Amparo proceeding (recurso de amparo) filed by PATRICIA CAMPOS VILLAGRA, identity card 0108800768, on behalf of BAJO PITA, S. A., corporate identification number 3101650097, against the MUNICIPALIDAD DE ALAJUELA.

Findings:

  1. 1By a written submission filed with the Office of the Clerk of this Chamber at 15:30 hours on 12 de febrero del 2020, the petitioner filed an amparo proceeding against the Municipalidad de Alajuela. She states that the party she represents is the registered owner of the properties in the Alajuela registry district recorded under the Real Property Folio system (Folio Real), registration numbers 384243-000, 305845000, 365846-000, 365847-000 and 128827-000. Through documents Nos. MAPU-U-01618-20l I, MA-PU-U-0l6l7-2011, MA-PU-U-0l6l6-20l1, MA-PU-U01615-20ll and MA-PU-U-01609-2012, land-use certificates (certificados de uso de suelo) were issued for those properties. Based on the land-use certificate issued through official letter MAPU-U-1609-2012, an environmental industrial park project was proposed, which currently has environmental approval (viabilidad ambiental) granted through resolution No. 708-2016-SETENA.By a resolution of the Alcaldía that bore neither a number nor a date, that land use was annulled. Before that resolution was issued, the guarantees of due process (debido proceso) were not observed. Furthermore, on 11 de febrero de 2020, the party she represents submitted a request to the local authority seeking access to the documents in the administrative record (expediente administrativo); however, not only was access denied at that time, but the denial was reiterated on 12 de febrero de 2020. The foregoing violated the fundamental rights of the party she represents. She requests that the proceeding be granted, with all resulting consequences.
  2. 2By a resolution issued at 15:28 hours on 13 de febrero del 2020, the present amparo proceeding was admitted for processing, and the mayor of Alajuela was ordered to submit a report (see electronic record).
  3. 3Laura María Chaves Quirós, in her capacity as mayor of the Municipalidad de Alajuela, reports under oath (see electronic record) that the petitioner is the special attorney-in-fact (apoderada especial) of Bajo Pita S.A. and the registered owner of the properties in the Alajuela registry district recorded under the Real Property Folio system, registration numbers 384243-000, 305845000, 365846-000, 365847-000 and 128827-000. It is true that, in 2012, the local government issued Land-Use Certificates, including the land-use certificate issued through official letter MA-PU-U-01609-2012, which specifically concerns the property bearing Real Property Folio registration N°384243-000. The project referred to by the petitioner as “Parque Industrial Ambiental” is the project known to SETENA under administrative expediente number N°8173-2012-SETENA, which is a mechanized sanitary landfill (relleno sanitario mecanizado) in Turrúcares de Alajuela.The effects of the environmental approval for that project were suspended through resolution N°2525-2019-SETENA of 06 de agosto del 2019. On 23 de julio del 2019, the Alcaldía Municipal received a motion for nullity (incidente de nulidad) against land use MA-PU-U-01609-2012 from resident Don Blass Hernández Araya. By a resolution issued at 14:00 hours on 06 de febrero del 2020, the Alcaldía Municipal granted that motion and annulled land-use certificate MA-PU-U-01609-2012 due to the existence of a supervening event (hecho sobrevenido). That resolution was served on the movant (incidentista) on 07 de febrero del 2020. On 11 de febrero del 2020, the petitioner submitted a written request to the Alcaldía (internal proceeding N°3351); however, because she did not provide a means for receiving notices, among other deficiencies in the document, the Alcaldía followed its usual practice in such cases, whereby the administration serves notice on the interested party through the Municipalidad’s service platform, as it did on 18 de febrero del 2020 through official letter MA-A-0607-2020 of 17 de febrero del 2020.It is true that, on 12 de febrero del 2020, two persons who did not identify themselves with appropriate documentation demonstrating their legal authority (legitimación) to represent Bajo Pita S.A. requested to speak with attorneys from the Municipalidad’s Servicios Jurídicos. They were attended by attorneys Licda. María José Brenes Lizano and Lic. Rafael Rojas Jiménez, who explained in detail that they were required to establish their legal authority by means of a special power of attorney (poder especial) and that, pursuant to article 271 of the Ley General de la Administración Pública, only the parties and their attorneys may access the record and its documents, particularly because the document was not yet public, as it was in the process of being served on Bajo Pita S.A. On 19 de febrero del 2020, the petitioner filed a motion for reconsideration with an appeal (recurso de revocatoria con apelación) against what is referred to internally as the undated and untimed resolution of the Alcaldía; that is, they automatically deemed themselves served with notice of the administrative act (acto administrativo).Therefore, as to that aspect of the amparo proceeding, the matter has become moot (carece de interés sobrevenido). By filing a motion for reconsideration with a subsidiary appeal (recurso de revocatoria con apelación en subsidio), the petitioner initiated the sequence of administrative remedies (recursos administrativos) established in the Código Municipal as a requirement for exhausting administrative remedies (agotar la vía administrativa). Because those administrative remedies remain pending, the present amparo proceeding has become a matter of ordinary legality (materia de legalidad). She requests that the proceeding be denied.
  4. 4The statutory requirements have been observed in the proceedings conducted.

Magistrada Picado Brenes writes the opinion; and,

Considering:

I. SUBJECT MATTER OF THE PROCEEDING

The petitioner alleges that the party she represents is the registered owner of several properties in Alajuela that have land-use certificates. Based on the land-use certificate issued through official letter MAPU-U-1609-2012, an environmental industrial park project was proposed, which currently has environmental approval granted through resolution No. 708-2016-SETENA. By a resolution of the Alcaldía that bore neither a number nor a date, that land use was annulled. Before that resolution was issued, the guarantees of due process were not observed. Furthermore, on 11 de febrero de 2020, the party she represents submitted a request to the local authority seeking access to the documents in the administrative record; however, not only was access denied at that time, but the denial was reiterated on 12 de febrero de 2020.

II. PROVEN FACTS

The following facts are deemed duly established and relevant to the decision in this matter, either because they have been proven or because the respondent failed to address them as ordered in the initial ruling:

  • a)The petitioner is the special attorney-in-fact of Bajo Pita S.A. and the registered owner of the properties in the Alajuela registry district recorded under the Real Property Folio system, registration numbers 384243-000, 305845000, 365846-000, 365847-000 and 128827-000 (see electronic record).
  • b)In 2012, the Municipalidad de Alajuela issued Land-Use Certificates, including the land-use certificate issued through official letter MA-PU-U-01609-2012, which specifically concerns the property bearing Real Property Folio registration N°384243-000 (see electronic record).
  • c)The project referred to by the petitioner as “Parque Industrial Ambiental” is the project known to SETENA under administrative expediente number N°8173-2012-SETENA, which is a mechanized sanitary landfill in Turrúcares de Alajuela. The effects of the environmental approval for that project were suspended through resolution N°2525-2019-SETENA of 06 de agosto del 2019 (see electronic record).

  • f)On 11 de febrero del 2020, the petitioner requested from the respondent Municipalidad “a copy of the Motion for Absolute Nullity (Incidente de Nulidad Absoluta) filed by Mr. Blas Hernández Araya against land-use certificate number MA-PU-U-1609-2012” and authorized Lic. Emanuel Murillo Salas to obtain copies of the requested information (see electronic record).
  • g)Through official letter N°MA-A-0607-2020 dated 17 de febrero del 2020, the Alcaldía Municipal informed the petitioner: “1. Your request submitted through official letter GG-073-2020 of 11 de febrero 2020 does not bear an authenticated signature. 2. The attached documents include only a simple copy of your identity card … and lack certification of the photocopy by a notary public. 3. You do not provide a place or means for receiving notices. Furthermore, I remind you that article 271 of the Ley General de la Administración Pública is very clear in specifying who has access to the record; in the present case, efforts are being made to locate the company you claim to represent so that it may be served with notice. I would greatly appreciate your appearing in person at this Municipalidad or formally submitting the legal documents establishing you as the attorney-in-fact with the broadest powers (apoderada generalísima) of Bajo Pita and providing an electronic means, fax number, or physical address at which the party you represent may henceforth be served, in order to guarantee both access to the administrative record and its documents and the right to receive notice” (see electronic record).
  • h)On 12 de febrero del 2020, two persons who did not identify themselves with appropriate documentation demonstrating their legal authority to represent Bajo Pita S.A. requested to speak with attorneys from the Municipalidad’s Servicios Jurídicos. They were attended by attorneys Licda. María José Brenes Lizano and Lic. Rafael Rojas Jiménez, who explained in detail that they were required to establish their legal authority by means of a special power of attorney and that, pursuant to article 271 of the Ley General de la Administración Pública, only the parties and their attorneys may access the record and its documents, particularly because the document was not yet public, as it was in the process of being served on Bajo Pita S.A. (see electronic record).
  • i)On 19 de febrero del 2020, the petitioner filed a motion for reconsideration with an appeal against the resolution issued at 14:00 hours on 06 de febrero del 2020 (see electronic record).
  • j)That, according to notarial record number sesenta y cinco-ocho executed by Licda. Ana Cecilia Salazar Segura, it was established: “ … that at eleven o’clock today, doce de febrero del año en curso, I appeared at the offices of the Mayor’s Office of the Municipalidad de Alajuela, accompanied by Mr. Emanuel Murillo Salas, who is of legal age, single, an attorney, a resident of Cartago, La Unión, holder of identity card number uno-mil seiscientos veintisiete-cero quinientos cincuenta y dos, and who is acting as a witness to this proceeding, in order to request the case file concerning the Motion for Absolute Nullity (Incidente de Nulidad Absoluta) filed by Mr. Blas Hernández Araya against land-use certificate (certificado de uso de suelo) number MA-PU-U-uno cero nueve-dos mi once, pertaining to the property recorded under real property folio number trescientos ochenta y cuatro mil doscientos cuarenta y tres, with survey plan A-setecientos siete mil trescientos trece dos mil uno, owned by said company, as requested yesterday through filing number cero cerocero tres cinco uno dos mil veinte before the Service Platform of the aforementioned municipality.

At the service window of the aforementioned Office, Licenciado Murillo Salas asked for the official named Tony, whose surname is unknown; however, at eleven ten we were attended by Licenciado Rafael Ángel Rojas Jiménez, who was accompanied by Licenciada María José Brenes and explained to us that he was responsible for the case file and that it could not be released because the respondent to the motion, Bajo Pita Sociedad Anónima, had not yet been served, since ‘the legal representatives hide and are like a ghost’; he also stated that the movant, Blas Hernández Araya, had already been served. Licenciado Rojas Jiménez stated that the motion had been filed in July of last year and that it had been decided on the basis of rulings by the Sala Constitucional and materials held by the municipality itself, such as the case file through which land use (uso de suelo) was granted for the properties of Bajo Pita Sociedad Anónima, the case file in which the building permit was processed, the public-interest invalidation proceeding (proceso de lesividad) being pursued by the Municipalidad de Alajuela before the administrative litigation courts, and case files from the Secretaria Técnica Nacional Ambiental and Ministerio de Salud.

Licenciado Rojas Jiménez also stated that the motion had been decided by the municipality’s Legal Department and signed by the Mayor. Following Licenciado Rojas Jiménez’s explanations, I again requested the case file, excluding the decision that was pending service, but he refused to release it, invoking the principle of unity of the act (principio de unificación del acto). The undersigned notary hereby certifies that this proceeding concluded at eleven thirty today. That is all” (see electronic record).

III. REGARDING THE SPECIFIC CASE

The report submitted by the respondent authority, which was given under the solemnity of oath, with the legal consequences that this entails, shows that the petitioner is the special attorney-in-fact (apoderada especial) of Bajo Pita S.A. and the registered owner of the properties in the province of Alajuela recorded under the Real Property Folio system with registration numbers 384243-000, 305845000, 365846-000, 365847-000 and 128827-000. It was established that, in 2012, the Municipalidad de Alajuela issued Land-Use Certificates (Certificados de Uso de Suelo), including the land use granted through official letter MA-PU-U-01609-2012, which specifically concerns the property recorded under real property folio registration N°384243-000. It was established that the project referred to by the petitioner as “Parque Industrial Ambiental” is the project known to SETENA under administrative case file number N°8173-2012-SETENA, which is a mechanized sanitary landfill (relleno sanitario mecanizado) in Turrúcares de Alajuela.

The environmental approval (viabilidad ambiental) for that project has been suspended pursuant to resolution N°2525-2019-SETENA of 06 de agosto del 2019. It was established that on 23 de julio del 2019, Mr. Blass Hernández Araya filed a motion for nullity (incidente de nulidad) against land use MA-PU-U-01609-2012. It was proven that, by a decision issued at 14:00 hours on 06 de febrero del 2020, the Municipal Mayor’s Office granted that motion and, due to the occurrence of a supervening event (hecho sobrevenido), annulled land-use certificate MA-PU-U-01609-2012—the decision was served on the movant on 07 de febrero del 2020. Subsequently, on 11 de febrero del 2020, the petitioner requested from the respondent Municipality a “copy of the Motion for Absolute Nullity filed by Mr. Blas Hernández Araya against land-use certificate number MA-PU-U-1609-2012” and authorized Lic. Emanuel Murillo Salas to obtain copies of the requested information.

It was verified that, through official letter N°MA-A-0607-2020 dated 17 de febrero del 2020, the Municipal Mayor’s Office informed the petitioner: “1. Your request submitted through official letter GG-073-2020 of 11 de febrero 2020 does not bear an authenticated signature. 2. The attached documents include only a simple copy of your identity card … and do not include a certification of the photocopy by a notary public. 3. You do not specify a place or means for receiving notices. Furthermore, I remind you that Article 271 of the Ley General de la Administración Pública is very clear in specifying who may access the case file; in the matter at hand, efforts are being made to locate the company you claim to represent so that it may be served. I would greatly appreciate it if you would appear personally before this Municipality or formally submit the legal documents establishing your status as attorney-in-fact with full powers (apoderada generalísima) of Bajo Pita and specify an electronic means, fax number, or physical address at which the company you represent may henceforth be served, in order to guarantee both access to the administrative case file (expediente administrativo) and its contents and the right to be served.” It became evident that, on 12 de febrero del 2020, two persons who did not identify themselves with appropriate documentation demonstrating their authority to represent Bajo Pita S.A. asked to speak with attorneys from the Municipality’s Legal Services, and were attended by Licda. María José Brenes Lizano and Lic. Rafael Rojas Jiménez, who explained in detail that they were required to establish their authority by means of a special power of attorney (poder especial) and that, pursuant to Article 271 of the Ley General de la Administración Pública, only the parties and their attorneys could access the case file and its contents, particularly because the document was not yet public, as it was in the process of being served on Bajo Pita S.A. At the service window of the aforementioned Office, Licenciado Murillo Salas asked for the official named Tony, whose surname is unknown; however, at eleven ten we were attended by Licenciado Rafael Ángel Rojas Jiménez, who was accompanied by Licenciada María José Brenes and explained to us that he was responsible for the case file and that it could not be released because the respondent to the motion, Bajo Pita Sociedad Anónima, had not yet been served, since ‘the legal representatives hide and are like a ghost’; he also stated that the movant, Blas Hernández Araya, had already been served. Licenciado Rojas Jiménez stated that the motion had been filed in July of last year and that it had been decided on the basis of rulings by the Sala Constitucional and materials held by the municipality itself, such as the case file through which land use was granted for the properties of Bajo Pita Sociedad Anónima, the case file in which the building permit was processed, the public-interest invalidation proceeding being pursued by the Municipalidad de Alajuela before the administrative litigation courts, and case files from the Secretaria Técnica Nacional Ambiental and Ministerio de Salud.

Licenciado Rojas Jiménez also stated that the motion had been decided by the municipality’s Legal Department and signed by the Mayor. Following Licenciado Rojas Jiménez’s explanations, I again requested the case file, excluding the decision that was pending service, but he refused to release it, invoking the principle of unity of the act. The undersigned notary hereby certifies that this proceeding concluded at eleven thirty today. That is all.” In conclusion, it is true that on 11 de febrero de 2020 the petitioner submitted a request to the local authority seeking access to the contents of the administrative case file, and that request was denied. This Chamber finds no grounds for denying the petitioner access to the case file. This position is based on the following points: 1. The petitioner is the registered owner of a property for which the Municipalidad de Alajuela issued a land-use certificate (property recorded under Real Property Folio registration N°384243-000); 2.

The motion for nullity filed on 23 de julio del 2019 by Mr. Blass Hernández Araya challenges the land-use certificate pertaining to the property recorded under Real Property Folio registration N°384243-000); 3. Failure to serve one of the parties is not grounds for restricting access to the case file, notwithstanding the respondent authority’s assertion in its written response to the petitioner, which stated: “I would greatly appreciate it if you would appear personally before this Municipality or formally submit the legal documents establishing your status as attorney-in-fact with full powers of Bajo Pita Sociedad Anónima and specify an electronic means, fax number, or physical address at which the company you represent may henceforth be served, in order to guarantee both access to the administrative case file and its contents and the right to be served”; 4.- Finally, the respondent authority acknowledges that it was unaware of official letter GG-073-2020—the official letter through which the petitioner not only requested a copy of the Motion for Absolute Nullity but also authorized Lic. Emanuel Murillo Salas to obtain the requested copies. In light of the foregoing, the petition is well-founded, with the consequences set forth in the operative portion (parte dispositiva) of this judgment.

IV. REGARDING THE ANNULMENT OF THE LAND USE

In judgment number 2020-001597 issued at nine twenty on veinticuatro de enero de dos mil veinte, this Chamber stated:

I.Subject matter of the petition.- The petitioner expresses disagreement with the Municipalidad de Guatuso regarding the revocation of the land-use study (estudio de uso de suelos) for a property she owns, which is intended for the construction of a house through the Bono de Vivienda. II.- The specific case.- In the sub lite, it is apparent that the claimant’s allegations amount merely to a dispute concerning ordinary legality (legalidad ordinaria); accordingly, it must be noted that the matters set forth in the first Whereas clause (Resultando) of this decision constitute a dispute falling outside the jurisdiction of this Court. Indeed, this Court is neither an overseer of legality nor an additional administrative instance, and therefore it is not for this Court to determine whether the land-use study for a specific property should be renewed. The petitioner must be informed that the Constitutional Chamber (Sala Constitucional) cannot and must not supplant public offices in deciding matters that, by their nature and by express mandate of the Law, must be resolved by those offices. Accordingly, those claims concern matters of ordinary legality that must be resolved by the Administration or, where appropriate, by the ordinary courts. For the foregoing reasons, the petition is declared inadmissible.”

This precedent applies to the case under consideration because this Court finds no reason to depart from the position expressed in that judgment, nor any grounds for assessing the situation presented differently. Therefore, the petition is inadmissible with respect to this issue because it concerns a matter of ordinary legality that must be resolved by the Administration or, where appropriate, by the ordinary courts.

V. CONCLUSION

Accordingly, the proper course is to grant the petition solely on the ground that Article 30 of the Political Constitution has been violated. In all other respects, the petition is denied.

VI.Dissenting opinion of Justice Rueda Leal. In the sub examine, I consider that the petition should be denied for the following reasons. In the dissenting opinion I entered in judgment n. º 2019-2355, issued at 9:30 on 12 de febrero de 2019, I stated:

“In Advisory Opinion 22-16 of 26 de febrero de 2016, the Inter-American Court of Human Rights indicated that, although some States recognize the right of petition for legal entities (personas jurídicas) subject to special conditions, such as trade unions, political parties, or representatives of Indigenous peoples, Afro-descendant communities, or specific groups, the fact remains that ‘Article 1.2 of the American Convention recognizes rights only in favor of natural persons, and therefore legal entities are not holders of the rights enshrined in that treaty.’ Furthermore, in the same advisory opinion, the Inter-American Court held that, in certain specific contexts, natural persons may exercise their rights through legal entities (for example, through a media outlet, as occurred in Granier et al. v. Venezuela); however, for such an exercise to be afforded protection under the Inter-American system, ‘the exercise of the right through a legal entity must involve an essential and direct relationship between the natural person requiring protection from the Inter-American system and the legal entity through which the violation occurred, because a mere connection between the two persons is insufficient to conclude that the rights of natural persons, rather than those of legal entities, are in fact being protected.

Indeed, something beyond the mere participation of the natural person in the activities inherent to the legal entity must be proven, such that this participation is substantially related to the rights alleged to have been violated.’ (emphasis added)(OC. 22/16).” In this regard, a reading of the filing initiating the proceedings does not clearly establish the essential relationship between the natural person and the legal entity with respect to the rights allegedly infringed, which, in my view, is necessary in order to examine the merits of the alleged violation.

Hence, I consider a priori that there is no situation susceptible to review in this jurisdiction.

VII. DOCUMENTATION SUBMITTED TO THE CASE FILE

This Chamber must notify the petitioner that, if any paper documents, objects, or evidence stored on any additional device or on electronic, computer, magnetic, optical, or telematic media, or produced through new technologies, were submitted, they must be collected from the Clerk’s Office within 30 business days after receipt of notice of this judgment; otherwise, all such materials shall be destroyed in accordance with the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Full Court at session No. 27-11 of 22 de agosto del 2011, Article XXVI, and published in Judicial Bulletin number 19 of 26 de enero del 2012, as well as the resolution approved by the Superior Council of the Judiciary at session No. 43-12 held on 3 de mayo del 2012, Article LXXXI.

Por tanto:

The petition is partially granted. Laura María Chaves Quirós, in her capacity as mayor of the Municipalidad de Alajuela, or whoever holds that office in her stead, is ordered to immediately issue the necessary directives within the scope of her authority so that she may immediately coordinate with the petitioner the delivery of a certified copy of the case file concerning the motion for nullity (incidente de nulidad) filed on 23 de julio del 2019 by Don Blass Hernández Araya against the land-use certificate (certificado de uso de suelo) pertaining to the property recorded under Folio Real registration N°384243-000. The foregoing is subject to the proviso that, if in her judgment the requested material contains private, sensitive, or confidential information concerning the parties involved, she must redact that information before transmitting the copies of the disputed case file. The Municipalidad de Alajuela is ordered to pay the costs, damages, and losses caused by the acts underlying this ruling, which shall be assessed during enforcement of the judgment before the contentious-administrative jurisdiction (jurisdicción de lo contencioso administrativo).

The respondent is advised that, pursuant to Article 71 of the Law governing this jurisdiction, any person who receives an order issued in amparo proceedings (recurso de amparo) that he or she is required to comply with or enforce, and who fails to comply with or enforce it, shall be subject to imprisonment for three months to two years or a fine of twenty to sixty day-fines, provided that the offense is not punishable by a more severe penalty. Laura María Chaves Quirós, in her capacity as mayor of the Municipalidad de Alajuela, or whoever holds that office in her stead, shall be served PERSONALLY. In all other respects, the petition is denied. Justice Rueda Leal dissents and would deny the petition.

Revisión del Documento *200028380007CO* SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del veinte de marzo de dos mil veinte .

Recurso de amparo presentado por PATRICIA CAMPOS VILLAGRA, cédula de identidad 0108800768, a favor de BAJO PITA, S. A., cédula jurídica 3101650097, contra la MUNICIPALIDAD DE ALAJUELA.

Resultando:

  1. 1Por escrito presentado en la Secretaría de esta Sala a las 15:30 horas de 12 de febrero del 2020 la recurrente presenta recurso de amparo contra la Municipalidad de Alajuela. Manifiesta que su representada es la propietaria registral de las fincas del partido de Alajuela inscritas bajo el sistema de Folio Real matrículas 384243-000, 305845000, 365846-000, 365847-000 y 128827-000. Mediante los documentos Nos. MAPU-U-01618-20l I, MA-PU-U-0l6l7-2011, MA-PU-U-0l6l6-20l1, MA-PU-U01615-20ll y MA-PU-U-01609-2012, se otorgaron certificados de uso de uso de suelo para esos fundos. A partir del certificado de uso de suelo otorgado por oficio MAPU-U-1609-2012, se planteó un proyecto de parque ambiental industrial que actualmente cuenta con viabilidad ambiental otorgada mediante resolución No. 708-2016-SETENA. Por resolución de la Alcaldía sin número, ni fecha, se dispuso la anulación de ese uso de suelo.De previo a esa resolución, no se cumplieron las garantías del debido proceso. De otra parte, el 11 de febrero de 2020, su representada planteó una solicitud ante el ente local, a fin de que se le permitiera acceder a las piezas del expediente administrativo; sin embargo, no sólo se les negó en ese momento el acceso, sino que en fecha 12 de febrero de 2020 se reiteró dicha negativa. Lo anterior, en detrimento de los derechos fundamentales de su representada. Solicita que se declare con lugar el recurso, con las consecuencias que implique.
  2. 2Por resolución de las 15:28 horas del 13 de febrero del 2020 se le dio curso al presente amparo y se le solicitó informe al alcaldesa de Alajuela (ver registro electrónico).
  3. 3Informa bajo juramento Laura María Chaves Quirós en su calidad de alcaldesa de la Municipalidad de Alajuela (ver registro electrónico) que la recurrente es apoderada especial de Bajo Pita S.A. y propietaria registrada de las fincas del partido de Alajuela inscritas bajo el sistema de Folio Real matrículas 384243-000, 305845000, 365846-000, 365847-000 y 128827-000. Es cierto que el gobierno local en el año 2012 otorgó Certificados de Uso de Suelo, incluyendo el uso de suelo mediante oficio MA-PU-U-01609-2012, que específicamente se trata de la finca matrícula de folio real N°384243-000. El proyecto al que hace mención la recurrente con el nombre de “Parque Industrial Ambiental”, es el proyecto que se conoce en la SETENA con el número de expediente administrativo N°8173-2012-SETENA, el cual es un relleno sanitario mecanizado en Turrúcares de Alajuela. La viabilidad ambiental a ese proyecto tiene sus efectos suspendidos mediante resolución N°2525-2019-SETENA del 06 de agosto del 2019.La Alcaldía Municipal recibió el 23 de julio del 2019 un incidente de nulidad contra el uso de suelo MA-PU-U-01609-2012 de parte del munícipe Don Blass Hernández Araya. La Alcaldía Municipal, mediante resolución de las 14:00 horas del 06 de febrero del 2020 resolvió declarar con lugar dicho incidente y anular por la existencia de un hecho sobrevenido, el certificado de uso de suelo MA-PU-U-01609-2012. Dicha resolución le fue notificada al incidentista el 07 de febrero del 2020. El 11 de febrero del 2020, la recurrente hizo una solicitud por escrito ante la Alcaldía (trámite interno N°3351), sin embargo, al no señalar medio para recibir notificaciones, además de otras carencias del documento, lo que usualmente hace la Alcaldía en esos caso, es que la administración procede a notificar en la plataforma de servicios de la Municipalidad al interesado, tal y como se procedió el 18 de febrero del 2020 mediante oficio MA-A-0607-2020 del 17 de febrero del 2020.Es cierto que el 12 de febrero del 2020, dos personas que no se identifican con documento idóneo que demostrara su legitimación para representar a la sociedad Bajo Pita S.A. solicitaron conversar con Abogados de Servicios Jurídicos de la Municipalidad, siendo atendidos por los abogados Licda. María José Brenes Lizano y el Lic. Rafael Rojas Jiménez, funcionarios que explicaron con detalle, que ellos deben acreditar mediante poder especial su legitimación y que de conformidad con el artículo 271 de la Ley General de la Administración Pública, sólo las partes y sus abogados pueden tener acceso al expediente y sus piezas, máxime que el documento no era público aún, pues estaba en etapa de notificación a Bajo Pita S.A. El 19 de febrero del 2020 la recurrente presentó recurso de revocatoria con apelación contra lo que internamente llaman resolución de la Alcaldía sin fecha y hora, es decir, ya de forma automática se dieron por notificados del acto administrativo, por lo que en lo que respecta a ese extremo del recurso de amparo, el mismo carece de interés sobrevenido.Al haberse presentado recurso de revocatoria con apelación en subsidio, la recurrente accionó la escalerilla de recursos administrativos establecidos en el Código Municipal, como requisito para agotar la vía administrativa. Al estar pendiente de resolverse esos recursos administrativos, el presente recurso de amparo se convierte en materia de legalidad. Solicita que se declare sin lugar el recurso.
  4. 4En los procedimientos seguidos se han observado las prescripciones legales.

Redacta la Magistrada Picado Brenes; y,

Considerando:

I. OBJETO DEL RECURSO

La recurrente alega que su representada es la propietaria registral de unas fincasen Alajuela que cuenta con certificados de uso de suelo. A partir del certificado de uso de suelo otorgado por oficio MAPU-U-1609-2012, se planteó un proyecto de parque ambiental industrial que actualmente cuenta con viabilidad ambiental otorgada mediante resolución No. 708-2016-SETENA. Por resolución de la Alcaldía sin número, ni fecha, se dispuso la anulación de ese uso de suelo. De previo a esa resolución, no se cumplieron las garantías del debido proceso. De otra parte, el 11 de febrero de 2020, su representada planteó una solicitud ante el ente local, a fin de que se le permitiera acceder a las piezas del expediente administrativo; sin embargo, no sólo se les negó en ese momento el acceso, sino que en fecha 12 de febrero de 2020 se reiteró dicha negativa.

II. HECHOS PROBADOS

De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:

  • a)Que la recurrente es apoderada especial de Bajo Pita S.A. y propietaria registrada de las fincas del partido de Alajuela inscritas bajo el sistema de Folio Real matrículas 384243-000, 305845000, 365846-000, 365847-000 y 128827-000 (ver registro electrónico).
  • b)Que la Municipalidad de Alajuela en el año 2012 otorgó Certificados de Uso de Suelo, incluyendo el uso de suelo mediante oficio MA-PU-U-01609-2012, que específicamente se trata de la finca matrícula de folio real N°384243-000 (ver registro electrónico).
  • c)Que el proyecto al que hace mención la recurrente con el nombre de “Parque Industrial Ambiental”, es el proyecto que se conoce en la SETENA con el número de expediente administrativo N°8173-2012-SETENA, el cual es un relleno sanitario mecanizado en Turrúcares de Alajuela. La viabilidad ambiental a ese proyecto tiene sus efectos suspendidos mediante resolución N°2525-2019-SETENA del 06 de agosto del 2019 (ver registro electrónico).
  • d)Que en fecha 23 de julio del 2019Don Blass Hernández Araya presentó un incidente de nulidad contra el uso de suelo MA-PU-U-01609-2012 (ver registro electrónico).
  • e)Que la Alcaldía Municipal, mediante resolución de las 14:00 horas del 06 de febrero del 2020 resolvió declarar con lugar dicho incidente y anular por la existencia de un hecho sobrevenido, el certificado de uso de suelo MA-PU-U-01609-2012 - resolución le fue notificada al incidentista el 07 de febrero del 2020- (ver registro electrónico).
  • f)Que en fecha 11 de febrero del 2020, la recurrente solicitó a la Municipalidad recurrida “copia del Incidente de Nulidad Absoluta interpuesto por el señor Blas Hernández Araya contra el certificado de uso de suelo número MA-PU-U-1609-2012” y autorizó al Lic. Emanuel Murillo Salas para que obtuviera copias de la información requerida (ver registro electrónico).
  • g)Que mediante oficio N°MA-A-0607-2020 de fecha 17 de febrero del 2020 la Alcaldía Municipal el informó a la recurrente: “1. Su solicitud mediante oficio GG-073-2020 del 11 de febrero 2020, no cuenta con autenticación de firma. 2. En los documentos anexos, solo aparece copia simple de su cédula de identidad … echándose de menos la certificación de la copia fotostática por notario público. 3. No indica lugar o medio para recibir notificaciones. Por otra parte le recuerdo que el artículo 271 de la Ley General de la Administración Pública es muy claro en indicar quienes tienen acceso al expediente, en el caso de marras, se está a la búsqueda de la Sociedad que usted dice representa para ser notificada. Mucho agradeceré se presente personalmente a esta Municipalidad o formalmente presente los documentos legales que la acreditan como apoderada generalísima de la sociedad Bajo Pita e indique un medio electrónico, fax, o la dirección física donde puede ser notificada en adelante su representada, lo anterior para garantizar tanto el acceso al expediente administrativo y sus piezas, como el derecho a ser notificado” (ver registro electrónico).
  • h)Que en fecha 12 de febrero del 2020, dos personas que no se identifican con documento idóneo que demostrara su legitimación para representar a la sociedad Bajo Pita S.A. solicitaron conversar con Abogados de Servicios Jurídicos de la Municipalidad, siendo atendidos por los abogados Licda. María José Brenes Lizano y el Lic. Rafael Rojas Jiménez, funcionarios que explicaron con detalla, que ellos deben acreditar mediante poder especial su legitimación y que de conformidad con el artículo 271 de la Ley General de la Administración Pública, sólo las partes y sus abogados pueden tener acceso al expediente y sus piezas, máxime que el documento no era público aún, pues estaba en etapa de notificación a Bajo Pita S.A. (ver registro electrónico).
  • i)Que en fecha 19 de febrero del 2020 la recurrente presentó recurso de revocatoria con apelación contra la resolución de las 14:00 horas del 06 de febrero del 2020 (ver registro electrónico).
  • j)Que según acta notarial número sesenta y cinco-ocho suscrita por la Licda. Ana Cecilia Salazar Segura se constató: “ … que al ser las once horas del día de hoy, doce de febrero del año en curso, me apersoné a las oficinas de la Alcaldía de la Municipalidad de Alajuela en compañía del señor Emanuel Murillo Salas, quien es mayor de edad, soltero, abogado, vecino de Cartago, La Unión, cédula de identidad número uno-mil seiscientos veintisiete-cero quinientos cincuenta y dos, quien funge como testigo de la presente diligencia, para solicitar el expediente del Incidente de Nulidad Absoluta interpuesto por el señor Blas Hernández Araya contra el certificado de uso de suelo número MA-PU-U-uno cero nueve-dos mi once que pertenece a la finca con folio real número trescientos ochenta y cuatro mil doscientos cuarenta y tres, con plano A-setecientos siete mil trescientos trece dos mil uno, propiedad de dicha compañía, así requerido el día de ayer mediante trámite número cero cerocero tres cinco uno dos mil veinte ante la Plataforma de Servicios del mencionado municipio.

En la ventanilla del citado Despacho el Licenciado Murillo Salas preguntó por el funcionario llamado Tony, de apellido desconocido; no obstante, a las once horas con diez minutos nos atendió el Licenciado Rafael Ángel Rojas Jiménez, quien se hizo acompañar de la Licenciada María José Brenes, y nos explicó que el expediente estaba a cargo de él y que no podía ser entregado porque la incidentada, Bajo Pita Sociedad Anónima, aún no había podido ser notificada porque “los representantes legales se esconden y que son como un fantasma”; asimismo, indicó que el incidentista, Blas Hernández Araya, ya había sido notificado. El Licenciado Rojas Jiménez indicó que el incidente se presentó desde julio del año pasado y que se resolvió con base en pronunciamientos de la Sala Constitucional e insumos que posee la misma municipalidad, tales como el expediente mediante el cual se otorgó el uso de suelo a las fincas de Bajo Pita Sociedad Anónima, el expediente por el que se tramitó el permiso de construcción, el proceso de lesividad que tramita la Municipalidad de Alajuela en sede contencioso administrativo, expedientes de la Secretaria Técnica Nacional Ambiental y Ministerio de Salud.

El Licenciado también indicó que el incidente fue resuelto por el Departamento Legal de la municipalidad y firmado por la Alcaldesa. Posterior a las explicaciones del Licenciado Rojas Jiménez, le solicité nuevamente el expediente sin incluir la resolución que se encuentra pendiente de notificación, pero se negó a entregarlo alegando al principio de unificación del acto. La suscrita notaria hace constar que la presente diligencia finalizó a las once horas treinta minutos del día de hoy. Es todo”(ver registro electrónico).

III. SOBRE EL CASO CONCRETO

Del informe rendido por la autoridad recurrida, el cual es dado bajo la solemnidad del juramento, con las consecuencias legales que ello implica, se desprende que la recurrente es apoderada especial de Bajo Pita S.A. y propietaria registrada de las fincas del partido de Alajuela inscritas bajo el sistema de Folio Real matrículas 384243-000, 305845000, 365846-000, 365847-000 y 128827-000. Se constató que la Municipalidad de Alajuela en el año 2012 otorgó Certificados de Uso de Suelo, incluyendo el uso de suelo mediante oficio MA-PU-U-01609-2012, que específicamente se trata de la finca matrícula de folio real N°384243-000. Quedó comprobado que el proyecto al que hace mención la recurrente con el nombre de “Parque Industrial Ambiental”, es el proyecto que se conoce en la SETENA con el número de expediente administrativo N°8173-2012-SETENA, el cual es un relleno sanitario mecanizado en Turrúcares de Alajuela.

La viabilidad ambiental a ese proyecto tiene sus efectos suspendidos mediante resolución N°2525-2019-SETENA del 06 de agosto del 2019. Se constató que en fecha 23 de julio del 2019 Don Blass Hernández Araya presentó un incidente de nulidad contra el uso de suelo MA-PU-U-01609-2012. Quedó probado que la Alcaldía Municipal, mediante resolución de las 14:00 horas del 06 de febrero del 2020 resolvió declarar con lugar dicho incidente y anular por la existencia de un hecho sobrevenido, el certificado de uso de suelo MA-PU-U-01609-2012 - resolución le fue notificada al incidentista el 07 de febrero del 2020-. Posteriormente en fecha 11 de febrero del 2020, la recurrente solicitó a la Municipalidad recurrida “copia del Incidente de Nulidad Absoluta interpuesto por el señor Blas Hernández Araya contra el certificado de uso de suelo número MA-PU-U-1609-2012” y autorizó al Lic. Emanuel Murillo Salas para que obtuviera copias de la información requerida.

Se verificó que mediante oficio N°MA-A-0607-2020 de fecha 17 de febrero del 2020 la Alcaldía Municipal le informó a la recurrente: “1. Su solicitud mediante oficio GG-073-2020 del 11 de febrero 2020, no cuenta con autenticación de firma. 2. En los documentos anexos, solo aparece copia simple de su cédula de identidad … echándose de menos la certificación de la copia fotostática por notario público. 3. No indica lugar o medio para recibir notificaciones. Por otra parte le recuerdo que el artículo 271 de la Ley General de la Administración Pública es muy claro en indicar quienes tienen acceso al expediente, en el caso de marras, se está a la búsqueda de la Sociedad que usted dice representa para ser notificada. Mucho agradeceré se presente personalmente a esta Municipalidad o formalmente presente los documentos legales que la acreditan como apoderada generalísima de la sociedad Bajo Pita e indique un medio electrónico, fax, o la dirección física donde puede ser notificada en adelante su representada, lo anterior para garantizar tanto el acceso al expediente administrativo y sus piezas, como el derecho a ser notificado”.

Quedó en evidencia que en fecha 12 de febrero del 2020, dos personas que no se identifican con documento idóneo que demostrara su legitimación para representar a la sociedad Bajo Pita S.A. solicitaron conversar con Abogados de Servicios Jurídicos de la Municipalidad, siendo atendidos por los abogados Licda. María José Brenes Lizano y el Lic. Rafael Rojas Jiménez, funcionarios que explicaron con detalla, que ellos deben acreditar mediante poder especial su legitimación y que de conformidad con el artículo 271 de la Ley General de la Administración Pública, sólo las partes y sus abogados pueden tener acceso al expediente y sus piezas, máxime que el documento no era público aún, pues estaba en etapa de notificación a Bajo Pita S.A. Posteriormente en fecha 19 de febrero del 2020 la recurrente presentó recurso de revocatoria con apelación contra la resolución de las 14:00 horas del 06 de febrero del 2020.

Finalmente se acreditó que según acta notarial número sesenta y cinco-ocho suscrita por la Licda. Ana Cecilia Salazar Segura se constató: “ … que al ser las once horas del día de hoy, doce de febrero del año en curso, me apersoné a las oficinas de la Alcaldía de la Municipalidad de Alajuela en compañía del señor Emanuel Murillo Salas, quien es mayor de edad, soltero, abogado, vecino de Cartago, La Unión, cédula de identidad número uno-mil seiscientos veintisiete-cero quinientos cincuenta y dos, quien funge como testigo de la presente diligencia, para solicitar el expediente del Incidente de Nulidad Absoluta interpuesto por el señor Blas Hernández Araya contra el certificado de uso de suelo número MA-PU-U-uno cero nueve-dos mi once que pertenece a la fina con folio real número trescientos ochenta y cuatro mil doscientos cuarenta y tres, con plano A-setecientos siete mil trescientos trece dos mil uno, propiedad de dicha compañía, así requerido el día de ayer mediante trámite número cero cerocero tres cinco uno dos mil veinte ante la Plataforma de Servicios del mencionado municipio.

En la ventanilla del citado Despacho el Licenciado Murillo Salas preguntó por el funcionario llamado Tony, de apellido desconocido; no obstante, a las once horas con diez minutos nos atendió el Licenciado Rafael Ángel Rojas Jiménez, quien se hizo acompañar de la Licenciada María José Brenes, y nos explicó que el expediente estaba a cargo de él y que no podía ser entregado porque la incidentada, Bajo Pita Sociedad Anónima, aún no había podido ser notificada porque “los representantes legales se esconden y que son como un fantasma”; asimismo, indicó que el incidentista, Blas Hernández Araya, ya había sido notificado. El Licenciado Rojas Jiménez indicó que el incidente se presentó desde julio del año pasado y que se resolvió con base en pronunciamientos de la Sala Constitucional e insumos que posee la misma municipalidad, tales como el expediente mediante el cual se otorgó el uso de suelo a las fincas de Bajo Pita Sociedad Anónima, el expediente por el que se tramitó el permiso de construcción, el proceso de lesividad que tramita la Municipalidad de Alajuela en sede contencioso administrativo, expedientes de la Secretaria Técnica Nacional Ambiental y Ministerio de Salud.

El Licenciado también indicó que el incidente fue resuelto por el Departamento Legal de la municipalidad y firmado por la Alcaldesa. Posterior a las explicaciones del Licenciado Rojas Jiménez, le solicité nuevamente el expediente sin incluir la resolución que se encuentra pendiente de notificación, pero se negó a entregarlo alegando al principio de unificación del acto. La suscrita notaria hace constar que la presente diligencia finalizó a las once horas treinta minutos del día de hoy. Es todo”. En conclusión, es cierto que el 11 de febrero de 2020 la recurrente presentó una solicitud ante el ente local, a fin de que se le permitiera acceder a las piezas del expediente administrativo, solicitud que le fue denegada. No encuentra esta Sala razones para denegar el acceso al expediente a la recurrente. Dicha posición se fundamenta en los siguientes puntos: 1. La recurrente es propietaria registral de una finca a la cual la Municipalidad de Alajuela le otorgó un certificado de uso de suelo (finca inscrita a Folio Real matrícula N°384243-000); 2.

El incidente de nulidad presentado en fecha 23 de julio del 2019 por Don Blass Hernández Araya es contra el certificado de uso de suelo que pertenece a la finca inscrita a Folio Real matrícula N°384243-000); 3. La falta de notificación de una de las partes no es excusa para limitar el acceso del expediente; alegato de la autoridad recurrida en su escrito de respuesta a la recurrente al indicarle: “Mucho agradeceré se presente personalmente a esta Municipalidad o formalmente presente los documentos legales que la acreditan como apoderada generalísima de la Sociedad Bajo Pita, e indique un medio electrónico, fax, o la dirección física donde puede ser notificada en adelante su representada, lo anterior para garantizar tanto el acceso al expediente administrativo y sus piezas, como el derecho a ser notificado”; 4.- Finalmente la autoridad recurrida reconoce que no tenían conocimiento del oficio GG-073-2020 -oficio mediante el cual la recurrente no solamente solicitó copia del Incidente de Nulidad Absoluta sino también que autorizó al Lic. Emanuel Murillo Salas para obtener las copias solicitadas-.Ante ese panorama el recurso deviene procedente con las consecuencias que indican en la parte dispositiva de esta sentencia.

IV. EN CUANTO A LA ANULACIÓN DEL USO DE SUELO

Esta Sala mediante sentencia número 2020-001597 de las nueve horas veinte minutos del veinticuatro de enero de dos mil veinte señaló:

I.Objeto del recurso.- La parte recurrente se muestra disconforme con la Municipalidad de Guatuso, por la revocatoria del estudio de uso de suelos de un inmueble de su propiedad, que está dispuesto para la construcción de una casa, mediante el uso del Bono de Vivienda. II.- Sobre el caso en concreto.- En el sub lite, se advierte que lo planteado por el accionante no es más que un conflicto de legalidad ordinaria, por lo que, se impone advertir que, lo expresado en el Resultando primero de la presente resolución, constituye un diferendo ajeno al ámbito de competencia de esta Jurisdicción. En efecto, este Tribunal no es un contralor de legalidad ni una instancia más de la administración, de modo que no le corresponde determinar la renovación o no del estudio de uso de suelos de una propiedad en específico. Es necesario indicarle a la parte gestionante que, la Sala Constitucional no puede, ni debe suplantar a los despachos públicos en la resolución de los asuntos que, por su naturaleza y por mandato expreso de la Ley, deban ser resueltos por ellos. Por lo que esos reclamos constituyen extremos de legalidad ordinaria que deben ser resueltos por la Administración o, en su caso, por la jurisdicción ordinaria. En razón de lo anterior, el recurso se declara inadmisible”

Precedente que es aplicable al caso en estudio, pues este Tribunal no encuentra razones para variar el criterio vertido en dicha sentencia, ni motivos que lo hagan valorar de manera distinta la situación planteada. Por lo tanto, el recurso deviene improcedente en cuanto a este extremo por tratarse de un extremo de legalidad ordinaria que deberá ser recuelto por la Administración o, en su caso, por la jurisdicción ordinaria.

V. CONCLUSIÓN

Así las cosas, lo procedente es declarar con lugar el recurso únicamente por vulneración del artículo 30 de la Constitución Política. En lo demás se declara sin lugar el recurso.

VI.Voto salvado del Magistrado Rueda Leal. En el sub examine, considero que el recurso debe declararse sin lugar por las siguientes razones. En el voto salvado que consigné en la sentencia n. º 2019-2355 de las 9:30 de 12 de febrero de 2019, sostuve:

“en la Opinión Consultiva 22-16 del 26 de febrero de 2016, la Corte Interamericana de Derechos Humanos indicó que si bien algunos Estados reconocen el derecho de petición a personas jurídicas con condiciones especiales, como lo son los sindicatos, partidos políticos o representantes de pueblos indígenas, comunidades afrodescendientes o grupos específicos, lo cierto es que “El artículo 1.2 de la Convención Americana sólo consagra derechos a favor de personas físicas, por lo que las personas jurídicas no son titulares de los derechos consagrados en dicho tratado”. Por otro lado, en la misma opinión consultiva, la Corte Interamericana dispuso que, en ciertos contextos particulares, las personas físicas pueden llegar a ejercer sus derechos a través de personas jurídicas (verbigracia, a través de un medio de comunicación, como acaeció en el caso Granier y otros contra Venezuela); empero, a efectos de que ello sea tutelable ante el sistema interamericano, “el ejercicio del derecho a través de una persona jurídica debe involucrar una relación esencial y directa entre la persona natural que requiere protección por parte del sistema interamericano y la persona jurídica a través de la cual se produjo la violación, por cuanto no es suficiente con un simple vínculo entre ambas personas para concluir que efectivamente se están protegiendo los derechos de personas físicas y no de las personas jurídicas.

En efecto, se debe probar más allá de la simple participación de la persona natural en las actividades propias de la persona jurídica, de forma que dicha participación se relacione de manera sustancial con los derechos alegados como vulnerados.” (énfasis agregado)(OC. 22/16)”.

Al respecto, de la lectura del escrito de interposición, no se desprende de manera clara la relación esencial entre la persona natural y la persona jurídica, en cuanto a los derechos presuntamente agraviados, lo cual a mi criterio es necesario para conocer por el fondo la eventual transgresión acusada.

De ahí que, a priori considere que no existe alguna situación susceptible de ser analizada en esta jurisdicción.

VII. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Debe prevenir esta Sala a la parte recurrente que de haber aportado algún documentos en papel, así como objetos o pruebas respaldadas por medio de cualquier dispositivo adicional, o por medio de soporte electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho, en un plazo de 30 días hábiles, después de recibida la notificación de esta sentencia, de lo contrario todo ello será destruido de conformidad con lo establecido en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión No. 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión No. 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se declara parcialmente con lugar el recurso. Se ordena a Laura María Chaves Quirós en su calidad de alcaldesa de la Municipalidad de Alajuela o a quien en su lugar ocupe el cargo que, inmediatamente gire las órdenes necesarias en el ámbito de sus competencias para que de forma inmediata proceda a coordinar con la recurrente, la entrega de la copia certificada del expediente relacionado con el incidente de nulidad presentado en fecha 23 de julio del 2019 por Don Blass Hernández Araya en contra del certificado de uso de suelo que pertenece a la finca inscrita a Folio Real matrícula N°384243-000. Lo anterior bajo la consideración que si, a su juicio, lo solicitado contiene datos privados, sensibles o confidenciales de las partes involucradas, deberá suprimir los mismos antes de la remisión de las copias del expediente en disputa. Se condena a la Municipalidad de Alajuela al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo.

Se le advierte al recurrido que, de conformidad con el artículo 71 de la Ley de esta jurisdicción, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Notifíquese a Laura María Chaves Quirós en su calidad de alcaldesa de la Municipalidad de Alajuela o a quien en su lugar ocupe el cargo, EN FORMA PERSONAL. En lo demás se declara sin lugar el recurso. El Magistrado Rueda Leal salva el voto y declara sin lugar el recurso.
