A writ of amparo (recurso de amparo) is being processed under case number 20-006642-0007-CO, filed by [Nombre 001], identity card number [Valor 001], against the MUNICIPALIDAD DE SAN JOSÉ AND THE MINISTERIO DE AMBIENTE Y ENERGÍA.
WHEREAS:
“…
THIRD: Article 50 of Ley Orgánica del Ambiente Nº 7554 establishes that ‘…water is in the public domain, and its conservation and sustainable use are matters of social interest.’ Likewise, pursuant to Articles 17 and 177 of Ley de Aguas Nº 276 and Article 41 of Decreto Ejecutivo Nº 35669-MINAET, Reglamento Orgánico del Ministerio de Ambiente y Energía, MINAE, through the Dirección de Agua, is responsible for issuing determinations and rulings concerning the ownership, beneficial use, utilization, governance, or oversight of waters in the public domain. In accordance with the preceding recital (considerando) of this report, the Dirección de Agua was asked to issue an opinion on the matter and submit the relevant report. In that regard, and insofar as relevant, in report number AL-0250-2020 dated 26 de Mayo de 2020, signed by Ms. Gabriela Paez Vargas in her capacity as Coordinadora Legal, that Directorate stated: ‘…In this regard, we must note that on 1 de abril of this year, this Directorate received an email from the appellant (recurrente), stating: “I, the undersigned, report the filling work being carried out on the adjoining property, clearly identified on the map I am attaching, located in Zapote, according to the directions and as may currently be observed by satellite.
This work encompasses the river protection area, 10 meters, and, when the coming rains occur, will very likely cause emergency situations for those of us whose properties adjoin that property. Notice is hereby given that if you do not immediately order the suspension of the work and removal of the material already deposited, complaints will be filed against you before the Ministerio Público for breach of official duties; you must immediately coordinate with the corresponding institutions to dispatch inspectors, issue notices, and take all other necessary measures.” Two important matters must be noted in this case: first, as of the date the appellant’s email was received, all field inspections by the Dirección de Agua had been suspended by order of the Ministerio de Salud; second, the email describes filling work being carried out within the river protection area, which, under Ley Forestal, falls within the jurisdiction of the Sistema Nacional de Áreas de Conservación.
Accordingly, by official letter DA-UHTPCOSJ-0890-2020 dated 6 de abril del 2020, notice of which was provided by email on 6 de abril of this year to both the appellant and Ms. Aimará Espinoza, Coordinadora de la Oficina Subregional San José del Área de Conservación Central, of SINAC, the appellant’s complaint was forwarded to the latter so that it could be addressed. Furthermore, the appellant submits Technical Report IAR-INF-1109-2018, which was issued at his request so that the Comisión Nacional de Emergencia could conduct an on-site assessment. That entity recommended: “Carry out comprehensive channeling work, tree cutting, sediment and garbage collection, and mitigation works (obras de mitigación) pursuant to a comprehensive work plan, in order to prevent greater future harm to communities bordering these rivers, all in accordance with current legislation and under the supervision of qualified professionals.
Analyze, at the interinstitutional and intermunicipal levels, the problem of informal settlements located along the banks of these rivers, for the purpose of identifying alternatives for relocating the families living in these highly vulnerable locations to suitable and safer land. Coordinate with each municipality (tres Ríos, Curridabat and San José) regarding comprehensive work for the río María Aguilar, incorporating into its Operational Plan prevention and mitigation measures for the purpose of conducting annual cleanup operations at the most vulnerable locations, responding to local emergencies during the rainy season, and carrying out mitigation works in many sections of the river channels. Establish periodic monitoring of river behavior, particularly in the designated work areas, so that improvements may be incorporated into the process.” It is important to note that this amparo action (recurso) was filed essentially because the Municipalidad de San José has not implemented the recommendations of the Comisión Nacional de Emergencia.
This is a local problem involving contamination of the channel or río María Aguilar by sediment (household garbage) and organic matter in the center of the channel, as well as erosion of the banks, particularly the left bank, and it must be addressed by the Municipality itself. We must note that, to date, the Dirección de Agua has received no application from the Municipalidad de San José for a permit to perform works within the channel (obra en cauce) of the río María Aguilar, whether for cleaning, rearrangement, dredging, or reinforcement of the banks, as is occurring in Barrio Luján, as the appellant correctly states….” FOURTH: The legal nature of the Sistema Nacional de Áreas de Conservación (hereinafter SINAC) is that of a decentralized agency with instrumental legal personality (órgano desconcentrado con personalidad jurídica instrumental) attached to MINAE, pursuant to Article 22 of Ley de Biodiversidad Nº7788.
Its fundamental purpose is to integrate authority over forestry matters, wildlife, protected areas, and MINAE, in order to establish policies and plan and implement processes aimed at achieving sustainability in the management of our country’s natural resources. In accordance with the preceding recital, the recommendation of the Dirección de Agua, and the maximum degree of administrative decentralization in the relevant field and technical specialty vested in SINAC, the undersigned respectfully—and because the ruling in which the Chamber requested the report does not refer to SINAC—requested the relevant report from that entity. Once submitted by SINAC, it will be added to the corresponding case file as soon as possible. III. Conclusions. Based on the foregoing, it follows that this Ministry, through the competent unit—namely, the Dirección de Agua—has acted in accordance with the law, as shown by the report and evidence submitted.
Although this matter is directly connected to the Municipalidad de San José, which must take specific actions to resolve the problem, this Ministry has nevertheless intervened to seek the solutions required for this particular situation….” .
“…
We are dealing with a local problem involving contamination of channels by sediment (household garbage) and organic matter in the center of the channel, as well as erosion of the banks, particularly the left bank, and it must be addressed by the Municipality itself, as provided in Article 1 of Código Municipal, which expressly states: ‘The municipality consists of the residents of the same canton, who promote and administer their own interests through the municipal government.’ We must also note that, to date, the Dirección de Agua has received no application from the Municipalidad de San José for a permit to perform works within the channel of the río María Aguilar, whether for cleaning, rearrangement, dredging, or reinforcement of the banks, as is occurring in Barrio Luján, as the appellant correctly states….”
Magistrada Hernández López drafted the opinion; and,
Whereas:
The appellant alleges that his fundamental rights have been violated. He states that since 2016, the río María Aguilar has eroded his property as a result of accumulations of garbage, sediment, and other materials obstructing the river’s normal channel. He alleges that since 2016, he has made numerous submissions to the Municipalidad de San José, accompanied by documentation from the Comisión Nacional de Emergencias (CNE), recommending and proposing the removal of the accumulation from the river channel, dredging of the channel, and construction of a structure to minimize the erosion process. Nevertheless, the Municipalidad de San José refused to carry out the works and implement the recommendations. He requests that this Chamber order the respondent authorities to proceed with dredging, restoration of the property, and construction of a retaining wall on the eastern side of his property to stop the erosion, thereby providing a permanent rather than temporary solution.
The following facts are deemed duly established and relevant to the resolution of this matter:
The protected party (amparado), [Nombre 001], is a resident of San Francisco de Dos Ríos, San José. His property has been eroded by the río María Aguilar as a result of accumulations of garbage, sediment, and other materials obstructing the river’s normal channel. (Undisputed Fact) On 16 de febrero de 2016, through official letter No. IAR-INF-0084-2016, the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, at the protected party’s request, provided a technical assessment of the area’s degree of vulnerability and a series of recommendations to prevent greater harm. It recommended: “Carry out comprehensive channeling work, tree cutting, sediment and garbage collection, and mitigation works pursuant to a comprehensive work plan, in order to prevent greater future harm to communities bordering these rivers, all in accordance with current legislation and under the supervision of qualified professionals.
Analyze, at the interinstitutional and intermunicipal levels, the problem of informal settlements located along the banks of these rivers, for the purpose of identifying alternatives for relocating the families living in these highly vulnerable locations to suitable and safer land. Coordinate with each municipality (tres Ríos, Curridabat and San José) regarding comprehensive work for the río María Aguilar, incorporating into its Operational Plan prevention and mitigation measures for the purpose of conducting annual cleanup operations at the most vulnerable locations, responding to local emergencies during the rainy season, and carrying out mitigation works in many sections of the river channels. Establish periodic monitoring of river behavior, particularly in the designated work areas, so that improvements may be incorporated into the process.” (See reports submitted under oath and evidence provided by the appellant) In October 2019, the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias prepared a new technical report, CNE-UIAR-INF-0923-2019, at the request of the protected party (amparado).
The report states that, if no protective works are undertaken at the site, erosion could cause the property’s perimeter fence to collapse and, in the future, affect the remainder of the property. It recommends assessing the possibility of erecting some type of structure to protect the left bank of the river and prevent further erosion. (See evidence submitted by the petitioner) By means of Official Letter No. ALCALDÍA-A2-00506-2020, the Municipalidad de San José informed the protected party: “…In response to your request that machinery and trained personnel be sent to dredge the river, I am forwarding the opinion issued by geographer Lorena Romero Vargas, Head of the Oficina Municipal de Gestión de Riesgo, and Eng. Marco Vinicio Corrales Xatruch, Manager of Provisión de Servicios, in which they address your request…” That letter further stated: “…In compliance with the legal framework currently in force, the Municipalidad de San José does not undertake mitigation measures within the watercourse (cauce), except in emergency situations where authorized by CNE or pursuant to an order of the Sala Cuarta….” (See documentation submitted by the petitioner) On 1° de abril de 2020, the protected party filed a complaint with the Ministerio de Ambiente y Energía concerning the problem posed by the fill being deposited on the adjoining property and its potential impact on the protected area (zona de protección) of the río María Aguilar in the Zapote area.
(See report submitted under oath and documentation provided) The problem of contamination of the watercourse, or río María Aguilar, by sediment (household waste) and organic matter in the center of the watercourse, as well as erosion of the banks, particularly the left bank, must be addressed by the respondent Municipality. (See reports submitted under oath) On 22 de mayo de 2020, the Ministro de ambiente y Energía was notified of the decision issued at 09:47 horas del 20 de mayo de 2020, whereby the parties to this amparo proceeding (recurso de amparo) were expanded and he was afforded a hearing. (See certificate of service in the Sistema Electrónico de Gestión) As of the date on which the amparo proceeding was filed, the Dirección de Agua of the Ministerio de Ambiente y Energía had not received any application from the Municipalidad de San José for a permit to perform works within the watercourse in order to carry out work within the río María Aguilar watercourse, whether for cleaning, rearrangement, excavation, or reinforcement of the banks—as stated by the petitioner. (See report submitted under oath)
Article 50 of the Constitution establishes that a fundamental purpose and essential value of the Costa Rican State is to seek “the greatest well-being of all inhabitants of the country.” Accordingly, a “healthy and ecologically balanced environment” forms part of the substance of the greatest well-being of all inhabitants and constitutes the cause, purpose, condition, and limit of the exercise of public powers and authority, not only by the State but also by the Municipalities. As with the right to property, the object to which the right to the environment pertains is external to the integrity of the human person (unlike, for example, the right to life); however, unlike the object of the right to property, the person forms part of and is integrated into the environment. Its protection therefore entails preserving the essential context for human life. Conduct that adversely affects it poses a danger to human existence itself and diminishes or deprives everyone of the “greatest well-being.” Life depends on the environment; therefore, care must be taken to ensure that the conditions guaranteeing life are maintained over time. In Judgment N° 601-2009, this Chamber held as follows:
“The origins of environmental problems are complex and arise from an interplay of natural and social processes within the framework of the country’s chosen model of socioeconomic development. For example, environmental problems occur when methods of exploiting natural resources cause degradation of ecosystems beyond their regenerative capacity, resulting in harm to broad sectors of the population and generating high environmental and social costs that lead to a deterioration in quality of life; indeed, the primary purpose of using and protecting the environment is to achieve development and evolution favorable to human beings (..) It is important to understand that, although human beings have the right to use the environment for their own development, they also have a duty to protect and preserve it for present and future generations. This is not particularly novel, because it is merely the application to this field of the principle of ‘harm’ (lesión), already established in ordinary law, under which the lawful exercise of a right is subject to two essential limits: on the one hand, the equal rights of others and, on the other, the rational exercise and beneficial enjoyment of the right itself.” Accordingly, public entities, including the Municipalities, are responsible for safeguarding respect for a healthy and ecologically balanced environment within their respective territorial jurisdictions, as well as the well-being of all inhabitants of their respective cantons.
Within the framework of their constitutional and statutory powers, they must act to ensure that this right is respected for all residents of the municipality and must act—again within the framework of their powers—to mitigate or correct actions that tend to violate it.
Municipal jurisdiction and the duty of interinstitutional coordination. Article 169 of the Constitución Política provides that “The administration of local interests and services in each canton shall be entrusted to the Municipal Government (...).” This provision has been developed by the ordinary legislature. Accordingly, Article 3 of the Código Municipal, Ley N° 7794 de 30 de abril de 1998, provides: “The governance and administration of cantonal interests and services shall be entrusted to the municipal government.” The Sala Constitucional has expressed the same view in its case law. For example, in Judgment N° 5445-99, issued at 14:30 horas del 14 de julio de 1999, it held as follows:
“VI.- THE POWERS OF MUNICIPALITIES ACCORDING TO SUBJECT MATTER (THE CONCEPT OF ‘LOCAL MATTERS’). By express constitutional provision—Article 169—functions or powers concerning ‘local matters’ are assigned to local governments, that is, ‘the administration of the services and interests’ of the locality within their jurisdiction, for which purpose they are granted autonomy (”). Their powers are therefore general, since there is no detailed enumeration of their specific functions, but merely a statement of the scope of their jurisdiction; this does not, however, mean that such jurisdiction cannot be determined, as this Court explained in Judgment number 6469-97, issued at sixteen hours and twenty minutes on ocho de octubre de mil novecientos noventa y siete, in the following terms:
“(...) local matters have such significance that any definition of their scope by the legislature or the courts must preserve the integrity of local interests and services. Thus, not even the legislature could enact legislation intended to dismember the Municipality (the territorial element) without observing the procedures previously established in the Constitución Política; nor could it enact legislation placing its inhabitants (the population) at a clear disadvantage relative to the rest of the country; or legislation affecting the very essence of local matters (government), thereby turning the Corporation into a mere empty shell that retains only its name while dismantling the entire system as conceived by the Asamblea Nacional Constituyente. Stated differently, certain functions are, by their nature, municipal—or local—and cannot be removed from that sphere of jurisdiction and converted into national services or interests, because doing so would dismantle the Municipality or, more precisely, deprive it of its constitutional substance. It is therefore impossible to define in advance the inviolable boundaries of local matters; instead, what does or does not fall within the authority of the community government must be determined by examining each specific case (...).” The foregoing highlights the fact that, by the express will of our Fundamental Charter, specific jurisdiction is assigned to local governments and that this authority is also exclusive to them; in other words, it is an original power of the municipality and may be displaced, in whole or in part, only through nationalization or regionalization legislation.”
Consequently, if a group of municipal residents within the Municipality’s territorial jurisdiction suffers flooding that endangers their lives and causes serious property damage, psychological harm, and harm to their quality of life and general well-being, this falls within the concept of “local interests and services” under constitutional Article 169. The causes of such problems must be identified precisely and, even more importantly, so must the solutions, in order to implement them as soon as possible. For this purpose, the Municipality is responsible for coordinating with national-level institutions having jurisdiction to address the problem. Indeed, the Chamber has already developed the municipal duty to coordinate with other state institutions in order to address local “interests” and duly provide “local services.” In the aforementioned Judgment N° 5445-99, the Chamber stated:
“(...) refer to the duty of coordination that must exist among local governments, decentralized institutions, and the Poder Ejecutivo in carrying out the functions entrusted to them, which must be analyzed in light of the very nature of municipal autonomy (autonomía municipal). By virtue of the provisions of Article 170 of the Constitution, municipalities (local corporate entities) enjoy functional, administrative, and financial autonomy in administering local interests and services (Article 169 of the Constitución Política) (...) Therefore, no conflict may be created through antagonism or rivalry between matters encompassed by the general purpose of ‘local interests and services’ and ‘national’ or ‘state’ public interests and services, which are intrinsically distinct from one another but are, in fact, meant to coexist (....) Once the subject-matter jurisdiction (competencia material) of a municipality within a particular territorial district has been defined, it is clear that certain responsibilities, by their very nature, are exclusively municipal, alongside others that may be regarded as national or state responsibilities; it is therefore essential to define the form of joint exercise of powers that is inevitably required, since the public authority of municipalities is local, while that of the State and other entities is national. It follows that municipal territory is simultaneously subject to state and institutional authority, insofar as circumstances so require. In other words, municipalities may share their powers with the Public Administration in general, a relationship that must operate under the terms established by law (Article 5 of the former Código Municipal and Article 7 of the new Código), which imposes a duty of ‘coordination’ between municipalities and the public institutions involved in exercising their respective powers, in order to prevent duplication of efforts and contradictions, especially because only voluntary coordination is compatible with municipal autonomy, as an expression thereof. In other words, a municipality is called upon to enter into cooperative relationships with other public entities, and vice versa, given the concurrent or overlapping nature—in many cases—of their interests regarding a specific matter. In legal scholarship, coordination is defined on the basis of the existence of several independent centers of action, each with its own responsibilities and decision-making powers, which may at times diverge; nevertheless, there must be a commonality of objectives in the relevant subject matter arising from their concurrence, insofar as the object receiving the ultimate results of the activities and actions of each is shared.” Thus, coordination is the ordering of relationships among these various independent activities, taking into account their concurrence with respect to the same object or entity so as to make it useful to an overarching public plan, without eliminating the reciprocal independence of the actors involved. Because neither the decentralized institutions nor the State itself have a hierarchical relationship with municipalities, specific conduct cannot be imposed on the latter. This gives rise to the essential interinstitutional ‘concerted action,’ in the strict sense, whereby autonomous and independent centers of action agree upon that preventive and overarching framework, within which each fulfills a role with a view to a mission entrusted to the others.”
It should further be noted that, pursuant to the mandatory provisions of Article 50 of the Constitución Política, the Municipalidades are required to devote themselves to protecting the environment (Judgment N° 2006-7994 at 8:57 a.m. on June 2, 2006).
ACTIONS OF THE MUNICIPALIDAD DE SAN JOSÉ AND THE RECOMMENDATIONS ISSUED BY THE COMISIÓN NACIONAL DE EMERGENCIAS TO THE MUNICIPALIDAD DE SAN JOSÉ. In the case under review (sub examine), the petitioner (recurrente) alleges that, since 2016, his property has been eroded by the río María Aguilar as a result of accumulations of garbage, sediment, and other materials obstructing the river’s normal channel, and that, as of the date this amparo proceeding (recurso) was filed, the respondent authorities had not implemented the recommendations issued since 2016 by the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias (CNE)—IAR-INF-0084-2016, dated February 16, 2016. After analyzing the evidence submitted, this Court finds that the fundamental rights of the protected party (amparado) were violated, at least by the respondent municipal corporation. The report submitted by the representatives of the Municipalidad de San José—which is deemed to have been given under oath, subject to the consequences, including criminal penalties, established in Article 44 of the Law governing this Jurisdiction—and the evidence submitted for resolution of this matter duly establish that the protected party, [Nombre 001], is a resident of San Francisco de Dos Ríos, San José.
His property has been eroded by the río María Aguilar because of accumulations of garbage, sediment, and other materials obstructing its normal channel. It has also been established that, on February 16, 2016, at the protected party’s request, the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias issued a technical assessment of the area’s degree of vulnerability and a series of recommendations for preventing further damage. It recommended: “Comprehensively carry out channelization work, tree cutting, removal of sediment and garbage, and mitigation works (obras de mitigación) in accordance with a comprehensive work plan, for the purpose of preventing further harm in the future to communities located along these rivers, all in compliance with current legislation and under the supervision of qualified professionals. Analyze at the interinstitutional and intermunicipal levels the issue of informal settlements located along the banks of these rivers, for the purpose of identifying alternatives for relocating the families living in these highly vulnerable locations to suitable and safer land.
Coordinate with each municipality (tres Ríos, Curridabat and San José) along the río María Aguilar to carry out comprehensive work under its Operational Plan for prevention and mitigation measures, for the purpose of conducting annual cleanup operations in the most vulnerable locations, responding to local emergencies during the rainy season, and undertaking mitigation works along many sections of the channels. Establish periodic monitoring of the rivers’ behavior, especially in the designated work areas, so that improvements can be incorporated into the process.” In addition to the foregoing, in October 2019 the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias prepared a new technical report, CNE-UIAR-INF-0923-2019, at the protected party’s request, stating that, if no protective works were undertaken at the site, erosion could cause the property’s perimeter fence to collapse and could eventually affect the remainder of the property.
It recommended assessing the possibility of erecting some type of structure to protect the river’s left bank and prevent further erosion. Lastly, it was determined that the problem of contamination of the channel or río María Aguilar by sediment (household garbage) and organic matter in the center of the channel, as well as erosion of the banks, particularly the left bank, must be addressed by the municipality itself. For its part, through Official Letter No. ALCALDÍA-A2-00506-2020, the Municipalidad de San José informed the protected party: “...In response to your request that machinery and trained personnel be sent to dredge the river, I hereby forward the opinion provided by geographer Lorena Romero Vargas, Head of the Oficina Municipal de Gestión de Riesgo, and Engineer Marco Vinicio Corrales Xatruch, Manager of Provisión de Servicios, in which they address your request...” That official letter stated: “...In compliance with the current legal framework, the Municipalidad de San José does not undertake mitigation measures within the channel, except in emergency situations where CNE authorizes them or pursuant to an order from Sala Cuarta....” It should be noted that, although the respondent municipal authority reports that the Gerencia de Provisión y Servicios and the Sección de Construcción y Mantenimiento de la Red Pluvial of the Municipalidad de San José are working on all administrative, legal, and engineering aspects of the matter, it is equally true that the record shows that the problem continues and that, despite the recommendations issued by the Comisión Nacional de Emergencias since 2016—the latest technical report being No. CNE-UIAR-INF-0923-2019, from October 2019—the Municipalidad has still not definitively resolved the problem, even though it is aware of the extensively documented contamination of the river.
In this regard, this Constitutional Court was able to verify the existence of the problem reported by the claimant (accionante), which is known to the respondent municipality and directly affects the petitioner, and for which no solution had been provided as of the date this proceeding was filed, thereby confirming a violation of the protected party’s fundamental rights. In addition, this Constitutional Court has repeatedly recognized and upheld that the Comisión’s authority to conduct the corresponding inspections and issue recommendations to the respondent Municipalidad is binding (see, to that effect, Judgments No. 12818-2009 at 3:32 p.m. on August 18, 2009 and 16389-2010 at 9:17 a.m. on October 1, 2010). Nevertheless, despite the foregoing, no solution has yet been implemented, nor has any information been provided regarding interim or urgent measures intended to prevent or mitigate the effects of contamination caused by the Río María Aguilar.
This must be considered in light of the specific authority granted to local governments by Article 169 of the Constitución Política, which provides: “The administration of local interests and services in each canton shall be entrusted to the Municipal Government (...).” Accordingly, the alleged violation of the protected party’s fundamental rights is established, and the proper course is to grant the petition, subject to the order set forth in the operative portion (parte dispositiva) of this judgment.
THE ACTIONS OF THE MINISTERIO DE AMBIENTE Y ENERGÍA. From the report submitted by the representatives of the respondent authority—which is deemed to have been given under oath, with the consequences, including criminal consequences, provided for in Article 44 of the Law governing this Jurisdiction—and the evidence submitted for resolution of the matter, it has been duly established that on 1° de abril de 2020, before the Ministerio de Ambiente y Energía, the protected party (amparado) reported the issue of the fills (rellenos) being placed on the adjoining property and the possible impact on the protection zone (zona de protección) of the río María Aguilar in the Zapote area. It was also established that, as of the date on which the amparo action (recurso de amparo) was filed, the Dirección de Agua del Ministerio de Ambiente y Energía had received no application from the Municipalidad de San José for a permit to perform in-channel works (permiso de obra en cauce) involving work within the channel of the río María Aguilar, whether for cleaning, rearrangement, dredging, or reinforcement of the banks—as stated by the petitioner. Lastly, on 22 de mayo de 2020, the Ministro de Ambiente y Energía was notified of the ruling issued at 09:47 hours on 20 de mayo de 2020, whereby the parties to this action were expanded and he was granted a hearing.
Accordingly, as regards the actions of the Ministerio de Ambiente y Energía, the amparo action must be denied, because it was not until 1° de abril de 2020 that the petitioner filed with the respondent Ministry the complaint concerning the situation alleged and for which he sought protection of his rights on 03 de abril de 2020. In this regard, it was established that, as of the date this amparo action was filed, namely 03 de abril de 2020, the respondent authority was still within the time limit for deciding that petition and communicating its outcome to the protected party, pursuant to Article 261 of the Ley General de la Administración Pública, which provides—in general terms—a period of two months for such purposes (it should be noted that the complaint was filed on 1 de abril de 2020). Consequently, this action is premature. In view of the foregoing, the action must be denied with respect to this issue, as is hereby ordered.
In environmental matters, it is the undersigned’s view that, where the Public Administration (Administración Pública) has already intervened, jurisdiction to hear and decide the matter lies with the administrative litigation jurisdiction (jurisdicción contenciosa administrativa). Nevertheless, I do examine the merits when other rights of persons affected by the source of pollution are at stake, including health, quality of life, and the right to enjoy a healthy, pollution-free environment (Article 50 of the Constitución Política), as in this case, in which it is alleged that the respondent authority has failed to carry out the works required to clean and dredge the channel and minimize the erosion process affecting the río María Aguilar, thereby creating a danger to the physical integrity and lives of the petitioner and his family, a threat to the right to enjoy a healthy and ecologically balanced environment, and a decent standard of quality of life.
The parties are hereby advised that, if they submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, they must retrieve them from the court office within a maximum period of 30 business days from notification of this judgment. Otherwise, any material not retrieved within that period shall be destroyed, pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial", approved by the Corte Plena at session N° 27-11 of 22 de agosto del 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 de enero del 2012, as well as pursuant to the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 de mayo del 2012, Article LXXXI.
Por tanto:
The action is partially granted, solely with respect to the Municipalidad de San José and its failure to comply with the recommendations issued by the Comisión Nacional de Emergencias to resolve the existing problem arising from the pollution and overflow of the río María Aguilar and their consequences—see IAR-INF-0084-2016, of 16 de febrero de 2016, recommending: “Comprehensively carry out channelization work, tree cutting, removal of sediment and garbage, and mitigation works (obras de mitigación) in accordance with a comprehensive work plan, for the purpose of preventing greater future impacts on the communities adjacent to these rivers, all in accordance with current legislation and under the supervision of qualified professionals. Analyze, at the interinstitutional and intermunicipal levels, the issue of informal settlements located along the banks of these rivers, for the purpose of identifying alternatives for relocating the families living in these highly vulnerable locations to suitable and safer land.
Coordinate with each municipality (tres Ríos, Curridabat and San José), with respect to the río María Aguilar, to undertake comprehensive work under its Operational Plan for prevention and mitigation measures, for the purpose of carrying out an annual cleaning intervention at the most vulnerable locations, as well as responding to local emergencies during the rainy season and undertaking mitigation works in many sections of the channels. Establish periodic monitoring of the rivers’ behavior, especially in the designated work areas, so that improvements may be incorporated into the process.” Likewise, with respect to technical report CNE-UIAR-INF-0923-2019—assess the possibility of erecting some type of structure to protect the left bank of the river and prevent continued erosion—that assessment shall be performed and it shall be determined whether such a measure is appropriate. Jhonny Araya Monge, in his capacity as Mayor of the Municipalidad de San José, or whoever holds that office in his stead, is ordered, within the scope of his authority, to adopt the pertinent measures so that, within a maximum period of SIX MONTHS from notification of this ruling, the necessary interinstitutional coordination is carried out and a definitive solution is provided to the reported problem affecting the petitioner.
The foregoing is ordered with the warning that failure to comply may constitute the offense defined in Article 71 of the Ley de la Jurisdicción Constitucional, which provides that anyone who receives an order issued in an amparo action that he or she must comply with or enforce, and fails to comply with or enforce it, shall be punished by imprisonment for three months to two years, or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The Municipalidad de San José is ordered to pay the legal costs (costas), damages, and losses caused by the acts underlying this ruling, which shall be assessed during enforcement of the judgment before the administrative litigation jurisdiction. In all other respects, the action is denied. Justice Salazar Alvarado files a note. Let notice be given.

*200066420007CO* SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas quince minutos del doce de junio de dos mil veinte .
Recurso de amparo se tramita en expediente número 20-006642-0007-CO, por [Nombre 001] , cédula de identidad número [Valor 001] , en contra de la MUNICIPALIDAD DE SAN JOSÉ Y EL MINISTERIO DE AMBIENTE Y ENERGÍA.
RESULTANDO:
Redacta la Magistrada Hernández López; y,
Considerando:
El recurrente estima lesionados sus derechos fundamentales. Refiere que desde el año 2016, el río María Aguilar ha erosionado su propiedad, lo anterior, a raíz de acumulaciones de basura, sedimento y demás que obstaculizan el cauce normal del rio. Acusa que desde el año 2016, ha realizado numerosas gestiones a la Municipalidad de San José con documentación de la Comisión Nacional de Emergencias (CNE) donde recomiendan y sugieren eliminar la acumulación en el cauce del río, dragar el cauce y construir una obra que minimice el proceso erosivo. No obstante, la Municipalidad de San José se negó a llevar a cabo las obras y recomendaciones. Solicita que esta Sala, ordene a las autoridades recurridas, proceder con el dragado, restablecimiento de la propiedad y la construcción de un muro de contención en el lado este de su propiedad para detener la erosión, dando así una solución permanente y no temporal.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
El amparado [Nombre 001] es vecino de San Francisco de Dos Ríos, San José. Su propiedad se ha visto erosionada por el río María Aguilar a raíz de acumulaciones de la basura, sedimentos y demás que obstaculizan el cause normal del río. (Hecho no Controvertido) El 16 de febrero de 2016, mediante el oficio No. IAR-INF-0084-2016, la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, a solicitud del amparado, brindó un criterio técnico del grado de vulnerabilidad del área y una serie de recomendaciones para prevenir mayores afectaciones. Recomendando “Efectuar integralmente trabajos de canalización, corta de árboles, recolección de sedimentos y basura, obras de mitigación acorde con un plan integral de trabajo, con la finalidad de prevenir mayores afectaciones a futuro en las poblaciones aledaños a estos ríos, todo bajo la legislación actual y supervisado por profesionales calificados.
Analizar a nivel interinstitucional e intermunicipal la problemática de los asentamientos marginales, que se localizan en las márgenes de estos ríos, con el propósito de buscar alternativas de trasladar a las familias que habitan estos sitios altamente vulnerables a terrenos aptos y más seguros. Coordinar con cada municipio (tres Ríos, Curridabat y San José) para el río María Aguilar, un trabajo integralmente, en su Plan Operativo de medidas de prevención y mitigación, con la finalidad de realizar una intervención de limpieza anual en los sitios de mayor vulnerabilidad, así como, en caso de emergencia locales durante el período lluvioso, además, de obras de mitigación en muchas secciones de los cauces. Establecer un control periódico de vigilancia sobre el comportamiento de los ríos, especialmente en los sectores de trabajo definidos, que permita incorporar las mejoras del proceso.” (ver informes rendidos bajo fe de juramento y pruebas aportadas por el recurrente) En el mes de octubre de 2019 la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias elaboró un nuevo informe técnico CNE-UIAR-INF-0923-2019, a solicitud del amparado.
Se indica que, de no intervenir el sitio con alguna obra de protección, la erosión podría hacer colapsar la malla perimetral de la propiedad y en un futuro afectar el resto de esta. Recomiendan valorar la posibilidad de levantar una estructura de algún tipo para proteger el margen izquierdo del río para evitar que se siga dando la erosión. (ver prueba aportada por el recurrente) Mediante el Oficio No. ALCALDÍA-A2-00506-2020, la Municipalidad de San José, le indica al amparado “…En atención a gestión, la cual solicita se envié maquinaria con personal capacitado para el dragado del río, le remito criterio externado por la geógrafa Lorena Romero Vargas, Jefe Oficina Municipal de Gestión de Riesgo y el Ing. Marco Vinicio Corrales Xatruch, Gerente Provisión de Servicios, donde se refieren a su solitud…” indicando en dicho oficio “…La Municipalidad de San José en cumplimiento del marco jurídico vigente no realiza medidas de mitigación en cauce, únicamente ante situaciones de emergencia donde la CNE autorice o por orden de la Sala Cuarta…”.
(Ver documentación aportada por el recurrente) El 1° de abril de 2020, ante el Ministerio de Ambiente y Energía, el amparado, denunció la problemática de los rellenos que se están realizando en la propiedad colindante y la posible afectación a la zona de protección del río María Aguilar en la zona de Zapote. (Ver informe rendido bajo fe de juramento y documentación aportada) El problema por contaminación del cauce o rio María Aguilar por sedimentos (basura doméstica) y materia orgánica en el centro del cauce, así como erosión de las márgenes sobre todo la izquierda, debe ser atendido por el Municipio recurrido. (Ver informes rendidos bajo fe de juramento) El 22 de mayo de 2020, el Ministro de ambiente y Energía, fue notificado de la resolución de las 09:47 horas del 20 de mayo de 2020, mediante la cual, se tuvo por ampliadas las partes del este recurso y se le dio audiencia. (Ver acta de notificación en el Sistema Electrónico de Gestión) A la fecha de interposición del recurso de amparo, la Dirección de Agua del Ministerio de Ambiente y Energía, no ha recibido solicitud de permiso de obra en cauce por parte de la Municipalidad de San José, para llevar a cabo trabajos dentro del cauce del río María Aguilar, ya sea de limpieza, acomodo, recaba o reforzamiento de las márgenes -tal como señala el recurrente-. (Ver informe rendido bajo fe de juramento)
El artículo 50, Constitucional, establece como fin fundamental y valor esencial del Estado costarricense procurar "el mayor bienestar a todos los habitantes del país". De tal manera que, el "ambiente sano y ecológicamente equilibrado" forma parte del contenido del mayor bienestar de todos los habitantes, causa, fin y también condición y límite del ejercicio de las potestades y competencias públicas, no solo del Estado, sino también de las Municipalidades. Al igual que el derecho de propiedad, el objeto sobre el que recae el derecho al ambiente es externo a la integridad de la persona humana (a diferencia por ejemplo del derecho a la vida), pero también a diferencia con el objeto del derecho de propiedad, la persona forma parte del ambiente, lo integra, de allí que su protección, supone la conservación del contexto esencial para la vida humana, una conducta con efectos negativos sobre él, supone un peligro para la propia existencia humana y una reducción o pérdida del "mayor bienestar" de todos. La vida depende del ambiente, por tanto, debe velar para que esas condiciones que garantizan la vida se mantengan en el tiempo. En Sentencia N° 601-2009, esta Sala dispuso lo siguiente:
"Los orígenes de los problemas ambientales son complejos y corresponden a una articulación de procesos naturales y sociales en el marco del estilo de desarrollo socioeconómico que adopte el país. Por ejemplo, se producen problemas ambientales cuando las modalidades de ecosistemas superior a su capacidad de regeneración, lo que conduce a que amplios sectores de la población resulten perjudicados y se genere un alto costo ambiental y social que redunda en un deterioro de la calidad de vida; pues precisamente el objetivo primordial del uso y protección del ambiente es obtener un desarrollo y evolución favorable al ser humano (..) importante que ello es entender que si bien el hombre tiene el derecho de hacer uso del ambiente para su propio desarrollo, también tiene el deber de protegerlo y preservarlo para el uso de las generaciones presentes y futuras, lo cual no es tan novedoso, porque no es más que la traducción a esta materia, del principio de la "lesión", ya consolidado en el derecho común, en virtud del cual el legítimo ejercicio de un derecho tiene dos límites esenciales: Por un lado, los iguales derechos de los demás y, por el otro, el ejercicio racional y el disfrute útil del derecho mismo".
Así las cosas, corresponde a los entes públicos, entre ellos a las Municipalidades, velar por el respeto a un ambiente sano y ecológicamente equilibrado en su respectiva circunscripción territorial, así como por el bienestar de todos los habitantes de su respectivo cantón, y dentro del marco de las competencias constitucionales y legales actuar a favor de asegurar el respeto de este derecho a todos los munícipes, y actuar -nuevamente dentro del marco de sus competencias- para mitigar o corregir las actuaciones que tienden a su violación.
Competencia municipal y obligación de coordinación interinstitucional. El artículo 169, de la Constitución Política, dispone que "La administración de los intereses y servicios locales en cada cantón, estará a cargo del Gobierno Municipal (...)". Esta norma ha sido desarrollada por el legislador ordinario, en atención a ello, el artículo 3, del Código Municipal, Ley N° 7794 de 30 de abril de 1998, dispone que: "El gobierno y la administración de los intereses y servicios cantonales estarán a cargo del gobierno municipal". En este mismo sentido, se ha expresado la Sala Constitucional en su jurisprudencia. Verbigracia, en Sentencia N° 5445-99, de las 14:30 horas del 14 de julio de 1999, se dispuso lo siguiente:
"VI.- DE LAS ATRIBUCIONES DE LAS MUNICIPALIDADES EN RAZÓN DE LA MATERIA (CONCEPTO DE "LO LOCAL"). Por disposición constitucional expresa -artículo 169-, hay una asignación de funciones o atribuciones en favor de los gobiernos locales en razón de la materia a "lo local", sea, "la administración de los servicios e intereses" de la localidad a la que está circunscrita, para lo cual se la dota de autonomía (") De manera que sus potestades son genéricas, en tanto no hay una enumeración detallada de sus cometidos propios, sino una simple enunciación del ámbito de su competencia; pero no por ello no determinable, a lo que hizo referencia este Tribunal en sentencia número 6469-97, de las dieciséis horas veinte minutos del ocho de octubre de mil novecientos noventa y siete, en los siguientes términos:
" (...) lo local tiene tal connotación que definir sus alcances por el legislador o el juez, debe conducir al mantenimiento de la integridad de los intereses y servicios locales, de manera que ni siquiera podría el legislador dictar normativa que tienda a desmembrar el Municipio (elemento territorial), si no lo hace observando los procedimientos previamente establecidos en la Constitución Política; ni tampoco promulgar aquella que coloque a sus habitantes (población) en claras condiciones de inferioridad con relación al resto del país; ni la que afecte la esencia misma de lo local (gobierno), de manera que se convierta a la Corporación en un simple contenedor vacío del que subsista solo la nominación, pero desactivando todo el régimen tal y como fue concebido por la Asamblea Nacional Constituyente. En otro giro, habrá cometidos que por su naturaleza son municipales -locales- y no pueden ser substraídos de ese ámbito de competencia para convertirlos en servicios o intereses nacionales, porque hacerlo implicaría desarticular a la Municipalidad, o mejor aún, vaciarla de contenido constitucional, y por ello, no es posible de antemano dictar los límites infranqueables de lo local, sino que para desentrañar lo que corresponde o no al gobierno comunal, deberá extraerse del examen que se haga en cada caso concreto (...)". De lo anterior, resalta el hecho de que, por voluntad expresa de nuestra Carta Fundamental, se asigna una competencia específica a los gobiernos locales, atribución que además es exclusiva de éstos; es decir, se trata de una competencia originaria de la municipalidad y sólo mediante una ley de nacionalización o de regionalización es que puede ser desplazada, total o parcialmente".
En consecuencia, si un grupo de munícipes, en su circunscripción territorial, sufren inundaciones con riesgo para sus vidas y graves daños patrimoniales, psicológicos, calidad de vida y bienestar general, esto se enmarca dentro del concepto de "intereses y servicios locales" del numera 169, constitucional, problemas cuyas causas tienen que ser identificadas con precisión y, más aun, las soluciones, a fin de implementarlas a la mayor brevedad posible; para lo cual corresponde a la Municipalidad coordinar con las instituciones de nivel nacional con competencia para actuar sobre el problema. En efecto, la Sala ya ha desarrollado la obligación municipal de coordinar con otras instituciones estatales en aras de atender los "intereses" y prestar cumplidamente los "servicios locales". En la citada Sentencia N° 5445-99, la Sala manifestó:
"(...) se refieren a la obligación de coordinación que debe existir entre los gobiernos locales, las instituciones descentralizadas y el Poder Ejecutivo, para llevar a cabo las funciones que le han sido encomendadas, lo que debe ser analizado a partir de la naturaleza misma de la autonomía municipal. Es en virtud de lo dispuesto en el artículo 170 constitucional, que las municipalidades (entes corporativos locales) gozan de autonomía funcional, administrativa y financiera en la administración de los intereses y servicios locales (artículo 169 de la Constitución Política) (...) No puede, entonces, crearse un conflicto por antagonismo o protagonismo entre la materia que integra el fin general de "los intereses y servicios locales" de los intereses y servicios públicos "nacionales" o "estatales", intrínsecamente distintos unos de otros, pero que en realidad están llamados a coexistir (....) Definida la competencia material de la municipalidad en una circunscripción territorial determinada, queda claro que habrá cometidos que por su naturaleza son exclusivamente municipales, a la par de otros que pueden ser reputados nacionales o estatales; por ello es esencial definir la forma de cooparticipación de atribuciones que resulta inevitable, puesto que la capacidad pública de las municipalidades es local, y la del Estado y los demás entes, nacional; de donde resulta que el territorio municipal es simultáneamente estatal e institucional, en la medida en que lo exijan las circunstancias. Es decir, las municipalidades pueden compartir sus competencias con la Administración Pública en general, relación que debe desenvolverse en los términos como está definida en la ley (artículo 5 del Código Municipal anterior, artículo 7 del nuevo Código), que establece la obligación de "coordinación" entre la municipalidades y las instituciones públicas que concurran en el desempeño de sus competencias, para evitar duplicaciones de esfuerzos y contradicciones, sobre todo, porque sólo la coordinación voluntaria es compatible con la autonomía municipal por ser su expresión. En otros términos, la municipalidad está llamada a entrar en relaciones de cooperación con otros entes públicos, y viceversa, dado el carácter concurrente o coincidente -en muchos casos-, de intereses en torno a un asunto concreto. En la doctrina, la coordinación es definida a partir de la existencia de varios centros independientes de acción, cada uno con cometidos y poderes de decisión propios, y eventualmente discrepantes; pese a ello, debe existir una comunidad de fines por materia, pero por concurrencia, en cuanto sea común el objeto receptor de los resultados finales de la actividad y de los actos de cada uno". De manera que la coordinación es la ordenación de las relaciones entre estas diversas actividades independientes, que se hace cargo de esa concurrencia en un mismo objeto o entidad, para hacerla útil a un plan público global, sin suprimir la independencia recíproca de los sujetos agentes. Como no hay una relación de jerarquía de las instituciones descentralizadas, ni del Estado mismo en relación con las municipalidades, no es posible la imposición a éstas de determinadas conductas, con lo cual surge el imprescindible "concierto" interinstitucional, en sentido estricto, en cuanto los centros autónomos e independientes de acción se ponen de acuerdo sobre ese esquema preventivo y global, en el que cada uno cumple un papel con vista en una misión confiada a los otros".
Adviértase, por lo demás, que las Municipalidades están obligadas, por imperativo del ordinal 50, de la Constitución Política, a prodigarse en la protección del ambiente (Sentencia N° 2006-7994 de las 8:57 horas de 2 de junio de 2006).
ACTUACIÓN DE LA MUNICIPALIDAD DE SAN JOSÉ Y LAS RECOMENDACIONES GIRADAS POR LA COMISIÓN NACIONAL DE EMERGENCIAS A LA MUNICIPALIDAD DE SAN JOSÉ. En el sub examine, el recurrente acusa que desde el año 2016, su propiedad se ha visto erosionada por el río María Aguilar a raíz de acumulaciones de la basura, sedimentos y demás que obstaculizan el cauce normal del río, sin que, a la fecha de presentación de este recurso, las autoridades recurridas hayan ejecutado las recomendaciones que ha venido dando la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias (CNE), a partir del 2016 -IAR-INF-0084-2016, del 16 de febrero de 2016-. Ahora bien, después de analizar los elementos probatorios aportados, este Tribunal acredita la lesión a los derechos fundamentales del amparado, al menos, por parte de la corporación municipal recurrida. Del informe rendido por los representantes de la Municipalidad de San José -que se tiene dado bajo fe de juramento con las consecuencias, incluso penales, previstas en el artículo 44 de la Ley que rige esta Jurisdicción- y la prueba aportada para la resolución del asunto, ha sido debidamente acreditado que el amparado [Nombre 001] es vecino de San Francisco de Dos Ríos, San José.
Su propiedad se ha visto erosionada por el río María Aguilar a raíz de acumulaciones de la basura, sedimentos y demás que obstaculizan el cauce normal. Además, que en fecha 16 de febrero de 2016, la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, a solicitud del amparado, brindó un criterio técnico del grado de vulnerabilidad del área y una serie de recomendaciones para prevenir mayores afectaciones. Recomendando “Efectuar integralmente trabajos de canalización, corta de árboles, recolección de sedimentos y basura, obras de mitigación acorde con un plan integral de trabajo, con la finalidad de prevenir mayores afectaciones a futuro en las poblaciones aledaños a estos ríos, todo bajo la legislación actual y supervisado por profesionales calificados. Analizar a nivel interinstitucional e intermunicipal la problemática de los asentamientos marginales, que se localizan en las márgenes de estos ríos, con el propósito de buscar alternativas de trasladar a las familias que habitan estos sitios altamente vulnerables a terrenos aptos y más seguros.
Coordinar con cada municipio (tres Ríos, Curridabat y San José) para el río María Aguilar, un trabajo integralmente, en su Plan Operativo de medidas de prevención y mitigación, con la finalidad de realizar una intervención de limpieza anual en los sitios de mayor vulnerabilidad, así como, en caso de emergencia locales durante el período lluvioso, además, de obras de mitigación en muchas secciones de los cauces. Establecer un control periódico de vigilancia sobre el comportamiento de los ríos, especialmente en los sectores de trabajo definidos, que permita incorporar las mejoras del proceso.”. Aunado a lo anterior, que en el mes de octubre de 2019 la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias elaboró un nuevo informe técnico CNE-UIAR-INF-0923-2019, a solicitud del amparado, en el cual, se indicó; que de no intervenir el sitio con alguna obra de protección, la erosión podría hacer colapsar la malla perimetral de la propiedad y en un futuro afectar el resto de esta.
Recomiendan valorar la posibilidad de levantar una estructura de algún tipo para proteger el margen izquierdo del río para evitar que se siga dando la erosión. Por último, se determina, que el problema por contaminación del cauce o rio María Aguilar por sedimentos (basura doméstica) y materia orgánica en el centro del cauce, así como erosión de las márgenes sobre todo la izquierda, debe ser atendido por el Municipio mismo. Por su parte, la Municipalidad de San José, mediante el Oficio No. ALCALDÍA-A2-00506-2020, la Municipalidad de San José, le indicó al amparado “…En atención a gestión, la cual solicita se envié maquinaria con personal capacitado para el dragado del río, le remito criterio externado por la geógrafa Lorena Romero Vargas, Jefe Oficina Municipal de Gestión de Riesgo y el Ing. Marco Vinicio Corrales Xatruch, Gerente Provisión de Servicios, donde se refieren a su solitud…” indicando en dicho oficio “…La Municipalidad de San José en cumplimiento del marco jurídico vigente no realiza medidas de mitigación en cauce, únicamente ante situaciones de emergencia donde la CNE autorice o por orden de la Sala Cuarta…”.
Nótese, que si bien es cierto la autoridad municipal recurrida informa que la Gerencia de Provisión y Servicios y Sección de Construcción y Mantenimiento de la Red Pluvial, que la Municipalidad de San José se encuentra trabajando en todos los aspectos administrativos, legales y de Ingeniería sobre el tema, no menos cierto resulta que de los autos se desprende que el problema continúa y que pese a que desde el año 2016 se brindaron recomendaciones por parte de la Comisión Nacional de Emergencias, siendo el último informe técnico el No. CNE-UIAR-INF-0923-2019, del mes de octubre de 2019, la Municipalidad a la fecha continúa sin resolver el problema de forma definitiva, aún teniendo conocimiento de la existencia de la contaminación del río ampliamiente referida. Al respecto, este Tribunal Constitucional pudo constatar que existe el problema denunciado por el accionante, el cual es conocido por el municipio recurrido y afecta directamente al recurrente, sin que a la fecha de interposición de este recurso se le haya podido dar una solución, con lo cual se verifica una lesión a los derechos fundamentales del amparado.
Adicionalmente, en reiteradas ocasiones este Tribunal Constitucional ha reconocido y avalado que la competencia de la Comisión radica en efectuar a la Municipalidad recurrida las inspecciones y recomendaciones correspondientes, es de carácter vinculante (ver en ese sentido las sentencias No. 12818-2009 de las 15:32 horas del 18 de agosto de 2009 y la 16389-2010 de las 9:17 horas del 1 de octubre de 2010). No obstante, a pesar de lo señalado, aún no se ha llegado a concretar ninguna solución, ni siquiera se informa de medidas provisionales o urgentes dirigidas a evitar o mitigar los efectos de contaminación provocados por el Río María Aguilar. Tomando en consideración la competencia específica que el artículo 169, de la Constitución Política, otorga a los gobiernos local, al disponer que: " La administración de los intereses y servicios locales en cada cantón, estará a cargo del Gobierno Municipal (...)”.
Por ello, se acredita la alegada violación a los derechos fundamentales del tutelado, siendo lo procedente declarar con lugar el recurso, con la orden que se indicará en la parte dispositiva de esta sentencia.
LA ACTUACIÓN DEL MINISTERIO DE AMBIENTE Y ENERGIA. Del informe rendido por los representantes de la autoridad recurrida -que se tiene dado bajo fe de juramento con las consecuencias, incluso penales, previstas en el artículo 44 de la Ley que rige esta Jurisdicción- y la prueba aportada para la resolución del asunto, ha sido debidamente acreditado que el 1° de abril de 2020, ante el Ministerio de Ambiente y Energía, el amparado, denunció la problemática de los rellenos que se están realizando en la propiedad colindante y la posible afectación a la zona de protección del río Mar ía Aguilar en la zona de Zapote. Además, que a la fecha de interposición del recurso de amparo, la Dirección de Agua del Ministerio de Ambiente y Energía, no ha recibido solicitud de permiso de obra en cauce por parte de la Municipalidad de San José, para llevar a cabo trabajos dentro del cauce del río María Aguilar, ya sea de limpieza, acomodo, recaba o reforzamiento de las márgenes -tal como señala el recurrente-. Por último que el 22 de mayo de 2020, el Ministro de ambiente y Energía, fue notificado de la resolución de las 09:47 horas del 20 de mayo de 2020, mediante la cual, se tuvo por ampliadas las partes del este recurso y se le dio audiencia.
Así las cosas, en cuanto a la actuación del Ministerio de Ambiente y Energía el amparo debe desestimarse, por cuanto no fue sino hasta el 1° de abril de 2020, que el recurrente presentó ante el Ministerio recurrido la denuncia de la situación que acusa y por la cual, acude en amparo de sus derechos en fecha 03 de abril de 2020. Al respecto, se pudo constatar, a la fecha de planteado este amparo, sea el 03 de abril de 2020, la autoridad recurrida se encuentra aún en plazo para resolver y comunicar el resultado de aquella gestión al tutelado, en atención a lo dispuesto en el artículo 261 de la Ley General de la Administración Pública, que dispone -en términos generales- dos meses para tales efectos, (obsérvese que la denuncia se presentó el 1 de abril de 2020). En consecuencia, este recurso resulta prematuro. En virtud de lo expuesto, se debe declarar sin lugar el recurso en cuanto a este extremo, como en efecto se dispone.
En asuntos ambientales, es criterio del suscrito, que si ya ha habido intervención de la Administración Pública, su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que se acusa que la autoridad recurrida no ha realizado las obras que se requieren para limpiar, dragar el cauce y minimizar el proceso erosivo del río María Aguilar, lo que provoca un peligro para la integridad y vida del recurrente y su familia, una amenaza al derecho a disfrutar de un ambiente sano y ecológicamente equilibrado y de un nivel digno de calidad de vida.
Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara parcialmente con lugar el recurso, únicamente, en cuanto a la Municipalidad de San José y la falta de acatamiento de las recomendaciones brindadas por la Comisión Nacional de Emergencias para solucionar el problema que existe por la contaminación, desbordamiento del río María Aguilar y sus consecuencias -ver IAR-INF-0084-2016, del 16 de febrero de 2016 Recomendando “Efectuar integralmente trabajos de canalización, corta de árboles, recolección de sedimentos y basura, obras de mitigación acorde con un plan integral de trabajo, con la finalidad de prevenir mayores afectaciones a futuro en las poblaciones aledaños a estos ríos, todo bajo la legislación actual y supervisado por profesionales calificados. Analizar a nivel interinstitucional e intermunicipal la problemática de los asentamientos marginales, que se localizan en las márgenes de estos ríos, con el propósito de buscar alternativas de trasladar a las familias que habitan estos sitios altamente vulnerables a terrenos aptos y más seguros.
Coordinar con cada municipio (tres Ríos, Curridabat y San José) para el río María Aguilar, un trabajo integralmente, en su Plan Operativo de medidas de prevención y mitigación, con la finalidad de realizar una intervención de limpieza anual en los sitios de mayor vulnerabilidad, así como, en caso de emergencia locales durante el período lluvioso, además, de obras de mitigación en muchas secciones de los cauces. Establecer un control periódico de vigilancia sobre el comportamiento de los ríos, especialmente en los sectores de trabajo definidos, que permita incorporar las mejoras del proceso.” así como, el informe técnico CNE-UIAR-INF-0923-2019 -valorar la posibilidad de levantar una estructura de algún tipo para proteger el margen izquierdo del río para evitar que se siga dando la erosión-, en cuanto a este último realizar dicha valoración y verificar si es o no procedente. Se ordena a Jhonny Araya Monge, en calidad de Alcalde de la Municipalidad de San José, o a quien en su lugar ocupe ese cargo, que dentro del ámbito de su competencia, adopte las medidas pertinentes para que, dentro del plazo máximo de SEIS MESES contado a partir de la notificación de esta resolución, realice la coordinación interinstitucional y den una solución definitiva al problema denunciado, que afecta al recurrente.
Lo anterior bajo apercibimiento de que podría incurrir en el delito tipificado en el artículo 71 de la Ley de la Jurisdicción Constitucional, el cual dispone que se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de San José al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. En lo demás, se declara sin lugar el recurso. El Magistrado Salazar Alvarado pone nota. Notifíquese.
