Request for supplementation and clarification (solicitud de adición y aclaración) of resolution No. 2020-014209, issued at 09:15 on 29 de julio de 2020, submitted by the petitioner (recurrente), [Nombre 001], an older adult, married, a farmer, identity card No. [Valor 001], resident of Salinas 2, in the amparo proceeding (recurso de amparo) that he filed jointly with other persons against the Minister of Environment and Energy, the President of the Consejo Nacional de Áreas de Conservación, and the Executive Director of the Sistema Nacional de Áreas de Conservación.
Having considered:
It is the basis for the development of other planning and regulatory instruments for Protected Wildlife Areas (Áreas Silvestres Protegidas).” Accordingly, under no circumstances may it be regarded as a means of registering or legalizing private parties’ possessory rights, nor does it have the legal authority to invalidate the acquisition procedure established by Article 37 of the Ley Orgánica del Ambiente. Consequently, the appellant’s request to suspend the implementation of the management plan (plan de manejo) would serve no purpose, because Article 37 of the Ley Orgánica del Ambiente is not the provision that authorizes the State to issue or implement a general management plan (Plan General de Manejo); rather, that authority derives from Article 73 of the Reglamento a la Ley de Biodiversidad: “Article 73.—Restoration, recovery, and rehabilitation of ecosystems, species, and their environmental services (servicios ambientales).
SINAC shall define, develop, and promote management actions to achieve the conservation, restoration, recovery, and rehabilitation of ecosystems and their components, based on scientific studies, management plans, or other planning instruments for Protected Wildlife Areas, in accordance with the objectives for which they were declared, including the management and/or eradication of invasive alien species, the recovery of soils and vegetation cover (cobertura vegetal), the control and prevention of forest fires, the mitigation of natural disasters, the control of populations of opportunistic native species, and the regulation of hydrological cycles.” Supplementing Article 73, section 3(p) of the same body of regulations defines a general management plan as follows:
“Article 3.—Definitions. For the application and interpretation of this Regulation, in addition to the definitions included in Article 7 of the Ley de Biodiversidad of 30 de abril de 1998, published in La Gaceta No. 101 of 27 de mayo de 1998; Article 2 of the Ley de Conservación de la Vida Silvestre No. 7317 of 30 de octubre de 1992, published in La Gaceta No. 235 of 7 de diciembre de 1992; Article 3 of the Ley Forestal No. 7575 of 17 de octubre de 1996, published in La Gaceta No. 16 of 23 de enero de 1997; Article 2 of the Reglamento a la Ley de Conservación de la Vida Silvestre, Decreto Ejecutivo No. 32633-MINAE, of 10 de marzo del 2005, published in La Gaceta No. 180 of 20 de setiembre del 2005; Decreto Ejecutivo No. 31514-MINAE of 3 de octubre del 2003, published in La Gaceta No. 241 of 15 de diciembre del 2003; and Decreto Ejecutivo No. 33697-MINAE of 6 de febrero del 2007, published in La Gaceta No. 74 of 18 de abril del 2007, the following shall be used as references: (…) p) General management plan: The planning instrument that guides the management of a Protected Wildlife Area toward achieving its long-term conservation objectives.
It is based on medium-term strategic lines of action and management objectives for the natural and cultural elements within the area, as well as on the relationship between those elements and their socio-environmental surroundings. It is the basis for the development of other planning and regulatory instruments for Protected Wildlife Areas.” Because a comprehensive process was followed in preparing the management plan for Zona Protectora Tivives, which is currently in force pursuant to Supplement No. 142 of 25 de julio del 2019, published in the national official gazette La Gaceta, it has complied with all established legal requirements. It must therefore be concluded that both the creation of Zona Protectora Tivives and its general management plan form part of the implementation of Article 50 of the Constitución Política, serving the general interest in an ecologically sound and balanced environment; consequently, suspending its implementation would cause substantial harm to the management and development of the Protected Wildlife Area.
Article 41 of the Ley de la Jurisdicción Constitucional provides that, in exceptionally serious cases, the Sala Constitucional may order the implementation or continued implementation of the effects of challenged laws or regulatory provisions when their suspension causes or threatens to cause certain or imminent harm or damage to public interests greater than that which implementation would cause the injured party. It also authorizes the President or the Reporting Justice (Magistrado Instructor) to order any protective or security measure that prudence may counsel in order to prevent material risks or avoid further harm resulting from the acts performed, all in accordance with the circumstances of the case. In this specific case, previous submissions have stated that subjecting property to an environmental land-use plan (plan de ordenamiento ambiental) or to a management plan for a Protected Wildlife Area neither deprives the right of ownership of its substance nor prevents its exercise, because, given its basis, it constitutes a reasonable and legitimate restriction.
Therefore, the legal prerequisite of periculum in mora would not apply so as to justify any interim protection in favor of the appellant, since there is no showing of any well-founded concern that the appellant’s subjective legal position would be seriously or irreparably harmed or impaired during the time required to issue the judgment on the merits. On the contrary, because the general management plan is a planning instrument that guides the management of a Protected Wildlife Area toward achieving its long-term conservation objectives, and because its implementation is also imperative under the directive of the Contraloría General de la República, pursuant to Report No. DFOE-AE-IF-16-2014, which was also considered among the obligations imposed by the Sala Constitucional in Resolution No. 14907-2017, at 09:15 hours on 22 de setiembre de 2017, any suspension of the implementation of the general management plan for Zona Protectora de Tivives would impair the defense and safeguarding of the fundamental right to a healthy and ecologically balanced environment, as well as the protection of natural beauty, in compliance with Articles 50 and 89 of the Constitución Política.
The general management plan for Zona Protectora de Tivives must remain in effect in order to conserve, rehabilitate, and transmit to future generations the natural heritage located within this Protected Zone, in compliance with current environmental regulations and the commitments undertaken by the country in the international treaties it has signed, including the Convención sobre la protección del patrimonio mundial, cultural y natural and the Convención para la Protección de la Flora, Fauna y de las Bellezas Escénicas Naturales de los Países de América. Relief requested (Petitoria). Based on the factual and legal grounds stated above, the continued implementation of the general management plan for Zona de Protección de Tivives is requested.
Justice Garro Vargas drafts the opinion; and,
Whereas:
I.Regarding supplementation and clarification (adición y aclaración). Technically, requests for supplementation and clarification are not means of challenge (medios de impugnación), but rather applications available when the judgment, in its reasoning section—in the particular case of this Jurisdiction—or its operative section, is incomplete, unclear, or imprecise. In other words, pursuant to section 12 of the Ley de la Jurisdicción Constitucional, supplementation and clarification of a judgment are available solely to complete it where any of the issues argued were not decided, or to clarify an unclear or confusing point that the decision may contain.
II.Regarding the application filed. After reviewing the application for supplementation and clarification filed by the appellant [Nombre 001], which concerns interlocutory order (resolución interlocutoria) No. 2020-014209, issued at 09:15 hours on 29 de julio de 2020, and through which the claimant requests clarification as to whether that order stays the challenged act in this appeal for protection by operation of law, this Chamber finds both the request for supplementation and clarification and the underlying claim inadmissible. First, it is evident that his request is not intended to clarify particular aspects of the ruling that are relevant to a better understanding of its scope or of the procedures for its enforcement, insofar as necessary to ensure full compliance with the judgment. The ruling clearly reserves judgment in this appeal until the constitutional challenge (acción de inconstitucionalidad) being heard by this Chamber under case file No. 18-001105-0007-CO has been decided. The request for clarification or supplementation of interlocutory order No. 2020-014209 is therefore inadmissible.
III.Regarding the stay of the administrative act (suspensión del acto administrativo) pursuant to Article 41 of the Ley de la Jurisdicción Constitucional, the appellant must first be advised that the Chamber has consistently held that an administrative act challenged through an appeal for protection will be stayed by operation of law when the Chamber expressly so orders in the decision admitting the constitutional protection action (acción de garantía) for consideration. In other words, no automatic stay arises upon issuance of the decision admitting the appeal for protection; rather, an express ruling by the Chamber is required to assess the consequences of staying or maintaining the challenged act, as permitted and required by the second paragraph of the provision in question. Having clarified the foregoing, it is established, secondly, that in the application now under consideration, the appellant asks this Chamber to order the suspension of the application of the Plan General de Manejo para la Zona Protectora de Tivives pursuant to Article 41 of the law governing this jurisdiction.
In this particular case, however, given the negative nature of the challenged acts, a stay of the administrative act is not appropriate, as doing so would amount to granting the appellants’ claim through an interlocutory ruling. Furthermore, the respondent authorities have reported that the Plan General de Manejo is a planning instrument that guides the management of a protected wilderness area (área silvestre protegida) toward fulfillment of its long-term conservation objectives. Suspending its application would therefore impair the defense and protection of the fundamental right to a healthy and ecologically balanced environment, as well as the protection of natural beauty, in compliance with sections 50 and 89 of the Constitución Política. Moreover, because ex post facto enforcement (coacción a posteriori) is ineffective in environmental matters—since, once socially harmful biological consequences have already occurred, punishment may have moral significance but will hardly compensate for the environmental damage caused—it is deemed appropriate not to suspend the application of the Plan General de Manejo para la Zona Protectora de Tivives, as requested by the appellant [Nombre 001].
Therefore:
The application filed is denied.

Solicitud de adición y aclaración de la resolución No. 2020-014209 , de las 09:15 horas del 29 de julio de 2020, presentada por el recurrente [Nombre 001], adulto mayor, casado, agricultor, cédula de identidad No. [Valor 001], vecino de Salinas 2, en el recurso de amparo que interpuso conjuntamente con otras personas, contra el Ministro de Ambiente y Energía, la Presidenta del Consejo Nacional de Áreas de Conservación y la Directora Ejecutiva del Sistema Nacional de Áreas de Conservación.
Resultando:
Redacta la Magistrada Garro Vargas; y,
Considerando:
I.Sobre la adición y aclaración . Técnicamente, las solicitudes de adición y la aclaración no son medios de impugnación, sino gestiones que proceden cuando la sentencia, en su parte considerativa -para el caso particular de esta Jurisdicción- o dispositiva, resulta omisa, oscura o imprecisa. En otros términos y, de conformidad con lo dispuesto por el numeral 12 de la Ley de la Jurisdicción Constitucional, la adición y aclaración de una sentencia procede, únicamente, para complementarla en caso que algunos de los puntos debatidos, no hubiere sido fallado o para clarificar un punto oscuro o confuso que el voto pudiere contener.
II.En cuanto a la gestión planteada . Luego de analizar la gestión de adición y aclaración interpuesta por el recurrente [Nombre 001], la cual va dirigida respecto a la resolución interlocutoria No. 2020-014209, de las 09:15 horas del 29 de julio de 2020 y por medio de la que el accionante requiere se le aclare si esa resolución suspende de pleno derecho el acto impugnado en este amparo; estima esta Sala que no es de recibo tanto la solicitud de adición y aclaración presentada, como la pretensión de fondo. En primer lugar, se evidencia que su petición no va dirigida a la clarificación de ciertos aspectos del pronunciamiento, que resulten relevantes para una mejor comprensión de sus alcances o los procedimientos para su ejecución, en la medida que sea necesario para dar cabal cumplimiento al contenido del fallo. Lo resuelto es claro en cuanto se reserva el dictado de la sentencia de este recurso hasta tanto sea resuelta la acción de inconstitucionalidad que, bajo expediente No. 18-001105-0007-CO, se tramita en esta Sala. Por ello, deviene improcedente la solicitud de aclaración o adición de la resolución interlocutoria No. 2020-014209.
III.En cuanto a la suspensión del acto administrativo de conformidad con lo establecido en el artículo 41 de la Ley de la Jurisdicción Constitucional, primeramente, debe aclararse al recurrente que es criterio reiterado de la Sala que el acto administrativo que se recurra en vía de amparo, será suspendido de pleno derecho cuando así lo disponga expresamente la Sala en la resolución que da curso a la acción de garantía; es decir, no existe una suspensión automática cuando se dicta la resolución que da curso del amparo, sino que se requiere un pronunciamiento expreso de la Sala para valorar las consecuencias de la suspensión o el mantenimiento del acto impugnado, valoración permitida y ordenada por el párrafo segundo de la norma de comentario. Puntualizado lo anterior, como segundo punto, se constata que en la gestión que ahora se conoce, el recurrente solicita a esta Sala que ordene la suspensión de la aplicación del Plan General de Manejo para la Zona Protectora de Tivives, de conformidad con el artículo 41 de la ley que rige a esta jurisdicción.
Sin embargo, como en el caso particular, por la naturaleza negativa de los actos impugnados, no resulta procedente la suspensión del acto administrativo, pues ello implicaría conceder de forma interlocutoria la pretensión de las personas recurrentes. Aunado a que han informado las autoridades recurridas que ese Plan General de Manejo es un instrumento de planificación que permite orientar la gestión de un área silvestre protegida hacia el cumplimiento de sus objetivos de conservación a largo plazo, por lo que la suspensión de su aplicación afecta la defensa y la tutela del derecho fundamental a un ambiente sano y ecológicamente equilibrado, así como a la protección de las bellezas naturales, en cumplimiento de los numerales 50 y 89 de la Constitución Política. Además, en razón de que en materia ambiental la coacción a posteriori resulta ineficaz, por cuanto de haberse producido ya las consecuencias biológicas socialmente nocivas, la represión podrá tener una trascendencia moral, pero difícilmente compensará los daños ocasionados en el ambiente, se considera de mérito no suspender la aplicación del Plan General de Manejo para la Zona Protectora de Tivives, como lo demanda el recurrente [Nombre 001].
Por tanto:
