Amparo proceeding (recurso de amparo) processed under case file no. 20-005606-0007-CO, filed by TERESITA ALFARO SALAS, identity card no. 0107780344, against the MUNICIPALIDAD DE BARVA, the MINISTERIO DE SALUD, and the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (ICAA).

Findings:

  1. 1In a submission received by the Clerk’s Office of the Chamber at 8:08 on 18 de marzo de 2020, the petitioner filed an amparo proceeding against the Municipalidad de Barva. She states that she lives in Barva de Heredia, specifically on calle 2, between avenida central and avenida segunda, or seventy-five meters south of the municipal building. She states that, in front of the house where she lives, there is a storm drain that is full of water and has overflowed when it rains, even lightly. She adds that, in her view, part of the problem is the sewer system, which consists of an irrigation ditch (acequia) into which rainwater and wastewater (aguas servidas) flow—and possibly also sewage (aguas negras) from houses without septic tanks. She states that this affects them not only because of foul odors, mosquitoes, and other disease vectors, but also because the irrigation ditch passes beneath her home—and many others.She explains that other neighbors have also filed related complaints. She adds that the irrigation ditch is piped, but there is an obstruction because the water level has risen and even overflows when it is not raining. She mentions that the house was built fifty years ago; however, the population has grown, as has the amount of garbage and waste that ends up in the sewer system. She adds that this poses a problem for the house’s structure because the water causes erosion. She asserts that she submitted a complaint to the mayor’s personal email address but received no response. She states that, in diciembre de 2019, they paid for a cleaning service to determine whether there was any blockage or obstruction in the water channel beneath the house, but no such blockage was found. She affirms that they went to the Área Rectora de Salud de Barva; however, they were informed that the matter fell within the jurisdiction of the Municipalidad de Barva.She alleges that this entity has not assumed responsibility, despite payment of the applicable taxes. She requests that the municipality be ordered to resolve the problem in both the short and long term, since the consequences could become worse.
  2. 2By order issued at 15:37 on 20 de marzo de 2020, the amparo proceeding was admitted for processing. A report was also requested from the mayor, the head of the Departamento de Obras Civiles, and the head of the Departamento de Control Urbano, all of the Municipalidad de Barva.
  3. 3In a submission received by the Clerk’s Office of the Chamber at 14:37 on 30 de marzo de 2020, Claudio Manuel Segura Sánchez, Kattia Isella Ramírez Freer, and Joel Antonio Castillo Agüero, respectively the mayor, the head of the Departamento de Ingeniería, and the head of the Departamento de Obras Civiles, all of the Municipalidad de Barva, submitted a report under oath. They clarify that the following administrative files (expedientes administrativos) exist: “1. Administrative file compiled by the Alcaldía Municipal, entitled ‘ADMINISTRATIVE FILE OF MS. TERESITA ALFARO SALAS, MS. NORA SALAS GONZÁLEZ. MSMARIA DE LOS ANGELES ARGUEDAS MURILLO,’ hereinafter identified as the Mayor’s Office File; 2. Administrative file compiled by the Departamento de Ingeniería, entitled ‘ADMINISTRATIVE FILE TERESITA ALFARO SALAS IDENTITY CARD: 0107780344,’ hereinafter abbreviated as the Engineering File; 3.Administrative file compiled by the Departamento de Obras Civiles, entitled ‘FILE NO. 20-005606-0007-C0, PROCEEDING: AMPARO PROCEEDING, PETITIONER TERESITA MARÍA AUXILIADORA ALFARO SALAS,’ hereinafter abbreviated as the Civil Works File; and 4. Administrative file compiled by the Unidad Técnica de Gestión Vial, entitled ‘File “Irrigation Ditches I Storm Sewer Case, District #1 Barva”,’ hereinafter identified as the UTGV File.” They state that there is a storm-drain inspection chamber (caja de registro de alcantarilla) in front of the petitioner’s house. They note that she has lived there for years and that this is the first time she has approached the municipality to state that the storm drain exceeds its capacity to convey rainwater. They add that it is inaccurate to argue, as the claimant does, that the sewer system consists of an irrigation ditch into which rainwater and wastewater flow.They explain that natural channels run primarily from east to west through the central district of Barva, and that these originated when the land was used for farming and it was necessary to construct irrigation channels supplied by a river. They state that the channel in this specific case is the Quebrada Seca. They mention that, over the years, the irrigation channels ceased to function as such and became stormwater collection channels; however, some people illegally use them to discharge wastewater, which flows downhill toward the Quebrada Seca. They state that many Barva residents’ houses were built alongside these irrigation ditches and, over the years, structures were built over them. They add that this apparently applies to the entire block where the petitioner’s property is located. They allege that it is incorrect to state that a sewer system exists, because what exists is an irrigation ditch, located within private properties, into which rainwater and wastewater flow.They assert that it is inaccurate to state that the petitioner made an oral complaint; however, when she appeared to report that the storm drain was blocked, the mayor instructed an official to inspect it. They acknowledge that, on 30 de noviembre de 2019, the petitioner sent an email to the mayor’s personal email address and that, although this was not an official channel, it was duly processed by being forwarded to the head of the Departamento de Obras Civiles. They add that the Alcaldía informed the petitioner that the matter would be sent to that department for the corresponding investigation. They argue that official letter no. 189-DOCM-2019 clearly records that the Departamento de Obras Civiles cleaned the inspection chambers located within the public right-of-way (derecho de vía) and verified that they were unobstructed; it further stated that, notwithstanding the foregoing, water remained in the inspection chambers, making it likely that an obstruction exists on private property.They state that responsibility for cleaning and maintaining the irrigation ditches that cross the properties clearly rests with the property owners. They add that the owners themselves must determine whether any obstruction exists in the irrigation ditch within their property and attempt to remove it. They allege that the petitioner accepted this when she stated in her email of 30 de noviembre de 2019: “if it is a matter of inserting a probe, we will make the financial effort to hire a sanitary-cleaning company capable of investigating whether there is a blockage in the section of pipe that runs through our house.” They dispute the assertion that the local government failed to address the protected party’s request, since official letter no. 000189-DOCM-2019 was provided to her through official letter MB-AMB-1691-2019 of 20 de diciembre de 2019. They argue that the petitioner’s mother received that document on 7 de enero de 2020.They assert that the petitioner did not challenge the official letter. They state that they do not know whether the claimant took the action described in the initial filing. They add that they were unaware that the petitioner had approached the Área Rectora de Salud de Barva because she had submitted no evidence of this in the municipal files. They state that the complaints made by the other neighbors have each been handled individually. They state that the municipality does not know why the house was built over the irrigation ditch, which is contrary to the applicable regulations, and that the alleged situation was therefore probably also caused by the petitioner. They indicate that a solution should be pursued among the potentially affected parties because this is a problem involving private properties and buildings constructed over an irrigation ditch, even though the ditch is not in the public domain (dominio público).They state that they have no direct knowledge of the alleged public-health problem; however, the local government maintains an ongoing road-cleaning program that includes storm drains and stormwater conveyance systems located on public roads. They explain that each property owner is responsible for private property and that, if the petitioner believes she is being affected by another parcel of land, she must report it. They add that, if this is a sanitary problem, the governing and competent authority is the Ministerio de Salud. They request that the proceeding be dismissed.
  4. 4By order issued at 7:42 on 1o de abril de 2020, the parties to this proceeding were expanded, and a report was therefore requested from the director of the Área Rectora de Salud de Barva and the executive president of the Instituto Costarricense de Acueductos y Alcantarillados (ICAA).
  5. 5In a written submission incorporated into the digital case file at 9:06 hours on 8 de abril de 2020, Yamileth Astorga Espeleta, in her capacity as executive president of the Instituto Costarricense de Acueductos y Alcantarillados, submitted a report under oath. She states that the technical study submitted by Manuel López Fonseca, director of the Área de Recolección de y Tratamiento de GSGAM of the ICAA, may be summarized as follows: “• In Costa Rica there are two separate sewer systems, one known as the storm sewer system (Sistema de Alcantarillado Pluvial), whose purpose is to convey rainwater from roofs, gutters, and downspouts of homes, as well as rainwater flowing along public roads, and the other known as the sanitary sewer system (Sistema de Alcantarillado Sanitario), whose purpose is to convey only wastewater (aguas residuales) from laundry sinks, kitchen sinks, showers, and toilets generated inside homes. • Under the regulations currently in force, storm sewer systems are administered by the municipalities of each canton, while the sanitary sewer system is operated and maintained by the operator responsible for providing drinking-water service within its respective geographic service area. • In the canton of Barva, the Municipalidad is currently the operator of the drinking-water service and, consequently, is also responsible for administering, operating, and maintaining sanitary sewer services, if any. • If no sanitary sewer system exists, wastewater must be disposed of through individual systems, namely septic tanks (tanques sépticos) together with their respective drainage systems (drenaje). • A reading of the appeal filed by the appellant clearly shows that the problem occurring in front of her property is related to an obstruction in the storm sewer system or natural channel (canal natural) located both on the public road and within her property, creating a blockage that prevents the free flow of the rainwater and sewage discharged into that channel. • Although the Municipalidad de Barva cleaned a section of the channel or storm sewer, water continues to be impounded at some point along it, creating stagnation that produces foul odors and breeding grounds for mosquitoes and other vectors. • According to the Municipalidad de Barva, it cleaned the inspection chambers (cajas de registro) located on the public road, but this did not fully resolve the problem because a blockage remains.That Municipality states that the obstruction is located inside the homes and, because they are private property, it must be addressed by the owners, who constructed buildings over the irrigation ditch (acequia) or natural channel. • In addition, the municipal authorities state that, if this is an internal problem between adjoining properties, it must be resolved by the corresponding Área Rectora de Salud in order to determine whether one parcel is affecting another due to a health-related problem. Based on the foregoing, the following conclusions are reached: a) The operator of the drinking-water system and, consequently, of the sanitary sewer system (if any) in the canton of Barva de Heredia is the Municipalidad of that canton. b) The storm sewer system, whether called a natural channel, irrigation ditch, or by any other name, must be administered and consequently kept in proper operating condition by the municipality of each canton. c) The Instituto Costarricense de Acueductos y Alcantarillados (AyA) has no jurisdiction over or operational involvement in drinking-water or sanitation services or in the administration of the stormwater system, because it is not the operator of those services in the canton of Barva de Heredia and the canton is not within its geographic service area. d) The matter reported by Ms.Alfaro Salas clearly concerns a problem affecting a natural channel, irrigation ditch, or storm sewer that falls within the exclusive and determinative jurisdiction of the Municipalidad de Barva. Accordingly, that Municipality is responsible for ensuring and implementing the proper channeling of rainwater so that it flows freely to the discharge point, eliminating any obstruction encountered, even when the irrigation ditch is located on private property, because it is a public-domain asset (bien demanial) belonging to that municipality. In this regard, article 1 of the Ley de Construcciones N° 833 provides: ‘The Municipalities of the Republic are responsible for ensuring that cities and other population centers meet the necessary conditions of safety, healthfulness, convenience, and beauty on their public roads and in the buildings and structures erected on their lands, without prejudice to the powers granted by law in these matters to other administrative bodies.’ The Ley para la Gestión Integral de Residuos N° 88339 also provides in article 8.- Functions of the municipalities: Municipalities shall be responsible for the comprehensive management of waste (gestión integral de los residuos) generated in their canton. e) Provide cleaning services for gutters, irrigation ditches, culverts, roads, public spaces, rivers, and beaches, as applicable, as well as the sanitary handling of dead animals on public roads.” f) If the Municipalidad de Barba (sic) determines, based on its investigations of either the section of irrigation ditch or natural channel located on the public road or the section within the properties, that the matter involves improper wastewater disposal between neighboring parcels (fundos vecinos), it must refer the case to the Ministerio de Salud so that said entity may conduct the corresponding dye tests (pruebas de coloración) and determine whether wastewater leaking from the septic tank of another home is being discharged into the section of the irrigation ditch that runs beneath these properties.In this regard, the Ley General de Salud provides: ARTICLE 292.- The discharge of blackwater (aguas negras), sewage (aguas servidas), and industrial waste into the storm sewer is prohibited in all cases. The Ministerio is empowered to restrict, regulate, or prohibit the disposal of non-biodegradable synthetic products through systems for collecting excreta, blackwater, and sewage. ARTICLE 285.- Excreta, blackwater, sewage, and stormwater shall be disposed of properly and hygienically in order to prevent contamination of the soil and natural water sources intended for human use and consumption, the formation of breeding grounds for vectors and diseases, and air pollution through conditions that threaten its purity or quality. In accordance with the foregoing, we reirerate (sic) that AyA has no administrative or operational involvement in the canton of Barva because it lies outside its geographic service area, and the operator of both the drinking-water system and the storm sewer system (rainwater) is unquestionably the Municipalidad de Barva de Heredia.Accordingly, it must conduct the corresponding inspections and investigations to determine where the blockage or obstruction identified by the appellant is located, in order to ensure that rainwater flows freely through the channel in question and to prevent the water from overflowing or stagnating and producing foul odors in Ms. Alfaro Salas’s home. If it determines that this is an internal problem between properties, it is recommended that it coordinate with the canton’s Área Rectora de Salud so that the appropriate dye tests may be performed.” She states that the storm sewer system is under the responsibility of the Municipalidad de Barva and that a solution must be found for the stormwater drainage system (sistema de evacuación de aguas pluviales) that simultaneously relieves the blackwater system so that both operate independently and without affecting or interfering with each other.She adds that, under article 74 of the Código Municipal, the local government is responsible for cleaning, maintaining, and properly operating the stormwater network, for which it even charges the corresponding fee. She notes that the municipality has jurisdiction over land-use planning (planificación territorial) and must therefore assess which areas are vulnerable to flooding and prevent construction that creates risks. She argues that local governments have legal mechanisms for inspection and oversight, as well as the authority to halt construction projects carried out in violation of urban-planning regulations. She explains that the Municipalidad de Barva is required to ensure that its jurisdiction has adequate storm sewers and that the regulations currently in force are complied with so that neighboring parcels are not affected by runoff (escorrentía) or by the vulnerability of their land.She adds that the ICAA has no direct involvement in storm sewer works because, under articles 1 and 2 of its enabling law, it must issue regulations governing storm sewers; nevertheless, coordination took place with the municipality for the purpose of implementing the works necessary to resolve the problem. She adds that the ICAA has been replacing its sanitary sewer pipes to provide better wastewater service. She maintains that, under the Código Municipal and article 169 of the Constitución Política, the municipality is the entity originally and primarily responsible for safeguarding local interests and for implementing the actions necessary for the conduct of activities in its canton. She asserts that, pursuant to the Ley de Planificación Urbana, the municipality is responsible for requiring performance security backed by property (garantías reales de cumplimiento) for the construction and delivery of infrastructure works; moreover, it is required to provide its canton with storm sewers so as to prevent the risk of flooding, destruction of roads and properties, and potential landslides.She cites article 1 of the Ley de Construcciones: “The Municipalities of the Republic are responsible for ensuring that cities and other population centers meet the necessary conditions of safety, healthfulness, convenience, and beauty on their public roads and in the buildings and structures erected on their lands, without prejudice to the powers granted by law in these matters to other administrative bodies.” She indicates that article 60 of the Ley Orgánica del Ambiente provides the following regarding the prevention and control of pollution: “To prevent and control environmental pollution, the State, the municipalities, and other public institutions shall give priority, among other matters, to the establishment and operation of adequate services in areas essential to environmental health, such as: a) The supply of water for human consumption. b) The sanitary disposal of excreta, sewage, and stormwater. c) Waste collection and management. d) Control of air pollution. e) Control of conical pollution. f) Control of chemical and radioactive substances.These services shall be provided in the manner established by specific laws and regulations, while encouraging the participation of the population and its organizations.” She states that the municipality is responsible for verifying the proper operation and disposition of the stormwater network within its jurisdiction, in accordance with provision VI.6 of the Reglamento para el Control Nacional de Fraccionamiento y Urbanizaciones of INVU.

It notes that local governments are responsible for administering and collecting municipal taxes, fines, and service fees, which include maintenance of the stormwater drainage system; therefore, pursuant to the principles of reasonableness, justice, and legality, they must ensure the existence and maintenance of that system. It requests that the petition be denied.

  1. 6In a written submission entered into the digital case file (expediente digital) at 9:26 hours on 23 de abril de 2020, María Antonieta Acuña Hernández, in her capacity as director of the Área Rectora de Salud de San Rafael de Heredia, submitted a report under oath. She states that on 25 de noviembre de 2019, the entity she represents received by email a complaint filed by the petitioner, stating that there was an obstructed drain (alcantarilla) in front of her residence, which she suggests is an irrigation ditch (acequia); she further stated that it might be connected to a wastewater system (sistema de aguas residuales) carrying blackwater (aguas negras) or graywater (aguas servidas). She notes that, in response to the foregoing, on 10 de diciembre de 2019, Shirlley Quirós Pérez, environmental manager for that Área Rectora, inspected the site and, according to report MS-DRRSCN-DARSSRBT-IT-030-2020 issued by her, the obstruction of the drain was confirmed, and for that reason the dye tests (pruebas de coloración) would not yield objective results.She states that, through official letter MS-DRRSCN-DARSSRB-031-2020, Claudio Segura, mayor of Barva, was asked to address the obstruction of the drain. She contends that the case file contains a report dated 16 de diciembre de 2019 from the Departamento de Obras Civiles de la Municipalidad de Barva addressed to the mayor, which recorded that the situation described by the Ministerio de Salud involved a series of inspection chambers (cajas de registro) forming an irrigation ditch running from east to west and that the pipeline passes beneath the buildings in the block; it further stated that other points had been examined but no obstructions were found, and therefore the obstruction was presumed to be located somewhere in the block where the complainant resides. She adds that, in view of that situation, the aforementioned municipal department stated that it was necessary for the Departamento de Ingeniería to identify the properties in order to determine the extent of the pipeline obstruction on private properties, and that a stormwater drainage system (sistema de alcantarillado pluvial) should be built in the canton.She explains that, in compliance with the Chamber’s ruling, on 20 de abril de 2020, the aforementioned environmental manager conducted a new assessment and prepared inspection record MS-DRRSCN-DARSSRB-1125-2020, which stated that, according to information provided by a neighbor, cleaning work had been performed on the drain, but the problem persisted. She asserts that technical report MS-DRSCN-DARSSRB-1141-2020 concluded that a report from the Departamento de Ingeniería was required to locate the obstruction and subsequently conduct fluorescein dye tests (pruebas de fluorceína [coloración]) to determine which residences or establishments discharge their wastewater, whether blackwater or graywater, into the pipeline. She explains that the matter has been handled diligently and that, while the system—whether the pipeline or sewer—remains obstructed, it is impossible to conduct the technical tests needed to determine whether any of the petitioner’s neighbors, or the petitioner herself, are diverting wastewater, whether blackwater or graywater, because any illegal connections could produce false positives or cause confusion in the results.She adds that the pipeline must be cleared and an assessment made as to whether it should be sealed off or whether the water should be diverted, which falls within the jurisdiction of the local government. She states that the matter remains open and under review. She requests that the petition be dismissed because the complaint has been duly addressed and, given the complexity of the case, the dye tests cannot be conducted while the pipeline remains obstructed. She adds that the matter was referred to the competent authority and that, once the aforementioned pipeline has been cleared, the corresponding technical tests may be performed.
  2. 7The legal requirements have been observed in the proceedings conducted.

Justice Rueda Leal drafts the opinion; and,

Considering:

I.Subject matter of the petition. The petitioner, a resident of Barva de Heredia, specifically seventy-five meters south of the municipal building (calle 2, between avenidas central and segunda), states that in front of the house where she lives there is a drain that is full of water and has overflowed when it rains. She notes that part of the problem is the drainage system, which consists of an irrigation ditch into which rainwater (aguas llovidas) and graywater flow, and possibly also blackwater from houses without septic tanks. She states that the foregoing affects them not only because of the foul odors, mosquitoes, and other vectors, but also because the irrigation ditch passes beneath her residence, as well as many others. She explains that other neighbors have also filed related complaints. She adds that the irrigation ditch is piped, but there is an obstruction because the water level has risen and even overflows when it is not raining.

She asserts that the foregoing poses a problem for the structure of the house because the water causes erosion. She maintains that she submitted a complaint to the mayor’s personal email address but received no response. She states that they contacted the Área Rectora de Salud with jurisdiction over Barva; however, they were informed that the problem fell within the municipality’s jurisdiction. She asserts that the municipality has not assumed responsibility, despite the payment of the corresponding taxes. She requests that the municipality be ordered to resolve the problem in both the short and long term, as the consequences could become more serious.

II. Proven facts. The following facts are deemed established and relevant to the decision in this matter

The petitioner is a resident of Barva de Heredia, specifically seventy-five meters south of the municipal building (calle 2, between avenidas central and segunda). (Fact not disputed by the authorities of the Municipalidad de Barva).

The property and the structure occupied by the petitioner are crossed by an irrigation ditch that empties into a drain inspection chamber located on a public roadway.

In Barva’s central district, there are natural channels running from east to west that originate from a river and, in this particular case, from Quebrada Seca; in the past, these were used as irrigation channels, but over the years they became stormwater collection channels. (Report by the authorities of the Municipalidad de Barva).

The channels are not a sewer system (sistema de alcantarillado); rather, they are irrigation ditches that pass through private properties and receive rainwater and graywater. (Report by the authorities of the Municipalidad de Barva).

With respect to the Municipalidad de Barva:

On 30 de noviembre de 2019, the petitioner sent an email to the mayor of Barva’s personal email address, stating that there was a drain in front of her house that overflowed, which posed a problem for her mother and for her; she added that Nora Sala, her mother, had appeared at the municipality to report the problem. (Evidence submitted by the authorities of the Municipalidad de Barva).

On 10 de diciembre de 2020, the mayor replied to the complainant that the case had been referred to the head of the Departamento de Obras Civiles and that the Unidad Técnica de Gestión Vial was also aware of it. (Evidence submitted by the authorities of the Municipalidad de Barva) Through official letter n.° 189-DOCM-2019 dated 16 de diciembre de 2019 and addressed to the mayor, the Departamento de Obras Civiles recorded the following concerning the case: multiple complaints had been received from both residents and street-cleaning personnel; several weeks earlier, during an inspection, it had been determined that the drain located in front of Nora Salas’s property consisted of inspection chambers situated in one of the irrigation ditches that had existed in central Barva for many years; those irrigation ditches run from east to west, and buildings have been constructed over them; during the preceding week, the inspection chambers located within the public right-of-way (derecho de vía) had been cleaned, and it was confirmed that they contained no obstructions, although the accumulation of water continued; on 10 de diciembre de 2019, the site was inspected again, and a large amount of foul-smelling graywater on the verge of overflowing was observed, leading to the conclusion that there must be an obstruction on one of the properties located between the house of Nora Salas González and the house of Fernando Aguilar Vargas and Clara Rosa Murillo Ramírez; finally, the following was stated: “Because that obstruction is located within one of those properties, we are unable to correct the situation.

It is therefore recommended that the Departamento de Ingeniería be advised to conduct inspections of the properties so that municipal inspectors may identify points where alterations to the irrigation ditch may be observed, if any, and verify that construction carried out (sic) in recent years did not affect that irrigation ditch in that specific block, since these problems did not occur previously. The definitive solution to this situation and to others that may arise in the other irrigation ditches existing in central Barva is to plan for the construction of a stormwater collection and channeling system within the public right-of-way, which, due to its high cost and (sic) implications for traffic, should be developed in stages.” (Evidence submitted by the authorities of the Municipalidad de Barva) On 7 de enero de 2020, Nora Salas received official letter n.° 000189-DOCM-2019. (Evidence submitted by the authorities of the Municipalidad de Barva).

In official letter MB-UTGV-0014-2020 dated 10 de enero de 2020, issued in connection with a complaint filed by other residents of Barva, the head of the Unidad Técnica de Gestión Vial stated:

“In response to your complaint filed on 08 de enero del 2020, you are hereby informed that, since noviembre del 2019, the Departamento de Obras Civiles and the Unidad Técnica de Gestión Vial Municipal have received telephone complaints from residents living near the area, specifically regarding the case of Doña Nora Salas González, whose property is adversely affected by the problem in question. On 16 de diciembre del 2019, through official letter number 00189 addressed to the Alcalde Municipal, the situation occurring in the area was described, and it was also suggested that the complaint be referred to the Departamento de Ingeniería so that municipal inspectors could gain access to the area where the obstruction may be located. Likewise, we are aware that central Barva needs a new stormwater collection and channeling system, and, as the Unidad Técnica Vial, we are willing to bring this matter before the Junta Vial Cantonal so that the availability of budgetary funds for engineering studies may be considered for 2021; those studies would be (sic) the means of producing a complete technical and economic analysis of this project, which we understand will have to be implemented in stages because of its potential financial cost.” (Evidence submitted by the authorities of the Municipalidad de Barva).

On 24 de febrero de 2020, the petitioner submitted a letter to the Municipalidad de Barva concerning official letter n.° 000189-DOCM-2019, in which she stated that she had received no “binding information” regarding follow-up on the problem mentioned in that document; this submission was referred to the Departamento de Obra Civiles through official letter n.o MB-ING-111-2020 dated 2 de marzo de 2020. (Evidence submitted by the authorities of the Municipalidad de Barva).

The head of the Civil Works Department, by official letter (oficio) n.o MB-OC-0036-2020 of 4 de marzo de 2020 addressed to the head of the Engineering Department, inquired, for purposes of responding to the claimant (accionante), whether the suggestion contained in official letter n.° 000189-DOCM-2019 had been acted upon with regard to “Conducting inspections of the properties in order to identify points where alterations to the irrigation ditch (acequia) may be observed (if any exist) and verifying that construction carried out (sic) in recent years did not affect (sic) that irrigation ditch in that specific block, since these problems had not occurred previously.” (Evidence submitted by the authorities of the Municipalidad de Barva).

The head of the Engineering Department, by official letter n.° MB-ING-117-2020 of 4 de marzo de 2020 addressed to the head of the Civil Works Department, stated that official letter n.° 000189-DOCM-2019 was not in her files and, according to the 2019 records, had not been received. (Evidence submitted by the authorities of the Municipalidad de Barva).

The head of the Civil Works Department, by official letter n.o MB-OC-0037-2020 of 5 de marzo de 2020 addressed to the head of the Engineering Department, forwarded official letter n.° 000189-DOCM-2019 for analysis and assessment, as well as for the appellant’s (recurrente) request to be addressed. (Evidence submitted by the authorities of the Municipalidad de Barva).

The head of the Engineering Department, by official letter n.° MB-ING-120-2020 of 5 de marzo de 2020, referred the matter to an inspector for preparation of the corresponding report. (Evidence submitted by the authorities of the Municipalidad de Barva).

On 25 de marzo de 2020, the authorities of the Municipalidad de Barva were notified that these proceedings had been initiated. (Certificates of service (actas de notificación)).

The head of the Engineering Department, by official letter n.° MB-ING-140-2020 of 25 de marzo de 2020 addressed to the head of the Civil Works Department, stated:

“In response to the referenced official letter (…), and as you are aware, it was referred to Inspector Gustavo Guzmán Morales to conduct an inspection and submit a report on the matter. However, the case before us became difficult to address properly because the period for conducting the inspection coincided with the yellow alert taking effect and, subsequently, the state of National Emergency due to COVID-19, decreed by the General Government of the Republic.

In any event, official letter No 00189-DOCM-2019, which was forwarded to me by means of the official letter cited in the reference, will now be addressed:

FIRST: Official letter No MB-OC-00037-2020 and official letter No 00189-DOCM-2019, as you are aware, were referred to Inspector Gustavo Guzmán Morales for appropriate action. This was done by means of Official Letter No MB-ING-120-2020.

SECOND: With direct regard to the irrigation ditch at issue, it is a body of water that has always existed in the Canton, a situation known to the residents of the Distrito Central de Barva and, unquestionably and with even greater reason, to those persons who have built unlawfully over the irrigation ditch or whose property is crossed by it.

THIRD: With regard to the culverts (alcantarillas) located within the right-of-way (derecho de vía), as you are well aware, their cleaning and maintenance are the responsibility of the Municipality, in this case the department that you represent. However, irrigation ditches that pass through private property must be cleaned and maintained by the property owners. Those same owners must determine whether there is any obstruction in the irrigation ditch within the boundaries of their property and attempt to remove it.

FOURTH: In official letter No 00189-DOCM-2019, you indicate where the obstruction in the irrigation ditch is located (see image 4); therefore, the request you sent to the Engineering Department to identify what you call ‘alterations to the irrigation ditch’ is not understood, given that the location of the problem is already known.

FIFTH: As indicated in the second point of this official letter, the irrigation ditch has always existed in the Canton. This type of channel dates back to a time when the land was used for farming and it was necessary to construct irrigation channels, which branched off from a river. Over the years, these irrigation channels ceased to function as such and became stormwater (aguas pluviales) collection channels. However, according to what you describe, unscrupulous persons unlawfully discharge wastewater (aguas servidas) into those bodies. At present, given the condition of the irrigation ditch, it is not possible to verify which (sic) homes are committing this reckless act, since it is piped along most, if not all, of its course and, in some cases, old structures have been built over it.

SIXTH: It should be noted that if your department has already determined what (sic) the solution to the problem is, the appropriate course is to allocate resources: first, to conduct the required studies and, subsequently, to construct the works. In this regard, the Municipality must not channel wastewater through the same conduit as stormwater. The matter falls within the jurisdiction of the Ministerio de Salud, which is the governing body with authority over public health. Accordingly, Ms. Alfaro Salas should have filed a formal complaint with that institution.

SEVENTH (sic): The complaint filed by Msr. Teresita Alfaro Salas is not known to this office.” (Evidence submitted by the authorities of the Municipalidad de Barva).

The person in charge of the Unidad Técnica de Gestión Vial Municipal, in official letter n.° UTGV-0074-2020 of 26 de marzo de 2020 addressed to the mayor and a legal adviser, stated:

“In response to the amparo proceeding (recurso de amparo) Exp: No. 20-005606-0007-CO filed by (…) Teresita María auxiliadora (sic) Alfaro Salas, and in response to official letter MB-AMB-0327-2020 sent to this department on 25 de marzo of this year, I hereby inform you that, with respect to the appellant, there is no record of any request for inspection or complaint concerning wastewater and the (sic) irrigation ditches existing in district 1 of Barva.

Furthermore, with regard to the inadequate capacity of the piped irrigation ditches to accommodate stormwater, pursuant to this department’s official letter MB-UTGV-0025-2020 in response to the request from Ms. María de los Ángeles Arguedas Murillo, and in order to provide a comprehensive solution to the problem affecting not only the affected area but also district 1 of the canton of Barva, a design will be prepared, together with the corresponding studies, for a stormwater drainage system (canalización de aguas pluviales). Those designs would be (sic) prepared under the procurement process that this department is promoting (sic), which is in the final stages of preparation.

Lastly, within this department’s current capacity, coordination was undertaken with the Civil Works Department so that it would clean the inspection chamber (caja de registro) within the right-of-way and thereby eliminate foul odors in the affected areas.” (Evidence submitted by the authorities of the Municipalidad de Barva).

With regard to the Ministerio de Salud:

On 25 de noviembre de 2019, the Área Rectora de Salud de San Rafael-Barva received by email a complaint filed by the appellant, stating that: in front of her home there is a blocked drain that has overflowed when it rains; part of the problem is a piped irrigation ditch running beneath her house through which rainwater and wastewater flow, affecting them through foul odors and mosquito breeding; her mother is an older adult; the population has grown and garbage ends up in the sewer system; they filed the complaint with the municipality, but it did not resolve the matter; among other arguments. (Evidence submitted by the director of the Área Rectora de Salud de San Rafael de Heredia).

On 10 de diciembre de 2019, Shirlley Quirós Pérez, environmental manager for that Área Rectora, inspected the site and, according to report MS-DRRSCN-DARSSRBT-IT-030-2020 of 8 de enero de 2020 issued by her (served on the appellant on 17 de enero de 2020), stated that the problem did not fall within the jurisdiction of the Ministerio de Salud, but rather that of the municipality. (Evidence submitted by the director of the Área Rectora de Salud de San Rafael de Heredia).

The Área Rectora de Salud de San Rafael-Barva, by official letter MS-DRRSCN-DARSSRB-031-2020 of 8 de enero de 2020 addressed to the mayor of Barva, informed him that the reported problem fell within the jurisdiction of the Municipalidad de Barva. (Evidence submitted by the director of the Área Rectora de Salud de San Rafael de Heredia).

The administrative record (expediente administrativo) contains official letter n.o 00189-DOCM-2019 of 16 de diciembre de 2019 from the Civil Works Department of the Municipalidad de Barva. (Evidence submitted by the director of the Área Rectora de Salud de San Rafael de Heredia).

On 17 de abril de 2020, the director of the Área Rectora de Salud de San Rafael-Barva was notified that these proceedings had been initiated. (Certificate of service).

On 20 de abril de 2020, Shirlley Quirós Pérez, environmental manager for that Área Rectora, conducted a new assessment and prepared inspection record (acta de inspección) MS-DRRSCN-DARSSRB-1125-2020, which stated that, according to information provided by a neighbor, cleaning work had been performed on the drain, but the problem persisted. (Report of the director of the Área Rectora de Salud de San Rafael de Heredia).

Environmental manager Shirlley Quirós Pérez, by technical report MS-DRSCN-DARSSRB-1141-2020 of 21 de abril de 2020 addressed to the director of that Área Rectora, reported that the problem of the blocked drain persisted and that a report would be requested from the Engineering Department of the Municipalidad de Barva in order to follow up on the case. (Report of the director of the Área Rectora de Salud de San Rafael de Heredia).

The director of the Área Rectora de Salud de San Rafael-Barva, by official letter n.o MS-DRRSCN-DARSSRB-1143-2020 of 21 de abril de 2020 addressed to the mayor of Barva, stated:

“As a follow-up to official letter MS-DRRSCN-DARSSRB-031-2020 sent to you regarding the blocked drain located 75 south of the municipality, in which you were advised that it is the Municipality’s responsibility to take the necessary action, no response to the aforementioned official letter has been received to date.

In a conversation with the Head of Civil Works, he indicated that it was suggested that you refer the case to the Engineering Department so that it may inspect the properties and thereby identify the points where alterations to the irrigation ditch can be observed. You are therefore requested, within eight calendar days (días naturales) after receiving this official letter, to send this Área Rectora a report on the action taken in the case, so that the appropriate follow-up may be conducted.” (Evidence submitted by the director of the Área Rectora de Salud de San Rafael de Heredia).

III.Regarding the specific case. In the case at bar (sub lite), the petitioner (recurrente), a resident of Barva de Heredia, specifically seventy-five meters south of the municipal building (Calle 2, between Avenida Central and Avenida Segunda), states that there is a storm drain (alcantarilla) in front of the house where she lives, which is full of water and has overflowed when it rains. She notes that part of the problem is due to the drainage system (sistema de alcantarillado), which consists of a drainage ditch (acequia) into which rainwater (aguas llovidas) and wastewater (aguas servidas) flow (possibly also sewage (aguas negras) from houses without septic tanks), and that this affects them not only because of foul odors, mosquitoes, and other factors, but also because the drainage ditch runs beneath her home (and many others). She states that other residents have also filed related complaints.

She adds that the drainage ditch has been piped, but there is an obstruction because the water level has risen and it even overflows when it is not raining. She contends that the foregoing poses a problem for the structure of the house because the water erodes it. She maintains that she submitted a complaint to the mayor’s personal email address but received no response. She asserts that they approached the health governing area (área rectora de salud) corresponding to Barva; however, they were informed that the matter fell within the municipality’s jurisdiction. She contends that the municipality has not taken responsibility, despite the payment of the corresponding taxes. She requests that the municipality be ordered to resolve the problem in both the short and long term, since the consequences could be worse.

A review of the record (autos) establishes that the petitioner is a resident of Barva de Heredia, specifically seventy-five meters south of the municipal building (Calle 2, between Avenida Central and Avenida Segunda). The petitioner’s property and the structure she occupies are crossed by a drainage ditch that empties into a storm-drain inspection chamber (caja de registro de alcantarilla) located on a public right-of-way (vía pública). In the central district of Barva, there are natural channels running from east to west that originate from a river and, specifically in the case of Quebrada Seca, were formerly used as irrigation channels; however, over the years, they became stormwater collection channels (canales colectores de aguas pluviales). The channels are not a drainage system; rather, they are drainage ditches that cross private properties and into which rainwater and wastewater are discharged.

With regard to the Municipalidad de Barva, it was established that, on 30 de noviembre de 2019, the claimant (accionante) sent an email to the Barva mayor’s personal email address, stating that there was an overflowing storm drain (alcantarilla) in front of her house, which posed a problem for her and her mother; she added that Nora Sala, her mother, had appeared before the municipality to report the problem. On 10 de diciembre de 2020, the mayor replied to the complainant that the case had been referred to the head of the Department of Civil Works and that it was also known to the Technical Road Management Unit. The Department of Civil Works, by official letter (oficio) n.° 189-DOCM-2019 of 16 de diciembre de 2019 addressed to the mayor, stated the following in this regard: multiple complaints had been received from both residents and road-cleaning personnel; weeks earlier, during an inspection (inspección), it had been determined that the storm drain in front of Nora Salas’s property consisted of inspection boxes (cajas de registro) located in one of the ditches (acequias) that had existed in downtown Barva for many years.

Those ditches run from east to west, and buildings have been constructed over them; the previous week, the inspection boxes located within the right-of-way (derecho de vía) had been cleaned, and it was found that, although they were unobstructed, water continued to accumulate. On 10 de diciembre de 2019, the site was inspected again, and a large quantity of foul-smelling wastewater (aguas servidas) was found to be on the verge of overflowing; it was therefore determined that there must be an obstruction in one of the properties located between the home of Nora Salas González and the home of Fernando Aguilar Vargas and Clara Rosa Murillo Ramírez. Finally, it stated: “Because that obstruction is located within one of those properties, we are unable to correct the situation; accordingly, it is recommended that the Engineering Department be advised to inspect the properties in order to identify points where alterations to the ditch may be observed (if any) and to verify that construction work carried out in recent years has not affected that ditch within that specific block, since these problems did not occur previously.

The definitive solution to this situation and to others that may arise in the other ditches existing in downtown Barva is to consider constructing a stormwater (aguas pluviales) collection and conveyance system within the right-of-way, which, due to its high cost and implications for traffic, should be developed in stages.” On 7 de enero de 2020, Nora Salas received oficio n.° 000189-DOCM-2019. The head of the Technical Road Management Unit, by oficio MB-UTGV-0014-2020 of 10 de enero de 2020, in connection with a complaint filed by other Barva residents, stated: “In response to your complaint submitted on 08 de enero del 2020, you are hereby informed that, since noviembre del 2019, the Department of Civil Works and the Municipal Technical Road Management Unit have received telephone complaints from residents near the area, specifically regarding Doña Nora Salas González, whose property is being harmed by the problem in question.

On 16 de diciembre del 2019, through official letter number 00189 addressed to the Municipal Mayor, the situation occurring in the area was described, and it was also suggested that the complaint be referred to the Engineering Department so that municipal inspectors could gain access to the area where the obstruction may be located. Likewise, we are aware that downtown Barva needs a new stormwater collection and conveyance system, and, as the Technical Road Unit, we are willing to bring this matter before the Junta Vial Cantonal so that budgetary funding for engineering studies may be considered for 2021; those studies would provide a complete technical and economic analysis of this project, which we know must be carried out in stages because of its potential monetary cost.” On 24 de febrero de 2020, the petitioner (recurrente) submitted a letter to the Municipalidad de Barva concerning oficio n.° 000189-DOCM-2019, in which she stated that she had received no “pertinent information” regarding follow-up on the problem mentioned in that document; this submission was referred to the Department of Civil Works by oficio n.o MB-ING-111-2020 of 2 de marzo de 2020.

The head of the Department of Civil Works, by oficio n.o MB-OC-0036-2020 of 4 de marzo de 2020 addressed to the head of the Engineering Department, asked, for purposes of responding to the claimant, whether the recommendation contained in oficio n.° 000189-DOCM-2019 had been acted upon with respect to “Inspecting the properties in order to identify points where alterations to the ditch may be observed (if any) and verifying that construction work carried out in recent years did not affect that ditch within that specific block, since these problems did not occur previously.” The head of the Engineering Department, by oficio n.° MB-ING-117-2020 of 4 de marzo de 2020 addressed to the head of the Department of Civil Works, stated that oficio n.° 000189-DOCM-2019 did not appear in her files and, according to the 2019 records, had not been received. The head of the Department of Civil Works, by oficio n.o MB-OC-0037-2020 of 5 de marzo de 2020 addressed to the head of the Engineering Department, forwarded oficio n.° 000189-DOCM-2019 for analysis and assessment and so that the petitioner’s request could be addressed.

The head of the Engineering Department, by oficio n.° MB-ING-120-2020 of 5 de marzo de 2020, referred the matter to an inspector for preparation of the corresponding report. On 25 de marzo de 2020, the authorities of the Municipalidad de Barva were notified that these proceedings had been instituted. The head of the Engineering Department, by oficio n.° MB-ING-140-2020 of 25 de marzo de 2020 addressed to the head of the Department of Civil Works, stated: “In response to the aforementioned official letter (…), and as you are aware, it was referred to Inspector Gustavo Guzmán Morales to conduct an inspection and issue a report on the matter. However, the case before us became difficult to address properly because the time scheduled for the inspection coincided with the entry into effect of the yellow alert and, subsequently, the state of National Emergency due to COVID-19, decreed by the General Government of the Republic.

In any event, this communication will address official letter No 00189-DOCM-2019, which was forwarded to me through the official letter identified in the reference: FIRST: Official letter No MB-OC-00037-2020 and official letter No 00189-DOCM-2019, as you are aware, were referred to Inspector Gustavo Guzmán Morales for proper handling. This was done through Official Letter No MB-ING-120-2020. SECOND: With direct regard to the ditch at issue, it is a body of water that has always existed in the Canton, a fact known to the residents of the Central District of Barva and unquestionably, and all the more so, to those persons who have unlawfully constructed over the ditch or whose property is crossed by it. THIRD: With respect to the storm drains located within the right-of-way, as you well know, their cleaning and maintenance are the responsibility of the Municipality, in this case the department you represent.

However, the cleaning and maintenance of ditches crossing private property are the responsibility of the property owners. Those same owners must determine whether there is any obstruction in the portion of the ditch within their property and attempt to remove it. FOURTH: In official letter No 00189-DOCM-2019, you indicate where the obstruction in the ditch is located (see image 4); therefore, it is unclear why you are asking the Engineering Department to identify what you call ‘alterations to the ditch’ when the location of the problem is already known. FIFTH: As indicated in the second point of this official letter, the ditch has always existed in the Canton. The origin of channels of this type dates back to a time when the land was used for cultivation and it was necessary to construct irrigation channels, which branched off from a river. Over the years, these irrigation channels ceased to function as such and became stormwater collection channels.

However, as you describe, unscrupulous persons unlawfully discharge wastewater into those bodies of water. At present, and given the condition of the ditch, it is impossible to determine which homes are engaging in this reckless conduct because most, if not all, of its course has been placed in pipes and, in some cases, has old structures built over it. SIXTH: If your department has already determined the solution to the problem, the appropriate course is to allocate resources, first to conduct the required studies and subsequently to construct the works. In this regard, the Municipality must not convey wastewater through the same channels as stormwater. The matter falls within the jurisdiction of the Ministerio de Salud, which is the governing and competent authority in the field of public health. Accordingly, Mrs. Alfaro Salas should have filed a formal complaint with that institution.

SEVENTH: The complaint filed by Mrs. Teresita Alfaro Salas is not known to this office.” The head of the Municipal Technical Road Management Unit, in oficio n.° UTGV-0074-2020 of 26 de marzo de 2020 addressed to the mayor and a legal adviser, stated: “In response to the constitutional rights action (recurso de amparo) Exp: No. 20-005606-0007-CO filed by (…) Teresita María auxiliadora (sic) Alfaro Salas, and in response to official letter MB-AMB-0327-2020 sent to this department on 25 de marzo del presente año, I hereby inform you that, with respect to the petitioner, this department has no document containing a request for inspection or complaint concerning the wastewater and the ditches existing in district 1 of Barva. Furthermore, regarding the insufficient capacity of the piped ditches to carry stormwater, pursuant to official letter MB-UTGV-0025-2020 from this department in response to the request submitted by Mrs.

María de los Ángeles Arguedas Murillo, and in order to provide a comprehensive solution to the problem not only in the affected area but also throughout district 1 of the canton of Barva, a stormwater conveyance system will be designed, together with the corresponding studies. Those designs would be prepared under the procurement process that this department is conducting and that is in the final stages of preparation. Finally, within this department’s current capacity, coordination took place with the Department of Civil Works so that it would clean the inspection box within the right-of-way and thereby eliminate the foul odors in the affected areas.” With respect to the Ministerio de Salud, it was established that, on November 25, 2019, the Área Rectora de Salud de San Rafael-Barva received by email a complaint filed by the appellant, stating that: in front of her home there is a blocked storm drain (alcantarilla) that has overflowed when it rains; part of the problem is a piped drainage ditch (acequia entubada) running beneath her house through which stormwater (aguas llovidas) and sewage (aguas servidas) flow, affecting them because of foul odors and the breeding of mosquitoes; her mother is an older adult; the population has grown and garbage ends up in the sewer system; they filed the complaint with the municipality, but it did not resolve the matter; among other arguments.

On December 10, 2019, Shirlley Quirós Pérez, environmental manager for that health district, inspected the site and, according to report MS-DRRSCN-DARSSRBT-IT-030-2020 of January 8, 2020, issued by her and served on the appellant on January 17, 2020, stated that the problem did not fall within the jurisdiction of the Ministerio de Salud, but rather that of the municipality. Through official letter MS-DRRSCN-DARSSRB-031-2020 of January 8, 2020, addressed to the mayor of Barva, the Área Rectora de Salud de San Rafael-Barva informed him that the reported problem fell within the jurisdiction of the Municipalidad de Barva. The administrative record (expediente administrativo) contains official letter n.o 00189-DOCM-2019 of December 16, 2019, from the Departamento de Obras Civiles de la Municipalidad de Barva. On April 17, 2020, the director of the Área Rectora de Salud de San Rafael-Barva was notified that these proceedings had been instituted.

On April 20, 2020, Shirlley Quirós Pérez, environmental manager for that health district, conducted a new assessment and prepared inspection report MS-DRRSCN-DARSSRB-1125-2020, which recorded that, according to information provided by a neighbor, cleaning work had been performed on the storm drain, but the problem persisted. Through technical report MS-DRSCN-DARSSRB-1141-2020 of April 21, 2020, addressed to the director of that health district, this official reported that the blocked storm drain problem persisted and that a report would be requested from the Departamento de Ingeniería de la Municipalidad de Barva in order to follow up on the case. Through official letter n.o MS-DRRSCN-DARSSRB-1143-2020 of April 21, 2020, addressed to the mayor of Barva, the director of the Área Rectora de Salud de San Rafael-Barva stated: “In follow-up to official letter MS-DRRSCN-DARSSRB-031-2020 sent to you regarding the blocked storm drain located 75 meters south of the municipality, in which you were informed that it is the Municipality’s responsibility to take the necessary action, no response to the aforementioned letter has been received to date.

In a conversation with the Head of Civil Works, he indicated that it was suggested that you refer the case to the Departamento de Ingeniería so that it may inspect the properties and thereby identify the points where alterations to the drainage ditch are observed. You are therefore requested, within eight calendar days after receipt of this letter, to submit to this health district a report on the action taken in the case, so that the appropriate follow-up may be conducted.” Against this backdrop, the petition must be partially granted.

In this regard, it is apparent that neither the municipality nor the health district has adequately followed up on the problem brought to their attention by the appellant.

It is an undisputed fact that a drainage ditch runs beneath the property occupied by the petitioner and other nearby properties; what is decisive for purposes of this jurisdiction, however, is that not only stormwater (aguas pluviales) but also wastewater (aguas residuales) is discharged into it, reaching an inspection chamber (caja de registro) located on the public roadway and subsequently emptying into quebrada Seca.

The Municipalidad de Barva has known of the facts since at least December 2019, as it verified on site the presence of a large quantity of foul-smelling sewage on the verge of overflowing and acknowledged the need to ask the local government’s Departamento de Ingeniería to identify the locations of alterations and the structures built over the drainage ditch in recent years; it also proposed, as a permanent solution, the construction of a stormwater collection and channeling system. Nevertheless, more than three months later, there is no evidence that any action had been taken to seek a solution to the problem. Accordingly, in addition to the arguments developed below, it has not been established that the local government acted diligently. In this respect, the municipal authority cannot maintain that responsibility for cleaning the drainage ditch rests solely with the property owners when it does not know the cause of the problem; this position is also contradictory because it is further asserted that part of the solution is to invest in a stormwater collection and channeling system.

Now, based on the foregoing, it is a fact that wastewater is being discharged into the drainage ditch, causing foul odors, mosquitoes, and overflows, with the evident consequences this entails for public health. In this regard, the Ministerio de Salud has known of the reported facts since November 2019 and, precisely because of the public-health problems described, cannot simply state—as it did in report MS-DRRSCN-DARSSRBT-IT-030-2020 of January 8, 2020—that the problem does not fall within its jurisdiction. Moreover, the health authority merely referred the matter to the municipality, with no evidence that it adequately followed up on the facts, even though it has sufficient authority to issue health orders (órdenes sanitarias) to resolve the problems that arose. Indeed, it was only after being notified that these proceedings had been instituted that it sent a letter to the mayor of Barva following up on the reported situation and requesting that the Departamento de Ingeniería inspect the properties to identify alterations to the drainage ditch.

The health authority also stated under oath that a report from the municipality’s Departamento de Ingeniería was necessary to locate the obstruction and subsequently conduct fluorescein tests (pruebas de fluorceína) (dye testing) to determine which homes or establishments discharge their wastewater—blackwater or sewage (aguas negras o servidas)—into the pipe.

Based on the foregoing, once the cause of the problem has been determined, if the residents are discharging wastewater in violation of legal provisions, they must bring their situation into compliance with the municipal and public-health provisions applicable to the specific case, which must be enforced through the means established by the legal system for those purposes.

Furthermore, because the wastewater flows toward quebrada Seca, this is considered not only a public-health problem but also an environmental one, making the situation even more reprehensible.

For the reasons stated, the petition against the Municipalidad de Barva and the Área Rectora de Salud San Rafael-Barva must be granted on the terms set forth in the operative portion (parte dispositiva).

Finally, although the petition against ICAA is denied because it has not been involved in the events and no specific situation attributable to it was alleged, that authority shall take note so that, within the scope of its jurisdiction, it may provide any technical support requested by the health and municipal authorities.

IV.Note by Justice Hernández López regarding the claim alleging infringement of Article 50 of the Political Constitution (Constitución Política).

1. The historical context that once prompted the Chamber’s extensive intervention in environmental matters has changed considerably, requiring this body to reconsider the conditions governing its participation in safeguarding the right of individuals to a healthy and ecologically balanced environment (ambiente sano y equilibrado), as protected by Article 50 of the Political Constitution. Indeed, the current situation—characterized by a vast body of statutory and regulatory provisions encompassing substantive rules, procedures, and the creation of bodies responsible for enforcing the provisions of the Fundamental Charter—is radically different from the prior situation, in which the absence of legislation and of state bodies with appropriate jurisdiction compelled the Chamber to assume a leading, virtually exclusive role in defending the aforementioned constitutional right.

2. Today, we face a “dense framework” of environmental regulations, which has produced two significant phenomena: the first and most obvious is the emergence of comprehensive legal regulation of activities whose impact on the environment had previously been subject to little or no regulation, as well as the creation of state bodies vested with powers to monitor and control the effects of human activity on the environment. The second phenomenon is that this increasing legalization—predominantly through statutes and regulations—inevitably brings both administrative justice and the ordinary courts—primarily the administrative litigation jurisdiction (jurisdicción contencioso administrativa), but also the criminal jurisdiction—into play. Consistent with the importance of environmental law, broad procedural avenues and inclusive rules of standing (medios de legitimación) have been established in those forums so that governed persons may enforce the provisions of the extensive body of law relating to environmental matters.

3. In that context, it is inappropriate, both legally and functionally, for the Constitutional Chamber (Sala Constitucional) to displace or—worse still—replace the ordinary judicial bodies in performing their task, which is also of constitutional rank, of ensuring effective compliance with statutes and regulations. It is legally inappropriate because, in the vast majority of these cases, the Chamber is being asked to interpret and enforce statutory and regulatory provisions, thereby risking an overlap between its jurisdiction and that of other judicial bodies that were specifically created to perform those tasks; it is also functionally unsound because the design of its proceedings is ill-suited to the complexity present in numerous environmental disputes, which consist of technically and legally complex series of facts and acts. There are well-known examples concerning both issues in which the Chamber has issued a partial or technically incomplete ruling, or in which unnecessary friction and harm to legal certainty (seguridad jurídica) have arisen.

4. Among the technical considerations I have assessed, I would add that this jurisdiction has no judges responsible for enforcing judgments (jueces ejecutores de sentencia) who could adequately monitor compliance with such judgments—which are generally complex and sometimes entail monitoring remedial plans, among other matters, with interinstitutional coordination and follow-up lasting months or even years.

5. From that perspective, this Court’s decision to step aside in environmental matters should not be viewed as an abandonment of environmental protection, but rather, to the contrary, as ensuring its proper protection in the forum best suited to the nature of its complexity and diversity. Nor should it be viewed as this forum relinquishing its duty to protect the constitutional rights entrusted to it by the Political Constitution and its Organic Law (Ley Orgánica), a duty that, in my view, remains reserved in this area for specific cases. Rather, it is an exercise in reallocating the burdens and tasks assigned to the various state bodies so that each of them may fully perform its work within its assigned sphere, as well as an exercise of the authority to define its own jurisdiction, as provided in Article 7 of its Organic Law.

6. It is clear that the Chamber does not contemplate leaving the task of protecting individuals’ rights in environmental matters to other jurisdictions. It is well known that, although any claim concerning the violation of statutory and regulatory provisions may be brought within the constitutional sphere, there are cases whose resolution requires nothing more than the application of constitutional law. The aim, then, is for the Chamber to become one of several leading actors, so that—collectively, with each acting within its own sphere—they can cover the full range of situations involved in protecting the right to a healthy and balanced environment within a society in which other equally pressing needs also exist. With this position, I firmly believe that citizens do not lose the slightest degree of protection, while substantial gains are made in breadth, perspective, and respect for the balance and distribution of powers, the latter being a principle that must be taken into consideration because it governs the constitutional dynamics of every liberal and democratic system such as ours.- 7.

Consistent with the foregoing, I maintain that this Chamber should refrain from hearing claims brought before it for alleged violations of Article 50 of the Political Constitution, leaving their hearing and resolution to the administrative justice system and the administrative litigation jurisdiction (jurisdicción contenciosa administrativa). The foregoing is stated as a general principle, without prejudice to acknowledging the existence of particular cases or categories of cases that, in my judgment, would still be better protected by this Chamber and therefore should be heard and decided by it.- Among such categories of cases, without this enumeration being regarded as a closed and definitive list, I would note that the Chamber should retain jurisdiction over situations such as claims concerning environmental violations that also directly endanger human health or the availability or quality of water; and cases involving gross and direct violations of the environment in which there is a manifest absence of protection by state authorities, provided further that the nature of the claim allows it to be addressed through a writ of amparo (amparo) as a summary and special procedural remedy, because I also believe that the writ of amparo should not be converted into an ordinary proceeding in order to address, even in the cases cited, matters exceeding its capacity to deal with them adequately.

8. In this particular case, based on the facts found to have been proven, the petitioner’s claim could potentially affect her health and that of her family. Consequently, it is clear that this case falls within the exceptions mentioned, and for that reason I considered it necessary for the Chamber to exercise its jurisdiction in order to verify or rule out whether the alleged omissions violate the fundamental rights of the protected persons.

V.Note by Justice Salazar Alvarado. In environmental matters, it is the undersigned’s position that, if the Public Administration has already intervened, the hearing and resolution of the matter fall to the administrative litigation jurisdiction. Nevertheless, I do address the merits when other rights of the persons affected by the source of pollution are at stake, including health, quality of life, and the right to enjoy a healthy and pollution-free environment (Article 50 of the Political Constitution), as is the case here, in which allegations are made concerning pollution problems located seventy-five meters south of the Municipalidad de Barva (calle 2, between avenidas central and segunda), caused by a storm drain (alcantarilla) that is full of water and has overflowed when it rains. In this regard, because there are alleged illegal connections, there is an impact from sewage (aguas negras) and graywater (aguas servidas), which affects the health of local residents and violates the right to enjoy a healthy and ecologically balanced environment and a dignified quality of life.

VI.Documentation submitted to the case file. The parties are advised that, if they have submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device or produced using new technologies, these must be collected from the court within a maximum period of 30 business days from the date of notification of this judgment. Otherwise, any material not collected within that period will be destroyed, pursuant to the “Regulation on Electronic Case Files before the Judiciary” (“Reglamento sobre Expediente Electrónico ante el Poder Judicial”), approved by the Corte Plena at session N° 27-11 of 22 de agosto del 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 de enero del 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 de mayo del 2012, Article LXXXI.

Por tanto:

The petition is partially granted solely against the Municipalidad de Barva and the Área Rectora de Salud San Rafael-Barva.

  • 1)Claudio Manuel Segura Sánchez, Kattia Isella Ramírez Freer, and Joel Antonio Castillo Agüero, respectively mayor, head of the Departamento de Ingeniería, and head of the Departamento de Obras Civiles, all of the Municipalidad de Barva, or whoever holds their respective offices, as well as María Antonieta Acuña Hernández, in her capacity as director of the Área Rectora de Salud de San Rafael, or whoever holds that office, are ordered to coordinate such actions as may be necessary within the scope of their respective authority so that, within THREE MONTHS, a solution—together with the corresponding schedule and implementation period—is designed for the pollution problem caused by the wastewater (aguas residuales) flowing into the inspection box (caja de registro) in front of the property inhabited by the petitioner, specifically seventy-five meters south of the municipal building in Barva (calle 2, between avenidas central and segunda).
  • 2)Claudio Manuel Segura Sánchez, Kattia Isella Ramírez Freer, and Joel Antonio Castillo Agüero, respectively mayor, head of the Departamento de Ingeniería, and head of the Departamento de Obras Civiles, all of the Municipalidad de Barva, or whoever holds their respective offices, are ordered to issue the appropriate instructions and take the necessary measures so that, within a maximum period of ONE MONTH from the date of notification of this judgment, a study is prepared concerning the current condition of the drainage ditch (acequia) that empties into the inspection box located in front of the property inhabited by the petitioner, specifically seventy-five meters south of the municipal building in Barva (calle 2, between avenidas central and segunda), and to determine whether there are obstructions or other elements (such as unauthorized structures or otherwise) contributing to the reported wastewater problem. Once completed, this report must be sent immediately to the Área Rectora de Salud San Rafael-Barva.
  • 3)María Antonieta Acuña Hernández, in her capacity as director of the Área Rectora de Salud de San Rafael, or whoever holds her office, is ordered to IMMEDIATELY issue the appropriate instructions for interim measures (medidas provisionales) to be taken to address the wastewater overflows from the inspection box located in front of the property inhabited by the petitioner, specifically seventy-five meters south of the municipal building in Barva (calle 2, between avenidas central and segunda). Furthermore, upon learning of the obstructions or other conditions affecting the drainage ditch, she must conduct the appropriate tests and issue the corresponding health orders (órdenes sanitarias) so that the problem of the improper discharge of wastewater is addressed. The respondent authorities are warned that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, anyone who receives an order issued in a writ of amparo proceeding that must be complied with or enforced and fails to comply with or enforce it shall be sentenced to imprisonment for three months to two years or fined twenty to sixty days, provided that the offense is not subject to a more severe penalty. The State and the Municipalidad de Barva are ordered to pay the legal costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed during enforcement of the judgment before the administrative litigation jurisdiction. In all other respects, the petition is denied. The Instituto Costarricense de Acueductos y Alcantarillados shall take note of the matters stated in Considerando III. Justice Hernández López files a note. Justice Salazar Alvarado files a note. Let notice be given.

Revisión del Documento *200056060007CO* SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas quince minutos del veintinueve de mayo de dos mil veinte .

Recurso de amparo que se tramita en el expediente n. º 20-005606-0007-CO, interpuesto por TERESITA ALFARO SALAS, cédula de identidad n. º 0107780344, contra la MUNICIPALIDAD DE BARVA, el MINISTERIO DE SALUD y el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (ICAA).

Resultando:

  1. 1Por escrito recibido en la Secretaría de la Sala a las 8:08 horas de 18 de marzo de 2020, la recurrente interpone recurso de amparo en contra de la Municipalidad de Barva. Indica que vive en Barva de Heredia, específicamente en calle 2, entre las avenidas central y segunda, o bien, de la municipalidad setenta y cinco metros al sur. Señala que al frente de la casa que habita hay una alcantarilla que se encuentra llena de agua y se ha llegado a rebalsar cuando llueve, aunque sea de forma leve. Acota que, según su criterio, parte del problema es el sistema del alcantarillado que consiste en una acequia a la que van a dar las aguas llovidas y servidas (posiblemente también aguas negras de las casas que no tienen tanques sépticos). Refiere que lo anterior les afecta no solo por los malos olores o los zancudos y otros vectores, sino también porque la acequia pasa por debajo de su vivienda (y de muchas otras).Expone que otros vecinos también han formulado denuncias relacionadas. Añade que la acequia está entubada, pero existe una obstrucción pues el nivel de agua ha subido y hasta se rebalsa sin lluvia. Menciona que la casa se construyó hace cincuenta años; empero, la población ha crecido, así como también la cantidad de basura y residuos que terminan en el alcantarillado. Acota que lo expuesto representa un problema para la construcción de la casa, ya que el agua erosiona. Sostiene que planteó una queja al correo personal del alcalde, pero no obtuvo respuesta. Manifiesta que, en diciembre de 2019, pagaron un servicio de limpieza para verificar si existía algún atasco u obstrucción en el paso de agua que está debajo de la casa, pero ese no fue el caso. Asevera que acudieron al área rectora de salud que corresponde a Barva; sin embargo, les informaron que el problema era competencia de la Municipalidad de Barva.Aduce que ese ente no se ha hecho responsable, pese a que se cancelan los tributos correspondientes. Pide que se obligue a la municipalidad a resolver el problema tanto a corto como a largo plazo, ya que las consecuencias podrían ser peores.
  2. 2Mediante resolución de las 15:37 horas de 20 de marzo de 2020, se dio curso al amparo. Asimismo, se solicitó informe al alcalde, al jefe del Departamento de Obras Civiles y al jefe del Departamento de Control Urbano, todos de la Municipalidad de Barva.
  3. 3Por escrito recibido en la Secretaría de la Sala a las 14:37 horas de 30 de marzo de 2020, rinden informe bajo juramento Claudio Manuel Segura Sánchez, Kattia Isella Ramírez Freer y Joel Antonio Castillo Agüero, por su orden alcalde, jefa del Departamento de Ingeniería y jefe del Departamento de Obras Civiles, todos de la Municipalidad de Barva. Aclaran que existen los siguientes expedientes administrativos: “1. Expediente administrativo conformado en la Alcaldía Municipal denominado como "EXPEDIENTE ADMINISTRATIVO SRA. TERESITA ALFARO SALAS, SRA. NORA SALAS GONZÁLEZ. SRAMARIA DE LOS ANGELES ARGUEDAS MURILLO", identificado en lo sucesivo como Expediente de Alcaldía, 2. Expediente administrativo conformado en el Departamento de Ingeniería, denominado como "EXPEDIENTE ADMINISTRATIVO TERESITA ALFARO SALAS CÉDULA: 0107780344", en adelante abreviado como Expediente de Ingeniería, 3. Expediente administrativo conformado en el Departamento de Obras Civiles. denominado como "EXPEDIENTE N°20-005606-0007-C0, PROCESO: RECURSO DE AMPARO, RECURRENTE TERESITA MARÍA AUXILIADORA ALFARO SALAS", en lo sucesivo abreviado como Expediente de Obras Civiles y, 4.Expediente administrativo conformado en la Unidad Técnica de Gestión Vial, denominado como "Expediente "Caso acequias I alcantarillado Pluvial Distrito #1 Barva" en lo sucesivo identificado como Expediente de la UTGV”. Indican que al frente de la casa de la recurrente existe una caja de registro de alcantarilla. Señalan que ella tiene años de vivir ahí y es la primera vez que acude a la municipalidad a manifestar que la alcantarilla excede su capacidad de transportar aguas llovidas. Acotan que no es preciso argumentar, tal y como lo hace la accionante, que el sistema de alcantarillado consiste en una acequia a la que llegan aguas llovidas y servidas. Expresan que en el distrito central de Barva circulan canales naturales con dirección este a oeste principalmente y el origen de estos data de tiempos donde los terrenos eran utilizados para el cultivo y era necesaria la construcción de canales de riego provenientes de algún río.Refieren que en el caso concreto se trata de la Quebrada Seca. Mencionan que con el paso de los años los canales de riego dejaron de funcionar como tales y se convirtieron en canales colectores de aguas pluviales; sin embargo, algunas personas los utilizan ilegalmente para lanzar aguas servidas que por la pendiente escurren hacia la Quebrada Seca. Manifiestan que muchas de las casas de los habitantes de Barva se construyeron al lado de esas acequias y con los años se hicieron construcciones encima de ellas. Añaden que esto aparentemente es el caso de toda la cuadra donde se ubica el inmueble de la recurrente. Aducen que es incorrecto afirmar que existe un sistema de alcantarillado, ya que lo que existe es una acequia donde llegan las aguas llovidas y servidas, dentro de propiedades privadas. Sostienen que no es preciso afirmar que la recurrente planteó una queja verbal; empero, cuando se apersonó a exponer que la alcantarilla se encontraba atascada, el alcalde giró instrucciones a un funcionario para que la inspeccionara.Admiten que, el 30 de noviembre de 2019, la recurrente envió un correo a la dirección electrónica personal del alcalde y, pese a no ser un medio oficial, se le dio el trámite correspondiente al ser remitido al jefe del Departamento de Obras Civiles. Agregan que la alcaldía le indicó a la recurrente que se enviaría el caso a ese departamento para la indagación correspondiente. Arguyen que el oficio n.° 189-DOCM-2019 es claro consigna que el Departamento de Obras Civiles efectuó limpieza de las cajas de registro ubicadas en el derecho de vía, y corroboró que la inexistencia de obstrucciones en ellas; además, indicó que pese a lo anterior quedó agua en las cajas de registro, por lo que es probable que exista una obstrucción en alguna propiedad privada. Señalan que es claro que le corresponde a los dueños de las propiedades limpiar y mantener las acequias que las atraviesan. Acotan que son los propios dueños quienes deben determinar si en el espacio de su propiedad existe alguna obstrucción en la acequia y tratar de eliminarlo.Aduce que lo anterior es aceptado por la recurrente cuando manifestó en el correo del 30 de noviembre de 2019: “si se trata de meter una sonda nosotras vamos a hacer el esfuerzo económico de contratar a alguna empresa de limpieza sanitaria que pueda indagar si existe un atasco en la parte de la tubería que atraviesa nuestra casa”. Refutan que el gobierno local no haya atendido la gestión de la amparada, pues, por medio del oficio MB-AMB-1691-2019 de 20 de diciembre de 2019, se le hizo llegar el oficio n.° 000189-DOCM-2019. Arguyen que ese documento lo recibió la madre de la recurrente el 7 de enero de 2020. Sostienen que la recurrente no impugnó el oficio. Aseveran desconocer si la accionante realizó lo expuesto en el escrito de interposición. Acotan que desconocían que la parte recurrente haya acudido al Área Rectora de Salud de Barva, pues no ha adjuntado prueba en los expedientes municipales.Refieren que las denuncias de los demás vecinos han recibido un trato individual. Expresa que la municipalidad desconoce las razones por las cuales la vivienda fue construida sobre la acequia, lo cual es contrario a la normativa, por lo que la situación acusada probablemente estaría también provocada por la recurrente. Indican que la solución debería corregirse entre los posibles afectados al tratarse de un problema entre propiedades privadas y edificaciones construidas sobre una acequia, aunque esta no sea de dominio público. Manifiestan que no les consta el supuesto problema de salud pública; sin embargo, el gobierno local mantiene un programa constante de limpieza de vías que incluye las alcantarillas y sistemas de conducción de aguas pluviales que se encuentran en la vía pública. Explican que en el caso de la propiedad privada se debe encargar cada propietario del inmueble, por lo que si la recurrente considera que está sufriendo una afectación de otro fundo deberá denunciarlo. Añaden que, si se trata de un problema sanitario, el órgano rector y competente es el Ministerio de Salud. Solicita que se declare sin lugar el recurso.
  4. 4Mediante resolución de las 7:42 horas del 1o de abril de 2020, se ampliaron las partes de este proceso, por lo que se solicitó informe al director del Área Rectora de Salud de Barva y a la presidenta ejecutiva del Instituto Costarricense de Acueductos y Alcantarillados (ICAA).
  5. 5Por escrito incorporado al expediente digital a las 9:06 horas de 8 de abril de 2020, rinde informe bajo juramento Yamileth Astorga Espeleta, en su condición de presidenta ejecutiva del Instituto Costarricense de Acueductos y Alcantarillados. Señala que el estudio técnico rendido por Manuel López Fonseca, director del Área de Recolección de y Tratamiento de GSGAM del ICAA, se resume de la siguiente manera: “• En Costa Rica existen dos sistemas de alcantarillado separados, uno denominado “Sistema de Alcantarillado Pluvial” cuyo objetivo es transportar las aguas de lluvia provenientes de techos, canoas y bajantes de las viviendas, así como las aguas de lluvia que discurren por las vías públicas, y el otro sistema se denomina “Sistema de Alcantarillado Sanitario” cuyo objetivo es transportar únicamente las aguas residuales provenientes de pilas, fregaderos, duchas e inodoros que se generan a lo interno de las viviendas. • De acuerdo con la reglamentación vigente, los sistemas de alcantarillado pluvial son administrados por las municipalidades de cada cantón y el sistema de alcantarillado sanitario es operado y mantenido por el operador a cargo de prestar el servicio de agua potable dentro de su respectiva área geográfica de cobertura. • En el cantón de Barva, la Municipalidad es actualmente el operador del servicio de agua potable y por ende le corresponde además administrar, operar y mantener los servicios de alcantarillado sanitario si los hubiera. • En caso de no existir sistema de alcantarillado sanitario, la disposición de las aguas residuales debe realizarse mediante sistemas individuales a saber, tanques sépticos más su respectivo drenaje. • De la lectura del recurso planteado por la recurrente, se desprende claramente que el inconveniente que se presenta frente a su propiedad está relacionado con una obstrucción del sistema de alcantarillado pluvial o canal natural que se ubica tanto en la vía pública, como dentro de su propiedad, generando un taponamiento que no permite al libre traslado de las aguas llovidas y servidas que se descargan en dicho canal. • A pesar de haber realizado la Municipalidad de Barva una limpieza de un tramo del canal o alcantarillado pluvial, este sigue presentando una especie de represamiento de agua en algún punto de este, el cual genera un estancamiento que provoca malos olores y criadero de mosquitos y otros vectores. • Según lo argumentado por la Municipalidad de Barva, ellos realizaron una limpieza de las cajas de registro ubicadas en vía pública, pero esto no solucionó el problema integralmente ya que sigue habiendo un atasco, señala ese Municipio que la obstrucción se presenta a lo interno de las viviendas y que por ser propiedad privada debe ser atendido por los propietarios, ya que construyeron edificaciones sobre la acequia o canal natural. • De forma adicional, señalan las autoridades municipales que, si se trata de un problema a lo interno entre propiedades contiguas, esto debe ser solucionado por el Área Rectora de Salud correspondiente, a fin de determinar si existe afectación entre fundos por un problema sanitario.De acuerdo con lo señalado supra, se concluye lo siguiente: a) Que el operador del sistema de agua potable y por ende del sistema de alcantarillado sanitario (si lo hubiere) en el cantón de Barva de Heredia es la Municipalidad de dicho cantón. b) Que el sistema de alcantarillado pluvial, llámese canal natural, acequia o cualquiera otra denominación que se le quiera dar, debe ser administrado y por ende mantenido operando adecuadamente por la municipalidad de cada cantón. c) Que el Instituto Costarricense de Acueductos y Alcantarillados ( AyA ) no tiene competencia ni injerencia operativa en los servicios a agua potable, de saneamiento ni de administración del sistema pluvial, por no ser el operador de esos servicios en el cantón de Barva de Heredia ni por estar dentro de su área de cobertura geográfica. d) Que en el caso denunciado por la Sra. Alfaro Salas se evidencia claramente que se trata de un problema que se presenta en un canal natural, acequia o alcantarillado pluvial el cual es de competencia exclusiva y determinante de la Municipalidad de Barva, por lo que en ese sentido le corresponde velar y resolver la adecuada canalización de las aguas de lluvia, a fin de garantizar que las mismas fluyan libremente hasta punto de descarga eliminando cualquier obstrucción que se presente, aún y cuando la acequia se ubique en propiedad privada, siendo que se trata de un bien demanial que pertenece a ese municipio.En sentido señala el artículo 1 de la Ley de Construcciones N° 833 : "Las Municipalidades de la República son las encargadas de que las ciudades y demás poblaciones reúnan las condiciones necesarias de seguridad, salubridad, comodidad y belleza en sus vías públicas y en los edificios y construcciones que en terrenos de estas se levanten sin perjuicio de las facultades que las leyes les concedan en estas materias a otros órganos administrativos". Señala además la Ley para la Gestión Integral de Residuos N° 88339 artículo 8.- Funciones de las municipalidades: Las municipalidades serán responsables de la gestión integral de los residuos generados en su cantón. e) Proveer de los servicios de limpieza de caños, acequias, alcantarillas, vías, espacios públicos, ríos y playas cuando corresponda, así como del manejo sanitario de animales muertos en la vía pública” f) Que si la Municipalidad de Barba (sic) determina según las investigaciones que realice tanto en el tramo de acequia o canal natural ubicado en vía pública o a lo interno de las propiedades, que se trata de una inadecuada disposición de las aguas residuales entre fundos vecinos, le corresponde trasladar el caso al Ministerio de Salud, para que esta entidad realice las pruebas de coloración respectivas y determine si se trata de la filtración de aguas residuales provenientes del tanque séptico de otra vivienda que estén descargando al tramo de acequia que pasa por debajo de estas propiedades.En este sentido señala la Ley General de Salud: ARTÍCULO 292.- Queda prohibido en todo caso la descarga de las aguas negras, de las aguas servidas y de residuos industriales al alcantarillado pluvial. El Ministerio queda facultado para restringir, regular, o prohibir la eliminación de productos sintéticos no biodegradables a través de los sistemas de recolección de excretas, aguas negras y servidas. ARTÍCULO 285.- Las excretas, las aguas negras, las servidas y las pluviales, deberán ser eliminadas adecuada y sanitariamente a fin de evitar la contaminación del suelo y de las fuentes naturales de agua para el uso y consumo humano, la formación de criaderos de vectores y enfermedades y la contaminación del aire mediante condiciones que atenten contra su pureza o calidad. Conforme lo anterior, reireramos (sic) AyA no tiene ninguna injerencia administrativa ni operativa en el cantón de Barva, siendo que se encuentra fuera de su ubicación de cobertura geográfica y el operador tanto del sistema de agua potable, como del sistema de alcantarillado pluvial (aguas de lluvia) indefectiblemente es la Municipalidad de Barva de Heredia, por lo que en ese sentido debe realizar las inspecciones e investigaciones respectivas para determinar en qué lugar se ubica el taponamiento u obstrucción señalado por la recurrente, a fin de garantizar que las aguas de lluvia discurran libremente por el canal señalado y evitar que el agua se rebalse o se estanque generando malos olores en la vivienda de la Sra. Alfaro Salas.En caso de determinar que se trata de un problema interno entre propiedades se recomienda que coordine con el Área Rectora de Salud del Cantón, a fin de que realicen las pruebas de coloración que correspondan”. Señala que el alcantarillado pluvial se encuentra bajo responsabilidad de la Municipalidad de Barva y se debe buscar una solución respecto al sistema de evacuación de aguas pluviales que al mismo tiempo libere el sistema de aguas negras, para que ambos funcionen de manera independiente y sin afectación o interferencia entre uno y otro. Acota que, de acuerdo con el artículo 74 del Código Municipal, es obligación del gobierno local la limpieza, el mantenimiento y la adecuada operación de la red pluvial, para lo cual incluso cobra la tasa correspondiente. Refiere que la municipalidad tiene competencia en materia de planificación territorial, por lo que debe valorar cuáles áreas son vulnerables a las inundaciones y evitar construcciones que generen riesgo.Aduce que los gobiernos locales cuentan con mecanismos legales de inspección, control y con la potestad de paralizar obras que se construyen al margen de la normativa referente a planificación urbana. Explica que la Municipalidad de Barva es la obligada de velar que en su jurisdicción haya un adecuado alcantarillado pluvial y se cumpla la normativa vigente de manera que predios vecinos no se vean afectados por la escorrentía o la vulnerabilidad de sus terrenos. Añade que el ICAA carece de injerencia directa en obras de alcantarillado pluvial, ya que, según los artículos 1 y 2 de su le constitutiva, debe girar normativa en materia de alcantarillado pluvial; sin embargo, se coordinó con la municipalidad a efectos de generar las obras necesarias para solventar la problemática. Añade que el ICAA ha venido sustituyendo sus tuberías de alcantarillado sanitario, para brindar un mejor servicio en el tema de las aguas residuales.Sostiene que, según el Código Municipal y el artículo 169 de la Constitución Política, la municipalidad es el ente que debe velar por los intereses locales en forma originaria y primaria, así como instrumentalizar las acciones necesarias para el desarrollo de las actividades en su cantón. Asevera que, conforme a la Ley de Planificación Urbana, le competente a la municipalidad exigir las garantías reales de cumplimiento en la construcción y entrega de las obras de infraestructura; además, se encuentra obligada a dotar a su cantón de alcantarillado pluvial, de manera que se eviten riesgos de inundación, destrucción de vías, propiedades y eventuales derrumbes. Cita el artículo 1 de la Ley de Construcciones: “Las Municipalidades de la República son las encargadas de que las ciudades y demás poblaciones reúnan las condiciones necesarias de seguridad, salubridad, comodidad y belleza en sus vías públicas y en los edificios y construcciones que en terrenos de estas se levanten sin perjuicio de las facultades que las leyes conceden en estas materias a otros órganos administrativos”.Indica que el artículo 60 de la Ley Orgánica del Ambiente establece, sobre la prevención y control de la contaminación: “Para prevenir y controlar la contaminación del ambiente, el Estado, las municipalidades y las demás instituciones públicas, darán prioridad, entre otros, al establecimiento y operación de servicios adecuados en áreas fundamentales para la salud ambiental, tales como: a) El abastecimiento de agua para consumo humano. b) La disposición sanitaria de excretas, aguas servidas y aguas pluviales. c) La recolección y el manejo de desechos. d) El control de contaminación atmosférica. e) El control de la contaminación cónica. f) El control de sustancias químicas y radiactivas. Estos servicios se prestarán en la forma que las leyes y los reglamentos específicos lo determinen, procurando la participación de la población y sus organizaciones”. Señala que la municipalidad se encuentra encargada de verificar que en su jurisdicción se de un correcto funcionamiento y disposición de la red pluvial, de acuerdo con el numeral el numeral VI.6 del Reglamento para el Control Nacional de Fraccionamiento y Urbanizaciones del INVU.Acota que a los gobiernos locales les compete la administración y cobro de los impuestos, multas y servicios municipales, dentro de los cuales se ubica el mantenimiento de la red pluvial, por lo que, en aplicación de los principios de razonabilidad, justicia y legalidad, deben de velar por la existencia y mantenimiento de la red pluvial. Solicita que se declare sin lugar el recurso.
  6. 6Por escrito incorporado al expediente digital a las 9:26 horas de 23 de abril de 2020, rinde informe bajo juramento María Antonieta Acuña Hernández, en su condición de directora del Área Rectora de Salud de San Rafael de Heredia. Indica que el 25 de noviembre de 2019 su representada recibió por correo electrónico una denuncia formulada por la recurrente, en la que se señaló que al frente de su vivienda había una alcantarilla obstruida, la cual sugiere que es una acequia; además, manifestó que existía la posibilidad de que se encontrara conectada a algún sistema de aguas residuales (negras o servidas). Acota que, en atención de lo anterior, el 10 de diciembre de 2019, Shirlley Quirós Pérez, gestora ambiental de esa área rectora, inspeccionó el sitio y, según el informe MS-DRRSCN-DARSSRBT-IT-030-2020 emitido por ella, se evidenció la obstrucción de la alcantarillo y que por esa razón no sería objetivas las pruebas de coloración.Refiere que, por oficio MS-DRRSCN-DARSSRB-031-2020, se solicitó a Claudio Segura, alcalde de Barva, que diera atención a la obstrucción de la alcantarilla. Arguye que, en el expediente consta un informe de 16 de diciembre de 2019 del Departamento de Obras Civiles de la Municipalidad de Barva dirigido al alcalde, en el que se consignó que la situación referida por el Ministerio de Salud corresponde a una serie de cajas de registro que configuran una acequia con recorrido de este a oeste y que la tubería pasa por debajo de las edificaciones del cuadrante; además, que se recorrieron otros puntos, pero no se encontraron obstrucciones, por lo que se presume la obstrucción en algún punto del cuadrante en el que habita la denunciante. Añade que, ante esa situación, el departamento municipal mencionado señaló que era necesario que el Departamento de Ingeniería identificara las propiedades para determinar el nivel de obstrucción de la tubería en las propiedades privadas, así como que se debía construir un sistema de alcantarillado pluvial en el cantón.Explica que, en atención a la resolución de la Sala, el 20 de abril de 2020, se efectuó una nueva valoración por parte de la gestora ambiental referida, quien elaboró el acta de inspección MS-DRRSCN-DARSSRB-1125-2020, en la que se consignó que, según información suministrada por una vecina, se realizaron trabajos de limpieza en la alcantarilla, pero el problema persiste. Aduce que, mediante informe técnico MS-DRSCN-DARSSRB-1141-2020, se concluyó que era necesario un informe del Departamento de Ingeniería para encontrar el sitio de la obstrucción y, posteriormente, poder realizar las pruebas de fluorceína (coloración) con el fin de determinar cuáles viviendas o establecimientos depositan sus aguas residuales (negras o servidas) a la tubería. Explica que se ha dado una diligente atención al caso y, mientras se mantenga la obstrucción del sistema (tubería o alcantarillado), es imposible realizar las pruebas técnicas para determinar si existe desvío de aguas residuales (negras o servidas) de algunos de los vecinos de la recurrente o de ella misma, ya que si hay conexiones ilegales podrían darse falsos positivos o confusión en los resultados.Agrega que se requiere desobstruir la tubería y valorar si condenarla o buscar algún desvío de aguas, lo cual le compete al gobierno local. Afirma que el asunto se encuentra abierto y en seguimiento. Solicita que se declare sin lugar el recurso, porque se ha dado una debida atención a la denuncia y por la complejidad del caso no se pueden efectuar las pruebas de coloración en el tanto se mantenga la obstrucción de la tubería. Añade que el asunto se trasladó para que fuera atendido por la instancia competente y, una vez desobstruida la tubería referida, se podrán realizar las pruebas técnicas correspondientes.
  7. 7En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta el Magistrado Rueda Leal; y,

Considerando:

I.Objeto del recurso. La recurrente, vecina de Barva de Heredia, específicamente de la municipalidad setenta y cinco metros al sur (calle 2, entre las avenidas central y segunda), señala que al frente de la casa que habita hay una alcantarilla que se encuentra llena de agua y se ha llegado a rebalsar cuando llueve. Acota que parte del problema es el sistema del alcantarillado que consiste en una acequia a la que van a dar las aguas llovidas y servidas (posiblemente también aguas negras de las casas que no tienen tanques sépticos). Refiere que lo anterior les afecta no solo por los malos olores o los zancudos y otros vectores, sino también porque la acequia pasa por debajo de su vivienda (y de muchas otras). Expone que otros vecinos también han formulado denuncias relacionadas. Añade que la acequia está entubada, pero existe una obstrucción pues el nivel de agua ha subido y hasta se rebalsa sin lluvia.

Aduce que lo expuesto representa un problema para la construcción de la casa, ya que el agua erosiona. Sostiene que planteó una queja al correo personal del alcalde, pero no obtuvo respuesta. Asevera que acudieron al área rectora de salud que corresponde a Barva; sin embargo, les informaron que el problema era competencia de la municipalidad. Aduce que ese ente no se ha hecho responsable, pese a que se cancelan los tributos correspondientes. Pide que se obligue a la municipalidad a resolver el problema tanto a corto como a largo plazo, ya que las consecuencias podrían ser peores.

II. Hechos probados. De importancia para la decisión de este asunto, se estiman como demostrados los siguientes hechos

La recurrente es vecina de Barva de Heredia, específicamente de la municipalidad setenta y cinco metros al sur (calle 2, entre las avenidas central y segunda). (Hecho incontrovertido por parte de las autoridades de la Municipalidad de Barva).

La propiedad y la construcción habitada por la recurrente es atravesada por una acequia que desemboca en una caja de registro de alcantarilla que se encuentra sobre vía pública.

En el distrito central de Barva hay canales naturales con dirección este a oeste provenientes de algún río y, en el caso concreto, de la Quebrada Seca; estos se usaron tiempo atrás como canales de riego; sin embargo, con el paso de los años se convirtieron en canales colectores de aguas pluviales. Los canales no son un sistema de alcantarillado, sino que constituyen acequias que pasan por propiedades privadas en las que se vierten aguas llovidas y servidas. (Informe de las autoridades de la Municipalidad de Barva).

En relación con la Municipalidad de Barva:

El 30 de noviembre de 2019, la recurrente envió un correo a la dirección electrónica personal del alcalde de Barva en el que indicó que al frente de su casa hay una alcantarilla que se desborda, lo que representaba un problema para su mamá y para ella; añadió que Nora Sala, quien es su mamá, se había apersonado a la municipalidad a exponer el problema. (Prueba aportada por las autoridades de la Municipalidad de Barva).

El 10 de diciembre de 2020, el alcalde le contestó a la denunciante que el caso había sido trasladado al jefe del Departamento de Obras Civiles y, además, que era de conocimiento de la Unidad Técnica de Gestión Vial. (Prueba aportada por las autoridades de la Municipalidad de Barva) El Departamento de Obras Civiles, mediante oficio n.° 189-DOCM-2019 de 16 de diciembre de 2019 dirigido al alcalde, consignó sobre el caso lo siguiente: se han recibido múltiples denuncias, tanto de los vecinos como de los funcionarios de limpieza de vías; semanas atrás, con ocasión de una inspección, se determinó que la alcantarilla ubicada al frente de la propiedad de Nora Salas, se encuentra conformada por cajas de registro ubicadas en una de las acequias que han existido en el centro de Barva desde hace muchos años; tales acequias tienen dirección este a oeste y sobre ellas se han construido edificaciones; la semana anterior se hizo una limpieza de las cajas de registro ubicadas sobre el derecho de vía y se constató que no hay obstrucciones en ellas, pero que la acumulación de aguas se mantuvo; el 10 de diciembre de 2019 se inspeccionó nuevamente el lugar y se constató una gran cantidad de aguas servidas con mal olor a punto de rebalsarse, por lo que se determinó que debía existir una obstrucción en alguna de las propiedades ubicadas entre la casa de Nora Salas González y la casa de Fernando Aguilar Vargas y Clara Rosa Murillo Ramírez; finalmente, se mencionó lo siguiente: “Debido a que dicha obstrucción se encuentra dentro de alguna de esas propiedad, se nos imposibilita corregir la situación, por lo que se recomienda: Sugerirle al Departamento de Ingeniería realizar inspecciones a las propiedad para lograr identificar puntos donde se puedan observar alteraciones a la acequia (de existir alguna) y verificar que construcciones que se hallan (sic) realizado en los últimos años no afectasen dicha acequia en ese cuadrante específico, ya que anteriormente no se presentaban estos problemas.

La solución definitiva para esta situación y otras que pueden surgir en las demás acequias que existen en el centro de Barva, es contemplar la construcción de un sistema de recolección y canalización de aguas pluviales que sea implementado dentro del derecho de vía, que por su elevado costo he (sic) implicaciones en el tránsito, sea desarrollado por etapas”. (Prueba aportada por las autoridades de la Municipalidad de Barva) El 7 de enero de 2020, Nora Salas recibió el oficio n.° 000189-DOCM-2019. (Prueba aportada por las autoridades de la Municipalidad de Barva).

El encargado de la Unidad Técnica de Gestión Vial, por oficio MB-UTGV-0014-2020 de 10 de enero de 2020, con ocasión de una denuncia planteada por otros vecinos de Barva, indicó:

“En atención a su denuncia presentada el 08 de enero del 2020, se le informa que, desde noviembre del 2019, el Departamento de Obras Civiles y la Unidad Técnica de Gestión Vial Municipal, recibió denuncias telefónicas por parte de vecinos aledaños a la zona, en el caso específico de Doña Nora Salas González, donde su propiedad se ve perjudicada por el problema en cuestión. Con fecha 16 de diciembre del 2019, mediante número de oficio 00189, dirigido al Alcalde Municipal, se le expuso la situación acontecida en la zona, también se le hizo la sugerencia de elevar la denuncia ante el Departamento de Ingeniería, para que mediante los inspectores municipales puedan tener acceso a la zona donde posiblemente se encuentre la obstrucción. Así mismo, somos conscientes que el casco central de Barva, necesita un nuevo sistema de recolección y canalización de aguas pluviales y como Unidad Técnica Vial, estamos anuentes a contemplar este tema ante la Junta Vial Cantonal, para que se valore para el 2021, la disposición presupuestaria para los estudios de ingeniería, que sería (sic) los que arrojarían todo un análisis técnico y económico sobre este proyecto, el cual sabemos deberá ejecutarse por etapas, ante el eventual costo monetario”. El 24 de febrero de 2020, la recurrente remitió una nota a la Municipalidad de Barva en relación con el oficio n.° 000189-DOCM-2019, en la que manifestó que no había recibido “noticias vinculantes” al seguimiento del problema mencionado en ese documento; esta gestión fue trasladada al Departamento de Obra Civiles por oficio n.o MB-ING-111-2020 de 2 de marzo de 2020. El jefe del Departamento de Obras Civiles, por oficio n.o MB-OC-0036-2020 de 4 de marzo de 2020 dirigido a la jefa del Departamento de Ingeniería, consultó a los efectos de dar respuesta a la accionante si se había atendido la sugerencia contenida en el oficio n.° 000189-DOCM-2019 en cuanto a “Realizar inspecciones a las propiedades para lograr identificar puntos donde se puedan observar alteraciones a la acequia (de existir alguna) y verificar que construcciones que se hallan (sic) realizado en los últimos años no afectase (sic) dicha acequia en ese cuadrante en específico ya que anteriormente no se presentaban estos problemas”. La jefa del Departamento de Ingeniería, por oficio n.° MB-ING-117-2020 de 4 de marzo de 2020 dirigido al jefe del Departamento de Obras Civiles, expuso que el oficio n.° 000189-DOCM-2019 no consta en sus expedientes ni tampoco fue recibido según consta en el control de 2019. El jefe del Departamento de Obras Civiles, por oficio n.o MB-OC-0037-2020 de 5 de marzo de 2020 dirigido a la jefa del Departamento de Ingeniería, remitió el oficio n.° 000189-DOCM-2019 para su análisis y valoración, así como para que se atienta la solicitud de la recurrente. La jefa del Departamento de Ingeniería, por oficio n.° MB-ING-120-2020 de 5 de marzo de 2020 trasladó el asunto a un inspector para que brindara el informe correspondiente. (Prueba aportada por las autoridades de la Municipalidad de Barva).

El 25 de marzo de 2020, las autoridades de la Municipalidad de Barva fueron notificadas del curso de este proceso. (Actas de notificación).

La jefa del Departamento de Ingeniería, por oficio n.° MB-ING-140-2020 de 25 de marzo de 2020 dirigido al jefe del Departamento de Obras Civiles, indicó:

“En atención al oficio indicado (…), y como es de su conocimiento el mismo fue trasladado al Inspector Gustavo Guzmán Morales para realizar inspección y brindar un informe al respecto. Sin embargo el caso que nos atañe se complicó de atender debidamente en razón de que el tiempo para hacer la inspección coincidió con la entrada en vigencia de la alerta amarilla y posteriormente el estado de Emergencia Nacional por el COVID-19, decretado por el Gobierno General de la República.

De todas formas en este acto se procederá a referirse al oficio No 00189-DOCM-2019, mismo que me fue trasladado mediante el oficio indicado en la referencia:

PRIMERO: El oficio No MB-OC-00037-2020 y el oficio No 00189-DOCM-2019, tal y como es de su conocimiento, le fue trasladado al Inspector Gustavo Guzmán Morales, para la debida atención. Lo anterior mediante el Oficio No MB-ING-120-2020.

SEGUNDO: En relación directamente con la acequia que nos atañe, es un cuerpo de agua existente desde siempre en el Cantón, situación que es de conocimiento de las personas habitantes del Distrito Central de Barva, e indiscutiblemente y con más razón aquellas personas que han construido en forma irregular sobre la acequia o que su propiedad es atravesada por la misma.

TERCERO: En lo que respecta a las alcantarillas que se encuentran en el derecho de vía, como usted bien conoce corresponde la limpieza y mantenimiento a la Municipalidad, en este caso al departamento que usted representa. Sin embargo, las acequias que pasan por propiedad privada les corresponden la limpieza y mantenimiento a los propietarios de los inmuebles. Estos mismos propietarios deben determinar si en el lapso de su propiedad existe alguna obstrucción en la acequia y tratar de eliminarlo.

CUARTO: Que en el oficio No 00189-DOCM-2019, usted indica donde se encuentra la obstrucción de la acequia, (ver imagen 4), por lo que no se comprende la solicitud que usted envía al departamento de ingeniería para detectar lo que usted denomina: “alteraciones a la acequia”, si ya es conocido el punto donde está el problema.

QUINTO: Que tal y como se indicó en el punto segundo de este oficio la acequia ha existido siempre en el Cantón, el origen de este tipo de canales, data desde tiempo donde los terrenos eran utilizados para el cultivo y era necesario la construcción de canales de riego, mismos que se derivaban de algún río. Con el paso de los años estos canales de riego dejan de funcionar como tales y se convierten en canales colectores de aguas pluviales. Sin embargo personas inescrupulosas de manera contraria a la ley, por lo que usted describe, lanzan aguas servidas a dichos cuerpos. En este momento y tal como se encuentra la acequia no es posible verificar cuales (sic) viviendas cometen esta imprudencia, ya que en la mayoría de su trayecto por no decir toda se encuentra entubada y en algunos casos con construcciones antiguas sobre ella.

SEXTO: Indicar que si ya su departamento detectó cual (sic) es la solución del problema, lo que procede es asignar recursos para: en primera instancia realizar los estudios requeridos y posteriormente para la construcción de las obras. Sobre este tema la Municipalidad no debe encausar aguas servidas en la misma canalización de las aguas pluviales. La situación es competencia del Ministerio de Salud quien es el órgano rector y competente en el área de Salud pública. Así las cosas la Sra. Alfaro Salas debió interponer denuncia formal a dicha institución.

SEPTIMO (sic): La denuncia interpuesta por la Sea. Teresita Alfaro Salas no es de conocimiento de esta oficina”. (Prueba aportada por las autoridades de la Municipalidad de Barva).

El encargado de la Unidad Técnica de Gestión Vial Municipal, en el oficio n.° UTGV-0074-2020 de 26 de marzo de 2020 dirigido al alcalde y a un asesor legal, señaló:

“En atención al recurso de amparo Exp: No. 20-005606-0007-CO interpuesto por (…) Teresita María auxiliadora (sic) Alfaro Salas y en respuesta al oficio MB-AMB-0327-2020 enviado a este departamento el día 25 de marzo del presente año, les informo que relacionado a la señora recurrente, no posee documento alguno de solicitud de inspección o queja relacionado con las aguas servidas y la (sic) acequias existentes en el distrito 1 de Barva.

Por otro lado, en relación al problema de la no capacidad de las acequias entubadas para dar capacidad a las aguas pluviales, por parte de este departamento según oficio MB-UTGV-0025-2020 respuesta a la solicitud a la señora María de los Ángeles Arguedas Murillo y poder dar una solución integral al problema de no solo la zona afectada si no también al distrito 1 del cantón de Barva, se procederá a realizar un diseño, con sus estudios respectivos para una canalización de aguas pluviales. Dichos diseños se estaría (sic) realizando con la contratación que este departamento se encuentra promovido (sic) y que se encuentra en etapas finales de elaboración.

Por último dentro de la capacidad actual de este departamento se coordinó con el departamento de Obras civiles para que realizara la limpieza de la caja de registro dentro del derecho de vía y así eliminar los malos olores de las zonas afectadas”. En relación con el Ministerio de Salud:

El 25 de noviembre de 2019, el Área Rectora de Salud de San Rafael-Barva recibió por correo electrónico una denuncia formulada por la recurrente, en la que se señaló que: al frente de su vivienda hay una alcantarilla obstruida que cuando llueve se ha llegado a rebalsar; parte del problema es una acequia entubada que pasa debajo de su casa por la que discurren aguas llovidas y servidas, lo cual les afecta por los malos olores y la reproducción de zancudos; su madre es una adulta mayor; la población ha crecido y la basura termina en el alcantarillado; plantearon la denuncia ante la municipalidad, pero no resolvieron; entre otros argumentos. El 10 de diciembre de 2019, Shirlley Quirós Pérez, gestora ambiental de esa área rectora, inspeccionó el sitio y, según el informe MS-DRRSCN-DARSSRBT-IT-030-2020 de 8 de enero de 2020 emitido por ella (notificado a la recurrente el 17 de enero de 2020), expresó que el problema no era competencia del Ministerio de Salud, sino de la municipalidad. El Área Rectora de Salud de San Rafael-Barva, por oficio MS-DRRSCN-DARSSRB-031-2020 de 8 de enero de 2020 dirigido al alcalde de Barva, le comunicó que el problema denunciado era competencia de la Municipalidad de Barva. (Prueba aportada por la directora del Área Rectora de Salud de San Rafael de Heredia).

En el expediente administrativo consta el oficio n.o 00189-DOCM-2019 de 16 de diciembre de 2019 del Departamento de Obras Civiles de la Municipalidad de Barva. (Prueba aportada por la directora del Área Rectora de Salud de San Rafael de Heredia).

El 17 de abril de 2020, la directora del Área Rectora de Salud de San Rafael-Barva fue notificada del curso de este proceso. (Acta de notificación).

El 20 de abril de 2020, Shirlley Quirós Pérez, gestora ambiental de esa área rectora, efectuó una nueva valoración y elaboró el acta de inspección MS-DRRSCN-DARSSRB-1125-2020, en la que se consignó que, según información suministrada por una vecina, se realizaron trabajos de limpieza en la alcantarilla, pero el problema persiste. (Informe de la directora del Área Rectora de Salud de San Rafael de Heredia).

La gestora ambiental Shirlley Quirós Pérez, mediante informe técnico MS-DRSCN-DARSSRB-1141-2020 de 21 de abril de 2020 dirigido a la directora de era área rectora, informó que el problema de la alcantarilla obstruida persiste y que se solicitará un informe al Departamento de Ingeniería de la Municipalidad de Barva un informe para dar el seguimiento al caso. La directora del Área Rectora de Salud de San Rafael-Barva, por medio del oficio n.o MS-DRRSCN-DARSSRB-1143-2020 de 21 de abril de 2020 dirigido al alcalde de Barva, señaló:

“En seguimiento al oficio MS-DRRSCN-DARSSRB-031-2020 enviado a su persona por el problema de alcantarilla obstruida ubicada 75 sur de la municipalidad, donde se le manifiesta que le corresponde a la Municipalidad realizar las gestiones, hasta la fecha no se ha recibido respuesta al oficio antes mencionado.

En conversación con el Jefe de obras civiles indica que se le sugiere a su persona trasladar el caso al Departamento de Ingeniería para que realice las inspecciones a las propiedades para así poder identificar los puntos donde se observan alteraciones a la acequia, por lo tanto se le solicita en un plazo de ocho días naturales después de haber recibido dicho oficio se remita a esta Área rectora un informe de lo actuado en el caso, para así dar el debido seguimiento respectivo”. III.Sobre el caso concreto. En el sub lite, la recurrente, vecina de Barva de Heredia, específicamente de la municipalidad setenta y cinco metros al sur (calle 2, entre las avenidas central y segunda), señala que al frente de la casa que habita hay una alcantarilla, que se encuentra llena de agua y se ha llegado a rebalsar cuando llueve. Acota que parte del problema se debe al sistema del alcantarillado, que consiste en una acequia a la que van a dar las aguas llovidas y servidas (posiblemente también aguas negras de las casas que no tienen tanques sépticos) y lo anterior les afecta no solo por los malos olores, zancudos y otros factores, sino también porque la acequia pasa por debajo de su vivienda (y de muchas otras). Expone que otros vecinos también han formulado denuncias relacionadas. Añade que la acequia está entubada, pero existe una obstrucción pues el nivel de agua ha subido y hasta se rebalsa sin lluvia.

Aduce que lo expuesto representa un problema para la construcción de la casa, ya que el agua la erosiona. Sostiene que planteó una queja al correo personal del alcalde, pero no obtuvo respuesta. Asevera que acudieron al área rectora de salud que corresponde a Barva; sin embargo, les informaron que el problema era competencia de la municipalidad. Aduce que ese ente no se ha hecho responsable, pese a que se cancelan los tributos correspondientes. Pide que se obligue a la municipalidad a resolver el problema tanto a corto como a largo plazo, ya que las consecuencias podrían ser peores.

Del estudio de los autos se tiene por demostrado, que la recurrente es vecina de Barva de Heredia, específicamente de la municipalidad setenta y cinco metros al sur (calle 2, entre las avenidas central y segunda). La propiedad y la construcción habitada por la recurrente es atravesada por una acequia que desemboca en una caja de registro de alcantarilla que se encuentra sobre vía pública. En el distrito central de Barva hay canales naturales con dirección este a oeste provenientes de algún río y, en el caso concreto la Quebrada Seca, estos se usaron tiempo atrás como canales de riego; sin embargo, con el paso de los años se convirtieron en canales colectores de aguas pluviales. Los canales no son un sistema de alcantarillado, sino que constituyen acequias que pasan por propiedades privadas, en las que se vierten aguas llovidas y servidas.

Concerniente a la Municipalidad de Barva se demostró que, el 30 de noviembre de 2019, la accionante envió un correo a la dirección electrónica personal del alcalde de Barva, en el que indicó que al frente de su casa hay una alcantarilla que se desborda, lo que representaba un problema para ella y su mamá; añadió que Nora Sala, quien es su mamá, se había apersonado a la municipalidad a exponer el problema. El 10 de diciembre de 2020, el alcalde le contestó a la denunciante, que el caso había sido trasladado al jefe del Departamento de Obras Civiles y, además, que era de conocimiento de la Unidad Técnica de Gestión Vial. El Departamento de Obras Civiles, mediante oficio n.° 189-DOCM-2019 de 16 de diciembre de 2019 dirigido al alcalde, consignó sobre al respecto lo siguiente: se han recibido múltiples denuncias, tanto de vecinos como de funcionarios de limpieza de vías; semanas atrás, con ocasión de una inspección, se determinó que la alcantarilla al frente de la propiedad de Nora Salas se encuentra conformada por cajas de registro ubicadas en una de las acequias que han existido en el centro de Barva desde hace muchos años.

Tales acequias tienen dirección este a oeste y sobre ellas se han construido edificaciones y la semana anterior se hizo una limpieza de las cajas de registro ubicadas sobre el derecho de vía y se constató que, a pesar de que no hay obstrucciones en ellas, la acumulación de aguas se mantuvo. El 10 de diciembre de 2019 se inspeccionó nuevamente el lugar y se verificó una gran cantidad de aguas servidas con mal olor a punto de rebalsarse, por lo que se determinó que debía existir una obstrucción en alguna de las propiedades ubicadas entre la casa de Nora Salas González y la casa de Fernando Aguilar Vargas y Clara Rosa Murillo Ramírez. Finalmente, se mencionó: “Debido a que dicha obstrucción se encuentra dentro de alguna de esas propiedad, se nos imposibilita corregir la situación, por lo que se recomienda: Sugerirle al Departamento de Ingeniería realizar inspecciones a las propiedad para lograr identificar puntos donde se puedan observar alteraciones a la acequia (de existir alguna) y verificar que construcciones que se hallan (sic) realizado en los últimos años no afectasen dicha acequia en ese cuadrante específico, ya que anteriormente no se presentaban estos problemas.

El 7 de enero de 2020, Nora Salas recibió el oficio n.° 000189-DOCM-2019. El encargado de la Unidad Técnica de Gestión Vial, por oficio MB-UTGV-0014-2020 de 10 de enero de 2020, con ocasión de una denuncia planteada por otros vecinos de Barva, indicó: “En atención a su denuncia presentada el 08 de enero del 2020, se le informa que, desde noviembre del 2019, el Departamento de Obras Civiles y la Unidad Técnica de Gestión Vial Municipal, recibió denuncias telefónicas por parte de vecinos aledaños a la zona, en el caso específico de Doña Nora Salas González, donde su propiedad se ve perjudicada por el problema en cuestión.

Con fecha 16 de diciembre del 2019, mediante número de oficio 00189, dirigido al Alcalde Municipal, se le expuso la situación acontecida en la zona, también se le hizo la sugerencia de elevar la denuncia ante el Departamento de Ingeniería, para que mediante los inspectores municipales puedan tener acceso a la zona donde posiblemente se encuentre la obstrucción. Así mismo, somos conscientes que el casco central de Barva, necesita un nuevo sistema de recolección y canalización de aguas pluviales y como Unidad Técnica Vial, estamos anuentes a contemplar este tema ante la Junta Vial Cantonal, para que se valore para el 2021, la disposición presupuestaria para los estudios de ingeniería, que sería (sic) los que arrojarían todo un análisis técnico y económico sobre este proyecto, el cual sabemos deberá ejecutarse por etapas, ante el eventual costo monetario”. El 24 de febrero de 2020, la recurrente remitió una nota a la Municipalidad de Barva en relación con el oficio n.° 000189-DOCM-2019, en la que manifestó que no había recibido “noticias vinculantes” al seguimiento del problema mencionado en ese documento; esta gestión fue trasladada al Departamento de Obra Civiles por oficio n.o MB-ING-111-2020 de 2 de marzo de 2020.

El jefe del Departamento de Obras Civiles, por oficio n.o MB-OC-0036-2020 de 4 de marzo de 2020 dirigido a la jefa del Departamento de Ingeniería, consultó a los efectos de dar respuesta a la accionante si se había atendido la sugerencia contenida en el oficio n.° 000189-DOCM-2019 en cuanto a “Realizar inspecciones a las propiedades para lograr identificar puntos donde se puedan observar alteraciones a la acequia (de existir alguna) y verificar que construcciones que se hallan (sic) realizado en los últimos años no afectase (sic) dicha acequia en ese cuadrante en específico ya que anteriormente no se presentaban estos problemas”. La jefa del Departamento de Ingeniería, por oficio n.° MB-ING-117-2020 de 4 de marzo de 2020 dirigido al jefe del Departamento de Obras Civiles, expuso que el oficio n.° 000189-DOCM-2019 no consta en sus expedientes ni tampoco fue recibido según consta en el control de 2019.

La jefa del Departamento de Ingeniería, por oficio n.° MB-ING-120-2020 de 5 de marzo de 2020, trasladó el asunto a un inspector para que brindara el informe correspondiente. El 25 de marzo de 2020, las autoridades de la Municipalidad de Barva fueron notificadas del curso de este proceso. La jefa del Departamento de Ingeniería, por oficio n.° MB-ING-140-2020 de 25 de marzo de 2020 dirigido al jefe del Departamento de Obras Civiles, indicó: “En atención al oficio indicado (…), y como es de su conocimiento el mismo fue trasladado al Inspector Gustavo Guzmán Morales para realizar inspección y brindar un informe al respecto.

Sin embargo el caso que nos atañe se complicó de atender debidamente en razón de que el tiempo para hacer la inspección coincidió con la entrada en vigencia de la alerta amarilla y posteriormente el estado de Emergencia Nacional por el COVID-19, decretado por el Gobierno General de la República. De todas formas en este acto se procederá a referirse al oficio No 00189-DOCM-2019, mismo que me fue trasladado mediante el oficio indicado en la referencia: PRIMERO: El oficio No MB-OC-00037-2020 y el oficio No 00189-DOCM-2019, tal y como es de su conocimiento, le fue trasladado al Inspector Gustavo Guzmán Morales, para la debida atención. Lo anterior mediante el Oficio No MB-ING-120-2020. SEGUNDO: En relación directamente con la acequia que nos atañe, es un cuerpo de agua existente desde siempre en el Cantón, situación que es de conocimiento de las personas habitantes del Distrito Central de Barva, e indiscutiblemente y con más razón aquellas personas que han construido en forma irregular sobre la acequia o que su propiedad es atravesada por la misma.

TERCERO: En lo que respecta a las alcantarillas que se encuentran en el derecho de vía, como usted bien conoce corresponde la limpieza y mantenimiento a la Municipalidad, en este caso al departamento que usted representa. Sin embargo, las acequias que pasan por propiedad privada les corresponden la limpieza y mantenimiento a los propietarios de los inmuebles. Estos mismos propietarios deben determinar si en el lapso de su propiedad existe alguna obstrucción en la acequia y tratar de eliminarlo. CUARTO: Que en el oficio No 00189-DOCM-2019, usted indica donde se encuentra la obstrucción de la acequia, (ver imagen 4), por lo que no se comprende la solicitud que usted envía al departamento de ingeniería para detectar lo que usted denomina: “alteraciones a la acequia”, si ya es conocido el punto donde está el problema. QUINTO: Que tal y como se indicó en el punto segundo de este oficio la acequia ha existido siempre en el Cantón, el origen de este tipo de canales, data desde tiempo donde los terrenos eran utilizados para el cultivo y era necesario la construcción de canales de riego, mismos que se derivaban de algún río.

Con el paso de los años estos canales de riego dejan de funcionar como tales y se convierten en canales colectores de aguas pluviales. Sin embargo personas inescrupulosas de manera contraria a la ley, por lo que usted describe, lanzan aguas servidas a dichos cuerpos. En este momento y tal como se encuentra la acequia no es posible verificar cuales (sic) viviendas cometen esta imprudencia, ya que en la mayoría de su trayecto por no decir toda se encuentra entubada y en algunos casos con construcciones antiguas sobre ella. SEXTO: Indicar que si ya su departamento detectó cual (sic) es la solución del problema, lo que procede es asignar recursos para: en primera instancia realizar los estudios requeridos y posteriormente para la construcción de las obras. Sobre este tema la Municipalidad no debe encausar aguas servidas en la misma canalización de las aguas pluviales. La situación es competencia del Ministerio de Salud quien es el órgano rector y competente en el área de Salud pública.

Así las cosas la Sra. Alfaro Salas debió interponer denuncia formal a dicha institución. SEPTIMO (sic): La denuncia interpuesta por la Sra. Teresita Alfaro Salas no es de conocimiento de esta oficina”. El encargado de la Unidad Técnica de Gestión Vial Municipal, en el oficio n.° UTGV-0074-2020 de 26 de marzo de 2020 dirigido al alcalde y a un asesor legal, señaló: “En atención al recurso de amparo Exp: No. 20-005606-0007-CO interpuesto por (…) Teresita María auxiliadora (sic) Alfaro Salas y en respuesta al oficio MB-AMB-0327-2020 enviado a este departamento el día 25 de marzo del presente año, les informo que relacionado a la señora recurrente, no posee documento alguno de solicitud de inspección o queja relacionado con las aguas servidas y la (sic) acequias existentes en el distrito 1 de Barva. Por otro lado, en relación al problema de la no capacidad de las acequias entubadas para dar capacidad a las aguas pluviales, por parte de este departamento según oficio MB-UTGV-0025-2020 respuesta a la solicitud a la señora María de los Ángeles Arguedas Murillo y poder dar una solución integral al problema de no solo la zona afectada si no también al distrito 1 del cantón de Barva, se procederá a realizar un diseño, con sus estudios respectivos para una canalización de aguas pluviales.

Dichos diseños se estaría (sic) realizando con la contratación que este departamento se encuentra promovido (sic) y que se encuentra en etapas finales de elaboración. Por último dentro de la capacidad actual de este departamento se coordinó con el departamento de Obras civiles para que realizara la limpieza de la caja de registro dentro del derecho de vía y así eliminar los malos olores de las zonas afectadas”.

En cuanto al Ministerio de Salud se comprobó, que, el 25 de noviembre de 2019, el Área Rectora de Salud de San Rafael-Barva recibió por correo electrónico una denuncia formulada por la recurrente, en la que se señaló que: al frente de su vivienda hay una alcantarilla obstruida que cuando llueve se ha llegado a rebalsar; parte del problema es una acequia entubada que pasa debajo de su casa por la que discurren aguas llovidas y servidas, lo cual les afecta por los malos olores y la reproducción de zancudos; su madre es una adulta mayor; la población ha crecido y la basura termina en el alcantarillado; plantearon la denuncia ante la municipalidad, pero no resolvieron; entre otros argumentos. El 10 de diciembre de 2019, Shirlley Quirós Pérez, gestora ambiental de esa área rectora, inspeccionó el sitio y, según el informe MS-DRRSCN-DARSSRBT-IT-030-2020 de 8 de enero de 2020 emitido por ella (notificado a la recurrente el 17 de enero de 2020), expresó que el problema no era competencia del Ministerio de Salud, sino de la municipalidad.

El Área Rectora de Salud de San Rafael-Barva, por oficio MS-DRRSCN-DARSSRB-031-2020 de 8 de enero de 2020 dirigido al alcalde de Barva, le comunicó que el problema denunciado era competencia de la Municipalidad de Barva. En el expediente administrativo consta el oficio n.o 00189-DOCM-2019 de 16 de diciembre de 2019 del Departamento de Obras Civiles de la Municipalidad de Barva. El 17 de abril de 2020, la directora del Área Rectora de Salud de San Rafael-Barva fue notificada del curso de este proceso. El 20 de abril de 2020, Shirlley Quirós Pérez, gestora ambiental de esa área rectora, efectuó una nueva valoración y elaboró el acta de inspección MS-DRRSCN-DARSSRB-1125-2020, en la que se consignó que, según información suministrada por una vecina, se realizaron trabajos de limpieza en la alcantarilla, pero el problema persiste. Esta funcionaria, mediante informe técnico MS-DRSCN-DARSSRB-1141-2020 de 21 de abril de 2020 dirigido a la directora de era área rectora, informó que el problema de la alcantarilla obstruida persiste y que se solicitará un informe al Departamento de Ingeniería de la Municipalidad de Barva un informe para dar el seguimiento al caso.

La directora del Área Rectora de Salud de San Rafael-Barva, por medio del oficio n.o MS-DRRSCN-DARSSRB-1143-2020 de 21 de abril de 2020 dirigido al alcalde de Barva, señaló: “En seguimiento al oficio MS-DRRSCN-DARSSRB-031-2020 enviado a su persona por el problema de alcantarilla obstruida ubicada 75 sur de la municipalidad, donde se le manifiesta que le corresponde a la Municipalidad realizar las gestiones, hasta la fecha no se ha recibido respuesta al oficio antes mencionado. En conversación con el Jefe de obras civiles indica que se le sugiere a su persona trasladar el caso al Departamento de Ingeniería para que realice las inspecciones a las propiedades para así poder identificar los puntos donde se observan alteraciones a la acequia, por lo tanto se le solicita en un plazo de ocho días naturales después de haber recibido dicho oficio se remita a esta Área rectora un informe de lo actuado en el caso, para así dar el debido seguimiento respectivo”.

Desde este panorama, procede declarar parcialmente con lugar el recurso.

Sobre el particular, se observa que ni la municipalidad ni el área rectora de salud le han dado un adecuado seguimiento a la problemática que la recurrente les puso en conocimiento.

Es un hecho incontrovertido que una acequia pasa por debajo de la propiedad que habita la accionante y de otras a sus alrededores; sin embargo, lo trascendental, a los efectos de esta jurisdicción, es que ella se vierten no solo aguas pluviales sino también residuales, las cuales llegan a una caja de registro ubicada en la vía pública para posteriormente desembocar en la quebrada Seca.

La Municipalidad de Barva tiene conocimiento de los hechos al menos desde diciembre de 2019, ya que corroboró en el sitio una gran cantidad de aguas servidas con mal olor a punto de rebalsarse y reconoció la necesidad de pedirle al Departamento de Ingeniería del gobierno local que identificaran los puntos con alteraciones y las construcciones que se efectuaron sobre la acequia en los últimos años; además, propuso como solución definitiva la construcción de un sistema de recolección y canalización de aguas pluviales. No obstante, más de tres meses después no consta que se hayan materializado acciones para procurar alguna solución al problema. De ahí que, además de los argumentos que de seguido se desarrollarán, no se acredita que el gobierno local haya actuado de forma diligente. En ese sentido, no puede el ente municipal sostener que únicamente les corresponde a los propietarios limpiar la acequia si desconoce la causa del problema, lo cual también resulta contradictorio porque también se afirma que parte de la solución es invertir en un sistema de recolección y canalización de aguas pluviales.

Ahora, partiendo de lo anterior, es un hecho que sobre la acequia se están vertiendo aguas residuales, lo cual provoca malos olores, zancudos y rebalses, con las consecuencias notorias para la salud pública que ello tiene. Al respecto, el Ministerio de Salud tiene conocimiento de los hechos denunciados desde noviembre de 2019 y, precisamente, por los problemas de salud pública referidos no puede simplemente (tal y como lo hizo en el informe MS-DRRSCN-DARSSRBT-IT-030-2020 de 8 de enero de 2020) indicar que el problema no le compete. Además, la autoridad de salud se limitó a remitir el asunto a la municipalidad, sin que conste que haya dado un adecuado seguimiento a los hechos, toda vez que cuenta con potestades suficientes para dictar órdenes sanitarias en aras de resolver los problemas suscitados. Incluso, no fue sino hasta después de la notificación del curso de este proceso, que le envió un oficio al alcalde de Barva con el que dio seguimiento a la situación denunciada y pidió que el Departamento de Ingeniería inspeccionara las propiedades para identificar alteraciones en la acequia.

Asimismo, la autoridad de salud manifestó bajo juramento que era necesario un informe del Departamento de Ingeniería de la municipalidad para encontrar el sitio de la obstrucción y, posteriormente, poder realizar las pruebas de fluorceína (coloración) con el fin de determinar cuáles viviendas o establecimientos depositan sus aguas residuales (negras o servidas) a la tubería.

Con base en lo anterior, una vez determinada la causa del problema, si los vecinos estuvieren vertiendo aguas residuales en infracción de las disposiciones legales, deben regularizar su situación en cumplimiento de las disposiciones municipales y de salud pública aplicables al caso concreto, las cuales deberán ser exigidas a través de los medios previstos por el ordenamiento jurídico para tales fines.

En adición, como las aguas residuales escurren hacia la quebrada Seca, no solo se considera un problema de salud pública sino también uno ambiental, lo cual resulta aún más reprochable.

Por las consideraciones expuestas, se impone estimar el recurso contra la Municipalidad de Barva y el Área Rectora de Salud San Rafael-Barva, en los términos que se dictarán en la parte dispositiva.

Finalmente, aun cuando se desestima el recurso en contra del ICAA por cuanto no ha tenido participación en los hechos y no alegó en su contra alguna situación puntual que se le pueda imputar, deberá tomar nota esta autoridad a los efectos de que brinde, dentro del ámbito de sus competencias, el apoyo técnico que le requieran las autoridades de salud y municipales.

IV. Nota de la Magistrada Hernández López respecto del reclamo por infracción del artículo 50 de la Constitución Política

1. El contexto histórico que motivó en su momento la amplia intervención de la Sala en materia ambiental, ha tenido una considerable variación que impone a este órgano reconsiderar las condiciones para su participación en el aseguramiento del derecho de las personas a un ambiente sano y equilibrado, tal y como ha sido tutelado en el artículo 50 de la Constitución Política. En efecto, la situación actual –caracterizada por una amplísima producción legal y reglamentaria que incluye reglas de fondo, procedimientos y creación de órganos para el cumplimiento de lo ordenado en la Carta Fundamental- es radicalmente diferente de la anterior, en la cual la ausencia de normativa y de instancias estatales con competencia apropiada, le impuso a la Sala un papel de protagonista, casi único, en la defensa del precitado derecho constitucional.

2. Hoy en día, nos encontramos frente a un “denso entramado” de normativa ambiental, lo cual ha producido dos fenómenos relevantes: el primero y más obvio, es el surgimiento de una abarcadora regulación jurídica respecto de actividades cuya incidencia en el ambiente estaba poco o nada ordenada, así la creación de órganos estatales con potestades de vigilancia y control sobre los efectos de la actividad humana en el entorno. El segundo fenómeno consiste en que esa creciente juridificación –predominantemente legislativa y reglamentaria– trae aparejada una ineludible entrada en escena tanto de la justicia administrativa como de la jurisdicción ordinaria -prioritariamente la contencioso administrativa, pero también la penal. En ellas, acorde con la importancia del derecho ambiental, se han regulado de forma amplia vías procesales y medios de legitimación incluyentes, de manera que los administrados puedan hacer valer lo establecido en ese amplio orden jurídico que se relaciona con el tema ambiental.

3. En ese contexto, no resulta apropiado jurídicamente, ni desde el punto de vista funcional, que la Sala Constitucional desplace, o -peor aún- sustituya, a los órganos de justicia ordinarios en la realización de su tarea, también de rango constitucional, de velar por el efectivo cumplimiento de leyes y reglamentos. Es impropio jurídicamente porque en la inmensa mayoría de estos casos lo que se solicita es que interprete y haga valer normas legales y reglamentarias con lo que arriesga traslapar sus competencias con las de otros órganos jurisdiccionales que –ellos sí- han sido creados para ejecutar tales tareas; y resulta también funcionalmente incorrecto, porque el diseño de sus procesos se aviene mal con la complejidad que está presente en numerosos conflictos ambientales que se componen de series de hechos y actos técnica y jurídicamente complejos. Sobre ambas cuestiones existen conocidos ejemplos en los que la Sala ha arrojado una resolución a medias o técnicamente incompleta, o bien se han generado fricciones innecesarias y afectación de la seguridad jurídica.

4. Como parte de los aspectos técnicos que he valorado, añado que está el hecho de que esta jurisdicción no cuenta con jueces ejecutores de sentencia que permitan darle seguimiento adecuado a las mismas -generalmente complejas-, que implican en ocasiones el seguimiento de planes remediales, entre otros, con coordinación interinstitucional y seguimiento de meses y hasta años.

5. Desde esa perspectiva, la decisión de dar un paso al lado en la materia ambiental por parte de este Tribunal no debe ser vista como un abandono de la materia ambiental, sino al contrario, de su adecuada tutela en la instancia que mejor se aviene a la naturaleza de su complejidad y diversidad. Asimismo tampoco debe ser visto como la declinación de esta instancia en su tarea de protección de los derechos constitucionales que le imponen la Constitución Política y su Ley Orgánica, que desde mi punto de vista, queda reservada en esta materia para casos específicos. Se trata más bien, de un ejercicio de reacomodo de las cargas y tareas que corresponden a los distintos órganos estatales, de manera que cada uno de ellos, pueda desplegar plenamente su labor dentro del ámbito que se le ha asignado, así como del ejercicio de fijar su propia competencia, según lo establece el artículo 7 de su Ley Orgánica.

6. Queda claro que la Sala no se plantea abandonar a otras jurisdicciones la labor de protección de los derechos de las personas en materia ambiental. Es conocido que si bien todo reclamo por infracción de normas legales y reglamentarias puede ser reconducido hasta el ámbito constitucional, existen casos cuya resolución no exige más que la aplicación del derecho de la Constitución. Se trata entonces de lograr que la Sala se convierta en protagonista junto con otros, de manera que –entre todos y cada uno en su espacio- se pueda cubrir toda la variedad de situaciones que presenta una protección del derecho a un medio ambiente sano y equilibrado dentro de una sociedad en la que también existen otras necesidades igual de acuciantes. Con esta posición creo firmemente que el ciudadano no pierde un ápice de protección pero se gana sustancialmente en amplitud, en perspectiva y en respeto al equilibrio y distribución de poderes, principio este último de obligada consideración, puesto que rige la dinámica constitucional de cualquier sistema liberal y democrático como el nuestro.- 7.

En línea con lo anterior, sostengo que esta Sala debe abstenerse de conocer los reclamos que se le presenten por supuesta infracción al artículo 50 de la Constitución Política para dejar en manos de la justicia administrativa y la jurisdicción contenciosa administrativa su conocimiento. Lo anterior se deja afirmado con carácter general, sin perjuicio de reconocer la existencia de casos particulares o grupos de casos que, según mi criterio, si resultarían aún mejor tutelados por esta Sala y por tanto deben ser conocidos y resueltos por ella.- Dentro de tales grupos de casos, y sin que esta enunciación pueda considerarse como una lista cerrada y definitiva, puedo señalar que la Sala debe reservarse el conocimiento de situaciones como por ejemplo los reclamos por infracciones ambientales que además pongan en riesgo directo la salud de las personas, o el acceso o calidad del agua; los casos de violaciones groseras y directas al ambiente y en los cuales se constate una palmaria ausencia de la protección por parte de las autoridades estatales, siempre y cuando además la naturaleza del reclamo permita ser abordado mediante el instrumento del amparo como instituto procesal sumario y especial, ya que estimo que tampoco se debe “ordinariar” el amparo para abordar, aún en estos casos citados, temas que rebasen la capacidad de ser atendidos adecuadamente en el mismo.

8. En el caso concreto, de conformidad con los hechos probados, el reclamo de la parte recurrente, podría eventualmente incidir en su salud y la de la su familia. En consecuencia, es claro que estamos ante las excepciones que mencionan y por esa razón he considerado necesario que la Sala ejerciera su competencia, para comprobar o descartar si las omisiones señaladas, vulneran los derechos fundamentales de las personas amparadas.

V.Nota del Magistrado Salazar Alvarado. En asuntos ambientales, es criterio del suscrito, que si ya ha habido intervención de la Administración Pública, su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que se acusan problemas de contaminación que se encuentran de la Municipalidad de Barva, setenta y cinco metros al Sur (calle 2, entre las avenidas central y segunda), provocado por una alcantarilla que se encuentra llena de agua y se ha llegado a rebalsar cuando llueve. En este sentido, al haber presuntas conexiones ilegales hay afectación por las aguas negras y aguas servidas, lo que afecta la salud de los vecinos del lugar, con violación del derecho a disfrutar de un ambiente sano y ecológicamente equilibrado y de un nivel digno de calidad de vida.

VI.Documentación aportada al expediente. Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se declara parcialmente con lugar el recurso únicamente en contra de la Municipalidad de Barva y el Área Rectora de Salud San Rafael-Barva.

  • 1)Se ordena a Claudio Manuel Segura Sánchez, Kattia Isella Ramírez Freer y Joel Antonio Castillo Agüero, por su orden alcalde, jefa del Departamento de Ingeniería y jefe del Departamento de Obras Civiles, todos de la Municipalidad de Barva, o a quienes ocupen sus cargos, así como a María Antonieta Acuña Hernández, en su condición de directora del Área Rectora de Salud de San Rafael, o a quien ocupe ese cargo, que coordinen lo necesario dentro del ámbito de sus competencia a efectos de que, en el plazo de TRES MESES se diseñe una solución, con el correspondiente cronograma y plazo de ejecución, al problema de contaminación que provocan las aguas residuales que escurren en la caja de registro al frente de la propiedad habitada por la recurrente, específicamente en Barva de la municipalidad setenta y cinco metros al sur (calle 2, entre las avenidas central y segunda).
  • 2)Se ordena a Claudio Manuel Segura Sánchez, Kattia Isella Ramírez Freer y Joel Antonio Castillo Agüero, por su orden alcalde, jefa del Departamento de Ingeniería y jefe del Departamento de Obras Civiles, todos de la Municipalidad de Barva, o a quienes ocupen sus cargos, que giren las órdenes pertinentes y tomen las medidas necesarias para que, en el plazo máximo de UN MES, contado a partir de la notificación de esta sentencia, se elabore un estudio de la condición actual de acequia que desemboca en la caja de registro que se encuentra al frente de la propiedad que habita la recurrente, específicamente en Barva de la municipalidad setenta y cinco metros al sur (calle 2, entre las avenidas central y segunda) y se determine si existen obstrucciones u otros elementos (tales como construcciones irregulares u otras) que contribuyan al problema denunciado de aguas residuales. Este informe deberá, una vez finalizado, ser remitido inmediatamente al Área Rectora de Salud San Rafael-Barva.
  • 3)Se ordena a María Antonieta Acuña Hernández, en su condición de directora del Área Rectora de Salud de San Rafael, o a quien ocupe su cargo, que, de manera INMEDIATA, gire las órdenes pertinentes para que se tomen las medidas provisionales a efectos de que se atiendan los rebalses de aguas residuales en la caja de registro que se encuentra al frente de la propiedad que habita la recurrente, específicamente en Barva de la municipalidad setenta y cinco metros al sur (calle 2, entre las avenidas central y segunda). Además, en el momento en que tenga conocimiento de las obstrucciones o demás condiciones de la acequia, deberá efectuar las pruebas y dictar órdenes sanitarias correspondientes a los efectos de que se atienda la problemática del vertido improcedente de aguas residuales. Se advierte a las autoridades recurridas que, de conformidad con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado y a la Municipalidad de Barva al pago de las costas, daños y perjuicios ocasionados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. En lo demás, se declara sin lugar el recurso. Tome nota el Instituto Costarricense de Acueductos y Alcantarillados de lo consignado en el considerando III. La Magistrada Hernández López pone nota. El Magistrado Salazar Alvarado pone nota. Notifíquese.
