Amparo proceeding (recurso de amparo) filed by [Nombre 001], an older adult, married, identity card No. [Valor 001], against the Ministro de Salud and the Directora General del Servicio Nacional de Salud Animal del Ministerio de Agricultura y Ganadería.
Findings:
It requests that the present application for amparo be dismissed, because that Institution has not violated any fundamental right of the petitioner herein, since the Ministerio de Salud addressed the complaints concerning the foul odors generated at the livestock operation in question, processing and following up on them as required, including in coordination with SENASA, and issued a health order (orden sanitaria) requiring immediate action to address the reported problem. Compliance with that order will be monitored, and the necessary technical, administrative, and legal measures will continue to be taken to ensure such compliance.
Officials of the company El Arreo, the owner of the establishment, also participated in the same meeting, including Mr. Edgar Montero Barrantes and Mr. Rigoberto Núñez Zúñiga, who are responsible for operating the waste and water treatment systems at the site. The latter is a chemist and serves as the technical officer responsible for the Operational Reports submitted by the company to the Ministry of Health (Anexos 11 y 12). The following is transcribed from the aforementioned Inspection Form No. 212583: “The inspection revealed deficiencies and improper management of solid and liquid waste in the corral area, contributing to some extent to the production of an odor not characteristic of a confined cattle operation. It should be noted that the aforementioned deficiency is confined solely to the corrals… It is hereby ordered that, within 10 business days, a Corrective Action Plan addressing the aforementioned nonconformities be submitted to the nearest SENASA office, so that they may be corrected and public and animal health are not adversely affected.” (Anexo 11).
On 08 June 2020, the Dirección Regional Chorotega, through official letter SENASA-DRCH-058-2020, requested that the General Directorate of SENASA provide the assistance of an environmental management professional in seeking a solution to the present odor problem, because it did not have personnel with technical expertise in these matters. This was because SENASA is not the governing authority for waste and wastewater treatment, which, under the applicable regulations, falls within the authority of the Ministry of Health, while residents perceive that, because this is a livestock operation, SENASA is the agency that must respond to requests for a solution in this area. On Wednesday, 10 June 2020, the owner of the establishment emailed the ordered Corrective Action Plan. It was then analyzed and compliance was verified. (Anexo 13). On Thursday, 11 June 2020, assistance was received from Engineer Rebeca Gutiérrez Bermúdez, a specialist in waste treatment at livestock operations who works for MAG in the Dirección Regional Central Sur, Departamento de Extensión Agropecuaria, following a request for assistance and cooperation submitted to that Ministry to address the matters identified by the Dirección Regional Chorotega in official letter SENASA-DRCH-058-2020.
Although Engineer Gutiérrez does not work for SENASA and therefore lacks the official authority to issue a health order (orden sanitaria) to any establishment, she provided assistance in conducting an inspection visit and subsequently preparing a technical report that could serve as an input for addressing the problem. Accordingly, another visit was made to the establishment and Inspection Form No. 212595 was prepared, recording that, depending on Engineer Rebeca Gutiérrez’s analysis and the contents of her technical report once received, further instructions would be issued if necessary. (Anexo 14). On 15 June 2020, a copy was received of a letter prepared by the company CII S.A. El Arreo and addressed to Mr. Gerardo Castañeda, Mayor of Liberia, providing an update on the corrective plans for the odor problem, implementation of which was underway in accordance with the dates stipulated therein.
(Anexo 15). On 16 June 2020, a new complaint was received under number 00086512, filed by Mr. [Name 001], who stated as follows: “He files a formal complaint for violation of Article 50, second paragraph, of the Political Constitution, due to environmental pollution and foul odors, and requests the immediate closure of the operation until environmentally compliant operation that does not harm health can be guaranteed.” (Anexo 16). In response, and given the multiple interventions carried out, on 22 June 2020, Dr. Salazar Aragón replied to Mr. Gonzaga regarding the complaint and stated as follows: “…Allow me to extend my greetings. In response to the complaint filed with the institution concerning foul odors, and considering that the source of the pollution is the establishment Centro Internacional de Inversiones (CII S.A), which is authorized by the institution under CVO code 089400-01, the establishment has been routinely inspected throughout the period in which it has operated, resulting in continuous improvement in production.
However, during an inspection conducted jointly with MINSA, the establishment’s managers, and its respective environmental manager on Friday, 29 May, two nonconformities were observed. The first was deficiencies and improper management of solid and liquid waste in the corral area, contributing to some extent to the production of an odor not characteristic of a ‘confined’ cattle operation. It should be noted that the aforementioned deficiency is confined solely to the corrals. In addition, deficiencies were observed in the infrastructure of the facilities providing shade to the animals in production. Therefore, it was ordered that, within ten business days, a corrective action PLAN addressing the aforementioned NONCONFORMITIES be submitted…”. In addition, on 02 June 2020, the establishment was visited again and the D1 Environmental Assessment Form submitted to SETENA in 2011 was inspected; that form approved the project for 4000 animals, and an expansion of that permit for 7500 animals, processed by SETENA, is also in place.
During the same visit, it was agreed to continue reducing the population by 500 animals per week in order to reduce production and improve the efficiency of waste management; furthermore, no additional animals would be admitted until the odor problem had been brought under control. The field inspection verified the application of calcium hydroxide in the corrals for the purpose of alkalizing the soil and improving bacterial biological activity. During the visit, it was agreed to double the application of bacteria and enzymes to 4 times per week in order to reduce and/or eliminate odors. It was ordered that the application for approval of the location permit for the wastewater treatment system be submitted to MINSA within 24 hours. On Wednesday, 10 June, the establishment sent SENASA, within the prescribed period, the plan containing corrective measures for the NONCONFORMITIES identified on 29 May.
Therefore, on 11 June, a new joint visit was conducted with Dr. Marín, Director of the Dirección Regional Chorotega; Dr. Vargas of the Dirección Nacional de Operaciones SENASA; and Engineer Rebeca Gutiérrez, a MAG official with extensive knowledge of solid and liquid waste management in livestock operations. A report concerning the establishment would accordingly be prepared in the following days. 2.- Requested assistance from an environmental management professional. As previously mentioned, following official letter SENASA-DRCH-058-2020, the General Directorate of SENASA and the Dirección Nacional de Operaciones arranged for an assistance visit by Engineer Rebeca Gutiérrez, who traveled from the Región Central Sur of MAG to assist with the inspection and the preparation of a technical report that would support decision-making regarding the improvements needed by the establishment’s Wastewater Treatment System (Sistema de Tratamiento de Aguas Residuales, STAR); receipt of that report is therefore pending.
Additional comments: To provide a better understanding of the context of this report with respect to the complaints addressed concerning the generation of foul odors, the following comments are added: 1. The Ley General del Servicio Nacional de Salud Animal, No. 8495, in Article 56, established which establishments require a Veterinary Operating Certificate (Certificado Veterinario de Operación) issued by SENASA in order to operate, including those engaged in livestock production. However, special regulations not repealed by that Law grant and preserve the authority and governing role of the Ministry of Health and MINAE specifically to regulate environmental matters involving waste and wastewater, regardless of the type of establishment or the authorization required for it to operate or produce. These regulations include Decrees N°33601-S-MINAE, Reglamento de vertido y reuso de aguas residuales, and N°39887-S-MINAE, Reglamento de Aprobación de Sistemas de tratamiento de aguas residuales. 2.
For the foregoing reason, SETENA granted environmental viability (Viabilidad Ambiental) to that establishment through Administrative Resolution N°1899-2011-SETENA, subsequently expanded through Resolution N°2425-2017-SETENA, for which purpose the establishment was required to submit, among other materials, a detailed description of the project, including the corresponding design calculations. 3. Additionally, as shown in Anexo 7, the establishment prepares its Operational Reports and submits them to the Ministry of Health. Logic would therefore dictate that, if that is the agency to which they must be submitted by law, it is also the agency that approves or rejects the operation of those Waste and Wastewater Treatment Systems on the basis of the reports, inspections, or technical assessments of their operation. 4. Notwithstanding the statements in paragraphs 1 through 3, as may be inferred from this report, SENASA has acted with more than due diligence in addressing the public’s complaints, grievances, and requests, for the purpose of helping ensure that production can take place in harmony with the environment, consistent with the first objective mandated by Ley SENASA 8495: “Article 2—Objectives of the Law.
The objectives of this Law are: a) To preserve, promote, protect, and restore animal health in order to achieve greater animal welfare and productivity in harmony with the environment.” However, this does not mean that the Animal Health Service has in any way supplanted the authority or hierarchy held by other governmental entities by mandate of law with respect to the public health of the human population, the governance of health matters, or the protection of the environment. Based on the foregoing, it requests that this application for constitutional relief (recurso de amparo) be dismissed because this National Service promptly responded to the requests submitted by the citizen, conducted the corresponding inspections, and has remained ready to take any appropriate corrective action.
Justice Garro Vargas drafts the opinion; and,
Considering:
I.Subject matter of the appeal (recurso). The appellant alleges that, in Liberia, 300 meters past the bridge over the Río Colorado, on the road toward La Cruz, a high-volume confined cattle operation is being conducted, generating enormous quantities of waste that receive no treatment whatsoever. He states that the operation does not comply with environmental, health, and volume-related operating standards, thereby causing environmental pollution through waste and foul odors. He reports that the odor is unbearable from the location of the aforementioned facilities to the city of Liberia, which is situated approximately three kilometers from the operation, to the extent that people cannot eat normally because it causes nausea, vomiting, and health problems among a population of approximately 20 thousand people. The respondent authorities are aware of this situation, but no effective action is being taken to solve the problem.
II.Established facts (hechos probados). The following facts are deemed duly established and relevant to the resolution of this matter, either because they have been substantiated or because the respondents failed to address them as ordered in the initial ruling (auto inicial):
The facility was ordered to submit to the Ministerio de Salud, within 24 hours, its application for approval of the location permit for the wastewater treatment system (sistema de tratamientos de aguas residuales). On Wednesday, 10 de junio, the facility sent SENASA, within the ordered time limit, its plan of corrective actions addressing the NON-conformities identified on 29 de mayo; accordingly, on 11 de junio, a new visit was conducted jointly with Dr. Marín, Director Regional Chorotega; Dr. Vargas of the Dirección Nacional de Operaciones SENASA; and Eng. Rebeca Gutiérrez, an MAG official with extensive knowledge of solid- and liquid-waste management in livestock operations. A report to the facility would therefore be prepared in the following days (report of the Directora General del SENASA and documentary evidence submitted).
III.Regarding the fundamental right to a healthy and ecologically balanced environment (derecho fundamental a un ambiente sano y ecológicamente equilibrado). On repeated occasions, this Court has elaborated upon the content of this right, enshrined in Article 50 of the Constitución Política. Environmental protection is an appropriate mechanism for safeguarding and improving everyone’s quality of life, making intervention by the Public Authorities necessary with respect to factors that may disturb environmental balance and prevent individuals from developing and living in a healthy environment. The State is the guarantor of the protection and preservation of the environment and natural resources. In this regard, the control and oversight of environmental matters and activities constitute an essential function of the State. Accordingly, in matters of environmental protection, the functions of governance, control, and oversight of environmental matters belong to the State and are entrusted to its various administrative agencies.
IV.Regarding constitutional jurisdiction in environmental matters (competencia constitucional en materia ambiental). As this Chamber has repeatedly held in its case law, constitutional jurisdiction in environmental matters cannot be extended to the point that it becomes a mechanism for verifying the technical criteria set forth in regulations or by administrative authorities in environmental matters; rather, it is limited to determining whether the competent government agencies have fulfilled the obligation imposed on them by Article 50 of the Political Constitution to act responsibly and promptly to protect the environment. It has also been held that the admissibility of an amparo proceeding (recurso de amparo) is contingent upon proof of an infringement or threat to one or more of the rights or guarantees established in the Political Constitution or in the international human-rights instruments signed by the country.
This latter circumstance underscores the fundamentally summary nature of amparo proceedings, whose procedures are ill-suited to slow and complex evidentiary measures or to the need first to examine—by means of a declaratory ruling—whether the subconstitutional rights cited by the parties as part of the factual allegations in the amparo proceeding or the statutory report (informe de ley), as applicable, actually exist, since it is evident that this Chamber lacks jurisdiction over that issue. Under these circumstances, it is not appropriate for the Chamber to issue any ruling, whether affirmative or negative, in such cases, because in order to determine whether fundamental rights have been violated, that dispute must first be resolved as a matter of ordinary law.
V.Regarding the specific case. The petitioner alleges that approximately three kilometers toward La Cruz, Guanacaste, 300 meters past the bridge over the Colorado River on the Inter-American Highway, specifically where the GISA packing plant operated, on the east side of that highway, there is a high-volume cattle production and breeding operation known as a “confined cattle operation” (“tabulado”) (the breeding, raising, and feeding of cattle in confinement). He states that the resulting activity generates enormous quantities of waste that receive no treatment whatsoever. Nor does it comply with environmental, health, and volume-related operating standards, thereby causing environmental pollution through waste and foul odors. Indeed, when he drives past those facilities, the odors are unbearable despite his use of air conditioning and keeping the windows closed. He further states that, after traveling three kilometers toward La Cruz, he must open the windows to let the odor out and disinfect the vehicle to eliminate it.
He indicates that the odor is unbearable from the location of the aforementioned facilities all the way to the city of Liberia. The problem is so serious, he claims, that in Liberia—which is located approximately three kilometers from that operation—the stench of a pigsty is unbearable, to the point that people cannot eat normally because it causes nausea, vomiting, and health problems among a population of approximately 20 thousand people. Furthermore, the situation is well known to the health authorities and SENASA, because local residents have reported it to the regional Health and SENASA authorities, as well as through social media and local news outlets. However, they have taken no effective action to resolve the problem. For their part, the respondent authorities provide a detailed account of the measures taken, indicating that they have diligently addressed and continue to address the reported problem within the scope of their respective authority.
They also acknowledge that, in recent weeks, the Ministry of Health’s Liberia Health Governing Area and SENASA’s Liberia Office have received a series of complaints concerning this situation. The complaints attribute the unpleasant odors associated with animal waste, which are perceptible in the air in the city of Liberia and neighboring communities, particularly those near the Colorado River, to the establishment known as Centro Internacional de Inversiones S.A., located 1.5 km west of Arrocera El Sabanero, in Liberia.
VI.The legal system grants the authorities responsible for protecting the environment and public health broad powers to perform their duties. Both the Ley General de Salud and the Ley Orgánica del Ambiente, as well as related provisions, confer detailed authority upon the various organizational levels to which the exercise of preventive, inspection, enforcement, and other functions is delegated. Moreover, the respondents also possess the powers granted by the Ley General de la Administración Pública to ensure the best possible fulfillment of the purposes of the Administration. In the present matter, the petitioner complains of the respondents’ negligence in addressing the environmental pollution caused by the cattle-production facility, which the residents of Liberia have repeatedly and extensively reported. See, in this regard, the report submitted by the Director General of SENASA. The body of proven facts shows that the authorities have been aware of the problem for months and, although several administrative acts (actos administrativos) have been issued, none has been effective or efficient, since the situation persists.
As indicated above, it is beyond the nature of the remedy for protection (recurso de amparo) to analyze in these proceedings the origin, veracity, or severity of the alleged harm; the constitutional inquiry is limited to determining whether the respondent authorities have acted diligently in addressing and ultimately resolving this environmental problem. In that context, it has been demonstrated that, during the inspection conducted on 29 de mayo de 2020 by the Ministerio de Salud, together with SENASA officials, at Centro Internacional de Inversiones S.A. (also called El Arreo), where cattle-production activities are conducted, the reported odors were caused by an approximately 10 cm-deep accumulation of animal waste on the dirt floor which, when mixed with rainwater, causes organic matter to decompose, generating the gases that produce the unpleasant odors. SENASA officials therefore served a health order (orden sanitaria) on those responsible for the premises, requiring them to submit within 10 days an action plan to resolve the odor problem, while also ordering immediate measures such as reducing the cattle population to 60%, moving the cattle exclusively to the already cemented pens, and treating the unpleasant odors chemically, physically, or biologically.
As a follow-up to that situation, on 02 de junio de 2020, SENASA again visited the facility and conducted a documentary review of the D1 Environmental Assessment Form (formulario de Evaluación Ambiental D1) submitted to SETENA in el año 2011, which approved the project for 4000 animals and includes an expansion of that permit processed by SETENA for 7500 animals. During the same visit, it was agreed that the animal population would continue to be reduced by 500 animals per week in order to reduce production and improve the efficiency of waste management; moreover, no additional animals would be brought in until the foul-odor problem had been brought under control. The application of calcium hydroxide in the pens was verified in the field, its purpose being to alkalinize the soil and improve the bacteria’s biological activity. During the visit, it was agreed to double the application of bacteria and enzymes to 4 times per week in order to reduce and/or eliminate the odors.
The facility was ordered to submit to the Ministerio de Salud, within 24 hours, an application for approval of the location permit for the wastewater treatment system. On miércoles 10 de junio (within the prescribed period), the facility sent SENASA its plan of corrective measures for the NON-conformities identified on 29 de mayo; accordingly, on 11 de junio, another visit was conducted together with Dr. Marín Director Regional Chorotega, Dr. Vargas de la Dirección Nacional de Operaciones SENASA, and Ing. Rebeca Gutiérrez, a MAG official with extensive knowledge of solid- and liquid-waste management in livestock operations. A report to the facility was therefore to be prepared in the following days. Nevertheless, on 05 de junio de 2020, the Dirección de Área Rectora de Salud de Liberia received a letter from the Director Regional del Área de Conservación Guanacaste del Sistema Nacional de Áreas de Conservación forwarding official letter No. UNA-LAQAT-OFIC-078-2020, dated 04 de junio de 2020, signed by MSc. José Pablo Sibaja Brenes, Director General y Científico del Laboratorio de Química de la Atmósfera de la Universidad Nacional, stating that on 28 de mayo de 2020 that institution had taken three air measurements: one in central Liberia, one at río Colorado, and one at Parque Nacional Rincón de La Vieja.
The air measurement at río Colorado (coordinates 10°40’06’’ N y 85°28’58’’ O) yielded a result of 2,2 ppm of hydrogen sulfide (H2S), which, according to the same official letter, exceeds the 2,0 ppm level considered harmful to health. Accordingly, it was reported that although the responsible company was implementing the measures ordered by SENASA, the air pollution had become a public-health problem. The Dirección de Área Rectora de Salud de Liberia therefore issued a health order to SENASA, as the institution responsible for regulating and monitoring the livestock activities conducted by Centro Internacional de Inversiones S.A., ordering it to take immediate action as necessary to eliminate the air pollution produced by the livestock operations at that cattle-production facility. That decision was challenged by SENASA’s representative. As indicated above, these entities have broad authority to act, and although they are subject to legality and reasonableness, the fact remains that, because this matter involves a threat to the environment and public health, legality and formalities must yield.
Evidently, neither entity has succeeded in coordinating joint action to achieve a comprehensive solution to the reported problem. It is well established that coordination among public entities and bodies is essential to the proper exercise of their authority and provision of the services entrusted to them, since it ensures effectiveness and efficiency; it is therefore one of the governing principles of administrative organization (see, in this regard, vote No. 2015-001626). Under the foregoing premises, the arguments seeking to justify the Administration’s inaction in response to the residents’ repeated reports cannot be accepted, particularly because the reported pollution was acknowledged by the respondent authorities and confirmed by the Laboratorio de Química de la Atmósfera de la Universidad Nacional at levels that have developed into a public-health problem. This Chamber understands that the respondent authorities may disagree about how to address the situation, which has even led to the challenging of measures; however, in accordance with the aforementioned principle of administrative coordination (principio de coordinación administrativa), they could—and should—have acted immediately, using their authority to the fullest extent rather than using procedural formalities to excuse their delay.
The principle favoring administrative action (principio pro acto) requires the Administration to direct its actions toward the issuance of a final administrative act resolving the matter entrusted to it; and if the authorities had sufficient evidence to establish the presence of unpleasant odors around the reported property, as indeed they did, they should have taken the steps necessary to safeguard the well-being of the environment and the residents of Liberia. The lack of follow-up by all respondents is also conspicuous, since their inertia and inactivity forced the residents to return repeatedly to restate their reports, complaints, and grievances. This is understandable because a considerable amount of time must have elapsed for air pollution to reach such a level.
VII.Conclusion. Consequently, given that the reported uncontrolled and irregular activity is understood to persist at a level now considered to affect not only the environment but also the health of the general population, the petition must be granted, with the effects stated in the operative part (parte dispositiva) of this judgment.
1. The historical context that once prompted the Chamber’s extensive intervention in environmental matters has changed considerably, requiring this body to reconsider the conditions governing its participation in safeguarding the right of individuals to a healthy and ecologically balanced environment, as protected by article 50 of the Constitución Política. Indeed, the current situation—characterized by a vast body of statutory and regulatory provisions that includes substantive rules, procedures, and the creation of bodies to enforce the requirements of the Carta Fundamental—is radically different from the former situation, in which the absence of rules and of state bodies with appropriate authority compelled the Chamber to assume a leading, nearly exclusive role in defending the aforementioned constitutional right.
2. Today, we face a “dense web” of environmental regulations, which has produced two significant phenomena: the first and most obvious is the emergence of comprehensive legal regulation of activities whose environmental impact had previously been subject to little or no regulation, as well as the creation of state bodies with powers to monitor and control the effects of human activity on the environment. The second phenomenon is that this increasing juridification—predominantly through statutes and regulations—inevitably brings both administrative justice and the ordinary courts into play, primarily the administrative-litigation jurisdiction (jurisdicción contencioso administrativa), but also the criminal jurisdiction. Consistent with the importance of environmental law, these jurisdictions have broadly established procedural avenues and inclusive standing mechanisms (medios de legitimación), enabling regulated persons (administrados) to enforce the provisions of the extensive body of law relating to environmental matters.
3. In that context, it is not legally or functionally appropriate for the Sala Constitucional to displace, or—even worse—replace, the ordinary courts (órganos de justicia ordinarios) in performing their task, which is also constitutional in rank, of ensuring effective compliance with laws and regulations. It is legally inappropriate because, in the vast majority of these cases, what is requested is that it interpret and enforce statutory and regulatory provisions, thereby risking an overlap between its jurisdiction and that of other judicial bodies that—unlike it—were created to perform such tasks; and it is also functionally inappropriate because the design of its proceedings is ill-suited to the complexity present in numerous environmental disputes involving series of technically and legally complex facts and acts. Regarding both issues, there are well-known examples in which the Sala has issued a partial or technically incomplete decision, or in which unnecessary friction and impairment of legal certainty (seguridad jurídica) have arisen.
4. Among the technical considerations I have assessed, I would add the fact that this jurisdiction does not have judges responsible for enforcing judgments (jueces ejecutores de sentencia) who could provide appropriate follow-up to those judgments—which are generally complex—and which sometimes involve monitoring remedial plans (planes remediales), among other matters, with interinstitutional coordination and follow-up lasting months or even years.
5. From that perspective, this Court’s decision to step aside in environmental matters should not be viewed as abandoning such matters, but rather as ensuring their proper protection before the forum best suited to their complexity and diversity. Nor should it be viewed as this forum’s relinquishment of its duty to protect the constitutional rights entrusted to it by the Constitución Política and its Ley Orgánica, a duty which, in my view, remains reserved in this area for specific cases. Instead, it is an exercise in reallocating the burdens and duties incumbent upon the various state bodies, so that each may fully carry out its work within its assigned sphere, as well as an exercise of determining its own jurisdiction, as established by Article 7 of its Ley Orgánica.
6. It is clear that the Sala does not intend to leave the task of protecting people’s rights in environmental matters entirely to other jurisdictions. It is well known that, although any claim alleging a violation of statutory and regulatory provisions may ultimately be brought within the constitutional sphere, there are cases whose resolution requires nothing more than the application of constitutional law (derecho de la Constitución). The aim, therefore, is for the Sala to become one of several leading participants, so that—collectively, with each acting within its own sphere—the full range of situations involved in protecting the right to a healthy and balanced environment may be addressed within a society in which other equally pressing needs also exist. With this position, I firmly believe that citizens lose not one iota of protection, while substantial gains are made in breadth, perspective, and respect for the balance and distribution of powers, the latter being a principle that must be taken into consideration because it governs the constitutional dynamics of any liberal and democratic system such as ours.- 7.
In keeping with the foregoing, I maintain that this Sala should refrain from hearing claims brought before it for alleged violations of Article 50 of the Constitución Política, leaving them to be heard by the administrative justice system and the contentious-administrative jurisdiction (jurisdicción contenciosa administrativa). The foregoing is stated as a general rule, without prejudice to recognizing the existence of particular cases or categories of cases that, in my view, would continue to receive better protection from this Sala and should therefore be heard and decided by it.- Among those categories of cases, without this enumeration being regarded as a closed and definitive list, I would note that the Sala should retain jurisdiction over situations such as claims involving environmental violations that also directly endanger people’s health or access to or the quality of water; cases involving egregious and direct violations of the environment in which there is a manifest absence of protection by state authorities, provided that the nature of the claim also permits it to be addressed through the remedy of amparo (amparo) as a summary and special procedural mechanism, since I also believe that the amparo proceeding should not be turned into an ordinary proceeding in order to address, even in the cited cases, issues that exceed its capacity to deal with them adequately.
8. In this specific case, according to the proven facts, the appellant’s claim could potentially affect the appellant’s health and physical integrity, as well as those of the people who live in the city of Liberia, because it involves a scientifically verified problem of air pollution caused by waste from livestock activities. Consequently, it is clear that this case falls within the aforementioned exceptions, and for that reason I considered it necessary for the Sala to exercise its jurisdiction in order to verify or rule out whether the alleged omissions violate the fundamental rights of the protected persons.
In environmental matters, it is the undersigned’s view that, if the Public Administration has already intervened, the matter must be heard and decided by the contentious-administrative jurisdiction. Nevertheless, I do address the merits when other rights of the persons affected by the source of pollution are at stake, including health, quality of life, and the right to enjoy a healthy and pollution-free environment (Article 50 of the Constitución Política), as in this case, which concerns alleged pollution caused by a high-volume confined-cattle operation that generates enormous quantities of untreated waste and fails to comply with environmental, health, and volume-related operating standards, producing pollution from waste and foul odors. This was reported to the Ministerio de Salud and to the Servicio Nacional de Salud Animal del Ministerio de Agricultura y Ganadería, without the problem having been definitively resolved, thereby impairing the right to a healthy and ecologically balanced environment.
This Sala must advise the appellant that, if any paper documents, objects, or evidence stored on any additional device or in electronic, computerized, magnetic, optical, telematic, or new-technology media were submitted, they must be collected from the court office within 30 business days after notification of this judgment is received; otherwise, all such materials will be destroyed in accordance with the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session No. 27-11 of 22 de agosto del 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 de enero del 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session No. 43-12 held on 3 de mayo del 2012, Article LXXXI.
Por tanto:
The appeal is granted. Consequently, the following is ordered: 1) Daniel Salas Peraza and Silvia Johanna Niño Villamizar, respectively, in their capacities as Ministro de Salud and Directora General del Servicio Nacional de Salud Animal del Ministerio de Agricultura y Ganadería, or whoever may hold those offices in their stead, shall, jointly and in coordination: a) immediately adopt the measures necessary to ensure that, within a maximum period of TWO MONTHS from notification of this judgment, a remedial plan has been prepared to resolve the air-pollution problem alleged in this amparo; b) implement and carry out that plan to provide a definitive solution to that problem within TEN MONTHS from notification of this judgment; c) immediately adopt the measures necessary to mitigate that pollution. 2) Daniel Salas Peraza, in his capacity as Ministro de Salud, or whoever may hold that office in his stead, shall, once the aforementioned ten-month period has elapsed and the pollution problem has therefore been resolved, arrange within TWO MONTHS for the measurement of hydrogen sulfide (H2S) in the air and shall communicate the result of the assessment to the appellant and to the affected population surrounding the reported establishment by whatever means is deemed appropriate.
They are warned that failure to comply with the stated order will constitute the offense of disobedience and that, pursuant to Article 71 of the law governing this jurisdiction, any person who receives an order issued in an amparo proceeding that the person is required to comply with or enforce and fails to comply with or enforce it shall be sentenced to imprisonment for three months to two years, or a fine of twenty to sixty day-fines, provided that the offense is not subject to a more severe penalty. The State is ordered to pay the costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed during enforcement of the judgment before the contentious-administrative jurisdiction. Recurso de amparo interpuesto por [Nombre 001], adulto mayor, casado, cédula de identidad No. [Valor 001], contra el Ministro de Salud y la Directora General del Servicio Nacional de Salud Animal del Ministerio de Agricultura y Ganadería.
Resultando:
Redacta la Magistrada Garro Vargas; y,
Considerando:
I.Objeto del recurso. El recurrente alega que, en Liberia, 300 metros después del puente sobre el Río Colorado, carretera hacia La Cruz, opera una actividad de ganado estabulado de alto volumen, la cual genera enormes cantidades de desechos que no reciben tratamiento alguno. Dice que la operación de dicha actividad no cumple las normas de operación ambiental, de salud y volumen generando contaminación ambiental por los desechos y malos olores. Refiere que el olor es insoportable desde el lugar en que se encuentran ubicadas las citadas instalaciones, hasta la ciudad de Liberia que está situada aproximadamente a tres kilómetros de distancia de dicha actividad, al extremo de que no se puede comer en forma normal, pues produce nauseas, vómito y problemas de salud en una población de alrededor de 20 mil personas. Situación que es conocida por las autoridades recurridas, pero no se toman acciones efectivas para solucionar el problema.
II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque los recurridos hayan omitido referirse a ellos según lo prevenido en el auto inicial:
a)En las últimas semanas se han recibido en el Área Rectora de Salud de Liberia del Ministerio de Salud y en la Oficina en Liberia de SENASA, una serie de denuncias por olores desagradables relacionados con desechos de animales, que se perciben en el aire en la ciudad de Liberia y poblados vecinos, principalmente los cercanos al río Colorado, que se atribuyen al establecimiento denominado Centro Internacional de Inversiones S.A., ubicado 1.5 km al oeste de la Arrocera El Sabanero, en Liberia (informes de las autoridades recurridas).
b)El 29 de mayo de 2020, para la atención de las denuncias, el Ministerio de Salud realizó una inspección, en conjunto con funcionarios del SENASA, al Centro Internacional de Inversiones S.A. (también llamado El Arreo), ubicado en Barrio Colorado, de la Arrocera El Sabanero, 1.5 km al oeste (antiguo GISA), en donde se realizan actividades de producción de ganado bovino (informe del Ministro de Salud y prueba documental aportada).
c)Según la inspección realizada el 29 de mayo de 2020, los olores que se perciben y que son objeto de denuncia, son debido a una acumulación de residuos de los animales en el piso de tierra de aproximadamente 10 cm de alto y al mezclarse con el agua de lluvia, esto provoca una descomposición de la materia orgánica que genera los gases que producen los olores desagradables. Los funcionarios de SENASA notificaron una orden sanitaria a los responsables del lugar para que presentaran en 10 días un plan de acciones para la solución del problema de los olores, además de ordenar acciones inmediatas como reducción del ganado a un 60%, pasar el ganado a los corrales ya cementados únicamente y tratamiento químico, físico o biológico de los olores desagradables (informe del Ministro de Salud y prueba documental aportada).
d)El 02 de junio de 2020, SENASA visitó de nuevo el establecimiento y se hizo inspección documentaria del formulario de Evaluación Ambiental D1 presentado al SETENA en el año 2011, el cual aprobó el proyecto para 4000 animales y cuenta con una ampliación a ese permiso tramitado por SETENA para 7500 animales. En la misma visita se acordó continuar con una disminución o despoblación de 500 animales por semana, a fin de reducir la producción y mejorar la eficiencia del manejo de desecho, además no se hará ingreso de más animales, hasta tanto no se haya regulado el problema de malos olores. Se verifica a nivel de campo la aplicación de hidróxido de calcio en los corrales, con el propósito de alcalinizar el suelo y mejorar la actividad biológica de las bacterias. Se acuerda en la visita duplicar la aplicación de las bacterias y de enzimas a 4 veces por semana con el fin de reducir y/o eliminar los olores.
Se ordena presentar la solicitud de aprobación del permiso de ubicación del sistema de tratamientos de aguas residuales en el Ministerio de Salud en 24 horas. El establecimiento envía a SENASA el miércoles 10 de junio (dentro del tiempo ordenado), el plan con las acciones correctivas de las NO conformidades encontradas el pasado 29 de mayo, por lo tanto, el 11 de junio se realizó una nueva visita en conjunto con el Dr. Marín Director Regional Chorotega, Dr. Vargas de la Dirección Nacional de Operaciones SENASA, Ing. Rebeca Gutiérrez funcionaria del MAG con amplios conocimientos en manejos de desechos sólidos y líquidos por actividades pecuarias. Siendo así que en los días posteriores se efectuará un informe al establecimiento (informe de la Directora General del SENASA y prueba documental aportada).
e)El 05 de junio de 2020, se recibió en la Dirección de Área Rectora de Salud de Liberia el oficio No. ACG-DIR-194-2020, de esa misma fecha, del Ing. Alejandro Masis Cuevillas, Director Regional del Área de Conservación Guanacaste del Sistema Nacional de Áreas de Conservación, mediante el cual traslada el oficio No. UNA-LAQAT-OFIC-078-2020, del 04 de junio de 2020, suscrito por el MSc. José Pablo Sibaja Brenes, Director General y Científico del Laboratorio de Química de la Atmósfera de la Universidad Nacional, en el cual se indica que el 28 de mayo de 2020 dicha institución realizó tres mediciones en el aire, a saber: una en Liberia centro, en río Colorado y en el Parque Nacional Rincón de La Vieja, siendo que la medición en el aire en el río Colorado (coordenadas 10°40’06’’ N y 85°28’58’’ O) se obtuvo un resultado de 2,2 ppm de ácido sulfhídrico (H2S), lo cual, según el mismo oficio, representa niveles por arriba de los 2,0 ppm que son perjudiciales para la salud (informe del Ministro de Salud y prueba documental aportada).
f)Aunque la empresa responsable está implementando medidas ordenadas por SENASA, el problema de la contaminación atmosférica pasó a ser un problema de salud pública, por lo cual, la Dirección de Área Rectora de Salud de Liberia emitió el oficio MS-DRRSCH-DARSL-390-2020, en base al cual se notificó a SENASA la Orden Sanitaria No. 689-2020, del 09 de junio de 2020, por ser esta la institución a cargo de la regulación y vigilancia de las actividades ganaderas que realiza el Centro Internacional de Inversiones S.A., ordenándose que de forma inmediata se tomen las acciones necesarias para eliminar la contaminación atmosférica producida por la actividad ganadera que se realiza en ese establecimiento de producción bovina, ubicado en Barrio Colorado de Liberia (informe del Ministro de Salud y prueba documental aportada).
g)El Director Regional de SENASA, Dr. Harold Marín Esquivel, presentó contra la Orden Sanitaria No. 689-2020 recurso de revocatoria con apelación en subsidio, el cual se encuentra en trámite (informe del Ministro de Salud).
h)El 15 de junio de 2020, se realiza una nueva inspección a lugar por parte del funcionario Bach. Armando Mendoza García, Gestor Ambiental del Área Rectora de Salud de Liberia, quien refiere las acciones que se están realizando en el lugar, entre estas, que en los corrales de piso de tierra en donde se localizó el problema de descomposición de materia orgánica que generan los gases que producen los olores, se están retirando los lodos para la construcción de capa de concreto, se disminuyó la cantidad de animales a 2000 animales en este momento aproximadamente para un mejor control de vectores, tratamiento y disposición de residuos sólidos y líquidos, se observa también limpieza en el entorno de los corrales, lastreo de caminos internos para la distribución de alimentos, equipo de extrusado de lodos (máquina de separar los sólidos de los líquidos), se está aplicando bacterias como tratamiento biológico para minimizar los olores, tratamiento de compost, en los corrales de piso de tierra se está aplicando carbonato de calcio y posteriormente se sacan los lodos. Al momento de la inspección se habían construido 35 pisos de concreto en corrales de 80 que se tienen planificados. Las lagunas están recibiendo tratamiento de productos biológicos para su estabilización y control de olores (informe del Ministro de Salud y prueba documental aportada).
i)El 19 de junio de 2020, la Dirección del Área Rectora de Salud de Liberia recibió copia de correo electrónico del funcionario de SENASA que tiene a cargo el caso, Sr. Ricardo Salazar Aragón, quien emite su criterio sobre el estado actual de la situación indicando que por la magnitud de la producción intensiva existente en el establecimiento, es imposible erradicar en su totalidad los olores en tan corto plazo, por ejemplo, aún eliminando el 100% de los animales el día de hoy, la presencia del olor va a permanecer por unas semanas mientras es tratado el establecimiento. Indica que, ya que se ha percibido una mejoría en algún grado debido a las acciones correctivas aplicadas y que algunas corresponden a una acción de corto plazo, otras mediano y largo plazo (informe del Ministro de Salud).
j)Todavía es posible percibir malos olores en ciertas horas del día, por lo que SENASA permanecerá vigilantes del cumplimiento de las órdenes giradas y de la evolución del problema, ya que, al ser procesos biológicos de degradación de la materia orgánica, los efectos de las medidas se van viendo con el paso de los días (informe de la Directora General del SENASA).
III.Sobre el derecho fundamental a un ambiente sano y ecológicamente equilibrado. En reiteradas ocasiones este Tribunal ha desarrollado el contenido de este derecho, contemplado en el artículo 50 de la Constitución Política. La protección del ambiente es un mecanismo adecuado para tutelar y mejorar la calidad de vida de todos, lo que hace necesaria la intervención de los Poderes Públicos sobre los factores que pueden alterar su equilibrio y obstaculizar que la persona se desarrolle y desenvuelva en un ambiente sano. El Estado se constituye en el garante en la protección y tutela del medio ambiente y los recursos naturales. En este sentido, el control y fiscalización de la materia y actividad ambiental se constituye en una función esencial del Estado, por lo que, tratándose de la protección ambiental, las funciones de rectoría, control y fiscalización de la materia ambiental, corresponden al Estado, a cargo de las diversas dependencias administrativas.
IV.Respecto a la competencia constitucional en materia ambiental. Tal y como ha sido reiterado en la jurisprudencia de esta Sala, la competencia constitucional en materia ambiental no puede extenderse al punto en que se convierta en un verificador de los criterios técnicos vertidos en las normas o por las autoridades administrativas en materia ambiental, sino que se limita a constatar si las dependencias estatales competentes han cumplido la obligación que les impone el artículo 50 de la Constitución Política, de asumir una actuación responsable y oportuna respecto a la protección del ambiente. Se ha sostenido también, que la procedencia del recurso de amparo está condicionada a que se acredite la existencia de una perturbación o amenaza a uno o más de los derechos o garantías contemplados en la Carta Política o en los instrumentos internacionales de derechos humanos suscritos por el país. Esta última circunstancia pone de relieve el carácter eminentemente sumario del proceso de amparo, cuya tramitación no se aviene bien con la práctica de diligencias probatorias lentas y complejas, o con la necesidad de entrar previamente a examinar -con carácter declarativo- si existen en realidad o no derechos de rango infra constitucional que las partes citen como parte del elenco fáctico del recurso de amparo o del informe de ley, según sea el caso, toda vez que es evidente que esa es una competencia de la que esta Sala carece.
Ante esta situación, no resulta procedente que la Sala vierta pronunciamiento alguno (positivo o negativo) en estos casos, porque para dilucidar si ha habido infracción o no de derechos fundamentales primero se debe resolver dicho conflicto en el plano de la legalidad.
V.Sobre el caso concreto. El recurrente acusa que aproximadamente a tres kilómetros hacia la Cruz, Guanacaste, 300 metros después del puente sobre río Colorado, carretera Interamericana, propiamente donde operaba la empacadora GISA, al costado este de esa carretera, existe un desarrollo y crianza de ganado conocido como "tabulado" (crianza, desarrollo y alimentación de ganado encerrado) de alto volumen. Dice que la actividad resultante genera enormes cantidades de desechos que no reciben tratamiento alguno. Tampoco cumple las normas de operación ambientales, de salud y volumen, generando contaminación ambiental por los desechos y los malos olores. Tan así es, que cuando pasa en vehículo por el frente de las referidas instalaciones, dichos olores le resultan insoportables, a pesar de ir con aire acondicionado y con los vidrios cerrados. Adicionalmente, afirma que después de circular tres kilómetros hacia la Cruz, requiere abrir vidrios para que el olor salga, así como desinfectar la máquina para eliminarlo.
Señala que el olor es insoportable desde el lugar en que se encuentran ubicadas las citadas instalaciones, hasta la ciudad de Liberia. Tan grave es el problema, asegura, que en Liberia -que está situada aproximadamente a tres kilómetros de distancia de dicha actividad-, el hedor a porqueriza es insoportable, al extremo de que no se puede comer en forma normal, pues produce nauseas, vómito y problemas de salud en una población de alrededor de 20 mil personas. La situación, además, es bastante conocida por las autoridades de salud y SENASA, ya que los vecinos la han denunciado ante las autoridades regionales de Salud y SENASA, y por medio de las redes sociales y los medios de comunicación locales. Sin embargo, no toman acciones efectivas para solucionar el problema. Por su parte, las autoridades recurridas realizan un detallado recuento de las actuaciones desplegadas, indicando que han atendido diligentemente y siguen atendiendo dentro del marco de sus competencias la problemática expuesta.
Aunado a que aceptan que en las últimas semanas se han recibido en el Área Rectora de Salud de Liberia del Ministerio de Salud y en la Oficina en Liberia de SENASA, una serie de denuncias por esa situación, cuyos olores desagradables relacionados con desechos de animales, que se perciben en el aire en la ciudad de Liberia y poblados vecinos, principalmente los cercanos al río Colorado, se atribuyen al establecimiento denominado Centro Internacional de Inversiones S.A., ubicado 1.5 km al oeste de la Arrocera El Sabanero, en Liberia.
VI.El ordenamiento jurídico concede a las autoridades encargadas de la tutela del ambiente y de la salud pública amplias facultades para cumplir con sus funciones. Tanto la Ley General de Salud, como la Ley Orgánica del Ambiente y las normas conexas, confieren competencias detalladas a los distintos niveles de organización en que se delega el ejercicio de las funciones preventivas, de inspección, sancionatorias, etc. Por otra parte, los recurridos cuentan también con las potestades que la Ley General de la Administración Pública otorga para asegurar el mejor cumplimiento posible de los fines de la Administración. En el presente asunto, el recurrente reclama la negligencia de los accionados para atender el problema de contaminación ambiental que genera el establecimiento de producción bovina que ampliamente y en reiteradas ocasiones los pobladores de Liberia han denunciado. Véase, en ese sentido, el informe rendido por la Directora General del SENASA.
Del elenco de hechos probados se desprende que las autoridades conocen la problemática referida desde hace meses y si bien se han dictado varios actos administrativos, ninguno ha sido eficaz y eficiente, pues lo cierto es que la situación persiste. Tal y como se indicó supra, excede la naturaleza del recurso de amparo analizar en esta sede el origen, la veracidad o gravedad del daño denunciado, y la trascendencia constitucional se limita en verificar si las autoridades accionadas han sido diligentes en atender y solventar finalmente dicha problemática ambiental. En ese contexto, ha quedado demostrado que en la inspección realizada el 29 de mayo de 2020, por el Ministerio de Salud, en conjunto con funcionarios del SENASA, al Centro Internacional de Inversiones S.A. (también llamado El Arreo), donde se realizan actividades de producción de ganado bovino, los olores que se perciben y que son objeto de denuncia, son debido a una acumulación de residuos de los animales en el piso de tierra de aproximadamente 10 cm de alto, que al mezclarse con el agua de lluvia, provoca una descomposición de la materia orgánica que genera los gases que producen los olores desagradables.
Por ello, los funcionarios de SENASA notificaron una orden sanitaria a los responsables del lugar para que presentaran en 10 días un plan de acciones para la solución del problema de los olores, además de ordenar acciones inmediatas como reducción del ganado a un 60%, pasar el ganado a los corrales ya cementados únicamente y tratamiento químico, físico o biológico de los olores desagradables. En seguimiento de esa situación, el 02 de junio de 2020, SENASA visitó de nuevo el establecimiento y se hizo inspección documentaria del formulario de Evaluación Ambiental D1 presentado al SETENA en el año 2011, el cual aprobó el proyecto para 4000 animales y cuenta con una ampliación a ese permiso tramitado por SETENA para 7500 animales. En la misma visita se acordó continuar con una disminución o despoblación de 500 animales por semana, a fin de reducir la producción y mejorar la eficiencia del manejo de desecho, además no se hará ingreso de más animales, hasta tanto no se haya regulado el problema de malos olores.
Se verifica a nivel de campo la aplicación de hidróxido de calcio en los corrales, con el propósito de alcalinizar el suelo y mejorar la actividad biológica de las bacterias. Se acuerda en la visita duplicar la aplicación de las bacterias y de enzimas a 4 veces por semana con el fin de reducir y/o eliminar los olores. Se ordena presentar la solicitud de aprobación del permiso de ubicación del sistema de tratamientos de aguas residuales en el Ministerio de Salud en 24 horas. El establecimiento envía a SENASA el miércoles 10 de junio (dentro del tiempo ordenado), el plan con las acciones correctivas de las NO conformidades encontradas el pasado 29 de mayo, por lo tanto, el 11 de junio se realizó una nueva visita en conjunto con el Dr. Marín Director Regional Chorotega, Dr. Vargas de la Dirección Nacional de Operaciones SENASA, Ing. Rebeca Gutiérrez funcionaria del MAG con amplios conocimientos en manejos de desechos sólidos y líquidos por actividades pecuarias.
Siendo así que en los días posteriores se efectuará un informe al establecimiento. No obstante, el 05 de junio de 2020, se recibió en la Dirección de Área Rectora de Salud de Liberia una misiva del Director Regional del Área de Conservación Guanacaste del Sistema Nacional de Áreas de Conservación, mediante la cual traslada el oficio No. UNA-LAQAT-OFIC-078-2020, del 04 de junio de 2020, suscrito por el MSc. José Pablo Sibaja Brenes, Director General y Científico del Laboratorio de Química de la Atmósfera de la Universidad Nacional, en el cual se indica que el 28 de mayo de 2020 dicha institución realizó tres mediciones en el aire, a saber: una en Liberia centro, en río Colorado y en el Parque Nacional Rincón de La Vieja, siendo que la medición en el aire en el río Colorado (coordenadas 10°40’06’’ N y 85°28’58’’ O) se obtuvo un resultado de 2,2 ppm de ácido sulfhídrico (H2S), lo cual, según el mismo oficio, representa niveles por arriba de los 2,0 ppm que son perjudiciales para la salud.
Por ello, se informa que si bien la empresa responsable está implementando medidas ordenadas por SENASA, el problema de la contaminación atmosférica pasó a ser un problema de salud pública, por lo cual, la Dirección de Área Rectora de Salud de Liberia emitió una orden sanitaria a SENASA, por ser esta la institución a cargo de la regulación y vigilancia de las actividades ganaderas que realiza el Centro Internacional de Inversiones S.A., ordenándose que de forma inmediata se tomen las acciones necesarias para eliminar la contaminación atmosférica producida por la actividad ganadera que se realiza en ese establecimiento de producción bovina. Aunque esa decisión fue impugnada por el representante de SENASA. Como se indicó supra, esas entidades cuentan con amplias facultades de actuación, y si bien se encuentran sujeta a la legalidad y la razonabilidad, lo cierto es que teniendo en cuenta que se trata de una amenaza al medio ambiente y a la salud pública, la legalidad y los formalismos se ven desplazados.
Evidentemente, ambas entidades tampoco han logrado coordinar acciones conjuntas para conseguir una solución integral al problema denunciado. Es sabido que la coordinación entre entes y órganos públicos es indispensable para el adecuado ejercicio de sus competencias y prestación del servicio encomendado, ya que permite asegurar la eficacia y eficiencia; y por ello es uno de los principios rectores de la organización administrativa (véase, en ese sentido, el voto No. 2015-001626). Bajo las premisas expuestas, no resultan de recibo los argumentos que pretenden justificar la inacción de la Administración ante las reiteradas denuncias de los vecinos, máxime que la contaminación denunciada fue aceptada por las autoridades recurridas y corroborada por el Laboratorio de Química de la Atmósfera de la Universidad Nacional con unos niveles que ha devenido en un problema de salud pública. Esta Sala comprende que entre las autoridades recurridas puede haber diferencias del abordaje de la situación, lo que ha ocasionado incluso la impugnación de disposiciones, pero en atención al mencionado principio de coordinación administrativa, pudieron –y debieron- haber actuado de inmediato, desplegando al máximo sus posibilidades de actuación y no escudando su demora en formalismos procesales.
El principio pro acto exige a la Administración encausar sus actuaciones para conseguir el dictado de un acto final que resuelva la situación que le ha sido encomendada, y si tienen elementos suficientes que les permiten constatar la presencia de olores desagradables en los alrededores del inmueble denunciado, como en efecto aconteció, debieron realizar las diligencias necesarias para garantizar el bienestar del medio ambiente y de los habitantes de Liberia. También se extraña la falta de seguimiento por parte de todos los recurridos, pues ante la inercia e inactividad de éstos, han debido los vecinos acudir una y otra vez a reiterar sus denuncias, quejas y reclamos. Lo que es entendible porque para que se produzca tal nivel de contaminación atmosférica ha debido transcurrir un tiempo considerable.
VII.Conclusión. Por consiguiente, dando por entendido que persiste la descontrolada e irregular actividad denunciada, a un nivel que ya se considera que tiene incidencia no solo en el ambiente, sino en la salud de la población en general, procede estimar el recurso y con los efectos que se indican en la parte dispositiva de esta sentencia.
1. El contexto histórico que motivó en su momento la amplia intervención de la Sala en materia ambiental, ha tenido una considerable variación que impone a este órgano reconsiderar las condiciones para su participación en el aseguramiento del derecho de las personas a un ambiente sano y equilibrado, tal y como ha sido tutelado en el artículo 50 de la Constitución Política. En efecto, la situación actual –caracterizada por una amplísima producción legal y reglamentaria que incluye reglas de fondo, procedimientos y creación de órganos para el cumplimiento de lo ordenado en la Carta Fundamental- es radicalmente diferente de la anterior, en la cual la ausencia de normativa y de instancias estatales con competencia apropiada, le impuso a la Sala un papel de protagonista, casi único, en la defensa del precitado derecho constitucional.
2. Hoy en día, nos encontramos frente a un “denso entramado” de normativa ambiental, lo cual ha producido dos fenómenos relevantes: el primero y más obvio, es el surgimiento de una abarcadora regulación jurídica respecto de actividades cuya incidencia en el ambiente estaba poco o nada ordenada, así la creación de órganos estatales con potestades de vigilancia y control sobre los efectos de la actividad humana en el entorno. El segundo fenómeno consiste en que esa creciente juridificación –predominantemente legislativa y reglamentaria– trae aparejada una ineludible entrada en escena tanto de la justicia administrativa como de la jurisdicción ordinaria -prioritariamente la contencioso administrativa, pero también la penal. En ellas, acorde con la importancia del derecho ambiental, se han regulado de forma amplia vías procesales y medios de legitimación incluyentes, de manera que los administrados puedan hacer valer lo establecido en ese amplio orden jurídico que se relaciona con el tema ambiental.
3. En ese contexto, no resulta apropiado jurídicamente, ni desde el punto de vista funcional, que la Sala Constitucional desplace, o -peor aún- sustituya, a los órganos de justicia ordinarios en la realización de su tarea, también de rango constitucional, de velar por el efectivo cumplimiento de leyes y reglamentos. Es impropio jurídicamente porque en la inmensa mayoría de estos casos lo que se solicita es que interprete y haga valer normas legales y reglamentarias con lo que arriesga traslapar sus competencias con las de otros órganos jurisdiccionales que –ellos sí- han sido creados para ejecutar tales tareas; y resulta también funcionalmente incorrecto, porque el diseño de sus procesos se aviene mal con la complejidad que está presente en numerosos conflictos ambientales que se componen de series de hechos y actos técnica y jurídicamente complejos. Sobre ambas cuestiones existen conocidos ejemplos en los que la Sala ha arrojado una resolución a medias o técnicamente incompleta, o bien se han generado fricciones innecesarias y afectación de la seguridad jurídica.
4. Como parte de los aspectos técnicos que he valorado, añado que está el hecho de que esta jurisdicción no cuenta con jueces ejecutores de sentencia que permitan darle seguimiento adecuado a las mismas -generalmente complejas-, que implican en ocasiones el seguimiento de planes remediales, entre otros, con coordinación interinstitucional y seguimiento de meses y hasta años.
5. Desde esa perspectiva, la decisión de dar un paso al lado en la materia ambiental por parte de este Tribunal no debe ser vista como un abandono de la materia ambiental, sino al contrario, de su adecuada tutela en la instancia que mejor se aviene a la naturaleza de su complejidad y diversidad. Asimismo tampoco debe ser visto como la declinación de esta instancia en su tarea de protección de los derechos constitucionales que le imponen la Constitución Política y su Ley Orgánica, que desde mi punto de vista, queda reservada en esta materia para casos específicos. Se trata más bien, de un ejercicio de reacomodo de las cargas y tareas que corresponden a los distintos órganos estatales, de manera que cada uno de ellos, pueda desplegar plenamente su labor dentro del ámbito que se le ha asignado, así como del ejercicio de fijar su propia competencia, según lo establece el artículo 7 de su Ley Orgánica.
6. Queda claro que la Sala no se plantea abandonar a otras jurisdicciones la labor de protección de los derechos de las personas en materia ambiental. Es conocido que si bien todo reclamo por infracción de normas legales y reglamentarias puede ser reconducido hasta el ámbito constitucional, existen casos cuya resolución no exige más que la aplicación del derecho de la Constitución. Se trata entonces de lograr que la Sala se convierta en protagonista junto con otros, de manera que –entre todos y cada uno en su espacio- se pueda cubrir toda la variedad de situaciones que presenta una protección del derecho a un medio ambiente sano y equilibrado dentro de una sociedad en la que también existen otras necesidades igual de acuciantes. Con esta posición creo firmemente que el ciudadano no pierde un ápice de protección pero se gana sustancialmente en amplitud, en perspectiva y en respeto al equilibrio y distribución de poderes, principio este último de obligada consideración, puesto que rige la dinámica constitucional de cualquier sistema liberal y democrático como el nuestro.- 7.
En línea con lo anterior, sostengo que esta Sala debe abstenerse de conocer los reclamos que se le presenten por supuesta infracción al artículo 50 de la Constitución Política para dejar en manos de la justicia administrativa y la jurisdicción contenciosa administrativa su conocimiento. Lo anterior se deja afirmado con carácter general, sin perjuicio de reconocer la existencia de casos particulares o grupos de casos que, según mi criterio, si resultarían aún mejor tutelados por esta Sala y por tanto deben ser conocidos y resueltos por ella.- Dentro de tales grupos de casos, y sin que esta enunciación pueda considerarse como una lista cerrada y definitiva, puedo señalar que la Sala debe reservarse el conocimiento de situaciones como por ejemplo los reclamos por infracciones ambientales que además pongan en riesgo directo la salud de las personas, o el acceso o calidad del agua; los casos de violaciones groseras y directas al ambiente y en los cuales se constate una palmaria ausencia de la protección por parte de las autoridades estatales, siempre y cuando además la naturaleza del reclamo permita ser abordado mediante el instrumento del amparo como instituto procesal sumario y especial, ya que estimo que tampoco se debe “ordinariar” el amparo para abordar, aún en estos casos citados, temas que rebasen la capacidad de ser atendidos adecuadamente en el mismo.
8. En el caso concreto, de conformidad con los hechos probados, el reclamo de la parte recurrente, podría eventualmente incidir en su salud e integridad física, así como de las personas que habitan en la ciudad de Liberia, por cuanto se está ante un problema de contaminación atmosférica -científicamente comprobado- por desechos de actividades ganaderas. En consecuencia, es claro que estamos ante las excepciones que mencionan y por esa razón he considerado necesario que la Sala ejerciera su competencia, para comprobar o descartar si las omisiones señaladas, vulneran los derechos fundamentales de las personas amparadas.
En asuntos ambientales, es criterio del suscrito, que si ya ha habido intervención de la Administración Pública, su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que se acusa la presunta contaminación por una actividad de ganado estabulado de alto volumen, la cual genera enormes cantidades de desechos que no reciben tratamiento alguno, y no cumple las normas de operación ambiental, de salud y volumen, generando contaminación por los desechos y malos olores, lo cual fue denunciado ante el Ministerio de Salud así como ante el Servicio Nacional de Salud Animal del Ministerio de Agricultura y Ganadería, sin que la problemática sea resuelta de forma definitiva, provocando afectación de un ambiente sano y ecológicamente equilibrado.
Debe prevenir esta Sala a la parte recurrente que, de haber aportado algún documentos en papel, así como objetos o pruebas respaldadas por medio de cualquier dispositivo adicional, o por medio de soporte electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho, en un plazo de 30 días hábiles, después de recibida la notificación de esta sentencia, de lo contrario todo ello será destruido de conformidad con lo establecido en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión No. 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión No. 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara con lugar el recurso. En consecuencia, se ordena lo siguiente: 1) A Daniel Salas Peraza y a Silvia Johanna Niño Villamizar, respectivamente, en su condición de Ministro de Salud y de Directora General del Servicio Nacional de Salud Animal del Ministerio de Agricultura y Ganadería, o a quienes en su lugar ejerzan esos cargos, que de manera conjunta y coordinada: a) adopten de forma inmediata las medidas necesarias para que en el plazo máximo de DOS MESES , contado a partir de la notificación de esta sentencia, se haya elaborado un plan remedial para solucionar el problema de contaminación atmosférica denunciada en este amparo; b) realicen y ejecuten ese plan para dar solución definitiva a ese problema en el plazo de DIEZ MESES, contado a partir de la notificación de esta sentencia; c) de forma inmediata adopten las medidas necesarias para mitigar esa contaminación. 2) A Daniel Salas Peraza, en su condición de Ministro de Salud, o a quien en su lugar ocupe ese cargo, que una vez transcurrido el anterior plazo de diez meses y, por ende, solucionada la situación contaminante, gestione en el plazo de DOS MESES, la medición de ácido sulfhídrico (H2S) en el aire, debiendo comunicar el resultado de la valoración al recurrente y a la población afectada circundante del establecimiento denunciado, por el medio que se considere oportuno.
Se les advierte que de no acatar la orden dicha, incurrirán en el delito de desobediencia y, que de conformidad con el artículo 71 de la Ley de esta jurisdicción, se le impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo.
