Amparo proceeding (recurso de amparo) processed under expediente número 20-009999-0007-CO, filed by AU SHUM TSANG, identity card 0800660941, and DANIELE PEYER, residence card 175600045409, against LA MUNICIPALIDAD DE ESCAZÚ and EL AREA RECTORA DE SALUD DE ESCAZU.
Findings:
In a written submission received by the Office of the Clerk of the Chamber at 12:29 on 05 de junio de 2020, the petitioners filed an amparo proceeding against the mayor, the head of the Road Management Technical Unit, and the head of the Environmental Management Department, all of the Municipalidad de Escazú, as well as the director and the officer responsible for the Health Regulation Process, both of the Área Rectora de Salud de Escazú. They state that on 27 de noviembre de 2019, the Comité de Desarrollo de Cuesta Grande filed an environmental pollution complaint with the Municipalidad de Escazú because the health and quality of life of residents in the area were being affected by several homes discharging sewage containing excrement into the roadside gutter and outside the residences, causing foul odors. They add that on 18 de diciembre de 2019, petitioner Verónica Shum Tsang filed a new complaint concerning the same events.
They state that, in an official letter dated 11 de diciembre de 2019, the respondent mayor’s office indicated that the alleged pollution problems fell within the jurisdiction of the Ministerio de Salud, without properly following up on the situation and instead referring the proceeding to another institution. They indicate that they approached the Ministerio de Salud and verbally filed the corresponding complaint; nevertheless, they reiterate that the Ministry is aware of the complaint because it was referred by the respondent Municipalidad. They state that the families affected by the pollution problems are residents of the neighborhood located at the intersection of calle Cuesta Grande and calle Isabel Agüero, in Escazú. They report that, because of the aforementioned problems, several residents organized to purchase pipes to prevent excrement from flowing through the gutters and causing fecal contamination; these conditions prevent them from eating or living with dignity in their own homes.
They note that, through official letter No. MSDRRSCS-ARSE-ERS-0438-2019 of 28 de junio de 2019, signed by the director and the officer responsible for the Health Regulation Process of the Área Rectora de Salud Escazú, that authority asked the mayor of Escazú to take a series of appropriate actions to provide a comprehensive solution to the complaint filed by Daniel Peyer. They allege that, despite the health orders (órdenes sanitarias) issued, the situation persists in clear violation of public health. They explain that the residents organized so that a private laboratory could evaluate samples at the site, where the laboratory Bioanalítica Pacífico Ltda detected foul odors, fecal matter, fats, oils, and various solids, among other substances. They complain that this situation causes them even greater concern because several media outlets have linked transmission of the COVID-19 virus to human feces, placing residents’ health at risk due to the Administration’s negligence and inaction.
They further state that the described pollution may cause people to contract hepatitis, a disease that puts their health at risk. They maintain that the respondent authorities have not taken the necessary action to verify the reported events and resolve the reported pollution problems. They consider their fundamental rights to have been violated.
By order issued at 11:21 on 08 de junio de 2020, the present proceeding was admitted for consideration, and the respondents were notified on 09 de junio de 2020.
Arnoldo Barahona Cortés, Jerson Calderón Valverde, and Cristian Boraschi González, in their respective capacities as mayor, coordinator of the Environmental Management Subprocess, and Urban Management manager, all of the Municipalidad de Escazú, report under oath (folio 62 of the electronic case file) that, in resolution Nº 2019-004583, this Constitutional Court dismissed a proceeding filed by the present petitioner concerning the same problem. They state that they have taken all legally and technically feasible actions, since the reported matter constitutes a public-health problem on properties, some of which lack construction permits. As part of the tasks to be performed, a schedule was established for applying fluorescent dye throughout the area, including calle Naranjo, calle Cuesta Grande, and calle Isabel Agüero. This work is being carried out in support of the Ministerio de Salud to identify possible violators—that is, sources of blackwater (aguas negras) and greywater (aguas grises).
These inspections were scheduled between 14 de abril and 24 de noviembre de 2020; to date, five have been conducted, four of which yielded positive results on public roads. In those cases, the matter and supporting evidence are referred to the Ministerio de Salud so that it may issue the corresponding health notice (notificación sanitaria). Since the national emergency due to COVID-19 was declared, no further inspections have been conducted because applying the dye requires entering homes, with the resulting risk to municipal personnel and residents. Inspections are expected to resume in the second week of junio. They describe the notices issued regarding the discharge of wastewater (aguas residuales) onto public roads and state that the property owners have not submitted any remediation plan (plan remedial); the case was therefore referred to the appropriate authorities. Regarding the complaint of 27 de noviembre de 2019, they describe the actions taken by the Municipalidad, which, in addition to the inspections and referrals already mentioned, include planning an intervention in the Cuesta Grande area. They request that the proceeding be dismissed.
Adolfo Ortiz Barboza, in his capacity as Director of the Área Rectora de Salud de Escazú, states under oath (folio 140 of the electronic case file) that on 16 de octubre de 2018, the appellant filed a complaint, which was answered that same day by official letter CS-ARSE-640-2018, informing him of the procedure to be followed in addressing his complaint, assigned consecutive number Nº 13739-18. The complaint Nº 13739-18 was internally scheduled for attention, with a visit to be conducted on 10 de enero del 2019. He states that on 20 de noviembre del 2018, Mr. Peyer was notified of the inspection appointment and asked whether he wished to be notified before the visit, to which he replied that he did not wish to be notified of the visit because the problem described was in a drainage ditch near his home and he was not directly affected, as evidenced by the Ocular Inspection Record (Acta de Inspección Ocular) RCS-ARSE-AIO-RS-121-RMAS-2018.
In February 2019, this Área Rectora received an amparo petition (Recurso de Amparo) under case file 19-001025-0007-CO, filed by Mr. Daniel Peyer concerning the same facts reported under consecutive number Nº13739-18; and, for purposes of resolving that amparo petition, on Thursday, 07 de febrero del 2019, an inspection visit was conducted at the location identified by the complainant, as recorded in Ocular Inspection Record Nº RCS-ARSE-AIO-RS-017-RMAS-2018. He adds that on 08 de febrero del 2019, Technical Report N°CS-ARSEERS-0186-2019 was issued, stating that the matters reported by Mr. Daniel Peyer could not be substantiated; Administrative Case File N° 13739-18 was therefore closed because no harm to public health had been established. During the inspection visit, a sodium fluorescein dye test was performed on each of the sanitary facilities in three dwellings located on the reported property, and all tests were negative, with Mr.
Daniel Peyer himself present; moreover, no offensive odors were perceived during the inspection. In other words, Mr. Daniel Peyer’s complaint was received on 16 de octubre del 2018 and assigned Administrative Case File N° 13739-18. That complaint was closed on 08 de febrero del 2019 through Technical Report N° CS-ARSE-ERS-0186-2019 because the matter reported by Mr. Daniel Peyer could not be substantiated, and he was duly notified on 11 de febrero de 2019. On 25 de junio del 2019, the Municipalidad de Escazú forwarded, through official letter UTGV-87-19, the case of Verónica Shum Tsang, Daniel Peyer, and Miguel Arias Jiménez, who reported sewage (aguas negras) pollution on the street known as Cuesta Grande (the intersection of Calle Cuesta Grande and Calle Isabel Agüero, San Antonio de Escazú). On 28 de junio de 2019, the Área Rectora de Salud issued and delivered official letters MS-DRRSCS-ARSE-ERS-0437-2019, MS-DRRSCS-ARSE-ERS-0438-2019, and MS-DRRSCS-ARSE-ERS-0439-2019 to the Municipalidad de Escazú, addressed to the Mayor and concerning the complaints made by Verónica Shum, Daniel Peyer, and Miguel Ángel Arias Jiménez, requesting information from the municipality in order to seek a comprehensive solution to the complaint. Specifically, the following was requested:
In a written submission received by the Secretariat of the Sala at 12:29 hours on 05 de junio de 2020 (folio 152 of the electronic case file), the appellant party responded to the reports submitted by the respondent authorities. It states that the municipal authorities acknowledge having detected a large number of dwellings that discharge polluted water into the drainage ditches and along the curb and gutter, but have done nothing about it and have not followed up on the case. It further states that the Ministerio de Salud authorities disregard the technical test submitted, asserting that only a test performed by them is valid, while doing nothing to obtain it.
The legal requirements have been observed in the proceedings conducted.
Justice Garro Vargas drafts the opinion; and,
Whereas:
Preliminary matter. Before analyzing the merits of the claim, it must be clarified that, since judgment No. 2008-02545, issued at 8:55 hours on 22 de febrero de 2008, this Sala has referred to the administrative litigation jurisdiction (jurisdicción contencioso administrativa)—with certain exceptions—matters in which it is disputed whether the public administration has complied with the time limits established by the Ley General de la Administración Pública. The present matter falls within an exception because it concerns a complaint relating to pollution and public health that allegedly was not resolved within a reasonable period. Having clarified that point, the Sala proceeds to decide the specific situation raised in this amparo proceeding.
Subject matter of the petition. The appellants contend that their fundamental rights have been violated because, despite repeatedly reporting the sewage and wastewater (aguas residuales) pollution problem in the Cuesta Grande sector, that pollution problem has not been remedied.
Proven facts. The following facts are deemed duly established and relevant to the decision in this matter, either because they have been substantiated or because the respondent failed to address them as ordered in the initial ruling:

Regarding the Fundamental Right to a Healthy and Ecologically Balanced Environment. On repeated occasions, this Court has elaborated on the scope of this right, enshrined in Article 50 of the Constitución Política. Environmental protection is an appropriate mechanism for safeguarding and improving everyone’s quality of life, making intervention by the Public Authorities necessary with respect to factors that may disturb the environment’s balance and prevent persons from developing and functioning in a healthy environment. The State is the guarantor of the protection and safeguarding of the environment and natural resources. Accordingly, oversight and enforcement (control y fiscalización) of environmental matters and activities constitute an essential function of the State; therefore, with respect to environmental protection, the functions of governance, oversight and enforcement in environmental matters belong to the State and are entrusted to its various administrative agencies.
Regarding the Specific Case. After analyzing the reports of the respondent authorities and the evidence submitted in the record, this Constitutional Court finds the alleged violation of the fundamental rights of the protected parties (amparados), as well as those of their neighbors, for the reasons set forth below. It has been established that the area known as Cuesta Grande lacks a sanitary sewer system and that sewage and wastewater (aguas residuales) are present on public roads, causing foul odors and health risks. The judicial record establishes that responsibility for the sanitary sewer system in the cantón de Escazú lies with the Municipalidad. It has likewise been established that both authorities (Municipalidad de Escazú and Área Rectora de Salud de Escazú) are aware of this problem, have exchanged correspondence regarding it, and have conducted inspections that confirmed the existence of unauthorized structures (obras irregulares) and sewage and wastewater on public roads, yet no concrete measures have been taken to resolve the problem at issue.
This Court has recognized that coordination among all public entities and bodies in exercising their powers and providing the services assigned to them by the legal system is one of the governing principles of administrative organization. Coordination, insofar as it ensures administrative efficiency and effectiveness, is a virtual or implicit constitutional principle that permeates the entire body of administrative law and binds all public entities; it may be inter-organizational (interorgánica)—among the various bodies comprising a public entity that are not subject to a hierarchical relationship—or intersubjective (intersubjetiva)—that is, among public entities, each possessing legal personality, its own budget, autonomy and specific powers—and its purpose is to prevent duplication and omissions in the exercise of each public entity’s administrative functions, ensuring that they are performed rationally and systematically (see, in this regard, judgment Nº 2007-015218, among others).
In the opinion of this Chamber, the case before us involves a serious public-health problem that affects the environment and the health of the community’s residents, and it is established that the respondent authorities have demonstrated an inability to enforce the applicable laws and fulfill their obligation to guarantee the residents of the area the enjoyment of a healthy and ecologically balanced environment, with the resulting consequences for their health given the nature of the public-health problem affecting them. In its consistent case law, the Chamber has held that human beings cannot be denied the right to a healthy environment and the right to health because the relevant public authorities are unable to exercise effectively the oversight powers and problem-solving authority granted to them by law. It is not sufficient to schedule inspections months in advance or to ask residents whether they consent to those inspections.
Both authorities possess sufficient and varied powers to ensure fulfillment of their duties. Nevertheless, despite having long been aware of the reported problem, the few measures they have taken have not been sufficient to resolve it. The persistence of the problem demonstrates that the few measures taken have clearly been insufficient, thereby giving rise to liability for failure to act (responsabilidad por omisión) in exercising powers whose nonexercise, in turn, violates the constitutional right of the administered persons (administrados) to receive efficient and effective public services. Moreover, the municipal authorities have failed to demonstrate that they responded in writing to the petitioners’ submissions. For the foregoing reasons, the petition for constitutional relief (recurso) must be granted so that both the respondent Municipalidad and the Ministerio de Salud coordinate with one another and take the measures necessary to provide an effective solution to this problem.
NOTE BY JUSTICE HERNÁNDEZ LÓPEZ REGARDING THE CLAIM ALLEGING VIOLATION OF ARTICLE 50 OF THE CONSTITUCIÓN POLÍTICA.
1. The historical context that once prompted the Chamber’s extensive intervention in environmental matters has changed considerably, requiring this body to reconsider the conditions for its participation in ensuring the right of persons to a healthy and balanced environment, as safeguarded under Article 50 of the Constitución Política. Indeed, the current situation—characterized by extremely extensive statutory and regulatory enactments that include substantive rules, procedures and the creation of bodies responsible for compliance with the provisions of the Fundamental Charter (Carta Fundamental)—is radically different from the previous situation, in which the absence of regulations and of State bodies with appropriate jurisdiction forced the Chamber to play a leading, nearly exclusive role in defending the aforementioned constitutional right.
2. Today, we face a “dense web” of environmental regulations, which has produced two significant phenomena: the first and most obvious is the emergence of comprehensive legal regulation of activities whose impact on the environment was previously subject to little or no regulation, as well as the creation of State bodies vested with powers to monitor and control the effects of human activity on the environment. The second phenomenon is that this growing legalization—predominantly through statutes and regulations—necessarily brings both administrative justice (justicia administrativa) and the ordinary courts (jurisdicción ordinaria)—primarily the contentious-administrative courts (jurisdicción contencioso administrativa), but also the criminal courts—into play. In these jurisdictions, consistent with the importance of environmental law, broad procedural avenues and inclusive rules on standing (medios de legitimación) have been established so that persons subject to the Administration may enforce the provisions of that extensive legal framework relating to environmental matters.
3. In that context, it is inappropriate, both legally and functionally, for the Sala Constitucional to displace—or, worse still, replace—the ordinary judicial bodies in performing their task, which is also constitutional in rank, of ensuring effective compliance with statutes and regulations. It is legally inappropriate because, in the vast majority of these cases, the Sala Constitucional is asked to interpret and enforce statutory and regulatory provisions, thereby risking an overlap between its jurisdiction and that of other judicial bodies that were specifically created to perform such tasks. It is also functionally inappropriate because the design of its proceedings is poorly suited to the complexity present in numerous environmental disputes, which involve sequences of technically and legally complex facts and acts. With respect to both issues, there are well-known examples in which the Sala Constitucional has issued a partial or technically incomplete decision, or in which unnecessary friction and harm to legal certainty have resulted.
4. Among the technical considerations I have assessed, I would add that this jurisdiction does not have judges responsible for enforcing judgments (jueces ejecutores de sentencia) who could provide adequate follow-up for such judgments—which are generally complex—and which sometimes require monitoring remedial plans, among other measures, with interinstitutional coordination and follow-up lasting months or even years.
5. From that perspective, this Tribunal’s decision to step aside in environmental matters should not be viewed as abandoning such matters but, on the contrary, as ensuring their proper protection before the forum best suited to their complexity and diversity. Nor should it be viewed as this jurisdiction declining its duty to protect the constitutional rights entrusted to it by the Constitución Política and its Ley Orgánica, a duty which, in my view, remains reserved in this area for specific cases. Rather, it is an exercise in reallocating the burdens and duties assigned to the various State bodies, so that each may fully perform its work within its assigned sphere, as well as an exercise of the power to determine its own jurisdiction, as provided in artículo 7 of its Ley Orgánica.
6. It is clear that the Sala Constitucional does not contemplate leaving the protection of individuals’ rights in environmental matters entirely to other jurisdictions. It is well established that, although any claim alleging a violation of statutory or regulatory provisions may ultimately be framed as a constitutional matter, some cases require nothing more than the application of constitutional law (derecho de la Constitución) for their resolution. The aim, therefore, is for the Sala Constitucional to become one of several leading actors so that—collectively, with each acting within its own sphere—they may address the full range of situations involved in protecting the right to a healthy and balanced environment within a society where other equally pressing needs also exist. I firmly believe that, under this position, citizens lose not one iota of protection, while substantial gains are made in breadth, perspective, and respect for the balance and distribution of powers, the latter being a principle that must necessarily be considered because it governs the constitutional dynamics of any liberal and democratic system such as ours.- 7.
Consistent with the foregoing, I maintain that this Sala Constitucional should refrain from hearing claims brought before it for alleged violations of artículo 50 of the Constitución Política, leaving their adjudication to administrative justice and the contentious-administrative jurisdiction. The foregoing is stated as a general rule, without prejudice to acknowledging that there are particular cases or categories of cases which, in my opinion, would still be better protected by this Sala Constitucional and therefore should be heard and decided by it.- Such categories of cases include, without this enumeration being regarded as a closed and definitive list, claims concerning environmental violations that also directly endanger human health or the availability or quality of water; and cases involving gross and direct violations of the environment in which there is a manifest absence of protection by State authorities, provided that the nature of the claim can be addressed through the constitutional relief action (amparo) as a summary and special procedural mechanism. I also believe that amparo proceedings should not be converted into ordinary proceedings in order to address, even in the cited cases, matters exceeding their capacity to deal with them adequately.
8. In this specific case, according to the proven facts (hechos probados), the petitioner’s claim could potentially affect the petitioner’s physical integrity, that of the petitioner’s family, and that of the persons living in the area known as Cuesta Grande, given the absence of sanitary sewerage and the discharge of sewage and wastewater onto public roads, with the resulting foul odors and health risks. Consequently, it is clear that this case falls within the exceptions mentioned, and for that reason I considered it necessary for the Sala Constitucional to exercise its jurisdiction to determine whether the alleged omissions violate the fundamental rights of the protected persons (personas amparadas).
NOTE BY MAGISTRATE SALAZAR ALVARADO. In environmental matters, it is the undersigned’s position that, if the Public Administration has already intervened, jurisdiction to hear and decide the matter lies with the contentious-administrative courts. Nevertheless, I do consider the merits of the matter when other rights of persons affected by the source of pollution are at stake, including health, quality of life, and the right to enjoy a healthy, pollution-free environment (artículo 50, of the Constitución Política), as occurs in this case, in which the petitioners consider their fundamental rights to have been violated. They allege that, despite repeatedly reporting the problem of pollution caused by sewage and wastewater in the Cuesta Grande area, the stated pollution problem has not been resolved, even though it affects the health and quality of life of residents because several homes discharge fecal wastewater into the curbside gutter and outside the residences, causing foul odors. The foregoing violates the right to enjoy a healthy and ecologically balanced environment and a dignified standard of quality of life.
DOCUMENTATION SUBMITTED TO THE CASE FILE. This Sala Constitucional must advise the petitioner that, if any paper documents, objects, or evidence stored on any additional device or on electronic, computer, magnetic, optical, or telematic media, or produced using new technologies, were submitted, they must be collected from the court office within 30 business days after receipt of notice of this judgment. Otherwise, all such materials will be destroyed in accordance with the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session No. 27-11 of 22 de agosto del 2011, artículo XXVI, and published in Boletín Judicial número 19 of 26 de enero del 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session No. 43-12 held on 3 de mayo del 2012, artículo LXXXI.

Revisión del Documento *200099990007CO* SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas quince minutos del tres de julio de dos mil veinte .
Recurso de amparo que se tramita en expediente número 20-009999-0007-CO, interpuesto por AU SHUM TSANG, cédula de identidad 0800660941, DANIELE PEYER , cédula de residencia 175600045409, contra LA MUNICIPALIDAD DE ESCAZÚ, EL AREA RECTORA DE SALUD DE ESCAZU.
Resultando:
Por escrito recibido en la Secretaría de la Sala a las 12:29 horas del 05 de junio de 2020, la parte recurrente interpone recurso de amparo contra el alcalde, jefe de la Unidad Técnica de Gestión Vial y el jefe del Departamento de Gestión Ambiental, todos de la Municipalidad de Escazú, así como el director y la encargada de Proceso Regulación de la Salud, ambos del Área Rectora de Salud de Escazú, y manifiesta que el 27 de noviembre de 2019 el Comité de Desarrollo de Cuesta Grande presentó ante la Municipalidad de Escazú una denuncia por contaminación ambiental, dado que se afecta la salud y calidad de vida de los vecinos de la zona, debido que varias casas de habitación lanzan aguas con excremento al cordón del caño y a las afueras de las viviendas, lo cual provoca malos olores. Añaden que el 18 de diciembre de 2019 la recurrente Verónica Shum Tsang presentó una nueva denuncia por los mismos hechos.
Señalan que por oficio de 11 de diciembre de 2019 la alcaldía recurrida indicó que los problemas de contaminación que se acusaban eran competencia del Ministerio de Salud, sin realizar un verdadero seguimiento sobre la situación y trasladando el procedimiento a otra institución. Indican que acudieron al Ministerio de Salud y de forma verbal presentaron la correspondiente denuncia, no obstante reitera que dicha denuncia es de conocimiento de ese Ministerio dado el traslado realizado por la Municipalidad recurrida. Señalan que las familias que se están viendo afectadas con los problemas de contaminación son los residentes del barrio ubicado en el cruce entre calle Cuesta Grande y calle Isabel Agüero, en Escazú. Refieren que debido a los problemas señalados, varios vecinos se organizaron para la compra de tuberías con la finalidad de evitar que el excremento fluya por los caños y ocasione un problema de contaminación por materia fecal, tales situaciones no permiten comer ni vivir dignamente en sus propios hogares.
Acotan que por oficio No. MSDRRSCS-ARSE-ERS-0438-2019 de 28 de junio de 2019 suscrita por el director y la encargada de Proceso Regulación de la Salud del Área Rectora de Salud Escazú esa autoridad solicitó al alcalde de Escazú realizar una serie de acciones pertinentes para dar una solución integral a la denuncia formulada por Daniel Peyer. Alegan que a pesar de las órdenes sanitarias emitidas, la situación persiste en clara lesión a la salud pública. Explican que los vecinos se organización para que un laboratorio privado valoraran muestras en el sitio, donde el laboratorio Bioanalítica Pacífico Ltda, detectó malos olores, materia fecal, grasas, aceites y sólidos diversos entre otros. Reclaman que dicha situación les preocupa en mayor grado, ya que en varios medios de comunicación se ha vinculado el contagio del virus COVID-19 por medio de heces humanas, lo que pone en riesgo la salud de los vecinos ante la negligencia e inacción de la Administración.
Por otra parte, señalan que por la contaminación descrita las personas pueden contraer hepatitis, enfermedad que pone en riesgo la salud de las personas. Sostienen que a las autoridades recurridas no han tomado las acciones del caso para verificar los hechos denunciados y solucionar los problemas de contaminación denunciados. Estiman lesionados sus derechos fundamentales.
Mediante resolución de las 11:21 horas del 08 de junio de 2020 se dio curso al presente recurso, lo cual se notificó a los recurridos en fecha 09 de junio de 2020.
Informa bajo juramento Arnoldo Barahona Cortés, Jerson Calderón Valverde y Cristian Boraschi González, en su condición de alcalde, coordinador del Subproceso de Gestión Ambiental y gerente de Gestión Urbana, todos de la Municipalidad de Escazú (folio 62 del expediente electrónico), que en la resolución Nº 2019-004583, este Tribunal Constitucional desestimó un recurso planteado por el aquí recurrente por la misma problemática. Refieren que han realizado las acciones que son legal y técnicamente posibles, puesto que lo denunciado constituye un problema de salud pública en predios que –algunos- no tienen permisos de construcción. Como parte de las tareas a realizar, se definió un cronograma de aplicación de fluorescencia en toda la zona, incluidas calle Naranjo, calle Cuesta Grande y calle Isabel Agüero. Dicha labor se realiza en apoyo al Ministerio de Salud, para detectar los posibles infractores (fuentes de aguas negras y grises).
Dichas inspecciones se programaron entre el 14 de abril y el 24 de noviembre de 2020; y a la fecha se han realizado cinco, de las cuales cuatro dieron positivas en vía pública. En esos casos, se traslada el asunto con pruebas al Ministerio de Salud, para que proceda con la correspondiente notificación sanitaria. Desde que se declaró la emergencia nacional por COVID-19, no se han realizado más inspecciones, por cuanto, para aplicar el colorante, se debe ingresar a las casas de habitación, con el consecuente riesgo para el personal municipal y los ciudadanos. Se tiene previsto retomar las inspecciones a partir de la segunda semana de junio. Refiere las notificaciones que se han realizado por salida de aguas residuales a vía pública, y señalan que los propietarios no han presentado plan remedial alguno, por lo que remitieron el caso a las instancias correspondientes. En lo que respecta a la denuncia de 27 de noviembre de 2019, refiere las acciones realizadas por la Municipalidad, que además de las inspecciones y traslados ya mencionados, incluye la proyección de una intervención en la zona de Cuesta Grande. Solicita se desestime el recurso planteado.
Informa bajo juramento Adolfo Ortiz Barboza, en su condición de Director del Área Rectora de Salud de Escazú (folio 140 del expediente electrónico), que el 16 de octubre de 2018, el recurrente presentó una denuncia que fue respondida el mismo día, mediante oficio CS-ARSE-640-2018, indicándole el procedimiento a seguir para la atención de su denuncia con el número de consecutivo Nº 13739-18. Se programó internamente, atención de la denuncia Nº 13739-18, para realizar visita el día 10 de enero del 2019. Refiere que el día 20 de noviembre del 2018, se le notificó al Sr. Peyer la cita de inspección y se le preguntó si él deseaba que se le avisara previo a la visita, a lo cual indicó que no deseaba que se le informara la visita ya que el problema descrito es en un caño cercano a su vivienda y que él no posee afectación directa según lo evidencia el Acta de Inspección Ocular RCS-ARSE-AIO-RS-121-RMAS-2018.
Para el mes de febrero del 2019 se recibió en esta área rectora un Recurso de Amparo bajo el expediente 19-001025-0007-CO interpuesto por el señor Daniel Peyer en cuanto los mismos hechos denunciados según consecutivo Nº13739-18; y con el fin de resolver dicho Recurso de Amparo, el día jueves 07 de febrero del 2019, se realizó visita de inspección al lugar señalado por el denunciante, según consta en el Acta de Inspección Ocular Nº RCS-ARSE-AIO-RS-017-RMAS-2018. Acota que el día 08 de febrero del 2019, se efectuó el Informe Técnico N°CS-ARSEERS-0186-2019 en el cual, se indica que, de lo denunciado por el Sr. Daniel Peyer, no se comprueba, por lo que se procede a archivar el Expediente Administrativo N° 13739-18 por no constatarse una afectación a la salud pública, por cuanto, el día de la visita de inspección, se realizó prueba de coloración con fluoresceína sódica a cada uno de los servicios sanitarios de tres viviendas ubicadas en la propiedad denunciada, siendo las mismas declaradas negativas estando inclusive presente el señor Daniel Peyer y durante el momento de la inspección no se percibieron olores molestos.
Dicho de otro modo, se conoció la denuncia del señor Daniel Peyer el día 16 de octubre del 2018, a la cual se le asignó el Expediente administrativo N° 13739-18. Dicha denuncia se cerró el 08 de febrero del 2019, mediante Informe Técnico N° CS-ARSE-ERS-0186-2019 al no constatarse el hecho denunciado por el señor Daniel Peyer, a quien se le notificó debidamente el día 11 de febrero de 2019. El día 25 de junio del 2019 la Municipalidad de Escazú trasladó por medio del oficio UTGV-87-19 el caso de Verónica Shum Tsang, Daniel Peyer y Miguel Arias Jiménez, quienes denuncian contaminación por aguas negras en la calle conocida como Cuesta Grande (intersección entre Calle Cuesta Grande y Calle Isabel Agüero, San Antonio de Escazú),y el 28 de junio de 2019 esa Área Rectora de Salud emitió e hizo entrega de los oficios MS-DRRSCS-ARSE-ERS-0437-2019, MS-DRRSCS-ARSE-ERS-0438-2019 y MS-DRRSCS-ARSE-ERS-0439-2019, en la Municipalidad de Escazú, dirigidas al Alcalde, en referencia a lo denunciado por Verónica Shum, Daniel Peyer y Miguel Ángel Arias Jiménez, solicitando información al municipio con el fin de buscar una solución integral a la denuncia, expresamente se solicitó lo siguiente:
Por escrito recibido en la Secretaría de la Sala a las 12:29 horas del 05 de junio de 2020 (folio 152 del expediente electrónico), la parte recurrente replica los informes de las autoridades recurridas. Indica que las autoridades de la municipalidad reconocen haber detectado una gran cantidad de viviendas que lanzas sus aguas contaminadas a los caños y al cordón del caño, pero no han hecho nada al respecto ni le han dado seguimiento al caso. Y las autoridades del Ministerio de Salud, desconocen la prueba técnica aportada indicando que únicamente tiene validez la realizada por ellos, sin que hagan nada para recabarla.
En los procedimientos seguidos se ha observado las prescripciones legales.
Redacta la Magistrada Garro Vargas; y,
Considerando:
De previo. Antes de analizar el fondo del alegato, debe aclararse que, a partir de la sentencia No. 2008-02545 de las 8:55 horas de 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa –con algunas excepciones – aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública. En el presente asunto, se plantea un supuesto de excepción, pues se está ante una denuncia relacionada con contaminación y salud pública, la cual presuntamente no ha sido resuelta en un plazo razonable. Aclarado el punto, se entra a resolver la situación concreta planteada en este amparo.
Objeto del recurso. Los recurrentes consideran lesionados sus derechos fundamentales, pues acusan que, a pesar de haber denunciado reiteradamente la problemática de contaminación por aguas negras y residuales en el sector de Cuesta Grande, no se ha solucionado el problema de contaminación indicado.
Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
Hechos no probados. No se estiman demostrados los siguientes hechos de relevancia para esta resolución:
Sobre el Derecho Fundamental a un Ambiente Sano y Ecológicamente Equilibrado. En reiteradas ocasiones este Tribunal ha desarrollado el contenido de este derecho, contemplado en el artículo 50 de la Constitución Política. La protección del ambiente es un mecanismo adecuado para tutelar y mejorar la calidad de vida de todos, lo que hace necesaria la intervención de los Poderes Públicos sobre los factores que pueden alterar su equilibrio y obstaculizar que la persona se desarrolle y desenvuelva en un ambiente sano. El Estado se constituye en el garante en la protección y tutela del medio ambiente y los recursos naturales. En este sentido, el control y fiscalización de la materia y actividad ambiental se constituye en una función esencial del Estado, por lo que tratándose de la protección ambiental, las funciones de rectoría, control y fiscalización de la materia ambiental, corresponden al Estado, a cargo de las diversas dependencias administrativas.
Sobre el caso concreto. Una vez analizados los informes de las autoridades recurridas y las pruebas aportadas a los autos, este Tribunal Constitucional constata la acusada lesión a los derechos fundamentales de los amparados, así como de sus vecinos, por las razones que a continuación se expondrán. Se verifica que en la zona denominada Cuesta Grande existe una problemática de ausencia de alcantarillado sanitario y de aguas negras y residuales en vía pública, con los consecuentes malos olores y riesgo sanitario. Está acreditado en el expediente judicial que la competencia del alcantarillado sanitario en el cantón de Escazú compete a la Municipalidad. En igual sentido, se tiene por constatado que ambas autoridades (Municipalidad de Escazú y Área Rectora de Salud de Escazú) conocen dicha problemática, han intercambiado correspondencia al respecto y realizado inspecciones, en las que se ha constatado la existencia de obras irregulares y de aguas negras y residuales en vía pública; sin que se hayan tomado acciones concretas tendentes a solucionar el problema de marras.
Este Tribunal ha reconocido que uno de los principios rectores de la organización administrativa lo constituye la coordinación que debe mediar entre todos los entes y órganos públicos al ejercer sus competencias y prestar los servicios que el ordenamiento jurídico les ha asignado. La coordinación, en cuanto asegura la eficiencia y eficacia administrativas, es un principio constitucional virtual o implícito que permea el entero ordenamiento jurídico administrativo y obliga a todos los entes públicos; puede ser interorgánica -entre los diversos órganos que conforman un ente público no sujetos a una relación de jerarquía- o intersubjetiva -esto es, entre los entes públicos, cada uno con personalidad jurídica, presupuesto propio, autonomía y competencias específicas-; y tiene por propósito evitar las duplicidades y omisiones en el ejercicio de las funciones administrativas de cada ente público, esto es, que sean desempeñadas de forma racional y ordenada (véase, al efecto, la sentencia Nº 2007-015218, entre otras).
A juicio de esta Sala, en la especie nos encontramos ante un problema sanitario grave que afecta al medio ambiente y la salud de los habitantes de la comunidad, y se constata que las autoridades accionadas han mostrado incapacidad para hacer cumplir las leyes en la materia y su obligación de garantizar el disfrute de los habitantes de la zona a un ambiente sano y ecológicamente equilibrado, con las consecuencias para la salud de esas personas debido a la naturaleza del problema sanitario que les aqueja. En reiterada jurisprudencia la Sala ha dicho que no se puede aceptar que a los seres humanos se les niegue el derecho a un ambiente sano, el derecho a la salud, debido a la incapacidad de las autoridades públicas correspondientes para ejercer efectivamente las potestades de vigilancia y la solución a los problemas otorgadas por ley. No basta con programar a meses plazo la realización de inspecciones o consultarle a los vecinos si están conformes con que se realicen dichas inspecciones.
Ambas autoridades poseen suficientes y variadas competencias para asegurar el cumplimiento de sus funciones. Sin embargo, a pesar de conocer de larga data la problemática denunciada, las pocas acciones que han desplegado no han sido suficientes para resolver la problemática ambiental denunciada. La persistencia del problema demuestra que las pocas acciones realizadas han sido claramente insuficientes, incurriendo así en responsabilidad por omisión en el ejercicio de esas potestades que, a su vez, lesionan el derecho constitucional de los administrados a que les presten servicios públicos eficientes y eficaces. Aunado a ello, no logran demostrar las autoridades municipales que hayan atendido, por escrito, las gestiones de los recurrentes. En razón de lo anterior, procede declarar con lugar el recurso, a fin que tanto la Municipalidad accionada como el Ministerio de Salud, coordinen entre sí y ejerzan las acciones necesarias para darle una solución efectiva a dicha problemática.
NOTA DE LA MAGISTRADA HERNÁNDEZ LÓPEZ RESPECTO DEL RECLAMO POR INFRACCIÓN DEL ARTÍCULO 50 DE LA CONSTITUCIÓN POLÍTICA.
1. El contexto histórico que motivó en su momento la amplia intervención de la Sala en materia ambiental, ha tenido una considerable variación que impone a este órgano reconsiderar las condiciones para su participación en el aseguramiento del derecho de las personas a un ambiente sano y equilibrado, tal y como ha sido tutelado en el artículo 50 de la Constitución Política. En efecto, la situación actual –caracterizada por una amplísima producción legal y reglamentaria que incluye reglas de fondo, procedimientos y creación de órganos para el cumplimiento de lo ordenado en la Carta Fundamental- es radicalmente diferente de la anterior, en la cual la ausencia de normativa y de instancias estatales con competencia apropiada, le impuso a la Sala un papel de protagonista, casi único, en la defensa del precitado derecho constitucional.
2. Hoy en día, nos encontramos frente a un “denso entramado” de normativa ambiental, lo cual ha producido dos fenómenos relevantes: el primero y más obvio, es el surgimiento de una abarcadora regulación jurídica respecto de actividades cuya incidencia en el ambiente estaba poco o nada ordenada, así la creación de órganos estatales con potestades de vigilancia y control sobre los efectos de la actividad humana en el entorno. El segundo fenómeno consiste en que esa creciente juridificación –predominantemente legislativa y reglamentaria– trae aparejada una ineludible entrada en escena tanto de la justicia administrativa como de la jurisdicción ordinaria -prioritariamente la contencioso administrativa, pero también la penal. En ellas, acorde con la importancia del derecho ambiental, se han regulado de forma amplia vías procesales y medios de legitimación incluyentes, de manera que los administrados puedan hacer valer lo establecido en ese amplio orden jurídico que se relaciona con el tema ambiental.
3. En ese contexto, no resulta apropiado jurídicamente, ni desde el punto de vista funcional, que la Sala Constitucional desplace, o -peor aún- sustituya, a los órganos de justicia ordinarios en la realización de su tarea, también de rango constitucional, de velar por el efectivo cumplimiento de leyes y reglamentos. Es impropio jurídicamente porque en la inmensa mayoría de estos casos lo que se solicita es que interprete y haga valer normas legales y reglamentarias con lo que arriesga traslapar sus competencias con las de otros órganos jurisdiccionales que –ellos sí- han sido creados para ejecutar tales tareas; y resulta también funcionalmente incorrecto, porque el diseño de sus procesos se aviene mal con la complejidad que está presente en numerosos conflictos ambientales que se componen de series de hechos y actos técnica y jurídicamente complejos. Sobre ambas cuestiones existen conocidos ejemplos en los que la Sala ha arrojado una resolución a medias o técnicamente incompleta, o bien se han generado fricciones innecesarias y afectación de la seguridad jurídica.
4. Como parte de los aspectos técnicos que he valorado, añado que está el hecho de que esta jurisdicción no cuenta con jueces ejecutores de sentencia que permitan darle seguimiento adecuado a las mismas -generalmente complejas-, que implican en ocasiones el seguimiento de planes remediales, entre otros, con coordinación interinstitucional y seguimiento de meses y hasta años.
5. Desde esa perspectiva, la decisión de dar un paso al lado en la materia ambiental por parte de este Tribunal no debe ser vista como un abandono de la materia ambiental, sino al contrario, de su adecuada tutela en la instancia que mejor se aviene a la naturaleza de su complejidad y diversidad. Asimismo tampoco debe ser visto como la declinación de esta instancia en su tarea de protección de los derechos constitucionales que le imponen la Constitución Política y su Ley Orgánica, que desde mi punto de vista, queda reservada en esta materia para casos específicos. Se trata más bien, de un ejercicio de reacomodo de las cargas y tareas que corresponden a los distintos órganos estatales, de manera que cada uno de ellos, pueda desplegar plenamente su labor dentro del ámbito que se le ha asignado, así como del ejercicio de fijar su propia competencia, según lo establece el artículo 7 de su Ley Orgánica.
6. Queda claro que la Sala no se plantea abandonar a otras jurisdicciones la labor de protección de los derechos de las personas en materia ambiental. Es conocido que si bien todo reclamo por infracción de normas legales y reglamentarias puede ser reconducido hasta el ámbito constitucional, existen casos cuya resolución no exige más que la aplicación del derecho de la Constitución. Se trata entonces de lograr que la Sala se convierta en protagonista junto con otros, de manera que –entre todos y cada uno en su espacio- se pueda cubrir toda la variedad de situaciones que presenta una protección del derecho a un medio ambiente sano y equilibrado dentro de una sociedad en la que también existen otras necesidades igual de acuciantes. Con esta posición creo firmemente que el ciudadano no pierde un ápice de protección pero se gana sustancialmente en amplitud, en perspectiva y en respeto al equilibrio y distribución de poderes, principio este último de obligada consideración, puesto que rige la dinámica constitucional de cualquier sistema liberal y democrático como el nuestro.- 7.
En línea con lo anterior, sostengo que esta Sala debe abstenerse de conocer los reclamos que se le presenten por supuesta infracción al artículo 50 de la Constitución Política para dejar en manos de la justicia administrativa y la jurisdicción contenciosa administrativa su conocimiento. Lo anterior se deja afirmado con carácter general, sin perjuicio de reconocer la existencia de casos particulares o grupos de casos que, según mi criterio, si resultarían aún mejor tutelados por esta Sala y por tanto deben ser conocidos y resueltos por ella.- Dentro de tales grupos de casos, y sin que esta enunciación pueda considerarse como una lista cerrada y definitiva, puedo señalar que la Sala debe reservarse el conocimiento de situaciones como por ejemplo los reclamos por infracciones ambientales que además pongan en riesgo directo la salud de las personas, o el acceso o calidad del agua; los casos de violaciones groseras y directas al ambiente y en los cuales se constate una palmaria ausencia de la protección por parte de las autoridades estatales, siempre y cuando además la naturaleza del reclamo permita ser abordado mediante el instrumento del amparo como instituto procesal sumario y especial, ya que estimo que tampoco se debe “ordinariar” el amparo para abordar, aún en estos casos citados, temas que rebasen la capacidad de ser atendidos adecuadamente en el mismo.

En el caso concreto, de conformidad con los hechos probados, el reclamo de la parte recurrente, podría eventualmente incidir en su integridad física, la de la su familia y de las personas que habitan en la zona denominada Cuesta Grande; lo anterior, ante la ausencia de alcantarillado sanitario y de aguas negras y residuales en vía pública, con los consecuentes malos olores y riesgo sanitario. En consecuencia, es claro que estamos ante las excepciones que mencionan y por esa razón he considerado necesario que la Sala ejerciera su competencia, para comprobar o descartar si las omisiones señaladas, vulneran los derechos fundamentales de las personas amparadas.
NOTA DEL MAGISTRADO SALAZAR ALVARADO. En asuntos ambientales, es criterio del suscrito, que si ya ha habido intervención de la Administración Pública, su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que los recurrentes consideran lesionados sus derechos fundamentales, pues acusan que, a pesar de haber denunciado reiteradamente la problemática de contaminación por aguas negras y residuales en el sector de Cuesta Grande, no se ha solucionado el problema de contaminación indicado, pese a que afecta la salud y calidad de vida de los vecinos de la zona, debido que varias casas de habitación lanzan aguas con excremento al cordón del caño y a las afueras de las viviendas, lo cual provoca malos olores. Lo anterior, con violación del derecho a disfrutar de un ambiente sano y ecológicamente equilibrado y de un nivel digno de calidad de vida.
DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Debe prevenir esta Sala a la parte recurrente que de haber aportado algún documentos en papel, así como objetos o pruebas respaldadas por medio de cualquier dispositivo adicional, o por medio de soporte electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho, en un plazo de 30 días hábiles, después de recibida la notificación de esta sentencia, de lo contrario todo ello será destruido de conformidad con lo establecido en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión No. 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión No. 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara con lugar el recurso. Se ordena a Arnoldo Barahona Cortés, Jerson Calderón Valverde y Cristian Boraschi González, en su condición de alcalde, coordinador del Subproceso de Gestión Ambiental y gerente de Gestión Urbana, todos de la Municipalidad de Escazú y a Adolfo Ortiz Barboza, en su condición de Director del Área Rectora de Salud de Escazú, o a quien en su lugar ocupe el cargo, realizar de forma coordinada y conjunta con los demás entes involucrados, las acciones que se encuentren dentro del ámbito de sus competencias para
