Villas del Río, se abastecen o no del agua potable al margen del ordenamiento jurídico infraconstitucional; tampoco es en esta instancia donde se debe precisar la responsabilidad legal de la Administración por las irregularidades que puedan o no estarse presentado. Todo lo anterior excede la naturaleza sumaria del recurso de amparo, así como la competencia de esta Sala Constitucional, definida por la Ley y la propia Constitución Política. Cualquier discusión sobre el particular debe ser planteada y resuelta sea en la propia sede administrativa, o ante la jurisdicción de legalidad ordinaria que corresponda.
VI.Ahora bien, en el sub lite quedó debidamente demostrado que el ICAA solicitó la desinscripción del pozo No. AB – 1477, por medio del oficio No. GG-2019-04071 de 21 de noviembre de 2019, 8 años después de haber gestionado su inscripción para abastecimiento poblacional (mediante el oficio No. PRE – 0270-2011 de 29 de abril de 2011). Por su parte, la Dirección de Agua del MINAE decidió efectuar una inspección del lugar hasta el 9 de noviembre de 2017, pese a que había dispuesto la inscripción del pozo a nombre del ICAA desde el 21 de junio de 2011. Asimismo, fue hasta el 17 de mayo de 2019, que la Dirección de Agua del MINAE, decide consultar al ICAA sobre el estado del pozo. Aunado a lo anterior, en su informe rendido bajo juramento el Director de Agua del MINAE señaló que para el 31 de julio de 2020, la solicitud de desinscripción planteada por el ICAA: “(…) se encuentra en proceso de análisis (…)”; sin embargo, en el oficio No. 0900-2020 de 4 de junio de 2020, había indicado a la Gerencia General del ICAA: “(…) se procede a atender su solicitud de desinscribir el caudal del pozo AB-1477 registrado a nombre de AyA de Registro Nacional de Concesiones y Cauces (…)”.
De lo expuesto es posible concluir que en el manejo del problema de fondo existe una evidente desidia, inercia, desatención, contradicción y descoordinación por parte de la Administración, que atenta contra el derecho de acceso al agua potable de la tutelada y de los habitantes de los condominios que se abastecen de agua potable, mediante el pozo No. AB – 1477; sobre todo si se toma en cuenta que la desinscripción del pozo en cuestión se pretende efectuar o se efectuó (no queda claro, dada la contradicción apuntada en la que incurre la Dirección de Aguas del MINAE), sin acreditar haber dispuesto la dotación del agua potable a través de un medio o forma alternativos. Ciertamente el ICAA no puede desentenderse de la problemática, pues de conformidad con el artículo 2.a) de su Ley Constitutiva le corresponde: “(…) a) Dirigir y vigilar todo lo concerniente para proveer a los habitantes de la república de un servicio de agua potable, recolección y evacuación de aguas negras y residuos industriales líquidos y de aguas pluviales en las áreas urbanas (…)”.
Tampoco lo puede la Dirección de Agua del MINAE, pues a tenor del artículo 41 del Reglamento Orgánico del Ministerio de Ambiente y Energía, son sus funciones: “(…) g. Operar y mantener actualizado el Sistema Nacional de información sobre el recurso (…) l. Atender las denuncias y controversias en materia de recurso hídrico, resolverlas conforme lo dispuesto en la legislación (…) m. Control y seguimiento de las concesiones de aprovechamiento de aguas y otras autorizaciones (…)”. Así las cosas, esta Sala Constitucional debe intervenir, ordenando a las autoridades recurridas que coordinen lo necesario y lleven a cabo todas las actuaciones que estén dentro del ámbito de sus competencias, para que se garantice el acceso al agua potable a las personas que se abastecen del pozo No. AB – 1477, a través de la forma o utilizando el medio o mecanismo que técnica o legalmente corresponda, mientras se resuelven en definitiva las irregularidades que existen respecto de su utilización, inscripción y desinscripción.
VII.Se incluye en la orden girada a la Gerencia General del ICAA, por ser a esa autoridad a la que se le dio traslado; apersonándose en su lugar la Directora de la UEN Gestión Ambiental del ICAA, sin brindar mayor detalle de la justificación para tal.
VIII.Conclusión. En mérito de lo expuesto, se impone declarar con lugar el recurso, con las consecuencias que se especifican en la parte dispositiva de esta sentencia.
IX.Documentación aportada al expediente. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión No. 27-11 del 22 de agosto de 2011, artículo XXVI y publicado en el Boletín Judicial No. 19 del 26 de enero de 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión No. 43-12 celebrada el 3 de mayo de 2012, artículo LXXXI.
Por tanto:
Se declara con lugar el recurso. Se le ordena a quien ocupe el cargo de Gerente General, así como a Viviana Ramos Sánchez, Directora de la UEN Gestión Ambiental, o a quien funja en ese puesto, ambos del Instituto Costarricense de Acueductos y Alcantarillados (ICAA), así como a José Miguel Zeledón Calderón, en su condición de Director de Aguas del Ministerio de Ambiente y Energía (MINAE), o quien en su lugar ocupe ese cargo, que coordinen lo necesario y lleven a cabo todas las actuaciones que estén dentro del ámbito de sus competencias, para que: a) dentro del plazo de SEIS MESES, contado a partir del momento en que se notifique esta sentencia, se solucione el problema que existe en cuanto a la inscripción, desinscripción y utilización del pozo No. AB – 1477 y, b) mientras tanto, se adopten todas las medidas que resulten necesarias para garantizar el acceso al agua potable a las personas que se abastecen del pozo No. AB – 1477, a través de la forma o utilizando el medio o mecanismo que técnica o legalmente corresponda; cualquiera que sea la decisión que finalmente se adopte, se debe garantizar el servicio hasta la implementación de una solución definitiva al problema de fondo.
Se advierte a las autoridades recurridas que, de conformidad con lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado y al Instituto Costarricense de Acueductos y Alcantarillados (ICAA), al pago de las costas, daños y perjuicios causados con los hechos que sirven de fundamento a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo.
