Resultando:

1. 1By resolution number 2011-014746 at 10:31 hours on October 28, 2011, this Sala resolved the present appeal on the merits, declaring: “The appeal is PARTIALLY GRANTED, and consequently it is ordered to EDUARDO LEZAMA FERNANDEZ, in his capacity as Deputy General Manager of the Instituto Costarricense de Acueductos y Alcantarillados, ALEX MENDEZ SAENZ, in his capacity as Technician of the Ministerio de Ambiente, Energía y Telecomunicaciones, VICTOR MORALES MORA, in his capacity as Municipal Mayor of Aserrí, and LETICIA CASTRO MORENO, in her capacity as President of the Municipal Council of Aserrí, CAROLINA UMAÑA CISNEROS, in her capacity as Director of the Health Governing Area (Área Rectora de Salud) of Aserrí, or to whoever holds these positions in their stead, that each one, within the scope of their competencies, coordinate actions in order to:1) Immediately take the necessary provisional measures so that the residents of Barrio Santa Lucía Arriba in Salitrillos de Aserrí have access to the public potable water service.2) Establish, within a maximum period of ONE calendar month from the notification of this resolution, a plan to provide a definitive solution for the potable water supply for the residents of Barrio Santa Lucía Arriba in Salitrillos de Aserrí, so that said residents have access to the public potable water service, whether through the constitution of an ASADA, through a legal connection to the Municipal Aqueduct, or through any other solution.3) Take all corresponding actions to execute said plan, so that within a maximum period of THREE MONTHS from the notification of this resolution, the access to the potable water service for said residents is definitively resolved...”
2. 2The appellant ZULAY CORODOBA VALVERDE, identification card 0105270250, by a brief filed on July 6, 2020, alleges non-compliance with what was ordered.
3. 3By resolution of the Supervisory Judge (Magistrado Instructor) at 10:04 hours on July 7, 2020, a hearing was granted to the Executive President of the Instituto Costarricense de Acueductos y Alcantarillados and to the Mayor of the Municipality of Aserrí so that they may refer to and provide the corresponding evidence regarding the acts and omissions attributed to them. Resolution notified on that same date.
4. 4Regarding the above-mentioned transfer, YAMILETTE ASTORGA ESPELETA reports under oath, in her capacity as Executive President of the Instituto Costarricense de Acueductos y Alcantarillados, in summary that: The Institute ordered at the time to coordinate for the purpose of making a decision, basically with the Municipality of Aserrí. At the time, it was agreed at a meeting held on November 17, 2011, that it would be the Local Government that would provide the solution to the appellants' situation, by reason of being the operators of the aqueduct in said affected area. Thus, the possibility of forming an ASADA was ruled out, which is also not currently seen as a viable option due to the Policy for the Organization and Strengthening of Community Management of Potable Water and Sanitation Services, approved by the AyA in 2015. According to the respective follow-up, the municipal operator demonstrated the signing of an Agreement with Mr.Víctor Quirós, holder of a property where a well has been drilled. The aforementioned agreement that the Municipality has allows the operator to request the environmental feasibility (viabilidad ambiental) from SETENA, to concession part of the flow from the Dirección de Aguas of MINAE, and to build the necessary infrastructure, in order to provide water to the residents of the locality of Santa Lucía. By virtue of what was agreed, and because the most viable solution from a technical and financial standpoint was for the Municipality of Aserrí to assume the responsibility of providing the service to Barrio Santa Lucía, which was actually already connected to the municipal system. The Institute obviously, from another perspective, has kept the matter under attention, following up on the aforementioned resolution within its faculties; it sent a report from the National Water Laboratory (Laboratorio Nacional de Aguas) to the Municipality of Aserrí.The users of the Community of Barrio Santa Lucía Arriba in Salitrillos de Aserrí are irregularly supplied from the aqueduct system administered by the Municipality of Aserrí, connecting at a point on the transmission pipe where the water is not yet treated, so they receive water not suitable for human consumption. The consideration was reached that the proposal indicated by the municipal operator to use a well was technically correct, as was the possibility of providing adequate treatment to the surface waters, should that supply option continue. During 2019, AyA has sent a series of official communications and requirements to the municipal operator in compliance with the provisions of articles 1 and 2 of Law No. 2726, which establish the governing authority (rectoría) of the Instituto Costarricense de Acueductos y Alcantarillados applicable to the services for potable water supply and for collection, treatment, and disposal of wastewater.Likewise, said Municipality to date has not responded to the Institution regarding the mentioned official communications, nor has it requested further procedures relating to the supply of the Municipal Aqueduct, it being said municipal entity that must evaluate, address, or implement the proposals indicated in the mentioned Report in accordance with its competencies and municipal autonomy. The AyA does not administer the aqueduct and sewer system of Aserrí, therefore only the system operator can provide a complete report on the characteristics and situation of the aqueduct they administer. We must understand that AyA, far from being a co-administrator of the system solving the operational and administrative problems arising in municipal aqueducts, corresponds only to the Institute to issue technical and control regulations, and in the case of the Aserrí Aqueduct, it has participated and coordinated with the Local Government to find a solution to the crisis, so AyA in that sense, has fulfilled beyond its obligation as governing body. It requests that the non-compliance proceeding be dismissed.
5. 5Regarding the above-mentioned transfer, OLDEMAR GARCIA SEGURA reports under oath, in his capacity as Municipal Mayor and Legal Representative of the Municipality of Aserrí, in summary that: Since 2011, in compliance with what was ordered by this sala in resolution 2011-014746, the residents of Barrio Santa Lucia Arriba in Salitrillos de Aserrí were temporarily allowed to remain connected to the main pipe of the municipal aqueduct coming from the intake on the Cañas River, while a definitive solution was being sought. In that same year, water was able to be provided to this sector through a cooperation agreement entered into between the Municipality of Aserrí and Mr. Víctor Quirós, who authorized providing water to this community from a well located on his property. However, subsequently, as Mr. Víctor Quirós indicated, due to inadequate management of this resource that caused excess water consumption, he decided to suspend its supply.Due to the foregoing, the residents were again authorized to temporarily connect to the main pipe coming from the spring (naciente) of the Cañas River. In order to provide the residents of this community a better water service through a connection to the aqueduct, several technical studies were required. As it is a complex, multi-stage process, after carrying out the mentioned technical studies, it was determined that in order to provide this service adequately and efficiently, new supply tanks first had to be installed in the sector of Salitrillos, which have already been duly installed in the sector of Salitrillos; the second stage to be developed is the installation of 700 meters of piping, which would allow connecting this community to the new water tanks. This stage was scheduled to start at the beginning of this year; however, due to the national emergency for COVID-19, the work had to be rescheduled for October 2020.This situation was already made known to Mrs. Zulay Córdoba Valverde and Lourdes Campos at a meeting held with them at the beginning of this year, and the rescheduling of the date through official communication DGA1312020-ext. Although the municipal aqueduct is working to provide a better water service to the residents of Barrio Santa Lucia Arriba in Salitrillos de Aserrí, through a connection to the aqueduct, they have not at any time been left without said resource, since, as ordered in resolution 2011-014746, this aqueduct has been executing different procedures that have allowed providing a solution to the water supply problem that this community presented, a service that will be improved in October with the connection to the new water tanks. It requests that the petitioner's request be rejected and the definitive archival of the file.
6. 6In the proceedings followed, the legal prescriptions have been observed.

Considering:

SOLE.- In the present matter, the appellant claims that the appealed authority has failed to comply with what was ordered by this Sala through judgment number 2011-014746 at 10:31 hours on October 28, 2011, where it was resolved: “The appeal is PARTIALLY GRANTED, and consequently it is ordered to EDUARDO LEZAMA FERNANDEZ, in his capacity as Deputy General Manager of the Instituto Costarricense de Acueductos y Alcantarillados, ALEX MENDEZ SAENZ, in his capacity as Technician of the Ministerio de Ambiente, Energía y Telecomunicaciones, VICTOR MORALES MORA, in his capacity as Municipal Mayor of Aserrí, and LETICIA CASTRO MORENO, in her capacity as President of the Municipal Council of Aserrí, CAROLINA UMAÑA CISNEROS, in her capacity as Director of the Health Governing Area of Aserrí, or to whoever holds these positions in their stead, that each one, within the scope of their competencies, coordinate actions in order to:

• 1)Immediately take the necessary provisional measures so that the residents of Barrio Santa Lucía Arriba in Salitrillos de Aserrí have access to the public potable water service.
• 2)Establish, within a maximum period of ONE calendar month from the notification of this resolution, a plan to provide a definitive solution for the potable water supply for the residents of Barrio Santa Lucía Arriba in Salitrillos de Aserrí, so that said residents have access to the public potable water service, whether through the constitution of an ASADA, through a legal connection to the Municipal Aqueduct, or through any other solution.
• 3)Take all corresponding actions to execute said plan, so that within a maximum period of THREE MONTHS from the notification of this resolution, the access to the potable water service for said residents is definitively resolved...” since as of the date of filing the proceeding, what was ordered had still not been fulfilled. In this regard, because a non-compliance proceeding had already been processed on a previous occasion, the Supervisory Judge on this occasion only transferred the matter to the Instituto Costarricense de Acueductos y Alcantarillados and the Municipality of Aserrí. In this regard, from the reports submitted to this Sala, it is verified that said authorities have complied with what was ordered, even if not exactly within the deadlines given; it is verified that, the Instituto Costarricense de Acueductos y Alcantarillados (AyA), has carried out, since 2011, a series of coordination actions with the Municipality of Aserrí, so that it is this local government that assumes the administration of the aqueduct and sewer system of Aserrí. During 2019, AyA has sent a series of official communications and requirements to the municipal operator in compliance with the provisions of articles 1 and 2 of Law No. 2726, which establish the governing authority of the Instituto Costarricense de Acueductos y Alcantarillados, and that said Municipality to date has not responded to the Institution regarding the mentioned official communications, nor has it requested further procedures relating to the supply of the Municipal Aqueduct. For its part, the representative of the Municipality of Aserrí details that, in 2011, water was able to be provided to this sector through a cooperation agreement entered into between the Municipality of Aserrí and Mr. Víctor Quirós, who authorized providing water to this community from a well located on his property. However, subsequently, he decided to suspend its supply. Due to the foregoing, the residents were again authorized to temporarily connect to the main pipe coming from the spring of the Cañas River. In order to provide the residents of this community a better water service through a connection to the aqueduct, several technical studies were required, after which it was determined that in order to provide this service adequately and efficiently, new supply tanks first had to be installed in the sector of Salitrillos, which have already been duly installed in the sector of Salitrillos; the second stage to be developed is the installation of 700 meters of piping, which would allow connecting this community to the new water tanks. This stage was scheduled to start at the beginning of this year; however, due to the national emergency for COVID-19, the work had to be rescheduled for October 2020. In conclusion, the filing presented must be dismissed with respect to the respondents Instituto Costarricense de Acueductos y Alcantarillados and with respect to the Municipality of Aserrí, because although there has been a delay in complying with what was ordered, it is reported that the water service has been continuously provided. Now, if the appellant or any other resident considers that the service provided by the Municipality violates the right to potable water, they may file a new appeal with these allegations. Given that said allegations would not be appropriate for analysis in this file, as they constitute new facts.

Therefore:

Resultando:

1. 1Mediante resolución número 2011-014746 de las 10:31 horas del 28 de octubre del 2011, esta Sala resolvió por el fondo el presente recurso, declarando: “Se declara PARCIALMENTE CON LUGAR el recurso, y en consecuencia se ordena a EDUARDO LEZAMA FERNANDEZ, en su calidad de Subgerente General de Instituto Costarricense de Acueductos y Alcantarillados, ALEX MENDEZ SAENZ, en su calidad de Técnico del Ministerio de Ambiente, Energía y Telecomunicaciones, VICTOR MORALES MORA, en su calidad de Alcalde Municipal de Aserrí, y LETICIA CASTRO MORENO, en su calidad de Presidenta del Concejo Municipal de Aserrí, CAROLINA UMAÑA CISNEROS, en su calidad de Directora del Área Rectora de Salud de Aserrí, o a quienes en su lugar ocupen estos cargos, que cada uno dentro del ámbito de sus competencias coordinen acciones a efectos de:1) Tomar de inmediato las medidas provisionales necesarias a efectos de que los vecinos del Barrio Santa Lucía Arriba en Salitrillos de Aserrí tengan acceso al servicio público de agua potable.2) Establecer, dentro del plazo máximo de UN MES calendario a partir de la comunicación de la esta resolución, un plan para darle una solución definitiva al abastecimiento de agua potable de los vecinos del Barrio Santa Lucía Arriba en Salitrillos de Aserrí, a efectos de que dichos vecinos tengan acceso al servicio público de agua potable, sea mediante la constitución de una ASADA, mediante la conexión legal al Acueducto Municipal, o mediante cualquier otra solución.2) Tomar todas las acciones correspondientes para ejecutar dicho plan, a efectos de que dentro del plazo máximo de TRES MESES contados a partir de la comunicación de esta resolución, el acceso al servicio de agua potable de dichos vecinos esté definitivamente solucionado..."
2. 2La recurrente ZULAY CORODOBA VALVERDE, cédula de identidad 0105270250, mediante escrito presentado el 06 de julio del 2020 acusa desobediencia a lo ordenado.
3. 3Mediante resolución del Magistrado Instructor de las 10:04 horas del 07 de julio del 2020, se dio audiencia al Presidente Ejecutivo del Instituto Costarricense de Acueductos y Alcantarillados y al Alcalde de la Municipalidad de Aserrí para que se refieran y aporten las pruebas correspondientes respecto a los hechos y omisiones que se les atribuyen. Resolución notificada en esa misma fecha.
4. 4Sobre el traslado anterior, informa bajo la fe de juramento, YAMILETTE ASTORGA ESPELETA, en su calidad de Presidenta Ejecutiva del Instituto Costarricense de Acueductos y Alcantarillados, en resumen que: El Instituto ordenó en su momento coordinar con la finalidad de tomar una decisión, básicamente con la Municipalidad de Aserrí. En su momento se acordó en reunión efectuada el día 17 de noviembre del 2011 que sería el Gobierno Local el que brindaría la solución a la situación de los recurrente, en razón de ser los operadores del acueducto en dicha zona afectada. Así las cosas, se descartó la posibilidad de constituir una ASADA, por lo cual actualmente tampoco se ve como una opción viable en razón de la Política de Organización y Fortalecimiento de la Gestión Comunitaria de los Servicios de Agua Potable y Saneamiento, aprobada por el AYA en el año 2015. Conforme al seguimiento respectivo, se demostró por parte del operador municipal la suscripción de un Convenio con el señor Sr. Víctor Quirós, poseedor de una finca que tiene perforado un pozo.El citado convenio con el que cuenta la Municipalidad le permite al operador solicitar la viabilidad ambiental con SETENA, concesionar parte del caudal ante la Dirección de Aguas del MINAE y construir la infraestructura necesaria, con el fin de dotar de agua a los vecinos de la localidad de Santa Lucía. En virtud de lo acordado, y debido a que la solución más viable desde el punto de vista técnico y financiero fue que la Municipalidad de Aserrí asumiera la responsabilidad de brindar el servicio a Barrio Santa Lucía, que en realidad ya estaba conectado al sistema municipal. El Instituto obviamente, desde otra perspectiva, ha mantenido bajo atención el asunto, dando seguimiento a la resolución supra indicada dentro de sus facultades, se le remitió a la Municipalidad de Aserrí reporte del Laboratorio Nacional de Aguas. Los usuarios de la Comunidad de Barrio Santa Lucía Arriba en Salitrillos de Aserrí se abastecen irregularmente del sistema de acueducto administrado por la Municipalidad de Aserrí, conectándose en un punto de la tubería de conducción donde el agua aún no es tratada, por lo que recibe agua no apta para consumo humano.Se llegó a la consideración que la propuesta indicada por el operador municipal de utilizar un pozo era técnicamente correcta, así como también la posibilidad de darle un tratamiento adecuado a las aguas superficiales, en caso de continuar con dicha opción de abastecimiento. El AyA ha remitido durante el año 2019, una serie de oficios y requerimientos al operador municipal en cumplimiento a lo dispuesto en los artículos 1 y 2 de la Ley No. 2726, que establecen la rectoría del Instituto Costarricense de Acueductos y Alcantarillados aplicable a los servicios de abastecimiento de agua potable y de recolección, tratamiento y disposición de aguas residuales. Así mismo, dicha Municipalidad a la fecha no ha brindado respuesta a la Institución, sobre los oficios mencionados, así como tampoco ha solicitado más gestiones relativas al abastecimiento del Acueducto Municipal, siendo dicha entidad municipal la que debe valorar, atender o implementar las propuestas indicadas en el citado Informe de acuerdo con sus competencias y autonomía municipal.El AyA no administra el sistema de acueducto y alcantarillado de Aserrí, por lo que solo el operador del sistema puede dar un informe completo sobre las características y situación del acueducto que administran. Debemos entender que AyA, lejos de ser un coadministrador del sistema solventando los problemas operativos y administrativos que se presenten en acueductos municipales, únicamente corresponde al Instituto emitir normativa técnica y de control, y en el caso del Acueducto de Aserrí se ha participado y coordinado con el Gobierno Local para encontrar solución a la crisis, por lo que AyA en ese sentido, ha cumplido más allá de su obligación como rector. Solicita se declare sin lugar la gestión de desobediencia.
5. 5Sobre el traslado anterior, informa bajo la fe de juramento, OLDEMAR GARCIA SEGURA, en su calidad de Alcalde Municipal y Representante Legal de la Municipalidad de Aserrí, en resumen que: Desde el año 2011, en cumplimiento con lo ordenado por esta sala en resolución 2011-014746, se les permitió temporalmente a los vecinos del Barrio Santa Lucia Arriba en Salitrillos de Aserrí, mantenerse conectados al tubo madre del acueducto municipal proveniente de la toma del rio Cañas, en el tanto se buscaba una solución definitiva. En este mismo año se logró brindar agua en este sector a través de un convenio de cooperación que se realizó entre la Municipalidad de Aserrí y el señor Víctor Quirós, quien autorizo brindarle agua a esta comunidad de un pozo ubicado en su propiedad. Sin embargo, posteriormente, según indicó el señor Víctor Quirós, debido a un inadecuado manejo de este recurso que provoco un exceso de consumo de agua, este decidió suspender su suministro.En razón a lo anterior se volvió a autorizar a los vecinos para conectarse temporalmente del tubo madre proveniente de la naciente del Rio Cañas. Que para poder brindarles a los vecinos de esta comunidad un mejor servicio de agua a través de una conexión al acueducto, se requirió realizar varios estudios técnicos. Que al tratarse de un proceso complejo y por etapas, después de realizar los estudios técnicos mencionados se determinó que para poder brindar este servicio de forma adecuada y eficiente primero se debía instalar nuevos tanques de abastecimiento en el sector de Salitrillos, lo cuales ya fueron debidamente instalados en el sector de Salitrillos, la segunda etapa, a desarrollar es la instalación de 700 metros de tubería lo cual permitiría conectar a esta comunidad con los nuevos tanques de agua. Esta etapa se tenía prevista para iniciar a principios de este año, sin embargo, debido a la emergencia nacional por COVID -19 los trabajos tuvieron que reprogramarse para octubre de 2020.Esta situación ya fue puesta en conocimiento de la señora Zulay Córdoba Valverde y Lourdes Campos en una reunión que se sostuvo con ellas a inicios de este año, y la reprogramación de fecha por medio del oficio DGA1312020-ext. Que si bien el acueducto municipal esta trabajando para poder brindarles un mejor servicio de agua a los vecinos del Barrio Santa Lucia Arriba en Salitrillos de Aserrí, a través de una conexión al acueducto, estos no han quedado en ningún momento desprovistos de dicho recurso ya que tal y como se ordena en la resolución 2011-014746 este acueducto ha venido ejecutando diferentes gestiones que han permitido brindar una solución al problema de abastecimiento de agua que presentaba esta comunidad, servicio que será mejorado en el mes de octubre con la conexión a los nuevos tanques de agua. Solicita se rechace la petición de la recurrente y el archivo definitivo del expediente.
6. 6En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta el Magistrado Hernandez Gutierrez; y,

Considerando:

UNICO.- En el presente asunto, la recurrente aduce que la autoridad recurrida ha incumplido lo ordenado por esta Sala mediante la sentencia número 2011-014746 de las 10:31 horas del 28 de octubre del 2011, donde se resolvió: “Se declara PARCIALMENTE CON LUGAR el recurso, y en consecuencia se ordena a EDUARDO LEZAMA FERNANDEZ, en su calidad de Subgerente General de Instituto Costarricense de Acueductos y Alcantarillados, ALEX MENDEZ SAENZ, en su calidad de Técnico del Ministerio de Ambiente, Energía y Telecomunicaciones, VICTOR MORALES MORA, en su calidad de Alcalde Municipal de Aserrí, y LETICIA CASTRO MORENO, en su calidad de Presidenta del Concejo Municipal de Aserrí, CAROLINA UMAÑA CISNEROS, en su calidad de Directora del Área Rectora de Salud de Aserrí, o a quienes en su lugar ocupen estos cargos, que cada uno dentro del ámbito de sus competencias coordinen acciones a efectos de:

• 1)Tomar de inmediato las medidas provisionales necesarias a efectos de que los vecinos del Barrio Santa Lucía Arriba en Salitrillos de Aserrí tengan acceso al servicio público de agua potable.
• 2)Establecer, dentro del plazo máximo de UN MES calendario a partir de la comunicación de la esta resolución, un plan para darle una solución definitiva al abastecimiento de agua potable de los vecinos del Barrio Santa Lucía Arriba en Salitrillos de Aserrí, a efectos de que dichos vecinos tengan acceso al servicio público de agua potable, sea mediante la constitución de una ASADA, mediante la conexión legal al Acueducto Municipal, o mediante cualquier otra solución.
• 3)Tomar todas las acciones correspondientes para ejecutar dicho plan, a efectos de que dentro del plazo máximo de TRES MESES contados a partir de la comunicación de esta resolución, el acceso al servicio de agua potable de dichos vecinos esté definitivamente solucionado..." pues a la fecha de interposición de la gestión todavía no se le había cumplido con lo ordenado. Al respecto, debido a que ya en anterior oportunidad se había tramitado gestión por desobediencia, el Magistrado Instructor le dio traslado en esta ocasión únicamente a Instituto Costarricense de Acueductos y Alcantarillados y a la Municipalidad de Aserrí. Al respecto, de los informes rendidos a esta Sala se comprueba que dichas autoridades han dado cumplimiento a lo ordenado, si bien no exactamente dentro de los plazos dados, sí se comprueba que, el Instituto Costarricense de Acueductos y Alcantarillados (AyA), ha realizado, desde el año 2011, una serie de actuaciones de coordinación con la Municipalidad de Aserrí, para que sea este gobierno local quien asuma la administración del sistema de acueducto y alcantarillado de Aserrí. El AyA ha remitido durante el año 2019, una serie de oficios y requerimientos al operador municipal en cumplimiento a lo dispuesto en los artículos 1 y 2 de la Ley No. 2726, que establecen la rectoría del Instituto Costarricense de Acueductos y Alcantarillados, y que dicha Municipalidad a la fecha no ha brindado respuesta a la Institución, sobre los oficios mencionados, así como tampoco ha solicitado más gestiones relativas al abastecimiento del Acueducto Municipal. Por su parte, el representante de la Municipalidad de Aserrí, detalla que, en el año 2011 se logró brindar agua en este sector a través de un convenio de cooperación que se realizó entre la Municipalidad de Aserrí y el señor Víctor Quirós, quien autorizo brindarle agua a esta comunidad de un pozo ubicado en su propiedad. Sin embargo, posteriormente, se este decidió suspender su suministro. En razón a lo anterior se volvió a autorizar a los vecinos para conectarse temporalmente del tubo madre proveniente de la naciente del Rio Cañas. Que para poder brindarles a los vecinos de esta comunidad un mejor servicio de agua a través de una conexión al acueducto, se requirió realizar varios estudios técnicos, luego de los cuales se determinó que para poder brindar este servicio de forma adecuada y eficiente primero se debía instalar nuevos tanques de abastecimiento en el sector de Salitrillos, lo cuales ya fueron debidamente instalados en el sector de Salitrillos, la segunda etapa, a desarrollar es la instalación de 700 metros de tubería lo cual permitiría conectar a esta comunidad con los nuevos tanques de agua. Esta etapa se tenía prevista para iniciar a principios de este año, sin embargo, debido a la emergencia nacional por COVID -19 los trabajos tuvieron que reprogramarse para octubre de 2020. En conclusión, corresponde declarar no ha lugar la gestión presentada en cuanto a los recurridos Instituto Costarricense de Acueductos y Alcantarillados y en cuanto a la Municipalidad de Aserrí, pues si bien se ha tardado en dar cumplimiento a lo ordenado, se informa que el servicio de agua se ha venido prestando. Ahora bien, si la recurrente o cualquier otro vecino considera que el servicio prestado por la Municipalidad es violatorio del derecho al agua potable, podrá presentar un recurso nuevo con estos alegatos. Siendo que, dichos alegatos no corresponderían analizarse en este expediente, por tratarse de hechos nuevos.

Por tanto:

No ha lugar a la gestión de desobediencia. Notifíquese.- Fernando Castillo V.
