Review of the Document *200128860007CO* Case File: 20-012886-0007-CO Decision No. 2020015177 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine fifteen on catorce de agosto de dos mil veinte.
Petition for constitutional relief (recurso de amparo) being processed under expediente número 20-012886-0007-CO, filed by JEFRY ANDREY VALVERDE PIEDRA, identification card 0112690177, against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS AND THE MINISTERIO DE SALUD.
BACKGROUND:
He explains that, under the regulations in force governing the respondent Instituto, particularly the “Reglamento Técnico Prestación de los Servicios de Acueducto, Alcantarillado Sanitario e Hidrantes, AR-PSAYA-2015,” Article 33 provides that the service provider is required to offer subscribers an alternative drinking-water supply service when a service suspension lasts longer than eight consecutive hours. He considers that, in this particular case, the disruption requires no additional measures beyond informing the public as provided by the regulations in force. He explains that: “(...) the Instituto Costarricense de Acueductos y Alcantarillados (AyA) has launched the ‘Mejoras en Abastecimiento de Agua Potable de la GAM’ program, comprising 8 infrastructure investment projects totaling 23 short- and medium-term works, with a total investment of ₡31.137 millones, to minimize the impact of the water shortages affecting the Acueducto Metropolitano.
The emergency projects comprising these 23 works, their completion percentage, the date on which each project began and its estimated completion date, and the number of people who would benefit... It should be noted that the completion dates range from the end of this year and, in some cases, extend through 2023.” He states that the respondent Instituto is carrying out other projects intended to address the current water deficit affecting the Acueducto Metropolitano, including: “• BPIP N° 02603 Improvements to the drinking-water distribution network for the central sector of the canton of Escazú. Scheduled for completion in the III Four-Month Period of 2024.” He recounts that, for the area in question, to mitigate the low production of drinking water at the Guatuso de Patarrá de Desamparados plant and the high demand in this sector, Zone II of the GAM will undertake a project to capture an additional source of approximately six l/s in the Guatuso mountains. He states that the work consists of installing seventy linear meters of pipe, one hundred mm in diameter, through the mountains from the indicated intake to the Guatuso drinking-water treatment plant, and that the project will be carried out during the next quarter because the pipe and other materials needed for installation must first be acquired.
He states that the permanent solution to the supply problems for approximately the next twenty years is the Quinta Etapa del Acueducto Metropolitano project, also known as the “Proyecto Ampliación Acueducto Metropolitano,” which is intended to increase production benefiting the Gran Área Metropolitana by up to two thousand five hundred liters per second. He considers that the respondent institution: “has acted in accordance with the regulations governing it, without arbitrarily manipulating the provision of the service, and has at all times undertaken duly substantiated and reasoned actions, as detailed above; it is therefore evident that the Instituto has acted in accordance with the law and that none of its actions has violated any constitutional right. On the contrary, the arguments presented and the evidence submitted support the conclusion that AyA has in fact acted as required.” He asks the Chamber to dismiss the petition.
Justice Salazar Alvarado drafted the decision; and,
CONSIDERING:
The petitioner considers that his fundamental rights have been infringed because he is a resident of Patarrá in Desamparados and, in the residential development where he lives, there have been excessive interruptions in the drinking-water supply for approximately four months, lasting up to seven hours, and because, although the respondent Instituto posts weekly notices on social media identifying the area where the water resource will be rationed, the announced schedule is not followed. Furthermore, two months ago, it announced that there would be no further water shortages.
The following facts are deemed duly established and relevant to the determination of this matter, either because they have been proven or because the respondent failed to address them as ordered in the initial ruling:
As the respondent authorities of the Instituto Costarricense de Acueductos y Alcantarillados correctly state, this Court has maintained a settled line of precedent (línea jurisprudencial) holding that individuals’ fundamental rights are not violated insofar as it is demonstrated that action has been taken within the limits of available resources to secure an adequate supply of drinking water. However, in view of the current public-health crisis affecting the country as a result of the pandemic caused by the COVID-19 coronavirus, it became necessary to reconsider that standard in Judgment No. 2020-007754, rendered at 09:45 hours on 24 de abril de 2020. The Court stated as follows:
“…With respect to this matter, as occurred in the cited precedents, the Chamber observes that, in principle, the lack of drinking-water service is attributable to a supply shortage. Nevertheless, the national emergency caused by COVID-19 makes it necessary for this Court to reconsider the aforementioned position. In this regard, the record shows not only that the water-supply shortage had been occurring since 2017, but also that ARESEP specifically noted that ICAA had fallen behind in infrastructure investment and, furthermore, had sustained significant losses from unaccounted-for water. The regulatory authority likewise stated that the drinking-water service operators’ capacity to execute projects had not reached the desired level.
Therefore, before continuing to accept any shortage situation, and in view of the COVID-19 pandemic (the fatal consequences of which in other parts of the world are public and notorious), ICAA must implement the appropriate measures to resolve in the short term the problems caused by the scarcity of water at production sources, without prejudice to its planned medium- and long-term solutions. This is ordered because access to this resource during the pandemic is essential to prevent further transmission, in accordance with the recommendations of the Ministerio de Salud. It should be noted that, after being notified of the filing of this amparo proceeding (amparo), ICAA established two interconnections with wells to reinforce supply in the affected systems and, in Hatillo 2, replaced pipes with higher-capacity ones. This demonstrates that it did have measures available to at least attempt to mitigate the situation; however, the record does not show that those measures resolved the alleged problem.
Although it appears that ICAA sought to distribute drinking water by tanker truck in Hatillo 2, it is unclear whether the amount of water was sufficient to meet the basic needs of the affected persons. In this respect, the fact that, during a forty-hour period, the appellant had access to the service for fewer than two hours illustrates the magnitude of the problem and demonstrates the violation of her right of access to water. Consequently, the petition must be granted against ICAA under the terms to be set forth in the operative portion of the judgment…”.
In the present matter, in response to the appellant’s claim concerning drinking-water shortages in Patarrá, Desamparados, lasting up to seven hours, the respondent authorities of the Instituto Costarricense de Acueductos y Alcantarillados state in their reports—submitted under oath following due warning of the consequences, including the criminal consequences provided for in Article 44 of the law governing this jurisdiction—that increased demand and the reduction in the resources available for treatment into potable water have caused a shortage of the resource and therefore made rationing necessary. They state that, in Guatuso de Patarrá de Desamparados, the water shortage is attributable to low production at the Guatuso de Patarrá plant and high demand for drinking-water consumption. Nevertheless, they argue that the institution endeavors to stabilize the water supply whenever the service is disrupted by implementing the protocols established under the regulations in force.
Notices inform the public about the condition of the systems. They also describe the projects currently under way to improve supply conditions in the GAM. Meanwhile, the Ministro de Salud informed this Chamber that, although no complaint had been received from the appellant in this case, on 23 de julio de 2020 the Área Rectora de Salud inspected Urbanización Marón in Patarrá and confirmed the drinking-water shortage with residents of the area. In this context, the Chamber considers the precedent quoted above applicable to the case at bar, since it finds no grounds for changing the standard expressed therein or any reason to assess the situation differently. It should be noted that the reports of both the representatives of the Instituto Costarricense de Acueductos y Alcantarillados and the Ministerio de Salud confirm the appellant’s allegations regarding the shortage of this precious resource in the locality in question.
Indeed, in response to this amparo, the Área Rectora de Salud Desamparados ordered the Unidad de Ingeniería del Proyecto de Mejoramiento Ambiental del Área Metropolitana de San José to take the necessary steps to ensure that the affected residents of Urbanización Marón de Patarrá receive drinking-water service for reasonable periods of time, without shutoffs on consecutive days. Thus, in this case, the Court finds that the appellant’s right of access to water was violated because the drinking-water supply was suspended where the appellant resides, namely Patarrá de Desamparados, even though the dry season had already ended and the respondent institute had announced that there would be no rationing. Accordingly, this amparo established that a drinking-water service shortage is affecting the residents of the locality where the appellant lives, a situation aggravated by the COVID-19 coronavirus pandemic, as discussed in the partially quoted Judgment No. 2020-007754.
The appropriate disposition is therefore to grant the petition as against the Instituto Costarricense de Acueductos y Alcantarillados, in accordance with the operative portion of this judgment. Finally, the record does not indicate that the situation challenged by the protected party (parte amparada) resulted from any act or omission by the respondent health authority. The Court therefore considers it appropriate to deny the petition as against that authority.
The parties are hereby advised that, if they submitted any paper document, as well as objects or evidence stored on any additional electronic, computer, magnetic, optical, or telematic device or produced using new technologies, they must retrieve them from the court office within a maximum period of thirty business days from notification of this judgment. Otherwise, any material not retrieved within that period will be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session No. 27-11 of 22 de agosto del 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 de enero del 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial at session No. 43-12 held on 3 de mayo del 2012, Article LXXXI.
POR TANTO:
The appeal is partially granted, solely against the Instituto Costarricense de Acueductos y Alcantarillados. Manuel Antonio Salas Piedra, in his capacity as General Manager of the Instituto Costarricense de Acueductos y Alcantarillados, or whoever holds that position, is ordered to IMMEDIATELY issue the corresponding directives and take all necessary measures within the scope of his authority so that, in the event of prolonged interruptions to the water service and taking into account the COVID-19 coronavirus pandemic, the affected population of Patarrá de Desamparados is guaranteed an adequate supply of water to meet its basic needs and implement the hygiene recommendations issued by the health authorities. He is hereby advised that failure to comply with said order may constitute the offense of disobedience and that, pursuant to Article 71 of the Law on Constitutional Jurisdiction (Ley de la Jurisdicción Constitucional), anyone who receives an order issued in an amparo proceeding (recurso de amparo) that must be complied with or enforced and fails to comply with or enforce it shall be subject to imprisonment for three months to two years, or a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty.
The Instituto Costarricense de Acueductos y Alcantarillados is ordered to pay the costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed during enforcement proceedings before the administrative litigation court. As to the Ministerio de Salud, the appeal is denied. Let notice be given.- Fernando Castillo V.

Revisión del Documento *200128860007CO* SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas quince minutos del catorce de agosto de dos mil veinte .
Recurso de amparo que se tramita en expediente número 20-012886-0007-CO, interpuesto por JEFRY ANDREY VALVERDE PIEDRA, cédula de identidad 0112690177, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS Y EL MINISTERIO DE SALUD.
RESULTANDO:
Redacta el Magistrado Salazar Alvarado; y,
CONSIDERANDO:
El recurrente considera lesionados sus derechos fundamentales, toda vez que, es vecino de Patarrá en Desamparados y. en la urbanización donde vive, desde hace aproximadamente cuatro meses, se experimenta el desabastecimiento exagerado del suministro de agua potable, hasta siete horas y que, pese a que el instituto accionado publica de forma semanal, por las redes sociales, el área en que habrá racionamiento del recurso hídrico, no se cumple el horario establecido. Además, desde hace dos meses, anunció que no habría más desabastecimiento.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
Como bien lo indican las autoridades recurridas del Instituto Costarricense de Acueductos y Alcantarillados, este Tribunal ha tenido una definida línea jurisprudencial en el sentido de que, en tanto se demuestre que se ha actuado dentro de las posibilidades materiales a fin de lograr un adecuado abastecimiento de agua potable, no se quebrantan los derechos fundamentales de las personas. Sin embargo, en atención a la actual situación de crisis sanitaria que se vive en el país por la situación de pandemia provocada por el coronavirus COVID-19, fue necesario reconsiderar ese criterio mediante Sentencia N° 2020-007754, de las 09:45 horas del 24 de abril de 2020. Lo anterior en los siguientes términos:
“…Sobre el particular, tal y como ocurrió en los precedentes de cita, la Sala observa que, en principio, la falta del servicio de agua potable responde a un problema de desabastecimiento. No obstante, la situación de emergencia nacional provocada por el COVID-19, hace necesario que este Tribunal se replantee la tesis supra citada. Al respecto, no solo consta que la problemática de desabastecimiento de agua se venía reflejando desde el 2017, sino que la ARESEP puntualizó que el ICAA tenía un rezago en la inversión en infraestructura y, además, significativas pérdidas por concepto de agua no contabilizada. Asimismo, el ente regulador también afirmó que la capacidad de ejecución de los proyectos por parte de los operadores del servicio de agua potable no ha sido la deseable.
De ahí que, previo a seguir validando alguna situación de desabastecimiento y en virtud de la pandemia por el COVID-19 (cuyas fatales repercusiones son públicas y notorias en otras latitudes), el ICAA debe implementar las acciones correspondientes a los efectos de solventar a corto plazo los problemas generados por la escasez de agua en las fuentes de producción, sin perjuicio de las soluciones a mediano y largo plazo que tenga proyectadas. Lo anterior se dispone, por cuanto el acceso a este líquido en medio de esta pandemia se torna fundamental para evitar una mayor propagación, según las recomendaciones del Ministerio de Salud. Nótese que, luego de la comunicación del curso de este amparo, el ICAA efectuó dos interconexiones con pozos para reforzar abastecimiento en los sistemas afectados y, además, en Hatillo 2 sustituyó tuberías por otras de mayor capacidad, lo cual demuestra que sí tenía acciones a su alcance para al menos tratar de mitigar la situación; empero, no consta que estas hayan solventado lo acusado.
Si bien se desprende que el ICAA ha procurado la repartición de agua potable por medio de camiones cisterna en Hatillo 2, no se aprecia con claridad si la cantidad de agua fue suficiente para suplir a las necesidades básicas de las personas afectadas. En ese sentido, el hecho de que, en un lapso de cuarenta horas, la recurrente solo haya tenido acceso al servicio por menos de dos, dimensiona la magnitud del problema y evidencia la transgresión al derecho de acceso al agua de la recurrente. Debido a lo anterior se impone la estimatoria del recurso en contra del ICAA, en los términos que se dictarán en parte dispositiva de la sentencia…”.
En el presente asunto, en atención al reclamo planteado por el recurrente en cuanto al desabastecimiento de agua potable en el sector de Patarrá, Desamparados, hasta por siete horas, las autoridades recurridas del Instituto Costarricense de Acueductos y Alcantarillados, en los informes que se tienen dados bajo fe de juramento, con oportuno apercibimiento de las consecuencias, incluso penales, previstas en el artículo 44, de la ley que rige esta jurisdicción, refieren que el aumento de la demanda y la baja en el recurso disponible para potabilizar, provoca déficit en la existencia del líquido, y, por lo tanto, se hacen necesarios racionamientos. Indican que en el caso de Guatuso de Patarrá de Desamparados, el faltante de agua obedece a una baja producción en la planta de Guatuso de Patarrá y a una alta demanda en los consumos de agua potable. No obstante, argumentan que la institución hace un esfuerzo en estabilizar el abastecimiento de agua, en los casos donde se presenta una afectación de dicho servicio, ya que se ejecutan los protocolos establecidos de acuerdo a lo que establece la reglamentación vigente.
Por medio de boletines de aviso se informa de la situación en la que se encuentran los sistemas. Igualmente, detallan los proyectos en los que se está trabajando actualmente para mejorar las condiciones de abastecimiento de la GAM. Mientras que el Ministro de Salud indica a esta Sala que, si bien no han recibido ninguna denuncia de parte del aquí recurrente, el 23 de julio de 2020, el Área Rectora de Salud, inspeccionó la Urbanización Marón en Patarrá y se verificó con vecinos de la zona sobre el faltante de agua potable. En ese contexto, la Sala considera que el precedente transcrito resulta aplicable al caso de marras, toda vez que no encuentran motivos para cambiar el criterio vertido ni razones para valorar de manera distinta la situación planteada. Nótese que de lo informado tanto por los representantes del Instituto Costarricense de Acueductos y Alcantarillados, como del Ministerio de Salud, se confirma lo alegado por el recurrente respecto al desabastecimiento del preciado líquido en la localidad en cuestión.
Incluso el Área Rectora de Salud Desamparados, en atención a este amparo, ordenó a la Unidad de Ingeniería del Proyecto de Mejoramiento Ambiental del Área Metropolitana de San José, que gestionara las acciones necesarias para que los vecinos afectados de la Urbanización Marón de Patarrá contaran con el servicio de agua potable por períodos de tiempo razonables, sin que se presenten cortes por días consecutivos. Así, en la especie, el Tribunal constata que se ocasionó una vulneración al derecho de acceso al agua del recurrente, en virtud de que ha sufrido la suspensión del suministro de agua potable, en el lugar donde habitan, sea Patarrá de Desamparados y cuando ya había pasado la época seca e, incluso, el instituto recurrido había anunciado que no habría racionamiento. De modo que, en este amparo se comprobó que se está frente a una situación de desabastecimiento del suministro del servicio de agua potable que afecta a los vecinos de lugar donde vive el recurrente, lo cual se agrava con ocasión de la pandemia del coronavirus COVID-19, conforme se reseñó en la Sentencia N° 2020-007754 parcialmente trascrita, por lo que lo procedente es declarar con lugar el recurso respecto al Instituto Costarricense de Acueductos y Alcantarillados, de conformidad con lo indicado en la parte dispositiva de esta sentencia.
Finalmente, de los autos no se desprende que la situación reclamada por la parte amparada se deba a acciones u omisiones de la autoridad sanitaria recurrida, por lo que el Tribunal estima que lo pertinente es declarar sin lugar el recurso en su contra.
Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión No. 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión No. 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
POR TANTO:
Se declara parcialmente con lugar el recurso, únicamente contra el Instituto Costarricense de Acueductos y Alcantarillados. Se ordena a Manuel Antonio Salas Piedra, en su condición de Gerente General del Instituto Costarricense de Acueductos y Alcantarillados, o a quien ocupe ese cargo, que, de manera INMEDIATA, gire las órdenes correspondientes y disponga lo necesario dentro del ámbito de sus competencias para que, ante interrupciones prolongadas del servicio de agua y teniendo en cuenta la pandemia del coronavirus COVID-19, se garantice a la población afectada en Patarrá de Desamparados el reparto suficiente de ese líquido a los efectos de que puedan suplir sus necesidades básicas e implementar las recomendaciones de aseo que las autoridades de salud han emitido. Se advierte que de no acatar la orden dicha, podrían incurrir en el delito de desobediencia y que, de conformidad con el artículo 71, de la Ley la Jurisdicción Constitucional, se le impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.
Se condena al Instituto Costarricense de Acueductos y Alcantarillados al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. Respecto al Ministerio de Salud, se declara sin lugar el recurso. Notifíquese.- Fernando Castillo V.
