Amparo proceeding (recurso de amparo) filed by [Nombre 001], an elderly adult, single, identity card No. [Valor 001], resident of Barrio Francisco Peralta, and [Nombre 002], of legal age, married, president of the protected organization, identity card No. [Valor 002], on behalf of the Asociación de Vecinos de Barrio Francisco Peralta y alrededores, legal entity identification No. 3-002-788740, against the Mayor, the Head of the Stormwater Network Construction and Maintenance Section, and engineer Adriana Herra, all of the Municipalidad de San José; and the Minister, the Director of Water, and the Head of Legal Counsel of the Executive Secretariat of the Sistema Nacional de Áreas de Conservación, all of the Ministerio de Ambiente y Energía.
Background:
In the case of intervention work 1 by the company Dos Pinos, because it has been reported to the Ministerio Público, the outcome of the appropriate procedural stage must be monitored should a possible settlement or termination of the proceedings arise. In the case of the works adjoining the land known as the Kirebe property, or the property recorded under real-property folio 644613-000, the Municipalidad de San José, as the local authority competent to grant land-use authorization (uso de suelo) and construction permits, must make such permits conditional upon the company owning this land carrying out the channelization works (obra de canalización) as agreed by the Comisión and in accordance with the technical basis of the Study “Procurement of Scientific and Technical Studies of the Micro-Watersheds of the Acequia las Arias and the Río Ocloro, Including: Stormwater-Catchment Survey, Hydrological and Hydraulic Analysis, Flood-Risk Analysis, and a Proposal for Prevention and Mitigation Measures to Reduce Urban Risk,” abbreviated tender N2016-LA000024-99999, conducted by DECH.
Until channelization is carried out in this sector, construction must not be authorized on this land, which in the interim must serve as a buffer area and delay the potential overflow of water from the Río Ocloro. These two works are part of the intervention plan agreed upon by the Comisión Interinstitucional, to which the Municipalidad is a party and a signatory to the agreements; consequently, as the Local Government, this Municipality must ensure that they are fully implemented in accordance with the Comisión’s agreements, so that the greatest possible degree of mitigation is achieved in accordance with the scientific and technical study of the micro-watershed. The Municipalidad de San José, as the local government responsible for cantonal infrastructure and the administrator of land use, must undertake to promote the proposed works on the properties known as the former Dos Pinos property, “the property adjoining the Río Ocloro on its right bank, located northwest of the intersection of calle 23 and avenida 20”; and the property known as the current Dos Pinos property, “the property located northeast of the intersection of calle 25 and avenida 20,” which is the subject of proceedings before the Ministerio Público.
Accordingly, the Municipalidad de San José must ensure that the works are incorporated into any development proposed for the aforementioned properties and must also evaluate the stormwater contributions from such developments, without prejudice to the permits required from this Dirección de Agua for the specified works. In the case of the works adjoining the land known as the Kirebe property, or the property recorded under real-property folio 644613-000, the Municipalidad de San José, as the local authority competent to grant land-use authorization and construction permits, must make such permits conditional upon the company owning this land carrying out the channelization works as agreed by the Comisión and in accordance with the technical basis of the Study “Procurement of Scientific and Technical Studies of the Micro-Watersheds of the Acequia las Arias and the Río Ocloro, Including: Stormwater-Catchment Survey, Hydrological and Hydraulic Analysis, Flood-Risk Analysis, and a Proposal for Prevention and Mitigation Measures to Reduce Urban Risk,” abbreviated tender N2016-LA000024-99999, conducted by DECH.

It is important to note that, pursuant to resolución 3304-2018-SETENA of 20 de diciembre del 2018, environmental viability (viabilidad ambiental) was granted to the project. Furthermore, the resolution cited above provides: “Together with this solution (point 6), there must be a written commitment from the MUNICIPALIDAD DE SAN JOSE to conduct constant periodic cleaning of that section in order to prevent obstructions caused by solid waste and debris, both in this sector and in all other sectors.
It must be understood that the presence of solid waste in this and other watercourses involves many stakeholders, not only institutional ones, and that the culture and environmental education of the residents who generate waste play an important role in preventing the accumulation of refuse along the river. The Dirección will make the permit conditional upon such systematic maintenance, which must be performed for any type of culverted section (sección de entubamiento), whether circular or square.” Furthermore, we must state that on 18 de mayo de 2019 this Dirección received a letter submitted by residents of Barrio Luján and Ciudadela Calderón Muñoz questioning whether, throughout the proceedings, the order of the Sala Constitucional had been disregarded. That request was reiterated by email sent to the Dirección de Agua. In response to the concerns raised by residents of the communities of Barrio Luján and Ciudadela Calderón Muñoz, they were informed by email dated 14 de agosto de 2019 that the analysis of the technical studies and the works to be carried out and approved formed part of a comprehensive solution intended to address the problem at the site.
It was explained to them that the existing culverting (entubamiento) on the property currently owned by Cooperativa de Leche Dos Pinos, located in Barrio Luján, was constructed without a permit and had therefore been reported to the Ministerio Público. They were advised that the dimensions of the works were derived from the study conducted by the company DEHC, based on the design flow (caudal de diseño) considered necessary to address water-overflow problems and the resulting flooding of adjacent areas. It was explained to them that what must be done in this sector of the Río Ocloro is to restore the watercourse (restauración del cauce) by removing the culverting. This may be done only at the appropriate stage of the judicial proceedings. The Dirección de Agua and SINAC cannot, through administrative channels, order or authorize this work because a criminal complaint has already been filed.
In this regard, they were informed that once the matter is resolved judicially, no permit will be required because the intervention will restore the watercourse from an unlawful condition, unless otherwise determined by the court order. If the judge so deems and orders, or if the matter is settled accordingly, the appropriate and ideal course is for the work to be undertaken subject to a design capable of conveying the design flow and consistent with the other interventions in the river proposed by the Comisión. It is reiterated that the protection-area setback (retiro de área de protección) must be respected at all times. Regarding the inquiry raised, it must be noted that Barrio Luján has an evident condition of culverting, with private properties and public areas that have been there for years; opening the watercourse to the open air is neither socially nor economically feasible. A consolidated condition exists.
Any intervention work undertaken must improve the hydraulic water-drainage capacity, which entails improving the conveyance of peak flows in accordance with the design flow stated in the DEHC report, and any work implemented must be capable of conveying that design flow. Maintenance of this type of work or of bridges is entirely the Municipality’s responsibility; the Municipalidad de San José is aware of this, and the Dirección de Agua will require compliance. As the community is aware, that Dirección established as a priority and directed that open-channel intervention works (obras de intervención a cielo abierto) be undertaken in the sectors where feasible and in accordance with the design agreed upon by the Comisión Interinstitucional. In response to the objections raised concerning the actions of the Dirección de Agua, they were respectfully advised, as had been stated at the most recent open meeting with the community, and are again advised, that neither the Dirección de Agua nor its Director serves or responds to the private interests of any party, much less yields to them, as was suggested in a communication from the community.
It was explained to them that the officials adhere to science and technical expertise within the framework of the law, which entails deciding matters in a manner that is technically correct and feasible, justified, and consistent with the law. In conclusion, it states that, as determined by the Comisión Interinstitucional, the immediate and comprehensive execution of all the intervention works agreed upon within the Comisión is unfeasible, whether for economic reasons, technical complexity, or the need to undertake within reasonable time frames those works that are more immediately feasible, in fulfillment of the measures intended to mitigate flooding in the communities. The Comisión recommends that the Municipalidad de San José address each stage of the intervention proposal defined by the Comisión, in accordance with economic and technical feasibility, proceeding from downstream to upstream throughout the watershed and relying on the designs developed and proposed in the study by the company DECH and on the specific recommendations and observations made by the institutions comprising the Comisión, according to their respective roles and fields of action and subject to the permits issued by the Dirección de Agua of MINAE.
To date, and according to the field inspection conducted by Ing. Danny Olivares Rivera, which resulted in report DA-UHTPCOSJ-0432-2020, dated 24 de febrero de 2020, the works authorized for the Municipalidad de San José have made considerable progress. In accordance with the foregoing, it is requested that the application for amparo (recurso de amparo) filed against the Dirección de Agua del Ministerio de Ambiente y Energía be dismissed, since that agency has been involved from the outset in seeking comprehensive solutions for the residents of Barrio Luján, el Cerrito, and Ciudadela Calderón Muñoz. The municipal agreements or commitments undertaken by the Municipalidad de San José to address specifically the problems of the petitioners from Barrio Francisco Peralta are unknown. It requests that the application be dismissed.
Justice Garro Vargas drafted the opinion; and,
Whereas:
I.Subject matter of the action. The petitioners allege that on 24 de julio de 2019, residents of Distrito Catedral and Zapote asked Engineer Herra, of the Red Pluvial de la Municipalidad de San José, to remove the garbage accumulated at the bridge over the río Ocloro on calle 29; however, they have not yet received a response. They request that the environmental damage caused by the accumulation of garbage obstructing the riverbed of the río Ocloro, the water pollution, and the failure of the San José municipal government to clean that tributary be remedied. They request that the respondent municipal council carry out the monitoring, maintenance, and cleaning that the crew allegedly hired for those purposes is required to perform regularly but has not performed again, creating a risk of possible damage when significant rainfall occurs.
II.Proven facts. The following facts are deemed duly established and relevant to the decision in this matter, either because they have been proven or because the respondents failed to address them as required by the initial order:
IV.Merits. By judgment No. 2016-007570, issued at 09:05 hrs. on 03 de junio de 2016, this Chamber granted writ of amparo No. 16-5730-0007-CO based on the following considerations and resulting disposition.
“ …V.- The specific case. A review of the record shows that on 11 de noviembre de 2015, the petitioner filed 2 complaints concerning the collapse of the sewerage system (sistema de alcantarillado) and the overflow of sewage and garbage in her community, which, according to her statement, caused serious damage to her property on 27 de octubre de 2015 and occurred again on 11 de noviembre de 2015. She requested that measures be taken to prevent such events from recurring, that she be informed of the intended response, and that she be compensated for the resulting damage. It must first be explained to the protected party that this Jurisdiction is not empowered to determine whether the Administration should be held civilly liable for the alleged damage and required to compensate her. Therefore, any disagreement with the respondent’s rejection of her claim in that regard is a dispute that must be brought through ordinary legal proceedings, should the petitioner deem it appropriate. As to the alleged failure to address the aforementioned health and environmental problem and her request concerning it, the Court proceeds to rule on the merits.
Indeed, the petitioner alleges that, despite the serious consequences of the October 2015 overflow of the Ocloro River, the measures required to prevent a similar situation from occurring have not been taken. In this regard, the respondent Municipality emphatically stated, under oath, that the severe flooding on October 27, 2015, resulted from an extraordinary rainfall event during which the Ocloro and María Aguilar Rivers, as well as the Pavas and Rivera streams, reached their maximum levels and, in those places where they did not overflow, rose above the levels of the stormwater system’s discharge points, preventing the water from flowing through those pipes until after the downpour had passed; this was not caused by the condition of the sewer system. They also stated that the Stormwater Network Construction and Maintenance Section worked jointly with the Municipal Disaster Risk Management Office and the Comisión Nacional de Emergencias to develop an Ocloro River Basin Response Program; and they indicate that they are about to invite bids for a study of the Ocloro micro-watershed, in order to scientifically determine the hydraulic condition of that river and propose infrastructure works to mitigate flooding.
Nevertheless, regarding this last matter, although 7 months have elapsed since the flooding that occurred on October 27, 2015, the respondent Municipality does not currently even mention an established schedule for verifying the actual condition of the Ocloro River’s containment in the event of a natural occurrence such as the one that already took place. Such verification is essential according to the Governing Health Area, which concluded as follows in report CS-URS-471-2016 dated May 25, 2016:
“4.1. Regarding the verification requested by the Constitutional Chamber as to whether the homes in the area are at risk of flooding due to blockage by refuse, the answer is that, during periods of heavy precipitation, the river can also be expected to carry all types of solid waste found throughout its watershed; this, in turn, increases the risk of blockages, primarily in the sections where the river is piped underground. In other words, the piped sections are the most vulnerable to blockages because of the spatial limitations of their cross-sections, which is not the case in the sections where the river has an open channel. Based on the foregoing, there is a reasonable probability that flooding will occur at the site due to blockages in the piped sections. Regarding the next question, concerning whether flooding may occur because of deficiencies in the sewer system or the improper disposal of water and channeling of the Ocloro River, a reliable answer depends on the hydrological and hydraulic studies available to the competent body, in this case the Municipality.
Based on the results of these studies and engineering calculations, it is possible to determine whether the flooding is attributable to reduced areas in the existing drainage cross-sections and/or to defects in the design of the stormwater system; the entire course of the watershed must therefore be reviewed. 4.2. Regarding the Minister’s request to determine and conclude whether the area identified in the complaint filed by Ana Lorena Collado Ulloa poses a danger to the public health of the residents of that area, the answer is that the river is contaminated with wastewater and, when this water enters the homes as a result of the river overflowing, it will create unsanitary conditions. Consequently, every time flooding occurs, there will be a real danger to the health of local residents. Regarding the recommendations requested by the Minister, this Governing Health Authority advises requesting from the Municipality the respective technical studies, plans, and schedules for the works it has promised the community in order to resolve the flooding problems at issue.” As the respondent authority reported under oath, what occurred was an unforeseen extraordinary event.
However, in the matter under review (sub examine), as a result of what happened, the administration has known, at least from October 2015 to the present, what may occur if precipitation comparable to that experienced at that time happens again and, consequently, it is required to take all necessary measures in a timely and responsible manner to mitigate the effects and disasters now known to be capable of recurring—which was a matter of public knowledge and news coverage. The inspection conducted by the Ministerio de Salud also determined the following:
“3.4. Between the bridge and the western section of the parking lot of the Dos Pinos branch in Bo. Luján [calle 23], the river channel could be observed to be partially obstructed by organic waste and possibly sediment … Notwithstanding this condition, should an overflow occur at this point, it is the undersigned’s opinion that the event would not affect Ciudadela Calderón Muñoz, because the two locations are separated by a distance of approximately 600 m and, moreover, given the prevailing topography at the site, the overflow could be expected to return to the river channel without traveling more than 100 m. 3.5. At an approximate distance of 400 m downstream from the reference point identified in the preceding section is the CEDESSO building, and it is precisely at this location that a piped section of the river begins, ending approximately 25 m west of the Multifamiliares de la Ciudadela Calderón Muñoz, which borders the eastern section of Lomas de Ocloro.
The CEDESSO building is specifically located northeast of the Clínica Carlos Durán and is the section of the Ocloro River’s open channel nearest to Ciudadela Calderón Muñoz, at an approximate distance of 100 m … A perimeter fence was constructed above the crown of the conduit through which the river flows and along the property boundaries of the CEDESSO building. Evidence could be seen there of organic waste material transported by the river that became trapped in the perimeter fence of the building in question, reaching heights between 1.0 and 1.5 m above the crown of the conduit... This evidence is the result of an extraordinary flood event that, whether or not it was associated with a blockage in the piping, shows that events of this kind, compounded by the proximity and favorable topographic conditions, may cause flooding in Ciudadela Calderón Muñoz, where the complainant resides. 3.6.
Based on the visual field inspection conducted today in the area depicted in photograph #1, it was determined that the river also carries wastewater, mostly of a domestic nature.” Accordingly, this Court finds that the petitioner is correct in stating that there is sufficient evidence that the flooding she has experienced may recur because the required measures have not been addressed in a timely manner, at least to lessen its effects. It is not enough to state that a micro-watershed study is being planned when the bidding process, scheduling, and implementation have not even been finalized. Moreover, the respondent Ministry also warned of other obstruction problems involving the perimeter fence of the Cendesso Building that may worsen during heavier precipitation and that must be addressed continuously and promptly by the respondent Municipality. Consequently, the application for constitutional relief (amparo) must be granted with respect to this issue...”

The application is granted. Johnny Araya Monge, in his capacity as Municipal Mayor of San José, or whoever holds that office, is ordered, within the non-extendable period of 6 months from notification of this judgment, to conduct the studies required to scientifically verify the hydraulic condition of the Ocloro River and, within the 6 months following that period, to implement the infrastructure works required to prevent flooding in the Ciudadela Calderón Muñoz area. The respondent is also ordered to immediately adopt all necessary and feasible measures that will help mitigate any flooding that may occur at that location while the studies and works in question are being carried out…”
V.Reference is made to the foregoing background because the information provided by the Director of Water at MINAE confirms that the actions listed by the respondent authorities of the Municipalidad de San José, which exceed an investment of one billion colones, are intended to comply with what this Chamber ordered in that judgment and not to address the specific situation reported by the petitioners in the present matter, namely, the existence of garbage accumulated in the channel (cauce) of the Río Ocloro where it passes beneath the bridge located on Calle 29. In this regard, that municipal council reports, among other matters, that with respect to the waste thrown by residents into the Río Ocloro, both the Sección de Limpieza Urbana and the Red Pluvial continuously collect such waste. Likewise, after each rainfall event, the accumulation points of waste carried by runoff (escorrentía) and deposited at bridge entrances and in pipes along the channel are cleaned.
Based on the foregoing, it is assumed that they deny responsibility for the events, since they state that the pollution caused by solid waste and sewage results from irresponsible conduct by residents in violation of environmental legislation, aggravated by the encroachment upon the protection areas (áreas de protección) and the river channel by the property owners themselves. It is thus established that they refer generally to addressing the garbage problem in the aforementioned tributary as it passes through the Canton of San José, but they do not identify any specific action in the sector reported by the petitioners, who have submitted evidence showing that the problem currently exists. Therefore, the allegations made by the authorities of that municipality are deemed insufficient, since, faced with a situation involving this possible level of pollution, they have not conclusively demonstrated that the situation has been addressed and duly resolved, or at least that it has been dealt with periodically and effectively.
Furthermore, the communication sent by the petitioner on 24 de julio de 2019 to the email address [email protected], which is acknowledged to be an official means of communication, cannot serve as a distraction. Although it is understandable that no response was provided because the communication did not request one, it is evident that the residents wanted effective intervention, since they were reporting a problem, and the municipality therefore should have acted more diligently. The Chamber observes that there has been inaction, since there is no evidence that the residents’ complaint was addressed, as the reported situation has persisted. This became even more evident because, in response to the request made by this Chamber in its ruling of 10:11 hrs. on 05 de junio de 2020, as evidence to aid adjudication (prueba para mejor resolver), the Mayor of San José submitted an institutional email dated 11 de junio de 2010 from Engineer Jenaro Campos and Engineer Vanessa Acosta of the Departamento de Servicios Ambientales, reporting the following: “Regarding the cleaning of the channel at this particular bridge, the Programa Aula Ambiental has not performed any cleaning in the channel or protection area.
It should also be noted that, at this bridge, the northern bank belongs to the Canton of Montes de Oca and the southern bank to the Canton of San José. Accordingly, waste removal in the protection area would have to be carried out on the southern bank, while cleaning work in the channel would have to be performed jointly with, or at least in coordination with, the Gobierno Local de Montes de Oca, since the river at that point forms the boundary between the cantons…”. In other words, that report confirms the inaction of the respondent municipal council in fulfilling its duty to clean the Río Ocloro channel in the aforementioned sector, the sole issue adjudicated in this amparo proceeding (recurso de amparo), unlike the matter addressed in the amparo proceeding cited as precedent, where action was taken regarding the river’s flow, which was causing flooding. The record (autos) also shows that no coordination has taken place with the Municipalidad de Montes de Oca to clean that channel, although it is now reported that such coordination is required.
In this context, the fundamental rights of the petitioners and the neighboring community are deemed to have been disregarded, since the danger and pollution that could result from waste accumulated in a river channel, to the detriment of human health and physical integrity and of the environment, are beyond dispute. Therefore, from a constitutional perspective, in the case at hand (sub lite), the Chamber concludes that the actions taken by the Municipalidad de San José, within the scope of its authority, in exercising its supervisory or oversight powers to protect health and the environment have been clearly insufficient. The Political Constitution implicitly recognizes the fundamental right of those subject to the administration (administrados) to the proper and efficient operation of public services, meaning that such services must be provided according to high quality standards. The necessary corollary of that right is the obligation of public administrations to provide them continuously, regularly, promptly, effectively, and efficiently, particularly when addressing possible pollution whose effects have not even been determined.
In such cases, Article 50 of the Political Constitution expressly recognizes the right of all present and future inhabitants of this country to enjoy a healthy and ecologically balanced environment. Compliance with this requirement is a fundamental guarantee for protecting the life and public health of community members.
VI.Conclusion. In view of the foregoing, the petition is deemed well-founded, although only against the Municipalidad de San José, since the record shows that the other respondent authorities bear no responsibility for the matters complained of by the petitioners. Moreover, the petition is granted with the effects stated in the operative provisions (parte dispositiva), since addressing the pollution reported by the petitioner residents is urgent.
1. The historical context that originally prompted the Chamber’s broad involvement in environmental matters has changed considerably, requiring this body to reconsider the conditions for its participation in safeguarding the right of individuals to a healthy and ecologically balanced environment, as protected by Article 50 of the Political Constitution. Indeed, the current situation—characterized by an extraordinarily extensive body of statutory and regulatory provisions that includes substantive rules, procedures, and the creation of bodies charged with enforcing the Fundamental Charter—is radically different from the previous situation, in which the absence of legislation and of government bodies with appropriate authority compelled the Chamber to assume an almost exclusive leading role in defending the aforementioned constitutional right.
2. Today, we face a “dense framework” of environmental legislation, which has produced two significant phenomena. The first and most obvious is the emergence of comprehensive legal regulation governing activities whose environmental impact had previously been subject to little or no regulation, as well as the creation of government bodies with powers to oversee and control the effects of human activity on the environment. The second phenomenon is that this growing juridification (juridificación)—predominantly through statutes and regulations—necessarily brings both administrative justice and the ordinary courts onto the scene, primarily the administrative-litigation courts, but also the criminal courts. In those forums, consistent with the importance of environmental law, broad procedural avenues and inclusive standing requirements (medios de legitimación) have been established so that those subject to the administration may enforce the provisions of the extensive legal framework relating to environmental matters.
3. In this context, it is inappropriate, both legally and functionally, for the Constitutional Chamber to displace or—worse still—replace the ordinary judicial bodies in carrying out their task, which is also constitutional in nature, of ensuring effective compliance with statutes and regulations. It is legally inappropriate because, in the vast majority of these cases, the Chamber is asked to interpret and enforce statutory and regulatory provisions, thereby risking an overlap between its jurisdiction and that of other judicial bodies that were specifically created to perform such tasks. It is also functionally inappropriate because the design of its proceedings is ill-suited to the complexity present in numerous environmental disputes, which consist of technically and legally complex series of facts and acts. With regard to both issues, there are well-known examples in which the Chamber has issued a partial or technically incomplete ruling, or in which unnecessary friction and harm to legal certainty have arisen.
4. Among the technical considerations I have assessed, I would add the fact that this jurisdiction does not have judges responsible for enforcing judgments (jueces ejecutores de sentencia) who could provide proper follow-up to such judgments—which are generally complex—and which sometimes involve monitoring remedial plans, among other measures, requiring interinstitutional coordination and oversight lasting months or even years.
5. From this perspective, this Court’s decision to step aside in environmental matters should not be viewed as abandoning environmental protection but, on the contrary, as ensuring its proper protection in the forum best suited to the nature of its complexity and diversity. Nor should it be viewed as this jurisdiction declining to perform the task of protecting constitutional rights imposed upon it by the Political Constitution and its Organic Law, a task that, in my view, remains reserved in this area for specific cases. Rather, this is an exercise in reallocating the burdens and duties assigned to the various government bodies so that each may fully perform its work within its assigned sphere, as well as an exercise of the power to define its own jurisdiction, as provided by Article 7 of its Organic Law.
6. It is clear that the Chamber does not contemplate leaving the task of protecting individual rights in environmental matters to other jurisdictions. It is well known that, although any claim concerning the violation of statutory and regulatory provisions may be brought within the constitutional sphere, there are cases whose resolution requires nothing more than the application of constitutional law. The aim, therefore, is for the Chamber to become one of several leading actors, so that—collectively, and each within its own sphere—they can address the full range of situations involved in protecting the right to a healthy and balanced environment within a society in which other equally pressing needs also exist. I firmly believe that, under this position, citizens do not lose the slightest degree of protection, while substantial gains are made in breadth, perspective, and respect for the balance and distribution of powers, the latter being a principle that must be taken into consideration because it governs the constitutional dynamics of any liberal and democratic system such as ours.- 7.
Consistent with the foregoing, I maintain that this Chamber should refrain from hearing claims brought before it for alleged violations of Article 50 of the Political Constitution, leaving their consideration to administrative justice and the administrative-law jurisdiction (jurisdicción contenciosa administrativa). The foregoing is stated as a general rule, without prejudice to recognizing the existence of particular cases or categories of cases that, in my opinion, would still be better protected by this Chamber and should therefore be heard and decided by it.- Among such categories of cases—and without this enumeration being considered a closed and definitive list—I would note that the Chamber should retain jurisdiction over situations such as claims involving environmental violations that also directly endanger individuals’ health or access to or quality of water; and cases involving gross and direct violations of the environment in which there is a manifest lack of protection by state authorities, provided further that the nature of the claim allows it to be addressed through the writ of amparo (amparo) as a special summary procedural remedy, since I also believe that amparo proceedings should not be converted into ordinary proceedings to address, even in the aforementioned cases, matters exceeding their capacity to be adequately resolved through that remedy.
8. In this particular case, according to the proven facts, the appellant’s claim could potentially affect the health and physical integrity of persons living in Barrio Francisco Peralta and the surrounding areas, given the possible flooding that may occur due to garbage accumulated in the channel of the Río Ocloro where it passes beneath the bridge located on calle 29. Consequently, it is clear that this case falls within the exceptions mentioned, and for that reason I considered it necessary for the Chamber to exercise its jurisdiction in order to determine whether the alleged omissions violate the fundamental rights of the protected persons.
In environmental matters, it is also the undersigned’s view that, where the Public Administration has already intervened, jurisdiction to hear and decide the matter lies with the administrative-law jurisdiction. Nevertheless, I do consider the merits of a case when other rights of the persons affected by the source of pollution are at stake, including health, quality of life, and the right to enjoy a healthy and pollution-free environment (Article 50 of the Political Constitution), as occurs in this case, in which the appellant alleges that since julio de 2019 they have requested that the Municipalidad de San José remove the garbage accumulated at the bridge over the río Ocloro on calle 29, because waste has accumulated in the river channel, thereby violating the right to enjoy a healthy and ecologically balanced environment and a decent standard of quality of life.
The parties are advised that, if they submitted any paper document, as well as objects or evidence stored on any additional electronic, computing, magnetic, optical, or telematic device or produced using new technologies, these must be collected from the court office within a maximum period of 30 business days from notification of this judgment. Otherwise, any material not collected within that period will be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Full Court at session No. 27-11 of 22 de agosto del 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 de enero del 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial at session No. 43-12 held on 3 de mayo del 2012, Article LXXXI.
Por tanto:
The appeal is granted solely against the Municipalidad de San José. Johnny Araya Monge, in his capacity as Alcalde de San José, or whoever holds that office, is ordered to comply with the following: 1) Immediately upon notification of this judgment, he shall coordinate the corresponding actions so that whatever is legally appropriate and falls within his authority is carried out, in order that, within two months from notification of this judgment, the pollution problem caused by the presence of waste in the channel of the río Ocloro where it passes beneath the bridge located on calle 29 is remedied. 2) He shall arrange for the implementation of periodic monitoring, maintenance, and cleaning of that area. The respondent authority is warned that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, any person who receives an order issued in amparo proceedings that he or she must comply with or enforce, and who fails to comply with or enforce it, shall be sentenced to imprisonment for three months to two years or to a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty.
The Municipalidad de San José is ordered to pay the costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed during enforcement of the judgment before the administrative-law jurisdiction. As to the other respondent authorities, the appeal is denied. Justice Hernández López submits a note. Justice Salazar Alvarado submits a note. Let notice be given.

Recurso de amparo interpuesto por [Nombre 001], adulta mayor, soltera, cédula de identidad No. [Valor 001], vecina de Barrio Francisco Peralta y [Nombre 002] , mayor, casado, presidente de la organización amparada, cédula de identidad No. [Valor 002], a favor de la Asociación de Vecinos de Barrio Francisco Peralta y alrededores, cédula jurídica No. 3-002-788740, contra el Alcalde, el Jefe de la Sección de Construcción y Mantenimiento de la Red Pluvial y la ingeniera Adriana Herra, todos de la Municipalidad de San José, el Ministro, el Director de Aguas y la Jefa de la Asesoría Jurídica de la Secretaría Ejecutiva del Sistema Nacional de Áreas de Conservación, todos del Ministerio de Ambiente y Energía.
Resultando:
Redacta la Magistrada Garro Vargas; y,
Considerando:
I.Objeto del recurso. Los recurrentes alegan que el 24 de julio de 2019 los vecinos del Distrito Catedral y Zapote solicitaron a la Ingeniera Herra, de la Red Pluvial de la Municipalidad de San José, realizar limpieza de la basura acumulada en el puente del río Ocloro, en calle 29, sin embargo, todavía no obtienen respuesta. Piden solucionar el daño ambiental que existe por el represamiento de basura en el cauce del río Ocloro, contaminación del agua y la omisión de parte del ayuntamiento josefino en la limpieza de ese afluente. Requieren que el cabildo accionado ejecute el monitoreo, mantenimiento y limpieza que la supuesta cuadrilla contratada para esos fines debe hacer regularmente y que no lo ha vuelto a realizar, con el riesgo de posibles daños cuando se presenten precipitaciones significativas.
II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque los recurridos hayan omitido referirse a ellos según lo prevenido en el auto inicial:
a)Esta Sala, mediante sentencia No. 2016-007570, de las 09:05 hrs. del 03 de junio de 2016, por mayoría declaró con lugar el recurso de amparo No. 16-5730-0007-CO, y ordenó “…a Johnny Araya Monge, en su condición de Alcalde Municipal de San José, o a quien ocupe el cargo, que proceda en el plazo improrrogable de 6 meses contado a partir de la notificación de esta sentencia, a realizar los estudios que se requieran para verificar científicamente la condición hidráulica del río Ocloro, y en los 6 meses siguientes a dicho plazo, implementar las obras de infraestructura que se requieran para evitar las inundaciones en el sector Ciudadela Calderón Muñoz. Asimismo, se ordena al recurrido adoptar de inmediato todas las medidas necesarias y posibles que coadyuven a mitigar las inundaciones que puedan producirse en dicho lugar, mientras se realizan los estudios y las obras en cuestión…” (hecho no controvertido).
b)El SINAC, en coordinación con la Municipalidad de San José, la Comisión Nacional de Emergencia y la Dirección de Aguas se encuentra trabajando en el proyecto “Obras de mitigación a lo largo del río Ocloro, en el sector Barrio Luján y Residencial Calderón Muñoz”, mediante el cual se pretende ampliar y profundizar el cauce del río Ocloro, para mitigar las inundaciones y acumulación de basura, según lo ordenado por este Tribunal en la sentencia No. 2016-007570 de las 09:05 hrs. del 03 de junio de 2016 (informe del Director de Agua del MINAE y prueba documental aportada).
c)El 24 de julio de 2019, la recurrente, del Comité de Vecinos de río Ocloro, remitió a la dirección electrónica [email protected], una gestión que indica lo siguiente: “Por este medio quiero comunicar que se ha ido acumulando una cantidad significativa de basura en el puente de la calle 29, (río Ocloro), en Barrio Francisco Peralta. Este queda de la Casa Italia 3 cuadras al sur. La basura está del lado este del puente. En cuenta hay ramas de árboles. Me temo que se pueda hacer un represamiento que afecte luego Barrio Luján. Incluyo fotos. Muchas gracias por su atención” (documento aportado por los recurrentes).
d)Debido a que el documento que remitió la recurrente vía correo electrónico dirigido a la ingeniera Herra es un acto de comunicación hacia la Administración, se procedió a tomar nota y se hizo la inspección y limpieza respectiva (informe de las autoridades municipales recurridas rendido el 12 de febrero de 2020).
e)Con respecto a los desechos que lanzan los vecinos al cauce del río Ocloro, tanto la Sección de Limpieza Urbana, como la Red Pluvial, realizan permanentemente labores de recolección de estos desechos. Asimismo, luego de cada evento de lluvia se procede a limpiar los puntos de concentración de desechos acarreados por la escorrentía y depositados en entradas de puentes y tuberías a lo largo del cauce (informe de las autoridades municipales recurridas).
f)La margen norte del puente que se ubica en calle 29, sobre el cauce del río Ocloro, pertenece al cantón de Montes de Oca y la margen sur al cantón de San José, por lo que las limpiezas de residuos en el área de protección se tendrían que hacer por la Municipalidad de San José en la margen sur y los trabajos de limpieza en cauce, en conjunto o mínimo en coordinación con el Gobierno Local de Montes de Oca, ya que el río en ese punto es limite divisorio cantonal (informe del alcalde recurrido y prueba documental aportada).
III.Hechos no probados. Se consideran indemostrados los siguientes hechos de relevancia para la resolución de este proceso constitucional.
2)Que la Municipalidad de San José, en el trascurso del año 2020, haya efectuado labores de limpieza del cauce del río Ocloro, en su paso por el puente que se ubica en calle 29.
3)Que la Municipalidad de San José haya coordinado con el gobierno local de Montes de Oca la limpieza del cauce del río Ocloro, en su paso por el puente que se ubica en calle 29.
IV.Sobre el fondo. Esta Sala, mediante sentencia No. 2016-007570, de las 09:05 hrs. del 03 de junio de 2016, declaró con lugar el recurso de amparo No. 16-5730-0007-CO, con base en las siguientes consideraciones y el subsecuente resultado.
“ …V.- Sobre el caso concreto. Del estudio de los autos, se tiene que el pasado 11 de noviembre de 2015, la recurrente planteó 2 reclamos en relación con el colapso del sistema de alcantarillado y desbordamiento de aguas negras y basura en su comunidad, que según indicó, le produjo graves daños en su propiedad el 27 de octubre de 2015, y que se repitió el 11 de noviembre de 2015; pidió que se tomaran medidas para evitar lo sucedido a futuro, que se le informara de lo que se pretendía realizar al respecto, y que se le indemnizara por los daños producidos. Debe indicarse de previo a la amparada, que no le corresponde a esta Jurisdicción determinar si la administración debe ser tenida como responsable civil de los daños atribuidos e indemnizar a la amparada, por lo que la eventual disconformidad con el rechazo de su reclamo en tal sentido por parte de la recurrida, es una discusión que corresponde ser planteada en la vía de legalidad, si así lo tiene a bien la recurrente. En cuanto a la acusada falta de atención al problema de salud y ambiental referido, y de su gestión en este sentido, se procede a resolver por el fondo.
En efecto, la recurrente acusa que a pesar de las graves secuelas de lo ocurrido en octubre de 2015 por el desbordamiento del río Ocloro, no se han tomado las medidas requeridas para evitar que ocurra una situación similar. Al respecto, la Municipalidad recurrida fue enfática en señalar, bajo fe de juramento, que las graves inundaciones producidas el 27 de octubre de 2015, fueron producto de un evento extraordinario de lluvia, en el que los ríos Ocloro y María Aguilar, así como las quebradas Pavas y Rivera, alcanzaron su máximo nivel y en aquellos lugares donde no se desbordaron, superaron los niveles de los puntos de descarga del sistema pluvial, lo que provocó que el agua no fluyera por dichas tuberías, sino pasado el aguacero; lo cual no fue producto de la condición del alcantarillado. Asimismo, señalaron que la Sección Construcción y Mantenimiento de la Red Pluvial trabajó en conjunto con la Oficina de Gestión Municipal de Riesgo a Desastres y la Comisión Nacional de Emergencias para formular un programa de Atención de la Cuenca del río Ocloro; e indican estar prontos a licitar un estudio de la microcuenca del Ocloro, con el fin de determinar científicamente la condición hidráulica de ese río y proponer obras de infraestructura que mitigaran las inundaciones.
No obstante, sobre este último aspecto, a pesar de que han transcurrido 7 meses desde la inundación ocurrida el 27 de octubre de 2015, la Municipalidad recurrida ni siquiera hace alusión actualmente a un cronograma ya establecido para verificar la situación real de la contención del río Ocloro ante un eventual hecho natural como el que ya se produjo, lo cual es primordial según con lo señalado por el Área Rectora de Salud, quien en el informe CS-URS-471-2016 del 25 de mayo de 2016 concluyó:
“4.1. Con relación a la verificación que solicita la Sala Constitucional en cuanto a si las viviendas del sector corren algún peligro de inundación por obstrucción de basuras. La respuesta es que durante la ocurrencia de precipitaciones intensas, es de esperar que el río también arrastre todo tipo de residuos sólidos que se encuentre a lo largo de su cuenca: lo cual a su vez, incrementa el riesgo de que se presenten obstrucciones principalmente en los sectores en que el río se encuentra entubado; es decir, los sectores entubados son los más vulnerables a obstrucciones en razón de las limitaciones de espacio en sus secciones, lo cual no ocurre con los sectores del río con cauce abierto: con base en lo dicho, existe una razonable probabilidad de ocurrencia de inundaciones en el sitio por obstrucciones en los sectores entubados. Con relación a la siguiente consulta de que ocurran inundaciones por deficiencias en el alcantarillado o mala disposición de las aguas y canalización del río Ocloro; una respuesta certera a esta consulta está en función de estudios hidrológicos e hidráulicos con que cuente el órgano competente, en este caso la Municipalidad.
A partir de los resultados de estos estudios y memorias de cálculo es posible definir si la ocurrencia de las inundaciones obedece a la existencia de áreas reducidas en las secciones de evacuación existente y/o a defectos en el diseño del sistema pluvial, por lo que es necesario revisar todo el trayecto de la cuenca. 4.2. En cuanto a la solicitud de la señora Ministra en el sentido de llegar a determinar y concluir si el área denunciada por la señora Ana Lorena Collado Ulloa, representa un peligro para la salud pública de los habitantes de ese sector. La respuesta es que el río se encuentra contaminado con aguas residuales y al llegar estas aguas al interior de las viviendas producto de un desbordamiento del río se va a generar una condición insalubre, por lo que cada vez que ocurra una inundación va a existir un peligro real para la salud de los residentes del lugar. Con relación a las recomendaciones que solicita la señora Ministra.
Esta Rectoría aconseja solicitarle a la Municipalidad los respectivos estudios técnicos, planes y cronogramas de actividades de obras que le han prometido a la comunidad para resolver los problemas de inundaciones que nos ocupan.” Según informó bajo juramento la autoridad recurrida, lo ocurrido fue un evento extraordinario no previsto. Sin embargo, en el sub examine, a partir de lo sucedido, al menos de octubre de 2015 a la fecha, la administración sabe lo que puede llegar a ocurrir de volver a tener precipitaciones como las de entonces, y en consecuencia, está obligada a tomar oportuna y responsablemente todas las medidas necesarias, a fin mitigar los efectos y desastres que ya se conoce pueden llegar a ocurrir de nuevo –lo cual fue un hecho público y noticioso-. En la inspección realizada por el Ministerio de Salud, también se determinó lo siguiente:
“3.4. -Entre el puente y el sector Oeste del estacionamiento de la sucursal de la Dos Pinos en Bo. Luján [calle 23] se pudo observar el cauce del río parcialmente obstruido con desechos orgánicos y posiblemente con sedimentos …No obstante esta condición y en el caso de que ocurra un desbordamiento en este punto, es criterio del suscrito que el evento no afectaría a la Ciudadela Calderón Muñoz, en razón de que entre ambos sitios existe una distancia de separación de unos 600 m y por otro lado, por la topografía imperante en el sitio, es de esperar que el desbordamiento regrese al cauce del río sin recorrer más de 100 m. 3.5. -A una distancia aproximada de unos 400 m aguas abajo respecto al punto de referencia indicado en la sección anterior, se encuentra el edificio CEDESSO y justamente en este sitio se inicia un tramo entubado del río que termina a unos 25 m al Oeste de los Multifamiliares de la Ciudadela Calderón Muñoz, la cual colinda con el sector Este de Lomas de Ocloro.
El edificio CEDESSO se ubica específicamente al Noreste de la Clínica Carlos Durán y es el sector del cauce abierto del río Ocloro más cercano a la Ciudadela Calderón Muñoz, encontrándose a una distancia aproximada de 100 m…Sobre la corona del ducto por donde fluye el río y en los linderos de la propiedad del edificio CEDESSO se construyó una malla perimetral en la cual se pudo apreciar la evidencia de material de desecho orgánico transportado por el río que quedó atrapado en la malla perimetral del edificio en cuestión, alcanzando alturas entre 1.0 y 1.5 m sobre la corona del ducto... Dicha evidencia es el resultado de la ocurrencia de una avenida extraordinaria que probablemente asociada o no con alguna obstrucción del entubamiento es posible que este tipo de eventos coadyuvados por la cercanía y condiciones topográficas favorables lleguen a causar inundaciones a la Ciudadela Calderón Muñoz, sitio de residencia de la denunciante. 3.6.-Fundamentado en la inspección visual de campo realizada en este día en la zona descrita en la fotografía #1 se pudo determinar que el río también transporta aguas residuales del tipo doméstico en su mayor parte.” Así las cosas, considera este Tribunal que lleva razón la recurrente en señalar, que existen suficientes indicios de que puedan volver a ocurrir las inundaciones de las que ha sido objeto, por no atenderse de forma oportuna lo requerido, para al menos aminorar sus efectos.
No basta con indicar que se está programando realizar un estudio de la microcuenca, si ni siquiera se ha concretado su licitación, programación y ejecución. Por otro lado, el Ministerio recurrido también advirtió otros problemas de obstaculización en la malla perimetral del Edificio Cendesso que pueden agravarse ante precipitaciones mayores, y que deben ser atendidos constante y oportunamente por la Municipalidad recurrida. Por consiguiente, el amparo debe ser declarado con lugar en cuanto a este extremo se refiere...”
Por tanto:
Se declara con lugar el recurso. Se ordena a Johnny Araya Monge, en su condición de Alcalde Municipal de San José, o a quien ocupe el cargo, que proceda en el plazo improrrogable de 6 meses contado a partir de la notificación de esta sentencia, a realizar los estudios que se requieran para verificar científicamente la condición hidráulica del río Ocloro, y en los 6 meses siguientes a dicho plazo, implementar las obras de infraestructura que se requieran para evitar las inundaciones en el sector Ciudadela Calderón Muñoz. Asimismo, se ordena al recurrido adoptar de inmediato todas las medidas necesarias y posibles que coadyuven a mitigar las inundaciones que puedan producirse en dicho lugar, mientras se realizan los estudios y las obras en cuestión…”
V.Se hace referencia al anterior antecedente debido a que se corrobora de lo informado por el Director de Agua del MINAE, que las acciones que enumeran las autoridades recurridas de la Municipalidad de San José, que superan una inversión de mil millones de colones, es para cumplir lo ordenado por esta Sala en esa sentencia y no para atender la situación focalizada que denuncian los recurrentes en el presente asunto, a saber: la existencia de basura acumulada en el cauce del río Ocloro, en su paso por el puente que se ubica en calle 29. Sobre ello, se tiene que de parte de ese cabildo se informa, entre otros extremos, que con respecto a los desechos que lanzan los vecinos al cauce del río Ocloro, tanto la Sección de Limpieza Urbana, como la Red Pluvial, realizan permanentemente labores de recolección de esos residuos. Asimismo, luego de cada evento de lluvia se procede a limpiar los puntos de concentración de desechos acarreados por la escorrentía y depositados en entradas de puentes y tuberías a lo largo del cauce.
Por lo anterior se asume que niegan responsabilidad en los hechos, pues indican que la contaminación con desechos sólidos y aguas negras reside en un acto irresponsable de los vecinos contraviniendo la legislación ambiental, agravado por la invasión a las áreas de protección y cauce del río provocado por los mismos propietarios. Se constata así que se refieren a una generalidad en la atención a la problemática de la basura en el afluente citado en su paso por el cantón josefino, pero no refieren una atención concreta, en el sector que denuncian los recurrentes, quienes aportan prueba que denota la existencia de la problemática en la actualidad. Por ello, se estima insuficiente lo alegado por las autoridades de ese ayuntamiento, pues ante una situación de ese posible nivel de contaminación no han demostrado fehacientemente la atención a la situación y que esta ha sido debidamente resuelta, o por lo menos, que se ha atendido en forma periódica y eficaz.
Por otro lado, no puede ser un elemento distractor lo relativo a la gestión remitida el 24 de julio de 2019 por la recurrente a la dirección electrónica [email protected] y que se acepta es un medio oficial de comunicación, pues debido a que en tal escrito no se demanda una respuesta, es entendible que ésta no se brindara, pero es evidente que los vecinos querían una intervención eficaz, pues estaban dando noticia de un problema, por lo que el ayuntamiento debió haber actuado en forma más diligente. La Sala observa que ha existido una inercia, pues no consta que se haya brindado atención a lo reclamado por los munícipes, pues la situación denunciada ha permanecido. Esto ha quedado más patente porque en atención a lo requerido por esta Sala mediante resolución de las 10:11 hrs. del 05 de junio de 2020, como prueba mejor resolver, el Alcalde de San José aporta un correo institucional del 11 de junio de 2010, de parte del Ingeniero Jenaro Campos y la Ingeniera Vanessa Acosta, del Departamento de Servicios Ambientales, donde informan lo siguiente: "En cuanto a lo referente a la limpieza de cauce en éste puente en particular, no se ha realizado ninguna limpieza en cauce o área de protección por parte del Programa Aula Ambiental, cabe resaltar también que en dicho puente la margen norte pertenece al cantón de Montes de Oca, y la margen sur al cantón de San José, así las cosas, las limpiezas de residuos en área de protección se tendrían que hacer en la margen sur, y los trabajos de limpieza en cauce, en conjunto o mínimo en coordinación con el Gobierno Local de Montes de Oca, ya que el rio en ese punto es limite divisorio cantonal…”.
Es decir, por lo dicho en ese informe se confirma la inacción del cabildo accionado en su deber de la limpieza del cauce del río Ocloro, en el sector referido, único punto dirimido en este amparo, a diferencia de lo atendido en el recurso de amparo citado como precedente, donde sí se atendió la afluencia del río, que provocaba inundaciones. Se desprende de los autos que tampoco se ha coordinado con la Municipalidad de Montes de Oca la limpieza de ese cauce, como ahora se informa que se requiere. En ese contexto, se estima que se han inobservado los derechos fundamentales de los recurrentes y la comunidad vecina, pues es incuestionable el peligro y la contaminación que podría provocar la existencia de residuos acumulados en el cauce de un río, en demérito de la salud y la integridad física de las personas, y del medio ambiente. Por ello, desde la perspectiva constitucional, en el sub lite la Sala concluye que las acciones en ejercicio de la potestad de control o vigilancia desplegadas en tutela de la salud y del ambiente por parte de la Municipalidad de San José, dentro del marco de sus competencias, han sido claramente insuficientes.
La Constitución Política recoge, tácitamente, el derecho fundamental de los administrados al buen y eficiente funcionamiento de los servicios públicos, esto es, que sean prestados con elevados estándares de calidad, el cual tiene como correlato necesario la obligación de las administraciones públicas de prestarlos de forma continua, regular, célere, eficaz y eficiente, máxime si se trata de la atención a una posible contaminación con efectos que ni siquiera han sido determinados. En esos supuestos, el artículo 50 de la Constitución Política reconoce expresamente el derecho de todos los habitantes presentes y futuros de este país, de disfrutar de un medio ambiente saludable y en equilibrio. El cumplimiento de este requisito es fundamental garantía para la protección de la vida y la salud pública de los miembros de la comunidad.
VI.Conclusión. En virtud de lo expuesto, se considera procedente el recurso, aunque sólo contra la Municipalidad de San José, pues se denota de los autos que, en lo reclamado por los recurrentes, no han tenido responsabilidad las demás autoridades recurridas. Además, la estimatoria es con los efectos que indican en la parte dispositiva, pues se hace perentoria la atención de la contaminación denunciada por los munícipes recurrentes.
1. El contexto histórico que motivó en su momento la amplia intervención de la Sala en materia ambiental, ha tenido una considerable variación que impone a este órgano reconsiderar las condiciones para su participación en el aseguramiento del derecho de las personas a un ambiente sano y equilibrado, tal y como ha sido tutelado en el artículo 50 de la Constitución Política. En efecto, la situación actual –caracterizada por una amplísima producción legal y reglamentaria que incluye reglas de fondo, procedimientos y creación de órganos para el cumplimiento de lo ordenado en la Carta Fundamental- es radicalmente diferente de la anterior, en la cual la ausencia de normativa y de instancias estatales con competencia apropiada, le impuso a la Sala un papel de protagonista, casi único, en la defensa del precitado derecho constitucional.
2. Hoy en día, nos encontramos frente a un “ denso entramado” de normativa ambiental, lo cual ha producido dos fenómenos relevantes: el primero y más obvio, es el surgimiento de una abarcadora regulación jurídica respecto de actividades cuya incidencia en el ambiente estaba poco o nada ordenada, así la creación de órganos estatales con potestades de vigilancia y control sobre los efectos de la actividad humana en el entorno. El segundo fenómeno consiste en que esa creciente juridificación –predominantemente legislativa y reglamentaria– trae aparejada una ineludible entrada en escena tanto de la justicia administrativa como de la jurisdicción ordinaria -prioritariamente la contencioso administrativa, pero también la penal. En ellas, acorde con la importancia del derecho ambiental, se han regulado de forma amplia vías procesales y medios de legitimación incluyentes, de manera que los administrados puedan hacer valer lo establecido en ese amplio orden jurídico que se relaciona con el tema ambiental.
3. En ese contexto, no resulta apropiado jurídicamente, ni desde el punto de vista funcional, que la Sala Constitucional desplace, o -peor aún- sustituya, a los órganos de justicia ordinarios en la realización de su tarea, también de rango constitucional, de velar por el efectivo cumplimiento de leyes y reglamentos. Es impropio jurídicamente porque en la inmensa mayoría de estos casos lo que se solicita es que interprete y haga valer normas legales y reglamentarias con lo que arriesga traslapar sus competencias con las de otros órganos jurisdiccionales que –ellos sí- han sido creados para ejecutar tales tareas; y resulta también funcionalmente incorrecto, porque el diseño de sus procesos se aviene mal con la complejidad que está presente en numerosos conflictos ambientales que se componen de series de hechos y actos técnica y jurídicamente complejos. Sobre ambas cuestiones existen conocidos ejemplos en los que la Sala ha arrojado una resolución a medias o técnicamente incompleta, o bien se han generado fricciones innecesarias y afectación de la seguridad jurídica.
4. Como parte de los aspectos técnicos que he valorado, añado que está el hecho de que esta jurisdicción no cuenta con jueces ejecutores de sentencia que permitan darle seguimiento adecuado a las mismas -generalmente complejas-, que implican en ocasiones el seguimiento de planes remediales, entre otros, con coordinación interinstitucional y seguimiento de meses y hasta años.
5. Desde esa perspectiva, la decisión de dar un paso al lado en la materia ambiental por parte de este Tribunal no debe ser vista como un abandono de la materia ambiental, sino al contrario, de su adecuada tutela en la instancia que mejor se aviene a la naturaleza de su complejidad y diversidad. Asimismo tampoco debe ser visto como la declinación de esta instancia en su tarea de protección de los derechos constitucionales que le imponen la Constitución Política y su Ley Orgánica, que desde mi punto de vista, queda reservada en esta materia para casos específicos. Se trata más bien, de un ejercicio de reacomodo de las cargas y tareas que corresponden a los distintos órganos estatales, de manera que cada uno de ellos, pueda desplegar plenamente su labor dentro del ámbito que se le ha asignado, así como del ejercicio de fijar su propia competencia, según lo establece el artículo 7 de su Ley Orgánica.
6. Queda claro que la Sala no se plantea abandonar a otras jurisdicciones la labor de protección de los derechos de las personas en materia ambiental. Es conocido que, si bien todo reclamo por infracción de normas legales y reglamentarias puede ser reconducido hasta el ámbito constitucional, existen casos cuya resolución no exige más que la aplicación del derecho de la Constitución. Se trata entonces de lograr que la Sala se convierta en protagonista junto con otros, de manera que –entre todos y cada uno en su espacio- se pueda cubrir toda la variedad de situaciones que presenta una protección del derecho a un medio ambiente sano y equilibrado dentro de una sociedad en la que también existen otras necesidades igual de acuciantes. Con esta posición creo firmemente que el ciudadano no pierde un ápice de protección, pero se gana sustancialmente en amplitud, en perspectiva y en respeto al equilibrio y distribución de poderes, principio este último de obligada consideración, puesto que rige la dinámica constitucional de cualquier sistema liberal y democrático como el nuestro. - 7.
En línea con lo anterior, sostengo que esta Sala debe abstenerse de conocer los reclamos que se le presenten por supuesta infracción al artículo 50 de la Constitución Política para dejar en manos de la justicia administrativa y la jurisdicción contenciosa administrativa su conocimiento. Lo anterior se deja afirmado con carácter general, sin perjuicio de reconocer la existencia de casos particulares o grupos de casos que, según mi criterio, si resultarían aún mejor tutelados por esta Sala y por tanto deben ser conocidos y resueltos por ella.- Dentro de tales grupos de casos, y sin que esta enunciación pueda considerarse como una lista cerrada y definitiva, puedo señalar que la Sala debe reservarse el conocimiento de situaciones como por ejemplo los reclamos por infracciones ambientales que además pongan en riesgo directo la salud de las personas, o el acceso o calidad del agua; los casos de violaciones groseras y directas al ambiente y en los cuales se constate una palmaria ausencia de la protección por parte de las autoridades estatales, siempre y cuando además la naturaleza del reclamo permita ser abordado mediante el instrumento del amparo como instituto procesal sumario y especial, ya que estimo que tampoco se debe “ordinariar” el amparo para abordar, aún en estos casos citados, temas que rebasen la capacidad de ser atendidos adecuadamente en el mismo.
8. En el caso concreto, de conformidad con los hechos probados, el reclamo de la parte recurrente, podría eventualmente incidir en la salud e integridad física de las personas que habitan en el Barrio Francisco Peralta y alrededores, ante las posibles inundaciones que puedan presentarse por la existencia de basura acumulada en el cauce del Río Ocloro, en su paso por el puente que se ubica en calle 29. En consecuencia, es claro que estamos ante las excepciones que mencionan y por esa razón he considerado necesario que la Sala ejerciera su competencia, para comprobar o descartar si las omisiones señaladas, vulneran los derechos fundamentales de las personas amparadas.
En asuntos ambientales, es también criterio del suscrito, de que, si ya ha habido intervención de la Administración Pública, considero que su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que la parte recurrente acusa que desde julio de 2019 solicitaron a la Municipalidad de San José realizar una limpieza de la basura acumulada en el puente del río Ocloro, en calle 29, pues existe una acumulación de desechos en el cauce del río, con violación del derecho a disfrutar de un ambiente sano y ecológicamente equilibrado y de un nivel digno de calidad de vida.
Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial" , aprobado por la Corte Plena en sesión No. 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión No. 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara con lugar el recurso únicamente, contra la Municipalidad de San José. Se ordena a Johnny Araya Monge, en su condición de Alcalde de San José, o a quien ocupe el cargo, cumplir con lo siguiente: 1) De forma inmediata a la notificación de la presente sentencia proceda a coordinar las acciones respectivas, con el fin de que se realice lo que en derecho y según su competencia corresponda, para que dentro del plazo de dos meses, contados a partir de la notificación de esta sentencia, se solvente el problema de contaminación generado por la existencia de residuos en el cauce del río Ocloro, en su paso por el puente que se ubica en calle 29. 2) Disponer la implementación del monitoreo, mantenimiento y limpieza periódica de ese sector. Se advierte a la autoridad recurrida, que de conformidad con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.
Se condena a la Municipalidad de San José al pago de las costas, daños y perjuicios ocasionados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. Respecto a las demás autoridades recurridas, se declara sin lugar el recurso. La Magistrada Hernández López pone nota. El Magistrado Salazar Alvarado pone nota. Notifíquese.
