Document Review *200034300007CO* Case: 20-003430-0007-CO Decision No. 2020006692 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine twenty hours on tres de abril de dos mil veinte.
Application for amparo (recurso de amparo) processed under case number 20-003430-0007-CO, filed by ISABEL ASCENSION DIAZ RIVEL, identity card 0502370960, against MINISTERIO DE SALUD, MUNICIPALIDAD DE LIMON.
Background:
In a written submission received by the Secretariat of the Chamber at 16:56 hours on 20 de febrero de 2020, the petitioner filed an application for amparo against the Municipalidad de Limón and the Ministerio de Salud, stating that she is a resident of Residencial Caribe in Nueve Millas de Limón, where for many years they have experienced problems involving wastewater, including sewage and gray water, which have worsened. She states that an application for amparo was previously filed concerning this problem (see case Nº 14-004560-0007-CO), in which the respondent municipality was ordered to construct the residential development’s sanitary sewer system and wastewater treatment plant. Nevertheless, she alleges that the respondent municipality merely constructed the sanitary sewer system, but not the wastewater treatment plant. She asserts that this omission means the sewage and gray water are not being treated and therefore remain exposed in the open air, generating foul odors and creating a lagoon of contaminated water in the area.
She states that, as regards the Ministerio de Salud, although it is aware of the situation, its only action has been to refer the complaint for noncompliance to the Ministerio Público. The underlying problem, however, remains without a comprehensive solution. She argues that, because of the contamination, children, older adults, and the other residents of the residential development have been living for more than 10 years in deplorable conditions, surrounded by sewage that constitutes a source of contamination. She considers that the facts described violate her fundamental rights. She requests that the application be granted.
By decision issued at 16:53 hours on 24 de febrero de 2020, the present application was admitted for processing, and the respondents were notified on 13 de marzo de 2020.
Guiselle Lucas Bolivar, in her capacity as Director of the Área Rectora de Salud en Limón, reports under oath that the background to this case includes the application for amparo processed under case Nº 08-006699-007-CO, in which an order was issued to comprehensively resolve the wastewater and sewage treatment problem in Urbanización El Caribe. She states that, through several health orders (órdenes sanitarias), the Mayor was ordered to submit a progress report on the actions undertaken to resolve the problem; this request was reiterated on other occasions, but, because no response was received, the case was referred to the Ministerio Público for failure to comply with health orders. Through report AML-0861-2019, the Municipality reported that the system design and financial estimate had been completed and that it was in the process of obtaining financial resources for the final wastewater treatment system for Residencial Caribe. A technical opinion was requested regarding the submitted documentation, and, following the deficiencies identified, a new health order (MS-DRRSHC-ARSL-0351-2019-OS) was issued. That order was likewise not complied with, and the corresponding complaint was therefore filed with the Fiscalía. She considers that all technical and administrative actions necessary to follow up on the case have been taken and requests that the application be dismissed.
Nestor Mattis Williams and Margina Reid Reid, in their respective capacities as Mayor and President of the Council of the Municipalidad de Limón, report under oath that the sanitary sewer system was constructed at an approximate cost of one hundred million colones. They state that reports and designs for construction of the treatment plant are already available, but an additional one hundred fifty million is required, which the municipality does not currently have. They request that the application be dismissed.

Considerations:
Subject matter of the application. The petitioner considers it a violation of her fundamental rights that, despite having filed several applications and requests, the wastewater, sewage, and gray-water problem at Residencial Caribe has not been resolved, leaving residents exposed to foul odors and contamination.
Proven facts. The following facts relevant to deciding this matter are deemed duly established, either because they have been substantiated or because the respondent failed to address them as required in the initial order:

Regarding the Fundamental Right to a Healthy and Ecologically Balanced Environment. On numerous occasions, this Court has developed the substance of this right, enshrined in Article 50 of the Constitución Política. Environmental protection is an appropriate mechanism for safeguarding and improving everyone’s quality of life, making intervention by public authorities necessary with respect to factors that may disrupt its balance and prevent individuals from developing and living in a healthy environment. The State is the guarantor of the protection and preservation of the environment and natural resources. In this regard, oversight and enforcement concerning environmental matters and activities constitute an essential function of the State. Accordingly, where environmental protection is concerned, the functions of governance, oversight, and enforcement in environmental matters belong to the State and are entrusted to its various administrative agencies.
Regarding the Actions of the Municipal Authorities. The present matter alleges that the Municipalidad de Limón has not complied with this Chamber’s orders to resolve the wastewater and gray-water problem at Residencial Caribe in Nueve Millas de Limón and that the problem persists despite the criminal complaints pursued by the health authorities. The Código Municipal requires the municipalities of each canton to ensure that the public is guaranteed the real and effective enjoyment of the right to health and to a healthy environment. It is undisputed that the reported problem was previously heard by this Chamber in cases Nº 08-006699-0007-CO and 14-004560-0007-CO and that, in both cases, noncompliance with the orders issued was established and certified copies of the relevant records were even forwarded to the Ministerio Público. An examination of the record establishes that, to date, the Municipalidad de Limón has taken no concrete action aimed at constructing the required treatment plant, citing budgetary reasons.
In this Chamber’s judgment, the matter before us involves a serious public-health problem that affects the environment and the health of the community’s inhabitants, and it is established that the Municipalidad de Limón has demonstrated an inability to enforce the applicable laws and fulfill its obligation to guarantee the inhabitants of the area the enjoyment of a healthy and ecologically balanced environment, with resulting consequences for their health due to the nature of the public-health problem affecting them. In settled case law, the Chamber has held that human beings cannot be denied the right to a healthy environment and the right to health because the corresponding public authorities are unable to exercise effectively the oversight and problem-solving powers granted to them by law. The persistence of the problem demonstrates that the few actions taken have clearly been insufficient, thereby giving rise to liability for omission (responsabilidad por omisión) in the exercise of those powers, which in turn infringes the constitutional right of the public to receive efficient and effective public services. For the foregoing reasons, the application must be granted as to this claim.
Regarding the Actions of the Health Authorities. For their part, the health authorities, being fully aware of the problem affecting the residents of the area, have followed up on the case, verified the existence of the problem, issued the appropriate health orders, confirmed noncompliance with them, and reported their non-enforcement in criminal proceedings. Accordingly, the application must be dismissed as to this claim, because no action or omission by the authorities of the Área Rectora de Salud has been established that threatens or violates the protected party’s fundamental rights; rather, the record shows that the authorities acted diligently within the scope of their powers.
Conclusion. In this context, it is established that, despite the passage of more than eleven years since the first judgment, the respondent municipal authorities have not taken timely, concrete action to mitigate or control the reported problem. For the reasons stated, this application against the Municipalidad de Limón must be granted due to the violation of Articles 50 and 21 of the Constitución Política, to the detriment of the petitioner and the other residents of the area.
NOTE BY JUSTICE HERNÁNDEZ LÓPEZ REGARDING THE CLAIM OF A VIOLATION OF ARTICLE 50 OF THE CONSTITUCIÓN POLÍTICA.
1. The historical context that originally prompted the Chamber’s extensive intervention in environmental matters has changed considerably, requiring this body to reconsider the conditions for its participation in safeguarding the right of persons to a healthy and ecologically balanced environment, as protected by Article 50 of the Political Constitution. Indeed, the current situation—characterized by an extremely broad body of statutory and regulatory law that includes substantive rules, procedures, and the creation of bodies to ensure compliance with the provisions of the Fundamental Charter—is radically different from the previous situation, in which the absence of regulations and of government bodies with appropriate jurisdiction compelled the Chamber to assume a leading, almost exclusive role in defending the aforementioned constitutional right.
2. Today, we face a “dense web” of environmental regulations, which has produced two significant phenomena: the first and most obvious is the emergence of comprehensive legal regulation of activities whose impact on the environment had previously been subject to little or no regulation, as well as the creation of government bodies with powers to monitor and control the effects of human activity on the environment. The second phenomenon is that this increasing legalization—predominantly through statutes and regulations—necessarily entails the involvement of both administrative justice (justicia administrativa) and the ordinary courts (jurisdicción ordinaria)—primarily the contentious-administrative jurisdiction (jurisdicción contencioso administrativa), but also the criminal jurisdiction. Consistent with the importance of environmental law, these jurisdictions have been provided with broad procedural avenues and inclusive means of standing (medios de legitimación), so that governed persons may enforce the provisions of that extensive legal framework relating to environmental matters.
3. In that context, it is neither legally nor functionally appropriate for the Constitutional Chamber to displace—or, worse still, replace—the ordinary courts in carrying out their task, which is also constitutional in rank, of ensuring effective compliance with statutes and regulations. It is legally inappropriate because, in the vast majority of these cases, the Chamber is asked to interpret and enforce statutory and regulatory provisions, thereby risking an overlap between its jurisdiction and that of other judicial bodies specifically created to perform such tasks; it is also functionally improper because the design of its proceedings is ill-suited to the complexity present in numerous environmental disputes, which consist of technically and legally complex series of facts and acts. There are well-known examples involving both issues in which the Chamber has issued a partial or technically incomplete decision, or in which unnecessary friction and harm to legal certainty have arisen.
4. Among the technical considerations I have assessed, I would add that this jurisdiction does not have judges responsible for enforcing judgments (jueces ejecutores de sentencia) who could adequately monitor compliance with such judgments—which are generally complex—and which sometimes entail monitoring remedial plans, among other measures, with interinstitutional coordination and follow-up lasting months or even years.
5. From that perspective, this Court’s decision to step aside in environmental matters should not be viewed as an abandonment of environmental protection but, on the contrary, as ensuring its proper protection before the forum best suited to its complex and diverse nature. Nor should it be viewed as this forum declining the task of protecting constitutional rights imposed upon it by the Political Constitution and its Organic Law, a task which, in my view, remains reserved in this field for specific cases. Instead, it is an exercise in reallocating the responsibilities and tasks assigned to the various government bodies, so that each may fully perform its work within its assigned sphere, as well as an exercise of the Chamber’s authority to define its own jurisdiction, as established in Article 7 of its Organic Law.
6. It is clear that the Chamber does not intend to leave the protection of persons’ rights in environmental matters entirely to other jurisdictions. It is well known that, although any claim alleging a violation of statutory or regulatory provisions may ultimately be brought within the constitutional sphere, some cases require nothing more for their resolution than the application of constitutional law. The objective, therefore, is for the Chamber to become one of several leading actors so that—collectively, with each acting within its own sphere—the full range of situations involved in protecting the right to a healthy and ecologically balanced environment may be addressed within a society that also has other equally pressing needs. I firmly believe that, under this position, citizens do not lose the slightest degree of protection, while substantial gains are made in breadth, perspective, and respect for the balance and distribution of powers, the latter being a principle that must necessarily be considered because it governs the constitutional dynamics of any liberal and democratic system such as ours.- 7.
Consistent with the foregoing, I maintain that this Chamber should refrain from hearing claims alleging violations of Article 50 of the Political Constitution and should leave their consideration to administrative justice and the contentious-administrative jurisdiction. The foregoing is stated as a general rule, without prejudice to recognizing that there are particular cases or groups of cases which, in my view, would still be better protected by this Chamber and should therefore be heard and decided by it.- Among such groups of cases, without this enumeration being regarded as a closed and definitive list, I would indicate that the Chamber should retain jurisdiction over situations such as claims involving environmental violations that also directly endanger human health or access to or the quality of water; cases involving gross and direct violations of the environment in which there is a manifest absence of protection by government authorities, provided that the nature of the claim also allows it to be addressed through an amparo proceeding (amparo) as a summary and special procedural mechanism, since I also consider that amparo proceedings should not be converted into ordinary proceedings in order to address, even in the cases cited above, matters exceeding their capacity to provide adequate relief.
8. In this specific case, according to the facts deemed proven, the appellant’s claim could potentially affect the appellant’s health and physical integrity, as well as that of everyone living in Residencial Caribe in Limón. Accordingly, it is clear that this case falls within the exceptions mentioned, and for that reason I considered it necessary for the Chamber to exercise its jurisdiction in order to determine whether the alleged omissions violate the fundamental rights of the protected persons.
NOTE BY JUSTICE SALAZAR ALVARADO. In environmental matters, it is also my view that, if the Public Administration has already intervened, the hearing and resolution of the matter falls within the contentious-administrative jurisdiction. Nevertheless, I do examine the merits of the matter when other rights of persons affected by the source of pollution are at stake, including health, quality of life, and the right to enjoy a healthy and pollution-free environment (Article 50 of the Political Constitution), as in this case, in which the appellant alleges that neither the Ministerio de Salud nor the respondent municipality has resolved the longstanding sewage and wastewater problem in the appellant’s community, in violation of the right to enjoy a healthy and ecologically balanced environment and a dignified standard of living.
DOCUMENTATION SUBMITTED TO THE CASE FILE. This Chamber must advise the appellant that, if any paper documents, objects, or evidence stored on any additional device or on electronic, computer, magnetic, optical, or telematic media, or produced using new technologies, were submitted, they must be collected from the court office within 30 business days after notice of this judgment is received; otherwise, all such materials will be destroyed in accordance with the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session No. 27-11 of 22 de agosto del 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 de enero del 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session No. 43-12 held on 3 de mayo del 2012, Article LXXXI.

The appeal is partially granted solely against the Municipalidad de Limón. Nestor Mattis Williams and Margina Reid Reid, in their capacities as Mayor and President of the Council, respectively, both of the Municipalidad de Limón, or whoever may hold those offices in their stead, are ordered to adopt immediately, within the scope of their authority, all measures necessary to provide a comprehensive solution to the water-disposal problem at Residencial Caribe, including, if necessary, seeking a budget amendment should the necessary resources not currently be available, so that construction of the required treatment plant is completed within a maximum period of SEIS MESES from notice of this judgment. They are advised that failure to comply with this order will constitute the offense of disobedience and that, pursuant to Article 71 of the Law governing this jurisdiction, any person who receives an order issued in an amparo proceeding that the person is required to comply with or enforce, and who fails to comply with or enforce it, shall be sentenced to imprisonment for three months to two years or a fine of twenty to sixty day-fines, provided that the offense is not subject to a more severe penalty.
The Municipalidad de Limón is ordered to pay the costs and the damages caused by the facts underlying this ruling, which shall be assessed during enforcement of the judgment before the contentious-administrative jurisdiction. For that purpose, whoever holds the position of Manager of the Área de Servicios Públicos Remunerados of the Contraloría General de la República is ordered not to authorize any budget or amendment thereto unless it includes the corresponding appropriation to resolve the existing problem in the cantón Central of the province of Limón. In all other respects, the appeal is denied. Justice Hernández López files a note. Justice Salazar Alvarado files a note. This decision shall be served personally upon Nestor Mattis Williams and Margina Reid Reid, in their capacities as Mayor and President of the Council, respectively, both of the Municipalidad de Limón, or whoever may hold those offices in their stead, as well as upon the person holding the position of Manager of the Área de Servicios Públicos Remunerados of the Contraloría General de la República, or whoever may hold those offices in their stead.

Revisión del Documento *200034300007CO* SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del tres de abril de dos mil veinte .
Recurso de amparo que se tramita en expediente número 20-003430-0007-CO, interpuesto por ISABEL ASCENSION DIAZ RIVEL, cédula de identidad 0502370960, contra MINISTERIO DE SALUD, MUNICIPALIDAD DE LIMON.
Resultando:
Por escrito recibido en la Secretaría de la Sala a las 16:56 horas del 20 de febrero de 2020, la parte recurrente interpone recurso de amparo contra la Municipalidad de Limón y el Ministerio de Salud, y manifiesta que es vecina del Residencial Caribe en Nueve Millas de Limón, lugar donde hace muchos años tienen problemas de aguas residuales (negras) y servidas, lo cual se ha agravado. Indica que anteriormente, por dicha problemática se interpuso un recurso de amparo (véase el expediente Nº 14-004560-0007-CO), en el que se ordenó -a la municipalidad recurrida- construir el alcantarillado sanitario del residencial y la planta de tratamiento de aguas. No obstante, alega, que la municipalidad recurrida se limitó a construir el alcantarillado sanitario, pero no así la planta de tratamiento de aguas. Acusa que tal omisión, implica que las aguas negras y servidas no estén siendo tratadas, por lo que permanecen al aire libre, generando malos olores y una laguna de agua contaminada en la zona.
Enuncia que, en lo que respecta al Ministerio de Salud, pese a que es conocedor de la situación, lo único que ha hecho es remitir al Ministerio Público la denuncia por desobediencia. Sin embargo, la problemática de fondo continúa sin resolución integral. Discute que, dada la contaminación, los niños, las personas adultas mayores y demás vecinos del residencial, se encuentran viviendo desde hace más de 10 años, en condiciones deplorables, alrededor de aguas negras que son un foco de contaminación. Considera que los hechos expuestos, resultan violatorios de sus derechos fundamentales. Solicita que se declare con lugar el recurso.
Mediante resolución de las 16:53 horas del 24 de febrero de 2020 se dio curso al presente recurso, lo cual se notificó a los recurridos en fecha 13 de marzo de 2020.
Informa bajo juramento Guiselle Lucas Bolivar, en su condición de Directora del Área Rectora de Salud en Limón, que este caso tiene como antecedente el recurso de amparo que se tramitó en el expediente Nº 08-006699-007-CO, y en el cual se ordenó solucionar en forma integral el problema de tratamiento de aguas residuales y negras en la Urbanización El Caribe. Refiere que mediante varias órdenes sanitarias, se ordenó al Alcalde presentar un informe de avances de las acciones desarrolladas para solventar dicha problemática, gestión que fue reiterada en otras ocasiones, pero ante la falta de respuesta se procedió trasladar el caso al Ministerio Público (por incumplimiento de órdenes sanitarias). Mediante informe AML-0861-2019, el Municipio informó que se realizó el diseño del sistema y la estimación financiera, y que se está en adquisición de recurso financiero para el sistema final de tratamiento de aguas residuales del Residencial Caribe. Se solicitó criterio técnico respecto de la documentación remitida, y tras las deficiencias encontradas se procedió a girar una nueva orden sanitaria (MS-DRRSHC-ARSL-0351-2019-OS), la cual tampoco fue cumplida y por la cual se procedió con la denuncia respectiva ante la Fiscalía. Considera que se han realizado todas las acciones técnicas y administrativas para el seguimiento del caso, y solicita se desestime el recurso planteado.
Informa bajo juramento Nestor Mattis Williams y Margina Reid Reid, en su condición de Alcalde y Presidenta del Concejo, ambos de la Municipalidad de Limón, que el alcantarillado sanitario se construyó, con un costo aproximado de cien millones de colones. Señala que para la construcción de la planta de tratamiento ya se cuenta con informes y diseños, pero se requieren ciento cincuenta millones más, con los cuales el municipio no cuenta en estos momentos. Solicita se desestime el recurso planteado.
En los procedimientos seguidos se ha observado las prescripciones legales.
Redacta la Magistrada Garro Vargas; y,
Considerando:
Objeto del recurso. La recurrente considera lesivo de sus derechos fundamentales el que, a pesar de haber planteado varios recursos y gestiones, no se haya resuelto la problemática de aguas residuales (negras) y servidas en el Residencial Caribe; por lo que los vecinos conviven expuestos a malos olores y contaminación.
Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
Hechos no probados. No se estiman demostrados los siguientes hechos de relevancia para esta resolución:
Sobre el Derecho Fundamental a un Ambiente Sano y Ecológicamente Equilibrado. En reiteradas ocasiones este Tribunal ha desarrollado el contenido de este derecho, contemplado en el artículo 50 de la Constitución Política. La protección del ambiente es un mecanismo adecuado para tutelar y mejorar la calidad de vida de todos, lo que hace necesaria la intervención de los Poderes Públicos sobre los factores que pueden alterar su equilibrio y obstaculizar que la persona se desarrolle y desenvuelva en un ambiente sano. El Estado se constituye en el garante en la protección y tutela del medio ambiente y los recursos naturales. En este sentido, el control y fiscalización de la materia y actividad ambiental se constituye en una función esencial del Estado, por lo que tratándose de la protección ambiental, las funciones de rectoría, control y fiscalización de la materia ambiental, corresponden al Estado, a cargo de las diversas dependencias administrativas.
Sobre las actuaciones de las autoridades municipales. En el presente asunto, se denuncia que la Municipalidad de Limón no ha cumplido las órdenes de esta Sala de resolver el problema de aguas residuales y servidas en el residencial Caribe en Nueve Millas de Limón; y que a pesar de las denuncias penales tramitadas por las autoridades sanitarias, el problema se mantiene. El Código Municipal obliga a las Municipalidades de cada cantón velar porque al administrado se le garantice el disfrute real y efectivo del derecho a la salud y a un ambiente sano.Es un hecho incontrovertido que la problemática denunciada ya fue conocida por esta Sala en los expedientes Nº 08-006699-0007-CO y 14-004560-0007-CO, y que en ambos se constató el incumplimiento a lo ordenado y se llegó incluso a testimoniar piezas al Ministerio Público. Del análisis de los autos se constata que, a la fecha, la Municipalidad de Limón no ha tomado ninguna acción concreta tendente a construir la planta de tratamiento que se requiere, aduciendo razones presupuestarias.
A juicio de esta Sala, en la especie nos encontramos ante un problema sanitario grave que afecta al medio ambiente y la salud de los habitantes de la comunidad, y se constata quela Municipalidad de Limón ha mostrado incapacidad para hacer cumplir las leyes en la materia y su obligación de garantizar el disfrute de los habitantes de la zona a un ambiente sano y ecológicamente equilibrado, con las consecuencias para la salud de esas personas debido a la naturaleza del problema sanitario que les aqueja. En reiterada jurisprudencia la Sala ha dicho que no se puede aceptar que a los seres humanos se les niegue el derecho a un ambiente sano, el derecho a la salud, debido a la incapacidad de las autoridades públicas correspondientes para ejercer efectivamente las potestades de vigilancia y la solución a los problemas otorgadas por ley. La persistencia del problema demuestra que las pocas acciones realizadas han sido claramente insuficientes, incurriendo así en responsabilidad por omisión en el ejercicio de esas potestades que, a su vez, lesionan el derecho constitucional de los administrados a que les presten servicios públicos eficientes y eficaces. En razón de lo anterior, procede declarar con lugar el recurso en cuanto a este extremo.
Sobre las actuaciones de las autoridades sanitarias. Por su parte, las autoridades sanitarias, teniendo pleno conocimiento de la problemática que afecta a los pobladores del sector, se han encargado de brindar seguimiento al caso, constatar su existencia, emitir las órdenes sanitarias procedentes, verificar su incumplimiento y denunciar la inejecución en sede penal. Así las cosas, procede desestimar el recurso en cuanto a este extremo, puesto que no se constata actuación u omisión alguna por parte de las autoridades del Área Rectora de Salud que amenace o violente los derechos fundamentales de la amparada; y más bien se desprende que ha procedido de manera diligente en el marco de sus competencias.
Corolario.En este contexto se constata que a pesar de haber transcurrido más de once años desde la primera sentencia, las autoridades municipales recurridas no han realizado acciones concretas oportunas para mitigar o controlar la problemática denunciada. Por las razones expuestas, se impone la estimatoria de este recurso contra la Municipalidad de Limón, por las violación a los artículos 50 y 21 de la Constitución Política en perjuicio de la recurrente y demás vecinos de la zona NOTA DE LA MAGISTRADA HERNÁNDEZ LÓPEZ RESPECTO DEL RECLAMO POR INFRACCIÓN DEL ARTÍCULO 50 DE LA CONSTITUCIÓN POLÍTICA.
1. El contexto histórico que motivó en su momento la amplia intervención de la Sala en materia ambiental, ha tenido una considerable variación que impone a este órgano reconsiderar las condiciones para su participación en el aseguramiento del derecho de las personas a un ambiente sano y equilibrado, tal y como ha sido tutelado en el artículo 50 de la Constitución Política. En efecto, la situación actual –caracterizada por una amplísima producción legal y reglamentaria que incluye reglas de fondo, procedimientos y creación de órganos para el cumplimiento de lo ordenado en la Carta Fundamental- es radicalmente diferente de la anterior, en la cual la ausencia de normativa y de instancias estatales con competencia apropiada, le impuso a la Sala un papel de protagonista, casi único, en la defensa del precitado derecho constitucional.
2. Hoy en día, nos encontramos frente a un “denso entramado” de normativa ambiental, lo cual ha producido dos fenómenos relevantes: el primero y más obvio, es el surgimiento de una abarcadora regulación jurídica respecto de actividades cuya incidencia en el ambiente estaba poco o nada ordenada, así la creación de órganos estatales con potestades de vigilancia y control sobre los efectos de la actividad humana en el entorno. El segundo fenómeno consiste en que esa creciente juridificación –predominantemente legislativa y reglamentaria– trae aparejada una ineludible entrada en escena tanto de la justicia administrativa como de la jurisdicción ordinaria -prioritariamente la contencioso administrativa, pero también la penal. En ellas, acorde con la importancia del derecho ambiental, se han regulado de forma amplia vías procesales y medios de legitimación incluyentes, de manera que los administrados puedan hacer valer lo establecido en ese amplio orden jurídico que se relaciona con el tema ambiental.
3. En ese contexto, no resulta apropiado jurídicamente, ni desde el punto de vista funcional, que la Sala Constitucional desplace, o -peor aún- sustituya, a los órganos de justicia ordinarios en la realización de su tarea, también de rango constitucional, de velar por el efectivo cumplimiento de leyes y reglamentos. Es impropio jurídicamente porque en la inmensa mayoría de estos casos lo que se solicita es que interprete y haga valer normas legales y reglamentarias con lo que arriesga traslapar sus competencias con las de otros órganos jurisdiccionales que –ellos sí- han sido creados para ejecutar tales tareas; y resulta también funcionalmente incorrecto, porque el diseño de sus procesos se aviene mal con la complejidad que está presente en numerosos conflictos ambientales que se componen de series de hechos y actos técnica y jurídicamente complejos. Sobre ambas cuestiones existen conocidos ejemplos en los que la Sala ha arrojado una resolución a medias o técnicamente incompleta, o bien se han generado fricciones innecesarias y afectación de la seguridad jurídica.
4. Como parte de los aspectos técnicos que he valorado, añado que está el hecho de que esta jurisdicción no cuenta con jueces ejecutores de sentencia que permitan darle seguimiento adecuado a las mismas -generalmente complejas-, que implican en ocasiones el seguimiento de planes remediales, entre otros, con coordinación interinstitucional y seguimiento de meses y hasta años.
5. Desde esa perspectiva, la decisión de dar un paso al lado en la materia ambiental por parte de este Tribunal no debe ser vista como un abandono de la materia ambiental, sino al contrario, de su adecuada tutela en la instancia que mejor se aviene a la naturaleza de su complejidad y diversidad. Asimismo tampoco debe ser visto como la declinación de esta instancia en su tarea de protección de los derechos constitucionales que le imponen la Constitución Política y su Ley Orgánica, que desde mi punto de vista, queda reservada en esta materia para casos específicos. Se trata más bien, de un ejercicio de reacomodo de las cargas y tareas que corresponden a los distintos órganos estatales, de manera que cada uno de ellos, pueda desplegar plenamente su labor dentro del ámbito que se le ha asignado, así como del ejercicio de fijar su propia competencia, según lo establece el artículo 7 de su Ley Orgánica.
6. Queda claro que la Sala no se plantea abandonar a otras jurisdicciones la labor de protección de los derechos de las personas en materia ambiental. Es conocido que si bien todo reclamo por infracción de normas legales y reglamentarias puede ser reconducido hasta el ámbito constitucional, existen casos cuya resolución no exige más que la aplicación del derecho de la Constitución. Se trata entonces de lograr que la Sala se convierta en protagonista junto con otros, de manera que –entre todos y cada uno en su espacio- se pueda cubrir toda la variedad de situaciones que presenta una protección del derecho a un medio ambiente sano y equilibrado dentro de una sociedad en la que también existen otras necesidades igual de acuciantes. Con esta posición creo firmemente que el ciudadano no pierde un ápice de protección pero se gana sustancialmente en amplitud, en perspectiva y en respeto al equilibrio y distribución de poderes, principio este último de obligada consideración, puesto que rige la dinámica constitucional de cualquier sistema liberal y democrático como el nuestro.- 7.
En línea con lo anterior, sostengo que esta Sala debe abstenerse de conocer los reclamos que se le presenten por supuesta infracción al artículo 50 de la Constitución Política para dejar en manos de la justicia administrativa y la jurisdicción contenciosa administrativa su conocimiento. Lo anterior se deja afirmado con carácter general, sin perjuicio de reconocer la existencia de casos particulares o grupos de casos que, según mi criterio, si resultarían aún mejor tutelados por esta Sala y por tanto deben ser conocidos y resueltos por ella.- Dentro de tales grupos de casos, y sin que esta enunciación pueda considerarse como una lista cerrada y definitiva, puedo señalar que la Sala debe reservarse el conocimiento de situaciones como por ejemplo los reclamos por infracciones ambientales que además pongan en riesgo directo la salud de las personas, o el acceso o calidad del agua; los casos de violaciones groseras y directas al ambiente y en los cuales se constate una palmaria ausencia de la protección por parte de las autoridades estatales, siempre y cuando además la naturaleza del reclamo permita ser abordado mediante el instrumento del amparo como instituto procesal sumario y especial, ya que estimo que tampoco se debe “ordinariar” el amparo para abordar, aún en estos casos citados, temas que rebasen la capacidad de ser atendidos adecuadamente en el mismo.
8. En el caso concreto, de conformidad con los hechos probados, el reclamo de la parte recurrente, podría eventualmente incidir en su salud e integridad física; así como en la de todas las personas que habitan en el Residencial Caribe en Limón. En consecuencia, es claro que estamos ante las excepciones que mencionan y por esa razón he considerado necesario que la Sala ejerciera su competencia, para comprobar o descartar si las omisiones señaladas, vulneran los derechos fundamentales de las personas amparadas.
NOTA DEL MAGISTRADO SALAZAR ALVARADO. En asuntos ambientales, es también criterio del suscrito, de que si ya ha habido intervención de la Administración Pública, considero que su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que la parte recurrente acusa que tanto el Ministerio de Salud como la municipalidad recurrida no han solventado el problema de aguas negras y servidas de larga data que existe en su comunidad, con violación del derecho a disfrutar de un ambiente sano y ecológicamente equilibrado y de un nivel digno de calidad de vida.
DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Debe prevenir esta Sala a la parte recurrente que de haber aportado algún documentos en papel, así como objetos o pruebas respaldadas por medio de cualquier dispositivo adicional, o por medio de soporte electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho, en un plazo de 30 días hábiles, después de recibida la notificación de esta sentencia, de lo contrario todo ello será destruido de conformidad con lo establecido en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión No. 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión No. 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.
Por tanto:
Se declara parcialmente con lugar el recurso únicamente contra la Municipalidad de Limón. Se ordena a Nestor Mattis Williams y Margina Reid Reid, en su condición de Alcalde y Presidenta del Concejo, ambos de la Municipalidad de Limón, o a quien en su lugar ocupe el cargo, adoptar inmediatamente, dentro del ámbito de sus competencias, las medidas que sean necesarias para darle una solución integral al problema de disposición de aguasen el Residencial Caribe; gestionando incluso y de ser necesario, una modificación presupuestaria si no se contara con los recursos en este momento, con el fin que, dentro del plazo máximo de SEIS MESES contado a partir de la notificación de esta sentencia, se ejecute la construcción de la planta de tratamiento que se requiere. Se le advierte que de no acatar la orden dicha, incurrirá en el delito de desobediencia y, que de conformidad con el artículo 71 de la Ley de esta jurisdicción, se le impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.
Se condena a la Municipalidad de Limón al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. Para lo anterior, se ordena a quien ejerza el cargo de Gerente del Área de Servicios Públicos Remunerados de la Contraloría General de la República que no autorice ningún presupuesto ni modificación a éste, si no incluye la partida respectiva para solucionar el problema existente en el cantón Central de la provincia de Limón. En lo demás, se declara sin lugar el recurso. La Magistrada Hernández López pone nota. El Magistrado Salazar Alvarado pone nota. Notifíquese la presente resolución a Nestor Mattis Williams y Margina Reid Reid, en su condición de Alcalde y Presidenta del Concejo, ambos de la Municipalidad de Limón, o a quien en su lugar ocupe el cargo, así como a la persona que ocupe el cargo de Gerente del Área de Servicios Públicos Remunerados de la Contraloría General de la República, o a quienes en su lugar ejerzan esos cargos, en forma personal.
