Whereas:

1. 1The consultation was received at the Secretariat of the Chamber at 14:01 hrs. on April 13, 2020. They indicate that by means of judgment No. 2018-014168, at 9:20 hours, on August 31, 2018, the Constitutional Chamber granted INCOPESCA a peremptory period of 6 months to comply with the technical and scientific study demonstrating a significant reduction in shrimp bycatch (captura incidental), as well as to make a decision on the reactivation of shrimp trawling (pesca de camarón por arrastre), due to the serious and irreversible economic harm to that sector. That study had to contemplate two aspects: 1.- A significant reduction in bycatch (captura incidental); 2.- That the technique be compatible with democratic sustainable development. For this reason, on March 12, 2019, Mr. Moisés Mug Villanueva, Executive President of the Costa Rican Institute of Fisheries and Aquaculture (Instituto Costarricense de Pesca y Acuicultura), presented the final report of an investigation aimed at assessing exclusion factors in shrimp fishing.This prompted several deputies of the Legislative Assembly to submit legislative bill 21.478 for processing. As indicated in the statement of purpose of the referred bill, the submission of the research results is the outcome of a series of actions taken by the fisheries authority in order to comply with the environmental precautionary principle. From this technical documentation, the Legislative Assembly, considering the current state of science and technology, assesses that there are several broad types of devices that allow compliance with the rules set by the constitutional precedent indicated above, which are detailed in the consultation. They add that, based on the background indicated, it is clear that one thing is the scientific and technical studies, which the Legislative Assembly must have before it to make the decision on whether to reopen the granting of semi-industrial permits and licenses, and another thing is the scientific and technical studies that must support (factual and legal component) the administrative act of granting new licenses or permits, both of which were considered in the legislative bill under consultation.In light of this, they consult: 1.- Is it in accordance with the Political Constitution and with vote 10540-2013 of the Constitutional Chamber, for the text of the law that reopens the granting of semi-industrial permits and licenses not to include the specific name or detailed list of devices for reducing bycatch (captura incidental), but rather, as is done in the legislative bill, for an express reference to be made to the obligation to use devices, together with the obligation of the administrative authority (INCOPESCA) to establish specific and concrete regulations?; 2.- Given the current state of science and technology, as well as the inputs considered by the Legislative Assembly in making the decision to reopen the granting of semi-industrial permits and licenses, is the level of scientific and technical certainty verified/assessed by the Legislative Assembly in the consulted bill constitutionally valid in light of vote 10540-2013 of this Constitutional Chamber, at 15:50 hrs. on August 7, 2013, the Convention on Biological Diversity of Rio, Articles 21 and 50 of the Political Constitution, and the democratic principle of sustainable development?II.- Regarding the potential violation of the principle of citizen participation in environmental decision-making due to the lack of publicity of the approved text, the following is consulted: 1.- Considering the nature of the changes made to several articles of legislative bill 21.478, in the case of the substitute text approved in extraordinary session No. 14 of the Legislative Plenary, held on Wednesday, November 27, 2019, by application of the constitutional principles of publicity, transparency, and access to information, was it necessary to conduct consultations again with the different involved sectors, and consequently, does the failure to do so entail a substantial defect in the legislative procedure? III.- Possible unconstitutionality on the merits. 1.- Having in view some of the background information considered in the Advisory Committee, which according to the legislators demonstrates a balanced management of coastal and marine resources, they consult whether the reopening of the granting of semi-industrial permits and licenses, which is the object of the consulted initiative, entails a violation of Articles 6 and 7 of the Constitution, insofar as they enable the application of international environmental protection law norms, the principle of environmental non-regression, and the principle of inviolability (intangibilidad) of the environmental public domain.
2. 2Pending before this same Chamber is dossier number 19-023057-00-07-CO, previously filed by CAROLINA HIDALGO HERRERA, CATALINA MONTERO GÓMEZ, ENRIQUE SÁNCHEZ CARBALLO, JORGE LUIS FONSECA FONSECA, JOSÉ MARÍA VILLALTA FLOREZ ESTRADA, KARINE NIÑO GUTIÉRREZ, LAURA GUIDO PÉREZ, LUIS ANTONIO AIZA CAMPOS, MARÍA JOSÉ CORRALES CHACÓN, MARIO CASTILLO MÉNDEZ, NIELSEN PÉREZ PÉREZ, PAOLA ALEXANDRA VALLADARES ROSADO, PATRICIA VILLEGAS ÁLVAREZ, ROBERTO THOMPSON CHACÓN, WALTER MUÑOZ CÉSPEDES, WELMER RAMOS GONZÁLEZ, in which the same bill that is the subject of examination in the sub examine is consulted.
3. 3The certified copy of legislative dossier number 21.478 has not yet been received by the Tribunal. Consequently, the period to evacuate the consultation has not begun to run.

Sole.- Given the evident connection (conexidad) that exists between the points raised in this matter and those that are the object of dossier number 19-023057-0007-CO being processed before this Chamber, and in order to avoid contradictory rulings that could affect the rights and interests of the involved parties, it is deemed appropriate and convenient to proceed to accumulate this dossier to the aforementioned one.

Therefore:

Accumulate this consultation to the one being processed under dossier number 19-023057-0007-CO before this Chamber and consider it as an amplification of the same.

Resultando:

1. 1La consulta se recibió en la Secretaría de la Sala a las 14:01 hrs. del 13 de abril de 2020. Señalan que mediante sentencia No. 2018-014168, de las 9:20 horas, del 31 de agosto de 2018, la Sala Constitucional le concedió a INCOPESCA un plazo perentorio de 6 meses, para cumplir con el estudio técnico y científico que demuestre una reducción significativa en la captura incidental del camaron, así como tomar una decisión sobre la reactivación de la pesca de camarón por arrastre, debido a los graves e irreversibles perjuicios económicos para ese sector. Ese estudio debía contemplar dos aspectos: 1.- Una reducción significativa en la captura incidental; 2.- Que la técnica sea compatible con un desarrollo sostenible democrático. En razón de ello, el 12 de marzo del 2019, el señor Moisés Mug Villanueva, Presidente Ejecutivo del Instituto Costarricense de Pesca y Acuicultura presentó el informe final de una investigación dirigida a valorar los factores de exclusión en la pesca de camarones.Esto motivó a varias diputados y diputados de la Asamblea Legislativa a presentar para su trámite el proyecto de ley 21.478. Tal y como se indica en la exposición de motivos del proyecto referido, la remisión de los resultados de la investigación es el resultado de una serie de acciones que tomó la autoridad de pesca en aras de dar cumplimiento al principio precautorio ambiental. De esa documentación técnica, la Asamblea Legislativa, considerando el estado actual de la ciencia y la técnica, valora que existen varios y amplios tipos de dispositivos que permiten el cumplimiento de las reglas puestas por el precedente constitucional arriba indicado, mismos que se detallan en la consulta. Agregan que a partir de los antecedentes que se indican, queda claro que una cosa son los estudios científicos y técnicos, que debe tener a la vista la Asamblea Legislativa para tomar la decisión de si reapertura el otorgamiento de permisos y licencias semi-industriales y, otra cosa, son los estudios científicos y técnicos que deben motivar (componente de hecho y de derecho) el acto administrativo de otorgamiento de nuevas licencias o permisos, siendo que ambos fueron considerados en el proyecto de ley consultado.A la luz de ello, consultan: 1.- ¿Resulta conforme con la Constitución Política y con el voto 105402013 de la Sala Constitucional, que no se inserte dentro del texto de la ley que reapertura el otorgamiento de permisos y licencias semi-industriales, la denominación 0 elenco detallado de los dispositivos para la disminución de la captura incidental, sino que, tal cual se hace en el proyecto de ley, se realice una referencia expresa a la obligación de utilizar dispositivos, junto a la obligación de la autoridad administrativa (INCOPESCA) de establecer las regulaciones específicas y concretas?; 2.- Dado el estado actual de la ciencia y la técnica, así como los insumos considerados por la Asamblea Legislativa en la toma de la decisión de reapertura en el otorgamiento de permisos y licencias semi-industriales, ¿resulta constitucionalmente válido a la luz del voto de esta Sala Constitucional número 10540-2013 de las 15:50 hrs. del 7 de agosto de 2013, el convenio sobre Diversidad Biológica de Río, los artículos 21, 50 de la Constitución Política y del principio democrático de desarrollo sostenible, el nivel de certeza científico y técnico constatado / valorado por la Asamblea Legislativa en el proyecto consultado?.II.- En cuanto a la posible lesión al principio de participación ciudadana en la toma de decisiones ambientales por la falta de publicidad al texto aprobado, se consulta: 1.- Considerando la naturaleza de los cambios efectuados a varios artículos del proyecto de ley 21.478, en el caso del texto sustitutivo aprobado en la sesión extraordinaria N.° 14 del Plenario Legislativo, celebrada el miércoles 27 de noviembre de 2019, por aplicación de los principios constitucionales de publicidad, transparencia y acceso a la información, ¿era necesario realizar nuevamente consultas a los diferentes sectores involucrados y consecuentemente el no haberse realizado entraña un vicio sustancial de procedimiento legislativo?. III.- Posible inconstitucionalidad por el fondo. 1.- Teniendo a la vista algunos de los antecedentes considerados en la Comisión Dictaminadora, que según los legisladores, evidencian un manejo equilibrado de los recursos costeros y marinos, consultan si la reapertura del otorgamiento de permisos y licencias semi-industriales objeto de la iniciativa consultada, conlleva una violación a los artículos 6 y 7 Constitucionales, en cuanto posibilitan la aplicación de normas de derecho internacional de protección ambiental, del principio de no regresión ambiental y del principio de intangibilidad del dominio público ambiental.
2. 2Ante esta misma Sala pende el expediente número 19-023057-00-07-CO, planteado previamente por CAROLINA HIDALGO HERRERA, CATALINA MONTERO GÓMEZ, ENRIQUE SÁNCHEZ CARBALLO, JORGE LUIS FONSECA FONSECA, JOSÉ MARÍA VILLALTA FLOREZ ESTRADA, KARINE NIÑO GUTIÉRREZ, LAURA GUIDO PÉREZ, LUIS ANTONIO AIZA CAMPOS, MARÍA JOSÉ CORRALES CHACÓN, MARIO CASTILLO MÉNDEZ, NIELSEN PÉREZ PÉREZ, PAOLA ALEXANDRA VALLADARES ROSADO, PATRICIA VILLEGAS ÁLVAREZ, ROBERTO THOMPSON CHACÓN, WALTER MUÑOZ CÉSPEDES, WELMER RAMOS GONZÁLEZ, en el que se consulta acerca del mismo proyecto que es objeto de examen en el sub examine.
3. 3La copia certificada del expediente legislativo número 21.478 aún no ha sido recibida en el Tribunal. En consecuencia, el plazo para evacuar la consulta no ha empezado a correr.

Redacta el Magistrado Castillo Víquez; y,

Considerando:

Único.- Ante la evidente conexidad que existe entre los extremos planteados en este asunto y los que son objeto del expediente número 19-023057-0007-CO que se tramita ante esta Sala, y a fin de evitar resoluciones contradictorias que pudieren afectar los derechos e intereses de los interesados, se estima oportuno y conveniente proceder a acumular este expediente al citado.

Por tanto:

Acumúlese esta consulta a la que bajo expediente número 19-023057-0007-CO se tramita ante esta Sala y téngase como ampliación de la misma.
