Proceeding for protection of constitutional rights (recurso de amparo) processed under expediente número 20-007681-0007-CO, filed by FRANCISCA ALVARADO HERNÁNDEZ, identification card 0203070457, against the MUNICIPALIDAD DE LOS CHILES ALAJUELA.

BACKGROUND:

  1. 1In a filing received by this Chamber at 17:25 hrs. on 29 de mayo de 2020, the petitioner filed a proceeding for protection of constitutional rights and stated that, since 29 de enero de 2019, Ms. Erlinda Calvo had approached the Municipalidad de Los Chiles to request an inspection of the sewer system (alcantarillado) running in front of her house and the petitioner’s property, which ultimately discharges water from the drainage ditches (caños), thereby encroaching upon her property. She states that, because the municipality failed to act and provide the required response, on 17 de septiembre de 2019 she submitted a formal request to the Junta Vial Cantonal. She adds that, in that document, she described in detail the problem she has experienced for 10 years. She also referred to the damage it causes to her property after the municipality itself dug the ditch some time ago but never completed the sewer work in front of her home or repaired the damage.She clarifies that the letters were sent in an effort to find a solution to the harm affecting her property, as she has tried to sell the lot to attain a better quality of life, but under the prevailing circumstances, prospective purchasers do not finalize the contract because the appraisal is rejected, given that it is readily apparent that the property suffers from wastewater flooding. She complains that, despite the foregoing, as of the date on which she sought constitutional relief, the respondent authority had not provided her with any response. For that reason, on 15 de noviembre de 2019 she sent another official letter to Mayor Jacobo Guillen Miranda, once again explaining the environmental and public-health problem affecting her property, which could also affect her neighbors. Nevertheless, she alleges that she received no response from either the mayor or any municipal department.In this regard, she believes that the municipality has failed to take the measures vested in it by law to remedy the serious problem, even though her family lives in the house, including a child under one year of age, and will be affected by the first rains, which will cause the land to flood, foul odors to arise, and the water to stagnate. She states that, because of the problem described, on 21 de enero de 2020 she went to the Junta Vial Cantonal to request a response to the letter sent on 17 de septiembre de 2019; however, she did not receive one. She reiterates that the property floods along its northern side because of water flowing down the slope where the municipal cemetery is located and from the neighbors across the street, as well as along the eastern side adjoining Erlinda Calvo and along the southern side, where there is a drainage ditch with a culvert (alcantarilla) that overflows and seeps onto her property.She further states that the drainage ditch on the southern side crosses her property and those of the adjoining landowners and discharges through the Centro Infantil de Los Chiles. She argues that the events described violate her fundamental rights, including her right to a dignified life, as she is an older adult. She requests that the proceeding be granted.
  2. 2By order issued at 19:23 hrs. on 30 de abril de 2020, this proceeding was admitted for processing, and the respondent authority was notified on 05 de mayo de 2020.
  3. 3In a filing submitted on 15 de mayo de 2020, JACOBO GUILLEN MIRANDA, in his capacity as Municipal Mayor; YENNER CÁCERES SOTO, in his capacity as President of the Consejo Municipal; and JOSÉ ABRAHAM DELGADO MOREIRA, in his capacity as Director of the Departamento de Gestión Vial, all of the Municipalidad de los Chiles Alajuela, state under oath that the issue raised in this proceeding for protection of constitutional rights can be divided into two separate problems that must be addressed independently: the water entering her property from the northern side, facing the road toward the cemetery, which results from surface runoff (escorrentía superficial) flowing onto calle 2 and, because of the slope of both calle 2 and the lot in question, entering the property as it makes its way toward the stream (quebrada) located along its southern boundary. They state that, although the water enters the property because of the land’s natural slopes, it can be properly diverted through a stormwater drainage system (alcantarillado pluvial) running along the northern and western boundaries of the lot, following vertices 4 to 3 and 3 to 2, so that at vertex 2 it can be discharged into the existing unnamed stream.They mention that this drainage system does not currently exist, although its construction is feasible in the short term. However, this would not resolve the flooding problem described in the southern half of the property because, as the petitioner states, the stream overflows during the rainy season. They indicate that the water comes from the stream located along the property’s southern boundary, between vertices 1 and 2, and that this stream has always existed at that location. Accordingly, Anexo 1 contains the petitioner’s property survey plan (plano). In this regard, they state that the plano from año1990 shows the existing stream along the property’s southern boundary. Anexo 2 contains the plano for the property adjoining the petitioner’s property to the south, which was prepared in año 2008. They mention that this plano identifies a 10 metros protected area (área de protección), which is a legal requirement along the banks of natural streams such as the one on this property.They state that this second problem is very different in nature because it would also entail making an investment—whether by enclosing the stream in a drainage conduit or undertaking some other selected project—on private property using public funds, an issue that the Municipalidad de Los Chiles has regarded as a limitation on its authority to provide a genuine solution to this problem. They indicate that there is a childcare center that has already enclosed the watercourse of that stream in drainage conduits using the center’s own financial resources. They conclude that, as the petitioner states, the problem has indeed been analyzed on various occasions by the Junta Vial Cantonal. Both the requests submitted and the subsequent analysis have addressed the two existing problems, but the institution remains constrained by the need to invest public funds in private property. They add that this “unnamed stream” is a natural depression that collects stormwater (aguas pluviales) from the northwestern sector of Los Chiles and that, although no studies have been conducted in this regard, the foul odors from the water in it suggest that contamination exists. They request that the proceeding be dismissed.
  4. 4In a filing submitted on 13 de mayo de 2020, CARMEN CRUZ CRUZ, daughter of ABDULIA CRUZ CRUZ, intervenes in support of the petitioner (coadyuvancia) and states that the property where she resides, registered in the name of her deceased mother, adjoins on its southern side a drainage ditch that was formerly a stream and that has no drainage infrastructure from that property to the street located in front of the municipal cemetery. She states that she has lived on that property for many years and that, at that time, her father authorized the Municipalidad to channel the water from that stream and provide better management of the watercourse (cauce). Over the years, the Municipalidad installed culverts to channel the water but did not complete the work, leaving the watercourse uncovered from her property through those of her other two neighbors. Furthermore, as part of the agreements, the municipality itself undertook to clean the drainage ditch, but it does not do so properly.She states that, as is well known to dozens of neighbors living along the route through which the water flows in large culverts, the stream running along the southern side of her mother’s property originates some 300 o 400 metros to the east; those sections have been drained and are not even visible because of the fill that was placed there. She adds that the water flowing through that drainage ditch causes approximately 60% of the property where she resides to flood, leaving her without access to the backyard; during huracán Otto, the property was flooded up to 80%, with the water coming within a few centimeters of the dwelling. She specifies that, in order to build the dwelling in which they live, a substantial amount of fill had to be placed to prevent overflowing water from reaching the dwelling’s floor level. She states that the drainage-ditch problem clearly affects three neighbors, each with a family household, and that it is also attributable to the failure to complete the drainage works in the block where their properties are located.
  5. 5In a written submission filed on 13 de mayo de 2020, ÁNGELES ALVARADO HERNÁNDEZ, the appellant’s daughter, requests leave to intervene in support (coadyuvancia) and states that there is no sewer system of any kind on the northern side of her mother Francisca Alvarado Hernández’s property, which would be the front of the property; nor on the eastern side, which would be the main road leading to the Cementerio Municipal; nor on the southern side, where a stream (quebrada) runs. She states that, as a resident of that canton, specifically the county seat, she knows the land in question very well, as well as the size of the adjoining properties. Therefore, because there is no sewer system on the NORTHERN and WESTERN sides of her mother’s property to provide an outlet for the water flowing through the sewer that ends in front of Erlinda Calvo’s property, at an inspection chamber (caja de registro) located at the EASTERN corner of her mother’s lot, as shown in the photographs submitted, water accumulates both from that conduit and from the properties located in the block adjoining the Cementerio to the EAST, as well as from the downspouts of the Colegio de Los Chiles on both sides of the road.Likewise, there is no sewer system in front of the Cementerio Municipal, so the water flowing down from the Colegio ends up in the inspection chamber located on the EASTERN side of her mother’s lot. In other words, there is nothing more than a simple inspection chamber for all this water, which has no outlet. When all this accumulation of water converges, it causes the channel to overflow during both the dry and rainy seasons, and the water spreads across the land in question through a ditch that is not of natural origin and that crosses the property. That ditch was excavated by the Municipalidad de Los Chiles several years ago, when it left the sewer works for the two blocks unfinished. She states that this problem did not exist at that time because the water flowed in different directions, whereas it now follows a single course and ends between her mother’s property and Erlinda Calvo’s property.She states that, regarding the stream running along the southern side of her mother’s property, this tributary is not an issue exclusive to the block where her mother’s property is located, but crosses other properties and, at that time, originated 300 metros EAST, passing through properties belonging to the Familia Solano Chamorro, the familia Serrano, and the familia García Salas, then through the property where the current Presidente del Concejo Municipal, Yenner Caseres Soto, resides, and thereafter toward the property that the municipality rents from the aforementioned man’s brother, Roy Cáceres Soto. However, the portion traversed by that stream was channeled through a sewer system by the municipality, but the work was not completed, leaving more than 75 metros of the tributary exposed. She emphasizes that the municipal officials are aware of the circumstances described because the flow of the water can be seen from the property rented by the municipality as a warehouse, and its passage through the properties of Mrs.Abdulia Cruz Cruz, Erlinda Calvo Solís, and her mother Francisca Alvarado remains exposed. She adds that this demonstrates that, because one section was channeled while the remainder of the watercourse was left exposed, during the rainy season the flow becomes obstructed at the final inspection chamber located in front of the Centro Infantil. She adds that the facts described should be recorded in the Municipalidad’s cadastral database because she knows that these sewer works on the stream, which became a drainage channel, were carried out with municipal resources on private properties to improve the channeling of the water. She further states that the Centro Infantil Los Chiles channeled the water and encountered no problem whatsoever with either the municipality or any other state entity. She states that the water entering from the northern side of her mother’s property as a result of surface runoff (escorrentía superficial) does not pose the main problem; rather, the problem is the channeled water that ends specifically at the eastern side of the property in the makeshift ditch that the municipality left inside the lot many years ago, which causes the foul odors that would not exist if the works at that location had been completed.She states that when the national emergency caused by Hurricane Otto occurred, the property was more severely affected because the Municipalidad de Los Chiles left fill material that caused the stream water to pool even more. On other properties, sewer works were completed for watercourses that had formerly been streams but that, over time and as a result of human activity, had been reduced to drainage channels. She states that, with respect to the steps taken before the Municipalidad de Los Chiles, no response has ever been received, nor have officials ever visited so that they could speak with her mother. Strangely, after this amparo action (recurso de amparo) was filed, the Municipalidad sent Engineer Abraham Delgado Moreira, not to seek a solution but merely to justify what had happened, as he made clear to her brother, who lives in the dwelling located on the land. In other words, the municipality has no evidence supporting its claim that it has attempted to resolve her mother’s problem.She concludes that her mother is raising not only the problem involving the stream, but also the failure to complete the sewer works in the block where her land and home are located, as well as those in the blocks adjoining the Cementerio.
  6. 6In the processing of these proceedings, the requirements of law have been observed.

Considering:

I. REGARDING THE ACTIVE INTERVENTIONS IN SUPPORT FILED

Through written submissions filed on 13 de mayo de 2020 by CARMEN CRUZ CRUZ, daughter of ABDULIA CRUZ CRUZ, and by ÁNGELES ALVARADO HERNÁNDEZ, they request recognition as active intervenors in support (coadyuvantes activas) of the appellant in these proceedings. In this regard, this Court considers it important to state that intervention in support is a form of supporting intervention whereby a person participates in proceedings by joining the claims of one of the principal parties. Accordingly, a person who has a direct interest in the outcome of the action has standing (legitimación) to act as an intervenor in support; however, because that person is not a principal claimant, they will not be directly affected by the judgment. In other words, the judgment’s effect cannot extend to them directly and immediately, nor are they affected by the res judicata effect (cosa juzgada) of the ruling, although in amparo matters they may benefit from the effect of the decision because of the “erga omnes” nature of the case law and precedents of the constitutional jurisdiction (artículo 13 de la Ley de la Jurisdicción Constitucional). In this case, the Chamber admits the interventions in support filed (under the terms of artículo 34 de la Ley de la Jurisdicción Constitucional), because the aforementioned persons requested that the appellant’s fundamental rights be guaranteed.

II. SUBJECT MATTER OF THE ACTION

The appellant files an amparo action and states that, since 29 de enero de 2019, Mrs. Erlinda Calvo has petitioned the Municipalidad de Los Chiles to inspect the sewer system running in front of her house and the appellant’s property, which ultimately discharges water from the drainage channels onto and thus into her property. She states that, because the municipality failed to act and provide the required response, on 17 de septiembre de 2019 she filed a formal request with the Junta Vial Cantonal. She adds that, in that submission, she explained in detail the problem she had experienced for 10 años. She also referred to the damage it causes to her property after the municipality itself excavated the ditch some time ago and never completed the sewer works in front of her home or remedied the damage. She clarifies that the communications were sent in an effort to find a solution to the harm to her assets, because she has attempted to sell the lot to obtain a better quality of life, but under the prevailing circumstances prospective buyers do not complete the contract because the appraisal is rejected, as it is readily apparent that the property has wastewater flooding problems.

She complains that, notwithstanding the foregoing, as of the date on which she seeks amparo relief, the respondent authority has not provided her with any response. For that reason, on 15 de noviembre de 2019 she sent a new official communication addressed to Mayor Jacobo Guillen Miranda, again explaining the environmental and public-health problem affecting her property, which could also affect the neighbors. Nevertheless, she alleges that she received no response from either the mayor or the municipal department. In this regard, she considers that the municipality has not taken the measures authorized by law to remedy the serious problem, even though her family lives in the house, including a child under one year of age, and will be affected by the first rains, which will cause the land to flood, produce foul odors, and leave water stagnant. She states that, because of the problem described, on 21 de enero de 2020 she went to the Junta Vial Cantonal to request a response to the communication sent on 17 de septiembre de 2019; however, she did not receive one.

She reiterates that the property is flooded from the northern side by water flowing down the slope where the cementerio municipal and the neighbors across the street are located; from the eastern side, which adjoins Erlinda Calvo’s property; and from the south, where a drainage channel runs and has a culvert (alcantarilla) that overflows and seeps into her property. She reiterates that the drainage channel on the southern side crosses her property and those of her adjoining neighbors and discharges through the Centro Infantil de Los Chiles. She contends that the facts described violate her fundamental rights, including her right to a dignified life, as she is an older adult. She requests that the action be granted.

III. PROVEN FACTS

The following facts are deemed duly established and material to the decision in this matter, either because they have been proven or because the respondent authority failed to address them as ordered in the initial ruling:

By a communication dated 29 de enero de 2019, Mrs. Erlinda Calvo petitioned the Municipalidad de Los Chiles to inspect the sewer system running in front of her house and the appellant’s property, which ultimately discharges water from the drainage channels (see report and evidence submitted by the appellant).

On 17 de septiembre de 2019, the appellant filed a formal request with the Junta Vial Cantonal for an inspection of the sewer system running in front of her house and property (see report and evidence submitted by the appellant).

On 15 de noviembre de 2019, the appellant sent a new official communication addressed to Mayor Jacobo Guillen Miranda, in which she again explained the environmental and public-health problem affecting her property, which could also affect the neighbors (see report and evidence submitted by the appellant).

By a communication dated 21 de enero de 2020, the appellant requested information concerning the response to the official communication of 17 de septiembre de 2019 (see report and evidence submitted by the appellant).

Regarding the waters that flow in front of the appellant’s property, on the north side (street frontage toward the cemetery), they are the result of surface runoff (escorrentía superficial) falling onto Calle 2 and, because of the slope of both Calle 2 and the lot in question, they enter that property in search of the stream (quebrada) located along its southern boundary. It states that, although the waters enter this property because of the natural slopes of the land, they can be properly diverted through a storm sewer system (alcantarillado pluvial) running along the northern and western boundaries of the lot, following vertices 4 to 3 and 3 to 2, so that at vertex 2 they may be discharged into the existing unnamed stream (see report and evidence submitted by the respondent authority).

The survey plan of the property adjoining the appellant’s property to the south, which was prepared in 2008, indicates a 10-meter protection area (área de protección) (see report and evidence submitted by the respondent authority).

An aerial photograph (fotografía aérea) of the study area shows that, farther downstream from the stream, there is also a childcare center that has already channeled the waters of that stream through a culvert, using the center’s own financial resources (see report and evidence submitted by the respondent authority).

The problem has been analyzed on several occasions by the Cantonal Road Board (Junta Vial Cantonal). Both the requests submitted and the subsequent analysis have addressed the two existing problems, with the institution being constrained by the fact that it would have to invest public funds in private property (see report submitted by the respondent authority).

IV. THE RIGHT TO A HEALTHY AND ECOLOGICALLY BALANCED ENVIRONMENT

Article 50 of the Political Constitution establishes every person’s right to a healthy and ecologically balanced environment as a fundamental right. Even before Article 50 was amended to expressly address environmental matters, the Chamber, through its case law, had derived this right from the constitutional provisions of Articles 21—the right to life and health—69—the rational use of land—and 89—the protection of natural beauty. The Chamber has adopted an open or broad view of the concept of the environment and of the protection afforded to it, going beyond the basic or primary protection of soil, air, water, marine and coastal resources, minerals, forests, the diversity of flora and fauna, and the landscape, to also consider elements relating to the economy, the generation of foreign currency through tourism, agricultural use, and others. Following the amendment of constitutional Article 50, which expressly enshrined environmental rights (derecho ambiental) as a fundamental right, the State’s obligation to guarantee, defend, and safeguard that right was also established in categorical terms, thereby making the State the guarantor of the protection and preservation of the environment and natural resources.

It is pursuant to this provision, in conjunction with Articles 20, 69, and 89 of the Political Constitution, that the State’s responsibility to exercise a protective and governing role in this field was derived, as provided by the constitutional provision under discussion, a role developed through environmental legislation. Thus, the constitutional mandate establishes the State’s duty to guarantee, defend, and preserve that right.

V. THE ROLE OF MUNICIPALITIES IN ENVIRONMENTAL MATTERS

Consistent with the foregoing, municipalities, as integral parts of the State as a whole, bear a significant share of responsibility for environmental matters within the scope of their powers and obligations, whether through the direct approval of permits or licenses for which prior compliance with requirements demonstrating proper environmental management before other government bodies is required, or through regular inspections and the referral of hazardous situations to the bodies with greater authority to intervene. It has already been established that local governments are subject to an obligation of coordination and prevention in environmental matters within their territorial jurisdiction, from which it follows that municipalities are indeed important actors in the task of environmental protection. The authority of local governments to establish their own land-use planning (ordenación territorial) through zoning plans (planes reguladores) is beyond dispute; however, the existence of such plans—which for the most part lack planning components addressing a healthy and ecologically balanced environment—does not render protective environmental legislation inapplicable.

On the contrary, the Chamber considers it a fundamental requirement, one that does not infringe the constitutional principle of municipal autonomy, that every zoning plan, before being approved and implemented, undergo an environmental impact assessment (examen del impacto ambiental) from the perspective afforded by constitutional Article 50, so that land-use regulation and its various legal regimes are compatible with the scope of the higher-ranking provision, particularly considering that this provision establishes the right of all inhabitants to obtain an environmental response from all public authorities. This undoubtedly includes municipalities, which are not exempt from the application of the constitutional provision and its implementing legislation. Local governments may and must require compliance with environmental requirements within their territory and, in the event of a conflict with the authorities responsible for environmental matters, may submit the disputes to the appropriate judicial review body (contralor jurisdiccional), depending on the nature of the violation (see, in this regard, sentencia número 2006-7994 de las 08:57 horas del 2 de junio de 2006).

VI. THE PRINCIPLE OF COORDINATION IN ENVIRONMENTAL MATTERS

Likewise, this Chamber has recognized that one of the guiding principles of administrative organization is the coordination that must take place among all public entities and bodies when exercising their powers and providing the services assigned to them by the legal system. Coordination, insofar as it ensures administrative efficiency and effectiveness, is a virtual or implicit constitutional principle that permeates the entire administrative legal system and binds all public entities. Coordination may be inter-organizational (interorgánica)—among the various bodies comprising a public entity that are not subject to a hierarchical relationship—or inter-entity (intersubjetiva), that is, among public entities, each with legal personality, its own budget, autonomy, and specific powers. The purpose of administrative coordination is to prevent duplication and omissions in the exercise of each public entity’s administrative functions, that is, to ensure that they are performed rationally and systematically (see voto número 07-15218 de las 12:00 horas de 19 de octubre de 2007).

Such administrative coordination is particularly relevant in cases involving environmental pollution because it enables the different public entities and bodies to combine their efforts so that every person’s fundamental right to a healthy and ecologically balanced environment may be protected in a timely and effective manner.

VII. MUNICIPAL AUTHORITY AND THE OBLIGATION OF INTERINSTITUTIONAL COORDINATION

Article 169 of the Political Constitution provides that: “The administration of local interests and services in each canton shall be entrusted to the Municipal Government (...).” This provision has been developed by the ordinary legislature; accordingly, Article 3 of the Municipal Code, Law Number 7794 of 30 de abril de 1998, provides that: “The governance and administration of cantonal interests and services shall be entrusted to the municipal government.” The Constitutional Chamber has expressed the same view in its case law. For example, sentencia número 5445-99, de las 14:30 horas del 14 de julio de 1999, held as follows:

“VI.- THE POWERS OF MUNICIPALITIES ACCORDING TO SUBJECT MATTER (THE CONCEPT OF ‘LOCAL MATTERS’). By express constitutional provision—Article 169—functions or powers relating to ‘local matters’ are assigned to local governments according to subject matter, namely, ‘the administration of the services and interests’ of the locality within their jurisdiction, for which purpose they are granted autonomy (”).

Accordingly, their powers are general insofar as there is no detailed enumeration of their specific responsibilities, but merely a statement of the scope of their authority; this does not, however, mean that such authority cannot be determined, as this Court explained in sentencia número 6469-97, de las dieciséis horas veinte minutos del ocho de octubre de mil novecientos noventa y siete, in the following terms:

“(...) local matters have such significance that any definition of their scope by the legislature or the courts must preserve the integrity of local interests and services. Thus, not even the legislature could enact legislation intended to dismember the Municipality (the territorial element) unless it did so in accordance with the procedures previously established in the Political Constitution; nor could it enact legislation placing its inhabitants (the population) in conditions clearly inferior to those of the rest of the country; nor legislation affecting the very essence of local matters (government), thereby turning the Corporation into a mere empty vessel retaining only its name while disabling the entire system as conceived by the National Constituent Assembly. Put another way, there are responsibilities that, by their nature, are municipal—local—and cannot be removed from that sphere of authority and converted into national services or interests, because doing so would entail dismantling the Municipality or, more precisely, stripping it of its constitutional substance. Consequently, it is not possible to prescribe in advance the inviolable boundaries of local matters; instead, what does or does not fall within the authority of community government must be determined through an examination of each specific case (...).” The foregoing highlights the fact that, by the express will of our Fundamental Charter, specific authority is assigned to local governments, and that this authority is moreover exclusive to them; in other words, it is an original power of the municipality and may be displaced, wholly or partially, only through a nationalization or regionalization law.”

Consequently, if a group of municipal residents within their territorial jurisdiction suffer flooding that endangers their lives and causes serious property damage, psychological harm, and harm to their quality of life and general well-being, this falls within the concept of “local interests and services” under constitutional Article 169. The causes of such problems must be precisely identified, and, even more importantly, so must the solutions, so that they may be implemented as quickly as possible; for this purpose, the Municipality must coordinate with national-level institutions empowered to address the problem. Indeed, the Chamber has already developed the municipality’s obligation to coordinate with other state institutions in order to address local “interests” and duly provide “local services.” In the aforementioned sentencia número 5445-99, the Chamber stated:

“(...) refer to the duty of coordination (coordinación) that must exist among local governments, decentralized institutions, and the Executive Branch in carrying out the functions entrusted to them, which must be analyzed in light of the very nature of municipal autonomy (autonomía municipal). By virtue of the provisions of Article 170 of the Constitution, municipalities (local corporate entities) enjoy functional, administrative, and financial autonomy in the administration of local interests and services (Article 169 of the Political Constitution) (...) Therefore, no conflict may be created through antagonism or competition between matters comprising the general purpose of ‘local interests and services’ and ‘national’ or ‘state’ public interests and services, which are intrinsically different from one another but are, in reality, intended to coexist (....) Once the subject-matter jurisdiction (competencia material) of the municipality within a particular territorial district has been defined, it is clear that some responsibilities are, by their nature, exclusively municipal, while others may be regarded as national or state responsibilities; it is therefore essential to define the form of shared exercise of powers (cooparticipación de atribuciones) that is inevitable, since the public authority of municipalities is local, while that of the State and other entities is national; it follows that municipal territory is simultaneously state and institutional territory, insofar as circumstances so require. In other words, municipalities may share their powers with the Public Administration generally, a relationship that must operate under the terms defined by law (Article 5 of the former Municipal Code, Article 7 of the new Code), which establishes a duty of ‘coordination’ between municipalities and the public institutions involved in exercising their respective powers, in order to avoid duplication of efforts and contradictions, particularly because only voluntary coordination is compatible with municipal autonomy, as an expression thereof. In other words, the municipality is called upon to enter into cooperative relationships with other public entities, and vice versa, given the concurrent or overlapping nature—in many cases—of interests concerning a specific matter. In legal scholarship, coordination is defined on the basis of the existence of several independent centers of action, each with its own responsibilities and decision-making powers, which may at times diverge; despite this, there must be a commonality of purposes in the subject matter, arising from concurrence, insofar as the object receiving the final results of each entity’s activities and acts is common to all.” Thus, coordination is the ordering of relations among these various independent activities, taking into account their concurrence with respect to the same object or entity so as to make it useful to an overall public plan, without eliminating the mutual independence of the acting parties. Because neither decentralized institutions nor the State itself stand in a hierarchical relationship with municipalities, specific conduct cannot be imposed upon the latter; this gives rise to the indispensable interinstitutional ‘concerted action’ (concierto), in the strict sense, whereby autonomous and independent centers of action agree upon that preventive and overall framework, in which each fulfills a role with a view to a mission entrusted to the others.”

It should further be noted that municipalities are required, pursuant to Article 50 of the Political Constitution, to devote themselves to environmental protection (judgment number 2006-7994 issued at 8:57 on 2 de junio de 2006).

VIII. MUNICIPAL ACTION IN THE SPECIFIC CASE

The petitioner files an amparo proceeding (recurso de amparo) and states that, since 29 de enero de 2019, Ms. Erlinda Calvo sought assistance from the Municipalidad de Los Chiles to request an inspection of the drainage system (alcantarillado) running in front of her home and the petitioner’s property, which ultimately discharges water from the drainage ditches (caños), thereby encroaching upon her parcel. She states that, because the municipality failed to take action to provide the required response, on 17 de septiembre de 2019 she submitted a formal request to the Junta Vial Cantonal. She adds that, in that document, she explained in detail the problem she has experienced for 10 years. She also referred to the damage it causes to her property after the municipality itself had, some time earlier, dug the ditch and never completed the drainage work in front of her home or remedied the damage.

She clarifies that the communications were sent in order to find a solution to the harm suffered by her property, since she has attempted to sell the lot to attain a better quality of life, but under the prevailing circumstances, prospective buyers do not proceed with the contract because the appraisal (peritaje) is rejected, as it is plainly evident that the property suffers from wastewater flooding. She complains that, notwithstanding the foregoing, as of the date on which she seeks amparo relief, the respondent authority (autoridad recurrida) has not provided her with any response. For that reason, on 15 de noviembre de 2019 she sent a new official letter (oficio), addressed to Mayor Jacobo Guillen Miranda, in which she again explained the environmental and public-health problem affecting her property, since it could also affect neighboring residents. However, she alleges that she received no response from either the mayor or the municipal department.

In this regard, she considers that the municipality has failed to take the measures authorized by law to remedy this serious problem, even though her family lives in the house—including a child under one year of age—and will be affected by the first rains, which will cause the land to flood, generate foul odors, and leave water standing. She notes that, in view of the foregoing problem, on 21 de enero de 2020 she went to the Junta Vial Cantonal to request a response to the communication sent on 17 de septiembre de 2019; however, she did not receive one. She reiterates that the property is flooded along its northern side by water flowing down the slope where the municipal cemetery and the neighbors across the street are located; along its eastern side, which adjoins Erlinda Calvo’s property; and along its southern side, where a drainage ditch runs and contains a culvert (alcantarilla) that overflows and seeps onto her property.

She replies that the drainage ditch on the southern side crosses her property and those of the adjoining landowners and discharges near the Centro Infantil de Los Chiles. She contends that the events described violate her fundamental rights (derechos fundamentales), including her right to a dignified life, as she is an older adult. She requests that the petition be granted.

After analyzing the evidence submitted, this Court finds that the fundamental rights of the protected party (amparada) were violated. From the report submitted by the representative of the respondent authority—which is deemed to have been given under oath, with the consequences, including criminal consequences, provided for in Article 44 of the Law governing this Jurisdiction—and the evidence submitted for the resolution of this matter, it has been duly established that, by a letter dated January 29, 2019, Ms. Erlinda Calvo petitioned the Municipalidad de Los Chiles to request an inspection of the storm drain running in front of her home and property, which ultimately discharges the water from the roadside drainage channels. Likewise, on September 17, 2019, the petitioner filed a formal request with the Junta Vial Cantonal for an inspection of the storm drain running in front of her home and property.

Subsequently, on November 15, 2019, the petitioner sent another official letter to Mayor Jacobo Guillen Miranda, once again describing the environmental and public-health problem affecting her property, which could also affect her neighbors. Similarly, by a letter dated January 21, 2020, the petitioner requested information regarding the response to the official letter of September 17, 2019. In this regard, the respondents maintain that the water flowing in front of the petitioner’s property on its northern side, facing the street toward the cemetery, results from surface runoff (escorrentía superficial) falling onto Calle 2 and that, because of the slope of both Calle 2 and the lot in question, it enters the property as it makes its way toward the stream located along its southern boundary. They state that although the water does enter the property as a result of the land’s natural slopes, it could be properly diverted through a stormwater drainage system (alcantarillado pluvial) running along the northern and western boundaries of the lot, following vertices 4 to 3 and 3 to 2, so that at vertex 2 it could be discharged into the existing unnamed stream.

They also stated that the stream exists along the southern boundary of the property, according to the survey plan submitted from 1990. Likewise, the 2008 survey plan for the property adjoining the petitioner’s property to the south indicates a 10-meter protection area. They add that an aerial photograph of the area under study shows that, in addition to the area downstream from the stream, there is a childcare center that has already placed the waters of that stream in a culvert using the center’s own financial resources. They maintain that the problem has been analyzed on several occasions by the Junta Vial Cantonal. Both the requests made and the subsequent analysis addressed the two existing problems, but the institution was constrained by the fact that it would have to invest public funds on private property. In view of the foregoing, this Chamber finds, first, that rainwater does in fact converge on the protected party’s property, including water arriving from the street in front of the cemetery, which the respondents themselves stated could be properly diverted through a stormwater drainage system running along the northern and western boundaries of the lot, following vertices 4 to 3 and 3 to 2, so that at vertex 2 it could be discharged into the existing unnamed stream.

With respect to that issue, the respondents did not indicate that they had provided a solution for channeling that water; accordingly, this first grievance warrants granting the proceeding. Second, regarding the unnamed stream running along the southern side of the petitioner’s property, it must be noted that although it is located on the petitioner’s property and has existed for many years, as shown on the 1990 survey plan, there are nevertheless grounds for finding that the respondent local government bears responsibility for resolving the problem. It should be noted that the respondent itself acknowledged that other residents of the municipality had placed the stream in pipes downstream; this statement constitutes an acknowledgment that the local government allowed interference with waters that had flowed naturally, which could clearly alter the normal runoff conditions. They also acknowledged that the stream is contaminated; on this particular matter, they likewise did not indicate that they had taken the necessary steps to resolve the situation, clearly constituting a failure to fulfill their duty of supervision (in vigilando).

Finally, this Chamber considers that the respondents also failed to adequately assess the risk to the protected party in her home; in the initial filing, the petitioner stated that the property experiences frequent flooding, yet they have taken no action in response. In this regard, it must be recalled that the obligations and powers of local governments concerning environmental problems and risks affecting municipal residents include, among other things, conducting regular inspections and referring hazardous situations to the authorities with greater competence to intervene. Local governments may and must require compliance with environmental requirements within their territory and, in the event of a conflict with the authorities responsible for environmental matters, may submit disputes to the appropriate judicial oversight body according to the nature of the violation; see, to this effect.

In view of the foregoing, this Chamber considers that the present proceeding must be granted so that the respondent municipality corrects the situation reported by the petitioner under the terms set forth in the operative portion (parte dispositiva) of this decision.

IX. NOTE BY JUSTICE HERNÁNDEZ LÓPEZ REGARDING THE CLAIM OF A VIOLATION OF ARTICLE 50 OF THE CONSTITUCIÓN POLÍTICA

1. The historical context that once prompted the Chamber’s extensive involvement in environmental matters has changed considerably, requiring this body to reconsider the conditions governing its participation in safeguarding the right of individuals to a healthy and ecologically balanced environment, as protected by Article 50 of the Constitución Política. Indeed, the current situation—characterized by an extremely extensive body of statutes and regulations that includes substantive rules, procedures, and the creation of bodies responsible for ensuring compliance with the Fundamental Charter—is radically different from the previous situation, in which the absence of regulations and of state bodies with appropriate jurisdiction compelled the Chamber to assume a leading, almost exclusive role in protecting the aforementioned constitutional right.

2. Today, we are faced with a “dense web” of environmental regulations, which has produced two significant phenomena. The first and most obvious is the emergence of comprehensive legal regulation governing activities whose impact on the environment had previously been subject to little or no regulation, as well as the creation of state bodies with powers to monitor and control the effects of human activity on the environment. The second phenomenon is that this increasing juridification—predominantly through statutes and regulations—necessarily brings both administrative justice and the ordinary courts onto the scene, primarily the administrative-law courts but also the criminal courts. Consistent with the importance of environmental law, these forums have been provided with broad procedural avenues and inclusive rules on standing (legitimación), enabling persons subject to government authority to enforce the provisions of the extensive legal framework relating to environmental matters.

3. In that context, it is neither legally nor functionally appropriate for the Constitutional Chamber to displace—or, worse still, replace—the ordinary judicial bodies in carrying out their task, which is also constitutional in rank, of ensuring effective compliance with statutes and regulations. It is legally inappropriate because, in the vast majority of these cases, the Chamber is being asked to interpret and enforce statutory and regulatory provisions, thereby risking an overlap between its jurisdiction and that of other judicial bodies that were specifically created to perform those tasks. It is also functionally inappropriate because the design of its proceedings is poorly suited to the complexity present in numerous environmental disputes, which consist of series of technically and legally complex facts and acts. There are well-known examples concerning both issues in which the Chamber has issued a partial or technically incomplete decision, or in which unnecessary friction and harm to legal certainty have resulted.

4. Among the technical considerations I have assessed, I would add that this jurisdiction does not have judges responsible for enforcing judgments who could properly monitor compliance with such judgments—which are generally complex—and which sometimes entail monitoring remediation plans, among other measures, with interinstitutional coordination and follow-up over periods of months or even years.

5. From that perspective, this Court’s decision to step aside in environmental matters should not be viewed as an abandonment of environmental issues but, on the contrary, as ensuring their proper protection in the forum best suited to the nature of their complexity and diversity. Nor should it be viewed as this jurisdiction declining to perform the task of protecting constitutional rights imposed upon it by the Constitución Política and its Ley Orgánica, which, in my view, remains reserved in this field for specific cases. Instead, it is an exercise in reallocating the burdens and duties assigned to the various state bodies, so that each may fully carry out its work within its assigned sphere, as well as an exercise of the Chamber’s authority to define its own jurisdiction, as provided in Article 7 of its Ley Orgánica.

6. It is clear that the Chamber does not intend to leave the protection of individuals’ environmental rights entirely to other jurisdictions. It is well known that, although any claim alleging a violation of statutory or regulatory provisions can ultimately be framed as a constitutional matter, there are cases whose resolution requires nothing more than the application of constitutional law. The goal, therefore, is for the Chamber to become one leading actor alongside others, so that—collectively, with each acting within its own sphere—the full range of situations involved in protecting the right to a healthy and ecologically balanced environment may be addressed within a society that also has other equally pressing needs. I firmly believe that under this approach citizens do not lose the slightest measure of protection, while substantial gains are made in breadth, perspective, and respect for the balance and distribution of powers, the latter being a principle that must necessarily be taken into consideration because it governs the constitutional dynamics of any liberal and democratic system such as ours.- 7.

In keeping with the foregoing, I maintain that this Chamber should refrain from hearing claims brought before it for an alleged violation of Article 50 of the Political Constitution, leaving their adjudication to the administrative justice system and the contentious-administrative jurisdiction (jurisdicción contenciosa administrativa). The foregoing is stated as a general principle, without prejudice to acknowledging the existence of particular cases or categories of cases that, in my opinion, would still be better protected by this Chamber and therefore should be heard and decided by it.- Among such categories of cases, and without this enumeration being regarded as a closed and definitive list, I may indicate that the Chamber should retain jurisdiction over situations such as claims concerning environmental violations that also directly endanger human health or access to or the quality of water; cases involving gross and direct violations of the environment in which there is a manifest absence of protection by the state authorities, provided that the nature of the claim also allows it to be addressed through the remedy of constitutional relief (amparo) as a summary and special procedural mechanism, since I also believe that constitutional relief should not be converted into an ordinary proceeding in order to address, even in the aforementioned cases, matters that exceed its capacity to deal with them adequately.

8. In this specific case, according to the facts established, the appellant’s claim could potentially affect her health and that of her family. Consequently, it is clear that this case falls within the exceptions mentioned, and for that reason I have considered it necessary for the Chamber to exercise its jurisdiction in order to determine whether the omissions identified violate the fundamental rights of the protected persons.

X. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are hereby advised that, if they have submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device or produced through new technologies, these must be collected from the court office within a maximum period of 30 business days counted from notification of this judgment. Otherwise, any material not collected within that period shall be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Full Court at session N° 27-11 of August 22, 2011, Article XXVI, and published in Judicial Bulletin number 19 of January 26, 2012, as well as the resolution approved by the Superior Council of the Judiciary at session N° 43-12 held on May 3, 2012, Article LXXXI.

POR TANTO:

The petition is GRANTED. Consequently, JACOBO GUILLEN MIRANDA, in his capacity as Municipal Mayor; YENNER CÁCERES SOTO, in his capacity as President of the Municipal Council; and JOSÉ ABRAHAM DELGADO MOREIRA, in his capacity as Director of the Road Management Department of the Municipalidad de los Chiles Alajuela, or whoever may hold those offices, are ordered, within SIX MONTHS from notification of this judgment, to adopt the appropriate measures and undertake the necessary coordination to prevent the risk of flooding on the appellant’s property, without prejudice to the adoption, before the expiration of that period, of urgent and provisional measures to mitigate that risk. The respondents are hereby advised that, pursuant to Article 71 of the Law governing this jurisdiction, anyone who receives an order issued in a constitutional relief proceeding (recurso de amparo) that the person is required to comply with or enforce, and who fails to comply with or enforce it, shall be subject to imprisonment for three months to two years or a fine of twenty to sixty day-fines, provided that the offense is not punishable by a more severe penalty.

The Municipalidad de los Chiles Alajuela is ordered to pay the legal costs and the damages and losses caused by the facts underlying this ruling, the amounts of which shall be determined in proceedings to enforce the contentious-administrative judgment (ejecución de sentencia de lo contencioso administrativo). Recurso de amparo que se tramita en expediente número 20-007681-0007-CO, interpuesto por FRANCISCA ALVARADO HERNÁNDEZ, cédula de identidad 0203070457, contra la MUNICIPALIDAD DE LOS CHILES ALAJUELA.

RESULTANDO:

  1. 1Por escrito recibido en esta Sala a las 17:25 hrs. del 29 de mayo de 2020, la parte recurrente presenta recurso de amparo y expone que, desde el 29 de enero de 2019, la señora Erlinda Calvo recurrió a la Municipalidad de Los Chiles, para solicitar la inspección del alcantarillado que pasa por el frente de su casa y de su propiedad (de la recurrente), que termina desaguando las aguas de los caños, es decir invadiendo su finca. Indica que ante la falta de acción de parte del municipio para brindar la respuesta debida, el 17 de septiembre de 2019, presentó gestión formal ante la Junta Vial Cantonal. Añade que en dicho escrito, explicó con detalle el problema que tiene desde hace 10 años. Además, hizo referencia al daño que este le causa a su propiedad, luego de que la misma municipalidad, tiempo atrás realizara el zanjo y nunca finalizara los trabajos de alcantarillado frente a su vivienda ni corrigiera el daño.Aclara que el envío de las notas, se hacen con el fin de encontrar una solución a la afectación que sufre su patrimonio, ya que ha tratado de vender el lote para tener una mejor calidad de vida, pero por las circunstancias que imperan, los oferentes no llegan a concretar el contrato por el rechazo del peritaje, ya que es muy notorio que la propiedad sufre de problemas de inundación de aguas residuales. Reclama que pese a lo expuesto, al día que acude en amparo, la autoridad recurrida no le ha brindado respuesta alguna. Por tal motivo, el 15 de noviembre de 2019 remitió un nuevo oficio, dirigido al alcalde Jacobo Guillen Miranda, en el cual nuevamente le expone el problema ambiental y de salud pública que tiene su propiedad, debido a que puede afectar a los vecinos. Sin embargo, alega que tampoco recibió respuesta alguna ni del alcalde ni del departamento del municipio. Sobre el particular, considera que el municipio no ha tomado las acciones correspondientes que la ley le otorga para corregir el grave problema, pese a que en la casa, vive su familia (con un niño menor de un año), la cual se verá afectada con las primeras lluvias que causarán que el terreno se inunde, haya malos olores y que las aguas se estanquen.Advierte que ante la problemática expuesta, acudió el 21 de enero de 2020 a la Junta Vial Cantonal, a solicitar respuesta de la nota enviada desde el 17 de septiembre de 2019; sin embargo, no la recibió. Reitera que la propiedad se inunda por el costado norte que caen las aguas de la pendiente donde se ubica el cementerio municipal y los vecinos de la línea del frente, además por la parte este, que colinda con Erlinda Calvo y por el sur, donde pasa un caño, el cual cuenta con una alcantarilla que se desborda y filtra su propiedad. Replica que el caño del costado sur, atraviesa su propiedad, la de sus colindantes y desagua por el Centro Infantil de Los Chiles. Cuestiona que los hechos descritos, lesionan sus derechos fundamentales, a tener una vida digna, pues es adulta mayor. Solicita que se declare con lugar el recurso.
  2. 2Mediante auto de las 19:23 hrs. del 30 de abril de 2020 se dio curso al presente recurso y se notificó a la autoridad recurrida el 05 de mayo de 2020.
  3. 3Por escrito presentado el 15 de mayo de 2020, informan bajo juramento JACOBO GUILLEN MIRANDA, en su condición de Alcalde Municipal, YENNER CÁCERES SOTO, en su condición de Presidente del Consejo Municipal y, JOSÉ ABRAHAM DELGADO MOREIRA en su Condición de Director del Departamento de Gestión Vial, todos de la Municipalidad de los Chiles Alajuela que, la problemática planteada dentro de este Recurso de Amparo, se puede dividir en dos problemáticas diferentes, que requieren ser tratadas por aparte como son: las aguas que caen a su propiedad por el costado norte (frente de calle hacia el cementerio), las cuales son producto de la escorrentía superficial que cae sobre la calle 2 y debido a la pendiente tanto de la calle 2, como del lote en cuestión, ingresan a esa propiedad buscando la quebrada ubicada en el lidero sur de la misma. Señala que si bien es cierto, las aguas ingresan a esta propiedad por acción de las pendientes naturales del terreno, estas pueden ser desviadas apropiadamente mediante un alcantarillado pluvial que recorra los linderos norte y oeste del lote, siguiendo los vértices 4 a 3 y 3 a 2, para así en el vértice 2 ser depositados en la quebrada sin nombre existente.Menciona que este alcantarillado no existe en la actualidad, aunque si es factible su construcción en el corto plazo. Sin embargo esto no resolvería el problema de inundación mencionado, en la mitad sur de la propiedad, puesto que como indica el recurrente en época lluviosa la quebrada se desborda. Indica que las aguas que provienen de la quebrada ubicada en el lindero sur (entre los vértices 1 y 2), de la propiedad, se trata de una quebrada que siempre ha existido en ese sitio. De esta forma, en el anexo 1 se presenta el plano propiedad del denunciante. Al respecto indica que el plano del año1990, muestra la quebrada existente en el lindero sur de la propiedad. El anexo 2 contiene el plano del colindante sur con el recurrente, el cual fue elaborado en el año 2008. Menciona que en ese plano se indica un área de protección de 10 metros, lo cual es un requisito de ley a la orilla de quebradas naturales como la que se presenta en esta propiedad.Señala que ese segundo problema es de naturaleza muy diferente, puesto que implicaría además realizar una inversión (ya sea al alcantarillar la misma u otra obra que se elija), en una propiedad privada, con fondos públicos, aspecto que la Municipalidad de Los Chiles ha visto como una limitación en sus potestades para darle una verdadera solución a este problema. Indica que existe un centro infantil que ya ha alcantarillado las aguas de dicha quebrada con recursos económicos del mismo centro. Concluye que ciertamente y como indica el recurrente, el problema ha sido analizado en diversas ocasiones en Junta Vial Cantonal. Tanto en las solicitudes realizadas, como en el análisis posterior han sido tratadas las dos problemáticas existentes, quedando la institución limitada por el hecho de tener que invertir en propiedad privada, recursos públicos. Agrega que esa “quebrada sin nombre”, constituye una depresión natural que recoge las aguas pluviales del sector noroeste de Los Chiles, y que aun cuando no se han realizado estudios al respecto, los malos olores de las aguas presentes en ella, sugieren que existe contaminación. Solicitan se desestime el recurso.
  4. 4Por escrito presentado 13 de mayo de 2020, por CARMEN CRUZ CRUZ, hija de ABDULIA CRUZ CRUZ, interpone coadyuvancia y expone que, en la propiedad que reside, a nombre de su difunta madre, en la parte sur se colinda con un caño, que anteriormente fue una quebrada, el cual no cuenta con alcantarillado desde dicha propiedad y hasta la calle que se ubica frente al cementerio municipal. Señala que, tiene muchísimos años de residir en esa propiedad, en aquel entones su papá autorizó a la Municipalidad para canalizar las aguas de esa quebrada y brindar un mejor manejo del cauce, luego del paso de los años la misma Municipalidad fue canalizando las aguas con alcantarillas, pero no finalizó las obras, dejando las aguas al descubierto desde su propiedad y las de sus otras dos vecinas. Por otro lado, dentro de los acuerdos la misma municipalidad se comprometió a realizar la limpieza del caño, pero no lo hace de la mejor manera.Indica que como es bien conocido por decenas de vecinos que viven en la línea por donde pasan las aguas canalizadas con alcantarillas grandes, la quebrada que pasa al costado sur de la propiedad de su madre, nace unos 300 o 400 metros al este, están drenados e incluso no es visible por los rellenos realizados. Agrega que sobre las aguas que pasan por ese caño, provocan que la propiedad donde reside se inunde casi en un 60%, dejándole sin acceso al patio, inclusive por el momento del huracán Otto, la propiedad se inundó a un 80%, quedando a pocos centímetros de llegar a la vivienda. Puntualiza que para poder construir la vivienda en la que habitan, se tuvo que efectuar un relleno bastante considerable, con el fin de evitar que el desbordamiento de las aguas lograse alcanzar el nivel del piso de la vivienda. Indica que es claro que el problema del caño les afecta a tres vecinos, que cuentan con un núcleo familiar y que también se debe a la falta de conclusión de las obras de alcantarillado en el cuadrante donde se ubica sus terrenos.
  5. 5Por escrito presentado 13 de mayo de 2020, por ÁNGELES ALVARADO HERNÁNDEZ, hija de la recurrente solicita coadyuvancia y expone que, en la propiedad de su madre Francisca Alvarado Hernández no existe ningún tipo de alcantarillado por el sector norte que sería el frente de la propiedad, ni por la parte este que sería la vía principal que comunica con el Cementerio Municipal ni por la parte sur donde pasa una quebrada. Señala que como vecina de ese cantón, y propiamente de la cabecera del cantón conoce muy bien el terreno en cuestión, así como la dimensión de los terrenos aledaños, por lo cual sobre la parte NORTE y OESTE de la propiedad de su madre al no existir el alcantarillado que brinde salida a las aguas que vienen del alcantarillado que termina frente a la propiedad de Erlinda Calvo, en una caja de registro que está en la esquina ESTE del lote de madre, lo cual fue aportado en fotografías, provoca que se acumulen las aguas tanto las que corren por dicho ducto así como las que vienen de las propiedades que se ubican en el cuadrante que colinda al ESTE del Cementerio, las bajantes del Colegio de Los Chiles a ambos lados de la vía.De igual manera frente al Cementerio Municipal no existe alcantarillado, por lo cual las aguas que vienen bajando del Colegio terminan depositándose en la caja de registro que esta al costado ESTE del lote de su madre. Es decir que no existe más que una simple caja de registro para todas estas aguas, que no tienen salida, al toparse todo este cumulo hídrico, hace que se rebalse el cauce tanto en época de verano como de invierno, e imperen las aguas dentro del terreno en cuestión en una zanja que no es de origen natural y que atraviesa la propiedad. Esa zanja fue excavada por la Municipalidad de Los Chiles hace varios años, cuando dejaron inconclusas las obras del alcantarillado de los dos cuadrantes, señala que para aquel momento no existía este problema, ya que las aguas tenían diferentes rumbos, que en la actualidad es uno solo y termina entre la propiedad de su madre y Erlinda Calvo. Indica que sobre la quebrada que pasa al costado sur de la propiedad de su madre, este afluente no es un asunto exclusivo del cuadrante donde se ubica la propiedad de su madre, sino que atraviesa otros terrenos, y nacía en aquel momento a 300 metros ESTE, el cual pasa por las propiedades de la Familia Solano Chamorro, de la familia Serrano, la familia García Salas, luego por la propiedad donde reside el actual Presidente del Concejo Municipal Yenner Caseres Soto y luego hacia la propiedad donde alquila la municipalidad al hermano del señor en mención, de nombre Roy Cáceres Soto, sin embargo, esta distancia que recorre dicha quebrada, fue canalizada mediante alcantarillado por parte del municipio, pero la misma no fue terminada, quedando al descubierto mas de 75 metros del afluente.Puntualiza que a los funcionarios Municipales les consta lo descrito, porque el paso del agua se observa desde la propiedad que alquila el municipio como bodega, quedando al descubierto el paso por las propiedades de doña Abdulia Cruz Cruz, Erlinda Calvo Solís y su mamá Francisca Alvarado. Agrega que lo anterior hace denotar que en efecto al canalizar de un sector y dejar al descubierto el resto del paso, en época de invierto se colapse el paso en la última caja de registro ubicada frente a la propiedad del Centro Infantil. Agrega que en la base catastral de la Municipalidad deben constar lo hechos descritos, porque le consta que estos trabajos de alcantarillado en la quebrada que se convirtió en caño fueron efectuados con recursos municipales en las propiedades privadas para efectuar a mejor canalización de las aguas. Añade que el Centro Infantil Los Chiles canalizó las aguas y no tuvo problema alguno ni con el municipio ni algún otro ente estatal.Señala que sobre las aguas que caen por la parte norte de la propiedad de su madre, y que son producto de la escorrentía superficial, no representan mayor problema, sino las canalizadas y que propiamente terminan al costado este de la propiedad en la zanja improvisada que dejó el municipio hace muchos años dentro del lote, las cuales originan los malos olores, lo cual no existiría si se hubiera concluido las obras en ese punto. Manifiesta que para el momento en que se presentó la emergencia nacional por el paso del Huracán Otto, la propiedad se vio mayormente perjudicada debido a que la Municipalidad de Los Chiles dejó un relleno que provoco que las aguas de la quebrada quedaran más empozadas En otras propiedades terminaron de alcantarillar pasos de aguas que anteriormente fueron quebradas, pero con el pasar del tiempo y por obra del ser humano quedaron reducidas a caños. Indica que sobre las diligencias efectuadas ante la Municipalidad de Los Chiles, nunca se ha obtenido una respuesta ni tampoco una visita de los funcionarios, para que pudieran dialogar con su madre.Extrañamente luego de presentar este recurso, la Municipalidad envió al Ingeniero Abraham Delgado Moreira no para buscar una solución sino para simplemente justificar lo sucedido, ya que así lo hizo ver a su hermano, quien reside en la vivienda que se ubica en el terreno. Es decir que el municipio no tiene constancia para mencionar que han tratado de resolver el problema a su madre. Concluye que su madre no solo está presentando el problema de la quebrada sino de la falta de conclusión de las obras de alcantarillado en el cuadrante donde su ubica su terreno y vivienda, así como las de los cuadrantes aledaños al Cementerio.
  6. 6En la substanciación de este proceso se han observado las prescripciones de ley.

Redacta el Magistrado Hernandez Gutierrez; y,

Considerando:

I. SOBRE LAS COADYUVANCIAS ACTIVAS PRESENTADAS

Mediante escritos presentados el 13 de mayo de 2020, por CARMEN CRUZ CRUZ, hija de ABDULIA CRUZ CRUZ y, por ÁNGELES ALVARADO HERNÁNDEZ, mediante los cuales solicitan se le tenga como coadyuvantes activas en este proceso a favor de la recurrente. Al respecto, este Tribunal considera importante indicar que la coadyuvancia es una forma de intervención adhesiva que se da cuando una persona actúa en un proceso uniéndose a las pretensiones de alguna de las partes principales. En virtud de lo anterior, está legitimado para actuar como coadyuvante quien ostente un interés directo en el resultado del recurso, pero al no ser actor principal, el no resultará directamente afectado por la sentencia, es decir, la eficacia de ésta no podrá alcanzarle de manera directa e inmediata, ni le afecta la condición de cosa juzgada del pronunciamiento, aunque en materia de amparo pueda favorecerle la eficacia de lo resuelto, debido al carácter de "erga omnes" que tiene la jurisprudencia y precedentes de la jurisdicción constitucional (artículo 13 de la Ley de la Jurisdicción Constitucional). En este caso, la Sala procede a admitir las coadyuvancias presentadas (en los términos del artículo 34 de la Ley de la Jurisdicción Constitucional) por cuanto las citadas personas solicitaron que se garantice a la recurrente sus derechos fundamentales.

II. OBJETO DEL RECURSO

La parte recurrente presenta recurso de amparo y expone que, desde el 29 de enero de 2019, la señora Erlinda Calvo recurrió a la Municipalidad de Los Chiles, para solicitar la inspección del alcantarillado que pasa por el frente de su casa y de su propiedad (de la recurrente), que termina desaguando las aguas de los caños, es decir invadiendo su finca. Indica que ante la falta de acción de parte del municipio para brindar la respuesta debida, el 17 de septiembre de 2019, presentó gestión formal ante la Junta Vial Cantonal. Añade que en dicho escrito, explicó con detalle el problema que tiene desde hace 10 años. Además, hizo referencia al daño que este le causa a su propiedad, luego de que la misma municipalidad, tiempo atrás realizara el zanjo y nunca finalizara los trabajos de alcantarillado frente a su vivienda ni corrigiera el daño. Aclara que el envío de las notas, se hacen con el fin de encontrar una solución a la afectación que sufre su patrimonio, ya que ha tratado de vender el lote para tener una mejor calidad de vida, pero por las circunstancias que imperan, los oferentes no llegan a concretar el contrato por el rechazo del peritaje, ya que es muy notorio que la propiedad sufre de problemas de inundación de aguas residuales.

Reclama que pese a lo expuesto, al día que acude en amparo, la autoridad recurrida no le ha brindado respuesta alguna. Por tal motivo, el 15 de noviembre de 2019 remitió un nuevo oficio, dirigido al alcalde Jacobo Guillen Miranda, en el cual nuevamente le expone el problema ambiental y de salud pública que tiene su propiedad, debido a que puede afectar a los vecinos. Sin embargo, alega que tampoco recibió respuesta alguna ni del alcalde ni del departamento del municipio. Sobre el particular, considera que el municipio no ha tomado las acciones correspondientes que la ley le otorga para corregir el grave problema, pese a que en la casa, vive su familia (con un niño menor de un año), la cual se verá afectada con las primeras lluvias que causarán que el terreno se inunde, haya malos olores y que las aguas se estanquen. Advierte que ante la problemática expuesta, acudió el 21 de enero de 2020 a la Junta Vial Cantonal, a solicitar respuesta de la nota enviada desde el 17 de septiembre de 2019; sin embargo, no la recibió.

Reitera que la propiedad se inunda por el costado norte que caen las aguas de la pendiente donde se ubica el cementerio municipal y los vecinos de la línea del frente, además por la parte este, que colinda con Erlinda Calvo y por el sur, donde pasa un caño, el cual cuenta con una alcantarilla que se desborda y filtra su propiedad. Replica que el caño del costado sur, atraviesa su propiedad, la de sus colindantes y desagua por el Centro Infantil de Los Chiles. Cuestiona que los hechos descritos, lesionan sus derechos fundamentales, a tener una vida digna, pues es adulta mayor. Solicita que se declare con lugar el recurso.

III. HECHOS PROBADOS

De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque la autoridad recurrida haya omitido referirse a ellos, según lo prevenido en el auto inicial:

Mediante nota del 29 de enero de 2019, la señora Erlinda Calvo recurrió a la Municipalidad de Los Chiles, para solicitar la inspección del alcantarillado que pasa por el frente de su casa y de su propiedad (de la recurrente), que termina desaguando las aguas de los caños (véase informe y prueba aportada por la parte recurrente).

El 17 de septiembre de 2019, la recurrente presentó gestión formal ante la Junta Vial Cantonal, para la inspección del alcantarillado que pasa por el frente de su casa y de su propiedad (véase informe y prueba aportada por la parte recurrente).

El 15 de noviembre de 2019, le recurrente remitió un nuevo oficio, dirigido al alcalde Jacobo Guillen Miranda, en el cual nuevamente le expone el problema ambiental y de salud pública que tiene su propiedad, debido a que puede afectar a los vecinos (véase informe y prueba aportada por la parte recurrente).

Mediante nota del 21 de enero de 2020, la recurrente solicitó información de respuesta en relación al oficio del 17 de septiembre de 2019 (véase informe y prueba aportada por la parte recurrente).

En relación con las aguas que caen frente a la propiedad de la recurrente, por el costado norte (frente de calle hacia el cementerio), son producto de la escorrentía superficial que cae sobre la calle 2 y debido a la pendiente tanto de la calle 2, como del lote en cuestión, ingresan a esa propiedad buscando la quebrada ubicada en el lidero sur de la misma. Señala que si bien es cierto, las aguas ingresan a esta propiedad por acción de las pendientes naturales del terreno, estas pueden ser desviadas apropiadamente mediante un alcantarillado pluvial que recorra los linderos norte y oeste del lote, siguiendo los vértices 4 a 3 y 3 a 2, para así en el vértice 2 ser depositados en la quebrada sin nombre existente (véase informe y prueba aportada por la autoridad accionada).

La quebrada existente en el lindero sur de la propiedad según plano aportado de 1990 (véase informe y prueba aportada por la autoridad accionada).

En el plano del colindante sur con el recurrente, el cual fue elaborado en el año 2008. Se indica un área de protección de 10 metros (véase informe y prueba aportada por la autoridad accionada).

En fotografía aérea de la zona de estudio, se muestra que además de aguas debajo de la quebrada, existe un centro infantil que ya ha alcantarillado las aguas de dicha quebrada con recursos económicos del mismo centro (véase informe y prueba aportada por la autoridad accionada).

El problema ha sido analizado en diversas ocasiones en Junta Vial Cantonal. Tanto en las solicitudes realizadas, como en el análisis posterior han sido tratadas las dos problemáticas existentes, quedando la institución limitada por el hecho de tener que invertir en propiedad privada, recursos públicos (véase informe rendido por la autoridad accionada).

IV. SOBRE EL DERECHO A UN AMBIENTE SANO Y ECOLÓGICAMENTE EQUILIBRADO

El artículo 50 de la Constitución Política establece como fundamental el derecho de toda persona a un ambiente sano y ecológicamente equilibrado. De previo a la modificación de este artículo 50 para considerar de manera expresa lo relativo al ambiente, ya la Sala, a través de su labor jurisprudencial, había derivado este derecho a partir de las disposiciones constitucionales de los artículos 21 derecho a la vida y a la salud-, 69 explotación racional de la tierra- y 89 protección de las bellezas naturales-. La Sala ha optado por una consideración abierta o macro del concepto ambiente y de la protección que se brinda al mismo, trascendiendo de la protección básica o primaria del suelo, el aire, el agua, los recursos marinos y costeros, minerales, bosques, diversidad de flora y fauna, y paisaje, para considerar también elementos referentes a la economía, a la generación de divisas a través del turismo, la explotación agrícola y otros.

A partir de la reforma del artículo 50 constitucional, en la cual se consagró expresamente el derecho ambiental como un derecho fundamental, se estableció también -en forma terminante- la obligación del Estado de garantizar, defender y tutelar este derecho, con lo cual, el Estado se constituye en el garante en la protección y tutela del medio ambiente y los recursos naturales. Es a tenor de esta disposición, en relación con los artículos 20, 69 y 89 de la Constitución Política, que se derivó la responsabilidad del Estado de ejercer una función tutelar y rectora en esta materia, según lo dispone la propia norma constitucional en comentario, función que desarrolla la legislación ambiental. Es así como el mandato constitucional establece el deber para el Estado de garantizar, defender y preservar ese derecho.

V. EL PAPEL DE LAS MUNICIPALIDADES EN MATERIA AMBIENTAL

De conformidad con lo dicho, las municipalidades, como parte integrante del todo que es el Estado, tienen dentro del ámbito de sus competencias y obligaciones una alta cuota de responsabilidad en materia ambiental, sea mediante la aprobación directa de permisos o licencias para las cuales se exija el previo cumplimiento de requisitos que acrediten ante otras instancias del poder público el adecuado manejo ambiental, como mediante inspecciones regulares y canalización de situaciones de riesgo ante las instancias con mayor competencia de intervención. Ha quedado establecido ya que a los gobiernos locales les alcanza la obligación de coordinación y prevención en materia ambiental dentro del ámbito de su jurisdicción territorial, de donde resulta que ciertamente las municipalidades son actores importantes en la tarea de protección al ambiente. Es indubitable la facultad de los gobiernos locales para darse su propia ordenación territorial a través de los planes reguladores; pero la existencia de estos -que en su mayoría carecen de complementos de ordenación desde el punto de vista del ambiente sano y ecológicamente equilibrado- no produce la desaplicación de la legislación tutelar ambiental.

Por el contrario, estima la Sala que debe ser requisito fundamental, que no atenta contra el principio constitucional de la autonomía municipal, el que todo plan regulador deba considerar, de previo a ser aprobado y desarrollado, con un examen del impacto ambiental desde la perspectiva que da el artículo cincuenta constitucional, para que el ordenamiento del suelo y sus diversos regímenes sean compatibles con los alcances de la norma superior, sobre todo, valorando que esta disposición establece el derecho de todos los habitantes a obtener una respuesta ambiental de todas las autoridades públicas y ello incluye, sin duda, a las municipalidades, quienes no están exentas de la aplicación de la norma constitucional y de su legislación de desarrollo. Los gobiernos locales pueden y deben exigir el cumplimiento de requisitos ambientales en su territorio, y en caso de conflicto con las autoridades rectoras de la materia ambiental, pueden someter las controversias al contralor jurisdiccional que corresponda según la naturaleza de la infracción ver, en este sentido, sentencia número 2006-7994 de las 08:57 horas del 2 de junio de 2006-.

VI. ACERCA DEL PRINCIPIO DE COORDINACIÓN EN MATERIA AMBIENTAL

Asimismo, esta Sala ha reconocido que uno de los principios rectores de la organización administrativa, lo constituye la coordinación que debe mediar entre todos los entes y órganos públicos al ejercer sus competencias y prestar los servicios que el ordenamiento jurídico les ha asignado. La coordinación, en cuanto asegura la eficiencia y eficacia administrativas, es un principio constitucional virtual o implícito que permea el entero ordenamiento jurídico administrativo y obliga a todos los entes públicos. La coordinación puede ser interorgánica -entre los diversos órganos que conforman un ente público no sujetos a una relación de jerarquía- o intersubjetiva, esto es, entre los entes públicos, cada uno con personalidad jurídica, presupuesto propio, autonomía y competencias específicas. La coordinación administrativa tiene por propósito evitar las duplicidades y omisiones en el ejercicio de las funciones administrativas de cada ente público, esto es, que sean desempeñadas de forma racional y ordenada (ver voto número 07-15218 de las 12:00 horas de 19 de octubre de 2007).

Dicha coordinación administrativa adquiere particular relevancia en el caso de problemas de contaminación ambiental, ya que esta permite que los distintos entes y órganos públicos puedan conjuntar esfuerzos, para que, se pueda proteger, de forma oportuna y efectiva, el derecho fundamental de toda persona a un ambiente sano y ecológicamente equilibrado.

VII. COMPETENCIA MUNICIPAL Y OBLIGACIÓN DE COORDINACIÓN INTERINSTITUCIONAL

El artículo 169, de la Constitución Política, dispone que "La administración de los intereses y servicios locales en cada cantón, estará a cargo del Gobierno Municipal (...)". Esta norma ha sido desarrollada por el legislador ordinario, en atención a ello, el artículo 3, del Código Municipal, Ley número 7794 de 30 de abril de 1998, dispone que: "El gobierno y la administración de los intereses y servicios cantonales estarán a cargo del gobierno municipal". En este mismo sentido, se ha expresado la Sala Constitucional en su jurisprudencia. Verbigracia, en sentencia número 5445-99, de las 14:30 horas del 14 de julio de 1999, se dispuso lo siguiente:

"VI.- DE LAS ATRIBUCIONES DE LAS MUNICIPALIDADES EN RAZÓN DE LA MATERIA (CONCEPTO DE "LO LOCAL"). Por disposición constitucional expresa -artículo 169-, hay una asignación de funciones o atribuciones en favor de los gobiernos locales en razón de la materia a "lo local", sea, "la administración de los servicios e intereses" de la localidad a la que está circunscrita, para lo cual se la dota de autonomía (") De manera que sus potestades son genéricas, en tanto no hay una enumeración detallada de sus cometidos propios, sino una simple enunciación del ámbito de su competencia; pero no por ello no determinable, a lo que hizo referencia este Tribunal en sentencia número 6469-97, de las dieciséis horas veinte minutos del ocho de octubre de mil novecientos noventa y siete, en los siguientes términos:

" (...) lo local tiene tal connotación que definir sus alcances por el legislador o el juez, debe conducir al mantenimiento de la integridad de los intereses y servicios locales, de manera que ni siquiera podría el legislador dictar normativa que tienda a desmembrar el Municipio (elemento territorial), si no lo hace observando los procedimientos previamente establecidos en la Constitución Política; ni tampoco promulgar aquella que coloque a sus habitantes (población) en claras condiciones de inferioridad con relación al resto del país; ni la que afecte la esencia misma de lo local (gobierno), de manera que se convierta a la Corporación en un simple contenedor vacío del que subsista solo la nominación, pero desactivando todo el régimen tal y como fue concebido por la Asamblea Nacional Constituyente. En otro giro, habrá cometidos que por su naturaleza son municipales -locales- y no pueden ser substraídos de ese ámbito de competencia para convertirlos en servicios o intereses nacionales, porque hacerlo implicaría desarticular a la Municipalidad, o mejor aún, vaciarla de contenido constitucional, y por ello, no es posible de antemano dictar los límites infranqueables de lo local, sino que para desentrañar lo que corresponde o no al gobierno comunal, deberá extraerse del examen que se haga en cada caso concreto (...)". De lo anterior, resalta el hecho de que, por voluntad expresa de nuestra Carta Fundamental, se asigna una competencia específica a los gobiernos locales, atribución que además es exclusiva de éstos; es decir, se trata de una competencia originaria de la municipalidad y sólo mediante una ley de nacionalización o de regionalización es que puede ser desplazada, total o parcialmente".

En consecuencia, si un grupo de munícipes, en su circunscripción territorial, sufren inundaciones con riesgo para sus vidas y graves daños patrimoniales, psicológicos, calidad de vida y bienestar general, esto se enmarca dentro del concepto de "intereses y servicios locales" del numera 169, constitucional, problemas cuyas causas tienen que ser identificadas con precisión y, más aun, las soluciones, a fin de implementarlas a la mayor brevedad posible; para lo cual corresponde a la Municipalidad coordinar con las instituciones de nivel nacional con competencia para actuar sobre el problema. En efecto, la Sala ya ha desarrollado la obligación municipal de coordinar con otras instituciones estatales en aras de atender los "intereses" y prestar cumplidamente los "servicios locales". En la citada sentencia número 5445-99, la Sala manifestó:

"(...) se refieren a la obligación de coordinación que debe existir entre los gobiernos locales, las instituciones descentralizadas y el Poder Ejecutivo, para llevar a cabo las funciones que le han sido encomendadas, lo que debe ser analizado a partir de la naturaleza misma de la autonomía municipal. Es en virtud de lo dispuesto en el artículo 170 constitucional, que las municipalidades (entes corporativos locales) gozan de autonomía funcional, administrativa y financiera en la administración de los intereses y servicios locales (artículo 169 de la Constitución Política) (...) No puede, entonces, crearse un conflicto por antagonismo o protagonismo entre la materia que integra el fin general de "los intereses y servicios locales" de los intereses y servicios públicos "nacionales" o "estatales", intrínsecamente distintos unos de otros, pero que en realidad están llamados a coexistir (....) Definida la competencia material de la municipalidad en una circunscripción territorial determinada, queda claro que habrá cometidos que por su naturaleza son exclusivamente municipales, a la par de otros que pueden ser reputados nacionales o estatales; por ello es esencial definir la forma de cooparticipación de atribuciones que resulta inevitable, puesto que la capacidad pública de las municipalidades es local, y la del Estado y los demás entes, nacional; de donde resulta que el territorio municipal es simultáneamente estatal e institucional, en la medida en que lo exijan las circunstancias. Es decir, las municipalidades pueden compartir sus competencias con la Administración Pública en general, relación que debe desenvolverse en los términos como está definida en la ley (artículo 5 del Código Municipal anterior, artículo 7 del nuevo Código), que establece la obligación de "coordinación" entre la municipalidades y las instituciones públicas que concurran en el desempeño de sus competencias, para evitar duplicaciones de esfuerzos y contradicciones, sobre todo, porque sólo la coordinación voluntaria es compatible con la autonomía municipal por ser su expresión. En otros términos, la municipalidad está llamada a entrar en relaciones de cooperación con otros entes públicos, y viceversa, dado el carácter concurrente o coincidente -en muchos casos-, de intereses en torno a un asunto concreto. En la doctrina, la coordinación es definida a partir de la existencia de varios centros independientes de acción, cada uno con cometidos y poderes de decisión propios, y eventualmente discrepantes; pese a ello, debe existir una comunidad de fines por materia, pero por concurrencia, en cuanto sea común el objeto receptor de los resultados finales de la actividad y de los actos de cada uno". De manera que la coordinación es la ordenación de las relaciones entre estas diversas actividades independientes, que se hace cargo de esa concurrencia en un mismo objeto o entidad, para hacerla útil a un plan público global, sin suprimir la independencia recíproca de los sujetos agentes. Como no hay una relación de jerarquía de las instituciones descentralizadas, ni del Estado mismo en relación con las municipalidades, no es posible la imposición a éstas de determinadas conductas, con lo cual surge el imprescindible "concierto" interinstitucional, en sentido estricto, en cuanto los centros autónomos e independientes de acción se ponen de acuerdo sobre ese esquema preventivo y global, en el que cada uno cumple un papel con vista en una misión confiada a los otros".

Adviértase, por lo demás, que las Municipalidades están obligadas, por imperativo del ordinal 50 de la Constitución Política, a prodigarse en la protección del ambiente (sentencia número 2006-7994 de las 8:57 horas de 2 de junio de 2006).

VIII. SOBRE LA ACTUACIÓN MUNICIPAL EN EL CASO CONCRETO

La parte recurrente presenta recurso de amparo y expone que, desde el 29 de enero de 2019, la señora Erlinda Calvo recurrió a la Municipalidad de Los Chiles, para solicitar la inspección del alcantarillado que pasa por el frente de su casa y de su propiedad (de la recurrente), que termina desaguando las aguas de los caños, es decir invadiendo su finca. Indica que ante la falta de acción de parte del municipio para brindar la respuesta debida, el 17 de septiembre de 2019, presentó gestión formal ante la Junta Vial Cantonal. Añade que en dicho escrito, explicó con detalle el problema que tiene desde hace 10 años. Además, hizo referencia al daño que este le causa a su propiedad, luego de que la misma municipalidad, tiempo atrás realizara el zanjo y nunca finalizara los trabajos de alcantarillado frente a su vivienda ni corrigiera el daño. Aclara que el envío de las notas, se hacen con el fin de encontrar una solución a la afectación que sufre su patrimonio, ya que ha tratado de vender el lote para tener una mejor calidad de vida, pero por las circunstancias que imperan, los oferentes no llegan a concretar el contrato por el rechazo del peritaje, ya que es muy notorio que la propiedad sufre de problemas de inundación de aguas residuales.

Reclama que pese a lo expuesto, al día que acude en amparo, la autoridad recurrida no le ha brindado respuesta alguna. Por tal motivo, el 15 de noviembre de 2019 remitió un nuevo oficio, dirigido al alcalde Jacobo Guillen Miranda, en el cual nuevamente le expone el problema ambiental y de salud pública que tiene su propiedad, debido a que puede afectar a los vecinos. Sin embargo, alega que tampoco recibió respuesta alguna ni del alcalde ni del departamento del municipio. Sobre el particular, considera que el municipio no ha tomado las acciones correspondientes que la ley le otorga para corregir el grave problema, pese a que en la casa, vive su familia (con un niño menor de un año), la cual se verá afectada con las primeras lluvias que causarán que el terreno se inunde, haya malos olores y que las aguas se estanquen. Advierte que ante la problemática expuesta, acudió el 21 de enero de 2020 a la Junta Vial Cantonal, a solicitar respuesta de la nota enviada desde el 17 de septiembre de 2019; sin embargo, no la recibió.

Reitera que la propiedad se inunda por el costado norte que caen las aguas de la pendiente donde se ubica el cementerio municipal y los vecinos de la línea del frente, además por la parte este, que colinda con Erlinda Calvo y por el sur, donde pasa un caño, el cual cuenta con una alcantarilla que se desborda y filtra su propiedad. Replica que el caño del costado sur, atraviesa su propiedad, la de sus colindantes y desagua por el Centro Infantil de Los Chiles. Cuestiona que los hechos descritos, lesionan sus derechos fundamentales, a tener una vida digna, pues es adulta mayor. Solicita que se declare con lugar el recurso.

Después de analizar los elementos probatorios aportados, este Tribunal verifica la lesión a los derechos fundamentales de la amparada. Del informe rendido por la representante de la autoridad recurrida -que se tiene dado bajo juramento con las consecuencias, incluso penales, previstas en el artículo 44 de la Ley que rige esta Jurisdicción- y la prueba aportada para la resolución del asunto ha sido debidamente acreditado que, mediante nota del 29 de enero de 2019, la señora Erlinda Calvo recurrió a la Municipalidad de Los Chiles, para solicitar la inspección del alcantarillado que pasa por el frente de su casa y de su propiedad (de la recurrente), que termina desaguando las aguas de los caños. Asimismo, el 17 de septiembre de 2019, la recurrente presentó gestión formal ante la Junta Vial Cantonal, para la inspección del alcantarillado que pasa por el frente de su casa y de su propiedad. Posteriormente, el 15 de noviembre de 2019, le recurrente remitió un nuevo oficio, dirigido al alcalde Jacobo Guillen Miranda, en el cual nuevamente le expone el problema ambiental y de salud pública que tiene su propiedad, debido a que puede afectar a los vecinos.

De igual manera, mediante nota del 21 de enero de 2020, la recurrente solicitó información de respuesta en relación al oficio del 17 de septiembre de 2019. Al efecto, los accionados aseguran que, en relación con las aguas que caen frente a la propiedad de la recurrente, por el costado norte (frente de calle hacia el cementerio), son producto de la escorrentía superficial que cae sobre la calle 2 y debido a la pendiente tanto de la calle 2, como del lote en cuestión, ingresan a esa propiedad buscando la quebrada ubicada en el lidero sur de la misma. Señala que si bien es cierto, las aguas ingresan a esa propiedad por acción de las pendientes naturales del terreno, estas pueden ser desviadas apropiadamente mediante un alcantarillado pluvial que recorra los linderos norte y oeste del lote, siguiendo los vértices 4 a 3 y 3 a 2, para así en el vértice 2 ser depositados en la quebrada sin nombre existente.

Asimismo, señalaron que la quebrada existente en el lindero sur de la propiedad según plano aportado de 1990. De igual forma, en el plano del colindante sur con el recurrente, el cual fue elaborado en el año 2008. Se indica un área de protección de 10 metros. Adicionan que en fotografía aérea de la zona de estudio, se muestra que además de aguas debajo de la quebrada, existe un centro infantil que ya ha alcantarillado las aguas de dicha quebrada con recursos económicos del mismo centro. Aseguran que el problema ha sido analizado en diversas ocasiones en Junta Vial Cantonal. Tanto en las solicitudes realizadas, como en el análisis posterior han sido tratadas las dos problemáticas existentes, quedando la institución limitada por el hecho de tener que invertir en propiedad privada, recursos públicos. Expuesto lo anterior, valora esta Sala, en primer lugar, que efectivamente, en el inmueble de la amparada concurren aguas pluviales, unas que llegan desde la calle frente al cementerio, las cuales los propios accionados indicaron que estas pueden ser desviadas apropiadamente mediante un alcantarillado pluvial que recorra los linderos norte y oeste del lote, siguiendo los vértices 4 a 3 y 3 a 2, para así en el vértice 2 ser depositados en la quebrada sin nombre existente.

En cuanto a ese aspecto, los recurridos no indicaron haber dado solución para la canalización de dichas aguas, razón por la cual en cuanto a este primer agravio procede la estimatoria del proceso. En segundo lugar, en cuanto a la quebrada sin nombre que pasa en el costado sur de la propiedad de la recurrente, se debe indicar que si bien esta se encuentra ubicada en propiedad de la recurrente y esta existe desde hace muchos años (tal como se advierte en el plano de 1990), lo cierto es que persisten razones para entender que hay responsabilidad del gobierno local accionado para dar solución al problema. Véase que el propio accionado aceptó que otros munícipes han entubado la quebrada aguas abajo, en dicha afirmación se acepta que el gobierno local ha permitido la intervención de las aguas que discurrían de forma natural, lo cual evidentemente podría hacer cambiar las circunstancias regulares de la escorrentía.

Asimismo, aceptaron que hay contaminación en la quebrada, sobre esta particular, tampoco indicaron haber realizado las gestiones necesarias para resolver dicha situación, claramente una falta en su deber in vigilando. Finalmente, considera esta Sala que los accionados tampoco han valorado adecuadamente el riesgo de la amparada en su casa de habitación, en el memorial de interposición el recurrente indicó que el predio soporta frecuentes inundaciones y ante ello no han tomado ninguna acción. En ese sentido debe recordarse, que dentro de las obligaciones y competencias de los gobiernos locales, relacionadas con los problemas ambientales y de riesgo de los munícipes deben, entre otras, realizar inspecciones regulares y canalización de situaciones de riesgo ante las instancias con mayor competencia de intervención. Los gobiernos locales pueden y deben exigir el cumplimiento de requisitos ambientales en su territorio, y en caso de conflicto con las autoridades rectoras de la materia ambiental, pueden someter las controversias al contralor jurisdiccional que corresponda según la naturaleza de la infracción ver, en este sentido.

En mérito de lo expuesto considera esta Sala que el presente proceso debe ser estimado para que el municipio accionado corrija la situación denunciada por la recurrente en los términos indicados en la parte dispositiva de la presente resolución.

IX. NOTA DE LA MAGISTRADA HERNÁNDEZ LÓPEZ RESPECTO DEL RECLAMO POR INFRACCIÓN DEL ARTÍCULO 50 DE LA CONSTITUCIÓN POLÍTICA

1. El contexto histórico que motivó en su momento la amplia intervención de la Sala en materia ambiental, ha tenido una considerable variación que impone a este órgano reconsiderar las condiciones para su participación en el aseguramiento del derecho de las personas a un ambiente sano y equilibrado, tal y como ha sido tutelado en el artículo 50 de la Constitución Política. En efecto, la situación actual –caracterizada por una amplísima producción legal y reglamentaria que incluye reglas de fondo, procedimientos y creación de órganos para el cumplimiento de lo ordenado en la Carta Fundamental- es radicalmente diferente de la anterior, en la cual la ausencia de normativa y de instancias estatales con competencia apropiada, le impuso a la Sala un papel de protagonista, casi único, en la defensa del precitado derecho constitucional.

2. Hoy en día, nos encontramos frente a un “denso entramado” de normativa ambiental, lo cual ha producido dos fenómenos relevantes: el primero y más obvio, es el surgimiento de una abarcadora regulación jurídica respecto de actividades cuya incidencia en el ambiente estaba poco o nada ordenada, así la creación de órganos estatales con potestades de vigilancia y control sobre los efectos de la actividad humana en el entorno. El segundo fenómeno consiste en que esa creciente juridificación –predominantemente legislativa y reglamentaria– trae aparejada una ineludible entrada en escena tanto de la justicia administrativa como de la jurisdicción ordinaria -prioritariamente la contencioso administrativa, pero también la penal. En ellas, acorde con la importancia del derecho ambiental, se han regulado de forma amplia vías procesales y medios de legitimación incluyentes, de manera que los administrados puedan hacer valer lo establecido en ese amplio orden jurídico que se relaciona con el tema ambiental.

3. En ese contexto, no resulta apropiado jurídicamente, ni desde el punto de vista funcional, que la Sala Constitucional desplace, o -peor aún- sustituya, a los órganos de justicia ordinarios en la realización de su tarea, también de rango constitucional, de velar por el efectivo cumplimiento de leyes y reglamentos. Es impropio jurídicamente porque en la inmensa mayoría de estos casos lo que se solicita es que interprete y haga valer normas legales y reglamentarias con lo que arriesga traslapar sus competencias con las de otros órganos jurisdiccionales que –ellos sí- han sido creados para ejecutar tales tareas; y resulta también funcionalmente incorrecto, porque el diseño de sus procesos se aviene mal con la complejidad que está presente en numerosos conflictos ambientales que se componen de series de hechos y actos técnica y jurídicamente complejos. Sobre ambas cuestiones existen conocidos ejemplos en los que la Sala ha arrojado una resolución a medias o técnicamente incompleta, o bien se han generado fricciones innecesarias y afectación de la seguridad jurídica.

4. Como parte de los aspectos técnicos que he valorado, añado que está el hecho de que esta jurisdicción no cuenta con jueces ejecutores de sentencia que permitan darle seguimiento adecuado a las mismas -generalmente complejas-, que implican en ocasiones el seguimiento de planes remediales, entre otros, con coordinación interinstitucional y seguimiento de meses y hasta años.

5. Desde esa perspectiva, la decisión de dar un paso al lado en la materia ambiental por parte de este Tribunal no debe ser vista como un abandono de la materia ambiental, sino al contrario, de su adecuada tutela en la instancia que mejor se aviene a la naturaleza de su complejidad y diversidad. Asimismo tampoco debe ser visto como la declinación de esta instancia en su tarea de protección de los derechos constitucionales que le imponen la Constitución Política y su Ley Orgánica, que desde mi punto de vista, queda reservada en esta materia para casos específicos. Se trata más bien, de un ejercicio de reacomodo de las cargas y tareas que corresponden a los distintos órganos estatales, de manera que cada uno de ellos, pueda desplegar plenamente su labor dentro del ámbito que se le ha asignado, así como del ejercicio de fijar su propia competencia, según lo establece el artículo 7 de su Ley Orgánica.

6. Queda claro que la Sala no se plantea abandonar a otras jurisdicciones la labor de protección de los derechos de las personas en materia ambiental. Es conocido que si bien todo reclamo por infracción de normas legales y reglamentarias puede ser reconducido hasta el ámbito constitucional, existen casos cuya resolución no exige más que la aplicación del derecho de la Constitución. Se trata entonces de lograr que la Sala se convierta en protagonista junto con otros, de manera que –entre todos y cada uno en su espacio- se pueda cubrir toda la variedad de situaciones que presenta una protección del derecho a un medio ambiente sano y equilibrado dentro de una sociedad en la que también existen otras necesidades igual de acuciantes. Con esta posición creo firmemente que el ciudadano no pierde un ápice de protección pero se gana sustancialmente en amplitud, en perspectiva y en respeto al equilibrio y distribución de poderes, principio este último de obligada consideración, puesto que rige la dinámica constitucional de cualquier sistema liberal y democrático como el nuestro.- 7.

En línea con lo anterior, sostengo que esta Sala debe abstenerse de conocer los reclamos que se le presenten por supuesta infracción al artículo 50 de la Constitución Política para dejar en manos de la justicia administrativa y la jurisdicción contenciosa administrativa su conocimiento. Lo anterior se deja afirmado con carácter general, sin perjuicio de reconocer la existencia de casos particulares o grupos de casos que, según mi criterio, si resultarían aún mejor tutelados por esta Sala y por tanto deben ser conocidos y resueltos por ella.- Dentro de tales grupos de casos, y sin que esta enunciación pueda considerarse como una lista cerrada y definitiva, puedo señalar que la Sala debe reservarse el conocimiento de situaciones como por ejemplo los reclamos por infracciones ambientales que además pongan en riesgo directo la salud de las personas, o el acceso o calidad del agua; los casos de violaciones groseras y directas al ambiente y en los cuales se constate una palmaria ausencia de la protección por parte de las autoridades estatales, siempre y cuando además la naturaleza del reclamo permita ser abordado mediante el instrumento del amparo como instituto procesal sumario y especial, ya que estimo que tampoco se debe “ordinariar” el amparo para abordar, aún en estos casos citados, temas que rebasen la capacidad de ser atendidos adecuadamente en el mismo.

8. En el caso concreto, de conformidad con los hechos probados, el reclamo de la parte recurrente, podría eventualmente incidir en su salud y la de la su familia. En consecuencia, es claro que estamos ante las excepciones que mencionan y por esa razón he considerado necesario que la Sala ejerciera su competencia, para comprobar o descartar si las omisiones señaladas, vulneran los derechos fundamentales de las personas amparadas.

X. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

POR TANTO:

Se declara CON LUGAR el recurso. Consecuentemente, se ordena a JACOBO GUILLEN MIRANDA, en su condición de Alcalde Municipal, YENNER CÁCERES SOTO, en su condición de Presidente del Consejo Municipal y, JOSÉ ABRAHAM DELGADO MOREIRA en su Condición de Director del Departamento de Gestión Vial de la Municipalidad de los Chiles Alajuela o, a quienes ocupan a esos cargos que, dentro del plazo de SEIS MESES contados a partir de la comunicación de esta sentencia, dicten las medidas respectivas y coordinen lo correspondiente a efectos de prevenir el riesgo de inundación en la propiedad de la recurrente, sin demérito de que con anterioridad a dicho plazo se tomen medidas urgentes y provisionales para mitigar dicho riesgo. Se previene a los recurridos que de conformidad con el artículo 71 de la Ley de esta jurisdicción, se le impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.

Se condena a la Municipalidad de los Chiles Alajuela al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo.
