Amparo proceeding (recurso de amparo) filed by ALLAN FERNANDO RIVERA BENAVIDES, identity card number 0109290361, against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.
Facts:
• Incorporation of the Pozo Zamora into the Acueducto Metropolitano. Design, construction, and commissioning of a new sedimentation tank at Los Sitios. • Río Agra Project. • Installation of piping and interconnection between Santa Ana and Puente Mulas II. Furthermore, it is important to bring to the attention of this Honorable Court that, as an additional supply measure, water is being distributed by tanker trucks in the affected areas. With regard to non-revenue water (agua no contabilizada), AyA has a program that has worked to reduce this component. It states that non-revenue water consists of actual and apparent losses; therefore, it is incorrect to claim “that AyA wastes 50% of its production,” because the apparent losses included in that percentage consist of water that was not billed, such as the flow allocated to supplying communities in areas of concentrated poverty. In addition, there are actual losses that cannot be eliminated, for example, water lost from the systems during operational processes, such as sanitary washing of tanks and treatment plants to ensure that the water is potable, or flows allocated to firefighting.
Non-revenue water is generally associated immediately with leaks; however, that is only one component of the percentage of non-revenue water. Although efforts are being made to address this reduction in the flows available to the population due to physical losses, eliminating all leaks would not, by itself, resolve the current deficit of the Acueducto Metropolitano. Nevertheless, it must be made clear that this does not mean that the percentage of losses caused by leaks is not being addressed; in fact, leak-response times have been reduced. According to data from AyA’s SIGOS system, in 2020, compared with 2019, there was a 13% reduction in the total time taken to address leaks, including road-surface repairs; additionally, since last year, work has been under way to contract on-demand leak-repair services precisely to improve these response times even further. Tendering process (licitación) 2019LN-00015-PRI is currently under way and is scheduled to be awarded on 16 de abril del 2020, provided that no appeals are filed against the process.
It adds that, with respect to the replacement of water meters (hidrómetros), the information presented by the appellant (recurrente) in his argument is outdated, since the appeals concerning public tender N°2016LN-00002-PRI conducted by the Institution were resolved in late 2019, and a contract is currently in force; therefore, the replacement and installation of new water meters is under way. There is an installation plan that provides for the replacement of stopped and destroyed meters and meters recording consumption greater than 3000 meters, as well as other uses, such as the installation of new services, replacement due to theft, and meters for testing. The solution to the supply problems for the next 15 to 20 years is the Fifth Stage of the Acueducto Metropolitano project, also known as the “Proyecto Ampliación Acueducto Metropolitano (PAAM),” which seeks to increase production benefiting the Gran Área Metropolitana by up to 2500 liters per second and is projected to be completed in 2025.
In all cases, the solutions are not immediate and require time to develop, but work is being done on them, just as it has been on the incorporation of new projects that have already been added to the Acueducto Metropolitano. It should be emphasized that, since last year, AyA has also taken the initiative to meet with communities and community leaders and explain the situation facing the country. Among the places visited by AyA officials is the community of Zapote, and Mr. Allan Fernando Rivera Benavides has participated in those meetings; the situation has been explained to him, and he is aware of the information set forth herein. As evidence thereof, Anexo 3 to the report supporting this submission includes the attendance lists from two meetings: one held with the residents of Zapote at the Salón Comunal and another held when he was received at the Sub Gerencia de Gestión de Sistemas GAM.
Furthermore, through informational campaigns and press conferences, the Institution most respectfully asks the public that, if water is stored, it be used solely for essential purposes such as cleaning and personal hygiene, as well as cooking, and that, when water service resumes, any water still in storage not be wasted but instead be used for toilets or some other activity that does not entail discarding it, since doing so causes a greater impact than anticipated. It also asks that we try to ration the manner in which the available resource is used, especially by those who do have a water supply, because if people without supply problems were to save part of what they currently consume each day, this would help alleviate the problems faced by those experiencing disruptions. It requests that this appeal be dismissed.
Justice Hernández López drafts the opinion; and,
Whereas:
I.Subject matter of the appeal. The appellant alleges that Zapote and other sectors of the Gran Área Metropolitana have experienced extensive drinking-water rationing by the respondent entity. Indeed, since January, print, digital, radio, and television media have repeatedly reported on the matter. He asserts that the arguments used to justify the inefficient provision of the public service—high consumption by the population and the drought caused by the phenomenon of Climate Change, which lower aqueduct tank levels—are untrue, because numerous news articles highlight poor water-management practices in the Gran Área Metropolitana and the respondent entity’s delays in providing the service. In light of the foregoing, he considers that they have been subjected to discriminatory treatment that violates their fundamental rights.
II.Proven facts. The following facts relevant to the decision in this matter are deemed duly established: a) in January of every year shown, production increases; this growth occurs because demand begins to rise, and the institution operates production at maximum capacity to meet it; however, the sources generally begin to be depleted as of February (report submitted under oath); b) Zapote, the sector referred to by the appellant, is located in the San José Operations area and is supplied by the Tanques de Curridabat, which store water produced at the Planta Potabilizadora de Tres Ríos; this sector is affected by supply shortages (report submitted under oath); c) the combined effect of both phenomena—the increase in demand and the decrease in the resource available for treatment—causes a deficit and, consequently, a supply shortage (report submitted under oath); d) regarding the failure to follow the published supply-interruption schedules, another factor to consider is that the pipeline network itself functions as a very large storage tank, even larger than the Tanques del Curridabat, and once the storage tanks are emptied, water remains inside the pipelines, with no means of detecting when they have emptied; that is, once the tank becomes empty, the pipeline begins to discharge, but at an unknown rate, making it nearly impossible to predict when the water available to each user will run out (report submitted under oath); e) through its supply-interruption notices, the Institution indicates a time at which it believes the population, on average, will be without service; however, at the stated time, some people in the lower parts of the pressure zone will still have service, while those living in the higher areas will already have been without service for some time (report submitted under oath); f) Licenciado Pablo González González, head of UEN Servicio al Cliente Zona1 GAM of the Instituto Costarricense de Acueductos y Alcantarillados, reported through memorandum N°UEN-SCZ1-GAM-2020-00360, dated 17 de marzo del 2020, that, with respect to supply-shortage notices in the area, AyA makes the following communication channels available to users:
III.Background.- This Chamber has ruled on the issue raised in this constitutional protection proceeding (amparo) on various occasions. Among others, in judgment number 2019008193 of 9:20 hours on 10 de mayo de 2019, it held as follows:
“REGARDING THE DRINKING-WATER SERVICE. On repeated occasions, this Court has denied appeals such as the one before us because the area in which service is requested lies above the supply elevation threshold (cota de abastecimiento)—that is, the maximum elevation at which service can be provided—or because of other technical constraints and objective budgetary limitations. Specifically concerning supply problems, after recognizing that the supply of drinking water constitutes an essential, fee-based public service, the Chamber’s case law has focused primarily on protecting natural persons’ rights to life and health. Thus, ensuring the purity of water intended for human consumption and continuity of its supply are part of the proper and efficient service owed to subscribers (see judgment Nº 004253-2014). Additionally, concerning drinking-water supply problems, this Court has stated that insofar as the respondent authorities demonstrate that they have acted within their material capabilities to achieve an adequate supply, individuals’ fundamental rights are not violated if the service is provided with some irregularities in flow or supply schedules (see, in this regard, this Chamber’s holdings in judgments Nº 2008-009714, 2008-018788, 2009-012511, 2010-015448 y 2011-006603, among others).” Later, that same judgment adds the following:
“From the reports submitted by the respondent authorities (autoridades recurridas), which are given under oath with the legal consequences that this entails, it is verified that there is indeed a water shortage (desabastecimiento de agua) in the Hatillo de San José sector, which has been aggravated by the considerable demand for drinking water and climatic conditions. From the foregoing, it is clear that the shortage alleged by the petitioner (recurrente) in this matter is not the responsibility of the Instituto Costarricense de Acueductos y Alcantarillados, but rather the result of climatic factors and the lack of consideration in water use by residents in the lower-lying areas of the sector referred to by the petitioner.”
IV.On the merits.- The report submitted to this Court by the respondent authorities, following due warning of the consequences provided for in Article 44 of the Ley de la Jurisdicción Constitucional, establishes that the drinking-water shortage reported by the petitioner is due to climatic conditions, given that this is the dry season, during which the flow rates (caudales) of the sources decrease and, in addition, the population changes its consumption habits and demands a greater quantity of water, thereby causing a deficit. It further shows that the community of Zapote, which is the specific sector referred to by the petitioner, is located within the San José Operating Zone and is supplied by the Tanques de Curridabat, which store water produced at the Planta Potabilizadora de Tres Ríos; this sector is affected by shortages resulting from increased demand and a decrease in the water resource available for treatment.
With respect to the problem that the shortage schedules do not match those published, the respondent authority states under oath that this occurs because the pipeline network itself functions as a very large storage tank, even larger than the Tanques de Curridabat, and once the storage tanks have been emptied, water remains within the pipelines, with no means of detecting when they have emptied; in other words, once the tank is empty, the pipeline gradually discharges, but at an unknown rate, making it nearly impossible to predict when the available water will run out for each user. For this reason, in its water-shortage notices, the institution specifies a time when it believes that, on average, the population will no longer have service; however, at the indicated time, some people in the lower-lying parts of the pressure zone will still have service, while those living in the higher areas will already have been without service for some time.
It is also stated that, for each of the services made available to users, events affecting those services are published as promptly as possible once the information has been received from the aqueduct’s operations area. The report submitted by the respondent authority also shows that there are many sectors where rationing (racionamientos) cannot be implemented, and this causes public dissatisfaction because people believe that the institution is deliberately affecting certain communities, but this is not the case. It is noted that what occurs is that this is technically impossible, because for water to reach the sectors already affected, it must necessarily first pass through other sectors; for example: All the Barrio México networks are connected upstream of Tanques del Sur; for the resource to reach Tanques del Sur and supply this operating zone, the population of Barrio México must first be supplied, so if water were rationed in Barrio México, less water would reach Tanques del Sur and the impact on the southern neighborhoods would be greater.
The same occurs in Alajuelita: most of the water supplying Alajuelita comes from Santa Ana and first passes through Escazú; if rationing were implemented in Escazú, less water would be available to the residents of Alajuelita who are being affected. The same occurs in Zapote: for water to reach the Tanques de Curridabat, it must first supply sectors of La Unión; once again, rationing water in any manner in these sectors of La Unión would prevent the water from reaching the Tanques de Curridabat and would have a greater impact on Zapote. The evidence additionally shows that the respondent institute has coordinated with the Instituto Costarricense de Electricidad (ICE) to extract more water from the reservoir during this dry season in order to increase production in Tres Ríos, and since Friday 6 de Marzo del 2020, approximately 100 l/s of additional flow has been available at the Planta de Tres Ríos to reinforce some of the affected systems, including the zone supplied by Tanques de Curridabat.
The Instituto Costarricense de Acueductos y Alcantarillados has also invested, over the last 6 years (del 2014 al 2020), 115% more than the cumulative investment made during the preceding 14 years. Among the projects that may be cited and that benefit the GAM, nearly 500 liters per second were added over the last two years through the Doña Lela, San Miguel and Palermo wells and CNP 7, 8 y 9. Last year, the Chigüite well began operating, adding 20 liters per second to the Tres Ríos system and thereby directly supporting the Curridabat system. Projects currently under way include: • Rehabilitation of the W5 well, which had lost its flow and was placed into operation on 12 de Marzo. • Redrilling of wells W06, W10 y W11. • Drilling of new wells: La Florida 2, W19 y W20. • Design, construction and commissioning of a new rising main (tubería de impulsión) in the La Valencia system. Design, construction and commissioning of a new rising main in the system and along the Santa Ana- Puente de Mulas line. • Construction of a transmission main (línea de aducción) in Los Sitios Moravia. • Design, construction and commissioning of a pumping station in the La Valencia system. • Improvements to pumping from Tanque La Uruca toward Tanques del Sur. • Construction of a new storage tank in Guadalupe. • And use of water from Ojo de Agua. • Incorporation of the Pozo Zamora into the Acueducto Metropolitano.
Design, construction and commissioning of a new sedimentation basin in Los Sitios. • Río Agra project. • Installation of pipeline and Santa Ana-Puente Mulas II interconnection. In light of the foregoing, this Chamber finds it established that the shortage is not due to arbitrary or negligent conduct by the water-supply and sewerage authorities. It also follows that the authorities, being aware of these problems, are taking measures to remedy the shortage. Accordingly, it is ruled out that the shortage is occurring for arbitrary reasons; quite the contrary, works, improvements and operational measures are being maintained to improve the supply to the affected communities, and efforts are also being made to establish an interconnection with other systems to increase the water supply. Consequently, the petition is denied.
V.Notwithstanding the foregoing, the General Manager of the Instituto de Acueductos y Alcantarillados is urged to adopt measures so that, whenever a drinking-water shortage lasts for several hours, the lack of water is remedied and residents of the community are provided with water service through tanker trucks or another technically suitable means.
VI.Documentation submitted to the case file (expediente). The parties are hereby advised that, if they have submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical or telematic device or produced using new technologies, these must be collected from the court office within a maximum period of 30 business days counted from notification of this judgment. Otherwise, any material not collected within that period shall be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session N° 27-11 del 22 de agosto del 2011, Article XXVI, and published in Boletín Judicial number 19 del 26 de enero del 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 de mayo del 2012, Article LXXXI.

Recurso de amparo interpuesto por ALLAN FERNANDO RIVERA BENAVIDES, cédula de identidad 0109290361, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTANTARILLADOS.
Resultando:
Redacta la Magistrada Hernández López; y,
Considerando:
I.Objeto del recurso. El recurrente aduce que en Zapote y otros sectores del Gran Área Metropolitana, han sufrido grandes racionamiento de agua potable, por parte del ente recurrido. Incluso, desde enero, tanto medios escritos, digitales, radiales y televisivos, han informado reiteradamente sobre el particular. Afirma que los argumentos que se ha utilizado para justificar la prestación ineficiente del servicio público -alto consumo por parte de la población y la sequía producida por el fenómeno del Cambio Climático, bajan los niveles de los tanques de acueductos-, pero no son veraces, pues numerosos artículos periodísticos resaltan la mala gestión en el manejo del agua en la Gran Área Metropolitana y rezago en la prestación del servicio por parte del ente recurrido. Por lo anterior, estima que se les ha brindado un trato discriminatorio, es violatorio de sus derechos fundamentales.
II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos: a) en el mes de enero en todos los años mostrados se da un crecimiento de la producción, este crecimiento se da porque inicia este aumento de la demanda, y la institución para suplirla pone en al máximo su producción, sin embargo generalmente a partir de mes de febrero se comienzan a agotar las fuentes (informe rendido bajo juramento); b) en el caso de Zapote, que es el sector al que hace referencia el recurrente, se ubica en la zona de Operación de San José, se abastece de los Tanques de Curridabat, que almacenan agua que se produce en la Planta Potabilizadora de Tres Ríos, este sector está afectado por desabastecimientos (informe rendido bajo juramento); c) el efecto de ambos fenómenos (el aumento de la demanda y la baja en el recurso disponible para potabilizar) provoca déficit y por lo tanto se da el desabastecimiento (informe rendido bajo juramento); d) en relación a la problemática de que los horarios de desabastecimiento no se cumplen con respecto a los publicados por la Institución otro factor a considerar, es que la red de tuberías funciona en sí misma como un tanque de almacenamiento de un gran tamaño, incluso más grande que los Tanques del Curridabat y una vez que los tanques de almacenamiento son vaciados, existe agua dentro de las tuberías que no se tiene como detectar su vaciado; es decir, una vez que el tanque se queda vacío la tubería se va descargando, pero a una tasa que no es conocida, lo que hace que sea casi imposible predecir a qué hora se le va a ir acabando el agua disponible para cada usuario (informe rendido bajo juramento); e) la Institución a través de sus boletines de aviso de desabastecimiento indica una hora en la que se cree que en promedio la población no tendrá servicio, sin embargo, en el horario indicado, habrá gente (de las partes más bajas de la zona de presión) que aún tenga servicio, mientras que los que viven en las partes más altas, ya tienen rato sin estar con el servicio (informe rendido bajo juramento); f) el Licenciado Pablo González González, encargado de la UEN Servicio al Cliente Zona1 GAM del Instituto Costarricense de Acueductos y Alcantarillados, mediante memorando N°UEN-SCZ1-GAM-2020-00360, de fecha 17 de marzo del 2020, informa que, en referencia a los comunicados por desabastecimiento en la zona, que el AyA, pone a disposición de los usuarios los siguientes medios de comunicación: 1) -Línea 800-REPORTE (800-7376783): Mediante el servicio de atención 800-REPORTE (800-737-6783) disponible las 24 horas los 365 días del año, los usuarios pueden consultar los eventos que afectan la prestación del servicio o bien realizar reportes por faltantes de agua para que se generen las acciones respectivas por parte de la Institución.2) - Página web de AyA: https://www.aya.go.cr cuenta con una sección denominada Interrupciones de Servicio/ Faltantes de Agua, donde el usuario pueden consultar los boletines emitidos por la Institución por afectación del servicio. De igual forma en esta página puede realizar consultas mediante el servicio de CHAT.
III.Antecedentes.- Sobre el tema planteado en este amparo esta Sala se ha pronunciado en diversas oportunidades. Entre otras, en sentencia número 2019008193 de las 9:20 horas del 10 de mayo de 2019, lo hizo en los siguientes términos:
“SOBRE EL SERVICIO DE AGUA POTABLE. En reiteradas ocasiones este Tribunal ha desestimado recursos como el que nos ocupa, debido a que la zona en la que se reclama el servicio supera la cota de abastecimiento -es decir, la altura máxima para otorgar el servicio-, o a otras imposibilidades técnicas y presupuestos objetivos. Concretamente en cuanto a problemas de abastecimiento, tras reconocer que el suministro de agua potable constituye un servicio público esencial y oneroso; la jurisprudencia de la Sala se ha dirigido fundamentalmente a la protección del derecho a la vida y a la salud de las personas físicas. Así, garantizar la pureza del líquido para consumo humano y la continuidad en el suministro de éste forman parte de un debido y eficiente servicio al abonado (véase la sentencia Nº 004253-2014). Adicionalmente, este Tribunal ha indicado, en relación con los problemas de abastecimiento de agua potable, que en el tanto las autoridades recurridas demuestren que se ha actuado dentro de sus posibilidades materiales a fin de lograr un adecuado abastecimiento, no se quebrantarían los derechos fundamentales de las personas si éste se ofrece con algunas irregularidades de caudal, u horario de suministro (ver, al respecto, el criterio de esta Sala en las sentencias Nº 2008-009714, 2008-018788, 2009-012511, 2010-015448 y 2011-006603, entre otras).” Más adelante, agrega esa misma sentencia lo siguiente:
“De los informes rendidos por las autoridades recurridas los cuales son dados bajo la solemnidad del juramento con las consecuencias legales que ello implica se verifica que efectivamente en el sector de Hatillo de San José, existe un problema de desabastecimiento de agua, que se ha agravado por la considerable demanda de agua potable y la situación climática. De lo expuesto, es claro que el desabastecimiento acusado por la recurrente en este asunto no es responsabilidad del Instituto Costarricense de Acueductos y Alcantarillados, sino de factores climáticos y de falta de consideración del uso del agua de los habitantes es las zonas más bajas del sector al que se refiere el recurrente”.
IV.Sobre el fondo.- Del informe rendido por parte de las autoridades recurridos a este Tribunal, con oportuno apercibimiento de las consecuencias previstas en el artículo 44 de la Ley de la Jurisdicción Constitucional, se acredita que la situación de desabasto de agua potable que denuncia el recurrente obedece situaciones climatológicas dado que estamos en época seca, y en ésta época, se producen reducciones en los caudales de las fuentes y adicionalmente la población cambia sus hábitos de consumo demandando una mayor cantidad de agua, lo que provoca un déficit. Además, se extrae que la comunidad de Zapote que es el sector al que hace referencia el recurrente específicamente, se ubica en la zona de Operación de San José, se abastece de los Tanques de Curridabat, que almacenan agua que se produce en la Planta Potabilizadora de Tres Ríos, y este sector está afectado por desabastecimientos, por efecto de aumento de la demanda y la baja en el recurso disponible para potabilizar.
En relación a la problemática de que los horarios de desabastecimiento no se cumplen con respecto a los publicados, la autoridad recurrida bajo juramento indica que se presenta, porque la red de tuberías funciona en sí misma como un tanque de almacenamiento de un gran tamaño, incluso más grande que los tanques de Curridabat y una vez que los tanques de almacenamiento son vaciados, existe agua dentro de las tuberías que no se tiene como detectar su vaciado; es decir, una vez que el tanque se queda vacío la tubería se va descargando, pero a una tasa que no es conocida, lo que hace que sea casi imposible predecir a qué hora se le va a ir acabando el agua disponible para cada usuario. Por esta razón, la institución a través de sus boletines de aviso de desabastecimiento indica una hora en la que se cree que en promedio la población no tendrá servicio, sin embargo, en el horario indicado, habrá gente (de las partes más bajas de la zona de presión) que aún tenga servicio, mientras que los que viven en las partes más altas, ya tienen rato sin estar con el servicio.
Se menciona además que en cada uno de los servicios dispuestos para los usuarios, los eventos que afectan los servicios son publicados a la brevedad, una vez recibida la información de parte del área de operación del acueducto. Del informe rendido por la autoridad recurrida, también se extrae que existen muchos sectores en los que no se pueden realizar racionamientos y eso provoca el malestar de la población pues siente que la institución afecta a propósito a ciertas poblaciones, pero esto no es así. Se señala que, lo que ocurre es que técnicamente no es posible, pues para que el agua llegue a los sectores ya afectados necesariamente primero debe pasar por otros sectores; por ejemplo: Todas las redes de Barrio México están conectadas antes de Tanques del Sur; para que el recurso llegue a Tanques del Sur y abastezca a esta zona de operación, primero tiene que abastecerse la población de Barrio México, por lo que si se racionara el agua en barrio México menos agua llegará a Tanques del Sur y la afectación sería mayor para los barrios del Sur.
Lo mismo pasa en Alajuelita, la mayoría del agua que abastece a Alajuelita proviene de Santa Ana y pasa primero por Escazú; si se realizaran racionamientos en Escazú, menos agua estaría disponible para los vecinos de Alajuelita que se están viendo afectados. Lo mismo sucede en Zapote, para que el agua llegue a los Tanques de Curridabat, primero debe abastecer a sectores de La Unión, nuevamente el racionar de alguna manera en estos sectores de La Unión impediría que el agua llegue a los Tanques de Curridabat y se tendría una mayor afectación en Zapote. Adicionalmente se extrae de la prueba que el instituto recurrido, ha coordinado con el Instituto Costarricense de Electricidad (ICE), con el fin de extraer más agua del embalse en esta época seca con la finalidad de aumentar la producción en Tres Ríos, y a partir del viernes 6 de Marzo del 2020 se dispone de alrededor de 100 l/s adicionales de caudal en la Planta de Tres Ríos para reforzar algunos de los sistemas afectados entre los que se incluye el de la zona abastecida por Tanques de Curridabat.
También el Instituto Costarricense de Acueductos y Alcantarillados ha invertido en los últimos 6 años (del 2014 al 2020) un 115% más que la inversión acumulada en los últimos 14 años, entre los proyectos que podemos citar y que benefician a la GAM se incorporaron en los últimos dos años cerca de 500 litros por segundo con los pozos Doña Lela, San Miguel y Palermo y los CNP 7, 8 y 9. El año pasado se puso a operar el pozo Chigüite, que incorpora 20 litros por segundo al sistema de Tres Ríos con lo que se ayuda directamente al sistema de Curridabat. Entre los proyectos en los que se está trabajando actualmente se encuentran: • La rehabilitación del pozo W5 que había perdido su caudal y que fue puesto en operación el pasado 12 de Marzo. • La reperforación de los Pozos W06, W10 y W11. • La perforación de nuevos pozos: La Florida 2, W19 y W20. • El diseño, construcción y puesta en marcha de una nueva tubería de impulsión en el sistema La Valencia.
El diseño, construcción y puesta en marcha de una nueva tubería de impulsión en el sistema y en línea Santa Ana- Puente de Mulas. • La construcción de una línea de aducción en Los Sitios Moravia. • Diseño, construcción y puesta en operación de una caseta de bombeo en el sistema La valencia. • Mejoras en la impulsión desde el Tanque La Uruca hacia Tanques del Sur. • Construcción de un nuevo tanque de almacenamiento en Guadalupe. • Y aprovechamiento del agua de Ojo de Agua. • Incorporación al Acueducto Metropolitano del Pozo Zamora. Diseño, construcción y puesta en operación de un nuevo sedimentador en Los Sitios. • Proyecto río Agra. • Instalación de tubería e interconexión Santa Ana-Puente Mulas II. En virtud de lo señalado, esta Sala tiene por acreditado, la situación de desabasto no obedece a una actuación arbitraria, ni negligente por parte de las autoridades de acueductos y alcantarillados.
Además se extrae que las autoridades conocedores de estos problemas, están tomado medidas para solventar la carencia. Así las cosas, se descarta que el desabastecimiento se esté presentado por razones arbitrarias, sino más bien todo lo contrario debido a que mantienen obras, mejoras y maniobras para mejorar el abastecimiento de las localidades afectadas, así como están tratando de realizar una interconexión con otros sistemas para aumentar el abastecimiento del agua. En consecuencia, se declara sin lugar el recurso.
V.No obstante, lo anterior, se insta al Gerente General del Instituto de Acueductos y Alcantarillados, adoptar medidas para que cuando el desabastecimiento de agua potable se presente por un período de varias horas, se supla la carencia de agua y se brinde a los vecinos de la localidad, el servicio de agua a través de camiones cisterna u otra forma técnicamente adecuada.
VI.Documentación aportada al expediente. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre Expediente Electrónico ante el Poder Judicial", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara sin lugar el recurso. Tome nota la autoridad recurrida de lo dispuesto en el considerando V de esta sentencia.- Fernando Castillo V.
