Amparo proceeding (recurso de amparo) processed under expediente number 20-007157-0007-CO, filed by YANNIE ISABEL DÍAZ CASTILLO, identity card 0701410866, against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADO, EL MINISTERIO DE SALUD Y LA MUNICIPALIDAD DE NICOYA.

BACKGROUND:

  1. 1In a written submission received by this Chamber at 10:40 hrs. on April 20, 2020, the petitioner filed an amparo proceeding and stated that she lives in Barrio San Martín, Nicoya. She asserts that on November 19, 2018, she reported to the respondent authorities that all residents of the residencial Manuel Ajoy discharge untreated sewage (aguas negras) from their homes into the stream running through the area. She adds that, as a result, she must endure the nauseating odors emanating from it. Moreover, children from her community play in that stream despite its waters being severely polluted. In addition, 5 months later, the respondents had taken no action whatsoever. That omission violates her fundamental rights. She requests that the proceeding be granted.
  2. 2By order issued at 13:51 hrs. on April 20, 2020, this proceeding was admitted for review, and the respondent authorities were notified on April 22, 2020.
  3. 3In a written submission filed on April 27, 2020, ZINNIA MARÍA CORDERO VARGAS, in her capacity as Director of the Área Rectora de Salud del Ministerio de Salud en Nicoya, reported under oath that, according to the review of the database conducted by the responsible officials concerning the various complaints filed with that Área Rectora, and as stated by Anahí Villegas Hernández, the official in charge of that process, as of April 22, 2020, neither the digital records of the Equipo de Atención al Cliente nor the administrative files opened as of that date contain any record that the petitioner herein had filed a complaint relating to the problem caused by the improper disposal of “untreated sewage into the stream running through the area” at residencial Manuel Ajoy in Nicoya. She states that she reviewed the records maintained by the Equipo de Atención al Cliente of that Área Rectora de Salud; however, there is no record that Ms. Yannie Isabel Díaz Castillo filed any complaint with that Ministry in 2019 concerning sanitary deficiencies. She requests that the proceeding be dismissed.
  4. 4In a written submission filed on April 28, 2020, MARCO ANTONIO JIMÉNEZ MUÑOZ, in his capacity as Mayor of Nicoya, reported under oath that this is a genuine problem and has existed for more than 25 years because, according to technical studies, the soil absorption conditions are incompatible with individual wastewater-treatment solutions, making it necessary to implement a comprehensive shared system for the entire project. He states that, since 2018, they have participated in meetings with AyA, Fundación Costa Rica Canadá, Grupo Muntual, Dirección de Aguas de MINAE, MIVAH and BANHVI to coordinate efforts concerning the problem. He indicates that the original project for the urbanización Emanuel Ajoy consists of a system based on recommendations by AyA; there is also an intention to include the Calderón Fournier project within the comprehensive system, and the project would be financed by BANHVI.He states that although Municipalidad de Nicoya does not have the budget to finance projects of this kind, it is willing to cooperate and facilitate the conditions necessary to bring the project to fruition because the situation at the site is becoming increasingly difficult for the residents of that community. He adds that the actions of that municipal corporation have focused on a management commitment, coordinating with other government entities competent in the matter in order to implement corrective measures collectively. He requests that the proceeding be dismissed.
  5. 5In a written submission filed on May 07, 2020, MAX GÓMEZ MARTÍNEZ, in his capacity as Cantonal Head of the Nicoya office of the Instituto de Acueductos y Alcantarillados, reported under oath that, based on technical report GSP-RCHO-2020-01211 dated May 6, 2020, signed by engineer Rosa González Palma of the Dirección Regional, the following is stated: “With respect to AyA and its relationship with the project known as Emanuel Ajoy and surrounding areas, the Institution has participated in various meetings and has heard the improvement proposals that Mutual Alajuela (as the institution financially responsible for the works) has put forward to address this problem, aimed at resolving wastewater management (Attached as evidence: Minutes of the Grupo Mutual Meeting). The genesis of that project was not entirely clear because the institution has no file for it (Ref: attached Oficio UEN-PC-2018-01577), and therefore, under the present circumstances, we cannot provide a technically clear explanation of how the system itself operates; in this instance, it is above all the developer’s responsibility to resolve a problem that, as the interested party correctly indicates, threatens public health, the environment, and the quality of life of those at the site.” He states that, in any event, the Ministerio de Salud is responsible for ordering measures for the planning and coordination of public health activities and, furthermore, that entity is responsible for approving and establishing water-sanitation principles relating to water quality.He indicates that it must be noted and clarified that the treatment solution for this housing project is a septic tank (tanque séptico); therefore, as already stated, its operation or failure to operate falls within the jurisdiction of the Ministerio de Salud, not AyA. He adds that Nicoya, as a city, has had a sanitation system since approximately 1969; its treatment capacity, as well as its networks and collectors, have been operating beyond their useful life for several years. Because of that situation, the network’s coverage has not been expanded for many years, as a matter of responsibility concerning the water that would ultimately reach the lagoon systems—the treatment method originally selected as the pollutant-removal option for the city of Nicoya—which have reached their treatment-capacity limit. He states that Emanuel Ajoy, as an established urbanización, dates from 2003 and was approved at that time by the Ministerio de Salud with a septic-tank treatment solution for its wastewater, as inferred from the inspection.He emphasizes that although, as already noted, the city of Nicoya has a wastewater collection and treatment system, neither at that time nor, much less, at present was that system equipped to receive the volume of flow generated by the approximately 200 housing units in this project. Thus, although the project was established as such and was constructed without permits from AyA, it was never accepted by the institution. He states that, on August 27, 2018, document No. GSPRCHO-2018-02430 was issued to the Dirección Jurídica, clearly for the purpose of keeping the institution’s legal division informed of situations arising in the various systems. He notes that responsibility for the problem identified by Ms. Díaz Castillo lies with several parties: first, the Ministerio de Salud, which at the time issued the necessary permits deeming the septic-tank solution suitable; and the developer, whose identity they do not know, Mutual or BAHVI.He indicates that the comprehensive project known as Emanuel Ajoy was not approved by his institution through final plans, since digital records are available from 2000 to the present and contain no record concerning the project’s location or characteristics. He states that septic-tank systems are a technical solution to the wastewater problem and, provided that they are built in accordance with their design, are a suitable option for the proper treatment and disposal of wastewater, particularly in places where no sanitary infrastructure exists or where such infrastructure is not feasible because of the terrain’s topography. Proyecto Emanuel Ajoy and the surrounding areas have a wastewater problem because their sanitation systems, which consist of septic tanks, do not function as theoretically intended due to the soil conditions. The drainage area required for a septic tank is not respected in most of these social-housing developments because uncontrolled growth and expansions permitted by other institutions cover nearly 100 % of the land, thereby worsening the problem because drainage is eliminated and, in fact, the purpose for which the system was installed is defeated.Likewise, the problem affecting the aforementioned project arises from the location of the homes, which are situated a considerable distance from the nearest existing network; nor does that network necessarily have sufficient collector capacity to convey the water from so many connections to the Treatment Plant, which, as stated, cannot receive any more wastewater. Connecting them would worsen the problem throughout the city of Nicoya because the network and Treatment Plant lack sufficient capacity. He states that, according to the petitioner’s account, responsibility lies with several parties, initially with the entity that at the time issued the necessary permits deeming the septic-tank solution suitable. Likewise, the project known as Emanuel Ajoy was not approved through plans by that Institute, since AyA’s digital records from 2000 onward have been verified and, to date, no such project appears in them.He asserts that a solution to the Emanuel Ajoy problem, and consequently to the problem of the interested party who filed the complaint with the Chamber, must be agreed upon by several entities, not only by the entity that provides the technical guidelines, but also by those that promoted the project at the time. He adds that, acting out of a sense of responsibility, the Región Chorotega, on behalf of AyA, asked the relevant Subgerencia to elevate the Nicoya project, as a comprehensive solution, to higher authorities in order to obtain financing and address problems such as this one. Nevertheless, he states that, from a technical perspective, no solutions have been identified other than installing networks and a robust treatment system, which must be funded by whoever originally omitted the studies and site characterization, as well as the sanitation works. In view of that negligence, responsibility for design, construction, and financing must rest with those who permitted those buildings and with those who failed to comply with the applicable regulations. He requests that the proceeding be dismissed.
  6. 6In the processing of this proceeding, all statutory requirements have been observed.

Opinion drafted by Justice Hernandez Gutierrez; and,

Considerations:

I. PRELIMINARY MATTER

Before analyzing the merits of the case—concerning the alleged violation of the right to prompt and full proceedings (procedimiento pronto y cumplido)—it must be clarified that, beginning with Judgment No. 2008-02545, issued at 08:55 on 22 de febrero de 2008, this Chamber has referred to the administrative-law jurisdiction—with some exceptions—those matters in which it is disputed whether the public administration has complied with the time limits established by the General Law of Public Administration (articles 261 and 325) or by sector-specific laws governing special administrative proceedings (procedimientos administrativos especiales), either to conclude administrative proceedings—initiated ex officio or at the request of a party—by means of a final administrative act (acto final), or to hear the applicable administrative appeals (recursos administrativos). Specifically, the case at bar (sub lite) presents an exceptional circumstance because it concerns an environmental complaint (gestión ambiental) filed with the Municipalidad de Puntarenas, the Dirección Regional Pacífico Central del Ministerio de Salud, and the Ministerio de Ambiente y Energía, which allegedly have not resolved it within a reasonable period. Having clarified this point, the Chamber proceeds to rule on the specific situation raised in this constitutional protection proceeding (amparo).

II. SUBJECT MATTER OF THE PETITION

The petitioner files a petition for constitutional protection (recurso de amparo) and states that she lives in Barrio San Martín, Nicoya. She asserts that on 19 de noviembre de 2018 she reported to the respondent authorities that all residents of the Manuel Ajoy residential development discharge untreated sewage (aguas negras) from their homes into the creek (quebrada) that runs through the area. She adds that, as a result, she must endure the nauseating odors emanating from it. Moreover, children from her community play in that stream, even though its waters are severely contaminated. In addition, 5 months later, the respondents have yet to take any action. That omission violates her fundamental rights. She requests that the petition be granted.

III. PROVEN FACTS

The following facts relevant to the decision in this matter are deemed duly established, either because they have been proven or because the respondent authority failed to address them as directed in the initial order:

Facts concerning the Ministerio de Salud.

On 19 de noviembre de 2018, the petitioner reported the pollution problem in the Manuel Ajoy housing development (urbanización) in Nicoya, arising from the use of a creek to discharge sewage (see evidence submitted in the case file).

Facts concerning the Municipalidad de Nicoya.

The Departamento de Control Constructivo y Obra Pública stated that, since 2018, it has participated in meetings with AyA, Fundación Costa Rica Canadá, Grupo Muntual, Dirección de Aguas de MINAE, MIVAH, and BANHVI to coordinate efforts concerning the problem (see report and evidence submitted by the Alcalde Municipal Titular de Nicoya).

The initial project for the Emanuel Ajoy housing development consists of a system based on recommendations from AyA. It is also intended to include the Calderón Fournier project within the comprehensive system, and the project would be financed by BANHVI. The report states that although the Municipalidad de Nicoya lacks the budget to finance projects of this type, it is willing to collaborate and facilitate the conditions necessary to make the project a reality, because conditions at the site are becoming increasingly difficult for the residents of that community (see report and evidence submitted by the Alcalde Municipal Titular de Nicoya).

Facts concerning the Instituto de Acueductos y Alcantarillados According to Technical Report GSP-RCHO-2020-01211, dated 06 de mayo de 2020, signed by engineer Rosa González Palma of the Dirección Regional, the following is stated: “With respect to AyA and its connection with the project known as Emanuel Ajoy and the surrounding areas, the Institution has participated in various meetings and has heard the proposals for addressing this problem that Mutual Alajuela (as the institution financially responsible for the works) has presented, which are aimed at solving the issue of wastewater management (manejo de Aguas Residuales) (Minutes of the Grupo Mutual Meeting attached as evidence). The origin of that project was not entirely clear, since the Institution has no case file (expediente) for it (Ref : attached Official Letter UEN-PC-2018-01577); therefore, under the present circumstances, we cannot provide a clear technical assessment of how the system itself operates. In this case, it is primarily the developer’s responsibility to solve a problem that, as the interested party correctly indicates, threatens public health, the environment, and the quality of life of those at the site” (see report and evidence submitted by the Jefe Cantonal de la oficina de Nicoya del Instituto de Acueductos y Alcantarillados).

According to Official Letter SG-GSP-RT-2019-00213, dated 18 de noviembre del 2019, signed by Álvaro Araya García, UEN Recolección y Tratamiento Periféricos, the corresponding Subgerencia was asked to refer the Nicoya project, as a comprehensive solution, to higher authorities in order to secure funding and address problems such as this one (see report and evidence submitted by the Jefe Cantonal de la oficina de Nicoya del Instituto de Acueductos y Alcantarillados).

IV. THE RIGHT TO A HEALTHY AND ECOLOGICALLY BALANCED ENVIRONMENT

First, it must be noted that the fundamental rights to health and to a healthy and ecologically balanced environment are constitutionally recognized (articles 21, 50, 73, and 89 of the Constitución Política), as well as recognized under the international legal framework applicable in Costa Rica. In this regard, in Judgment N° 2006-005928, issued at 15:00 on 2 de mayo del 2006, this Court ruled: “(…) The right to life recognized in article 21 of the Constitution is the cornerstone upon which the other fundamental rights of the inhabitants of the Republic rest. Likewise, that provision of the political charter provides the basis for the right to health, because life is inconceivable unless human beings are guaranteed the minimum conditions necessary for an adequate and harmonious psychological, physical, and environmental balance. Public health and the right to a healthy and ecologically balanced environment are constitutionally recognized in articles 21, 50, 73, and 89 of the Constitución Política.

Specifically, constitutional article 50 expressly recognizes the right of all inhabitants of the country to enjoy a healthy and perfectly balanced environment. That right is a fundamental guarantee protecting life and public health. In support of the foregoing, this Court has relied on the concept of ‘environmental quality’ (calidad ambiental) as a measure specifically of people’s quality of life, in conjunction with other elements such as health, food, work, and housing, indicating that every person has the right to use the environment for their own development, but not without limitation, because there is also a duty to protect and preserve the environment for present and future generations—the principle of sustainable development (principio de desarrollo sostenible)—.” Furthermore, article 50 of the Constitución Política gives rise to the State’s obligation to protect the environment.

That provision states: “The State shall seek the greatest well-being of all inhabitants of the country by organizing and promoting production and the most appropriate distribution of wealth. Every person has the right to a healthy and ecologically balanced environment. Accordingly, every person has standing to report acts that infringe that right and to seek compensation for the harm caused. The State shall guarantee, defend, and preserve that right. The law shall establish the corresponding liabilities and penalties.” This confirms that the various public authorities have an inescapable duty to preserve, defend, and guarantee every person’s fundamental right to health and to a healthy and ecologically balanced environment.

V. COORDINATION AMONG PUBLIC INSTITUTIONS IN THE COMPREHENSIVE PROTECTION OF THE ENVIRONMENT

The State—as a whole—is under an obligation to take the measures necessary to protect the environment in order to prevent levels of pollution, deforestation, extinction of flora and fauna, and excessive or improper use of natural resources that endanger the health of the governed population (administrados). For purposes of this responsibility, a public institution includes both the Central Administration—ministries such as the Ministerio del Ambiente y Energía and the Ministerio de Salud—which, by virtue of their subject-matter jurisdiction, have extensive involvement and responsibility concerning environmental conservation and preservation and most often act through their specialized divisions. Municipalities likewise bear substantial responsibility in this task within their territorial jurisdiction. Given the diversity of actors that may be involved, it might be thought that this shared responsibility would cause chaos in administrative management.

Therefore, to prevent the simultaneous coexistence of spheres of authority with different origins and characteristics, the duplication of national and local efforts, and confusion regarding the rights and obligations of the various parties involved, it is necessary to establish a series of coordination mechanisms among the various divisions of the Executive Branch and decentralized institutions, and between those bodies and the municipalities, so that they may carry out the functions entrusted to them. This Chamber has previously addressed the principle of coordination between public agencies and municipalities in pursuing common objectives, stating in Judgment N° 5445-99, issued at 14:30 on 14 de julio de 1999, that: “Coordination is the ordering of the relationships among these various independent activities, taking into account their convergence upon the same object or entity in order to make that convergence useful to an overall public plan, without eliminating the reciprocal independence of the participating entities.

Because there is no hierarchical relationship among decentralized institutions, or between the State itself and the municipalities, specific conduct cannot be imposed upon the latter. This gives rise to the indispensable interinstitutional ‘agreement’ (concierto), in the strict sense, whereby autonomous and independent centers of action agree upon that preventive and overall framework, within which each fulfills a role with a view to a mission entrusted to the others. Thus, relations between municipalities and other public entities may be conducted only on a basis of equality, resulting in mutually agreed forms of coordination and excluding any form of coercion that would impair their autonomy by subjecting corporate entities to a coordination framework without or against their consent. This nevertheless permits the necessary subordination of these entities to the State and in the State’s interest (through the State’s ‘administrative oversight’ (tutela administrativa) and, specifically, through the function of legality review entrusted to it, with general supervisory authority over the entire sector.”

VI. REGARDING THE ÁREA RECTORA DE SALUD OF THE MINISTERIO DE SALUD IN NICOYA IN THIS SPECIFIC CASE

In these proceedings, the appellant filed an amparo petition (recurso de amparo), stating that she lives in Barrio San Martín, Nicoya. She asserts that on November 19, 2018, she reported to the respondent authorities that all residents of the Manuel Ajoy residential development discharge untreated sewage (aguas negras) from their homes into the stream that runs through the area. She adds that, as a result, she must endure the nauseating odors emanating from it. In addition, the children in her community play in that stream even though its waters are severely polluted. Furthermore, 5 months later, the respondents had still taken no action. That omission violates her fundamental rights. She requests that the petition be granted. Based on the report submitted by the representatives of the respondent authorities—which is deemed to have been given under oath, with the consequences, including criminal consequences, provided for in Article 44 of the Law governing this Jurisdiction—and the evidence submitted for the resolution of the matter sub judice, the Chamber finds it established that the Regulatory Team of the Área Rectora de Salud stated that neither the digital records of the Customer Service Team nor the administrative files opened as of that date contained any record that the appellant had filed a complaint concerning the improper disposal of “untreated sewage into the stream that runs through the area.” However, the evidence submitted by the appellant shows that the complaint was filed with that authority on November 19, 2018, expressly identifying the pollution problem in the Manuel Ajoy housing development in Nicoya, where a stream is used to discharge sewage.

Accordingly, it was established that the respondent authorities of the Ministerio de Salud have not addressed the complaint filed by the appellant; therefore, the amparo petition must be granted insofar as that authority is concerned. This is in accordance with the provisions of the operative portion (parte dispositiva) of this decision.

VII. REGARDING THE MUNICIPALIDAD DE NICOYA IN THIS SPECIFIC CASE

With respect to the facts involving the respondent local government, for purposes of resolving these amparo proceedings, the Departamento de Control Constructivo y Obra Pública stated that, since 2018, it has participated in meetings with AyA, Fundación Costa Rica Canadá, Grupo Mutual, Dirección de Aguas de MINAE, MIVAH, and BANHVI in order to coordinate efforts concerning the problem. It further stated that the initial project for the Emanuel Ajoy housing development consists of a system based on AyA recommendations, that the Calderón Fournier project is also intended to be included within the comprehensive system, and that the project would be financed by BANHVI. It states that although the Municipalidad de Nicoya lacks the budget to finance projects of this kind, it is willing to collaborate and facilitate the conditions necessary to bring the project to fruition, because the situation at the site is becoming increasingly difficult for the residents of that community.

In this regard, the Chamber observes that although the administrative authorities of the respondent municipality have intervened in an effort to resolve the problem affecting the appellant’s community, the fact remains that, as of this date and after a disproportionate amount of time has elapsed, no viable option has yet been presented to address the problems faced by local residents. This plainly violates the appellant’s fundamental rights; therefore, these proceedings must be resolved in her favor insofar as that authority is concerned.

VIII. REGARDING THE NICOYA OFFICE OF THE INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS

With respect to the Instituto Costarricense de Acueductos y Alcantarillados, it was established that, regarding the project known as Emanuel Ajoy and surrounding areas, the institution has participated in various meetings and heard the proposed improvements that Mutual Alajuela—as the institution financially responsible for the works—has put forward to address the problem, focusing on a solution for wastewater management (manejo de aguas residuales) (Meeting Minutes of Grupo Mutual attached as evidence). The origin of that project was not entirely clear because the institution has no file concerning it. This case is primarily a matter of the developer’s responsibility to resolve a problem that, as the interested party correctly states, threatens public health, the environment, and the quality of life of those in the area. In addition, the Unidad de Recolección y Tratamiento Periféricos stated that the corresponding Deputy General Management should be asked to refer the Nicoya project, as a comprehensive solution, to higher authorities in order to obtain funding and address problems of this kind.

They also consider that Emanuel Ajoy, as an established housing development, dates from 2003 and was approved at that time by the Ministerio de Salud with a septic-tank (tanque séptico) solution for treating its wastewater, as inferred from the inspection. It emphasizes that although, as already stated, a wastewater collection and treatment system exists in the city of Nicoya, neither at that time nor, much less, at present was that system equipped to receive the volume of flow generated by the approximately 200 housing units in this project. Thus, although the project was established as such and was built without permits from AyA, it was never formally accepted by the institution. With respect to the respondent Instituto, the Chamber finds that the petition must also be granted, since that authority acknowledged that it was aware of the matter raised in the amparo petition, yet no solution to the problem had been reached as of this date.

In accordance with the foregoing, the Chamber finds that the appellant’s allegations are well-founded and that her fundamental rights have been violated. Indeed, this Constitutional Court established that approximately seventeen months had elapsed since the protected party filed her complaint and that, although actions had been taken to address it, it could not be shown that those actions had been communicated to the appellant. In the opinion of this Court, the time taken to inform the appellant of the actions undertaken was unreasonable. Consequently, this amparo petition must be granted due to a violation of Article 41 of the Constitution. The Chamber further finds that a disproportionate period has also elapsed without a final resolution of the complaint filed by the protected party. In view of the foregoing, the petition must be granted, as stated in the operative portion of this decision.

IX.Lastly, it should be noted that if the authorities of the Instituto Costarricense de Acueductos y Alcantarillados consider other entities to be responsible, they may bring the corresponding actions through the appropriate ordinary proceedings and jurisdiction to enforce any liabilities they deem applicable for the alleged acts or omissions.

X. NOTE BY JUSTICE SALAZAR ALVARADO

In environmental matters, it is the undersigned Justice’s opinion that, where the Public Administration has already intervened, jurisdiction to hear and resolve the matter lies with the contentious-administrative jurisdiction (jurisdicción contenciosa administrativa). Nevertheless, I do consider the merits of the matter when other rights of the persons affected by the source of pollution are at stake, including health, quality of life, and the right to enjoy a healthy, pollution-free environment (Article 50 of the Constitución Política), as is the case here, where pollution problems are alleged in Barrio San Martín, Nicoya, caused by residents of the Manuel Ajoy residential development, who are accused of discharging untreated sewage and wastewater (aguas servidas) into the stream that runs through the area. In this regard, the discharge of this sewage and wastewater affects the health of local residents, violating their right to enjoy a healthy and ecologically balanced environment and a dignified quality of life.

XI. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are hereby advised that if they submitted any paper documents, objects, or evidence stored on any additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, such materials must be collected from the court office within a maximum of 30 business days from notice of this judgment. Otherwise, any material not collected within that period will be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session N° 27-11 of August 22, 2011, Article XXVI, and published in Boletín Judicial number 19 of January 26, 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on May 3, 2012, Article LXXXI.

POR TANTO:

The petition is hereby GRANTED. ZINNIA MARÍA CORDERO VARGAS, in her capacity as Director of the Área Rectora de Salud of the Ministerio de Salud in Nicoya; MARCO ANTONIO JIMÉNEZ MUÑOZ, in his capacity as Mayor of Nicoya; and MAX GÓMEZ MARTÍNEZ, in his capacity as Cantonal Chief of the Nicoya office of the Instituto de Acueductos y Alcantarillados, or whoever may hold those positions, are ordered, IMMEDIATELY upon notice of this decision, jointly and in coordination, to take all necessary measures to ensure temporarily that the health of the persons living in Barrio San Martín, Nicoya is not adversely affected while a permanent solution is developed for the problem at issue in these proceedings. They are further ordered, within a period not exceeding TWENTY-FOUR MONTHS from notice of this judgment, jointly and in coordination, to adopt all necessary measures within the scope of their respective authority to plan for and provide a permanent solution to the environmental problem in Barrio San Martín, Nicoya.

The respondents are advised that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, any person who receives an order issued in an amparo proceeding that the person must comply with or enforce, and who fails to comply with or enforce it, shall be punished by imprisonment for three months to two years or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The State, the Municipalidad de Nicoya, and the Instituto Costarricense de Acueductos y Alcantarillados are ordered to pay the costs, damages, and losses caused by the events giving rise to this ruling, the amounts of which shall be determined during enforcement of the judgment before the contentious-administrative jurisdiction. *200071570007CO* SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas quince minutos del veintinueve de mayo de dos mil veinte .

Recurso de amparo que se tramita en expediente número 20-007157-0007-CO, interpuesto porYANNIE ISABEL DÍAZ CASTILLO, cédula de identidad 0701410866, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADO, EL MINISTERIO DE SALUD Y LA MUNICIPALIDAD DE NICOYA.

RESULTANDO:

  1. 1Por escrito recibido en esta Sala a las 10:40 hrs. del 20 de abril de 2020, la parte recurrente presenta recurso de amparo y expone que, vive en el Barrio San Martín, Nicoya. Afirma que el 19 de noviembre de 2018 denunció ante las autoridades recurridas, que todos los residentes del residencial Manuel Ajoy, desfogan las aguas negras de sus viviendas, sin tratamiento alguno, en la quebrada que pasa por el lugar. Agrega que como consecuencia de lo anterior, debe soportar los nauseabundos olores que de ahí salen. Además, los niños de su comunidad juegan en dicho riachuelo, pese a que las aguas se encuentran severamente contaminadas. Aunado a lo anterior, 5 meses después, no existe intervención alguna de las recurridas. Esa omisión, vulnera sus derechos fundamentales. Solicita que se declare con lugar el recurso.
  2. 2Mediante auto de las 13:51 hrs. del 20 de abril de 2020 se dio curso al presente recurso y se notificó a las autoridades recurridas el 22 de abril de 2020.
  3. 3Por escrito presentado el 27 de abril de 2020, informa bajo juramento ZINNIA MARÍA CORDERO VARGAS, en su condición de Directora del Área Rectora de Salud del Ministerio de Salud en Nicoya que, de acuerdo con la revisión realizada en la base de datos por parte de los funcionarios responsables, en lo referente a las diferentes denuncias que se presentan en esa Área Rectora, según lo indica la funcionaria Anahí Villegas Hernández, encargada de ese proceso, al día 22 de abril de 2020, no consta en los registros digitales del Equipo de Atención al Cliente ni en los expedientes administrativos abiertos a esa fecha, que la aquí recurrente haya interpuesto denuncia alguna relacionada con la problemática por mala disposición de “aguas negras sin tratamiento alguno, en la quebrada que pasa por el lugar” en el residencial Manuel Ajoy en Nicoya. Señala que procedió a la revisión de los registros que se llevan en el Equipo de Atención al Cliente de esa Área Rectora de Salud, sin embargo, no consta que la señora Yannie Isabel Díaz Castillo haya interpuesto denuncia alguna en el año 2019 ante ese Ministerio, por deficiencias sanitarias. Solicita se desestime el recurso.
  4. 4Por escrito presentado el 28 de abril de 2020, informa bajo juramento MARCO ANTONIO JIMÉNEZ MUÑOZ, en su condición de Alcalde de Nicoya que, este es un problema real y ha existido desde ya hace más de 25 años, debido a que según estudios técnicos las condiciones de absorción del terreno no son compatibles con soluciones individuales de tratamientos de aguas residuales, por lo que se hace necesario la implementación de un sistema común integral para todo el proyecto. Señala que desde el 2018 han participado en reuniones con las instancias AyA, Fundación Costa Rica Canadá, Grupo Muntual, Dirección de Aguas de MINAE, MIVAH y BANHVI, con el fin de coordinar sobre la problemática. Indica que el proyecto inicial para la urbanización Emanuel Ajoy consiste en un sistema de recomendaciones de Ay A, se pretende incluir además del proyecto Calderón Fournier dentro del sistema integral y el proyecto sería financiado por el BANHVI.Señala que aunque la Municipalidad de Nicoya no cuenta con el presupuesto para financiar este tipo de proyectos, si están anuentes en colaborar y facilitar condiciones para que se haga realidad, debido a que la situación se vuelve cada vez más difícil en el sitio para los vecinos de esa comunidad. Añade que las acciones de esa corporación municipal se han dirigido en un compromiso de gestión, coordinando con otros entes gubernamentales competentes en la materia, a efectos de implementar de manera grupal acciones correctivas. Solicita se desestime el recurso.
  5. 5Por escrito presentado el 07 de mayo de 2020, informa bajo juramento MAX GÓMEZ MARTÍNEZ, en su condición de Jefe Cantonal de la oficina de Nicoya del Instituto de Acueductos y Alcantarillados que, con fundamento en el informe técnico, GSP-RCHO-2020-01211 de fecha del 6 de mayo del 2020 suscrito por la ingeniera Rosa González Palma de la Dirección Regional se indica lo siguiente: “En lo que respecta al AyA, y la relación que tiene con el proyecto denominado Emanuel Ajoy y zonas circundantes, la Institución ha participado en diversas reuniones y ha escuchado las propuestas de mejora para dicha problemática que la Mutual Alajuela (como institución responsable por las obras a nivel financiero) ha presentado sobre la mesa, avocadas a la solución del manejo de Aguas Residuales (Anexo como prueba Minuta de la Reunión Grupo Mutual). La Génesis de dicho proyecto, no fue del todo clara, pues este proyecto no cuenta con expediente dentro de la institución (Ref : Oficio UEN-PC-2018-01577 adjunto) por lo que no podemos bajo las circunstancias actuales indicar técnicamente de forma clara el funcionamiento del sistema como tal; en este caso es ante todo una cuestión de responsabilidad del desarrollador el dar solución a un problema que como bien lo indica la interesada, atenta contra la Salud Pública, el ambiente y la calidad de vida de quienes se encuentran en el lugar”.Señala que le corresponde en todo caso al Ministerio de Salud dictar las medidas para la planificación y coordinación de las actividades públicas referentes a la salud y, además, es esa entidad la que aprueba y dicta los principios de la sanidad de las aguas en relación con su calidad. Indica que debe tomarse en cuenta y aclararse que la solución de este proyecto habitacional es vía tanque séptico, por lo que compete al Ministerio de Salud como se ha indicado (no al AyA) su funcionamiento o la falta de este sea su competencia. Agrega que Nicoya como ciudad, cuenta con un sistema de Saneamiento desde el año 1969 aproximadamente, su capacidad de tratamiento, así como sus redes y colectores, trabajan sobre su vida útil desde hace algunos años por la situación anterior, desde hace muchos años no se ha ampliado la cobertura de la red, por una cuestión de responsabilidad respecto de las aguas que finalmente vendrán a los sistemas lagunares y que es el método de tratamiento que se erigió en su momento como la opción de remoción de contaminantes para la ciudad de Nicoya y que han llegado a su límite de capacidad de tratamiento.Señala que para el caso de Emanuel Ajoy, como urbanización establecida tiene como data del año 2003, y fue aprobada por el Ministerio de Salud en ese momento con una solución de tratamiento para sus aguas residuales con utilización de Tanque Séptico, esto como una deducción de lo inspeccionado. Puntualiza que si bien es cierto y como ya se ha indicado en la ciudad de Nicoya, existe un sistema de recolección y tratamiento de las aguas residuales, el mismo no estaba en ese momento ni mucho menos en el actual, preparado para recibir la cantidad de caudal que dispone el alrededor de 200 soluciones habitacionales de este proyecto. Así que si bien el proyecto se estableció como tal y fue construido sin los permisos por parte del AyA, nunca fue recibido por la institución. Señala que en fecha 27 de agosto del 2018 se emitió un documento a la Dirección Jurídica bajo el No. GSPRCHO-2018-02430, a todas luces con el afán de mantener informado a la parte legal de la institución de las situaciones que se van presentando en los diversos sistemas.Alude que la responsabilidad de la problemática que indica la Sra. Díaz Castillo es de varios actores, en primera instancia del Ministerio de Salud, quien en su momento dio los permisos del caso para establecer como apta la solución de tanque séptico, del Desarrollador que desconocen quien fue, Mutual o BAHVI. Indica que el proyecto integral denominado Emanuel Ajoy, no fue aprobado con planos finales por parte suya, pues se tienen registros digitales desde el año 2000 a la fecha y en lo tocante a la ubicación y características de este no existe registro alguno. Señala que los sistemas de tanque séptico, son una solución técnica al problema de las aguas residuales, siempre y cuando se construya de acuerdo con el diseño, son una opción idónea para el adecuado tratamiento y disposición de las aguas residuales, sobre todo en aquellos lugares donde no existe infraestructura sanitaria o por topografía del terreno no es factible.El Proyecto Emanuel Ajoy y zonas circundantes tienen un problema de aguas residuales, debido a que sus sistemas de saneamiento que son tanques sépticos por las condiciones del terreno, no funcionan como la teoría lo establece. El área de drenaje que debe tener un tanque séptico y en la mayoría de los casos en estas urbanizaciones de bien social, dado al crecimiento descontrolado y ampliaciones que son permitidas por otras instituciones, cubren hasta casi el 100 % de terreno que no se respeta, lo que aumenta la problemática, pues se elimina el drenaje y de hecho se elimina el fin para el que se instaló, asimismo el problema que enfrenta el proyecto supra indicado se origina por la ubicación de las viviendas que se encuentra a una considerable distancia de la red más cercana existente, esto igualmente no asegura la capacidad de colector para trasegar el agua de tal cantidad de conexiones, hasta la Planta de Tratamiento, que como se ha indicado no puede recibir más agua residual.El conectarlas agravaría el problema de toda la ciudad de Nicoya por falta de capacidad de la red y de la Planta de Tratamiento. Señala que de acuerdo con lo que externa la recurrente, la responsabilidad es de varios actores, en primera instancia quien en su momento dio los permisos del caso para establecer como apta la solución de tanque séptico, asimismo el proyecto denominado Emanuel Ajoy, no fue aprobado con planos por parte de ese Instituto, pues se tiene certeza de los registros digitales de AyA desde el año 2000 y a la fecha no existe tal proyecto. Asevera que una solución al problema de Emanuel Ajoy y por ende de la interesada que pone la denuncia ante la Sala es que esta debe ser consensuada por varios entes, no solo de quien da los lineamientos técnicos; si no más bien de quienes impulsaron en su momento el proyecto. Añade que la Región Chorotega (por parte de AyA) bajo un sentido de responsabilidad solicitó a la Subgerencia respectiva, que el proyecto de Nicoya como una solución integral, se elevara a instancias mayores, a fin de conseguir un financiamiento y poder enfrentar problemáticas como esta.No obstante expresa que técnicamente no se encuentran más soluciones que la habilitación de redes y sistema de tratamiento robusto, que deberá ser costeado por quien en su momento omitió los estudios y caracterización del sitio, así como de las obras de saneamiento, siendo consciente de su negligencia, la responsabilidad en materia de diseño, constructivas y financieras, deberán ser sentadas en quienes permitieron esas edificaciones y en aquellos quienes no cumplieron la normativa como está establecido. Solicita se desestime el recurso.
  6. 6En la substanciación de este proceso se han observado las prescripciones de ley.

Redacta el Magistrado Hernandez Gutierrez; y,

Considerando:

I. DE PREVIO

De previo a analizar el fondo del asunto -por la presunta violación del derecho a un procedimiento pronto y cumplido- debe aclararse, que a partir de la Sentencia No. 2008-02545 de las 08:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa –con algunas excepciones-, aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo – instruido de oficio o a instancia de parte- o conocer de los recursos administrativos procedentes. Precisamente, en el sub lite, se plantea un supuesto de excepción, pues, se está ante una gestión ambiental, presentada ante la Municipalidad de Puntarenas, la Dirección Regional Pacífico Central del Ministerio de Salud y el Ministerio de Ambiente y Energía, que presuntamente no han sido resueltas en un plazo razonable. Aclarado el punto, se entra a resolver la situación concreta planteada en este amparo.

II. OBJETO DEL RECURSO

La parte recurrente presenta recurso de amparo y expone que, vive en el Barrio San Martín, Nicoya. Afirma que el 19 de noviembre de 2018 denunció ante las autoridades recurridas, que todos los residentes del residencial Manuel Ajoy, desfogan las aguas negras de sus viviendas, sin tratamiento alguno, en la quebrada que pasa por el lugar. Agrega que como consecuencia de lo anterior, debe soportar los nauseabundos olores que de ahí salen. Además, los niños de su comunidad juegan en dicho riachuelo, pese a que las aguas se encuentran severamente contaminadas. Aunado a lo anterior, 5 meses después, no existe intervención alguna de las recurridas. Esa omisión, vulnera sus derechos fundamentales. Solicita que se declare con lugar el recurso.

III. HECHOS PROBADOS

De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque la autoridad recurrida haya omitido referirse a ellos, según lo prevenido en el auto inicial:

Hechos relativos al Ministerio de Salud.

El 19 de noviembre de 2018, la recurrente denunció el problema de contaminación en la urbanización Manuel Ajoy en Nicoya. Dado que utilizan una quebrada para descarga de aguas negras (ver prueba aportada a los autos).

Hechos relativos a la Municipalidad de Nicoya.

El Departamento de Control Constructivo y Obra Pública señaló que desde el 2018 han participado en reuniones con las instancias AyA, Fundación Costa Rica Canadá, Grupo Muntual, Dirección de Aguas de MINAE, MIVAH y BANHVI, con el fin de coordinar sobre la problemática (véase informe y prueba aportada por el Alcalde Municipal Titular de Nicoya).

El proyecto inicial para la urbanización Emanuel Ajoy consiste en un sistema de recomendaciones de AyA, se pretende incluir además del proyecto Calderón Fournier dentro del sistema integral y el proyecto sería financiado por el BANHVI. Señala que aunque la Municipalidad de Nicoya no cuenta con el presupuesto para financiar este tipo de proyectos, si están anuentes en colaborar y facilitar condiciones para que se haga realidad, debido a que la situación se vuelve cada vez más difícil en el sitio para los vecinos de esa comunidad (véase informe y prueba aportada por el Alcalde Municipal Titular de Nicoya).

Hechos al Instituto de Acueductos y Alcantarillados Según Informe Técnico GSP-RCHO-2020-01211, de fecha 06 de mayo de 2020, suscrito por la ingeniera Rosa González Palma de la Dirección Regional se indica lo siguiente: “En lo que respecta al AyA, y la relación que tiene con el proyecto denominado Emanuel Ajoy y zonas circundantes, la Institución ha participado en diversas reuniones y ha escuchado las propuestas de mejora para dicha problemática que la Mutual Alajuela (como institución responsable por las obras a nivel financiero) ha presentado sobre la mesa, avocadas a la solución del manejo de Aguas Residuales (Anexo como prueba Minuta de la Reunión Grupo Mutual). La Génesis de dicho proyecto, no fue del todo clara, pues este proyecto no cuenta con expediente dentro de la institución (Ref : Oficio UEN-PC-2018-01577 adjunto) por lo que no podemos bajo las circunstancias actuales indicar técnicamente de forma clara el funcionamiento del sistema como tal; en este caso es ante todo una cuestión de responsabilidad del desarrollador el dar solución a un problema que como bien lo indica la interesada, atenta contra la Salud Pública, el ambiente y la calidad de vida de quienes se encuentran en el lugar” (véase informe y prueba aportada por el Jefe Cantonal de la oficina de Nicoya del Instituto de Acueductos y Alcantarillados).

Según oficio SG-GSP-RT-2019-00213, de fecha 18 de noviembre del 2019, suscrito por Álvaro Araya García, UEN Recolección y Tratamiento Periféricos, solicitó a la Subgerencia respectiva, que el proyecto de Nicoya como una solución integral, se elevara a instancias mayores, a fin de conseguir un financiamiento y poder enfrentar problemáticas como esta (véase informe y prueba aportada por el Jefe Cantonal de la oficina de Nicoya del Instituto de Acueductos y Alcantarillados).

IV. SOBRE EL DERECHO A UN AMBIENTE SANO Y ECOLÓGICAMENTE EQUILIBRADO

Debe indicarse, en primer lugar, que los derechos fundamentales a la salud y a un ambiente sano y ecológicamente equilibrado se encuentran reconocidos constitucionalmente (artículos 21, 50, 73 y 89, de la Constitución Política), así como, a través de la normativa internacional aplicable en Costa Rica. En este sentido, en Sentencia N° 2006-005928 de las 15:00 horas del 2 de mayo del 2006, este Tribunal resolvió: “(…) El derecho a la vida reconocido en el numeral 21 de la Constitución es la piedra angular sobre la cual descansan el resto de los derechos fundamentales de los habitantes de la república. De igual forma, en ese ordinal de la carta política encuentra asidero el derecho a la salud, puesto que, la vida resulta inconcebible si no se le garantizan a la persona humana condiciones mínimas para un adecuado y armónico equilibrio psíquico, físico y ambiental. Ahora bien, la salud pública y el derecho a un ambiente sano y ecológicamente equilibrado se encuentran reconocidos constitucionalmente en los artículos 21, 50, 73 y 89 de la Constitución Política.

Específicamente, el artículo 50 constitucional reconoce de forma expresa el derecho de todos los habitantes del país a disfrutar de un medio ambiente saludable y en perfecto equilibrio. Ese derecho es garantía fundamental para la protección de la vida y la salud pública. En apoyo de lo anterior este Tribunal ha recurrido a la utilización de la noción de “calidad ambiental” como un parámetro, precisamente, de la calidad de vida de las personas, que se conjuga con otros elementos tales como la salud, la alimentación, el trabajo y la vivienda, haciendo referencia a que toda persona tiene derecho a hacer uso del ambiente para su propio desarrollo pero no de manera ilimitada, ya que, también, existe un deber de protección y preservación del medio ambiente para las generaciones presentes y futuras –principio de desarrollo sostenible–”. Asimismo, del artículo 50, de la Constitución Política, se deriva la obligación del Estado de proteger el ambiente.

Norma que establece al efecto: "El Estado procurará el mayor bienestar a todos los habitantes del país, organizando y estimulando la producción y el más adecuado reparto de la riqueza. Toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado. Por ello está legitimada para denunciar los actos que infrinjan ese derecho y para reclamar la reparación del daño causado. El Estado garantizará, defenderá y preservará ese derecho. La ley determinará las responsabilidades y las sanciones correspondientes". Con lo que se corrobora que las distintas autoridades públicas tienen el deber ineludible de preservar, defender y garantizar el derecho fundamental de toda persona a la salud y a un ambiente sano y ecológicamente equilibrado.

V. SOBRE LA COORDINACIÓN DE LAS INSTITUCIONES PÚBLICAS EN LA PROTECCIÓN INTEGRAL AL AMBIENTE

Existe una obligación para el Estado -como un todo- de tomar las medidas necesarias para proteger el ambiente, a fin de evitar grados de contaminación, deforestación, extinción de flora y fauna, uso desmedido o inadecuado de los recursos naturales, que pongan en peligro la salud de los administrados. En esta tarea, por institución pública se entiende tanto a la Administración Central -Ministerios, como el Ministerio del Ambiente y Energía y el Ministerio de Salud-, que en razón de la materia, tienen una amplia participación y responsabilidad en lo que respecta a la conservación y preservación del ambiente; los cuales actúan, la mayoría de las veces, a través de sus dependencias especializadas en la materia. Del mismo modo, en esta tarea tienen gran responsabilidad las municipalidades en lo que respecta a su jurisdicción territorial. Debido a la diversidad de actores que pueden intervenir, podría pensarse que esta múltiple responsabilidad provocaría un caos en la gestión administrativa.

Por ello, a fin de evitar la coexistencia simultánea de esferas de poder de diferente origen y esencia, la duplicación de los esfuerzos nacionales y locales, así como la confusión de derechos y obligaciones entre las diversas partes involucradas, se hace necesario establecer una serie de relaciones de coordinación entre las diversas dependencias del Poder Ejecutivo y las instituciones descentralizadas, y entre éstas con las municipalidades, a fin de poder llevar a cabo las funciones que les han sido encomendadas. Esta Sala se ha referido ya al principio de coordinación de las dependencias públicas con las municipalidades en la realización de fines comunes, al señalar mediante Sentencia N° 5445-99, de las 14:30 horas del 14 de julio de 1999, que: "La coordinación es la ordenación de las relaciones entre estas diversas actividades independientes, que se hace cargo de esa concurrencia en un mismo objeto o entidad, para hacerla útil a un plan público global, sin suprimir la independencia recíproca de los sujetos agentes.

Como no hay una relación de jerarquía de las instituciones descentralizadas, ni del Estado mismo en relación con las municipalidades, no es posible la imposición a éstas de determinadas conductas, con lo cual surge el imprescindible «concierto» interinstitucional, en sentido estricto, en cuanto los centros autónomos e independientes de acción se ponen de acuerdo sobre ese esquema preventivo y global, en el que cada uno cumple un papel con vista en una misión confiada a los otros. Así, las relaciones de las municipalidades con los otros entes públicos, sólo pueden llevarse a cabo en un plano de igualdad, que den como resultado formas pactadas de coordinación, con exclusión de cualquier forma imperativa en detrimento de su autonomía, que permita sujetar a los entes corporativos a un esquema de coordinación sin su voluntad o contra ella; pero que sí admite la necesaria subordinación de estos entes al Estado y en interés de este (a través de la «tutela administrativa» del Estado, y específicamente, en la función de control la legalidad que a éste compete, con potestades de vigilancia general sobre todo el sector".

VI. SOBRE EL ÁREA RECTORA DE SALUD DEL MINISTERIO DE SALUD EN NICOYA EN EL CASO CONCRETO

En el presente proceso, la parte recurrente presenta recurso de amparo y expone que, vive en el Barrio San Martín, Nicoya. Afirma que el 19 de noviembre de 2018 denunció ante las autoridades recurridas, que todos los residentes del residencial Manuel Ajoy, desfogan las aguas negras de sus viviendas, sin tratamiento alguno, en la quebrada que pasa por el lugar. Agrega que como consecuencia de lo anterior, debe soportar los nauseabundos olores que de ahí salen. Además, los niños de su comunidad juegan en dicho riachuelo, pese a que las aguas se encuentran severamente contaminadas. Aunado a lo anterior, 5 meses después, no existe intervención alguna de las recurridas. Esa omisión, vulnera sus derechos fundamentales. Solicita que se declare con lugar el recurso. Del informe rendido por los representantes de las autoridades recurridas -que se tienen dado bajo juramento con las consecuencias, incluso penales, previstas en el artículo 44 de la Ley que rige esta Jurisdicción- y la prueba aportada para la resolución del sub judice, la Sala tiene por acreditado que el Equipo de Regulación del Área Rectora de Salud, indicó que no consta en los registros digitales del Equipo de Atención al Cliente ni en los expedientes administrativos abiertos a esa fecha, que la recurrente haya interpuesto denuncia alguna relacionada con la problemática por mala disposición de “aguas negras sin tratamiento alguno, en la quebrada que pasa por el lugar”.

Sin embargo, en la prueba aportada por la recurrente, consta que la denuncia fue interpuesta ante dicha autoridad el 19 de noviembre de 2018, indicando expresamente el problema de contaminación en la urbanización Manuel Ajoy en Nicoya. Dado que utilizan una quebrada para descarga de aguas negras. En razón de lo anterior, se logró acreditar que las autoridades accionadas del Ministerio de Salud no han atendido la denuncia interpuesta por la recurrente, razón por la cual procede la estimatoria del amparo en cuanto a dicha autoridad se refiere. Lo anterior de conformidad con lo indicado en la parte dispositiva de la presente resolución.

VII. SOBRE LA MUNICIPALIDAD DE NICOYA EN EL CASO CONCRETO

En cuanto a los hechos relacionados con el Gobierno Local accionado, a efectos de la resolución del presente proceso de amparo se tiene que el Departamento de Control Constructivo y Obra Pública señaló que desde el 2018 han participado en reuniones con las instancias AyA, Fundación Costa Rica Canadá, Grupo Mutual, Dirección de Aguas de MINAE, MIVAH y BANHVI, con el fin de coordinar sobre la problemática. Asimismo, indicaron que el proyecto inicial para la urbanización Emanuel Ajoy consiste en un sistema de recomendaciones de AyA, se pretende incluir además del proyecto Calderón Fournier dentro del sistema integral y el proyecto sería financiado por el BANHVI. Señala que aunque la Municipalidad de Nicoya no cuenta con el presupuesto para financiar este tipo de proyectos, si están anuentes en colaborar y facilitar condiciones para que se haga realidad, debido a que la situación se vuelve cada vez más difícil en el sitio para los vecinos de esa comunidad.

En ese sentido, aprecia esta Sala que si bien las autoridades administradoras del municipio accionado han intervenido a fin de dar solución de la problemática que se presenta en la localidad de la recurrente, lo cierto es que a la fecha, habiendo transcurrido un plazo desproporcionado, aun no se ha presentado alguna opción viable a efectos de atender la problemática de los vecinos del lugar, lo cual, a todas luces, vulnera los derechos fundamentales de la recurrente, razón por la cual el presente proceso debe ser estimado en cuanto a dicha autoridad se refiere.

VIII. SOBRE LA OFICINA DE NICOYA DEL INSTITUTO DE ACUEDUCTOS Y ALCANTARILLADOS

En lo que respecta al Instituto Costarricense de Acueductos y Alcantarillados, se acreditó que el proyecto denominado Emanuel Ajoy y zonas circundantes, la Institución ha participado en diversas reuniones y ha escuchado las propuestas de mejora para dicha problemática que la Mutual Alajuela (como institución responsable por las obras a nivel financiero) ha presentado sobre la mesa, avocadas a la solución del manejo de Aguas Residuales (Anexo como prueba Minuta de la Reunión Grupo Mutual). En este caso es ante todo una cuestión de responsabilidad del desarrollador el dar solución a un problema que como bien lo indica la interesada, atenta contra la Salud Pública, el ambiente y la calidad de vida de quienes se encuentran en el lugar. Adicionalmente, se mencionó de parte de la Unidad de Recolección y Tratamiento Periféricos, que se solicite a la Subgerencia respectiva, que el proyecto de Nicoya como una solución integral, se elevara a instancias mayores, a fin de conseguir un financiamiento y poder enfrentar problemáticas como esta.

Asimismo, consideran que el caso de Emanuel Ajoy, como urbanización establecida tiene como data del año 2003, y fue aprobada por el Ministerio de Salud en ese momento con una solución de tratamiento para sus aguas residuales con utilización de Tanque Séptico, esto como una deducción de lo inspeccionado. Puntualiza que si bien es cierto y como ya se ha indicado en la ciudad de Nicoya, existe un sistema de recolección y tratamiento de las aguas residuales, el mismo no estaba en ese momento ni mucho menos en el actual, preparado para recibir la cantidad de caudal que dispone el alrededor de 200 soluciones habitacionales de este proyecto. Así que si bien el proyecto se estableció como tal y fue construido sin los permisos por parte del AyA, nunca fue recibido por la institución. En lo que respecta al Instituto accionada considera esta Sala que el recurso también deviene en procedete toda vez que dicha autoridad aceptó tener conocimiento del asunto planteado en amparo, sin que a la fecha se llegara a alguna solución de la problemática planteada.

De conformidad con lo dicho, esta Sala considera que la recurrente lleva razón en sus alegatos y existe una lesión a sus derechos fundamentales. Efectivamente, acreditó este Tribunal Constitucional que transcurridos, aproximadamente, diecisiete meses desde que la amparada presentó su denuncia, si bien se han realizado acciones para atenderla, lo cierto es que, no pudo comprobarse que estas actuaciones para atender la denuncia le hayan sido comunicadas a la recurrente. En criterio de este Tribunal, el plazo transcurrido para informarle a la recurrente lo actuado resulta irrazonable. En consecuencia, se impone la estimatoria de este recurso de amparo, por infracción del artículo 41 constitucional. Asimismo, considera esta Sala que también ha transcurrido un plazo desproporcionado para la resolución final de la denuncia interpuesta por la tutelada. En merito de lo expuesto, procede la estimatoria del recurso, tal como se indica en la parte dispositiva de la presente resolución.

IX.Por último, debe indicarse que si las autoridades del Instituto Costarricense de Acueductos y Alcantarillados consideran que existe responsabilidad por parte de otras entidades, podrá emprender en la vía y jurisdicción ordinaria correspondiente las acciones para exigir las responsabilidades que entienda pertinentes por las acciones u omisiones que aduce.

X. NOTA DEL MAGISTRADO SALAZAR ALVARADO

En asuntos ambientales, es criterio del suscrito, que si ya ha habido intervención de la Administración Pública, su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que se acusan problemas de contaminación en el Barrio San Martín, Nicoya, provocado por los vecinos del residencial Manuel Ajoy, quienes se acusa desfogan las aguas negras y servidas, sin ningún tratamiento a la quebrada que pasa por el lugar. En este sentido, al verter estas aguas negras y aguas servidas se afecta la salud de los vecinos del lugar, con violación del derecho a disfrutar de un ambiente sano y ecológicamente equilibrado y de un nivel digno de calidad de vida.

XI. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

POR TANTO:

Se declara CON LUGAR el recurso. Se ordena a ZINNIA MARÍA CORDERO VARGAS, en su condición de Directora del Área Rectora de Salud del Ministerio de Salud en Nicoya, a MARCO ANTONIO JIMÉNEZ MUÑOZ, en su condición de Alcalde de Nicoya y, a MAX GÓMEZ MARTÍNEZ, en su condición de Jefe Cantonal de la oficina de Nicoya del Instituto de Acueductos y Alcantarillados o, a quienes ocupen esos cargos, que de forma INMEDIATA, a partir de la notificación de la presente resolución, de manera conjunta y coordinada dispongan lo necesario para asegurar temporalmente que no hayan afectaciones a la salud de las personas que habitan en el Barrio San Martín, Nicoya mientras se da una solución definitiva del problema objeto del presente proceso. Asimismo, dentro del plazo no mayor a VEINTICUATRO MESES, contados a partir de la notificación de esta sentencia, de forma conjunta y coordinada adopten las medidas que sean necesarias dentro del ámbito de sus respectivas competencias, a fin de que prevean y brinden una solución definitiva a la problemática ambiental del Barrio San Martín, Nicoya.

Se advierte a los recurridos que de conformidad con lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado, a la Municipalidad de Nicoya y al Instituto Costarricense de Acueductos y Alcantarillados al pago de las costas, daños y perjuicios ocasionados por los hechos que han dado lugar a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo.
